C o mm i ss i o n o n Higher Education (CHED) is working on how to utilize the Php 8.3-billion budget for SUCs in the Philippines to subsidize the tuition of over 1.4 million students around the country. In an interview with TN, CHED-Negros Island Region Director Freddie Bernal said, “CHED is working on the implementing guidelines on how to utilize the budget.” In the recently approved budget by both houses in the Congress, the undergraduate programs for all State Universities and Colleges
(SUCs) in the Philippines will be free. Hence, the said free tuition fee program in SUCs is among the provisions placed under conditional implementation. According to CHED Chairperson Patricia Licuanan, as cited in The Philippine Star, the Php 8 billion budget will accommodate 113 SUCs in the Philippines where they need to ensure the proper implementation and guidelines to be able to manage the huge amount of funds. Aiming for facility upgrade and quality instruction, College of Education (CEd) installed six 50-inch Ultra HD Smart televisions (TV) in the CEd rooms in the month of January 2017. CEd Dean Libertine De Guzman said the purpose of
the smart TV is for instruction, since some of the Liquid Crystal Display (LCD) projectors are not functional anymore. She also cited the l i f e t i m e o f LC D projector is around 3,000 hours only and many classes are using it a lmost every period. The college

then ordered TVs instead of requesting for another projector as it is cable and WiFi ready. Also, she revealed the cost of each smart TV amounted to Php 55,000. As of now, six out of eight Smart TVs are already installed, four
at the second floor and two situated in the accreditation and TLE room. The installation in the Demonstration room and CEd 3 shall follow soon, De Guzman explained. The demo room will be converted into a conference room and the awarded bidder will start the construction this month, while the installation in CEd 3 is withheld due to security matters. On the other hand, College of Arts and Sciences (CAS) acting Dean Michael Baldado said they already installed four LED TVs last year; three at the first floor of CAS building and one in the Physics department. EDITORIAL The end, users! Thirty-eight instructors of Negros Oriental State University (NORSU) main and external campuses who have reached the compulsory retirement age are called to stop their service teaching Norsunians as mandated in the University Memorandum Order No. 14 s. 2016. Students under these teachers are supposed to be designated with another professor to fill the position of the terminated instructor. But due to complicated processes the university needs to undergo before granting its stakeholders the service they deserve, the students’ drive to learn is on the verge of falling into a cliff. With the pressing demand for a solution in this situation, the procurement process for consultancy services should be a priority of the university as outlined by the RA 9184 or General Procurement Reform Act, and have the necessary budget be approved. We believe if the administration aims for educational excellence, the processes should not jeopardize the quality of education they are selling. In our present situation, it seems that it is the student’s problem to look for a teacher that could replace their elderly instructor. This should not be the case. NORSU should provide us the competent teachers we need without interrupting our studies with the sudden changes in the administration, management, or the school in general. If t he y c an not g r ant t he re t i re d i nst r u c tors’ consultancy services as mandated by law, they might as well pay the instructors the expected amount they should receive for those who will render extra service and load. They could even do a hurriedly-done mass hiring while the students come to their teacher-empty classrooms, compromising quality education. Also, the effectivity of this memorandum is untimely. Compared to having this implemented for the next semester, Norsunians can have a better transition and adjustment from the old to the new instructors and no hanging classes or topics. Today, the learners suffer the consequences, leaving their grades and future to the depths of uncertainty. Formulating memorandums for the school to follow, the admin must have also thought of its consequences. Before even terminating the out-going teachers, they should have sought people who would replace them beforehand. Stopping the teachers to teach can only be allowable if this does not affect the students’ welfare. But it is otherwise. And we, Norsunians, do not deserve this.
From justice to retribution As I recall it, President Duterte won on the back of an assurance to end crime in three to six-month time span. As to how he would do it, only he knows. Then a large number of alleged drug personalities and criminals were killed and put behind bars right after May 9. More so, hundreds of thousands from different age brackets have voluntarily surrendered themselves. For this reason, jails have been flooding with criminals and streets have been filled with children exploited by crime groups. Brilliant lawmakers of our land (of course, including our
President) however came up with a smart, inhumane, cruel idea – revive death penalty and lower the age of criminal responsibility to nine years old! Speaker Pantaleon Alvarez and Capiz Representative Fredenil Castro, two of President Rodrigo Duterte’s top ally in the House of Representatives, proposed further lowering the age of criminal responsibility from 15 years old to nine as a deterrent to the use of youth in the commission of crimes. But, will it? Yes, the youth should be taught to accept responsibility for their actions and words, but is it through rehabilitation and

Most of you probably heard about our elder mentors who were told not to report to classes starting January. That was the doing of University Memorandum Order 14, series of 2016 released amidst Christmas vacation. Because of that, no classes under the affected teachers occured on the
first week of 2017. I experienced it because I am under one. To give light to those who did not know and wish to know, the order was to strictly implement laws and guidelines from the government. government interventions? The answer is a big NO. They should learn it through their families. The family is the most important social unit of society but it is not just the basic societal unit. Family is also the basic sexual unit, the basic child raising unit, the basic all around fun and friendship unit. These children deserve and need support and guidance from their family. At home is where the child should learn, grow, discern from right and wrong. So I believe that the government must focus on nurturing it. It is clearly against the best interest of the child. For a civilization to succeed, the family must succeed, and right now, I’m seeing that it’s not. If we have stronger families we will have stronger schools, stronger churches, and stronger communities with less poverty and less crime. By same token, terror, anguish and frustration prevail among all Filipinos amidst rise in crime and drug – related offenses. So may I ask you now, is taking away someone else’s life enough to eradicate all the heinous crimes and free our society from states one of the prohibitions of hiring personnel is “those who reached the compulsory retirement age except as to consultancy services.” There are 21 teachers in Main and Bajumpandan Campuses above the age of 65 and are still teaching. They’re even part-time instructors, not consultants as what the law mandated. So why were they still hired? I won’t care to know what negligence of duty took place but two things persist as bad fruits of the event. I am concerned for students of these instructors because the Human Resource Officer had said student grades from them won’t be credited because they are not constitutionally bound to NORSU (unless NORSU has accepted it which I could not know). And since they are not legal to teach as of the moment (until they may be procured as consultants), the students will personally be their responsibility, not the school, during classes. On the other hand, these
“lawlessness”? Again, NO. I, myself cannot accept that someone can just claim the life of a criminal rather than rehabilitate him/her. I am one of the many people around the world who fights to purge the earth with this vicious act. Victims and/or their families of the crimes will accept nothing less than death for the criminal. But I am firmly against its reinstatement. Though death penalty in a dominantly Christian Country will always be very a debatable concern and many will support it, I strongly believe that its imposition is not the answer to the high crime rate of our country and does not prevent the commission of dreadful crimes. Demanding retribution against criminals may have prevalent support in the public, but a reliable judicial system should be grounded in purely justice, and not vengeance. Death penalty is not an “valuable” response. It is the duty of political leaders to adopt solutions to the country’s challenges in ways that will support the rule of law and advance the protection of human FROM JUSTICE/to page 4
elder teachers should be following protocols. They should have stayed at home. Look at them, teaching at the age when they should be enjoying even more. Have I told that they have resumed teaching? Well, they won’t receive any salar y from January until they would really stop or finally rehired. As what concluded in a meeting between the affected mentors and the administration, most of our elders agreed to teach for free. The university administration is said to be working on the matter to restore what can be restored, planning the procurement and even writing to the government. But as everyone may know, old teachers should not be teaching, especially for work not compensated. And students should be relocated to other classes. I hope whatever the administration is doing, they better do it fast.

This 21-year old lad, who is a fifth year Bachelor of Science in Civil Engineering student, is the current chief of staff of SGDC II. He never thought of nothing else but to lead his constituents with confidence and integrity. He is about 5’6” tall and has a fine complexion with an approachable charisma. This handsome guy easily develops friends not only because of his looks but also the way he converse seizes people’s attention. When it comes to love, he is the hopeless romantic type. He loves to travel and conduct humanitarian missions and spends his vacant
time painting, sketching, and writing stories and articles. He comes from Tanjay City and currently lives at Ablir Street, Sibulan. He is an active student who is prone to different organizations and led various activities that made the campus a hype. Even though the CEA student government has no budget, he was able to come up with Tambayayong, an annual activity of NORSUBajumpandan Campus, uniting student leaders including leaders from Pamplona Campus. With the use of personal money and solicitation from friends, they were able to pursue it. Through activities such as the Science Fest with quiz bowls and Physics Olympics, he wants students to build rapport to have one goal and vision. “It was never easy to be a student leader,” he said. “Naay time nga muabot sa punto nga maghilak nalang ko sa office.”

“The consistency of your attitude determines your genuine personality, but if that changes, it would be your remarkable style of being fake.” Who would have thought that the best professor could turn out into a monster? I wish he didn’t exist. Yes, I looked at him as my great educator before. He was once my inspiration to be someone like him in the near future. But everything turned out into black and just as the curtain of darkness wrapped me the way I perceived him. I was not the only one affected. We were all affected. I don’t even have to go into details just to mention how disappointed we were. How does it feels when your project is being dumped even though you exerted much effort on it? The sweat… The sleepless nights… My wasted tears; they fall like rain, and my heart is in pain. I’m not ashamed to share that I had cried while workng to beat its deadline. All weren’t worth his appreciation. With all the broken promises, I should not have expected much from him. We ended up learning less than what we deserve in his class. And there is one thing that I have discovered from him: once he know your weaknesses, he will treat you like dirt. It is no longer my mistake or my classmates’ mistake why we are not born handsome and beautiful. It’s not even my fault why I was born not equipped with such versatile talent that you favor to deal with. I am just human. I am not like him who want to change everything and be proclaimed as hero in this institution. I am not like him trying to be perfect. I am not like him trying to be friendly. I should have known him before dawn and remind myself not to trust him. I want him to realize how much pain he has caused to us — students. Even until now, I can’t look at his eyes during his class. T h e un i v e r s i t y president signed University Memorandum Order no. 14, s. 2016 advising part-time instructors who are 65 years old and above to temporarily stop from duty starting January 2017. Paragraph no. 2 of the said memorandum released on December 27 of 2016 states “they [part-time instructors in their retirement age] are advised not to report to duty starting January 2017 until the procurement process of being consultants in accordance with Republic Act 9184 is finished.” These affected part-time instructors are teachers from the government public education institutions who have retired but rehired to teach. Their Hiring R e p u b l i c Ac t 9 1 8 4 , ot her wis e known as t he Government Procurement
Reform Act, and Section 4, D of the Amended Policy and Guidelines for Contract of Services of the Civil Service Commission Memorandum Circular no. 12, s. of 2004 states the prohibition of hiring people specifically to “those who reached the compulsory retirement age except as to consultancy services.” The consultancy service, which will bring back the affected teachers will still need these teachers to go under procurement process which takes a long period of time. B i d s a n d Aw a r d s C om m itte e ( BAC ) He a d Virginia Lacuesta said BAC only processes the procurements and in the case of the consultants, first action for procurement of consultancy service needs to be from the end users. Furthermore, she disclosed the procurement process regarding the consultancy services is difficult since no
consultancy firm exists in Dumaguete City to easily recommend any person as the firm will have to participate through Philippine Government Electronic Procurement System (PhilGEPS). Also, Approved Budget of Contract (ABC) for the consultancy service was not approved in the 2016 Annual Procurement Plan. But Lacuesta said projects not procured in the 2016 APP will be tackled with the 2017 APP in a Board of Regents Meeting on January 19. Also she added the ABC for consultancy service for 2017 has been inserted in the 2017 APP for approval. On the other side, she disclosed another way for the affected faculty to be rehired individually but complications would arise regarding their requirements. It is stated in Annex H Appendix A of the 2016 Revised Implementing Rules and Regulations of RA 9184 as what Lacuesta discussed. The VPAA In an inter view with Villahermosa on Januar y 19, end-users have already been notified of the strict implementation of the amended policy and guidelines and were advised since June 2016 to start the procurement process. Howe ve r, t he ord e r w as neglected. End-users in the situation refers to the people who are responsible and have authority over the staff hired through procurement such as Job Order. Dr. Rose Marie Pinili, Vice President for Academic Affairs
(VPAA), being one of the end users and most knowledgeable of the matter, refused to disclose anything saying the administration is already finding solutions to restore the consultants’ position. A lt hou g h not g iv i ng clarif ications, the VPAA revealed the university heads are taking the matter to higher authority by seeking advice from the national Civil Service Commission and even Malacañang Palace. For students’ sake On January 9, a special meeting took place between t he af fe c te d te a che rs i n Dumaguete Campuses and the administrative heads were involved. 21 elderly instructors from the NORSU Dumaguete Campuses are affected with the office order while there are five from Bais Campus, eight from Bayawan, two from Guihulngan, one from Pamplona, and one from Mabinay as what Human Resource Officer Jim Villahermosa counted. Majority of the suspended instructors in Dumaguete C ampuses agreed among themselves to continue teaching until the semester ends even without pay. “Nobody will handle their classes,” College of Business Administration Dean Elsie Ramacho said, if the consultants would follow the memorandum order. Ramacho reported to have at least three affected mentors in CBA. Mrs. Marilyn Bulaclac, affected instructor from Social Science Department, said majority of affected faculty pity the classes they would have to leave. That was why she agreed to teach for free. As agreed, instructors who do not want to volunteer for free teaching are expected to report only until the Midterm Examinations are done. Contrary to the matter, Villahermosa cited there will be no credit of grades to the students under the affected instructors since they are no longer legal teachers. “Students have to be transferred to other instructors,” Villahermosa said.

However, the burden of this tuition-free policy will likely result to massive exodus of students from private Higher Education Institutions (HEIs) to SUCs, CHED Executive Director Julio Vitriolo said in a statement from Palawan News. Thus, enrolment in SUCs are therefore only expected to rise without the necessary additions and improvements in infrastructure, faculty and research.
After the announcement of the approved budget, President Rodrigo Duterte ordered that poor but academically qualified students would be given the priority. Hence, in a message sent to Congress, the President vetoed certain provisions of the Php 3.35 trillion 2017 national budget and subjected several others to “conditional implementation”.
