Family can park in front yard to accommodate son with special needs RAHUL GUPTA rgupta@insidetoronto.com A Bedford Park couple can breathe easy after receiving an exemption from the city to park in their front yard to accommodate their young son with special needs. Kas and Kurt Lingenfelter originally had their appeal for the space in the front yard of their home at 45 Cranbrooke Ave. turned down by North York Community Council (NYCC) back in 2015. The couple launched an appeal on the grounds denying them use of the parking space to accommodate disability is a violation of provincial human rights legislation. At its January meeting held Tuesday, NYCC voted to allow an exemption, supported by city staff and local city councillor Christin

Carmichael Greb, to allow the space. "We’re very relieved we don’t have to take further legal action," said Kas Lingenfelter alongside her husband Kurt following the vote held in North York Civic Centre’s council chambers. "This isn’t just about a private parking spot," Kurt said. "It’s about inclusion in your own neighbourhood and being able to access your own home." The Lingenfelters initially made a permit application in late 2013 to be able to park in the front yard of their detached home, which was turned down by the city because parking was available at the back of the property. The couple decided to appeal the decision and also reconstruct their home, they said to better accommodate the needs of their son, which included removing the rear space and installing a new paved spot at the front. After NYCC rejected the appeal, the couple decided challenge the decisions on the grounds Toronto’s resi-

Kurt Lingenfelter stands on the parking pad in front his Cranbrooke Avenue home on Tuesday, Jan. 17. His family recently received approval for the space from North York Community Council. dential parking standards violate provincial laws since there’s no allowance for disability. "The process is flawed," Kas said. "There’s nowhere you can indicate (in the city permit application) this is for an accommodation of a disability." Because the matter is also before the Ontario Human Rights Tribunal, part

were aware of the regulations banning front-yard parking. According to Dell, the Lingenfelters received several exemptions from the city already for the re-building of their home. He worried if the parking appeal was granted more residents would come forward with legal please of their own to park in their own front

of the debate was held in closed chambers. During the public portion, the council did hear from several deputants for and against the application. Michael Dell, who lives across the street told councillors he’s had to park on the street for 30 years, and when the Lingenfelters moved to the area approximately 10 years ago they

yards. "It’s always nice to do something for a neighbour," Dell said. "But the parking will suffer." Megan Segsworth, a neighbour and close friend of the Lingenfelters pointed out front yard parking is prevalent in the neighbourhood, even though it is supposed to be illegal. She said the couple are dedicated parents whose "entire lives are structured around the care of their child". Despite much of the debate taking place in closed chambers to ensure the family’s privacy, Kas said it was important to have the matter at least partially discussed in public to provide encouragement to other families struggling to deal with a loved one’s disability. "We want other people who haven’t faced the city, because they’re afraid, to know you can fix it," she said. "Everyone who has a child with a disability feels beaten already and they don’t have the strength (to go up against the city). Thankfully, we have friends who said ’do this, it’s the right thing’".

ABOUT US

Time to fix Toronto’s too-low property tax problem Toronto’s budget committee has heard from 230 members of the public concerned about the city’s operating and capital budget for 2017. And if the committee were seriously listening to those deputations, the course forward on the year’s budget would be obvious. First, preserve services that impact Torontonians: services that include but are not limited to subsidized daycare, shelter services, library hours, public housing, transit, and to at least one Toronto Olympian, swimming pools. And following from that, finance it all adequately; which is to say, Toronto Council should raise property taxes appropriately for the many tasks at hand. There were some, such as representatives of the real estate sector, who worried about changes to collect more revenue from the municipal land transfer tax and urged status quo. But there were only a handful if that, who suggested that Toronto’s property tax rates were too high and needed to be reigned in. That, of course, is because property taxes in Toronto aren’t too high. Indeed, single family homeowners pay lower property rates than anywhere in the Greater Toronto Area, and have since Toronto was amalgamated nearly 20 years ago. Those single family homeowners are also bearing the burden of infrastructure and service demands that other, smaller municipalities don’t have to contemplate: an aging public transit system and a vast inventory of public housing. It confounds reason to think that the city has managed to give its residents such a deal on their taxes for so long. And yet this year, Mayor John Tory and budget chief Gary Crawford are sticking to a pledge to raise property taxes only by two per cent. This won’t close a budget gap of $91 million in total, so it is likely in the coming month that Toronto’s budget committee and City Council will have to disappoint some or maybe all of the people who came forward asking that services and subsidies be maintained - and cut. As well, council will have to dig into reserves and defer important investments, to the tune of $100 million. Politically, it is easy to understand why Mayor Tory doesn’t want to waver on property tax rates. He did promise inflationary tax increases, and might lose support in some quarters if he goes back on that promise. But what is politically expedient is not financially, or societally sustainable. Council needs to move beyond expedience, and raise taxes to an appropriate level.

Lawyer’s lonely mission takes him to the streets Mukhtiar (Mark) Dahiya brings free legal help to homeless people in Toronto. Tall and fierce, Dahiya, a lawyer from Northern India, has made pro bono street law in his adopted city his mission, and works at it despite being unable to do so officially, as a lawyer of record. It has cost him. The Beach resident has seen people decline into drugs and mental illness, and knows many who died. He’s attracted unwanted attention from police. He contracted tuberculosis. Dahiya’s now 65, but won’t give up his dream: to open the City Law Centre, an office where people without homes or money can get a will, or deal with

MIKE ADLER Edges of Toronto tickets police hand them for throwing cigarettes in the street. It’s unacceptable, "unCanadian," for the homeless to lack legal representation, says Dahiya, who believes just talking to a lawyer lessons their isolation, improves chances for survival. "They don’t need a Bay Street lawyer. They need a guy like me," he says.

"I kept many people from suicide." But since he became a lawyer here in 2006, Dahiya says the Law Society of Upper Canada has held him back from doing what other lawyers won’t. As a street lawyer, he couldn’t afford licence and insurance fees for a practice, so he’s appeared in summary trials for the homeless as an agent, rather than lawyer. Short of funds, he was told last October he’s now exempt from the lawyer’s annual fee but, as he’s considered retired, he can’t provide legal services. If he returns to practice law, he’d have to pay insurance. Last week, the city announced it will finally begin recording and assess-

ing all the deaths of its homeless, hoping this can lead to their better health. But who will see to their legal rights? Dahiya argues the homeless don’t stand in lines for legal aid. He refuses, after all he’s tried, to join any charity or church who can fund his dream. "That is beneath my dignity," he says, waving his hand. A storefront clinic may not be something Dahiya, for all his passion, can achieve. But that doesn’t mean he’s wrong. The City Law Centre must exist. FANNIE SUNSHINE fsunshine@insidetoronto.com Residents who came out to a Ward 10 town hall meeting Tuesday, Jan. 17 were treated to a "sneak preview" of the latest revised plans of a controversial development on the site of the former Bathurst Manor Plaza. Calling it a "10-year saga", York Centre Coun. James Pasternak told some 90 residents who attended the meeting at Antibes Community Centre near Bathurst Street and Drewry Avenue the latest development plan still has to be reviewed by city staff once an official application is received. "We need to balance respect for the neighbourhood and responsible development," he said, calling it a sneak preview for constituents and not a commu-

nity consultation meeting on the matter. The plaza on Wilmington Avenue at Overbrook Place has undergone several revisions over the years since The Biddington Group of Companies proposed a residential development in 2006. The newest revisal calls for 164 three-storey back-to-back townhouses ranging from 1,700 to 2,000 square feet, underground parking, and private roads. The block at the Wilmington Avenue and Overbrook Place corner will be zoned commercial-residential to allow for potential retail opportunities, such as a coffee shop, with 30,000 to 40,000 square feet of space up for grabs, said Biddington lawyer Adam Brown, adding plans include space for retail parking. But although Bid-

Justin Greaves/Metroland

York Centre Councillor James Pasternak (Ward 10) and Mayor John Tory answer questions at a Town Hall meeting on Tuesday at the Antibes Community Centre. Ward issues were discussed, including development plans for the former Bathurst Manor Plaza. dington has provided opportunity for retail, there has been no in-

terest as of yet, he said, adding he’s hoping for a 2018 groundbreaking.

Brown did not say when the application will be officially filed.

The meeting also heard from constituents concerned about closed commuter parking lots, particularly one at 75 Billy Bishop Way near Wilson station which shut down in December to make way for a shopping centre. Pasternak said he plans to bring forward a motion at Thursday’s executive committee meeting to establish a commuter parking advisory group to come up with interim solutions. Yorkdale is expected to open 1,100 commuter parking spots next month, and the Toronto-York Spadina Subway Extension is expected to offer some 2,800 spaces at three of its new stops once it opens. Mayor John Tory, who attended the town hall meeting, said he will support Pasternak’s motion.

kids’ Registration

CONSUMER FEATURE

Fun winter learning activities for kids Little ones can often get restless when they’re inside during the cold winter months, so find inspiration and ideas with these creative activities that are fun and educational. 1. Nature and animals. Parks, petting zoos, farms and nature discovery walks are all great activities this time of year. Many zoo animals (like polar bears, Arctic wolves and snow owls) thrive in their natural winter habitats and are much more fun to observe now. Encourage kids to ask questions, and look up the answers you don’t know together when you get home. 2. The perfect indoor playdate. Schedule some fun with friends that supports learning through play, like by finding an easy DIY creative project for kids online. Registered early childhood educators, who are trained in child development and plan play-based early learning programs, recommend providing opportunities

for exploration and discovery using everyday objects. Let the kids be in charge. Ask yourself: Is there a variety of materials for them to explore, like with different textures, sizes and shapes? Can they make choices about what the project will look like or what it can do? Is there an opportunity to ask questions and work together? Pick a fun project that requires creativity, not just following instructions. Remember: there is no right way to play. The most fun and learning happens in the “doing” rather

than a perfect product. 3. Local fairs and festivals. Free community events happen year-round, not just during the warmer months. So explore the variety of festivals on offer, which almost always have designated activities especially designed for kids. Craft fairs, multicultural events and food festivals also inspire creativity, learning and inquisitiveness. Find more information about registered early childhood educators at www.college-ece.ca.

Trump’s battle with the press Ford-like Here on the eve of the inauguration of presidentelect Donald J. Trump in Washington D.C., it’s hard not to think about the inaugural meeting of Toronto Council in 2010, and the years that followed it. There are all sorts of parallels between Rob Ford, amalgamated Toronto’s third mayor, and America’s soon-to-be 45th president. But the one that strikes me most this week is the one that impacted me most in 2010: their declared war on portions of the news-media. Both Trump and Ford took full advantage of an early advantage. In Trump’s case, it was the report of unverified intelligence information on the website Buzz Feed, and a more restrained report on same by CNN. In Ford’s case, it was a series of reports during the election by the Toronto Star, calling into question his methods coaching high school football.

DAVID NICKLE The City Trump, in high dudgeon, refused in his first, rare news conference to take questions from a reporter from CNN and flung invective at both organizations. His Transition Team has mused about tossing the Washington press corps out of the West Wing of the White House. Ford, you may recall, ordered the Toronto Star banished from the mayor’s office’s email notification list, falsely denigrated one of the Star’s reporters as a pedophile, and later in his administration, hid from growing scandal behind the doors of

the mayor’s office and the bluster of his brother Doug. Through much of this time, the Toronto media was fighting a rearguard action in the war over public opinion with the Fords. I was President of the City Hall Press Gallery at the time, so was something of a public face for my colleagues. It had amazed me at the time, how easy it was to denigrate journalists trying to bring light and accountability to a highly-questionable mayoralty. What also has amazed me, though, was how possible it was for good journalists to turn that denigration around with tough, diligent reporting. That’s something for American journalists to bear in mind, over their long game just beginning. David Nickle covers city hall for Metroland Media Toronto. Contact him at dnickle@insidetoronto.com

TRANSIT

9

For this week’s column, I thought I’d attempt to answer a question many of you seem to have, judging from the amount of correspondence received on the topic, about Metrolinx. Specifically, what the heck does Metrolinx do? While Metrolinx stories take up plenty of characters on InsideToronto.com and the media properties of just about every major outlet, it’s become increasingly evident there are large swathes of individuals without the foggiest clue about the provincial agency’s purpose. How is it that a Crown agency in existence for over 10 years and tasked with implementing the largest transit expansion in the province’s history operates largely anonymously? You might not realize, but Metrolinx also operates GO Transit, the Union Pearson Express, and the Presto fare system. Metrolinx also funds bike shares, and promotes walkability and carpooling.

RAHUL GUPTA TO in Transit It is responsible for the construction of Toronto’s first light rail lines the Eglinton Crosstown, Finch West and, maybe one day, the Sheppard East LRT. It advises the provincial government on matters of transportation, although it’s not clear just how valued that advice is. Despite all those responsibilities, and an annual operating budget of several hundreds of millions of dollars, Metrolinx still manages to fly under the radar, at least as far as the public is concerned. Take the TTC’s ongoing Presto implementation work as an example: when a

Are my hearing issues just ear wax?

fare gate or vending machine malfunctions, it’s invariably the TTC catching flak from irate customers. But beyond providing initial front line assistance, the TTC has little to do with operating the program. Metrolinx also serves a unique purpose for the province that it can provide cover for unpopular political decisions: Don’t like the astronomical UP Express fares? Blame Metrolinx, even though it’s the Ontario government which signed off on gearing the four-stop transit line, at least initially, to the needs of business professionals and not the general public. Don’t like that GO electrification is taking so long to implement? Blame Metrolinx, even though the province has the final say on funding. It all makes for an intriguing situation where a vastly important government agency can operate largely in the shadows, and one that’s unlikely to change anytime soon.

10 TECHNOLOGY

Seniors closing the gap on digital divide HILARY CATON hcaton@insidetoronto.com At 101 years old, Bessie Stallworthy has a cell phone, can send emails, use Facebook, blog and search the web from her laptop or iPad. "I have to admit, it’s pretty awesome and I started tinkering with the computer with no purpose at all. I just wanted to learn something different," said the centenarian who has lived in the Upper Beach neighbourhood for 65 years. She first dabbled in technology at the age of 79 as a New Year’s resolution. One of her friends gave her an old laptop and printer and she began her foray into technology. She’s never taken a computer course, but instead has either learned on her own or had a little help from her friends. She uses her computer to send emails and her iPad to go on Facebook and look at pictures from her recliner. She still continues to explore the world through the Internet, when many seniors, 20 years her junior, feel overwhelmed by the concept of technology. "I have an interesting life thanks to computers and technology because I have so much at my fingertips now," she said. Stallworthy is one of the many seniors across Canada who are choosing to not be left behind on the "shoulder" of the information highway. According to Statistics Canada, seniors have the fastest growing rate of Internet usage in the country. The number of Canadians 75 and older who choose to go online spiked from five per cent to 27 per cent from 2000 to 2012. It’s a trend the Canadian Association of Retired Persons (CARP), a non-profit organization that advocates for financial security and improved health care for Canadians over 50, is noticing more and more, said chair of the Toronto chapter Adina Lebo. "Seniors are using technology rather socially for

Justin Greaves/Metroland

Bessie Stallworthy, a 101-year-old Toronto woman who isn’t afraid to embrace technology, checks her blogs inside her home in the Upper Beach. Stallworthy got her first computer at 79 and hasn’t stopped surfing the web since. Skyping with grandchildren and keeping in touch with family. It keeps them connected, it keeps them actively engaged rather than looking at four walls," said Lebo. CARP encourages their membership to keep up with technology as a part of active living after retirement, which is where seniors begin their decline and disinterest in technology; when they leave the workforce. "We are in an increasingly digital world and if you’re not digitally connected you’re not part of the world. You’re left behind," Lebo added. But it’s all about the right motivation for the majority of seniors to adopt the technology in the first place, ac-

cording to University of Toronto professor and co-director of the Aging Gracefully Lab Dr. Cosmin Munteanu. Society is pushing more towards intergenerational technology use with generations coming together in digital spaces like Facebook and Skype. "It gives them the option to be more a part of the family life as family life becomes more digital, it forces them to adopt technology," said Munteanu, who also works on creating apps to bridge the digital divide between seniors and youth. Youth make up a large portion of tech users today having grown up with technology right at their fingertips from infancy. From using touch screen technology

on phones and tablets to using SnapChat, kids are consuming technology faster and earlier than previous generations and have access to the Internet like never before. According to MediaSmarts, a non-profit organization focusing on digital and media literacy, 99 per cent of the 5,436 Canadian students they surveyed in 2012 from grades 4 to 11 have access to the Internet outside of school. "It’s always shocked me at how fast this generation has picked up technology. It’s just second nature to them," said Penny Staznik, a mother of two boys, who already has one of them asking to create a YouTube channel with friends.

"I think it’s the mentality that they’re not afraid of it. It’s always been there so they just go for it." Staznik’s oldest son, Goran, is nine years old and loves computer programming. He’s working on creating his own video game with the help of MakerKids, an after school program in Bloor West Village. It focuses on teaching kids ages eight to 12 about robotics, coding and Minecraft. The company’s lead instructor Graham Steele sees firsthand the amount of technological knowledge kids already have when they walk through the doors of the program. "They know about the concepts we teach, but they’re missing the applica-

tion portion, like what can you actually do with that knowledge. Now if they have ideas, they know the first step in where to go to pursue that idea," Steele said. Kids are building video games, hot water heater switches and more. That thirst for technology is a gateway to creating a more technologically literate society that will hopefully also include more tech-savvy seniors. "There’s no dearth of opportunity for you as a new person to tech, young or old," Lebo said. "The connectedness we have is less of a burden and becomes more like a need for many of us no matter what your age."

New president and CEO for Baycrest Foundation

Did You KNOW

O Tulip tune-up The Dutch created a unique tulip for Canada’s milestone anniversary. Called Canada 150, the tulip is white with red flames and looks like our Canadian flag.

O That’s a lot of bulbs! The commemorative tulips were available to the public exclusively through Home Hardware. Four million bulbs were sold and will bloom April to June. If all the bulbs sold were lined up in a row, they could stretch from Brampton to Sudbury.

O Friendship blooms After the Second World War, Princess Juliana of the Netherlands presented Ottawa with 100,000 tulip bulbs as a token of friendship for Canada’s help in the Second World War. photo National Capital Commission

Tune in to a TV quiz show these days and there’s always at least one question about decades. On Family Feud it might be to list New York Yankees of the ’50s. On Jeopardy something to do with ’70s sitcoms. And so on. Ah yes, And So On. My fave. Last week all five episodes were dedicated to musical groups of the ’60s. Anyhow, I was watching a quiz show marathon the other night, passed out on the couch with the set on and dreamed I was a contestant on Who Wants To Be A Millionaire. I’d made it to the million-dollar question and had all three lifelines left: the 50:50, Ask The Audience and Plus One (a friend allowed to come on stage and help.) And get this. My friend was none other than Data from Star

14th Annual

JAMIE WAYNE But Seriously Trek: an expert on everything. I couldn’t wait. Host Chris Harrison declared, "Fasten your seatbelts. Jamie’s about to go for the $1 million." Then paused, "Right after this commercial. Gotcha. . But before the break, I’ll leave you with his question. What is the name of the current decade?" It sapped all the energy out of me. I had no idea. I turned to the audience. Their minds were even blanker than mine. Even Data was clueless. Already white, his face

turned whiter. And he refused to make eye contact. Suddenly my alarm went off and I woke up. Whew. Saved by the bell. I breathed a sigh of relief. Not because I wouldn’t have won the million bucks. With the attention, I would’ve probably gotten my own reality show. It was having to sit through that commercial before answering. A trailer for Pilates Of The Caribbean 2: The Search For A Cruise Ship With A Demographic Than Can Actually Do Pilates This Time. No way I would’ve ever made it through that. Jamie Wayne is a lifelong columnist who takes writing very seriously. The topics? Not so much. His column appears every Thursday. Contact him at jamie.wayne@sympatico.ca

I consider my residents like family; taking care of them makes me proud.
