I

cannot believe there is only 26 days till Christmas! Where has 2013 gone?

We have achieved a lot this year for the South African community with the partnership of the new website, SA going to NZ, and have a large membership running in conjunction with at least five facebook groups. We have to thank Sherelee for administering these sites and keeping a balance when bloggers get too negative or too despondent. Prime Minister John Key said it best when he reiterated that people should stop talking about the negatives and concentrate on the positives in New Zealand. The SA Socials on the Shore are holding their own with so many new migrants ‘fresh off the boat.’ Keep on joining us once a month to enjoy the camaraderie and the familiarity of being a Saffa. From our New Arrivals evenings, which are becoming very popular, we have seen that there are still way too many South Africans being held up at Customs due to the bad advice they have been given from their offshore agents. North Shore Immigration Service gives free advice to anyone coming to New Zealand. Please make use of this service before it’s too late! LEGAL UPDATE: EMPLOYMENT LAW

Yule is merry, but not too merry!

O

nce again, our in-house employment law specialist Eska Hartdegen imparts some words of wisdom over the events that often take place at the inevitable yearend office get together. The Yule tide is upon us, and December holds the promise of warmer weather and Christmas functions – a well deserved celebration and thank you to all for their hard work during the previous year. But to keep costs down, partners are no longer necessarily included, which poses its own problems and increases risk. In 2008, an 18 year old female apprentice was awarded $20,000 arising from a sexual incident which happened at a 2006 work Christmas party. So employers, meet the jolly season armed and ready! Occupational health and safety, human rights, and drink driving laws apply to the office party, so before hosting a company event, be aware of companies’ legal obligations and liabilities. Under the Health and Safety in Employment Act 1992, employers have the duty to take “all practicable steps” to ensure the safety of staff at work by identifying any possible risks or hazards. This includes possible hazards at Christmas functions held off-site, and means taking steps to avoid instances of discrimination, harassment or bullying. Here are some practical safety measures to avoid post-party malaise by putting in place measures to keep the level of jollity under control. Before the Christmas event, send out a Memo reminding staff of expected behaviour and conduct by referring to the company policies and giving a friendly reminder that there should be no blogging or photos posted on social networking sites. Also work is as per normal the day after the party! Set a start and finish time for the function, provide high protein and good absorbent foods and plenty of alcohol free drinks, limit the quantity of free alcohol per person, no alcohol allowed for under 18s or for anyone who is visibly intoxicated, assign managers to keep an eye on behaviour generally and on alcohol intake, have designated sober drivers and put in place transport such as mini vans for staff and provide taxi chits, assign a go-to contact person if any anything goes amiss. In Auckland, celebrating Christmas on the sea is particularly favoured .This brings its own hazards and risks and the possibility of a man overboard due to a combination of excessive sparkling wine and stormy seas or the possibility of sexual harassment incidents occurring, as happened in Ellis v Proceedings Commissioner, a decision of the High Court. The complainant resigned because of series of sexual harassment incidents by her employer. One such occurrence happened at a Christmas function, on a customer’s boat. One of the issues the High Court considered was the status of incidents which took place outside the workplace. The Court held that “There can be no suggestion that actions of sexual harassment to an employee must occur in the workplace for an employer or its agent to offend against the Human Rights Act 1993”. The Court endorsed the “but for” test which asks: “Would sexual harassment have occurred ‘but for’ the plaintiff’s employment?” It was held that it would not have, and that the only contact between the employer and employee was workThe South African

related, and the fact that the incident took place away from work premises did not remove the nexus between the employment and the sexual harassment. According to the Human Rights Commission there is a surge in sexual harassment complaints resulting from office Christmas parties, and the Commission singles out this occasion as one of the most likely times for sexual harassment to occur. To minimise risk, a good alternative event to consider is a Christmas party which includes partners and children and grandchildren and is held on solid ground. A few words of wisdom from career Counsellor Paula Stenberg on how best to behave at the company Christmas bash, is “It’s about credibility. At the end of the day you can lose respect. e’ve seen the country through some tough times. When we came into office, the country was in recession, the worst global financial crisis for generations had just struck, and we were facing years of government deficits and ever-increasing debt.

The day after we were elected, we got to work to turn this around, and we haven’t stopped since. I’m proud of our achievements.

The economy was in recession. Government spending under Labour had risen by 50% in five years. Families were battling high inflation and mortgage rates of over 10%.

Together with the rest of New Zealand, the Government has persevered even in the face of some big challenges along the way.

One in five teenagers were leaving school unable to read and write properly. Forecasts for unemployment were growing.

Under National, the country is in good shape. Our economy is among the fastest-growing in the developed world. Our hospitals are performing more operations every year. Our schools are lifting achievement for young people. And recorded crime is at its lowest rate for 33 years.

New Zealanders wanted change. They wanted greater security, and better prospects. They wanted policies that they knew made economic sense.

We want to take New Zealanders with us as we build on our momentum towards the brighter future you and your family deserve. Five years ago, a combination of the Global Financial Crisis and poor government decision-making meant New Zealand was teetering.

That was when voters turned to National.

The day after we were elected, we got to work. And we haven’t stopped working since. A Global Financial Crisis and devastating earthquakes would have knocked back the most robust of economies, and the most resilient of people. But the Government and New Zealanders have persevered. We have worked together and it’s that combination of effort and direction which has got us to the much stronger position we enjoy today. New jobs are being created. The economy is growing, and forecast to be among the top handful of countries for growth in the developed world.

Health Insurance? Or Waiting List?

T

here has been a significant change to the eligibility to New Zealand’s publicly funded healthcare for those who hold a WORK VISA. Previously, if your visa was valid for 2 years from the date of issue, you were eligible. However going forward, to be eligible for public healthcare, your visa must be valid for 2 years or more from the date you enter New Zealand. Alternatively, if you hold a valid work visa and your consecutive visas (including visitor and student visas) total 2 years or more without a break, you will also be eligible to public healthcare. If you do not meet these requirements, you can still receive emergency treatment however, it’s likely you’ll be sent the bill. If you are a visitor to NZ and do not have Travel Insurance, you may be able to apply for a non-residents insurance policy. Accident-related treatment generally is covered by the Accident Compensation Corporation (ACC), but visitors to New Zealand are recommended to have comprehensive travel insurance to meet the costs of expenses that ACC does not cover (including repatriation). It is an unfortunate fact that most of us do not get through life unscathed. Health insurance provides peace of mind that, if the unforeseen does happen and the public health system cannot help you, you can afford to get expert medical treatment when you really need it. Surgery is expensive, listed below are some examples of common procedures

(with indicative costs as at May 2013): Prostate removal $10,000 $15,000 Angioplasty $17,300 - $27,400 Total hip joint replacement $20,000-$27,000 While urgent treatment is available through the public system, people can find themselves in a slow-moving queue for those ailments that aren’t immediately life threatening. Having health insurance eliminates waiting on public waiting lists, getting you treated and on the way to living normally again as soon as possible. That is the primary benefit for most people, and why it is worth considering. And with the cost of medical treatments and the availability of new procedures and drugs increasing, more and more New Zealanders are going private. With the rising cost of private medical insurance, it can be tempting to change to another medical insurer if a cheaper premium is available. However, before submitting a new application, keep in mind that you may be forfeiting cover for pre-existing conditions, particularly those newer problems which have occurred since taking out the policy. Adding or increasing an excess with your current insurer may be a better option.

It is important to ensure that, when taking out any type of insurance, details of all medical ailments should be disclosed, no matter how long ago they occurred or how minor they may seem. We’ve seen a lot of media coverage which highlights the importance of providing a full medical history. Failure to provide important information could lead to issues at claim time. Stephenson has just completed the Auckland marathon in the name of Jogging4Jack where he’s been, and is still, raising funds for 4 year old Jack who has been diagnosed with Viral Encephalitis in Cape Town. Jack was diagnosed in February this year and has been in the Red Cross Hospital in Cape Town ever since. His medical bills have exceeded R800 000.00 and Stephenson, along with many others, are helping to raise funds around the world.

Speed Limits!!! I

n the property finance world today, LVR or Loan to Value Ratios, have become as important as Serviceability. Loan to Value Ratios is basically the Banks lending compared to the property’s value, ie: • Property Value $1,000,000 • Mortgage $800,000 • LVR 80%

On 1 October 2013, the NZ Reserve Bank imposed what has become known as “Speed Bumps” on the Retail Banks in New Zealand. What these Speed Bumps do, is to limit the Banks total mortgage lending book in the over 80% LVR, to only 10% of the entire book. This was done by the NZRB in order to slow down the rampant increase in property prices / values, particularly in Auckland and Christchurch.

If you fall in to this <80% LVR bracket, and you have any other debt, my advice would be to refinance/consolidate now. The LVR Speed Limits have now been imposed for over a month, but has it been successful in doing what it was designed to do? Contrary to, what appears to be, popular belief, the speed limit was meant to limit the amount of high LVR lending, not stop it altogether, but it seems to have been misunderstood by the majority. This is traditionally the busiest time of the year in the Real Estate market, yet the latest data from the RBNZ shows a 20% drop in Mortgage Approvals, on this time last year. So it would seem that it has had some impact. It will possibly keep the period prior to Christmas quieter than usual, and January will remain traditionally quiet. By February most of the banks will have cleared their backlog of pre-approvals, and they will have a better idea of their numbers in terms of their LVR lending. After that, the gates should be open to good, higher LVR lending again. My advice would be to work with your mortgage broker, who can show you the best way to prepare your finances, in readiness for your application. We will also know immediately which banks are open to what type of business, and will prepare your application for approval!!! The silver lining is that those mortgages within the 80% limit, are in heavy demand by banks, who all want a larger slice of this particu-

Fingerprinting for South Africans in NZ The New Zealand Police recently informed the representatives of all the foreign countries that they will no longer be taking fingerprints for Immigration purposes. NZ Post is to take over the task and will render the service at a fee. NZ Post fingerprinting went live in Auckland last month. The NZ Police in Auckland will no longer assist with fingerprinting for Immigration purposes. As NZ Post use an electronic system this will not be of any assistance to South African National as this is not compliant with the barcoded application forms used by South Africa. Immigration:

3 weeks can change your life! O

ur whole life is about making choices - whether it’s education, careers, children or immigration. And it’s about time and money! My topic is about your time, your choices and immigration.

Lately, I have come across a number of people who are in New Zealand and who have offshore Immigration Advisers - and immediately in walks the major issues of time, money and choice! There has to be a crystal clear message to everyone who would like to immigrate to New Zealand - you have to have a job offer from a New Zealand employer in order to apply for a Work Visa and/or whether you meet the requirements for a Residence Visa under the Skilled Migrant Category. I am not talking about partnership-based applications or business categories here at all. If you’re not in New Zealand and you engage the services of an Immigration Adviser who is offshore you run the risk of not getting the services you deserve.

Firstly, the job! If you’re not in NZ it is nearly impossible to secure a job offer (there are exceptions) but even if you are in NZ and on a Visitor’s Visa it is quite difficult, though not impossible. However, let’s say you find a job yourself or with our help and you have that all important signed job offer from an NZ employer in your hands, time is now of the essence. Normally in New Zealand, a three to four week notice period is worked before a person leaves the place of employment. Immigration NZ’s processing time could take up to four weeks to process your Work Visa application. If you use an offshore Immigration Adviser you are going to lose at least three weeks of this valuable time excluding the time taken by Immigration NZ. Why is that? As your Adviser is offshore you will need to send your job offer documents across the waters. It would take 4 – 5 working days to have them delivered. It would then take time for the preparation of the application by your Adviser (say another 4 – 5 working days) and then your Adviser would send your application back to New Zealand (again 4 – 5 working days in transit) to INZ. Three weeks lost! Immigration NZ would take the necessary time to process the application. Another four weeks. Is your prospective employer willing to wait at least two months to get you on board? That’s if everything goes smoothly with INZ and no questions or queries arise from the application. Quick questions from INZ can be done within 24 to 48 hours. What happens if INZ asks for additional documents or they send a letter with potentially prejudicial information and they need written replies? It would take 4 - 5 working days delivery to the offshore office, the reply from the Adviser, and then 4 - 5 working days back to NZ again. In the meantime, the clock is ticking.

Secondly, money! Time is money. The time you sit around in New Zealand waiting for the paperwork to be processed is costing you in rands – and The South African

with the exchange rate – in big rands. You have to eat so food is on the list, accommodation and transport and all the extras that go with living – then there are the medicals – all the while you’re waiting for papers to be delivered backwards and forwards offshore before you can even lodge the papers with INZ for the Work Visa. That job in New Zealand will be at stake, given the extra 3 week wait, and what is all this costing you in the long run? Weigh up your choices and make the right one. At the end of the day, if you don’t have the job you cannot stay in this beautiful country!

‘We need to be ashamed’

A

record 851 rhinos have been killed by poachers to date this year in South Africa, leading to fears that these wild animals could be extinct in less than a

decade.

If the current rate of killings continues to rise, wild rhinos could be extinct in South Africa by early 2020. There are only an estimated 22,000 wild rhinos left and, financially, rhino poaching has cost South Africa R1.1billion between 2008 and 2013. “We need people to be ashamed of this. The fact that the rhinos are killed is because there is a market out there. There are people coming to steal our heritage,” said a South African government official. Poachers from neighbouring countries are hunting the rhinos for their horns, which are sold to crime syndicates that operate in Asia, where the horns are believed to cure cancer, penile erection and hangovers. The World Wildlife Foundation said that it was still a fight worth fighting, even as poachers turn their attention to South Africa, after destroying animals in Kenya and Mozambique.

How to Sell your Home for More…

The impact of presentation, staging and photography You may have seen the story in the NZ Herald recently where a couple made $162,000 (17%) on a Meadowbank property in just 3 months; simply with a few licks of paint, furniture to stage it and a good marketing campaign. First impressions count. The first words in Ray Wood’s book How to Sell your Home for More are, “It’s not a question of if the price of real estate can be influenced… it’s a question of by how much”. An American study on rows of identical houses showed those that were home-staged sold for 10-15% more. In New Zealand the consensus is that it can add as much as 10%. As Ray Wood puts it, “the best selling results ALWAYS occur when the seller works with their real estate professional to make sure the presentation details are complete, before marketing preparations (photography, etc…) begin”. Staging costs upwards of $2,000 but if you can get even a 2% return, ie $12,000 on a $600,000 property, then it’s well worth it. The key point is that property presentation really does influence the sale price. Whether you have it professionally staged or do it yourself, make sure you work closely with your sales professional to get it right – it’s money in your pocket! Excellent photography is also a key requirement for a successful marketing programme. Those photos appear in all your print and internet advertising. It’s the first impression potential buyers get and is more often than not the deciding factor on whether they choose to view a home. An effective marketing campaign is the next phase. A

fter fourteen years of collecting information about my relatives, my journey to South Africa began. My genealogical family deserved some much needed contact so I decided it was time to go back and braai with my bru’s!

I purchased the best insurance policy money could buy after packing a healthy bottle of adventure and enthusiasm into my bag. After 28 hours in the air, 3 different time zones and a slight weave from all the whiskey, I touched down at OR Thambo airport. Within a few days it was as though I’d never left. I was in the bosom of my family and was constantly teased about how I spoke and what I wore. People are very fashion conscious and one of my Joburg trendsetting cousins constantly told me off for wearing a singlet and jandals. I felt humbled hearing how proud they have always been of me and my achievements. We poured for hours over photographic albums overflowing with pictures of my family and the reminder that I had never been forgotten. Instead of being critical about the country I opened my mind and enjoyed it all. But,

honestly, I couldn’t live there. I’m a Kiwi now! I have ties to my motherland and my family will always be in my heart and I loved chatting away in my poor Afrikaans as I felt bonded to this estranged family. From day one to the sad goodbye at the end of my holiday, adventure and socializing was the name of the game – which was nonstop. My family made sure I had a stellar time sightseeing, going to game parks and enjoying slap chips soaked in salt and vinegar. I was happy as! The panoramic landscapes and spectacular sunsets held my attention and my camera captured those moments. South Africa is a land of beautiful contrasts. Too quickly my holiday was over and the time came to say goodbye but my love affair with South Africa and my South African family was not over – it has only just begun again! michael_rust@icloud.com
