From the editor Good day, I am in South Africa again presenting free immigration seminars in four cities. The feeling of desperation from some people is extreme as some, just because of their demographic, cannot get jobs as they are reserved for others. We hear the stories at the seminars. The rich seem to be fairing far better than the average man in the street. As long as you do not dig too far under the surface, people still seem happy and, as you know, it’s a great place to come for a holiday with the kiwi dollar. I am still not sure what the final result of the election is as the news is brief. I’m told it’s in the hands of Winston Peters. I’m sure I’ll hear as soon as a decision is made. We have not had the best support for this issue of the magazine but it’s still a publication to be proud of. I would like to encourage all advertisers to support the mag to keep it going. All I know is that the 200 SA Magazines I take to South Africa on my seminar travels are fought over. Due to flight weight restrictions, unfortunately, I’m not able to take more but if I could, I’d still have none left by the end of the seminars. They are treasured as their future network when coming to New Zealand and your advert in hard copy is seen by at least 800 people in SA in October alone. As you are well aware, the SA Magazine is also emailed and read by over 4,000 people who often forward to family and friends. The magazine thanks our loyal advertisers and welcomes our new ones. Disparity of Treatment – A lurking trap easily fallen into! Our in-house employment law specialist, Eska Hartdegen, shares some cases of interest.
D
isparity of treatment in a workplace can have serious consequences for the employer, who may be faced with a personal grievance claim lodged by an employee, and on the other hand for the employee in question who could claim disadvantage, and in a case where they have been dismissed, claim that they have been unjustifiably dismissed and treated inconsistently. In the recent Employment Court decision of Andre Nel v ASB Bank Limited, the employer had applied to have the pleading as to disparity of treatment in Mr Nel’s statement of claim struck out. Judge Corkill refused the strike out application. Eska Hartdegen He considered the issue of disparity of treatment in detail, and held that “parity of treatment is necessarily case-specific”. Further, in considering also the case of Sutherland v Air New Zealand Ltd where disparity was alleged, Judge Corkill held “I do not think it is desirable for this Court to exhaustively define disparity” and said further that “Factors such as identity of employer, position held by the employees, the general nature of the misconduct, and the like are all relevant and will assist in the assessment of whether a valid comparison can be made”. and in conclusion he held that “it is not necessary, or desirable, to define the term”. Mr Nel’s employment was terminated after some 18 years of service. Mr Nel faced serious allegations after certain interactions with Ms A. Judge Corkill quotes Mr Nel as saying that “he reasonably believed she had developed a romantic interest in him; that they worked in a workplace where staff engaged in banter which was at times sexually suggestive; that the use of profanities was common, as the working environment was “generally relatively smutty”; and Ms A participated fully in this workplace environment”. After some “private Facebook exchanges between Mr Nel and Ms A, she told him that his feelings towards her were not reciprocated, and that she wished to maintain a strictly professional relationship. He says he immediately apologised and set about repairing the relationship”. A disciplinary process followed “which resulted in the decision to terminate on the ground that Mr Nel had: failed to comply with ASB’s Code of Conduct; failed to comply with ASB’s Harassment, Discrimination, Bullying and Offensive Behaviour Policy; failed to act consistently with ASB values, including its value of integrity; and failed to meet ASB’s expectations of Mr Nel as a senior manager”. Mr Nel claimed he was treated inconsistently in comparable circumstances to how others The South African
had been treated, and he challenged both the process followed by ASB and the substantive fairness. In the Sutherland case above, the employee while on duty overseas had “abused a fellow employee for the other’s involvement in an employer-supported employee organisation”, after he had consumed “a significant quantity of alcohol”. The Court criticised the company for focusing on the fact that the employee was drunk, and claiming that that justified dismissal, and asserting that “this differed from comparator instances which involved other employees who had not been intoxicated.” In that case the Judge had held “I think to focus upon the aspect of drunkenness and, by its exclusion from the findings of the company in the other cases, to assert there was not disparity, is too narrow”. Judge Corkill referred also to the case of New Zealand Police Association Inc v Commissioner of Police, and said that even though “the offending of a comparator employee did not match the plaintiff’s offending”, the Judge had nevertheless held ‘I conclude that serious misconduct by another police officer, in circumstances occasioning the disciplining of that officer, is relevant in a comparative way to the punishment of dismissal imposed upon Mr Neilsen for his offending, notwithstanding that the offending by the compared officer did not duplicate, through matching identifying characteristics, as it were, the offending by Mr Neilsen’.
This legal issue is complex and can be a minefield! It would be prudent for employers to take legal advice early to avoid making decisions that could constitute disparity of treatment. Employees too should seek advice if they consider they are being treated differently to others.

The Sperm whales can be seen all year round, Orca (Killer humpback whales in June – July. Geothermal activity – Rotorua has Geysers that you can watch erupt every morning, and also has bubbling hot mud and naturally heated hot springs. Just an hour away is Lake Taupo which also has plenty of geothermal activity going on, parts of the Lake are warmed by geothermal activity. You can even dig your feet into the sand to feel the heat coming up from beneath the ground. You are always within 130km of a beach – In New Zealand you are always close to a beach. The furthest away you can get is around 130km, even then, a lake is sure to be nearby. New Zealand also has some of the best beaches on Earth, with clean fresh water and multiple beaches to choose from, it makes spending Christmas and New Year a great holiday in NZ. iss South Africa, Demi-Leigh Nel-Peters, has been crowned Miss Universe 2017. The 22-year-old, who recently earned a
business management degree, was crowned at The AXIS theatre at Planet Hollywood casinoresort on the Las Vegas Strip. The runner-up was Miss Colombia Laura Gonzalez, while the second runner-up was Miss Jamaica Davina Bennett. Ninety-two women from around the world participated in the decades-old competition. They changed the strings around, they developed new styles of picking, they only use the first five frets of the guitar — they developed a totally unique genre of guitar music, indigenous to South Africa.” He started taking lessons in that local style. The chap who taught him was an apartment cleaner around the corner from where he lived, and then he bought a cheap steel-string guitar. And he was on his way. He met Sipho Mchunu, who became his partner in Juluka (which means ‘Sweat’ in Zulu), and they played traditional maskanda guitar music for about six or seven years, initially performing as a duo. Hilton Rosenthal signed Juluka to his independent label. In 1979, its first album, Universal Men, was released. Within a few years, this most unlikely band had managed to score a hit in the UK with the famous ‘Scatterlings of Africa’. They were offered a tour of Europe and North America. Clegg and Mchunu both resigned from their jobs, and hit the road. Eventually, Mchunu decided that he had tired of life as a professional musician. So he resigned, and Juluka came to an end — but Clegg was still full of the fire of music and dance, and formed Savuka. Savuka means ‘We Have Risen’ in Zulu. The song ‘One Human, One Vote’ was released in 1989. As much as their songs were rooted in a very particular time and place Clegg believes that the The South African

You can use an online KiwiSaver Calculator to see how much you might have when you reach 65, and how your choice in fund or contribution rate might affect this. You can also make voluntary contributions which can really add up in the long term.
What happens when you reach retirement age? While you can access your funds when you reach retirement age, it doesn’t mean you have to! If you continue working, you can still contribute and continue to potentially grow your balance until you’re ready to start withdrawing. If you do retire, there may be no need to withdraw everything – so you can keep your money away from temptation until you do need it.
How is KiwiSaver different to some previous superannuation funds? The difference with KiwiSaver to some historical superannuation funds is that it’s your money, and it’s held in a trust account in your name with the provider’s supervisor. This means if a KiwiSaver provider’s business were to fall over, your investments wouldn’t be affected. You contribute, as well as your employer and the Government and it’s your savings, to help you into a first home or to assist you with a better quality of life in retirement. People go barefoot. Everywhere. And I mean everywhere. From the supermarket to restaurants and bars. During the summer months, shoes are just simply not a requirement.
The coffee is the best. Ever. Oh man. The coffee. It is just so good. New Zealand invented the flat white and with such an amazing brunch scene, the Kiwis have perfected the art of coffee making. Nowhere else I've been can quite compare on the coffee front so just beware that NZ will ruin coffee for you for life if you ever leave.
You have to go up and pay. I would say in most other countries I have been to, when you are finished your meal you ask for the bill and leave cash at the table. Well, not in New Zealand. Here, you go up to the till and pay. It can be a little confusing at first when you are sitting waiting on the bill which never appears. It also doesn't matter how many people there are, even a group of 12 would go up to the till and pay for their meal individually.
There is no such thing as tipping. Yep that's right. Forget your 12.5% service charge or adding a little bit onto a taxi fare. New Zealand doesn't have a tipping culture. Leaving money behind on a table is seen as accident as opposed to a reward. Tipping isn't a big thing here. A friend of mine left $10 on a cafe table as a tip only to have the waitress run out after her to say she had left money behind.
There are earthquakes all the time. New Zealand experiences about 15,000 earthquakes per year but thankfully most of these are so deep they cannot be felt. However, about 150-200 earthquakes are felt up and down the country each year, some much more severe than others. Most buildings are now designed to rock with the earth to absorb the impact so they physically sway from side to side during an earthquake. Due to being on a fault line, this factor is just a normal way of life here.
New Zealand uses weird names for everyday items. Although, of course, English is the national language there are some words which haven't translated over. For example, courgettes are zucchinis, cling film is glad wrap, a cooler box is known as a chilli bin, a dairy is a shop, swimming shorts are togs, flip flops are jandals and sweets are lollies. There really is a whole new vocabulary to learn. Oh and "piss" is alcohol. The South African

any teenagers struggle with expressing and understanding their feelings. The teenage years can be a sensitive and challenging time for teens and their parents. Art can be a great way for teens to express feelings that are sometimes difficult to verbalise. Art is an expressive language which gives teenagers a way to tap into their creativity and communicate in a nonthreatening way. It is also a way for teenagers to feel in control, rather than feel like they are under a spotlight with the therapist subjecting them to what could feel like a verbal cross-examination. Art therapy provides a way for teenagers to express their feelings and opinions through imagery, which many teenagers find much easier and less stressful than words. If you would like to access art therapy for a teenager you know, or if you are a teenager looking for a supportive environment to express your feelings, you are most welcome to join the art therapy group for teenagers run by qualified and registered art therapist Elaine Matthews Venter. f you have not tried a Club Med yet, I suggest you make it your next travel goal. In October, my family and I headed to La Pointe aux Canonniers in Mauritius and it was the most phenomenal holiday destination and experience, ever!

After a 4-hour flight from South Africa and an hour’s drive from the airport to the resort near the Grand Bay (Grand Baie) area, we were stunned at the beauty and magnificence of the place.
Spending ten days in paradise meant we got to try almost everything every day. Considering how warm, considerate and welcoming Club Med staff have been, we are definitely considering a visit to Club Med France next year to ski in the French Alps.
The very first night, there was an extravagant buffet with master chefs at the helm with their dishes on display, personally serving guests. After dessert, we passed by the common entertainment area and heard the wonderful songs of a musical put together by the children who practiced it at the Kids Club Med day care. We had, of course, taken our nanny not realising that this amazing resort caters for kids as young as 6 months, up to young teenagers, at Baby Club Med. Each day was filled with extraordinary adventures, from the glass bottom boat, to treasure hunts on the beach and a variety of artistic activities which kept my 4-year-old occupied for hours. Another appealing aspect of this resort, is their extensive consideration of baby needs, with a fully stocked baby room which is accessible 24-hours a day. You can get freshly cooked veggies at lunch and dinner daily, which we did for our 8-month-old; reducing the burden of a heavy suitcase. Spending Diwali away from home for the first time, made me question my holiday dates, until we were pleasantly surprised by the professional Bollywood show and treats provided on this auspicious day. Each guest also received a note and Diwali parcel on their bed, which really enhanced the festive vibes. There was a range of things to do each day, and the constantly changing menu, allowed you to experience true Mauritian cuisine, without a doubt. Every evening there was plenty of entertainment for the children and much later, dance parties went well into the night for the adults. We were not aware that there would be themed evenings but quickly got into the groove as almost all the guests wore all white on one night, all black on another and hats on certain other evenings, etc. I cannot describe how much fun we had socialising with people from around the world or how magnificent it was to learn about The South African
Of course, there was plenty of other things to do during the day as well, such as the famous glass bottom boat, skiing, snorkelling, sailing, diving, yoga, full body massages, etc.
My only advice to families who want to experience a life-changing, all-inclusive holiday is to pick a Club Med destination and get on the first flight.

Pavlova: a Christmas dessert

avlova is a dessert named after the Russian ballerina Anna Pavlova. The dessert is believed to have been created in honour of the dancer either during or after one of her tours to Australia and New Zealand in the 1920s. The nationality of its creator has been a source of argument between the two nations for many years. With its simple recipe, is frequently served during celebratory and holiday meals. Photo: Hazel Fowler Pavlova is made by beating egg whites (and sometimes salt) to a very stiff consistency before folding in caster sugar, vinegar or another acid (e.g. cream of tartar or lemon juice), cornflour, and sometimes vanilla essence, and slow-baking the mixture. It is a meringue dessert with a crisp crust, and soft and light inside. South African Bodyboarder Iain Campbell crowned the best in the world!
I
ain Campbell started his career 14 years ago and has had a passion for competing on the World Tour circuit where he is currently on top of the leader board.
Campbell is originally from Durban and, at just 26, he is on top of the leader board for the Association of Professional Bodyboarders Tour. Currently sitting on 18500, he recently came second at the Hawaii Pipeline (if you have ever seen Blue Crush, you will know the size of those waves) and landed a win at the Sintra Pro in Portugal. Early on in life, Campbell knew he had a love for the ocean and began as a lifesaver. He ventured into water polo while at school before turning his sights to bodyboarding. Desperate to compete internationally he travelled to the Canary Islands off the north western coast of Africa and worked from there to join the World Tour Circuit. His win in Portugal was met with ups and downs due to the changing weather. During the event, Campbell received the only 10-point ride of the competition which pushed him through to the semi-finals. Grow avocado: plant, care and harvest
A
vocado is one of the home gardener’s most longed-for fruit trees. For southern gardeners, this may be a distant dream but most North Island growers would have good success with a tree (or two, if space allows). A native of South America, avocados have become a mainstay of Western diets. Avocado, Marmite, tomato and cheese on Vogel’s toast is a favourite – for breakfast, lunch or dinner! This versatile fruit is great in savoury guacamole, but can also be used in sweet dishes such as raw avocado cheesecake and chocolate mousse. Unsurprisingly, given their South American ancestry, avocado trees only thrive in warm locations. A light frost will burn any tender growth, and anything cooler than -3°C will kill a young tree. The best areas for growing avocado are Northland, Auckland, Bay
of Plenty, Gisborne and Hawke’s Bay, but trees have been grown very successfully in Nelson and Golden Bay too. Have I got the right conditions to grow avocado? Site selection is very important to provide a warm, sheltered position for your avocado tree. The site should be: • protected from wind; • warm and sunny. Avocado trees also need excellent drainage, which in practice means 2m or 3m of freedraining soil. This is because its roots are extremely sensitive. The deep-growing tap root – a long slender root, similar to a big carrot – loathes heavy, clay and wet soil. The
roots are susceptible to the fungal disease phytophthora, which thrives in difficult dirt. To find out if your soil will support an avocado tree: •D ig a deep test hole in the desired spot. •K eep an eye on how well it drains after a good spell of rain. * If it hasn’t fully drained after a couple of days, try another spot. Avocado trees can be grown in coastal locations, as the trees are salt-tolerant. Avocado trees can take 3 years to bear fruit, but then they can produce up to 200 avocados a year. http://www.stuff.co.nz

the Far North are also favourable growing regions. The industry consists of 1350 growers who collectively manage over 4000 hectares of mainly the Hass variety of avocados. A number of pack houses, fruit marketing companies and exporters are involved in the industry to market and sell New Zealand avocados both in New Zealand and overseas.
The Hass variety of avocado The avocado is unique in that it is harvested mature, but unripe. In fact, the avocado will not ripen while it is attached to the tree. The age of fruit at maturity ranges from 9-18 months at which point once the fruit are picked they will begin to ripen. In the case of Hass, fruit change from green to black and soften to a creamy texture that makes the avocado ideal for consumption. Hass is harvested for export from late August through to late March. In March this year Van Zyl-Roux was served with a notice to appear before a disciplinary inquiry relating to allegations he had

Botha said: “My client’s allegations regarding a conspiracy were now substantiated, it was now so obvious. I placed it on record that I had obviously become a thorn in their sides, the conviction and dismissal of my client was now a foregone conclusion, they were a thinly-disguised tag-team to convict my client and evict him from the SAPS.” In June this year, Van Zyl-Roux was convicted of all but the failure to hand over the docket charge and dismissed. “They gave us no reasons. We did an internal appeal [to the head office] pointing out all the irregularities and abuses, including bias and collusion between the presiding officer and the prosecutor. But on Monday they informed him that his appeal had failed. Again, they gave no proper reasons,” Botha said. Van Zyl-Roux intends taking his dismissal on appeal to the public service bargaining council and, if he loses there, to the labour court. This could take years. JP van Zyl-Roux has the support of ‘Saving the Wild’, an internationally-funded organisation seeking to protect South Africa’s wildlife. Director Jamie Joseph said: “Tragically, in South Africa, the good cops, the best of the best, are often targeted for doing their job ‘too well’. She said van Zyl-Roux was a “hero” and Saving the Wild’s legal team would stand by him. “He does not need to clear his name … his impeccable record speaks for itself.
