T

he dust has now settled regarding Donald Trump’s win and the sky has not fallen in. In fact, things have already improved. The stock

market had a 3% drop at the initial news and the media had headlines of ‘Market Crashes’ and the like. The following day most of the share markets in the world went up and are still up, with talk of increasing interest rates globally. Most of you who have family overseas have seen the Immigration policy changes over the last few months and there is talk that there will be tougher changes next year. The government is hard pressed by the opposition and other interest groups complaining about the volume of immigrants coming to New Zealand to make these changes - 70,000 for this year and the same expected next year. This has an effect on house prices which have started stabilising with the new Reserve Bank rules. I have issues with this continued argument about housing. For the last two years the property price trajectory is spot on and prices are playing catch up from the five year Global Financial Crises. I know it is hard for new home buyers to buy their first home, it always is, but should we devalue the 65% of the population who own houses? The truth of the exceptional immigration numbers is that less and less Kiwis are leaving New Zealand to find jobs elsewhere and more and more Kiwis are coming home to a New Zealand which is rated the best country in the world to work, live and play. Well done, New Zealand, the envy of most. I would like to say ‘Merry Christmas’ to all our readers and a big thank you to our loyal advertisers who consistently advertise in The South African Magazine, keeping this little publication going. LEGAL UPDATE: EMPLOYMENT LAW

Process trumps all, be it in restructures or dismissals! Our in-house employment law Barrister, Eska Hartdegen, reports on some employment cases of interest where employers failed at process

M

r Shoshany, an employee who was fired for making cash withdrawals and personal purchases totalling about $11,500 on his company credit card while in Las Vegas between business appointments, was awarded three-and-a-half-months' lost wages and $10,000 compensation by the Employment Relations Authority (ERA). Mr Shoshany had on two previous occasions used his credit card for personal purchases and had made cash withdrawals from it for his personal use. He e-mailed “the 4RF accounts officer…copying in the Chief Financial Officer (CFO) and Vice-President of Sales, informing them all of his personal purchases. Mr Shoshany asked that they deduct the amount spent from his salary and he received a response from 4RF accounts thanking him and notifying him that the deduction would be made”. After a disciplinary process held with the employee, the company’s Chief Executive “concluded Mr Shoshany's conduct had ‘damaged trust and confidence’ and that his actions amounted to serious misconduct, warranting summary dismissal”. The ERA disagreed, finding the dismissal to be procedurally and substantively unjustified and that Mr Shoshany had a valid personal grievance claim. In another case, Ms Hills who worked at Cafe de Paris in Palmerston North was dismissed when the gaming machines were down by $1,000 at the end of her shift. She made a claim for unjustified dismissal, claimed that she had been underpaid and that “money had been deducted from her wages”. At the disciplinary meeting held with Ms Hills, the employer had required that the $1,000 “be paid back by cashing up seven days' outstanding leave and paying the balance from her [Ms Hills’] wages”. The ERA “accepted Hills only agreed to the measure of deducting the money from her wages under duress, and found the deduction of pay was unauthorised”. Ms Hills was held to have been unjustifiably dismissed and was awarded “$3,200 in lost wages and wages deducted for gaming machine shortfalls and $6,000 compensation for hurt and humiliation”.

Ms Franich was awarded $7,000 compensation and a penalty of $5,000 was also awarded against Vodafone. These three cases illustrate the risks employers face when undertaking business restructures and disciplinary processes. It is always advisable to seek professional legal advice before embarking on a dismissal or restructuring exercise that could easily end up costing companies tens of thousands of dollars.

In a case against Vodafone, Ms Franich, who had been employed as a Sales Manager for Vodafone since 2011, was moved after a restructure to a “desk-based sales role, dealing with a large number of small customers”. Previously her role had involved dealing with big customers and dealing with customers face-to-face. Ms Franich raised a personal grievance claim “about her new role as a result of the restructure” and alleged that ‘her former manager had bullied her” and that “her manager had made inappropriate comments about her weight to other people and undermined her position”. After an internal investigation, Vodafone found Ms Franich had not been treated unfairly. The ERA found that “Vodafone breached its duties of good The South African

‘The Last Time We Spoke’ Written by Fiona Sussman

T

he Last Time We Spoke is Fiona Sussman’s second novel. Her very successful first novel, Shifting Colours, was set against the backdrop of apartheid South Africa. This new book navigates the underbelly of urban New Zealand.

The novel opens with a brutal home invasion, which sees the world of a middle-aged farmer’s wife and that of an illiterate teen collide. The genesis for the story was a spate of very violent home invasions in New Zealand in the nineties, which left their imprint on Sussman. She was struck by both the brutality of the crimes, and the sheer youth of the perpetrators. Left with many questions, she felt a need to explore such incidents on a deeper level and avoid the common knee-jerk response to them. Sussman spent two years researching the novel, immersing herself in the world her characters would inhabit. This included going out on police patrol, speaking with inmates and staff at prisons across the North Island, and interviewing ex-gang members and victims of crime.

While this is a dark tale, it is also a very human story of hope and possibility. The Last Time We Spoke is about the human capacity to transcend a broken life, and finds light in dark places. Both Sussman’s books have been published internationally. The manuscript for The Last Time We Spoke won the Kobo/NZ Author Publishing Prize. Sussman, a former GP, has lived in New Zealand for almost twenty seven years. She has been writing for thirteen of these. When not writing, or juggling family life, Sussman helps manage the charity hospital she and her husband established in Auckland.

"Free markets, free people, and the world's strongest society ensure that New Zealand takes the top spot in the Prosperity Index," the institute said. After New Zealand, Norway came second followed by Finland, Switzerland, Canada, Australia, Netherlands, Sweden, Denmark and the United Kingdom. Bottom of the table were Burundi, Angola, Mauritania and Iraq. "New Zealand has ranked first in the Prosperity Index for six of the last ten years. Bar a small prosperity drop as a result of the 2008 global financial crisis and the immediate impact of the Canterbury Earthquakes, New Zealand's prosperity has been on an upward trend, particularly since 2012," the institute said. "This rise has been driven by concerted efforts by policymakers, especially in economic and health policy. inda Paul emigrated from Durban to New Zealand ten years ago and settled on the North Shore in Auckland. She loves the beauty of this country and believes this place is an artist’s dream.

Laylah, Rhythmic Champ

T

welve-year-old Laylah Waggie is an exceptionally gifted rhythmic gymnast who will challenge the dominance of Australian, American and Eastern European gymnasts on the global stage next year. She became the undisputed champion of New Zealand Rhythmic Gymnastics when she won the NZ Junior Rhythmic Gymnastics title in Invercargill in September this year. She will now compete on the junior International circuit representing New Zealand in overseas during 2017. Now a Glenfield Intermediate School student, Laylah has been performing since the age of five when her love of gymnastics began. She is also one of the exhibition dancers with the popular Auckland City Dukes Klopse group and her grandfather, Riedewaan Waggie, is the Founder of the group in Auckland. Laylah receives expert International gymnastics coaching from her Russian coach, Olga, at the North Harbour Gymnastics Academy. For the past five years she has won the Regional and National Rhythmic Gymnastics titles with her unique style. A

t East Coast Bays Dental we are used to looking at human teeth and although there are a lot of amazing facts about human teeth, animals possess far more interesting pearly whites! The type of teeth animals have depend on the diet of the animal. Carnivores, or meat-loving animals, have sharp teeth to easily eat their prey, whereas herbivores have flat teeth to easily eat plants and leaves. Animals that eat meat and plants (humans for example) usually have sharp teeth in the front of their mouths and flat teeth at the back. Here are some fun facts about amazing animal teeth. • Dolphins only have one set of about a 100 teeth. The teeth are all the same shape and not specialised for cutting or grinding as it is not used for chewing! It only aids in gripping objects and are used as a defensive weapon. The age of a dolphin can also be determined by examining the growth rings in their teeth (almost like a tree trunk), but this can only be done by looking at it under a microscope. One growth ring represents one year. • Sharks usually have about 5 rows (or even more) of razor sharp teeth with 20-30 teeth per row. They keep on growing new teeth and lose on average one tooth per day. Amazingly one shark can go through about 300 000 teeth during the span of its life! • Snails have the most teeth of any animal although their mouth is no bigger than a head of a pin. They could have up to 25,000 teeth! They don't chew with the teeth though. It is set in a ribbonlike structure and used to shred their food.

•S nakes have two hollow teeth or fangs used to store venom and also injecting it into prey. They also have small teeth in the lower jaw to latch onto the victim. •H ippos have 36 adult teeth and can sometimes retain some of the baby teeth. The incisor teeth can grow to 40cm and the canine teeth up to 50cm. They use these impressive teeth to fight over territory and to keep intruders away. •R abbits have 28 teeth that keep on growing. This compensates for the constant wear of the teeth as a result of a high- fibre diet of grasses, weeds, twigs and leaves. •A leech has three separate jaws with 100 tiny, sharp teeth to cut through skin. •E lephants have 26 teeth. In most animals, including humans, teeth form from top to bottom, but in elephants it forms from back to front. They have 6 sets of molars in a lifetime and as a tooth wears out through grinding a new one slowly moves forward to replace it. Loss of teeth is the leading cause of death in elephants. As the final 6th molar begins to wear, it gets increasingly difficult to chew and digest food. •D ogs have more teeth than humans and rarely get cavities as their saliva has a very high pH that prevents demineralisation. Dogs have 42 teeth and cats 30. Aren't the animal kingdom amazing? Humans are also blessed with a wonderful set of teeth, so please try to take good care of them!

First whale visit since Monday’s massive earthquake lifts Kaikoura’s spirits

visit by one of Kaikoura’s worldfamous whales has lifted the spirits of the town’s quake-struck residents today. Whale Watch Kaikoura posted on its Facebook page today a video of a whale breaching the surface - the first sighting since the 7.8 quake hit on Monday.

The power of compounding returns

T

here is an ancient story that explains why you should start to save and invest early, regularly and long term. It centres around the invention of the game of chess; recounted in Sahnameh, an epic poem written by Persian poet Ferdowsi between 977 and 1010.

When Sessa, an Indian Brahmin mathematician, showed his invention to the ruler of the country, the ruler was so pleased that he gave Sessa the right to name his prize. Sessa asked for one grain of rice for the first square of the chessboard, two for the second and so forth, doubling the amount each time for all 64 squares. Surprised that Sessa asked for such a low price, the ruler agreed. After a few hours, the treasurer gave the results of the calculation, explaining that it would take more than all the assets of the kingdom to give the Sessa the reward. Whilst in the first square of the chessboard there is only one grain, by the 64th square, it is 18 million trillion grains of rice - more than enough to cover the entire surface of the earth! The power of compound returns is most relevant these days when it comes to managing our personal finances. SPUR Steak House opens in Albany

S

outh African flame-grilled meat chain Spur opened in Albany last month and is already drawing queues. In its first week the restaurant welcomed patrons in the thousands, according to operations manager and co-owner for the White Cloud Spur, Jaco Jordaan. Deputy managing director for the Spur Corporation and fellow co-owner, Mark Farrelly says they had queues of 60 to 80 people – on one occasion stretching up to the road – a reaction he didn’t expect. Both hailing from Cape Town, Farrelly and Jordaan began setting up White Cloud Spur around nine months ago, after Farrelly had the idea to open a Kiwi branch. Established in 1967, the Spur brand is known for its flame-grilled meats, particularly steaks, burgers and ribs. Peter Woodberg loved his experience at the Spur recently. His party arrived and were taken straight to their booked seats. The service was fantastic, in fact, sometimes too good. He had a fillet, his dinner quests had John Dory and chicken snitzel, all cooked to perfection. They finished off with cheese cake and Dom Pedros, in true South African style! Free falling By Maria Chinn

I

was asked this question by many people, “Why jump out of a perfectly safe plane?” and I never replied to them so let me sum it up now.

I remember reading somewhere that ‘maybe the places most enclosed—by walls, by rules—are the ones that pose the greatest danger’. So when the door of that little plane opened at 9,000ft and all I could see were patches of blue skies and puffs of white clouds I knew I was safe and that I was going to have the most exhilarating experience of my life! But there are a couple of more reasons too. Firstly, the shear adrenalin will give your heart such a kick start, you will realise that you have been walking around half asleep. Secondly, the view of the Bay of Islands is breathtaking and to see that beauty in total silence while you are doing a 20 second free fall is totally indescribable. Thirdly, we only live once and we need to make every second count and live life to the fullest and those 20 seconds can feel like a lifetime! What’s next for me – 16,000ft tandem doing speeds of 120kph … or more! Skydive Bay of Islands in Kerikeri.

7. Nga Tapuwae O Toi Walk, Whakatane If you wish to discover the wider Whakatane area and are looking for a great walk then follow Nga Tapuwae O Toi – one of Whakatane’s most popular walkways. It includes historic pa sites, native forest and pohutukawa trees, bird colonies and incredible coastal and rural views. The entire round trip is 16km long, but if this is too long you can just walk sections.

8. Glow worm kayak tour Take a kayaking trip that starts at dusk from the Waimarino Adventure Park to one of the region’s hidden gems, with only the moon and the stars to light your path. Once you reach the glow worm cavern, the glow worms adorn the walls of the canyon all around you and the starry night sky above is still visible as you float among a galaxy of living lights. t is amazing how quickly this year has passed. The big surprise for the South African market this year was the New Zealand Immigration announcement that South African passport holders visiting New Zealand would be required to obtain a Visa before leaving South Africa. This was a shock for the many South Africans who had already booked to visit family here in New Zealand.

What is happening in the property market??

Contradictory views on the property market have become more prevalent during the last few months. These have included the ANZ bank CEO David Hisco warning in July that the Auckland housing market was over-cooked. REINZ report for October 2016 shows that Auckland’s median house price rose by 5% during October 2016 to $868,000, a 16% increase year-on-year. Part or all of the October increase could have been due to a change in mix, as Real Estate Institute of New Zealand (REINZ) spokesperson Bryan Thomson said: “Auckland experienced a lot of strength in the upper end of the market but the lower end appears to be wavering due to the revised Loan to Value Rules (LVR rules) having more of an effect on lower-priced sales compared to higher priced sales.” The national median price was up 10.9% year-on-year, in spite of the number of sales nationwide dropping by 9% from September 2016 to October 2016, and by 14% in October compared to the same time last year.

The graph below is from REINZ data and shows price movements over the last 10 years for Auckland, and for the rest of the country excluding Auckland.

The big question is what will happen over the next few months and whether the Auckland price increases will continue? Tony Alexander, chief economist for BNZ, wrote in his Weekly Overview on 17 November “Where now? I remain of the view that come the New Year the market will be lifting again.” Jonno Ingerson, Head of Research at CoreLogic NZ, stated on 3 November… “Just in the last few weeks new listings and demand have suddenly surged upwards and what was looking like a very sad Spring is now beginning to look a bit healthier. That said, prediction in this market is a near impossibility.” My personal view is that the jump in the REINZ Median Auckland prices in October was largely due to a change in mix rather than a real change in property prices, and that a correction will take place at some stage. Apart from this, my expectations follow those of Tony Alexander, but we should take note of Jonno’s comment that “prediction in this market is a near impossibility.” Disclaimer: The comments and opinions expressed above are my personal views and are NOT those of Barfoot & Thompson. Israel – a holiday of extremes By Janine Tuzza

A

friend of mine, Neil Evans, has recently returned from a memorable holiday in Israel. When you leave the islands you are normally presented with a necklace of shells, but in Israel you are presented with a certificate from the Tourism Board. A lovely touch! Getting to Israel was a flight to Thailand (Bangkok) with Thai Airways and then EL AL to Tel Aviv. Lots of security of five checks with an interview on why you are travelling, how long, where you going, etc, is just the beginning of your journey. As EL AL do not have permission to fly over Islamic countries such as Saudi and Iran, the route travels round the Saudi peninsula and up following the Red Sea. Israel is a modern democratic country and a land of huge contrasts - from blue oceans, desert and the green lushness of springs like the Ein Gedi Springs. The population is made up Arab, Jews and Orthodox Jews. Here are some of the highlights of Neil’s trip. Old City of Jerusalem has so much history and places like the Mount of Olives and the Garden of Gethsemane make you appreciate the reality of what is written in the Bible. These are real places and very, very old. Two beliefs on the burial site of Jesus:

On the Lake of Galilee a sail boat made to look like an authentic fishing boat takes you to view the land from the shore and you end up at a quaint restaurant where you get to eat St Peter’s fish – basic fish and chips! The Dead Sea is the lowest point on earth, approx. 600m below sea level. It is impossible to sink in the Dead Sea and as Neil said, “you are unprepared for the sensation.” The base of the Dead Sea is rock and mud. If you plan to go there, maybe a good idea is to take some reef shoes! The mud is used worldwide in Spa treatments and is full of minerals. Just to give you an idea of the solidity of the salt water, sea water is at 3%. The Dead Sea is at 30%. Masada – Neil’s impression is it really is in the middle of nowhere but full of history. If the rocks could talk! The tales they would tell! Herod the Great built a palace for himself atop this rock plateau. This was a secure location with a large cistern to collect water. Genesis Land is not much to look at but the experience is a must. Here you get to ride a camel and ‘Abraham’ explains the form of hospitality as it was in ancient times with a basic meal on offer, rustic but good. Nazareth Village – this is a village built to look and run as it did in ancient times. The meals available here are eaten as in ancient times - an amazing experience which takes you back in time. Only thing is you feel like you should be in costume. Hezekiah’s Tunnel – ½ km long walk through tunnels built under the City of David to provide water into the city. You will need a torch and shoes you don’t mind getting wet. A head torch was a great idea as you become hands-free. Food in Israel was surprising with an emphasis on salads. Similar to the Chinese, noodles are a regular feature for breakfast. In Israel all manner of salads are available for breakfast and all other meals. A visit to the Holocaust Museum also provides an interesting meal. If you want to have coffee with milk or anything dairy you have to go to the non kosher side of the restaurant.
