The world is in turmoil with 50,000 refugees arriving in Europe every day. We are lucky we live in New Zealand far from the chaos that Europe is experiencing. We have lifted our quota slightly but if we want to keep the economy and our prosperity we have to be very careful of not taking on too many. They all come at a huge cost to the taxpayer. Helen Clarke, an ex-Prime Minister of New Zealand, now a very senior person in the UN said this on a recent trip to New Zealand; “War is terrible and tragic but once the war is over the displaced people should go back to their home country. To do that, massive refugee camps should be built on the border or close to the border with schools and facilities supported financially by the UN and all the countries around the world. Once the war is over everyone goes home”. The danger of refugees going to Australia, Germany, New Zealand and USA is that the refugees will never go home as life is too good in these countries. Spring has sprung and at last the weather is warming up. We have had some beautiful sunny days and with daylight savings kicking in we can now braai on the beach after work until 8pm. Hooray! A restructure must achieve its proposed end-result, or the redundancy becomes an unjustified dismissal! Eska Hartdegen, our in-house employment law specialist shares two Court decisions of interest to our readers, regardless of whether they are employers or employees

On 14 April, Ms Brake informed her manager that she needed a day’s leave “because she had leukaemia. She assured Ms Retter that the illness had not affected her work and her condition was stable and under control”.
The relevant sections of the Employment Relations Act 2000 (ERA) discussed in the two cases, are sections 103A (1) and (2) of the ERA and section 4.
At 3pm that same day, Ms Brake was called to a meeting in which she was advised that there was a proposal to restructure “and informing Ms Brake that her position may be surplus to requirements”. Her position subsequently was declared redundant.
wo recent Court decisions, one in the Employment Court and the other a Court of Appeal decision, have cast the spotlight anew on an employer’s obligations when restructuring a business and making employees redundant.
Section 103 provides: “(1)…the question of whether a dismissal or an action was justifiable must be determined, on an objective basis,…(2)… The test is whether the employer's actions, and how the employer acted, were what a fair and reasonable employer could have done in all the circumstances at the time the dismissal or action occurred”. In the case of Michael Rittson-Thomas t/a Totara Hills Farm v Hamish Davidson, Chief Judge Colgan held that the test set out in section 103 requires that a two-pronged assessment be followed; the first being whether the dismissal (here a redundancy) was justified; and the second, being whether the process followed, was fair. At [53] and [54] of the Rittson case Judge Colgan finds: “Section 103A does require the Court to inquire into a decision to declare an employee’s position redundant… [54] It will be insufficient under s 103A, where an employer is challenged to justify a dismissal or disadvantage in employment, for the employer simply to say that this was a genuine business decision and the Court (or the Authority) is not entitled to inquire into the merits of it (My emphasis)”. Judge Colgan finds that the enactment of section 103A in 2004, and the further amendment in 2010, does affect “the previous law about justifications for dismissal on grounds of redundancy”. On assessing whether the employer’s claim that making Mr Davidson redundant would result in a 10% saving of the wages bill, Judge Colgan finds that this would not have been, “and that the dismissal was unjustified”. Mr Davidson was awarded lost salary, compensation, KiwisSaver contributions and legal costs.
In the Brake case, Judge Travis held in the Employment Court decision, that “there was no suggestion that the redundancy was a mask for some ulterior motive in dismissing Ms Brake”, finding that the fact of her having leukaemia and the announcement of the proposal was “simply an unfortunate coincidence”. However Judge Travis finds that the employer had relied on incorrect financial information; that instead of a loss of $61,000 for the financial year, the company had made a profit of $60,000, making the dismissal for redundancy unjustified, and describing the situation as “a genuine, but mistaken dismissal”. What is important to note about the Court of Appeal’s decision is that it has firmly established that the test set out in section 103A does require the Court to assess whether the employer: “had failed to discharge the burden of showing that its actions, and the manner in which it acted, were what a fair and reasonable employer would have done in all the circumstances at the time of Ms Brake’s dismissal”. The Court found that: “The directors of GTA had acted precipitously” and that the process followed had not complied with the good faith requirements of section 4 of the Act in respect of consultation and the provision of adequate information to the employee. The employer’s appeal was dismissed and Ms Brake was awarded $65,000 lost salary (the equivalent of 12 months’ income), $20,000 compensation and $16,000 actual legal costs. Employers must accept that their rationale and the outcome of a restructure will in future be subject to scrutiny by the Court. Best policy is to seek advice first!
In 2014, in an appeal from the Employment Court, the Court of Appeal again considered both sections 103 and section 4 in Grace Team Accounting Ltd v Brake (GTA). This decision confirms that in order to establish whether a dismissal for redundancy is justified, the employer’s rationale for the redundancy needs to be assessed by the Court, and that the Court must assess whether the redundancy would achieve the proposed result. The facts of the Brake case are that Ms Brake was employed as an accountant in October 2009 and was made redundant in April 2010. The South African

n today’s always-on, busy, busy, gotta-keep-up world, it should come as no surprise that stress-related illness is one of the biggest threats to our health and wellbeing. Even though it’s generally accepted that the physical aches and pains we suffer can be attributed to stress, we often don’t grasp the full extent of the connection.
Sometimes we even wear our stress like a badge of honour. It’s almost like the phrase ‘I’m so stressed’ has become the only acceptable answer to the question ‘How are you?’. Strange as it seems, not being burdened by stress seems less socially acceptable these days than being heavily burdened by stress - how did that happen?

In many cultures they have a tooth mouse collecting lost teeth. In Spain and Mexico children leave their teeth for Ratoncito Perez or the rat of teeth and similarly in France they have a tooth mouse called La Petit Souris or little mouse. Switzerland, Luxembourg, Argentina, Belgium and many other countries also have a tooth mouse visiting. The mouse actually predates the fairy and was first seen in a 17th century French story named ‘La Bonne Petit Souris’.

iving in New Zealand it’s easy to understand my continued love of taking pictures and why I had to start ALV Photography.
Pop, to the fashion catwalk of Durban Fashion Week, to the ordinary people in extraordinary situations, I captured it all. What a trip!
From the minute I arrived nearly 6 years ago I have felt an amazing kinship to this beautiful country. (As a good South African friend always says; the stork dropped him off on the wrong continent..... I feel the same way).

elicity Bosch was born in the Cape and immigrated to New Zealand 13 years ago. She has two daughters, a son and a grandson residing on the North Shore. Working for the Wairua Valley Special School she deals with children every day and understands their needs and the needs of the community. Her passion is being involved with the Rainbow Support Group (SA Support Group), a non-profit organisation established by Barbara Baumgart in 2001. This is an organisation which helps migrant families settle into New Zealand and assist with food parcels, furniture, clothing and guidance for those in need. Helping each other and remembering to pay-it-forward keeps them going. One of the ways to do this is to volunteer at the pre-Christmas lunch for the elderly which is held on the first Saturday in December at Mayfield Hall in Glenfield. Opportunities in the Auckland Unitary Plan The purpose of this article is to again make current and future property owners aware of potential opportunities so that they can make the best decisions related to their properties. (My previous article about the AUP was in Issue 32, May 2013).
At this stage, we have still only seen the Proposed AUP (Auckland Unitary Plan), and there will be changes..!!! Timeline (summarised) Draft AUP was released 15 March 2013 Public consultation and changes to end August 2013 Proposed AUP was notified on 30 September 2013 Submission to July 2014 and Hearings to April 2016 Final version of AUP – probably late 2016.
For example, the Residential 4B zone in the historic North Shore District Plan allows subdivision down to 450m2 (subject to conditions).
This process will create a blueprint for the development of Auckland.
My recommendation is for readers to go to the council website, find the Proposed AUP, check what zone their property is in and read the rules for their zone.
The Auckland population was 1,486,000 in 2011 and is expected to rise by one million people over the next 30 years. The Draft AUP proposed that 280,000 of the new homes required be located in the existing urban areas, and that 160,000 be built in four main “future urban” areas. The proposed “future urban” areas have already experienced large land price increases. The proposed densification of the existing urban areas also creates opportunities.

Many of these properties fall into Mixed Housing – Suburban in the Proposed AUP, where subdivision to 400m2 is proposed, but potentially to 200m2 for properties with land areas over 1200m2 and street frontages of 20m or more (also subject to conditions).
Be aware of opportunities such as buying your neighbours property if they sell, or if you want to sell, speak to your neighbour about jointly marketing both properties. But remember – the plan you are viewing is the Proposed AUP, and there will be changes before the final AUP is released. A zoning map from the Proposed AUP is attached as an example. Usually, as we get older and life circumstances begin to change such as getting married, buying our first home, having children, etc, only then do we start thinking about our financial situation.

If you died or became disabled how much would you or your family need? You will probably also need disability cover, trauma, income protection insurance and health insurance because you are more likely to be disabled than to die. If it only covers the mortgage payment or debts it probably isn’t sufficient as you still need to pay bills, eat and continue with your normal lifestyle. Not insuring your partner Think about all the scenarios that could affect you and your family and make sure you have a plan in place. Your ability to earn can be affected by the non-working spouse dying or falling seriously ill especially if there are children. You might need to take time off work and there are costs, such as childcare. The lesson here is to think about all the scenarios that could affect you and your family. We suggest that a person choosing an insurer should also look at financial strength, policy quality and customer service, including the insurer’s reputation at claim time. Insurers have to disclose their financial strength rating and there are good independent sources of policyquality ratings. These will help you avoid nasty surprises like an insurance policy that may have exclusions or conditions other policies don’t have.
