From the editor Good Day,

W

e have recently returned from a three week seminar tour in South Africa. The weather was good and, by and large, it was warm throughout the trip with the exception of a few days of rain and heavy wind. Reading the daily newspapers was frightening. Front page news: SA has 51 murders a day so murder is up, house robberies are up, hijacking up but sexual offences are down. Some good news! Reports of the ANC in-house squabbling is expected to devalue the Rand by 30%. SAA is in financial trouble and is ‘being flown into the ground’. They have huge debt and some international airports are preventing them from landing. That’s the news on any given day but who reads the newspapers or watches SABC news anymore? Not many. People live in a secure little bubble surrounded by high walls and razor wire. The demand for gated communities is high and properties in these secure areas are at a premium, fetching good prices. Estate Agents do not have open homes in most areas as it’s too dangerous due to theft, assault and rape. On the face of it, South Africa looks good, everyone still smiling and laughing but underneath, the tension is almost tangible. One thing I noticed about most people is that they spend a fortune on fashion, shoes and hairstyles but when asked if they have money the answer is no. They live on credit. A hand-to-mouth existence which is not good and it’s getting worse. On a good note, we went to some great restaurants and with the exchange rate prices were a mere pittance of what the locals pay. Crayfish for $30.00! I like a good steak and am a little fussy on how it’s cooked but some of the big-headed chefs disregard the waiters’ orders from customers and serve it their way, irrespective. At the end of my trip I can honestly say that it is hard to beat a Bushman’s Grill steak, cooked to perfection, with sauces to die for. Well done, Bushman’s Grill. You are certainly one of the top 5 steak houses in the world. All I can say to the South Africans who made the hard choice to immigrate to New Zealand, you have made the right decision for your family. We should all be very grateful. I am! Happy Reading! LEGAL UPDATE: EMPLOYMENT LAW

A bird in the hand is worth two in the bush – the risk and the cost of not claiming what is due, when it is due! Some words of wisdom from Employment Law Barrister, Eska Hartdegen

I

wish to pose a question. What should an employee do, who is entitled to a substantial annual bonus calculated on the gross sales of their employer’s company, the bonus is paid to them monthly, and the employer simply at some moment stops paying the bonus? This was the circumstance that arose in the case of Thompson v 88 C-Force Textile Industries Limited. An employee since 1999 and promoted to the position of General Manager (GM) in 2001, the parties negotiated an agreement in 2005 that the GM would be paid a higher percentage annual bonus on the annual turnover he personally was responsible for, where the turnover was in excess of $2 million. In mid-2008, the employer attempted to reduce the bonus payable. After failed negotiations to reach an agreement, the employer simply stopped paying the bonus. Instead of taking any steps in response to this action to recover the bonus, the employee continued to work on as GM, regardless. In late October 2011, the GM’s role was declared redundant. At that point a claim was filed under section 131(a) of the Employment Relations Act 2000 for recovery and reimbursement of the arrears of the bonus sum of $201,751.39, plus holiday pay of 8%, plus interest on those two sums. The GM’s explanation in the Employment Relations Authority (ERA) for doing nothing to recover his bonus payments for the three years was that he was concerned at the time about losing his job, and that he viewed his unpaid bonus “as a nest egg” which was accruing to him throughout his employment. In response to the claim, the company lodged a counterclaim against the ex-GM claiming that he had been overpaid bonuses of $266,000 between 2005 and 2008. The counterclaim was dismissed, with the Authority Member saying that the company “wrongly calculated his bonus entitlement based on total company sales instead of his personal sales only".

bonus and which set out its method of calculation, the GM’s claim succeeded. The company could only challenge the meaning and interpretation of the clause, not the fact that the GM was entitled to a bonus. Nor could the employer alter the bonus entitlement. A well-drafted employment agreement and bonus provision affords certainty and will result in a successful outcome. There always will be risk attached to not claiming what is due, when it is due. Where a dispute arises, as it did in this case, the litigation costs involved are a resulting expense for both parties, however, both employees and employers stand to benefit from seeking advice while contract terms are negotiated and before contracts are finally signed.

The company's argument that by failing to bring the matter up, the ex GM had accepted the change to his bonus payments was rejected by Authority. Instead, the Authority Member held that it was the GM’s right to decide at what point he wished to make the claim for arrears bonus. Although the company was ordered to pay $185,144.72 in arrears bonus, the Authority Member awarded no interest in respect of the bonus nor his holiday pay entitlements. Thus the GM forfeited at least his holiday pay on the sum, which arguably he would have accrued had the bonus been paid all along. Most importantly and fortunately for the GM, his employment contract had been drafted by his own lawyer, and not by the company’s lawyer. Brushing up on your oral hygiene routine By Sandra Bekker, East Coast Bays Dental

G

ood oral hygiene is not only imperative in preventing cavities and maintaining a healthy bright smile but is also important in overall health. Think you know everything about how take care if your teeth? Well, it takes a bit more than a quick clean to fight off cavities, tooth loss and bad breath.

Brush your teeth twice a day Do not rush! Remember that you have to brush at least 2 minutes at a time to do a thorough job. Use a soft bristled brush and a fluoride-containing toothpaste. You could also consider investing in an electric toothbrush as it has a slight advantage in improved plaque removal than a manual brush. It also has the perk of being easier to use especially if you have arthritis or other problems which could make tooth brushing more difficult.

Don't skimp Use enough floss- about 40 cm. Wind most of it on the middle finger of one hand and the rest on the middle finger of the other hand. Hold it tight with the thumb and fore finger.

Proper technique Gentle brushing with a circular motion and the bristles angled upward toward the gum is indicated. Brush the inside, outside and chewing surfaces of the teeth as well as the tongue for optimal oral health. Store the brush in an upright position and let it air dry between brushing. Never keep it covered as mould, bacteria or yeast can form on it. Know when to replace your toothbrush Ideally it should be replaced every 3-4 months or sooner if the bristles become frayed.

Take it one tooth at a time Gently guide the floss in the space between the teeth using an up and down rubbing motion. Work systematically in a C shape around each tooth and never snap or force the floss. Unwind fresh floss before you move on to the next tooth. If you find using floss difficult to manage try using an inter-dental cleaner such as pre-threaded floss or tiny inter-dental brushes. Use a fluoride-containing mouth rinse This could be used in addition to brushing and flossing to promote healthy teeth and gums. Visit the dentist regularly For optimal dental health it is very important to have regular professional cleanings and checkups. Contact your dentist if you notice any bleeding or swollen gums, loose permanent teeth, persistent bad breath or unusual sensitivity as this could indicate a problem. Remember that prevention and early detection of problems can help promote a lifetime of good oral health and save a lot of money on dental treatments in the future. E

ven growing up with my brother, Shane, he was a chef in the making. He was always in the kitchen with Mom and cherished our visits to Ouma to learn more about cooking. Shane was a real bushman and loved the African outdoors. He often reminisces that eating ‘sadza ne nyama’ out of a cast iron skillet in Kariba with Dad was the best meal of his life. He loved food with lots of flavours from a young age and was always experimenting with different recipes and tweaking them to his liking. After a year in retail, Shane and Dee together with my husband, Gerard and I opened Bushman’s Grill in Northcote on the North Shore. We’re ‘Wild about food’ and passionate about creating a memorable dining experience. Shane, with his Gordon Ramsey type personality, and his commitment to quality and flavour encapsulation has not disappointed. We have just been awarded our second Trip Advisor Award of Excellence. He completed a Cordon Bleu cooking course at 17 years of age which further enhanced his culinary talents. However, after school an interest in electronics lead him into Electrical Engineering. When he completed his studies, he went to assist our father with the running of a newly purchased restaurant. Together with Deidre, his childhood sweetheart, they managed DV8 together for the next ten years, earning the reputation of ‘Steaks you leave home for’. Deidre continued to run DV8 for many more years as Shane again assisted our father to launch another family-run a business. King Pie Harare was born, a pie franchise from Namibia that was enjoying popularity in South Africa. Shane and our younger brother Dean operated the business from the central kitchens, which provided our many bake-offs around the city. I established a large wholesale side of the business. When Zimbabwe’s economy collapsed, and we could no longer import the prepacked spices from the Franchise holder in Namibia, Shane developed new and even better approved recipes. This afforded the continuation and expansion of the business for the next ten years. Shane and Dee owned and operated a popular restaurant in Hermanus, Rossi's, for seven years when we immigrated to South Africa in 2003. In 2011 they joined other family members in Auckland where Shane worked as a manager in a large retail chain. The South African

Financial Strength rating systems – what’s it all about?

T

he New Zealand insurance industry has been through an overhaul in the last few years. Our nation has gone from one of the least regulated insurance industries in the world, to enforcing strict licensing and regulatory requirements for insurance providers.

In 2010 the Insurance Prudential Supervision Act was released (and an Amendment Bill released in 2012), requiring insurance provider companies and their products to be scrutinised by independent regulators with ratings then publicised. There are three approved rating agencies in operation in New Zealand:

These agencies provide assessment criteria and alphabetical rating systems to communicate the financial strength of a company. But what do these rating systems tell us and what do the ratings mean? These rating systems provide a continually reviewed independent and professional indication of any one company’s financial strength. This gives consumers an indication on a provider’s creditworthiness (relating to their ability to pay claims) and distinguishes between high and low risk companies available in the market. Ratings do not offer any guarantee; rather they provide a benchmark that compares qualitative and quantitative criteria to produce an overall rating. Some of the criteria taken into consideration include both internal (business) and external (financial/environmental) risks, including potential risks presented by a company’s legal structures, their practices, policies and procedures, and looks at company assets and how they are managed. Once assigned, ratings are made available through websites, printed communications and disclosures, and all policyholders must be notified

My paintings are my way of saying, ‘here I am’. I started exhibiting after my first three ! ! ! paintings and I was lucky enough to ! begin selling. I was also teaching too until my body said no more. ME/CFS hit me and stole my life as I knew it. I attended the Learning Connexion Art School in Wellington on a part-time basis of 15 hours a week, receiving my Honours Diploma in Art and Creativity Level 6. Although I still cannot sweep my own floors, I have my painting waiting for me when I’m feeling the need. Most days, I step back and look at a painting I’ve just completed and wonder, ‘how did that happen’. Today I paint what I’m feeling in the moment, and am getting my life back. very country has its own lingo and slang that are commonly used by true locals and New Zealand is no exception. From chur to chook, it’s not an easy ride being the newbie in town. Refer to this guide and you’ll be passing yourself off as a true Kiwi/Jafa in no time—don’t worry, you’ll find out what a Jafa is soon enough! 1. Dairy: Corner store selling day-to-day essentials. 2. Lolly: Candy and sweets. 3. Bach: Holiday home pronounced ‘batch’. If you’re anyone in New Zealand, you will own one. 4. Jandals: Flip flops/thongs. The closest thing to going barefoot (which Kiwi’s love by the way!).

The Beautiful Cook Islands By Janine Tuzza

As South Africans we love the outdoors, braais and having fun. A client of mine, Luke Meintjies, recently visited the beautiful Cook Islands. Over lunch we had fun reminiscing about his trip and here are some of the things he enjoyed, as well as tips for holidaymakers.

NZ$100 per person per day (based on 6 guests). This provides all the comforts of home, with 3 en-suite bedrooms, only 20 meters from the beach, with free use of the kayaks. A great way to do your own thing!

Flying Virgin Australia was the airline of choice on a ‘seat and bag’ option. For the 4 hour flight this was adequate with coffee, tea and water offered. A good idea is to download an APP prior to flying which allows you to download movies once on board.

A good hint is to pre-book any excursions as these fill up really quickly. Things like pub crawling, having a dinner with the locals in their homes, deep-sea fishing, quad biking in the central part of the island and a glass bottom boat taking you snorkelling on the reef. Take an underwater camera - well worth it.

Transfers came in at about NZ$20 pp one way and it was a squashed ride with many other travellers in a hi-ace. Felt like home! Interestingly with their party of six it was cheaper to hire a 7-seater van for the day of your departure and drive yourself to the airport.

Matua Craft Beer is worth a visit. Cost NZ$10 and you get 2 beers and a great presentation on how craft beer is made. They explain how they source their hops and here is something interesting for nothing – hops are best if grown above 35 degrees latitude.

Scooter hire is a fantastic way to see the Island. No helmets though. Scary!! But then the roads are just one lane and the speed limit is 50kms. Cost of a scooter hire can vary from NZ$16 – 20 per scooter depending on the duration of hire.

Food when you self cater is not an issue. You just have to be creative. On Luke’s trip each couple vacuum packed a meal for one of the nights, so on arrival they had 3 meals already set up for preparation. Other nights were spent eating out and prices reasonable. There are lovely restaurants at hotels and small places all over. Just look at the menus and costs first so there are no surprises. Purchasing food from a grocer can be expensive as most produce is imported. 2 litres of fresh milk for instance costs around NZ$9 so long life is the milk of choice.

BE AWARE: You need to do a little test to see you can keep the scooter standing up, together with your New Zealand drivers’ licence. This is done at the scooter hire company. Cost is FREE. Then you are free to ride! Luke and party hired a self-catering bach for the 6 of them which came in at about

Punanga Nui Markets in town is a fresh produce market. A great way to shop and you get the island feel. Get there early to get the best quality produce. Thursday nights from 5pm is the start of the Muri Markets where locals cook great good quality meals to local music. If you wish to mix in local culture and meet locals and fellow travellers this is a must. Trader Jacks in town is good value for pizzas and burgers. Sails restaurant is another great choice and the restaurant looks out over the lagoon. Eat and enjoy while the sun sets. Something different that is becoming popular is Kayaking/Paddle boarding at night. The Kayaks/paddle boards have lights underneath and this attracts the fish. An amazing experience! A good idea is to take a walk along the beaches. You will come across hotels with great bars and entertainment. Ah yes and not only do people fish. Luke saw a dog fishing for his dinner. And quite successful he was too! Charter a fishing boat for 6 hours at NZ$170 pp. So next time you are looking for a place to chill and take in some Vitamin D, give Tuzza Travel a call.
