AMPR: Gov’t must act on precarious financial situation of retired educators By THE STAR STAFF

uerto Rico Teachers Association (AMPR by its Spanish initials) President Víctor Manuel Bonilla Sánchez demanded on Tuesday that the government take action to address the indigence of retired teachers. He also announced that he has presented a series of proposals in that direction that include increasing the pensions of retirees and reestablishing the prescription drug bonus and the employer’s contribution to the medical plan. “Following the restructuring of the public debt, the government continues to allude to the restoration of the state’s financial soundness and the projections of economic growth in the country,” Bonilla Sánchez said at a press conference. “For this reason, we demand that our claim be heard and that funds be identified and allocated to correct the situation in which retired teachers live. Not making these changes now will have greater repercussions in the future.” The labor leader added that there is also room to consider other bonuses to compensate for the loss of retirement benefits that have plagued retirees over the past decade. The proposals were discussed in meetings

that began in early October with several senators and representatives of almost all political parties. Bonilla Sánchez noted that more than 44,000 retired teachers in Puerto Rico have an average income of $20,000 per year or below. In addition, in the past 10 years teachers have suffered significant losses in retirement benefits and since 2007 retired teachers have not received a cost-of-living adjustment to their pension, which represents a further reduction in benefits and lower return on pension income as living costs rise. “This loss of benefits has put a large majority of our retired teachers on or near the federal poverty line,” added Dr. Fredeswinda Valentín Valentín, president of the AMPR’s Department of Retired Teachers. “The situation is aggravated considering that all the teaching staff of the Department of Education did not have the privilege of contributing to Social Security, so, in their older adulthood, all those now pensioned do not have access to Social Security and its benefits, which includes Medicare, on their own.” According to a doctoral dissertation by former Elderly Advocate Rossana López León, the general perception of retired teachers --

one that is reinforced by recent data -- is that they do not have enough money to cover their monthly expenses. “This means that their quality of life is not guaranteed and many have the need to return to part-time work,” López León said. “They also face constant anxiety and diminished health, as well as social isola-

tion. Meanwhile, the economic situation of retirees will result in dependence on government services which, in more aggravated circumstances, will be more costly.” “Faced with this situation, it is urgent to develop public policy that addresses the economic insufficiency of current and future beneficiaries,” she added.

LUMA to install 1.5 million meters, launch text notification system By THE STAR STAFF

UMA Energy announced onTuesday the federally funded Meter Modernization Initiative (MMI), which will install over 1.5 million next-generation electricity meters and the launch of the Customer Service Text Notifications to update customers via cell phones on reported service and billing requests. The information is contained in a statement in which LUMA, the private operator of the Puerto Rico Electric Power Authority’s transmission and distribution system, also provided a progress update on its initiatives. During the year-end review, LUMA also highlighted the state of progress across a number of critical areas, with updates on its efforts to clear vegetation, modernize substations, replace poles and streetlights, install automation devices and deploy new and enhanced customer tools and communications. “We are committed to making progress every day and sharing regular updates with all Puerto Ricans. As part of that commitment, we’re very excited to announce two major initiatives, the Meter Modernization Initiative and Customer Service Text Notifications,” said Juan Saca, president and CEO of LUMA. “These two initiatives will help build a better energy future for all our customers by providing LUMA with information we need to restore power more quickly when outages occur, while also providing text-based, timely updates along the way.” Before the summer of 2024, LUMA will begin the instal-

The customer service improvement includes updates on service interruptions and emergency situations that have been reported by a customer, including estimated times of restoration to keep customers informed, bill payment information and information on bill adjustment requests. During LUMA’s year-end review of its Building a Better Future work plan, which was first announced three months ago, the company also said it installed more than 1,200 grid automation, devices totaling more than 3,000 devices to date on critical infrastructure to make outage impacts smaller and shorter; repaired and replaced more than 1,000 utility poles across the island, totaling more than 10,300 to date; started reconstruction at three substations; cleared vegetation from over 200 miles of powerline rights-of-way across 59 municipalities; and installed 25,500 streetlights, totaling more 78,000 streetlights. In October, LUMA launched the Customer Battery Energy Sharing initiative, a battery emergency demand response program to help improve service reliability across the island. Five renewable service providers have joined the program and more than 1,700 customers have enrolled since the program launched.

Union calls on gov’t to crack down on employers that don’t pay Yule bonuses By THE STAR STAFF

he Trade Union Solidarity Movement (MSS by its Spanish initials), a union representing private sector workers, chided Labor and Human Resources Secretary Gabriel Maldonado González on Tuesday for failing to supervise employers who do not pay Christmas bonuses. The Department of Labor and Human Resources announced that 43,955 employees will not receive Christmas bonuses this year. The MSS said each year, the same names appear in the list of employers that do not pay bonuses. “Year after year, we see in the list of employers who do not pay Christmas bonuses that several companies continually repeat this bad practice,” union representative José Rodríguez Vélez said. “Security guard companies, private schools, cleaning companies, hospitals, and the last straw are fast food restaurants, which do not pay a bonus. Still, from time to time, they open a new establishment.” The union leader expressed surprise that fast food restaurants that pay a “pittance of $2.13 an hour and sell a bottle of water for

RodríguezVélez noted that private security companies and private schools have been appearing on the list for five years in a row. “How can they not generate profits after not paying the bonus for so long?” he said. “Maybe they use creative accounting or ask not to pay the bonus, and the Department of Labor is not effective enough to investigate the finances of the private companies that do not pay the bonus.” In the 2017 labor reform, an employee must work 1,350 hours to acquire the benefit of the Christmas bonus; before the reform, they had to work 700 hours. “Then employers at all levels complain that people do not want to work, but they cannot provide a fair bonus, since with inflation, we know that $600 does not go far, and in the worst case, there are employers that don’t want

to pay it,” Rodríguez Vélez said. Rodríguez Vélez called on the labor chief to deny the requests of employers seeking to avoid paying the Christmas bonus when they have appeared on the list for two consecutive years. He also asked the agency to be more thorough in evaluating creative accounting

requests and, finally, to require restaurants that pay $2.13 an hour but open new restaurants to pay the bonus. The MSS represents hundreds of employees of private companies in Puerto Rico, mainly Pepsi Cola, Coca Cola and Partner Business Services.

Senate president takes dim view of court’s ruling on SEC By THE STAR STAFF

S

enate President José Luis Dalmau Santiago expressed his discontent Tuesday with an island court ruling that leaves Jessika Padilla Rivera in place as interim chairperson of the State Elections Commission (SEC). Dalmau Santiago emphasized that the stability and legitimacy of the entity in charge of electoral processes should not be subject to questions or controversies. “Puerto Rico’s electoral system is the backbone of our democracy where voters, political parties, and elected officials from the executive and legislative branches place their trust,” Dalmau Santiago in a written statement. “The legitimacy of those who direct the State Elections Commission and, therefore, the final decisions of the processes leading to primaries and the general election and, subsequently, the counting of the votes and the allocation of officials of a new government, under no circumstances should be in question.” He argued that the current situation, marked by the indefinite occupation of the interim position by Padilla Rivera and the governor’s resistance to presenting a confirmable appointment, has generated a legitimate dispute between the executive and legislative branches.

“The judiciary on both occasions has contributed to preserving distrust in our electoral system by circumventing what the Electoral Code says and thereby maintaining a state of instability, depriving the people of Puerto Rico of having a named and confirmed SEC chairperson …” the Senate president said. “The court’s determination allows us to be in an election year process for the first time in our democratic history without a person occupying the position of [SEC chairperson].” “As president of the Senate, I have appealed on two occasions to the Court of First Instance to decide that the alternate chairperson cannot occupy the position of interim chairperson indefinitely and that the governor must submit the appointment of the actual chairperson as soon as possible,” Dalmau Santiago added. “I also asked the Supreme Court to hear the case and it declined to do so.” The veteran lawmaker said he held the executive and judicial branches responsible for any conflict that arises from this point forward, stressing that the weight of any controversies will fall on them in the court of public opinion. “Since the Judiciary does not recognize the clear letter of the law or the order that must prevail in our electoral system, and seeing its particular way of proceeding – where the basic

principle of separation of powers is ignored – it is up to each person to assume their responsibility for their decisions and actions,” Dalmau Santiago said.

uan Luis Camacho Semidei, a political analyst and legislative adviser to the Popular Democratic Party (PDP), officially announced his candidacy for at-large representative onTuesday. Camacho Semidei said in a press release that he seeks to bring his experience in both public service and private enterprise to the House of Representatives in order to address the challenges and opportunities facing Puerto Rico. Currently serving as an aide to Senate President José Luis

Dalmau Santiago, Camacho Semidei noted that among his main concerns are the difficulties faced by the island’s education system, the crisis in health services, and access to adequate services for the care and attention of Puerto Rico’s elderly. He added that he would introduce legislation that is accompanied by fiscal, social and economic studies. Among his main proposals are: 1) Transfer the maintenance of schools to the municipalities with the necessary resources; 2) Encourage health professionals to stay on the island by making the career field attractive

and non-punitive; 3) Reform social assistance systems so that working parents and/or people who care for their elderly family members are not prevented from contributing to the economy; 4) Legislate with fiscal and social studies to measure the impact on fiscal health and families. “I strongly believe in economic development, accessible and quality education, and a health system that encourages prevention and effectively addresses the needs of our citizens,” the candidate said. “My priority will be to present legislation in favor of our children, the working class and our seniors.”

NWS warns of dangerous rip currents through Friday By THE STAR STAFF

T

he National Weather Service (NWS) in San Juan is warning of a high risk of dangerous rip currents on the northwest and northeast coasts of Puerto Rico and Culebra, effective through Friday afternoon. Affected beaches will face life-threatening rip currents due to the heavy surf, with breaking waves between six and eight feet, and occasionally higher, the NWS said. Rip currents are powerful, fast-moving channels of water that flow offshore and can drag even the most experienced swimmers away from shore into deeper water, making it difficult for them to return. The NWS emphasizes the importance of following the recommendations of lifeguards and heeding beach patrol flags and signs. Rip currents most often occur at low points or breaks in the sand barrier and near structures such as jetties and piers.

Later on Tuesday, Bureau for Emergency Management and Disaster Administration Commissioner Nino Correa Filomeno followed up on the NWS’ warnings and offered details of several emergency situations that occurred over the weekend, such as the rescue of three people in Playa Escondida in Fajardo, and the recovery on Monday of the body of a 25-year-old man at the same site. Correa Filomeno outlined “at least six situations” over the weekend in which people had to be rescued from the water and the loss of more lives was avoided, including incidents in Isabela, Ocean Park in San Juan, Río Grande, Loíza and Ceiba. In case you are caught in a rip current, the NWS advises calling for help and staying calm, avoiding exhaustion and staying afloat while waiting for assistance. If possible, swim parallel to the shore and back toward the beach, but do not try to swim directly against the rip current, as this can quickly lead to exhaustion.

Special counsel asks Supreme Court to decide whether Trump is immune from prosecution

ack Smith, the special counsel prosecuting former President Donald Trump on charges of plotting to overturn the 2020 election, asked the Supreme Court earlier this week to rule on Trump’s argument that he is immune from prosecution. The justices quickly agreed to fast-track the first phase of the case. Smith’s request was unusual in two ways: He asked the justices to rule before an appeals court acted, and he urged them to move with exceptional speed. “This case presents a fundamental question at the heart of our democracy: whether a former president is absolutely immune from federal prosecution for crimes committed while in office or is constitutionally protected from federal prosecution when he has been impeached but not convicted before the criminal proceedings begin,” Smith wrote. On Monday evening, just hours after Smith filed papers in the Supreme Court, the justices granted his initial request: to put their consideration of whether to hear the case on a fast track. The court ordered Trump’s lawyers to file their response to the petition seeking review on an abbreviated schedule, by Dec. 20.

Smith’s filings represented a vigorous plea to keep the trial on track by cutting off an avenue by which Trump could cause delays. A speedy decision by the justices is of the essence, Smith wrote, because Trump’s appeal of a trial judge’s ruling rejecting his claim of immunity suspends the criminal trial. The proceeding is scheduled to begin March 4 in U.S. District Court in Washington. Any significant delays could plunge the trial into the heart of the 2024 campaign season or push it past the election, when Trump could order the charges be dropped if he wins the presidency. “The United States recognizes that this is an extraordinary request,” Smith wrote. “This is an extraordinary case.” The trial judge, Tanya Chutkan, rejected Trump’s sweeping claims that he enjoyed “absolute immunity” from the election interference indictment because it was based on actions he took while in office. In her ruling two weeks ago, she condemned his attempts to “usurp the reins of government” and said there was nothing in the Constitution or American history supporting the proposition that a former president should not be bound by

the federal criminal law. Trump appealed the decision to the U.S. Court of Appeals for the District of Columbia Circuit. He also asked Chutkan to freeze the election interference case in its entirety until the appeal was resolved. In his Supreme Court brief, Smith conceded that the election case could not be decided until after the appeal of the immunity issue was resolved. On Sunday, his team filed papers to Chutkan asking her to keep the March 4 trial date and saying she could still work on certain aspects of the case even as the appeal was being heard. In what appeared to be an attempt to cover all bases, Smith’s team also filed a request to the appeals court in Washington on Monday to decide the immunity question quickly. Winning the appeal of the immunity decision was only one of Trump’s goals in challenging Chutkan’s ruling. All along, he and his lawyers have had an alterative strategy: to delay the trial for as long as possible. If the trial were put off until after the election and Trump were to win, he could have his attorney general simply dismiss the charges. Holding a trial after the presidential race was over would also mean that voters would not get to hear any of the evidence that prosecutors have collected about Trump’s expansive efforts to reverse the results of the last election before weighing in on whether to elect him again in 2024. Even if Trump’s lawyers are unable to postpone the trial until after the presidential race was decided, they are hoping to push it off until the heart of the campaign season in August or September. That would present Chutkan with a difficult decision: Should she hold the trial at a time Trump could be out holding rallies and meeting voters and suffer what are sure to be his vociferous complaints or make the decision herself to delay the trial until after the race is over? Smith urged the justices to move fast. He asked the court to use an unusual procedure to leapfrog the appeals court, “certiorari before judgment.” It has been used in cases involving national crises, like President Richard Nixon’s refusal to turn

over tape recordings to a special prosecutor or President Harry Truman’s seizure of the steel industry. The procedure used to be rare. Before 2019, the court had not used it for 15 years, according to statistics compiled by Stephen Vladeck, a law professor at the University of Texas at Austin. As of late last year, he found, the court has used it 19 times since. Among recent examples in which the court bypassed appeals courts were cases on abortion, affirmative action and student debt forgiveness. A statement from Trump’s campaign called the request by Smith a “Hail Mary” attempt to get to the Supreme Court and “bypass the appellate process.” Smith’s request was based on an argument that prosecutors have used several times in the election interference case: that the public itself, not just the defendant, Trump, has a fundamental right to a speedy trial. As in the Nixon tapes case, Smith wrote, “the circumstances warrant expedited proceedings,” adding: “The public importance of the issues, the imminence of the scheduled trial date and the need for a prompt and final resolution of respondent’s immunity claims counsel in favor of this court’s expedited review at this time.” Smith asked the Supreme Court to consider a question it has never addressed before: whether the Constitution confers presidential immunity from criminal prosecution. Smith acknowledged that the Supreme Court said in 1982 that former presidents enjoy some special protections, at least in civil suits — ones from private litigants seeking money — and that the Justice Department has long taken the view that sitting presidents cannot be indicted. “But those principles cannot be extended to provide the absolute shield from criminal liability that respondent, a former president, asserts,” Smith wrote. “Neither the separation of powers nor respondent’s acquittal in impeachment proceedings lifts him above the reach of federal criminal law. Like other citizens, he is accountable for criminal conduct.”

resident Volodymyr Zelenskyy of Ukraine began his last-ditch pitch for additional U.S. aid for his country’s war effort after arriving in Washington Monday by declaring that the true winner of the stalled negotiations in Congress is Russia. “If there’s anyone inspired by unresolved issues on Capitol Hill, it’s just Putin and his sick clique,” Zelenskyy told national security officials at the National Defense University in Washington. The remarks represented a message to Congress, even as its chances of passing an aid deal have become increasingly bleak. They also marked Zelenskyy’s first appeals in a hastily organized trip to Washington that was also scheduled to include meetings with members of Congress and President Joe Biden on Tuesday. Zelenskyy and the White House have argued that supporting Ukraine would protect the West in the long term by preventing Russian President Vladimir Putin from trying to seize more of Europe, though polls show the American public has grown increasingly skeptical of financial assistance for Ukraine. “America will be more secure if we stand up to Putin’s increasingly aggressive Russia,” Defense Secretary Lloyd Austin said Monday, adding that “Putin still believes that he can outlast Ukraine and that he can outlast America. But he is wrong.” Biden is hoping Zelenskyy will not only sway members of Congress to pass a $110.5 billion emergency spending bill that includes aid for Ukraine but will also reiterate the importance of defending against Russia’s aggression. The visit comes a week after Republicans blocked the package, putting any future financial assistance for Ukraine in doubt. On Tuesday, the Ukrainian president will first visit

Biden and his aides have also warned that refusing to support Ukraine in the coming months could pave the way for a Russian victory. Republicans, however, have said that any Ukraine aid must be grouped with restrictions on asylum claims at the United States’ southern border and on another program Biden has relied on to allow Afghans and other refugees to stay in the United States temporarily, according to people familiar with the matter. They have also pushed for the national expansion of a rapid deportation policy. Democrats, with the support of the White House, have signaled support only for some of the restrictions on asylum, including a move that would impose a stricter definition for migrants to meet when they claim they need refuge because they fear persecution in their home countries. “There’s no way to get it done this week,” said Sen. James Lankford, an Oklahoma Republican involved in the negotiations. He said the only question is whether Congress stays in Washington next week and continues deliberating or picks up the talks in early January. “That’s a big unknown at this point.” Separately, Biden is also expected to approve another weapons package using existing funds for Ukraine this month, Kirby said. Republicans have grown more outspoken with their skepticism as it has become clear that Ukraine has struggled with its counteroffensive against Russia. While the United States has provided tens of billions of dollars in aid, Ukraine’s top military commander, Gen. Valerii Zaluzhnyi, said last month that the war had reached a stalemate, as deadly battles yielded few territorial gains.

Powell Jr. wrote for the majority, “we think it appropriate to recognize absolute presidential immunity from damages liability for acts within the ‘outer perimeter’ of his official responsibility.” Other Supreme Court precedents seem to be of no help to Trump. In Clinton v. Jones in 1997, the court unanimously allowed a sexual harassment suit against President Bill Clinton to proceed while he was in office, discounting concerns that it would distract him from his official responsibilities. Prosecutors said they also planned to call a witness who could talk about the specific times that day when Trump’s Twitter account was in use. Texas Supreme Court rules against woman who sought court-approved abortion By J. DAVID GOODMAN

T

he Texas Supreme Court earlier this week overturned a lower court order allowing an abortion for a pregnant woman whose fetus was diagnosed with a fatal condition, hours after her lawyers said she had decided to leave Texas for the procedure in the face of the state’s abortion bans. The court ruled that the lower court made a mistake in ruling that the woman, Kate Cox, who is more than 20 weeks pregnant, was entitled to a medical exception. In its seven-page ruling, the Supreme Court found that Cox’s doctor, Damla Karsan, “asked a court to pre-authorize the abortion yet she could not, or at least did not, attest to the court that Ms. Cox’s condition poses the risks the exception requires.” Texas’ overlapping bans allow for abortions only when a pregnancy seriously threatens the health or life of the woman. “These laws reflect the policy choice that the Legislature has made, and the courts must respect that choice,” the court wrote. The ruling, which applied only to Cox’s current pregnancy, suggested that the court would not be open to readings of the law that would expand the medical exception in Texas beyond all but the most serious cases. The fact that Cox decided to leave the state rather than wait for a ruling underscored the difficulty of seeking court permission for an abortion in the midst of a pregnancy. Cox asked the lower court for approval after she learned that her fetus had a fatal condition and after several trips to the emergency room. Her lawyers and her doctor argued that carrying the pregnancy to term risked her health and her future ability to have children. The legal authorization she obtained from the lower court was put on hold when Texas Attorney General Ken Paxton appealed to the state Supreme Court. But uncertain of when a ruling would come, her lawyers said Monday that she had decided to seek an abortion in a state where it is legal. “Kate desperately wanted to be able to get care where she lives and recover at home surrounded by family,” Nancy Northup, CEO for the Center for Reproductive Rights, which was representing Cox in her case, said in a statement. “While Kate had the ability to leave the state, most people do not, and a situation like this could be a death sentence.” The case was believed to be the first to seek a court-ordered exception since the U.S. Supreme Court overturned Roe v. Wade last

year, clearing the way for Republican-controlled states such as Texas to enact near-total bans on abortions. It marked a new chapter in the legal history of abortion in the United States, with pregnant women now going to court seeking permission for their doctors to do what they determine to be medically necessary without fear of severe criminal or civil penalties. Legal challenges have emerged in several states where doctors said the bans were preventing abortions even in cases of serious pregnancy complications. Last week, a Kentucky woman who was eight weeks pregnant filed a suit seeking to overturn that state’s bans. Cox’s case, filed last week, was unusual for being brought during her pregnancy. At the same time that the Texas Supreme Court was considering her case, it was also weighing an action brought by women and their doctors, represented by the Center for Reproductive Rights, seeking to clarify the limits of medical exceptions to the Texas abortion bans. That case, Zurawski v. Texas, involves women who said they were forced to continue pregnancies, despite dangers to their health, because the vagueness of the state’s exemptions made doctors extremely cautious about when a medical condition was serious enough to allow for an abortion. Cox’s husband and Karsan are also represented by the Center for Reproductive Rights. In its decision Monday, the Texas Supreme Court suggested a general standard that could be applied beyond Cox’s case. “The exception does not mandate that a doctor in a true emergency await consultation with other doctors who may not be available,” the court wrote. “The exception is predicated on a doctor’s acting within the zone of reasonable medical judgment, which is what doctors do every day.” Through September, Texas recorded only 34 abortion procedures performed in the state in 2023, according to state health statistics. In 2020, before the first of the state’s highly restrictive laws went into effect, there were more than 50,000. A spokesperson for Texas Right to Life, an anti-abortion group, lamented that, despite the court’s decision, Cox would be able to obtain an abortion elsewhere. “We mourn the decision to take Baby Cox’s life rather than give her every chance at life,” the spokesperson, Kimberlyn Schwartz, said in a statement. Lawyers for Paxton’s office argued in their appeal that Cox did not meet the criteria for a medical exception to the state’s overlapping

abortion bans, which are among the strictest in the nation, and said she was seeking an “elective abortion.” Cox’s fetus received a diagnosis of trisomy 18, a genetic abnormality that in all but rare cases results in miscarriage, stillbirth or an infant’s death within the first year after birth. Karsan, who is also a plaintiff in the Zurawski case, determined that an abortion would be the safest option for the mother’s health. Cox, a mother of two young children who has said she would like a big family, has been to the emergency room four times during the course of her pregnancy for symptoms including discharge and cramping. The lower court judge, Maya Guerra Gamble, a Democrat in the Travis County district court, agreed in her ruling that Cox could have the abortion under Texas law. Karsan “believes in good faith, exercising her best medical judgment,” that an abortion was the medically recommended course of action, the judge wrote. The judge issued a temporary restraining order barring Paxton and others from enforcing the state bans against Karsan, Cox’s husband and any medical staff members who assisted an abortion in her case. Paxton objected, first sending letters to three Houston hospitals where Karsan can admit patients, saying that the judge’s order was only temporary and would not protect them from civil or criminal penalties if they allowed Cox’s procedure. Soon after, Paxton appealed the lower court’s order to the Texas Supreme Court, whose nine members are all

Republicans. In their brief, state lawyers argued that to allow abortions to be performed based on the standard of a “good faith” determination of a doctor that they are medically necessary “opens the floodgates to pregnant mothers procuring an abortion” through a willing doctor. Under Texas law, a doctor convicted of performing an illegal abortion can face a prison term of up to 99 years and fines of at least $100,000. Lawyers for Paxton’s office argued that the standard for determining what constitutes a serious threat was clear: a doctor’s “reasonable medical judgment” that a pregnancy posed such a risk; they said Cox did not meet that threshold. The court agreed with the state, finding that the “good faith” standard had been applied by the lower court in error and that the correct standard, under the law, is a “reasonable medical judgment.” It asked the Texas Medical Board “to provide guidance in response to any confusion that currently prevails.” “Judges do not have the authority to expand the statutory exception to reach abortions that do not fall within its text under the guise of interpreting it,” the Supreme Court found. “Our ruling today does not block a lifesaving abortion in this very case if a physician determines that one is needed under the appropriate legal standard, using reasonable medical judgment,” the court added. “If Ms. Cox’s circumstances are, or have become, those that satisfy the statutory exception, no court order is needed.”

T

he price of Bitcoin is surging again. Major financial firms are showing renewed interest in digital currencies. And crypto fanatics are celebrating the end of a long period of depressed prices and business collapses. But the sudden explosion of optimism has come at a turbulent moment for the cryptocurrency industry. The last time crypto prices were skyrocketing, the industry’s most influential executives were Sam BankmanFried and Changpeng Zhao, rival billionaires whose online sparring could move markets. Now Bankman-Fried, founder of the FTX crypto exchange, and Zhao, who ran the world’s largest crypto firm, Binance, both face prison time after parallel falls from power. A federal jury convicted Bankman-Fried last month on fraud and conspiracy charges stemming from FTX’s collapse. Three weeks later, Zhao pleaded guilty to a money laundering charge and agreed to relinquish control of Binance. With the two men out of the picture, a crowded field of crypto entrepreneurs, Wall Street executives and government regulators are vying to control the industry’s next chapter. Their scramble for influence could determine whether crypto survives in the United States, where a regulatory crackdown has made it increasingly difficult for the industry to operate. Some executives have argued that the crypto world needed to purge figures like Zhao and Bankman-Fried — aggressive entrepreneurs who gave priority to growth over compliance — to win over regulators and the public. After Zhao’s guilty plea, Brian Armstrong, CEO of the U.S.-based crypto exchange Coinbase, hailed the case as a turning point for the industry. “We now have an opportunity to start a new chapter,” Armstrong posted on social media last month. “This industry should be built right here in America, in a compliant way, under U.S. law.” But the crypto world remains filled with companies that engage in risky business practices and don’t offer much transparency about their experimental products. “There is no intrinsic value to any of this,” said Hilary

A year ago, Sam Bankman-Fried and Changpeng Zhao ran two of the largest crypto companies. As they grapple with legal woes, others are jockeying to lead the industry’s next chapter. The vision behind bitcoin, the original and most valuable digital currency, was first laid out by someone using the pseudonym Satoshi Nakamoto, whose mysterious identity became its own brand. As the crypto world expanded, new centers of power and influence emerged. Zhao founded Binance in 2017 and built it into the world’s largest marketplace for buying and selling experimental coins. The exchange’s size and reach turned Zhao into a star on Twitter, now known as X, where he accumulated more than 8 million followers, dismissing government lawsuits and allegations of illegal conduct as disinformation spread by crypto’s enemies. Zhao’s chief rival was Bankman-Fried, who appeared on billboards and magazine covers, cultivating a persona as the responsible adult who would help the fledgling industry work with regulators. In the end, both Zhao and Bankman-Fried fell from grace. Bankman-Fried is set to be sentenced in March and faces the prospect of decades behind bars. Zhao is likely to receive a lighter sentence, with prosectors expected to request about 18 months. “Having those characters not in the plot anymore is a really good thing,” said Jeremy Allaire, CEO of the crypto company Circle. “I’m focused and have been focused on:

How do we make this useful for the world?” A new generation of executives is already emerging as the industry’s top cheerleaders. Paolo Ardoino, an outspoken crypto enthusiast with a vast online following, recently took over as CEO of Tether, the company that oversees one of the most popular digital currencies. At Binance, Zhao was replaced by Richard Teng, a key executive at the exchange who had been groomed to step into Zhao’s shoes. On paper, Teng is Zhao’s opposite. The Binance founder was antagonistic toward regulators, while Teng is a veteran of the Monetary Authority of Singapore, the country’s central bank. Binance’s future is uncertain. As part of a settlement last month, the company agreed to pay a $4.5 billion fine to several government agencies and have a U.S. monitor embedded in the business for the next three years. “My general sense is there’s a real ‘wait and see,’” Allaire said. “I don’t think anyone knows the details of what that monitorship means.” A Binance spokesperson did not respond to a request for comment. Arguably the biggest beneficiary of crypto’s current reshuffle is Coinbase’s Armstrong, who declared this month that bitcoin “may be the key to extending western civilization.” Coinbase’s share price has nearly tripled over the past six months, even after the Securities and Exchange Commission sued the firm as part of the agency’s broad crackdown on the industry. “Coinbase is now the last man standing,” said John Todaro, an analyst at Needham who tracks the crypto industry. “There’s less competition out there.” Coinbase has also positioned itself to profit from a potentially seismic development in the crypto world — the possible approval of an exchange-traded fund, or ETF, that tracks the price of bitcoin. In recent days, bitcoin’s price has surged to over $43,000, its highest level since a wave of bankruptcies sent the industry into crisis last year. Much of the enthusiasm is fueled by growing confidence that the SEC is poised to approve a bitcoin ETF that would trade on traditional stock exchanges, potentially bringing new money into the industry. Coinbase has agreed to store the bitcoin that would underlie an ETF offered by BlackRock, one of the world’s largest asset managers. BlackRock is the biggest of several major financial firms, including Fidelity, that have applied to offer the investment product. Wall Street was once the enemy of the insurgent crypto industry, but after a bruising 18 months of bankruptcies and arrests, crypto proponents have greeted the collaboration between Coinbase and BlackRock as a potential salvation. “Crypto isn’t disrupting Wall Street; it’s merging with it,” Allen said. “It’s fairly obvious — they think they can make some money here.”

Wall St rises modestly after inflation data, Fed on tap U .S. stocks edged higher on Tuesday to push the major indexes to new highs for the year, after inflation data did little to alter expectations for the timing of a rate cut by the Federal Reserve, as investors eyed the central bank’s last policy decision of the year on Wednesday. The November Consumer Price Index (CPI) rose 3.1% on an annual basis, in line with estimates from economists polled by Reuters, as a drop in gasoline prices was overshadowed by a rise in rents. Core prices, excluding volatile items such as food and energy costs, also matched expectations, showing a 4% annual rise. On a month-on-month basis, consumer prices ticked up 0.1% last month, compared with estimates of remaining unchanged. Markets had recently been pricing in a rate cut by the Federal Reserve as soon as March, but traders pared those bets and are now targeting May for the first rate cut after the central bank began its hiking cycle in March 2022. Expectations for a cut of at least 25 basis points in March fell to 43.7%, from about 50% before the data, according to the CME Group’s FedWatch Tool. The market is now pricing in a chance of about 78% for a cut in May, up from about 75% on Monday. “The market is certainly assuming that inflation is going to keep coming down, that earnings in this next year are going to show some decent growth and the Fed is going to cut rates,” said Scott Wren, senior global market strategist at the Wells Fargo Investment Institute in St. Louis. “The market is counting on more of a soft landing that would allow the Fed to ease up.” The Dow Jones Industrial Average rose 113.66 points, or 0.31%, to 36,518.59, the S&P 500 gained 12.13 points, or 0.27%, to 4,634.71 and the Nasdaq Composite gained 68.53 points, or 0.47 %, to 14,501.01. Markets will get another look at inflation data in the form of the Producer Price Index (PPI) before all eyes turn to the Fed’s policy announcement at the conclusion of its twoday meeting on Wednesday. The European Central Bank and the Bank of England are also scheduled to deliver their policy verdicts later this week. Oracle slumped 12.2% as the cloud services provider forecast third-quarter revenue below estimates on slowing demand for its cloud service. Energy was the worst-performing of the 11 major S&P sectors, falling more than 1% as crude prices slid. The tech sector, however, was among the best-performing, touching a record high as it is on track for its biggest yearly percentage gain since 2019. Google-parent Alphabet dipped 0.8%, after “Fortnite” maker Epic Games prevailed in its high-profile antitrust trial over the company. Advancing issues were roughly even with decliners on the NYSE while declining issues outnumbered advancers by a 1.1-to-1 ratio on the Nasdaq. new lows. The federal funds futures market on Friday was pricing in a 46% chance of a cut at the Fed’s March meeting, and a nearly 80% chance of a cut in May, according to the CME FedWatch tool. Many investors believe stocks can continue rising in the weeks and months ahead, with the S&P 500 just 4% from making a fresh all-time high. Past rate cycles have shown that stocks tend to climb dur-

ing the period when monetary policy is “on hold.” The S&P 500 has gained an average of 5.1% in periods that the Fed has paused its rate-hiking cycle and before the central bank’s first cut, according to an analysis of nine such periods by ClearBridge Investments. resident Joe Biden warned Israel’s leaders on Tuesday that they were losing international support for their war in the Gaza Strip, exposing a widening rift with Prime Minister Benjamin Netanyahu, who rejected out of hand the American vision for a postwar resolution to the Palestinian conflict. Biden delivered the blunt assessment of America’s closest ally in the Middle East during a fundraiser in Washington, where he described Netanyahu as the leader of “the most conservative government in Israel’s history” that “doesn’t want a two-state solution” to the country’s long-running dispute with Palestinians. “I think he has to change, and with this government, this government in Israel is making it very difficult for him to move,” Biden said. The president’s remarks came hours after Netanyahu pledged to defy weeks of American pressure to put the Palestinian Authority in charge of Gaza once the fighting ends. Netanyahu ruled out any role there for the group, which now governs Palestinian society in the Israeli-occupied West Bank. “There is disagreement about ‘the day after Hamas,’” Netanyahu said in a video statement posted on social media. He said he hoped the two governments could reach an agreement about what happens after the war ends, but he vowed not to allow threats to Israel’s population to continue. “After the great sacrifice of our civilians and our soldiers, I will not allow the entry into Gaza of those who educate for terrorism, support terrorism and finance terrorism,” Netanyahu said. “Gaza will be neither Hamastan nor Fatahstan.” Fatah is the political faction, a rival to Hamas, that controls the Palestinian Authority, which was ousted from Gaza in 2007 but still administers parts of the West Bank. Until Tuesday, the United States had largely backed Israel both in action and in rhetoric — supporting the

He has repeatedly described his decadeslong history with Israel; Monday evening, he declared at a White House Hanukkah reception: “I am a Zionist.” Biden’s public message has evolved since the Oct. 7 attacks. He publicly urged Israel to do more to protect civil-

Donald Tusk chosen as Poland’s prime minister after rival is rejected By ANDREW HIGGINS

P

oland’s newly elected Parliament torpedoed a long-shot effort by right-wing forces to stay in power and chose opposition leader Donald Tusk as the nation’s new prime minister earlier this week. The decision ushers the biggest and most populous country on the European Union’s formerly communist eastern flank into a new era. Legislators, as expected, rejected a new government proposed by the caretaker prime minister, Mateusz Morawiecki, whose party, Law and Justice, lost its parliamentary majority in an October election. As Parliament shot down Law and Justice’s effort to keep power, opposition legislators taunted Morawiecki and his supporters over their defeat, chanting “Donald Tusk, Donald Tusk.” Later Monday, Parliament nominated and confirmed Tusk, 66, as Poland’s new leader, drawing cheers and applause from his allies and a sour denunciation of the new prime minister as a “German agent” from Jaroslaw Kaczynski, chair of Law and Justice and Poland’s de facto leader since 2015. Tusk, a veteran centrist politician who led Poland from 2007 to 2014, is expected to be sworn in Wednesday by President Andrzej Duda, an ally of Law and Justice. “This is a truly wonderful day, not only for me, but for all those who have deeply believed for many years that things will get better, that we will chase away the darkness, that we will chase away evil,” Tusk said after being confirmed as prime minister by the Sejm, the more important lower house of the Polish Parliament. The return to power of Tusk, endorsed as Poland’s new leader with 248 votes for and 201 against in the Sejm, completed an ill-tempered period of political transition that Law and Justice had sought to prolong as long as possible, despite losing its majority in the October election. Morawiecki, who led Poland’s previous right-wing government, resigned after the election but was asked by Duda to stay on in a caretaker capacity and to try to form a new government. Critics of Law and Justice denounced Duda’s move as a last-gasp attempt by the defeated party to prolong its rule and appoint allies to positions in state institutions and companies. Votes in Parliament on Monday, however, ended the defeated party’s efforts to remain in office and elevated Tusk, the leader of the main opposition party, Civic Coalition, to leadership of a new government. He is expected to announce his Cabinet on Tuesday. After a day of often raucous debate, 266 legislators voted against the government proposed by Morawiecki and 190 voted for, far short of the majority it needed in the 460-member Sejm to hang on. By rejecting Morawiecki’s proposed government, doomed to fail because of Law and Justice’s electoral defeat, Parliament delivered a humiliating blow to Kaczynski, a bitter political and personal enemy of Tusk. Kaczynski warned that the vote against Morawiecki and the return to power of Tusk, whom he has repeatedly reviled as an agent for German and Russian interests, “look like the end of Polish democracy, but we hope this will not be the case.” Many others, however, cheered the end of the deeply conservative party’s rule, including Lech Walesa, a former Polish president

and leader in the 1980s of the anti-communist Solidarity trade union movement. A longtime foe of Kaczynski who has accused him of collaborating with the communist-era secret police, Walesa was so eager to witness the demise of Law and Justice that, despite a recent struggle with COVID, he traveled to Warsaw from his home in the port city of Gdansk to witness the vote. He stood in the spectators’ gallery beaming with delight as Tusk was confirmed as prime minister. The installation of a new government headed by Tusk could be a drastic shift away from Poland’s direction during eight years of Law and Justice rule, a period marked by close relations between the governing party and the Roman Catholic Church and frequent quarrels with the European Union. Scope for change, however, will be crimped by the grip of Law and Justice appointees on the judiciary; powerful state bodies like the central bank, the national prosecutor’s office, the national broadcasting system; and large state-controlled corporations like energy giant PKN Orlen. Many of those appointments will be hard to reverse. The outgoing government made clear it had no intention of cutting Tusk any slack, with former ministers recycling wild election campaign smears of the man now set to govern Poland. Speaking in Parliament on Monday evening, Mariusz Blaszczak, defense minister in the previous government, responded to Tusk’s nomination as prime minister by denouncing him as a threat to national security who, “completely obedient to Brussels and Berlin,” will “weaken our security and push us to the periphery of Europe.” He also vowed to “defend” public media, drawing jeers from Tusk’s supporters. The public broadcasting system, a network of national and local radio and television stations, is stacked with Law and Justice loyalists. TVP, the main state television station, has so far clung to its role as a propaganda bullhorn for Law and Justice. Its news coverage is heavily slanted in favor of the former governing party, though it has now curbed somewhat previously incessant denunciations of Tusk as a traitor. During a debate before the votes in Parliament rejecting Morawiecki and approving Tusk, opponents of Law and Justice reviled the former governing party as sore losers who had needlessly dragged out the transfer of power. “These entire two months were built on

the foundation of bitterness and non-acceptance of the sovereign’s judgment, which removed Law and Justice from power,” said Wladyslaw Kosniak-Kamusz, the leader of a centrist party allied with Tusk. “This is the end of this bad stage for Poland,” he added. Law and Justice’s defeat came less than a month after a far-right party performed far better than expected in Dutch national elections. Although it fell well short of winning a majority and is having trouble forming a government, the Dutch party’s result sent shock waves across Europe since the Netherlands had long been seen as one of the continent’s most liberal countries. In Poland, Tusk and his allies are divided on the issue of abortion, which was almost completely banned by the previous government, but they share a desire to restore the independence of the Polish judiciary, which was heavily politicized under Law and Justice, and to repair relations with the European Union. A long and often-vicious election campaign cast a shadow over Poland’s previously robust support for Ukraine as Law and Justice sought to avoid losing votes to a far-right party strongly opposed to helping Ukraine. A new centrist government headed by Tusk would most likely try to put relations between the two countries back on track, though issues like cheap Ukrainian grain and a blockade of the border by protesting Polish truckers could obstruct a quick return to more harmonious relations. Law and Justice won more votes than any other single party in the October election and proclaimed victory. But its opponents — Tusk’s Civic Coalition; a leftist grouping, New Left; and a centrist alliance, Third Way — won a clear majority in the Sejm. The opposition also expanded a majority it had in the Senate, the upper house of Parliament. That simple arithmetic was running against Law and Justice was clear when the new Parliament convened for the first time Nov. 13 and selected Szymon Holownia, a leader of Third Way, as speaker of the Sejm and rejected a candidate put forward by the previous governing party. Why Biden needs an immigration deal By ROSS DOUTHAT

O

ver the last few months, the incredulous question — How can Donald Trump possibly be leading the polls; there must be some mistake — has given way to the clear reality: Something in American life would need to change for Joe Biden to be favored for reelection in November 2024. The good news for Biden is that it’s easy to imagine developments that would help his reelection bid. Notwithstanding a fashionable liberal despair about how bad vibes are deceiving Americans about the state of the economy, there’s plenty of room for improvements — in inflation-adjusted wages, interest rates, the stock market — that could sweeten the country’s economic mood. (Just sustaining the economic trajectory of the last few months through next summer would almost certainly boost Biden’s approval ratings.) The looming Trump trials, meanwhile, promise to refocus the country’s persuadable voters on what they dislike about the former president; that, too, has to be worth something in the swing states where Biden is currently struggling. In both those cases, though, the president doesn’t have much control over events. No major economic package is likely to pass Congress, and whatever influence you think his White House did or didn’t exert over Trump’s indictments, Biden staffers won’t be supervising jury

There is an issue that’s hurting Biden, however, where the Republican Party is (officially, at least) quite open to working with the president, provided that he’s willing to break with his own party’s interest groups: the security of the southern border, where Border Patrol apprehensions remain stubbornly high even as the president’s approval ratings on immigration sit about 30 points underwater. There is a commonplace interpretation of the immigration debate that treats the unpopularity of an uncontrolled border primarily as an optics problem: People are happy enough to have immigrants in their own communities, but they see border disorder on their television screens and it makes them fearful about government incompetence. Sometimes this interpretation comes packaged with the suggestion that the people who worry most about immigration are rural voters who rarely see a migrant in real life, as opposed to liberal urbanites who both experience and appreciate diversity. The last year or so of blue-city immigration anxiety has revealed the limits of this interpretation: Place enough stress on New York or Chicago, and you will get demands for immigration control in even the most liberal parts of the country. But really, there’s never been good reason to think that immigration anxiety only manifests itself telescopically, among people whose main exposure to the trend is alarmist Fox News chyrons. Consider a new paper from Ernesto Tiburcio and Kara Ross Camarena — respectively a doctoral student in economics at Tufts University and a Defense Department analyst — which uses Mexican-government ID data to track the flow of Mexican migrants into counties in the United States, and finds that exposure to immigrants increases conservatism among natives. As the migrant flow goes up, so does the vote for Republicans in House elections: “A mean inflow of migrants (0.4 percent of the county population) boosts the Republican Party vote share in midterm House elections by 3.9 percentage points.” And the inflow also shifts local policy rightward, reducing public spending and shifting money toward law enforcement as opposed to education. This suggests that a pro-immigration liberalism inevitably faces a balancing act: High rates of immigration make native voters more conservative, so a policy that’s too radically open is a good way to elect politicians who prefer the border closed. You can see this pattern in U.S. politics writ large. The foreign-born population in the United States climbed through the Obama presidency, to 44 million from 38 million, and as a share of the overall population it was nearing the highs of the late 19th and early 20th century — a fact that almost certainly helped Donald Trump ride anti-immigration sentiment to the Republican nomination and the presidency. Then under Trump there was some stabilization —

(Cheriss May/The New York Times) the foreign-born population was about the same just before COVID-19 hit as it had been in 2016 — which probably helped to defuse the issue for Democrats, increase American sympathy for migrants, and make Biden’s victory possible. But since 2020, the numbers have been rising sharply once again, and the estimated foreign-born share of the U.S. population now exceeds the highs of the last great age of immigration. Which, again unsurprisingly, has pushed some number of Biden voters back toward Trump. Border control in an age of easy global movement is not a simple policy problem, even for conservative governments. But policy does matter, and while the measures that the White House is reportedly floating as potential concessions to Republicans — raising the standard for asylum claims, fast-tracking deportation procedures — aren’t quite a pledge to finish the border wall (maybe that’s next summer’s pivot), they should have some effect on the flow of migrants north. Which makes them a distinctive sort of policy concession: A “sacrifice” that this White House has every political reason to offer, because Biden’s reelection becomes more likely if Republicans accept it.

Y aquí a mí, como que la impresión que me da es que sí que hubo una equivocación,

Golden Globes 2024 nominations: ‘Barbie’ and ‘Oppenheimer’ in front To compare, the Oscars attract about 19 million viewers.

o many, the Golden Globe Awards are a perfect example of Hollywood’s two faces. In public, the entertainment capital plays along: It’s an honor just to be nominated, giggle tee-hee, this event is an absolute delight. In private, smiles drop and eyes roll: The prizes are not seen as meaningful markers of artistic excellence, but there is no way around them. From a business perspective, the Globes represent a crucial marketing opportunity for winter films and TV shows. The nominations for the 81st ceremony, which will be televised by CBS and streamed on Paramount+ on Jan. 7, were announced Monday morning by Cedric the Entertainer and Wilmer Valderrama. New movies like “American Fiction,” “Poor Things” and “The Zone of Interest” will compete alongside summertime behemoths like “Oppenheimer” and “Barbie.” “Barbie” led the nominations with nine, followed by “Oppenheimer” with eight. In the television categories, “Succession” had the most with nine, followed by “The Bear” and “Only Murders in the Building” with five apiece. In one obvious snub, “The Color Purple,” based on the Broadway version of the story and backed by Oprah Winfrey, was left out of the best film, musical or comedy category. In a surprise, voters found a way to invite Taylor Swift to the ceremony, nominating her “Eras Tour” concert film in a new category for blockbusters. The Golden Globes have long been positioned as an important campaign stop for Oscar hopefuls. Nomination voting for the 96th Academy Awards begins on Jan. 11. In truth, the impact may be overblown. “The Fabelmans” won 2023 Globes for best film drama and best director, while “The Banshees of Inisherin” was named best film musical or comedy, also picking up Globes for acting and screenwriting. (Penske controls the biggest Hollywood trade publications, which rely on awards-related advertising income.) The new owners expanded the voting pool to about 300 journalists from around the world, with attention paid to diversity. Fewer than 100 people voted on the Globes until a couple of years ago; as recently as 2021, there were no Black voters. The January show will include two new categories — one for stand-up comedy on television and the other for blockbuster films, defined as those taking in at least $100 million at the United States box office and $150 million worldwide. (The Academy of Motion Picture Arts and Sciences, the organization behind the Oscars, introduced a category for “popular” movies in 2018 as part of an effort to boost viewer interest. The film establishment had a meltdown, and the academy backtracked. To compare, Hollywood responded with shrugs in September when the Globes announced a category dedicated to box office winners, perhaps revealing how little the Globes are regarded as actual honors.) With the exception of the blockbuster category, which has eight slots, the categories now have six nominees, up from five. In

The Beverly Hilton and Unite Here, a union representing housekeepers, front desk attendants, servers and other workers at the hotel, said Friday that they had reached a tentative deal for a new contract. “Together, the iconic Beverly Hilton and its employees set the stage for the awards season, and we are delighted to be able to do so once again,” the union said in a statement. The recipients of the Globes for lifetime achievement, one in film and the other in television, will be named in the coming weeks — along with a host for the ceremony, the spokesperson said. The stand-up comedian Jerrod Carmichael hosted the 2023 Globes, which attracted about 6.3 million viewers, down 10% from the 6.9 million for the televised Globes ceremony in 2021. (NBC refused to broadcast the event in 2022, citing the HFPA’s problems.)

This vegetarian main is ready to shine on your holiday table You can make the stew the day before (stews are easygoing like that), then reheat it gently so it’s warm when it meets the phyllo. This ensures that the filling will end up piping hot and the pastry nicely browned at the same time. If you’re using the optional feta, add it immediately before baking: You want each salty, creamy nugget to remain a distinct bite, rather than melt into the already silky mix of cauliflower, sweet potatoes and zucchini. Bold and bronzed, this blockbuster pie doesn’t need much garnish. A

s savory and alluring as a pot of stew can be, it’s rarely charismatic enough to hold its own as the centerpiece of a blowout holiday feast. There’s no amount of chopped parsley on top that can adequately dress up that long-simmered brown underneath; a stew, by nature, is always more cozy and homey than fancy and showstopping. But pour that same stew into a pastry crust and bake until its buttery surface turns golden and glistening, and you’ve got a spectacular main course that’s ready for a star turn. You can do this to pretty much any thick stew and get excellent results. This time, I went meatless, riffing on a chickpea-filled vegetable tagine rich with sweet spices and minced preserved lemon. Since the best stews can be quite involved — all those vegetables to chop and sear, plus a long, slow bubbling on the stove — I’ve kept the pastry simple and used a prepared phyllo rather than homemade dough. Then I streamline things some more. Phyllo recipes can be fussy, calling for buttering each fragile, gossamer (and now sodden) piece before stacking them one on top of another. Instead, I use a trick I learned several years ago while making a feta torte. After assembling everything in the pan, I poke holes in the dough and just pour the melted butter on top. It seeps between the layers beautifully and bakes up burnished, crisp and shiny. And using a sheet pan means that this pie can wow a crowd and feed it, too.

Spiced vegetable phyllo pie In this spectacular meatless meal, crisp sheets of buttery, golden phyllo surround vegetables and chickpeas stewed with sweet spices, preserved lemon and earthy turmeric. You can prepare the vegetable stew the day before; just reheat it so it’s warm when it meets the phyllo pastry. Once it’s baked, you can serve this hot or at room temperature, making it perfect for a party. Since it’s baked on a sheet pan, it makes enough to feed a crowd. Yield: 12 servings Total time: 2 hours, plus at least 15 minutes’ resting Ingredients: 1 tablespoon extra-virgin olive oil, more as needed 2 medium red onions, chopped 1 red bell pepper, seeded and sliced 2 tablespoons tomato paste 1 1/4 teaspoons ground turmeric 1 1/4 teaspoons sweet paprika 1 teaspoon ground ginger 1/2 teaspoon ground cinnamon Large pinch of freshly grated nutmeg 2 1/2 teaspoons kosher salt (such as Diamond Crystal) 1 3/4 pounds cauliflower, florets roughly chopped (about 4 cups) 1 pound sweet potatoes, peeled and cut into 3/4-inch

cubes (about 4 cups) 1 medium zucchini, cut into 3/4-inch cubes 1 (14.5-ounce) can chickpeas, drained and rinsed 2 cups vegetable or chicken broth 1 tablespoon minced preserved lemon or 2 teaspoons grated lemon zest 1/2 cup mint, roughly chopped, more for topping 12 tablespoons/170 grams unsalted butter, melted 8 ounces feta, crumbled (optional) 1 (16-ounce) package frozen phyllo dough, defrosted Preparation: 1. Heat the olive oil in a large skillet or Dutch oven over medium-high. Once hot, add the red onion and bell pepper. Sauté until tender and golden at the edges, about 5 minutes. 2. Stir in tomato paste, turmeric, paprika, ginger, cinnamon, nutmeg and salt. Toss well to combine. Sauté until the spices and tomato paste are fragrant, about 2 to 3 minutes, adding more oil if needed. 3. Add the chopped cauliflower, sweet potato, zucchini and chickpeas to the pan, and stir to coat with tomato and spices. Pour in the broth and preserved lemon, and bring to a simmer. Partly cover with a lid and simmer for 40 to 45 minutes or until the mixture is thick and the vegetables are very tender. (Vegetable mixture can be made up to 24 hours ahead; reheat before proceeding.) Stir in the mint. 4. Heat oven to 400 degrees. Brush 2 tablespoons melted butter inside a rimmed 18-by-13-inch sheet pan. Line the pan with half of the phyllo dough (you can keep it in a stack) and brush the top with 4 tablespoons melted butter. Using a slotted spoon, spread the vegetable mixture evenly on top of the butter-brushed phyllo dough and sprinkle with feta, if using. Cover with the remaining phyllo dough. Use a paring knife to pierce holes throughout the top of the dough all the way through the layers, and brush the surface with the remaining 6 tablespoons melted butter. 5. Bake for 25 to 30 minutes, or until the phyllo is crisp and golden brown. Let sit 15 to 30 minutes before serving. Use a serrated knife to slice pieces. Top with more mint to serve.

How menopause changes the brain

A

cross the U.S., roughly 6 million adults 65 and older have Alzheimer’s disease. Almost two-thirds of them are women — a discrepancy that researchers have long attributed to genetics and women’s longer life spans, among other reasons. But there is growing consensus that menopause may also be an important risk factor for the development of dementia later in life. Women going through the life phase, which is clinically defined as the end of fertility, face as many changes in the brain as in the ovaries, said Dr. Lisa Mosconi, a neuroscientist and director of the Women’s Brain Initiative at Weill Cornell Medicine. While the vast majority of women will weather these changes without long-term health consequences, about 20% will develop dementia in the decades that follow. The female brain is rich in estrogen receptors, particularly in regions that control memory, mood, sleep and body temperature, all of which “work beautifully when estrogen is high and consistent,” Mosconi said. Estrogen is also vital for the brain’s ability to defend itself against aging and damage. The characteristic decline in estrogen during menopause not only alters the functioning in some brain regions, she said, but it is also thought to change the brain’s structure; scans show reduced volume in menopausal brains compared with male brains of the same age and with those of

pre-menopausal women. These neurological changes may be responsible for some menopausal symptoms, including hot flashes, mood disruption and a mild, usually temporary decline in memory and cognition. They also resemble changes in the brain that precede dementia, Mosconi said. “Some of the brain regions that are impacted by menopause are also some of the regions impacted by Alzheimer’s disease,” she said, but the link between the two is not fully understood. The symptoms of menopause themselves, such as lack of sleep and hot flashes, have been linked to dementia too. A study published last year found that hot flashes were associated with an increased amount of tiny lesions in the brain, which are a sign of declining brain health, said Dr. Pauline Maki, a professor of psychiatry and director of the Women’s Mental Health Research Program at the University of Illinois at Chicago and co-author of the study. A more recent study determined that hot flashes during sleep were associated with an increase in blood-based Alzheimer’s biomarkers that serve as early indicators of the disease. While this research sounds alarming, most women’s brains and cognitive function stabilize after the menopause transition, Maki said. “Consider how many women go through menopause — every woman, right? And 80% of them will not get dementia,” she said. “We can’t catastrophize this universal

The San Juan Daily Star transition.” Beyond that, there are things you can do to bolster your health and cognition in the face of declining estrogen. Three steps to protect your brain Several studies have found that up to 40% of dementia cases could be prevented, said Dr. Jessica Caldwell, director of the Women’s Alzheimer’s Movement Prevention Center at the Cleveland Clinic in Las Vegas. And a few lifestyle changes in midlife, including quitting smoking, reducing alcohol intake, sleeping better and remaining mentally and socially active, aid in prevention. But for women in menopause, experts say that three things in particular are likely to have the most effect by addressing both the short-term symptoms as well as the longterm risk of dementia. Hormone therapy, timed right For decades, researchers were concerned that the hormone therapy used to treat menopause symptoms was associated with an increased risk of developing dementia in older women. But recent studies, including one published last month that reviewed the findings of over 50 studies, look more closely at the timing of the therapy and suggest a more nuanced picture: Hormone therapy that was started around the time when menopausal symptoms began was associated with a reduced risk of Alzheimer’s disease and dementia. Other studies have found that hormone therapy had no effect on dementia and Alzheimer’s risk, Maki said, but these treatments are effective at addressing hot flashes and night sweats as well as improving quality of life, all of which are “important determinants of brain health,” she said. Consistent exercise Physical inactivity presents a greater risk for neurodegenerative diseases in women than in men, Caldwell said. “We know that physical inactivity is a risk factor for dementia. And women throughout their lives, on average, are twice as likely to be physically inactive than men,” she said. A 2018 study that followed almost 200 middle-aged women for 44 years found that the greater their fitness level at the start of the study, the lower their risk of developing dementia later in life. And Mosconi found that brain scans of physically active middle-aged women had fewer Alzheimer’s biomarkers compared to their sedentary counterparts. A healthy diet In recent years, researchers have found that certain diets, like the Mediterranean diet and the fairly similar MIND diet, which prioritize vegetables, fruits, whole grains, lean proteins and healthy fats, are associated with a reduced risk of dementia in both men and women. The Mediterranean diet in particular seems to be a protective tool, even for women with a genetic risk for Alzheimer’s disease, Mosconi said. And there may be a specific added benefit of these plant-rich diets for women: Preliminary research suggests that certain gut bacteria — which are nourished by a plantrich diet — might help balance estrogen levels in the body. Many of these lifestyle changes take time that many middle-aged women feel they don’t have, Caldwell said. “We are expected by society to put ourselves after everybody else, whether that’s kids, parents or spouses, and we need to keep ourselves on the priority list,” she said. “Because if we don’t do these types of health-maintenance behaviors, we will not have the healthy brain aging we want.”

Ohtani’s contract goes beyond dollars and sense By KEN BELSON

J

apanese baseball players are taught to keep a low profile and let their performances do the talking. Yet, for more than a decade, Shohei Ohtani has been willing to make waves. In high school, he wanted to become the first Japanese player to go straight to the major leagues. When he debuted as a professional in Japan instead, he insisted on playing the field and pitching, something rarely done. He continued the feat after joining the Los Angeles Angels six seasons ago, winning two MVP awards as well as the nicknames Shotime and Japan’s Babe Ruth. Now, Ohtani, 29, has broken another barrier, signing a record 10-year, $700 million contract to play for the Los Angeles Dodgers. The deal, announced Saturday, was as eye-popping as his tape measure home runs and blazing fastball: more than $275 million above what his Angels teammate Mike Trout received in 2019; and $10 million more per year than Damian Lillard of the NBA’s Milwaukee Bucks, who had the highest annual salary in American pro sports. It also eclipses that $50 million to $60 million that Argentine soccer star Lionel Messi is earning each year to play for Major League Soccer’s Inter Miami. Ohtani’s belt-busting contract highlights the often-confounding economics of baseball and professional sports more broadly, where networks and companies spend hundreds of millions, even billions, of dollars to link their businesses to players and teams whose success can be ephemeral. Japanese players from Hideo Nomo to Ichiro Suzuki to Hideki Matsui proved to be bankable signings. But Ohtani’s record payday is something entirely different. It is evidence that Japanese players aren’t just very good but are among the best — and most popular — in an increasingly international game. “The number of Japanese players coming to the United States has been building, but this takes it to a whole other level,” said Vince Gennaro, who was a consultant to several major league teams and now runs the sports business programs at New York University. Ohtani is not the only highly coveted Japanese star this offseason. Yoshinobu Yamamoto, 25, has been the best pitcher in Japanese baseball the past three seasons and

Shota Imanaga, who pitched against Team USA in the World Baseball Classic, and Yuki Matsui of the Rakuten Golden Eagles, are two other left-handed pitchers also on the market. But teams evaluating their talent face the same challenges they do with American players because running a professional sports team is not like running an airline or supermarket. Supply and demand, and profits and losses are moving targets, not fixed positions. The value of a player’s contract is often based on a grab bag of statistics coupled with hunches that his or her success will continue unimpeded by age, injury or bad luck. Although promoted as the ultimate twoway player, Ohtani is unlikely to pitch in 2024 because of an elbow he injured last season. He’s still a formidable hitter, of course, but his Bunyanesque reputation comes from his prowess both at the plate and on the mound. The Dodgers, who are paying Ohtani the equivalent of the gross domestic product of a small Pacific nation, will make back only a fraction of what they’re paying him to stay in the lineup. The Dodgers have led the league in attendance 10 of the past 11 seasons, so there are only so many more tickets they can sell. Raising ticket prices is also tricky because it could push out average fans. Japanese companies, no doubt aware that Ohtani’s games will be broadcast live in Japan, will rush to buy signage at Dodger

Stadium. How much more they might be willing to pay than an American company is unclear. The Dodgers keep all the revenue from the sale of jerseys, caps and other merchandise in their home market, but sales of gear sold elsewhere must be shared with all 30 MLB teams. And although the Dodgers already have a very lucrative local television deal, the league controls national and international media deals, including the one that allows games to be shown in Japan. Still, Ohtani’s achievements are undeniable, particularly in his home country. Baseball has been the national sport in Japan for more than a century, and for most of that time, the Japanese have used the game to measure themselves against the United States. For decades, American teams led by Ruth and many others demolished their hosts. But over time, the competition has evened. Even as Japanese players succeeded in the major leagues, however, skeptics found reason to be critical. Nomo joined the Dodgers as a pitcher in 1995 and was voted rookie of the year, but cynics said he succeeded because he had an unorthodox, stop-motion delivery. When Suzuki set a major league record in 2004 with 262 hits in a season, critics said he did so primarily by hitting ground balls and line drives. Hideki Matsui was a top slugger in Japan, but turned out to be an ordinary power hitter on the Yankees. Ohtani, though, is beating the Americans

on their own terms. “He can hit a home run 500 feet and throw a ball 100 miles per hour, and he’s bigger and stronger than most Americans,” said Robert Whiting, who has written several books on baseball in Japan, including “You Gotta Have Wa.” Ohtani’s Ruthian contract might never have been signed if Nomo, Hideki Irabu and Alfonso Soriano hadn’t challenged Japanese restrictions on the movement of players in the 1990s. Nomo, for instance, retired from Japanese baseball so he could sign with the Dodgers, while Irabu pushed back when his old team, the Chiba Lotte Marines, cut a deal to send him to the San Diego Padres. Irabu was later sent to the Yankees, his preferred destination. A couple of years later, Soriano, who had been drafted as a teenager by the Hiroshima Carp, followed. “The real credit for the growth of the Japanese market in the U.S. belongs to Nomo, Irabu and Soriano,” said Gene Orza, a longtime lawyer for the MLB Players Association. “Those three broke the dam. Ohtani really owes it to them.” And even if the Dodgers do not make back their money directly from Ohtani, they may be playing the long game. They have made the playoffs 11 consecutive years but won only one World Series title. By teaming up Ohtani with Freddie Freeman and Mookie Betts — two other former MVPs — as well as an excellent pitching staff, the Dodgers could become the dominant team of the decade. That is a far cry from the Angels, who never made the playoffs or even had a winning record during Ohtani’s six seasons with the team. “If the Dodgers win two or three World Series in the next six, seven years,” Gennaro said, “Ohtani will be the face of the franchise and a whole generation of fans will follow the team for years.”

G

olf is a sport where certain years stand out above others, and 2023 may prove to be one of those years. It’s a heady list. In 1860, Willie Park Sr. won the first British Open, which was held at Prestwick Golf Club, marking the debut of the oldest major tournament. In 1913, amateur Francis Ouimet won the U.S. Open, beating the two best English golfers of the time, and popularizing the sport in the United States. In 1930, Bobby Jones completed the first and only Grand Slam, winning the four majors of his day in one year. Babe Didrikson Zaharias became the first woman to make a cut on the PGA Tour in 1945, competing in the Phoenix Open and Tucson Open. She went on to dominate that decade of golf. In 1950 the LPGA was formed. In 1968, a group of professional golfers, led by Jack Nicklaus and Arnold Palmer, broke away from the Professional Golf Association of America to create the PGA Tour. Tiger Woods completed the Tiger Slam — winning all four men’s major championships consecutively over two seasons, from 2000-01. This year could prove pivotal for the men’s and women’s game, with both of the top tours looking at mergers. For the PGA Tour, June 6 signifies a before and after in professional golf. That morning Jay Monahan, the PGA Tour commissioner, announced a “framework agreement” for the PGA Tour to work with LIV Golf, the Saudi-backed golf league that he had spent much of the previous year disparaging. “I would ask any player that has left or any player that would ever consider leaving: Have you ever had to apologize for being a member of the PGA Tour?” Monahan had said a year earlier. After the LPGA and its equivalent across the Atlantic, the Ladies European Tour, or LET, reached an agreement to merge, the LET vote to approve the merger was abruptly postponed. Here’s a look back at a roller-coaster year. Behind the scenes The PGA Tour-LIV announcement looms large for the sheer suddenness of the tour’s reversal and the way that it angered and alienated some of its top players, including Rory McIlroy, who had been one of Monahan’s staunchest allies. McIlroy has since resigned from the PGA Tour board. For his part, Monahan has expressed regret with how the announcement was made. “The rollout was a failure on my part,” he said at The New York Times DealBook Summit last month. “I’ve owned it, and I’ve continued to own it.” On the other side, LIV Golf was given a boost, if not a lifeline. The league had been rolled out haphazardly. Its first tournaments in 2022 had been marred by problems, such as the lack of a television deal and team uniforms. Cameron Smith — attention shifted to poor attendance at events and a lack and officials made connecting LIV — which is funded by Saudi Arabia’s Public Investment Fund, or PIF — with the country’s history of human rights abuses. But that day in June, in an about-face, there was Monahan sitting next to the fund’s governor, Yasir al-Rumayyan, calling for cooperation. “There are only a handful of people who weren’t surprised given the past two years,” said Kevin Hopkins, vice president at Excel Sports Management. “Not knowing what this is going to lead to is going to be the next headline.” As shocking as this announcement was for golf fans, it was also a surprise to the PGA Tour’s membership, which was largely caught off guard. The year in the women’s game was more positive — exciting major championships, the debut of a promising young star, a hotly contested Solheim Cup that ended in a draw between the two teams — but the women’s tour also has a cloud of uncertainty hanging over it.

of a major media partner to broadcast the events. The June 6 announcement gave the fledging league relevance. “We went from being cast unfairly as outsiders in golf to our chairman sitting shoulder to shoulder with the commissioner of the PGA Tour,” said Gary Davidson, LIV Golf’s interim chief operating officer in 2023. “We always knew that LIV could coexist.” With the LPGA and LET, their merger talks had been going smoothly. The two tours have been operating in a joint venture since 2020, a period when prize money rose on both tours. This year the two boards negotiated terms for a merger, with the LPGA effectively taking over the LET. Whether it happens depends on a vote by the LET players. “The vote has been postponed by the LET board from its original Nov. 21 date as more time was needed to evaluate all relevant information received,” said Mollie Marcoux Samaan, the LPGA commissioner. “A new date for the vote has not yet been set. The LPGA board remains enthusiastic about the opportunity to bring our two organizations together.” In the spotlight Both the women’s game and men’s game also provided compelling story lines on the course. The first men’s major, the Masters Tournament, came down to a duel between Jon Rahm, a stalwart of the PGA Tour, and Koepka, a multiple major champion who had left for LIV. Rahm prevailed, but in the next major, the PGA Championship, Koepka pulled away from the field to win his fifth major. LIV saw this as validation. “Competing in the Masters and then winning the PGA Championship was massive for us,” Davidson said. “It proved the competitiveness of LIV, that it could prepare the guys well for majors.” (On Thursday, LIV announced that Rahm would join its tour next year.) The five women’s major championships also provided excitement. Lilia Vu won the first and last of the majors, to rise to the No. 1 ranking and claim the player of the year title. Céline Boutier became the first French player to win her home country’s Amundi Evian Championship. And Allisen Corpuz, a young American in her second year on the tour, won the U.S. Women’s Open. The LPGA also got a feel-good story with Rose Zhang, who had long been the No. 1-ranked amateur woman in the world. Zhang turned pro in June and won the first event she entered.
