ormer Tourism Company director Terestella González Denton has filed her candidacy for mayor of San Juan under the Popular Democratic Party (PDP) and says she will develop a government plan that will focus on addressing poverty. González Denton said Sunday that her desire to return to public service and her love for the capital city moved her to file her candidacy for San Juan mayor. “I call it [the Government plan] a living platform because I want to tie it to organizations that are currently making a change in the capital city and doing social and economic work,” she said as quoted in a radio interview. Among some of the problems that González Denton said she would address, she pointed to clean and illuminated roads as an everyday responsibility, as is the issue of poverty surrounding the capital and its close proximity to tourism zones. “We see places that, really, are almost marginalized, and they do not have any interconnection with the city,” she said. “And that’s the same thing; they are marginalized spaces, and there is great poverty, so we have to work on that vision of the city.” The former top tourism official stressed meanwhile that she would amend the Public Order Code so that, instead of being a harassment measure for merchants, it focuses on improving the security services of the municipal police. “We are going to look at this code so that it is a fair code and it is a code that applies to areas where there is a greater flow of visitors and see that harmony between what is the life of the resident and commerce,” she said.

The candidate also welcomed the leap that the mayors of Villalba and Comerío, Luis Javier Ortiz Hernández and Josian Santiago Rivera, respectively, intend to take to the Senate. PDP Rep. Héctor Ferrer Santiago, whose work was noted by the San Juan mayoral candidate, said González Denton has impeccable experience. “We have a capital city that does not compete with other cities in Latin America because, unfortunately, the outgoing mayor has dedicated himself to throwing tar and establishing a Public Order Code due to the inability to control crime,” Ferrer Santiago said. The freshman lawmaker, who will run for reelection, also criticized Elmer Román, a candidate for resident commissioner in the New Progressive Party primaries, who he said would have no way out against the PDP’s candidate for the post, Pablo José Hernández Rivera.

Keren Riquelme Cabrera on Monday announced the filing of a bill that makes it possible for people diagnosed with lupus to request and obtain a sign for parking their vehicles in areas designated for citizens with disabilities. “Lupus disease is prevalent in Puerto Rico,” Riquelme said. “According to the latest available data, one out of every 629 inhabitants on the island confronts this condition that disrupts the body’s immune system and triggers, in many cases, rashes on the face that manifest themselves in the cheeks and nose area, making it very uncomfortable for these patients to walk long distances outdoors,”. “Faced with this reality, we accepted the petition on

behalf of Lupus patients, and we filed this measure that makes life a little easier for these people, many of whom suffer terrible pain as a result of these skin eruptions that we know are part of the condition associated with this unique disease,” added the New Progressive Party senator, who expects the measure to be addressed quickly in the next regular session, which begins in January. Lupus causes the immune system to become overactive, forming large amounts of antibodies that in turn attack the patient’s healthy tissues and organs, including the skin. In Law 28-2018 as amended and Law 41-2022, lupus is considered a serious disease of a catastrophic nature and is grounds for a leave of absence from work. The majority of people impacted by lupus and all its modalities are women.

Sen. Vargas Vidot seeks reelection, vows to challenge SEC ‘hoax’ against independent candidates By THE STAR STAFF

ndependent Sen. José “Chaco” Vargas Vidot announced his candidacy to run again for an at-large Senate seat in the 2024 elections, he revealed in a video posted Monday on his Facebook page. “In 2024 I want to continue to be in the Senate. I call with great respect and love that if there is something unique in the Senate; it is not just me, it is all of us making our country transform,” the senator said. “We want to continue the work we are doing in the office, which ranges from oversight, coordination of services, visiting communities and attending to their situations, and supporting and pushing causes of social justice, mental health and more.” Vargas Vidot said he again faces obstacles from the State Elections Commission

(SEC) when it comes to collecting endorsements, this time because the SEC included an additional reason for rejecting endorsements that the Electoral Code does not recognize as valid. By means of the regulation, the SEC indicates that it will validate the signature of an endorser and decide if it is incompatible with previous signatures of the voter. In addition, the SEC regulatory measure is only stipulated for independent candidates, which Vargas Vidot said amounts to discrimination by the SEC against candidates who are not recognized as participating in the SEC or in the endorsement process. “The provisions of Section 5.6 of the Rules for the Filing of Candidacies is a discriminatory approach to independent candidates that we will be raising with the State Election Commission and we are prepared

to go to court,” Vargas Vidot said. “Since in 2016 we already won in court against the discriminatory action of requiring 54,000 endorsements, now they invent a reason to reject our endorsements, which is not recognized in the Electoral Code and which only applies to independent candidates. Worst of all … in addition to being a hoax on the part of the SEC, it’s something that doesn’t make sense. People change their signatures over time, and not only that, but with endorsements now being electronic, the signature on a tablet or cell phone is not the same as a physical one, so it is an arbitrary and capricious way for the SEC to hinder independent candidacies.” “I have spoken with other independent candidates and they are notifying me of endorsement rejections for this reason, as happens to me, and we are going to stop it,” the independent senator said.

PFEI chooses Rivera Sánchez as its next president By THE STAR STAFF

he Special Independent Prosecutor Panel (PFEI by its Spanish initials) announced Monday that the former judges who serve on the panel -- Rubén Vélez Torres, Ygri Rivera Sánchez and Aida Nieves Figueroa -- met in the morning to fill the vacancy in the presidency following the death of Nydia Cotto Vives. As dictated by the provisions of Law 2-1988, the Law to Create the Office of the Special Independent Prosecutor Panel, the position of president is chosen through free

selection among the qualified members that constitute the PFEI. Accordingly, Rivera Sánchez was entrusted with occupying the presidency and directing the work of the institution. Rivera Sánchez thanked Vélez Torres for acting in an extraordinary manner as interim president at the time of Cotto Vives’ death late last week. The PFEI adopted a resolution recognizing Cotto Vives for her dedication, and extended its condolences and solidarity to her family. Rivera Sánchez was initially appointed

as an alternate member of the PFEI, when Crisanta González Seda became president of the OPFEI. Subsequently, she was promoted by appointment of the governor, and confirmed by both legislative bodies, to full member on Nov. 14, 2018. She was sworn in five days later. Rivera Sánchez has an extensive history in public service. She is and has been a member of various advisory committees of the Supreme Court. She also served as outside legal counsel to the Government Ethics Office and as a member of the Gov-

ernor’s Advisory Commission on Education Matters. She also chaired the University of Puerto Rico board of trustees. In the judicial branch, Rivera Sánchez dedicated almost 20 years of her life to the Court of First Instance in San Juan, where she spent over 12 years presiding over a criminal chamber. She later became a member of the Court of Appeals. The selection of Rivera Sánchez as PFEI president does not require further action by La Fortaleza or the island Legislature.

Fiscal board seeks dismissal of suit accusing it of illegal vote buying By THE STAR STAFF

T

he Financial Oversight and Management Board (FOMB) has asked the judge overseeing the Puerto Rico Electric Power Authority’s (PREPA) Title III bankruptcy to dismiss a lawsuit that claims the federally appointed panel engaged in illegal vote buying. The filing was made recently in the case GoldenTree Master Fund vs. the FOMB under PREPA’s bankruptcy. GoldenTree Asset Management and Syncora Guarantee sued in November alleging that the oversight board has given several groups, including National Public Finance Guarantee Corporation, the fuel line lenders and the BlackRock Financial Management group, advantageous debt settlements so that they vote in favor of PREPA’s plan of adjustment. The oversight board said the action is designed to obstruct confirmation at all costs, not on the merits but rather based on litigation overload. The board noted that the plaintiffs are creditors who allegedly own or insure some $886 million in PREPA bonds and who intend to object to confirmation of PREPA’s proposed plan of adjustment. They are also seeking the designation of a receiver for PREPA. The oversight board said the case should be dismissed because the court lacks subject-matter jurisdiction. The declaratory judgment action does not present an actual case or controversy; it seeks only an advisory opinion on the abstract question of whether certain votes were solicited or procured in bad faith, the board said. Second, the oversight board said, the plaintiffs have not presented a ripe dispute. “To the contrary, the Complaint raises issues concerning contingent future events that might never come to pass,” the board said. “As of the filing of the Complaint, not a single ballot had been cast in favor of, or in opposition to, PREPA’s proposed Plan. Unless and until such votes are cast, the Court should not waste time and effort seeking to determine whether such uncast ballots should

be designated.” The oversight board also said the complaint is defective because it omits bringing a whole host of necessary parties to the suit such as the creditors whose votes are at issue. The complaint should also be dismissed, the board said, because it does not plead a cognizable claim for solicitation or procurement of votes not in good faith; it refers only to negotiations for and entry into the plan sponsoring agreements (PSAs). “Case law is clear that negotiating and entering into a PSA that obligates a creditor to vote does not constitute soliciting or procuring a vote and thus is not actionable under section 1126(e),” the oversight board said. The board also said the questions raised by the plaintiffs should be addressed during the confirmation hearing next year. PREPA has been in bankruptcy since 2017 to restructure some $9 billion in debt under the Puerto Rico Oversight, Management and Economic Stability Act. A debt adjustment plan is expected to be confirmed next year. Economist critiques debt adjustment plan Separately, Ramón Cao, an economist, submitted an economic evaluation of PREPA’s debt adjustment plan on behalf of the Instituto de Competitividad y Sostenibilidad

Económica (ICSE). Cao noted problems with the oversight board’s “Customer Affordability Calculation,” which concluded that, under the proposed debt deal, the monthly electricity bill for unsubsidized residential customers is going to increase by 6.2% and that customers can afford to pay it, because the total monthly bill will be, on the average, about 6% of their yearly “representative income” of $25,356. “Since electricity is an essential input for the production of every good and service in the economy, an increase in electricity tariff rates is going to certainly increase production costs for every other good and service produced on the island, inducing increases in supply prices in almost all other goods and services consumed in the economy,” Cao said. “If the general price level increases, consumers have to rearrange their consumption patterns. Such rearrangement of consumption patterns implies that they cannot afford to consume all the things they used to purchase, and [must] even readjust their consumption of electricity. The published analysis is limited to residential customers, not considering the effects of the [debt deal] on commercial, government and industrial customers. This is a major shortcoming. Nonresidential customers, particularly commercial customers, are going to bear most of the burden of proposed tariff rate increases.” He also said PREPA’s debt has another major component: its debt to the Employees Retirement System (ERS). “PREPA, years ago, decided to stop making the corresponding employer contribution to ERS and created a debt. The FOMB decision in this case [...] is the same that it adopted for the rest of Government and public corporations’ retirement systems; that is, to adopt a Pay Go approach for old employees and a Defined Contributions Retirement System for new employees,” the economist said. “That such a model has been adopted across the board, without making public any actuarial, financial or economic analysis for individual cases, tends to induce people to think that it is an unjustified ideological approach.”

GDB’s collateral monitor challenges PFC debt restructuring By THE STAR STAFF

A

year after a bankruptcy court approved the Public Finance Corporation’s (PFC) debt restructuring, the Government Development Bank of Puerto Rico (GDB) Debt Recovery Authority (DRA) collateral monitor Cantor-Katz is now arguing in an appeal that PFC bondholders should have received less than $47 million in replacement debt. The petition was made in a Dec. 13 opening appeals brief to the U.S. First Circuit Court of Appeals in the case FOMB, et al v. AmeriNational Community Services, LLC. Cantor-Katz, along with GDB DRA servicer Amerinational Community Services, ar-

gued that there was no valid claim, as required by the statute governing the GDB qualifying modification. The new bonds were issued five years after the GDB’s qualifying modification. “It may have been expedient for the governmental parties to do an about-face and eliminate the valid claim requirement so as to have the maximum consideration to offer to PFC Bondholders -- but such expediency cannot trump [The Puerto Rico Oversight, Management and Economic Stability Act] PROMESA or governing law,” the collateral monitor and servicer argued. no need for a valid claim under standby letters of credit, to issue more debt, because the bond indenture and the master trust agreement had superseded the terms set forth in the restructuring support agreement term sheet. PFC bondholders accepted $13.8 million in cash and $47 million in bonds in exchange for their $1.1 billion in outstanding debt. They agreed that they would accept only cash if the courts did not allow the bond issuance. The District Court entered an order approving the PFC Qualifying Modification on Dec. 30, 2022, but deferred its decision concerning whether, as contemplated by the PFC Qualifying Modification, certain additional bonds of the DRA could be issued.

arranquitas Mayor Elliot Colón Blanco is inviting the entire community to the “Blackout Party,” which will take place in the eastern-central mountain town’s Monsignor Miguel Mendoza public square this Friday starting at 7:30 p.m. The event got its name as a result of the unexpected blackout that took place during the night of the town’s Christmas lighting when the Quisqueya Ensemble was in full performance. A power outage by LUMA Energy left the town’s traditional center without power,

forcing the cancellation of the celebration. In response to that challenge, Colón Blanco decided to transform adversity into opportunity, giving rise to what is now known as the “Blackout Party.” The activity will be full of music and joy, the mayor said, with outstanding performances by the Cantores de Bayamón, Los Animales Parranderos, and Joseph Fonseca, who were originally scheduled to close the night of the “switch-on.” In addition to the excellent musical lineup, attendees will be able to enjoy artisan kiosks, taste delicious traditional food and

New CDC director seeks to foster trust in a battered agency By SHERYL GAY STOLBERG

D

r. Mandy K. Cohen dropped by the Fox affiliate in Dallas in November, just days after the governor of Texas signed a law barring private employers from requiring COVID-19 shots. If she thought promoting vaccination would be a tough sell in a ruby-red state, Cohen, the new director of the Centers for Disease Control and Prevention, did not give any indication. “I’m not just the CDC director, I’m also a mom,” she said cheerily, noting on live television that her daughters, 9 and 11, had already received the latest COVID and flu shots. She added, “So I wouldn’t recommend something for the American people I wouldn’t recommend for my own family.” It was the kind of stock phrase that Cohen has repeatedly invoked as she pursues a task that some public health experts fear is impossible: restoring Americans’ faith in public health, and in her battered agency. Five months into her tenure, with the COVID public health emergency officially over, the CDC’s new leader is relentlessly on message. Americans’ trust in the agency, and in science more broadly, was badly damaged by the coronavirus pandemic, and the loss of faith is particularly pronounced among Republicans. In a recent survey by the Pew Research Center, 38% of Republicans said they had little or no confidence in scientists to act in the public’s best interests, up from 14% in April 2020. At the same time, the CDC’s winter vaccination campaign appears to be falling on deaf ears. Last week, the agency issued an alert warning that low vaccination rates for the flu, COVID and respiratory syncytial virus, known as RSV, could lead to “severe disease and increased health care capacity strain in the coming weeks.” And partisan divisions over vaccination persist: A KFF poll in September found that 7 in 10 Democrats but just a quarter of Republicans planned to get the updated COVID shot. Cohen, whom President Joe Biden selected to succeed Dr. Rochelle P. Walensky, is responding with a nationwide media blitz. Since taking the helm of the CDC in July, she has traveled the country, promoting vaccination in 19 cities in 13 states. She has visited 22 vaccination sites and has participated in dozens of interviews, including an appearance on NBC’s “Today” just before Thanksgiving. She has left a trail of social media posts

(Desiree Rios/The New York Times) in her wake, including a series of short videos, called “Check-In With Dr. Cohen,” that typically begin with some variation of the same greeting: “Hi everyone, it’s Mandy Cohen!” In one video recorded on Long Island, New York, Cohen and a county health official, wearing hard hats and vests, reported on how wastewater can help scientists track viruses and disease. In Dallas, she appeared with another county health official to talk about the importance of data, and with a nurse at a church health fair. And in Chicago, she stood by the president of the American Medical Association as he promoted vaccination. When she speaks to reporters, she frequently brings up her children. “Science is important and yes, the data is important,” Cohen said in an interview with The New York Times. “But at the end of the day, we’re also all humans. And if we can have a human-to-human conversation about what I would do for my own kids, who I love and I want to be healthy, maybe that can connect us in a different way.” Cohen is taking over an agency that is in transition. Her predecessor, Walensky, who began serving at the start of the Biden administration and stepped down in June, commissioned a review of the CDC that identified serious weaknesses in areas ranging from testing to data collection to communications. Walensky then initiated an overhaul of the agency.

Cohen has said she is committed to carrying out that plan, which included setting up a new forecasting and analytics center, as well as structural changes intended to enable the agency to quickly translate its science into coherent policy recommendations. But even her staunchest allies say her top priority must be to change the way the public views her agency. “Restoring trust probably is the No. 1 challenge right now,” said Dr. Judith Monroe, president and chief executive of the CDC Foundation, an independent nonprofit established by Congress to mobilize privatesector support for the agency’s work. “Because where’s your platform if folks don’t trust what you say?” The morning before she was to leave for a two-day, three-city swing through Texas, Cohen huddled with her top aides and her infectious disease team at CDC headquarters in Atlanta for an update on the flu, COVID and RSV — which circulate during what the agency now calls the “winter respiratory virus season.” One benefit of that moniker: Winter viruses are less politically toxic than COVID. The news was mixed. Hospitalizations from the flu were up slightly from last year. The rate of COVID vaccination was much lower than that of flu vaccination among health care workers — not a good sign. A new monoclonal antibody shot to prevent RSV in infants was in

short supply, but 77,000 more doses had just been released. Texas was seeing an uptick in RSV. But there was something else on Cohen’s mind. During her travels, she had been hearing from people who worried about side effects from vaccination and wanted more information about what federal health officials were doing to monitor vaccine safety. The CDC, she told her colleagues, needed to be able to “tell a clear and concise story.” Unlike Walensky, who had no prior government experience and made headlines for seeking out media training, Cohen is not a stranger to Washington or the spotlight. She was a top official at the Centers for Medicare & Medicaid Services during the Obama administration. Later, as secretary of health and human services in North Carolina, she laid the groundwork for the Republicancontrolled legislature to accept an expansion of Medicaid, and she helped steer the state through the pandemic. After news reports that Biden was planning to pick Cohen for the director’s post, more than two dozen congressional Republicans signed a letter accusing her of politicizing science. They cited her tenure in North Carolina, where she called for students and staff members in K-8 schools to wear masks and threatened legal action against a school district over its COVID policies. But while her relationships with Republicans in North Carolina may have been tense, they never veered into vitriol, said state Rep. Donny Lambeth, a Republican and a chair of the Health Committee in the North Carolina House of Representatives. “She was cool, calm and collected almost every time we had her in front of us,” Lambeth said. “She did not get rattled.” There were few fireworks during her congressional testimony last month. When Rep. Daniel Crenshaw, R-Texas, pushed her to admit that the CDC had been wrong during the pandemic, she politely ignored the request. Rep. Jeff Duncan, R-S.C., wanted to know if she had regrets about COVID restrictions from her time in North Carolina. Cohen did not admit to any. Campus crackdowns have chilling effect on pro-Palestinian speech

t the University of Pennsylvania, approval for the screening of a documentary critical of Israel was denied. At Brandeis University — which expressed a public commitment to free speech — a proPalestinian student group was barred for statements made by its national chapter. At the University of Vermont, a Palestinian poet was set to deliver a talk, but the school pulled the meeting space after students complained he was antisemitic. There are growing signs that colleges are starting to clamp down on pro-Palestinian protests and events on campus, as the institutions face pressure from donors, alumni and politicians, who are furious over what they say is an antisemitic campaign against Jews. Some schools have simply canceled events or delayed them. A handful of schools have shut down student groups and disciplined students. Some students have simply stopped participating in protests, concerned for their own safety, spooked by alumni who have started do-not-hire lists and outside groups that have doxxed students. The war in the Middle East is laying bare the difficulties American universities are confronting in navigating free expression. Already under attack in recent years from conservatives

for closing off debate on other topics, university leaders are now struggling to balance open expression with fears and complaints from some Jewish students that the language of pro-Palestinian protest calls for violence against them. As video of some protests went viral, with some devolving into physical altercations, university officials have been under more and more pressure to find a way to contain the demonstrations. Radhika Sainath, an attorney with Palestine Legal, a civil rights group, said her organization has received more than 450 requests for help for campus-related cases since the Hamas attack, more than a tenfold increase from the same period last year. The cases include students who have had scholarships revoked or been doxxed, professors who have been disciplined, and administrators who have gotten pressured by trustees. “It’s truly like nothing else we’ve ever seen before,” Sainath said. “We’re having a ’60s-level moment here, both as far as the repression but also the mass student mobilization.” In the past few months, the most prominent pro-Palestinian campus group, Students for Justice in Palestine, has been suspended from at least four universities, including Columbia, Brandeis, George Washington and Rutgers. In some cases, the universities accused the group of being supportive of Hamas, disrupting classes and intimidating other students.

The group, a loosely connected network of autonomous chapters founded about 30 years ago, has denied those allegations. “These suspensions are a dangerous escalation of the repressive measures administrators have been taking to characterize anti-Zionist student organizers as a violent and existential threat,” the national Students for Justice in Palestine group said in a statement, adding that administrators “have crafted the infrastructure for mass repression, censorship and intellectual manipulation.” In Florida, the chancellor of the State University System of Florida wrote a letter in late October to school presidents that chapters of Students for Justice in Palestine in the state must be “deactivated” — an order civil rights groups say clearly violates the First Amendment. School leaders are in a tough position, said Burt Neuborne, a New York University law professor and founding legal director of the Brennan Center for Justice. Universities, he said, “will pay a price in intellectual openness if they are unduly restrictive in speech that they allow on their campuses,” but “on the other hand, you’ve got traumatized and frightened young people; you don’t want to ignore them.” Administrators at the University ofVermont canceled an in-person event in late October featuring Palestinian poet Mohammed el-Kurd, after some students said he was antisemitic. ElKurd could not be reached for comment. The Anti-Defamation League, which tracks antisemitism, describes el-Kurd on its website as displaying a “troubling pattern of rhetoric and slander that ranges far beyond reasoned criticism of Israel.” Lecture organizers rejected the charges of antisemitism. “The conflation of critics of Israel and anti-Zionism with antisemitism is false and used to curb academic freedom,” said Helen Scott, a professor involved in planning the event, adding that many of the lecture series board members are Jewish. The university cited security reasons, but a university lawyer later acknowledged to faculty there were no threats to the venue or speaker, according to a video reviewed by The New York Times. The event was held online instead. University officials could not immediately be reached for comment. “This is a climate where it’s OK to cancel a talk at the last minute by a prominent Palestinian poet,” said Scott, noting that three students of Palestinian descent who attended other colleges were shot in town last month. (Officials arrested a 48-year-old man in the shooting and were investigating whether it was a hate crime.) “What message does that send?”

William Youmans, an associate professor at George Washington University, where administrators this semester suspended the Students for Justice in Palestine chapter, said that while university officials’ tactics were sometimes chilling student activism, pressure from external forces — with doxxings and warnings to potential employers — were having greater consequences. “In many ways, I feel like that strategy is a bit more effective at actually silencing,” said Youmans, who was a member of the SJP chapter at the University of California, Berkeley, in the early 2000s. “If administrators suppress speech, it backfires because they’re so clearly not supposed to be doing that.” But Youmans said the responses of universities still had consequences. “Some of this is to signal, ‘Hey, we’re doing stuff,’” Youmans said. “The easiest thing to do is put out statements that please donors.” But, he added, “Of course, a lot of those have the informal effect of stigmatizing kinds of groups, stigmatizing kinds of speech.” Scholars studying and writing about the Israeli-Palestinian conflict have always walked delicately, but the environment has deteriorated since Oct. 7, according to a biannual survey carried out last month. The survey, from the University of Maryland and George Washington University, found that 66% of respondents reported self-censoring on the Middle East in general, up from 57% in the fall of 2022. Chisato Kimura, a 23-year-old-law student at Yale who is a member of Yalies4Palestine, said she has not been deterred and would continue to protest on behalf of Palestinians. She said schools talk a lot about diversity “and love to plaster our faces on posters and promotional material” but need to accept that “if you have diverse faces on campuses, you’re also going to have diverse voices and opinion.” At Harvard, an undergraduate student organizer with the school’s Palestine Solidarity Committee said students were worried about the consequences of speaking out for Palestinians. She did not want to be named out of fear for her physical safety and possible repercussions at the college. Worries over being disciplined by her school cause some students to think twice about speaking openly about their views in class, she said. But ultimately, the student said, given the brutal deaths of thousands of civilians in Gaza, she feels there is no choice but to continue to protest and speak out on campus, whatever the consequences. The stakes in Gaza, she said, “are too great to be silent in a moment like this one.”

Giuliani was ordered to pay $148 million. What happens now? By EILEEN SULLIVAN

A

federal jury in Washington ordered Rudy Giuliani last week to pay $148 million in damages to two former Georgia election workers he defamed by spreading baseless claims that they tried to steal votes from Donald Trump on Nov. 3, 2020. Giuliani, who faces a litany of legal and financial troubles, has said he will appeal the verdict. Here’s what happens next: The judge will order a judgment on what Giuliani must pay. The jury awarded the two former poll workers, Ruby Freeman and her daughter, Shaye Moss, who are Black, $148 million. That was after they gave hours of emotional testimony describing the relentless threats and attacks they received, including from people who said they should be hanged for treason or lynched. The total included a combined $75 million in punitive damages; compensatory damages of $16.2 million to Freeman and $16.9 million to Moss; and $20 million to each of them for emotional suffering. Before Freeman and Moss can collect any money, the judge, Beryl Howell of the U.S. District Court in Washington, will need to enter a judgment ordering the amount Giuliani is required to pay. In civil cases like this one, the judge can change the amount determined by the jury. Once Howell rules on the amount, Giuliani can appeal the decision. The money will not come immediately. “Defense lawyers can string out these cases for pretty substantial periods of time before payments actually have to be made,” said Robert Rabin, a professor at Stanford Law School with expertise on torts and compensations. If Giuliani appeals the verdict, Freeman and Moss could ask the judge to make him post a bond to secure some of his assets while an appeal is pending, said Christopher Mattei, a lawyer who represented the Sandy Hook families in their defamation case against Infowars founder Alex Jones. The women can also request a special proceeding to look into ways to collect the judgment from him, such as garnishing his wages. Giuliani, who served as the mayor of New York City and as a federal prosecutor, cannot currently work as a lawyer because of disciplinary actions against him. Giuliani refused to comply with the court’s requirement to disclose financial documents that would show his net worth, including how much money he makes from media endeavors such as his podcast. And at any point, Giuliani and Freeman and Moss could agree on a settlement. Giuliani will still be on the hook, even in bankruptcy. After Friday’s verdict, Giuliani was likely to file for bankruptcy protection, according to a lawyer familiar with his legal situation. The damages he owes Freeman and Moss are considered an “intentional tort,” meaning Giuliani was aware of what he was doing when he defamed the women by spreading

(Jeenah Moon/The New York Times) baseless lies about election fraud, and bankruptcy would not erase his liability. “It may be that Ruby Freeman and Shaye Moss are able to chase Rudy Giuliani to his grave to catch every penny they can out of his pockets,” Barbara McQuade, a University of Michigan law professor, said recently on MSNBC. McQuade was a U.S. attorney for the Eastern District of Michigan from 2010 to 2017. If Giuliani, who is 79, dies before Freeman and Moss receive compensation, they could still collect compensatory and emotional damages against his estate, Rabin said. Giuliani faces additional legal challenges. Giuliani is under indictment in Georgia. A local prosecutor brought racketeering charges against him, Trump and others for their efforts to overturn the election results in Georgia. He faces a defamation suit from Dominion Voting Systems, one of the largest voting machine vendors in the country. The company accused Giuliani of spreading lies about the company as part of his efforts to keep Trump in office. Giuliani’s former lawyer, Robert Costello, is also suing him for $1.3 million in unpaid legal fees. And a former employee, Noelle Dunphy, filed a lawsuit in May, claiming that Giuliani harassed and assaulted her beginning in 2019. Giuliani has denied the allegations.

Carbon markets are in limbo. That’s not stopping this firm. By MANUELA ANDREONI and MAX BEARAK

irst, the little-known Emirati company set its sights on a forest the size of Maine. Then, another one that was as big as South Carolina. After that, it focused on a chunk of land the size of Puerto Rico. As the oil-rich emirate of Dubai, United Arab Emirates, prepared to host this year’s United Nations-sponsored climate summit, the company, named Blue Carbon and founded by a prince, was accumulating proposed deals on huge swaths of land across the developing world. It sought to position itself as a force for a purported solution to global warming: carbon credits. Carbon credits are potentially one of the most important — but also most controversial — tools to speed up efforts to reduce global emissions of heat-trapping gases. The idea is simple: each credit is worth 1 ton of carbon dioxide emissions that was sequestered or avoided. In theory, the carbon trade could increase the ambition of industrialized nations by letting them reduce emissions in other countries while figuring out how to do it home. It could also direct funds to developing countries that badly need them to grow their economies sustainably. But counting greenhouse gas emissions is a complex endeavor. Many conservationists worry the carbon market could be abused by countries looking to lower emissions without abandoning fossil fuels. Others hope the trade would channel money the developing world needs to keep forests standing and build renewable energy plants. Blue Carbon is pushing into the business despite unresolved issues of how the market for credits such as these should best be structured. Many conservationists hope the trade would channel money the developing world needs to keep forests standing and build renewable energy plants. (by M. Vorel, LibreShot) credits based on the expected emissions reductions from those projects to nations that are looking to reduce their carbon footprints. One ton of carbon stored in trees equals one carbon credit that can be bought and sold. But what government officials portrayed as a once in a lifetime opportunity for their nations was seen by many conservationists as an uncertain bet to curb carbon emissions with the potential to strip scores of local communities of their land rights. Carbon markets are still largely unregulated. While they provide a way to marshal money to protect forests, much of the worry over deals such as Blue Carbon’s comes down to how little companies have to publicly divulge. “We need all the financial levers we can get” to protect forests, said Zoe Quiroz-Cullen, a director at Fauna & Flora, an international wildlife nonprofit. But, she added, “I’m not seeing the level of detail that we would expect and for this number of announcements at this kind of scale.” Most carbon-market activity until now happened between companies seeking to satisfy their voluntary pledges to curb greenhouse gas emissions. But the trades Blue Carbon wants to broker have much higher stakes. They take advantage of a system created in the landmark Paris climate accord nearly a decade ago that allows nations to trade emission reductions that would count toward the buyer’s own pledge to reach carbon neutrality. Though countries and companies are starting to make deals, the rules that govern the trade remain unwritten. Negotiators at the recently concluded COP28 summit in Dubai failed once again to agree on a framework for regulating the trades, largely over questions of how they would report the emissions reductions of their projects. “We want and need countries and their partners to be very clear and transparent about what it is they’re doing,” said Alexia Kelly, who was a lead negotiator for the

United States on emissions trading and markets provisions of the Paris Agreement. “But absent any kind of agreed rules, that may or may not be occurring.” The terms of Blue Carbon’s proposed deals were not released publicly. Its draft contract with Liberia’s government, reviewed by The New York Times, shows the company wouldn’t buy any land, but instead secure the right to sell carbon credits from areas that are currently occupied by communities, private farms and reserves. President Emmerson Mnangagwa of Zimbabwe touted an agreement in September that could give control of almost a fifth of the country’s territory to Blue Carbon. At a recent ceremony he said the deal would close the country’s “financing gap to the tune of $200 million.” Requests for information on the agreements went unanswered by Blue Carbon and the office of its founder, Sheikh Ahmed Dalmook Al Maktoum, as well as four of the five African nations with deals. When Loretta Alethea Pope Kai, chair of National Civil Society Council of Liberia, an umbrella group of advocacy organizations, saw the draft contract between her government and Blue Carbon in August, she said she committed herself to blocking it. For years, Pope Kai had worked with community leaders to help pass a law that protects the land rights of communities as well as their right to be consulted about projects that affect them. “We said, ‘Halt the negotiation,’ because we need more consultation,” she recalled in an interview. “The deal was a bad deal.” The draft document, which hasn’t been signed by Liberian authorities, was dated in July and said Blue Carbon would get 70% of the proceeds — tax free for a decade — from the sale of any carbon credits related to the land. The government would get the remaining 30%, plus a 10% royalty over the value of each credit, half of which would go to local communities. Environmentalists complained that local communities and the government were getting too little. A commonly used protocol by Plan Vivo, a nonprofit based in Britain, says communities should get at least 60% of the revenue from carbon credit sales. Wilson Tarpeh, CEO of Liberia’s Environmental Protection Agency, said the government never intended for the deal to go forward before rules were in place. “We are also very new to this issue, that’s why we are taking our time to make sure that the rules are put in,” he said in an interview. “But carbon is a major asset and we want to make money out of it.” The governments of Zambia, Zimbabwe, Tanzania and Kenya, which signed memorandums of understanding to negotiate deals over tens of thousands of square miles with Blue Carbon, did not respond to questions regarding the status of the deals. Kenya’s president, William Ruto, told reporters at the climate summit in Dubai that his country had “not sold one inch” of its land as part of any carbon-market deal.

Wall St builds on rally as Fed euphoria lingers

U

.S. stocks advanced on Monday as market participants parsed mounting expectations of interest rate cuts from the Federal Reserve in the coming year and looked ahead to a week of crucial economic data. All three major U.S. stock indexes gained ground in a broad but modest rally, with the S&P 500 and the Nasdaq advancing the most and the Dow inching toward yet another all-time closing high, posting nominal gains. Wall Street continues to build on seven straight weeks of gains, the S&P 500’s longest weekly winning streak since 2017, fueled by optimism of policy rate cuts in 2024, a fervor that Fed policy makers attempted to rein in on Monday. The S&P 500 was last about 1.1% shy of its all-time record close, reached in January 2022. “It’s a carry-over from the seven-week advance that we’ve seen, reflecting the confirmation by the Fed that they are likely finished raising rates and that they will start to cut interest rates at least by the second quarter of 2024,” said Sam Stovall, chief investment strategist of CFRA Research in New York. “But trees don’t grow to the sky, so sooner or later stocks will take a breather and digest some of these gains.” Chicago Fed President Austan Goolsbee warned that the central bank has not pre-committed to cutting rates anytime soon, while Cleveland Fed President Loretta Mester said financial markets had got “a little bit ahead” of the central bank with respect to the timing and extent of interest rate cuts. Even so, financial markets have priced in a 63.4% likelihood that the central bank will lower its Fed funds target rate by 25 basis points at its March monetary policy meeting, according to CME’s FedWatch tool. “The Fed would like the market to respond in a more measured fashion, while also reminding investors that since the Fed is data-dependent, there’s no guarantee that what we think today will actually come to fruition,” Stovall added. Later in the week, as the Christmas holiday draws near, the Commerce Department is expected to release its third and final take on third-quarter GDP on Thursday, to be followed by its broad-ranging Personal Consumption Expenditures (PCE) report on Friday, which will cover income growth, consumer spending, and crucially, inflation. At 2:07 p.m. EST, the Dow Jones Industrial Average (.DJI) rose 19.2 points, or 0.05%, to 37,324.36, the S&P 500 (.SPX) gained 26.72 points, or 0.57%, to 4,745.91 and the Nasdaq Composite (.IXIC) added 107.49 points, or 0.73%, to 14,921.41. Of the 11 major sectors in the S&P 500, communication services (.SPLRCL) were up the most, with real estate (.SPLRCR) suffering the biggest percentage drop. Mounting attacks by militant groups on ships in the Red Sea sent crude prices higher over supply concerns,

which in turn boosted energy stocks (.SPNY), which have largely been left behind by the recent rally. S&P 500 energy stocks were last up 1.1%. United States Steel (X.N) jumped 27.2% to a more than 12-year high after Japan’s Nippon Steel (5401.T) announced it would buy the steelmaker in a $14.9 billion deal including debt. Apple (AAPL.O) dipped 0.7% as China’s ban on the

company’s iPhones and other foreign-made gadgets gathered momentum. VF Corp (VFC.N) slid 7.6% after the Vans sneaker maker said it was investigating “unauthorized” activity on its computer systems, an incident that disrupted some of its business, including the ability to fulfill orders on its ecommerce site. Advancing issues outnumbered declining ones on the NYSE by a 1.20-to-1 ratio; on Nasdaq, a 1.09-to-1 ratio favored decliners. The S&P 500 posted 29 new 52-week highs and two new lows; the Nasdaq Composite recorded 110 new highs and 90 new lows.

Austin returns to Israel with a tougher message and lessons learned

A

fter three years as President Joe Biden’s quiet man at the Pentagon, Defense Secretary Lloyd Austin stepped off his plane at Ben Gurion Airport in Tel Aviv, Israel, on Monday and into the limelight. It was his second visit to the region since Israel launched a war in the Gaza Strip in retaliation for the Hamas-led terrorist attack on Oct. 7. During meetings and conversations with Israeli officials, Austin has stressed both the Biden administration’s support for Israel and concerns about the rising Palestinian death toll. But his message has become more blunt: Israel, Austin recently predicted, could face “strategic defeat” that would leave the country less secure if it does not do more to protect civilians. The warning is one that Austin is well equipped to deliver. The retired four-star general brings a wealth of military experience in combat, including urban warfare. Early U.S. efforts to target the Taliban and insurgents in Afghanistan in 2004. The troop “surge” in Iraq in 2007. The planning to pry Mosul, Iraq, from the hands of the Islamic

State group in 2016. Austin was involved in all of that. As the Biden administration navigates the Gaza crisis, the intensely private Austin is taking a prominent role and also revealing more of himself. “You know, I learned a thing or two about urban warfare from my time fighting in Iraq and leading the campaign to defeat ISIS,” he said in a speech at the Reagan National Defense Forum this month, using an alternative name for the Islamic State. “The lesson is not that you can win in urban warfare by protecting civilians. The lesson is that you can only win in urban warfare by protecting civilians.” Republicans criticized the defense secretary for not sounding supportive enough of Israel. The day after the speech, Sen. Lindsey Graham, R-S.C., told CNN’s “State of the Union” that Austin was “naïve,” adding, “I’ve just lost all confidence in this guy.” But critics of Israel’s bombing campaign say the message is long overdue, as the death toll in Gaza nears 20,000, according to health officials there. “This level of civilian killing and destruction, and the rage it generates, guaran-

tees militant recruitment and support for resistance among future generations, both in Palestine and beyond,” said Daniel Levy, a former Israeli peace negotiator who is now the president of the U.S./Middle East Project. “That’s a problem for both Israel and the U.S.” Criticism of how Israel is conducting the war has grown in recent days after its military said soldiers on Friday accidentally killed three Israeli hostages held in Gaza. The men were holding a makeshift white flag when they were shot, the military said. During his earlier trip to Israel, six days after the Hamas attack, Austin warned his Israeli counterpart, Yoav Gallant, and the country’s military chief, Lt. Gen. Herzi Halevi, that the large number of troops they had assembled at the border of Gaza, combined with the air campaign, was excessive. Israel needed to establish humanitarian corridors and a defined set of rules to protect Palestinian civilians, he told them. The Israeli military, he said, should carry out a targeted precision air campaign, with limited numbers of special operations troops on the ground to act quickly on intelligence leads about the location of senior Hamas leaders. One day later, on Oct. 14, he took his warning public. In a Pentagon statement describing his phone call with Gallant, and in other statements about their calls since then, Austin raised the issue of civilian casualties. Austin’s advice comes from both successes and failures of the U.S. military, including the thousands of civilian deaths in U.S. bombing campaigns in Afghanistan, Iraq and Syria. Last year, Austin ordered the U.S. military to strengthen its efforts to prevent civilian deaths in combat operations. He has also urged Israeli leaders to prioritize efforts to recover hostages taken by the group and others on Oct. 7, sending scores of U.S. Special Operations forces to advise Israeli planners and dispatching MQ-9 Reaper surveillance drones to fly over Gaza to search for clues about the captives’ locations. Since the war in Gaza began, Israel has insisted that it is trying to limit civilian casualties in a battle against a terrorist group that embeds itself among the population.

Israeli military officials scaled back their ground campaign somewhat. But they did not follow Austin’s guidance on using mostly precision munitions accompanied by targeted special operations raids, instead continuing to bombard Gaza with unguided “dumb bombs.” On Dec. 2, Austin turned up the pressure. “In this kind of a fight, the center of gravity is the civilian population,” he said at the defense forum. “And if you drive them into the arms of the enemy, you replace a tactical victory with a strategic defeat.” Nearly half of the air-to-ground munitions that Israel has used in Gaza have been unguided, according to a U.S. intelligence assessment, which Pentagon officials say may help explain the high civilian death toll. Even the precision-guided munitions that the United States military has favored in its campaigns in Iraq, Syria and Afghanistan produced high civilian casualties. Unguided munitions pose an even greater threat to civilians, analysts say. An Israeli military official acknowledged that the Israeli air force used unguided “dumb bombs” in Gaza but said the U.S. intelligence assessment was too high. The United States and Britain used dumb bombs over Dresden, Germany in 1945, killing about 25,000 people. But “military doctrine has evolved since World War II days, and today, the preferred doctrine in highly dense urban areas is to do intelligence-led precision strikes with precision munitions, and special operations forces,” Gen. Mark Milley, the former chair of the Joint Chiefs of Staff, said in an interview. “You have to go slower, with greater precision, and it’s going to take longer and it’s harder, but you have to do that — that’s what Austin is trying to get at,” Milley said. “He is a soldier. He has experience in combat operations. He understands the military instrument and how you should use it.” Speaking to reporters Monday after meetings in Tel Aviv, Austin said U.S. support for Israel was “unshakable” and that the country “has every right to defend itself.” He added, “As I’ve said, protecting Palestinian civilians in Gaza is both a moral duty and a strategic imperative.”

How Hungary undermined Europe’s bid to aid Ukraine By ANDREW HIGGINS

T

he European Union has a population of around 450 million and one of the world’s biggest economies. So how is it that Hungary, a small country with only 10 million people and a lackluster economy blighted by high inflation, this past week steamrolled Europe’s plan to throw Ukraine a financial lifeline worth $52 billion? The Hungarian prime minister, Viktor Orban, torpedoed the aid package, strongly supported by much bigger countries like Germany, France and Poland, by exploiting the power of veto held by each of 27 member states over key decisions relating to foreign and security policy and spending. The requirement for unanimity on important matters, designed to ensure that small countries have a voice, but which many see as a grave design flaw, means that no decision gets taken unless everyone is on board. Other European leaders have mostly shied away from threatening to use, never mind actually wielding, the veto. But Orban has embraced it as a disruptive weapon in his battles to shape policy and engage in what Daniel Freund, a German member of the European Parliament and critic of the Hungarian leader, described as a “constant game of extortion and blackmail.” On the eve of a summit meeting on Ukraine held Thursday in Brussels, the European Union’s executive arm released 10 billion euros, about $11 billion, in funding for Hungary that had been frozen over its violation of various EU rules. Officials said the timing was coincidental, but many saw it as a payoff. A further 17.6 billion euros remains frozen. After insisting in Brussels that he was not using his veto to extract money — “it’s not about a deal. We represent approaches and principles,” he said — Orban told Hungarian radio, “This is a great opportunity for Hungary to make clear that it must get all of what it is due.” There are growing concerns, however, that Orban wants to paralyze decision-making in pursuit of a broader ambition: upending the European Union in its current form and remaking it in Hungary’s image as a bastion against liberal values, immigrants and what he calls the “woke movement and gender ideology.” Hungary, he says, is a “counter model” that works. “The fear is that he actually wants to create chaos and disorder and destroy the EU from within,” said Charles Grant, director of the Center for European Reform, a research group in London. “He used to be more transactional, but people I talk to in Brussels say he has become more unreasonable, more truculent, more self-

The victory of centrist and liberal forces in a recent Polish general election ended the eight-year tenure of Law and Justice, a conservative nationalist party closely aligned with Orban in hostility to Brussels. Since Russia started its full-scale invasion of Ukraine in February 2022, Hungary has worked consistently to water down European sanctions and, echoing a favorite Kremlin talking point, denounced them as hurting Europe, not Russia. But he still went along in the end, endorsing all sanctions applied on Russia by the European Union. Last week, however, he broke ranks. He kept his veto weapon sheathed when fellow leaders voted to open negotiations with Ukraine over EU membership, something he had previously said he would never accept but in the end accepted by leaving the room during the vote. But he used his veto to block the funding package, moving beyond previous bluster to mount a frontal attack on Europe’s core policy of helping Ukraine. Membership talks usually drag on for many years, and Orban signaled Friday that he would do everything in his power to make sure they lead nowhere. “Luckily we have time to correct the decision,” he said in a post on social media. Orban, who has tight control of the Hungarian media through state conglomerates and loyal business cronies, is not going anywhere in Hungary. His governing Fidesz party last year

won its third general election in a row. Also seemingly immovable is the European Union’s commitment to unanimity on the most important decisions. There have been demands for many years that decisions be taken instead by a majority, with votes weighted to reflect the population of each country, but that would require changing treaties, something that virtually no leader wants to risk trying to do. In a speech to Poland’s parliament on Tuesday, Donald Tusk, the new prime minister, outlined a vision of Europe diametrically opposed to that promoted by Orban. Europe, he said, was more than just a trade bloc but a guardian of what he described as “European political values of democracy, the rule of law, media independence and freedom of speech.” But he ruled out treaty changes. Orban for his part has voiced growing contempt for the European Union. He in October derided it as a “bad contemporary parody” of the Soviet empire and mocked its impotence in face of his defiance of European rules requiring member states to protect press freedom, minority rights and judicial independence. “We had to dance to the tune Moscow whistled. The agreement in Brussels on Thursday to at least start membership negotiations with Ukraine gave a symbolic boost to President Volodymyr Zelenskyy of Ukraine, who had just returned empty-handed from a visit to the United States. war effort is being held up by political divisions in Congress, and Ukraine hoped that money from Europe would fill the gap. European leaders will meet in January to try to get Orban to relent. If he again uses his veto, as seems likely, Europe will still deliver money to Ukraine using various cumbersome alternative mechanisms that don’t require Hungary’s approval. That would tide Ukraine over in the short term but cast a shadow over Europe’s long-term ambitions as a reliable geopolitical player. Ivan Krastev, co-author of “The Light That Failed,” a book that examined disenchantment with liberal democracy in Eastern Europe, warned in The Financial Times on Friday that if “Europe cannot solve its Orban problem” it risks paralysis and fragmentation. The European Union, built on the ruins left by World War II, has defied repeated predictions of imminent doom, most recently after Britain voted to leave in 2016. That set off alarm in Brussels — and joy among EU skeptics — that Brexit might trigger an avalanche of defections by other countries. But nobody followed Britain’s lead, and even longtime critics of the bloc such as Marine Le Pen in France and Geert Wilders in the Netherlands, whose far-right party performed unexpectedly well in a general election last month, have shifted from advocating withdrawal from the union to demanding an overhaul of its priorities. Orban, too, insists Hungary will not leave or be forced out, not least because it needs the money. It is the largest recipient per capita of European funds. His mission, he said in Budapest recently, is not to take Hungary out but to “take over Brussels.” An important step on that path are elections next summer for the European Parliament, an assembly whose 705 members are chosen by voters in all 27 member states. It has limited powers and is mostly ignored by the general public, but nonetheless serves as a barometer of Europe-wide sentiment. Growing public unease across much of the continent over a surge in illegal immigration this year could tilt the European Parliament sharply to the right in the summer elections and end the current isolation of Orban’s Fidesz party, which is now largely friendless and powerless in the European legislature. In what amounted to a test run of the message he hopes will mobilize European votes to follow Hungary’s lead, Orban told a Fidesz rally last month, “The French, the Germans, the Italians, the Austrians would give half their lives if they could again have a country without migrants.” He added: “The Hungarian model works.”

What’s driving former progressives to the right? By MICHELLE GOLDBERG

I

n a new essay in the progressive magazine In These Times, writers Kathryn Joyce and Jeff Sharlet grapple with the contemporary version of an old phenomenon: erstwhile leftists decamping to the right. There have been plenty of highprofile defectors from the left in recent years, among them comedian Russell Brand; environmentalist-turned-conspiracytheorist Robert F. Kennedy Jr.; and journalist Matt Taibbi, a onetime scourge of Wall Street, who was recently one of the winners of a $100,000 prize from the ultraconservative Young America’s Foundation. What gives this migration political significance, however, are the ordinary people following them, casting off what they view as a censorious liberalism for a movement that doesn’t ask anyone to “do the work” or “check your privilege.” Joyce and Sharlet write, “We, the authors of this article, each count such losses in our own lives, and maybe you do, too: friends you struggle to hold onto despite their growing allegiance to terrifying ideas, and friends you give up on, and friends who have given up on you and the hope you shared together.” Naomi Klein described similar losses in her great book “Doppelganger,” which follows the exploits of one of the most infamous of recent progressive apostates, Naomi Wolf, a former liberal feminist who became an anti-vax influencer and a

El primer ejecutivo añadió que “este proyecto es una solución resiliente que fortalece esta vía en el barrio Cañabón, estableciendo altos estándares de seguridad de acceso a la comunidad en beneficio de todos sus residentes y visitantes, pues esta construcción es capaz de manejar la fuerza de la corriente del río, cumple con los códigos y requisitos de construcción más modernos, proveyendo ahora una infraestructura sostenible a largo plazo. La inversión realizada en este proyecto de reconstrucción sobrepasa los $4 millones, de los cuales $3.6 millones provienen de fondos federales de FEMA, $402 mil de fondos CDBG-DR y $85 mil provienen de fondos estatales de nuestro Departamento de Transportación y Obras Públicas. La viabilidad de la obra fue posible a través de un adelanto de $905 mil del programa piloto Working Capital Advance de COR3”. The mostest for the hostess: The joy of vintage guides to throwing a party By ALEXANDRA JACOBS

V

intage cookbooks are a curious subdivision of the thriving antiquarian trade. They are, of course, more likely than most old books to be splattered with disgusting substances — maybe even to contain evidence of kitchen pests. They are as vulnerable as college texts to previous owners’ margin notes (“Delicious!”) and suggested modifications, sometimes helpful. With his No. 1 bestseller “Baking Yesteryear,” TikTok star B. Dylan Hollis has reawakened America to the food from community cookbooks of the past. But let’s not neglect their more glamorous cousins: vintage entertaining guides. In our gastronomically obsessed age, these are pleasurable not because of the recipes — though many contain a few perfunctory ones — but for their often humorous explication of how to be a good host, or as was far more common back in the day, hostess. They are replete with chafing dishes and towering candelabras, billowing chiffon sleeves and conversational pointers. And culinary shortcuts, a la Eleanor Roosevelt serving hot dogs to the king and queen of England: The Joy of Not Cooking. They are a reminder that even in the worst of times, and without much expenditure, the home can be a respite of civility, friendship and grace. Part of these books’ charm is that — unlike classic recipes that are replicated ad nauseam online, lacking much copyright protection — they tend to be out of circulation and therefore feel like special finds. “DISCARD” reads the cruel library stamp on a copy of “How to Do It: Or the Lively Art

of Entertaining,” by Elsa Maxwell, from Rizzoli’s 2005 reprint that someone painstakingly uploaded to the Internet Archive. I can’t remember how I came into possession of a 1957 first edition, marked in pencil at a bargain $10, but “How to Do It” now roosts near my precious microwave with “Hostess” (1961), by English florist Constance Spry, with an assist from Rosemary Hume (and some adorable cartoon illustrations); “All About Parties” (1968), by Edith Gilbert, a syndicated columnist; “The Party: A Guide to Adventurous Entertaining” (1997), by Washington, D.C., fixture Sally Quinn; and more corporate but no less compelling volumes from Betty Crocker and Bloomingdale’s. The taxonomy of such books can be murkier than mock turtle soup. Dealers often marginalize them. Bonnie Slotnick, whose warren-like store in New York’s East Village is filled with unexpected treasures like “The Pyromaniac’s Cookbook: The Best in Flaming Food and Drink,” warned that news media mentions of out-of-print books, like a Veranda magazine feature about “These Entertaining People: A Guide for the Elegant Hostess” (1966), by fashion editor and television personality Florence Pritchett Smith, can artificially inflate the price. Best to keep a cool head and, perhaps, plumb the shelves of your older relatives. That’s where I first discovered the fascinating career of Annemarie Huste, who worked for Jackie Kennedy (briefly, since she blabbed about it) as well as diminutive impresario Billy Rose. Huste was a bona fide chef who ran a cooking school for a time, but her books, which include “To the Good Life! Entertaining With Annemarie” (1990), nonetheless throw off strong hostessy sparks, as do those of Vincent Price, the actor best known for his Gothic roles, and his

second wife, Mary. Elsa Maxwell was right up there with those authors in the department of celebrity proximity: one of the most famous hostesses of the 20th century, as well as an occasional gossip columnist and actress — though her style of party-giving suggests she would have thrived as a director, possibly of musicals. She is acknowledged for popularizing the scavenger hunt and often introduced elements of surprise, like live animals, at her affairs. “The fish course consisted of live seals she set free around the ballroom,” her obituary in The New York Times dryly recorded of one. She was not a fan of cocktail parties, “whose unlovely symbol is the ring on the best mahogany,” she writes in “How to Do It,” adding that “in nine cases out of 10 the people who are invited to cocktail parties are the people your host has not thought worth inviting to either luncheon or to dinner — so why, I ask, should I bother with them?” Novelists know how much can go deliciously wrong when entertaining. These experts — rarely dictatorial, generous with attribution, nosing right into interesting people’s homes — try endearingly to ensure everything will go right. Gilbert, a proponent of morning coffees and bon voyage luncheons, suggests a “party log or diary similar to the call board used in” — yes — “the theater”; also progressive dinners spread over friends’ houses like “two, three or more acts.” Quinn won’t serve red wine to large groups. Spry has plenty to say about poorly arranged breakfast trays, pretentious “sugar-tong manners” and meeting her Waterloo in the form of an unfamiliar artichoke. Again, don’t come to these guides for the food, more amusing than appetizing, and sometimes downright grotesque. (All that weird, off-putting glaze over hams, salads, cakes.) Rather, it’s a kind of coaxing, feminine spirit that draws you in: the social butterfly alighting next to the bookworm, an eternal flame of hospitality a-flicker, under the dubious fondue.

Five international movies to stream now By DEVIKA GIRISH

T

his month’s picks include a Canadian mumblecore comedy, an Argentine mother-daughter thriller, a Bangladeshi drama about a woman fighting a patriarchal system and more. ‘Retrograde’ The first several minutes of Adrian Murray’s cringe comedy take place in a single, uninterrupted shot. Framed from behind, Molly (Molly Reisman), a 20-something woman in Toronto, and her new housemate, wait in a car by the side of the road as a cop issues Molly a ticket for reckless driving. Even as the film eventually moves on to multiple other locations, including Molly’s apartment, her office and her ex-boyfriend’s home, we never truly leave those initial minutes in the car. The incident takes over Molly’s entire life as she becomes increasingly obsessed with fighting the ticket — reenacting the scenario repeatedly, doing the rounds of traffic court and talking her friends’ and co-workers’ ears off about the wrongs of the system. As far as plot goes, that is pretty much all there is. Murray builds out a series of quotidian interactions around Molly’s newfound preoccupation, unfolding a witty, minor-key drama about the daily indignities of modern living and the small, often irrational ways in which we try to claw back agency from an indifferent world. Played with a masterful deadpan by Reisman, Molly is touchingly unlikable — not in the showy ways now fashionable in movies about antiheroines, but in the pricklier, everyday ways that women are rarely allowed to be onscreen. (Stream it on Tubi.) ‘Elena Knows’ Argentine acting powerhouse Mercedes Morán is the linchpin of this gutting motherdaughter drama, adapted from a novel of the same name by Claudia Piñeiro. Both the book and the movie unearth myriad complexities within a classic crime premise: Rita (Erica Rivas), the middle-aged daughter of Elena (Morán), is found dead by hanging in the local church. But Elena, who has Parkinson’s disease, is convinced it is a murder, not a suicide, and she embarks on a painstaking quest through Buenos Aires, visiting the police, the church, Rita’s workplace and the home of Rita’s childhood friend to seek answers. The whodunit framework eventually emerges as a red herring; there are revelations to come, but they are not the sort Elena hopes for. Instead, she faces hard, irreconcilable facts about motherhood, femininity and

Molly Reisman in “Retrograde” (Cinedigm) women’s autonomy over their bodies and lives. The movie, directed by Anahí Berneri, reifies these themes beautifully in the cinematography, using claustrophobic close-ups and elliptical edits to approximate Elena’s resolve in the face of her illness, as well as the limitations of her often arrogant perspective. Morán, for her part, stuns with a tightly wound performance of embodiment: When Elena’s long-repressed tears finally flow at the end, you may find that you’ve been holding your breath the whole time, too. (Stream it on Netflix.) ‘Rehana’ The heroine of this taut Bangladeshi drama by Abdullah Mohammed Saad is difficult to pin down from the very start. When we meet Rehana (Azmeri Haque Badhon), she is berating her brother over the phone; soon after, as she’s proctoring an exam at the medical school where she teaches, she expels a student rather cruelly for trying to cheat. But her severity is also a sign of her integrity. Later that day, Rehana sees a student emerge from a professor’s office, looking distraught. When she learns of the professor’s abuse behind closed doors, she embarks on a furious crusade to have him punished — despite the censure of the administration and the protestations of the terrified victim. As the students, the perpetrator’s wife and even Rehana’s young daughter all become embroiled in the ensuing crisis, “Rehana” lays bare difficult questions. As a bystander, is Rehana’s responsibility only to the victim of the assault, or also to the many others the man may harm if he goes unpunished? And what is the price worth paying for justice? Is her career, and her daughter’s education, an acceptable cost? Composed of tight indoor shots and a bleak, blue-gray palette, the film brings

to life a suffocating world where a courageous woman’s choice is between sacrifice and selfishness. (Rent or buy it on Amazon.) ‘The Mountains Are a Dream That Call to Me’ A verdant forest fills the screen, crowded with vivid green trees. Something stirs in their midst; a silhouette becomes visible. Is it a plant, a person in camouflage, or a ghost? “The Mountains Are a Dream That Call to Me” is a movie full of such subtle shifts, perceptible only to the attentive eye. Composed of moods and landscapes, Cedric Cheung-Lau’s feature unfolds as a simple yet expansive tale about two hikers through the Himalayas — a Nepali man, Tukten (Sanjay Lama Dong), on his way to a new job, and an Australian woman, Hannah (Alice Cummins), grieving some unspoken loss. rugged terrain cuts to a close-up of Tukten’s crinkled face as he awakens in the morning glow; a long scene of Hannah stripping in a dimly lit bedroom is followed by an image of a peak glistening in the moonlight against a dark sky. The rumbling of winds thickens the silence of these shots. There’s little dialogue, no discernible story, no neat beginning or end: just a portrait of the smallness of humans against the monumentality of nature. (Stream it on the Criterion Channel.) ‘Robe of Gems’ The entwined stories of three women, all victims of misogyny in Mexico, unfurl slowly in Natalia López Gallardo’s sinister, cryptic drama. Isabel (Nailea Norvind) is a wealthy, white, blond woman moving into her mother’s grand, rural house with her family, and grappling with marital trouble with her husband. Her longtime maid, María (Antonia Olivares), is looking for her kidnapped sister, one of the many women gone missing amid the drug and gang violence in Mexico. And La Torta (Aida Roa), a local cop, tries futilely to keep her teenage son in check as he sinks deeper into the cartel world. In a bravura opening shot, a luminous forest comes slowly into view, and we see a man snipping at the scrub, though the sounds we hear are incongruous — a woman’s moans. A reversal in perspective reveals that we’ve been looking out from the wife’s point of view as she’s pressed up against the glass wall of her new house by her husband, in a sexual act that soon turns to silent, unexplained violence. Throughout, “Robe of Gems” employs such canny shifts in perspective and tricks of sound. If the narrative can feel obscure or difficult to follow, it’s because the movie palpably renders the fog of fear, menace, desperation and inequity that embroils these women, rendering their lives illegible even to themselves. Q

: Some thoughts vanish from my brain as soon as I think of them. Why can’t I remember things I just knew? And how can I improve my short-term memory? A: Perhaps you smile and shake hands with a new acquaintance, and then promptly forget the person’s name. Or maybe you walk into your kitchen to do … something. What was it again? Exasperating as it is, this type of forgetfulness is usually normal, said Dr. Sharon Sha, a professor of neurology at Stanford University. When we blank on information we just learned or thoughts we just had, it’s typically because our brains didn’t save them as long-term memories to begin with, Sha said. We don’t always make memories When going about your daily life, your brain holds information in a temporary state called working memory, said David Gallo, a professor of psychology at the University of Chicago. Having a phone conversation while following a dinner recipe, for instance, involves juggling multiple tasks in your working memory at once, he said. Most people can only hold about four or five thoughts or tasks in their working memories at a time, Gallo said. But unless those thoughts go through a brain process called encoding, he added, they won’t be saved permanently in your long-term memory. This works like a computer’s “save” function, said Dr. Scott Small, director of the Alzheimer’s Disease Research Center at Columbia University. “If you’re taking notes and you close your computer without saving, your notes are gone forever,” he said. The encoding process involves creating meaningful connections between brain cells and requires ample working memory. So if you’re preoccupied with introducing yourself to someone new or deciding what you’ll say next, your brain won’t encode information like the new name you hear — and you’ll promptly forget it. While these lapses may seem frustrating in the moment, they’re actually essential for your day-to-day functioning, said Lynne Reder, a professor emeritus of psychology at Carnegie Mellon University. If our brains encoded everything we saw, heard, smelled or felt, we wouldn’t have any working memory left for things like walking, talking or listening. How to remember Sometimes it’s easy to remember information, Sha said. If you feel a strong emotion such as fear or trauma in the moment you learn something, for in-

But there are other tricks and tactics, experts say, that can help us purposefully save memories for the long-term. Repeat and recite. Repeating information, especially in new ways, can assist with memory storage, said Ronald Davis, a professor of neuroscience at the University of Florida. When we hear, see, recite aloud or write down a word, we get several chances to encode that word using different pathways in the brain. Studies also suggest that writing new information by hand — be it on paper or a tablet with a digital stylus — can activate more of the brain than typing can, further strengthening our memories. The more times we repeat something, the more likely we are to remember it, Davis said. Assign meaning. Remembering arbitrary information can be particularly challenging, Reder said. That’s why it is sometimes easier to recall names that

are connected to certain characteristics or qualities. We might remember a dog named Rusty if it had rustcolored fur, for example. “If you meet someone named Michelle who’s from Florida, you can imagine a Florida beach with a seashell, which sounds like Michelle,” Gallo said. “Now you can associate that name with a context, visual image and rhyme.” Sing along. On a similar note, remembering can come easier when information is set to tunes, Sha said. You might remember an advertisement jingle, for example, even if it’s for a product you’d never buy. Neuroscientists are still learning why music helps, but Sha said that “tagging” memories with tunes might move them into different parts of the brain, making them more likely to stick. Create a visual or emotional cue. If you’re trying to remember to perform a specific task, Sha said that it can help to imagine yourself doing it or thinking about how it’ll make someone feel. If you need to buy a holiday gift for your daughter, for instance, you can picture yourself purchasing the item, or imagine how happy it’ll make your daughter when she opens the present. Prioritize sleep and exercise. As with many things in life, it’s more challenging to encode new information when you’re sleep deprived, Gallo said, so it’s crucial that you get enough rest. Regular activity such as aerobic exercise, weight lifting, stretching or even short walks can also enhance memory, both in the short term and over time, experts said. Keeping your heart healthy through exercise helps keep your brain healthy, Gallo said. “This can help you age gracefully, and keep your memory functioning optimally at any stage of life.”

I

n the spring of 2022, Philip Jacobs, an artist and fossil hunter, was walking along the Jurassic Coast in southern England when he came across a snout. It was about 2 feet long, complete with teeth, and appeared to have come from an ancient ocean predator known as a pliosaur. When crews returned days later with a drone, they found the snout had fallen from a cliff towering over the beach — embedded in the cliff was the rest of the skull. The more than 6-foot-long fossil, with the skull intact and no bones missing, is the “discovery of a lifetime,” one expert said. “There are some special features in it that we haven’t seen on the previous ones that have been discovered,” Steve Etches, a paleontologist who has been collecting fossils for more than 40 years and was involved in the excavation, said by phone recently. “And it’s the most complete. So the whole skull is there; there are no bones missing.” Pliosaurs were the largest carnivorous reptiles that ever lived, Etches said, and reigned at the top of the food chain in the seas of the Jurassic Period. They were probably solitary hunters who preyed on plesiosaurs and ichthyosaurs, other marine reptiles, he added. “They are rather like lions on the Serengeti,” Etches said of pliosaurs. “You get a pride of lions, but thousands of antelope and everything else. It’s the same as the Jurassic seas.” The skull is being kept in The Etches Collection Museum of Jurassic Marine Life in Kimmeridge, around 7 miles west of the Jurassic Coast and more than 100 miles southwest of London. Etches said the museum was working to get the skull into a display case for viewing in January. Pliosaurs lived between 200 million and 65.5 mil-

lion years ago, and could grow to more than 40 feet long. With extremely powerful jaws, massive flippers and daggerlike teeth, they could quickly hunt and crush prey into bite-size pieces, said David Martill, an emeritus professor of ​paleobiology at the University of Portsmouth in England, who was not involved in the find. “There was nothing in the ocean that could have escaped an attack,” he said. The first pliosaur fossils were found in the 1820s along the Jurassic Coast, and further discoveries have expanded scientists’ knowledge of the creatures. But nothing has come close to the nearly intact skull, Martill said. “One, it’s enormous,” he added. “It’s also extremely wellpreserved.” The skull could offer new clues about the pliosaur, which had a nostril that would let water flow into its mouth, allowing it to smell and hunt prey. Scientists hope the skull will shed further light on this anatomy and, ultimately, the structure of the ecosystem in the Jurassic seas. More details about the skull will be shown in the documentary “Attenborough and the Jurassic Sea Monster,” airing on PBS in February. “We want to compare that ecosystem with other ecosystems — Cretaceous ones and even modern ones — to see if they are structured in the same way,” Martill said. The fact that some vertebrae remain attached to the skull suggests the rest of the pliosaur may be inside the cliff, waiting to be discovered, he added. Etches is sure of it, but excavating it will not come cheap: It could cost about 250,000 pounds, or about $300,000, which he hopes to raise. “We really need to extract it,” he said, acknowledging a crew of people who helped to bring the discovery to light. “And they’ve done it for the best possible reasons, for science, and so people worldwide can benefit from the information we get from it.”

Could a drug give your pet more dog years? By EMILY ANTHES

T

he life of a pet dog follows a predictable trajectory. Over time, the floppy-eared puppy that keeps falling asleep in his food bowl will become a lanky-legged adolescent with an insatiable interest in squirrels — before eventually settling into adulthood as a canine creature of habit, with a carefully chosen napping location and a well-rehearsed greeting ritual. But as the years progress, his joints will stiffen and his muzzle will gray. And one day, which will inevitably arrive too soon, his wagging tail will finally still. “When you adopt a dog, you’re adopting future heartbreak,” said Emilie Adams, a New Yorker who owns three Rhodesian Ridgebacks. “It’s worth it over time because you just have so much love between now and when they go. But their life spans are shorter than ours.” In recent years, scientists have been chasing after drugs that might stave off this heartbreak by extending the lives of our canine companions. On Tuesday, the biotech company Loyal announced that it had moved one step closer to bringing one such drug to market. “The data you provided are sufficient to show that there is a reasonable expectation of effectiveness,” an official at the U.S. Food and Drug Administration informed the company in a recent letter. (Loyal provided a copy of the letter to The New York Times.) That means that the drug, which Loyal declined to identify for proprietary reasons, has met one of the requirements for “expanded conditional approval,” a fast-tracked authorization for animal drugs that fulfill unmet health needs and require difficult clinical trials. The drug is not available to pet owners yet, and the FDA must still review the company’s safety and manufacturing data. But conditional approval, which Loyal hopes to receive in 2026, would allow the company to begin marketing the drug for canine life extension, even before a large clinical trial is complete. “We’re going to be going for claiming at least one year of healthy life span extension,” said Celine Halioua, the founder and CEO of Loyal. Whether the drug will actually deliver on that promise is unknown. Although a small study suggests LOY-001 might blunt metabolic changes associated with aging, Loyal has not yet demonstrated that it lengthens dogs’ lives. But the letter, which came after years of discussion between Loyal and the FDA, sug-

A team of academic researchers is conducting a canine clinical trial of rapamycin, which has been shown to extend the lives of lab mice. And Loyal is recruiting dogs for a clinical trial of another drug candidate, dubbed LOY-002. These developments are a sign of the accelerating pace of the science and the seriousness with which researchers and regulators are taking a field that once seemed like science fiction. They also raise questions about what it might mean to succeed, said Daniel Promislow, a biogerontologist at the University of Washington and a co-director of the Dog Aging Project, which is conducting the rapamycin trial. “What if it works?” he said. “What are the implications?” Lapping at the fountain of youth Aging may be an inevitability, but it is not an unyielding one. Scientists have created longer-lived worms, flies and mice by tweaking key aging-related genes. These findings have raised the tantalizing possibility that scientists might be able to find

drugs that had the same life-extending effects in people. That remains an active area of research, but canine longevity has recently started to attract more attention, in part because dogs are good models for human aging and in part because many pet owners would love more time with their furry family members. The drugs under investigation act in different ways. Rapamycin, which has also attracted intense interest as a potential longevity drug for humans, inhibits a protein known as mTOR, which regulates cell growth and metabolism. This year, a team of scientists including Promislow and some of his colleagues at the Dog Aging Project published an analysis of dogs that had been randomly assigned to receive either a low dose of rapamycin or a placebo for six months. Although the sample size was small, 27% of dog owners whose pets received the drug reported improvements in health or behavior, including increases in activity or playfulness, compared with 8% of owners whose dogs received a placebo. LOY-001, an extended-release implant intended for large, adult dogs, is designed to modulate a different growth-related compound: insulin growth factor-1, or IGF-1. The IGF-1 pathway has been associated with aging and longevity in several species; in dogs, it is known to play a key role in determining body size. Although the idea remains unproven, some scientists hypothesize that high IGF-1 levels drive both rapid growth and accelerated aging in large dogs, which generally have shorter life spans than small ones. Loyal’s own research, which has not yet been published, suggests that LOY-001 does reduce IGF-1 levels in dogs and that it might curb aging-related increases in insulin; an observational study of nearly 500 dogs also suggested that lower insulin levels were correlated with reduced frailty and a higher quality of life. “It’s quite an exciting approach,” said Colin Selman, a biogerontologist of aging at the University of Glasgow, who was not involved in the research and had not personally reviewed the company’s data. But proving that a drug can actually extend canine lives will require large, timeconsuming clinical trials. Although some are underway, it will be at least several more years before the results are in. And regardless of the drug, researchers will need to demonstrate that it adds good, healthy years to a dog’s life, rather than just drawing out their decline, experts said. Canine conundrums It is too soon to say what longevity drugs

will cost, but Halioua predicted that LOY-001 would work out to “mid-double-digit dollars per month.” For some owners, cost will not be a deterrent, said Karen Cornelius of Illinois, who has owned mastiffs and other “giant” breeds for decades. Many died when they were about 9 years old, said Cornelius, who runs several Facebook groups for owners of giant dogs. “We were just having a discussion on one of my forums yesterday about how shortlived they were, and how people would give almost anything if they could extend that life,” she said. Some ethicists worried that this enthusiasm could be exploited, especially if the drugs are advertised as fountains of canine youth while questions of long-term safety and efficacy remain unresolved. The dogs themselves cannot give consent, they noted. “Is it in their best interest to live a little bit longer when there’s some risk to taking these drugs?” said Rebecca Walker, a philosopher and bioethicist at the University of North Carolina at Chapel Hill, who said she would not give a longevity drug to her golden retriever. “Or is it really in the best interest of their owners, who are very attached to them?” The worst side effect of LOY-001 has been mild and temporary gastrointestinal distress, Halioua said, although she acknowledged that the bar for safety would be “extremely, extremely, extremely high.” Longevity drugs are intended for healthy dogs, which changes the risk-benefit calculus. “It’s one thing if a dog is on death’s door and you’re giving them some late-breaking treatment,” said Bev Klingensmith, a Great Dane breeder in Iowa who also has a Great Dane and a golden retriever of her own. “Giving my young, healthy dog a brand-new drug would seem a little scary.” Even drugs that deliver on all their promises will raise ethical questions. “If animals are living longer, do we have the resources and commitment to provide lives worth living?” Dr. Anne Quain, a veterinarian and an expert on veterinary ethics at the University of Sydney, said in an email. “What if we see more dogs outliving their owners?” Reforming the breeding practices that have contributed to life-shortening health problems in many dogs and expanding access to basic veterinary care might be a better way to improve canine lives, she added. “We can save many ‘dog years’ by ensuring that as many dogs have access to that care as possible,” she said.

Tommy DeVito loves New Jersey, and New Jersey loves him back

A

t Natoli’s Italian Deli in Secaucus, New Jersey, in the shadow of MetLife Stadium, one can now order the Tommy DeVito hero — chicken parm a la vodka — just like the breakout New York Giants quarterback likes it. In the past month, DeVito, raised across the Hackensack River in Cedar Grove, has rocketed from third-string obscurity to star on the often-dismal Giants, keeping their longshot playoff chances alive -- barely -- and becoming an icon of the greater Meadowlands metro area. DeVito, 25, grew up loving the Giants, his mother’s chicken sandwiches and watching his father, a plumber, fix boilers. Now he is known as “Tommy Cutlets,” a nickname he scribbled on fans’ white tank tops during an event at Primo Hoagies in nearby Wayne. He posed for selfies pursing his fingers Italianstyle in his signature touchdown celebration. A hometown NFL hero might seem like an anomaly in an era of free agents, multimillion-dollar contracts and teams without local roots. But when DeVito materialized in the Meadowlands, he drove home the truth that a “New York” team has actually played in one state over for nearly half a century. That state is

now staking an ownership claim. Tommy Cutlets has become the toast — or maybe the bruschetta — of the towns that lie in the shadow of MetLife Stadium. At Lombardi’s Bar and Restaurant in Cedar Grove, where the DeVitos live down the street and have been customers for years, the owner seized on a mafia analogy to describe DeVito’s sudden prowess. “He’s the don now,” the owner, Al Lombardi, said. The don still lives with his parents less than 10 miles from the stadium, but he is ubiquitous on the back pages of tabloids and social media. DeVito started and won three straight games for the Giants, including a thrilling comeback at home against the favored Green Bay Packers last week on “Monday Night Football,” before crashing back to earth in Sunday’s gruesome 24-6 road loss to the New Orleans Saints in which the quarterback was sacked seven times. Hardcore fans here have followed his career for years, from peewee leagues to a high school state championship for Don Bosco Prep, the football powerhouse in Ramsey, New Jersey, and then Syracuse University and the University of Illinois. Hometown hopes flagged early this year after DeVito failed to be selected in the NFL

draft, which left him living with his family and uncertain about his football future. But this spring, he headed over to the Meadowlands and walked onto the Giants practice squad as an undrafted rookie. He was riding the bench when injuries to the Giants’ top two quarterbacks opened the starting role last month. The DeVito family rooting section cheered his plays with the trademark hand gesture whose myriad meanings can include a profane, get-a-load-of-this attitude. His father, Tom DeVito Sr., in proper old-world style, would kiss the cheek of his son’s agent, Sean Stellato. The cameras love the agent, who calls his client the “Passing Paisan” and dresses in a black pinstriped suit, turtleneck and fedora. And they love the overflow DeVito contingent smoking cigars in the parking lot during pregame tailgating, amid tables of chicken parmigiana heroes handmade by a cousin and a feast of Italian food laid out in aluminum trays. Last Tuesday morning, having slept only an hour after his son’s triumph over the Packers, Tom DeVito Sr. was back to the boilers. “It’s heating season, so it’s business as usual for me,” he said. “I’m the donkey of the family.” Given his son’s sudden stardom, he said, “It’s gotten to the point I tell my workers, ‘I’m not going inside because as soon as I walk in the house, everyone’s got their Giants jerseys on.’ I can’t get any work done.” He added, “Every five seconds, my wife sends me another media request. I have 818 text messages to return. It’s just so overwhelming for him and us.” The hype has not won over everyone. A crowd of regulars at the Belmont Tavern in Belleville last Wednesday stoically sipped Seven and Sevens and debated whether the quarterback had the staying power to merit a spot on the wall of fame. “A few games don’t make a season. He’s got to earn his stripes,” said Joe Coviello, a patron from Nutley. “Once you start losing, you’re out.” Anyway, the wall already has two Tommy DeVitos: the gangster character from “Goodfellas” played by Joe Pesci, who also grew up nearby; and the real-life member of the Four Seasons singing group, another local. At Natoli’s in Secaucus, they’re sold. DeVito’s photo is in the center of a family photo gallery set up in a corner. The lunchtime crowd

last Wednesday swarmed the counter for the Tommy DeVito hero. “How do you beat a chicken parm cutlet with vodka sauce? How do you beat this kid? He’s a hero,” said Rob Gail, who was busy polishing off his own sandwich. “He’s a humble guy who lives at home with his mom and dad. I lived at home until I was 30 years old, and my mom makes great chicken cutlets. I get it.” It appears that many New Jerseyans do. Of the state’s population of roughly 9.3 million, roughly 500,000 residents identify solely as Italian American, and another 750,000 claim partial Italian ancestry, according to 2022 census figures. Teresa Fiore, a professor of Italian American studies at Montclair State University, said New Jersey has the third-largest population of Italian Americans in the country. “It’s a profoundly Italian state,” she said. “Tommy DeVito is joining a very large family of famous Italians from New Jersey.” The avalanche of stereotypes, from memes of wannabe wiseguys in track suits to “Godfather” allusions, amuses Ignacio Urbina, one of the people who coached DeVito at Don Bosco Prep, a school named after a saint born near Turin, Italy. Getting noticed for being Italian “wasn’t a huge thing at Don Bosco,” Urbina said. “It’s not exactly unfamiliar territory to Italian American families here.” But DeVito’s image has become intertwined with his ethnicity. “It’s the New Jersey thing. People still talk about ‘The Sopranos’ and ‘Jersey Shore,’ and it’s all fed into that, and people seem to eat it up,” Urbina said. He called DeVito a hardworking, confident player who regularly returns to the school, including a recent football open house where he spoke to families of prospective students. If DeVito is now a long way from high school ball, you would not know it to see him as he was swarmed by reporters at his locker after practice last Wednesday. He seemed unfazed. It could have been another afternoon practice at Don Bosco. “I appreciate all the support, and there’s a lot going on right now,” he said. “I’m just trying to be me. I’m going to let my personality show.” Back at Lombardi’s, Lombardi said he hopes the ride continues for the don of the Giants’ offense. But he was realistic. “An NFL quarterback and a mobster, there’s no difference,” he said. “Any day, it could be over.”
