he Financial Oversight and Management Board has outlined the agenda for developing the 2024 fiscal plan and fiscal year (FY) 2025 budget for the Puerto Rico Aqueduct and Sewer Authority (PRASA). The information is contained in a Dec. 22 letter sent by Financial Oversight and Management Board Executive Director Robert Mujica to Gov. Pedro Pierluisi Urrutia, Senate President José Luis Dalmau Santiago and House Speaker Rafael Hernández Montañez. The oversight board said the 2024 PRASA fiscal plan and FY25 PRASA budget must incorporate updated financial and operational information and enhance the long-term visibility of PRASA’s strategic initiatives. Specifically, the 2024 PRASA fiscal plan must include an extended fiscal plan period of 15 years. Prior fiscal plans were developed under a five-year fiscal plan period. An extended fiscal plan period of 15 years serves as a crucial foundation for decision making, strategic planning, and ensuring both resilient and responsible operations for PRASA in the long term, the board said. Under such an extended timeframe the fiscal plan must incorporate the financial benefits stemming from PRASA’s core initiatives, including the 15-year capital improvements program (CIP). Prior fiscal plans outlined ambitious CIP deployment targets of $6.5 billion over a five-year period using various funding sources. However, the 2024 PRASA
Financial Oversight and Management Board Executive Director Robert Mujica fiscal plan must include updated CIP projections over a 15-year period focusing on capital investments to PRASA’s water and wastewater infrastructure using available federal funding sources. The oversight board said that by April 1, 2024 the governor must submit a proposed 2024 PRASA fiscal plan to the board. By April 26, the board will send to the governor a notice of violation, as needed. On May 13, the governor must make revisions, and on May 31 the oversight board will certify the fiscal plan. The schedule for the process of developing, submitting, approving and certifying the FY25 PRASA budget will start on May 31, 2024 with the oversight board sending a forecast of revenues to the governor and the island Legislature, and the process will end on June 28, when the board expects to certify the FY25 PRASA budget.
Tony Croatto’s family says it has no control over use of composer’s song in NPP ad By THE STAR STAFF
“Y
o Habito Una Tierra Luz,” a song written and recorded in 1979 by the late composer Tony Croatto, has become the target of controversy for the Croatto family because the administration of Gov. Pedro Pierluisi Urrutia features it in a government advertising campaign. Tony Croatto was an Italian-born singer and composer best known for his Spanish folkloric songs from Puerto Rico. He died of cancer in 2005. Croatto’s son Hermes Croatto posted a statement on social media Wednesday night expressing his disagreement with the use of the song “Yo Habito Una Tierra Luz” (I Inhabit a Land of Light) in a seasonal ad aired by the island government. He said the family was not asked about the use of the song. “For those who have asked us about the use of the song “I Inhabit a Land of Light” in the government’s Christmas announcement, we want to let you know that we were not aware of the use of the song for this,” the
statement said. “Unfortunately, and for reasons we will not go into now, the family has no control over this song, nor did they authorize its use for the advertisement. Like everyone else, we did not find out until the commercial came out.” Hermes Croatto emphasized that the government should not be blamed for the situation. “We assume that they made an approach to use the song and the person who manages it said yes regardless of our father’s feelings of always staying out of political issues,” read the social media post that was signed by Alejandro, Mara and Hermes Croatto. The song was also used in an advertising campaign called “La Isla Estrella” by the Tourism Company under the administration of former Gov. Alejandro García Padilla.

iven the filing of a candidacy for the Senate for the District of Mayagüez by the suspended mayor of Mayagüez, José Guillermo Rodríguez Rodríguez, Popular Democratic Party (PDP) President Jesús Manuel Ortiz González asked Rodríguez on Thursday “to reconsider your candidacy, and for the good of the PDP” withdraw it and focus his energies on defending himself before justice. “I recognize the right of every person to aspire to the position they wish. As president, I guarantee fair processes to every candidate, framed in guaranteeing

candidates that comply with the requirements of the law and in the presentation of a strengthened PDP for the 2024 election,” Ortiz González said in a written statement. “This is why, although Rodríguez Rodríguez’s aspiration will be evaluated by The Candidate Qualification Commission, I reiterate the position that I have assumed in this and other cases regarding candidates and/or incumbents who face legal situations in process.” “This is a particularly delicate case since it is in an advanced judicial stage,” the PDP president added. “If Rodríguez continues with his candidacy, it is up to the Qualifying Commission to evaluate this case and make its recommendation to the Secretary General.”

da Norah Henriquez announced on Thursday that she will seek an independent candidacy for governor, after renouncing the internal primary process and disaffiliating herself from the Dignity Project (Proyecto Dignidad) party. “As a party we established a Code of Ethics to ensure the best management and behavior of members and affiliates, in the face of a citizenry affected by years of abuses and corruption,” . Unfortunately, said body of rules has not been fully enforced or used to promote healthy limits between enrollment,” said Henriquez, who is an attorney, in a written statement. At the same time, she said she recognizes that the principles that were raised as the banner of the conservative movement have become a thing of the past. “Specifically that lack of respect led me to a deep reflection on my permanence in this party,” she said. “This despite the fact that by Wednesday, December 13, 2023, in the afternoon, we had already drafted the
judicial review appeal. Considering the different internal and public dynamics between members and affiliates without due intervention that promotes a healthy interaction, in accordance with the established regulations, I understand that the party is not in a position to withstand the defense of an adverse judicial procedure.” Nilda Pérez, secretary general of the Dignity Project, said in a statement that “[i]n Proyecto Dignidad, the legal processes were rigorously established, a primary board was created with representation of both candidates for the governorship, agreements were reached for both campaigns and the party was aimed at holding it in February 2024.” “It should be noted that Proyecto Dignidad offered at all times to Ms. Henriquez, as well as to all our applicants, the guarantees of fair and equitable due process of law to advance their candidacies,” the party leader said. Rep. Aponte Hernández hails job growth By THE STAR STAFF

ew Progressive Party Rep. José Aponte Hernández on Thursday characterized the current four-year governmental term (2021-2024) as one of “jobs,” highlighting the historic drop in the unemployment rate – 5.7%, which is the lowest in 34 years – and labor participation that is close to a million people (958,200). “This four-year period, no announcements were made to create 50,000 jobs in 18 months as was done in 2012 and it never materialized; on the contrary, more than 20,000 jobs were lost,” said the former speaker of the House of
Representatives in a written statement. “This quadrennium has been different and the statistics are there for everyone to evaluate. Not only do we have the lowest unemployment rate in more than three decades, we also added 23,100 new jobs in November. This makes it clear that this has been, without a doubt, the quadrennium of jobs.” Employment grew by 2.5% in November, after a 2.7% increase in October, according to information provided by the island Department of Labor and Human Resources’ Non-Agricultural Salaried Employment Survey. “We have the highest number of people working since December 2012,” Aponte said. “Even with the demographic
reality, where the median age rose to 44.5 years and we have over 760,000 people aged 65 and over, the economy added new jobs, with the private sector leading the way with 21,100 new jobs. This means that Puerto Rico’s economic footing is in great shape and that is due to the measures that this administration has taken.” “Beyond the numbers and figures, the reality on the street is that there are jobs for anyone who wants to have one,” the veteran lawmaker added. “There is money in the economy and there is fiscal responsibility on the part of the government. Puerto Rico has experienced an economic resurgence that is unique in our history and jobs are an essential part of this.”

R
esident Commissioner Jenniffer González Colón says she is not ruling out the possibility of seeking statehood via a declaration by the U.S. Congress that Puerto Rico is an incorporated territory. In an interview with the STAR, the resident commissioner, who is vying to be the New Progressive Party (NPP) candidate for governor in the 2024 elections, noted that her first bill introduced in Congress in 2017 had a provision for pursuing statehood declaring Puerto Rico an incorporated territory. “Statehood is going to happen for Puerto Rico; the question is when that is going to happen,” González Colón said. “[...] I know it is going to happen; the question is when and what provision is going to be used to make it happen. But it is one of the examples or reforms that was used by other territories to get statehood. It cannot be discarded.” González Colón has made “governing with the people” her slogan. She proposes a multi-prong approach to attacking poverty. Federal funding by itself cannot do the job, she said. “Surprisingly, after a lot of federal funds that have been approved, you get 1% or 2% more of people living under poverty on the island,” she said. Still, she said, Puerto Rico is shut out of several key federal programs designed to lift people out of poverty such as the Supplemental Nutrition Assistance Program, commonly known as SNAP. The resident commissioner managed to get the Child Tax Credit for Puerto Rico, but with not the same amount of funds as the states. Something else that needs attention, she said, is the matter of subsidies, which are taken away from people once they join the workforce. “We should find a way to incentivize those people who join the labor force without losing some of those benefits,” González Colón said. “The idea is not to punish them so they may lose access to affordable housing or access to health care providers.”

(Jenniffer González Colón/Facebook) Another path out of poverty is education, the gubernatorial hopeful said. “We must encourage and enforce bilingual teaching in the schools,” she said.”If you lack access to power, and power is knowledge, you are literally castrating or frustrating the aspirations in terms of our kids.” Attacking poverty, she said, is “an issue of education, providing the tools and of course enforcing what is already the law.” In the area of security, González Colón said law enforcement lacks a strategy to counter narcotics trafficking in the Caribbean region. “At the United States level there is no strategy in management and counternarcotics in the region,” she said. “The United States does have a strategic approach in the Pacific in the northern area and the southern part of the United States, but not on the Caribbean border. So I did file a legislation in that regard.” She said she brought the Biden administration’s drug czar, Rahul Gupta, to the island to see firsthand the dimensions of the transshipment of drugs through Puerto Rico. Another vital problem in regard to drug violence is the fact that local usage is creating turf wars among gangs, and the resident commissioner said that as governor her cabinet would include people with experience in fighting local drug wars. Regarding the brain drain that is fac-
ing the island as many professionals and younger people leave the island for more opportunities abroad, González Colón said the key is to improve the permitting system. She said right now the government needs to cut the cost of doing business. Small to midsize businesses in Puerto Rico need to wait eight to 24 months for permits, whereas the process takes 30 days or less in Florida. In consultation with Sen. Rick Scott (R-Fla.), who installed Florida’s permitting system when he was the state’s governor, González Colón intends to emulate Florida’s experience, which includes an automated system, “not the system that the governor [of Puerto Rico] just announced
that’s not functioning.” Regarding improving incentives for teachers to take jobs when their pensions have been frozen by the Financial Oversight and Management Board, González Colón said she has been discussing the issue with the board. “I meet with retired teachers and I don’t know how they do it, living on $900 a month, having to pay rent, having to pay utilities,” she said. She said she was motivated to challenge Pierluisi, also a member of the NPP, because she feels that “the people have been left behind.” “When I visit people in their homes they ask me, ‘How am I going to pay my rent? How am I going to pay for utilities?’” “There are issues the people have and they feel that the government doesn’t see them,” she said. González Colón said she remains firm in her decision not to support Donald Trump if he is the Republican nominee for president next year. For one thing, she will be too busy between her own campaign and her congressional duties to involve herself in a national campaign, and for another thing, she is seven months pregnant. “With my work at Congress, [the fact that] I’ll be a new mother and my own campaign, I won’t have the time,” she said. Still, her decision not to support Trump is rooted in the Jan. 6, 2021 attack on the U.S. Capitol. “What happened on January 6 was a coup,” she said.

Justice Dept. recovers over $340 million in corporate lawsuits By THE STAR STAFF

he island Justice Department will close the year with more than $340 million in recovered funds, the result of multiple lawsuits filed against multinational companies and representing the rights of Puerto Ricans and particularly vulnerable populations. Justice Secretary Domingo Emanuelli Hernández noted that through the agency’s Division of Monopolistic Affairs, the agency has focused its efforts on the defense of citizens, filing a series of legal claims against companies that have engaged in deceptive practices. Collections resulting from those claims, to date, represent $344,557,580 in new revenue for the island government, with more to be received in stages. The Justice Department has several active lawsuits against companies from which they have demanded financial compensation to correct the damages caused by their illegal practices, which affect the health and access to medicines of the population, the economic situation of university students and water quality, among other impacts. Emanuelli said the actions taken by the agency he heads

will translate into direct services to citizens. Among the settlements are those brought against companies involved in the opioid epidemic and manufacturers of e-cigarettes. The Monopolistic Affairs team represented the commonwealth government in the lawsuit against insulin manufacturers Eli Lilly & Co., Eli Lilly Export, Novo
Nordisk Inc. and Sanofi Aventis, and pharmacy benefit managers Express Scripts Inc., CaremarkPCS Health, Caremark Puerto Rico and OptumRx Inc., for having engaged in unfair and deceptive business practices that have illegally raised the price of insulin over the past decade to 1,200% of its original cost. They control most of the market in the United States and their effects are reflected in Puerto Rico. In turn, the island will receive more than $2 billion through the announcement of the historic agreement by which Johnson & Johnson, as well as distributors AmerisourceBergen, Cardinal Health and McKesson, must make a disbursement of $26 billion nationwide. The companies agreed to settle thousands of lawsuits filed by state and local governments in the mainland United States and Puerto Rico, whose residents were affected by pharmaceutical companies, distributors and companies involved in the opioid epidemic. In addition to financial compensation, several bans were imposed in order to stop the aformentioned companies from the practices that led to the public health emergency, and distributors were required to implement corrective measures.
Digital car stickers can now be registered with Autoexpreso By THE STAR STAFF
P
uerto Rico Innovation and Technology Services (PRITS) Office Director Antonio Ramos Guardiola and Transportation & Public Works (DTOP by its Spanish acronym) Secretary Eileen Vélez Vega announced Thursday that citizens whose digital car sticker was defective will now be able to register it with the AutoExpreso application to pay tolls. The announcement comes three months after the new digital vehicle sticker went into effect. “Previously, citizens who received a new digital tag seal were facing problems registering it as a toll stamp,” the PRITS director said. “We diligently attended to this situation with AutoExpreso staff so that citizens, as in our CESCO Digital application, could carry out all the procedures online through the AutoExpreso application or portal without the need to visit the offices.” The official stressed that people who register their tag stamp to use the toll do not need to activate the auto recharge or provide credit card information if they do not wish to do so. For people who do not have a seal eligible for a digital tag, acquiring a new toll seal is unnecessary since the tag seal has no cost. They will only need to go through the regular process of paying annual fees in the month corresponding to their renewal. A digital tag stamp that is activated for toll use will have a single charge of $7. The DTOP secretary noted that “the implementation of the digital tag during recent months has been in phases taking into consideration the needs of the users.” “That is why this new alternative of registering it in the AutoExpreso is simple and allows you to complete the
procedure in less time,” Vélez Vega said. People who have not registered their account with AutoExpreso and who have a seal eligible for digital tag and wish to use it for toll purposes, as well as people who have a seal not eligible for tag purposes and acquire a new one for both functions (tag and toll), or people who did not have any seal and acquire the tag seal and at the same time wish to use it for tolls, must create an account in AutoExpreso and confirm the email. Then they must select the “existing stamp” option and fill out the boxes with stamp information, including the stamp and serial numbers. The serial number for the digital label seal can be obtained on the seal itself or through the CESCO Digital application. People who have already registered their account with AutoExpreso and their seal is eligible for label use will not need to carry out any additional procedures. On the other hand, people whose AutoExpreso seal is not suitable for label use must unlink their ineligible seal through the AutoExpreso mobile application or portal and register their new seal through the same AutoExpreso app. Ramos Guardiola recommended that citizens register their toll stamp in AutoExpreso since this will give them better visibility in order to monitor and recharge their account balance. They will receive notifications of low balance, which is a benefit for avoiding fines, which he noted are inactive at the moment. Also, users will receive recharge notifications when they make them. According to reports, nearly 70,000 citizens have completed the tag renewal process through the CESCO Digital application since the digital tag was announced last September. Ramos Guardiola reiterated that the renewal
process can be done through the application, so that “we speed up the process even more and allow citizens to carry out their procedures at their convenience.” To date, more than 619,000 digital tag renewals have been successfully completed. That figure should increase dramatically in the coming days given that December is when the most car sales are made and the number of renewals increases.
Transportation and Public Works Secretary Eileen Vélez Vega said the “new alternative” of registering the digital vehicle sticker with the AutoExpreso application “is simple and allows you to complete the procedure in less time.”

‘We are not equipped to deal with this.’ Migrant surge overwhelms US border. By NATALIE KITROEFF
A
t a remote spot in the Arizona desert, near a hole in the border wall, dozens of migrants huddled over wood fires. After fleeing war in Sudan, violent gangs in Central America or Mexican cartels, the men had all crossed into the United States illegally, walked on foot over rugged terrain for hours and arrived at this outpost exhausted, hungry and cold. They wanted to turn themselves in to authorities to ask for asylum but were stranded here, miles from the closest town, Sásabe. Then, as temperatures dropped Tuesday night, a convoy of Border Patrol agents rolled in, loaded the men into a van to be processed and sped away — off to search for more people in need of rescue. “We are not equipped to deal with this,” Scott Carmon, a Border Patrol watch commander, said while surveying the muddy encampment. “It’s a humanitarian disaster.” This is the crisis unfolding at the southern border, as migrant encounters once again hit record levels and test the capacity of American law enforcement to contain an explosion of illegal crossings with far-reaching repercussions for the Biden administration. Thousands of migrants are arriving at the border every day, trekking from the farthest reaches of the globe, from Africa to Asia to South America, driven by relentless violence, desperation and poverty. In May, the Biden administration briefly celebrated when crossings declined, even after pandemic-era border restrictions were lifted and many feared the floodgates would open. But the numbers have spiked in recent months, provoking sharp criticism from both parties and fears within the administration that the issue will damage Democrats’ electoral future. Last week, the number of apprehensions reached more than 10,000 a day — stretching the resources of the Border Patrol and overwhelming small towns on both sides of the border, where people have been funneled by smugglers consolidating new routes to evade capture by U.S. authorities. “In terms of migrants per day, De-
cember 2023 is bigger than any average we have ever seen,” said Adam Isacson, a migration expert at the Washington Office on Latin America. “Every official who is commenting on it, on all levels, says they’re near or past the breaking point.” Secretary of State Antony Blinken and other senior officials traveled to Mexico on Wednesday to discuss the spike in migration with President Andrés Manuel López Obrador, while U.S. officials monitored a new caravan of more than 2,000 migrants moving north through the country toward the United States. The caravan is unlikely to make it to the United States, experts said, but it has drawn significant media attention to the tide of migrants who have already crossed the border en masse. Mexico has been a stalwart enforcer of U.S. border restrictions, detaining a record number of migrants this year, government figures show. But in December, the National Migration Institute, a government agency, suspended migrant deportations from the country because of a lack of funding, according to an institute official who was not authorized to speak publicly. Experts and officials are still piecing together exactly what’s behind the recent migration swell. Among the leading theories: larger numbers of Mexicans who seem to be fleeing cartel turf battles across the country, rumors about the end of a key legal pathway that may have prompted a rush to cross and smugglers who have pushed desperate people of all nationalities to try to enter at increasingly remote parts of the border. “If you move to a place that’s super remote, there won’t be a lot of agents on staff, and that increases your chances of being released into the U.S.,” Isacson said. “There is nowhere to put people. They can’t hold you.” Izzeddin, a 32-year-old migrant from Sudan, was among about a dozen men from his homeland at the Arizona encampment Tuesday. He sipped sugary coffee provided by an aid group, No More Deaths, that has helped keep migrants alive with blankets, food and 911 calls to address life-threatening injuries. “We came here because we need

A raging civil war in Sudan has driven millions from their homes, including these men, who said they lost family members and left loved ones in refugee camps to trek to the United States. In Sudan, Izzeddin said, “we saw people being killed, raped.” He and his companions, he said, were all waiting for one thing: “Border Patrol to come pick us up and give us protection.” Often, migrants who get to the United States and ask for asylum — protection from political or other persecution at home — do not actually get their claims screened upon arrival. Because of the limited capacity to detain people at the border, many are instead released with a court date for a judge to evaluate their cases. The process can take years. In Arizona, border officials closed a key port of entry to legal crossings in early December to focus on the unlawful ones. Carmon pleaded for more resources. “Give us more help; give us FEMA,” he said, referring to the Federal Emergency Management Agency.
Last week, workers from No More Deaths evacuated migrants caught in a rainstorm to a nearby Border Patrol facility, a spokesperson for the group said. “If we had a flooded city and people needed to get evacuated, they would drive National Guard trucks, those big cattle trucks, and put our citizens in them,” Carmon said. “Why they’re not down here helping us transport these people to safety and warmth, I don’t know.” For Izzeddin, being exposed to the elements in the desert felt a lot safer than staying in Sudan. “It doesn’t matter if it’s cold,” he said. “There is peace here.”

T
he Michigan Supreme Court earlier this week gave Donald Trump an important victory in the legal battle over his eligibility to return to the White House by allowing the former president to appear on the state’s primary ballot in February. But in a narrow ruling, the court left the door open for a new challenge to bar Trump from the general election ballot in the key battleground state over his attempts to overturn the 2020 election. The decision was the latest in the highstakes efforts to block Trump from returning to power. It follows the bombshell ruling by the Colorado Supreme Court, which on Dec. 19 determined in a 4-3 opinion that Trump should be removed from the state’s 2024 Republican primary ballot for his role in the Jan. 6, 2021 attack on the U.S. Capitol. Lawyers across the country are venturing into largely unexplored legal terrain that could have far-reaching implications for future elections as they argue over a constitutional amendment passed after the Civil War. The provision, Section 3 of the 14th Amendment, disqualifies people who served as federal officers and “engaged in insurrection or rebellion” from holding office. The original intent was to bar Confederate officials from serving in the U.S. government. But the courts and Congress have not clearly established how the
provision should be interpreted today, or how much latitude states have to remove candidates from the ballot. Jocelyn Benson, Michigan’s secretary of state, said in a statement Wednesday that the state’s top court had rightly concluded that she lacked the authority to prevent Trump from appearing on the primary ballot. But she called on the U.S. Supreme Court to promptly provide guidance on his eligibility to run for office. “I continue to hope they do this sooner rather than later to ensure that we can move forward into 2024’s election season focused on ensuring all voters are fully informed and universally engaged in deciding the issues at stake,” she wrote. The cases nationwide are being litigated with enormous urgency because primary voters will start casting ballots in Iowa in mid-January. Trump applauded the Michigan ruling on social media. “We have to prevent the 2024 Election from being Rigged and Stolen like they stole 2020,” he wrote on his platform, Truth Social. Ron Fein, the legal director of Free Speech For People, which filed the lawsuit seeking to disqualify Trump, said the Michigan Supreme Court ruled narrowly, sidestepping the core questions at the heart of the case. But, he noted in a statement, “The Michigan Supreme Court did not rule out that the question of Donald Trump’s disqualification for engaging in insurrection against the U.S. Constitution may be resolved at a later stage.” Michigan’s primary will be held Feb. 27.

The efforts to disqualify Trump present the U.S. Supreme Court with one of its most politically explosive cases since it settled the dispute over the 2000 election in President George W. Bush’s favor. The question ofTrump’s eligibility is widely expected to be answered by the U.S. Supreme Court. Some form of challenge to his eligibility has been lodged in more than 30 states. Many of those challenges have already been dismissed, and officials in some states, including California, have signaled that they are wary of the efforts to have the former president removed. But several challenges are still pending. Maine’s secretary of state is expected to soon decide whether Trump can appear on the ballot there after a challenge from voters under the same section of the 14th Amendment. In Oregon, the same group that filed the Michigan lawsuit is also seeking to have the courts remove Trump from the ballot, although the secretary of state there declined to remove him in response to an earlier challenge. A key difference between the Michigan and Colorado decisions was that the latter followed a trial that established an evidentiary basis to find that Trump incited a violent uprising after losing the 2020 election. In Michigan, the lawyers challenging Trump’s eligibility sought a similar trial but were turned down by the courts. The Michigan ruling included a dissent by Justice Elizabeth M. Welch. While she agreed with the decision allowing Trump to remain on the primary ballot, Welch argued that the court should have issued a more detailed ruling tackling the legal questions at play. Welch said that Colorado state law made clear that political parties could only put forward “qualified” candidates in a primary presidential ballot. Michigan election law includes no such requirement, she wrote. The Michigan secretary of state “lacks the legal authority to remove a
legally ineligible candidate from the ballot once their name has been put forward by a political party,” Welch wrote. Ashraf Ahmed, a professor at Columbia Law School who studies election law, said the U.S. Supreme Court would be taking up a case on legal issues that have rarely been decided by courts. “When we’re talking about how uncharted this is, this is radically new territory,” Ahmed said. “And it’s radically new territory because we’ve never had a president before who could plausibly be implicated under Section 3.” He said that he expected the court would want to hear the case quickly, but that the justices would most likely avoid delving into the weightiest matters, like defining Section 3 of the 14th Amendment. Instead, he said, they might issue a ruling largely on procedural grounds. “I suspect the last thing that the U.S. Supreme Court wants to get involved in is the presidential election,” he said. The Supreme Court in Michigan, a swing state that Trump lost in 2020 to President Joe Biden, is composed of seven justices: Three were elected after being nominated by Democrats, one was recently appointed by the current Democratic governor, and three others were appointed by a Republican governor and later elected. A lower-court judge previously decided the ballot eligibility case in Trump’s favor. Judge James Robert Redford of the Court of Claims in Michigan ruled in November that disqualifying a candidate through the 14th Amendment was a political issue, not one for the courts. A lower court in Colorado had also ruled in Trump’s favor before the state Supreme Court there took up the case. Redford also ruled that Michigan’s top elections official did not have the authority alone to exclude Trump from the ballot. Free Speech for People appealed the ruling, asking the state Supreme Court to hear the case on an accelerated timetable. Benson, the Michigan secretary of state and a Democrat, echoed the request for a quick decision, citing approaching deadlines for printing paper primary ballots. She wrote that a ruling was needed by Dec. 29 “in order to ensure an orderly election process.” Jan. 13 is the deadline for primary ballots to be sent to military and overseas voters; absentee voter ballots must be printed by Jan. 18.

T
he collapse of Silicon Valley Bank, the conviction of Sam Bankman-Fried, the reassertion of union power and the turmoil at OpenAI were just some of the big business stories in a year that was full of them. DealBook has chosen some of the biggest newsmakers, stories and trends from 2023. The world races to regulate AI Artificial intelligence had a good year. Investment poured into AI startups; Big Tech firms deployed their scale and cloud computing operations to build ties with the field’s new leaders; and Nvidia became the first chipmaker to hit a market capitalization of $1 trillion thanks to demand for its AI semiconductors. The investor enthusiasm was matched by worry among lawmakers, who often struggled to keep pace with the companies developing the technology. But the first steps toward developing regulations for AI have been taken. President Joe Biden issued an executive order in October focused on the technology’s implications for national security; China imposed restrictions on certain types of AI; and European Union lawmakers passed one of the world’s first regimes to regulate the technology. But amid the disparate efforts, there was also an attempt to achieve some measure of international collaboration. Last month, more than two dozen countries, including rivals U.S. and China, tech executives and researchers attended Britain’s AI Safety Summit. The event didn’t end with an agreement for a new set of rules, but the governments warned of the dangers posed by the most advanced AI systems and agreed to keep talking. The PGA Tour and LIV Golf agree to a merger On June 6, the PGA Tour, the world’s preeminent men’s professional golf circuit, and LIV Golf, a Saudi-funded rival that was poaching top players and posed a serious threat, tentatively agreed to join forces. The decision was a stunning reversal for the PGA Tour and its commissioner, Jay Monahan, and it was negotiated in secret, angering many of the tour’s top players. The deal demonstrated the growing power of Saudi Arabia in the business of sports. The kingdom has spent billions in soccer, boxing and golf as part of a push to diversify its oil-dependent economy. But many questioned the logic of the deal and pointed to Saudi Arabia’s dismal human rights record. U.S. lawmakers want to know if the Saudi government is using sports to further its strategic objectives as a means of “sportswashing.” ‘Barbenheimer’ dominates the box office In July, two movies that were released on the same day provided a long-awaited signal that theaters had bounced back from the pandemic. “Barbie” is a comedy based on the Mattel doll and directed by Greta Gerwig. “Oppenheimer” is a biopic about the creator of the atomic bomb made
by auteur filmmaker Christopher Nolan. Together, they gave North American multiplexes their biggest weekend since “Avengers: Endgame” arrived in April 2019. Some moviegoers even watched them back-to-back. The movies opened as the Writers Guild of America and the Screen Actors Guild-American Federation of Television and Radio Artists, the union representing tens of thousands of actors, were both on strike, bringing the industry — and hopes for a consistent stream of hits — to a near standstill. The WGA reached a deal with studios in September and SAG-AFTRA reached an agreement with studios in November. Regional bank failures set off a crisis On March 10, in the biggest bank failure since the 2008 financial crisis, the government seized Silicon Valley Bank. A recap: The bank’s clients — spooked by news that the bank was working to shore up its finances and that Moody’s had downgraded its bond rating — had pulled out more than $40 billion of their deposits. On March 12, regulators shut down Signature Bank, a New York-based lender. The banks’ failures led to fears about the stability of other midsize lenders. Wall Street’s biggest banks agreed to give $30 billion to First Republic and Swiss authorities brokered a deal for UBS’ take over of its domestic rival, Credit Suisse. But even a multibillion-dollar intervention wasn’t enough to save First Republic: Federal regulators seized the lender in May sold it to JPMorgan Chase. The UAW conducts a historic strike On Sept. 14, the United Auto Workers union began its first strike that simultaneously targeted all three Detroit automakers, General Motors, Ford Motor and Stellantis, the parent of Ram, Jeep and Chrysler. The union broke from its traditional approach of idling most or all operations at one company, instead taking action at a limited number of each company’s locations. After six weeks, the workers reached tentative agreements with the three companies, giving workers their biggest pay raises in decades while avoiding a protracted work stoppage. The UAW’s success inspired it to go after nonunionized carmakers, including Tesla and foreignowned companies. Taylor Swift conquers the world The Eras Tour, Taylor Swift’s career-encompassing run of shows, was a blockbuster this year, selling $14 million in tickets each night, according to one estimate, setting it on a pace to potentially reach $1.4 billion in total sales by the time the tour ends next year. Swift, who in July broke the record for most chart-topping albums by a woman, also engineered a new type of deal for her concert film. She negotiated directly with the theater chain AMC Entertainment to release “Taylor Swift: The Eras Tour.” That allowed her to bypass big studios and keep 57% of ticket revenue. During its opening weekend in October, the film made an estimated three-day gross of $95 million to $97 million in North American theaters, easily becoming the biggest concert film opening ever. Sam Bankman-Fried is convicted On Nov. 2, after four hours of deliberation, a jury found

It was a stunning fall for Bankman-Fried, a one-time poster child of the cryptocurrency industry who was worth $20 billion just a year earlier. After FTX collapsed, many of his closest lieutenants and executives agreed to work with prosecutors and testified against him. In a trial in New York, he was portrayed as a brazen young founder, who funneled stolen money into his investments and used it for extravagant spending. Bankman-Fried, 31, is expected to appeal. He is scheduled to be sentenced March 28. U.S. businesses face new pressures in China President Joe Biden and the Chinese leader, Xi Jinping, held their first face-to-face talks in more than a year last month on the sidelines of a meeting of Asia-Pacific leaders near San Francisco. The discussions were cordial and designed to reestablish lines of communication. But Xi also sought to reassure U.S. business leaders during the trip. He hosted a banquet for business executives. Those who attended included Tim Cook, CEO of Apple; Larry Fink, CEO of BlackRock; and Stephen Schwarzman, CEO of Blackstone. Xi tried to convey that foreign business was welcome in China, despite the growing challenges of operating there amid a crackdown on companies with Western ties and the strained relationship with the U.S. Yet the dinner showed that many U.S. companies aren’t ready to give up on doing business in the country. Elon Musk berates advertisers who fled X At the DealBook Summit on Nov. 29, Elon Musk made waves after he used profane language to denounce companies that had suspended their advertising on X, formerly known as Twitter, following Musk’s endorsement of an antisemitic conspiracy theory. He also said he hadn’t meant to support bigots, and apologized for his post. World Stocks at Highest in Over a Year on Rate Cut Bets W orld stocks rallied to their highest level in more than a year on Wednesday, while the U.S. dollar hit a five-month low, as expectations mounted that key central banks such as the Federal Reserve will start to cut interest rates early next year. In line with expectations of lower interest rates, the benchmark 10-year Treasury yield fell to a five-month low, while the two-year Treasury yield tumbled to a low not seen in seven months. Investor hopes that monetary conditions might be loosening boosted the MSCI’s gauge of stocks across the globe by 0.46% to a level not seen since October 2022. On Wall Street, the Dow Jones Industrial Average added 0.21%, while the S&P 500 and the Nasdaq Composite were flat. European shares edged up 0.21%, with trade subdued given public holidays across the region on Monday and Tuesday. Analysts said the main risk for markets was that rates might not fall as fast as expected. “If global equity markets have one Achilles’ heel going into January 2024, it is the expectation that the Fed will be methodically and consistently cutting interest rates throughout the year,” said Nicholas Colas, Cofounder of DataTrek Research. The benchmark 10-year Treasury yield fell to 3.793%, and the 2-year yield retreated to 4.2375%. [US/] Expectations of rate cuts also dragged on the U.S. dollar, which fell 0.51% against a basket of six major currencies to a level last seen on Jul. 27. [USD/] The jovial mood in world equity markets and a sluggish dollar lifted the euro by 0.54% to $1.1102, more than a four-month peak. “If the Fed cuts rates because inflation has come so far down that they don’t want policy to unintentionally tighten ... then that’s probably a good scenario,” said Lou Brien, market strategist at DRW Trading in Chicago. If they cut because of a weakening economy, however, “then the history is kind of harsh” for the economy and the stock market. “The motivation behind the rate cuts is still unknown and is going to be the most important factor,” Brien said. Market pricing shows a more than 80% chance the Fed is likely to begin cutting rates next March, according to the CME FedWatch tool, with over 150 basis points of easing priced in for all of 2024. Oil prices slipped as some major shippers returned to the Red Sea - an area disrupted after Yemen’s Houthi militant group began targeting vessels earlier this month. Israeli Supreme Court ruling expected mid-January By AARON BOXERMAN
A
looming Supreme Court decision on Prime Minister Benjamin Netanyahu’s divisive plan to overhaul Israel’s courts returned to major public attention Thursday after an Israeli television channel reported that a leaked draft of the court’s ruling showed a narrow majority of the court intended to block a key part of the overhaul. The development revived Israel’s confrontation with the country’s deep fissures over the overhaul plan and threatened to disrupt Netanyahu’s fragile wartime government. The overhaul plan had prompted huge, monthslong protests that, before the war, were seen as one of the gravest domestic political crises Israel had faced in the 75 years since the nation’s founding. The New York Times has not obtained a copy of the leaked decision, and the Israeli television outlet, Channel 12, did not publish a full version of the document. A spokesperson for Israel’s courts said Thursday that “the writing of the ruling is not yet complete.” The court’s decision is expected in mid-January. The ruling has the potential to throw Israel’s unity government, formed after the Oct. 7 Hamas-led terrorist attacks, into disarray as the country wages war in the Gaza Strip and faces international pressure over the scope of its military campaign. The Channel 12 report, on Wednesday night, said that eight of the court’s 15 judges were set to overturn a law passed in July that stripped the Israeli Supreme Court of the power to overturn government actions and appointments it deems “unreasonable.” Netanyahu’s right-wing governing coalition had pushed the law through the Israeli Parliament, saying the law was needed to remove the court’s ability to overrule the will of the majority. Before the Hamas invasion, two members of Israel’s new war Cabinet — one of Netanyahu’s longtime rivals, Benny Gantz, and Defense Minister Yoav Gallant — had criticized

Netanyahu tried to fire Gallant, the defense minister, after he criticized the pace of the plan, only to reverse his decision amid widespread outrage. Should the court rule against Netanyahu, it could set off a constitutional crisis within Israel if his allies try to defy it. Regardless of the outcome, the case is considered one of the most consequential in Israel’s history. Not only could it determine the extent to which politicians are subject to judicial oversight, but it has also led to the spectacle of a court weighing in on an issue that directly affects its own powers. The law was part of Netanyahu’s wider plan to weaken the country’s judiciary, which led to the months of huge street protests. Opponents, including Israel’s chief justice and at-
torney general, said the plan — if fully carried out — would deal a fatal blow to the country’s separation of powers. But the dispute faded into the background after the Hamas attacks on Oct. 7, in which roughly 1,200 people were killed and more than 240 were taken hostage to Gaza, according to Israeli authorities. Four days after the attack, Netanyahu formed a wartime government with opponents including Gantz, the leader of the opposition National Unity alliance, who opposed the judicial overhaul. The crisis over the judicial changes was a proxy for deeper rifts over Israel’s future. Secular and liberal Israelis view the Supreme Court as a bulwark in a country that is becoming more conservative and religious.

Officials have said more than 40 people died in the blast on Tuesday, but the country’s health minister, Wilhelmina Jallah, said in a telephone interview that the number of fatalities could rise because an additional 83 people were injured. A video circulating on social media showed people running from the explosion, some of them wrapped in flames, as thick, black smoke rose from the tanker. “These guys risked their lives for little or nothing,” Jacob Vesselee, the regional traffic commander, said in a phone call.

Jerry Brown, the CEO of the John F. Kennedy Medical Center in Monrovia, the largest hospital in Liberia, said the hospital received 28 people on Wednesday with burns. Two of them have since died. He added that while the hospital has capable doctors, it does not have a specialized burn unit, forcing them to turn the trauma section into a makeshift burn unit. “Our capacity to treat burns is dismal,” said Brown, adding that the hospital could handle four or five burn cases at a time. “It’s a big challenge.”

Navalny’s comments, posted on his social network accounts and written with a heavy dose of irony and humor, highlighted his good spirits and seemed intended to assuage concerns among allies who had grown anxious about his health and status since his sudden disappearance from the public eye on Dec. 5. “I am your new Father Frost,” Navalny wrote, referring to the Russian version of Santa Claus. “I have a sheepskin coat, a hat with earflaps; I should get felt boots soon, and I have grown a beard during the 20-day transit.” But, he added, “The main thing is that I now live above the Arctic Circle.” Navalny, 47, is a longtime antagonist of President Vladimir Putin who has been subject to increasingly harsh punishment over the past year. His transfer to one of Russia’s high-security “special regime” penal colonies had been expected since September, when he lost an appeal against the 19-year sentence he is serving. But his lawyers and allies were not notified in advance that he would be moved, raising fears and speculations about his health after legal team was unable to contact him. His ability to pass a letter from a new prison suggested that Navalny would most likely remain a fixture in Russia’s public life as the country nears another presidential election that Putin is poised to win amid little genuine competition. Navalny has been in custody since his detention in January 2021 at a Moscow airport, where he had arrived after spending months in Germany recovering from poisoning
by a nerve agent. Navalny and Western governments have accused the Kremlin of the poisoning, a charge that Russian officials have denied. A former site of a Gulag labor camp, Navalny’s new snow-swept penal colony, in the town of Kharp, is one of the most remote in Russia. Known as the “Polar Wolf” colony, it is surrounded by tundra and polar mountains. Freezing dark winters give way to brisk summers with clouds of mosquitoes. Daylight is scarce, a fact he alluded to in his letter Tuesday. “I don’t say ‘Ho-ho-ho,’ but I do say ‘Oh-oh-oh’ when I look out of the window,” Navalny said, “where I can see it’s night, then evening, then night again.” Navalny said that he had not seen much of his new Arctic permafrost surroundings yet, but that he had noticed that prison guards there were different than their colleagues in central Russia. Wearing warm mittens and felt boots, they carried machine guns and were aided by “those very beautiful fluffy shepherd dogs,” he said. A 2019 video report from the prison by a municipalowned news agency said that it had featured a library with 8,000 books, a shop, a church, and a prisoner cook who loves making big cakes. A trip to Kharp from Moscow takes more than 40 hours on a train, which departs every second day. But Navalny described a more complicated 20-day journey through the Russian prison system. He went to Moscow from his penal colony in the nearby Vladimir Region, then to Chelyabinsk and Yekaterinburg in the Ural Mountains and then through Kirov up north to Vorkuta before finally arriving in Kharp on Saturday, according to his letter. “I did not expect anyone would find me here until mid-January,” he said. “I was very surprised then when yesterday, the cell’s doors were opened with the words: ‘There is a lawyer for you.’”

Blinken meets with Mexico’s president about surge in migration at the border By HAMED ALEAZIZ and EMILIANO RODRÍGUEZ MEGA
S
ecretary of State Antony Blinken and other top American officials discussed the root causes of migration with Mexico’s president Wednesday in hopes of figuring out a strategy to slow the surge in illegal crossings at the southern U.S. border. President Joe Biden dispatched the officials to Mexico City at a pivotal moment, as border crossings have hit record numbers and there is growing pressure on Biden to solve — or at least contain — a crisis that has proved to be a consistent political vulnerability. The situation at the border is at the center of some of Biden’s biggest priorities going into 2024, particularly as Republicans in Congress demand a new crackdown on immigration in exchange for wartime aid for Ukraine and Israel. “As we made clear in Mexico City today, we are committed to partnering with Mexico to address our shared challenges, including managing unprecedented irregular migration in the region, reopening key ports of entry and combating illicit fentanyl and other synthetic drugs,” Blinken said in a post on the social media platform X, formerly Twitter. The large number of migrants in recent weeks has forced border officials to temporarily shut down several railway crossings in Texas and to close the port of entry in Lukeville, Arizona. Those actions were intended to allow border officials to redeploy their personnel to respond to the situation. But the decision disrupted business in the United States and Mexico. On Wednesday, Alicia Bárcena Ibarra, Mexico’s secretary of foreign affairs, said that “the importance of reopening the border crossings is a priority for us.”

On several occasions in recent weeks, the U.S. Border Patrol encountered more than 10,000 people a day trying to cross the border. Shortly before Wednesday’s meeting, President Andrés Manuel López Obrador of Mexico said the U.S. Congress should offer more support to Latin America instead of putting up “barriers, barbed wire fences on the river or thinking about building walls.” He added, “It is more efficient and more humane to invest in the development of the people.” López Obrador also said next year’s presidential election in the United States would bring migration to the top of the agenda. Former President Donald Trump, whose plans to erect a border wall became emblematic of his harsh immigration policies, is the leading candidate for the Republican presidential nomination. “The migration issue is going to intensify,” López Obrador said. Wednesday’s two-hour meeting also
included Alejandro Mayorkas, the homeland security secretary, and Liz SherwoodRandall, the White House homeland security adviser. Mexico has taken steps to keep migrants from massing along the border in the past. But earlier this month, the Mexican government suspended migrant deportations because of a lack of funding, according to an official from the government’s National Migration Institute who was not authorized to speak publicly. During the Trump administration, Mexico agreed to take migrants under a policy known as “Remain in Mexico.” The migrants waited in border towns for months as they awaited court hearings in the United States, a key pillar of Trump’s crackdown on asylumseekers. Later, during the institution of Title 42, a measure that allowed border agents to quickly expel asylum-seekers, Mexico agreed to take in migrants from other countries. Biden has struggled to keep the numbers down despite trying to institute limits on asylum access at the border and deporting migrants to Venezuela and Cuba. He has also said he is willing to make “significant compromises” with Republicans on the border if Republicans will agree to aid for Ukraine and Israel. A caravan that began its journey north Sunday reflects the challenges in curbing migration. Migrant caravans have become a common phenomenon and are usually broken up by authorities well before they reach the U.S. border. The latest caravan, roughly 1,000 miles south of the U.S. border in the state of Chiapas, includes people from Honduras, Haiti and Cuba, among other countries. The Mexico office of the United Nations refugee
agency said in a statement that the procession was starting to disperse and consisted of more than 2,000 people. It initially included approximately 5,000 people, the agency said. Republicans have stepped up their attacks on Biden over the border numbers, a continuing issue for the president as he seeks reelection next year. In Texas, Gov. Greg Abbott signed a law that authorizes law enforcement officials in his state to arrest migrants who cross without authorization. (El Paso County challenged the measure in federal court last week.) The president has also faced pressure from mayors in Democratic cities over the increase in migrants arriving in their cities. Last week, López Obrador briefed reporters about a call with Biden in which they agreed that more enforcement at the border was needed. “Now we have an extraordinary situation because the number of migrants passing through our country with the purpose of reaching the United States has increased,” he said, adding that Mexico was “going to help, as we always do.” U.S. Customs and Border Protection officials announced Friday that there were more than 190,000 apprehensions between ports of entry in November. U.S. officials said they “removed or returned” more than 400,000 people between May and the end of November. “We are facing a serious challenge along the southwest border, and CBP and our federal partners need more resources from Congress — as outlined in the supplemental budget request — to enhance border security and America’s national security,” Troy Miller, the acting leader of the border agency, said in a statement Friday.

Ukraine doesn’t need all its territory to defeat Putin By SERGE SCHMEMANN
T
he new report in The New York Times that Russia is quietly signaling a readiness to freeze the war in Ukraine is both suspicious and tantalizing. The caveats are many: An armistice would leave Vladimir Putin in control of about a fifth of Ukrainian territory. He is not trustworthy; he could use prolonged negotiations to bolster his forces for a renewed push, or to lull Western lawmakers into cutting aid for Ukraine; he may be stalling in the hope that Donald Trump, his preferred choice for president, will return to the White House and stiff Ukraine. But if Putin turns out to be serious, Ukraine should not pass up an opportunity to end the bloodshed. Recovered territory is not the only measure of victory in this war. A painful reality check shows the 600-mile-long Ukrainian-Russian front in a figurative and literal freeze, draining Ukrainian resources and lives without much prospect for change in the foreseeable future. The much-anticipated Ukrainian counteroffensive of the past six months exacted a huge cost in casualties and materiel, but barely nudged the front lines. Ukraine’s top military commander has said the fight is at a “stalemate” — a notion deemed taboo not long ago — and only an unlikely technological breakthrough by one side or the other could break it. end, lawmakers in the United States and Europe have separately held up critically needed aid packages for Ukraine, and there’s no certainty how they will fare in the new year. The conflict could still take an unexpected turn, as it has before. But the prospect at this juncture is of a long war of attrition, inflicting ever more damage on Ukraine, sacrificing ever more lives and spreading instability over Europe. The way things are going, “Ukraine will for the foreseeable future harbor Europe’s most dangerous geopolitical fault line,” argues Michael Kimmage, author of “Collisions,” a new history of the war. He foresees an endless conflict that deepens Russia’s alienation from the West, enshrines Putinism and delays Ukraine’s integration into Europe. That, at least, is the bleak prognosis if victory in the war continues to be defined in territorial terms, specifically the goal of driving Russia out of all the Ukrainian lands it occupied in 2014 and over the past 22 months, including Crimea and a thick wedge of southeastern Ukraine, altogether about a fifth of Ukraine’s sovereign territory. But regaining territory is the wrong way to imagine the best outcome. True victory for Ukraine is to rise from the hell of the war as a strong, independent, prosperous and secure state, firmly planted in the West. It would be exactly what Putin most feared from a neighboring state with deep historical ties to Russia, and it would be a testament to what Russia promised to become in 1991, when both countries broke free of the Soviet Union, before Putin entered the Kremlin and succumbed to grievance and the lure of dictatorial power and imperial illusion. Any talk of armistice is understandably difficult for Volodymyr Zelenskyy, the intrepid Ukrainian president who has steadfastly sought to project a morale bolstering picture of steady battlefield successes. It would be very painful, and politically very difficult for him, to halt the fighting without punishing Russia and by leaving it in control of so much Ukrainian land. After his senior military commander, Gen. Valery Zaluzhny, described the true state of affairs as a stalemate in an interview with The Economist in November, Zelenskyy bristled at what he perceived as defeatism. But to explore an armistice is not to walk away. On the contrary, the fight must go on, even when talks begin, to maintain the military and economic pressure on Russia. Those people who are resisting continued aid to Ukraine, whether some Republicans in Congress or Viktor Orban in Hungary, must not be allowed to abandon the Ukrainians now. If Putin is seriously looking for a cease-fire, he is doing so on the presumption that the alternative is a continued slaughter of his soldiers, and that there is nothing more he can achieve through destruction, violence or bluster. And stopping the fight is not to grant Putin a victory, however loudly he may claim one. Ukraine and much of

Russia’s army has been mauled and humiliated, and the country’s economy has been severed from the West. An armistice would not be easy to achieve or to police. But conversations and writings about various potential models have been quietly circulating in government and think tank circles. The authors of the most recent one, Samuel Charap of the Rand Corp. and Jeremy Shapiro of the European Council on Foreign Relations, argued that however dim the prospect of peace, the war “will probably end through some sort of negotiation.” The first stage of talks, they proposed, would be focused on agreeing to stop hostilities, disengaging the forces and installing a third-party monitoring mission. The next hurdle would be to devise a security arrangement that would give Ukraine the assurances it needs while taking account of Russia’s opposition to a full NATO member on its western border. Many other issues would enter into the mix — Russian war crimes, reparations, sanctions. And any armistice would be far short of a final settlement. But the only way to find out if Putin is serious about a cease-fire, and whether one can be worked out, is to give it a try. Halting Russia well short of its goals and turning to the reconstruction and modernization of Ukraine would be lasting tributes to the Ukrainians who have made the ultimate sacrifice to preserve the existence of their nation. And no temporary armistice would forever preclude Ukraine from recovering all its land.

Gobernador extiende Declaración de Emergencia por Violencia de Género POR CYBERNEWS

A FORTALEZA – El gobernador Pedro Pierluisi, firmó el jueves, la Orden Ejecutiva 2023-039 que extiende la Declaración de Emergencia por Violencia de Género hasta el 31 de diciembre de 2024. “Estamos enfrentando diversas manifestaciones de violencia física, sicológica, sexual y económica que representan un mal social complejo. Ante ello, es necesario trabajar tanto en la prevención como en la atención a víctimas teniendo como objetivo la erradicación de cualquier expresión de violencia de género. Con el estado de emergencia hemos instituido transformaciones en el manejo de este mal social y sus múltiples manifestaciones en el Poder Ejecutivo. Tales iniciativas se han implementado e integrado como política pública en las agencias del Gobierno de Puerto Rico. La obra que comenzamos el 25 de enero de 2021 con la Declaración de Emergencia no ha terminado y mucho menos nuestro compromiso inquebrantable con erradicar la violencia. Por ello, damos continuidad a las iniciativas y proyectos comenzados e implementados por el Comité de Prevención, Apoyo, Rescate y Educación de la Violencia de Género (Comité Pare)”, estableció el gobernador en la Orden Ejecutiva. La extensión de la Declaración de Emergencia, tiene como objetivo salvaguardar la asignación de recursos fiscales en los presupuestos de las agencias
y el ofrecimiento de servicios esenciales por parte de las agencias y las organizaciones no gubernamentales expertas, así como continuar desarrollando e implementado el sistema de recopilación de datos. Del mismo modo, se seguirán estableciendo alianzas con los gobiernos municipales para ampliar la red de servicios y apoyo a personas en situaciones de violencia de género. Igualmente, se continuarán concretando acuerdos de colaboración entre los municipios y el Centro de Operaciones y Procesamiento de Órdenes de Protección (COPOP) -adscrito a la Unidad de Violencia de Género y Asuntos Juveniles del Negociado de la Policía- integrando a las policías municipales en el sistema de trabajo diseñado para la atención y diligenciamiento de las órdenes de protección y el patrullaje preventivo, como parte del plan de trabajo, objetivos y metas del COPOP. La Orden Ejecutiva establece que se continuarán ampliando las herramientas para el manejo, procesamiento y la atención de las órdenes de protección, en colaboración con el Poder Judicial, las agencias y las organizaciones no gubernamentales. Además, como parte de las acciones concretas, se implementará el adiestramiento y capacitación continua del personal público sobre los protocolos adoptados para la atención y manejo de la violencia de género en toda manifestación. Igualmente, se desprende de la OE que las cam-
pañas de prevención y educación contra la violencia tendrán continuidad, así como el desarrollo de planes y programas necesarios entre las agencias y las organizaciones no gubernamentales para la atención y apoyo de las víctimas secundarias de la violencia de género, sobre todo los y las menores que son víctimas secundarias de feminicidios. Del mismo modo, se revisarán y establecerán programas efectivos para la rehabilitación dirigida a romper el ciclo de la violencia de género y se continuará implementando el currículo de equidad y respeto entre los seres humanos en las escuelas del sistema público de enseñanza.

Rockwell begins this wrenching character drama in New York City circa 1994, and nicely recaptures the look and feel of Gotham indies of that era. But that’s not just window dressing. Stephen Scarlata’s giddily entertaining documentary tracks the evolution of these pictures, from the direct rip-offs of the ’70s and ’80s to their utterly insane contemporary counterparts, the cheapo disaster hybrids of the “Sharknado” ilk. But it also drills deeper, running down the history of sharks in fiction in general, as well as the (often negative) effects these works have had on the public perception of these much-maligned animals. (Shudder) ‘De Humani Corporis Fabrica’: The latest effort from the accomplished documentary filmmakers Véréna Paravel and Lucien Castaing-Taylor combines a distinct nonfiction film style — the fly-on-the-wall institutional portrait, most frequently identified with Frederick Wiseman, focusing on a French hospital — and a more experimental approach, utilizing specialized cameras to explore the interiors of the human body during medical procedures. The latter footage, while not for the squeamish, is fascinating, taking a detached and almost fantastical view of our organs and orifices that’s akin to the landscapes of phantasmagorical science fiction. But the straightforward documentary sections are equally transfixing, forgoing talking head interviews for overheard conversations and operating room chitchat (“This guy’s weirdly put together!”), and capturing moments of staggeringly raw emotion and vulnerability. Tom Smothers, comic half of the Smothers Brothers, dies at 86 By WILLIAM GRIMES
T
om Smothers, the older half of the comic folk duo the Smothers Brothers, whose skits and songs on “The Smothers Brothers Comedy Hour” in the late 1960s brought political satire and a spirit of youthful irreverence to network television, paving the way for shows like “Saturday Night Live” and “The Daily Show,” died Tuesday at his home in Santa Rosa, California, a city in Sonoma County. He was 86. He died “following a recent battle with cancer,” a spokesperson for the National Comedy Center announced on behalf of the family. The Smothers Brothers made their way to network television as a folk act with a difference. With Tom playing guitar and Dick playing stand-up bass, they spent as much time bickering as singing. With an innocent expression and a stammering delivery, Tom would try to introduce their songs with a story, only to be picked at by his skeptical brother. As frustration mounted, he would turn, seething, and often deliver a trademark non sequitur: “Mom always liked you best.” Hoping to reach a younger audience, CBS gave the brothers creative control over “The Smothers Brothers Comedy Hour,” a one-hour variety show that made its debut in February 1967. For the next three seasons it courted controversy as it addressed U.S. policy in Vietnam, religious fundamentalism, racial strife and recreational drug use. Running features like Leigh French’s “Share a Little Tea With Goldie,” replete with drug references, either delighted or scandalized, depending on the age and the politics of the viewer. “During the first year, we kept saying the show has to have something to say more than just empty sketches and vacuous comedy,” Smothers said in a 2006 interview. “So we always tried to put something of value in there, something that made a point and reflected what was happening out in the streets.” Tom, more liberal than his brother and largely responsible for the production of the show, brought in writers attuned to the thinking of the baby boom generation — among them Rob Reiner, Steve Martin, Pat Paulsen and Mason Williams — and stretched the boundaries of taste at every turn. “Easter is when Jesus comes out of his tomb, and if he sees his shadow he goes back in and we get six more weeks of winter,” Tom said on one show. Far more combative than his mild-mannered brother, who survives him, Tom fought network executives and censors until CBS, tired of complaints from its rural affiliates, especially in the South, abruptly canceled the show in April 1969 and replaced it with “Hee Haw,” a corn-pone counterpart to the fast-paced (and often controversial) “Rowan and Martin’s Laugh-In” that featured country music stars. “In any other medium we would be regarded as moderate,” Tom Smothers told reporters at a news conference the day after the show was canceled. “Here we are regarded as rebels and extremists.” An Army family Thomas Bolyn Smothers III was born Feb. 2, 1937, on

Shortly before the Japanese attack on Pearl Harbor, the family moved again, to the Los Angeles area, where Tom and Dick’s mother, Ruth (Remick) Smothers, had grown up. She found work in an aircraft factory. Smothers’ father remained on Corregidor in Manila Bay to fight and was taken prisoner on the Bataan Peninsula in the Philippines. He survived the Bataan Death March, but in 1945 he died of injuries sustained when American planes mistakenly bombed the prison ship transporting him to a camp in Japan. Tom Smothers attended an assortment of schools as his mother descended into alcoholism and moved from husband to husband. In 1955, he graduated from Redondo Union High School, where he was a state champion on the parallel bars. While in high school, he and Dick, two years his junior, sang in a barbershop group that won second prize on “Rocket to Stardom,” a local talent contest broadcast from the showroom of a Los Angeles Oldsmobile dealer. At San Jose State College (now University), where Tom studied advertising, the brothers decided to ride the folk music wave and formed the Casual Quintet. In early 1959, by then a trio with Bobby Blackmore as lead singer, they began performing at the Purple Onion in San Francisco, a popular showcase for folk singers and comedians, billed as the Smothers Brothers and Gawd. Gradually, the brothers introduced comic patter into their act, satirizing the folk music scene and turning their sibling rivalry — which was genuine — into shtick. The act “slowly evolved to be a running argument between two brothers who sang but never finished a song,” Smothers said in 2006. The brothers became regulars on “The Tonight Show” with Jack Paar, “The Garry Moore Show” and “The New Steve Allen Show.” They signed with Mercury Records and recorded
“The Smothers Brothers at the Purple Onion,” the first of several successful albums. They toured college campuses nonstop. In 1963, Tom married Stephanie Shorr. The marriage ended in divorce, as did his marriage to Rochelle Robley. In addition to his brother, he is survived by his wife, Marcy Carriker Smothers; their son, Bo, and daughter, Riley Rose Smothers; and a grandson. His son from his first marriage, Thomas Bolyn Smothers IV, died this year. In a statement, Dick Smothers said, “Tom was not only the loving older brother that everyone would want in their life, he was a one-of-a-kind creative partner.” In 1965, CBS gave the brothers their own sitcom, “The Smothers Brothers Show,” produced by Aaron Spelling. It did not play to their strengths: Tom played a probationary angel sent back to Earth to move in with and watch over his brother, a swinging bachelor played by Dick. The ratings were strong, but it was a miserable experience. Deprived of their instruments and a live audience, and saddled with a laugh track, the brothers struggled. “It was a nothing show,” Tom told The New York Times in 1967. “There was no point of reference, nothing meaningful, no satire in it.” After “The Garry Moore Show” failed to challenge “Bonanza” on Sunday nights, Michael Dann, the head programmer at CBS, took a chance on a Smothers Brothers variety show. Connecting with the young Expectations were low, but “The Smothers Brothers Comedy Hour” connected with viewers, especially younger ones, and outperformed “Bonanza” in the ratings. The humor was irreverent, the writing was sharp, and musical guests like the Who and Jefferson Airplane broke the varietyshow mold. A war with CBS executives began almost immediately, and a pattern quickly developed. The censors would cut words, lines or entire sketches. Smothers would fight tooth and nail to have them reinstated, often successfully. When thwarted, he would complain loudly and publicly. After CBS cut the words “breast” and “heterosexual” from an early sketch, written by Elaine May, about two professional censors (played by Tom Smothers and May), Smothers told the Times: “The censors censored the censorship bit. It’s a real infringement of our creative rights.” CBS began insisting that an advance tape of each week’s show be sent to the network and its affiliates for their review. In April 1969, when the tape of a show that included a satirical sermon delivered by comedian David Steinberg, failed to arrive on schedule for the second time, CBS informed the brothers that they had broken their contract and that the show, whose option had been renewed two weeks earlier, would be canceled. In an interview for the Archive of American Television in 2000, Smothers looked back on the show and its impact. “It was the ’60s that we reflected,” he said. “The country was going through a revolution — a social revolution, a political and consciousness revolution, about government and its part. We tried to reflect that.”

s the calendar enters winter and water temperatures in parts of the Atlantic Ocean drop, dozens of coldstunned sea turtles that washed ashore in Massachusetts in critical condition have been flown south on private planes for the winter. No, these sea turtles aren’t the most glamorous reptiles in the Northeast, but the special treatment they are receiving could save their lives. This month, conservationists with the New England Aquarium sea turtle hospital in Boston sent the largest group yet of endangered Kemp’s ridley sea turtles, 51 of them in varying conditions, to facilities in Florida, according to Adam Kennedy, director of rescue and rehabilitation at the aquarium. The aquarium needed to make room for new arrivals. It was the latest group to be flown south in recent weeks. Three weeks ago, 35 turtles were flown to facilities in North Carolina, according to a news release from the aquarium, and another 15 turtles were taken to the National Aquarium in Baltimore. Sixteen of the Florida-bound turtles were sent to the Clearwater Marine Aquarium. The rest were divided among the Florida Aquarium in Tampa, the Loggerhead Marinelife Center in Juno Beach and the Mote Marine Laboratory and Aquarium in Sarasota. When the water temperature drops below 50 degrees Fahrenheit, their internal body temperature also falls, causing them to become cold-stunned, according to the National Oceanic and Atmospheric Administration’s fisheries service. In this condition, the turtles become weak and inactive, and may be washed to the shore. If their temperature remains low or the turtles are not rescued, they may develop health problems or die. Cold-stunning events are not uncommon and can affect hundreds or even thousands of sea turtles annually. These events can take place in extreme cold-weather events and have occurred repeatedly in recent decades in waters as far north as Cape Cod Bay in Massachusetts and as far south as Corpus Christi Bay in Texas. than 200 sea turtles have been treated so far this season, including 186 critically endangered Kemp’s ridley turtles, 19 green turtles and six loggerheads. The aquarium said that some of the turtles suffered from dehydration and pneumonia and had injuries like fractured shells. As a result, treatment can range from a week up to more than a year before the turtles can be released into the ocean. “Our survivorship is anywhere between 70 and 80%, depending on how severe the winter is,” Kennedy said. “Once they make it through their first three days in rehabilitation and they get to what we would consider a more normal body temperature and what waters they would normally be occupying, the rate does go up pretty high.” Kennedy said about 400 sea turtles on average were rescued each year. “Our hope is that the winds blow, they get all the turtles in, because any turtles that are out in Cape Cod Bay at this time are not going to survive,” he said. “They’re out there trying to do their best, hoping that it’s going to get warm. But folks up in the Northeast know, that’s not going to happen anytime soon.”

A cozy one-pot chicken for a fuss-free holiday By MELISSA CLARK
T
he Yiddish word tsimmes, or tzimmes, means to make a big fuss over something. It’s also the name of an Ashkenazi dish of sweet potatoes, carrots, dried fruit and sometimes flanken or brisket, traditionally served at Jewish holidays. You’d think, with a name like tsimmes, it must be a fussy dish, needing chopping, peeling and praying over to get right. But the tsimmes I grew up with were simple vegetable side dishes, a pretty mix of orangehued roots dotted with dark prunes and glistening with honey, baked until plush and velvety. Sure, there was some peeling and chopping, but next to frying latkes, pinching kreplach and rolling matzo balls, a pan of tsimmes was the one fuss-free part of the holiday preparation. With that ease in mind, I created this tsimmes as a convenient holiday showpiece. Since Hanukkah is approaching, I wanted a one-pot dish that was festive enough for a holiday meal, yet easy enough to leave time to make latkes. Tsimmes recipes vary greatly, but the version I grew up with included honey and orange juice to nudge the natural sweetness of the root vegetables and dried fruit. For this main-course version, I decided to nix the honey and use only orange juice, which reduces during simmering to a vibrant, tangy glaze. I also substituted dates for the usual prunes, though almost any dried fruit will do. Dried cherries and cranberries add pops of color, while dried apricots blend in with the roots for a chewy-sweet surprise in every bite. Tsimmes can veer into sweet-enough-fordessert territory, which would cloy as a main. So another tweak was to add cumin and coriander to the cinnamon and ginger that typically spice the dish, because I wanted those earthy, musky flavors to ground it to the savory side. Lastly, I added chicken to make the dish substantial enough to anchor the meal. Because root vegetables need to simmer for 45 minutes or longer to turn silky and plush, dark meat chicken is a better partner than breasts. Bone-in thighs will work, though the skin becomes limp after all that simmering. I call for boneless thighs because they get wonderfully soft and tender as they bubble away beneath the roots. This tsimmes is such a simple, cozy main dish that the only fuss will be made over, not by, the cook who serves it.
Braised chicken thighs with sweet potatoes and dates This colorful meal is based on tsimmes, the classic Ashkenazi dish of sweet potatoes, carrots and dried fruit (and sometimes meat) typically served on Rosh Hashana and other Jewish holidays. This version includes boneless, skinless chicken thighs and spices, and lets everything simmer together in a Dutch oven until fragrant and silky. It’s a festive one-pot meal that’s sweet, savory and a little tangy from some orange juice used for braising. Yield: 6 to 8 servings Total time: About 1 1/2 hours Ingredients: 2 1/2 pounds boneless, skinless chicken thighs (see Tip) 2 teaspoons kosher salt (such as Diamond Crystal), more as needed 1 1/2 teaspoons ground coriander 1/2 teaspoon ground cumin 1/2 teaspoon freshly ground black pepper 1 1/4 pounds sweet potato, peeled and cut into 1/2-inch chunks 1 pound carrots, peeled and cut into 1/4-inch thick coins 1 cup dates or prunes, diced (or substitute other dried fruit) 1 teaspoon finely grated lemon zest 1 teaspoon grated or minced fresh ginger (optional) 1 (2-inch-long) cinnamon stick 1 large pinch ground cayenne or red-pepper flakes 2 tablespoons extra-virgin olive oil, more as needed 1 large leek, trimmed, halved lengthwise and sliced into half-moons 1/2 cup freshly squeezed orange juice 3/4 cup chopped fresh cilantro or dill Preparation: 1. Heat oven to 350 degrees. In a large bowl, combine chicken thighs, 1 teaspoon salt,

In another large bowl, add the sweet potato, carrot, dates or prunes, lemon zest, grated ginger if you like, cinnamon stick, cayenne and remaining 1 teaspoon salt. Stir to combine. 3. In a 5- to 7-quart Dutch oven, heat oil over medium-high. Add as many pieces of chicken as comfortably fit in the bottom of the pan without crowding and brown on both sides, about 5 minutes. Transfer chicken pieces to a plate as they brown. Repeat with remaining chicken, adding more oil as needed. 4. Add leeks, a pinch of salt and more olive oil to the pan if it looks dry. Sauté leeks until
golden and tender, 5 to 7 minutes. 5. Place half of the chicken in 1 layer on top of the leeks. Top with half of the sweet potato mixture, spreading it out evenly over the chicken. Repeat layering with the remaining chicken and sweet potato mixture. Pour orange juice into the pan. 6. Cover pot and transfer to the oven. Braise, covered, until the chicken and vegetables are tender, for about 55 to 70 minutes, stirring the mixture after 30 minutes. Sprinkle with herbs and serve. Tip: Because of the long braising time needed to cook the root vegetables, it can be tricky to use chicken breasts because they’re liable to overcook.

POR CUANTO: La parte peticionaria por conducto de su abogado, Lcdo. Carlos L. At what point should college athletes be considered employees? By BILLY WITZ

randon Outlaw sat on a witness stand for two days last week and described what it was like to play football at the University of Southern California. His fingerprints were scanned when he arrived for meals at the athletes’ dining hall to make sure he was there. He received text messages from anonymous class checkers, who on occasion asked him to send photos to verify he was indeed in class. He regularly urinated into a cup before practice and handed it to a member of the training staff, who would inform him if he was properly hydrated. After Outlaw conducted an interview with a student journalist, a coach reminded him that he had violated team policy by not clearing the interview with a school official. Outlaw, who graduated in December 2022 with a master’s degree in entrepreneurship and innovation, detailed an existence that bore little semblance to the romantic ideal of the college athlete. Instead, he described football as occupying close to 60 hours per week during the season and requiring him — with an athletic academic counselor’s assistance — to shoehorn his classes into windows that did not conflict with his countless football-related activities, which some days started at 6 a.m. The question at the heart of Outlaw’s testimony, at a National Labor Relations Board hearing in Los Angeles, is a simple one that carries profound implications: Should college athletes be considered employees? If the answer is yes, it could be the death knell for the amateurism model that has remained a bedrock of college athletics as it has evolved into a billion-dollar business, allowing schools to pour money that might have gone directly to players into coaches’ salaries, glittering facilities and ballooning staffs. Granting athletes employee status would bolster their standing in antitrust lawsuits and

(Emily Berl/The New York Times) arm the highest-profile athletes, football and men’s and women’s basketball players, with the power to collectively bargain directly with universities for salaries and other rights. The case threatens to “disrupt and transform more than 100 years of college athletics,” said Adam Abrahms, a lawyer representing USC, which, along with the Pac-12 Conference and the NCAA, is a defendant. Such disruption would be welcome, said Ramogi Huma, the executive director of the National College Players Association, an athlete advocacy group. Earlier this year, Huma filed the complaint with the NLRB on behalf of USC’s football and men’s and women’s basketball players. “The years of tradition we’re trying to stop is the tradition of exploitation, the tradition of double standards and the tradition of refusing to pay fair market value to employees,” Huma said after the third day of the hearing last week. The proceedings are scheduled to continue in late January, when coaches and administrators may be called to testify, and
conclude by the end of February. A ruling is not likely to come until later next year. The hearing is but one salvo in an assault against amateurism that was supercharged in 2021 by a unanimous Supreme Court decision in which Justice Brett Kavanaugh characterized the NCAA as a price-fixing cartel. Players on the Dartmouth men’s basketball team have also gone before the NLRB to ask that they be considered employees; and a lawsuit, Johnson v. the NCAA, seeking to have athletes considered employees, is winding its way through federal court. Then there is a raft of antitrust suits, including House v. NCAA, a class-action grievance asking for $1.4 billion in damages (which the court could triple) for athletes in the top conferences. The athletes in that case argue that the NCAA’s previous restrictions on name, image and likeness rights unfairly deprived them from a share of television and social media revenue. These challenges have prompted the NCAA to repeatedly ask for an antitrust exemption from Congress, where they have seldom found a sympathetic ear. The lack of traction prompted Charlie Baker, a former Massachusetts governor in his first year as NCAA president, to suggest this month that the wealthiest athletic programs begin putting at least $30,000 annually into trust funds for at least
half their athletes, an offering he hopes will get Congress to accede to narrow antitrust relief. “We all know this is a big public issue and people have opinions about college sports,” said Daniel Nash, the lead counsel for the Pac-12. “But this is an unfair labor practice case.” The stage in Los Angeles — far from the halls of Congress or august courtrooms with wood paneling and high ceilings — reflected that. The hearing took place in a conference room in a generic glass office building with the administrative judge, Eleanor Laws, seated in a portable box where she looked eye to eye across a table of more than a dozen lawyers. (About the only other people in the room were several members of the news media.) That a case would end up before the NLRB, which handles fair employment cases involving private businesses, has seemed inevitable since Jennifer Abruzzo, the board’s general counsel, invited a challenge two years ago by issuing a memo saying that the law would support classifying scholarship football players in the NCAA’s top division as employees. The NLRB accepted Huma’s case, which has been broadened to include men’s and women’s basketball players as well as nonscholarship athletes, who are commonly referred to as walk-ons. The Pac-12 and the NCAA have been named as co-defendants so that any ruling would apply to both public and private schools that are part of those organizations. Over the opening days, Amanda Laufer, the lead attorney for the general counsel, sought to demonstrate through the testimony of two recent former walk-on football players, Outlaw and Kohl Hollinquest, that USC exerted extraordinary control over the athletes, even ones who were not being rewarded with scholarships or earning hundreds of thousands of dollars in endorsements like Caleb Williams, the team’s Heisman Trophywinning quarterback. (Another subpoenaed witness did not show up for the hearing’s third day on Dec. 20. Laufer declined to identify the athlete, but subpoenas have been issued for other athletes.) In addition to the fingerprint monitoring of their dining hall attendance, the class monitors and the nearly daily hydration and weight checks, players were required to remain in the team hotel when they were on the road unless they left with the team — even if the game was many hours away.
