







Gov. Pedro Pierluisi Urrutia has asked U.S. congressional leaders to consolidate hurricane disaster recovery aid into a single federal award and to grant Puerto Rico more federal funding, a letter notes.
The letter was sent Wednesday to House Speaker Nancy Pelosi (D-Calif.), House Minority Leader Kevin McCarthy (R-Calif.), Senate Minority Leader Mitch McConnell (R-Ky.), and Senate Majority Leader Charles Schumer (D-N.Y.).
The governor notes that as Congress and the administration work on a potential disaster relief and supplemental appropriations package for fiscal year 2022, lawmakers should provide similar relief to the one provided by Congress in the 2018 Bipartisan Budget Act in response to the devastation of hurricanes Maria and Irma in 2017.
The letter seeks changes to the Robert T. Stafford Disaster Relief and Emergency Assistance Act and other actions that would help facilitate administrative efficiency in the recovery from Hurricane Fiona in September of this year similar to the recovery process of Hurricane Maria.

“This is vital because many facilities that have not been fully repaired or replaced following Hurricane Maria may have further deteriorated since Hurricane Fiona,” the governor added. “Therefore, limiting FEMA [Federal Emergency Management Agency] assistance based on the pre-disaster condition of a facility for Hurricane Fiona is likely to be restrictive.”
Pierluisi also requested that 100% federal cost share be provided for all consolidated Maria and Fiona permanent work projects.
The governor asked the federal government to allow the implementation of FEMA’s Disaster Flexible Match (DFM) Program to alleviate administrative burden and avoid the projected grant deadline-related challenges of its Public Assistance Program (PA).
“Similar to the global match process for FEMA’s Hazard Mitigation Grant Program, the DFM Program for the PA program will allow the non-federal cost share to be based on a percentage of a disaster’s overall obligation instead of on a per project basis,” he said.
“To consolidate both disasters, Section 428 public assistance program alternative procedures (PAAP) (42 U.S.C. 5189f) of the Stafford Act will need to be amended to allow obligated projects, with agreed fixed cost estimates, to be versioned to include damages caused by Fiona,” Pierluisi said in the letter. “In addition, we reiterate our request that section 428 PAAP-obligated projects under Maria (DR4339-PR) be amended to allow versions to accommodate any impacts due to inflation, construction material cost
Regarding housing, Pierluisi said that similar to Community Development Block Grant Disaster Recovery (CDBG-DR) funding for hurricanes Irma and Maria, housing assistance due to Hurricane Fiona should be broader than just rehabilitation, reconstruction or relocation.
“Following the same percent distribution as in the current CDBG-DR Action Plan, PRDOH [the island Housing Department] requests an additional $414 million for other housing assistance needs arising from Hurricane Fiona,” the governor said.
Pierluisi also asked for changes in the Earned Income Tax Credit.
“We are very grateful for the EITC support that was enacted in the American Rescue Plan Act (ARPA), which contemplated a $600 million federal contribution to a Puerto Rico EITC program that was estimated to cost $800 million a year; that is, a federal contribution of 75% for the program. These funds have been very helpful in bringing working families out of poverty,” he said. “However, the actual program cost has amounted to approximately $1.05 billion rather than $800 million, for which a federal contribution of 75% would be $787 million, $187 million more than was contemplated in the ARPA. An adjustment to the federal contribution to 75% of actual program costs would help Puerto Rico to extend this very valuable benefit to working families residing on the island and would contribute to its overall economic recovery. We therefore request your consideration of this matter.”
Cayey Mayor Rolando Ortiz Velázquez had not as of press time on Thursday responded to requests for information regarding properties declared a public nuisance that he allegedly acquired through corporations. According to journalist Carmen Enid Acevedo of Bonita Radio, several properties in Cayey that are said to have been declared public nuisances by the municipal council passed into the hands of Ortiz Velázquez through a corporation and also in a personal capacity between 2016 and 2022. All are identified under the same address in the El Polvorín neighborhood of that municipality, according to the public registry of the Municipal Revenue Collections Center.
In addition to the two lots on Núñez Romero Street that were purchased in the name of MCBRIDGE LLC in last July, two others, one at No. 41 on that street and another on José De Diego Street in the same town, and a third, in the Jájome Alto neighborhood of the municipality, reportedly appear in the registry. The latter was purchased in 2016 and those in the urban center were purchased in March 2019 and November 2021, respectively.
Ortiz Velázquez has a total of seven properties to his name in Cayey, a municipality he has led as mayor since 1997, after winning election for the first time in 1996. There are two plots of land purchased in the 1990s in the Cercadillo and Sumido neighborhoods and another from 2001 in the Lapa neighborhood of the municipality he runs.
In February of this year, the municipality of Cayey circulated ads on social media and on a YouTube channel making available to the public an inventory of properties declared public nuisances.
In March, the property on José De Diego Street had a movement of ownership in its name. It was on March 4 when MCBRIDGE LLC was incorporated in the mayor’s name.
Four months after its creation, MCBRIDGE acquired two lots at 324-034-070-15 and 070-14, from plots 01 and 06.
The amendment document to the corporation states that its resident agent and administrator will have the address of 26 Calle Evaristo Vázquez, Bda El Polvorín, Cayey, P. R. 00736-5032 and offers a telephone number that begins with 615.
Bonita Radio called that number Sunday night and the man who answered acknowledged being from Cayey but did not want to identify himself. He did not answer when
Velázquezasked if he resides in the El Polvorín neighborhood of that municipality, a contact address that is included both in the corporation owned by Ortiz Velázquez and in listings of his properties in a personal capacity.
The financial stability index of the credit union industry in Puerto Rico, prepared by Estudios Técnicos Inc. (ETI), still indicates a solid performance, although the recent trajectory in the index has been affected by a decrease in deposits and an increase in reserves associated with investments in marketable securities made by the sector.
Economist Leslie Adames, director of ETI’s Economic Policy and Analysis Division, commented in a written statement that “the financial position of the sector continued to show a good performance in the third quarter with growth in the customer base, in lending activity, improvements in profitability and stable asset quality.”
The index stood at a value of 0.70 in the third quarter of 2022, reflecting a moderate quarterly decrease when compared to the value of 0.75 in the previous quarter, but remains in positive territory when compared to the 0.68 registered for the end of the third quarter of 2021. The index fluctuates between 0 (financial fragility) and 1 (financial strength). It measures the financial health of the credit union industry against four criteria: liquidity (total loans/deposits), solvency (capital to total assets), asset quality (non-performing loans/total loans) and profitability (return on assets, or ROA).
“In the third quarter of 2022, total deposits at cooperatives decreased by $24 million to $8.101 billion compared to the previous quarter. This was something we had foreseen would happen because the liquidity associated with federal stimulus funds aimed at supporting people’s incomes has been used in part to finance consumption in durable goods and compensate for the loss in purchasing power associated with the inflationary environment that still prevails in the economy,” Adames said. “Even so, the sector reflects a positive variation in deposits of $2.021 billion compared to the balance in deposits of $5.951 billion at the end of the first quarter of 2020.”
As for the number of members, the upward trend continues with 3,900 additional members between the second and third quarters of 2022, also reflecting a net increase of 18,921 members to 1.12 million during the 12-month period that ended in the third quarter of 2022, Adames reported.
Meanwhile, lending activity increased from $5.925 billion in the second quarter of 2022 to $6.124 billion in the third quarter of 2022 supported mainly by increases in the balance sheets of the mortgage and automobile loan portfolios. The increase in deposit-related credit has contributed to the sector’s liquidity starting to move to the levels prevailing in the
pre-pandemic period.
“The ratio of loans to total deposits stood at 75.6 percent in the third quarter of 2020, after hitting a low of 67.2 percent in the second quarter of 2021,” Adames said. “To the extent that credit activity maintains a higher growth rate than deposits, we should expect this indicator to maintain a trajectory toward the pre-pandemic average of 82.1 percent. In this sense, liquidity is something that the sector must continue to manage with caution.”
The delinquency rate remained stable at 2.01% in the third quarter of 2022 compared to 2.11% in the third quarter of 2020, although it increased slightly compared to 1.97% for the second quarter of 2022. However, current levels of provisions for bad loans and for the total loan portfolio suggest that the sector maintains the resources needed to cover credit risk in its loan portfolios.
The advisory group that would overhaul the island Revenue Code has resumed its work on certain recommendations that will be delivered to Gov. Pedro Pierluisi Urrutia next year.
The advisory group, chaired by Treasury Secretary and Government Chief Financial Officer Francisco Parés Alicea, said the recommendations will be delivered in May.
During the new work session, the transition process for manufacturing companies to leave the Law 154 excise tax system and move to Act 52-2022, which establishes a new income tax regime for manufacturing companies that opt for the change, will be discussed. The analysis of the recommendations that represent a potential fiscal cost will also be finalized, among other matters, to comply with the objectives outlined under Executive Order 2021-072 of Oct. 7, 2021 and, in turn, with the Principle of Fiscal Neutrality.
“In these meetings that will take place every month, the work will be focused on the recommendations regarding income tax, consumption taxes and the inspection of measures against tax evasion, specifically,” Parés Alicea said. “We are going to begin to discuss the work plan and the most important recommendations that arose in the meetings that we held for three months, both with government officials and with representatives of the private sector.”
He stressed that Pierluisi’s priority is to achieve a fair, clear and efficient tax system before the end of the current four-year term.
“The governor summoned us again to present him with a report with final recommendations,” Parés Alicea said.
The working group created under Executive Order 2021-072 is made up of the Treasury secretary, who serves as president; the director of the Office of Management and Budget, Juan Blanco Urrutia; the executive director of the Fiscal Agency and Financial Advisory Authority (AAFAF by its Spanish initials), Omar Marrero Díaz, along with the main financial officer of AAFAF, Luis Umpierre Ferrer; the secretary of Economic Development and Commerce (DDEC by its Spanish acronym), Manuel Cidre, along with the assistant secretary of operations at DDEC, Humberto Mercader; and the executive director of the Municipal Revenue Collections Center, Reinaldo Paniagua Latimer and his adviser, Miguel Fonseca Crespo.
On behalf of the private sector are Edwin Ríos, from the Association of Economists; the chairman of the Tax Affairs Committee of the Certified Public Accountants Association, CPA Felipe Rodríguez; the president of the Chamber of Commerce, Juan Alvarado Zayas; the representative of the Industrialists Association, Carlos Serrano; economist Gustavo Vélez; and attorney Kenneth Rivera and CPA Denisse Flores, who are appointed by the governor.
Gov. Pedro Pierluisi Urrutia said Thursday that he does not rule out resuming the Drug- and Weapon-Free Schools Zone (ZELDA by its Spanish initials) project that was implemented in the 1990s during the administration of then-Gov. Pedro Rosselló González, when Pierluisi was secretary of Justice.
“These unfortunate incidents give us the opportunity to see well and review well everything that is being done and not skimp,” the governor said in response to questions from reporters. “That’s why, when they talk to me about the Drug- and Weapon-Free Schools Zone, it’s a program that was established when I was Justice secretary in the ‘90s. I know the program; I don’t want to rule it out. That is, within this evaluation that we are doing for which we have not only the resources of the
Department of Education, but also of the Puerto Rico Police. If we end up deciding that this should go forward, or it makes sense.”
When asked about his opinion on the legislative measure that calls for evaluating the establishment of armories and/or shooting ranges near schools, the governor said he prefers to wait for the legislative process to end.
“So we will have to see if that bill is approved and in what form it is approved; by then I can make a decision,” Pierluisi said. “For now, I would be speculating because I do not have the details of the bill. I know it is generating controversy. … All that must be evaluated.”
The governor’s remarks came at the end of a press conference on the end-of-the-year activity that will feature the return of the “Dick Clark’s New Year’s Rockin’ Eve” show in the Convention District in San Juan.
In the area of Infrastructure, Energy, and Resilience, participants in this week’s White House dialogue on strategies for jumpstarting Puerto Rico’s economic development agreed to the following:
* The Department of the Treasury and the government of Puerto Rico will work to approve plans for $158 million from the American Rescue Plan’s Capital Projects Fund to deliver high-speed internet access to households and businesses who currently lack access, particularly in economically disadvantaged communities and remote areas with inadequate service.
* The Puerto Rico Office of Management and Budget, in coordination with the National Telecommunications and Information Administration (NTIA) and Federal Communications Commission, will fully establish a Broadband Program Office to coordinate and oversee broadband initiatives across the island. The Broadband Program will work to advance high-speed internet planning, infrastructure, adoption and access across the island, with NTIA providing technical assistance and $5.7 million under its Broadband Equity, Access, and Deployment, and Digital Equity programs.
* The Department of Energy (DOE) will lead an interagency Puerto Rico Grid Recovery and Modernization Team, including the Federal Emergency Management Agency (FEMA), Department of Housing and Urban Development (HUD), Department of Agriculture, and Department of Commerce, to collaborate more intensively on the build-out of Puerto Rico’s energy infrastructure. Energy Secretary Jennifer Granholm will convene the team monthly and work closely with Gov. Pedro Pierluisi Urrutia to accelerate projects that rebuild an electricity grid that is more resilient, secure and capable of supporting 100% clean electricity by 2050.
* FEMA will adopt a new islandwide approach to approving projects to mitigate hazards to the energy grid, speeding up project development and completion of Hurricane Maria resilience work, and prioritizing proposals that increase resilience across the entire grid.
* FEMA will partner with DOE, the U.S. Environmental Protection Agency (EPA),
and the U.S. Army Corps of Engineers to install temporary generation capacity and perform repairs that, together, will stabilize Puerto Rico’s energy grid and add approximately 600-700 megawatts of capacity. This will enable the Puerto Rico Electric Power Authority and LUMA Energy to repair damage to the power system caused by hurricanes Maria and Fiona without compromising service to homes and businesses.
* U.S. Interior Secretary Deb Haaland will work with Pierluisi to jointly appoint three trustees and a federal representative to the Puerto Rico Conservation Trust in
the first quarter of 2023. The Department of the Interior will also invest in key infrastructure projects to improve management and access for Puerto Rico’s protected lands in partnership with local communities, including a new office facility at Cabo Rojo National Wildlife Refuge and road repairs at the Caribbean National Wildlife Refuge Complex.
* The EPA, the Puerto Rico Department of Health, and the Puerto Rico Department of Natural and Environmental Resources (DNER) will partner to maximize the impact of $78.4 million in annual funding for water infrastructure that the island receives
through the Clean Water and Drinking Water State Revolving Funds. EPA will also invest $1.6 million to support an inventory of brownfield sites in the municipalities of Aibonito, Aguas Buenas, Corozal and Las Piedras to begin cleaning up and redeveloping those sites into community assets.
* The DNER will develop a sustainable program for solid waste management and administer $40 million in recovery funds for its implementation, with technical assistance from the EPA. EPA and the DNER will also jointly pilot a new program incentivizing the closure of open dumps in Puerto Rico and installation of solar panels, building on an EPA and DOE study of 19 landfills on the island for solar feasibility.
* The Department of Defense will invest $1.5 million to enable the Local Redevelopment Authority for the former Roosevelt Roads Naval Station to carry out infrastructure and development projects, in partnership with the island Department of Economic Development and Commerce, and the Office of the Governor of Puerto Rico.
* The U.S. Department of Transportation and the Puerto Rico Department of Transportation and Public Works will jointly facilitate major infrastructure works and innovative financing for priority projects across the island.
* The Puerto Rico Department of Housing (Vivienda) and six municipalities in the new ConSur consortium will implement recovery projects in areas hard-hit by earthquakes in 2019 and 2020 and launch an action plan for over $200 million in HUD funds for housing, economic development, and infrastructure recovery projects.
* Vivienda, with support from HUD, will also develop a comprehensive State Housing Plan for Puerto Rico, committing to specific actions to meet housing needs in the wake of bankruptcy and recent natural disasters.
* The U.S. Army Corps of Engineers will award key contracts to undertake major public works projects, including: the Caño Martin Peña project to re-establish the tidal connection between the San José Lagoon and San Juan Bay, and important flood risk management projects in Río Puerto Nuevo, Río Grande de Arecibo, and Río de la Plata.

Sen. Raphael Warnock’s victory in Georgia’s runoff election Tuesday delivered Democrats just one additional seat, but that single layer of padding for their majority will hand them substantially more leeway to control the Senate than they have now.
Warnock’s success gives Democrats a 51-49 majority in the Senate beginning in January, expanding the bare minimum hold they currently have by virtue of Vice President Kamala Harris’ tiebreaking power in the evenly divided chamber.
“After one year, 10 months and 17 days of the longest 50-50 Senate in history, 51! — a slim majority,” an ebullient Sen. Chuck Schumer, D-N.Y. the majority leader, said Wednesday as he celebrated both the Warnock victory and the expanded Democratic ranks.
“It just gives us a lift,” he told reporters at the Capitol.
The implications for Senate Democrats and the Biden administration extend well beyond the single Senate slot. With an additional vote, Democrats can take much more operational control of the Senate, easing the confirmation of contentious nominees, clearing the way for investigations and availing themselves of breathing room on a variety of matters.
“It makes all the difference in the world,” said Sen. Dick Durbin of Illinois, the No. 2 Democrat in the chamber and chair of the Judiciary Committee, which would find its work filling judicial vacancies to be much less fraught with a bigger majority.
A larger Democratic contingent will give the party a one-seat advantage on congressional committees that are now evenly split, a situation that allows minority Republicans to maintain significant leverage over legislation and other business. As a result, some administration nominees have stalled in committee, while others have made it out only through a special floor procedure that costs Democrats time. Having an edge on the committees will allow Democrats to overcome Republican opposition, if they can hold together.
“It is good for the efficiency of the Senate,” said Sen. Sherrod Brown, D-Ohio, chair of the Banking Committee, where united Republican opposition held up some of President Joe Biden’s nominees for a time this year. “We can be more nimble, we will be a lot quicker, we will be a little more decisive and that’s good. It doesn’t mean we will pass everything.”
Rules that allow any single senator to block action through a filibuster — and require 60 votes to break it — will still hinder Democrats and require bipartisan efforts to advance bills. And while they are now down a seat, Senate Republicans, again led by Mitch McConnell of Kentucky, will not hesitate to block Democratic efforts — particularly headed into a presidential election cycle.
But with 51 votes, Democrats will have more latitude to maneuver within those limitations. An enlarged majority also dilutes the influence of individual senators such as Joe Manchin, D-W.Va., who has used his swing-vote status to exert effective veto power over legislation, helping to derail
some of the main elements of Biden’s agenda and significantly shaping those that have been achieved. Manchin, however, has said that he would welcome a wider margin because it would take some of the attention and pressure off him as he weighs another run in 2024.
Such a situation would “make it easier for me,” Manchin told reporters last week on Capitol Hill.
Warnock’s win also secured for Democrats the authority to subpoena witnesses before Senate committees without the cooperation of Republicans, which could be hard to come by if the GOP disagrees with the subject of the inquiry or views it as partisan. With House Republicans planning an onslaught of investigations when they assume control in January, the ability of Senate Democrats to mount their own investigations could allow them to counterpunch.
“The subpoena power is going to be very important, especially as the House goes into overdrive on investigations,” said Sen. Chris Van Hollen, D-Md. “It will provide some check and balance.”
Schumer said expanded investigatory power would provide Democrats an opening to “deal with corporate corruption and inequities and other problems throughout the country.”
Had Warnock lost, Democrats still would have retained control of the Senate, but under the existing 50-50 setup, with its attendant hurdles. That outcome would have doubtless been deflating to Democrats considering how eagerly they have looked forward to a 51-49 split.
Republicans knew what was at stake as well, and Walker sought to make it an issue even after Democrats clinched the Senate majority last month with the victory of Sen. Catherine Cortez Masto in Nevada.
“If I lose this runoff, Democrats will have a 51-seat majority where the most radical proposals will succeed,” a fundraising appeal from Walker said. “We cannot let that happen.”
Republicans said they were sorry to see their power diminished in the Senate, but noted that the narrow Republican majority in the House would deprive Democrats of
the ability they now have to control both chambers and use a special budget procedure known as reconciliation to roll over Republicans on tax and spending issues, as they did twice in the past two years.
“I’d much rather have 50-50 than 49-51,” acknowledged Sen. John Cornyn, R-Texas, who noted that the new House majority would be a backstop against reconciliation. “I think the voters kind of like the idea of us being stalemated. Either bad things won’t happen, or if things do happen, it will have to be the old-fashioned way by finding consensus.”
But Democrats were thrilled about their new numbers, impatient for an expanded majority after two years of struggling with evenly divided numbers.
In a body that has experienced frequent absences because of the coronavirus and other medical conditions, the added seat will make everyday scheduling a little less difficult, relieving Democratic leaders of the need to make sure that every senator is on hand for close votes, and sparing Harris the chore of idling nearby in the event she is needed.
The 51st seat also means that Democrats will have an added boost heading into 2024, no small matter when they will be defending seats in Republican-leaning states such as West Virginia, Montana and Ohio.
There are other, less tangible, benefits as well for Democrats, who were considered in serious danger of losing a seat or two, by gaining a seat and tightening their grip on the Senate.
“It gives Democrats in the Senate a kind of bounce in our step that we can build on,” said Sen. Ron Wyden, D-Ore., chair of the Finance Committee.

He is a fan of early-2000s rock, which was popular when he was in kindergarten. He is still working to get his undergraduate degree. And he is couch surfing to save money as he starts his new job, which is representing Florida’s 10th Congressional District in the U.S. House of Representatives.
Rep.-elect Maxwell Frost, a 25-year-old Afro-Cuban progressive activist from Orlando, Florida, is about to be the youngest member of Congress. He has swapped the megaphone he once used to lead protests for a seat in one of the nation’s most powerful institutions, where he will be the first member of Generation Z to serve.
In a body where the average age was more than twice his (58.4 years old in the most recent Congress), Frost is starting with a keen sense of mission.
“I think we all have this call to action, and you feel like you have to do something,” he said on a recent Wednesday, as he made his way to a hotel room to freshen up before getting his official head shot taken.
The something that motivated Frost, he said, was the Sandy Hook Elementary School shooting in 2012, when he was in high school, which killed 26 people, most of them young children, and gave rise to a grim and nearly omnipresent ritual of active shooter drills for primary and secondary school students across the country.
Frost, who is of Lebanese, Puerto Rican and Haitian descent and was adopted at birth in 1997, grew up in Orlando with a mother who was a Cuban refugee and schoolteacher and a father who was a Kansas-born musician.
At an early age, he came to love music and the arts, eventually hosting a music festival
with a friend. But he found another passion in political activism, volunteering in 2012 with President Barack Obama’s reelection campaign and then in 2016 with presidential campaigns for Sen. Bernie Sanders, I-Vt., and former Secretary of State Hillary Rodham Clinton.
After enrolling at Valencia College in Orlando in 2015, he took a break in 2019 to work for the American Civil Liberties Union, and later became a national organizer for the youth-led advocacy group March for Our Lives, which focuses on enacting stricter gun control measures. He drove for Uber to make ends meet.
In January 2021, a political operative approached urging him to seek public office, but Frost said what ultimately persuaded him to do
so was connecting with his biological mother several months later.
During the conversation, Frost learned that his biological mother, who had seven other children and gave birth to him at the most vulnerable point in her life, had given him up because she did not have the resources to care for him.
“Just hearing about the hardships she went through as a woman of color really solidified my beliefs,” Frost said. “I hung up the phone and said, ‘I’m running for Congress.’ ”
He declared his candidacy two months later. Frost said he was moved to run “for people like my biological mother, for my family and for my district,” and wanted to be in a position “to fight to ensure that the condition doesn’t exist for anybody.”
Frost’s win in the midterm elections was a bright spot for Democrats, who lost ground in Florida and narrowly lost their majority in the House. He adds to a diverse field of newly elected representatives from underrepresented communities.
Not everyone has been dazzled by Frost’s youthful enthusiasm. His Republican challenger, Calvin Wimbish, suggested that he was unfit to serve in Congress.
“What has he been able to do?” Wimbish asked in an interview with Spectrum News. “Has he managed people, resources, has he had time? Has he had the exposure to learning from others?”
Frost is taking over the distinction of youngest member of Congress from Rep. Madison Cawthorn, R-N.C., who was elected in 2020 at
the age of 25. But the Florida Democrat is not the youngest member of Congress in history. That record, which is unlikely ever to be broken, belongs to William C.C. Claiborne, who may have been 22 when he was elected to the House in 1797. (There is some dispute over his age but no question that he was younger than 25.)
While the Constitution mandates that House members be at least 25 years old, the House chose to seat Claiborne anyway.
With his youth come some unique challenges for Frost. He is spending his first few weeks in Washington crashing with friends as he searches for an affordable place to live, as he will not be paid for a few weeks, until the new Congress convenes Jan. 3.
When the moment is right, he said he would rent a studio apartment within walking or electric scooter distance of the Capitol.
Rep. Val Demings, D-Fla., whom he will succeed, has offered him mentorship and described him in an interview as “beyond his years.”
“He takes the job seriously, but I don’t think he takes himself too seriously,” Demings said. “If he can keep that kind of spirit, even on the rough days and nights here, he’ll be OK.”
Her main piece of advice for the youngster: Talk to different people and look across the aisle for unlikely allies.
Rep. Mark Pocan, D-Wis., who visited Frost before the primary election to help his campaign, said he would fit right in in Congress.
“You know, for someone who is 25, he’s kind of an old soul,” Pocan said, adding that he had been struck by Frost’s “thoughtfulness of how he looked at issues and his progressive values.”
Sanders was among the first to reach out to congratulate him after the election was called, Frost said, recounting how he knew his former boss was calling when the Vermont area code popped up on his phone.
“He has the potential to be a great leader, speaking to the young people in this country,” Sanders said of Frost in an interview.
For now, Frost is focused on some immediate tasks. He has about a year left of his undergraduate education at Valencia College, and he said he intends to resume his coursework at some point.
Over the next two years, Frost aims to lean into his love for grassroots organizing by building a strong local presence with an accessible district office. At the Capitol, he said his goal was to make incremental steps toward addressing Democratic priorities such as improving health care, enacting gun control measures and building community violence intervention programs.
The Supreme Court seemed splintered earlier this week about whether to adopt a legal theory that would radically reshape how federal elections are conducted, giving state legislatures largely unchecked power to set all sorts of election rules and draw congressional maps warped by partisan gerrymandering.
The justices’ questioning over three hours of arguments suggested that they were roughly divided into three camps. The three most conservative justices appeared prepared to embrace an expansive version of the theory, while the three liberal justices were adamant that it should be rejected.
The remaining members of the court — Chief Justice John Roberts and Justices Brett Kavanaugh and Amy Coney Barrett — seemed to be searching for a compromise under which state supreme courts would generally have the last word on disputes over state laws governing federal elections but be subject to oversight from federal courts in rare cases.
The case concerned the “independent state legislature” theory, which is based on a reading of the Constitution’s Elections Clause, which says, “The times, places and manner of holding elections for senators and representatives, shall be prescribed in each state by the legislature thereof.”
Proponents of the strongest form of the theory say this means that no other organs of state government — not courts, not governors, not election administrators, not independent commissions — can alter a legislature’s actions on federal elections. The arguments Wednesday focused on whether state supreme courts can reject state laws on federal elections under their constitutions.
David H. Thompson, a lawyer for Republican state lawmakers in North Carolina, said the theory means that the state’s Supreme Court should not be permitted to strike down a congressional voting map drawn by the Legislature on the ground that it was a partisan gerrymander that violated the state Constitution.
Justice Elena Kagan warned that position had “big consequences.”
“It would say that if a legislature engages in the most extreme forms of gerrymandering, there is no state constitutional remedy for that,” she said, adding: “It would say that legislatures could enact all manner of restrictions on voting, get rid of all kinds of voter protections that the state Constitution in fact prohibits.”
“This is a proposal,” she said, “that gets rid of the normal checks and balances.”
Thompson responded that Congress and federal courts remained free to act.
Justice Samuel Alito suggested that it may be dangerous to entrust state judges, many of whom are elected, with the task of assessing the constitutionality of voting maps.
“Do you think,” he asked, “that it furthers democracy to transfer the political controversy about districting from the legislature to elected supreme courts where the candidates are permitted by state law to campaign on the issue of districting?”
The case, Moore v. Harper, No. 21-1271, concerned a voting map drawn by the North Carolina Legislature that was rejected as a partisan gerrymander by the state’s Supreme Court. Experts said the map was likely to yield a congressional delegation made up of 10 Republicans and four Democrats.
The state court rejected the argument that it was not entitled to review the actions of the state Legislature, saying that adopting the independent state legislature theory would be “repugnant to the sovereignty of states, the authority of state constitutions and the independence of state courts, and would produce absurd and dangerous consequences.”
Republicans seeking to restore the legislative map in February asked the U.S. Supreme Court to intervene, arguing in an emergency application that the state court had been powerless to act.
The justices rejected the request for immediate intervention in March, and the election in
November was conducted under a map drawn by experts appointed by a state court. That resulted in a 14-member congressional delegation that was evenly divided between Republicans and Democrats, roughly mirroring the state’s partisan divisions.
On Wednesday, Roberts asked focused questions of both sides. He told Thompson that a 1932 Supreme Court decision, Smiley v. Holm, undercut his argument. In that decision, the court ruled that a governor’s veto did not run afoul of the Elections Clause.
“That’s a pretty significant exception,” Roberts said.
Thompson responded with a distinction that did not seem to persuade the chief justice or his colleagues. He said that procedural limits on the legislature’s power, like a veto, were constitutional but that substantive limits, like a state court’s review of a voting law under the state Constitution, were not.
Barrett seemed unconvinced. “You do have a problem with explaining why these procedural limitations are OK but substantive limitations are not,” she said, adding that the line between procedure and substance could be elusive.
Thompson responded that “this is an easy case, that this is obviously substantive because there was a map and it was thrown in the trash by the courts.”
The Supreme Court has never endorsed the “independent state legislature” theory, but four of its conservative members have issued
opinions that seemed to take it very seriously.
On Wednesday, Kavanaugh seemed to be searching for a middle ground.
Drawing on a concurring opinion by Chief Justice William Rehnquist in Bush v. Gore, the 2000 decision that handed the presidency to George W. Bush, Kavanaugh proposed that “state courts would have a role interpreting state law and that federal court review of that should be, in his words, deferential and simply should be a check to make sure that the state court had not significantly departed from state law.”
The three lawyers who argued against the independent state legislature theory said that adopting it would have enormous consequences.
But all three conceded that there may be exceptional situations in which federal courts could second-guess state court rulings based on state constitutions.
Donald Verrilli, a lawyer for state officials opposed to the theory, said the question was “whether the state decision is such a sharp departure from the state’s ordinary modes of constitutional interpretation that it lacks any fair and substantial basis in state law.”
Alito said he was worried that the Supreme Court would announce a standard so strict that it could never be met. “The worst thing we could do, although it might be attractive for some reasons,” he said, “is to say, ‘Well, there is a limit but, you know, it’s one that in practice can never be exceeded.’”
Kagan said she had the opposite concern.
“Very good judges on very good courts can find it incredibly easy to disagree with each other,” she told Verrilli, referring to his proposed standard. “And so if Justice Alito asked you, can it be flunked, I think what I want to ask you after hearing that colloquy is, is there a danger it’s going to be satisfied too easily?”
Blizzard, are operating those leagues at a loss or just beginning to break even.
Although major esports events sell out buildings like the Chase Center and attract tens of millions of viewers in China, tickets cost less than for traditional sports games, and far fewer Americans are watching esports than the 12.4 million who watched the 2022 NBA finals or the 17 million the NFL averaged for 2021 regular-season games, a difference that means less interest from advertisers.
Most critically, leagues like the NBA and NFL earn billions of dollars each year through broadcast deals with television networks, while many esports are streamed for free on sites like YouTube and Twitch. Some early revenue projections included anticipated broadcasting deals with Twitch and YouTube that were less lucrative and consistent than expected.

By KELLEN BROWNINGIt had been more than three hours of tense, back-and-forth combat — projected across the massive Jumbotron at San Francisco’s Chase Center — when the sellout crowd, thumping together inflatable thundersticks and yelling with excitement, sensed victory was at hand.
A South Korean esports team, DRX, guided their video game characters into the home base of the rival T1 squad and smashed its Nexus, a blue gemstone, to pieces, clinching this year’s League of Legends world championship.
Fans roared their approval, fireworks flared, the winners embraced, and the losers sobbed into their keyboards. Executives from Riot Games, the League of Legends publisher, presented DRX with diamond rings sponsored by Mercedes, celebrating the pinnacle of the professional video game scene.
It was a perfectly choreographed event, the kind of spectacle gaming publishers had promised investors from the traditional sports world when they first pitched them on putting their money into the rapidly growing esports industry in the mid2010s.
“I remember seeing a team come out, and the fans were going crazy and asking for autographs. I thought, ‘Oh, my gosh, this is just like our experience,’” said Zach Leonsis, the son of Ted Leonsis, who owns the NBA’s Washington Wizards and the NHL’s Washington Capitals. The younger Leonsis invested in an esports team in 2016.
But despite the industry’s growth and appeal to the young consumers traditional sports owners are desperate to attract, the money has not followed. Some sports owners have soured on the industry’s short-term prospects after discovering that the methods that make money in traditional sports — like building fan bases in specific cities and striking lucrative deals with television networks — don’t always apply in esports.
Most have not yet turned a profit or seen a return on their investments, and the gaming publishers that control the biggest competitive leagues in North America, like Riot and Activision
Of course, esports investors did not expect the industry to supplant traditional sports in just a few years. But some have still been underwhelmed by early returns.
“They certainly pitched us that the growth of these leagues would be meteoric, and we all drank the Kool-Aid,” said Ben Spoont, CEO of an esports organization called Misfits Gaming, whose backers include the owners of the NBA’s Orlando Magic and the NFL’s Cleveland Browns. “What has happened is that growth has not materialized as fast as we had hoped.”
There are other challenges. Most League of Legends competitions in North America take place at Riot’s arena in Los Angeles, where many teams are based. That deprives esports teams of a chance to make money hosting games or to build a fan base in a specific region.
Activision aimed to change that with leagues based on Overwatch and Call of Duty, its first-person shooter games. Both would hold home and away matches, with teams located around the country like traditional sports teams. Activision charged investors $20 million to join the Overwatch League.
But the league was just building momentum when the COVID-19 pandemic forced it to cancel in-person events. Since then, it has struggled to gain traction. Activision allowed teams to defer fees to be in the league and is now helping teams cover their costs, paying each of the league’s 20 teams about $1 million this year, according to a person with knowledge of the league’s finances.
“Even with the recalibration brought on by the pandemic, we’ve had full arenas and record viewership,” said Joe Christinat, an Activision spokesperson, adding that there was “overwhelming enthusiasm” for the new Overwatch and Call of Duty games. “Our fans want these leagues, and we remain committed to them.”
Investors have also realized that game publishers’ incentives are not necessarily aligned with their own. Publishers can afford to operate money-losing esports leagues as long as they drive interest in their profitable video games, so they sometimes prioritize growth over revenue. Riot, for instance, might hesitate to sign a contract to broadcast League of Legends exclusively on YouTube or Twitch because it would preclude viewers in China, where both services are blocked, from tuning in.
Those kinds of conflicting aims have at times led to tense
negotiations.
Gaming executives urge patience. They say esports, popular for decades in Asia, are still nascent in North America and should be thought of more as a high-growth startup than a fully mature business. U.S. viewers watched an estimated 217 million hours of esports content this year, according to the data firm Stream Hatchet, up from 147 million in 2018. “We often say that we’re still in the leather helmet days of the NFL,” said Naz Aletaha, Riot’s global head of League of Legends esports.
Many investors in the space still believe esports will eventually become a dominant, profitable industry. But in the short term, some are “very frustrated,” said John Needham, Riot’s president of esports, adding that Riot has worked to convince investors to embrace a different monetization model.
Although sponsorships still make up a majority of revenue, a cornerstone of Riot’s strategy involves microtransactions: selling recreational League of Legends players in-game items for their characters that are themed around real-world esports events like the world championship.
It sounds like a niche revenue source, but early numbers have been eye-popping. When Riot hosted its 2022 championship event for Valorant, another esport, it made $40 million from microtransactions alone. Half of that went to the league’s teams through a revenue-sharing agreement.
“This is where we’re going to disrupt the broadcast revenue formula, because that scales,” Needham said.
For now, the costly endeavor of fielding competitive teams is simply a catalyst for the real revenue-generating operations at many esports organizations. Prominent teams like FaZe Clan and 100 Thieves have morphed into more general lifestyle brands that offer viewers apparel and livestreaming entertainment. FaZe Clan, which went public this year in what was seen as a bellwether for the industry, is losing money and cutting costs as shares of its stock plummet.
Even Team Liquid, considered one of the more competition-focused esports organizations, has made much of its money elsewhere and now has nine separate sources of revenue, including owning an esports encyclopedia website, said Mark Vela, CEO of Axiomatic Gaming, Team Liquid’s ownership group.
“It’s a natural evolution,” Vela said. “Everyone’s having to take a step back and seeing what’s really working for us here.”
Team Liquid, which took in more than $38 million in revenue last year, is not yet profitable, but Vela, whose ownership group includes the Leonsis father-son duo, said esports remain alluring because of the rare type of young, affluent viewer they attract.
Spoont is also optimistic long term, but he is not willing to wait. In July, he sold his European League of Legends team to a Spanish esports group for about $35 million. He said he was pivoting Misfits to focus on content creation, partly because it could be another decade before competitive esports reach their potential.
“We were trying to accomplish as an industry what took the NBA 50 years, but we were trying to do it within a five-year time period,” he said, referring to the many NBA teams that were not immediately lucrative businesses. “Turns out that it doesn’t happen.”
The S&P 500 gained ground on Thursday, lifted by technology and energy shares, while a rise in weekly jobless claims suggested the labor market was slowing down.
Wall Street’s main indexes have come under pressure in recent days, with the benchmark index shedding 3.6% in the past five sessions on expectations of a longer rate-hike cycle and downbeat views on the economy from some top company executives.
However, investors drew some comfort on Thursday after data showed the number of Americans filing claims for jobless benefits increased moderately last week, while unemployment rolls hit a 10-month high toward the end of November.
“More people are filing jobless claims, which shows labor forces are weakening a little bit,” said Thomas Hayes, chairman at Great Hill Capital LLC in New York.
“It’s just one data point that leads to the Fed cooling down their aggressive hikes, but it doesn’t change December’s 50 basis point (rate hike). The key is going to be the data between December and February as to what they do next.”
The report follows data last Friday that showed U.S. employers hired more workers than expected in November and increased wages, spurring fears that the Fed might stick to its aggressive stance as it attempts to tame decades-high inflation.
The producer price index and the University of Michigan’s consumer sentiment survey on Friday and November’s consumer price data next week will also be in focus ahead of Fed’s policy decision on Dec. 14.
Investors see a 91% chance that the U.S. central bank will hike the key benchmark rate by 50 basis points to 4.254.50%, with the rates peaking in May 2023 at 4.94%.
The U.S. central bank has raised its policy rate by 375 basis points this year in the fastest hikes since the 1980s.
This aggressive approach has stoked worries of a recession, with top executives of major U.S. financial institutions including JPMorgan, BlackRock and Citi forecasting a likely economic downturn in 2023.
Adding to the fears, the yield curve between the 2-year and 10-year Treasury notes has also widened in the recent days.
At 10:43 a.m. ET, the Dow Jones Industrial Average was up 241.67 points, or 0.72%, at 33,839.59, the S&P 500 was up 32.12 points, or 0.82%, at 3,966.04, and the Nasdaq Composite was up 130.60 points, or 1.19%, at 11,089.15.
Ten of the 11 major S&P 500 sector indexes rose, led by 1.5% gain in technology stocks.

Brittney Griner, the American basketball star imprisoned in Russia, was released Thursday after nearly 10 months of captivity in a prisoner swap for Viktor Bout, a convicted Russian arms dealer known as the “Merchant of Death,” President Joe Biden announced.
In a brief statement from the Roosevelt Room of the White House, with Cherelle Griner, Griner’s wife, by his side, Biden confirmed the release and said that Griner would be back in the United States within 24 hours.
“I spoke with Brittney Griner,” Biden said. “She’s safe. She’s on a plane. She’s on her way home after months of being unjustly detained in Russia, held in intolerable circumstances.”
He added: “Brittney will soon be back in the arms of her loved ones — and she should have been there all along.”
Cherelle Griner described her wife’s imprisonment as “the darkest moments” in her life. She thanked Biden and administration officials for working tirelessly to secure Griner’s release.
“Today, I’m just standing here, overwhelmed with emotions,” she said.
The cheer inside the White House was tempered by the failure to secure the release of Paul Whelan, another American who remained in Russian custody on Thursday despite months of efforts by U.S. diplomats to include him as part of the deal with the Russians for the exchange with Bout.
Whelan, a Marine veteran who later worked as a corporate security executive, was arrested at a Moscow hotel in December 2018 and convicted in June 2020 on espionage charges that the U.S. government says were manufactured.
A senior White House official said Thursday that Russians made it clear within the last several weeks that the choice for Biden would be to approve a one-to-one swap — Griner for Bout — and that they
were unwilling to consider releasing Whelan. The official, who asked not to be named to discuss the negotiations, said the president made “the difficult decision” to proceed.
The official said that the president agreed to a “one-for-one” swap much like he did in April when he agreed to release Konstantin Yaroshenko, a Russian pilot, in exchange for Trevor Reed, an ailing U.S. Marine veteran held for two years on what his family considered to be bogus charges of assault.
In an email to supporters, David Whelan, Whelan’s brother, celebrated Griner’s release, saying that “the Biden administration made the right decision to bring Ms. Griner home, and to make the deal that was possible, rather than waiting for one that wasn’t going to happen.” But he added that “it’s clear the U.S. government needs to be more assertive.”
“If bad actors like Russia are going to grab innocent Americans, the U.S. needs a swifter, more direct response, and to be prepared in advance,” David Whelan said.
In his remarks celebrating Griner’s release, Biden pledged to continue working to free Whelan.
“Sadly, for totally illegitimate reasons, Russia is treating Paul’s case differently than Brittney’s,” he said. “And while we have not yet succeeded in securing Paul’s release, we are not giving up. We will never give up.”
Griner, an All-Star center with the WNBA’s Phoenix Mercury and a two-time Olympic gold medalist, was serving a nine-year prison sentence that put her at the center of a fraught geopolitical showdown between Washington and Moscow. In February, she was stopped at an airport near Moscow after customs officials found two vape cartridges containing hashish oil in her luggage.
Her case became an international cause because she was seen as a hostage held by President Vladimir Putin’s government as Russia was subjected to a broad swath of international sanctions in response to its invasion of Ukraine a week after her arrest. The Biden administration’s efforts to negotiate a prisoner swap stalled for months as she was sent to a penal colony outside Moscow.
American officials said efforts to secure Griner’s release began to show signs of succeeding in recent weeks, with Russian officials indicating that they would be open to a swap for Bout.
Two days ago, Russians
moved Griner from the penal colony to Moscow, in preparation for a possible swap, according to a senior White House official. Thursday morning, Russians put Griner on a plane and flew her to an airport in the United Arab Emirates, whose government had agreed to serve as the location for the swap.
In return, Biden granted clemency for Bout, cutting short his time in a U.S. prison, where he has been held for 12 years. He was scheduled to be released in 2029, but was instead returned to the custody of Russian officials at the United Arab Emirates airport.
Griner had been described by one of her lawyers this fall as struggling emotionally and increasingly worried that she would not be freed. She was permitted outside once a day to walk for an hour in a small courtyard, according to her lawyer, and otherwise confined to a cramped cell with two cellmates. She slept on a specially elongated bed to accommodate her 6-foot-9 frame.
American officials met with her in the penal colony last month for the first time since a Russian court rejected her appeal and reported that she was doing “as well as can be expected,” as a White House spokeswoman put it at the time.
Griner turned 32 while in custody.
The trade for Bout gave Moscow back one of the most notorious arms dealers of modern times, a man who earned the nick-
name “Merchant of Death” as he evaded capture for years. He was convicted in 2011 by a New York jury on four counts that included conspiring to kill American citizens. Prosecutors said he had agreed to sell antiaircraft weapons to drug enforcement informants who were posing as arms buyers for the Revolutionary Armed Forces of Colombia.
The senior White House official defended the administration’s decision to swap Bout for Griner, saying the top priority for Biden is to bring wrongfully detained Americans home. But he said that it was a difficult decision for the president and that such swaps would only be made in “extraordinary and rare” cases.
The exchange is certain to spark criticism that Biden is encouraging foreign governments to take more Americans captive in the hopes of later trading them for someone or something they want in return.
Administration officials have tried to respond to that concern by using sanctions or travel bans to punish governments or others who take hostages and by increasing the warnings to Americans traveling abroad about the danger of being taken into custody by adversarial governments. The official said that no one should expect the administration to make such deals in every case, but said that in Griner’s situation, officials felt a “moral” burden to act.

Iran’s police chief, Hossein Ashtari, said Thursday that “the police will not show restraint in dealing with security threats,” according to ISNA, the Iranian student news agency.

One of the European Parliament’s vice presidents, Pina Picierno, called the hanging “the first insane death sentence carried out on a protester in Iran.”
Amnesty International said it was “horrified” at the execution, saying it came less than three weeks after “a grossly unfair sham trial,” and called on the government to “stop using the death penalty as tool of political repression against protesters in their desperate attempt to end the popular uprising.”
More than 18,000 people have been arrested in the protests, according to rights groups. Many have been tried by the Revolutionary Court on “moharebeh” charges.
Sotoudeh, a human rights lawyer and former prisoner, wrote on Facebook on Tuesday.
Diana Eltahawy, Amnesty International’s deputy director for the Middle East and North Africa, wrote in a report last month that 21 people were at risk of receiving death sentences over the protests.
“Two months into the popular uprising and three years on from the November 2019 protests, the crisis of impunity prevailing in Iran is enabling the Iranian authorities to not only continue carrying out mass killings, but also to escalate the use of the death penalty as a tool of political repression,” Eltahawy said in the report.

The man, Mohsen Shekari, was accused of blocking a street in Tehran and of attacking a member of the Basij militia with a machete, according to the Mizan news agency, which is overseen by the country’s judiciary. He is one of 11 protesters who have so far been sentenced to death by the regime.
The announcement came during a week that saw businesses, shops and traditional bazaars in more than 50 cities across Iran participate in one of the largest general strikes in decades in support of protests calling for the end to the authoritarian clerical rule that has been in place since 1979.
Shekari was arrested Sept. 25 and sentenced Nov. 20 by Iran’s Revolutionary Court, a special court for political cases and political prisoners, the agency said. He was accused of “moharebeh,” or waging war against God, a charge that carries an automatic death sentence.
His execution — along with the speed with which it occurred after his sentencing — was taken as a clear signal that the government was escalating its efforts to intimidate the protesters.
Activists, lawyers and ordinary Iranians immediately took to social media to condemn the hanging, saying Shekari was denied his access to a lawyer through his interrogations and legal proceedings.

According to the Mizan report, Shekari admitted to blocking an intersection in the Sattar Khan neighborhood in Tehran with a companion, named Ali, who handed him the machete and offered him money if he stabbed a security officer. The report said the injured officer needed 13 stitches.
It was not possible to independently verify the official account of the incident.
Sharyar, a protester who was held in prison before being released, said in a series of tweets that he had met Shekari during his incarceration. “Mohsen Shekari loved life — he was waiting for his freedom,” he wrote, describing his fellow inmate as a “quiet young man” who had been working at a cafe in Tehran when he decided to join the protests. Shekari had hoped that his harsh sentence would be softened to 10 years in prison, Sharyar said.
Prominent Iranian athletes and celebrities also denounced the government’s use of the death sentence.
Navid Mohammadzadeh, a well-known actor in Iran, said in an Instagram post that tagged Shekari’s name, “Nothing washes off blood.”
“Your silence means supporting oppression and oppressors,” a renowned Iranian actress, Taraneh Alidoosti, wrote in a post, urging others to speak out.
Shekari’s death drew swift condemnation from rights groups and government officials around the globe.

The head of the judiciary, Gholamhossein Mohseni-Ejei, who has repeatedly called for speedy trials and sentences, confirmed Monday that the trials were being dealt with “in a very short period of time,” according to Mizan.
Xi Jinping may be the most powerful autocrat in the world, but he was forced this week to pirouette to meet the demands of ordinary Chinese fed up with his failed “zero-COVID” strategy.
Throngs of ordinary Chinese — “old hundred names” in Chinese parlance — took to the streets to express frustration with China’s repressive COVID-19 lockdowns and, implicitly, with China’s overall repression. Many held up blank sheets of paper, signifying that they could not say what they wanted.
Xi read those blank sheets of paper, though. Police detained many protesters and blocked off areas where people might gather — but the Chinese government still was forced to bow to public opinion. It brightly declared a “new situation” and on Wednesday relaxed its COVID-19 policy.
Without much acknowledging the protests and while pretending that this was all its own idea, the Chinese leadership declared an end to many of the most burdensome elements of its COVID-19 policy, which has kept down the virus, as well as the Chinese people.
Lockdowns will become shorter and more targeted, and people who test positive for the coronavirus with mild symptoms can stay at home instead of being taken away to quarantine. Negative tests will no longer be routinely required in most public spaces. Cold medicines, whose sales had been curtailed so people couldn’t hide their COVID-19 symptoms, will be available again.
The government’s response, though, does not, of course, address the larger yearning for an end to autocracy.
The dictatorship remains, and those detained as a result of the street protests are presumably still in jail. But Wednesday’s announcement is a remarkable turnabout.
Historically, popular protests in modern China have not resulted in more freedom but in less. In 1956, Mao Zedong decided to “let 100 flowers bloom” — but then was horrified when some of this intellectual blooming was critical of his rule. The upshot was a crackdown that sent some of my Chinese friends to labor camps for two decades.
In April 1976, a popular protest against the hard-liners led them to sack one of the reformers, Deng Xiaoping. In 1978 and ’79, calls on the “Democracy Wall” for greater freedom led to the imprisonment of activists like Wei Jingsheng. In 1986, student protests for greater liberalization led to the firing of the Communist Party leader who favored liberalization, Hu Yaobang.
Then the 1989 Tiananmen democracy movement was a profound cry for greater freedom — and the result was a massacre, long prison sentences and the rise of hard-liners who have made the nation less free.
So it feels like a historic milestone that Xi was forced to bow to protests, but the easing may be costly.
Xi managed the pandemic adeptly for a time, reducing COVID-19 mortality to levels that almost any country would envy. Yet as vaccines became available, Xi didn’t adapt well. He didn’t import more effective mRNA vaccines from the West and didn’t sufficiently promote vaccinations and boosters for the vulnerable and elderly. He kept up the lockdown policy long after it was sustainable, partly because of the classic dictator’s difficulty in assessing the opinions of people when you imprison them for speaking up.
The upshot is that any rapid relaxation of COVID-19 rules today, without first raising vaccination rates among the elderly, may lead to hundreds of thousands of Chinese dying from COVID-19. That is on Xi.
One of China’s great paradoxes is that in many areas, it is an administrative marvel adept at self-correction. It has overseen infrastructure development and education improvements that are extraordinary: The life expectancy of a child born in Beijing today is higher than that of a child born in Washington, D.C. Yet Chinese leaders have often struggled to self-correct in the ideological realm.
The result: China’s authoritarian rulers have overseen the rise of an urban, well-educated middle class that aspires to greater participation, yet “People’s China” refuses to let people do so.
In the reform era, China arguably bought off many of its citizens by raising incomes. The implicit deal was that the government would let people improve their lives but
not fully determine their lives. Xi broke that deal with his COVID-19 policy, which made lives worse.
Many years ago, when I was a Beijing correspondent for The New York Times, covering the Tiananmen protests, a young man put the nation’s aspiration this way: “We have rice, but we want rights.”
In the latest protests, slogans were similar: “We want freedom, not lockdowns. We want votes, not a ruler. We want dignity, not lies. We are citizens, not slaves.”
Those brave protesters have changed China’s national policy, and their broader yearning for rights can no more be extinguished than a virus; someday the Chinese Communist leadership will have to respond to that very human aspiration. Xi may remain in charge, but a legacy of this year’s protests may be the reminder that this yearning still flickers, just beneath the surface, in the most populous nation on

“Una de las cosas que ustedes han visto que hemos estado haciendo con los pasados 8 meses fue buscar acuerdos bipartitas para lograr aprobar un proyecto de estatus que nos permita resolver nuestro problema colonial. Y en ese sentido busqué a la congresista Nydia Velásquez y ambas nos sentamos luego de largas semanas, y debo decir meses, conseguimos un acuerdo bipartidista que le ponía fin a que pudiéramos tener un estatus digno fuera de la cláusula territorial.
Un acuerdo histórico. Es la primera vez que Nydia Velázquez y un estadista se ponen de acuerdo para aprobar un proyecto de ley sobre estatus. Yo hubiera preferido un proyecto de estatus que fuera estadidad si o no, que fue el proyecto que originalmente radiqué. Sin embargo, en aras de que bajo esta mayoría demócrata en la Cámara se aprobará legislación y pudiéramos lograr un consenso, accedí, no solamente a incluir la opción de independencia y la
opción de independencia en asociación con los Estados Unidos, sino también en múltiples concesiones para lograr destrancar esto y de que hubiera un acuerdo bipartidista en el Congreso.
Fruto de eso fue el anuncio que hicimos junto al líder de la Mayoría, Steny Hoyer, el gobernador de Puerto Rico, la congresista Ocasio Cortez, la congresista Velázquez, el congresista Darren Soto y esta servidora empujando esta medida y tenía el momentum para poderse
aprobar. Lamentablemente, luego de ese anuncio la congresista Ocasio Cortez se retiró del acuerdo y pidió enmiendas adicionales. Estuvo también en esa reunión Raúl Grijalva, presidente del Comité de Recursos Naturales, quien estuvo en Puerto Rico haciendo incluso hasta vistas públicas para que hubiera el insumo de los puertorriqueños y más de 30 y pico de personas fueron deponentes en esas vistas o sometieron documentación.
Luego de esos acuerdos, la congresista Ocasio Cortez pidió enmiendas adicionales que empezaron a tratar de cambiar la intención original del proyecto, pero en aras de que se aprobara un proyecto de Puerto Rico y de estatus para que pudiéramos resolver nuestro problema colonial, concedimos enmiendas adicionales para que el Comité de Recursos Naturales en la Cámara aprobará esta medida. Ahora, después de esos dos cambios en las negociaciones originales, la congresista Ocasio Cortez pidió que este proyecto no se viera antes de las elecciones de medio término y que se diera después de las elecciones de medio término para que se aprobara de manera más más rápida. Ahora pasaron las elecciones de medio término y resulta que estas 3 semanas llevamos teniendo reuniones con el líder de la Mayoría quien me informa que la congresista Ocasio Cortez tiene enmiendas adicionales al proyecto. así que ya a mí me parece que esto es una falta de respeto al pueblo de Puerto Rico de gente que no vive en la isla como es el caso de Ocasio Cortez que vive en Nueva York, que tiene todos los derechos en que viven los puertorriqueños allá, pero los que vivimos en Puerto Rico tenemos que estar sujetos a que nos sigan cambiando las reglas del juego”, dijo González Colón en declaraciones escritas.

Luego de que la Policía de Puerto Rico iniciara una investigación, como resultado del hallazgo de un vehículo abandonado en Cayey, determinó activar el Alerta Rosa para sumar la colaboración de los ciudadanos en la búsqueda de una mujer, iniciada por la Uniformada desde temprano el martes.
El comisionado de la Policía, Antonio López Figueroa, explicó que los agentes se toparon con un auto Hyundai Tucson negro, abandonado frente al Monumento del Jíbaro en Cayey. A raíz de ello, ini-
ciaron una investigación para identificar a su dueño, que resultó ser una mujer de 57 años y residente de Humacao, de nombre Lourdes Milagros Hernández Rivera.
Al contactar a sus familiares, estos indicaron desconocer su paradero, razón por la cual la Policía determinó activar una investigación de persona desaparecida. Hasta ese momento, los familiares de la mujer no se habían percatado de que esta se encontraba desaparecida ni la habían reportado.
La Policía activó un grupo de trabajo para intensificar la investigación y la búsqueda, empleando la limitada información disponible hasta ese momento, provista por la familia. La investigación preliminar apunta a que la mujer visitó un médico en compañía de un familiar y salió de su casa sin que su compañero se percatara y sin avisar a familiares sobre su rumbo.

‘The Christmas Clapback’ Stream it on BET+
BET+ is moving into the holiday market big time, and Robin Givens’ food-centric comedy is among the highlights. The Miles family has long been obsessed with its church’s holiday cook-off, and the three daughters (Nadine Ellis, Porscha Coleman and Candace Maxwell) have now picked up the whisk from their late mother. This season will be more hectic than usual, though, thanks to the influencer-nextdoor (Kara Royster) entering the contest. And she can cook, despite having a phone glued to her hand. Each sister gets a romance — including a matter-of-factly lesbian one — and the shenanigans are entirely adult and nice. Even the influencer turns out to be sweet!
‘A Christmas Mystery’
Stream it on HBO Max.
Violet Pierce (Violet McGraw) is such a keen sleuth that when her best friend’s genial dad is accused of stealing their town’s precious jingle bells, she immediately sets out to right this outrageous perversion of justice. Never mind that Violet is only 11 and that the sheriff (Eddie Cibrian) is her dad who, understandably, doesn’t approve of his daughter breaking into the station’s computer. “A Christmas Mystery” is the rare family-friendly holiday movie with a restrained approach to saccharine, and McGraw is endearing in the treacherous role of a pint-size know-it-all. This could easily be the beginning of a franchise.
‘A Christmas Story Christmas’

The original Ralphie, Peter Billingsley, returns in this sequel to the beloved 1983 movie. The nostalgia needle has moved from 1940 to 1973, with Ralphie, older but not much wiser, dragging his family back to his Indiana child-
hood home for the holidays. The set design is a marvel of 1970s oranges and browns, and it’s always a pleasure to see Julie Hagerty (as Ralphie’s mom). But sadly, Clay Kaytis’ movie is a slog. The voice-over narration, once irresistible, has become nonstop blather and the set pieces (including a triple-dog-dare on a ski jump) are just not funny. There are plenty of opportunities to ponder some enduring questions: Why is good slapstick so hard to pull off? When will anybody admit that barflies spending the holidays glued to a dive’s counter aren’t heartwarming?
‘Christmas With You’ Stream it on Netflix.
Remember that reference to blizzards and widowers? It was a little something called foreshadowing. Here, the blizzard forces a pop star, Angelina (Aimee Garcia), and her assistant (Zenzi Williams) to crash in the humble abode of a widower named Miguel (Freddie Prinze Jr.). They had decided on the spur-of-the-moment visit because Angelina had been charmed by a fan video posted by Miguel’s daughter, Cristina (Deja Monique Cruz). The clincher is that our singer is in need of new material and Miguel just happens to be a gifted songwriter. The movie’s best trick, however, is to combine two big celebrations: Christmas and Cristina’s quinceañera. Win-win.
‘Falling for Christmas’ Stream it on Netflix.
With Vanessa Hudgens taking a break from seasonal fare, Lindsay Lohan steps into the fray. In her first lead role in almost 10 years, Lohan plays the perfectly named Sierra Belmont, a hotel heiress still looking for her purpose. After an accident on the slopes, Sierra is struck with amnesia and ends up in a ski lodge owned by Jake Russell (Chord Overstreet), the inescapable widower with a cute kid. Lohan leans a little too hard on the comedy at first, but she locks into a groove as Sierra learns one valuable lesson after another and finds her true calling. More, please.
‘A Hollywood Christmas’ Stream it on HBO Max.
After starring in two Bay Area-set “California Christmas” movies, Josh Swickard moves 400 miles south for this sluggish meta-comedy. Jessica (Jessika Van) is a director specializing in holiday TV movies, and she’s in the middle of shooting her latest feature on a Los Angeles lot when her new boss, Christopher (Swickard), tells her he’s shutting down her pipeline for budgetary reasons. It doesn’t help that Jessica wants to stick to seasonal formulas and
Christopher thinks Christmas movies are just not complex enough — an argument raised by no network executive ever. Spoiler alert: He will come around.
‘Holiday Harmony’ Stream it on HBO Max.
When her vintage VW van breaks down after almost hitting a wandering alpaca … You’re already hooked, right? Aspiring singer Gail (Annelise Cepero) gets stranded in the kind of charming small town that only exists in holiday movies. Fortunately, the local mechanic, Jeremy (Jeremy Sumpter), is a sweet guy and, best of all, his mother is played by Brooke Shields. Gail becomes the new music teacher and her romance with Jeremy unfurls in a satisfyingly predictable manner. (Did Jessica from “A Hollywood Christmas” direct this? No, but Lauren Swickard, Josh Swickard’s wife, cowrote it.) The movie’s secret weapon: “This Is Christmas,” a terrific country ballad co-written by Mary Steenburgen. If anything on this list deserves to become a Yuletide classic, it’s this song.
‘The Noel Diary’ Stream it on Netflix.
Jake (Justin Hartley, of “This Is Us” fame) and Rachel (Barrett Doss, “Station 19”) have smoking chemistry in this polished effort from “Father of the Bride” director Charles Shyer, making “The Noel Diary” the best romance and possibly even the best movie of this bunch, period. He is a bestselling writer, while the most important line on her character sheet is that she is looking for her birth mother. As if this weren’t enough, the freakishly perfect Jake has an unbearably cute Australian shepherd named Ava who comes along for the ride when the two gorgeous hu-
mans embark on a road trip through a fantasyland Northeast in the middle of winter. In a self-aware nod to its genre, “The Noel Diary” boasts a great two-step joke about how many rooms are left at an inn when a pair of incredibly attractive people show up without a reservation.
‘Scrooge: A Christmas Carol’ Stream it on Netflix.
It takes a little while to get over the fact that all those classy British and Irish voices — Olivia Colman, Luke Evans, Jessie Buckley, Jonathan Pryce — are paired with some of the most garish animation in recent memory. A hopped-up yet grindingly slow adaptation of Dickens’ ubiquitous holiday classic, the movie incorporates old Leslie Bricusse songs from his “Scrooge” musical, as well as three new numbers. The most welcome surprise is that Scrooge’s dog doesn’t talk or sing. Thank God for small mercies.

Yes, it’s another musical version of “A Christmas Carol.” Will Ferrell’s Ghost of Christmas Present leads a supernatural special-ops team (Sunita Mani kills as Past) that tricks unredeemable people into changing their ways. Their latest target, Ryan Reynolds’ Clint Briggs, proves extremely unwilling to budge, though. For most of the movie, Ferrell looks unsure as to whether he should play this straight or not, but Reynolds is all in as a sleek dude described as “the perfect combination of Mussolini and Seacrest.” He can move, too. While it outstays its welcome by a good 30 minutes, “Spirited” nails more jokes than strictly required, and the splashy musical numbers land. Mission accomplished.

La hipoteca fue constituida mediante la escritura numero 31, otorgada en San Juan, P.R., el 22 de enero de 1999, ante el Notario Jose R Fournier Torres; y el pagare de la misma fecha, por $64,950.00 y garantizado por dicha hipoteca, lleva el numero de testimonio (se desconoce) del mismo Notario Jose R Fournier Torres. En dicha demanda se tramita un procedimiento de cobro de dinero y ejecución de hipoteca bajo el número mencionado en el epígrafe. Se alega en dicho procedimiento que la parte Demandada incurrió en el incumplimiento del Contrato de Hipoteca, al no poder pagar las mensualidades vencidas correspondientes a los meses de octubre de 2019 hasta el presente, más los cargos por demora correspondientes. Además, adeuda a la parte demandante las costas, gastos y honorarios de abogado en que incurra el tenedor del pagaré en este litigio. De acuerdo con dicho Contrato de Garantía Hipotecaria la parte Demandante declaró vencida la totalidad de la deuda ascendente a la suma de $70,718.29 la cual se compone de un primer principal por la suma de $62,319.29 y un principal diferido por la suma de $8,399.00, más intereses sobre la suma de $62,319.29 a razón del 7 1/8% anual, así como todos aquellos créditos y sumas que surjan de la faz de la obligación hipotecaria y de la hipoteca que la garantiza, incluyendo la suma pactada para costas, gastos y honorarios de abogado. When Derek Jeter retired, Brian Cashman, the New York Yankees’ general manager, said that the long and time-honored tradition of naming a Yankees captain should be retired with him.
That was before Aaron Judge debuted with the team and rose through the pinstriped ranks.
Now, as the Yankees close on a record-setting, nine-year, $360 million free agent deal with Judge, a slugging outfielder, part of his return could include him being named the 16th captain in club history.
Team owner Hal Steinbrenner suggested in November that naming Judge captain is something that the team “would consider” if he returned. In October, first baseman Anthony Rizzo and pitcher Néstor Cortés each said that Judge should be named captain if he came back. “Most of the guys in there agree with me,” Cortés told reporters.
“I’ve never been the one that’s made the decision to make a captain,” Cashman said earlier this week before his departure from baseball’s winter meetings in San Diego. “That decision doesn’t sit at the manager’s desk. It doesn’t sit at the general manager’s desk. It always sits at the owner’s desk.”
Cashman said he only declared post-Jeter that there was no more need for a Yankees captain because Jeter, a shortstop inducted into the Hall of Fame last year, set the bar so high and did it as well as anyone ever could.
“I felt it was appropriate to state that I’m not sure if we ever need one again,” Cashman said. “But that doesn’t mean if someone else is worthy that emerges and, clearly in Aaron Judge’s case, he is spectacular.”
He added, “Just like when we retire numbers, that comes from ownership.”
And if Steinbrenner wants to honor Judge, Cashman said, “I support that decision 110%.”
Jeter was named as the Yankees’ 15th captain by George Steinbrenner in June 2003.
“He represents all that is good about a leader,” Steinbrenner, who died in 2010, said then. “I’m a great believer in history, and I look at all the other leaders down through Yankee history, and Jeter is right there with them.”
Jeter was the first Yankees captain since Don Mattingly, who retired after the 1995 season. The lineage of Yankees captains stretches back to Babe Ruth and includes Lou Gehrig and Thurman Munson. Graig Nettles, Willie Randolph and Ron Guidry were also captains in the 1980s.
Judge, 30, has emerged as a clear team leader over his seven seasons in the majors and earned the admiration of teammates this past summer for his leadership and energy as he set the American League single-season home run record at 62 and tied for the major league lead with 131 RBIs. It was a career year in which he also led the majors in runs scored (133), on-base percentage (.425), slugging percentage (.686) and total bases (391).
“I acknowledge that Aaron Judge has been a leader of this franchise in every way, shape and form,” Cashman said.
Manager Aaron Boone said “we’ll talk about all that stuff” when asked Wednesday about the idea of Judge formally being named captain.
“He’s an amazing player, an amazing person that certainly has the respect of everyone in that room,” Boone said. “Guys look to him, look up to him. So when you have a player of that caliber but that also is as beloved and as important as he is on a daily basis, especially on the intangible stuff, you’d best hang onto that.”

There are only five serious Super Bowl contenders left in this season — six if you count the Minnesota Vikings, though you really shouldn’t.
The Buffalo Bills (9-3), the Cincinnati Bengals (8-4), the Dallas Cowboys (9-3), the Philadelphia Eagles (11-1) and Kansas City (9-3) are the NFL’s best teams by any meaningful measure. All five are solid to spectacular on both offense and defense, and, crucially, all are healthy enough to play well down the stretch.
Beyond the Fab Five, however, the playoff field is overcrowded with battered or underqualified applicants. And the Vikings.
The San Francisco 49ers (8-4) would rank among the serious contenders if not for Jimmy Garoppolo breaking his foot last week, an injury that ended his regular season. With a defense that allows a league-low 283.9 yards per game and an offense built around rushing and micro-passing, the 49ers operate on quarterback autopilot. Unfortunately, unless Garoppolo can return in the playoffs, rookie backup Brock Purdy — the team’s third starter this season — will be tasked with landing the team during a thunderstorm.
Purdy poked just enough buttons for the 49ers to beat the Dolphins (8-4) last week, revealing Miami’s offense as a precision-tuned sports car capable of exceeding 200 mph and of bursting into flames if a dust mote gets under the hood.
The Baltimore Ravens (8-4) were also on the Super Bowl shortlist before Lamar Jackson’s Week 13 knee injury. Jackson is expected to miss only a few weeks, but the Ravens are also probability-defying disaster artists who have lost three games this season in which they entered the fourth quarter ahead by two scores. If the Ravens need to convert a fourthand-inches sneak to stave off an opponent’s late-game rally in the playoffs, their huddle will probably be struck by lightning.
The Seattle Seahawks (7-5) have been a pleasant surprise but lack the sheer talent required to survive the playoff gantlet. The Seahawks will be forced to settle for the We Won the Russell Wilson Trade trophy, which comes bundled with a 2023 first-round pick: not a bad consolation prize.
The AFC South is like one of those college basketball conferences full of tiny divinity schools, and the Tennessee Titans (7-5) are its perennial champions who earn an automatic tournament bid only to get walloped by Duke. The Eagles beat the Titans, 35-10, last week, underscoring the difference between true contenders and teams built to defeat the Houston Texans.
The NFC South is full of mismanaged and financially hamstrung teams, allowing the Tampa Bay Buccaneers (6-6) to stay atop with tight defense and residual flickers of Tom Brady sorcery. The Buccaneers will clinch the division unless the Atlanta Falcons (5-8) enjoy a surge. In other words, the Buccaneers have clinched the division.
The New England Patriots (6-6) remain in the playoff picture out of a sense of tradition, despite an offense cribbed from the 1968 edition of “Junior Varsity Strategies for Sluggish Lads.” Many opponents still surrender on sight to the Patriots because of 20 years of Pavlovian conditioning, which is all that needs to be said about the New York Jets (7-5).
The Los Angeles Chargers (6-6), coming off a loss to the Las Vegas Raiders, are better at producing Justin Herbert viral-video highlights than victories.
The playoff chase has grown so dreary that when the New York Giants (7-4-1) and the Washington Commanders (7-5-1) faced off in what amounted to a winner-takes-all duel for a wild-card berth, neither team won. Nothing signals mutual unworthiness quite like a 20-20 tie.
Finally, there are the baffling Vikings (10-2), who can clinch the NFC North with a win over the Detroit Lions on Sunday. The Vikings offense ranks 19th in the NFL in yards per game (335.8), and the defense gives up the league’s second-most yards per game (398.7) — not exactly the statistical profile of a Super Bowl front-runner. The Vikings are the anti-Ravens, often winning on last-second fumbles, multiple goal-line stands, fortuitous replay reviews or meteor showers.
The Cowboys and the Eagles beat the Vikings by a combined 64-10 score in their meetings, illustrating how far the Vikings’ good fortune should carry the team in the postseason.
With five legitimate powerhouses jockeying for 14 playoff spots, the NFL will have a hard time manufacturing drama over the rest of the regular-season schedule. Compelling matchups are in short supply, while likely blowouts and allbut-meaningless contests will be abundant.
A first-round bye in the NFC may be on the line when the Eagles visit the Cowboys on Dec. 24. The Bengals host the Bills and the Ravens in Weeks 17 and 18, matchups that will finalize the AFC seeding.
Otherwise, the late-season broth is rather thin:
The Chargers host the Dolphins on Sunday night in a game more likely to generate tiresome Justin Herbert vs. Tua Tagovailoa talk-show arguments than playoff clarity.
The Giants and Commanders square off again in Week 15. While most games with playoff implications are “flexed” into prime time TV windows, the networks may flex this rematch to Wednesday at 4 a.m., preempting the soybean report.
The Seahawks host the 49ers on Thursday night in Week 15: As all experts predicted in the preseason, the NFC West will come down to a duel between Brock Purdy and Geno Smith.
There are also plenty of games involving teams that are still alive, at least mathematically, including Detroit, Green Bay, Las Vegas and Pittsburgh. The Indianapolis Colts (4-81) fired their head coach a month ago and lost, 54-19, to the Cowboys on Sunday night, yet The Times’ Playoff Predictor gives the team a 1 to 2% chance of reaching the postseason. Their Week 15 meeting with the Vikings, lopsided and dull as it looks on paper, may well have “playoff implications” for both teams.
The NFL expanded the playoffs to 14 teams in 2020 precisely so that fans of four-win teams could dream of wildcard berths in mid-December and that Giants-Commanders ties would be consequential. The top five contenders are just so much stronger (and healthier) than the field this year that it makes the final five weeks of the season feel perfunctory.
