Fiscal board approves $76 million contract for Vieques hospital project ‘with observations’

The Financial Oversight and Management Board approved this week “with observations” a $76 million contract to build a hospital facility in Vieques whose real costs have been estimated to be at least $25 million more. The oversight board reviewed the proposed contract between the Puerto Rico Infrastructure Financing Authority (PRIFA) and Caribe Tecno CRL and Firma de Ingenieros, Arquitectos & Asociados PSC for the design and construction of new medical facilities in the offshore island municipality.

After reviewing the contract, the oversight board approved it “with Observations.”

“For the avoidance of doubt, the review performed by the Oversight Board does not constitute a legal review of the contractual documentation or the contracting process, including without limitation: compliance with contracting requirements under applicable laws, rules, and regulations, both federal and local; and compliance with applicable laws, rules, and regulations governing procurement activities, both federal and local,” the board said.

The contract stems from a competitive procurement process issued on Aug. 18, 2022 and contemplates the design and construction of new medical facilities in the Municipality of Vieques that would occupy approximately 46,800 square feet, including a dialysis building and the central utility plant.

Additionally, the site will accommodate new parking areas and drop-off lanes, provide proper vehicle circulation by accommodating the flow of traffic to allow for the separation of emergency vehicles and private vehicles, and comply with helipad restrictions and clearances.

The proposed contract was approved by the Federal Emergency Management Agency (FEMA) allowing awards for permanent work projects to be based on fixed cost estimates, instead of the actual cost of the project.

“As such, if the actual cost of the project exceeds the fixed cost estimate agreed upon by FEMA and PRIFA, PRIFA is responsible for the additional costs,” the oversight board said. “However, if the actual cost is below the fixed cost estimate, PRIFA may use the remaining funds for other eligible purposes, such as for additional cost-effective hazard mitigation measures to increase the resiliency of public infrastructure.”

“Notably, PRIFA’s fixed cost estimate was $104.6 mil-

lion, which is significantly higher than FEMA’s cost estimate of $48.3 million,” the board added. “PRIFA informed the Oversight Board that this difference corresponds to the fact that the estimate made by FEMA did not contemplate the impact of costs related to regulatory requirements, existing codes, and requirements of the Auxiliary Secretariat for Regulation and Accreditation of Health Facilities and the Department of Health, among others.”

The proposed contract has a maximum payable amount of $75.9 million. “The Oversight Board’s review indicates that PRIFA has sufficient budgeted funds to cover the cost of the Proposed Contract. This determination does not consider the extent to which total available funds will be subsequently encumbered by PRIFA throughout the Proposed Contract’s term,” the oversight board said. “Consequently, we rely on PRIFA’s budget certification for the purposes of this review.”

The contract for the design and construction of a new hospital complex in Vieques stems from a competitive procurement process initiated last August.

Bill filed to certify students in anti-gender violence curriculum

Rep. José “Ché” Pérez Cordero filed House Bill 1566 on Thursday for the Office of the Women’s Advocate and the Department of Education to certify students in the public school system against abuse and gender violence.

The measure was filed in response to the sharp increase in cases of femicide and domestic violence that have been registered on the island. According to the most recent figures from the Puerto Rico Police Bureau, 7,906 incidents of domestic violence were recorded in 2021. Meanwhile, figures reported by the press state that, as of April 16, 2022, some 2,326 incidents of domestic violence had been reported for that year.

“Eradicating violence is the work and commitment of everyone in our society,” Pérez Cordero said. “We already know that the Department of Education will begin to educate students about respect and equity in all its schools and that it will be carried out according to grade level,

but it requires dividing empowerment and leadership tools, among other benefits. Implementing measures such as these represents a nominal economic investment, but with an extremely beneficial balance.”

“It is necessary to empower young people with tools that help them carry a message of eradication and rejection of dating violence,” the legislator added. “Education is one of the main tools for eradicating the evil of violence in all its forms. Our young people are the foundation and schools are the ideal environment. By training them to take this important message to their peers, we are contributing to addressing this evil and in turn providing to young people the materials, literature or records used for the certifications that must be aligned with the public policy of the governor, Pedro Pierluisi, around violence and, in turn, be aligned with the work on respect and equity that Education has been leading.”

Likewise, the Department of Education and the Office of the Women’s Advocate will be instructed to evaluate the content, join specialists from both agencies and establish the contact hours necessary to obtain the certification, which will even require learning the services that the women’s advocate offers to the community, the lawmaker said.

FEMA allocates funds for generators at hazard mitigation centers

The Federal Emergency Management Agency (FEMA) announced Thursday that it allocated nearly $2 million for the first phase of a $25 million project for police stations, government centers and other facilities that play a vital, and often life-saving, role during a disaster.

The hazard mitigation proposal consists of purchasing and installing generators at 35 police stations and 39 government facilities under the Puerto Rico Public Buildings Authority.

“With the first phase of this project, which includes the contracting process, identifying the engineering firm that will perform the evaluation, design and other procedures, we take an important step toward communities having more reliable facilities,” said José G. Baquero, FEMA’s federal disaster recovery coordinator. “By having an alternate source

of energy, we help address the lack of electricity that greatly affected these places during Hurricane Maria.”

The allocation is being provided through FEMA’s Hazard Mitigation Grant Program and will allow facilities such as police stations, courthouses, government centers and emergency response offices that transform schools into shelters during emergencies to provide their services during power outages.

Several police stations in towns such as Aibonito, Humacao, Lajas, Las Marías, Lares, Quebradillas and Santa Isabel are included, as are government centers in Añasco, Ceiba,

Hatillo, Jayuya, Loíza, Moca, Sabana Grande, Utuado and Yabucoa, among others.

Public Safety Secretary Alexis Torres said his agency will keep collaborating with FEMA to continue moving hazard mitigation projects forward.

“This time, we will impact 35 police stations with the installation of electrical generators, which will allow us to provide service to residents during electrical service interruptions,” Torres said. “Our commitment, together with the Public Buildings Authority, is to impact as many police stations as possible throughout the island.”

Vega Alta culture carnival enters 35th year

The public can enjoy art and culture Feb. 24-26 at the 35th edition of the traditional Vegalteño Carnival in Vega Alta.

Following the tradition of its late founder Don Miguel Curbelo, the carnival will be held in the Gilberto Concepción de Gracia Public Square.

Rodney Curbelo, spokesman for the event and son of Don Miguel, said the carnival celebration arose about 40 years ago from the need to fill a void of tradition, art and culture in the municipality.

“We have followed the tradition of our father; our family is part of this celebration where the best of the artistic cultural work of our people is presented,” Curbelo said, noting that the carnival is a nonprofit organization established by his late father in 1983.

He added that the event is coordinated in collaboration with volunteer groups and with the administration of the Municipal Government of Vega Alta and its mayor, María Vega.

First complete study of arriving visitors yields hopeful signs for island tourism

Discover Puerto Rico on Thursday published the details of the first complete study on visitors arriving in Puerto Rico, a task that lasted one year and included interviews conducted at different points on the island with 1,607 travelers of legal age from abroad.

Discover Puerto Rico also announced that it entered into a collaborative agreement with Ana G. Méndez University (UAGM) for cooperation in the training of students, the scheduling of educational events and the promotion of research on tourism, with initiatives such as the exchange of information or studies such as the visitor’s profile revealed Thursday.

One of the main findings of the study for 2022 is that 98% of those surveyed were satisfied with their experience on the island. Similarly, 95% said that they will return in the future while less than 15% experienced concerns with the destination.

“With such high satisfaction and desire to return among the visitors, this group of travelers offers an important opportunity for the island,” said Erin Francis Cummings, CEO of Destination Analysts, the firm that conducted the study along with Gaither International. “They are the

easy fruit to pick, with a certainly higher chance of conversion. In 2022, only 49% of leisure visitors to Puerto Rico were repeat visitors. At a time of economic anxiety or uncertainty, this group is an opportunity for Puerto Rico to maintain visits in the short term.”

Her statements were made during a Discover Puerto Rico event held at the Carolina Campus of the University of Puerto Rico.

The main reason for the trips taken by those

surveyed was vacation (65%). Only 13% said that their trip was to visit relatives. Travelers selected Puerto Rico as a destination for its climate (34%), its scenic beauty (32%), and local culture (31%).

On average, travelers stayed on the island for 6.1 nights. About half stayed overnight in a hotel (45%), a third in short-term rentals (34%), and the rest in private residences. It is estimated that each visitor spent around $208 per day. Those expenses include lodging, food, entertainment, experiences such as guided excursions and general purchases.

In terms of sociodemographic characteristics, the visitors were, on average, 46 years old, the majority were women (58%), the predominant marital status was married (60%), and the average family income was around $135,000 per year. A third of the travelers came from homes with children.

Sixty-four percent identified as White or Caucasian, 64% and 13% as Black or African American, and 24% as Hispanic or Latino. A similar percentage (23%) said they were of Puerto Rican descent and 8% affirmed their identity as a member of the LGBTQ+ community.

This overview shows the composition of travelers in the best year in the history of the island tourism industry in terms of visitor

spending ($5.7 billion), accommodation rental tax collections ($116 million), and jobs in the tourism sectors, recreation and lodgings (91,500). Likewise, 2022 had the highest passenger traffic at Luis Muñoz Marín International Airport (over 10 million) in more than a decade and was the year in which Discover Puerto Rico’s Live Boricua (Vive Boricua) promotional campaign launched.

In fact, the promotional efforts of Discover Puerto Rico show progress in the familiarity of travelers with Puerto Rico as a tourist destination, in the positive perception of the island and the probability of visiting, officials said. Both the probability of a visit and the positive perception of Puerto Rico increased five percentage points from 2021, according to data from the Strategic Marketing & Research firm.

“The advance has been made because Discover Puerto Rico was able to add a significant amount of economic resources with the allocations we received from federal funds (ARPA, CARES and CDBG-DR)” said Alisha Valentine, director of research and analysis at Discover Puerto Rico. “In 2022, we managed to reach over 33 million homes with the Live Boricua campaign and over 32% of our visitors know about or have been positively impacted by our promotional efforts.”

NPP general assembly slated for March 5

Gov. Pedro Pierluisi Urrutia, as the president of the New Progressive Party (NPP), has convened the party’s next general assembly for Sunday, March 5, at Roberto Clemente Coliseum in Hato Rey.

The assembly’s agenda will focus on the completion of the reorganization of the NPP, as well as the ratification of management positions and the strategies for the 2024 general election, the governor said Thursday.

“We are the largest party in Puerto Rico and the only one whose goal is equal rights with Statehood,” the governor said in a written statement. “Therefore, the thousands of delegates from La Palma, as our electoral army, will say they are present to ratify the governing body of our community and join forces in the fight for Equality ahead of the 2024 elections.”

“At the assembly I will also give an account of all the achievements of the NPP administration during the first two years of these four years and the work that remains to be done,” the NPP leader added. “There is work for a long time, and we are the only party that guarantees the continuation of everything that is being done.”

NPP Secretary General Carmelo Ríos Santiago emphasized the energy and desire of the grassroots toward the general elections in November 2024.

“For the past two years, we have been visiting each of the 78 municipalities on the island as part of the reorganization work,” he said. “We have seen a single, vibrant, militant party eager for November 2024 to arrive to vote en masse for our candidates. I assure you that we will win many municipalities we do not have now and more seats in the Legislative Assembly.”

“Led by our governor and party president, the NPP is organized, strengthened, and prepared for the upcoming electoral events,” Ríos Santiago added. “The general assembly is the culmination of the reorganization work, which included two successful conventions, the only party in Puerto Rico to hold them, a regulation assembly that broke attendance records, and a full house in each of the municipalities we visited.”

San Juan Miguel Romero Lugo, whose city will host the assembly, anticipated that the island capital is ready to be the scene of a historic party reorganization.

“We urge all the penepés and statehooders to be present at the assembly, as the great family that we are, to direct our goals and proposals for the benefit of the development of our people for 2024,” the mayor said. “In San Juan, we are ready, and we have prepared ourselves for this assembly to take place in an organized way for the enjoyment of everyone.”

As part of the agenda, delegates will ratify the three vice presidents of the NPP and the presidents, vice presidents and

state delegates of the auxiliary organizations such as women, youth and public servants, as well as several amendments to regulations and resolutions in favor of statehood.

The gates of 10 of the 11 campuses of the University of Puerto Rico (UPR) were closed on Thursday after the UPR Workers’ Union went on strike a day earlier for better wages and improved health coverage.

The UPR-Mayagüez Campus (RUM) was not closed because its employees are represented by another union.

On Wednesday night, UPR President Dr. Luis Ferrao Delgado said in a written statement that: “Since I assumed the presidency of the University of Puerto Rico I have been, together with my team in Central Administration, in the best disposition to attend to the demands of the different unions of our university.”

“I have publicly acknowledged that there are needs for pay justice and that is why my administration is working on reviewing and updating the Classification and Pay Plan, which has not been reviewed in 44 years. We have held several meetings with Mr. David Muñoz [Hernández], president of the Workers’ Union, and his delegates to address their demands,” Ferrao Delgado noted in the statement. “During the process, we have made it clear that the granting of a salary increase and other benefits to our employees that carry budgetary impact is already contained in our budget request for the new budget (FY2024) and eventually this must be certified by the Fiscal Oversight Board (sic).”

“However,” the official added, “in order to address part of the demands made by the Union, we presented a genuine alternative: a non-recurring bonus of $2,125 for each employee of the Union. This equates to approximately a salary increase of $2,024 per month per year and a half. However, our offer was not accepted by the Union.”

Muñoz Hernández said it was explained to the union that for the new budget a request was made to the Office of Management and Budget for more than $129 million so that UPR can honor the minimum wage policy. He said he is confident that, if approved by the Financial Oversight and Management Board, “we can do the necessary wage justice.”

Ferrao Delgado also said in the statement that “regarding the claim of a single medical plan, Certification Number 2020, 2021-1 of the [UPR] Governing Board prevents us from accessing the Union’s claim and granting a medical plan different from that of all UPR employees.”

“Within the framework of this process of dialogue, we reiterate our invitation to reconsider the position of the Union to call a strike, which not only violates the best interests of the university community but also constitutes an open violation of the provisions of the Supplementary Rules and Conditions of Work of the Workers’ Union in its article 1 subsection H, which clearly states: ‘that the union, in consideration of what has been negotiated, undertakes with the university administration not to carry out activities such as strikes, work stoppages or any other variant of these that may affect services in any way,’” the university president said.

UPR wakes up on strike at 10 campuses Development Bank signs economic collaboration pact with DR

President Luis Alemañy González, along with the consul general of the Dominican Republic in Puerto Rico, César Cedeño, signed on Thursday a historic collaborative agreement with the objective of promoting Dominican entrepreneurs in Puerto Rico.

“The EDB continues its efforts to make its financial products available in all sectors,” Alemañy González said in a written statement. “Today, we are very happy, because with the signing of this Agreement, we guarantee ourselves to be one of the first financial options to achieve the business dream of our Dominican brothers.”

The Dominican government representative in Puerto Rico said “I am very satisfied with this initiative, to ensure that our Dominican entrepreneurs have the possibility of accessing loans with reasonable interest rates, for the development of their businesses.”

“With this we follow up on the efforts and interest of President Luis Abinader Corona, along with Governor

Pedro Pierluisi in strengthening our commercial ties,” Cedeño said.

With the agreement, the EDB will be assigning a liaison officer and offering guidance in coordination with the consulate. Among the EDB’s financial products are term loans with interest rates of four to eight percent and credit lines.

“We thank Mr. Luis Alemañy for his openness toward developing this project, as well as Mr. Miguel Cabral, director of the Bilateral Joint Commission, Puerto Rico-Dominican Republic, who together with yours truly will be in the best disposition to enforce the agreements we sign today, because it represents a great advance for our community,” Cedeño added.

Alemañy González pointed out that the results of the U.S. Census reveal that the population born in the Dominican Republic and residing in Puerto Rico increases every year. In 1980, some 20,558 Dominicans were registered on the island and for the most recent study, for 2019, that figure exceeded 52,295.

“We know the entrepreneurial spirit of Dominicans, and the EDB is ready to offer them the necessary financial

tools so that they can achieve success, and thus continue contributing to the economy of Puerto Rico,” Alemañy González said.

The gates at all but one of the University of Puerto Rico’s 11 campuses were closed on Thursday after the UPR Workers’ Union went on strike a day earlier.

In the wake of tragedy, balancing freedom and safety at Michigan State

Until a gunman shot and killed three Michigan State University students this week, the campus was a whirl of activity where 50,000 students came and went as they pleased on foot, bike, scooter and bus from dormitories to classrooms to libraries.

But two days after the shooting, it was a place for hushed vigils, remembrance and reflection, and where yellow police tape stretched in front of the student union. Classes were canceled as students and faculty tried to balance the freedom of campus life with the sudden reminder that in a country flooded with guns, securing college campuses from random attacks can be an especially vexing challenge.

While elementary, middle and high schools in the United States have been transformed in the last generation — with only moderate success — by metal detectors, new security systems, increased screening for visitors and the installation of locks on classroom doors to evade mass shooters, the same changes have not come to colleges and universities.

“What we do and what is acceptable from K through 12 is not necessarily acceptable when you get to the college level,” said Anthony Gentile, a professor at John Jay College of Criminal Justice and security adviser to the Newtown Public School District in Connecticut, where the Sandy Hook Elementary School massacre occurred in 2012. “Frankly, anybody can drift onto one of the campuses and do what happened the other day.”

That vulnerability was made hauntingly apparent in the wake of Monday’s attack by the gunman, identified by authorities as Anthony McRae, a 43-year-old who appeared to have no known affiliation with the university. In addition to the three dead, five students who were shot Monday remained hospitalized in critical condition.

Hundreds of students, braving cold weather and fierce winds, gathered Wednesday night for a vigil on campus. After a performer sang “You’ll Never Walk Alone,” those gathered were addressed by Gov. Gretchen Whitmer; Teresa Woodruff, the interim university president; Tom Izzo, the men’s basketball coach; and two student leaders. “Our loss has been great,” Izzo said. “Our lives have been permanently changed, but with a shared commitment to help each other.”

Some students said this week that they wished the campus had tighter security measures, such as requiring key cards or photo identification to enter the student union. Others were skeptical that those kinds of steps would have prevented the attack.

At least one person promoted the notion of allowing guns on campus, scrawling a message on the Rock, a campus landmark that is frequently painted and repainted: “Allow us to defend ourselves & carry on campus.”

On Wednesday afternoon, Ally Anderson, a senior, stood in front of the Rock, quietly paying her respects to the students who were killed before she would leave campus and drive home to Danville, Kentucky. The message supporting

concealed carry had already been painted over.

“I think it’s, like, really insensitive at the moment,” Anderson said. “It feels like there’s already so many guns, that if they did help, we would have been safe.”

Sarah Forsyth, 18, a freshman studying communications, was in her dorm room Monday night when she heard of the shooting on campus. She felt safe there, she said, because a student ID is required to enter each floor of the dorm.

But other parts of campus, such as the student union and classroom buildings, are generally open to the public, Forsyth said.

“Before all this happened, I never felt there was any threat to safety or anything like that,” she said. “I felt very secure on campus.”

Officials from universities and colleges around the country said they were evaluating their own security in the wake of the attack at Michigan State. Capt. Kyle Garwood of the Wichita State University police in Kansas said that he was in favor of more buildings on campus having electronic key card access, a measure that is present in about 70% of the school’s 80 buildings.

Police officers on campus already patrol entrances and exits to check that they are secured, removing bricks or rocks that students commonly use to prop open doors. There is a campuswide system that sends security alerts to phones — common across the country — but students opt in to the service, rather than opting out.

Garwood said he would also like to increase the number of surveillance cameras.

“We want to be in an open place where we welcome thought and diversity and challenge ourselves,” he said. “But there’s this other side of humanity that’s dark and wants to do evil.”

Rodney Chatman, the vice president for public safety at Brown University, said one important trend in recent years has been the increased installation of card access systems

for some campus buildings, especially dorms and libraries.

“It’s a balancing act because you don’t want colleges to appear like prisons or Fort Knox,” he said. “At the same time, we need to keep these spaces safe.”

Although mass shootings on college campuses date to the 1966 clock tower massacre at the University of Texas at Austin, the way campus police departments prepare and respond to such threats did not change dramatically until 2007, when a 23-year-old student killed 32 people at Virginia Tech, experts said.

Police chiefs recognize it is almost impossible to control access to university campuses: There are simply too many entrances and buildings. Many land-grant universities, like Michigan State, are the size of small cities, and local residents and students come and go for classes, sporting events and cultural events.

“Even with smaller colleges, it is impossible to wall off the entire campus,” said John Ojeisekhoba, the chief of campus security at Biola University in La Mirada, California, and the president of the International Association of Campus Law Enforcement Administrators. “You can’t detect everyone who brings a firearm on a college campus.”

New details about the accused gunman, McRae, continued to emerge Wednesday. A serious run-in with police in 2019 played out as he was smoking a cigarette on the back steps of a shuttered addiction treatment facility in Lansing around 2 a.m., records show. Businesses in the area had reported several recent burglaries, and an officer stopped to talk with McRae.

The exchange was brief and calm, court records show. McRae volunteered that he was carrying an unlicensed Ruger LCP .380 semi-automatic handgun and extra ammunition. He had ridden a bike there; a decade earlier he had been charged on four occasions with driving with a suspended license, records show, and his father said he no longer drove a car.

He faced a felony weapons charge, but he pleaded guilty to a lesser crime, a misdemeanor, after his lawyer, a public defender, argued that he had been unlawfully detained. He was sentenced to 18 months of probation. A felony conviction would have barred him from being able to legally purchase a gun.

The gunman’s father, Michael McRae, said that police seized several weapons from his son but that he had acquired other guns without telling him.

Dozens of students, state lawmakers and other residents gathered Wednesday in front of the Michigan State Capitol in Lansing for a demonstration to call for gun control. During the demonstration, Maya Manuel, a Michigan State student who helped organize the rally, told students to sit in straight lines in front of the Capitol building with their legs crossed, “crisscross apple sauce like we learned in school.”

Manuel said she wanted the peaceful sit-in at the Capitol to demonstrate that she and her fellow classmates have practiced lockdown and active shooter drills in school since they were children.

“Please acknowledge us,” Manuel said.

In Ohio town where train derailed, anxiety and distrust are running deep

All around the once-thriving industrial town in the quiet hills of eastern Ohio, there were signs this week of business as usual. Schools were in session, restaurants were serving lunch and trains were again barreling along the tracks that cross Market Street.

But all around, too, were signs that nothing was normal at all. People sniffed the water coming out of their taps, checked rashes in the mirror and gazed down into creeks at the green-white shoals of fish and frogs floating belly up. The smell lingered, reminding some of a tire fire, others of burning plastic, mixed with model airplane glue or nail polish remover.

Nearly two weeks after a Norfolk Southern freight train derailed in East Palestine, and a controlled burn of toxic chemicals it was carrying forced hundreds of residents to evacuate the area for days, the normal for many here was dread.

“It’s always kind of been a comforting sound,” Traci Mascher, who is raising three of her grandchildren in the town, said of the wail

of the trains as they rattled through. “And now it’s a horrifying sound.”

As dusk fell Tuesday, she and her husband, Greg, took their granddaughters to a park so they could sit on a bench and think. Other families were sending their children back to school this week, but the Maschers’ girls had broken out in rashes in recent days, and they wondered what dangers to their health might linger throughout the town. Neighbors were returning to their houses, but they had seen firsthand the monstrous plume over the rooftops and had not spent a night at home since.

The Maschers had been in East Palestine for three generations, and Greg Mascher, 61, now spoke of it like a foreign land. “I’m lost,” he said. “Totally lost.”

Perhaps the most frightening thing for the town’s roughly 4,700 residents is how much remains unknown, and whether dangers that may be addressed in the short term will pose a threat years down the line. Experts have warned that understanding the causes and consequences could require a more comprehensive investigation than what has taken place so far.

Confusing and seemingly shifting messages from government and railroad officials have frayed the local trust, which was already thin in a town battered by decades of mill and plant closures. Rumors and suspicions about the incident are swirling on Facebook and TikTok accounts all over the country; around town, they are also being traded among neighbors in backyards and through the open windows of pickup trucks.

The tension rose Wednesday evening in the East Palestine High School gym, where the town had scheduled an “informational open house.”

Hours before the meeting, Norfolk Southern announced it would not attend, with a spokesperson saying that “we have become increasingly concerned about the growing physical threat to our employees and members of the community around this event stemming from the increasing likelihood of the participation of outside parties.” The company did not provide any additional details on the nature or origin of the threats.

Residents, frustrated with a lack of answers, pushed local officials to take their questions anyway, as they pressed for more assurance that their water and homes were safe and demanded to know how this could be prevented and what would be done to take care of the town.

At a news conference Tuesday, state officials recommended that people in the area use bottled water, particularly if they rely on a private well. A day later, the Ohio Environmental Protection Agency said it was “confident that the municipal water is safe to drink” after a series of tests did not show contaminants, but encouraged those with private wells to test their water.

Part of the train and its cargo of hazardous chemicals initially ran off the tracks on the night of Feb. 3, leaving a fiery, frightening jumble of about 50 cars. Parts of East Palestine were forced to evacuate within three days of the derailment, when state officials agreed to the company’s request to intentionally burn some of the chemicals to defuse the threat of an explosion that could have sent shrapnel and toxic fumes flying. Chemicals on board included vinyl chloride, a colorless, flammable gas that can cause headaches and dizziness after being inhaled and potentially, after sustained exposure, a rare form of liver cancer.

As of Wednesday, the Environmental Protection Agency had screened 459 homes and had not detected either vinyl chloride or hydrogen chloride, an agency spokesperson

said. But days earlier, people in the town had learned that the train had been carrying more toxic chemicals than they had been told previously, convincing many that more was being kept from them.

Michael S. Regan, the head of the EPA., was set to travel to East Palestine on Thursday, the agency said, to meet with state and local officials, along with residents.

“I just don’t trust anybody,” said Mike Routh, 28, standing in the parking lot of the Abundant Life Fellowship church in New Waterford, a town 5 miles east of East Palestine. The church had been temporarily turned into an assistance center, and Norfolk Southern was giving out $1,000 payments to “cover costs related to the evacuation.” Routh, who installs cellphone towers for a living, was debating whether to take the company’s money and worried that doing so would limit his options for compensation later on if he were to join a lawsuit.

The company was going to buy its way out, he predicted, pointing out, as many here do, that its trains began running through the town again minutes after the evacuation order was lifted. “It’s almost a war of corporate greed against small-town America,” Routh said. He and his wife were talking about moving away for good. “This town was starting to come back and now it’s going to just die.”

A spokesperson said Wednesday that Norfolk Southern had set aside funds for residents in the area, including more than $1.5 million to help cover the cost of evacuations, and that it was providing air purifiers to some households and had expanded the eligibility for assistance.

“We will be judged by our actions,” Alan Shaw, the Norfolk Southern president and CEO, said in a statement. “We are cleaning up the site in an environmentally responsible way, reimbursing residents affected by the derailment, and working with members of the community to identify what is needed to help East Palestine recover and thrive.”

But this did little to assuage the town’s anger and frustration.

“I just don’t want to be diagnosed with cancer or something 10, 15 years down the line because of their mistake,” said Therese Vigliotti, 47, who was outdoors the night that the chemicals were burned and said that her tongue still feels scalded and that she had seen blood in her stool for two days.

Most of the anger so far has been directed at Norfolk Southern, with elected officials publicly taking the rail company to task. Gov.

Mike DeWine of Ohio, a Republican, called it “absurd” that Norfolk Southern had not been required to notify local officials about the train’s contents before it came through because of its classification, calling for congressional action and dangling the threat of legal action should the company fail to pay for the cleanup.

In a public letter, Gov. Josh Shapiro of Pennsylvania, a Democrat, denounced Norfolk Southern for its “poor handling” of the derailment, charging that “prioritizing an accelerated and arbitrary timeline to reopen the rail line injected unnecessary risk and created confusion in the process.”

On Wednesday, four senators — Sherrod Brown and J.D. Vance of Ohio, and Bob Casey and John Fetterman of Pennsylvania — wrote a letter to the EPA requesting more information about the agency’s plans and ability to respond to the derailment, as well as any information about long-term effects on the environment and how the rail company would be held accountable.

An initial federal report detailing the investigation into the derailment is expected to be released in two weeks. The National Transportation Safety Board confirmed that surveillance footage from a nearby home showed a wheel bearing overheating just before the train derailed, and that officials would examine the wheel, the cars and documentation from the train as part of its investigation.

Some railroad union officials and residents pointed to surveillance footage posted online from a business in Salem, Ohio, 20 miles from the derailment, which seemed to show flames coming from underneath the train, raising further questions about when it became clear that the train was at risk of derailing. The footage was first reported by The Pittsburgh Post-Gazette.

When the train did ultimately crash in East Palestine, said Chasity Smith, “it was like the gates of hell opened up.” Since then Smith, 40, has found herself sniffing her tap water and the well water that her horses drink from. Ever since the derailment, she has watched trucks and workers rumble through the village, questioning why they were in such a hurry to rebuild the railroad tracks when she and her

neighbors were still unsure if it was safe to drink the water or even breathe the air.

The way that the response from Norfolk Southern and government officials has unfolded has deepened a conviction among many here that they have been treated as expendable victims of powerful forces. In downtown East Palestine on Tuesday afternoon, a man stood on a street corner holding a sign that read: “Profits over people/ They Poisoned the Community.”

The next morning, a family — a father, mother and 3-year-old girl — stood on another corner holding posters suggesting the EPA had orchestrated the controlled burn of the chemicals just to get trains running again, declaring that “The EPA nuked a town to open the Railroad #OhioChernobyl.”

“I think the company has the money to have the big say in what’s going on,” said the mother, who gave her name only as Melinda and said the government only acts at the bidding of corporate power.

Driving south out of town past the Dairy Queen, every house relies on well water, said Russell Murphy, 50, who lives on a farm a few miles outside East Palestine. No one in the area can drink the water right now, and it’s not clear when they will be able to again. Murphy and his wife are wondering if they will have to leave, and who would buy their home if they did.

Leslie Run burbles along the bottom of the hill where the Murphys live. Russell Murphy stood on a bridge Tuesday, pointing out one dead fish after another; state officials have already counted 3,500 dead fish across waterways near the derailment.

“The water scares me,” Murphy said. Officials can test and say it is safe for now, he said, but he does not believe that the chemicals released in the controlled burn simply disappear.

“What’s it going to be two years from now?” he said. “Are we going to start seeing cancer cells pop up? Or three weeks from now? I don’t know how long that stuff takes to get where it’s got to get to.”

Noting that people were making stickers that said, “I Survived the Toxic Train Wreck 2/2/23,” Murphy gave a morbid laugh. It was way too early, he said, to be so sure.

Charges dismissed for reporter arrested at Ohio derailment news event

Charges have been dismissed against a reporter who was arrested last week while covering a news conference on the train derailment in East Palestine, Ohio, Dave Yost, the Ohio attorney general said in a statement earlier this week.

On Feb. 8, the reporter, Evan Lambert, had been waiting for the news conference about the status of the derailment, about 50 miles northwest of Pittsburgh, to start at 3 p.m. But the event was delayed for two hours, clashing with his scheduled live shot for NewsNation, the cable channel where he works.

Lambert filmed his live shot around 5 p.m. — away from the lectern for officials that was set up in a school gymnasium — and reported the news quietly, Mike Viqueira, the Washington bureau chief of NewsNation, said in an interview last week.

As Gov. Mike DeWine, a Republican, shared an update that residents of East Palestine would be allowed to return home, local law enforcement officials told Lambert that he was “out of line for talking when the governor was talking,” Viqueira said. Lambert was arrested.

During the arrest, Lambert is heard saying “I’m

doing my job,” in a video from WKYC Studios, a television station. He told the four officers not to touch him as they surrounded him. Then, the officers and Lambert moved to a hallway, where two officers put Lambert on the ground on his stomach, video of the encounter showed.

Yost said Wednesday that his office had reviewed video and documentary evidence and that the charges of resisting arrest, a second-degree misdemeanor, and criminal trespass, a fourth-degree misdemeanor, were “unsupported by sufficient evidence.”

NewsNation said Lambert had been released from jail the same night.

“While journalists could conceivably be subject to criminal charges for trespassing in some situations, this incident is not one of them,” Yost said.

He also said that tensions were running high in the days after the derailment on Feb. 3 and that local officials “appeared to be following the lead of the National Guard.”

“Regardless of the intent, arresting a journalist reporting at a press conference is a serious matter,” Yost said. “Ohio protects a free press under its constitution, and state officials should remember to exercise a heightened level of restraint in using arrest powers.”

Financial woes thrust Lyft, long in Uber’s shadow, into the spotlight

In 2018, Lyft’s co-founders, Logan Green and John Zimmer, assembled employees in the cafeteria of the San Francisco company’s headquarters for a staff meeting. There, they explained that they were spending $250 million to purchase Motivate, the owner of the CitiBike bicycle-sharing program in New York.

But employees had been hoping for more. For years, Lyft had been struggling against Uber, its far bigger ride-share competitor, which had expanded into food delivery and announced its entry into dozens of countries around the globe. Lyft’s workers were clamoring for it to make an ambitious move. Some had hoped executives would announce Lyft’s own worldwide expansion, according to two former senior employees who spoke on the condition of anonymity.

It didn’t happen. The bike-sharing deal is an example of what analysts and three current and former employees say is an overly cautious business strategy that has dogged Lyft since its early days. The company’s decision not to deliver food or offer rides outside North America proved costly as it recovered from the pandemic, giving Uber a firm advantage that has prompted questions about the future of Lyft’s business.

Last week, in financial results for the last three months of 2022, Lyft warned that it would be hindered by economic challenges, spooking Wall Street and sending its stock price tumbling nearly 40%, matching a low of $10 a share, before rebounding slightly this week. It is now valued at $4.2 billion, from $22 billion at its peak.

Lyft did report record revenue of $1.2 billion in its most recent quarter — as well as $588 million in losses. But it has yet to prove

it can become a profitable business, and its recent financial woes have set off speculation over whether it could be an acquisition target.

Lyft said that its Motivate acquisition was part of a so-called micro-mobility strategy and that since 2018, more than 2 million people had taken a bike or scooter ride using the app. In a statement, the company said it remained confident in its overall business. “There is a clear opportunity to take advantage of the market, as driver supply and ride-share demand is the highest in nearly three years,” said Eric Smith, a Lyft spokesperson.

Uber, which is valued at $71 billion, has said it expects to achieve operating income profitability at some point this year, signaling to investors that its business is strengthening. The company said it had more drivers on its ride-hailing platform worldwide in its most recent quarter than ever before. Uber declined to comment on Lyft’s performance.

Uber has made some shrewd — or lucky — bets. It started delivering food in 2014, and it faced skepticism over whether that service would ever take off. Then, when pandemic restrictions forced people to stay inside their homes, both companies’ ride-hailing businesses shut down practically overnight. Lyft had few alternatives, but Uber drivers found that

they could continue to earn some money through the app’s delivery service as food orders skyrocketed.

When people began traveling again in 2021, demand for rides shot back up, but drivers were slow to return to ride-hailing apps. Initially, both companies struggled to meet rider demand. But Uber recovered faster, both because of its delivery business and because it quickly invested $250 million in incentives to coax drivers back. Lyft spent less money on incentives and offered them later than Uber did. Its supply problems lingered.

Lyft said Monday that it considered offering food delivery services during the early pandemic but that it determined there was less of an overlap between drivers who ferried passengers and those who wanted to deliver food than it had expected. The company did introduce in April 2020 a pilot program called Lyft Delivery, which allowed drivers to pick up and deliver essential supplies and products to businesses, before canceling the program last month, according to an email viewed by The New York Times.

Drivers have finally returned to Lyft in large numbers. The company said Tuesday that growth in the number of drivers on its platform from December to January was greater than in any other month-to-month period since 2019.

Still, over the past six months, Lyft paid drivers an average of 19% less in base pay per hour than Uber, and Lyft drivers drove about six hours fewer per month than Uber drivers, according to Gridwise, an app that helps drivers track their earnings.

Uber has also expanded aggressively into more than 70 countries. It has clashed with foreign transit services and made mistakes, but its greater scale has cushioned the financial blow of the pandemic. Lyft, which

only transports passengers in the United States and Canada, said it was hurt by a slow return to travel in cities on the West Coast.

Before the pandemic, Lyft had spent years examining whether to enter other countries, sending executives to Australia, Europe and elsewhere before ultimately deciding that it was too costly, according to two former employees. Even its entrance to Canada has stalled, though Lyft said it was planning more expansions there.

Lyft said its caution was prudent since the pandemic halted travel soon after the company could have entered international markets.

Green, Lyft’s CEO, and Zimmer, the company’s president, bonded over how Lyft could be an alternative to inefficient public transit and reduce the need for car ownership. Both men continue to emphasize that vision in internal meetings, according to four current and former employees. But some have questioned whether their single-mindedness is hindering Lyft’s ability to expand into other businesses or markets.

Employees have worried for months about Lyft’s poor stock performance, and some were even more alarmed by the recent plunge, two current employees said.

Some analysts have said that Lyft should merge with another gig company, like DoorDash, or be purchased by a private equity firm. But broader economic challenges, combined with the volatility of Lyft’s stock and the fact that it is unprofitable, would make a deal difficult.

Some investors are waiting to see the changes that Lyft makes this year before hitting the panic button. Executives said on the earnings call that they were considering more cost-cutting measures, after laying off 13% of the company’s employees in autumn.

Tesla fired Buffalo workers seeking to organize, union says

Tesla fired at least 18 employees, including several leaders of a unionization campaign, a day after they announced plans to organize a Tesla plant in Buffalo, New York, workers said in a filing to the National Labor Relations Board.

Elon Musk, the chief executive of Tesla, has been blunt in his opposition to unions, and the company has a reputation for using hardball tactics against union organizers. In 2021, the National Labor Relations Board found that Tesla had illegally fired a worker involved in organizing at the company’s car factory in Fremont, California, and that Musk had illegally threatened workers with the loss of stock options if they unionized.

“I strongly feel this is in retaliation to the committee announcement and it’s shameful,” Arian Berek, a member of the Buffalo organizing committee, said in a statement. Berek said she was fired after returning to work after a bout with COVID-19 and bereavement leave.

The Rochester branch of the Workers United union, in a “charge against employer” dated Wednesday, told the labor relations board that it sought an injunction to block the firings, which it called unlawful.

Tesla “terminated these individuals in retaliation for union activity and to discourage union activity,” the filing said. The firings were reported earlier by Bloomberg News.

Tesla did not immediately respond to a request for comment.

The Buffalo factory makes solar panels and components for charging equipment, according to Tesla’s website, and has about 800 workers who help develop driver-assistance software.

The firings appear likely to complicate Tesla’s relationship with President Joe Biden, who on Wednesday praised the company’s decision to open up a portion of its charging network to owners of other electric vehicles.

The move seemed to represent an improvement in the relationship between Biden and Musk, who had complained that the administration paid insufficient attention to Tesla during its push for electric vehicle subsidies.

But Biden has also cast himself as a strong promoter of unions, and has been critical of companies that take what he considers to be anti-union actions. A White House spokeswoman did not immediately respond to a request for comment on the Tesla firings.

A complaint charged that Tesla fired workers over their plans to unionize.

Wall St slips as economic data fuels rate-hike worries

U.S. main stock indexes slipped on Thursday after unexpectedly strong inflation data and a fall in weekly jobless claims fed into fears that the Federal Reserve will keep raising interest rates to tame high prices.

A Labor Department report showed the highest rise in producer prices in seven months in January as the cost of energy products surged.

It also showed the number of Americans filing new claims for unemployment benefits unexpectedly fell last week, offering more evidence that the labor market remains tight.

“The PPI was up almost twice the forecast and that is clearly a negative for the market overall,” said David Russell, vice president of Market Intelligence at TradeStation.

“And when you consider how strong the job market is, the expectation is that the Fed may raise rates a few more times and then get to a point when it does not need to raise anymore, but there’s no reason for it to cut (later this year).”

After a massive selloff in 2022, the main stock indexes have climbed this year on the back of upbeat earnings and expectations the U.S. central bank will switch to smaller rate hikes.

However, signs of a sturdy U.S. economy and an acceleration in January consumer prices recently raised concerns among traders that the Fed may not hit pause on its hawkish policies anytime soon, with hopes of rate cuts later this year receding.

The Fed is seen pushing the benchmark rate above the 5% mark by May and keeping it above those levels till the year-end.

Meanwhile, Cleveland Fed President Loretta Mester said inflation remains too high and noted that she was open to raising rates by more than what her colleagues wanted at the last monetary policy meeting.

Traders will also scrutinize remarks from other Fed officials, including St. Louis Fed President James Bullard, to assess the central bank’s tone on monetary policy.

At 12:32 p.m. ET, the Dow Jones Industrial Average was down 168.59 points, or 0.49%, at 33,959.46, the S&P 500 was down 19.94 points, or 0.48%, at 4,127.66, and the Nasdaq Composite was down 60.96 points, or 0.50%, at 12,009.64.

Ten of the 11 major S&P 500 sectors posted losses, with technology and communication services leading the declines.

Tesla Inc slid 1% as the EV maker said it was recalling 362,000 U.S. vehicles after the U.S. auto regulator said its Full Self-Driving Beta software may cause a crash.

Cisco Systems Inc rose 6.6% to hit a nine-month high after the network gear maker raised its full-year earnings forecast.

Roku Inc soared 15.8% after it forecast first-quarter revenue above market estimates.

Shopify Inc sank 15% after the Canadian ecommerce company forecast slowing revenue growth for the current quarter despite price hikes and new product launches.

Under the rubble: Gasps of air, protein powder and miraculous rescues

For about 200 hours, two Turkish brothers entombed under the rubble of a collapsed building in the earthquakedevastated city of Kahramanmaras held on, rationing bodybuilding supplements, drinking their own urine, swallowing gulps of air.

“Breathing was easy,” one brother, Abdulbaki Yeninar, 21, told the local Ihlas news agency. “We took protein powder.”

On Tuesday, rescue workers pried Yeninar and his brother, Muhammed Enes Yeninar, 17, from the cement and twisted metal, one of at least nine such improbable rescues over a week after a 7.8-magnitude earthquake leveled towns, killed tens of thousands of people and displaced many more in Turkey and Syria.

In the same city, teams dug a tunnel 16 feet long through tons of fallen walls, floors and piping to reach a woman, in a rescue that was broadcast on live TV. And to the south, a volunteer mining crew joined the efforts to save another, earning tribute from President Recep Tayyip Erdogan, who said they “will never fade away from our memories.”

The miraculous rescues served as rare bright spots in one of the bleakest periods in memory for Turkey, what Erdogan said Tuesday could reasonably be called the “disaster of the century.”

He reported a new death toll for his country, 35,418, and the United Nations said that more than 5,500 Syrians had died. Millions more people in both countries have been displaced since the quake devastated the region last week, with many afraid to return to damaged buildings and struggling to survive in makeshift shelters and extreme cold.

Relief organizations typically scramble to find survivors in the first 72 hours after a natural disaster, as the passing of time exponentially diminishes hope for finding signs of life. In the past week, more than 35,000 Turkish search and rescue teams joined thousands of international workers to dig through the rubble, according to AFAD, Turkey’s emergency management agency.

In recent days, desperation has increasingly set in as the rescue missions have turned to recovery, a humanitarian crisis has taken shape, and hard-hit and hard-to-reach Syrian towns have lamented that they have been forgotten.

On Tuesday, as the total death toll in both Syria and Turkey surpassed 40,000, Turkish authorities arrested more contractors

suspected of shoddy construction that violated building codes.

Critics of Erdogan, who is seeking to defend his response to the disaster, drew attention to videos that showed him previously hailing some of the housing projects that crumbled and buried people. And Turkish police detained scores of social media users on accusations of spreading panic-inducing posts.

But as Turkey’s National Defense Department and national broadcasters shared footage of the rescues, the rare glimmers of good news were celebrated.

In the city of Adiyaman, in southeastern Turkey, rescue workers in bright red and yellow hard hats and vests contrasted sharply with the dust-caked skin and hair of a young man they sought to free from the rubble.

After digging out the man, identified by state news agencies as Muhammed Cafer Cetin, 18, they hooked him up to an IV, fitted him with an oxygen mask and wrapped him in a shimmering survival blanket.

They then delicately carried him in a stretcher over the debris under which he had been buried to an ambulance waiting to take him to the hospital. His condition was not immediately clear. Another man, Ramazan Yucel, 45, was also rescued in the province, according to state news agency Anadolu.

Finally free, the exhausted Yeninar brothers emerged from the rubble, their eyes shut and their arms bound in stretchers as rescuers in fatigues and bright vests carried them away in Kahramanmaras, near the epicenter

of the quake.

Desperate for good news, the workers embraced one another and cheered as the brothers left for the hospital, where they explained how they had survived to the news media.

Rescuers had pulled their mother, also alive, out of the rubble two days earlier, and she was being treated in a hospital in the city of Kayseri for leg injuries, they said.

In the same city, the state news service Anadolu Agency broadcast the rescue of Aysegul Bayir, 35, live to a rapt Turkish audience. Viewers watched as rescue teams dug a 16-foot tunnel through the ruins to reach her.

In the same leveled town, Muharrem Polat, 32, and his wife, Hadiyet Polat, emerged from the rubble after 203 hours. In Antakya, a volunteer mining crew from the northern province of Zonguldak found Emine Akgul, 26, and pulled her to safety, according to the state broadcaster TRT. Another woman was rescued in Antakya City in Hatay province, 204 hours after the quake struck.

Erdogan hailed the miners, saying, “The tunnels they dug, bringing out our citizens, are truly extraordinary deeds.”

While the footage of the survivors, lifted out of the ruins to applause, heartened rescue workers who had been clawing through the frigid cement for days and encouraged a grieving population, the rescues were most likely a fleeting, and perhaps final, dose of such news.

The chances of finding more survivors

will only dim as the hours and days grow, experts say. And facing the challenges posed by millions of homeless and displaced citizens, many of them hungry, Turkey and Syria grappled with the scope of the relief effort and the search for accountability.

On Tuesday, U.N. Secretary-General António Guterres announced the launch of a $397 million humanitarian appeal for Syria over three months. The agency had released $50 million from its emergency funds for shelter, health care, food and protection for 5 million Syrians who, he said, are not getting the quake aid in the scale and speed that they require.

“Aid must get through from all sides, to all sides, through all routes — without any restrictions,” Guterres said.

In northwestern Syria, the earthquake’s damage spanned a region carved up over 12 years of civil war: areas held by the government of the authoritarian president, Bashar Assad, and by forces opposed to him.

The opposition side has received only a trickle of aid, in part because of the difficulties of getting access to the region. The government side, where outside relief has been coming in through major airports, tightly controls and restricts the flows of aid from its territory to the opposition side. Before the quake, only one border crossing from Turkey was used for all U.N. aid flowing to the opposition-held side.

Assad has now agreed, for the first time since the war began, to allow two more border crossings from Turkey to be used to temporarily supply aid to opposition-controlled territory in the northwest.

As the United Nations sought to broker terms with Syria’s government, Turkish authorities turned toward the question of unsafe construction. The justice minister, Bekir Bozdag, said Sunday that legal proceedings against more than 130 people were underway over their suspected ties to collapsed buildings.

Among those charged was Sukru Isitmen, a builder of at least six collapsed buildings in the Besni district of Adiyaman province. Isitmen is a member of the executive body of the district’s branch of the president’s governing Justice and Development Party.

Hours after rescue workers pulled the latest survivors from the wreckage, after night fell and the temperatures dropped again, Erdogan addressed the nation.

“Our search and rescue teams pulling out our citizens alive” he said, “even after many long hours, is the most important source of consolation amid this dark picture.”

Biden suggests the latest objects shot down by the US military were not for surveillance

President Joe Biden on Thursday said intelligence agencies have no indication that three objects shot down over North America in recent days were surveillance craft from China or any other power but vowed to establish new parameters to guard American airspace.

The latest objects appeared unrelated to the Chinese spy balloon that was downed Feb. 4 but, instead, were probably tied to private companies or research institutions, Biden said. Nonetheless, he announced that he expects to speak soon with Chinese President Xi Jinping to lodge his objections to the original balloon’s violation of U.S. airspace.

Biden’s televised statement from the White House was his first extended effort to address the furor over perceived possible threats in the sky since U.S. fighter jets fired missiles at objects over Alaska, Canada and Lake Huron over the past week.

American authorities were still trying to recover the debris from those objects, but Biden said they did not appear to pose a surveillance danger to the United States.

“We don’t yet know exactly what these three objects were, but nothing right now suggests they were related to China’s spy balloon program or they were surveillance

vehicles from any other country,” Biden said. Here’s what else you need to know:

— Biden said his administration is developing new parameters to guide how to respond to unidentified aerial objects, to improve measures to detect them and to update rules and regulations governing the launching of uncrewed craft.

— Secretary of State Antony Blinken will work with other nations to create common global norms for the largely unregulated high atmosphere.

— Biden said there is no evidence “that there has been a sudden increase in the number of objects in the sky.” Instead, he said, U.S. authorities have been more attuned to detecting them after radar changes instituted after the Chinese balloon was spotted over the continental United States.

— Biden rejected criticism of his handling of the spy balloon. “I hope we’re going to get to the bottom of this,” he said. “But I make no apologies for taking down that balloon.”

Scientists wondered if warming caused Argentina’s drought. The answer: No.

Lack of rainfall that caused severe drought in Argentina and Uruguay last year was not made more likely by climate change, scientists said Thursday. But global warming was a factor in extreme heat experienced in both countries that made the drought worse, they said.

The researchers, part of a loose-knit group called World Weather Attribution that studies recent extreme weather for signs of the influence of climate change, said that the rainfall shortage was a result of natural climate variability.

Specifically, they said, the presence of La Nina, a climate pattern linked to below-normal sea-surface temperatures in the Pacific that influences weather around the world, most likely affected precipitation.

La Nina usually occurs once every three to five years, often alternating with El Nino, which is linked to abovenormal sea temperatures. But La Nina conditions have persisted for most of the past three years, and central South America has been drier than normal for most of that time.

In the last three months of 2022, however, the drought became especially severe. Rainfall totals in central Argentina were the lowest in more than a half-century, and yields of wheat, soybeans and other crops fell dramatically in prime growing regions there and in Uruguay. Water emergencies were declared in some areas.

Like previous studies by the group, this one used observational data and computer models to compare what

occurred late last year with what would have likely occurred in a world that had not warmed by 1.2 degrees Celsius, or 2.2 degrees Fahrenheit, as a result of humancaused emissions of carbon dioxide and other heat-trapping gases. The work has not yet been peer-reviewed, but the techniques the researchers used have been peer-reviewed in previous studies.

The analysis looked at rainfall totals for October to December over most of Argentina, all of Uruguay and a small part of southern Brazil. They found that without climate change, there was a 5% chance that such a period of sharply lower rainfall would occur in any given year.

But climate change did not increase the chances, they found. If anything, climate models show that region of central South America becoming slightly wetter as warming continues, though the researchers said the effect was insignificant and, as appeared to be the case with this drought, could be overwhelmed by natural variability.

The area also experienced record-setting heat waves last November and December. Extreme heat can make droughts worse by increasing the loss of moisture from soil and plants, said Juan Rivera, a researcher at the Argentine Institute for Snow Research, Glaciology and Environmental Sciences, who worked on the study.

In an earlier analysis, World Weather Attribution found a link between climate change and the December heat wave, saying that it was about 60 times more likely to occur than it would have been in a world that had not warmed.

tioquia in Colombia who contributed to the study, said that other factors, including deforestation, could also have worsened the dry conditions.

Large-scale clearing of forests reduces atmospheric moisture, Arias said, and Argentina and Uruguay receive much of their moisture from the southern Amazon, where extensive deforestation has occurred.

World Weather Attribution has conducted several dozen studies of droughts, heat waves, floods and other extreme weather events since 2014, and most of them show some influence of global warming.

Friederike Otto, a climate scientist at the University of Oxford who co-founded the group, said that the new research shows “that not every bad thing that is happening now is happening because of climate change.”

“It’s important to show what the realistic impacts of climate change are,” she said.

Thousands of Chinese retirees protest government cuts to benefits

Thousands of retirees confronted local officials and police outside a popular park in the central Chinese city of Wuhan to demand the repeal of recent cuts in government-provided medical insurance for seniors.

The protest Wednesday, the second in Wuhan in a week, was the latest sign of strain on the finances of China’s local governments, which are responsible for covering much of the cost of everything from health care to heating homes. China’s “zero-COVID” policies, dictated by Beijing over the past three years, saddled those localities with additional costs, while a downturn in the real estate market eroded a reliable stream of revenue.

Video footage that circulated online indicated that large crowds gathered around Zhongshan Park in Wuhan, as police tried to divide them by imposing barricades. When police officers tried to push the crowds back, older men and women refused to back off and shouted in officers’ faces. Some protesters sang songs like “The Internationale,” an anthem employed by both the ruling Communist Party and by protesters, who have used it to suggest that the party has strayed from its ideological roots.

In Wuhan, seven witnesses to the protest and two other residents described what they called a large demonstration during the day. One witness said he had seen police officers roughly detain protesters and lead them away.

On Thursday, a couple of hundred seniors gathered in groups at the same park at midday, angrily discussing their unhappiness with the health insurance policy changes. Security was tight, with plainclothes officers milling around, filming people as they talked. Nearly 100 uniformed officers stood behind crowd control barriers.

Social frictions in China may be reappearing as economic growth slows and the population ages. China has one of the world’s highest levels of income inequality. The protest Wednesday took place near a luxury mall with street-level stores for brands like Dior, Louis Vuitton and Versace.

The protests were about China’s medical insurance system for urban residents. The system consists of two parts: a collective pool of funds and each individual’s account. As part of a restructuring of the national health

insurance system, local governments are reducing the amount of money deposited into the personal accounts.

Protesters who gathered Feb. 8 had vowed to return in a week if their demands that the local government restore insurance contributions for retirees to previous levels were not met.

The Wuhan government, in a document posted on its website, said that while it was true that the reforms would result in lower payments to everyone’s personal insurance accounts, ultimately there would be lower out-of-pocket expenses for certain individuals, because the collective pool would shoulder more of a person’s health care costs for routine hospital visits.

In addition to the protest in Wuhan, videos also surfaced online Wednesday of a demonstration of retirees in the port city of Dalian, in Liaoning province. Last month, a crowd of retirees gathered outside government offices in the southern city of Guangzhou to protest the reduction in government contributions to their personal health insurance accounts, according to videos posted online.

Alfred Wu, an associate professor at National University in Singapore who specializes in political and economic issues in China, said the protesters, many of whom are retired government workers or employees of state-owned companies, were upset at what they saw as a broken promise.

They accepted years of working for low salaries with the expectation that they would receive generous health care and pensions in retirement. Workers in China also expected to retire fairly young by international standards — by 50 or 55 for many women and by 55 or 60 for many men, although it is common for retired older workers to take part-time jobs.

The trade-off on retirement benefits has become increasingly unsustainable in the face of China’s looming demographics challenges, in which the number of old people is growing more rapidly than that of young people entering the workforce.

When COVID struck, local governments had another financial burden: paying for extensive mass testing and quarantine facilities mandated by the central government.

“The COVID measures accelerated a problem that was already looming on the horizon,” Wu said.

Local governments across China are facing financial crises. In the mid-1990s, they lost most of their ability to collect taxes because of a government policy change. They

were given broad authority instead to borrow money, or to raise money by selling long-term leases of state-owned land to developers.

Sales of land leases boomed, and were equal to roughly 7% of the entire economy’s output in recent years. Even that money was not enough to pay for local governments’ extensive investments in roads, bridges, rail lines, urban parks and other projects. Provinces, cities and towns also borrowed heavily, often using stateowned enterprises to do so.

A slow-motion housing crisis since autumn 2021 has now disrupted China’s model for local government financing. With dozens of developers defaulting on at least some of their debts, they have pulled back sharply from leasing further land. Government revenues from land transfers dropped by nearly one-quarter last year.

That deprived local governments of money even as their expenses surged because of “zero-COVID” policies enacted by Beijing.

Caught between falling revenues and rising costs, local governments have responded by delaying pay for civil servants and enacting broad spending cuts. Many local governments in Hebei province, which surrounds Beijing on three sides, could not even afford to continue heating subsidies for natural gas during the winter, leaving residents to shiver during a record-setting cold wave.

Last month, hundreds of workers who had been hired for the government’s mass testing programs took to the streets to demand unpaid wages. A month prior, medical students at universities and hospitals, many of whom were pressed into duty as the country’s health care system strained to handle a flood of COVID cases, protested for better pay and more protective equipment.

How a fog of questions over a spy balloon and UFOs fed a diplomatic crisis

Senior American officials increasingly believe the Chinese spy balloon that was shot down off the coast of South Carolina in early February was originally supposed to conduct surveillance over U.S. military bases in Guam and Hawaii, but winds carried it off course to Alaska, Canada and finally the continental United States.

The evolution of Washington’s understanding of the Chinese military’s original goals and new details that reveal misreadings of the U.S. reaction by Chinese officials in private meetings reflect how difficult it is for the United States and China to discern each other’s intentions — a gap that American officials fear could lead to greater mistrust in an already fraught relationship or even to armed conflict.

In another example of the fog created by superpower rivalry and political imperatives, U.S. officials said in interviews on Wednesday that they now increasingly believe three unidentified flying objects shot down over North America were unlikely to be surveillance devices.

U.S. officials said they are still trying to make a definitive conclusion on what the objects were, and do not think they will reach one until more debris is collected. Some senior officials said that based on preliminary work, they believe the three objects were likely designed for scientific or

weather research and had ceased to function, becoming akin to airborne trash.

But the fallout from the spy balloon itself continues to escalate tensions between the United States and China even as new revelations around the episode reveal the depths of confusion over it. American officials discussed those revelations on the condition of anonymity because of sensitivities over intelligence and diplomacy.

Some Biden administration officials say that even if the balloon was aimed at the Pacific region, it was designed to spy on the United States and other nations. And Chinese officials did nothing about the balloon as it passed over the continental United States — including above nuclear missile silos in Montana — for days after senior American diplomats first confronted Chinese officials in private over it.

It took almost three days after the public crisis over the balloon erupted for Chinese officials to tell U.S. counterparts that the controllers of the balloon were trying to speed it out of American airspace, an apparent effort to defuse tensions that baffled Biden administration officials and demonstrated how badly Beijing had misread the United States.

By that point, the balloon was reaching the coastline, the American public and politicians had expressed fury over it for days — some criticizing President Joe Biden for not shooting it down

immediately — and U.S. officials were intent on getting their hands on it to study its sensors, even if they would end up examining only debris resulting from a missile strike.

An F-22 fighter jet shot the balloon down with a single missile hours later, on the afternoon of Feb. 4.

Other murky actions have challenged U.S. analysts trying to read Chinese intentions. On Jan. 28, when the balloon approached the Aleutian Islands and American airspace over Alaska in its off-course trajectory, the balloon’s self-destruct function did not activate, U.S. officials said. Chinese operators may not have wanted to destroy the balloon; it is also possible that they attempted to trigger the self-destruct mechanism and it failed.

Operators or officials might have mistimed the winds and thought currents would carry the balloon quickly over Alaska and out of American airspace to the Arctic Ocean. Or they might have decided to allow the balloon to continue onward to see what kinds of intelligence it could collect — not foreseeing the diplomatic and political maelstrom that would ensue once the balloon drifted with the winds to the continental United States.

Some American officials say they know the intended trajectory of the spy balloon in part because the U.S. government tracked the balloon from the time of its launch in late January from Hainan Island in southern China, a detail first re-

ported Monday by The New York Times, and observed it as it moved across the Pacific. U.S. agencies also monitored the balloon as it was pushed in different directions by the winds, officials said.

Once the balloon went off course, as U.S. officials suspect, Chinese officials and the machine’s operators, who could be employees of a civilian-run balloon maker under contract with the People’s Liberation Army of China, appeared to make a series of bad decisions.

Chinese operators and officials did not take any immediate action after the two top American diplomats, Antony Blinken, the secretary of state, and Wendy Sherman, the deputy secretary, issued a formal démarche to a senior Chinese diplomat, Zhu Haiquan, at the State Department around 6:30 p.m. on Feb. 1 over the balloon, telling him his government had to do something about it. Zhu appeared taken by surprise, U.S. officials said.

More than 24 hours later, and a half-day after the Pentagon announced the existence of the balloon, Chinese foreign ministry officials in Beijing spoke privately to diplomats in the U.S. Embassy to tell them the balloon was a harmless civilian machine that had gone off course.

Later that Friday, Feb. 3, after China issued a public statement expressing regret, and after Blinken canceled a planned weekend visit to Beijing, the balloon appeared to accelerate, U.S. officials said.

Is China ‘probing with bayonets’?

It’s easy to let your imagination run wild when it comes to the unidentified flying objects now making frequent appearances over North America. At least one object was reported to be cylindrical, eerily suggestive of past imagined visitors. “The cylinder was artificial — hollow — with an end that screwed out!” wrote H.G. Wells in “The War of The Worlds.” “Something within the cylinder was unscrewing the top!”

Maybe the Martians really are coming.

Alternatively, maybe the UFOs that were shot down over Alaska, Canada and Lake Huron emerged from somewhere in China, just like the large balloon that was shot down Feb. 4 off the South Carolina coast. There’s a lot we still don’t know, and the White House is being appropriately careful not to jump to conclusions. Maybe it’s the Russians or something altogether innocent. But let’s think through the implications of the Made in China hypothesis.

Why would Beijing do it? The likeliest answer comes in the form of an old Leninist maxim: “Probe with bayonets. If you find mush, push.”

Balloons (if that’s in fact what the mystery aircraft really are, a point that remains unconfirmed) may hardly seem threatening like bayonets. But, as The New York Times

reported last week, Beijing has sent balloons over more than 40 countries. Balloons can scrape up photographic and other data that reconnaissance satellites cannot. And they can operate in a zone known as “near space,” between 12 and 62 miles above the Earth, that the Chinese military calls “a new battleground in modern warfare.”

Balloons could also expose gaps in what the Pentagon calls “domain awareness.” They do not move in predictable patterns, as satellites do, and they can more easily evade radar than most aircraft. They help an adversary find our blind spots, not just in terms of how we detect threats to national security but also in how we conceive of them.

The point is crucial — and too easily forgotten. In October 2000, a billion-dollar American destroyer, the USS Cole, was nearly sunk at dock in the Yemeni Port of Aden by a small fiberglass boat carrying high explosives. Less than a year later, nearly 3,000 people were killed on 9/11, when 19 hijackers turned commercial airliners into giant cruise missiles.

Yang Jiechi took the opportunity to lecture Secretary of State Antony Blinken at length at their first meeting in 2021. The balloon that overflew Montana and other states arrived just before Blinken was supposed to visit Beijing in an effort to patch up relations.

Maybe there are explanations for each incident that amount to accidents of timing or trivial misunderstandings. But, again, the pattern adds up.

There’s a coda to the Leninist maxim about probing with bayonets. It concludes: “If you encounter steel, withdraw.” Vladimir Putin found little steel in Washington or European capitals after he invaded Georgia, seized Crimea and obliterated much of Syria. Beijing has found little steel as it has probed everywhere from the cyber domain to the South China Sea.

That needs to change. Announcing a multibillion arms sale to Taiwan is the place to start. Alternatively, if the UFOs really are Martians, it might at least give both countries the opportunity to set their differences aside.

Both cases are examples of effective low-tech aggression. More important, they are also case studies about how a lack of imagination cripples our own defenses. We tend to think that our adversaries might act against us the way we would act against them: by using the most advanced technologies at our disposal. But part of Chinese military doctrine is based on the idea of Sha Shou Jian, or the “assassin’s mace” — an inferior power using weapons that can surprise and defeat a superior one. In that perspective, balloons operating in near space fit the paradigm.

If sending surveillance balloons into U.S. airspace is nervy, what about setting up a network of illicit police stations across the world, including in New York, to surveil and sometimes intimidate Chinese nationals living abroad? Or how about hoovering up the personal information of as many as 22 million U.S. federal government employees, a Chinese hack that was exposed in 2015? Or pilfering information about the F-35, America’s most advanced jet fighter? And what about the Chinese-owned app TikTok, which President Joe Biden belatedly banned on all U.S. government devices because of its potential to scoop up its users’ personal data?

Any person, or country, that spends decades brazenly spying and stealing without real consequence will probably spy and steal some more. In that perspective, too, balloons are just parts of a familiar Beijing pattern.

La OPM ofrecerá talleres al personal seleccionado por el DF, según los requisitos establecidos por la Ley de Asignaciones Consolidadas, 2022, SEC. 703, sobre los aspectos: biopsicosociales y legales de la violencia de género; hostigamiento sexual, protocolos sobre violencia doméstica en el empleo, acoso sexual, agresión sexual, acecho, intervención en crisis, entre otros.

Rodríguez Troche explicó que “nuestra agencia continúa aunando esfuerzos e identificando los recursos necesarios para tener un equipo de trabajo altamente cualificado para atender cualquier situación y población en situaciones de vulnerabilidad. A eso estamos llamados en Familia”.

El esfuerzo va dirigido además al personal del DF responsable de administrar el Programa de Asistencia Temporal para Familias Necesitadas (TANF).

Por su parte, el administrador de ADSEF, Alberto Fradera Vázquez se mostró optimista con este acuerdo de colaboración. “Nuestro personal trabaja diariamente con mujeres que han sido víctimas de violencia, pero no tienen las herramientas que necesitan. El equipo de la agencia estará capacitado aún más para identificar los recursos y poder asistirles con mucha sensibilidad”, dijo el administrador.

When Raquel was 2, the family moved to Southern California for her father’s work in the war effort. At 7, encouraged by her mother, she enrolled at San Diego Junior Theater, where her only early disappointment was being cast in her first play as a boy. She began ballet classes the same year and continued to study dance for a decade.

Raquel Welch, the voluptuous movie actress who became the 1960s’ first major American sex symbol and maintained that image for a half-century in show business, died Wednesday at her home in Los Angeles. She was 82.

Her death was confirmed by her son, Damon Welch. No cause was given.

Welch’s Hollywood success began as much with a poster as with the film it publicized. Starring in “One Million Years B.C.” (1966) as a Pleistocene-era cave woman, she posed in a rocky prehistoric landscape, wearing a tattered doeskin bikini, and grabbed the spotlight by the throat with her defiant, alert-to-everything, take-no-prisoners stance and her dancer’s body. She was 26. It had been four years since Marilyn Monroe’s death, and the industry needed a goddess.

Camille Paglia, the feminist critic, described the poster photograph as “the indelible image of a woman as queen of nature.” Welch, she went on, was “a lioness — fierce, passionate and dangerously physical.”

When Playboy in 1998 named the 100 sexiest female stars of the 20th century,

Welch came in third — right after Monroe and Jayne Mansfield. Brigitte Bardot was fourth.

The critics were often unkind. Throughout her career, Welch was publicly admired more for her anatomy than for her dramatic abilities. She even called her 2010 book — a memoir cum self-help guide — “Beyond the Cleavage.”

But when she had a chance to show off her comic abilities, the critics were kinder. Welch won a Golden Globe for her role in Richard Lester’s 1973 adaptation of “The Three Musketeers”; her character was a hopelessly klutzy 17th-century Frenchwoman torn between two lives — as a landlord’s wife and the queen’s seamstress.

Despite a career based largely on sex appeal, Welch repeatedly refused to appear nude on screen. “Personally, I always hated feeling so exposed and vulnerable” in love scenes, she wrote in her memoir, noting that even when she appeared in a prestigious Merchant Ivory film (“The Wild Party,” 1975), the filmmakers, those acclaimed arbiters of art-house taste, pressured her to do a nude bedroom scene, to no avail.

After graduating from La Jolla High School in San Diego, where her nickname was Rocky, she received a scholarship — thanks to success in local beauty pageants — to study theater at San Diego State College. But she dropped out at 19 to marry her high school boyfriend, James Wesley Welch. Because of her local celebrity, she landed a job as the “weather girl” on KFMB, a San Diego television station.

The birth of her two children complicated her career plans, but she soon left her husband — “the most painful decision of my entire life,” she called it — and moved to Los Angeles to pursue acting. (They divorced in 1964.)

She had hoped to move to New York instead, she recalled. But the trip would have been prohibitively expensive, and, anyway, she didn’t own a winter coat.

It was not long before Raquel Welch had a contract with a major studio, 20th Century Fox. She had early hopes of making her big-screen debut in a James Bond movie; producer Albert R. Broccoli wanted her for “Thunderball.” But that dream was quashed when she was cast in “Fantastic Voyage” (1966), a science fiction film about scientists reduced to microscopic size to travel inside a diseased human body. Then came “One Million Years B.C.,” and that did it.

She appeared in some two dozen films over the next decade, perhaps most notably “Myra Breckinridge” (1970), based on Gore Vidal’s campy novel, in which she played a glamorous transgender woman, and “The Last of Sheila” (1973), a semi-campy murder mystery with a luxury-yacht setting and

But she had already discovered the joys of stage work. Inspired after seeing Frank Sinatra’s nightclub act, Welch made her club debut, singing and dancing, at the Las Vegas Hilton in 1973. Eight years later she made her Broadway debut, hired as a two-week vacation replacement for Lauren Bacall in the hit musical “Woman of the Year.” Her reviews were so admiring (Mel Gussow’s in The New York Times ended by writing, “One hopes that Miss Welch will soon find a musical of her own”) that she returned the next year for a six-month stint in the role.

Few thought of Welch as a Latina actress, but she embraced that identity late in her career, starring as a melodramatic Mexican American aunt on “American Family,” a PBS series (2002). She learned to speak Spanish in her 60s; her father had not allowed the language to be spoken at home when she was growing up.

Her last film was “How to Be a Latin Lover” (2017), a comic drama about an aging gigolo, played by Eugenio Derbez. She played his new target — a disarming, tooglamorous-to-be-true grandmother. Her final television appearances were on “Date My Dad” (2017), a Canadian American series, in a recurring role as the leading man’s Mexican mother-in-law.

Welch was married and divorced four times. After James Wesley Welch, her husbands were Patrick Curtis (1969-72), a producer; André Weinfeld (1980-90), a French director and producer; and Richard Palmer (1999-2008), a restaurateur.

In addition to her son, Raquel Welch is survived by her daughter, Tahnee Welch, and a brother, Jimmy Tejada.

In her late 70s, Welch was still followed by photographers, and reporters were still commenting on her appearance. In 2001, she answered questions about fashion and style in an interview with the Los Angeles Times.

“Style has to have substance,” she said. “It has to have fire.” Praising synergy, instinct, imagination and attitude over trendiness and fashion-magazine dictates, she concluded, “It’s about being yourself on purpose.”

El tipo mínimo para la primera subasta del inmueble antes relacionado, será el dispuesto en la Escritura de Modificación de Hipoteca, es decir la suma de $98,188.00. Además, la parte demandada adeuda a la parte demandante los cargos por demora equivalentes a 5.00% de la suma de aquellos pagos con atrasos en exceso de 15 días calendarios de la fecha de vencimiento; los créditos accesorios y adelantos hechos en virtud de la escritura de hipoteca; y las costas, gastos y honorarios de abogado equivalentes a $9,900.00.

Además, la parte demandada se comprometió a pagar una suma equivalente a $9,900.00 para cubrir cualquier otro adelanto que se haga en virtud de la escritura de hipoteca y una suma equivalente a $9,900.00 para cubrir intereses en adición a los garantizados por ley. Que los autos y todos los documentos correspondientes al Procedimiento incoado estarán de manifiesto en la SECRETARIA DEL TRIBUNAL DE PRIMERA INSTANCIA CENTRO JUDICIAL DE CAROLINA, SALA SUPERIOR durante las horas laborables. The Yankees start their season with a plot twist

Every baseball season is a television series airing from mid-February through early October, with possible bonus episodes until early November. Nowhere is this clearer than with the New York Yankees, the franchise that pioneered the team-branded cable network. And the pilot episode always starts at George M. Steinbrenner Field.

On Wednesday afternoon, as pitchers and catchers reported to spring training in Tampa, Florida, the YES Network went live to the host of the show, manager Aaron Boone, for his opening monologue. It came in the form of a news conference, and the first question concerned starter Frankie Montas and the inflammation in his throwing shoulder.

“So, Frankie is going to have surgery …” Boone said.

And we’re off — with an instant plot twist!

The Yankees were not counting heavily on Montas, not with $63 million invested this season in their top two starters, Gerrit Cole and newcomer Carlos Rodón. But it sure would have been nice to have the version of Montas who was one of the league’s best starters in 2021. Now, Boone conceded, the hope is that Montas might return late in the season.

Montas, a power right-hander, was thought to be a high-impact addition when he arrived last summer in a trade from the Oakland Athletics. The Yankees gambled that his preexisting shoulder injury would not be serious, and lost the bet: Montas never managed a quality start (at least six innings pitched with no more than three earned runs) in eight outings after the trade, and now he’s unavailable.

Luis Severino and Nestor Cortes (out for the time being with a hamstring strain) will be part of the rotation, with Domingo Germán and Clarke Schmidt as solid options to replace Montas. But the Yankees’ depth has been tested before the first formal workouts.

“Anytime you have some attrition, especially at this time of year when you have pitcher injuries, that always scares you,” Boone said. “But it’s also a part of the team that I have a ton of confidence in. I feel

like our rotation, on paper — and I caution we’re in the middle of February right now, but I’m excited about their potential impact and what they can be. I’m also really excited about the depth of our bullpen.”

The relievers, indeed, could be very strong, boosted by the return of right-hander Michael King, who has already thrown 10 bullpen sessions in his recovery from elbow surgery last July. King’s role is uncertain — can he still be a multi-inning weapon? — but his confidence in Boone’s options is unshaken.

“We can roll out an A squad every time out,” King said. “If someone needs a day off, you can replace them with someone just as good.”

The Yankees had enough talent and depth last season to pitch to a 3.30 ERA (third best in the majors), and the left-hander Rodón is an upgrade over right-hander Jameson Taillon, who signed with the Chicago Cubs. In the last two seasons, for the Chicago White Sox and the San Francisco Giants, Rodón averaged 12.2 strikeouts per nine innings — the most of any pitcher with at least 40 starts — while going 27-13 with a 2.67 ERA.

Even so, Rodón — who signed a sixyear, $162 million deal with the Yankees in December — has this in common with his new teammates: He, too, has been beaten by the Houston Astros in the postseason. (Rodón lost a playoff start to Houston in 2021.) The Astros have won four of the last six American League pennants, stifling the Yankees in the championship series three times.

Last fall’s effort was an especially emphatic flex: The Astros swept the Yankees, who batted .162 with 50 strikeouts in the four dreary games. The Yankees had hoped to blend contact hitters with sluggers in the series, but injuries to D.J. LeMahieu and Andrew Benintendi reduced them to a one-dimensional offense and kept the Yankees without a pennant since their 2009 championship season.

“We led the league in runs scored last year —

that’s actually a thing, trying to score runs,” Boone said. “We ran up against a buzz saw and we were a little depleted. But that said, if we’re going to win it all, we’ve got to find a way to get by these teams that in a given year really got it rolling on the mound. We’ve got to find a way to be able to win those nip-and-tuck games, too.”

Houston went on to set a World Series record for strikeouts while beating Philadelphia (71 in six games), and Boone acknowledged that the Astros had “set the standard” in the league. But while the Yankees did lead the AL in runs last year — the Los Angeles Dodgers scored more overall — they lost Benintendi to the White Sox in free agency and have questions at several positions.

Is Aaron Hicks — who has hit .211 in his last 162 games — a viable everyday left fielder? Which of the three starting shortstops in the ALCS (Oswaldo Cabrera,

Isiah Kiner-Falefa and Oswald Peraza) will emerge as a starter in spring training — or will the top prospect Anthony Volpe win the job? How much does third baseman Josh Donaldson have left?

The Yankees retained their new captain, Aaron Judge, after his 62-homer explosion, and brought back dependable first baseman Anthony Rizzo. LeMahieu’s broken toe has healed, and it will be fun to watch a Gold Glove winner, Harrison Bader, fly around center field all season. There is still a lot to like from a team that just won 99 games.

“Every year that I’ve been here, we’ve gone in with the idea that we want to be a championship team,” Boone said. “It’s a reasonable goal.”

A reasonable goal. As slogans go, it is accurate but uninspiring. The show is compelling, but the Yankees need to punch up the script — get more range from the cast, that is — to stretch it to November.

A missed $140 million payment sends sports TV negotiations into overdrive

Diamond Sports Group, which owns and operates 19 regional sports networks that televise about a third of all MLB, NBA and NHL games, said earlier this week that it would not make a $140 million interest payment on its nearly $9 billion of debt, setting the stage for a possible bankruptcy filing next month and building pressure for the leagues and others amid a sea change in how fans watch sports throughout the United States.

The missed payment triggered a 30-day grace period, and Diamond Sports said on Wednesday that it intended to keep talking with the leagues and its creditors to come up with more favorable arrangements to televise games during that time.

The sports networks, which are branded Bally Sports and include channels like Bally Sports Florida and Bally Sports San Diego, exist mainly because Diamond Sports pays hefty fees to teams for the rights to show their games locally, and cable customers pay fees in their cable bills that keep the channels afloat. The company owes teams about $2 billion in rights fees this year, according to its most recent financial filing, and the fees have continued to increase even as fewer Americans stick with cable television, meaning less revenue for Diamond Sports.

The missed payment won’t have immediate effects on the production of game broadcasts, with the NHL and NBA in the middle of their seasons, but if Diamond Sports enters bankruptcy or stops making payments without a clear agreement to dig out with its creditors and the leagues, it could throw the games into television limbo and threaten one of the biggest moneymakers for sports teams that are used to spending big on athletes, coaches and others.

Diamond Sports has been in financial trouble from nearly the moment it was conceived.

In 2017, The Walt Disney Co., which controls ESPN, reached an agreement to buy most of 21st Century Fox’s assets. They included its portfolio of regional sports networks, which operated under the Fox Sports banner. But to secure regulatory approval of the deal, Disney agreed to sell the regional sports networks to keep the core of Fox’s wide range of media, including hit television shows and movies.

Most of the regional sports networks were bought in 2019 by Sinclair Broadcast Group, the largest operator of local television stations in the country, in a deal worth $10.6 billion. Sinclair created a wholly owned subsidiary, Diamond Sports Group, to operate the networks, and loaded it up with $8 billion in debt to finance the purchase.

All the parties have been broadly negotiating a deal in which Diamond Sports would enter Chapter 11 bankruptcy with a reorganization plan, according to two people involved nymity because they were not authorized to speak publicly

about the negotiations.

Although no deal has been made, the people said the companies had been negotiating a bankruptcy in which Sinclair would give up most of its ownership stake in Diamond Sports, while creditors would take the equity in exchange for restructuring or forgiving up to $8 billion of its debts. Sports leagues would grant additional rights to Diamond Sports, particularly digital rights, to help put the regional sports network on stronger footing to seek more loans or a sale.

But the terms of any agreement could shift substantially, and there is no guarantee there will be one at all. If most of the involved parties are unable to come to an agreement, Diamond Sports would most likely file for a free-fall bankruptcy, in which the bankruptcy court would play a much larger role and the leagues and the creditors would be in greater danger of not being paid at all.

For decades, regional sports networks were some of the most lucrative channels in the cable bundle. Ten years ago, 100 million households in the United States subscribed to a cable or satellite television package, and nearly every one of those households received one or more regional sports networks, like YES Network in New York City or NBC Sports Bay Area in San Francisco, in those packages. The fees that households paid for those channels, a few dollars a month, were and remain among the highest paid for any channel.

Armed with the revenue from high fees, regional sports networks have paid ever-escalating costs to teams to show their games, like the reported $8.35 billion Time Warner Cable paid for the rights to show Los Angeles Dodgers games. This has led to rising revenues, and team valuations, across

professional sports.

Some of that dynamic is being upended. Only around 70 million U.S. households now pay for some form of television, and the rate of cord-cutting is only accelerating. Some television operators, like Dish Network, have dropped some regional sports networks from their offerings, believing it was not worth increasing the price of receiving television for the large percentage of households who watch little or no sports.

Despite the challenges to and the decline of cable, the regional sports networks still generate a lot of cash. Diamond Sports’ financial filings show that its problems have been made more urgent because of its heavy debt load.

If Diamond Sports is unable to come to an agreement with its creditors and ceases or reduces rights payments, Major League Baseball is likely to feel the pain first. The NBA and NHL regular seasons are almost over, and most rights payments have already been made. But the baseball season starts in March, and teams are counting on receiving payments over the next several months.

Rob Manfred, the MLB commissioner, said on Wednesday that if Diamond Sports were unable or unwilling to broadcast games, the league would find a way to do so on its own, most likely by hiring its own production crews and showing the games both digitally and on traditional television.

He warned that baseball would move quickly away from Diamond Sports if it did not pay clubs what they are owed.

“If Diamond doesn’t pay under every single one of the broadcast agreements, that creates a termination right and our clubs will proceed to terminate those contracts,” Manfred said.
