oldenTree Asset Management LP, Syncora Guarantee Inc. and holders and insurers of 40% of the estimated $8.29 billion in outstanding Puerto Rico Electric Power Authority (PREPA) bonds have renewed a petition to seek a receiver to take control of the utility. The bondholders and monolines submitted the motion last week, seeking a lift of the automatic stay imposed in the bankruptcy process to enforce “their statutory rights” for a mandatory receiver under section 207 of the Puerto Rico Electric Power Authority Act and “such receiver will thereafter take control of PREPA and its property in accordance with the Authority Act.” A previous request for a receiver was denied by U.S. District Judge Laura Taylor Swain, who is overseeing PREPA’s Title III bankruptcy process, and upheld by the First Circuit Court of Appeals, but the bondholders are using the appeal ruling to file the renewed motion. At the conclusion of its recent opinion, the First Circuit stated, that being said, “it appears the Title III court’s final summary judgment order in the adversary proceeding could open the door to a prompt ruling on a renewed (or entirely new) motion for relief.” The bondholders said they were filing the renewed petition now, before the court starts confirmation hearings on PREPA’s debt adjustment plan, “before their undisputed property rights are wiped out entirely.” Since the Title III case began, the Financial Oversight and Management Board for Puerto Rico “has knowingly and intentionally caused PREPA to flagrantly disregard and breach its obligations to the Bondholders by, among other things, misappropriating certain net revenues as defined in the Trust Agreement to pay for things that do not constitute current expenses,” the bondholders said. They also said PREPA is failing and refusing to properly calculate and deposit net revenues into a sinking fund to further secure the utility’s obligation to repay the bonds. “PREPA and the oversight board admit that, since the commencement of this Title III case, despite having collected and identified more than $3 billion of net revenues that should have been transferred to the applicable accounts that comprise the Sinking Fund under the unambiguous terms of the Trust Agreement, almost no Net Revenues or other moneys have been deposited by PREPA into the applicable accounts that comprise the Sinking Fund or any of the other funds controlled by the Trustee to repay the bonds,” the bondholders said.

PREPA is required to deposit revenues to the credit of the Sinking Fund, which comprises three separate accounts: the Bond Service Account, the Redemption Account and the Reserve Account. “Revenues are now gone, never to be replaced. It is hard to imagine a more direct or overt diminution in value,” the bondholders said. “Making matters more dire for the bondholders, this court ruled that the bondholders’ secured claim is limited to the amount on deposit in the applicable accounts that comprise the Sinking Fund, approximately $19 million today, even though PREPA’s manifold breaches of the Trust Agreement were the very reason that billions of dollars had not been deposited therein.” The court has also estimated the bondholders’ $8.4 billion deficiency claim in the amount of $2.38 billion by making a present value calculation of what it thought would be paid into the Sinking Fund if a receiver were appointed, the very remedy movants now seek to exercise, they said. As the confirmation hearing approaches, the bondholders said, the oversight board is moving forward with its corrected fourth amended Title III plan of adjustment PREPA that will “provide for the ongoing misappropriation of Net Revenues in perpetuity, pay non-settling Bondholders mere pennies on the dollar, strip away the property rights of the Bondholders to obtain mandatory appointment of a receiver granted them under the Authority Act and the Trust Agreement, and “settle” away the Bondholders’ statutory right to priority payment ahead of creditors whose claims do not constitute current expenses.”

Pierluisi signs bills strengthening international banking oversight By THE STAR STAFF

ov. Pedro Pierluisi Urrutia has signed two bills into law to strengthen the oversight of international banking and financial entities operating in Puerto Rico to combat money laundering. With both measures, House Bill (HB) 1699 and HB 1700, the Office of the Commissioner of Financial Institutions (OCIF) is allowed to conduct investigations for change of control of entities, issue cease and desist orders, and order to show cause. The bills also enable the OCIF to carry out agreements and initiate procedures under the Uniform Administrative Procedure Laws. The OCIF will be empowered to impose fines and administrative sanctions for violations of the laws, as well as OCIF regulations and orders. ouse of Representatives legal counsel Jorge Martínez Luciano said late last week that in all “probability,” on or before March 4, which is the deadline established by House Speaker Rafael “Tatito” Hernández Montañez, the suspension of face-to-face work in the lower chamber due to COVID-19 infections will be lifted. “It is more likely than improbable that the restriction will be lifted on March 4,” Martínez Luciano told reporters following a court hearing Friday before Judge Anthony Cuevas Ramos, after Dignity Project Rep. Lisie Burgos Muñíz was not allowed to enter the House earlier in the week because she was not wearing a mask, a restriction imposed in the face of an alleged increase in coronavirus cases. As an alternative, Martínez Luciano proposed that the legislator can carry out her work virtually, through the Zoom platform, for which he noted that, at this stage, a “reasonable accommodation” will be sought. “We have until Wednesday. The plaintiff

Students at Bayamón school receive instruction in personal finance By THE STAR STAFF

W

ith the aim of offering financial tools, promoting savings habits and imparting knowledge about credit, priority management, budgeted purchases, among other topics, teachers at Gedalias Bilingual Academy in Bayamón are offering their students a class in finance starting in the secondary grades. According to the 2021 report “Financial Education Around the World” by the World Bank, in Puerto Rico, only 32% of people are financially literate, which means that seven out of 10 island residents lack an education in personal finance. “Financial education is vital for making decisions that allow us to move forward and get closer to our goals and well-being,” school director Yolyhalmarie Hernández said. “At Gedalias Bilingual Academy we are very aware of this issue and as a business owner, entrepreneur and mother of

three children, it is my moral duty to open the doors so that the minds of these children are directed to what they will find in the real world.” “These young people are equipping themselves with knowledge to recognize risks and make good financial decisions that will benefit them in their lives,” she added. The class focuses on introductory concepts of finance, introduction to credit, savings strategies, recording expenses, setting goals and managing priorities. Students are also instructed on the calculation of taxes and interest, sales workshops and budgeted purchases. “Financial education is not an option. We are training future leaders to not only make money, but also manage it wisely,” Hernández said. “Teaching a child to make money is important, but what they really need is to know how to manage it, because regardless of the sums they generate, they will learn how to multiply them. And that is true success in finance.”

HTA seeks investment management firm to handle $980 million in toll road PPP proceeds By THE STAR STAFF

T

he Highways and Transportation Authority (HTA) has issued a request for proposals (RFP) seeking bids from firms that provide investment management services for some $980 million in proceeds that the HTA obtained from the public-private partnership agreement to manage four toll roads. The RFP was posted on the Fiscal Agency and Financial Advisory Authority’s website. Interested parties have until March 15 to submit offers, the document noted. The notice says the HTA’s overall investment objectives are, in order of priority, principal security, liquidity of funds and maximizing investment income. Investment practices and procedures must comply with federal and Puerto Rico laws and a written investment policy to be developed by the investment manager together with the HTA. On Dec. 14, 2023, the HTA and the Puerto Rico Public-Private Partnerships Authority completed the financial closing of a long-term concession granted by HTA to Puerto Rico TollRoads LLC, owned by Spanish infrastructure operator Abertis Infraestructuras S.A. Under the concession agreement, Puerto Rico TollRoads LLC paid a concession fee to the HTA of $2.85

billion and assumed responsibility for operating, maintaining and improving the PR-20, PR-52, PR-53 and PR-66 toll roads extending across Puerto Rico for the next 40 years. A portion of the initial amount was used to pay all of the HTA’s outstanding obligations and fund transaction expenses, with the remaining balance, estimated at approximately $980 million, to be used to fund projects for the construction, reconstruction and maintenance of non-toll roads to achieve a state of good repair and extend the life cycle of existing highway infrastructure, implement highway capacity enhancements, provide highway congestion relief, complete the Puerto Rico strategic highway network, and enhance multimodal transportation, including, but not limited to, completing streets, scenic byways, bicycle routes and pedestrian walkways, among other modes. The HTA is requesting proposals from qualified firms to provide investment management and custodial services for the net proceeds. The selected firm must provide credit analysis of investment instruments recommended for the portfolio, evaluate market risk and develop strategies that minimize its impact on the portfolio, and provide monthly/quarterly/annual reporting on the portfolio.

ICF: Remains found in Loíza are those of missing Colombian citizen By THE STAR STAFF

The Institute of Forensic Sciences confirmed that skeletal remains found on a farm in Loíza belong to a Colombian citizen reported missing Jan. 26.

human skeleton found on a farm at the intersection of highways PR-951 and PR-187 in Loíza was identified by personnel from the Institute of Forensic Sciences through comparison of dental x-rays. According to reports, the remains are those of John Bo-

laños Gómez, a citizen of Colombian nationality. Bolaños Gómez was reported missing on Jan. 26, on the grounds of the Mansiones Vista Mar Marina urbanization in Carolina. According to the police, at around 11:52 a.m. on Friday, a call was received alerting them to the discovery of the skeleton.

Aguada mayor takes advantage of governor’s visit to air grievances By THE STAR STAFF

A

guada Mayor Christian Cortés Feliciano took advantage of Gov. Pedro Pierluisi Urrutia’s visit to the northwestern coastal town on Sunday for political meetings to make public his demands about pending projects that demand urgent attention. “Indeed, I wanted to bring to the attention of the governor several issues that will surely not be discussed in his meetings today, but that it is up to his administration to address and that unfortunately to this day remain unresolved,” Cortés Feliciano said. “These are important issues for our people. The first, and surely the most urgent, is the incredible problem that the management of the Aqueduct and Sewer Authority (PRASA) has to provide a stable drinking water service in our town. There is no reliable service, but the bills arrive in the mailboxes without fail.” The mayor, who is also an engineer, drew attention to an unattended landslide on state highway PR-417 in the Marías neighborhood (next to the El Grand Marnier Restaurant), as well as another landslide on PR-411 in the Jagüey neighborhood close to Epifanio Estrada School. Similarly, the laying of asphalt on highway PR-417 is urgent;ly needed “from kilometer 4.64 to kilometer 11.00, from the Mamey neighborhood to the PR-2 exit in the Cerro Gordo neighborhood,” Cortés Feliciano said.

In addition, PR-2 in Aguada needs asphalt attention, as do other landslides on state highways caused by Hurricanes Irma, María and Fiona that endanger the safety of citizens and hinder access to essential services, the mayor pointed out. “Specifically, we are talking about PR-411 in the Jagüey and Atalaya neighborhoods, PR-419 in the neighborhoods of Naranjo, PR-417 in the Cerro Gordo neighborhoods and PR-414 in the neighborhoods of Cruces, among

others,” Cortés Feliciano said. “Particularly worrisome is the landslide on state highway PR-115, in front of the Cooperative Center of our town, and the delays in the city’s revitalization projects, which are vital for the economic and social development of our town.” “The truth is that these projects are at the mercy of a battle of egos between the technical teams of the Department of Housing, Horne and Tetra Tech,” the mayor said. “Take for example the South Detour project, on which the municipality has complied with everything, including building permits, and is waiting for the Department of Housing for a document -- a single document! -- to get started. I also brought to the governor’s attention the urgent need for the opening of the Government Center, and of course, the serious problem of coastal erosion on our shores of Aguada. I indicated to the governor that these matters are the responsibility of the state government to deal with. It is their responsibility to make things happen.” The citizens of Aguada have also pointed out that the town’s old factories and facilities of the Industrial Development Company are abandoned and in disuse, Cortés Feliciano said. The mayor suggested that “if they transfer these facilities to the municipalities at nominal cost, we could fix them and rent them to citizens of our towns who have the need for spaces for their companies.” “In Aguada we believe in and promote entrepreneurship,” he said.

Pedro Pierluisi Urrutia, president of the New Progressive Party (NPP), stressed on Sunday that the party’s work for social justice on behalf of all the people, inspired by the example of Don Luis A. Ferré, continues to guide the New Progressives in the struggle for statehood. Accompanied by resident commissioner candidate William Villafañe Ramos, Moca Mayor Ángel Beto Pérez Rodríguez, former Moca Mayor Enrique “Kike” Avilés, legislative leaders and hundreds of supporters, district directors, candidates and neighborhood leaders from the northwest region of the island, Pierluisi said that no candidacy is more important than achieving equality for all American citizens of Puerto Rico. Pedro Pierluisi told a gathering of New Progressive Party faithful we have achieved is to produce results on in Moca on Sunday that no candidacy is more important than achieving the field. As Gaza death toll mounts, the peace lobby fights for influence in Washington By KATE KELLY

W

hen the American Israel Public Affairs Committee, the most influential pro-Israel group in the United States, wants to use its muscle, it can call on its considerable resources to run negative ads against lawmakers who oppose its agenda and pour money into funding a challenger. When the Friends Committee on National Legislation, a Quaker group that is pushing for a cease-fire between Israel and Hamas, wants to push its message, its Middle East lobbyist turns to tactics like playing guitar with schoolchildren in the occupied West Bank and sharing video messages about their fears with members of Congress on Capitol Hill. Going up against the many forces backing Israel is a challenge for any group. But the clash is especially striking when it comes to the Friends Committee, whose anti-war positions are in sync with much of the left of the Democratic Party but run counter to Biden administration policy in the wake of the Hamas terror attack and face intense opposition on the right. AIPAC, founded about 70 years ago to promote Israel’s interests in the U.S., is a juggernaut. Last year, its nonprofit arm reported more than $73 million in revenue. Last month, its political action committee, which supports candidates who embrace its policy priorities, reported record fundraising — bolstering a $40 million war chest that could be spent trying to defeat political opponents in Washington. It has the ear of congressional leaders in both parties. The Friends Committee, which was founded during World War II, is part of what amounts to Washington’s peace lobby. It does not run a political action committee. It reports about $3 million in annual revenue. Its lobbying approach involves looking for “the divine in the people that we’re meeting with,” Sarah Freeman-Woolpert, the Quaker group’s deputy director of strategic advocacy, says in a video. The group has draped a banner stating “Ceasefire Now!” in English, Arabic and Hebrew on the facade of its Second Street office, which faces the Hart Senate Office

(Kenny Holston/ The New York Times) Building on Capitol Hill. “We’re clearly being outspent, but I think the saving grace is that our ideas are just more popular,” said Hassan ElTayyab, the Friends Committee’s Middle East legislative director. “So our currency is people power, and getting constituents to lobby their members of Congress,” he said. “And that has a major impact. And you can’t necessarily buy that public support.” But while polling suggests that American support for Israel’s tactics in the Gaza Strip is weakening as the civilian death toll there grows, groups like the Friends Committee and its coalition of more than 80 like-minded groups, including American Muslims for Palestine, Jewish Voice for Peace and the Episcopal Church, are struggling to get traction for their message in Washington. As Congress grapples with providing more aid to Israel, the Friends Committee and its political allies are pushing for an immediate cease-fire, more humanitarian aid for Palestinians in Gazan,

continued funding for the U.N. aid group UNRWA and a cleareyed assessment of Israel’s human rights record. AIPAC, which is supporting scores of Democrats and Republicans for reelection this cycle, is well known — and feared — in Washington. “Members of both parties worried about crossing the American Israel Public Affairs Committee,” former President Barack Obama wrote in his 2020 memoir, echoing a refrain heard from lawmakers today. AIPAC has recently run harsh ads spotlighting some lawmakers’ refusal to condemn the Oct. 7 terror attacks carried out by Hamas. It plans to challenge incumbents such as Reps. Ilhan Omar, D-Minn., and Jamaal Bowman, D-N.Y., whose stances on Israel and the Palestinians it disagrees with. The peace groups are largely focused on amplifying their influence with left-leaning Democrats — but hoping to win over more moderates along the way. The Religious Society of Friends, or Quakers, has been lobbying since its founding in the 1600s in England, said Jordan Landes, a Quaker historian at Swarthmore College. Quaker lobbying centers on a handful of themes, referred to as “testimonies,” including peace, equality and stewardship, Landes said. The Friends Committee was founded in 1943, in the throes of World War II. It focuses on policy objectives like alleviating child poverty and ensuring funding to help fight the impact of climate change. It also promotes peace around the world, not only in Gaza. El-Tayyab is a self-described agnostic who grew up in Plymouth, Massachusetts, and was a musician in a roots rock band called American Nomad before becoming a lobbyist (he still plays frequent gigs). His

work on Middle East policy recently took him to Jerusalem and the West Bank city Ramallah, where he and other peace advocates met with faith and political leaders. In Ramallah, he played his guitar and sang “I want a cease-fire now” to students at a local Quaker school assembly. He comforted some who were troubled by the war and its impact on them and their family members, promising “to relay those conversations to Congress when I get back.” He also met with Mahmoud Abbas, the president of the Palestinian Authority, while in the West Bank. Over cigarettes and tea, Abbas thanked El-Tayyab and his other visitors for their work lobbying for a cease-fire, according to two people who were there. A New York Times/Siena poll in December showed that 44% of respondents believed that Israel should stop its military campaign in Gaza, with 39% believing that Israel should continue (18% of respondents didn’t know or declined to answer). A January poll from the AP-NORC Center for Public Affairs Research showed that 50% of adults surveyed believed that the war had “gone too far,” with 46% saying it had either been “about right” or “not gone far enough.” As the Gaza health ministry reports that more than 28,000 Palestinians have been killed, El-Tayyab and his fellow peace lobbyists are pushing for a ceasefire not only on moral grounds, but also on practical ones. “This is not sustainable,” said the Rev. Mae Elise Cannon, executive director of Churches for Middle East Peace, the group that convened the recent meeting with Abbas. “It’s not sustainable for Palestine, for the Israelis. Even if Gaza is rebuilt, this can’t continue, and so I think that’s a huge concern.”

ormer President Donald Trump vented about his latest legal defeat to freezing supporters at a Michigan rally Saturday night, a day after a New York judge fined him nearly $355 million plus interest in his civil fraud case. The Republican front-runner for his party’s presidential nomination, Trump denied that he had conspired to manipulate his net worth, which he was found liable of by Justice Arthur Engoron in a ruling that could wipe out Trump’s entire cash stockpile. “This judge is a lunatic,” he said in his opening salvo at his rally, held inside an airport hangar in Oakland County about 30 miles from Detroit. Both groups have proclaimed fierce loyalty to Trump, who, like the Republican National Committee, has made it clear whom he wants to lead the party in the key state: Pete Hoekstra, his former ambassador to the Netherlands and a former House member. “I said, ‘Can you get Hoekstra?’” Trump said of his endorsement for the role. But the Trump-styled election denier who has led the Michigan Republican Party for almost a year, Kristina Karamo, is clinging to power. She claims that a Jan. 6 vote to remove her by a group of state party leaders was illegitimate, defying the RNC’s recognition of Hoekstra on Wednesday as her rightfully elected replacement.

The infighting has drawn unwanted headlines and headaches for Republicans in Michigan, where Trump was averaging around a 60 percentage point lead over his last remaining rival in the nominating race, Nikki Haley, his former ambassador to the United Nations. Trump’s relatively unimpeded march toward the nomination has belied the squall of legal setbacks surrounding him, both in the four criminal cases and other civil cases proceeding against him. Perhaps the biggest yet came Friday, with the civil fraud fine, which could exceed $450 million with interest. It also undercut Trump’s relentlessly curated image of his business empire and personal fortune, his calling card that helped propel him to reality television stardom and then the presidency in 2016. That judgment, along with recent one by a jury for $83.3 million in a defamation lawsuit brought by writer E. Jean Carroll, who accused Trump of a decades-old rape, could deplete the former president’s entire stockpile of cash. (A jury previously found him liable for sexually assaulting Carroll.) “Our court system is a mess,” Trump said. A game, a parade, a shooting: The story of America in three acts By JOHN BRANCH

A

merica’s most communal cultural event, the Super Bowl, featured a wildly popular team from Kansas City cheered by a global pop star who is dating the tight end. After the Chiefs won, she kissed her boyfriend under the falling confetti. Three days later, the city held a massive parade and celebration where gunfire broke out, scattering panicked fans in football jerseys, killing a woman and hurting 22 others, about half of them kids. Super Bowl. Parade. Shooting. Is there a more American story than that? The shooting was not directly related to football, in the way that a shooting at a mall is not related to shopping. But every such shooting feels like a crime against American culture. Settings have included schools, colleges, movie theaters, churches and synagogues, grocery stores, concerts. There is now a subset of mass shootings occurring at parades. No parcel of American public life feels completely safe. No shooting feels like a surprise, except to the people who live through it. This one was a coda to the global sporting event where we celebrate all things American — from football to Usher, military flyovers to the Puppy Bowl. What if a shooting happened at a massive hometown celebration of the champions, in a crowd of people wearing team gear? It felt like an unoriginal plot device. But deadly shootings happen so regularly in the United States that only the wildest circumstances bring attention. Chiefs players were nearby. Some were rushed away. One, offensive lineman Trey Smith, described being squeezed into a closet, hiding while trying to calm a little boy. It was luck that the death toll was not higher. “One of the cultural problems is that we are losing the ability to be in community with one another,” said Jason Kander, a fifth-generation Kansas City resident, a Democratic former Missouri secretary of state and an advocate for tighter gun laws. “And when we cannot safely gather and celebrate, it’s only going to exacerbate the problem.” That is the concern of Frank White, a Democrat and the elected county executive of Jackson County (which includes Kansas City) who played 18 seasons with baseball’s Kansas City Royals. He rode in the parade and was onstage outside Union Station for

People hid for about 30 minutes, quietly and with phones silenced, the way American children are now taught in schools. “You always want to put on the best show for your city, at a time when a lot of people have eyes on you,” White said. “And you take pride in your city not being part of a mass shooting like this. So it was discouraging. It’s about showcasing your city and your civic pride, but at the same time, you’re frustrated because gun violence around the nation is just out of control.” Wednesday was Valentine’s Day, the sixth anniversary of the shooting that killed 17 at a Parkland, Florida, high school. It was also the 45th day of 2024, and by that night, there had been 49 mass shootings in the United States, according to the Gun Violence Archive. (The archive defines them as shootings in which at least four people are killed or hurt, not including the shooter.) The Kansas City shooting raised familiar questions about the intersection of American sports and culture. Are sports events, and the parades that celebrate them, a place to forget the real world, or experience it? Amazon argues labor board is unconstitutional By NOAM SCHEIBER

I

n the latest sign of a growing backlash within corporate America to the 88-year-old federal agency that enforces labor rights, Amazon argued in a legal filing Thursday that the National Labor Relations Board was unconstitutional. The move followed a similar argument by SpaceX, the rocket company founded and run by Elon Musk, in a legal complaint in January, and by Trader Joe’s during a labor board hearing a few weeks later. The labor board consists of a prosecutorial arm, which issues complaints against employers or unions deemed to have violated federally protected labor rights; administrative judges, who hear complaints; and a five-member board in Washington, to which decisions can be appealed. Amazon’s filing was part of a case before an administrative judge in which labor board prosecutors have accused Amazon of illegally retaliating against workers at a Staten Island, New York, warehouse known as JFK8, which unionized two years ago. The company’s lawyers repeatedly denied in their filing that Amazon had broken the law. Then, under a section titled “Other Defenses,” they argued that “the structure of the N.L.R.B. violates the separation of powers” by “impeding the executive power provided

that lawyers for SpaceX made in a federal lawsuit last month, after the labor board issued a complaint accusing the company of illegally firing eight employees for criticizing Musk. SpaceX sued in Texas, but a federal judge there Thursday granted the board’s motion to transfer the case to California, where the company’s headquarters are located. In a statement, the board’s general counsel, Jennifer A. Abruzzo, said, “I am pleased that SpaceX’s blatant forum-shopping efforts in Texas attempting to enjoin the agency’s litigation against it have failed.” Wilma Liebman, a chair of the labor board under President Barack Obama, called the arguments by Amazon and SpaceX “radical,” adding that “the constitutionality of the NLRB was settled nearly 90 years ago by the Supreme Court.” The arguments appear to align with a broader conservative effort to question the constitutionality of a variety of regulatory actions, some of which have resulted in cases before the Supreme Court. In January, the Supreme Court also agreed to hear a case brought by Starbucks, which is challenging the standard federal judges use to reinstate employees who are fired during a union campaign. The outcome of the case could rein in the labor board’s long-standing practice of seeking reinstatement for workers while their cases are litigated, a process that can take years.

OpenAI completes deal that values the company at $80 billion By CADE METZ and TRIPP MICKLE

O

penAI has completed a deal that values the San Francisco artificial intelligence company at $80 billion or more, nearly triple its valuation in less than 10 months, according to three people with knowledge of the deal. The company would sell existing shares in a socalled tender offer led by venture firm Thrive Capital, the people said. The deal lets employees cash out their shares in the company, rather than a traditional funding round that would raise money for business operations. OpenAI, which declined to comment, is now one of the world’s most valuable tech startups, behind ByteDance and SpaceX, according to figures from data tracker CB Insights. The deal is another example of the Silicon Valley deal-making machine pumping money into a handful of companies that specialize in generative AI — technology that can generate text, sounds and images on its own. The funding boom kicked off early last year,

after OpenAI captured the public’s imagination with the release of the online chatbot ChatGPT. (The New York Times sued OpenAI and its partner, Microsoft, in December, claiming copyright infringement of news content related to AI systems.) The deal comes at a critical time for OpenAI, providing it with an important vote of confidence after a year of controversy. In November, the company’s board fired Sam Altman, its CEO, because it lost confidence in his leadership. The dismissal ignited a week of chaos and threw the company’s future into doubt, as employees threatened to resign in solidarity with Altman. Ultimately, he was reinstated and several board members resigned. In an attempt to resolve last year’s turmoil, OpenAI hired law firm WilmerHale to review the board’s actions and Altman’s leadership. WilmerHale is expected to finish its report on the episode early this year. The company agreed to a similar deal early last year. Venture capital firms Thrive Capital, Sequoia Capital, Andreessen Horowitz and K2 Global agreed to

buy OpenAI shares in a tender offer, valuing the company at around $29 billion. Investors are eager to pour money into AI companies. Last January, Microsoft invested $10 billion in OpenAI, bringing its total investment in the San Francisco startup to $13 billion. Thrive did not respond to a request for comment. Since then, Anthropic, an OpenAI rival, has raised $6 billion from Google and Amazon. Cohere, a startup founded by former Google researchers, raised $270 million, bringing its total funding to more than $440 million, and Inflection AI, founded by a former Google executive, also raised a $1.3 billion round, bringing its total to $1.5 billion. OpenAI appeared to be close to finalizing its latest deal in November, when Altman was unexpectedly fired. In the week that followed, the potential deal loomed over Altman’s efforts to negotiate his way back into the company. Before he was reinstated, over 700 of the company’s 770 employees signed a petition calling for his reinstatement.

Global equity funds see big inflows amid stock rally G lobal equity funds racked up significant inflows in the week to Feb. 14 propelled by investor optimism amid a robust stock market rally, despite lingering uncertainties over the Federal Reserve’s rate cut plans. According to data from LSEG, investors acquired a net $9.12 billion worth of global equity funds during the week, marking their largest weekly net purchase since Dec. 27, 2023. Investors raised their holdings as global stocks rallied to their two-year peaks this week. The MSCI world stock index overcame a 1.1% dip early in the week, driven by a higher-than-expected U.S. inflation reading, to hit a new two-year peak of 752.55 on Friday. The U.S. equity funds received $6.78 billion, the biggest weekly inflow in seven weeks. Investors also purchased about $1.74 billion worth of Asian equity funds but sold European funds of a net $151 million. Among sector funds, tech received $2.66 billion in a fifth successive week of net buying. Industrials and consumer discretionary sectors also drew about $277 million and $242 million, respectively. Meanwhile, global bond funds garnered about $11.25 billion in net purchases, extending inflows into an eighth consecutive week. Corporate bond funds drew $2.47 billion, the biggest inflow in four weeks, while government, and loan participation funds secured about $1.72 billion and $467 million, respectively, in net purchases. At the same time, investors offloaded $41.48 billion worth of money market funds after two weeks of net buying in a row. In commodities, investors withdrew $654 million out of precious metal funds, extending outflows into a seventh successive week. Energy funds also witnessed about $77 million worth of net selling. Data covering 28,577 emerging market funds showed equity funds received $382 million, the first weekly inflow in five weeks, while bond funds had outflows, worth about $85 million on a net basis. U.S. stocks fell on Friday with the Nasdaq showing the largest decline after a hotter-than-expected producer prices report eroded hopes for imminent interest rate cuts by the Federal Reserve. A Labor Department report showed producer prices increased more than expected in January, feeding fears inflation was picking up after months of cooling. After five consecutive weeks of gains, all three indexes posted a weekly decline. The data could encourage the Fed to wait before cutting rates. Earlier this week, a hot consumer prices report sparked a selloff in equity markets although a slump in January retail sales on Thursday stoked hopes of rate cuts.

Netanyahu says he won’t bow to pressure to call off Rafah invasion By ADAM RASGON and AARON BOXERMAN

rime Minister Benjamin Netanyahu of Israel insisted Saturday that Israel would not bow to international pressure to call off its plan for a ground invasion of Rafah, the southernmost city in the Gaza Strip that is now packed with more than 1 million Palestinians. Many of the people now in Rafah are displaced and living in schools, tents or the homes of friends and relatives, part of a desperate search for any safe refuge from Israel’s military campaign, which has dragged on for more than four months. Their lives are a daily struggle to find enough food and water to survive. “Those who want to prevent us from operating in Rafah are basically telling us: Lose the war,” Netanyahu said at a news conference in Jerusalem on Saturday evening. “It’s true that there’s a lot of opposition abroad, but this is exactly the moment that we need to say that we won’t be doing a half or a third of the job.” About the same time as Netanyahu addressed the news conference, thousands of anti-government protesters filled a central thoroughfare in Tel Aviv — the largest protest against the prime minister in months. They filled the same street where mass protests against Netanyahu’s efforts to weaken the country’s judiciary riled the nation before the start of the Israel-Hamas war. Calls for an immediate election rose above a din of air horns. Protesters lit a red flare in the middle of a drum circle while others wielding flags stared down half a dozen police officers on horseback. “The people need to rise up, and the

Lerner said that even before the war, he lost confidence that the government has the nation’s best interest at heart, but “Oct. 7 proved it,” he said. Netanyahu’s comments also came as world leaders and international organizations were raising alarms that an invasion of Rafah would only compound the humanitarian disaster for displaced Palestinians. Josep Borrell, the European Union’s top

diplomat, reiterated Saturday his appeal to Israel to refrain from launching a military operation in Rafah “that would worsen an already catastrophic humanitarian situation.” Netanyahu, however, said Palestinians would be permitted to leave Rafah and contended that there was “a lot of space” north of the city where civilians could resettle. The Israeli leader played down the chances of a quick breakthrough in indirect talks with Hamas on a cease-fire in exchange for a hostage release. He said that Hamas — the armed group that long controlled Gaza and which led the Oct. 7 attack on Israel that started the war — was making “ludicrous” demands in those negotiations. Explaining his decision to stop Israeli officials from participating in follow-up negotiations in Cairo earlier this week, the prime minister went on to say Hamas had not compromised on its demands “one nanometer.” “There’s nothing to do until we see a change,” he added. Earlier on Saturday, Ismail Haniyeh, the leader of Hamas’ political wing, issued a statement accusing Israel of “procrastinating” in addressing Hamas’ demands. Hamas has been calling for a comprehensive ceasefire, the reconstruction of Gaza, the end of Israel’s blockade of the territory and the re-

lease of Palestinian prisoners held by Israel. President Joe Biden said at a news conference Friday that he didn’t expect Israel to invade Rafah while efforts to free the hostages were ongoing. South Africa this week asked the International Court of Justice, the United Nations’ top judicial body, to intervene to stop Israel’s planned advance into Rafah. But on Friday, the court declined to issue new constraints aimed at preventing such an incursion. Instead, it said the “perilous situation” in Gaza, including in Rafah, required Israel to abide by its previous ruling last month, which included taking “all measures within its power” to prevent the crime of genocide by its forces. Netanyahu has called the charge that Israel has engaged in genocide “false” and “outrageous.” Israeli officials have insisted that an incursion into Rafah is needed to destroy tunnels between Egypt and Gaza and to try to root out Palestinian militants there. But the Israelis have not yet presented a plan to evacuate civilians as the U.S., Israel’s closest ally, has demanded. Many civilians sheltering in Rafah have already moved multiple times as Israel’s military campaign has pushed farther south, and some have said their homes north of the city have been destroyed and they have grown tired of repeatedly relocating. “If they want to come here — amid all these people — there will be massacres,” said Khalil el-Halabi, 70, one of the many displaced Palestinians from northern Gaza who have sought shelter in Rafah. Some displaced Palestinians have now moved back north toward Deir al Balah in central Gaza, according to the U.N.’s humanitarian coordinator. People in Rafah have grown so desperate for food that they are stopping aid trucks and eating what they manage to get on the spot, according to the United Nations. As the Israeli invasion of Rafah looms, neighboring Egypt has grown increasingly concerned that an Israeli operation in the city could send Palestinian refugees streaming into its territory. Egypt has warned Israel of “dire consequences” should Israeli forces embark on a ground operation in Rafah. But Israel’s defense minister, Yoav Gallant, tried to assuage those concerns Friday, saying Israel had “no intention of evacuating Palestinian civilians to Egypt.” Israel and Egypt have had a decadeslong peace treaty that is a cornerstone of stability in the Middle East.

kraine is engaged in a desperate fight to hold back the Russian onslaught. Russian forces captured the longtime Ukrainian stronghold of Avdiivka before dawn on Saturday, Moscow’s first major battlefield gain since it took Bakhmut last May. But across the entire 600-mile long front, Ukraine is short on ammunition without renewed U.S. military assistance, and it is struggling to replenish its own depleted forces after two years of brutal fighting. Russia’s assault has split into five major lines of attack, spanning towns and cities across much of the front in eastern and southern Ukraine. Here is the status of Russia’s offensive in five crucial battles: 1. Avdiivka: Russia captured a longtime Ukrainian stronghold. The now-destroyed city of Avdiivka covers only some 12 square miles. But for the better part of a decade it carved a bulge in the front line that undermined crucial Russian logistical operations. It sits only a few miles from the city of Donetsk, which Russia has occupied since 2014. In recent weeks, Russian forces have breached a crucial supply line and threatened to encircle Ukrainian soldiers. Oleksandr Tarnavskyi, head of Ukraine’s forces in the south, said Ukraine had no choice but to withdraw. “In a situation where the enemy is advancing on the corpses of their own soldiers with a 10-to-1 shell advantage, under constant bombardment, this is the only correct solution,” he said in a statement. It’s not clear how far the Russians might be able to push this fight beyond Avdiivka, or how well Ukrainians have constructed their next lines of defense. But the next major population centers, home to tens of thousands of civilians, are only about 35 miles to the west. Roughly 50,000 Russian soldiers have been dedicated to the fight for Avdiivka in this direction, although the numbers fluctuated. Tens of thousands of Russians have been killed or wounded, according to Western and Ukrainian officials, but Russia has steadily replenished their ranks, including using convicts to join the fighting. Even if the lines stabilize after the Russians take the city, its fall allows the Russian military to move troops and equipment more efficiently behind the line as it presses in other directions.

By last month, Russian forces had finally cleared out the last Ukrainian defenders of Marinka, another longtime front-line town. There is very little left of Marinka after two years of Russian bombardments and battles. But its capture has allowed the Russians to turn their attention to the south and another vital Ukrainian stronghold, Vuhledar. Last year, the Russians repeatedly tried to attack Vuhledar from the south and suffered catastrophic losses, including a devastating defeat in one of the largest tank battles of the war. But with Marinka under control, the Russians are attacking Vuhledar from the north. They are currently advancing through the village of Novomykhailivka, which is about 13 miles to the northeast. It is not clear how many forces the Russians have amassed in this direction, but Ukrainian officials have said Russia has kept around 40,000 in the nearby Mariupol area to be deployed for attacks from the south. Soldiers fighting in the Vuhledar area said the fall of Avdiivka, 55 miles to the northeast, would likely free up Russian forces to step up attacks from the north. 3. Robotyne: Russia is seeking to reverse

Ukraine’s largest gains last year. When Ukraine’s failed summer counteroffensive culminated last year, its forces had managed to advance only about 10 miles deep into the southern front, reaching just beyond a tiny village, Robotyne. Russia now appears determined to win back what it lost. The Russian military has more troops concentrated on this front than on the Avdiivka front, Dmytro Lykhovii, a spokesperson for Ukrainian soldiers fighting in the south, said this past week. “It seems that the Russians have set a goal to gain some success there by storming in, just as they are trying to do in Avdiivka,” he said. 4. Kreminna: Russia is pushing from Kreminna to reclaim towns in the northeast it lost to Ukraine in late 2022. Ever since the Russians were driven out of occupied territories in northeastern Ukraine more than a year ago — losing control over more than 500 settlements spread

over 11,000 square kilometers — they have been fighting to try and take it back. Last year, little territory changed hands, despite intense fighting in the forest belts along the front here. Now, Russia is starting to move forward again, albeit slowly in the face of fierce Ukrainian resistance. Russian forces are pushing in two directions from the city of Kreminna: toward the battered city of Kupiansk to the north, and toward Lyman, 80 miles to the south. Russia has maintained a total force of around 110,000 troops in the area for months, despite losses, Illia Yevlash, a spokesperson for the military in the area, told reporters this month. 5. Bakhmut: Russia has regained the momentum, and a major Ukrainian city could come into artillery range. Russia destroyed and then seized the city of Bakhmut in May, its last significant territorial gain on the battlefield before advancing on Avdiivka this past week. By the time the Russians took Bakhmut, their forces were exhausted, and the Wagner mercenary group that led the fight was in open rebellion against the Russian ministry of defense. Ukrainian hopes to exploit the disarray to counterattack around the flanks of the city largely stalled. Now, it is the Russians who have the initiative. Gen. Oleksandr Syrsky, the newly appointed commander of Ukrainian forces, said recently that the Russians are determined to break through their defenses around Chasiv Yar, which would give them control of commanding heights in the area and expose the city of Kramatorsk to increased artillery fire. Some 62,000 Russian soldiers are on the ground in the Bakhmut direction, according to Ukrainian estimates. “The situation is tense, requiring constant monitoring of the overall situation and prompt decision-making on the ground,” Syrsky said in a statement this month.

Risking arrest, Russians mourn Navalny in small acts of protest By VALERIE HOPKINS

or the second day in a row, mourners walked purposefully along Moscow’s snow-heaped Garden Ring on Saturday carrying bouquets to lay at one of the improvised memorials to Alexei Navalny, the Russian opposition figure who perished in a prison colony the day before. The flowers, wrapped in paper to shield them from the icy wind, were not only a symbol of mourning. They also served as a form of protest in a country where even the mildest dissent can risk detention. And the people who laid bouquets at the Wall of Grief, a monument to the victims of political persecution during the Josef Stalin era, shared the conviction that the Russian state was behind Navalny’s death. “He didn’t die, he was killed,” said Alla, 75, a pensioner who declined to give her last name because of possible repercussions. “Theoretically, we knew that they wanted to destroy him,” said her friend Elena, 77, whose arm was interlaced with Alla’s. “But when it happened it was such a shock, the senseless brutality of it, just senseless.” She found out what had happened when her daughter and granddaughter called her in tears to share the news. Both women expressed pride that people were showing up to express their disagreement with the state, despite the sweeping crackdown on dissent since Russian President Vladimir Putin launched the full-scale invasion of Ukraine almost two years ago. In announcing Navalny’s death Friday, Russia’s prison service said that he felt suddenly unwell during a walk and that the causes were “being determined.” A lawyer for Navalny said an “additional histology” had been performed on the body to determine the cause of his death, and that its results should be ready next

At least 400 people have been detained across Russia since Navalny’s death was announced, according to the human rights group OVD-Info. Among them was a priest, the Rev. Grigory MikhnovVaitenko, who had been scheduled to hold a memorial service for Navalny in St. Petersburg. It is the most significant spate of arrests since protests against a general mobilization for the war in Ukraine in September 2022. “They try to scare us so much that it is not possible to live,” said Elena, who added that she worried for the fate of hundreds of other

political prisoners in Russia. Fear prevented Andrei, a 17-year-old in 11th grade, from buying flowers, but he wanted to come and see what was happening. He bristled when one passerby mocked the mourners and questioned Navalny’s legacy. “What did he do for our country that deserves our prayers or mourning?” said Sergei, a pensioner who also provided just his first name. “What about smart voting?” ventured Andrei, referring to a system pioneered in 2018 by Navalny’s team that encouraged voters to unite around one opposition candidate, hoping to outpoll Putin loyalists. “He was an empty person, just a puppet of the West,” Sergei responded. As they spoke, dozens of police observed and interacted with people coming to the complex, and another group of riot police in position near paddy wagons looked on half a block away. The Wall of Grief, in central Moscow, is on Sakharov Avenue, named after Andrei Sakharov, the Nobel Prize-winning physicist whose activism was punished with 12 years of internal exile in Gorky, today known as Nizhny Novgorod. The government has used the site to contain protest movements by making it the only permitted venue whenever public pressure for a march has forced a response. Navalny frequently addressed demonstrations there. For Olya, 39, the heaps of flowers and candles served as a rare but valuable reminder that she is not alone in wanting a democratic,

free Russia without war. “At a time like this it is so important to see that there are people who think like I do,” she said, as she brought roses to the Wall of Grief. Earlier, she said she had laid flowers at the Solovetsky Stone, another monument to victims of political repression, across from the headquarters of the FSB, the successor agency of the KGB. “And it’s a shame that in a short period of time, people come and go, and you can’t see all the people who came throughout a day, who are constantly being asked to leave,” she added. “But you can see flowers.” Protests are effectively banned in Russia, and the arrests the past two days show the extent to which authorities are ready to go to suppress public displays of anger or mourning. “A responsible citizen who loves his homeland, was forced to leave it or is trying to the last not to leave it, has only one weapon — a memorial candle,” wrote Andrei Kolesnikov, a Moscow-based commentator, in an opinion piece he hopes to publish soon, calling them “the last weapon of a civilized, not savage, person and citizen.” On Friday, videos began circulating of men with their faces covered, removing flowers from the Solovetsky Stone, in what was interpreted as a sign that authorities do not want the scale of the outpouring of grief to become public. Still, life largely went on as usual across Moscow, with restaurants and shopping districts bustling. And news of Navalny’s death, the improvised memorials and the arrests were largely missing from news broadcasts Saturday. State television channels Rossiya24 and Rossiya-1 instead discussed the Munich Security Conference and the Russian capture of Avdiivka in Ukraine, and featured the “Russia International Exhibit and Forum,” a patriotic showcase celebrating the food, technology and culture of each of the country’s regions. Russian state-controlled Channel 1 mentioned Navalny in its news bulletins only three times, for about 30 seconds each and without mentioning he was a politician or even the official reason for his imprisonment. But for many gathered in Moscow, the memory of the protest will be indelible. “Someday what we are watching may be in history books,” Andrei, the student, whispered, as police officers urged him and a New York Times journalist to leave the premises. Watching the steady flow of people bearing flowers, and under the increasing pressure of a police officer to move along, he slipped into an underground crosswalk with a request. “Please don’t forget that there are still many good people in this country,” he said.

The best case for Ukraine aid By ROSS DOUTHAT

T

he first year of the war in Ukraine seemed to vindicate Russia hawks. The belief that Vladimir Putin was a careful chess player whose ambitions could be constrained through negotiation, the belief that Ukraine couldn’t plausibly defend itself against Moscow and therefore didn’t merit support from an already overstretched America — these ideas seemed to dissolve in the first months of war, with Putin gambling and rambling while Ukrainian arms threw his forces back. The second year of war has been kinder to realists and doves. Russia, as in many wars before, seems stronger in a grinding conflict than it did in the initial thrusts. Putin’s regime proved resilient against the West’s economic weapons, and against internal opposition as well; the death in prison of Russia’s leading dissident, Alexei Navalny, looks like the latest example of the dictator’s ruthless settling of accounts. Meanwhile, the Ukrainian counteroffensive of spring and summer failed: A year ago there was still hope that a Russian retreat would turn into a rout, but since then stalemate has ruled the front. The changed situation has created a division in the hawkish argument, visible as the U.S. Congress wrangles over further aid to Ukraine. On the one hand you still

have rhetoric that seems to belong more to the first year of war, claiming that Putin is clearly losing the war (“This guy is on life support,” Sen. Thom Tillis, R-N.C., told his colleagues in the Senate debate), and that aid to Ukraine is a cheap, effective way to degrade and defeat an American rival without fighting the Russians ourselves. On the other you have arguments that suggest that the tide is turning against Ukraine, that Putin is getting ever stronger (“Russia’s capacity to produce military equipment has increased tremendously,” Denmark’s defense minister warned recently), and that he’ll be ready to attack the Baltics or some other NATO country soon. The strange events this past week on Capitol Hill, in which Rep. Mike Turner, R-Ohio, a Ukraine hawk, teased secret intelligence about Russian superweapons in space, felt like an attempt to boost this narrative — emphasizing Russia’s increasing strength as the reason to keep on sending money and weapons to Ukraine. The problem with the first argument is that it doesn’t match the changing situation on the ground. The problem with the second argument is that it raises a big strategic question: If Russia has gotten only stronger since we started funding the Ukrainian war effort, doesn’t that suggest that we’ve ended up overstretched after all, just as critics warned? I think there is a good case for continued aid to Ukraine that doesn’t rely on either exaggerating Ukrainian successes or hyping Russia’s military-industrial complex. But it’s a case that’s hard to make under the sweeping terms that have framed our support for Ukraine to date. The legislation that passed the Senate includes, ostensibly as a concession to skeptics, a provision requiring the Biden administration to submit to Congress a detailed strategic plan explaining how the aid will “hasten Ukrainian victory.” But as Keith Gessen of The New Yorker puts it, mildly, at this point most military observers are “a little hard-pressed to describe an actual military victory for Ukraine.” It’s more likely that there simply is no plausible path to a full Ukrainian triumph — or at least not one that’s compatible with defending the United States’ other interests around the world. We are not giving Ukraine money, in other words, because we see a likely future in which Russia can be pushed back to the prewar lines of control. Instead, the best reason to continue sending aid is to make it easier to negotiate an armistice on terms favorable to Ukraine’s survival and resilience — since any such terms will become less and less favorable if we’re seen as abandoning the Ukrainians in advance. I hope and believe that this is what the White House, beneath its wartime rhetoric, is currently seeking: not outright victory but the best possible deal to end the

And certainly there are reasons, if that’s your goal, that you wouldn’t want to say so openly; you’d want to present yourself as planning for victory even if you’re actually ready to negotiate. But the Biden administration has a domestic audience as well as an international one, and it might be easier to convince domestic doubters — wavering House Republicans, especially — if the current aid package weren’t being presented as the clincher for a Russian defeat that isn’t actually in evidence, or the key to the sweeping victory that our prior investments have conspicuously failed to bring about. These days that kind of promise — Triumph just around the corner! Victory waiting just beyond the next offensive! — evokes memories of Afghanistan and Vietnam, rather than confidence in U.S. strategic prowess. What’s needed instead is something much subtler: a public argument that doesn’t concede too much to Russian aggression, but concedes enough to military reality to convince Americans that they’re making an investment that will actually help bring the conflict to an end.

Eso es algo que se está tratando de coordinar, pero sería algo totalmente voluntario, sería que contratistas entrevistan personas que tienen permisos de trabajo y entonces coordinan para que esas personas ayudan en los proyectos elaboren en los proyectos que tienen”, dijo el gobernador a preguntas de la prensa. Ya para el próximo es una materia presupuestaria, a menos que se legisle, pues para el próximo será una materia presupuestaria. Tendremos que incluir la cantidad necesaria para honrarle la paga justa y necesaria que merecen los jueces. Y entonces, así que ahora será un asunto presupuestario a menos que se legisle. Porque si se legisla, pues entonces tenemos más certeza, porque ya están las escalas aprobadas. Y ya es más bien a nivel presupuestario cumplir con ese mandato de ley”, expresó.

Finalmente, sobre el Proyecto de Cámara 1948 que elimina la vacunación como requisito para matricular estudiantes, insistió que su política pública fomenta el uso de las vacunas. “Ya se atendió por vía de un proyecto que yo firme, el que padres puedan objetar a vacunar a sus hijos por razones religiosas, por ejemplo, y sin que se les tenga que requerir que un pastor o un sacerdote valide esa objeción. O sea, que ya hicimos eso, pero la política pública de la administración es fomentar que se vacunen. El Departamento de Salud objetó, entiendo que objetó esa medida que tú mencionas. Así que no ha llegado a mi despacho. Si llega a mi despacho la voy a evaluar, pero vuelvo y repito, nosotros fomentamos, creemos que la vacunación es buena para nuestros niños y jóvenes, para prevenir múltiples enfermedades”, dijo el gobernador a preguntas de la prensa. AN JUAN – El director ejecutivo de Paradiso College Preparatory, Robert Acosta exigió al Senado de Puerto Rico realizar vistas públicas para el proyecto que pretende que el Departamento de Educación imponga una moratoria de cinco años al establecimiento de escuelas alianza (charter) en Puerto Rico. “Nos parece increíble que se baje a votación en el Senado una medida de tanta trascendencia y que perjudicaría la posibilidad de que nuestros niños y jóvenes tengan la educación que merecen”, dijo Acosta en declaraciones escritas. Supuestamente el Senado va a aprobar en la sesión del martes un proyecto para establecer una moratoria de permisos para escuelas charter. Insistió en que “es imperativo que el Senado realice vistas públicas para que las partes involucradas-

particularmente estudiantes y padres- puedan ofrecer su testimonio con respecto a las escuelas alianza”. Acosta catalogó como falso el argumento que “las escuelas charter tengan un impacto en el presupuesto de las escuelas del sistema público. La operación de Paradiso College Preparatory ha sido financiada en su totalidad con fondos privados, sin la inversión de dinero público”. “Los opositores a las escuelas charter alegan que dichos planteles tienen un impacto fiscal negativo en las escuelas públicas existente. Argumentar un impacto negativo de nuestras escuelas es errado. Por el contrario, nuestras escuelas proveen las condiciones dignas para que se dé un proceso adecuado de enseñanza-aprendizaje y cerremos la brecha académica. No sufrimos de escasez de materiales y equipo, ausentismo de docentes o planta física en mal estado”, concluyó.

How Paul McCartney’s lost bass guitar was found five decades later By ISABELLA KWAI

N

o one seemed to know what had happened to one of the most important bass guitars in music history, though in the decades since it went missing, there had been some dramatic rumors. Was the Höfner violin bass, which had accompanied Paul McCartney and the Beatles to worldwide fame, tucked away in a private collection? Had it been secretly shipped to a wealthy fan in Japan? It turned out the bass was passing time in a more unassuming locale: the loft of a family home in East Sussex, England. The family reported the guitar in late September after a couple of journalists and a guitar expert started a new campaign looking for it in 2023, more than 50 years after it was last seen. The guitar, which has been authenticated by its manufacturer, has been returned to McCartney, according to a statement posted on his website Thursday. “Paul is incredibly grateful to all those involved,” it said. It was the denouement to an enduring mystery that had gripped Beatles fans, including one group who pooled their skills to help find it. ‘It Started Beatlemania’ The Höfner 500/1 guitar is a precious part of Beatles lore. It can be heard on recordings of hit songs including “Love Me Do,” “She Loves You” and “Twist and Shout.” After becoming the band’s bassist, McCartney desperately needed a bass guitar and bought the instrument in a music store in Hamburg, Germany, in 1961. “I got my Violin Bass at the Steinway shop in the town center,” he recalled in a 1993 interview with Guitar Magazine. It cost the equivalent of 30 pounds — cheap enough for him to afford. “And once I bought it, I fell in love with it,” he said. “For a light, dinky little bass, it has a very rich sound.” As the Fab Four found a whirlwind of fame, McCartney played the Höfner through hundreds of the gigs, including early concerts at the Cavern Club in Liverpool, England, where the Beatles met their future manager, Brian Epstein, and for the

One of the last sightings of the bass was in London in 1969, in footage of the band writing their album “Let It Be.” Sometime after that, it disappeared. Efforts to locate the bass had stalled until last September, when two journalists and a Höfner expert revived the search and appealed to the public for tips. “It’s an iconic instrument,” said Nick Wass, a semiretired consultant for Höfner who has worked with McCartney. “It started Beatlemania.” Among the hundreds of responses they received were some promising clues, said Scott Jones, a journalist who worked on the project with his wife, Naomi Jones. A sound engineer who had worked with McCartney remembered that the guitar had been left in the back of a van in 1972 and that thieves had then broken in. Another tip, Scott Jones said, suggested that the guitar had been stolen in

the neighborhood and then sold for a little money and “some free beer” to Ronald Guest, the landlord of a local pub. Then, in late September, the landlord’s family, living in the town of Hastings, in southeast England, reached out to McCartney’s studio: Could the guitar in their loft be the missing bass? ‘It’s Hardly Traveled Any Distance at All’ “We thought this bass would have gone off on a more glitzy journey,” said Jones, adding that in fact, the research indicated that the guitar had stayed in the same family. “In all of those years, it’s hardly traveled any distance at all.”

Jones said that a member of the Guest family handed the guitar over to McCartney’s studio in Sussex, England. Posts on social media appeared to show Ruaidhri Guest, 21, holding the guitar. He did not immediately respond to a request for comment, but he said in a post Friday that the family would be releasing details “in due course.” Soon after the guitar emerged in late September, Wass drove from Germany to England to help authenticate that it was, in fact, that Höfner. “There it was in my hands,” Wass said, adding that he had been looking for the guitar since McCartney inquired about it several years ago. Finding it, he said, felt “thrilling.” “It didn’t take me more than 10 seconds to know it was the right one,” he said. Wass pointed to the left-handed guitar’s distinctive parts and color. Five international movies to stream now

‘So Long, My Son’ By DEVIKA GIRISH

T

he scenes that open this ravishing drama by Wang Xiaoshuai feel like pieces of a cryptic puzzle, gesturing evocatively at a whole that remains out of view. Two boys play beside a lake, a death is seen from a distance, and years later, in some other place, a grieving couple struggle to raise a wayward son. Slowly, these fragments swirl together into a decades-spanning epic about two couples in China, brought together in the 1980s by their factory jobs and then torn apart by a series of losses, including those inflicted by the country’s one-child policy. With its nonlinear stitching, the movie demands patience, and rewards it handsomely. Each scene trembles with emotion, conjured at the precise intersection of performance, cinematography and carefully rendered political context. In one sequence, the central couple, Liyun (Yong Mei) and Yaojun (Wang Jingchun), receive news of layoffs in a companywide meeting. As the crowd of workers erupts in rage, the camera settles on Liyun’s face, streaked by a single tear: A personal tragedy is etched in the canvas of a historical one. The two will suffer many more crises, but in relaying them nonchronologically, the film allows for plenty of grace and resilience, capturing life not as an arc but as a collection of moments — sometimes good, sometimes bad, always fleeting. (Stream it on Mubi.) ‘Antigone’ A Greek tragedy is re-imagined as a bristling tale of rage against injustice in this French Canadian thriller from director Sophie Deraspe. If the names of the movie’s characters seem out of place at first — the protagonist is Antigone (Nahéma Ricci), an Algerian immigrant and high school student in Montreal, and her siblings are Polynice, Étéocle and Ismène — the epic dimensions of their lives become quickly apparent. They arrived in Quebec with their grandmother when Antigone was only 3, having lost both their parents; the two brothers now provide for their meager household — through

aboveboard as well as illicit means involving gangs. When an incident of brazen police brutality kills Étéocle and sends Polynice to prison, Antigone takes it upon herself to free her brother through an audacious plan that puts her own life in danger. This modern twist on the Greek heroine’s self-sacrifice generates a number of timely ripples; social media becomes a key tool in Antigone’s battle against the state. Anchored in a riveting performance by Ricci, “Antigone” is a portrait of immigrant disenfranchisement, adolescent rage and familial duty that feels both eternal and strikingly contemporary. (Stream it on Tubi.) ‘Three of Us’ Along the western coast of India lies a breeze-swept stretch of land called the Konkan, dotted with trees and ancient forts, and boasting a unique language and cuisine. In 2014, filmmaker Avinash Arun unfurled “Killa,” a gentle coming-of-age tale, in the meditative heart of Konkan, the area’s unhurried pace and natural beauty offering an ideal setting for the young protagonist’s newfound grief. In his new feature, “Three of Us,” Arun returns to the region to draw out his character’s internal battles — although this time, his focus is on a middle-aged couple confronting mortality. When she discovers that she has dementia, Shailaja (Shefali Shah), who lives and works in Mumbai, decides that she wants to revisit the Konkan village where she spent formative years of her childhood. Her husband, Dipankar (Swanand Kirkire), goes along, bemused but supportive. There, in the long shadows of palm trees, Shailaja reconnects with Pradeep (Jaideep Ahlawat), a childhood friend who seems to unfasten something deep inside her. The strength of “Three of Us” lies precisely in its reluctance to name or detail things. Instead, the film simply observes the three wonderful lead actors as they move about the beautiful landscape, dramas of yearning, sadness and joy all playing out in their gestures, evoking essential truths of life. (Stream it on Netflix.) ‘The Green Perfume’ French comedies don’t get much sillier — or more entertaining — than this caper by director Nicolas Pariser, which tangles together a thespian accused of an onstage murder, a cartoonist running from her nagging mother, and a host of international criminals and detectives. Vincent Lacoste plays the poor straight man, Martin, unwillingly caught up in these high jinks. An actor in the Comédie-Française, he is in the wings when a colleague drops dead during a climactic monologue. A parting whisper from the victim puts the target on Martin’s back, and he embarks on a journey across Europe evading both the cops and the killers, while Claire (Sandrine Kiberlain), the cartoonist, follows along, for no discernible reason other than to avoid dinner with her family. Not much of it makes sense, per se, but that’s kind of the point: “The Green Perfume” takes the tropes of convoluted crime thrillers and re-imagines them with tongue-in-cheek irony. (Stream it on Mubi.) ‘Norma’ In this Argentine comedy from Santiago Giralt, the life of a rich woman in her 60s, Norma (Mercedes Morán), begins to fall apart. One day, she comes home to find that her housekeeper has found a better job and is leaving her. That snagged thread slowly unravels the whole fabric of Norma’s life, as she realizes the ways in which daily routines and comforts

have numbed her to her discontents. Her marriage is stuck, her relationships with her mother and sister are broken, and her panic attacks are debilitating. Morán, who wrote the script with Giralt, brings a gentle, effortless authenticity to even the more trite or cutesy parts of the film — such as Norma’s newfound weed habit, or her budding, sisterly friendship with a new neighbor, a red-haired therapist, who helps Norma loosen up. Her aging doldrums may be familiar, but Norma embodies a fullness — she’s spoiled, vulnerable, impulsive and deeply empathetic — that we rarely see in older women on screen. This is a midlifecrisis movie that thrums with the energy and optimism of a coming-of-age film. (Stream it on Netflix.)

Can the world’s largest cruise ship really be climate-friendly? By CEYLAN YEGINSU

O

n Jan. 23, in a ceremony that, of course, involved a soccer ball, Argentine soccer superstar Lionel Messi pressed a button and a bottle of Champagne smashed against the bow of Icon of the Seas, christening the world’s largest cruise ship at its home port of Miami. Like an A-list celebrity stepping onto the red carpet, the arrival of Royal Caribbean’s 250,800-ton ship has captured the world’s attention, with some marveling over its cutting-edge features, like the largest water park at sea, while others criticize the gigantic ship’s potential to damage the environment. With the capacity to carry nearly 8,000 people, the 20-deck, 1,198-foot-long vessel — whose inaugural cruise with paying passengers departs Saturday — is the size of a small city. There are eight “neighborhoods” packed with amenities that include a 55-foot waterfall, six waterslides and more than 40 restaurants, bars and entertainment venues. According to Royal Caribbean, the ship, which is registered in the Bahamas, also sets a new standard for sustainability with the use of energy-efficient technology designed to minimize the ship’s carbon footprint and move closer to the company’s goal of introducing a net-zero ship by 2035. “We live by one single philosophy, which is to deliver the best vacations responsibly,” said Nick Rose, the vice president of environmental stewardship at Royal Caribbean Group. “And to do that we build with the core principles of sustaining our planet and communities.” For decades the cruise industry has been criticized for its negative impact on the environment. A 2021 study published in the Marine Pollution Bulletin found that despite technical advances, cruising remains a major source of air, water and land pollution affecting fragile habitats and human health. While environmental groups have welcomed some of the features on Icon of the Seas, such as its advanced water treatment system, some say building such huge ships is contrary to the cruise industry’s long-

term goals of sustainability and preservation. “The ships are getting bigger and bigger and that is the wrong direction for the cruise industry to be going,” said Marcie Keever, director of the Oceans and Vessels Program at the environmental organization Friends of the Earth. “If you were really thinking about sustainability and not your bottom line, you would not be building a cruise ship with a capacity of nearly 10,000 people.” With more than five different brands, Royal Caribbean has a fleet of 65 cruise ships of various sizes. Icon of the Seas was built to meet demand and deliver experiences that its consumers were seeking, the company said, adding that all its ships carry the same sustainability principles of energy efficiency, and advanced waste and water management. Here’s a look at some key features that Royal Caribbean says make Icon of the Seas more sustainable and how they stack up. Transitioning to alternative energy sources Icon of the Seas is Royal Caribbean’s first ship to be powered by liquefied natural gas, a fossil fuel that the cruise industry has touted as a cleaner alternative to the commonly used heavy fuel oil. “LNG is currently the fossil fuel available at a scale that has the best performance in reducing atmospheric emissions,” said Cruise Lines International Association, the industry’s trade group, in its 2023 Environmental Technologies and Practices Report, citing analysis from SeaLNG, an industry coalition that promotes the benefits of LNG as a viable marine fuel. But environmental analysts are concerned about LNG’s long-term problems. Despite emitting around 25% less carbon dioxide than conventional marine fuels, they say, LNG is mostly methane, a powerful gas that traps more heat in the atmosphere over time than carbon dioxide. According to a 2020 greenhouse gas study by the International Maritime Organization, the United Nations body that regulates global shipping, the use of LNG as a marine fuel grew 30% between 2012

Shore power capabilities When cruise ships are docked at ports, their engines and diesel generators are often running on fuel, emitting carbon dioxide into populated areas. Icon of the Seas has been built to run on shore power electricity in ports, a cleaner alternative to fuel, and hopes to become one of the first cruise ships to plug into the local power grid at Port Miami when shore power facilities are set to become available in the spring. Three ships can plug in safely and simultaneously at the port on any given day, including Icon of the Seas, a spokesperson for Port Miami said. “When it comes to sustainability, there is no silver bullet and we want to pull every lever possible,” Rose said. “So if we can pull into a port that has cleaner shore-power capabilities we want to plug in so we don’t use any fuel.” The problem is that most ports don’t supply shore power: Only 2% of the world’s ports currently offer it for cruise ships, according to CLIA. Royal Caribbean says it is working with ports and other cruise lines to further its use. Converting waste to energy on board Expanding its 30-year “Save the Waves” program, which aims to help keep trash out of landfills and the ocean, Royal Caribbean has built what it says is a firstof-its-kind waste management system on board Icon of the Seas that converts waste into energy. The microwave-assisted pyrolysis technology, known as MAP, takes food, biowaste and cardboard waste and turns it into small pellets. The pellets are then heated up to produce a gas that is converted into steam energy that Royal Caribbean said would be used to power the ship’s water park. The system also produces biochar, which has the potential to be used as a fertilizer. The company said it will have a better understanding of the system’s output while the ship is in full operation in the coming months, but so far it takes around 25 kilowatts of electricity to operate the system with an output of 200 kilowatts. “It won’t take much energy to run the system,” Comer said, but, he added, “It won’t produce much energy for the ship, either.” Advanced water treatment Icon of the Seas is equipped with an advanced purification system that is designed to treat all wastewater on board, from toilets and showers to kitchen galleys. More than 93% of the ship’s fresh water will be produced on board through a system of reverse osmosis, which removes contaminants from water, the cruise line said. Keever said Royal Caribbean deserves credit for the treatment systems. “They’re installing the most expensive and best sewage treatment technology on their ships, and it’s important because they are the biggest cruise line and are showing the industry that they can do it, pay for it and they should,” she said. Fuel cells In its 2023 promotional video series, “Making an Icon,” Royal Caribbean said Icon of the Seas would be

(Royal Caribbean International) its “first ship with fuel cell technology,” which would be used to power parts of the ship like the air conditioning and elevators. But it won’t happen yet. Fuel cells combine hydrogen and oxygen to make electricity without combustion and their byproduct is water, meaning they do not emit as many greenhouse gases as traditional fossil fuels. While Icon of the Seas has been built to accommodate fuel cells, the batteries have not yet been installed, according to Bloom Energy, the fuel cell manufacturer working with Royal Caribbean. Because of the size and scope of the project, Bloom Energy said it encountered issues with external suppliers. Bloom Energy is now focused on solving the issues for larger fuel systems that are being planned for Royal Caribbean’s 5,668-passenger Utopia of the Seas, which is scheduled to enter service next year. Suminder Singh, the vice president of marine at Bloom Energy, said the next opportunity to equip Icon of the Seas with the cells may not be for another five years, when the ship is scheduled to go into dry dock. Royal Caribbean says it may not take that long and the decision will depend on the success of the technology on Utopia. Comer said that while fuel cells would be a great option, they have similar life-cycle emissions as conventional oil-based fuels if they are made on land using

natural gas. “We need hydrogen made from renewable electricity,” he said. “And if we have that and use it in fuel cells, then you would basically have zero-life cycle greenhouse gas emissions.”

Kansas City shooting is latest violence to mar a sports celebration By SANTUL NERKAR

L

ast June, 10 people were shot during celebrations on the night the Denver Nuggets won the NBA title. In 2019, four people were shot at the NBA championship rally for the Toronto Raptors. Two men were shot and killed in a Los Angeles suburb during a celebration of the Dodgers’ World Series victory in 2020. Last week brought the latest example of violence marring a celebratory sports moment. On Wednesday, shots rang out at the end of a Super Bowl victory parade in Kansas City, Missouri, leaving one woman dead and at least 22 people injured. The bloodshed led Kansas City’s mayor, Quinton Lucas, to question whether the city would have another parade if the team won again. “If we’re blessed enough to win a Super Bowl again, do we do this again?” Lucas asked during an interview with KMBC, a local news station. “Or do we all just say, ‘Go to Arrowhead Stadium, walk through metal detectors’ — have a very secured, vastly smaller event?” The vast majority of sporting events and championship celebrations take place without any overt violence. But some high-profile instances in recent years have led to a growing unease among some that sporting events are becoming less safe. Although there is little available data on the exact number of violent incidents in and around sporting events each year, researchers say several factors contribute to this feeling. One is the sheer number of people involved. A typical NFL game, for instance, attracts around 70,000 spectators. Larger crowds naturally increase the number of interactions that can lead to violence, said Tamara Herold, a professor of criminal justice at the University of Nevada, Las Vegas, who studies crowd control and violence at sporting events. “Crowd density tends to matter quite a bit,” Herold said. The NFL has a security presence at its official events like games, including the Super Bowl and the Pro Bowl, and the annual draft, with a “control center” that monitors the venue and even online

But parades and other championship celebrations are not official league events. The parade in Kansas City, for instance, went through the heart of the city, and attendees did not need to pass through any security checkpoint. The availability of alcohol, extreme heat or cold, and even the importance of the game in question (say, a Game 7 of the World Series) can also be aggravating factors for violence, Herold said. Stephen Billings, a professor at the University of Colorado’s business school who studies crime, said the fact that more aggressive behavior was taken for granted at sporting events — where people are often drinking alcohol and screaming — might contribute to such outbursts, too. “When the norms are different than the typical norms in society, and people feel like they feel the right to do something, that’s when we have conflict, too,”

he said. And the effects can spill over beyond the venues. Research from Billings found that violent crime increased within a half-mile of venues in Charlotte, North Carolina, between 2005 and 2009 on game days compared with days when there were no games. Over a four-year period, regular-season games in the NHL were associated

with an approximately 10% increase in assaults in the host cities, according to research from Kristina Block, a doctoral student at Sam Houston State University. More research from Block, written with Jacob Kaplan, a researcher at Princeton University, found a 7% increase in local public disorder crimes during home playoff games in the NHL. Steven Block, a professor of criminology at Central Connecticut State University, examined roughly 60 incidents of fighting among fans at stadiums in North America in a 2017 paper. Often, the fights stemmed from rival team allegiances, involved alcohol and were defused by other spectators, not stadium security. He also emphasized the role of density. “Just because of the sheer numbers, people might not feel like there’s security,” he said. “They feel they’re on their own, both to act aggressively and defend themselves.” After the Boston Marathon bombing in 2013, cities heightened surveillance and began sharing more information about how to prevent another attack. But those efforts were focused on threats of terrorism, not the kind of violence that erupts spontaneously. Nonetheless, Herold emphasized that the vast majority of sporting events were safe and that the violence that Americans did hear about was the exception. “These things, when they do happen, are tragedies,” she said. “But they are still relatively rare events.”

Don Gullett, ace for the Big Red Machine, dies at 73 By ALEX WILLIAMS

D

on Gullett, a flame-throwing left-handed pitcher who starred for three World Series champion teams in the 1970s, first with the Cincinnati Reds and then with the New York Yankees, died last Wednesday. He was 73. The Reds organization confirmed the death in a statement but did not cite a cause or say where he died. The Reds during Gullett’s tenure were one of the great teams of all time. The Big Red Machine, as it was known, was famous for its lumber, with an eradefining lineup of hitters that included Johnny Bench, Joe Morgan, Tony Pérez and Pete Rose. While the team’s pitching rarely received top billing, Gullett established himself as a feared ace during the team’s run as a dynasty. Nicknamed Smokin’ Don, he blew away batters with a fastball whose velocity tickled triple digits, at times drawing comparisons to his idol, Sandy Koufax, the storied Los Angeles Dodgers left-hander. Willie Stargell, the Hall of Fame slugger for the Pittsburgh Pirates, once said that Gullett “could throw a ball through a car wash without it ever getting wet.” Adding a nasty forkball that left batters waving at air, he went 17-11 with a 3.04 earned run average in 1974. Sparky Anderson, the Reds’ manager, predicted that, “barring an injury,” Gullett “is almost sure of making the Hall of Fame.” Those words would turn out to be prophetic, but not in the way Anderson intended. Gullett had the honor of starting Game 1 of the World Series for three straight years beginning in 1975 — the first two with the Reds, the third with the Yankees. In a thrilling seven-game triumph over the Boston Red Sox in 1975, Gullett lost the opener but came back to win Game 5, surrendering only two earned runs in 8 2/3 innings. After the Reds steamrolled the Yankees in a fourgame sweep the next year, the Bronx Bombers’ principal owner, George Steinbrenner, had apparently seen enough: He signed Gullett to a six-year contract

Don Gullett (Wikipedia) for $2.1 million (the equivalent of about $11 million today) as a free agent. “He had to take it,” Bench was quoted as saying in Gullett’s obituary in The Cincinnati Enquirer. “It was the hardest decision I think Don Gullett ever made in his life, but for his family it was the only decision he could make.” In his first year in pinstripes, in 1977, Gullett went 14-4, helping the team to its first World Series victory since 1962. Surgery in 1978 for a double tear in the rotator cuff of his left shoulder would mark the end of his playing days. His efforts to rehabilitate his throwing arm failed. He sat out the 1979 season, and the Yankees released him in 1980. Still, Gullett had tallied 109 wins against 50 losses

during his career, finishing with a winning percentage of .686 — the seventh best in league history for pitchers who notched at least 1,000 innings. On a Reds team stacked with stars, his athleticism had stood out to teammates — as had his humble manner. “He was a total athlete,” The Enquirer quoted Bench as saying. “He could hit and run like the wind and the nicest, nicest person. I don’t think I’ve ever heard a bad word ever said about Don.” Donald Edward Gullett was born Jan. 6, 1951, near Lynn, Kentucky, not far from the Ohio border, the sixth of eight children of Buford and Lettie Gullett. As a teenager, Don Gullett built his strength baling hay on local farms while becoming a dazzling All-State star on the diamond, gridiron and hardwood at McKell High School. He became a local legend, known for feats like scoring 72 points in a football game and striking out 20 of 21 batters while pitching a perfect game. Chosen 14th overall out of high school by Cincinnati in the 1969 draft, Gullett appeared in only 11 games in the minor leagues before being fasttracked to the big leagues in 1970, when he was 19. In the National League Championship Series in 1970, the Reds swept a powerful Pirates team in three games, with Gullett, in relief, tallying saves in Games 2 and 3. Despite his youth, he was not awed by the experience. “I wasn’t nervous a bit going in there,” he said during the series. “Talking to all these reporters is a lot tougher than facing Willie Stargell or Roberto Clemente.” The Reds lost the World Series in five games to the Baltimore Orioles that year and fell to the Oakland A’s (another dynasty of the 1970s) two years later. Still, the best years were yet to come, both for the team and for its star left-hander. After his playing days were over, Gullett retired to a farm near his hometown, where, with his wife, Cathy, he grew tobacco and other crops. Information about his survivors was not immediately available. Interviewed in 1989 by the Los Angeles Times, Gullett said that it took time to get over his premature exit from baseball. “I looked at myself and I was only 31, 32 years old,” he said. “It kind of bothered me mentally. It was mentally tough to watch games.” Even in regret, however, he maintained his trademark humility. “It was just unfortunate in my career,” he added. “If I had stayed healthy, there is the chance I could have been very successful.”

Your plane could be delayed or something valuable lost. Try to shortcircuit potential problems. Use a checklist when packing, keep valuables close to you, and take lots of books and CDs in case you have to wait out a delay. In spite of it all, have fun!

Someone you work with might need a sympathetic shoulder to cry on today, Libra. Stresses on the job extend beyond everyone’s capacity to endure, so don’t be surprised if at some point a colleague sheds a few tears. You might find your patience pushed beyond its normal limits. On days like this it’s best to work as quickly as you can, stay focused, and go for a drink after you leave work. Then have a nice walk home!
