he Electrical Industry and Irrigation Workers Union (UTIER by its Spanish initials), which represents Puerto Rico Electric Power Authority (PREPA) workers, asked the court this week to reject the Financial Oversight and Management Board’s (FOMB) petition to eliminate a pair of collective bargaining agreements (CBAs). The oversight board earlier this month said PREPA has two remaining CBAs -- one with UTIER, with approximately 139 active members remaining, and one with the Union of Independent Professional Employees, with some three active members remaining. Since the oversight board’s arrival, the plan to dismantle PREPA has been accelerated, the union argued. “The plan was conceived in no small part for the express purpose of ridding PREPA of its unions, in particular UTIER,” the union said. “Looking at the facts, there can be no doubts about this. The Oversight Board and PREPA have attacked UTIER from every angle.” UTIER added that the public-private partnership agreements with LUMA Energy and Genera PR were used to hinder the unions. “Now, the FOMB wants to deprive UTIER of its collective bargaining agreement,” the union said. “The document that so many fought long and hard for to establish a fair and equitable labor relation with PREPA. Moreover, the Oversight Board expects to take down
the Retirement System with it.” The oversight board argues that the rejection of UTIER’s collective bargaining agreement (CBA) is the only viable path for PREPA’s reorganization. “However, the Oversight Board has not demonstrated the quantum of proof necessary to justify the rejection of the CBA,” the union said. “Furthermore, it has failed to engage in the required good faith negotiations that could potentially lead to a reasonable solution for all parties involved. Therefore, UTIER respectfully requests that the Court deny the Oversight Board’s request for CBA rejection.” Under the Bankruptcy Code, “the trustee, subject to the court’s approval, may assume or reject any executory contract or unexpired lease of the debtor. Generally, the only issue before a court is whether assumption or rejection is based on business judgment. Thus, to satisfy the business judgment test, the debtor must show that the proposed course of action will be advantageous to the estate and the decision is based on sound business judgment.” In a separate motion filed Jan. 9, the PREPA retirement system said the utility couldn’t modify its pension obligations by rejecting its contract with its union. The retirement system, known as the Sistema de Retiro de los Empleados de la Autoridad de Energía Eléctrica, argued that it was a creditor, and its governance can’t be changed by the debt plan.

Measure would implement electronic data system in ambulances By THE STAR STAFF
I
n order to shorten the response time in a medical emergency, Sen. Keren Riquelme Cabrera on Wednesday announced the filing of a measure that seeks to implement an electronic data system in ambulances so that their operators are aware of the services and specialists available at each of the hospitals in their service areas. The measure also includes the implementation of a global positioning system (GPS) that tells the ambulance driver the travel time to each facility, with traffic data. “After talking with personnel from the Department of Health, the Office of the Insurance Commissioner, the Assistant Secretary for Regulation and Accreditation of Health Facilities (SARAFS), the Puerto Rico Hospitals Association, and medical services administrators, we determined that in order to expedite the process of medical help to emergency patients, ambulances must be equipped with a database with updated data in real time on the capacities of hospitals

he first clash in the new House legislative session continues to escalate. After Speaker of the House of Representatives Rafael “Tatito” Hernández Montañez voiced his support for Citizen Victory Movement (MVC by its Spanish initials) Rep. Mariana Nogales Molinelli, who had criticized Alternate Minority Leader Gabriel Rodríguez Aguiló for asking for a House Ethics probe against her, the New Progressive Party lawmaker said he will file an ethics complaint against Nogales Molinelli. Hernández Montañez hesitated to refer the matter to
the Ethics Committee because no accusation of irregularity had been made. He insisted, however, that he will not hesitate to do so at the appropriate time. Rodríguez Aguiló highlighted the double standard with which he said the statements made by the Nogales Molinelli were measured. The MVC lawmaker challenged Rodriguez Aguilo to present any complaint to the corresponding forum “if he truly has his pants on properly.” “She [Nogales Molinelli) has been on bail for 230 days and that has never happened in the House of Representatives,” Rodríguez Aguiló said. “Since she challenged me, I have already made the official arrangements and I must be receiving the official report from the Court and
I guarantee that I will file the complaint in the Ethics Committee.” Nogales Molinelli was charged last year along with her mother and their Ocean Front Corporation for tax evasion. The previous December she was fined $2,000 and publicly rebuked by the House. Last month, Judge Iraida Rodríguez of the Court of First Instance of San Juan ruled against Nogales Molinelli, finding cause to arrest on two of the 24 charges that the Office of the Special Independent Prosecutor Panel had filed against her. The judge found evidence on charges of perjury and ideological falsehood for omissions in a Government Ethics Office report.
Forensic Sciences Institute incorporates new lab information system By THE STAR STAFF
T
he Forensic Sciences Institute (ICF by its Spanish initials) has incorporated a new laboratory information management system that will streamline the registration of evidence received by the agency, provide users with the status of the analysis of the evidence and provide access to the results of forensic analysis to authorized officials, ICF Executive Director Dr. Maria Conte Miller announced Wednesday. Conte Miller emphasized in a written statement that “this is another important step in the transformation of the Institute to make our operation more efficient, offer greater accessibility to the expert analyses we carry out and give greater transparency to our processes.” The laboratory information management system, called “Beast,” integrates in a single database all the scientific
activities of each of the ICF’s laboratories and divisions. The ICF invested $700,000 in the project. “Beast began to be implemented in 2022 with the integration of the Medicolegal Investigation Division, Forensic Interviewers and the Evidence Receipt area of all laboratories,” the ICF executive director said. “From the registration in the area of delivery of corpses, the documentation of the pathologists’ cases and the data for the interviews in the identification processes carried out with the families, all are registered in this new system.” This week, the Toxicology, Digital Evidence, Doubtful Documents, Firearms (Ballistics) and Controlled Substances Laboratory have been integrated, Conte Miller said. The Division of Forensic Investigators will soon be recording its scene investigation reports, she said. “Our investigators use the CRIME PAD app to document the scene and record evidence. They have the app on a
tablet that syncs with Beast,” the official said. “With the integration of ‘CRIME PAD’ into ‘Beast,’ the documentation of the evidence from the scenes is digitized and made available to the users of the system.”

Governor: Infrastructure still a concern as classes resume By THE STAR STAFF

ov. Pedro Pierluisi Urrutia said Wednesday that the information he has received is that the resumption of classes this week at the island’s public schools went off without major setbacks. Nonetheless, the issue of infrastructure and short columns remains a concern, he said. Students returned to classes on Tuesday. “We are having a good school restart based on all the information that comes to me, that the secretary provides me,” the governor said during a visit to the Dr. Pedro Albizu Campos second unit school in Aguas Buenas. “At the same time, the materials are there because the debit card, the P-card, is being used by school principals, so there is no reason for materials to be missing when they have that debit card available.
I would say the biggest challenge we still have is the infrastructure. This particular school is in very good condition. I visited here at the beginning of last semester. I saw, along with Mayor Karina Nieves, some deficiencies. We pointed them out and the Public Buildings Authority, obviously in collaboration as a team with the [Education] Department, addressed them.” The Education Department is running an ongoing maintenance program. “For example, right now we have more than 100 schools where short columns are being repaired, they’re the ones that are missing, they’re the ones that had the most short columns that were the most challenging,” Pierluisi said. “When that happens, we often fall into what is called ‘interlocking,’ That may mean that students have to go to another school at a different time while that major construction is taking
place, but we hope that by the end of this year practically all the issues of the short columns will be resolved.” “So that what we are left with is again, situations such as painting, roof sealing that is being done …” the governor added. “And there are other things such as, for example, what we suffered in the summer, the heat that was taken care of by buying fans. A feasibility study is being done on what would be the cost of installing air conditioners in all schools; our private schools, most of them do not have air conditioning either. And, it’s not just installing the air conditioning, it’s that the electrical substation that serves the particular school has the capacity for that. “So everything is being taken care of. It’s a smooth process, but I have to say that this restart is happening in a very good way.”

Spanish teachers difficult to recruit, Education chief says By THE STAR STAFF

ducation Secretary Yanira Raices Vega said Wednesday that Spanish teachers have become difficult to recruit. “It’s hard [recruiting] for them to be prepared,” the secretary said in response to questions from the press. “Maybe there is no interest in the subject of Spanish to obtain the certification.” Asked if the same thing happens in other subjects, Raíces Vega said that it also happens in

the subjects of English, mathematics, science and special education. “In the most challenging [subjects],” she said. In the subjects of social studies, history, physical education and fine arts, the official said she has no problem recruiting teachers. When asked if universities are aware of the need to certify teachers in the aforementioned areas, and if they convey that information to students, the secretary replied: “It’s a decision on the part of the students, and I’m constantly
in constant communication with the universities.” “But the tendency I’m seeing is in Spanish,” Raíces Vega said. “My teachers are going away and they are not entering in the same numbers that they are leaving.” She noted that for the new school semester, which began Tuesday, 84 positions are vacant between directors and students. Education secretary encourages parents to pick up grades on Friday By THE STAR STAFF

ducation SecretaryYanira RaícesVega on Wednesday reminded those in charge of students that it is their responsibility to pick up grades on Friday. “The most important thing this Friday for me is that it is one of those days that dad, mom or the person in charge comes to pick up the report card that is sent to the school and prepare us for this Friday because the schools, the teachers, are already finishing the
reports,” Raíces Vega said during a visit with Gov. Pedro Pierluisi Urrutia to the Dr. Pedro Albizu Campos second unit school in Aguas Buenas. “In addition, the multidisciplinary team can also receive mom and dad or the person in charge to work on socio-emotional issues.” The Education secretary said her wish is that this year 80% of those in charge will be able to obtain the students’ grade reports, unlike on previous occasions when they were not sent by mail or with the students.
“Well, last time it was at 73 percent -that hadn’t been seen in Education in years,” she said. “So I’m hoping to get to 80 percent. Not even when they were [required to pick up the grades in person] did it reach 73 percent.” During the administration of then-Gov. Alejandro García Padilla, going to the schools to pick up report cards became a requirement to avoid referrals to the Family Department. That guideline was eliminated under the next governor, Ricardo Rosselló Nevares. “I think it’s a matter of the message, to
tell mom and dad to encourage them in a positive way that we’re here waiting, that we want to help them, support them in the process of educating their children,” Raíces Vega said. “It’s mom and dad’s responsibility to come. I want to convey a message of exhortation in a positive way, and not be saying that I’m going to be doing this to you, I’m going to take this away from you. So far I have to tell you that 73 percent have responded. I hope to get to 80 percent, and little by little make that culture and keep them informed.

Union seeks order for commonwealth to enforce collective bargaining agreements By THE STAR STAFF
A
s the Official Committee of Retirees (COR) reported on Wednesday that it was ceasing operations, the American Federation of State, County & Municipal Employees (AFSCME) asked the Title III court that worked on the commonwealth’s bankruptcy to require the government to honor collective bargaining agreements (CBAs) as part of the exit plan. Since its creation in 2017 by the U.S. Trustee under the PROMESA Law and the Bankruptcy Code, the Official Committee of Retirees has represented some 167,000 pensioners of the Central Retirement System, Teachers and the Judiciary in the bankruptcy process of Puerto Rico. The COR, however, announced that it was ceasing
operations because the order confirming the adjustment plan for the commonwealth “is final, firm and unappealable.” AFSCME argued that employees were being actively harmed as the commonwealth, whose debt adjustment plan was confirmed in March 2022 to restructure some $33 billion in debt and $55 billion in pension liabilities, had failed to execute the CBAs for almost two years. AFSCME was the only labor organization to support the plan. AFSCME’s early support served as a catalyst for settlements by other stakeholders. “A critical underpinning of AFSCME’s rationale in being a Plan Support Party was that AFSCME would have five-year CBAs deemed fully-enforceable as of the Plan’s Effective Date,” the union said.
However, that has yet to happen. Employees, for instance, earned an upside bonus of about $11,000 in 2022. Because officials were not implementing the agreements, workers could not use that money for their defined contribution accounts, reducing their retirement savings, AFSCME argued. AFSCME asked the court to enforce the plan and require that the CBAs be executed. “AFSCME respectfully submits that judicial intervention is necessary to ensure
that thousands of AFSCME-represented public employees continue to serve the commonwealth and its citizens with enforceable collectively bargained-for contract rights,” AFSCME said in a response supporting the consummation of the debt adjustment plan.
Fiscal board rejects proposed tax relief for investors in local bonds By THE STAR STAFF
A
fter conducting a preliminary review, the Financial Oversight and Management Board rejected two bills from the island House of Representatives, one of which would establish a tax credit for residents who suffered losses on investments in Puerto Rico bonds. In a letter Wednesday addressed to Rep. Ángel Morey Noble, the oversight board’s legal adviser, Jaime A. El Koury said House Bill (HB) 1537 and HB 1582 are inconsistent
with the Certified Commonwealth Fiscal Plan. HB 1537 establishes an amnesty program for taxpayers with outstanding tax liability, while HB 1582 establishes a tax credit for Puerto Rico residents who lost money on investments made in Puerto Rico bonds. The oversight board said “the Bills are inconsistent with the Fiscal Plan, to the extent that HB 1537 deposits 75% of funds collected through the amnesty program in the Pension Reserve Trust, generating a loss to the Commonwealth’s General Fund,” the letter said.
“HB 1582 favors certain creditors while establishing sizable tax credits, without providing offsetting savings or identifying new revenues to compensate for implementation costs.” The board said it appreciates the opportunity to review the bills under Puerto Rico Oversight, Management and Economic Stability Act, commonly known as PROMESA, and shares a desire to collect unpaid taxes, provide some relief to Puerto Rico’s residents who may be struggling to pay their tax debts, and support residents’ economic security. HB 1537, among other things, establishes an amnesty program for taxpayers with outstanding tax liability incurred prior to Dec. 31, 2021, inclusive of previous tax years up to that date. The amnesty would allow taxpayers to either pay the entirety of their outstanding tax liability immediately and avoid paying interest and penalties owed, or pay through an installment plan over a period of up to four years, with a waiver of penalties and a reduction of interest due. The amnesty applies to income, excise, sales, withholding, and special tax debt. “The Oversight Board’s estimates show that the implementation of the proposed amnesty program would lead to the collection of approximately $76.8 million in owed taxes. However, as proposed by the Bill, 75% of amnesty collections would go to the Pension
Reserve Trust instead of the General Fund,” the board said. “Therefore, while HB 1537 would likely increase overall tax revenues, the General Fund would lose approximately $20 million over the next four years.” In addition to the $20 million General Fund revenue loss, the oversight board noted, HB 1537 would also likely entail additional administrative expenditures, violates the Plan and Confirmation Order for the commonwealth and favors certain creditors over others.

Appeals court seems skeptical of Trump’s immunity claim By ALAN FEUER, CHARLIE SAVAGE, EILEEN SULLIVAN and GLENN THRUSH
A
federal appeals court expressed deep skepticism earlier this week about former President Donald Trump’s claim that he is immune from charges of plotting to subvert the 2020 election, suggesting that it is unlikely to rule in his favor on a central element of his defense. As Trump looked on, a three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit peppered his lawyer D. John Sauer with tough questions about his assertion that his client could not be prosecuted for actions he took while in the White House. The judges seemed incredulous when Sauer said a president could use the military to assassinate a political rival and be shielded from prosecution unless the Senate first convicted him at an impeachment proceeding. At another point, Judge Karen LeCraft Henderson, the panel’s sole Republican appointee, seemed to reject a central part of Trump’s argument: that his efforts to overturn his loss to Joe Biden cannot be subject to prosecution because presidents have a constitutional duty to ensure that election laws are upheld. “I think it’s paradoxical to say that his constitutional duty to take care that the laws be faithfully executed allows him to violate the criminal law,” Henderson said. Still, the panel seemed torn at times about how broadly it might rule, with Henderson suggesting that a sweeping decision to deny immunity to former presidents could result in a flood of partisan prosecutions. She also raised the prospect of sending the issue back to the trial judge, Tanya Chutkan, for additional scrutiny on issues such as whether Trump’s actions should be thought of as official or private. Such a move would play into the former president’s desire to delay a trial on the election charges. Regardless of how the panel ultimately rules, the issue of immunity is likely to reach the Supreme Court, which is already hearing another crucial question about whether Trump can be removed from state ballots.
The pace and outcome of the immunity question will play a major role in deciding when — or whether — Trump will go to trial in the election interference case. They could also go a long way in determining the timing of the three other criminal trials Trump is facing in the months ahead. Trump attended the hearing in person even though he was not required to be there. Wearing a dark blue suit and a red tie, he sat at the far right of his lawyers’ table, sometimes whispering to another attorney, Will Scharf. He was largely stone-faced, but when the panel’s two Democratic appointees — Judge J. Michelle Childs and Judge Florence Pan — were questioning Sauer, Trump leaned forward in his chair and stared intently at them. Several times while James Pearce, who represented the government, was speaking, Trump and his lawyers exchanged notes on a yellow legal pad. The question of immunity has already bounced around various federal courts for more than three months. Chutkan has put the underlying case, in which Trump is facing four criminal counts related to his efforts to remain in office after his election loss, on hold until the issue is resolved. But winning the immunity appeal has always been only one of Trump’s goals. He is also hoping that protracted litigation can eat up enough time to postpone the election trial — now set to start in early March — until after Election Day. If he retakes the White House, he could then seek to order the charges against him to be dropped or try to pardon himself. In one tough moment for Trump during the hearing Tuesday, Henderson rebutted Sauer’s argument that for more than 200 years, American courts had never sat in judgment over actions that a president had taken while in office. Henderson pointed out that until Trump was indicted, courts had never had to consider the criminal liability of former presidents for things they had done while in the White House. Still, Henderson, echoing one of Sauer’s arguments, expressed concern that allowing the election case to go to trial could open the “floodgates” to future

Pearce, speaking for the prosecution, disagreed, arguing that Trump was an aberration and that prosecuting him would not result in an onslaught of partisan indictments. He maintained that it has long been clear — at least since Richard M. Nixon accepted a pardon after resigning during the Watergate scandal — that presidents can be charged for crimes they committed in office. Pan and Childs appeared to be unified in expressing doubt about Trump’s immunity claims. At one point, Pan presented Sauer with a hypothetical situation, asking if a president could be criminally charged for ordering SEAL Team 6 — a military commando unit — to assassinate a political rival. Sauer said that a prosecution would be possible in that situation only if the president had first been found guilty in an impeachment proceeding. When Pearce addressed the court, he seized on that example. He warned of “an extraordinarily frightening future”
if a president could order the military to murder a rival and then escape criminal liability by simply resigning before he could be impeached or otherwise avoid a conviction in the Senate. Pan also noted that Sauer had conceded some occasions when presidents were not immune from prosecution for official acts, if only after being convicted at an impeachment proceeding. She said Trump’s broader claims about immunity would therefore hinge on whether that was the only circumstance when courts could sit in criminal judgment of a president’s

Menéndez, in defiant speech, says bribery case against him is ‘baseless’ By NICHOLAS FANDOS
S
en. Robert Menendez, D-N.J., took to the Senate floor earlier this week to deny charges that he accepted bribes to benefit the governments of Egypt and Qatar and defiantly warned colleagues that they could be next. Menendez, in an extraordinary speech, accused the Justice Department of targeting him in a public smear campaign, saying prosecutors brought indictments based on “baseless conjecture, not facts” and dribbled out new accusations to erode his public standing. He explained his conduct, laid out in the federal charges, as acts of routine statesmanship, not corruption. And he claimed, without further explanation, that it would become clear at trial that there was “no evidence” that gold bars and cash authorities found in his home were bribes. “The United States attorney’s office is engaged not in a prosecution, but a persecution,” Menendez said, growing emotional at times. “They seek a victory, not justice.” The remarks were highly unusual. Lawmakers are typically loath to discuss federal charges, particularly in the halls of Congress. Yet Menendez, a pugnacious fighter who beat back corruption charges once before, addressed his remarks directly to colleagues, including many who have called on him to resign. “I don’t want you to lose sight of how dangerous this precedent would be to all of you,” the senator said, suggesting provocatively that the government’s approach, if successful, could make it a crime to advocate for a foreign government to buy American aircraft or agricultural goods. That view differed sharply from the one prosecutors in New York City have advanced. Since September, a series of updated indictments have charged Menendez, together with his wife, Nadine, with using his Senate office to benefit foreign governments and allies at home in exchange for lucrative gifts, including mortgage and car payments, tens of thousands of dollars in cash and more in gold bars. Though many of the actions they list — including Senate statements, legislation and personal phone calls — are not in themselves improper, the indictments have cited encrypted messages, secret dinners and even internet search history that together paint a portrait of a senator who they say knowingly flouted his oath. Menendez’s speech did not address the government’s accusations that he also used
his leverage to try to throttle state and federal prosecutions of key allies in exchange for bribes. Nicholas Biase, a spokesperson for the U.S. attorney’s office in NewYork City, which brought the charges, declined to comment. The case is scheduled to go to trial in May, and Menendez has not ruled out running for reelection this fall despite formidable primary challengers. On Tuesday, Menendez took particular umbrage at the charge that he conspired to act as a foreign agent of Egypt between 2018 and 2022. The charge has little precedent, and prosecutors have said it stemmed from actions by Menendez to increase U.S. aid and military sales to Egypt in exchange for the payoffs. Avoiding many of the indictment’s particulars, the senator argued that he took actions in relation to Egypt based solely on his senatorial judgment and typical foreign policy considerations. He ticked through a series of actions he had taken to punish or criticize Egypt over its human rights record and other issues over the years. “Does any of this sound like I was on the take with Egypt?” he said, asserting one could not be a critic of a totalitarian state and its agent at the same time. He similarly sought to rebut claims that he had helped the government of Qatar as part of an arrangement involving a New Jersey business developer seeking a multimilliondollar investment from a fund run by a Qatari sheikh. Prosecutors said the senator supported Senate legislation and issued a public statement praising the Gulf nation to help the developer, who rewarded him with gifts to secure business. Menendez, though, told fellow senators that he had “received nothing, absolutely nothing, from the government of Qatar” for his praise. He criticized the indictment for including photos of watches the developer offered to buy him “but no proof of receiving any such gift.” As for his public statements on Qatar, “That give and take, that carrot and stick, that cajoling and rewarding is the essence of diplomacy,” he said. Menendez said that the prosecution had taken a toll. “I am suffering greatly as a result of what they have done,” he said, apparently choking back tears. “After 50 years of public service, this is not how I wanted to celebrate my golden jubilee. But I have never violated the public trust.”

Surprised by new details about Austin’s health, White House orders review By PETER BAKER
T
he White House was caught off guard once again earlier this week when it learned that Defense Secretary Lloyd Austin had been diagnosed with prostate cancer a month ago and had surgery to treat the disease under general anesthesia on Dec. 22 without notifying either President Joe Biden or his staff. The new revelations exacerbated frustration in the West Wing, where officials were still dealing with the discovery that Austin, 70, had been secretly hospitalized last week for complications resulting from a condition that the Pentagon did not disclose even to the White House until Tuesday morning. While aides to the president said he would not fire Austin, they acknowledged the breakdown in communications and moved to assert new discipline over the administration. Jeffrey Zients, the White House chief of staff, ordered a review of procedures and sent a directive to Cabinet secretaries making clear that they are to inform the White House when they are unable to perform their duties. “Notify the Offices of Cabinet Affairs and White House Chief of Staff in the event of a delegation of authority or potential delegation,” Zients wrote in the memo, which was obtained by The NewYork Times. “This notification should occur when agencies anticipate or are preparing for a delegation of authority and again when the delegation occurs.” He added that he wanted any such notification in writing. White House spokesperson John Kirby said Biden’s “first and foremost concern is the secretary’s health” and that the president still had “full faith and confidence” in Austin and would keep him until the end of his term. But Kirby acknowledged concerns with the secrecy. “It’s not good,” he told reporters at a briefing. “It’s certainly not good, which is why we want to make sure it doesn’t happen again.” Republicans remained dissatisfied. “The failure to notify Congress of his inability to perform his duties was a clear violation of the law,” said Sen. Roger Wicker of Mississippi, the ranking Republican on the Senate Armed Ser-
vices Committee. “It remains unclear who decided to ignore federal law, but there must be accountability. An internal review — ordered by the same chief of staff who played a part in this crisis — is woefully inadequate.” The president was not told until Thursday that Austin had been taken by ambulance to Walter Reed National Military Medical Center in Bethesda, Maryland, three days earlier, and the Pentagon did not make it public until Friday evening. Even then, the Pentagon said only that he was being treated for complications from “an elective medical procedure.” Austin did not even reveal the specifics of his condition in a telephone call with the president Saturday, according to White House officials. The White House only learned Tuesday morning that Austin had been diagnosed with prostate cancer, at which point Zients informed Biden. Kirby confirmed that the White House likewise did not know that the Dec. 22 procedure involved surgery under general anesthesia, which normally would trigger the transfer of a defense secretary’s power to his deputy. A statement released later Tuesday by Austin’s doctors at Walter Reed disclosed that he had been diagnosed in “early December” and did not describe the resulting surgery as “elective.” Austin was brought back to the hospital on Jan. 1 after experiencing nausea with “severe abdominal, hip and leg pain,” according to the doctors, who determined that he had developed a urinary tract infection. He remains hospitalized and the doctors said they “anticipate a full recovery although this can be a slow process.” The White House memo to the Cabinet reflected the sense of consternation that the nation’s top defense official could be in the intensive care unit for so long without the president or other major national security officials being aware of it. Even Austin’s deputy secretary, who would be called upon to act in a crisis in his absence, was not told at first that he was in the hospital. While Biden has been described as understanding, people close to the White House recounted a deep frustration and bafflement among some on
the president’s team. Austin, a reserved retired general, does not have a particularly intimate relationship with Biden or his team, but he is well liked and deeply respected, making the situation all the more upsetting to them. For days, White House officials pressed the Pentagon to disclose more about the medical issues and were flabbergasted that it took so long. Austin’s secrecy has unwittingly provided critics with ammunition to accuse Biden of not being in full control of his administration and raised questions about how the 81-year-old president would handle a health crisis of his own. The Defense Department has initiated a 30-day review of what happened and how its procedures should be changed if necessary. In a memo, Kelly Magsamen, Austin’s chief of staff, on Monday ordered Jennifer Walsh, the department’s administration and management director, “to identify the relevant facts and circumstances during this period and evaluate the processes and procedures through which the deputy secretary of defense was notified that she should carry out the functions and duties of the secretary of defense.” In his memo Tuesday, Zients told all Cabinet departments to send him their current procedures by Friday so he
can evaluate them to determine if they need adjustment. He made clear that power should be transferred “when a cabinet member is traveling to areas with limited or no access to communication, undergoing hospitalization or a medical procedure requiring general anesthesia, or otherwise in a circumstance when he or she may be unreachable.” Austin participated in a secure conference call on the morning of New Year’s Day with Biden, Secretary of State Antony Blinken, National Security Adviser Jake Sullivan and other officials about operations in the Middle East, according to the White House. At some point later that day, Austin experienced what a spokesman said was “severe pain” and was taken to Walter Reed. Austin has acknowledged the lack of transparency. “I recognize I could have done a better job ensuring the public was appropriately informed,” he said in a statement on Saturday. “I commit to doing better.” White House press secretary Karine Jean-Pierre pointed to that as an acceptance of accountability in explaining why the president has remained supportive of his defense chief. “Secretary Austin was very clear,” she said, “and we appreciate that he had taken responsibility for this.”

Dow, S&P 500 retreat as yields edge up ahead of data, earnings T
he S&P 500 and Dow lost ground and closed lower on Tuesday, pressured by a modest rise in Treasury yields as investors assessed the timing and size of any Federal Reserve interest rate cuts in 2024 ahead of inflation data this week. At World Court, Israel to confront accusations of genocide By ISABEL KERSHNER and JOHN ELIGON
T
he International Court of Justice, the United Nations’ highest judicial body, will begin hearings this week in a case brought by South Africa that accuses Israel of committing genocide in the Gaza Strip. The hearings, the first step in a lengthy process should the case go forward, will be the first time that Israel has chosen to defend itself, in person, in such a setting, attesting to the gravity of the indictment and the high stakes for its international reputation and standing. Genocide, the term first employed by a Polish lawyer of Jewish descent in 1944 to describe the Nazis’ systematic murder of about 6 million Jews and others based on their ethnicity, is among the most serious crimes of which a country can be accused. In its submission to the court, South Africa cited that lawyer, Raphael Lemkin, to expand the definition of genocide. South Africa, whose post-apartheid government has long supported the Palestinian cause, accused Israel of actions in Gaza against Hamas that are “genocidal in character.” It says Israel has killed Palestinian civilians, inflicted serious bodily and mental harm, and created for the residents of Gaza “conditions of life calculated to bring about their physical destruction.” More than 23,000 Palestinians have been killed over the past three months, a majority of them women and children, according to health officials in Gaza. And most of the enclave’s 2.2 million residents have been displaced since the war began, increasing the danger of disease and hunger, according to international organizations. The allegation, which Israel categorically denies, is laden with a particular significance in Israel, a country founded in the wake of the near wholesale destruction of European Jewry and that soon after became a haven for Jews expelled by the hundreds of thousands from Arab lands. Israel, a signatory to the 1948 international Convention against Genocide, is keeping the details of its defense for the court. But Israeli leaders say South Africa’s allegations pervert the meaning of genocide and the purpose of the convention. A more fitting case, they say, could be brought against Hamas, an internationally labeled terrorist organization that is the target of Israel’s military campaign in Gaza. “There’s nothing more atrocious and preposterous than this claim,” President Isaac Herzog of Israel said Tuesday. “Actually, our enemies, the Hamas, in their charter, call for the destruction and annihilation of the state of Israel, the only nation state of the Jewish people.” Ayelet Shaked, a former Israeli justice minister, called the genocide allegations a “blood libel,” a reference to the centuries-old antisemitic trope that Jews kill non-Jewish babies to drink their blood, and asserted that the South African government was using the case to distract its own public from their country’s domestic problems. The International Court of Justice adjudicates disputes between states, and the initial hearings in the Israel case will take place Thursday and Friday in The Hague.

General Assembly passed a nonbinding resolution, put forth by the Arab Group and the Organization of Islamic Cooperation, calling for a cease-fire, and the Security Council passed a binding resolution, also promoted by Arab countries, calling for the delivery of more humanitarian aid. South Africa filed an 84-page application to the court in December laying out its claims and citing statements by Israeli officials, which it says “constitute clear direct and public incitement to genocide, which has gone unchecked and unpunished.” Israelis have pointed out that some of the evidence South Africa cites is slim. Among the examples is a comment made in a television interview by an Israeli pop star, Eyal Golan, who said Israel should “erase” Gaza. In a statement released late Tuesday, Israel’s attorney general and state prosecutor said any calls for intentional harm to civilians may amount to the criminal offense of incitement. “Currently, several such cases are being examined by Israeli law enforcement authorities,” the statement added. South Africans have long empathized with the Palestinian people, equating their life in Gaza and under the occupation in the West Bank with the oppression suffered under apartheid. Nelson Mandela gave explicit voice to this connection, saying in a 1997 speech, “We know too well that our freedom is incomplete without the freedom of the Palestinians.” That sentiment is driving South Africa’s case, said Ronald Lamola, the country’s justice minister, who will lead the delegation at The Hague. “We do believe that it is important for a state like South Africa that has experienced apartheid discrimination to stand firm with the people of Palestine,” he said in an interview.
Israel, for its part, says it did not choose war but was forced into it after Hamas led a cross-border assault against it Oct. 7. About 1,200 people, most of them civilians, were killed in the attack, according to Israeli authorities, making it the deadliest single day in Israel’s 75-year history and for Jews since the Holocaust. More than 100 of the 240 captives seized Oct. 7 are still being held in Gaza. U.N. rapporteurs said in a statement Monday that the Hamas-led rampage, which included murder, hostage-taking, rape and mutilation, could amount to war crimes and, given their scope, perhaps also crimes against humanity. A final ruling could take years, but as an emergency provision, South Africa is calling on the court to order Israel to immediately halt its military operation. The court’s decisions are typically binding, though it has few means of enforcing them. In 2004, the court issued a nonbinding opinion that Israel’s construction of its security barrier inside the territory of the occupied West Bank was illegal and that it should be dismantled. Twenty years later, the system of walls and fences is still standing. Even if Israel was to comply with an injunction, Hamas, which is not bound by the laws of war, would not be compelled to similarly stop fighting. Israel’s military insists that it is prosecuting the war in line with international law. Officials point to the millions of messages, sent by various means, telling Gaza’s civilians to evacuate to safer areas ahead of bombings, and say they are constantly working to increase the amount of aid entering Gaza. The death toll in Gaza, they say, is attributable in part to the use by Hamas of residential areas and civilian structures, including schools and hospitals, to launch attacks, store weapons and hide fighters. Rear Adm. Daniel Hagari, chief spokesperson for the military, categorically refuted the genocide accusation and said the court should instead focus on how the war started Oct. 7. “We were the ones who were butchered,” Hagari said. In a statement, Hamas welcomed South Africa’s decision to bring the case and called on “all countries to submit similar files and requests to competent national and international courts against this Nazi entity,” referring to Israel. The United States, Israel’s most important ally, denounced South Africa’s petition. John Kirby, the National Security Council spokesperson, described it as “meritless, counterproductive, completely without any basis in fact whatsoever.” While the South African government maintains that it is pursuing its case to stop a genocide, analysts say officials were more likely motivated by domestic and diplomatic political pressures. In the two years that Russia has pursued its war in Ukraine, South Africa has vigorously resisted condemning Russia, a crucial ally. In taking that stance, South African officials often pointed to what they say is a double standard: U.S. officials demanded support for Ukraine’s sovereignty but paid little attention to Palestinian demands, they said.

The buses weren’t fully operating, so people were jumping on the pickup trucks that are open in the back.” “There was a lot of desperation,” she added. “Since this gangster disappeared, everyone
has been in constant fear.” Noboa, who has prioritized restoring security to a country awash in gang violence fueled by a flourishing drug trade, had earlier declared a state of emergency and deployed more than 3,000 police and military officers to search for the escaped gang leader, Adolfo Macías. The 60-day declaration imposes a nationwide overnight curfew and allows the military to patrol streets and take control of the prisons. “The time is over when drug-trafficking convicts, hit men and organized crime dictate to the government what to do,” Noboa said in a video announcing the state of emergency Monday, adding that it was necessary for security forces to take control of Ecuador’s prison system. That decision, prison experts said, may have led to the escape of Macías and the prison uprisings. Some security experts believe that as many as one-fourth of the country’s 36 prisons are controlled by gangs. Noboa has vowed to retake control of the prisons, which have become both gang headquarters and recruiting centers. Last week, he announced that he was seeking to hold a referendum on security measures, including harsher sentences for crimes such as murder and arms trafficking, and expanding the role of the military. Noboa, the center-right scion of a banana dynasty, took office in November after an election dominated by worries about safety and the economy. Violence has spiraled in recent years as gangs have battled for control of lucrative drug-trafficking routes that transport narcotics to the United States and Europe.
Those fears were amplified by the assassination on the campaign trail of another presidential candidate, Fernando Villavicencio, who had said not long before his killing that he had been under threat from Los Choneros. Macías is perhaps the most well known of the gang leaders running drug operations from behind bars, and his group is believed to have been one of the first in Ecuador to forge ties with powerful Mexican cartels. Macías, who is serving a 34-year sentence for crimes that include drug trafficking, escaped from prison once before, in 2013. He became the leader of Los Choneros around 2020 and has presided over the gang’s activities from his cell in the Guayaquil prison, part of a compound that holds around 12,000 inmates. Macías was found missing from his cell during a sweep for contraband. His disappearance came as he and other highprofile criminals were scheduled to be sent to the maximumsecurity prison, according to officials. A top government official suggested this week that Macías
may have learned of his imminent transfer through a government leak. “That would be very serious,” said the official, Esteban Torres, because “it would mean that there is rot at the highest levels of government.” Securing Ecuador’s prisons is vital to making sure efforts to root out corruption are effective, said Will Freeman, a fellow for Latin America studies at the Council on Foreign Relations. “You need to make sure that when you actually send people to prison for money laundering or working in complicity with organized crime as public officials, that the punishment is meaningful and that they’re not just continuing to operate criminal rings from jails,” he said. He said a state of emergency could help stabilize the prisons, since the entity tasked with running the prison system had failed to control gangs, but that it was not a long-term solution. He noted that Noboa’s predecessor had repeatedly imposed similar measures. “Obviously they didn’t really durably improve the situation,” he said.
France gets its youngest and first openly gay prime minister By ROGER COHEN

n a typically bold bid to revitalize his second term, President Emmanuel Macron named Gabriel Attal, 34, as his new prime minister, replacing Élisabeth Borne, 62, who made no secret of the fact that she was unhappy to be forced out. Attal, who was previously education minister and has occupied several government positions since Macron was elected in 2017, becomes France’s youngest and first openly gay prime minister. A recent Ipsos-Le Point opinion poll suggested he is France’s most popular politician, albeit with an approval rating of just 40%. Macron, whose second term has been marked by protracted conflict over a pensions bill raising the legal retirement age to 64 from 62 and by a restrictive immigration bill that pleased the right, made clear that he saw in Attal a leader in his own disruptive image. “I know that I can count on your energy and your commitment to push through the project of civic rearmament and regeneration that I have announced,” Macron said in a message addressed to Attal on X, formerly known as Twitter. “In loyalty to the spirit of 2017: transcendence and boldness.” Macron was 39 when he sundered the French political system that year to become the youngest president in French history. Attal, a loyal ally of the president since he joined Macron’s campaign in 2016, will be 38 by the time of the next presidential election in April 2027, and would likely become a presidential candidate if his tenure in office is successful. This prospect holds no attraction for an ambitious older French political guard, including Bruno Le Maire, the finance minister, and

But for Macron, who is term-limited, it would place a protégé in the succession mix. “My aim will be to keep control of our destiny and unleash our French potential,” Attal said after his appointment. Standing in the bitter cold at a ceremony alongside Borne, in the courtyard of the prime minister’s residence, Attal said that his youth — and Macron’s — symbolized “boldness and movement.” But he also acknowledged that many in France were skeptical of their representatives. Alain Duhamel, a prominent French author and political commentator, described Attal as “a true instinctive political talent and the most popular figure in an unpopular government.” But, he said, an enormous challenge would test Attal because “Macron’s second term has lacked clarity and been a time of drift, apart from two unpopular reforms.” If France is by no means in crisis — its economy has proved relatively resilient despite inflationary pressures and foreign investment is
pouring in — it has appeared at times to be in a not uncharacteristic funk, paralyzed politically, sharply divided and governable with an intermittent recourse to a constitutional tool that enables the passing of bills in the lower house without a vote. Macron, not known for his patience, had grown weary of this sense of deadlock. He decided to force Borne out after 19 months although she had labored with great diligence in the trenches of his pension and immigration reforms. Reproach of her dogged performance was rare but she had none of the razzmatazz to which the president is susceptible. “You have informed me of your desire to change prime minister,” Borne wrote in her letter of resignation, before noting how passionate she had been about her mission. Her unhappiness was clear. In a word, Macron had fired Borne, as is the prerogative of any president of the Fifth Republic, and had done so on social media in a way that, as Sophie Coignard wrote in the weekly magazine Le Point, “singularly lacked elegance.” But with elections to the European Parliament and the Paris Olympics looming this summer, Macron, whose own approval rating has sunk to 27%, wanted a change of governmental image. “It’s a generational jolt and a clever communications coup,” said Philippe Labro, an author and political observer. Attal has shown the kind of forcefulness and top-down authority Macron likes during his six months as education minister. He started last summer by declaring that “the abaya can no longer be worn in schools.” His order, which applies to public middle and high schools, banished the loosefitting
full-length robe worn by some Muslim students and ignited another storm over French identity. In line with the French commitment to “laïcité,” or roughly secularism, “You should not be able to distinguish or identify the students’ religion by looking at them,” Attal said. The measure provoked protests among France’s large Muslim minority, who generally see no reason that young Muslim women should be told how to dress. But the French center-right and extreme right approved, and so did Macron. In a measure that will go into effect in 2025, Attal also imposed more severe academic conditions on entry into high schools as a sign of his determination to reinstate discipline. For these and other reasons, Attal is disliked on the left. Mathilde Panot, the leader of the parliamentary group of extreme left representatives from the France Unbowed party and part of the largest opposition group in the National Assembly, reacted to his appointment by describing Attal as “Mr. Macron Junior, a man who has specialized in arrogance and disdain.” The comment amounted to a portent of the difficulties Attal is likely to face in the 577seat Assembly, where Macron’s Renaissance Party and its allies do not hold an absolute majority. The change of prime minister has altered little or nothing for Macron in the difficult arithmetic of governing. His centrist coalition holds 250 seats. Macron wants a more competitive, dynamic French state, but any new package of reforms that further cuts back the country’s elaborate state-funded social protection in order to curtail the budget deficit is likely to face overwhelming opposition. This will be just one of the many dilemmas facing the president’s chosen wunderkind.

The secretary of defense can’t go AWOL. Neither can America. By BRET STEPHENS

decade ago, I wrote a book with the subtitle “The New Isolationism and the Coming Global Disorder.” I’ve been wrong about a thing or two (or three) over the years. I wish I had been wrong about this. Disorder comes in two varieties: disorder within a system (like a coup or revolution inside a sovereign state) or of the system itself (like the de facto collapse of the state system throughout parts of Africa and the Middle East). The former may be devastating, but it is usually containable. The latter can sometimes be a matter of quiet erosion before it becomes one of outright collapse. But its consequences are hard to predict, difficult to control and sometimes epochal in scope. We are living in an era of dissolving systems. The Biden administration struggles to gain control over illegal immigration at the southern border. It’s failing. Beijing is gradually seizing control of the South China Sea, over which one-fifth of the world’s trade passes. Nothing stops it. Iran is enriching uranium to near weapons grade. The world barely notices. Ukraine is running out of munitions. Congress is too divided to help save an ally. Hezbollah’s attacks on northern Israel and Houthi

attacks on international shipping risk a much broader Middle East war, potentially involving the United States. We seem to be careening toward it without brakes. For each of these crises, you can point to a separate cause. The collapse of governance in much of the developing world. The power of drug cartels in South America and terrorist militias in Lebanon and the Gaza Strip. The increasingly close alliance between Iran, Russia and China, forming a new axis of resentment, repression and revanchism. But there’s a deeper cause: the fading away of Pax Americana — the idea that the United States has a duty, rooted in values and interests, to police the global commons, defend embattled allies, deter anti-American dictatorships and punish major violations of international order, like Iraq’s seizure of Kuwait or Russia’s invasions of Ukraine. The thought that Washington should be the world’s cop is now considered, on a bipartisan basis, to be an idea whose time has passed. The Trumpian right wants an America that’s out only for itself; the progressive left wants to delegate the job to multilateral organizations like the United Nations. But reality is that the world doesn’t police itself, and an unpoliced world is pandemonium. I suspect we are much closer to that world — months, possibly — than most Americans appreciate. What happens when Ukraine runs out of shells or when a Hezbollah rocket hits an Israeli school? This is the context for the strange but telling story of Defense Secretary Lloyd Austin’s unannounced medical absence — at first described only as for “complications from an elective procedure” — that landed him in Walter Reed’s intensive care unit while the president, the national security adviser, the chair of the Joint Chiefs and the deputy defense secretary (who was on vacation) were left unawares. Walter Reed officials announced on Tuesday that Austin had prostate cancer surgery on Dec. 22 and that he returned on Jan. 1 because of complications. His stay appears to have been much longer than first reported. We should all wish Austin a speedy recovery. Nonetheless, the dereliction of duty here is so serious that it ought to require Austin’s immediate resignation. The job of secretary of defense is to be on the job. Imagine if the Houthis had put a hole in an American ship, requiring an immediate response. Hours could have been lost while combatant commanders tried to get direction from the Pentagon. What’s astonishing here isn’t that Austin neglected to inform his staff or the White House. It’s the nonchalance with which the administration is treating the incident. Austin has described it as a matter of poor

If this were, say, the defense minister of New Zealand, nobody would care. (Sorry, New Zealand.) But the fallacy of abandoning Pax Americana is that we don’t have the option of transforming ourselves into a larger version of New Zealand: faraway and inoffensive. A world we seek to turn our back on is likelier to stab us in the back than it is to turn its back on us. That’s why we have to preserve, and police, a global order. Joe Biden understands this in his bones. But most progressives in the Democratic Party don’t, nor do the MAGA neo-isolationists who share the progressives’ “come home, America” mentality. And the president’s cautious execution of foreign policy hasn’t helped. The dilatory arming of Ukraine allowed Russia to harden its defenses in the occupied territories. The refusal to get serious about border security has given isolationist Republicans political capital they don’t deserve. Pinprick attacks against Iranian proxies aren’t going to deter Tehran from its regional or nuclear ambitions. Failing to dismiss the secretary of defense sends a signal of unseriousness that Americans may not notice but our adversaries do. The challenge of global order is that, hard as it is to preserve, it is harder and usually bloodier to piece together once lost. It bears repeating that we are much closer to losing it than most realize.

AYEY – El grave atraso reparaciones de la Carretera PR1 de Cayey a Aibonito apuntan a negligencia del contratista, por lo que la representante Gretchen Hau, por el distrito Cidra Cayey, iniciará una profunda investigación como presidenta de la Comisión de Infraestructura de la Cámara. “Aquí está pasando algo raro y vamos a investigar porqué ese proyecto está en el limbo. Si el contratista no cumple, quien le reclutó, el Departamento de Transportación y Obras Públicas (DTOP) tiene que reclamarle al seguro por esa inacción y nada de eso ha ocurrido. Esto que está pasando, esa dilación en las labores en esa carretera es altamente cuestionable”, aseguró la legisladora, quien hizo un llamado a la Oficina del Contralor para que examine dicha situación. Hau señaló que fue el 6 de julio del 2023 cuando el gobernador Pedro Pierluisi anunció el inicio de dicho
proyecto. “Pasados ya seis (6) meses no ha habido adelanto, más bien lo que hemos visto son parchos, dilaciones y excusas”, aseguró. La también exsenadora por el distrito de Guayama, añadió que desde antes de llegar a la Cámara, estuvo haciendo constantes reclamo al Departamento de Transportación y Obras Públicas (DTOP) con relación al estado de varias vías, entre ellas la PR1. Para la legisladora, el DTOP ha sido altamente ineficiente en la supervisión al contratista a quien está asignada dicha obra. “En la memoria está aquel Mensaje de Estado ofrecido por el gobernador Pierluisi a la Asamblea Legislativa en abril del 2022, donde se resaltó la cantidad de toneladas de asfalto depositadas así como los beneficios del programa Abriendo Caminos. Sin embargo, la realidad de quienes transitan las vías de rodaje es totalmente diferente a lo expresado por gobernador, sobre todo en el caso particular de la PR-1 de Cayey a A ibonito”. Dicho proyecto ya pasó por el proceso de asignación
de fondos, subasta e inicio de las labores. “Qué está pasando que no se aceleran los trabajos. For Dizzy Gillespie, Queens was the place to be and to bop By MIA JACKSON
D
izzy Gillespie helped make Minton’s Playhouse famous. Minton’s in Harlem was where jazz musicians — from out-of-towners to locals performing in nearby big band theaters in Harlem — sought refuge during late-night jam sessions, and a new genre, bebop, was born. Gillespie, together with Charlie Parker, is largely considered a pioneer of the rebellious jazz style that diverged from mainstream swing jazz’s emphasis on orchestrated productions and collective harmony. Instead, it ushered in an era of artistic experimentation that better reflected the realities of Black urban life and the talents of Black musicians. “Jam sessions, such as those wonderfully exciting ones held at Minton’s Playhouse, were seedbeds for our new, modern style of music,” Gillespie wrote in his autobiography, “To Be or Not to Bop.” But there was another gathering spot for Gillespie and his peers: the three-story Colonial Revival-style building in Corona, a neighborhood in Queens, that he bought in 1953. Jazz clubs were in Harlem. But jazz musicians lived on the tree-lined streets of Queens. While white musicians skedaddled to the suburbs, Black jazz virtuosos sought solace in the neighborhoods where their racial identity was welcomed — ultimately congregating into two enclaves in the borough. The first was in the southeast by Addisleigh Park where composer Clarence Williams and his wife moved in the 1930s, with Count Basie, Lena Horne, Duke Ellington’s son, Mercer Ellington, and James Brown eventually following suit. The second was in Corona, where Louis Armstrong lived until his death, and a place that Gillespie, fellow trumpeter Clark Terry and Ella Fitzgerald once called home. Queens had the charm of the South, conveniences of the northern lifestyle and was close enough to the teeming jazz scene of Harlem without being ensnared. The borough didn’t generate a fresh jazz genre like Harlem. But the borough was an incubator where music got worked out, imagined and revised, as Black musicians were grappling with the commercialization of their craft.

Gillespie often invited fellow musicians to his basement to play alongside him. “Dizzy, Babs Gonzales and I would mainly spend time down in the basement because that’s where he would rehearse,”
said Ernest Gillespie, Dizzy’s cousin. Ernest Gillespie, now 96, lived in nearby East Elmhurst during that time and currently resides in Fresh Meadows, Queens. The basement housed a full set of drums, a piano and, eventually, a pool table
and train set. The fridge in the basement was always stocked with Carlsberg Elephant, his favorite beer. The walls were adorned with art from other countries, souvenirs collected during his time as the nation’s first jazz ambassador. Starting in 1956, the State Department financed Gillespie and his band to travel across the world promoting democratic values. Gillespie also nurtured many up-andcoming musicians. “I met Count Basie, Ella Fitzgerald and Junior Mance in that basement,” said Dizzy’s godson, Harris Stratyner, now 68, who was a budding saxophone and clarinet player at the time. “Dizzy really was a teacher. He would teach the young cats how to play and how to follow rhythms, and it all happened in his basement in Corona.” Jeanie Bryson, 65, Gillespie’s daughter and an accomplished singer, lived in nearby LeFrak City along with her mother, composer Connie Bryson, who was never married to Gillespie. The father-daughter relationship, hidden from public view, was limited, but Jeanie Bryson recalled how her father would visit and she remembered his mentorship of musicians fondly. “He helped so many young musicians from different countries and gave these guys an opportunity that was beyond their imagination at the time,” she said. They had no children together, but they built a family in the neighborhood. On the outside, their home was an ordinary redbrick building much like the other homes in the area, including their neighbor’s, Armstrong, who lived around the corner. Armstrong’s home was designated a historic landmark in 1988 and opened for public tours in 2003. Armstrong bought a home in Corona with his wife, Lucille, in 1943, a decade before the Gillespies. Here, he carved out a humble life in a neighborhood of predominantly Italian immigrants and a growing community of middle-income Black residents. “We’re right out here with the rest of the colored folk and the Puerto Ricans and Italians and the Hebrew cats,” Armstrong told Ebony magazine in 1964. “What the hell I care about living in a ‘fashionable’ neighborhood?” His classic hit “What a Wonderful World” was written by Bob Thiele and David George Weiss as a tribute to Armstrong’s beloved Corona. The demographics of the neighborhood have changed in the decades since, with Latino immigrants replacing Italian immigrants in the 1960s, drawn by relatively affordable real estate and a welcoming attitude, the same forces that once lured Black newcomers. Now, the neighborhood is a hub for the next generation of Mexican, Ecuadorian and Dominican residents.
There are very few public acknowledgments of the period when Black musicians called Corona home. The Corona East Elmhurst Historic Preservation Society has long argued that the city’s Landmarks Preservation Commission has not properly recognized the historical significance of Queens properties. The society filed the initial petition in 2015 to have Gillespie’s home designated a landmark, but was denied. “Corona East Elmhurst, with its rich history and significant traditions is in jeopardy of becoming a negligible factor in the thought of the world,” the group wrote in the initial petition. “We felt we needed to create this society to preserve, protect and promote the history and legacy so future generations will know the greatness of the community,” said Deborah Tyson, one of the founders of the local society. The Queens Borough President’s Office, in collaboration with the Port Authority of New York and New Jersey, has been placing banners, murals and signage along the AirTrain’s John F. Kennedy Airport route from Jamaica, Queens, as a small but insufficient attempt to bring awareness to the borough’s rich musical heritage. “We need to try to preserve the history because there aren’t many people left who know the story of the community,” Tyson said. “We have places that are worthy of preservation. They may not look like a brownstone or a mansion on Fifth Avenue, but it doesn’t mean they aren’t worthy of preservation as well.”

We are in a big COVID wave. But just how big? By FRANCESCA PARIS
T
he curves on some COVID-19 graphs are looking quite steep, again. Reported levels of the virus in U.S. wastewater are higher than they have been since the first omicron wave, according to data from the Centers for Disease Control and Prevention, though severe outcomes still remain rarer than in earlier pandemic winters. “We are seeing rates are going up across the country,” said Amy Kirby, program lead for the CDC’s National Wastewater Surveillance System. The program now categorizes every state with available data at “high” or “very high” viral activity. The surge might reach its peak this week or soon after, modelers predict, with high levels of transmission expected for at least another month beyond that. Hospitalizations and deaths have remained far lower than in previous years. There were around 35,000 hospitalizations reported in the last week of December — down from 44,000 a year earlier — and 1,600 weekly deaths as of early December, down from 3,000. (At the same time in 2020, there were around 100,000 hospitalizations and 20,000 deaths each week.) Many of the metrics used early in the pandemic have become much less useful indicators of how widely the virus is spreading, especially since federal officials stopped more comprehensive data tracking efforts when they declared an end to the public health emergency last spring. Higher population-wide immunity has meant fewer hospitalizations even with high virus spread, and the sharp decline of COVID test results reported to authorities has made case counts far less relevant. Wastewater testing remains one of the few reliable instruments still available to monitor the virus. It can signal the start of a surge before hospitalizations begin to rise, and it includes even people who don’t know they have COVID. For many who remain at higher risk from the virus — like those who are older, immunocompromised or already have a serious illness — it’s become a crucial tool helping them understand when to be particularly careful. But it’s an imperfect metric, useful pri-
marily for identifying if there’s an acceleration of virus spread, not for telling you exactly how much virus is circulating. The data is often reported as normalized viral copies per milliliter or per gram, a number that is nearly impossible to translate into precise case counts, experts say. It’s also hard to know how comparable two different surges are: A peak in the data may not mean exactly the same thing this year as it did last year. That’s why many scientists who study the data will say only that it shows the nation is in the middle of a large wave, not whether the surge this winter is bigger than previous ones. (The CDC doesn’t show the actual concentration levels — its dashboard instead shows how much they have increased relative to when spread was low. Above eight standard deviations is considered “very high.”) Wastewater testing works at all because “everybody poops,” said David O’Connor, a virus expert at the University of WisconsinMadison. Samples of wastewater are captured at or on the way to treatment plants and tested for viral RNA in a lab. But no two samples are perfectly comparable. The amount of RNA in the sample will fluctuate depending on many factors, including the local population at any given time — think of a holiday influx into Miami or a college town emptying out for summer — and how much other material, such as industrial waste, is in the system. What experts really want to know, said
Marisa Eisenberg, a professor at the University of Michigan who runs a wastewater monitoring lab for five sites, is how much virus there is relative to the number of people around — the wastewater equivalent of the per capita case count. Some labs “normalize” the data — that is, they adjust the denominator — by looking at the number of gallons flowing through the plant, Eisenberg said. But many sites use something called “pepper mild mottle virus,” a virus that infects pepper plants. “People have studied this in human sewage and found we shed pretty consistent levels of this pepper virus,” she said. “So that’s a measurement of how many people went to the bathroom in the sewer shed today.” Once Eisenberg’s team normalizes the results, it sends data to the state and to the CDC, which collects information from sites across the country that together account for about 40% of the U.S. population. The CDC then aggregates its data and publishes state, regional and national trends. (Two companies that analyze wastewater, Verily Life Sciences and Biobot Analytics, also aggregate data from hundreds of sites and offer national and local pictures of virus spread.) But those nationwide estimates can be tricky. The sample population the CDC looks at largely excludes people with septic tanks and cities with no wastewater testing. There can be data lapses, as when the CDC switched contractors last year. Existing sites
can stop testing, and new sites start up, as the network changes and expands. And while Biobot and Verily can use the same methodology and normalization across all their sites, the CDC has to determine trends from data that arrives from different sites with a variety of methodologies. Finally, there are changes to the virus itself that could make comparisons over time more difficult. Scientists who track those changes say there are hints that this latest variant, JN.1, may be able to better replicate in the gut. It’s still just a hypothesis, O’Connor said. But it’s possible the virus is “a little more cozy in the gut” than it used to be, he said. If the hypothesis proves correct, it could mean that infected people shed more viral copies than they used to. In the wastewater data, the same number of infections could look like a lot more COVID. All of that together creates significant uncertainty about how comparable the data is from year to year. Michael Mina, a public health researcher and chief science officer for eMed, estimates the real amount of COVID spreading could be quite a bit higher or lower than this time last year. But there’s no doubt that there’s a lot of virus, he said. And far more now than just a few months ago. Many experts who study this data recommend dropping any notion of precision and just squinting a little at the line’s recent trajectory. And look at your city’s wastewater if possible, since data for a single site tends to be more reliable over time than a national estimate. “If you have vulnerable people in your community or family, you want to be particularly aware when cases are going up, and take more precautions,” Mina said. “And when cases are going down or at a lull, relax those precautions.” Those precautions include wearing a high-quality mask, getting vaccinated, testing and staying home if sick — and if someone at high risk is infected, taking Paxlovid. Even in this new pandemic phase, people are still dying and can still get long COVID, said Maria Van Kerkhove, the technical lead on COVID for the World Health Organization. “While the crisis of COVID is over, the threat is not,” she said.

Quebec still longs for its lost hockey team, a nationalist symbol By NORIMITSU ONISHI
W
hen the Nordiques left Quebec nearly 30 years ago, the hockey team’s departure fueled the kind of mythologizing and nostalgia familiar to fans of the Brooklyn Dodgers. The Nordiques’ stint in Quebec, playing there in the NHL from 1979 to 1995, overlapped with the French-speaking province’s two failed attempts to secede from the rest of Canada, and the team’s identity melded with that of their fans: a linguistic minority struggling to assert itself in a part of the world dominated by English speakers. The Nordiques wore their politics on their sleeves, literally, putting the Quebec flag’s fleur-de-lis on their uniforms. They also sang Canada’s national anthem only in French. The team’s exit “left a hole in Quebec City and Quebec regional politics, and a hole in Francophone identity, as well,” said Jean-François Lisée, who led the separatist Parti Québécois from 2016 to 2018, and who is now a columnist for the newspaper Le Devoir. So ever since the financially ailing Nordiques decamped for Denver, generations of Quebec’s political leaders have sought to bring them back, going as far as building an arena that cost 370 million Canadian dollars (nearly $280 million), even as economic changes have made the team’s return increasingly unlikely. “People see themselves in a national concept and in a hockey team, or in the memory of a hockey team, and politicians have tried to harness this sense of nationalism for political gains,” said Martin Pâquet, a historian of Quebec at the University of Laval in Quebec. “That’s essentially why they keep calling for the return of the Nordiques.” The latest to do just that was the government of Premier François Legault, who was overwhelmingly reelected to a second term in 2022, but whose approval ratings have been falling this past year because of a series of missteps, including approving a 30% salary raise for lawmakers. (Renaud Philippe/The New York Times) nounced with great fanfare that it had agreed to pay CA$5 million to CA$7 million for the Los Angeles Kings to play two preseason games in Quebec next October, as part of a strategic maneuver to keep pressing the NHL for the city’s own team. Such a move would have perhaps led to at least a blip up in the polls in the past. But this time, it backfired. Roundly criticized, the announcement pushed Legault’s ratings further down, helping to make him the most unpopular of Canada’s 10 provincial leaders, according to polling by the Angus Reid Institute. Was the criticism, and the missing bump in the polls, because of the timing of the announcement? It came around the same time that hundreds of thousands of the province’s public schoolteachers and health care workers went on strike, demanding better wages. Or was it the cost of the deal, a lot of money spent on a long-shot gamble? Legault’s own finance minister, who has nicknamed himself the “minister of the Nordiques,” acknowledged candidly, if imprudently, that the odds of getting back a team were only 10%.
Maybe it was the ebbing of nationalist feelings among the French Québécois, especially the young. Or was it just the passing of time? “If a couple has been separated because one of the members left some 25 years ago, it’s really time to move on,” Pâquet said. Of course, the province of Quebec does still have an NHL team: For decades, the Montreal Canadiens have been one of the league’s most storied franchises. But for many in Quebec, being a fan of the Canadiens was never an option — they had never been French Canadian enough. The Canadiens played in Montreal, the multicultural, diverse, bilingual metropolis that is the historical rival of the predominantly French-speaking Quebec City. Outside the province, though, the Canadiens were famous for their French Canadian stars, like Guy Lafleur. As Quebec’s independence movement emerged in the 1960s, so did hopes for an NHL team in Quebec City, in what was hoped would eventually become the capital of a new nation. The city got
its team in 1979 after the Nordiques and others in a smaller league were absorbed into the NHL. After people in Quebec voted against independence the following year, in the province’s first referendum, some channeled their frustrated nationalist sentiments into fierce support of the Nordiques. Games between the Nordiques and the Canadiens took on mythic proportions, acting as proxies for larger battles. “We learned at a very young age to hate the Canadiens,” said Jocelyn Simard, 65, a French Québécois man who has lived all his life in Quebec City and grew up as a die-hard fan of the Chicago Blackhawks. Once the Nordiques arrived, Simard felt he had found the team he was waiting for his whole life. While the Canadian anthem was sung in both French and English before games elsewhere, only French was heard in the Nordiques’ arena. Lafleur would play his final two seasons in a long career for the Nordiques. “In the end, many, many French Canadians identified more with the Nordiques than the Montreal Canadiens,” Simard said, adding that he had not lost hope in a return of the Nordiques. Simard spoke as he watched a game played by Quebec’s junior league team, the Remparts, at the Vidéotron Center — the pricey arena that provincial and city leaders built in 2015 with public funds to show the NHL how committed they were to getting a team. But if fans of Simard’s generation tended to share his feelings toward the Nordiques, the team’s significance did not seem to resonate with younger hockey fans at the arena, many born after the team’s departure. “Me, I’m a fan of the Montreal Canadiens, whereas my father still has the Nordiques in his mind,” said Mathis Drolet, 17, a student who grew up in Quebec. His friend, Justin Tremblay, 17, said he was aware of how the Nordiques were tied to previous generations’ aspirations — “Quebec wanting to become a nation

From page 27 and all that” — but those hopes felt distant to him. “They’re things we learned at school,” Tremblay said. Located in the league’s smallest market — the Quebec metropolitan area now has about 800,000 people — the Nordiques struggled financially for years and left for Denver in 1995. In the team’s first season in the United States, renamed the Colorado Avalanche, it won the Stanley Cup — deepening a sense of betrayal in Quebec. The Parti Québécois-led government at the time had refused the Nordiques’ owner’s request for a bailout — just months, it turned out, before the province’s second referendum on independence from Canada.
The referendum failed by a razor-thin margin — with some politicians and political experts eventually blaming the loss on the government’s refusal to bail out the Nordiques. And so to this day, Quebec’s political leaders vow to bring back the Nordiques, and even the slightest development can generate significant attention in the local news media. “In Quebec City, those stories are on the front page of newspapers,” said Frank Pons, a professor on sports management at the University of Laval. But most hockey industry experts say the chances of a return are close to nonexistent. In recent years, the NHL has chosen to expand in bigger markets, including Seattle and Las Vegas, and has
given no indication of seriously entertaining Quebec as a candidate for expansion or relocation, Pons said. For the NHL, Quebec and its small television market just make little business sense. “It’s an economic approach,” he said, “whereas in Quebec, it’s an emotional approach.” Given the lingering emotions toward the Nordiques, few expect politicians to acknowledge the cold, hard truth about the chances of the Nordiques ever coming home. “How many votes would that get you?” said Lisée, the former party leader. “If you don’t want to be in power, you can say that if you think that. Most politicians will say it would be such a great thing to have the Nordiques back.”

After expected snow Tuesday, today and Friday, the temperature Saturday evening, when the Kansas City Chiefs will happen to be playing the Miami Dolphins, will be around minus 3 degrees. A tarpaulin was laid over the field, but so much snow fell on the tarp that players from both teams had to be recruited to haul it off before the game. Minutes later, the field was completely covered with new-fallen snow anyway.
The snow obscured the yard markers, making first-down decisions merely guesswork. In the end, the Philadelphia Eagles beat the Chicago Cardinals, 7-0, to win their first championship. The New York Times suggested the game should have been postponed but quickly added, “Don’t say that in the presence of any faithful Philadelphia followers. Wet, cold and uncomfortable though they might have been, they were happy.” Kansas City fans will hope to feel the same after Saturday.
