ouse Minority Leader Carlos “Johnny” Méndez Nuñez and New Progressive Party (NPP) Rep. Víctor Parés Otero (San Juan) on Tuesday rejected the latest version of the debt adjustment plan for the Puerto Rico Electric Power Authority (PREPA) filed in court by the Financial Oversight and Management Board. “This fourth version of PREPA’s Debt Adjustment Plan was presented on a Saturday, just hours before the end of the year. In addition to lacking transparency, the Plan is totally arbitrary, unnecessarily impacting residential consumers and our small and medium-sized businesses (SMEs),” Méndez Nuñez said in a written statement. “We reject this proposed increase of 4.4 cents per kilowatt-hour for residential customers and a higher one for SMEs.” “It is important to emphasize that the increase in the cost of electricity affects not only residential customers, but also SMEs and industries, for which it would be tough not to pass this increase on to consumers,” the former House speaker added. “That’s not what we’re looking for. We also highlight that the payment of pensions, approximately $300 million annually, has not been considered in that Plan. This is a strong blow that should not be approved.” The oversight board, which represents PREPA in its bankruptcy, filed yet another Fourth Amended Plan of Adjustment last week to include the debt settlement reached with the Official Committee of Unsecured Creditors on Dec. 18. Like previous PREPA debt deals, the plan of adjustment contains 18 classes of debtors. The plan includes provisions creating a GUC Trust Board comprising three members to be appointed to manage all matters related to unsecured creditors, including a GUC Trust created to distribute proceeds of the settlement. The Unsecured Creditors Committee (UCC) and the oversight board reached a settlement on PREPA payments on Dec. 18 that would give the UCC a fixed payment of $335 million, the avoidance action proceeds, up to another $300 million if the court reduces bondholder claims, as well as other considerations. In exchange the UCC agreed to support the plan and drop an adversary proceeding arguing that its claims were superior to those of bondholders, which U.S. District Judge Laura Taylor Swain, who is overseeing Puerto Rico’s bankruptcy cases, ruled have only a $2.4 billion unsecured claim on their $8.3 billion in outstanding debt. The oversight board has said it does not need to
re-solicit votes on the plan because the settlement will harm no creditor group. The extra money to pay the UCC will come from a recent increase of the oversight board’s estimate of how much debt PREPA can sustain. From and after the effective date, reorganized PREPA will provide a single recovery in the form of payment to the PREPA PayGo Trust sufficient to satisfy participants’ claims against the PREPA Employees Retirement System (ERS) to the extent described in Article XIII of the plan. Regarding pensions, the plan says benefit payments for which the PREPA ERS is entitled will be limited to benefits payable to any participant who is a retiree as of the effective date of the plan without any further cost of living adjustments from and benefits payable to participants who are active PREPA ERS participants with benefit accruals frozen as of the effective date. The contractual obligations of PREPA to PREPA ERS including, without limitation, the obligation to pay employer contributions sufficient to fund benefits in the PREPA ERS Regulations and any obligations PREPA is required to pay on account of participants who moved to employment with the commonwealth or its agencies, will be rescinded under the plan. PREPA will also charge a “legacy charge” consisting of all applicable customer charges and volumetric charges set at the levels for each customer class. The legacy charge is collected to ensure sufficient cash flow required for PREPA’s debt service on certain new bonds to be issued under the plan.

Senators to hold round-table on surge of fraud schemes targeting the elderly By THE STAR STAFF

ens. Marisa “Marissita” Jiménez Santoni and Keren Riquelme Cabrera announced Tuesday that a task force will meet to create strategies aimed at providing guidance to the elderly population on new fraud schemes focused on this sector of the population, which exceeds 760,000 in Puerto Rico. The meeting, scheduled for next week at the Capitol, will be attended by officials from the Public Safety, Justice and Family departments, as well as the Office of the Ombudsman for the Elderly, the Office of Innovation and Technology Services (PRITS) and the American Association of Retired Persons. better known as AARP, among others. “Today we see how fraud schemes have focused on the elderly, as well as on those who are close to reaching 60 years of age. The increase in the use of social media by this sector of the population, which if we include a metric from 55 years old onwards, we are talking about over 925,000 people, almost a third of our population,” said Jiménez Santoni, senator for the District of Carolina.

is a skyrocketing increase in social media fraud that targets older adults.” “All kinds of fraudulent schemes have an impact on this important sector of our society, which is why we need to develop an aggressive targeting campaign, along with mechanisms to facilitate the identification of these criminal elements, as well as their prosecution in the judicial system,” the at-large senator said. “There can be no impunity whatsoever.” On Tuesday morning, news reports detailed a dizzying increase in fraud cases involving older adults, as well as people who are approaching 60 years of age, among which romantic frauds through electronic platforms such as social networks stand out. “What we seek with this meeting is to outline strategies, real and applicable, in an expeditious manner to address these fraud schemes,” Jiménez Santoni said. “[...] In addition, there must be mechanisms available for older adults that make it easier for them to identify these types of schemes for the purpose of prevention. We will also evaluate whether more legislation is needed and what areas we can strengthen.”
Proposed program would offer seed money to young entrepreneurs in Río Piedras By THE STAR STAFF

ith the aim of encouraging young people to establish their own businesses in the urban district of Río Piedras, District 3 (San Juan) Rep. José “Cheito” Hernández Concepción has proposed a seed capital program for new businesses known as “Bet on Río Piedras.” “The traditional urban area of Río Piedras is experiencing a new resurgence with the initiatives of our mayor Miguel Romero,” the New Progressive Party lawmaker said. “To
support this effort, we have outlined a new support program for young people who wish to develop their own businesses, which we have called ‘Bet on Río Piedras,’ a platform that allows the disbursement of seed capital for young people between 18 and 35 years old who establish their businesses in this important area of San Juan.” The proposed new program will offer up to $10,000, or 30 percent of the investment in equipment and materials, through seed capital, similar to the SME (Small & Midsize Enterprises) Development program. The re-
quirements, in addition to the regular ones in the aforementioned program, also include that the business must be established in the urban area. The new program also provides technical assistance. “In the coming days we will be discussing the matter with the secretary of the Department of Economic Development and Commerce [DDEC by its Spanish acronym], Manuel Cidre,” Hernández Concepción said. “But the new program will be similar to the ‘Women’s Business Briefcase,’ a program created over the past four years that offers, among other things, business training seminars, access to development tools, individualized support and the opportunity to interact with other entrepreneurs, exchanging ideas and concepts for improvement. It is a hybrid program between the Briefcase and SME Development.” Through the Women’s Business Briefcase Portal, DDEC offers the tools to guide, facilitate and give direction so that interested people can create their own businesses, or expand and grow their existing businesses, with a vision to export their goods and services competitively to the global market. In the heart of the San Juan metro area, Río Piedras was the seat of the Municipality of Río Piedras until 1951, when it was incorporated into the Municipality of San Juan. Río Piedras,
sometimes known as the “University City,” has a long and rich relationship with the island’s primary teaching center, the University of Puerto Rico, Río Piedras Campus. For many years, Río Piedras was one of the most active places in the capital and the economic engine of the metro area. Hernández Concepción is the author of House Resolution 449, which creates a sales and use tax-free zone in the traditional urban area of Río Piedras. The measure was approved in the House of Representatives and is under evaluation by the Senate.

NPP, PDP field candidates for elective positions as deadline passes By THE STAR STAFF
T
he New Progressive Party (NPP) has candidates for all of its elected positions, NPP Electoral Commissioner Vanessa Santo Domingo announced Tuesday, which was the deadline for aspiring candidates to file applications to run in this year’s elections. The electoral process consists of 148 candidates. In the case of mayors, they are presented together with the city assembly members as they are grouped positions. “The NPP is ready for this electoral cycle,” Santo Domingo said. “One hundred percent of the [elective positions] have candidates, from experienced leaders to new faces committed to our ideal, demonstrating that we are a party with structure and organization.” She noted that preliminarily, 608 candidates had filed their candidacies with the State Elections Commission. Of those, some 32 percent are women aspiring to elective office: 17 to the mayoralties, 18 to the Senate, and 12 to the House of Representatives, Santo Domingo detailed. The official announced that, so far, there will be primaries in 22 municipalities, in all the senatorial districts except in Carolina, in the at-large candidacies for the Senate and the House of Representatives, in the majority of the House district seats, and in the governor’s race. The NPP Evaluation Committee is evaluating the latest filings and complaints filed with the Electoral Commissioner’s Office. At noon on Tuesday the process for filing a candidacy for the
Popular Democratic Party Electoral Commissioner Karla Angleró various elective positions closed. Separately, Dignity Project Electoral Commissioner Nelson Rosario anticipated in an interview before the noon deadline that the party would not have candidates for all elective positions. Popular Democratic Party (PDP) officials did not answer requests for comment but preliminarily, they expected to have candidates for all their elective positions. This year, the PDP opted to nominate fewer at-large candidates for the Legislature in order to improve the winning chances of the party’s candidates in those races. PDP Electoral Commissioner Karla Angleró and the party’s secretary general, Gerardo “Toñito” Cruz, announced that the candidacy process for all elective positions in the November elections had been completed.
That included the respective municipal assemblies for the 78 municipalities, 40 House districts, eight Senatorial districts, at-large candidacies for both chambers, resident commissioner and governor. “On October 16, we opened applications for all elective positions. Today, January 2, 2024, one year before the PDP assumes its new mission of leading the country toward true development, we have completed all the available candidates for the next elections and, contrary to what detractors have said publicly, the PDP will go to the election with 100 percent of the same candidates covered,” Angleró said in a written statement. “This is undoubtedly a reflection of the work of our president [Jesús Manuel Ortiz González] to put the PDP in a position to win, which
has raised the enthusiasm of all the populares of the island and those who have become interested in running for an elective position.” She added that the party will hold primaries in almost all races, except for resident commissioner since only Pablo José Hernández Rivera filed a candidacy for that post. MVC presents Córdova Iturregui as a ‘water’ candidate for governor Also on Tuesday, the Citizen Victory Movement (MVC by its Spanish initials) completed its process of filing candidates for the fall elections, which includes a “water” candidate for governor, despite the fact that they agreed with the Puerto Rican Independence Party (PIP) to support the candidacy of Juan Dalmau Ramírez for governor. Dr. Javier Córdova Iturregui, a retired university professor and former president of the Puerto Rican Association of University Professors, will be the MVC’s candidate for governor. As part of the so-called Country Alliance agreements, the MVC will support the PIP candidate for governor while the PIP will support the MVC candidate for resident commissioner. Roberto Velázquez Correa was announced Tuesday as the PIP’s “water” candidate for the D.C. post. At the close of the filing period, the MVC will have internal contests for the positions of resident commissioner, atlarge representative and at-large senator. The party has adopted the alternate method for primaries, which is why it will be holding a series of assemblies during January and February to choose the candidates for those positions.

enate President José Luis Dalmau Santiago announced Tuesday that this Thursday, Jan. 4, an event called “Give a Smile in This New Year” will be held at the Capitol, where attendees will have the opportunity to greet the Three Wise Men of Juana Díaz. “We extend a special invitation to the people of Puerto Rico to join our Three Kings Day celebration at the Capitol,” Dalmau Santiago said in a written statement. “It will be a day full of magic, tradition and shared joy.” During the event, which will begin at 10 a.m. on the
north side of the Capitol, families will have access to various play and entertainment areas. On stage, the Remi Show, Shabum, and the Clown Orchestra will perform, along with the animation of Alex DJ. Also on hand will be superheroes from the Mental Health and Anti-Addiction Services Administration. In addition, the Senate will receive the visit of the Three Wise Men of Juana Díaz starting at 2 p.m., when the children will be able to have their portraits taken with them. “Let’s celebrate our tradition and welcome this New Year with smiles and joy from our House of Laws,” the Senate leader said.

Taboada de Jesús calls for charges against individuals injured while using illegal pyrotechnics By THE STAR STAFF
I
ndividuals who used illegal pyrotechnic material on New Year’s Eve and were injured should be prosecuted since they had been warned in advance that the use of explosive materials is illegal, a police organization leader said Tuesday. “Those individuals who are in hospitals receiving treatment either private or with payments from the government health card as a result of an explosion from a prohibited pyrotechnic item must be prosecuted for the illegal use of explosive material,” said Lt. José Taboada de Jesús, president of the Puerto Rico Police Members Association. “We call on the colleagues of the Puerto Rico Police and the Municipal Police not to drop the cases of these people who used explosives that exploded in their hands, injuring their bodies and putting them in an emergency room. No one can claim that they did not know about the danger of

Puerto Ricans were informed well in advance about the danger of using explosives to celebrate Christmas, the law enforcement leader reiterated. On this occasion, the violators of the law on explosives confronted an oriented population and alert neighbors who used their cell phones to record violations with the use of multiple variations of explosive materials on New Year’s Eve, he said. “They are already beginning to show evidence of the disorder caused by these irresponsible people who kept an entire community in agony with the detonation of thousands of firecrackers and quarter-sticks of dynamite,” Taboada de Jesús said. “We urge residents to protect these videos so they can be used in the courts.” He said the Puerto Rico Police Bureau carried out exceptional intelligence work, conducting raids that managed to remove millions of firecrackers, quarter-sticks of dynamite and illegal pyrotechnic material that would have otherwise impacted the
tranquility of communities. “However, the mafia that exists at the country’s docks managed to circumvent security and inspections so that more than 20 wagons [containers] of explosive material easily entered the country,” Taboada de Jesús said. “We insist that these violators of neighborhood peace must be taught a lesson.” “We have to make complaints against everyone who, knowing the risk and knowing that the use of quarter-sticks of dynamite or illegally manufactured instruments could cause damage,” he added. The law enforcement officer was adamant in insisting violators “must be prosecuted in the courts of the country.” “There are many laws here that allow and support the Puerto Rico Police to be able to file complaints against anyone who is in a hospital convalescing from a wound caused by the mishandling of an explosive,” Taboada de Jesús said. “Being injured does not exonerate a person from the violation.”
10 patients treated at Centro Medico due to New Year’s Eve mishaps By THE STAR STAFF
T
he emergency room at Centro Médico received 10 cases on Sunday, NewYear’s Eve, and into the early hours of New Year’s Day, five due to injuries from fireworks and another five reportedly due to wounds sustained from stray bullets. As reported by Dr. Israel Ayala, medical director of the Puerto Rico Medical Services Administration (ASEM), in a written statement issued Monday, “of the five injured only one claims to have been [wounded due to] bullets fired into the air.” “This case is in the investigation stage and is yet to be confirmed,” the official added. “With these figures we can deduce that the campaign against bullets in the air continues to yield results, but we must not let our guard down. The goal should be to continue educating the public to eliminate this practice.” Regarding the burning of gunpowder and fireworks, Ayala specified that “from Christmas Eve 2023 until today, a total of eight patients were registered.” “Meanwhile, in the approximate period of 24 hours, referring to New Year’s Eve and the early morning of New Year’s, a total
of 94 patients due to various medical conditions who arrived at our Emergency Room were referred either from other hospital institutions or directly from their homes,” he said. The physician noted that holiday season festivities go on in Puerto Rico and called for continuing to celebrate with prudence. “The celebrations of Three Kings Day, the Octavitas and the San Sebastián Street Festivities are approaching and at these events the consumption of alcoholic beverages is higher, so I urge you, to avoid tragedies, if you are going to consume alcohol, hand over the keys,” Ayala said. In the period from Dec. 24 to Dec. 31, 2023, meanwhile, the number of car accidents reached 35 cases, along with 17 accidents involving motorcycles.

First homicide of 2024 is reported in Bayamón By THE STAR STAFF
T
he Puerto Rico Police Bureau was investigating the new year’s first homicide case, which occurred on Monday afternoon on PR-167 in Bayamón. According to authorities, at around 2:15 p.m., a call
to the 9-1-1 Emergency System alerted police about a person who had sustained several gunshot wounds. When agents reached the reported location, they found the bullet-riddled body of an unidentified man between 20 and 30 years old inside a white 2018 Toyota Corolla. It was reported that PR-167 was closed to traffic during
the police response. Agent José Díaz of the Bayamón Centro precinct was investigating the case, while agents assigned to the Bayamón Criminal Investigation Corps’ Homicide Division, along with the prosecutor on duty, joined the investigation.

For 2024, expect state debates over AI, gender and firearms By RICK ROJAS
A
s Americans have engaged in fierce disagreement over gender expression and sexual orientation, the costs and reach of racism, and the danger and opportunity presented by rapid technological advancement, state legislatures have been one of the most visible and influential arenas for these debates. It will probably be no different in 2024. Lawmakers in dozens of states will soon be returning to work, weighing in on some of the most divisive issues confronting the country, including access to transitionrelated care for young transgender people, abortion and gun rights. Lawmakers will also consider new regulations on artificial intelligence, a digital frontier that security experts have described as a serious potential threat — and one where state lawmakers could play a vital role by adopting safeguards that could be a model for the federal government to eventually follow. “Consensus has yet to emerge, but Congress can look to state legislatures — often referred to as the laboratories of democracy — for inspiration regarding how to address the opportunities and challenges posed by AI,” said a report published in November from the Brennan Center for Justice, a nonpartisan law and poverty think tank. Several states, including Florida, South Carolina and New Hampshire, are considering legislation that would govern the use of artificial intelligence in political advertising, particularly “deepfake” technology, which could enable the voice and likeness of a candidate to be co-opted and used in malicious ways. The South Carolina bill would limit the use of such technology within 90 days of an election and require a disclaimer declaring that the advertisement includes imagery or audio that has been “manipulated or generated by artificial intelligence.” “The technology that produces this content has advanced rapidly and outpaced government regulation,” Nick DiCeglie, a Republican state senator in Florida who introduced legislation in December, said in a statement. In Missouri, lawmakers have proposed forbidding educators from referring to a student using pronouns that do not align with their “biological sex” without written permission from a student’s parent. Lawmakers are also considering strengthening the law the state enacted in 2023 that prevents doctors from prescribing puberty blockers and hormones for transgender minors. The new proposals include removing a sunset clause on the current law, as well as an exception that allowed minors who were already prescribed puberty blockers or hormones before the law went into effect to continue receiving treatment. Twenty-two states have now passed laws preventing access to transition-related health care for minors; some have been blocked by legal challenges. The laws were part of a flurry of legislation championed by conservative lawmakers over the past two years that focused particularly on the gay and transgender community. It included bills aimed at limiting drag performances and classroom discussions of gender identity and sexual orientation.

Washington state had considered a similar measure in 2023, but it failed, with opponents mainly put off by the cost. Supporters said the Washington Future Fund, as the program is officially known, would help with closing an important division in opportunity. “Income gaps and other institutionalized racist policies and practices prevent Black, Indigenous and other people of color from building generational wealth,” the Economic Opportunity Institute, a think tank based in Seattle focused on economic security, racial equity and sustainability, said of the proposed policy. “The Washington Future Fund would shrink this racial wealth gap and provide longer term economic stability to low-income Washingtonians.”
In South Carolina, one of the few Southern states that have not passed a ban on transition-related care for minors, critics of the earlier proposed prohibitions have warned that the fight is not over. “We were able to stave off the worst attacks in 2023, but we need all hands on deck when the state legislature returns in January 2024,” the American Civil Liberties Union of South Carolina said in a recent statement. Virginia is another state where a transgender care ban for minors failed in 2023, as did nearly a dozen other bills assailed by critics as “anti-transgender.” But in 2024, with Democrats reclaiming full control of the General Assembly after the November elections, the majority has indicated that abortion protections, limits on access to guns and a higher minimum wage would rank as their biggest priorities. Trump’s most ambitious argument in his bid for ‘absolute immunity’ By ADAM LIPTAK
T
here is almost nothing in the words of the U.S. Constitution that even begins to support former President Donald Trump’s boldest defense against charges that he plotted to overturn the 2020 election: that he is absolutely immune from prosecution for actions he took while in office. A federal appeals court will hear arguments on the question next week, and the panel will consider factors including history, precedent and the separation of powers. But, as the Supreme Court has acknowledged, the Constitution itself does not explicitly address the existence or scope of presidential immunity. In his appellate brief, Trump said there was one constitutional provision that figured in the analysis, although his argument is a legal long shot. The provision, the impeachment judgment clause, says that officials impeached by the House and convicted by the Senate are still subject to criminal prosecution. The provision says: “Judgment in cases of impeachment shall not extend further than to removal from office, and disqualification to hold and enjoy any office of honor, trust or profit under the United States: But the party convicted shall nevertheless be liable and subject to indictment, trial, judgment and punishment, according to law.” All the clause says in so many words, then, is that “the party convicted” in the Senate can still face criminal prosecution. ferred immunity from prosecution may come as a surprise to some of those who did the acquitting. Take Sen. Mitch McConnell, the Republican leader from Kentucky, who voted for acquittal. Shortly afterward, in a fiery speech on the Senate floor, he said the legal system could still hold Trump to account. “We have a criminal justice system in this country,” McConnell said. “We have civil litigation. And former presidents are not immune from being held accountable by either one.” That suggests that Trump’s reading of the clause is far from obvious, but the Justice Department has said that it is not wholly implausible. In 2000, its Office of Legal Counsel issued a 46-page memorandum devoted to just this question. It was called “Whether a Former President May Be Indicted and Tried for the Same Offenses for Which He was Impeached by the House and Acquitted by the Senate.” The argument that such prosecutions run afoul of the Constitution “has some
force,” according to the memo, which was prepared by Randolph Moss, now a federal judge. But, it went on, “despite its initial plausibility, we find this interpretation of the impeachment judgment clause ultimately unconvincing.” It added: “We are unaware of any evidence suggesting that the framers and ratifiers of the Constitution chose the phrase ‘the party convicted’ with a negative implication in mind.” More fundamentally, the memo said, “impeachment and criminal prosecution serve entirely distinct goals.” Impeachment trials involve political judgments. Criminal trials involve legal ones. In a brief filed Saturday, Jack Smith, the special counsel, wrote that “acquittal in a Senate impeachment trial may reflect a technical or procedural determination rather than a factual conclusion.” The brief noted that at least 31 of the 43 senators who voted to acquit Trump at the impeachment trial said they did so at least in part because he was no longer in office and thus not subject to the Senate’s jurisdiction. Trump’s reading of the provision “would produce implausibly perverse results,” Judge Tanya Chutkan, who is overseeing his trial in U.S. District Court in Washington, wrote in a decision last month rejecting Trump’s claim of absolute immunity. She noted that the Constitution permits impeachment for a narrow array of offenses — “treason, bribery or other high crimes or misdemeanors.” Under Trump’s reading, Chutkan wrote, “if a president commits a crime that does not fall within that limited category, and so could not be impeached and convicted, the president could never be prosecuted for that crime.” “Alternatively,” she went on, “if Congress does not have the opportunity to impeach or convict a sitting president — perhaps because the crime occurred near the end of their term, or is covered up until after the president has left office — the former president similarly could not be prosecuted.” She added that President Gerald Ford’s pardon of former President Richard Nixon, who resigned as calls to impeach him for his role in the Watergate scandal grew, would have been unnecessary under Trump’s reading.

H
undreds of migrants bound for New York City were taken to New Jersey over the holiday weekend, in an apparent attempt to bypass a city order that seeks to limit the chaotic flow of arrivals. Since Saturday, 13 buses from Texas and Louisiana carrying about 450 migrants have arrived in New Jersey, including a bus that arrived early Monday in Jersey City, according to Steve Fulop, the city’s mayor. Other stops included New Jersey Transit hubs in Secaucus, Fanwood, Edison and Trenton. The surge in New Jersey arrivals appears to be an end-run around an emergency executive order last week by New York City’s mayor, Eric Adams, requiring charter bus companies to provide 32 hours’ advance notice of the arrival of migrants and restricting the times of day when they can be dropped off. “They’re using New Jersey essentially as a bus stop to circumvent the limits on buses that can arrive in New York,” Fulop said, adding that he is not yet concerned about the migrants’ passage through the state. The buses — mostly from Texas, but at least one from Louisiana — had chaperones who assisted migrants in transferring to trains and buses heading into New York City. The office of Texas Gov. Greg Abbott did not immediately respond to a request for comment. A spokesperson for the governor of Louisiana, John Bel Edwards, a Democrat, said that while one of the bus companies was based in the state, the migrants aboard the bus came from Texas, and that their office was not involved. A spokesperson for New Jersey’s governor, Philip Murphy, also a Democrat, said “nearly all” of the asylum-seekers arriving by bus had “continued with their travels en route to their final destination of New York City.” The spokesperson, Tyler Jones, added that the state was “closely coordinating” with local New Jersey officials, the federal government and New York City. In New York, Power Malu, whose organization Artists Athletes Activists has been meeting migrants at the Port Authority Bus Terminal and directing them to the city’s intake center, said his staff had not seen a bus of asylum-seekers arrive there since Friday when the Police Department began enforcing the order. He called the arrival rules too stringent and said he had seen more migrants arriving at the intake center at the Roosevelt Hotel on foot after being dropped off elsewhere. “They’re going to come to New York City because they are desperate and they’re looking for opportunity,” Malu said. “This is not going to slow down the flow and this is not going to stop them.” Michael Gonnelli, the mayor of Secaucus, New Jersey, where several migrants disembarked over the weekend, said in a statement Sunday that the new rules might be too difficult to enforce and were “resulting in unexpected consequences” for transit hubs in New Jersey.

Slow rollout of national charging system could hinder EV adoption By MADELEINE NGO

ore than two years ago, lawmakers approved billions of dollars to build out a national electric vehicle charging network in the hopes of encouraging more drivers to switch to cleaner cars. The money, included in the bipartisan infrastructure law, was intended to help assure drivers they could reliably travel longer distances without running out of power. But a robust federal charging network is still years away. Only two states — Ohio and New York — have opened any charging stations so far. A handful of others have broken ground on projects in recent weeks, with the aim of completing them in early 2024. In total, 28 states, plus Puerto Rico, have either awarded contracts to build chargers or started accepting bids for projects as of Dec. 15. The rest are much further behind on starting construction. Broad availability of chargers is critical for the Biden administration’s goal of getting EVs to make up half of new car sales by 2030. Americans routinely cite “range anxiety” as one of the biggest impediments to buying an EV. About 80% of respondents cited concerns about a lack of charging stations as a reason not to purchase an EV, according to an April survey from the Energy Policy Institute at the University of Chicago and the Associated Press-NORC Center for Public Affairs Research. The Biden administration is trying to entice consumers to buy EVs both by offering tax credits of up to $7,500 and promising to build out a national backbone of high-speed chargers. That network is meant to give drivers the assurance that they could reach a reliable charger every 50 miles along major roads and highways. The White House has set a goal of building a national network of at least 500,000 public chargers by 2030, but researchers at the National Renewable Energy Laboratory have projected that the country will need more than 1 million public charging ports by the end of the decade. Ben Shapiro, a researcher at RMI, a nonprofit that promotes the energy transition, said the country needed to accelerate the pace of new charging infrastructure considerably. “People certainly have this perspective that there isn’t enough charging,” Shapiro said. “And that, I think,

A
rollercoaster 2023 that ended with an equity rally on hopes for rate cuts amid slowing inflation has extended into the first trading day of 2024, pushing European stocks to an almost two-year high and bringing U.S. stock market peaks into view. Today’s economic calendar looks light, so the theme that has driven markets since the beginning of November looks set to dominate until important U.S. data is released on Wednesday - JOLTs and manufacturing ISM - and the minutes from the Federal Reserve’s December meeting. At that meeting, the central bank appeared to make the long-awaited pivot, signaling that tightening of interest rates is likely over and the discussion of rate cuts coming into view. Traders moved quickly to price in easing of policy and, as things stand, are looking for 150 basis points of easing this year, with the first 25 basis-point rate cut almost fully priced for March. Wednesday’s minutes will be parsed for clues on whether that pricing is justified, especially as commentary over the holiday period from Fed policymakers has been sparse. It looks set to remain that way this week, apart from speeches from Richmond Fed President Tom Barkin on Wednesday and Friday. Barkin will get to vote on policy this year as the annual reshuffle of voters on the Federal Open Market Committee sees Barkin, Raphael Bostic, Mary Daly and Loretta Mester get a vote, while Austan Goolsbee, Patrick Harker, Neel Kashkari and Lorie Logan rotate out in 2024. How the new composition of voters on the FOMC affects policy this year remains to be seen. For now, European equities are pushing higher with the STOXX 600 trading at a 23-month high and Germany’s DAX rising over 1%. The euro zone’s banking stocks are leading the rally, jumping as much as 2% and on track for their biggest daily rise since October. Wall Street futures are also pointing to a higher open. With the S&P 500 just 1% from its all-time high, it seems only a matter of time before new peaks are reached for the U.S. benchmark. The picture in Asia was less rosy with MSCI’s broadest index of Asia-Pac shares outside Japan falling 0.6%,

Russia hammers Kyiv with missiles in large-scale attack By CONSTANT MEHEUT and ANATOLY KURMANAEV
R
ussian missiles and drones hammered Kyiv on Tuesday morning, officials said, in a large-scale attack on the Ukrainian capital and other cities that killed at least five people and injured nearly 130 others, a day after President Vladimir Putin of Russia promised to retaliate for a Ukrainian assault on a Russian city. The barrage — which the Ukrainian air force said involved about 100 missiles, including hypersonic weapons that fly at several times the speed of sound — was the latest in an escalating cycle of air assaults between the two countries, as both sides look for ways to inflict damage away from the largely deadlocked front line. Moscow claimed that Ukraine retaliated hours later Tuesday, firing at least eight missiles on the Russian city of Belgorod. The attack killed one civilian and injured four others, according to the local governor. Later in the day, a strike hit the nearby town of Shebekino, the governor said, damaging an administrative building but causing no injuries. The recent strikes against Ukraine may also be the start of another Russian air campaign against critical infrastructure. Ukrainian authorities had warned for months that Russia was stockpiling high-precision missiles to pound cities once the weather turned cold in a repeat of last year’s bombing campaign. Experts believe that strategy is aimed at diminishing Ukrainian morale and weakening its military and industrial capacities. Both sides have improved their air defenses in the past year, but they have also expanded their military capacity to hit targets away from the front lines. And as the past week’s cycle of strikes and counter-strikes escalates, Moscow and Kyiv are showing growing readiness to deploy these capabilities. “This is a competition of endurance,” said Serhii Kuzan, chair of the research group Ukrainian Security and Cooperation Center. He said Ukraine’s powerful air defenses were now forcing Russia to launch massive air

With each new attack, he added, Russia increasingly legitimizes “Ukraine’s retaliatory strikes against Russian air and naval bases, ammunition depots, defense enterprises and enemy oil bases.” Both sides appear to be trying to justify the airstrikes as retaliation for previous attacks, in an escalating titfor-tat that risks causing more civilian casualties, either from direct targeting or falling debris. Since the start of the war Russia has regularly targeted civilian areas in Ukraine, resulting in thousands of casualties. In Kyiv on Tuesday, most of the casualties were reported at a nine-floor residential building that was damaged and caught fire. Vitali Klitschko, the mayor, said at least two people died and 49 others were injured there. The recent wave of missile attacks intensified Friday, when a ferocious Russian missile barrage killed at least 39 people, wounded about 160 others and hit industrial and military infrastructure as well as hospitals and schools, Ukrainian officials said. The next day — in what a Ukrainian official said
was a response to Russia’s attack Friday — a barrage of missiles killed 24 people in the Russian city of Belgorod — the deadliest attack on the Russian territory since the start of the war. In New Year’s Day remarks, Putin vowed retaliation. “From our side, we will build up the strikes,” he said. Hitting Kyiv on Tuesday appeared to be a prime objective. Air-raid alerts sounded throughout the morning, as wave after wave of missiles rained down, punctuated by loud bangs of air defense systems trying to destroy them. Massive plumes of black and white smoke rose over the capital, cutting through the gray early morning sky, as several buildings were hit. Kharkiv, near the border with Russia, also came under a large-scale missile attack, according to its mayor, Ihor Terekhov. One person was killed there and 45 were injured, he said. On Tuesday, the Belgorod region came under attack again, according to Russian officials, in what may have been Ukraine’s response to the morning’s strikes. Ukrainian officials have not yet commented on that assault. Ukraine’s largest Western allies have explicitly prohibited the government in Kyiv from using the weapons they supply to hit targets inside Russia’s internationally recognized borders. Russia’s Defense Ministry claimed that Ukraine’s latest attacks on the Belgorod region Tuesday were launched from a Ukrainian-made Vilkha multiple rocket launcher, highlighting the country’s growing domestic military capabilities. For its part, analysts believe Russia has been able to expand its own missile production in the past year despite Western sanctions. Ukrainian officials warned in the fall that Russia had stockpiled more than 800 highprecision weapons in preparation for massive winter assaults. It was not immediately clear what, exactly, the Russian military tried to hit in its attacks against Kyiv on Tuesday. At least two facilities located in an industrial zone in the north of the capital were hit, and remained shrouded in billows of smoke by midday. Ukraine’s Energy Ministry also said that nearly 260,000 residents had been temporarily left without electricity Tuesday, suggesting that the power grid may have been one of the targets. “Those missiles are a bit random,” said Serhii Zarybin, an employee of a cement factory, as he looked at what was left of a large auto repair workshop burned down in a strike. In front of him, dozens of cars were charred and twisted metal sheets were scattered all around, while a thick cloud of white smoke hovered above the site.

ope Francis used his New Year’s Day address to highlight concern over the worsening situation of the Catholic Church in Nicaragua as a result of a protracted crackdown by the government of President Daniel Ortega, which has detained clerics, expelled missionaries, closed Catholic radio stations and limited religious celebrations. Speaking to the faithful gathered in St. Peter’s Square for the traditional New Year’s Angelus prayer and blessing, Francis said he was “following with concern what is happening in Nicaragua, where bishops and priests have been deprived of their freedom.” He expressed his “closeness in prayer to them, their families and the entire church in the country,” and called on all Catholics to “pray insistently” to find “a path of dialogue to overcome difficulties.” “Let’s pray for Nicaragua today,” Francis said. Vatican News reported Monday that at least 14 priests, two seminarians and a bishop had been arrested in recent days in Nicaragua, and that the country’s top church leader, Cardinal Leopoldo Brenes, had expressed his closeness “to the families and communities who are without their priests at this time.” Since 2018, as Ortega has increasingly sidelined political opponents from all walks of life, detaining many and suppressing civic rights, the country’s Catholic leaders remained among the only independent voices of dissent. Gianni La Bella, a professor of contemporary history at the University of Modena and Reggio Emilia, said in a 2022 interview that since 2018, there had been dozens of attacks of various kinds against the church and its institutions, a sign that the Ortega government perceived the “Church as an obstacle,” as the “only beacon that can shed light on the conditions of the people in Nicaragua.” Church leaders initially tried to mediate between the government and political opposition, but they were unsuccessful, and the government’s crackdown intensified. Since 2018 the Catholic Church in Nicaragua has been subject to more than 770 attacks, arrests, expropriations, and harassment including “impediments to processions, prayers, masses in cemeteries,” as well as hate messages, according to Martha Patricia Molina, a Nicaraguan lawyer and author of the study “Nicaragua: A Persecuted Church?” In August 2022, Bishop Rolando Álvarez became the most senior clergyman to be detained in Latin America for political views in decades. After the bishop’s arrest, Francis spoke of “his concern and sorrow” over the situation in Nicaragua. “I would like to express my conviction and my hope that, through an open and sincere dialogue, the basis for a respectful and peaceful coexistence might still be found,” Francis said after the weekly Angelus prayer at that time. In February, Álvarez was convicted of treason, stripped of his citizenship and sentenced to 26 years in prison. Some of the clerics who have been imprisoned have been released, and in October, the Vatican announced that 12 priests from Nicaragua who had recently been released from prison would be housed in the Diocese of Rome. Ortega lost elections in 1990 but reclaimed the presidency in 2007, and spent a decade chipping away at the country’s democracy. Tens of thousands of people rose up
against Ortega and his wife, Vice President Rosario Murillo, in 2018, accusing them of being a dictatorial family dynasty. Hundreds of people landed in prison for opposing the government, and at least 300 were shot in protests. Last year, Ortega began seizing the properties of political prisoners and dissidents forced into exile. The government also took control of the buildings and bank accounts of a prominent Jesuit-run university in Managua, accusing the school of being a “center of terrorism,” according to Fides, a Catholic news agency. Throughout the crackdown, the Vatican has opted to keep doors of communication with the government open. On Monday, Francis spoke of finding “a path of dialogue to overcome difficulties.” Victor Gaetan, author of a book on Vatican diplomacy, wrote in Fides last year, “A common Vatican strategy, especially under an autocratic regime, is to maintain a presence and resist being swallowed — quietly working to limit the state’s most aggressive tactics while seeking preservation of the sacraments and apostolic succession.”

Death toll rises to at least 55 after powerful earthquake in Japan By MOTOKO RICH and HISAKO UENO
A
t least 55 people were killed in the powerful earthquake that struck western Japan on Monday, authorities said a day after the disaster, as they continued to comb through the rubble of collapsed and burned buildings. The dead included 24 in Wajima, a city in Ishikawa prefecture, the coastal epicenter of the earthquake, which triggered tsunami warnings, extensive evacuations and widespread power outages after it hit around 4:10 p.m. on New Year’s Day. A large fire broke out in Wajima after the quake, which registered 7.6 on the Japanese seismic intensity scale. Some died after being trapped in rubble from destroyed buildings. The tsunami warnings were lifted Tuesday morning and the quake did not produce waves as high as initially feared. Police, firefighters and members of the country’s Self-Defense Forces were still assessing the damage, which included buckled roads along with charred houses and commercial facilities. About 33,000 homes in Ishikawa and neighboring Niigata prefecture were without power Tuesday morning, said Yoshimasa Hayashi, chief Cabinet secretary. About 20,000 homes across four prefectures lacked running water. Hayashi said 57,360 people had fled their homes and gone to nearly 1,000 different evacuation facilities across the affected prefectures. He said officials continued to search for people buried under rubble after 120 such incidents were reported to local police or fire departments, raising the possibility of a higher death toll. Hayashi said nuclear power plants in the affected prefectures continued to report no abnormalities. Officials warned residents in the affected areas to brace for further aftershocks, landslides or new tsunami warnings. Speaking to reporters at a briefing Tuesday morning, Noriko Kamaya of the Japan Meteorological Agency said there was a
10% to 20% chance that an earthquake of equivalent intensity could occur in the next week. She urged residents to exercise caution during sea-based activities such as fishing. Prime Minister Fumio Kishida told reporters Tuesday that
teams were working to clear roads blocked by landslides or damaged buildings. He also said retailers were supplying water, food, blankets, portable toilets and more to those housed in evacuation centers.

he Israeli military said Tuesday that it had begun withdrawing some soldiers from parts of the Gaza Strip, part of a planned pullout of about five brigades, but its forces continued pounding the enclave with airstrikes, according to residents. Witnesses and Palestinian news reports said that Israeli forces were withdrawing from several parts of northern Gaza, including Jabalia, a refugee camp dating back to 1948 that has grown into a dense, bustling town, as well as the area north of the Shati refugee camp, the area around AlRantisi Hospital and other neighborhoods of Gaza City. Hearing the news, some Palestinians who had fled the north earlier in the war returned to check on their homes and neighborhoods. They found their old streets transformed, said Abed Karin Khadar, 24, who went with his family back to Al Juron, a neighborhood in Jabalia, to see if he could grab some clothing from their home. He described the scene in an audio message Tuesday. Buildings lay in pieces, he said. Streets were flooded and
pocked with deep craters. Bodies lay here and there, rotting, he said. As they walked down the streets, they could hear people calling from under the rubble of destroyed buildings, pleading, “We’re down here,” Khadar recalled. But they could do little with their bare hands, and civil defense teams could not get close because the roads were blocked with debris. When he reached home at last, he said, he found it burned down. “They just destroy whatever they can,” he said. “It’s a ghost town. Houses are burned. Roads are damaged. They leave homes burned, ruined.” And the risks to civilians remained. In southern Gaza, the Palestinian Red Crescent Society said Tuesday that Israeli shelling had struck its headquarters, in Khan Younis, killing at least five displaced people who had been sheltering in the area, including a 5-month-old infant, and that three people had been injured, including one of the organization’s first responders. The Israeli military did not immediately comment. Khadar said a rocket landed less than 100 yards from
him, killing one person. “This announced withdrawal is just for media consumption, but effectively, they are still striking the area,” Khadar said of the Israeli military. Israel had announced Monday that it would begin withdrawing several thousand troops from Gaza, at least temporarily, in an effort to shore up the country’s economy, which has slumped as reservists across the country stop working to take up arms. Analysts viewed the move as a sign of Israel’s impending shift to a more limited, targeted phase of the war, a pivot the United States has been urging it to make. But Israel’s defense minister, Yoav Gallant, indicated Tuesday during a visit to Gaza that the war would continue. He said Israeli forces would keep “holding a finger on the trigger” in northern Gaza, where he said the military had destroyed Hamas battalions but would continue targeting the several thousand fighters it estimates remain there. “We are not giving up,” he said. The military said Tuesday that it had conducted targeted operations over the last few days across Gaza and killed dozens of Hamas fighters.

Governor defiance tries to usurp Washington’s role By DAVID FIRESTONE
I
n mid-December, just one day after Texas Gov. Greg Abbott signed into law a radical new immigration bill, immigrant rights groups challenged it in court as ridiculously unconstitutional. The groups felt they had no choice, but they did exactly what Texas was counting on, because the point of the law isn’t simply how outrageous it is; it’s about the fight it will cause. And nothing defines Abbott’s governorship more than his endless fights against Washington, almost always in a way that hurts the poor, the stateless and those who live outside the boundaries of his state’s Republican culture. The new law gives Texas the power to take over immigration enforcement from the federal government. It’s now a state crime to cross from Mexico to Texas at an unauthorized crossing; state police are empowered to arrest migrants, and state judges are empowered to order them to leave the country. Forget all those niceties about asylum policy; if Texas doesn’t want you in the state, it can kick you back over the border. None of this is legal, of course. Only the federal government can set immigration policy and enforce border security. Only the federal government can arrest migrants for immigration violations or deport them. The Supreme Court made that clear in 2012 in a decision that prohibited Arizona

AN JUAN – El Centro de Investigación en Ciencias Moleculares (CICiM) de la Universidad de Puerto Rico fue nuevamente anfitrión de un internado especializado en biología molecular y biotecnología, llamado Taller de Biotecnología y Biología Molecular Avanzada, dirigido a estudiantes de ciencias y premédica de la Universidad del Sagrado Corazón (USC). Esta iniciativa propició que una docena de estudiantes universitarios recibieran adiestramientos en instrumentación científica de última generación y técnicas avanzadas, tales como cultivo celular eucariota, extracción y purificación de metabolitos, resonancia magnética nuclear (NMR, por sus siglas en inglés) y microscopía de fluorescencia. El evento fue respaldado por el proyecto “Empowering STEM in Sagrado” (ESTEMS) de la Fundación Nacional de Ciencias (NSF, por sus siglas en inglés), en alianza con los Centros de Excelencia en Investigación Biomédica y el Centro de Neuroimagen y Electrofisiología (COBRE y NIEF, por sus siglas en inglés), ambos proyectos con sede en el CICiM. America Ferrera and the ‘Barbie’ monologue we all talked about By CARLOS AGUILAR
L
isting some of the many perils of womanhood in a still patriarchal society, the monologue that actress America Ferrera delivers in “Barbie” with the intensity of a rallying cry, became one of the most talkedabout movie moments of 2023. “I’ve never been a part of something so eagerly anticipated,” Ferrera said during an interview at a Beverly Hills, California, hotel restaurant. Originally from Los Angeles but based in New York, she was back in her hometown for an awards-season screening of the smash hit. Relaxed in a cozy beige sweater, Ferrera, 39, was recalling a prerelease press stop in Mexico City where 20,000 frenzied people welcomed filmmaker Greta Gerwig and the cast of her pink-soaked comedy. “It was like a presidential campaign,” she added. Ferrera plays Gloria, mother and Mattel employee whose self-doubt and unfulfilled aspirations in the real world prompt an existential crisis in Stereotypical Barbie (Margot Robbie) in Barbie Land. Ferrera’s plucky performance has landed her in the Oscar discussion this year. Although Gloria might be considered a supporting player in “Barbie,” Ferrera knows that it’s her flawed character who sets the adventure in motion. The performer, who broke through in “Real Women Have Curves” (2002) and went on to win an Emmy for her turn as the title character in “Ugly Betty” (2006-10), deeply admires how Gerwig dared to infuse a seemingly vacuous concept with plenty of meaning. “It’s huge for something that is both so commercially successful and culturally dominant to also be about many things at the same time, which is not easy to execute in the biggest movie of the year,” Ferrera noted. Here are edited excerpts from our conversation. Q: Has the massive success of “Barbie” come as a surprise to you? A: I went into reading the script with really no attachment to Barbie at all. I didn’t grow up playing with Barbies. I was more curious about what Greta would do with it. It wasn’t just funny and subversive and delightfully weird. It was also about womanhood. When I was done reading the script, I was just giddy that this was the Barbie movie that no one asked for, but we were going to get. I felt it was going to be huge from the beginning. Q: Why did you never play with Barbies

A: We couldn’t afford Barbies. She was very expensive along with all of her stuff. [Laughs] I had a cousin who had Barbies, and I would play with them at her house, but they also seemed very far away from me. I didn’t necessarily feel represented in the Barbie narrative. It felt like a world that wasn’t accessible to me. Q: Since you didn’t have a personal attachment to Barbie, how did you find your way into the character of Gloria and this world? A: One of the things that really gave me a glimpse into this character was the documentary called “Tiny Shoulders: Rethinking Barbie” that showed when Barbie expanded into many different sizes and shapes and colors. The woman [Kim Culmone] who led that as the head Barbie designer, a very cool feminist progressive woman, was getting backlash from all sides: From the legacy holders saying, “Barbie can’t change.” And from her progressive friends, angry that she cared
about Barbie. “Why would you care about something that has been so bad for women?” But she had her own deep personal connection to playing with Barbies with her mother. She fought for this idea that she knew was imperfect but that still meant something to her. That gave me the insight I needed to play Gloria as a real adult woman and to understand why she plays with Barbie and wishes herself to Barbie Land. Q: What did you think the first time you saw Gloria’s now incredibly popular speech? A: It definitely felt like an important moment, but Gloria was shining from the very beginning. She represents this quest for the permission to express yourself. She has to play the role of Mom and of responsible career woman, while hiding everything she loves underneath the corporate suit, being what she thought she needed to be. From the moment we meet her with her pink sneakers on to her getting to drive in that car chase, there was so much wish fulfillment and release for somebody who has been repressing so much. The monologue felt so right for Gloria. Yes, it breaks the Barbies out of their moment, but it’s also the natural breaking point for Gloria, where she has to say what she’s discovering on this journey. I recognized that it was a big moment and that it needed to work, but it also didn’t work independent of her entire search for more freedom for herself. Q: What are your thoughts on the discourse that some people believe Gloria’s speech oversimplifies feminism? A: We can know things and still need to hear them out loud. It can still be a cathartic. There are a lot of people who need Feminism 101, whole generations of girls who are just coming up now and who don’t have words for the culture that they’re being raised in. Also, boys and men who may have never spent any time thinking about feminist theory. If you are well-versed in feminism, then it might seem like an oversimplification, but there are entire countries that banned this film for a reason. To say that something that is maybe foundational, or, in some people’s view, basic feminism isn’t needed is an oversimplification. Assuming that everybody is on the same level of knowing and understanding the experience of womanhood is an oversimplification. Q: Gloria’s story is deeply intertwined with that of Barbie. How do you think the
two help each other overcome their struggles? A: Greta, Margot and I talked about Gloria and Barbie’s relationship as a love story. Not necessarily a romantic one, which some people on the internet have pushed for that reading of it, but we talked about it as Barbie and Gloria needing each other to be complete and to be the pieces of a puzzle that’s missing for each of them. The journey releases Gloria of the impossible assignment of being the kind of woman that she thinks she needs to be in the real world. And Barbie releases her herself from having to be an idea that is never going to satisfy all the things she’s meant to satisfy by choosing to be a human. Q: What was your reaction when you first saw the doll made in your image for the Barbie collection inspired by the movie? A: Surreal. There were actually some similarities to me in the facial features. She’s the first Barbie doll fashioned after a Honduran American woman to ever exist. That’s really special, to know that no one had a Honduran Barbie doll to play with until now. Q: Do you feel like your career has always been marked by firsts, like being the first Latina to win a lead acting Emmy? There’s a lot of pressure in being the first. A: I just took any single opportunity in front of me to do the best possible work that I could do in the hopes that there would be another opportunity after that. Looking backward, it’s much clearer to see that my career has been shaped by how the culture saw somebody like me. The opportunities that came my way were ones that kept me in very specific boxes. What I saw as my job as an actor was to inject those characters with as much complexity as I could, and not just play characters that were a foil to an expectation. Q: What does the ideal future for Latinos in the industry look like to you? A: The hope is that we get to actually have outlets for the immense talent that exists among Latinos. And that we can move beyond fighting just to be visible and that we can actually create and exist as full humans, as artists, with things to say beyond, “We’re here.” But it’s hard to find those opportunities. There’s a lot out there that is very transactional in terms of checking boxes to claim diversity. One of the most exciting things to me about this movie was, as a Latina woman, being invited to be a part of something so adventurous and joyful and fun. Gloria is Latina, but being Latina was not her reason for being in this story.

Ana Ofelia Murguía, Mexican actress and voice in Disney’s ‘Coco,’ dies at 90 By ZAN YHUANG

na Ofelia Murguía, one of Mexico’s most acclaimed actresses, whose voice acting as Mama Coco in the animated movie “Coco” brought her international recognition, died Sunday. She was 90. Her death was confirmed by Mexico’s National Institute of Fine Arts and National Theater Company, which did not specify the cause of death. The National Theater Company described Murguía on social media as “one of Mexico’s greatest actresses.” In a statement, Lucina Jiménez López, director of the National Institute of Fine Arts, described her career as one that “marked an entire era.” In the 2017 film “Coco,” made by Disney’s Pixar Animation Studios, Murguía plays the key role of Mama Coco, the great-grandmother of a boy, the protagonist Miguel, who finds himself in the land of the dead on a journey to uncover his family’s history. At the emotional climax of the film, Miguel and Mama Coco sing the song “Remember Me” together. The movie, which is built around the Mexican holiday of the Day of the Dead, was celebrated for its portrayal of Mexican culture and its handling of weighty subjects like death in

It won best animated featured and best original song, for “Remember Me,” at the 2018 Oscars. “Coco” introduced Murguía to a global audience, but she was well-known in her home country long before. Ana Ofelia Murguía was born Dec. 8, 1933, in Mexico City. She studied acting at Mexico’s National School of Theater Arts and made her debut in 1954 in the play “Trial By Fire.” Her first screen role was in the 1964 film “Transit.” She would go on to appear in more than 70 plays and 90 films, working with some of Mexico’s best filmmakers. Hailed for her versatility, she often played the role of the villain or antagonist, according to a statement from the Institute of Fine Arts and National Theater Company. At Mexico’s prestigious Ariel awards, Murguía won best supporting actress for her performances in “Cadena Perpetua,” in 1979; “Los Motivos de Luz,” in 1986; and “La Reina de la Noche” (The Queen of the Night), in 1996. She was nominated for best actress five times but never won. In 2011, she was recognized with a Golden Ariel special lifetime achievement award. Considering dry January? Set yourself up for success. By CATHERINE PEARSON
D
ry January sounds like a simple proposition: No alcohol. For 31 days. And some enthusiasts jump in without much planning — perhaps even hungover after a rowdy New Year’s Eve. There is no data suggesting that those folks won’t be able to abstain from drinking, said Dr. David Wolinsky, an assistant professor of psychiatry and behavioral sciences with Johns Hopkins Medicine, who specializes in addiction. But starting the month with a few strategies in your back pocket — and with a clear sense of your goals — may help you get the most out of the challenge. “Most of the benefits of Dry January are probably going to be related to the intention with which you go into Dry January,” Wolinsky said. The challenge isn’t a stand-in for treatment for people with alcohol use disorder, he stressed, but those who are looking to get a fresh start to the year may benefit from the mental and physical reset it can offer, and the opportunity to adopt new habits. For instance, a 2016 study found that six months after Dry January ended, participants were drinking less than they were before. We spoke to Wolinsky and other experts about some strategies for a successful month. Tell people about your plan. One of the simplest steps is to spread the word among friends and family that you intend to take the month off, said Casey McGuire Davidson, a sobriety coach and host of “The Hello Someday Podcast,” which focuses on “sober-curious” topics. Research has shown that accountability can play a crucial role in helping habits stick, and you might find a friend or partner to join you, Davidson suggested. Even if you don’t, you may be surprised by how encouraging people are of your goal (though she said you should share it only with people you trust). “Dry January gives people a pe-

(Lorenzo Gritti/The New York Times) riod of time when they can stop drinking with community and support,” she said, “without a lot of questions.” Davidson also recommended reading books that may help you evaluate your relationship with alcohol, or listening to sobriety podcasts. Identify your triggers. Habits tend to be cued by certain environments or situations, explained Wendy Wood, a professor of psychology and business at the University of Southern California and the author of “Good Habits, Bad Habits: The Science of Making Positive Changes That Stick.” For instance, “you have a toothbrush ‘habit,’” she said. “You put your toothbrush in a certain place. You brush your teeth usually at about the same time in the morning in that place.” Wood said that for many people, drinking habits are shaped in a similar way. “Understanding where it is that you typically drink, who you’re with, what you drink, and disrupting those
cues — disrupting the context in some way — is really critical to changing habits,” she said. It may help to jot down observations throughout the month, Wolinsky said, recommending three columns: What was the situation in which you wanted to drink? What were your thoughts about drinking? And what did you do instead? Find friction points. Building extra time or effort into an activity that is typically seamless for you — such as pouring a glass of wine when you walk through the door after a long day at work — greatly reduces the likelihood of engaging in that behavior, Wood said. Something as simple as moving your wineglasses to the back of the cupboard can create just enough friction to help you achieve your goal of abstaining. Similarly, Davidson recommended removing all alcohol from your home before Jan. 1, or at least your favorite drinks. “I was a red wine girl,” she said.
When she took a break from drinking — a break that has lasted eight years — Davidson told her husband: “I can’t have any in the house. If it’s sitting on the counter, there’s no way I’m not going to pour myself a glass.” Make a plan for self-care. All of the experts recommended thinking about what you will do during moments when you would otherwise be drinking. So, instead of mixing a cocktail to relax before bed (which can disrupt sleep anyhow), you might try deep breathing or brewing a cup of tea. It may take some trial and error to find satisfying alternatives. “Give yourself grace” in the coming weeks, said Khadi Oluwatoyin, founder of the Sober Black Girls Club. Make time for rest to the extent you are able. And don’t take on too many New Year’s resolutions, she suggested; for instance, doing Dry January while adopting a new diet may be a recipe for failure. Some people slip up simply because they are hungry, Oluwatoyin said: “Go get something to eat!” Davidson recommends rewarding yourself, either at the end of each day or the end of the week. Fun activities or indulgences can help the month feel like less of a slog. “This is a period of experimentation and curiosity,” she said. “Instead of going to a bar, can you get a pedicure or massage on Friday night? Or get takeout sushi and plan a movie night with friends or your partner?” These “tiny shifts” can give you something to look forward to.

11. Voting Record Date. The voting record date is November 14, 2023 (the “Voting Record Date”), which is the date for determining which Holders of Claims in Voting Classes (except the Bond Classes15) are entitled to vote on the Fifth Modified Third Amended Plan. The Exculpated Parties have, and upon confirmation of the Plan shall be deemed to have, participated in good faith and in compliance with the applicable laws with regard to the solicitation of votes and distribution of consideration pursuant to the Plan and, therefore, are not, and on account of such distributions shall not be, liable at any time for the violation of any applicable law, rule, or regulation governing the solicitation of acceptances or rejections of the Plan or such distributions made pursuant to the Plan. For the avoidance of doubt, notwithstanding anything contained herein to the contrary, the Plan shall not, and shall not be construed to, release or exculpate, any payment obligation under the applicable National Insurance Policy, to any beneficial holder of National Insured Bonds, in accordance with its terms solely to the extent of any failure of such holder to receive the treatment provided to Holders of Claims in Class 9 (or any claims that National may have against a beneficial holder of National Insured Bonds with respect to National’s applicable obligations under the National Insurance Policies). As of the Effective Date, all Entities that hold, have held, or may hold a Released Claim released pursuant to this Article XXXI of the Plan, are, and shall be, permanently, forever and completely stayed, restrained, prohibited, barred, and enjoined from taking any of the following actions, whether directly or indirectly, derivatively, or otherwise, on account of or based on the subject matter of such discharged Released Claims: (i) commencing, conducting, or continuing in any manner, directly or indirectly, any suit, action, or other proceeding (including, without limitation, any judicial, arbitral, administrative, or other proceeding) in any forum; (ii) enforcing, attaching (including, without limitation any prejudgment attachment), collecting, or in any way seeking to recover any judgment, award, decree, or other order; (iii) creating, perfecting, or in any way enforcing in any matter, directly or indirectly, any Lien; (iv) setting off, seeking reimbursement or contributions from, or subrogation against, or otherwise recouping in any manner, directly or indirectly, any amount against any liability or obligation owed to any Entity released under Article XXXI hereof; and (v) commencing or continuing in any manner, in any place of any judicial, arbitration, or administrative proceeding in any forum, that does not comply with or its inconsistent with the provisions of the Plan or the Confirmation Order. Section 40(C) – Supplemental Injunction. n the only recent year in which Travis Kelce and the Kansas City Chiefs weren’t playing in the Super Bowl, the NFL star was driving around Los Angeles in early February with his business managers, André and Aaron Eanes, marveling at billboards featuring Dwayne Johnson, the actor and entertainer better known as The Rock. “Man, I don’t think I’ll ever be as famous as the Rock,” Kelce said. His co-managers looked at each other. “We’re like, ‘Yes, you can,’” André Eanes said. The twin brothers had known since Kelce was at the University of Cincinnati that the 6-foot-5 athletic star with the Marvel-character physique, blue eyes and affable charm had crossover potential. But let’s be honest. Nobody imagined this. This was a year even The Rock might envy. Kelce, a tight end, won the Super Bowl (his second) in February. In March, he hosted “Saturday Night Live.” He’s starred in seven national television commercials. The podcast he co-hosts with his brother, Jason, is among the most popular on Spotify. He launched a clothing line with his team. And he’s dating the world’s most famous pop singer. Perhaps you’ve heard. Kelce’s sudden conquering of the zeitgeist — being put on the map, if you will — has taken even die-hard football fans by surprise. The reality is that most of his ascent has been years in the making — the result of a carefully manicured business plan developed by the 34-year-old Eanes brothers that blossomed at precisely the right moment. The Chiefs have spent the past few years as the most unstoppable force in football and, along the way, Kelce’s other team has grown to include a creative strategist, a community outreach coordinator, a Los Angeles-based publicist, a personal chef and a trainer. He has four football agents, led by Mike Simon at VMG. In the spring, he also became a client of Creative Artists Agency to feed his budding acting itch.

Game shows are a consideration. Maybe a few less commercials. “People say to me, ‘Man, it’s been a crazy year,’” Aaron Eanes said. “When I say, ‘Actually, it’s not that crazy,’ people look at me funny. It’s because it’s easy when you have a plan. We’re executing that plan.” Before you run to YouTube and TikTok to research conspiracy theories, no, the plan did not include Taylor Swift. Kelce’s managers have a window of time between the ending of the Super Bowl in February and the beginning of training camp in July in which their plan for the Kelce brand must unfold. Once the season starts, Kelce manifests what he wants on his own. But while Kelce’s shift into a more mainstream form of celebrity was planned out before he met Swift, there is no question that the doubling of his prospective audience — from mostly men between the ages of 18 and 49 to a far larger group bolstered heavily by Swift’s female fans of all ages — has changed the calculus for
where the plan goes from here. “The awareness of Travis is much larger and with an even broader audience,” said Richard Lovett, CAA’s co-chair. “It’s accelerated that which was probably inevitable in terms of his level of awareness and appeal.” André Eanes, who manages Kelce’s portfolio of 28 investments, first met his client through Kelce’s college roommate, D.J. Woods, a childhood friend of Eanes, who grew up near Cleveland. They became close when Eanes started an event management business while still in college that booked venues and hosted DJs around Cincinnati. Eanes became Kelce’s go-to guy for a VIP pass. “He was always the life of the party,” André Eanes said of Kelce. “Everyone wanted to go hang out with Travis.” At the same time, Aaron Eanes was studying sport management and entrepreneurship at Bowling Green University in northern Ohio. He wanted to help athletes grow their careers. But he had no interest in becoming a traditional sports agent. “Agents are contract advisers,” Aaron Eanes said. “I thought instead about a music model and building a business where there’s coordination with all their external
providers.” Aaron Eanes hadn’t even graduated when he began pitching college football players about the services of a manager in addition to a traditional agent. It was an unusual proposition at the time for most players, whose focus primarily was on getting that first professional contract. But Kelce seemed to grasp the bigger picture that his friends were charting. He became the second client of A&A Management, the company that the Eanes brothers still run. “It was unusual,” said Simon, Kelce’s agent. “I think his thought process at the time was, ‘Let’s all do this together, and we’ll figure it out as we go.’” Kelce’s first glint of mainstream publicity came in a 2015 feature in Complex magazine, in which he stood on a pool table wearing a burgundy velour Versace jumpsuit and Gucci sunglasses. A short time later, Aaron Eanes got a call from a producer from E! about a reality dating show. “I was like, Absolutely not!” Aaron Eanes said. The brothers eventually relented, thinking that a TV show might open other doors. After “Catching Kelce,” which ran for eight episodes and never did find Kelce’s true love, they agreed that reality television was one and done. Instead, Kelce, a lifelong comedy fan, gave his co-managers a lofty goal to chase: He wanted to be on “SNL.” Aaron Eanes reached out to the show’s producers during the 2020 season, but their reciprocated interest sounded lukewarm at best. That changed in October 2021 after Kelce dropped into an “SNL” after-party before a game in Philadelphia and went to work, chatting up (and impressing) Lorne Michaels. The day after the Chiefs defeated the Philadelphia Eagles in the Super Bowl in February, Aaron Eanes’ phone rang at 9 a.m. It was “SNL.” “I don’t think he’s even been to sleep yet,” Aaron Eanes told the booking agent. After walking out onto the stage at Rockefeller Center’s Studio 8H on March 4, less than a month after the Super Bowl win, Kelce choked up during the show’s opening monologue at the enormity of fulfilling a childhood dream. He had brought

After “SNL,” the Eanes brothers began interviewing Hollywood agencies that had stronger connections in the entertainment industry. “We’re just two guys that live in Ohio,” Aaron Eanes joked. Lovett and Tom Young, CAA’s co-head of sports media, both said that Kelce had an easygoing charisma and a coachable nature that made producers want to work with him. “Decision-makers and those folks that are meant to be visionary about who’s the next potential movie star, those folks had already tapped into Travis even coming out of ‘Saturday Night Live,’” Lovett said. “And probably before.” But nothing was being rushed, Aaron Eanes said. That’s not Kelce’s style. And Aaron Eanes had already been laying the groundwork for his client’s path to the A-list. Throughout 2022, Aaron Eanes had targeted endorsement deals with companies that were not traditional NFL partners — like promoting vaccines for Pfizer, for instance, or a new debit card from Experian. The purpose was to build out Kelce’s resume as a standalone pitchman, rather than yet another interchangeable player in a commercial for one of the NFL’s partners, capitalizing on a foundation built by the league.
Danielle Salzedo, a veteran brand strategist who joined Kelce’s management team after 14 years at Viacom, said she has adopted marketing lessons from working with music artists like Harry Connick Jr., who was constantly willing to reinvent himself to reach new audiences. “That ability to continue to evolve what your image is and stay current but still remain elevated, from someone who is already a global star,” Salzedo said, “is something that I think Travis has the ability to do.” Kelce’s inner circle insists that his time as a viral celebrity hasn’t changed him. His personal chef, Kumar Ferguson, has been pals with Kelce since they played recreational basketball together in the fourth grade. He drives home-cooked meals (typically wild rice, chicken and veggies) to the Chiefs’ practice facility every day so that he and Kelce can have lunch together. Despite the growing pile of distractions, Kelce’s longtime trainer, Alex Skacel, said the star tight end’s dedication to football has never been stronger. Skacel likes to share the story of a visit to Paris Fashion Week a few years ago, when he and Kelce took a late-night jog around the city because Kelce was antsy for a workout after an entire day of sitting by the runway. “It’s midnight, and we’re doing sprints over the bridges over the river,” Skacel said. “No matter where he is, he finds time to get done whatever he needs to get done.” While 2023 was a nearly perfect year for Kelce, Aaron Eanes
said the increased attention has his team considering a potential area of concern: oversaturation. Is there too much of Kelce on television and in the news, and could fans grow numb to the sight of him? The plan for next year revolves around one word: curation. Fewer deals. Quality over quantity. Authenticity first. After a midweek visit to New York to talk at a sports business conference, the Eanes brothers were rushing to catch flights to Ohio for a few days with family before heading back to Kansas City, where the Chiefs were playing the Buffalo Bills in a clash of two top teams. The game was decided in the final moments by a penalty that reversed what would likely have become a signature play in Kelce’s career. Trailing by 3, Kelce caught a pass in the open field. Then, as he was about to be tackled, he showed off the arm he had used as a high school quarterback, throwing a perfect pass back to an open teammate who raced in for what appeared to be a game-winning score. The only problem was that the teammate had lined up incorrectly before the play, which erased the touchdown. The Chiefs went on to lose the game, but once again, Kelce had found a way to be in the middle of everything. “We positioned Travis to be world famous,” André Eanes said. “We didn’t know how it would happen, or when it would happen, or what would help push that further along. But it’s always been the thought in the back of our minds.”
PGA Tour and Saudi-backed LIV extend deadline to finalize deal By LAUREN HIRSCH
W
hen the PGA Tour and the upstart LIV Golf league, which is bankrolled by Saudi Arabia’s sovereign wealth fund, announced their groundbreaking deal in June for the men’s golf circuits to join forces, they left most details unanswered and set a Dec. 31 deadline to figure them out. Now, with that deadline having come and gone, it is clear that the two sides will need more time. The PGA Tour commissioner, Jay Monahan, said in a memo to players Sunday evening that the PGA Tour and Saudi Arabia’s sovereign wealth fund, the Public Investment Fund, were “working to extend” the negotiations into the new year. The sides had been discussing signing a formal one-month extension, which could be further prolonged, said three people familiar with the negotiations who were not authorized to discuss them. But while both sides remain focused on completing a deal, they have not set any new formal deadline. Those negotiations continue as the PGA Tour progresses on simultaneous talks to raise additional money from Strategic Sports Group, an investment group
led by Fenway Sports Group — the parent company of the Boston Red Sox, the Pittsburgh Penguins and the English soccer club Liverpool. Monahan said on Sunday that the tour and Strategic Sports Group “have made meaningful progress” in their talks and that the tour had “provided S.S.G. with the due diligence information they requested.” The parties are focused on finalizing terms of the deal and documents, he said. The PGA Tour, the Saudi wealth fund and the Strategic Sports Group entered 2024 with significant uncertainty about the deal. Since the June announcement, questions that had initially accompanied the agreement’s frenzied rollout appear to have compounded: How will potential U.S. investment sit alongside Saudi money? How will the golf circuits work together even as the Saudis still actively seek to poach PGA Tour players? The planned partnership was announced on June 6 with scant contours of an actual agreement. The PGA Tour and the Saudi wealth fund had planned to work out the details, including governance, the valuation of assets and how the money would be put to work, by the end of 2023.
About two weeks after the tentative partnership was announced, the tour and the Saudi wealth fund, which had been bitterly feuding for months, agreed to drop their acrimonious litigation against each other. LIV had accused the tour of violating antitrust laws, and the tour had accused LIV of improperly interfering with existing player contracts. In the months since, the preliminary pact has faced backlash from players, who said that they were blindsided by the deal, and American lawmakers, with some demanding further investigation into the tour’s ties to Saudi money and influence. Discontent among players, includ-
ing those on the powerful PGA Tour policy board, has been pervasive. And LIV Golf recently signed Jon Rahm, the No. 3 player in the Official World Golf Ranking, poaching him from the PGA Tour and highlighting the Saudis’ continued willingness to spend money on the sport and make LIV a competitor to the tour. “To have Jon on board was critically important to our future and what we want to do,” Greg Norman, the CEO of LIV Golf, said of the move. “It will create a domino effect — there will be more apples falling from the tree — no question about it, because LIV continues to develop.”
