esident Commissioner Jenniffer González Colón on Wednesday called on both the Financial Oversight and Management Board and the central government to say out loud what is involved in the change in the additional charge for the payment of the debt that will increase electricity bills on the island, so that a calm analysis of the increase can be made and alternatives can be considered for the benefit of consumers and businesses. “For example, what alternatives have been considered to mitigate it, including using more natural gas to lower the cost of the price of fuel; how was this increase determined?” said González Colón, who is challenging Gov. Pedro Pierluisi Urrutia in this year’s New Progressive Party primaries, in a written statement. “And where are the future plans to reduce the cost of energy and improve the stability and quality of the electrical system?” The resident commissioner noted that in its fourth Debt Adjustment Plan for the Puerto Rico Electric Power Authority (PREPA), the oversight board proposes a higher debt payment charge than previously announced that would represent a significant increase in the bill for electric power service on the island. She has stated her repudiation of any increase in the electricity bill. “The people, the small and medium-sized merchants, the industrial sector, are all stunned by so many economic impositions added to the high cost of living,” González Colón said. “We should focus on how to be more competitive, attract investment, and encourage people not to move. This significant increase would cause the opposite: an economic slowdown by making the cost of living and doing business more expensive. In this way, we will not be more attractive for new companies in the manufacturing sector to establish themselves on the island.” “People need to plan, but they can only do this with real data, speaking clearly, not with a ‘change changes’ in energy costs,” the resident commissioner said. González Colón called for people to be told what to really expect with the increase, whether or not other increases are coming, how the increase in the additional charge was determined, and where the future plans are to reduce the cost of energy and
improve the system. “I have always supported Puerto Rico being fiscally responsible, and one of those ways is by paying its debts, but the consumer does not have to pay for the mistakes of the past, and even less so when the service does not meet the expectations of what is paid for it,” she said. “The Board is responsible for planning how to pay the adjusted debt and the component that includes the central government, PREPA, LUMA, Genera and the Puerto Rico Energy Bureau are responsible for proposing strategies to make the system work and lower costs, as well as alternatives for protecting consumers in the process of energy costs they pay,” the resident commissioner said.

Electoral comptroller handling complaints against Dorado, San Juan mayors alleging violations By THE STAR STAFF
T
he electoral comptroller of Puerto Rico, Walter Vélez, said his office will evaluate a complaint filed against Dorado Mayor Carlos López Rivera for allegedly using public funds to highlight his image in violation of the electoral ban that began Jan. 1. He also revealed Wednesday that his office detected that current San Juan Mayor Miguel Romero Lugo’s campaign misidentified some of the political donations he received in the 2020 race. The amount of money, which was not detailed by the comptroller, “was not properly identified” in the reports submitted, Vélez said during an interview in Radio Isla 1320. “I don’t have the amount here, but [we detected] a certain amount of money that was not properly presented in the reports with the correct information, and they already made a payment as a penalty for that amount,” the official said. In addition to the fine, Romero Lugo will have to make some changes to the expense reports before the office’s final determination is published this week. The State Elections Commission (SEC) Board of Assistant Comptrollers banned Gov. Pedro Pierluisi Urrutia from using the slogan “Making Things Happen” because it violates the electoral ban in the sense that it is highlighting the administration’s achievements with public funds in an election year, Vélez said. The SEC’s decision is the second ruling banning Pierluisi’s
Dorado Mayor Carlos López Rivera campaign from using the slogan. Last week, the courts sided with a Popular Democratic Party suit filed in November against the use of the slogan. Vélez said officials will give Pierluisi “a couple of weeks” to stop the campaign but did not say what will be the consequences of using public funds for the campaign or if they have to paid back. He said that if the government continues with the slogan, it may face penalties that start at $10,000.
Meanwhile, Vélez said his office will investigate a complaint filed against Dorado’s mayor for using public funds to highlight his image in violation of the electoral ban, which began Jan. 1. Municipal assembly member Yamira Colón Rosa, who is running for mayor of Dorado under the Citizen Victory Movement banner, filed a complaint with the Electoral Comptroller’s office against López. She said she toured Dorado and found around 14 signs and posters made with public funds highlighting the name and photo of the mayor. “This practice is a violation of the electoral ban that prohibits elected public officials from using public funds to highlight their name and image in an election year,” Colón Rosa said. “Those signs must be removed or the name and image of the mayor covered. This was not done.” Later on Wednesday, López Rivera reacted to media reports about the alleged complaint filed against him. “Once again, the candidate of the Victoria Ciudadana party in Dorado makes statements and complaints without verifying whether the information is correct,” the mayor said. “In Dorado, we are responsible and all signs that had information or images that are prohibited by the electoral ban were removed. The signs to which Mrs. Colón refers are political propaganda paid for with funds from the Carlitos López Committee. In fact, the photo that she gave to the press, which is a photo of my family located at the entrances to the town, was paid for with funds from my campaign.”
House candidate makes call for blood donations By THE STAR STAFF

anuel Calderón Cerame, a municipal legislator in San Juan who is running for a seat in the island House of Representatives, called on all San Juan residents who are in a condition to do so to donate blood in the different facilities that provide the service.
“Today is a great day to give the gift of life and raise awareness about the need for blood and platelets,” the Popular Democratic Party municipal legislator said. “The issue of blood supplies in Puerto Rico, especially at Christmas time, is recurrent and it is required that there be safe levels for attending to all the cases that arrive at hospitals. In fact, the medical technologist at the Blood Bank of the
Río Piedras Medical Center, Lymar Agosto, urged citizens to make blood donations. We join that call.” In fact, Agosto said, the refrigerators of the aforementioned blood component collection center have only 45 units of type A positive red blood cells, and 38 O positive units, when they are supposed to have between 100 and 200 units of red blood cells each. That would be to cover perhaps an emergency event. If the supplies of the Blood Bank in the Medical Center are exhausted, the Medical Services Administration would have to buy the blood components from other institutions, such as the Mutual Services Blood Bank and the Red Cross. “Unfortunately, during the Christmas season, car and other motor vehicle accidents, the use of pyrotechnics, and the assignments of other hospitals to the emergency room, the Medical Center, as well as gunshot wounds, among other cases, increase,” Calderón Cerame said. “Hence the importance of setting aside a little time and giving this gift of life. Let’s start 2024 with better blood supplies.” The Blood Bank is next to the multi-story parking lot of the Medical Center, located on

Oversight board rejects hikes in salary, bonuses for ASEM By THE STAR STAFF
T
he Financial Oversight and Management Board on Wednesday rejected granting salary hikes to some 975 workers from the Medical Services Administration (ASEM by its Spanish acronym) as proposed in the entity’s collective bargaining agreement (CBA). In a letter addressed to ASEM Director Jorge Matta on Wednesday, the oversight board rejected the proposal put forward by the General Workers Union (UGT by its Spanish initials) to offer salary and Christmas bonus increases as part of the CBA. The UGT proposed increases in the salaries of the 975 employees by some $35,000 a year, including the increased Christmas bonus. Such increases are for employees with average salaries of approximately $32,000. “The proposed increases would more than double the current salaries of the union employees of ASEM, an entity financed by billing medical centers and their patients. The increase proposed by UGT would be in addition to already significant recent salary increases, effective July 1, 2023, for the vast majority of ASEM employees following the successful implementation of
Medical Services Administration Director Jorge Matta (X.com) the Civil Service Reform (CSR),” the oversight board said. As part of the CSR, 73% of ASEM employees received an average annual salary increase of $7,373.25. The UGT’s proposal to offer substantial salary and bonus increases in addition to the already implemented increases does not align with the CSR principles and
methodologies and is inconsistent with the Fiscal Plan for Puerto Rico certified by the oversight board, the board said. Specifically, the letter said the oversight board’s authorization was sought to offer the 975 employees under the UGT the following salary increases: • A monthly salary increase of $2,000,
effective July 1, 2023; • A monthly salary increase of $300, effective Jan. 1, 2025; • A monthly salary increase of $300, effective Jan. 1, 2026; and • A $1,5000 signing bonus to be paid no later than Dec. 31, 2023. According to the letter, the total estimated impact of the proposed increases is $101 million for the period from July 1, 2023 to Dec. 31, 2026. On Oct. 13, 2023, the oversight board approved ASEM’s proposed compensation plan to implement the new market-based salary structure, which increases the salaries of job classes in ASEM to better align with comparable jobs in the local labor market. The total cost of implementation of ASEM’s new compensation plan is $11 million, impacting 73% of ASEM’s active employees and 93% of budgeted vacant positions. “UGT’s proposal to include bonus and salary increases in its negotiation proposal does not align with the Central Government’s Uniform Classification and Remuneration Plan that is part of the principles and methodologies of the CSR,” the oversight board’s letter notes.
Fiscal board seeks court’s permission to end PREPA unions’ collective bargaining agreements due to pensions By THE STAR STAFF
T
he Financial Oversight and Management Board asked the federal bankruptcy court this week to allow it to end the collective bargaining agreements (CBAs) with Puerto Rico Electric Power Authority (PREPA) unions, arguing the utility cannot pay the unaffordable pension and grievance claims. The oversight board said PREPA has two remaining CBAs – one with the Electrical Industry and Irrigation Workers Union (UTIER by its Spanish acronym), with around 139 active members remaining, and one with the Union de Empleados Profesionales Independientes, with some three active members remaining. Each of the CBAs require, among other things, that PREPA’s current pension system continue to operate and be maintained as a fully funded trust. “PREPA cannot assume its CBAs because it is unable to cure the significant multibillion dollar underfunding of its defined benefit plan, meet future funding obligations to maintain the system as it currently exists and as required by the CBAs, or pay the unions’ grievance claims asserted in excess of $1 billion,” the oversight board said in the
motion filed Tuesday. “Assumption of the CBAs would also be inconsistent with the pension reform measures the Oversight Board has determined are essential to ensure adequate funding for accrued pension benefits. The pension reform measures are the same as those implemented for governmental employees of the Commonwealth and other Title III debtors.” PREPA’s Employees Retirement System (ERS) has recently asserted PREPA owes it $1.2 billion in unpaid employer contributions from 2016 to date, plus an additional $5 billion in future contributions through 2060. “Rejecting PREPA’s CBAs with UTIER and UEPI is necessary to PREPA’s reorganization and to allow for essential reform of pension benefits for participants in the PREPA ERS and to avoid liability for a potentially large administrative assumption claims for employer contributions to and grievances under the CBAs,” the oversight board argued. The board wants to turn PREPA’s pension system into a “pay as you go” system. Meanwhile, PREPA bondholders this week lost an appeal in the First Circuit Court of Appeals to overturn the district court’s approval of PREPA’s disclosure statement for the bankruptcy plan of adjustment.
The PREPA ad hoc group, comprising a subset of bondholders that oppose the plan of adjustment, argued in December that the plan was unconfirmable because of the disparate treatment of creditors.
The Puerto Rico Electric Power Authority’s Employees Retirement System has recently asserted that the utility owes it $1.2 billion in unpaid employer contributions from 2016 to date, plus an additional $5 billion in future contributions through 2060.

Swain dismisses suit seeking to invalidate law firm representing fiscal board By THE STAR STAFF

he judge overseeing Puerto Rico’s Title III bankruptcy has ruled against a Puerto Rico business that sought to disqualify the law firm O’Neill & Borges, the legal representative of the Financial Oversight and Management Board, in an Economic Development Bank (EDB) loan sale dispute. U.S. District Judge Laura Taylor Swain ruled that R&D Master Enterprises does not have standing to challenge the oversight board’s retention of O’Neill & Borges as local counsel. She also said the Title III court does not have jurisdiction to rule on the sale of an EDB loan.
“It is perhaps due to this legal separation between the commonwealth and the EDB that the motion and reply are devoid of facts that would demonstrate that the loan sale transaction has financially harmed the commonwealth, or that the nullification of the sale agreement would financially benefit the commonwealth,” Swain said in a ruling last week. R&D argued that O’Neill & Borges had conflicts of interest and could not represent the oversight board because it also represented a group of funds that acquired a $384 million commercial loan portfolio from the EDB. R&D is one of the borrowers whose loans were the subject of that transaction. O’Neill & Borges denied that it represented the purchasers
or that it represented the oversight board with any matters involving the sale. The portfolio was allegedly sold at a discount and the EDB has since sued to invalidate the sale agreement. The oversight board said the suit contained baseless allegations. “[R&D] appears to contend that the consideration paid by the purchasers under the sale agreement represented a substantial discount from the true value of the loan portfolio and that the unwarranted discount created a windfall for the purchasers at the EDB’s expense, but movant has not explained how any such windfall has harmed the commonwealth,” Swain said in her order. The EDB loan, she ruled, is not tied to Puerto Rico’s Title III for the bankruptcy court to rule directly on the matter.

How a proxy fight over campus politics brought down Harvard’s president By NICHOLAS CONFESSORE
T
he resignation of Harvard’s president, Claudine Gay, earlier this week followed a lengthening catalog of plagiarism allegations that appeared to steadily sap her support among the university’s faculty, students and alumni. But for many of Gay’s critics, her departure was also a proxy victory in the escalating ideological battle over American higher education. Taking down Gay was a “a huge scalp” in the “fight for civilizational sanity,” Josh Hammer, a conservative talk show host and writer, wrote on the social media platform X, formerly Twitter. “A crushing loss to D.E.I., wokeism, antisemitism & university elitism,” wrote conservative commentator Liz Wheeler, referring to diversity, equity and inclusion. “This is the beginning of the end for D.E.I. in America’s institutions,” said conservative activist Christopher Rufo, who had helped publicize the plagiarism allegations. Until last month, conservative-inspired efforts to remake higher education had unfolded primarily at public universities in right-leaning states such as Florida and Texas, where GOP lawmakers and state officials could exercise their legislative and executive powers to ban diversity offices, set up right-leaning academic centers and demand changes to curriculum. But Gay’s resignation on Tuesday secured their movement a signal victory at the country’s most storied private university, which had for weeks resisted calls for a change in leadership. “I think there are major problems with higher education, and Harvard represents a lot of those problems,” said John D. Sailer, a senior fellow at the National Association of Scholars, a conservative education nonprofit. “To the extent those problems have been exposed, and skepticism increases towards the current best instantiation of higher education, I think that puts a lot of wind in the sails of reform.” Gay’s defenders seemed to agree, warning that her resignation would encourage conservative interference in universities and imperil academic freedom (though some experts have rated Harvard itself poorly on campus free speech during Gay’s tenure in leadership).

(Sophie Park/The New York Times) “This is a terrible moment,” said Khalil Gibran Muhammad, a professor of history, race and public policy at the Harvard Kennedy School. “Republican congressional leaders have declared war on the independence of colleges and universities, just as Gov. DeSantis has done in Florida. They will only be emboldened by Gay’s resignation.” Barely a month had passed since Gay had appeared, along with the presidents of the Massachusetts Institute of Technology and the University of Pennsylvania, at a congressional hearing on campus antisemitism, where their lawyerly defense of a student’s right to engage in anti-Jewish speech provoked national outrage. Some Jewish students, faculty and donors also felt Gay had been too timid in her response to the Oct. 7 attacks on Israel by Hamas, as well as to complaints over antisemitism on campus. Two of the three presidents who spoke at the hearing are now out of office. (The second of those is M. Elizabeth Magill, who resigned as the University of Pennsylvania president just four days after she testified before Congress.) On Tuesday, Gay’s antagonists jockeyed for credit, sometimes hailing the effectiveness of their own political theater.
Rep. Elise Stefanik of New York, a Harvardeducated Republican, noted in a statement that her interrogation of Gay at last month’s hearing had “made history as the most viewed congressional testimony in the history of the U.S. Congress.” Republican lawmakers, she promised, would “continue to move forward to expose the rot in our most ‘prestigious’ higher education institutions.” Even before the hearing, conservative activists and outlets had begun reexamining Gay’s acclaimed but relatively thin academic output, prompting further examination by mainstream news outlets. The public drumbeat began almost immediately after the hearing with a post by Rufo, who had obtained an anonymous dossier of work published by Gay in which she had allegedly plagiarized other scholars, as well as a report in the Washington Free Beacon. That outlet published a follow-up on Monday night with additional examples. All told, the plagiarism allegations spanned nearly half of her published academic articles, the report said. But along the way, Gay — a scholar of Black political participation and an architect of Harvard’s efforts to advance what she has called “racial justice” on campus
— came to stand for the right’s broader critique of elite academia, which it views as intellectually narrow, lax in standards and overly focused on questions of identity. Opponents attacked Gay, who attended Princeton and Harvard before turning to an administrative career, as unqualified for the position she had assumed just six months ago, a charge her supporters rejected as racist. “It was a thinly veiled exercise in race & gender when they selected Claudine Gay,” Vivek Ramaswamy, the entrepreneur and Republican candidate for president, wrote on X on Tuesday. “Here’s a radical idea for the future: select leadership based on *merit.*” Whether the resignation of one or two college presidents will spur any broader remaking of higher education is unclear. As the COVID pandemic recedes, Republican officials and education activists have found it more difficult to interest broad swaths of voters in campaigns to restrict access to sexually explicit books, or in often-vague attacks on “wokeism” and “equity.” The two Republican presidential contenders who have campaigned most explicitly against higher education institutions — the Yale-educated Ron DeSantis and the Harvard-educated Ramaswamy — have failed to gain lasting traction in the race. Efforts to stop schools from requiring job applicants to furnish diversity statements, or commitments to particular ideas about race and justice, have attracted support beyond the political right. But more heavy-handed measures to require — or ban — the teaching of particular ideas have gained less traction, leading activists on the right to focus more on other areas, such as dismantling tenure protections and administrative programs related to DEI. “If Rufo’s goal is to enlist the public into his war on higher ed, he has yet to succeed,” said Jeffrey Sachs, a scholar at Acadia University in Nova Scotia who studies academic speech policies. “The public, including a majority of Republicans, does not want government deciding what gets taught in America’s university classroom. Nor do they warm to the idea when specific legislation is presented to them for review.”

en. Robert Menendez, D-N.J. — already accused of using his political influence to benefit Egypt — was newly charged earlier this week with using his power to help the government of Qatar. Federal prosecutors in New York City said that Menendez exploited his Senate office to aid a prominent New Jersey developer in securing financial backing from an investment fund run by a Qatari sheikh in exchange for lucrative bribes. The alleged payoffs included cash, gold bars, Formula One tickets for a relative and an offer of a designer watch. Prosecutors said the developer, Fred Daibes, “also expected Menendez in exchange to take action to benefit the government of Qatar, and thereby benefit Daibes, who was seeking millions of dollars in investment from a fund with ties to the government of Qatar.” The updated indictment broadens the government’s allegations that Menendez, 70, who was the influential head of the Senate Foreign Relations Committee at the time, used his official position to convey benefits to foreign governments in return for bricks of gold and tens of thousands of dollars in bribes. In October, prosecutors accused Menendez; his wife, Nadine Menendez; and another defendant, Wael Hana, of conspiring to have the senator work on behalf of the Egyptian government without registering with the Justice Department. Adam Fee, a lawyer for Menendez, said Tuesday that the government’s new allegations “stink of desperation.” “Despite what they’ve touted in press releases, the government does not have the proof to back up any of the old or new allegations against Sen. declined through a spokesperson to comment on the new indictment. Menendez stepped down from his Foreign Relations Committee post after he was first indicted in September, but he has resisted calls that he resign from the Senate and has not ruled out running for reelection. He and his co-defendants have all pleaded not guilty, and they are scheduled for trial in U.S. District Court in Manhattan in May. The new accusations are certain to renew scrutiny not just of Menendez but also of Qatar. Investigators in Europe and the United States have spent years trying to combat sophisticated influence operations by wealthy Persian Gulf nations, including Qatar, on both sides of the Atlantic. Belgian authorities charged a European Parliament official in 2022 as part of a sweeping investigation into Qatari bribes. U.S. prosecutors have accused the wealthy Arab nation of bribing FIFA officials to host the 2022 World Cup, which the senator attended. (Daibes was also in Qatar during the games, court records show, but it was unclear if he attended any matches.) And just last year, the Justice Department scrutinized but ultimately decided not to charge a retired four-star Marine general who it suspected was secretly lobbying for the nation. Daibes had been planning a major highrise residential project at 115 River Road in
Edgewater, New Jersey, but the project lost its financing after getting bogged down in a delayed environmental cleanup, court records show. Prosecutors said it was Menendez who helped craft a solution. In June 2021, the senator introduced Daibes to an investor who was a member of the Qatari royal family and the principal of the Qatari Investment Co., the indictment said. In late 2022, Daibes — who at the time was facing unrelated federal bank fraud charges in New Jersey — got permission to travel to London and Qatar to meet with the potential new lenders, who had signed a letter of intent to enter into a joint venture with a company controlled by Daibes. Then, in January 2023, he finalized a $45 million shared-ownership agreement for the Edgewater project with a company founded by the member of Qatar’s royal family, Bergen County deed records show. A spokesperson for the company, Heritage Advisors, could not be immediately reached for comment. The new allegations against Menendez claim that during the period when the financial deal with the Qatari-linked fund was under discussion, the senator “made multiple public statements supporting the government of Qatar.” Menendez also provided Daibes with these statements so that the developer could “share them with the Qatari investor and a Qatari government official associated with the Qatari Investment Company,” prosecutors said. In September 2021, Menendez and Daibes attended a private event in Manhattan held by the Qatari government. A few days later, Daibes sent Menendez photographs of wristwatches with prices ranging from $9,990 to $23,990. “How about one of these,” Daibes wrote, prosecutors said. Within days, Daibes sent Menendez a link to a website that tracked a Senate resolution supportive of Qatar that had been introduced a day earlier and referred to the Foreign Relations Committee. The new indictment also suggests for the first time that the senator and his wife took steps to try to cover up other bribes they are accused of taking after federal agents raided the couple’s New Jersey house in 2022. Specifically, prosecutors said that in December 2022 the Menendezes attempted to repay tens of thousands of dollars worth of bribes that had come in the forms of payments for a home mortgage and toward a Mercedes-Benz convertible. In both cases, the couple created documentation describing the original bribes as loans they were repaying, the indictment said.

Trump appeals decision barring him from Maine primary ballot By JENNA RUSSELL
L
awyers for former President Donald Trump filed an appeal Tuesday seeking to overturn the ruling last week by Shenna Bellows, Maine’s secretary of state, to bar him from appearing on the state’s Republican primary ballot. Bellows, a Democrat, “was a biased decision maker who should have recused herself and otherwise failed to provide lawful due process,” lawyers for Trump wrote in the 11page appeal filed in Maine Superior Court. They further argued that she had “no legal authority to consider the federal constitutional issues presented by the challengers.” Bellows “made multiple errors of law and acted in an arbitrary and capricious manner,” the lawyers wrote. They demanded that the court vacate the secretary’s decision, which they described as “the product of a process infected by bias.” Maine became the second state to exclude Trump from the primary ballot Dec. 28, when Bellows found him ineligible under the third section of the 14th Amendment,
which prohibits people who have engaged in insurrection from holding office. Her decision followed a similar landmark finding in Colorado, where the state Supreme Court ruled Dec. 19 that he could not appear on the ballot there. A spokesperson for the Trump campaign previously called both states’ actions “partisan election interference” and “a hostile assault on American democracy.” Similar challenges to Trump are playing out in states around the country, mostly in the courts. Trump is expected to file an appeal of the Colorado ruling with the United States Supreme Court within days. If the court takes the case, it would most likely put a hold on legal challenges elsewhere, though the potential impact on Maine’s unfolding process remains unclear. Richard Hasen, a law professor at the University of California, Los Angeles, and an election law expert, said he expects the appeal in Maine to proceed even if the Supreme Court takes up the Colorado case, because of the pressing need to resolve the matter, and because some of the legal questions in
the two states differ. “I don’t think that will stop the process in its tracks,” he said. “Trump wants to move ahead because he’s off the ballot, and the state wants finality.” Given the need to finalize ballots promptly for voters in the military and overseas, the complex legal maneuvering is taking on increasing urgency. The Republican primaries in Maine and Colorado are both scheduled for Super Tuesday, March 5. Challenges to Trump’s candidacy have been filed in at least 33 states. Beyond Colorado and Maine, at least 17 states have unresolved challenges in play, including California, New Hampshire, Oregon and North Carolina. By law, the Superior Court in Maine must rule on Trump’s appeal by Jan. 17. That decision may then be appealed within three days to the state’s highest court, which must issue its own ruling within 14 days of the lower court’s decision. Reaction to the Maine decision has been mixed among residents and elected officials. Bellows, a former state senator, was elected
by the state Legislature to her second twoyear term in December 2022. In the run-up to her decision, Trump’s lawyers demanded that Bellows recuse herself because of prior social media posts in which she referred to the attack on the U.S. Capitol on Jan. 6, 2021, as an “insurrection” — evidence, they said, that she had already made up her mind about that day’s events, and his role in them, before hearing any evidence. They argue in their appeal, as they did in their case filings, that the disqualification of a presidential candidate under the 14th Amendment is “a political question reserved for the Electoral College and Congress.” Since releasing her decision, Bellows and her staff have faced threats and harassment, she wrote in a post on social media on Saturday, including a “swatting” call to state police that reported a fake emergency at her home after her address was shared online. In her post on Facebook, Bellows called the threats “unacceptable,” adding, “We should be able to agree to disagree on important issues without threats and violence.”

What we’re watching in 2024 By ANDREW ROSS SORKIN
A
s we look ahead to the new year, The New York Times has identified about a dozen themes that are likely to become running narratives that could define the business and policy ecosystem for the next 12 months. Of course, the presidential election, perhaps one of the most polarizing in history, is going to infect every part of the business world. Watch out for which CEOs and other financiers back candidates — and, importantly, which ones go silent — and how companies deal with outspoken employees. Also look for some wealthy executives to avoid giving directly to candidates but instead donate to political action committees as a shield, of sorts, from public scrutiny. Another storyline that will probably remain part of the water cooler — er, Slack and X (formerly known as Twitter) — conversation in business is the backlash against environmental, social and corporate governance principles, or ESG. This fight has manifested itself into a political battle and increasingly found its way in the past year into a debate about free speech on campuses (another theme that isn’t going away). Here’s a bit more detail on what we’re looking out for this year. The U.S. presidential election. The race seems set to come down to a rerun of 2020, with Donald Trump leading opinion polls to be the Republican candidate despite his mounting legal battles. The big question is how business leaders will respond. Will they coalesce around (and direct their money to) an anyonebut-Trump candidate? Nikki Haley, the former governor of South Carolina, is leading that race, but she has a long way to go to catch up to Trump. President Joe Biden, who has made a series of consequential decisions on the economy, hopes voters will start to feel an economic upswing to reverse his sagging poll ratings. Private credit could see defaults. Just as 1980s-style leveraged buyouts have been rechristened “private equity,” so too has “shadow banking” been rebranded as “private credit” and “direct lending” in time for the business to reach its highest levels yet. Direct lending by investment firms and hedge funds has
become a $1.5 trillion titan, with scores of companies turning to the likes of Apollo and Ares for loans instead of, say, JPMorgan Chase. But the industry may face a test in 2024: Indebted borrowers, facing looming debt maturities and high interest rates, already are turning to private credit for yet more loans, raising concerns that lenders could face a wave of defaulting clients. A string of failures could hit these lenders hard, skeptics fear — leaving pension funds, insurers and other backers of private credit funds holding the bag. Media deal mania? Reports that David Zaslav, the CEO of Warner Bros. Discovery, held talks last month about a potential merger with Paramount set off a wave of speculation that 2024 would be a year of media consolidation. The industry has been transformed in recent years by the growth of streaming, changes in the way people consume media and big tech’s encroachment into sectors typically dominated by old-school media companies. Now the industry is on the cusp of the next major shift with the rise of artificial intelligence. One date to put in your diary: April 8, 2024, the two-year anniversary of the merger of WarnerMedia and Discovery to create Warner Bros. Discovery — and the first day that the new company can be sold without risking a big tax bill. Will unions maintain their momentum? Organized labor had a banner year in 2023, with big wins in fights with Hollywood studios and the auto industry. Whether that signals a permanent turnaround for the labor movement is up for debate. But the election most likely will be a key factor. Both Biden and Trump tried to woo striking autoworkers this year, so expect more efforts to win over blue-collar voters. Middle East money will flow. Tensions with China and economic sanctions have made it increasingly difficult for companies to raise money from a place that used to be top of the list. Middle Eastern investors have picked up the slack. Saudi Arabia, the United Arab Emirates, Qatar and others are spending money as they look to diversify their fossil fuel-dependent economies. The sectors are wide-ranging, including sports, tech companies, luxury, retail and me-

Critics say the petrostates with dubious human rights records are trying to launder their reputations, but that hasn’t stopped Western business from seeking their lucre. One trend to watch: the growing ties between China and Middle Eastern money. Beijing is trying to deepen links with countries outside of Washington’s orbit or, at least, with those willing to play both sides. More antitrust fights. A tough year for regulators — like Lina Khan at the Federal Trade Commission and Jonathan Kanter of the Justice Department — ended with two wins after both Illumina and Adobe called off multibillion-dollar takeovers in the face of government pressure. Enforcers could already claim some success by forcing dealmakers to weigh whether a big deal is worth pursuing, given the potential risk that they might have to spend months in court defending it. Don’t expect Khan to ease the pressure; do expect more antitrust fights. New climate disclosure rules. Public companies have been bracing for years for new climate-related disclosure rules from the Securities and Exchange Commission. In 2021, the agency signaled that climate change would be one of its priorities. About a year later, Gary Gensler, the SEC chair, proposed new rules. The most contentious aspect of the draft regulations was a requirement that large companies disclose greenhouse gasses emitted along their value chain. The new rules are set to be finali-
zed in the spring. But the probable lawsuits could go all the way to the Supreme Court. Another election to watch: India’s. The world’s biggest democracy and a rising superpower, India will go to the polls in April and May. Prime Minister Narendra Modi is benefiting from the West’s search for a regional bulwark to counter China. Business is looking at opportunities in India as companies work to diversify their supply chains and tap into a fast-growing economy. The election will also be a crucial early test of how AI can factor into the spread of (mis) information during an election. Workplace shake-ups. In late 2022, the release of ChatGPT propelled AI into the public consciousness. In 2023, companies experimented with new ways to build the technology into their operations, but few had yet to overhaul their procedures to cope with it. It’s still not clear exactly what AI will mean for jobs, but in 2024, we may see more companies making decisions about its use in ways that will have consequences for workers. The other big topic workplaces are grappling with is the response to the war in the Gaza Strip. Some companies are already considering changes to their workplace diversity, equity and inclusion programs, and executives face some of the same pressures as university presidents when it comes to how to handle their statements and responses to incidents related to the war.

lobal stock markets extended a New Year slide on Wednesday and the dollar edged higher as concerns about the chances of a soft landing mounted, while the latest hostilities in the Middle East added to downbeat market sentiment. The yield on benchmark 10-year Treasury notes briefly climbed above 4% as market optimism about interest rate cuts ebbed despite bullish comments about the U.S. labor market by Richmond Federal Reserve President Thomas Barkin. A soft landing is “increasingly conceivable” as the Fed makes “real progress” toward taming inflation without inflicting major damage on the jobs market, Barkin said. MSCI’s broad index of world equities slipped 1.0% to its lowest level in almost two weeks, with the major European bourses down more than 1% and Wall Street indices all lower too. Asia Pacific shares outside Japan shed 1.5%. The market is trying to figure out if a soft landing is possible with the six rate cuts by year-end the futures market is currently pricing in or if that scenario will be painful, said Anthony Saglimbene, chief market strategist at Ameriprise Financial in Troy, Michigan. “Usually when you get that type of aggressive interest rate cuts, it comes with more economic pain,” Saglimbene said. “Our view is that the market is probably priced in too many rate cuts for this year.” Caution ticked up ahead of the release of minutes from the Fed’s last policy meeting in 2023, due at 2 p.m. ET (1900 GMT), as well as the U.S. unemployment report for December on Friday. Fed officials in December predicted 75 basis points (bps) of rate cuts this year, driving money market bets for around double that amount and market optimism that prompted a year-end rally in stocks and bonds. “We had that whacking great rally at the end of last year when markets convinced themselves there will be a soft (economic) landing, cooling inflation and a rapid pivot to rate cuts,” AJ Bell investment director Russ Mould said. “But if you get an unexpected hard landing or an inflationary boom, you might get a slightly different script, so I guess people are now pausing for reflection.” Resilience in the U.S. labor market has kept a recession at bay. The government is expected to report on Friday that non-farm payrolls increased by 168,000 jobs in December, according to a Reuters survey of economists, after rising 199,000 in November. But labor market conditions are gradually easing. U.S. job openings dropped by 62,000 to 8.79 million for the third straight month in November, the Labor Department said on Wednesday. A
pair of explosions Wednesday at a commemoration for Iran’s former top general, Qassem Soleimani, killed at least 103 people and wounded another 171, according to Iranian officials, sowing fear and grief in Iran, which has been on edge for more than a year over widening divisions between the hard-line government and many of its people. Coming almost three months into Israel’s war in the Gaza Strip and a day after an explosion killed several Hamas officials in a suburb of Beirut, the blasts also ratcheted up fears of a widening regional conflict. Iranian officials told state media that a pair of bombs were placed in bags along the road toward the cemetery in the city of Kerman. The bags exploded as a huge procession of people was on its way there to commemorate the four-year anniversary of the assassination in an American drone strike of Soleimani, the architect of the axis of regional militias and powers that oppose Israel and the United States. The officials said the bags appeared to have been detonated via remote control, leaving bodies in pieces on the ground. Given the sheer scale of the blasts, which state media described as a terrorist attack, the death toll was likely to rise. Videos and photos of the explosions’ aftermath on state media showed widespread carnage and chaos, with sirens blaring and the injured — among them children — collapsing to the ground. Bloodied, several of the wounded screamed, “God help us. Everyone is killed.” Iran’s Supreme Leader Ayatollah Ali Khamenei issued a statement blaming the attack on Iran’s “malicious and criminal enemies,” but stopped short of naming any group or country. Khamenei vowed that Iran’s enemies should know that “this tragedy will have a strong response.” While no group has claimed responsibility for the attack, Iranian President Ebrahim Raisi seemed to blame the country’s archrivals, the United States and Israel. “We tell the criminal America and Zionist regime that you will pay a very high price for the crimes you have committed and will regret it,” he said. Analysts said that while it was far too soon to tell, there were numerous possibilities for who might have attacked the cemetery, including Sunni Muslim terrorist organizations such as the Islamic State group or Iranian separatist groups, all of whom have struck Iranian civilians in the past.

The attack did not fit Israel’s usual methods when striking Iran, said Ali Vaez, the Iran project director at Crisis Group. Israel, he said, has not previously attacked ordinary civilians in Iran, tending instead to target individuals such as nuclear scientists and senior security officials, or facilities such as nuclear sites in precision strikes. Just before Wednesday’s explosions, videos showed a dense crowd of thousands walking along a road lined with food and drink stalls and flags as a prayer from the Quran played from speakers. Then a huge blast rocked the area. The air filled with screams, and people scattered in all directions, videos showed. “Unfortunately many of the injured people are in critical condition,” said Babak Yektaparast, the spokesperson for the country’s emergency relief operations. He said all medical facilities in the province of Kerman were on standby to treat patients and emergency airplanes
were being deployed for medical evacuations to hospitals in Tehran, the capital. The head of Iran’s judiciary, Gholamhossein Mohseni Ejei, said all the country’s intelligence, security and military organs were mobilizing to determine who was behind the explosions. Iran declared a national day of mourning on Thursday and emergency officials issued a call for blood donations in Kerman for the injured, saying there was a shortage of blood supplies given the high number of casualties. Iran’s interior minister, Ahmad Vahidi, told state television that most of the casualties were from the second explosion, which followed minutes after the first, as crowds had gathered to help the injured. He said the situation in the city of Kerman was now under the control of security and military. The explosions came four years to the week after the United States assassinated Soleimani, the longtime commander of Iran’s Revolutionary Guard’s powerful Quds Force, at Baghdad airport. Soleimani had been hailed in Iran and in parts of the wider region as a hero for building and arming an Iranled network of regional proxy militias that countered the United States and Israel across the Middle East, and he continues to enjoy near-mythic status among pro-government Iranians. His funeral in 2020 drew more than 1 million mourners, according to official estimates. Every year, on the anniversary of his assassination, some Iranians hold processions and ceremonies in his honor. By cultivating close personal ties with the leaders of partners across the region, the Arabic-speaking Soleimani became the face of Iran’s Shiite axis of influence, which reshaped Middle East geopolitics for years to come. The Syrian and Iraqi militias he helped establish also played a critical role in defeating the Islamic State, the extremist group that overran large swathes of Syria and Iraq in the mid-2010s. The regional allies Soleimani armed and funded also included Hamas, the military and political group that controls Gaza, as well as Hezbollah, the armed political party that dominates much of Lebanon. Hezbollah has been clashing with Israeli forces on Lebanon’s southern border even as Hamas battles Israel in Gaza. The identities of those who died in Iran on Wednesday were not yet known. Some Iranians on social media were blaming the government and local security officials for failing to secure such a high-profile event. During the funeral ceremony for Soleimani in 2020, a stampede along the same road as Wednesday’s explosions killed 60 people.

A ‘miracle’: Plane erupts in flames while landing in Tokyo, but all aboard survive By MOTOKO RICH, HISAKO UENO, KALY SOTO and EMMA BUBOLA

s flight attendants yelled, urging passengers to evacuate, an eerie orange glow burned outside the windows of Japan Airlines Flight 516. The harrowing scene was caught on video from inside the plane, which collided with a Japanese coast guard aircraft as it was landing on Tuesday in Tokyo. Through skill and luck — one aviation expert called it “a miraculous job” — the flight crew of the Japan Airlines plane evacuated all 367 passengers and 12 crew members safely at Haneda Airport near Tokyo Bay, according to Japan’s transport minister, Tetsuo Saito. But five coast guard members, who had been headed to help with the earthquake relief in western Japan, were killed, Prime Minister Fumio Kishida said during a news conference. NHK, the public broadcaster, later said 14 people had been injured on the passenger plane. “The root cause of this accident is not known yet,” Saito said at a news briefing, adding that the country’s transport safety board and other agencies would work to determine what had happened. Video aired by NHK shows a fireball streaking across the tarmac as the plane touched down. As frightening as that looked from outside the plane, it was even scarier inside, said Anton Deibe, a 17-year-old Swede who was on the plane with his family, as quoted in the Swedish newspaper Aftonbladet. He told the newspaper that his family did not understand exactly what was happening or the announcements, which he said were in Japanese. His father, Jonas, told the newspaper, “The entire cabin was filled with smoke within a few minutes,” adding: “We threw ourselves down on the floor. Then the emergency doors were opened, and we threw ourselves at them.” “The smoke in the cabin stung like hell,” Anton told Aftonbladet. He said that once they got out of the plane, he and his family had run out “onto the field.” “It was chaotic,” he added. “We are all completely in shock,” he said. “I don’t think we understood what had happened.” The family later said they were doing well. The Kyodo News agency of Japan quot-
ed a passenger who described feeling as if the plane had hit something before it then jerked upward. The passenger, who was not identified, then told of seeing sparks outside the window and the cabin filling with smoke. Japan Airlines said the plane had left New Chitose Airport in the northern prefecture of Hokkaido at 4:15 p.m. and was scheduled to land at Haneda at 5:35 p.m., but landed at 5:47. A coast guard official said the coast guard aircraft had started taxiing to the runway around 4:45 p.m., about an hour before the collision. The airline said in a statement that the two planes collided and that both aircraft caught fire. The airline added that according to interviews with the operating crew, the pilots “acknowledged and repeated the landing permission from air traffic control,” and then proceeded with the approach. In its statement, Japan Airlines said that the cause of the accident was still under investigation and that it was cooperating with officials. Live footage after 6 p.m. showed firefighters trying to douse flames pouring out of the aircraft, an Airbus A350-900. Video showed the passengers using the evacuation slides to exit. According to Japan Airlines, the aircraft’s announcement system malfunctioned during the evacuation, so the crew used a megaphone and their voices. The coast guard plane involved in the collision was a smaller propeller plane, according to the coast guard. Japan Airlines drew praise for being able to safely evacuate 367 passengers under what was likely to have been enormous pressure. Footage of the accident showed flames coming out the windows of the collapsed plane, making it seem impossible that everyone made it out safe. Ed Galea, a professor and director of the Fire Safety Engineering Group at the University of Greenwich in Britain, called the Japan Airlines 350 evacuation “a miraculous job.” When the plane came to a stop, the nose gear collapsed, pitching the aircraft nose down with its tail up. Galea said in an interview that the footage showed passengers were evacuated from two of the exits at the front of the plane, and one exit at the back. Some of the “passengers essentially had to climb a hill in smoke,” he said. “A cabin crew stood at the back waving a torch, urging them to come forward.”

Japan Airlines crews are trained to evacuate all passengers within 90 seconds, Kuwasaki said. The crew was able to confirm that all passengers had evacuated by 6:05 p.m., she added. Trisha Ferguson, CEO of the Interaction Group, a company that designs airplane safety cards, said the fact that all the passengers managed to safely disembark in what could have otherwise been a deadly accident demonstrated successful cooperation between passengers and staff. “The crew was spectacular in their reaction times,”
said Ferguson, an aviation industry expert with 28 years of involvement in passenger safety education. “What they did was amazing,” she added. As part of safety testing of new airplanes, airlines must demonstrate that all passengers can be evacuated in 90 seconds. In the 1970s and 1980s, emergency training was mainly focused on the crew, Ferguson said, but in the 1990s and 2000s, new emphasis was placed on educating passengers how to react in emergencies. In this case, passengers could see the smoke, giving them incentive to move faster and leave behind their luggage. When passengers stop to take their luggage during an evacuation, the process is slowed, Ferguson said. “It really is a miracle that they got everyone out,”

ach New Year’s Eve, more than 2 million revelers — twice as many as typically fill Times Square — dress in white and pack Copacabana Beach in Rio de Janeiro to watch a 15-minute midnight fireworks extravaganza. The one-night hedonistic release is one of the world’s largest New Year’s celebrations and leaves Copacabana’s famed 2.4 miles of sand strewed with trash. But it began as something far more spiritual. In the 1950s, followers of an Afro-Brazilian religion, Umbanda, began congregating on Copacabana on New Year’s Eve to make offerings to their goddess of the sea, Iemanjá, and ask for good fortune in the year ahead. It quickly became one of the holiest moments of the year for followers of a cluster of Afro-Brazilian religions

that have roots in slavery, worship an array of deities and have long faced prejudice in Brazil. Then, in 1987, a hotel along the Copacabana strip started a Dec. 31 fireworks show. It was a huge hit that began attracting large numbers. “Obviously, this was great for the hotel industry, for tourism,” said Ivanir Dos Santos, a professor of comparative history at the Federal University of Rio de Janeiro. A new New Year’s tradition was born, and the revelers adopted some old Umbanda traditions, including throwing flowers into the sea, jumping seven waves and, especially, wearing white, a symbol of peace in the religion. But the huge party, Dos Santos said, “also then pushed the worshippers off the beach.” Not entirely. Dos Santos was standing on Copacabana Beach, dressed in white, with the chants of Umbanda worshippers behind him. Yet this was Dec. 29, the date when devotees of the Afro-Brazilian religions now descend on Copacabana Beach to make their annual offerings to Iemanjá (pronounced ee-mahn-JA). Alongside beachgoers in bikinis and vendors selling beer and barbecued cheese, hundreds of worshippers were trying to make contact with one of their most important gods. Devotees believe that Iemenjá, who is often depicted with flowing hair and a billowing blueand-white dress, is the queen of the sea and a goddess of motherhood and fertility. With temperatures exceeding 90 degrees, many gathered under a tent for traditional dances and songs around an altar of small wooden ships, loaded with flowers and fruit, that would soon be sent into the sea. Outside, they dug shallow altars in the sand, leaving candles, flowers, fruit and liquor. “This is a tradition passed from generation to generation. From grandmother to mother to son,” said Bruna Ribeiro de Souza, 39, a schoolteacher, sitting in the sand with her mother and her toddler son. They had lit three candles and poured a glass of sparkling wine for Iemenjá. Nearby was their foot-long wooden boat,
ready for its voyage. Souza’s mother, Marilda, 69, said her own mother brought her to Copacabana to make offerings to Iemanjá in the 1950s. It was a way, she said, to reconnect with her family’s African roots. Afro-Brazilian religions were largely created by slaves and their descendants. From about 1540 to 1850, Brazil imported more slaves than any other nation, or nearly half of the estimated 10.7 million slaves brought to the Americas, according to historians. One of the most popular religions, Candomblé, is a direct extension of Yoruba beliefs from Africa, which also inspired Santería in Cuba. Residents of Rio created Umbanda in the 20th century, mixing the Yoruba worship of various deities with Catholicism and aspects of occultism. Roughly 2% of Brazilians, or more than 4 million people, identify as followers of Afro-Brazilian religions, according to a survey conducted in 2019. (About half identified as Catholic and 31% evangelical.) That was an increase from the 0.3% who said they followed AfroBrazilian religions in Brazil’s 2010 census, the last official figures. The religions have given many Black Brazilians a cultural identity and connections with their ancestors. But followers have also faced persecution. Extremists in the evangelical church have called the religions evil, attacked their followers and destroyed their places of worship. Still, as the sun set over Copacabana Beach on Friday, groups of beachgoers cheered on the worshippers as they marched into the surf with bouquets of white flowers, bottles of sparking wine and their wooden boats. (Environmental concerns led devotees to abandon Styrofoam boats, and they no longer load on things like bottles of perfume.) Alexander Pereira Vitoriano, a cook and Umbanda worshipper, carried one of the largest boats and waded into the waves first. As he let the boat go, a wave capsized it, a sign to the followers that Iemenjá had taken the offering.

What Harvard should learn from Claudine Gay’s resignation By BRET STEPHENS

had written and filed a column about Harvard University and its president, Claudine Gay, when news of her resignation broke Tuesday afternoon after fresh allegations of plagiarism in her published work. I’d like to record what I wrote: “Cancel culture is always ugly and usually a mistake. If Gay is to go, let it be after more deliberation, with more decorum, and when pundits like me aren’t writing about her.” Oh well. The point may now be moot, but the important question for Harvard was never whether Gay should step down. It was why she was brought on in the first place, after one of the shortest presidential searches in Harvard’s recent history. How did someone with a scholarly record as thin as hers — she has not written a single book, has published only 11 journal articles in the past 26 years and made no seminal contributions to her field — reach the pinnacle of American academia? The answer, I think, is this: Where there used to be a pinnacle, there’s now a crater. It was created when the social justice model of higher education, currently centered on diversity, equity and inclusion efforts — and heavily invested in the administrative side of the university — blew up the excellence model, centered on the ideal of intellectual merit and chiefly concerned with knowledge, discovery and the

free and vigorous contest of ideas. Why did that change happen? I’ve seen arguments that it goes back to the 1978 Bakke decision, when the Supreme Court effectively greenlit affirmative action in the name of diversity. But the problem with Bakke isn’t that it allowed diversity to be a consideration in admissions decisions. It’s that university administrators turned an allowance into a requirement, so a kind of racial gerrymander now permeates nearly every aspect of academic life, from admissions decisions to faculty appointments to the racial makeup of contributors to essay collections. If affirmative action had been administered with a lighter hand — more nudge than mandate — it might have survived the court’s scrutiny last year. Instead, it became a pervasive regime that frequently got in the way of the universities’ higher goals, particularly the open exchange of ideas. In announcing Gay’s appointment, Harvard praised her leadership and scholarship. The work of a university president is also that of executive, fundraiser and cheerleader for the institution, and maybe the Harvard Corporation thought she’d be good at that. But skin color was the first thing The Harvard Crimson noted in its story about her taking office, and her missteps and questions about her academic work gave ammunition to detractors who claimed she owed her position solely to her race. This is the poisoned pool in which Harvard now swims. Whenever it elevates someone like Gay, there’s an assumption by admirers and detractors alike that she’s a political symbol whose performance represents more than who she is as a person. The weight of expectations on her must have been crushing. But dehumanization is the price any institution pays when considerations of social engineering supplant those of individual achievement. It may take a generation after the end of affirmative action before someone like Gay can have the opportunity to be judged on her own merits, irrespective of her color. But the damage that the social justice model has done to higher education will take longer to repair. In 2015, 57% of Americans expressed high confidence in higher education, according to a Gallup survey. Last year, the number had fallen to 36%, and that was before the wave of antisemitic campus outbursts. At Harvard, early admission applications fell by 17% last fall. The school next to Boston will probably rebound. But Harvard also sets the tone for the rest of American higher ed — and for public attitudes toward it. One of the secrets of America’s postwar success wasn’t simply the caliber of U.S. universities. It was the respect they engendered among ordinary people who aspired to send their children to them. That respect is now being eroded to the point of being erased. For good reason. People admire, and will strive for, excellence — both for its own sake and for the status it
confers. But status without excellence is a rapidly wasting asset, especially when it comes with an exorbitant price. That’s the position of much of American academia today. Two-hundred thousand dollars or more is a lot to pay for lessons in how to be an anti-racist. Nobody should doubt that there is still a lot of excellence in today’s academia and plenty of good reasons to send your kids to college. But nobody should doubt, either, that the intellectual rot is pervasive and won’t stop spreading until universities return to the idea that their central purpose is to identify and nurture and liberate the best minds, not to engineer social utopias.

AN JUAN – Ante las expresiones del Contralor Electoral, Walter Vélez en una emisora radial durante la mañana del miércoles en las que prohíbe la utilización de la frase “Haciendo que las cosas pasen” por el Gobierno de Puerto Rico, el presidente del Partido Popular Democrático (PPD), Jesús Manuel Ortiz, reiteró el planteamiento que hiciera en octubre pasado de que el gasto público en anuncios del Gobierno con esta frase viola la Constitución de Puerto Rico. “Las expresiones del Contralor Electoral, validan la denuncia que hicimos en octubre pasado. La frase “Haciendo que las Cosas Pasen” del Gobierno de Puerto Rico es un estribillo político que viola la Constitución al utilizar fondos públicos para fines privados. Nuestro planteamiento nunca ha tenido que ver
con la veda electoral, sino con el mal uso del dinero del pueblo, que fue destinado a una campaña para realzar la imagen del Gobernador y no para satisfacer las necesidades del pueblo” expresó. “Con nuestra denuncia, no buscábamos extender la veda electoral, nuestro fin siempre ha sido que se tenga pudor en el uso de los fondos que están destinados a mejorar la calidad de vida de los puertorriqueños y no utilicen los mismos para desarrollar campañas para resaltar la imagen de nadie. La Oficina del Contralor Electoral está llamada a velar por la transparencia en la utilización de fondos públicos y el hecho de que hasta ahora no hayan puesto una prohibición a la utilización de la frase por parte del Gobierno es lamentable”, añadió. En octubre pasado, el presidente del PPD se querelló ante la Oficina de la Contralor de Puerto Rico,
ante la Oficina del Contralor Electoral y en noviembre demandó judicialmente al gobierno por la violación al artículo 13 de la Ley de Financiamiento de Campañas Políticas, la cual prohíbe la utilización de fondos públicos para el uso de un partido político, aspirante, candidato o comité de campaña. “Actualmente, la demanda está ante la consideración del honorable Anthony Cuevas y el PPD tiene hasta el próximo viernes para presentar nuestra oposición a la desestimación del recurso presentado por todos los demandados”, expresó el también representante por Acumulación. Ortiz González expresó que llevará el caso hasta sus últimas consecuencias, “para que sucesos como estos no vuelvan a repetirse en el Gobierno de Puerto Rico y que los responsables de esta campaña le devuelvan al erario el dinero invertido en el mismo”.

AN JUAN – Julián J. Crespo López es la nueva figura política en el pueblo de los changos, quien radicó su candidatura a la alcaldía por el Partido Popular Democrático (PPD). ‘Ferrari’ review: Michael Mann puts you in the driver’s seat By MANOHLA DARGIS
I
n “Ferrari,” Adam Driver looms like a colossus as Enzo Ferrari. Driver is tall and rangy, but he looks even bigger here — wider, too — partly because Enzo wears boxy suits with linebacker shoulders so broad they nearly scrape the edges of the frame. The most famous man in Italy aside from the Pope, Enzo makes blood-red race cars with sexy curves and supercharged engines. The Commendatore, as he’s called, looks more like a tank. He seems an ideal vehicle for Michael Mann, a filmmaker with his own line of beautiful obsessions. Set largely in 1957, the movie “Ferrari” focuses on an especially catastrophic year in Enzo’s convoluted life. He makes some of the most coveted cars in the world: There’s a king impatiently waiting in Enzo’s office not long after the story takes off. (That royal personage, who’s short, is anxious that, this time, his feet will reach the pedals easily.) All the world wants something from Ferrari, who in turn seems to care only about his race cars, ravishing red beasts that roar out of his factory near his home in Modena and into the world’s fastest, most lethally dangerous races, where records, machines and bodies are routinely broken. What makes those cars and Ferrari run permeates the movie, which opens with the young Enzo (Driver) behind the wheel, racing and all but flying. The jaunty, propulsive jazz on the soundtrack give the scene inviting charm (you’re ready to jump in Enzo’s car, too), as does the smile that spreads across his face. It’s one of the few times he cracks one. Soon after, the story downshifts to an older Commendatore, now gray and imperial and facing bankruptcy as he struggles both with work and two households with two very different women. One greets him on an especially angry morning by firing a gun at him, which does get his attention. Death stalks Enzo and this movie, which energetically gathers momentum even as Mann busily juggles the story’s numerous parts and warring dualisms. Written by Troy Kennedy Martin, the film is based on Brock Yates’ cleareyed 1991 biography “Enzo Ferrari: The Man, the Cars, the Races, the Machine,” if only in strategic part. (Martin also wrote the original, car-centric caper film “The Italian Job.”) While the book traces its subject (and brand) from cradle to beyond the grave, the movie condenses the automaker’s life into a brief, emblematic period and a series of dramatic oppositions, including two

The movie is similarly divided between genres, and like Enzo himself, it toggles between the melodrama that defines his domestic life and the thriller that takes off every time one of his race cars does. Mann spends a lot of time on Enzo’s bifurcated personal life, which is split between his house in Modena and a pastoral farmhouse outside the city. In Modena, he lives in a gloomy mansion that he shares with Laura (Penélope Cruz), his wife and business partner, and with his mother (a ferocious Daniela Piperno), a gorgon who haunts the other inhabitants like a curse. It’s no wonder that he regularly flees to the farmhouse to be with Lina Lardi (Shailene Woodley), and their young son, Piero (Giuseppe Festinese). With these women, Mann expands the usual narrow parameters of the great-man-ofhistory narrative but only Enzo’s relationship with Laura proves of interest. Woodley is serviceable as Lina, a tousled bland homebody who, for the most part, is either in bed or whipping something up in the kitchen. Despite the couple’s issues — Lina wants Enzo to legally recognize their son so that he can carry the Ferrari name — their relationship is too pedestrian, or maybe simply too happy, to be productive, at least for this director. Mostly, Lina and Piero function as the temperate, tolerant counterpoint to his miserable
marriage. A lot of effort has gone into frumping up Cruz for that marriage; it’s a lost cause. Her Laura is no more dowdy than Anna Magnani, the mythic Italian actress who’s a clear reference, certainly visually, for the character. Cruz presents an inherently glamorous picture, however much Laura has been dulled by the death of her and Enzo’s only son. Cruz lets light into this often unmodulated character, whose emotional palette ranges between bitter resentment and barely contained rage, adding intricate, complicating notes. You see the faded humor in Laura’s sardonic bitterness, and maybe something that once approached joy. You also see the toughness and intelligence of the woman who helped build the Ferrari brand and the legend. Driver lets you into Enzo as far as possible given the material, though the actor’s warmth and decency never fully mesh with his character’s cool, consuming self-interest. Like a number of Mann’s other more memorable protagonists, Enzo is a gravely serious, hardworking, closed fist of a man who often seems ready to strike. That threat can keep you both on edge and fixed on these characters, and is crucial to their violent charisma. If brutality were all there was to them, though, they would be forgettable, nothing more than cheap villains. Part of what makes them mesmerizing is the play between their existential torrent and the titanic willed effort it takes for these characters to hold all of it
(whatever that it is) in check. Enzo is intimidating, at times threatening and, as you’re often reminded, driven and divided. Yet partly because he’s clinging to an established enterprise rather than building it up his intensity feels fueled more by power than by desire. What come across here is his autocratic mercenariness, disregard for other people’s lives and, mostly, his love of cars. In one early morning scene at Lina’s, he pushes his car down the driveway so he doesn’t wake her or Piero. It’s a nice touch, though reads like a bid to humanize Enzo. What’s more revealing are the images of him after he drives off, an interlude that Mann analytically breaks down into shots of Enzo’s hands working the wheel and gears while his feet dance on the pedals. Mann seems to have put in serious time behind the wheel himself because the racing is flat-out thrilling. Many of the most pleasurable scenes take place when the drivers (played by, among others, Gabriel Leone, Jack O’Connell and Patrick Dempsey) are hard at work and barreling around a track or down an ominously empty country lane, as in a climactic open-road event called the Mille Miglia. Mann shoots this lunatic race from every conceivable angle — with cameras in and out of cars, bearing down on drivers’ faces, agitatedly hovering midair — creating an immersive, visceral intimacy that, as engines whine and thunderously roar, you feel in your bones. Enzo may have also once felt it, but now he’s the boss with the stopwatch. Outwardly, Enzo has the makings of a natural addition to Mann’s stable of troubled and tormented men, anguished souls that he gives voice to with his sublimely expressionistic filmmaking. Yet Enzo remains out of reach. One issue is that Mann needs a character with soul, not just a calling. He keeps searching for one and, to that end, he periodically shows Enzo in a close-up so extreme that the automaker’s face crowds the foreground, dominating your sightlines much as he dominates his life. These images convey Enzo’s isolation from much of his world, with all its living and needlessly dead. You’re about as deep inside this character’s head as imaginable, though given the glimpses you catch of what’s inside and all the damage that Enzo does, it is the filmmaker more than the character who holds you rapt. — ‘Ferrari’ Rated R for auto-racing carnage. With Tom Wilkinson, would you get a time bomb or a warm hug? By ALISSA WILKINSON
I
t takes 27 minutes for Tom Wilkinson to actually show up in “Michael Clayton,” but his specter haunts every second. The movie opens with his voice on a recording, pleading in familiar terms with “Michael” — we find out later he’s a fixer at the law firm where Wilkinson’s character is a partner. “I’m begging you, Michael, I’m begging you, try to make believe this is not just madness, because this is not just madness,” the voice pleads, pitch modulating and then oscillating through steadiness to vexation. He launches into a story about leaving a building to find himself coated in “amniotic, embryonic fluid,” then coming to a “stunning moment of clarity” about his work as a litigator who’s poured years of his life into, well, we don’t know yet, but it must be bad. Tony Gilroy’s screenplay gives Wilkinson a lot to work with, but it’s his performance that grabs you by the throat, all the more gripping because we don’t really know what’s going on. Who is this man? Is he aware of what he’s saying, or have his marbles gone skittering across the room and into every corner? Is anything he says true, and if it is, does he know it? Those questions hover over the movie, the tension stretching drum-tight before Wilkinson even appears. George Clooney is the star of “Michael Clayton,” but its beating heart lies with Wilkinson, this imploding man on the phone. Wilkinson (no relation, although publicists used to ask me), who died Saturday at 75, is one of those actors everyone knows even if they can’t quite place him. He is the guy from “The Full Monty,” from “Batman Begins,” from “Mission: Impossible — Ghost Protocol.” He did everything from “The Best Exotic Marigold Hotel” to “The Grand Budapest Hotel,” and channeled historical figures including Joseph P. Kennedy (in “The Kennedys”), Lyndon B. Johnson (in “Selma”) and Benjamin Franklin (in “John Adams”). He played a lot of priests and a lot of soldiers and a lot of men from history, but he never quite managed to be pigeonholed as anyone in particular. Wilkinson worked a lot, with multiple film, TV and stage credits most years since the early 1980s, in part because he usually didn’t play the lead. Instead, he was the man you brought in to fill a role with gravitas and a spark of peril, someone who
would never simply say lines but make everything suddenly significant. What’s so fascinating about Wilkinson’s career, the kinds of characters he chose to portray, is their capacity for vulnerability and unpredictability. When he walked on screen, you were not quite sure whether this guy was going to be trustworthy or explosive. The instruments Wilkinson had to work with — his look, his stature, his voice — weren’t particularly remarkable on their own. His face, which began to verge on the cherubic as he aged, was that of an ordinary Englishman, someone you’d bump into in a pub. His voice wasn’t particularly rumbly or low-pitched, and although he stood much taller than many men he acted with, you’d never stare as he walked down the street. Wilkinson looked, in essence, like someone’s granddad, a man who would slip you a cough drop midmeeting and wink. Yet, his roles I remember most involved an element of danger so thoroughly fused into that exterior that I spent the whole movie wondering whether this guy was a warm hug or a time bomb. In Michel Gondry’s “Eternal Sunshine of the Spotless Mind,” Wilkinson has a minor role as the doctor overseeing the memory-erasing procedure that Jim Carrey’s lovelorn Joel desperately seeks. Kirsten Dunst plays Mary, the muchyounger assistant who falls in love with the doctor. When he tries to explain that the two of them have a history already, there’s equal parts patheticness and pathos in his performance. Is he predator, prey or helplessly uncertain how his own work really affects people? He’s not sure, and neither are we. Or there’s the bereaved father in Todd Field’s “In the Bedroom,” a quiet, upstanding Maine father who is being eaten alive by his need to avenge the death of his son at the hands of his son’s girlfriend’s ex-husband. The final half-hour features Wilkinson at his most volatile, a deadpan expression on his face and a pistol in his hand. What’s in his heart is wholly inscrutable not just to the man at the other end of the gun, but to the audience, too. He could go off at any minute — or not at all. The greatest encapsulation of this ability, however, still lies in “Michael Clayton,” with the role of attorney Arthur Edens (for which he was Oscar-nominated) perfectly tuned for Wilkinson’s abilities. When his monologue ends, we’re pretty sure the man on the phone needs immediate psychiatric

Maybe this guy really has had a blinding moment of insight, a sudden attack of moral clarity. Or maybe not? Edens, it emerges, has bipolar disorder and is typically medicated, and Wilkinson plays this as a man whose mind keeps slipping sideways inside his skull. The effect on the audience is absolutely electric. In one scene, Edens knocks on a window to say hello to Clayton, a sweet smile on his face — surely this guy just needs a nap. In another, just after he seemed moderately lucid, he’s curled in bed, all but rocking back and forth as he talks to a child on the phone about the kid’s favorite fantasy book, seeming desperate to understand. Other people don’t know what to do with him either; a plaintiff seems to harbor both affection for and fear of him, and we get it. He seems equally likely to fly off the handle or offer a cup of tea. “You are a manic depressive,” Clayton says to him, by way of dismissing what seems like an attack of conscience not befitting a legendary litigator. “I am Shiva, the god of death,” Wilkinson replies, no histrionics, just a flat statement of fact. It makes your toes curl. The most chilling scene in “Michael Clayton” comes straight out of the blue, a perfect showcase for Wilkinson’s ability to ride the edge. Clayton is driving the streets
of Manhattan to find Edens, who has gone missing. He spots him walking down an alleyway with a comically giant bag of baguettes, and Edens, delighted to see him, offers him one. His face is childlike and open, vulnerable and generous. We’re almost afraid this man will get mugged for his bread. Then Clooney starts talking about committing Edens to an institution, and suddenly a glint appears in Wilkinson’s eye. “Michael,” he says, in a voice that sounds very different from the one on the recording, “I have great affection for you, and you lead a very rich and interesting life.” This does not seem like a compliment. “But you’re a bag man, not an attorney,” he continues, in a tone of perfect lucidity. Suddenly we’re seeing Edens, the courtroom killer, exactly the lawyer you’d choose to defend a giant corporation in a multibillion-dollar class action suit. He is about to rip out Clayton’s guts. Calmly, Edens goes on to explain why Clayton’s approach to getting Edens into an institution — the better to control the situation — is completely wrongheaded, given the laws about these things in New York. Everything he has done is a mistake, and Clayton knows it because Edens knows it. “Well, good luck and God bless,” he concludes. “But I’ll tell you this: the last place you want to see me is in court.” And we, at least for that moment, believe him.

A stunning eclipse, a moon race and other space events in 2024 By MICHAEL ROSTON

ndia landed a robot on the moon and NASA brought pieces of an asteroid back to Earth to study. A green comet illuminated night skies and a “ring of fire” eclipse captivated spectators from Oregon to Brazil. SpaceX launched nearly 100 rockets, and Japan and Europe put powerful new space telescopes into orbit. For space and astronomy lovers, these were some of the biggest events of 2023. The year ahead promises more memorable happenings on launchpads, in orbit and around the solar system. Here’s what to expect in 2024. Milestones on the path back to the moon NASA wants to put American astronauts on the moon’s surface in the years ahead with the Artemis III mission. Before that can happen, though, many things have to go right, and two of the most important are scheduled for 2024. The first is the Artemis II mission. NASA introduced the four astronauts of Artemis II last year. As soon as November, they could travel around the moon and back. They would be the first humans to travel near the moon since 1972, when the Apollo 17 mission concluded. To fly in 2024, NASA will need to resolve issues with a heat shield on the astronauts’ spacecraft, as well as overcome other potential delays. The second hurdle is that the Orion capsule can only orbit the moon — it doesn’t land. Astronauts need another vehicle to head to the surface. For the moment, that is a version of Starship, the spacecraft being built by SpaceX, the private spaceflight company founded by Elon Musk. But Starship needs a lot of work before it will be ready to carry astronauts to the moon. Prototypes of Musk’s Starship launched twice in 2023, and each mission ended in a fiery blast. SpaceX has said it wants to fly the next Starship test early this year; whether it succeeds or fails, flights of more prototypes could follow. If SpaceX gets the next Starship flights right, NASA’s prospects of putting the next man and the first woman on the moon will improve in the years ahead. A total eclipse over North America

(Travis Dove/The New York Times) The celestial spectacle of 2024 will be the “Great North American Eclipse.” On April 8, the moon will get in the way of the sun, darkening the Earth during the day. The eclipse’s broad path starts in Mexico, crosses into Texas, continues up through Arkansas and Missouri into southern Illinois, crosses into Indiana and Ohio, then darkens western New York and states in New England before ending in Canada’s eastern provinces. If you live in the path of totality, get ready for visitors. (You can’t book travel to the path soon enough.) And if you plan to observe the eclipse — from anywhere — it’s time to order eclipse glasses or other protective viewers. New rockets and rides to space Falcon 9 rockets, built and operated by SpaceX, have become the dominant way to get to space. The launcher or its Falcon Heavy variant flew 96 times in 2023, with every flight to orbit a success. But SpaceX should expect new competitors on launchpads in 2024. They include: — Vulcan, a rocket built by United Launch Alliance, a joint venture of Boeing and Lockheed Martin: The rocket’s engines are built by Blue Origin, the space company founded by Jeff Bezos of Amazon. It could fly on Jan. 8.
— Ariane 6, a European rocket: The European Space Agency has been without a dedicated vehicle to get to orbit recently, forcing Europe to rely on SpaceX and others to get spacecraft out into the solar system. After a series of delays, Ariane 6’s first flight could occur in June. — H3, a Japanese rocket: This vehicle launched for the first time in March 2023, but it failed in its attempt to put an imaging satellite into orbit. A second attempt may happen as soon as Feb. 15. — New Glenn, a rocket from Blue Origin: Bezos’ company has flown tourists to the edge of space in its smaller New Shepard vehicle. Its large orbital launcher could debut in 2024, shaking up private spaceflight if it proves successful. New vehicles could also visit the International Space Station. Dream Chaser, a space plane built by the company Sierra Space, may carry cargo to the station for the first time this year. Additionally, Starliner, a capsule built by Boeing, may carry a crew of astronauts to the outpost in orbit on April 14 after years of delays. Lunar traffic jam Three missions attempted to land on the moon in 2023. Only one, Chandrayaan-3 from India, succeeded. Four additional missions — and perhaps more —
will also try to complete a lunar landing in 2024: — SLIM, a Japanese mission, should be the first lunar landing attempt of 2024, on Jan. 20. The small, experimental spacecraft launched in September and is orbiting the moon. — Two other missions come from private companies, with NASA as their primary customer. Astrobotic, a Pittsburgh company, will launch its Peregrine lunar lander on Jan. 8, which could attempt to set down near the Ocean of Storms on the moon’s near side in February. Intuitive Machines of Houston will send its own lander toward the moon’s south pole as early as mid-February. — China is also planning its fourth moon landing. Chang’e-6 could head toward the moon’s far side in May, gathering samples of moon rock and dust to bring to Earth for study. Other missions are more tentative. Japanese company Ispace, which crashed its first lander last year, could make a second attempt late this year. . And Intuitive Machines has ambitions of sending two more NASA-sponsored missions to the moon in 2024. Journeys around the solar systemThere’s a vast solar system out there, and missions large and small will set out to explore it. The biggest is Europa Clipper, a NASA spacecraft headed to Jupiter’s moon, Europa, in October. Europa has an icy exterior concealing a vast ocean that scientists say may have the right conditions for life. After Clipper arrives at Europa in 2030, the spacecraft will attempt no landing there, but it will study the moon during dozens of flybys. Two new spacecraft could also head to the red planet no earlier than August as part of the small NASA ESCAPADE mission. The spacecraft will orbit Mars and study the magnetic bubble that surrounds it. In October, the European Space Agency will launch the Hera mission to the asteroid Dimorphos. It will study the effects of an earlier mission, NASA’s Double Asteroid Redirection Test, which slammed into Dimorphos in 2022 to test whether altering a space rock’s trajectory could protect Earth from future asteroid strikes.

Navigating ups and downs, Shiffrin absorbs life lessons (Taylor’s version) By BILL PENNINGTON
A
s Mikaela Shiffrin plans the next phase of her record-setting career as a skier, she is looking, as she always has, to the example of another female megastar who has experienced kindred highs and lows and highs in her career: Taylor Swift. The American skier Shiffrin is the most successful, and precocious, Alpine racer in history, having smashed the mark for World Cup victories, by women and men, while still in her prime skiing years. The American singer-songwriter Swift is the world’s biggest pop star, smashing music industry records one after another. When Shiffrin made her debut on the World Cup circuit, she was just shy of turning 16, the same age Swift was when she began recording her debut album five years earlier. They have both been teenage sensations lavished with praise and profit. While Swift, named Time magazine’s person of the year for 2023, might right now be the most famous human on the planet, Shiffrin, celebrated at home, has bona fide rock star status in Europe, where ski racing is the national sport of several countries. They are both at the top of their respective mountains. They have been innovators, historymakers and leading figures in their highwire professions. But like many caught in the pop culture maelstrom, they’ve experienced intense, barbed criticism after any failure, real or perceived. Each has openly dealt with a parent’s death or serious illness and each has taken lengthy breaks from performing. A Swiftie since she was 13, Shiffrin, like legions of other girls and women, sees herself in Swift and has come to recognize elemental parallels in their careers and lives. For perspective, Shiffrin, 28, turns to her idol. In July, Shiffrin rented a suite for Swift’s Eras Tour concert in Denver, an event Shiffrin described as “three hours of jumping up and down while singing every song at the top of my lungs.” Within that experience, Shiffrin pondered if there was a lesson that would help shape the next “era” of her own luminous career.

(Doug Mills/The New York Times) Had Swift, the teen prodigy who is now 34, helped point the way from one stage to another? “Absolutely, because I’ve spent 15 years studying Taylor Swift and she has been guiding me a little bit every step of the way,” Shiffrin said in a recent interview in Killington, Vermont, where she claimed the 90th of her 93 career World Cup victories. “It’s why most Swifties become Swifties. It feels like her music is speaking directly to you. Her experiences resonate; I’ve always tried to learn from them.” Shiffrin’s mother, Eileen, a former ski racer who is also one of her coaches, insisted that Swift had provided guidance that is more multifaceted and sophisticated than it might seem. “Miki’s sport and career thrives on creativity,” Eileen Shiffrin wrote in an email last month, using Mikaela’s family nickname. She added that “every new Taylor Swift song, concert and video,” is an inspiration and motivation to her daughter. Eileen Shiffrin, who praised Swift’s “street smarts” and business acumen, continued: “She keeps Miki ticking like she does the whole world. And she stands her ground, as she should, and that’s a
great role model.” As Mikaela Shiffrin, who has never met Swift, recalled various chapters of her public journey — stunning racing successes, ill-timed flops, the perils of fame, the accidental death of her father in 2020 — Shiffrin readily identified ways Swift had influenced her responses to each situation. That long-distance tutelage began when the preternaturally gifted Shiffrin, nurtured in the Colorado mountains and at a venerable Vermont ski academy, won three World Cup races and a world championship gold medal as a high school senior. A year later, in 2014, she became the youngest slalom champion in Olympic history, at 18, and was thrust into an international sporting spotlight that has only seemed to magnify with each season. But since her days as a 13-year-old listening to Swift’s 2008 album “Fearless” on repeat, she said, she has looked for clues on how to live as a celebrity. “Granted, Taylor is a big fish in a big pond and I’m more of a big fish in a small pond,” Shiffrin said. “But you can see how she’s handled the attention, because she was a teenager, too. She was able to hold up and work on her music. And while
she’s very comfortable sharing a lot of her life, she builds a layer of protection when she needs it. She can disappear. That does seem to give her energy. “I took all that in and kind of assimilated it. Although it was hard for me because I had to go from being an extreme introvert to being comfortable around a lot of cameras and microphones. It’s a bit funny having to go through life quantifying yourself as an introvert but having to live it in an extroverted way.” After winning gold and silver medals at the 2018 Pyeongchang Olympics, Shiffrin won an unprecedented 17 races in the following season. At the time, a five- or six-win Alpine season would have been considered prosperous. But at the start of the next season, Shiffrin did not match the astonishing pace she had set a year earlier. “People started to say that I’d lost my touch, that maybe I had peaked and my career was fading,” Shiffrin said with a look of exasperation as she slumped backward into a lounge chair. “I was like, ‘Oh, gosh, everybody’s saying all this stuff about me like I’m never going to be a good skier again.’” Shiffrin was reminded of Swift’s “Reputation” album from a few years earlier, and again saw parallels. “That album was built of basically having her reputation go incredibly downhill, or at least that’s how she perceived it with all the feuds that were going on at the time,” Shiffrin said. “But she came back in a big, big way. I related to the album because it made me feel like life is full of ebbs and flows. And that everything is probably going to be OK.” Shiffrin rallied in January 2020, with successive victories. But roughly a week after the second of those restorative triumphs, on Feb. 1, her older brother, Taylor, reached her by phone in Europe to say that their father, Jeff Shiffrin, had been seriously hurt at home in Colorado. Returning to Denver, Mikaela climbed onto her father’s hospital bed for several hours, a vigil that ended with his death on Feb. 2. The family has declined to reveal details of what happened; a coroner ruled the death an accident and listed the cause as a head injury.

In last month’s interview, without prompting, Shiffrin recalled that Swift’s 2020 album “Folklore” came out five months after her father’s death and that it included “Epiphany.” Swift has said the song explores the emotional distress of health care workers at the height of the COVID-19 pandemic and of soldiers at war, a correlation that pays homage to one of Swift’s grandfathers, who was a battle-hardened U.S. Marine in World War II. Shiffrin played “Epiphany” over and over. “She literally addressed the most unforeseeable and horrific experience I ever have gone through,” Shiffrin said of Swift, whose parents have each dealt with cancer. “It speaks directly to the experiences I had in the hospital with my dad. “It was hard to listen to and heart-wrenching but also uplifting at the same time, which is something I really needed at that time.” Shiffrin’s return to competition in the 2021-22 season included a string of triumphant results, as well as a shocking, demoralizing outing at the Beijing Olympics, where she did not win a medal. Since then she has won 20 races, which puts her on pace for roughly 130 career victories if she were to race five more years. The previous World Cup wins record, which stood for 34 years, was
86. She has won 14 world championship medals, one shy of the most in a career. But whatever Shiffrin’s future holds, she is sure of two things. The first is that given her level of sporting fame, Shiffrin could likely arrange to meet Swift, but she is afraid to do so. “I’d probably trip over myself and be so tongue-tied,” Shiffrin said, laughing. “And then it’d be memorable to her because it’s the first time she’s experienced, like, a goofball.” The second certainty is that she will use Swift as a model to help define the next era of her career, regardless of how many Alpine skiing records she accumulates. “Taylor Swift has reset so many records and held so many titles in the music industry that they have had to create new ways to measure her success,” Shiffrin said. “And I’ve noticed that she just keeps going.” Does that help solve Shiffrin’s central dilemma: What to do next? “Well, there’s an entire universe inside Taylor Swift’s mind that we haven’t tapped into yet — maybe we’ve tapped into 1% of what she can accomplish because of her music,” Shiffrin said. “And I think about my skiing in a similar way. I’m closer now to reaching my potential, but it’s not about a record or another title. “I’ve noticed Taylor just keeps going. In a way, you never finish doing that work.”

Spanish soccer star testifies about unwanted kiss By RACHEL CHAUNDLER
J
ennifer Hermoso, the Spanish soccer star who received an unsolicited kiss on the mouth after her team won the World Cup, gave evidence in Spain’s National Court earlier this week against Luis Rubiales, the Spanish former soccer boss who is being investigated over allegations of sexual assault and coercion in connection with the episode. Hermoso’s testimony in Zaragoza, Spain concluded the high-profile criminal inquiry of Rubiales, which was opened days after the World Cup, which took place in Sydney in August. A judge, Francisco de Jorge, must now decide whether to charge Rubiales or to close the case. If de Jorge concludes there is evidence of wrongdoing, Rubiales will face trial on a sexual assault charge — punishable with between one and four years in prison. Rubiales and three executives at the soccer federation, including the former coach, Jorge Vilda, may also face charges of coercion after they were accused of exerting pressure on Hermoso to show support for Rubiales. Rubiales has denied the charges, saying that it was nothing more than a “peck.” On Tuesday morning, Hermoso was the last in a string of Spanish sporting ce-
lebrities to give evidence. The list of witnesses summoned by de Jorge reads like the “Who’s Who” of Spanish soccer, with stars such as Alexia Putellas, the current Best FIFA Women’s Player; Misa Rodríguez, the goalkeeper for Real Madrid; and Irene Paredes, Barcelona’s star defender. Several football association executives have also given their versions of events, as have Vilda, Hermoso’s brother and Rubiales himself. Hermoso spoke to the news media outside Spain’s National Court after her appearance. “All is in the hands of justice,” she said, seemingly at ease. What exactly she or the other witnesses disclosed to de Jorge has not been made public officially, as the hearings have been held behind closed doors. But shortly after Hermoso left court Tuesday morning, the Spanish prosecutor’s office issued a statement confirming that she had testified that “the kiss was unexpected and at no point consented.” The prosecutor’s statement also highlights “the constant harassment” experienced by Hermoso on the journey home to Spain from Australia in August and how it “altered her normal life, producing a situation of distress and sadness.” Almost half a year after the Spanish women’s World Cup victory was eclipsed
by the behavior of Rubiales, Hermoso’s profile continues to rise. Her recent performance on the field was instrumental in a Nations League victory against Italy, keeping alive the Spanish team’s hopes of qualifying for the Olympic Games in Paris. Earlier this week, Hermoso signed a deal with the Mexican club, Tigres UANL. Reports in the Spanish media put a six-figure number to the contract, big money in women’s soccer. The minimum salary for Spanish league players is a mere 21,000 euros, or about $23,000, compared with 180,000 euros, or about $197,000, for their male
counterparts. Hermoso was also chosen by Spanish broadcaster TVE to co-present the New Year’s Eve celebrations. Rubiales, on the contrary, has almost disappeared from public life in Spain. Claiming to be a victim of “false feminism,” he has maintained that Hermoso initiated the kiss. But in October, soccer’s global governing body banned him from the sport for three years. As he awaits de Jorge’s decision, Rubiales is also being investigated by anti-corruption prosecutors over irregularities in the use of federation funds.
