IEPR: Delays in vital statistics reports hinder new knowledge on health issues

Puerto Rico Institute of Statistics (IEPR by its Spanish initials) Director Orville M. Disdier Flores charged Thursday that the island Health Department has failed to produce annual vital statistics reports, hindering new knowledge on socioeconomic and health issues associated with the population.

The IEPR demanded on Jan. 10, through a letter addressed to Health Secretary Carlos Mellado López, the delivery of the annual reports of vital statistics corresponding to each calendar year of the period 2017-2020.

“Currently, the only information coming to the Institute is preliminary death registry data. … Since 2016, we have not received vital statistics on mortality, births, marriages, and divorces in Puerto Rico,” Disdier Flores said. “We have demanded multiple times that Health produce that information immediately. We believe that the delay is unacceptable because not having this vital information could affect the economy, social composition and strategic planning.”

In response to questions from Rep. Luis R. Ortiz Lugo, chairman of the House Emergency Preparedness, Reconstruction and Reorganization Committee, IEPR senior manager Alberto Velázquez Estrada added that the lack of vital data could affect the development of new socioeconomic and epidemiological studies on the island.

Disdier Flores said his agency received on Nov. 2, 2022 from the Department of Health incomplete responses to the requested data related to vital statistics for the aforementioned period. In the most recent letter

sent, which was signed by the executive director, the IEPR pointed out that “if the information required here is not provided, the Institute may go to the competent courts or forums to enforce Act No. 209 and the Regulations.”

During the public hearing, Ortiz Lugo asked Health Department staff about the problems affecting the production of vital data. Jonathan Morales González, an adviser on vital statistics and demographic affairs at the Department of Health’s Assistant Secretariat for Planning and Development, stressed that the main problem is a lack of personnel.

“Right now, I’m the only demographer in the office,” he said.

Meanwhile, agencies supported with amendments the creation of new protocols to determine deaths related to catastrophic events.

Senate Bill 524, which seeks to create the “Law on the Protocol for the Determination of the Cause and Manner of Deaths Related to Natural Disasters or Catastrophic Events,” was also addressed in a public hearing.

The Institute of Forensic Sciences (ICF) and the IEPR, as well as the departments of Health and Public Safety, presented papers suggesting several changes to the legislation under consideration.

ICF Director María S. Conte Miller argued that the text should undergo amendments to clarify the scope of the proposed form to evaluate and classify cases of death by factors related to natural events and catastrophes.

At the same time, Conte Miller stressed that the form proposed by the bill, “duly amended,” will allow reliable statistical data for the adoption of public policies or measures that will be used prospectively.

“That’s a step forward and in the right direction,” she said.

The Health Department also expressed concern about paragraph c of Article 4 of the bill, which would establish that the doctor will send the patient’s file to the ICF for analysis.

“The question arises whether, in fact, this paragraph refers to all deaths, that is, natural and unnatural deaths, that occur during an emergency declaration,” the agency noted.

“If so, this measure must be accompanied by guidelines for implementation and allocation of the estimated budget, because when being sent to the Institute of Forensic Sciences for analysis, any death that occurs during an emergency may be limited between the number of pending cases and their resources,” said the presentation signed by Mellado López. “At any time, this could create a delay in the data that must be reported to the Demographic Registry.”

Bill filed to investigate bidding process for repo housing units

Rep. José Aponte Hernández announced on Thursday the filing of a resolution in the island House of Representatives to investigate the bidding processes for repossessed residential units in Puerto Rico.

“During recent weeks, we have received information from many citizens about serious irregularities in the auction process for repossessed houses,” the New Progressive Party at-large legislator said. “Among the data we have received are that people who bid -- and to enter the process you have to provide a certain amount of money -- do not receive information after the end of the auction period. Even worse, days later, they see the property again in sales listings, without knowing if it was awarded or not. Meanwhile, in some cases it is the citizens who have to call to have the deposit returned that they have made to enter the process, which should

not happen.”

“Another issue that has been brought to our attention focuses on the fact that it is the clients who have to call their broker to corroborate whether or not they took the auction and it is not the other way around,” Aponte Hernández noted. “It is a very difficult process for many people and more so at the moment that the private sector itself is not producing the number of new units to meet the demand. That is why it is urgent to address this matter …”

The former House speaker emphasized that the situation adds to the difficulty that already exists for people, particularly in the middle class, to acquire a home on the island.

“There is no doubt that we live in a housing shortage in Puerto Rico,” Aponte Hernández said. “Many families cannot buy [a home] because of a volatile and inflated market in several respects. The lack of action and transparency about the auction process adds to this problem.”

Measure for timely inspection of elderly care centers clears Senate

The island Senate approved a measure this week that establishes a new rigorous and transparent process for the inspection of care centers for the elderly in Puerto Rico.

Senate Bill 836, co-authored by New Progressive Party (NPP) Sen. Keren Riquelme Cabrera and passed late Wednesday, also requires every care institution for the elderly to have an operable electrical generator and enough fuel to last a period of no less than 20 days without regular electricity service.

“We are always evaluating alternatives to assist the elderly, those men and women who built modern Puerto Rico,” the senator said. “We believe that the current Regulation No. 7349 (Regulation for the Licensing and Supervision of Establishments for the Care of the Elderly) is not sufficiently clear on the issue of power plants in

care centers. That is why we wanted to make clear what the requirement is, that of a generator with the capacity to operate for 20 consecutive days.”

The bill, whose other co-author is Sen. Wanda “Wandy” Soto Tolentino, also establishes that the inspections conducted by the Family Department at such centers to corroborate the functionality of the generators and water cisterns will be carried out 90 days before the start of the

hurricane season, as opposed to the currently required 30 days prior.

“A month is a short time to inspect senior care centers across the island,” Riquelme said. “It is urgent that this be changed to three months. This is to give each center that did not meet the requirements of an operational generator and water cistern time to correct the failures before the arrival of the hurricane season in June.”

PREPA board approves contract to privatize energy generation on the island

The Puerto Rico Electric Power Authority (PREPA) governing board in a 4-1 vote Thursday afternoon approved the contract that would put PREPA’s legacy power plants under a private operator.

PREPA board member Tomás Torres voted against the deal because, he said, it is a mere contract for operation and maintenance, a task that PREPA personnel can carry out.

“We are going to pay millions to a private firm and take away resources that can be used by PREPA to pay its debt or for capital works,” Torres said.

PREPA has been bankrupt since 2017 and is in court to restructure close to $10 billion in debt.

Details of the contract with the private operator were kept secret because the information is considered confidential until the parties sign it. Sources said the selected private operator, which has been identified as a consortium headed by a subsidiary of New Fortress Energy called NFR Energia, Peak Energy and Black & Veatch, will be paid anywhere up to $100 million.

The contract, which the Public-Private

Partnerships Authority (P3A) board approved unanimously last Sunday (Jan. 15), now goes to the consideration of Gov. Pedro Pierluisi Urrutia, who has 30 days to act. The Finan-

cial Oversight and Management Board must review it also.

PREPA Governing Board Chairman Fernando Gil Enseñat revealed that the Puerto

Rico Energy Bureau issued a certificate of compliance on Jan. 15. The document has yet to be made public.

Gil Enseñat said the contract will be valid for 10 years and that after the fifth year it can be reviewed. Costs of the contract are expected to go down significantly after the sixth year, once power plants are decommissioned in favor of renewable energy.

Ángel Figueroa Jaramillo, president of the Electrical Industry and Irrigation Workers Union (UTIER), said the union will wait until the contents of the contract are made public before deciding its next step.

He said the contract is very similar to the one that put LUMA Energy in charge of PREPA’s transmission and distribution system. However, he said the protections provided to the workers are only the ones guaranteed by law and not the collective bargaining agreement. Under the LUMA Energy contract, workers could work with the private operator or move to other government agencies.

Most workers moved to other government agencies to avoid losing their pensions.

“My advice to the workers is not to go to work for the private operator,” the UTIER president said.

Judge Swain: Class action suit against LUMA must be heard in local court

Aclass action suit against LUMA Energy that seeks over $800 million in damages will have to be heard in a Puerto Rico court instead of in the U.S. District Court as it has no impact on the bankruptcy case, U.S. District Court Judge Laura Taylor Swain has decided.

The judge overseeing Puerto Rico’s Title III bankruptcy cases overruled LUMA’s objections to removing the suit from federal court with her decision issued Wednesday.

LUMA Energy assumed the operation of the Puerto Rico Electric Power Authority’s (PREPA) transmission and distribution (T&D) system on June 1, 2021. On April 13, 2022, the plaintiffs filed the case captioned Ismael Herrero Domenech and the Class Composed by all Residential Electric Energy Consumers, Customers of LUMA Energy LLC of Puerto Rico v. LUMA Energy, LLC and underwriters. On April 25, 2022, plaintiffs filed the case captioned Wendco of Puerto Rico Inc.; MultiSystem Restaurant Inc.; Restaurant Operators Inc.; Apple Caribe Inc. also sued LUMA et al on behalf of all merchants doing business on the island. On May 17, 2022, the first and the second civil actions were consolidated as a class action suit.

The case centers around ratepayers who have sought class action status in a suit in which they seek $800 million from LUMA Energy alleging that it failed to maintain PREPA’s equipment, resulting in an islandwide blackout in April 2022.

The suit was later removed to federal court because PREPA is in bankruptcy. Magistrate Judge Judith Dein in a report to the court said the case should be remanded back

to the local jurisdiction, but LUMA objected.

LUMA had argued that Dein’s report erroneously concluded that the removed action would not affect the efficient administration of PREPA’s bankruptcy and that the legal issues raised in the removed action were not relevant to PREPA’s bankruptcy case “notwithstanding the fact that LUMA alleges that PREPA’s conduct and potential liability are at the center of the Removed Action.”

Swain agreed with Dein’s recommendations that a local court was a more appropriate forum for the case. While the size of the claim was significant to PREPA’s estate, if plaintiffs win and LUMA is able to get PREPA to indemnify LUMA, it doesn’t mean it will affect the administration of the case, Swain noted.

Swain said “LUMA has not proffered any reason why the forum in which the Removed Action is adjudicated will be significant to the administration of PREPA’s Title III case.”

In another PREPA ruling, Swain said PREPA’s dispute with Cobra Acquisitions over a $200 million claim will remain stayed until at least July 31 while the bankruptcy is resolved. Cobra, whose president was convicted on bribery charges related to his work in Puerto Rico, asked the court in January to lift the stay so that the claims could be litigated.

PRIDCO to reimburse EPA $11 million for cleanup at Maunabo Superfund site

The U.S. Environmental Protection Agency (EPA) has reached a settlement with the Puerto Rico Industrial Development Co. (PRIDCO) for the reimbursement of $11 million in costs the EPA incurred in cleaning up contamination at the Maunabo Groundwater Superfund Site in Puerto Rico.

“We are pleased to have reached a settlement with the Puerto Rico Industrial Development Company that holds it accountable -- not the taxpayer -- for the cleanup of contamination at its property and protects the Maunabo community,” EPA Regional Administrator Lisa F. García said in a statement issued late Wednesday. “This settlement reimburses EPA for its work in assessing the contamination, designing the remedy and cleaning up the groundwater contamination.”

The Maunabo Groundwater Contamination Site is located in the southeastern coastal area of Puerto Rico, where the groundwater is contaminated with various types of volatile organic compounds (VOCs), including tetrachloroethene (PCE), trichloroethene (TCE), and cis-1,2-dichloroethene (cis-1,2-DCE). The site includes

four wells that provide drinking water to the Maunabo Urbano public water system, which is currently getting its drinking water from safe sources. The EPA selected, designed and implemented the remedy for the site through its Superfund program.

The EPA determined that one or more of the tenants at an industrial park owned by PRIDCO was a source of the VOC contamination. In September 2015, PRIDCO declined to participate in settlement discussions, leading the United States Department of Justice (DOJ) to file a civil lawsuit in federal district court in Puerto Rico to recover EPA’s costs for cleaning up the site. The DOJ argued that PRIDCO, as the owner of the industrial park, was legally responsible for the contaminated groundwater, and the court agreed, awarding EPA its past response costs and holding PRIDCO accountable for future costs as well. PRIDCO appealed the decision to the U.S. Court of Appeals for the First Circuit, which upheld the district court’s ruling. The settlement resolves PRIDCO’s current financial obligations for the site as a result of the lawsuit.

Under the terms of the settlement, PRIDCO will pay the EPA a total of $11 million over seven years to cover all of the agency’s past response costs and interest. The payment will reimburse the EPA for the funds it spent cleaning up the Maunabo Groundwater Superfund site and ensuring that the drinking water in the affected communities is safe for residents.

Special prosecutor appointed to investigate Hatillo mayor

The Special Independent Prosecutor Panel (PFEI by its Spanish initials) determined this week to appoint a special independent prosecutor (FEI) to investigate Hatillo Mayor Carlos Román Román and the press officer of that municipality, José Padilla Romero.

The facts in the case originated with a complaint filed by William Rosales Concepción against the mayor for the alleged use of the facilities of the city council and municipal employees in the recording of an audiovisual spot for the purposes of his partisan political campaign.

The complaint alleges activities carried out by Román while serving as interim mayor, and in the context of his preparation for a special election held in May 2022.

Attorney General Domingo Emanuelli Hernández referred the case to the Justice Department’s Division of Public Integrity and Comptroller’s Affairs (DIPAC by its Spanish acronym).

As a result of its preliminary investigation, DIPAC concluded that there is sufficient cause to believe that Román Román and Padilla engaged in possible criminal conduct described in articles 5,012 and 13,000 of Law 222-2011, known as the Law for the Control of Political Campaigns in Puerto Rico.

Based on the findings of that investigation, DIPAC

advised that an FEI be appointed, which was accepted by the Justice secretary, who in turn recommended the case to the PFEI.

“Having conducted a thorough and thoughtful analysis of the Department of Justice’s preliminary report, as well as the evidence collected accompanying that report and applicable law, we have determined to uphold the recommendation of the Secretary of Justice,”

the PFEI states in its resolution dated Wednesday, Jan. 18.

Pursuant to that determination, the PFEI appointed Manuel Núñez Corrada as FEI and Zulma Fúster Troche, in her capacity as deputy prosecutor, to conduct a thorough investigation into the alleged illegal conduct of municipal officials.

The resolution adds that the FEI and his deputy have a period of 90 days to carry out such an investigation.

America hit its debt limit, setting up bitter fiscal fight

The United States hit its debt limit Thursday, prompting the Treasury Department to begin using a series of accounting maneuvers to ensure the federal government can keep paying its bills before what’s expected to be a protracted fight over whether to increase the borrowing cap.

In a letter to Congress, Treasury Secretary Janet Yellen said the government would begin using what is known as extraordinary measures to prevent the nation from breaching its statutory debt limit and asked lawmakers to raise or suspend the cap so that the government can continue meeting its financial obligations.

“The period of time that extraordinary measures may last is subject to considerable uncertainty, including the challenges of forecasting the payments and receipts of the U.S. government months into the future,” Yellen said. “I respectfully urge Congress to act promptly to protect the full faith and credit of the United States.”

The milestone of reaching the $31.4 trillion debt cap is a product of decades of tax cuts and increased government spending by both Republicans and Democrats. But at a moment of heightened partisanship and divided government, it is also a warning of the entrenched battles that are set to dominate Washington, and that could end in economic shock.

Newly empowered House Republicans have vowed that they will not raise the borrowing limit again unless President Joe Biden agrees to steep cuts in federal spending. Biden has said he will not negotiate conditions for a debt-limit increase, arguing that lawmakers should lift the cap with no strings attached to cover spending that previous Congresses authorized.

Treasury officials estimate the measures that they began using Thursday will enable the government to keep paying federal workers, Medicare providers, investors who hold U.S. debt and other recipients of federal money at least until early June. But economists warn that the nation risks a financial crisis and other immediate economic pain if lawmakers do not raise the limit before the Treasury Department exhausts its ability to buy more time.

The episode has prompted fears in part because of the lessons both parties have taken from more than a decade of debt-limit fights. A bout of brinkmanship in 2011 between House Republicans and President Barack Obama nearly ended in the United States defaulting on its debt before Obama agreed to a set of caps on future spending increases in exchange for lifting the limit.

Most Democrats have solidified in their position that negotiations over the debt limit only enhance the risks of economic calamity by encouraging Republicans to use it as leverage. That is particularly true of Biden,

who successfully stared down Republicans and won an increase in 2021 with no stipulations.

Newly elected Republicans, emboldened by anger among their base and conservative advocacy groups over past failures to exact concessions for raising the limit, have pledged not to let that happen again.

In reality, both parties have approved policies that fueled the growth in government borrowing. Republicans repeatedly passed tax cuts when they controlled the White House over the past 20 years. Democrats have expanded spending programs that have often not been fully offset by tax increases. Both parties have voted for large economic aid packages to help people and businesses endure the 2008 financial crisis and the 2020 pandemic recession.

Federal spending declined from its pandemic high in 2022, reaching nearly $6 trillion in the fiscal year, or just under 24% of the economy. The federal budget deficit, which is the shortfall between what the United States spends and what it takes in through taxes and other revenue, topped $1 trillion for the year. That is a decline from the past two years as emergency pandemic spending expired, though the Biden administration predicts the deficit will rise again in the current fiscal year.

Many House Republicans call the current spending levels and the debt load a threat to economic growth. They have not yet released formal demands for raising the limit, but have pushed to tie it to large spending reductions and passage of a budget that balances over the course of a decade.

“The American people rightfully recognize that maintaining Washington’s status quo, which runs up massive deficits and adds trillions to our national debt, is unsustainable,” Rep. Jason Smith, R-Mo., chair of the House Ways and Means Committee, said in a statement. “President Biden should be spending this time working with House Republicans to address the debt ceiling in a

way that imposes some fiscal sanity. Otherwise, the president is simply scheduling America’s next debt crisis.”

Sen. Mitch McConnell of Kentucky, the Republican leader, struck a more conciliatory tone Thursday, predicting the limit would be raised in the first half of this year.

“In the end, I think the important thing to remember is that America must never default on its debt,” McConnell said in Kentucky. “It never has and it never will. But we will end up in some kind of negotiation with the administration over what are the circumstances or conditions under which the debt ceiling be raised.”

He added: “I would not be concerned with a financial crisis.”

White House officials say it is inappropriate to attach any conditions to raising the limit. They also say Republicans are not serious about reducing deficits, pointing to the first bill the new House took up this month. That legislation would cut new funding for the IRS to crack down on wealthy tax cheats, which the nonpartisan Congressional Budget Office estimated would generate $180 billion over 10 years. The bill to repeal that funding would add more than $100 billion in additional budget deficits over the next decade, according to the office’s estimates.

“They’re threatening to kill millions of jobs and 401(k) plans by trying to hold the debt limit hostage unless they can cut Social Security, cut Medicare, cut Medicaid,” Karine Jean-Pierre, the White House press secretary, told reporters Wednesday.

Congress still has a few months to find a way to raise the limit. The Treasury is expected to continue employing its extraordinary measures for as long as possible. But the economic toll could mount the closer the country comes to running out of cash, which could result in the United States being unable to pay its bondholders and defaulting on its debt. In 2011, as the standoff escalated, investors grew jittery, driving up borrowing costs for businesses and homebuyers.

On Thursday, Yellen began what is likely to be a monthslong process of using the extraordinary measures to delay a default. In her letter, she said she is initiating a “debt issuance suspension period” that will last through June 5 and that Treasury will no longer be fully investing the portion of the Civil Service Retirement and Disability Fund that is not immediately required to pay beneficiaries. Treasury investments in the Postal Service Retiree Health Benefits Fund are also being suspended.

Yellen will most likely have to take additional steps if the stalemate drags on. Determining the actual “Xdate,” when the United States will not be able to pay all its bills on time, is difficult because it depends on how fast tax receipts are coming in and the performance of the economy.

Right-wing Trump allies win seats on oversight, reflecting GOP priorities

They were deeply involved in Donald Trump’s efforts to overturn the 2020 presidential election results. They have come to the defense of people being prosecuted for participating in the deadly storming of the Capitol on Jan. 6, 2021. Some have called for violence against their political enemies online, embraced conspiracy theories or associated with white supremacists.

Several of the most extreme Republicans in Congress and those most closely allied with Trump have landed seats on the Oversight and Accountability Committee, the main investigative organ in the House. From that perch, they are poised to shape inquiries into the Biden administration and to serve as agents of Trump in litigating his grievances as he plots his reelection campaign.

Their appointments are the latest evidence that the new Republican majority is driven by a hard-right faction that has modeled itself in Trump’s image, shares his penchant for dealing in incendiary statements and misinformation, and is bent on using its newfound power to exact revenge on Democrats and President Joe Biden.

Many of the panel’s new Republican members — including Reps. Marjorie Taylor Greene of Georgia, Paul Gosar of Arizona, Lauren Boebert of Colorado and Scott Perry of Pennsylvania — are among Trump’s most devoted allies in Congress. Their appointments underscore that while the former president may be a shrunken presence in the current political landscape, he still exerts much control over the base of his party.

They are also an unmistakable signal from Speaker Kevin McCarthy, who won his post after an excruciating battle with hard-right rebels, that he plans to reward such lawmakers — even some who led the opposition to his election — with high-profile roles.

Both Greene and Gosar were removed from congressional committees by Democrats during the last Congress for internet posts that advocated violence against their political enemies. Both also have appeared with Nick Fuentes, the white supremacist and Holocaust denier.

Greene, who is pressing to impeach Biden and has demanded an investigation of the treatment of Jan. 6 defendants, had listed the Oversight panel as her first choice. She recently said that if she had led the Jan. 6 attack, “we would have won” and that people would have been “armed.” (She later said she was being sarcastic.) Gosar has referred to members of the mob that stormed the Capitol as “peaceful patriots.”

Joining them on the panel will be Perry, who was one of the key figures in Trump’s effort to subvert the election results, and Boebert, who has repeated Trump’s false claims that the election was stolen and came under fire for posting about Speaker Nancy Pelosi’s location on Twitter during the Capitol riot.

The Oversight Committee has long been populated by the most ideological and outspoken members of the House in both political parties, along with those who have less interest in legislating than in landing political blows that will grab the attention of the public and tarnish their opponents.

“We always treated it as a dumping ground for our less serious members,” said Brendan Buck, who served as a top adviser to the past two Republican speakers, Paul Ryan of Wisconsin and John Boehner of Ohio. “Republicans have long treated Oversight as the land of misfit toys.”

But with Democrats controlling the White House and Senate, leaving the GOP with little prospect of enacting its rightwing legislative agenda, House Republicans have made it clear that investigations will be their primary focus, giving members of the Oversight panel more relevance.

“There’s very little evidence that members on the far-right have moved on from Donald Trump,” said Buck. “This will be a forum for his grievances and going down ridiculous rabbit holes and entertaining conspiracy theories.”

But the implications go beyond the committee itself and reflect the state of the party, where moderate voices are few and being on the right side of Trump is still regarded as a necessity. In 2021, eight Republican senators and 139 Republican repre-

sentatives voted to sustain one or both objections to the election results that made Biden president.

“It’s a snapshot of where the Republican Party is,” said William Kristol, a prominent Never Trump conservative, referring to the makeup of the House Oversight Committee. “It’s wishful thinking to think there is a healthy Republican Party and this wacky Republican conference. They just got elected. Aren’t they the most representative thing of the party that exists?”

The White House has seized on the elevation of members who have mimicked Trump’s tactics as the latest example of the Republican Party’s lurch to the extremes.

“Republicans are handing the keys of oversight to the most extreme MAGA members of the Republican caucus who promote violent rhetoric and dangerous conspiracy theories,” Ian Sams, a White House spokesperson, said in a statement, referring to Perry, Greene, Boebert and Gosar. “They have defended and downplayed a violent insurrection against our democracy.”

Sams added, “House Republican leaders should explain why they are allowing these individuals to serve on this committee and reveal transparently once and for all what secret deals they made to the extreme MAGA members in order to elect a speaker.”

Other new members on the Oversight Committee who have attracted less attention include Rep. Russell Fry of South Carolina, who has campaigned with election conspiracy theorists including Mike Lindell, the CEO of MyPillow; and Rep. Anna Paulina Luna of Florida, who has denied the results of the 2020 election and has appeared on a television program that has pushed the QAnon conspiracy theory.

A spokesperson for Luna said the congresswoman “has done thousands of hours of media on the campaign trail and as a member of Congress and, being that she works full time, does not obsessively track TV programs.”

It is not yet clear how much latitude lawmakers devoted to Trump will have to use the panel to do his bidding. Some Republicans have signaled, for instance, that they do not want to relitigate the work of the Jan. 6 committee, as Trump has made it clear he desperately wants to do, fearing that focusing on the attack and the former president’s actions leading up to it will hurt the party politically.

Rep. James Comer, R-Ky., chair of the Oversight Committee, has said he plans to investigate Biden’s family and its business connections. He is not seen as an extremist in the conference.

But in his role as chair, he will have to balance and address the demands of committee members like Greene, who has already introduced five articles of impeachment against Biden. That includes one on the day he took office, when she accused him of abusing his power as vice president to benefit his son Hunter Biden’s business dealings in Ukraine.

Comer “may have claimed that he wanted the committee to be ‘credible,’ but the selection of these members shows this committee is nothing more than a bad joke,” said Brad Woodhouse, a senior adviser to the Congressional Integrity Project, a group dedicated to undermining Republican-led congressional investigations.

In a statement Wednesday evening, Comer called Republicans on his panel “an all-star lineup ready to hit the ground running and go to bat for the American people.”

Kamala Harris to speak in Florida on 50th anniversary of Roe v. Wade

Vice President Kamala Harris will travel to Florida on Sunday to deliver a speech commemorating the 50th anniversary of Roe v. Wade, the landmark Supreme Court ruling that established a constitutional right to abortion but was overturned last summer.

She will also criticize Republicans across the country who have tried to curtail access to abortion and some forms of contraception in the months since the ruling was overturned, according to officials within her office who outlined the speech on the condition of anonymity.

As the post-Roe landscape in America takes shape, with a patchwork of states working to restrict abortion access or ban it outright, the White House has few options beyond using the bully pulpit to spur support for reproductive rights from state to state.

Without the votes in the Senate to enshrine the protections offered by Roe into law, and with the president unable to grant those protections through executive action, administration officials hope Harris’ appearance in Florida will help sustain the sort of anger that became a driving force for voters during the midterm elections.

“The vice president will make very clear: The fight to secure women’s fundamental right to reproductive health care is far from over,” her press secretary, Kirsten Allen, said in a statement. “She will lay out the consequences of extremist attacks on reproductive freedom in states across our country and

For days, authorities said, a Michigan woman experiencing a mental health crisis walked the streets of a Detroit suburb with her three children, knocking on doors, asking for food and sleeping outside, underdressed, in below-freezing temperatures.

Sheriff’s deputies found the woman, Monica Cannady, 35, and two of her children, Malik Milton, 3, and Kyle Milton, 9, dead from hypothermia Sunday, authorities said. They were in a wooded field where they had been sleeping in their hometown, Pontiac, Michigan, a predominantly Black city of about 60,000 about 20 miles north of Detroit.

Cannady’s 10-year-old daughter survived and reported the deaths to a nearby resident, saying that her “family was dead in a field,” Sheriff Michael Bouchard of Oakland County said at a news conference Monday. He said the accidental deaths had been preventable and that they represented a larger, systemic failure.

“This tragedy is fundamentally evidentiary of the breakdown of our mental health system in America,” he said. “We don’t give our mental health providers and systems enough support.”

Details provided by law enforcement officials of the family’s final days paint a grim picture: Cannady was behaving erratically three weeks before her death, family members told authorities, but she refused to seek professional help. She left

She is also expected to highlight the executive action Biden signed last summer, with provisions that include defending patients’ right to travel across state lines to receive medical care and issuing guidance to retail pharmacies.

Harris’ trip to Florida, the country’s third most-populous state, is not a coincidence: Abortions after 15 weeks of pregnancy are banned there. Republicans, fresh from winning supermajorities in the Florida legislature, have discussed changing the timeline to 12 weeks. Earlier this month, after the Food and Drug Administration issued a regulation allowing the sale of abortion pills at retail pharmacies, Florida health officials warned pharmacists not to dispense the pills.

While Harris speaks in Florida on Sunday, Biden will issue a proclamation commemorating Roe, one of dozens he makes to mark events each year. Other administration officials are making trips to highlight the importance of abortion access. On Thursday, Xavier Becerra, the secretary of Health and Human Services, will travel to Minnesota, where officials are working to expand access to reproductive health care.

On Saturday evening, Cannady told the children to lie down in a field, where they froze to death hours later, Bouchard said. It was only after Cannady’s daughter walked to a nearby home and sought help that authorities were able to find the bodies of her mother and brothers in a field.

Melanie Rutherford, a City Council member whose district includes the neighborhood where Cannady and her children died, said that Cannady’s refusal to seek mental health assistance reflects an anxiety that can persist among some Black people.

“When you think about the mental health issues, especially in the African American community, oftentimes we’re scared to tell anyone. And oftentimes we’re mislabeled,” said Rutherford,

who is Black. “We have to come to the realization that mental health is real. Mental illness is real.”

Citing medical privacy laws, Dana Lasenby, CEO and executive director of the Oakland Community Health Network, which provides mental health services to Oakland County residents, said that she could not comment on whether her office was contacted by Cannady’s family members. She said that Cannady’s case had garnered significant attention in Pontiac, and that her organization was using it as an opportunity to discuss the availability of mental health resources in the area.

“We want to be solution focused. We want to add solutions and responses that will help,” she said. “We want to prevent this from ever happening again.”

Supreme Court poised to reconsider key tenets of online speech

For years, giant social networks like Facebook, Twitter and Instagram have operated under two crucial tenets.

The first is that the platforms have the power to decide what content to keep online and what to take down, free from government oversight. The second is that the websites cannot be held legally responsible for most of what their users post online, shielding the companies from lawsuits over libelous speech, extremist content and real-world harm linked to their platforms.

Now the Supreme Court is poised to reconsider those rules, potentially leading to the most significant reset of the doctrines governing online speech since U.S. officials and courts decided to apply few regulations to the web in the 1990s.

On Friday, the Supreme Court is expected to discuss whether to hear two cases that challenge laws in Texas and Florida barring online platforms from taking down certain political content. Next month, the court is scheduled to hear a case that questions Section 230, a 1996 statute that protects the platforms from liability for the content posted by their users.

The cases are part of a growing global battle over how to handle harmful speech online. In recent years, as Facebook and other sites attracted billions of users and became influential communications conduits, the power they wielded came under increasing scrutiny. Questions arose over how the social networks might have unduly affected elections, genocides, wars and political debates.

The Supreme Court case that challenges Section 230 of the Communications Decency Act is likely to have many ripple effects. While newspapers and magazines can be sued over what they publish, Section 230 shields online platforms from lawsuits over most content posted by their users. It also protects platforms from lawsuits when they take down posts.

For years, judges cited the law in dismissing claims against Facebook, Twitter and YouTube, ensuring that the companies did not take on new legal liability with each status update, post and viral video. Critics said the law was a Get Out of Jail Free card for the tech giants.

“If they don’t have any liability at the back end for any of the harms that are facilitated, they have basically a mandate to be as reckless as possible,” said Mary Anne Franks, a University of Miami law professor.

The Supreme Court previously declined to hear several cases challenging the statute. In 2020, the court turned down a lawsuit, by the families of individuals killed in terrorist attacks, that said Facebook was responsible for promoting extremist content. In 2019, the court declined to hear the case of a man who said his former boyfriend sent people to harass him using the dating app Grindr. The man sued the app, saying it had a flawed product.

But on Feb. 21, the court plans to hear the case of Gonzalez v. Google, which was brought by the family of an American killed in Paris during an attack by followers of the Islamic State. In its lawsuit, the family said Section 230 should not shield YouTube from the claim that the video site supported terrorism when its algorithms recommended Islamic State videos to users. The suit argues that recommendations can count as their own form of content produced by the platform, removing them from the protection of Section 230.

A day later, the court plans to consider a second case, Twitter v. Taamneh. It deals with a related question about when platforms are legally responsible for supporting terrorism under federal law.

Eric Schnapper, a University of Washington law professor who is one of the lawyers representing the plaintiffs in both cases, said in an interview that the arguments were narrow enough that they wouldn’t change wide swaths of the internet. “The whole system doesn’t break down,” he said.

But Halimah DeLaine Prado, Google’s general counsel, said in an interview that “any negative ruling in this case, narrow or otherwise, is going to fundamentally change how the internet works,” since it could result in the re-

moval of recommendation algorithms that are “integral” to the web.

Twitter did not respond to a request for comment.

Tech companies are also closely watching the Texas and Florida cases. Both states passed laws prohibiting social networks from taking down certain content after Twitter and Facebook barred then-President Donald Trump following the Jan. 6, 2021, riot at the U.S. Capitol. Texas’ law lets users sue if a large online platform removes their post because of the “viewpoint” it expresses. The Florida law fines platforms that permanently ban the accounts of a candidate for office in the state.

NetChoice and CCIA, groups funded by Facebook, Google, Twitter and other tech companies, sued to block the laws in 2021. The groups argued that the companies had a constitutional right to decide what content to host.

“It’s a roundabout way of punishing businesses for exercising First Amendment rights that others disagree with,” said Chris Marchese, a counsel at NetChoice.

In Florida, a federal judge agreed with the industry groups, ruling that the law impinged on the platforms’ First Amendment rights, and the 11th U.S. Circuit Court of Appeals upheld most of that decision. But the 5th U.S. Circuit Court of Appeals upheld Texas’ law, rejecting “the idea that corporations have a freewheeling First Amendment right to censor what people say.”

That puts the Supreme Court under pressure to step in. When federal courts offer different answers to the same question, the Supreme Court often chooses to settle the dispute, said Jeff Kosseff, an associate professor of cybersecurity law at the U.S. Naval Academy.

World stocks fell on Thursday as global recession worries mounted with U.S. Federal Reserve officials maintaining a hawkish stance, while the dollar declined against the Japanese yen.

Boston Fed President Susan Collins said the Fed will probably need to raise interest rates to “just above” 5% and hold them there for a period.

She was the latest in a string of Fed officials to suggest the U.S. central bank needs to remain hawkish to successfully bring down inflation.

Earlier, European Central Bank president Christine Lagarde pushed up euro zone bond yields slightly by telling the World Economic Forum’s Davos gathering that the bank would stay the course with rate hikes.

Also, Thursday’s data showed that overall U.S. housing starts declined 1.4% to a rate of 1.382 million units last month. Building permits dropped as well, down 1.6% o a rate of 1.330 million units.

Edward Moya, senior market analyst, at OANDA in New York said, “the housing market is in recession and you’re going to get these regional Fed surveys that are weak and are going to show that business activity is struggling.”

Benchmark 10-year U.S. Treasury yields bounced off four-month lows. Benchmark 10-year yields were last at 3.386%, after earlier dropping to 3.321%, the lowest since Sept. 13. The yields have fallen from 3.905% at yearend, and from a 15-year high of 4.338% on Oct. 21.

U.S. bond yields had fallen as investors worried that the U.S. central bank will not be able to raise rates as high and for as long as it has indicated if the economy soon enters a downturn.

The Dow Jones Industrial Average fell 208.05 points, or 0.62%, to 33,088.91, the S&P 500 lost 29.64 points, or 0.75%, to 3,899.22 and the Nasdaq Composite dropped 101.46 points, or 0.93%, to 10,855.55.

Microsoft’s announcement of 10,000 layoffs also was being digested, along with more earnings reports on the most recent quarter. Procter & Gamble raised its full-year sales forecast and said it plans to continue raising prices.

The pan-European STOXX 600 index lost 1.34% and MSCI’s gauge of stocks across the globe shed 0.90%.

Investors were also paying attention to comments from U.S. Treasury Secretary Janet Yellen, who reported using extraordinary cash management measures to keep borrowing under the federal debt limit.

In the currency markets, the dollar was down 0.4% against the Japanese yen. Investors were unwinding some trades from the previous day when the Bank of Japan (BOJ) surprised markets by sticking with ultra-low interest rates.

Over 1 million protest Macron’s pension plan in the streets of France

More than 1 million protesters, chanting slogans like “retirement before arthritis,” took to the streets throughout France to protest President Emmanuel Macron’s plan to raise the legal age of retirement to 64 from 62.

Striking workers, from Calais in the north to Marseille in the south, closed schools, stopped many trains, disrupted the Paris Metro, lowered electricity output and curtailed flights, as France once again roused itself to resist tampering with its protective social model.

Macron, who is in the first year of his second and last term, wants to push through an overhaul of what he views as an untenable pension system. He sees this as a core part of his legacy. But in a country where work is viewed by many as a burden rather than an opportunity, and retirement as the panacea beyond it, his determination has ignited fierce resistance.

Labor unions, from the extreme left to the moderate center, united behind the protests, as did often splintered left-ofcenter political parties. Marine Le Pen, the leader of the extreme-right National Rally party that has attracted growing support among the working class, also called for “an unjust reform” to be blocked.

In Paris, where the strikers’ march stretched over 2 1/2 miles, Corinne Arramy, a hospital worker, wore a sticker saying “We live longer and that’s for the best, not a reason to die at work.” Arramy, 56, said, “This is the start of something big,” a

fight to preserve a hard-earned right.

Teachers, railway workers and employees at public radio stations joined more than 1 million protesters at more than 200 demonstrations across the country, according to the Interior Ministry. The CGT labor union put the number at over 2 million. On Thursday evening, the labor unions welcomed the day’s “powerful mobilization” and called for a new day of strikes and protests on Jan. 31.

Chants of “Metro, Work, Tomb” rose from the crowds in derisory dismissal of what is widely portrayed as a government attempt to squeeze the last of pleasure from life in a hypercompetitive world.

A long confrontation, involving further strikes, seems inevitable. For the French left, which has failed to reach even the runoff round of the last two presidential elections, defeating pension changes amounts to a critical test of its heft and ultimately of its eventual capacity to return to power.

For Macron, a centrist who tried and failed with a different pension overhaul in 2019 that also provoked massive protests, it is the crux of his attempt to give direction to a second term that has up to now seemed a time of drift. He has vowed, since his election campaign last year, to see the changes through.

The government believes the only way to balance the pension system is to make the French work longer. Workers and employers pay mandatory payroll taxes that are used to fund state pensions, but the ratio of workers to retirees has dropped sharply as life expectancy has increased. In 2000, there were 2.1 workers paying into the system for every one retiree, a number that fell to 1.7 in 2020.

“If you want the pact between generations to be just, this reform is essential, and so we will do it with respect, a spirit of dialogue, but also determination and responsibility,” Macron said during a visit on Thursday to Barcelona, Spain.

However, the government’s arithmetic is fiercely contested by labor leaders who argue that taxing the country’s millionaires

and their dividends would be a more effective way to fund the current pension system. “Pensions are something sacred in France,” said Matthieu Jilard, 26, a student who joined the Paris protest.

Rising inflation has contributed to a restive mood in France, but at a deeper level the overhaul attempt reveals ingrained attitudes toward work, equated with drudgery, and retirement, equated with the freedom at last to enjoy life.

A recent survey by the IFOP polling and marketing company found that only 24% of French people considered work “very important,” compared with 60% in 1990. The feeling of being unrecognized or taken for granted in the workplace appears widespread.

France is something of an outlier on pensions among European countries, many of which have already pushed back retirement for the very reasons Macron has outlined. In Germany, the legal age of retirement is 65 and is being gradually increased to 67. Spain is also working toward retirement at 67.

But some countries allow workers to retire before the legal age, provided they have paid into the system long enough. Italy, for instance, has also set 67 as the legal age of retirement, but many leave their jobs earlier.

Still, in France workers generally leave the labor market two to three years earlier than in other major European economies, according to an official advisory body called the Pensions Advisory Council.

The overhaul would raise the legal age of retirement in annual three-month increments, starting this fall, to reach 64 by 2030, three years after Macron, who is subject to term limits, leaves office. Parliament will begin discussing the bill next month, and Macron hopes it will become law by the summer.

That target, however, appears ambitious.

“If there is no positive response from the government, today is a first step, and there will be a second step,” Philippe Martinez, the head of the CGT, told reporters before the march in Paris.

New Zealand prime minister surprises with plan to step down

Jacinda Ardern, who became a global liberal icon as New Zealand’s prime minister but faced deepening political challenges with an election looming at home, said in a surprise announcement Thursday that she would step down as the country’s leader.

In a tearful speech in the New Zealand city of Napier, where Ardern’s Labour Party was hosting its summer caucus retreat, she said she did not feel personally prepared to complete another term. She will leave office by Feb. 7, she said.

“I believe that leading a country is the most privileged job anyone could ever have, but also one of the more challenging,” Ardern said. “You cannot and should not do it unless you have a full tank plus a bit in reserve for those unexpected challenges.”

She added: “This has been the most fulfilling 5 1/2 years of my life. I am leaving because with such a privileged job comes a big responsibility.”

Labour lawmakers will elect a new leader of the party — and the country — in three days’ time, Ardern said.

Ardern, 42, became prime minister in 2017 and won a historic reelection in 2020, largely on the strength of New Zealand’s response to COVID-19, which allowed residents to live a mostly normal life for much of the pandemic. But her party has since fallen sharply in the polls amid economic troubles and some highly publicized instances of violent crime.

Soon after her unexpected rise to power, as New Zealand’s youngest prime minister in 150 years, Ardern became something of an international celebrity. She had a daughter while in office and brought her to the floor of the United Nations. To admirers, she became the sunny face of progressivism, and a welcome alternative to the politics represented by then-President Donald Trump in the United States.

But it was her response in 2019 to the massacre of 51 people at two mosques in Christchurch, by a gunman espousing anti-Muslim, anti-immigrant hatred, that solidified her image as a hero of the global left.

“We represent diversity, kindness, compassion. A home for those who share our values. Refuge for those

who need it,” she said at the time of New Zealand. Within a week, Ardern had imposed temporary restrictions on the purchase of guns, followed by the passing of a law a few weeks later that banned most semi-automatic weapons.

Ardern said she had informed party members earlier Thursday of her decision to resign. She said would remain a member of Parliament for her electorate in the city of Auckland until April, in order to avoid the need for a byelection.

Labour has been facing major political challenges ahead of the Oct. 14 election. For almost a year, the party has polled behind the center-right National Party, led by Christopher Luxon, a former aviation executive. As of December, support for Labour was at 33%, compared with 38% for the National Party.

Still, Ardern has remained personally popular with the electorate. She has regularly outperformed Luxon in polls as most New Zealanders’ “preferred prime minister.”

Luxon said last month that the polls showed New Zea-

landers felt the country was going in the “wrong direction.” He added: “What they can see is a government that’s just not getting things done.”

Voters are principally concerned about the many economic issues the country faces. Home prices in New Zealand, which surged over the past decade, fell 12% in 2022. Borrowers, most of whom are able to fix their mortgage rate for only a few years at a time, are at high risk of negative equity, as they balance a high cost of living and surging inflation with the twin challenges of falling home prices and rising interest rates.

A perceived rise in violent crime, including high-profile incidents in which employees of corner stores have been attacked and in one case killed, has also contributed to a sense of dissatisfaction.

Ben Thomas, a political commentator and former press secretary for the National Party, said Ardern’s resignation would come as a surprise for many New Zealanders and could spell disaster for Labour.

“She’s Labour’s number one political asset,” he said. “It would very much be a personal decision to step down, as opposed to a considered strategy about what would be best for Labour in the election.”

In her remarks, Ardern addressed her partner — television presenter Clarke Gayford — and their 5-year-old daughter Neve. They were, she said, “the ones that have sacrificed the most out of all of us.”

“To Neve: Mum is looking forward to being there when you start school this year,” she said. “And to Clarke — let’s finally get married.”

In resigning almost a year before a general election, Ardern follows closely in the footsteps of a recent predecessor, John Key, who stepped down in 2016, allowing his deputy, Bill English, to take his place as leader of the National Party and prime minister.

But there is no obvious successor to Ardern. Grant Robertson, Labour’s deputy leader, will not seek the leadership, Ardern said. Any candidate seeking to lead Labour must have the support of at least two-thirds of its lawmakers — a requirement that raises the prospect of a power vacuum, prolonged infighting and a relative newcomer, at least in voters’ eyes, leading the party and the country.

Jacinda Ardern, who has been the leader of New Zealand for the past five years, said she would step down by Feb. 7.

New York City was the site of one of the deadliest riots in United States history 160 years ago this year.

It was the Draft Riots of 1863, in the middle of the Civil War. New York then was hardly the monolithic liberal bastion it has since become. Its economy benefited significantly from the slave economy and the cotton it produced. And, although the state’s abolition of slavery became effective in 1827, during the following decades, as historian Sylviane A. Diouf has noted, the city came to dominate the illegal slave trade to the American South, Brazil and Cuba.

Indeed, the mayor at the time, Fernando Wood, was a pro-Southern, pro-slavery Democrat, who proposed that the city secede from the Union in 1861 after South Carolina became the first state to do so the year before.

Conservative, antiwar Democrats, known as Copperheads, were enraged by the onset of the Civil War, and they were vocal opponents of Abraham Lincoln’s war policies. They saw abolitionists as agitators and their call to end slavery as an affront to states’ rights. Many Copperheads thought the secession was constitutional and the war misguided because, as historian Jennifer L. Weber explains in The Journal of the Abraham Lincoln Association, “the Constitution (they rightly pointed out) says nothing about the terms of membership in the Union.”

So the Copperheads and their presses began relentless racist campaigns that inflamed the passions of poor and working-class whites. They offered a kind of “great replacement” theory of its time, claiming that once freed, Black throngs would invade New York City and create competition for whites’ jobs and threaten their way of life.

When Lincoln issued his preliminary Emancipation Proclamation in 1862, it served to cement the replacement paranoia. The editor of a Copperhead newspaper on Long Island wrote at the time that “in the name of freedom for Negroes” the proclamation “imperils the liberty of white men.”

Then, when the Enrollment Act of 1863 passed, establishing the first national draft, tensions boiled over into a bloody five-day riot. More than 100 people died, although some believe there may have been an undercount

of hundreds. The riots were anti-government because the government was forcing people to participate in a war to which they were vehemently opposed. They were anti-Black because racist phobias had been drummed into them. And they were anti-elite because another point of tension was that wealthy people could buy exemption from conscription by paying a $300 fee, an amount far out of reach of most working-class men.

Working-class white people had been radicalized by white supremacy, racial tribalism, the fear of new arrivals and anti-government fervor.

A lot has changed since 1863, but devices of division and provocation remain, a means of dividing the white from the nonwhite working class by stoking a combination of grievance against outsiders and against the government and wealthy elites seen to be favoring their interests over those of “ordinary” (i.e., white) citizens.

For much of American history, the holy grail of liberal politics and activism has been to find a way past such divisions, a way to make poor and working-class people of all races see that their fates and interests are linked.

But race, then as now, remains a powerful tool for driving a wedge in the working class. This is not to say that a coalition can’t be built, or has never been built. In the New Deal realignment of the 1930s, Democrats built a coalition that supported the working class, to at least some extent, regardless of race. It wasn’t perfect, of course, because it still accommodated racist Democrats in the South, but it was a coalition.

That coalition began to fall apart in the 1960s with the successes of the civil rights movement. Since that time, Black leaders have been struggling to reshape the coalition, from Martin Luther King Jr.’s Poor People’s Campaign of the late 1960s, to Jesse Jackson’s National Rainbow Coalition, founded in the 1980s, to the Rev. William Barber’s focus on “fusion coalitions” that came out of his Moral Mondays campaign started in 2013 to protest North Carolina’s hardright legislative turn.

Liberal politicians have developed another method at coalition-building, one that sometimes works: a cultural bilingualism that tries to speak to the white working class and educated liberals separately, on their own terms and in their own languages.

But as the forces of intellectualism and what we’ve come to call “diversity” exert increasing power in the Democratic Party, non-college-educated white voters have fled. As Nate Cohn pointed out in this paper in 2021, after Joe Biden’s victory: “When the Harvard-educated John F. Kennedy narrowly won the presidency in 1960, he won white voters without a degree but lost white college graduates by a 2-to1 margin. The numbers were almost exactly reversed for Biden, who lost white voters without a degree by a 2-to-1 margin while winning white college graduates.”

Similarly, according to a Politico analysis, in 2020 Donald Trump won an astonishing 96% of those districts in which 70% or more of people were white and fewer than 30% were college-educated.

This partisan bifurcation of the white vote is being called the “diploma divide,” but it’s more than that. It also frequently represents a basic knowledge gap, which encourages a hostility to truth, which softens the ground for conspiracy peddling, hate-mongering, extremist radicalization and episodes of terrorism.

Again, 1863 is in the distant past. But themes from that era are percolating at the edges — and sometimes not only the edges — of conservative discourse: The growing expression and occasional endorsement of “great replacement” theory. The calls, still marginal yet increasing, for secession or civil war. The fear of the Other, whether in the form of a liberated slave or a southern border crosser. The routine debasement and growing mistrust of government, and in particular its efforts to improve racial equality.

There aren’t anti-Black race riots brewing in New York City. But a familiar, vintage anger and unease is growing, and it’s deeply worrisome.

Desestiman demanda de CODEPOLA contra Municipio de San Juan por prohibir armas en transporte colectivo hacia la SanSe

S AN JUAN – El juez Anthony Cuevas Ramos desestimó el jueves, una demanda que presentó la Corporación para la Defensa del Poseedor de Licencia de Armas de Puerto Rico, Inc. (CODEPOLA) y Ariel Torres Meléndez contra el Municipio de San Juan, por ordenar que no se admiten armas en la guaguas contratadas para el transporte colectivo en las Fiestas de la Calle San Sebastián (SanSe).

“En vista de lo anteriormente expuesto, se declara Ha Lugar la moción de desestimación presentada por el Municipio de San Juan. En su consecuencia se dicta Sentencia desestimando la demanda presentada”, reza la sentencia de 14 páginas.

El alcalde del Municipio de San Juan, Miguel Romero, ordenó que no se permita a cualquier persona que esté portando un arma de fuego, abordar las guaguas contratadas por el Municipio para el transporte a la actividad de las Fiestas de las Calles de San Sebastián. A pesar de esto, surgió de la vista celebrada que no existe controversia sobre la disponibilidad de otros métodos de transporte hacia el Viejo San Juan en las cuales no se prohíbe la portación de armas legal. Por ejemplo, se podría acudir en su propio carro y estacionar las áreas limítrofes, se puede acudir mediante taxi privado o el servicio a través de la aplicación Uber, etc. O sea, la prohibición de la portación de las armas de fuego no es en el lugar de la actividad, como lo establece incorrectamente la parte Demandante. No se hará un registro de toda persona que desee asistir a la actividad.

SAN JUAN – El presidente de la Asociación de Maestros de Puerto Rico, Víctor Manuel Bonilla Sánchez, anunció el jueves que la organización que representa a los maestros del sistema público de enseñanza participará en la edición 53 de las Fiestas de la Calle San Sebastián.

Bajo su propio lema Brillemos juntos hacia una educación pública de excelencia, se explicó que la AMPR formó parte de varias ediciones del tradicional evento y en esta ocasión se hace meritorio defender la cultura y las tradiciones.

“Para nosotros es importante defender y apoyar eventos como este que no solo resaltan nuestra cultura, sino en los que se exponen los trabajos de todos nuestros artistas. Con nuestra participación promovemos la educación y el rol importante de las artes”, indicó Bonilla Sánchez en comunicación escrita.

Los Demandantes reclamaron que se les está violentando su derecho a portar armas según establecido por la Segunda Enmienda de los Estados Unidos. Estos solo sustentan su reclamo basado en un caso que resolvió el Tribunal de Primera Instancia, American Civil Liberties Union, et al v. Municipio de San Juan, et al, Caso Civil Núm. K PE2014-0042. En el caso citado, la anterior alcaldesa de San Juan determinó establecer unos puntos de cotejo y control de acceso en los cuales oficiales de la policía registrarían a toda persona que interesara participar de las actividades de las Fiestas de la Calle San Sebastián, incluyendo a personas que deseaban acudir al Viejo San Juan sin, necesariamente, acudir al evento. El Tribunal de Primera Instancia determinó que la actuación del Municipio era inconstitucional. Al hacer su análisis, expresó que “se trata de cerrar la Capital del País por 4 días y obligar a todo ciudadano que desee entrar por cualquier razón, someterse a un registro irrazonable, con propósitos generales de hacer cumplir la ley”. American Civil Liberties Union, et al v. Municipio

de San Juan, et al, Caso Civil Núm. K PE2014-0042, página 19. En adición, el Tribunal entendió que existían alternativas menos onerosas y lesivas.

“A diferencia del caso discutido, en este caso no existe una prohibición del uso de vías públicas ni se está haciendo un registro a todas las personas que desean entrar al casco del Viejo San Juan, aun cuando estas no interesen acudir al evento. El Municipio ha dispuesto, como requisito para el uso de uno de los muchos métodos de transportación para llegar al evento, el requerimiento de que no se lleven armas de fuego. En este caso tampoco se ha expresado que existen medidas menos onerosas y lesivas, excepto por las contenciones de los Demandantes de que lo que se está haciendo no ayuda a la protección de la población en el evento. Finalmente, debemos mencionar que la sentencia del TPI no es vinculante”, agregó el juez.

“Nos parece importante aclarar que la presente prohibición no se trata de un discrimen específico contra las personas que tienen licencia de armas, sino que la prohibición les aplica a todas las personas, tengan o no licencia de portación de armas. También reiteramos que no se trata de una prohibición de que las personas no transiten por las vías públicas del Viejo San Juan o se estacionen en los puntos de estacionamiento del Municipio, sino que solo, para efectos de las guaguas contratadas por el Municipio, no se podrá tener arma de fuego. Esto no afecta a que cualquier persona que tenga una licencia de portar armas y decida acudir con su arma lo haga y disfrute de la actividad al igual que el resto de los ciudadano”, concluyó.

Bonilla Sánchez destacó que la AMPR tiene un compromiso con las Bellas Artes en las escuelas porque “muchos de esos estudiantes hoy día son excelentes músicos, pintores, escultores y artistas que han puesto el nombre de Puerto Rico en alto. Necesitamos darle visibilidad a las Bellas Artes en los planteles públicos y apoyar a los estudiantes a que se desarrollen en esa área”.

“Exhortamos a todos los maestros, padres y estudiantes a que nos acompañen el domingo, 22 de enero desde las 9:00 de la mañana en la Plaza Colón del Viejo San Juan para que a través de nuestra participación continuemos promoviendo la importancia de las Bellas Artes y de nuestra cultura”.

El personal de la AMPR y todas sus instituciones estarán acompañados de la banda escolar de la Segunda Unidad Macaná del municipio de Guayanilla, además de otras comparsas, pleneros, vejigantes de Juana Díaz y Morovis, así como delegaciones de otros pueblos de la Isla.

Jeff Beck’s 10 essential songs

Songs could barely contain Jeff Beck’s guitar. It jabbed at tunes with brute-force riffs. It sparred with singers for the spotlight. It clawed at the limits of verses and choruses, screaming melodies of its own, making notes slide and wriggle; sometimes it scraped out funky, contentious rhythm chords.

Yet in quieter moments, Beck’s guitar could also be startlingly tender, cherishing a melody or proffering teasing, insinuating undercurrents. Beck, who died Jan. 10 at 78, was also a master of electric guitar tones, of amplification and distortion. He could make his Stratocaster sound icy, searing, slashing and otherworldly in the course of a single track.

With a career that began during the British Invasion, Beck at first tucked his guitar work into songs aimed for pop radio. But by the end of the 1960s, he was leading his own groups, backing his lead singers with roiling, slamming arrangements that made them shout to keep up; he was blasting his way toward metal. Beck’s instrumentals moved to the forefront in the 1970s as his material shifted toward jazz-rock. But he never left behind the blues and rockabilly that had inspired him from the start.

Here, in chronological order, are 10 tracks that reveal Beck’s range and intensity.

The Yardbirds, ‘Over Under Sideways Down’ (1966)

The pushy, up-and-down, Eastern-tinged guitar line that opens the song, and the squirming guitar riff behind the chorus, turn this track from jaunty British Invasion pop into something far more urgent. Beck’s lead guitar takes over for the entire last minute, melding rockabilly and something like raga, leaving the rest of the band to whoop along.

Jeff Beck, ‘Shapes of Things’ (1968)

Beck’s supercharged remake of a Yardbirds song has Rod Stewart on vocals and a churning, whipsawing arrangement that rivals anything from contemporaries like the Who. The song gallops from the get-go as Beck answers his own power chords with countermelodies high and low. The bridge rockets into double time, and after the final ver-

Donovan with the Jeff Beck Group, ‘Barabajagal’ (1969)

Beck the bandleader, abetted by wailing backup singers including Suzi Quatro, catalyzed this rowdy song by Donovan, the normally soft-spoken flower-child troubadour. Beck’s electric guitar opens with twangy rockabilly syncopation, sets up the choppy piano groove and pointedly spurs things along. He really starts to wail toward the song’s free-for-all finish.

Stevie Wonder, ‘Lookin’ for Another Pure Love’ (1972)

Beck and Stevie Wonder shared songs and appeared on each others’ albums in the 1970s, and “Lookin’ for Another Pure Love” from Wonder’s “Talking Book” featured the guitarist at his most sweetly melodic in the song’s bridge. His solo eases up to a high note and then casually trickles down, continuing through the track to garland Wonder’s vocals with little slides and curlicues, reveling in the song’s sophisticated chord progression.

Jeff Beck, ‘Cause We’ve Ended as Lovers’ (1975)

Beck’s best-known ballad is an instrumental version of a Wonder song. He plays it with long-lined phrases and constantly changing nuances of tone: as a dialogue, as a keening lament, as bitter self-accusations, as an anguished plea, as a fragile chance at hope. From start to finish, it sings.

Jeff Beck, ‘Freeway Jam’ (1975)

Written by Max Middleton, then the keyboardist in Beck’s band, “Freeway Jam” is a brisk shuffle that materializes and fades out as if it’s excerpted from a jam session, though parts are clearly mapped out. It gives Beck room to peal some clarion melodies and then attack them with trills, bent notes, blues licks and dissonances. A live version featuring keyboardist Jan Hammer, released in 1977, makes the tune even more gleefully frenetic.

Jeff Beck and Rod Stewart, ‘People Get Ready’ (1985)

Rod Stewart rejoined Beck for a remake of the Curtis Mayfield gospel-soul standard, “People Get Ready,” that starts out restrained but grows fervid. Beck offers a sta-

tely, fanfarelike guitar hook after the first verse, then engages Stewart more and more: taking over the melody with note-bending variations, surging up from below, goading Stewart to shout and leap into falsetto. Despite its dated 1980s production, the song finds the spirit.

Jeff Beck, ‘THX 138’ (1999)

Could a player as physical as Beck handle the mechanical drive of electronica? Of course. A tireless programmed drumbeat drives “THX 138,” but Beck rides it in multiple ways: with an Eastern-tinged modal loop, with sustained power chords, with high blues lines, with ferocious stereo call-and-response chords, with a melody that leaps skyward. For all the gadgetry, human hands dominate this mix.

Jeff Beck with Jimmy Page, ‘Beck’s Bolero’ (2009)

Before he formed Led Zeppelin, Jimmy Page was Beck’s co-lead guitarist and then his successor in the Yardbirds. In 1966, they collaborated to record “Beck’s Bolero,” written by Page, for Beck’s first solo single. This gracious latter-day reunion for the Rock & Roll Hall of Fame is noisy, flashy, virtuosic and over the top in exactly the right proportions.

Jeff Beck, ‘Over the Rainbow’ (2010)

For all his speed and dexterity, Beck never underestimated the beauty of a sustained melody. He played this Hollywood standard backed by chords from a string orchestra, sliding through the tune, holding back some notes and using tremolo on others, making every turn of the familiar song sound like a precious discovery.

NFL playoff predictions: Our picks in the divisional round

No. 6 New York Giants at No. 1 Philadelphia Eagles

ous pass rushers: They are the NFL sack leaders (70), led by Haason Reddick’s 16 and three other players with doubledigit totals.

Afootball game is really contested among four teams: two offenses and two defenses. In recent seasons, though, explosive offenses have dominated much of the coverage. Each playoff team’s chances are usually discussed in terms of offensive output, while defenses need to be as dominant as the San Francisco 49ers’ to define a team’s identity.

The Buffalo Bills and Cincinnati Bengals are capable of scoring outbursts and came away with wild-card wins last week as big favorites. But both teams failed to cover the spread after struggling to contain opponents that started backup quarterbacks.

The remaining playoff teams are as evenly matched as they have been all year, and that’s especially true of the offenses. Of the eight teams left in the postseason, seven finished the regular season in the top 10 for offensive efficiency, while only five have top-10 defenses. Those stronger defenses should provide the edge in this weekend’s divisional round matchups.

SATURDAY’S GAMES

No. 4 Jacksonville Jaguars at No. 1 Kansas City

Line: Kansas City -9 | Total: 52.5 The Jaguars have played their best when they’ve been expected to do the

least. After starting with a 3-7 record that left Jacksonville way outside the playoff picture, the team won six of its final seven regular-season games to force its way in. In the wild-card round against the Los Angeles Chargers, Trevor Lawrence threw four picks in the first half, seemingly burying the Jags with a 27-0 deficit. But the Jaguars rallied for one of the biggest comebacks in playoff history.

By that logic, the underdog Jaguars could put on another show in a game they’re not expected to win — playing top-seeded Kansas City, who had the NFL’s best regular-season offense. Because Kansas City has been so good, the team has laid big numbers in game after game and won a lot of games it failed to cover. In its last nine home games, it is 1-7-1 against the spread. That could be because the market is giving Kansas City too many points for home-field advantage. It also could be a consequence of a defense that likes to get aggressive when playing with a comfortable lead.

Kansas City’s defense — which ranks 20th in passing defense, per Football Outsiders’ Defense-Adjusted Value Over Average (DVOA) metric — takes more chances with its pass rush when ahead. It’s a high-risk, high-reward scenario that can often end games with a quarterback sack or give up big plays late. Time running down, playing from behind, that’s when Lawrence and company have shined.

All season, the Giants thrived on climbing back into games they trailed, with four fourth-quarter comebacks in the regular season. But Daniel Jones may have given the best performance (301 passing yards and 78 rushing yards) of the wild-card weekend, when the Giants scored four touchdowns and played from ahead most of the way in an upset of the Vikings. The lead owed as much to the team getting back defensive starters from injury and their limiting the Vikings’ big plays.

The defense will have to re-up on that effort against the Eagles and Jalen Hurts, who enter the game rested thanks to last week’s bye. The Eagles beat the Giants in both of their regular-season meetings, but those games are probably not terribly predictive: The Giants had significant offensive-line injuries in the first meeting (Philadelphia won, 48-22), and they rested their starters in a 22-16 loss in Week 18.

Despite Jones’ dual-threat abilities and the reemergence of running back Saquon Barkley in contract seasons for both, the Giants feasted on a loser’s schedule this season. Against top-10 defenses, the team went 2-4-1. Those games were all within reach: All but one were decided by 8 points or fewer.

The Bills should be playing on emotion in this rematch of the Week 17 game that was canceled after Damar Hamlin went into cardiac arrest during the contest. Hamlin reportedly will be in attendance on the Bills’ sideline for the first time, and that could give a major morale boost. But the Bills have struggled with turnovers, particularly when quarterback Josh Allen’s opportunistic throws ignore easy, clock-controlling short pickups.

The Bengals have locked up opponents late thanks largely to defensive adjustments made in-game by coordinator Lou Anarumo that limit big plays long enough for the Bengals’ offense to do damage (and in some cases, defensive linemen have forced turnovers that led to touchdowns).

Cincinnati may need the help putting up points. The offensive line’s injury woes continued last week when Jonah Williams went down with a knee injury in the wild-card win over the Baltimore Ravens. Williams and Alex Cappa, another starter on the line who injured his ankle in Week 18, did not practice Wednesday. Joe Burrow has adapted to the pressure: He’s been getting the ball out in an average of 2.49 seconds, the second fastest in the league behind Tom Brady.

Buffalo’s defense hasn’t been as strong in the last half of the season, especially since losing Von Miller to a knee injury in November, and they’ve been forced to blitz more than they probably want to. Miami exploited Buffalo’s secondary, with the receiver combo of Jaylen Waddle and Tyreek Hill getting 113 yards on 10 catches. If Skylar Thompson can do that, imagine what Burrow can do with Tyler Boyd, Tee Higgins and Ja’Marr Chase spreading the field.

No. 5 Dallas Cowboys at No. 2 San Francisco 49ers 6:30 p.m., Fox

The Dallas Cowboys notched their first road playoff win in 30 years last week to set up this throwback to the rivalry games of the 1990s. There have been some stylistic updates for both franchises, though.

Brock Purdy is not Steve Young, and he hasn’t had to be. The 49ers have won 11 straight, with the rookie backup Purdy under center for seven of those games. His bevy of options, from tight end George Kittle to running back Christian McCaffrey to Deebo Samuel, are fast and hard to tackle, and they rack up yards after the catch.

This won’t be an offensive bonanza for either side, though, after both teams absolutely wrecked their opponents in the wild-card round. The market has made San Francisco a 3.5-point favorite, the narrowest spread of the weekend, and

the total of 46 points is its lowest. The 49ers’ Nick Bosa and Cowboys’ Micah Parsons are the two leading contenders for the defensive player of the year, so these quarterbacks should be pressured more than they have been all season.

Dak Prescott is the better of the two quarterbacks, but he’ll need his running backs, Tony Pollard and Ezekiel Elliott, to help keep the 49ers’ defense honest. San Francisco is better at defending the pass than the rush, and went 2-4 in games in which they allowed 99 or more yards on the ground. Assuming the 49ers are able to neutralize receiver CeeDee Lamb as well as other teams have recently, the Cowboys may need to rely on Dalton Schultz, and for Prescott to avoid a disaster turnover. It’s a lot that needs to go right, but that’s why Dallas is getting the points.

Gauff and Raducanu deliver at the Australian Open, but only one advances

Coco Gauff versus Emma Raducanu sounded like quite a tennis match for a new age. The Australian Open organizers clearly agreed and gave the youngsters top billing: 7 p.m. in Melbourne’s Rod Laver Arena to open the night session Wednesday.

“I’m glad we got the prime spot,” Gauff said. “I hope we delivered.”

After a shaky, error-strewn start, their first career meeting had its moments. Above all, it had some extended, tightto-the-baseline rallies with Raducanu throwing her body into her shots and Gauff using her speed and anticipation to chase down balls that few others could have reached.

It was high-velocity entertainment, punch against counterpunch, Raducanu’s fluidity and full-cut returns versus Gauff’s more explosive movement and powerful serve.

That Gauff prevailed, 6-3, 7-6 (4), was no big surprise, even if she had to save two set points in the second set. She, for now, is the more accomplished and consistent player. She is the one in the top 10, the one with multiple tour titles in singles and doubles, the one who has been competing regularly on the circuit since 2019.

And yet Raducanu, despite being ranked just No. 77 at the moment, has already acquired what Gauff is chasing: a Grand Slam title. At the 2021 U.S. Open, Raducanu became the first singles qualifier to win a major in what felt more like a fairy tale than a sporting event.

She did not lose a set in 10 matches in New York, becoming a global star at age 18. Gauff, who beat Venus Williams at age 15 on her way to reaching the fourth round at Wimbledon in 2019, can relate, but only to a degree.

“I feel like she experienced it on a much bigger level than I did,” Gauff said of becoming a public figure. “But coming on tour young, it’s a different life from juniors, playing in small events, to all of a sudden people knowing your name, people expecting you to win all the time.”

It quickly became apparent that Raducanu was not going to win all the time, that she had somehow gotten into the zone very early and might not find her way back again for

quite a while, if at all. She has yet to win another tour title or get past the second round in another major, and she has cycled through coaches and nagging injuries like the ankle she sprained badly less than two weeks before the start of the Australian Open.

“We just did absolutely everything we can,” Raducanu said. “We had pretty much, like, 10 days before the tournament, and Day 1, I was on crutches and doing pool rehab. To get onto the court from there has been a massive effort.”

Meanwhile, Gauff opened her season in Auckland, New Zealand, by winning the title and arrived in Melbourne with momentum.

She will face another American, Bernarda Pera, in the third round Friday and is playing doubles with Jessica Pegula, who also advanced to the third round in singles Wednesday by defeating Aliaksandra Sasnovich of Belarus in straight sets.

Although she broke through to reach her first Grand Slam singles final at the French Open last year, losing to No. 1 Iga Swiatek, Gauff finished the season on a downbeat: hitting the wall after her first full year on tour and losing all three of her matches at the WTA Finals in Fort Worth, Texas, and losing again after crossing the Atlantic to Glasgow, Scotland, for the Billie Jean King Cup Finals team event.

Her forehand, traditionally her less reliable stroke, kept breaking down under duress, and shoring it up was again a point of focus for her and her team during the offseason.

Improving it and her belief in it will be critical to achieving her Grand Slam goal, and it held up well for much of the match Wednesday only to get shakier down the stretch in the second set as Raducanu targeted it repeatedly.

Gauff certainly defended well off both wings Wednesday night, extending rallies and ultimately forcing Raducanu to go for too much.

“It’s difficult,” Raducanu said. “She is a great mover, great athlete — puts another ball in play, so you feel like you have to squeeze it closer to the line and then she kind of teases errors out of you that way.”

When Gauff served at 4-5 in the second set, Raducanu had command of both of the set points, dictating the pat-

terns and terms of engagement only to miss when it came time to seal the deal.

Her backhand drop shot on the second set point would have clearly been a winner if it had crossed the net, but it hit the tape and fell back on Raducanu’s side of the court. In the tiebreaker, she lost three more key points when she was the one setting the tempo.

“I think 13 days ago if you would have told us, ‘Hey, you’re going to be in the draw and win a round,’ it would have been a massive effort for sure,” Raducanu said. “Saying that, I still think I didn’t necessarily play my best today. Although in the second set I had chances and we were pushing it, I still felt like I could have done better. But props to her.”

Raducanu and Gauff had never even practiced together, but when it was over Wednesday, the handshake gave way to a friendly embrace at the net.
