Senator proposes probe into coffee price hike some call ‘one more tax’

Says Agriculture Dept. must provide details on how proceeds from increase will be used

Agriculture Secretary Ramón González Beiró will have to render an account before the island Senate regarding the use of the millions of dollars that the agency he leads will receive from the increase in the price of coffee.

Arecibo District Sen. Elizabeth Rosa Vélez announced the filing of legislation to investigate the reasons behind the increase in the price of coffee and the repercussions for consumers.

Last week, the Department of Consumer Affairs (DACO by its Spanish acronym) authorized the increase in the price of coffee.

The measure orders the Agriculture Department to submit a detailed report on how it will use the money collected.

“Knowing how the money collected from the increase in coffee will be invested is a serious matter that the country should know about,” the senator said. “Experts linked to the industry allege that the increase established by the Department of Consumer Affairs and endorsed by Agriculture is one more tax since it does not benefit coffee growers at all.”

“For this reason, it is necessary to know how the money collected will be invested and to validate the supposed grounds that the government in power has for increasing prices,” Rosa Vélez continued. “Coffee for decades has been one of the most consumed products in Puerto Rican homes and families are the ones that will have to adjust their budgets to deal with the increase.”

Puerto Rico Coffee Roasters general manager Germán Negrón said publicly that the increase established by DACO translates to $1 more than the price consumers currently pay on the shelves. He also argued that the decision lacks an economic study and does not consider the needs of coffee growers.

Meanwhile, Association of Coffee Purchasers and Processors President Miguel López Hernández thanked DACO Secretary Hiram Torres Montalvo and González Beiró on Sunday for the price increase.

“We are very appreciative of Secretary of Agriculture González Beiró for his bravery and perse-

verance for the changes that must be made in the coffee industry,” López Hernández said. “He has given us confidence and hope. We also thank the new secretary of DACO for establishing a new order in coffee prices, which without doubt has arrived to guarantee a product of better quality for the tables of consumers, and at the same time sets the foundation to promote the country’s coffee industry.”

Rosa Vélez contended that “When I analyze the public statements of different experts on the subject of coffee or businessmen linked to this sector, the reality is that there are serious questions that both the Department of Agriculture and DACO have to explain.”

The senator also highlighted that the measure she filed additionally inquires about the duration or permanence of the announced increase and how it will impact local coffee production.

“It is our obligation as senators to care for the well being of consumers, which is why this investigation is so important,” she said. “The government has an obligation to be transparent, and unfortunately, this increase raises serious questions. We will follow up on the legislative process so that the measure is dealt with as soon as possible.”

The Senate Economic Development, Essential Services and Consumer Affairs Committee will evaluate the measure. Rosa Vélez stressed that she would use other methods that the Senate allows to investigate the issue, which she said lacks benefits for both consumers and the island’s coffee sector.

González Beiró announced an increase of $3.42 per bushel, to $18 per bushel.

San Juan muni legislator targets recycling program for review

Manuel Calderón Cerame, the spokesman for the Popular Democratic Party in the San Juan Municipal Legislature, filed an investigative resolution Sunday to look at the current status of the municipal recycling program.

“Recycling programs feel like they need to be monitored to make them work properly,” Calderón Cerame said. “In that sense, it seems right to investigate if the companies contracted to provide adequate services with these tons of recycled material in the Municipality of San Juan and also do it correctly and in compliance with state and federal requirements.”

The PDP spokesman in the island capital made a statement in a radio interview a few days ago about the absence of an aggressive recycling plan at the Fiestas de la Calle San

Sebastián earlier this month.

“The fiestas were very good and that is recognized, but if something was absent it was the lack of an aggressive recycling program and the raising of awareness about the consumption of plastic,” Calderón Cerame said.

In the resolution introduced in the municipal legislature, he points out the lack of an efficient awareness campaign against climate change, clear information on the days in which recycling program personnel go out to collect material in the communities of San Juan, and regular inspections of the companies contracted with the municipality for those purposes.

“We are going to make sure that things are done well, and that the thousands of San Juan residents who every day separate paper from plastic and glass in their respective boxes have the certainty that their effort is not in vain,” Calderón Cerame said.

FEMA allocates $18.5 million for first phase of new reservoir, water treatment plant expansion

The first phase for the construction of a new reservoir in the Valenciano River and the expansion of the Valenciano Water Treatment Plant has been approved at a

cost of over $18.5 million from the Federal Emergency Management Agency (FEMA) under its Hazard Mitigation Grant Program.

The new reservoir, to be located in the municipality of Juncos and an asset of the Puerto Rico Aqueduct and Sewer Authority (PRASA), will have a capacity of 12.7 million cubic meters of water.

Gov. Pedro Pierluisi Urrutia stated that the project authorized by FEMA responds to the impacts of climate change in order to have a resilient infrastructure for future weather events.

“We have worked hard to obtain the approval of funds for Phase 1 of this project,” the governor said. “The Valenciano Reservoir project is a priority for my administration because it promotes quality of life and health for the nearly 140,000 residents living in Humacao, Caguas, Juncos, San Lorenzo, Las Piedras and Gurabo, in addition to improving water storage capacity, which will benefit the surrounding towns. I want to thank President Biden’s administration, as well as FEMA staff, for working closely with our government to achieve the approval of such an important project.”

Once the first phase is completed, which includes the procurement of engineering services, preliminary engineering design, environmental compliance and permitting processes, planning for land acquisition and final design and construction documents, FEMA will consider additional funding for Phase 2 at a cost of over $399 million.

“Residents in the area will benefit from this mitigation work, especially during drought conditions, when the existing potable water supply systems cannot meet the water demand for the area,” Deputy Federal Disaster Recovery Coordinator Andrés García said. “When the project is completed, it will offer enough water storage and pumping capacity to ensure a steady water supply for the area.”

PRASA Executive President Doriel Pagán Crespo said the efforts of her team and the close collaboration with FEMA and Central Office for Recovery, Reconstruction and Resiliency have made the project a reality.

“The Valenciano Reservoir is another of our priority projects, which will provide redundancy and flexibility in the potable water systems of these six municipalities,” she said.

practices that Sixto ‘George’ engaged in with other radio and television personalities,” the two journalists said in a joint statement. “The people mentioned so far work in the media in other roles, as announcers, entertainers, commentators, etc., not as journalists. Not everyone who appears in front of a television camera or behind a microphone in a radio booth is a journalist. In the media there coexists a wide variety of types of programs, such as talk shows, entertainment, drama and game shows, and among them is the news format. Many

people are unaware of that difference and think that all artists, models and public figures in the media are journalists. Nothing could be further from the truth.”

During the first week of the trial, it came to light through the testimony of former Public Affairs Secretary Anthony Maceira Zayas that Díaz Colón told him that he could use radio presenters and “influencers” to change the negative narrative received by the administration of then-Gov. Ricardo Rosselló Nevares.

Protesters at Aguadilla construction site say guard fired blanks; at least 2 injured

At least one masked private guard fired blanks Sunday against protesters in Aguadilla who are demanding a stop to certain construction projects in the maritime zone that they say hurt the environment.

At least two protesters were reportedly injured. One of them is a woman, according to videos posted by former independent gubernatorial candidate Eliezer Molina in his Facebook page, and the other is a man.

The incident occurred in the context of ongoing protests being staged by a number of demonstrators against the construction of various projects that, they say, are destroying the Las Golondrinas cave and a pelican habitat. The protesters have also established camps.

The owner of the property, the protesters said, is a developer who is allegedly

violating an array of regulations, and has acquired private land from various residents of the area.

The Department of Natural Resources, the Institute of Puerto Rican Culture and other agencies have said the construction is illegal.

No private guard, at press time, had been arrested or identified. Protesters were shouting and carrying signs during the incident.

Citizens Victory Movement Rep. Mariana Nogales Molinelli said some 15 protesters were hurt when private guards used pepper spray to break up the protest.

After the incident, police mobilized dozens of agents and buses to the property.

“We have photographs of the bullets and of the private guard who fired,” Nogales Molinelli said. “We are waiting for them to preserve the scene [for evidence], because it has not been done.”

EPA approves $23 million for water infrastructure in Caguas, 4 other towns

The U.S. Environmental Protection Agency (EPA) has approved a $23 million investment from the Bipartisan Infrastructure Law to fund water infrastructure projects in Caguas, Coamo, Jayuya, Naranjito and Orocovis.

The EPA has formally approved work plans that will allow the Puerto Rico Department of Natural and Environmental Resources (DNER) to proceed with the projects under the investment, according to an agency statement.

“When water infrastructure fails, it threatens people’s health and the environment. This Bipartisan Infrastructure Law

investment will improve the lives of Puerto Rico communities facing major water challenges,” EPA Regional Administrator Lisa F. García said. “The Bipartisan Infrastructure Law is a unique and historic opportunity to correct longstanding environmental and economic injustices across America. This funding will create jobs while upgrading the island’s aging water infrastructure.”

DNER Secretary Anais Vega Rodríguez said “this historic EPA grant is an important additional step to improve the quality of our waters by allowing the management of a series of polluting sources and renewing deteriorated infrastructure.”

“Likewise, projects like these are truly essential for environmental protection and contribute to the socioeconomic development of the impacted regions,” she added. “The close collaboration between the EPA and the DNER to solve specific problems will continue with another series of projects during the coming years.”

The Clean Water State Revolving Fund program provides low-cost financing, in some cases at zero percent interest, for local projects. To allow for the program to support more water quality and infrastructure improvement projects, the Bipartisan Infrastructure Law provides additional capitalization grants to each state for the recipient’s program. Puerto Rico will receive $23,214,000 to use on the planning, design and construction of eligible water quality improvement and protection projects in the five targeted municipalities.

After consultation, the EPA and the government of Puerto Rico have identified specific projects which are vital to protect and improve water quality, aquatic life, recreation and natural habitat. Specifically, the EPA-approved projects are

for the design and construction of sanitary sewer systems in four municipalities (Coamo, Jayuya, Naranjito and Orocovis), eliminating many private septic systems and sewer discharges around the island. A fifth project will eliminate a Caguas wastewater treatment facility that will turn into a wastewater pump station, thereby eliminating a major discharge point.

President Biden signed the Bipartisan Infrastructure Law on November 15, 2021. The law’s investment in the water sector includes $50 billion to the EPA to strengthen the nation’s drinking water and wastewater systems -- the single largest investment in clean water that the federal government has ever made.

Report: PR must look to ‘nearshoring’ policies to boost competitiveness

Puerto Rico must increase its competitiveness to take advantage of new U.S. policies on “reshoring” and “nearshoring,” which involve producing items closer to home, a report from economic think tank Estudios Técnicos says.

The idea is to transfer commercial and manufacturing operations of critical goods and services from China to the United States or nearby countries, according to “Impact of ‘Nearshoring’ in Puerto Rico,” a report in the most recent edition of ETI Trends by economists from Estudios Técnicos.

The report notes that when the reshoring program was announced, the reaction was positive in Puerto Rico because the U.S. territory has competitive advantages over other places to attract U.S. companies wishing to relocate their manufacturing operations closer to home.

The outlook has changed under “nearshoring” or “friendshoring” policies because Puerto Rico now competes with jurisdictions close to the United States in which production costs are lower than those in Puerto Rico but have a comparable industrial base and infrastructure.

“This should force us to take measures to face important challenges regarding our competitiveness compared to the countries mentioned above. Puerto Rico is not adequately preparing for ‘reshoring’ and much less for what ‘nearshoring’ implies,” the report said.

ETI Trends noted that the global economy has undergone significant transformations since the COVID epidemic, the conflict between China and the United States, and Russia’s invasion of Ukraine. One is that the economy is more responsive to geopolitical considerations than before. The geopolitical conflict between the United States and China has given rise to a trade war with global consequences since China is an essential supplier of

Western economies.

China’s zero COVID-19 policy has contributed to the idea of “reshoring” “nearshoring” and more recently to “friendshoring,” a concept Treasury Secretary Janet Yellen introduced during a speech before the Atlantic Council. The pandemic caused huge disruption to supply chains worldwide, and other economic shocks have closely followed it. Uncertainty still hangs over supply chains, driven by rising fuel prices, soaring shipping costs and rolling COVID-19 lockdowns globally.

What impact is this process having in the Caribbean and mid-Americas region? The countries with the most significant potential for reshoring are Mexico, Colombia, Costa Rica, Guatemala and El Salvador. The sectors or industries that benefit the most are transportation, pharmaceuticals, computers, and scientific and professional equipment. Three factors explain this: geographic prox-

imity to the United States, lower labor costs, and lower shipping costs compared to shipping from China to the United States.

“Let’s look at Mexico, for example. Its most important market and partner of the USMCA (US-Mexico-Canada Free Trade Agreement) tripartite trade agreement is the United States,” the report reads.

According to recent data, as of September 2022, exports from the 10 Mexican states with the most significant number of exports to the United States grew at an average annual rate of 20.6%. Most are border states with the United States. The state of Chihuahua occupied the first place.

Nearshoring has acquired vital importance for Latin America and the Caribbean. According to estimates by the Inter-American Development Bank (2022), it could bring an additional $78 billion to its exports in the coming years, both for goods ($64.1 billion) and services ($14 billion), particularly for Mexico, Colombia, Brazil, Argentina and the Dominican Republic. Several countries are part of free trade agreements with the United States (USMCA and CAFTA-DR), which adds an advantage. In addition, several are in the Caribbean (Costa Rica, Jamaica, Dominican Republic).

“Changes in the global environment are not limited to this aspect (“reshoring” and “nearshoring”). Two examples that reflect what has been said: by 2027 Apple will have moved a good part of its production in China to India, and, closer to us, Costa Rica has become a producer and exporter of ‘chips’ and medical equipment, something completely unexpected a few years ago,” the ETI Trends report said. “As we have indicated many times, Puerto Rico has to be inserted into the global economy and must have the mechanisms for our companies to understand it, and the risks that this changing and volatile environment entails.”

General Fund revenue from December exceeded estimates by 28%

Treasury Secretary Francisco Parés Alicea announced over the weekend that the net income of the General Fund for the month of December 2022 amounted to $1.411.2 billion, $309.9 million, or 28%, more than estimated for that month.

The first half of fiscal year (FY) 2023 (July to December 2022), meanwhile, showed $5.422 billion in collections, which exceeds the projection for that period by $668.2 billion. It also exceeds what was collected during the first six months of the previous fiscal year by $1.54 billion.

“This is important, given that, as a result of the passage of Hurricane Fiona through Puerto Rico, the department implemented a series of administrative measures that postponed several filing dates and payments and, even so, the collections have exceeded what was projected so far,” Parés Alicea said in a written statement.

The fiscal plan certified on Jan. 27, 2022 established a revenue projection for FY 2023 of $11.145 billion.

Soon, the Financial Oversight and Management Board is expected to review the fiscal plan in close collaboration with the island government.

Meanwhile, the immediate economic effect of Hurricane Fiona on revenues and other external factors, such as the Federal Reserve’s monetary policy of raising interest rates as a mechanism to curb inflation, have acquired greater relevance with respect to income.

Likewise, administrative determination No. 22-08 (DA 22-08), published by the Treasury Department, established several tax administration measures in response to the emergency caused by Hurricane Fiona, including: postponements of the filing date of income tax returns and corresponding payments of contributions for individuals and corporate entities (until Dec. 15, 2022), the temporary suspension of the payment of the sales and use tax (IVU by its Spanish acronym) on the importation of goods introduced for resale (until Oct. 31, 2022) and the exemption from the payment of the IVU on prepared foods (until Oct. 13, 2022).

Mishandling of classified information has Congress asking questions

Roy Blunt, a longtime member of the intelligence committees in the Senate and House before retiring this year, said he was always extremely careful and under close supervision when handling classified material.

“I even took off my Fitbit,” said Blunt, R-Mo., about the level of precautions he and fellow committee members took to protect the secrecy of the documents they usually only reviewed in a sensitive compartmented information facility (known as a “SCIF”) in the Capitol complex with no electronics allowed.

Based on their own experiences, many lawmakers said they were astounded and dismayed by the discovery of caches of unsecured classified documents scattered at former President Donald Trump’s Mar-a-Lago retreat in Florida, stored in President Joe Biden’s garage in Delaware and held in former Vice President Mike Pence’s residence in Indiana.

Given the tight controls placed on their handling of such items, they said they found it inconceivable that leaders of the executive branch could be so sloppy. As a result, lawmakers are already talking about new penalties for mishandling sensitive information.

“There is no excuse for it,” said Rep. Mike Quigley, D-Ill., who has been a member of the House Intelligence Committee for eight years. “There is no excuse for mishandling documents ever. By anybody.”

Quigley and Rep. Darin LaHood, R-Ill., also on the intelligence panel, said Thursday that they intend to introduce legislation that would impose new sanctions for lax control over classified information through carelessness or other behavior that did not rise to the level of criminality. The punishment could include fines, revocation of security clearances and other options. Their effort is not likely to be the only one.

“People are really upset,” said Sen. Susan Collins, R-Maine, a member of the upper chamber’s Intelligence Committee. “Something is terribly amiss. The idea that someone can just inadvertently take classified documents is pretty far-fetched.

The sense of outrage on Capitol Hill has only intensified since the Biden administration said it would not disclose to the intelligence panels the contents of the found materials while special counsel inquiries continue.

Sen. Mark Warner, D-Va., chair of the Senate panel, said he intends to challenge that position. Members of both parties say the administration’s stance is preventing them from conducting oversight on the national security risks of the cavalier treatment of classified information.

The White House handles a flood of classified information, and the executive branch zealously guards its prerogatives on what it classifies and declassifies and what it allows Congress to see. While the Biden administration is likely to push back on attempts to impose new rules, Con-

gress has broad oversight over the intelligence community and controls its funding and confirmation of high-ranking nominees, giving lawmakers considerable leverage.

To illustrate the steps that members of Congress take to protect secret information, several members of the intelligence panels outlined the procedures they operate under. Committee members typically handle or hear classified information in secure rooms in the Capitol — one on the House side, one on the Senate and another in the Hart Senate Office Building.

Upon arriving in an anteroom, they are signed in by staff, directed to lock up all electronics and allowed into the SCIF. Once inside, they are permitted to review documents and take notes, but their notes are locked away and cannot be removed from the facility. Lawmakers said they were other safeguards in place that they would not discuss.

“The rule is very, very clear, and you have to scrupulously adhere to it,” said Sen. Ron Wyden, D-Ore., another longtime intelligence panel member. “You cannot take anything from the room.”

Upon leaving, lawmakers are again reminded not to take any classified material.

“After the hearing or briefing is over, the documents

are reclaimed before you leave the SCIF,” Collins said. “Nevertheless when you got out, you are asked if you have any classified documents with you and your name and the time that you leave is noted.”

“I wonder if the executive branch, ironically which is producing these documents, has far looser standards,” she added.

On the occasions when a lawmaker needs to see a document but cannot go to a secure room, the material is brought to their office in a locked pouch by an authorized staff member. In the presence of the lawmaker, the pouch is unlocked, the document handed over for review, then returned to the pouch and locked back up. There can be no discussion of the contents.

“The only time that document is out of the pouch is while the member is reading it,” Blunt said. “It is understood even with a trusted employee who works for you on the Intelligence Committee that you don’t discuss it in that setting. That is the level of protection that classified documents have in the Senate and the Congress.”

Considering the longstanding security practices, senators said that it was inexplicable to them how classified documents from Biden’s Senate years were found in his possession, though Sen. Dick Durbin, D-Ill., said he did not believe there had been any criminal wrongdoing.

“I wouldn’t go that far,” Durbin told reporters this week. “I will tell you they’re not very careful in handling classified documents when I think of how we deal with them in the Capitol in comparison. Whoever was responsible for it didn’t follow the basics.”

Other lawmakers said that at minimum, the executive branch should be following the same principles that Congress does.

“It may be as simple as just a better system for housekeeping to know that if a document goes in, it goes back at the appropriate time to the agency that it came from,” said Sen. Martin Heinrich, D-N.M., an intelligence panel member. “There’s a pretty good system here: You go into the SCIF, and you view information in that location and you don’t take it out. So I think we need to make sure we have the same sort of hygiene wherever these briefings are taking place.”

Tyre Nichols beating opens a complex conversation on race and policing

The killing of Tyre Nichols, a 29-year-old Black man in Memphis, Tennessee, at the hands of police has prompted outrage and condemnation from racial justice activists, police reform advocates and law enforcement officials, including the chief of the Memphis Police Department, a Black woman who lobbied for policing changes in the wake of George Floyd’s murder.

The fact that the five officers charged in Nichols’ killing are Black complicates the anguish. It has also brought into focus what many Black people have said is frequently lost in police brutality cases involving white officers and Black victims: that problems of race and policing are a function of an entrenched police culture of aggression and dehumanization of Black people more than of interpersonal racism. It is the system and the tactics that foster racism and violence, they say, rather than the specific racial identities of officers.

“It’s not racism driving this, it’s culturism,” Robert M. Sausedo, the head of a Los Angeles nonprofit formed after the Rodney King beating in 1991, said after watching the video of Nichols’ beating Friday night.

“It’s a culture in law enforcement where it’s OK to be aggressive to those they’re supposed to serve,” Sausedo said. But he also commended Los Angeles police officials for their progress working with the community since the King beating.

Videos released by the city of Memphis on Friday evening, including police body camera footage and shots from a pole-mounted police camera, show Nichols crying out for his mother while officers hold him down, kick him in the head and punch him.

“We have to talk about this institutionalized police culture that has this unwritten law, you

can engage in excessive use of force against Black and brown people,” Ben Crump, a prominent civil rights lawyer who is representing Nichols’ family, said in a television interview.

Many urban police departments have been pushing to diversify their ranks — a strategy policing experts still support as one way to improve practices and law enforcement’s relationship with minority communities.

James Forman Jr., who has studied and written on race and law enforcement, said that asking why the race of the officers did not prevent them from committing violence against Nichols loses sight of the systemic forces at work.

“Blackness doesn’t shield you from all of the forces that make police violence possible,” Forman said. “What are the theories of policing and styles of policing, the training that police receive? All of those dynamics that propel violence and brutality are more powerful than the

race of the officer.”

Amber Sherman, an activist and organizer working with the Nichols family as they push for policy changes in the police, said that racism is a clear factor in policing when you look at who the victims of police violence are, not the race of the officers.

Officers of all races “are indoctrinated into a practice that sees Black people and brown people as less than,” Sherman said.

On social media, some people rejected the idea that racism was to blame, arguing that pointing to systemic policing robs individuals of agency and responsibility.

“Can’t people be bad people motivated by their lack of maturity, self-awareness and inability to discern? Does every incident involving police and black men have to revert back to being an issue in race?” Barrington Martin II, a former Democratic congressional candidate in Georgia, wrote on Twitter.

Conservative commentator Allie Beth Stuckey wrote on Twitter that “It is a warped worldview that can’t grapple with the fact that people of all races do bad things. Black police brutally beating a black man isn’t because of white supremacy, racism or a system. They did it because people have the capacity to do wrong.”

Others expressed disappointment that Black officers did not have more empathy as well as concern that the race of the officers would muddle the issue of entrenched police violence against Black people.

“As an African American, it’s unfortunate that because the officers are Black, people are going to say violence against Blacks is not racially motivated,” said Joel Kellum, 57, a public school teacher in New York City. “Black cops will do

that to Black perps, too,” Kellum added. “It’s complicated and it’s sad.”

Police reform advocates have long argued that departments should more accurately reflect the demographics of the communities they police as a way to improve policing and help build trust in those communities. In Memphis, 65% of the population is Black, as is 58% of the police force.

“We have a very simplistic way of approaching the problem of policing and believing that representation is some kind of silver bullet,” said Jody Armour, a University of Southern California law professor who studies racial justice. “It’s not just a Black and white issue, but a Black and blue one. And when you put on that blue uniform, it often becomes the primary identity that drowns out any other identities that might compete with it.”

Patrick Yoes, national president of the Fraternal Order of Police, a national law enforcement organization, called the reported failure of other officers to intervene in the fatal beating of Nichols “sickening,” adding: “The event as described to us does not constitute legitimate police work or a traffic stop gone wrong. This is a criminal assault under the pretext of law.”

Friday night, the group that represents Memphis police officers offered condolences to the Nichols family but did not address the actions of the officers. “The Memphis Police Association is committed to the administration of justice and never condones the mistreatment of any citizen nor any abuse of power,” a statement from the association read.

Many police reform activists say diversifying police forces, especially in leadership, has made a difference and remains a worthy goal. (Nichols himself once considered becoming a police officer as a way of changing policing from the inside, a friend said.)

The fact that Nichols was assaulted by Black officers “doesn’t mean that we should abandon what’s critical like diversifying police departments,” said Miriam Krinsky, a former prosecutor who is now executive director of Fair and Just Prosecution. “Individuals who come from communities that are most policed and at times overpoliced have a right to expect that those who we charge to keep them safe and build their trust come from, and have a connection to, those communities,” she said.

Still Krinsky acknowledged that police reform has to go beyond diversity. “Because if we hire the right people, but then the culture of the organization, and how they’re trained, and the tone and values that are modeled aren’t the right ones — just having the right people alone isn’t going to be a solution to some of the concerns about police behavior.”

Man who shot pepper spray at officer on Jan. 6 gets nearly 7 years in prison

With a sea of uniformed police officers looking on, a New Jersey man who pleaded guilty to shooting pepper spray into the face of Officer Brian D. Sicknick during the Jan. 6, 2021, storming of the Capitol was sentenced late last week to nearly seven years in prison.

The 80-month sentence handed down against the man, Julian Khater, brought an end to one of the wrenching cases involving Sicknick, who died one day after he was doused with pepper spray in the melee outside the Capitol.

At the same hearing, George Tanios, a second man who was accused in the attack, was sentenced to time served, having already spent five months in jail as his case moved through the courts. In July, Tanios pleaded guilty to misdemeanor charges after the government agreed to drop an assault count against him.

While early reports suggested that Sicknick died of his injuries, an autopsy later showed that he died of natural causes, after suffering multiple strokes that were not directly related to the violent riot in support of President Donald Trump. Still, prosecutors have noted in court filings that Washington’s medical examiner determined that Sicknick had engaged with rioters Jan. 6 and that “all that transpired played a role in his condition.”

Gladys Sicknick, Sicknick’s mother, told Khater that he had gone after her son “like he was an animal,” adding that whatever penalty he received was “not enough in my eyes.”

Gladys Sicknick also had lacerating words for the larger mob of rioters who had laid siege to the Capitol.

“All of you bear responsibility for the injuries sustained by Brian’s fellow officers — the broken bones, head trauma and the continuing mental anguish they suffer and will endure for the rest of their lives,” she said. “Imagine the emotional pain that would cause someone to take his own life. Four officers committed suicide. You and your ‘movement’ caused their deaths.”

Officer Caroline Edwards, who was injured in the same attack and testified about her experience to congressional investigators, also appeared in court to deliver remarks to Judge Thomas F. Hogan, who presided in the case.

“Sometimes when I close my eyes I can still see his face, white as a sheet,” Edwards said of Brian Sicknick, adding, “I would give anything to take the pain away from the Sicknick family and my fellow officers.”

Khater’s sentence was one of the longest given to any of the 950 people charged so far in connection with the Capitol attack. The most severe sentences, which have ranged from 7 1/2 years to 10 years in prison, have been handed down to defendants accused of assaulting police officers.

In court papers filed before the hearing, Khater said he had no intention of entering the Capitol on Jan. 6 and only went to Washington that day because Tanios invited him to tag along to a rally by Trump. Tanios, who is from West Virginia, later admitted buying two cans of bear spray and two canisters of a less potent pepper spray before the trip to Washington, but said they were only for self-protection.

In his papers, Khater acknowledged that he used pepper spray against at least three officers, including Sicknick, but explained that he had merely given into “his anxiety” in “a dangerous and chaotic atmosphere.”

When Khater addressed Hogan, he noted that he had already been in custody for 684 days — “a long, agonizing, but humbling experience,” as he put it.

“What happened on Jan. 6 — there’s no words for it,” he said. “It’s unfortunate, and I wish I could take it all back.”

Just before he handed down Khater’s sentence, Hogan said he could not understand why he had joined the mob and attacked officers who presented no threat to him.

“It just does not compute with me, this type of activity, and people thinking they can do this because they disagreed with the results of the election,” he said.

Easy to use, mobile payment apps are also easy to misuse

The use of mobile payment services has surged — along with worries about financial risks.

Services like Venmo and Zelle let people pay others or receive payments almost instantly, with a few taps on their phone. To use them, you typically download the app and link it to a bank account or credit card. Well over half of Americans use the payment tools, according to a 2022 survey by Consumer Reports.

But while they’re fast and easy, the apps can have serious drawbacks. Users can lose money if they accidentally pay the wrong person, mis-type a dollar amount or succumb to a fraud or a scam that tricked them into making a payment. About a quarter of bank customers in an October survey by J.D. Power said they or a close relative had experienced fraud via a peer-to-peer service. And according to Consumer Reports, 12% of frequent payment-app users reported sending money to the wrong person.

Users are mostly on their own in those situations because payment apps fall into a regulatory “gray area” and lack the robust loss protections of credit and debit cards, said Delicia Hand, director of financial fairness with Consumer Reports. “It’s kind of a user-beware situation,” she said.

In an analysis published this week, the consumer magazine determined that none of the four popular payment apps — Apple Cash, Cash App, Venmo and Zelle — reimburse users when a payment is mistakenly sent to the wrong person, because such transactions are considered “authorized.”

The report said the apps also wouldn’t compensate clients if a criminal tricked them into sending money — perhaps by impersonating someone the users know or pretending to represent their bank — because the users, in a sense, had approved the transaction.

When contacted, representatives of the apps did not directly challenge Consumer Reports’ characterization of their reimbursement policies. But they indicated that they do encourage customers to reach out to them for help if they encounter a problem or suspect fraud.

“Each situation is reviewed on a case-by-case basis, as we strive to help any customer experiencing challenges resolve their issue,” a spokesperson for PayPal, Venmo’s parent company, said in an email.

The apps are more likely to reimburse users when they are the victims of fraud and didn’t actively authorize the payment in any way — such as when their phone or password was hacked or they lost their device. Several cap your loss at $50 if you notify them quickly, but your potential loss may rise to $500 after a few days. And if you wait longer than 60 days, you may get nothing. (Venmo says it covers the full amount if you notify the company within 60 days.)

Representatives of the apps said they had taken steps to protect customers and help prevent payment mishaps, and they urged users to follow advice on the app websites. All advise using the tools only with friends, family or others who can be trusted, and the apps all include safety reminders or warnings. Apple Cash, for instance, sends a warning if users try to send money to someone outside their contact list. Venmo sends a “flag” if the app detects that the user may not know the recipient. The sender may get a pop-up prompt to verify the last four digits of the recipient’s phone number.

“The security and privacy of all Venmo customers and their information is a top company priority,” PayPal said in a statement.

Formal changes may be coming. Zelle, which is owned by a group of seven big banks through a company called Early Warning Services, is said to be weighing new rules that would reimburse customers duped by certain kinds of scams. And the Consumer Financial Protection Bureau is considering issuing guidance that could make banks bear more liability for customer losses on peer-to-peer transactions.

The report also raised concerns about privacy risks because the apps may collect and share personal information widely, often for “vague” purposes, and some make it difficult for users to delete their data, Consumer Reports said. (Apple Cash states clearly that it does not sell data to third parties, the review found.)

In general, “slow down when using the apps,” said Rachel Gittleman, financial services outreach manager for the Consumer Federation of America. Their speed is handy, she said, but it’s easy to slip up.

Before hitting the button, confirm the recipient’s username, phone number or email address. “Double, triple and quadruple check” that you are sending the money to the right person, Hand said.

It’s also wise to send a small “test” payment — say, $1 — and confirm the correct person received it before sending a large sum.

Think of the payments as cash, said Jennifer White, senior director of banking and payments intelligence at J.D. Power. “You would not hand someone you did not know cash, and so you shouldn’t send cash to anyone you are not personally connected with.”

Other tips: Use the identity verification options your app offers, like two-factor authentication, White said. They may slow things down a bit, but they can help avoid problems.

Check your accounts at least once a week to see if anything looks amiss. And if you no longer use an app, delete it from your phone so it won’t be vulnerable to hacking.

While people may leave funds in the apps indefinitely and use them as a payment source, it’s wise to transfer funds into your own bank account as soon as possible. But consumers may be reluctant to do so quickly since some apps may charge fees for “expedited” transfers, Gittleman said.

Recession fears pose challenge to energy shares after stellar year

Apotential US recession and tough comparisons to a stellar 2022 are weighing on the prospects of energy stocks delivering an encore to last year’s stunning run, despite valuations that are seen as still comparatively cheap.

The S&P 500 energy sector is up 4.2 per cent year-todate, slightly lagging the rise for the broader index. The sector logged a 59 per cent jump in 2022, an otherwise brutal year for stocks that saw the S&P 500 drop 19.4 per cent.

Energy bulls argue the sector’s valuations bolster the case for a third-straight year of gains, which would be the first such feat for the group since 2013. Goldman Sachs, RBC Capital Markets and UBS Global Wealth Management are among the Wall Street firms recommending energy stocks.

Despite last year’s run, the sector trades at a 10 times forward price-to-earnings ratio, compared to 17 times for the broad market, and many of its stocks offer robust dividend yields. The potential returns for shareholders were highlighted this week when Chevron shares rose almost 5 per cent after announcing plans to buy US$75 billion (RM318 billion) worth of its stock.

Some investors worry, however, that energy companies may find it hard to increase profits after huge jumps in 2022, especially if a widely expected US economic downturn hits commodity prices.

“The group appears to be holding up well, but there is some trepidation due to the fact that investors are concerned about an economic slowdown and what that will do to demand,” said Robert Pavlik, senior portfolio manager at Dakota Wealth.

He said he is slightly overweight the energy sector, including shares of Chevron and Pioneer Natural Resources.

Economists and analysts in a Reuters survey forecast US crude would average US$84.84 per barrel in 2023, compared to an average price of US$94.33 last year, citing expectations of global economic weakness. US crude prices recently stood at around US$80 per barrel.

At the same time, many investors beefed up their holdings of energy stocks in 2022 after years of avoiding the sector, which had often underperformed the broader market amid concerns such as poor capital allocation by companies and uncertainties over the future of fossil fuel. The sector’s weight in the S&P 500 roughly doubled last year to 5.2 per cent.

However, that dynamic may be petering out, said Aaron Dunn, co-head of the value equity team at Eaton Vance.

“People have come back to energy in a big way,” he said. “We had that tailwind the last couple of years, which was that everyone was under-invested in energy. I don’t think that’s the case anymore.”

And while energy companies are expected to deliver strong quarterly reports over the coming weeks after a roaring 2022, those numbers may have set a high bar for this year.

With 30 per cent of the sector’s 23 companies reported so far, energy’s fourth-quarter earnings are expected to have climbed 60 per cent from a year earlier, and 155 per cent for full-year 2022, according to Refintiv. But earnings are expected to decline 15 per cent this year, the biggest drop among the

Exxon Mobil and ConocoPhillips are among the reports due next week, when investors also will focus on the Federal Reserve’s latest policy meeting.

“Last year was a banner year,” said Matthew Miskin, co-chief investment strategist at John Hancock Investment Management. “Now they have got to try to beat that to show growth, and I think that is going to be a challenge.”

In the meantime, bullish investors point to shareholder-

friendly uses of cash by the companies.

The energy sector’s 3.43 per cent dividend yield as of year-end 2022 was nearly twice the level of the index overall, according to Howard Silverblatt, senior index analyst at S&P Dow Jones Indices. Energy companies executed US$22 billion in share buybacks in the third quarter, just over 10 per cent of all S&P 500 buybacks.

“From a total return perspective, that is where I think energy can still continue to differentiate itself versus the broader market,” said Noah Barrett, energy and utilities sector research lead at Janus Henderson Investors.

Others, however, believe more value may exist in areas of the market that were beaten down last year. Dunn, of Eaton Vance, said stocks in areas such as consumer discretionary and industrials may appear more attractive.

Russia and Ukraine battle for control of villages near Bakhmut

Russian forces were wrestling for control of villages in eastern Ukraine near the beleaguered city of Bakhmut over the weekend, the latest flashpoint in a battle that Moscow views as crucial for its push to seize the whole of the eastern region of Donbas.

Ukraine’s general staff said Sunday that its soldiers had repelled attacks on the small village of Blahodatne and several other settlements in the area. The statement came a day after Russia’s Wagner group, a private military company that has conducted much of the fighting around Bakhmut on Moscow’s behalf, claimed that its forces had captured Blahodatne.

“Blahodatne is under our control,” Yevgeny Prigozhin, a Russian businessperson and the head of the Wagner group, said Saturday in a statement posted on a website for one of his companies.

Russia’s defense ministry has not confirmed the report, and the claim could not be independently verified. Prigozhin has sought to cast his mercenaries as the most effective fighting force in the area and previously has claimed credit for battlefield advances ahead of Kremlin confirmation.

Blahodatne lies between Soledar, a salt-mining town that Russian forces recently captured after weeks of intense fighting, and a road that runs north from the city of Bakhmut. The road serves as a crucial supply line for Ukrainian forces defending the city.

Since the summer, Bakhmut has bea-

come a focal point of the fighting in eastern Ukraine and the target of Moscow’s most significant offensive.

Moscow aims to encircle Bakhmut, cut off its supply routes and then force the city’s defenders to withdraw. Despite some recent success, Russia’s progress in the campaign, which began over the summer, has been grindingly slow, and both sides have sustained heavy casualties in intense fighting.

But since capturing Soledar earlier this month, Russian forces have stepped up shelling of the villages just to the west of it, including Blahodatne.

Many civilians have followed a direc-

tive from the government in Kyiv to leave Donetsk, which is home to Bakhmut and one of the two regions that make up the Donbas region. Civilians who have stayed remain vulnerable to shelling and artillery attacks, with dozens killed in recent weeks. Pavlo Kyrylenko, head of Donetsk’s military administration, said Sunday that five civilians had been killed a day earlier in the region.

Almost a year after Russia launched its full-scale invasion of Ukraine, both sides are expected to launch renewed offensives in the coming months, as Kyiv puts to use the heavy weapons sent from the West and Russia deploys the huge numbers of men it drafted last year.

Amid warnings that Russian forces were regrouping for an anticipated spring offensive, Ukraine’s allies pledged new sophisticated weapons for the fight.

Germany and the United States last week announced that they would send battle tanks to Ukraine, a move that came after weeks of tense back-channel negotiations between Western officials. But it may be months before the tanks rumble across the battlefield.

Britain’s defense ministry said Sunday that the first Ukrainian soldiers had arrived in Britain for training on the Challenger 2 tanks that were promised earlier this month.

In a speech Saturday, President Volodymyr Zelenskyy of Ukraine expressed gratitude for the latest promises of military aid but said that his country’s allies should still do more.

“Ukraine needs long-range missiles, in particular, to remove this possibility of the occupiers to place their missile launchers somewhere far from the front line and destroy Ukrainian cities with them,” he said in an overnight address.

The city of Kherson, in southern Ukraine, has faced repeated strikes in recent weeks. On Sunday, shelling there killed at least three people and wounded six others, including a nurse, according to the regional military administration.

“Residents of Kherson, go to the nearest shelter or stay at home,” it said in a post on the Telegram messaging app. “In no case stay outside.”

Russian forces have shelled Kherson on a near-daily basis following their retreat from the city in November.

But the Kremlin has set full control of the Donbas, where it has held considerable ground since 2014, as its immediate military objective. To that end it has mobilized tens of thousands of new recruits, although it has failed to achieve sweeping territorial gains in the region in recent months.

Military authorities in Ukraine say that Moscow’s advances in the Donbas region have come at the expense of heavy casualties, not least among the ranks of the Wagner private military company. Some analysts of the conflict say that Wagner’s failure to secure Bakhmut, even after months of fighting, has dimmed its star in some Russian military circles.

The Institute for the Study of War, a think tank based in Washington, said in a report Saturday that conventional Russian forces were “likely replacing exhausted” Wagner forces “to maintain the offensive in Bakhmut” after the capture of Soledar.

But Russia might be less willing to sustain heavy losses among regular conscripts than among Wagner fighters, the report said.

“The Russians’ ability to execute largescale rapid offensives on multiple axes this winter and spring is thus very questionable,” the report said.

To fix its problems in Ukraine, Russia turns to the architect of the war

Gen. Valery Gerasimov, the architect of President Vladimir Putin’s invasion of Ukraine, took over the dayto-day running of Russia’s war effort this month by convincing his boss that his predecessor was too passive, U.S. and European officials say.

But Gerasimov’s turbocharged strategy is what led to Russia’s problems to begin with, and Moscow still does not have the troops, ammunition or equipment that military officials say it needs to mass the big offensive promised by the country’s senior military leader.

Since Gerasimov replaced Gen. Sergei Surovikin, who was in the job for three months, Russia’s military leadership has focused on tactical issues like whether troops should travel in civilian vehicles and the dangers of their cellphone use, Western officials say. But while those matters have certainly bedeviled service members, there is no evidence that the Russian military has begun to address its fundamental problems, like shortages of ammunition and well-trained troops, despite the musical chairs of generals, according to these officials.

In Washington, where military and defense officials walk the halls of the Pentagon with lists of the steadily growing number of Russian generals who have been fired or demoted during 11 months of war (nine so far), the latest installment of who’s in charge is viewed as part of a drama with an everevolving cast of characters who have not gotten the job done.

“It’s kind of like a reality TV show,” Colin Kahl, the undersecretary of defense for policy, told reporters last week. “And I think it’s more indicative that the Russians have still not figured it out about how they intend to command the fight, and I think the dysfunction among Russian commanders is pretty profound.”

Now on his third overall war commander, Putin has accomplished few of his goals. Russian troops have failed to seize Kyiv, the capital; President Volodymyr Zelenskyy is still in power; Ukraine has closer ties to the West than ever; and despite signs of some cracks, NATO remains united. Even Russia’s more limited goal of taking over the entire eastern region of the Donbas remains elusive.

To fix this mess, Putin has turned to none other than Gerasimov.

For 10 years, Gerasimov was believed to be working to modernize the Russian armed forces as the chief of general staff for the military — the equivalent of the U.S. chair of the Joint Chiefs of Staff. He had studied U.S. misadventures in Afghanistan, Iraq, Syria, the former Yugoslavia and Libya, and aimed to incorporate those insights into the plans.

But evidence of that effort has yet to emerge on the Ukrainian battlefield.

Gerasimov, 67, comes complete with contradictions that characterize senior Russian leaders: His counterparts in the West say that he has personal integrity but that he pushes the lies of his government. He told Western officials early last year that Russia had no intention of invading Ukraine; weeks later, Russian troops had crossed the border. He has also remained close to Putin, who appointed him head of his military more than a decade ago.

As he sought to overhaul the Russian military, Gerasimov elevated the irregular warfare tactics that he falsely believed

that Americans were conducting, instead of focusing on what the United States did well — combined arms warfare, blending various military capabilities to create overwhelming force, Seth G. Jones, a national security expert, argues in his book “Three Dangerous Men.”

As a result, Russia’s military gained expertise in subterfuge and clandestine tactics, like sending Russian Spetsnaz special forces units, without insignia, to Crimea before Russia illegally annexed the peninsula in 2014.

But the war in Ukraine has required a different kind of maneuvering: offensive campaigns by large numbers of ground forces operating in different areas with the goal of seizing land. There, Gerasimov has been ineffective.

The troops sent to take Kyiv in the early days of the war lacked even basic supplies and soon stalled outside the city. He did not hone the military’s ability to move large numbers of different kinds of troops, by land, air and sea, yet his invasion plan depended on that. Russian forces got bogged down, and then eviscerated, in northern Ukrainian cities and towns.

Gerasimov himself almost fell victim to his military’s poor planning when, in late April, he narrowly escaped being killed in a Ukrainian strike when he visited troops. Dozens of Russians were killed instead, in an incident that prompted Moscow to scale back visits from leaders to the front.

“This goes to the lack of serious training and operational experience in the Russian Ministry of Defense,” said Frederick Hodges, a retired

lieutenant general and former top U.S. Army commander in Europe. “When you get into a real war, like the one in Ukraine, all their shortcomings are immediately exposed.”

The result of those shortcomings was on display in November in a scene broadcast on Russian state television. Standing in front of a map and a Russian flag, and wearing army fatigues, Surovikin announced Russia’s retreat from the southern city of Kherson, calling it a “difficult” decision.

“Having assessed the situation, I propose to take up defense on the left bank of the Dnieper,” he told his superiors, in a reference to the river that offered the sole remaining escape route.

Missing from the scripted televised meeting was Putin — an absence, U.S. and NATO officials said, that reflected his desire to distance himself from what was by any account a stunning military defeat.

Just a month earlier, Surovikin had been appointed to lead the Ukraine effort, replacing Gen. Alexander Dvornikov.

But Surovikin, according to U.S. military officials and Biden administration officials, had solidified a shaky Russian position in Ukraine, particularly in the south. He had pushed for Russian forces to abandon Kherson and conducted a retreat that minimized Russian casualties. He then focused his forces on what the U.S. military calls “defense in depth,” building secondary trench lines.

While his defensive moves raised worries in Washington that Russia might be able to withstand renewed Ukrainian offensives, Russian military bloggers had a far different reaction.

The bloggers, who have emerged as an influential voice during the conflict, criticized the Russian military command for the retreat from Kherson. Putin had been uncomfortable with that plan, initially rejecting Surovikin’s recommendation to pull back. U.S. and allied officials believe that Gerasimov and Russian Defense Minister Sergei Shoigu used Putin’s skepticism of the defensive stance against Surovikin.

U.S. officials predicted in December that Gerasimov and Shoigu would try to reassert their control over the military amid intense jockeying for Putin’s ear. In January, the two made their move, engineering a field demotion for Surovikin.

With Putin still insisting that Russia will seize the Donbas and even Kyiv, expectations are rising that Gerasimov will be under immense pressure to carry out a successful offensive this spring, military officials and analysts say.

“It’s now on him, and I suspect Putin has unrealistic expectations again,” Mark Galeotti, who studies Russian security affairs, said in a Twitter message, calling Gerasimov’s promotion “the most poisoned of chalices.”

Iran says it thwarted a drone attack on a munitions facility

Iran’s defense ministry said that it had thwarted an attack Saturday on one of its munition centers in the central city of Isfahan by shooting down three drones.

In a statement, the ministry said the attempted attack occurred about 11:30 p.m local time with quadcopter drones and it reported no casualties. It said the facility’s roof had sustained minor damage.

Video footage posted on social media by witnesses showed a large explosion erupting in the night sky above the military facility, which is located on a major road in northern Isfahan. A man standing on the side of the road as traffic whizzed by is heard on the video saying anti-aircraft missiles were fired before an explosion was heard. “It’s a drone, it’s a drone,” he said of the target.

State television said authorities were investigating what was behind the attempted attack on the munitions center and the extent of the damage.

But some Telegram channels, including that of Sepah Cyberi, which is affiliated with Iran’s Revolutionary Guard, accused Israel and its agents inside the county of being behind the attack and warned “experience has shown that Iran will retaliate.”

“Wait for rogue drones hitting Zionist oil tankers,” its posting said.

Iran and Israel have been engaged in a shadow war on land, sea, air and in cyberspace for the past three years, with Israel carrying out strikes on Iranian military and nuclear facilities and assassinating scientists and a senior military official.

During the tenure of Prime Minister Naftali Bennett, Israel also started targeting Iranian defense and military officials

and key infrastructure. Bennett called it the “octopus doctrine” of striking inside Iran to damage its capacity to arm proxy militias in the region hostile to the Jewish state.

If Israel was behind Saturday’s attack, it would mark the first known covert operation in Iran ordered by Prime Minister Benjamin Netanyahu, a known hawk on Iran, since he returned to office last month. It would also suggest that he will continue the policy of his predecessor to expand the target list inside Iran.

Iran has retaliated to such attacks in the past by targeting Israeli-owned ships with drones in the Persian Gulf and in the Red Sea and by firing ballistic missiles into Kurdish northern Iraq where, it said, Israel planned and carried out a drone attack on an Iranian drone factory in March 2022. And Tehran has also carried out cyberattacks on Israeli civilians.

In its statement after Saturday’s attack, Iran’s defense ministry said “such

blind-sighted attacks will have no bearing on the country’s development.”

Local media said the attack involved three quadcopter suicide drones, and it was similar to a strike carried out against a nuclear centrifuge factory belonging to Iran’s Atomic Agency in June 2021 and one carried out against a Hezbollah facility in Beirut in August 2019. The latter attack destroyed what Israeli officials described as machinery vital to Hezbollah’s missile production efforts.

Quadcopter drones, so named because they have four rotors, have a short

flight range and in Saturday’s attack they were believed to have taken off from inside Iran. The origin of the drones involved in Saturday’s attack was not yet clear but because of Isfahan’s distance from Iran’s international borders the attack was also likely organized from inside Iran.

The drone attack comes at a tense time in Iran, which has faced more than four months of protests against the rule of the Islamic Republic. The government has responded with brutal crackdowns, including mass arrests and the execution of four protesters.

The war between the Catholic cardinals

The death of the pope emeritus, Benedict XVI, was succeeded by a small literary outpouring, a rush of publications that were interpreted as salvos in the Catholic Church’s civil war. The list includes a memoir by Benedict’s longtime secretary that mentioned the former pontiff’s disappointment at his successor’s restriction of the Latin Mass, a posthumous essay collection by Benedict himself that’s being mined for controversial quotes, and an Associated Press interview with Pope Francis that made news for its call to decriminalize homosexuality around the world.

Amid all these words, two interventions deserve particular attention. One isn’t exactly new, but the revelation of its author elevates its importance: It’s a memorandum, intended for the cardinals who will elect Francis’ successor, that first circulated in 2022 and has now been revealed by Vatican journalist Sandro Magister to be the work of Cardinal George Pell of Australia, a leading conservative churchman who passed away just after Benedict.

Beginning with a bald declaration that the Francis pontificate has been a “catastrophe,” the memorandum depicts a church falling into theological confusion, losing ground to evangelicalism and Pentecostalism as well as secularism, and weakened by financial losses, corruption and lawless papal governance. (On the climate within the Vatican, Pell writes, “Phone tapping is regularly practised. I

am not sure how often it is authorized.”)

The other is a long essay by Pell’s fellow cardinal, Robert McElroy of San Diego, that ran this week in America, the Jesuit magazine. It shares with Pell’s memo a premise that the church faces debilitating internal divisions, but it argues that division should be resolved through the completion of the revolution sought by the church’s liberals. In particular, McElroy urges the church to shelve any meaningful judgment on sexual relationships and to open communion to “all of the baptized,” presumably including Protestants. Only this kind of radical inclusion, he suggests, has “any hope of attracting the next generation to life in the church.”

That the contending factions within Catholicism hold very different views is not a revelation, but it’s still striking to have them stated so frankly by prominent cardinals: Pell’s direct criticism of the Francis papacy and McElroy’s straightforwardness about his liberal goals makes plain what is often rhetorically obscured.

It’s not just their substance but their style that’s illuminating. In Pell’s terse, brusque list, you can see a condensation of conservative alarm over the condition of the church. In McElroy’s more expansive calls for “dialogue” and “discernment,” you can see the confidence of a progressive Catholicism that assumes that any dialogue can lead in only one direction.

mere coexistence is probably not sustainable. (The current attempt by Francis-aligned prelates to basically crush the Latin Mass shows how quickly it gives way.) Some kind of stronger bridge would have to exist between the McElroy and Pell worldviews for their successors to still share a church in 2123.

And in the distance between their presuppositions, which start with differing sociological analyses of why the church is struggling and end with a vast doctrinal gulf, you can feel the shadow of schism hanging above the 21stcentury church. McElroy is not a radical theologian; Pell was not a marginal reactionary. These are mainstream figures laboring at the heart of the Catholic hierarchy, and yet the gap between their worldviews seems like it could place them in entirely different branches of the Christian faith.

For all their undeniable conservatism, a consistent goal for Benedict as well as John Paul II was some kind of synthesis for the modern church, in which the changes ushered in by Vatican II could be integrated with the traditional commitments of Catholicism. Their era has now ended, but if the church is to hold its current factions together for the long run, a synthesis is still necessary;

Is that imaginable? As someone who basically agrees with Pell’s diagnosis, I can read McElroy and find points of reasonable discussion, particularly where he talks about the role of Catholic women in the governance of the church. In theory, one can imagine a Catholicism with more nuns and laywomen in important offices that retains its core doctrinal commitments, just as — to jump off from the pope’s recent interview — one can imagine a church vigorously opposed to unjust discrimination or state violence against gay people that also still holds to the rule of chastity and the centrality of sacramental marriage.

But syntheses can’t just be drawn up on paper; they have to live in the hearts of actual believers. And right now, the tendency is toward irreconcilable differences, toward a view of Catholicism’s future, on both sides of its divides, where the current argument can only be resolved only with four simple words: We win; they lose.

Gobernador Pierluisi envía carta a líderes del Congreso sobre medidas para Puerto

Once a bullied teen, now the movies’ master storyteller of youth

As a child growing up in Dikkelvenne, a quiet, quaint village near Ghent, Belgium, movie director Lukas Dhont often felt like an outsider. Other boys saw him as too feminine and mocked his interest in dance, except one named Félicien, with whom he shared a close friendship. But as the two approached puberty, Dhont felt social pressures pulling them apart.

“In that moment, that tenderness started to become looked at through the lens of sexuality,” Dhont, now 31, said in a recent interview. “People were divided into groups and boxes, and we were confronted with the idea of labels.” As they became fearful of being ostracized, their friendship evaporated, and Dhont, who is gay, was fiercely bullied for the rest of his school days.

That experience as a young person struggling with expectations around gender and sexuality has shaped both of Dhont’s acclaimed feature films: “Girl,” his 2018 movie about a transgender ballerina, and “Close,” a devastating portrait of a friendship between two young boys in the Belgian countryside, which won the Grand Prix award, the equivalent to second place, at the Cannes Film Festival last year.

“Close” is being distributed by A24 in the United States and was released in theaters Friday. It further establishes Dhont as a phenom of global art house cinema and one of its most observant chroniclers of adolescence. And it cements his reputation as a filmmaker who is exceptionally skilled at eliciting intensely emotional performances from young, often untrained actors.

Dhont, who employs loose scripts and encourages his actors to improvise dialogue, said his method resembled that “of a choreographer, introducing movements.” He said his relatively open approach allowed young actors “to bring so much of themselves” to the films. “I create characters for them to hide in,” he said. “They are like co-authors.”

That strategy helped him to coax out two astonishing central performances for “Close,” a slow-burn drama about two 13-year-old boys named Léo and Rémi (played by newcomers Eden Dambrine and Gustav De Waele) whose close bond elicits scrutiny when classmates suspect they are a couple. After a skittish Léo begins distan-

cing himself from Rémi, a series of slights build to tragedy.

Dambrine, a French student at a dance academy in Belgium, had never acted before Dhont spotted him on a train in 2018 and approached him about auditioning for the lead role in “Close.” Dhont explained that when he saw the then-11-year-old, he was struck by his “angelic and androgynous” features and “very big eyes.”

In a video call, Dambrine, now 15, explained that it had been a “boyhood dream” to act in a movie, and that he had gotten the impression that acting could be fun from watching the blooper reels from “Avengers” films. (He added that when he called his mother to tell her that

a stranger had approached him about starring in a movie, she had responded: “Get off the train! Get off the train!”) His mother ultimately accompanied him throughout the shoot, which lasted two months, in Belgium and the Netherlands. Among other challenges, the film required Dambrine to act out several intensely emotional moments in long, silent close-up. After he nailed a scene, in the first take, in which his character has a breakdown in a doctor’s office, much of the crew began weeping, Dhont recalled.

Dambrine’s mother, whose name is France, said Dhont’s talent for working with young actors was partly a function of his youth. “He is not that far from being a teen,” she said, adding that Dhont’s emphasis on fostering bonds between crew and cast members before shooting, and his openness to improvisation, allowed her son to feel comfortable so he could focus on the emotional elements of his performance.

She also noted that Dhont and Dambrine shared the experience of having been raised by single mothers “who had to figure out how to raise their kids.” The director, she said, “has a lot of empathy.”

Dhont recalled that he had first become interested in film as a child, amid his parents’ divorce, when his mother returned home one night from seeing “Titanic,” James Cameron’s 1997 blockbuster. “My mom had been gloomy, and seeing her come back, telling me how beautiful it was,” he said, “I became obsessed with the film, and the feeling that a film could change someone.”

His interest in making movies was bolstered at age 12, when an incident led him to give up his childhood dream of being a dancer. Dhont said that after performing a dance to the song “Fighter,” by Christina Aguilera, at a school talent show, his classmates mocked him even more mercilessly. “I felt so ashamed that I told myself I will not dance publicly anymore,” he recalled.

Dhont said that his films thus far have been about the period in a person’s youth when they are “confronted with society for the first time” and “performing types of identities or stereotypes of identities.”

“When you’re young, you want to belong to a group, but there are people for whom that doesn’t work,” Dhont said. “My films are about showing the world from that perspective.”

Novak Djokovic captures his 10th Australian Open men’s singles title

Novak Djokovic came to Australia with a mission or, really, a series of them.

To win the championship he had won nine times once more. To win a 22nd Grand Slam men’s singles title and draw even with his rival Rafael Nadal at the top of that list. To remove any doubt anyone might have about whether he remains the world’s dominant player — the most commanding player of the last decade and now this one, too. To show the world that the only way to keep him from winning nearly any tennis tournament is to not let him play.

Check. Check. Check. And check.

A year after Australia deported him over his refusal to be vaccinated against COVID-19, Novak Djokovic reclaimed the Grand Slam title he has won more than any other, capturing a record 10th championship at the Australian Open by beating Stefanos Tsitsipas 6-3, 7-6 (4), 7-6 (5) on Sunday in Melbourne.

After one last forehand off Tsitsipas’ racket floated long to end a match that felt lopsided despite the two tiebreakers, Djokovic turned and stared at his family and coaches sitting in his box. He pointed to his head, his heart and then just below his waistband, letting the world in on his team’s code language and telling it that winning Sunday took everything he had.

“It takes a big heart, mental strength and the other thing as well,” he said with a laugh once the night had turned into the early morning.

He wore a jacket emblazoned with a bright number 22 just under the right side of his collarbone and called this triumph “the biggest victory in my life.”

In addition to gaining pole position to surge past the injured Nadal on the career Grand Slam list — and in the greatest-of-all-time debate — Djokovic also reclaimed the top spot in the world rankings, making him, at 35, the second-oldest player to reach that rarefied realm, behind only Roger Federer, who was nearly 37 during his last stint on top of the tennis world. Djokovic turns 36 on May 22. It’s probably a bad idea to bet against his taking that record from Federer, as he has so many others.

The feat is even more noteworthy given how much tennis Djokovic has had to miss in the last year. He can’t play in the United States because of his refusal to get a COVID-19 shot. Unless there is a change in that policy, he will again miss a major tournament in Indian Wells, California, in March, and the hard court swing this summer, which includes the U.S. Open.

He is either stubborn or a man of principle — and more likely both.

Djokovic’s score sheets in this tournament might suggest that these last two weeks were little more than a vacation Down Under, with some tennis thrown in. He dropped only a single set in seven matches. His fourthround, quarterfinal and semifinal tests were nearly complete wipeouts of opponents.

When Djokovic is on as he was in the second week of this tournament, his game is all about firsts. Linescraping first serves that give him the first point of his service games. First breaks of his opponents’ serves that become a first dagger, and first-set wins for a player who rarely lets anyone creep back into a match.

He does not let opponents catch their breath, smacking returns at their shins, forcing them to hit yet another shot, and then another one, after they think they have won a point. It’s tennis as a form of suffocation. Tommy Paul, the American who was Djokovic’s victim in the semifinal, said when it was over that much of the first set had been a blur. Paul has played tennis his whole life, but this time, the seconds between points, between the moment he hit a ball and the moment he was on the run chasing the next one, have never passed so quickly.

But Djokovic’s reclamation mission in Australia was filled with hazards. Ahead of the tournament, he aggravated his hamstring, forcing him to take the court wearing a thick strapping around the injured area until the final. He hobbled through the first week, playing without the magical movement that is the foundation of his game.

Goran Ivanisevic, Djokovic’s coach, said 97% of players would have pulled out of the tournament.

“He is from outer space,” Ivanisevic said of Djokovic, who became even more aggressive because of his injury, smacking his forehand whenever he saw a chance to end a point quickly. “His brain works differently.”

And then, as with so many of his previous injuries, a combination of rest, massages and painkillers made the pain and discomfort go away when it mattered most. He heard the noise on social me-

dia questioning whether the leg had ever been hurt at all and shot back that no one ever questioned the validity of other players’ injuries — an unsubtle reference to the always banged-up Nadal.

Then, just as he was hitting top speed, his father, Srdjan, was caught on video taking a picture with fans outside Rod Laver Arena, some of whom were holding Russian flags, after Djokovic’s win in the quarterfinals. Serbia and Russia have close political and cultural ties. Tennis crowds outside Serbia almost always arrive with some hostility for Djokovic, and they pull hard for his opponents, who are usually underdogs.

Djokovic dealt with Paul and then dealt with the public, assuring everyone that his father had never meant to show support for the war in Ukraine, that as someone who grew up in the war-torn Balkans he knew the horrors of violent conflict and would never support it.

After that, only Tsitsipas, for years seen as tennis’s heir apparent, stood in his way.

Maybe Sunday night in Australia, where the large, spirited Greek population has turned Tsitsipas into an adopted son, would be the night, especially with the No. 1 ranking on the line.

Then again, maybe not. Tsitsipas came out without the ease and fluidity that he had played with for nearly two weeks, and he fell behind early. Djokovic barely seemed to break a sweat as he took the first set.

In the second set, though, Tsitsipas’ arm seemed to loosen, the forehands started to bang, and the windmill one-hand backhands started to whip.

This will undoubtedly be the hour that keeps Tsitsipas up at night in the coming weeks. The netted volley that would have given him a chance to break Djokovic’s serve at 4-3. The tentative return of Djokovic’s meatball of a second serve when Tsitsipas had set point. The long forehand and the loose backhand — the stroke Djokovic picked on all night that gave him the edge he would not give up in the tiebreaker.

“He’s the greatest that has ever held a tennis racket,” Tsitsipas said of Djokovic as he held his runner-up plate once more.

Hamlin’s injury highlights precarious position of many young NFL players

The beginning of the end of Zeke Motta’s football career came at Lambeau Field in Green Bay, Wisconsin, in December 2013, when he ran downfield to cover a kickoff for the Atlanta Falcons. Two blockers from the Packers slammed him to the ground, and he briefly lost consciousness.

He had a fracture of the C1 vertebra that sits at the base of the skull and holds the head upright. Two surgeries later, doctors told Motta, then 24, it was too risky to keep playing.

That was when his physical problem also became a financial one — a common story for hundreds of former NFL players who have been injured on the field, especially early in their careers. Because Motta was a rookie when he was hurt, he was ineligible for a pension or post-career health care. And his applications for disability benefits jointly administered by the league and union have been repeatedly denied.

Now 32, Motta said he’s “still trying to find my way.” He saved enough money from his brief professional career to buy a house, but the lingering physical effects of his injury have limited the kinds of work he can do.

“I spent my whole life playing football and working toward a dream,” Motta said. “Then only to find out that it’s just a business.”

This month, Damar Hamlin, a 24-year-old Buffalo Bills safety, went into cardiac arrest and was revived on the field during a prime-time NFL game. His collapse shocked a national TV audience and highlighted the potentially grave danger of playing football.

In only his second year, Hamlin had not met the threshold of three years for a pension and other critical benefits. The spotlight on his case almost guarantees that the NFL and the Bills will ensure that he is taken care of if he does not play again. But Motta and hundreds of other players whose young careers were derailed by injuries are often less fortunate. They leave the game with damaged bodies and mixed job prospects, and some struggle to get the help they need.

“The world’s collective heart is pouring itself out for Hamlin, but the main point is there are a lot of journeymen players who leave the league with seri-

ous problems,” said Michael LeRoy, who teaches sports labor law at the University of Illinois Urbana-Champaign. “People assume the players are taken care of. But the NFL loves you until you’re injured, and then you’re somebody else.”

Belinda Lerner, head of NFL Player Benefits and Retired Player Programs, said the league has expanded benefits and retroactively given pensions to former players who didn’t qualify before.

‘Pain has just become part of my life’

The benefits players are eligible for if they get hurt and leave the game are agreed to by the NFL and the players union. The league pulls in about $18 billion in annual revenue, and player salaries and benefits are funded by the players’ share of that pot, with the union and league deciding how to divide it.

Whether or not Hamlin tries to return to football, his contract underscores how little young players earn relative to the league’s stars even as they remain one injury away from losing their jobs.

Drafted in the sixth round in 2021, Hamlin signed a four-year, $3.6 million rookie deal that paid him $660,000 the first year and $825,000 the second, the minimum salaries set in the collective bargaining agreement. The average NFL salary is above $2 million, and the league’s stars earn well into eight figures per season.

Hamlin’s contract included a standard provision that would cut his salary in half if he was placed on injured reserve, but the union and the league worked out a deal for him to be paid the full amount. If Hamlin doesn’t return to the field next

season, he can still recoup his entire $940,000 salary as part of an injury-protection benefit that was expanded in the last labor agreement.

There are various resources designed to fill the gaps for unvested players, including the union’s hardship fund and a hospital network across NFL cities where players can get annual checkups and other care at no cost. But in a sport in which careers can end on a single play and leave players with long-lasting effects, they are often not enough.

All injured players can apply for a Line of Duty benefit, a category of disability. Players who are approved receive at least $4,500 per month, or $54,000 a year, for 7 1/2 years.

“It’s basically an injury severance,” said Paul Scott, who worked at the NFL Player Benefits Disability Plan before starting Benefits Huddle, which helps players file claims.

As an administrator at the plan until 2016, Scott fielded calls from players applying for benefits, so he knew firsthand the difficulty in getting approved for them. Scott said only about half the applications for the Line of Duty benefit were approved at the time. The union declined to say what the approval rate is now.

About $320 million will be paid this year to the nearly 3,200 former players receiving some form of disability benefits, according to the union. “We advocate for a fair process to ensure all players are treated equally when they apply,” the union said in a statement.

Motta, so far, is among those applicants who have been denied by the disability board.

Motta said his application for the Line of Duty benefit has been denied based on the disability plan’s point system.

“Because there’s not too many players that come through with a fractured C1 vertebra, they don’t really know how to evaluate the symptoms of that,” he said. “I have neuropathy, tingling, stiffness, headaches. Pain has just become part of my life.”

Motta received workers’ compensation and sued members of the Falcons’ medical staff over the handling of his injury (the suit was resolved out of court). Sitting at a desk in a customer service job made his pain worse, so he now teaches Qigong, a Chinese mind-body practice, and works as a free-dive instructor. He

will meet with a doctor next month to make a final appeal to the disability board.

Even for injured, benefits can be out of reach

In 1981, Kenny Blair, who joined the Philadelphia Eagles as an undrafted rookie, was injured in training camp. When he jumped to catch a pass, a defender hit him in the chest helmet-first, breaking his sternum and sending him into cardiac arrest. Blair spent weeks in a hospital and had a metal plate put in his chest.

To collect his last paycheck, Blair said, he had to sign a letter that turned out to be his release. He never played a game in the league.

Blair does not recall anyone telling him how to apply for benefits, and he was ineligible for a pension or other retiree benefits. He became a high school football coach and still suffers from vertigo and nerve and visual problems.

“It was dirty for them to cut me with an injury like that,” he said. “All I wanted to do was play football.”

Cameron Clark, an offensive lineman drafted by the New York Jets in the fourth round in 2020, collided with a teammate during practice in his second training camp and collapsed. He lost feeling in his entire body, except for his right arm, for more than an hour. A specialist diagnosed him with a spinal-cord injury and told him that if he continued playing football, he risked being permanently paralyzed.

Forced to retire at 24, Clark applied for disability benefits but said he has been denied.

“My career ended due to an injury that happened in an NFL facility,” Clark said. “I’m not looking for any handouts, but it’s a benefit that I earned through being an employee for the NFL that I feel like I rightfully qualify for, that I was denied.”

Whether these players’ appeals are approved or not, the harsh reality that Hamlin’s injury has highlighted is unlikely to change.

“Nobody ever wants to see this happen again, for both humanitarian and business reasons,” said Nellie Drew, a sports law professor at the University at Buffalo. “He’s the poster child for what the NFL does not want us thinking about, which is that the game is very, very dangerous.”
