Fiscal board approves its version of FY 2025 budget

The Financial Oversight and Management Board announced Monday that it certified its $33.3 billion fiscal year 2025 consolidated budget for the Commonwealth of Puerto Rico consisting of the $13.1 billion general fund budget, the $4.9 billion special revenue fund budget, and the $15.3 billion federal fund budget.

The general fund budget increases total spending by 3% from the previous fiscal year. It includes additional funding for social programs, including assistance for aging adults, support for mental health, early childhood resources, and prevention plans against violence. The budget also provides funding for critical services such as education, health, public safety, social welfare, and economic development.

“The fiscal year 2025 budget includes important investments in education, health, and infrastructure to support not only Puerto Rico’s recovery and economic growth but also the quality of life for all Puerto Rico residents,” said Robert F. Mujica Jr., the executive director of the oversight board.

The budget also includes provisions to control government spending outside the budget process. Spending bills or laws must identify how the government intends to pay for the cost of bills or laws.

“Budgets must be balanced, and a budget is not only balanced at the beginning of the year but must remain balanced throughout the fiscal year,” Mujica said. “The government has consistently enacted spending bills in past fiscal years that were inconsistent with the budget and outside of the budget process. This budget process must be reformed. PROMESA [the Puerto Rico Oversight, Management and Economic Stability Act] mandates fiscal responsibility, and responsible budgeting means every dollar spent must be accounted for – in government just like in any household or business.”

15% of the budget, or $4.9 billion, is for education overall.

The budget also includes an additional $100 million for health and welfare investments, including mental health programs, intellectual disability, and medical residencies. Some 20% of the budget, or $6.6 billion, is for health overall.

The budget further includes $242 million in new infrastructure investments for health centers, road maintenance and ferry operations, and water quality and flood control. An additional $132 million in funding goes to municipalities, including $30 million in funding to municipalities needing more significant financial support. The budget includes an extra $43 million to support the 2024 elections, including for ballot printing, additional staffing, and educational advertising.

Mujica said that if the Legislative Assembly decides to reverse the approval of several measures with fiscal impact that were objected to by the oversight board, then the budget could be included in those that count as a requirement for the fiscal entity created under PROMESA to leave Puerto Rico.

Mujica stated that the measures approved at the close of the ordinary session resulted in the budget being out of balance. Therefore, the board certified his version. PROMESA requires, among other conditions, that there be four consecutive balanced budgets approved by consensus.

“For us at the Oversight Board, the approval of the budget is more than just a financial decision; it’s a statement of government priorities and a commitment to invest in the future of the people of Puerto Rico without spending that would tip Puerto Rico back into deficit,” the official added.

The budget includes an additional $432 million in investments in education, including $121 million in commonwealth funding for the University of Puerto Rico (UPR), contingent on UPR establishing and committing to goals and milestones for fostering academic excellence, economic development and financial responsibility. Vieques prepares for effects of Hurricane Beryl’s passage to the south

Vieques Mayor José “Junito” Corcino Acevedo announced Monday the preventive activation of the Emergency Operations Center (COE by its initials in Spanish) with the passage of powerful Hurricane Beryl, which is expected to pass between 250 and 300 miles south of Puerto Rico beginning this morning.

Under preventive activation, the COE begins its work expeditiously.

Dangerous swells and riptides were expected from the storm in southern Puerto Rico.

“Since last week we have monitored the development of Hurricane Beryl and its trajectory. Although experts indicate that this impressive atmospheric phenomenon will pass about 300 miles south of the island, we made the decision to activate, as a preventive measure, the COE of the municipality of Vieques,”

Corcino Acevedo said in a press release. “Our COE, which has the latest technology, as well as the trained personnel to handle any situation, is ready to attend to any emergency that may occur with the passage of this historic hurricane through the south.”

Corcino added that the offshore island municipality has the María M. Simons school facilities to serve as a shelter in case of an emergency.

The Vieques COE is located in the old Mercedes de Ruiz (Milivy) school in the Santa María neighborhood.

“Our COE is made up of elements of the municipal police, the emergency corps of the municipality, as well as state agencies such as the departments of Public Safety, Family, Education -- for the shelters -- and Health, in addition to the Bureaus of Police, Firefighters and Medical Emergencies,” the mayor added. “We also have

liaisons with the National Guard and the Federal Emergency Management Agency (FEMA), as well as the federal government’s Fish and Wildlife Service. We have first-class radio frequency communication systems and all-terrain vehicles for emergency interventions.”

The COE also has a 30-ton emergency

electrical generator system and a second backup system based on solar technology that would provide electricity to the COE uninterruptedly.

As of 2 p.m. Monday, the eye of Hurricane Beryl was located near latitude 12.8 North, longitude 62.3 West. The Category 4 storm with maximum sustained winds near 150 miles per hour (240 kilometers per hour), with higher gusts, was moving toward the west-northwest at near 20 mph (31 km/h), having made landfall in the Windward Islands early Monday, according to the National Hurricane Center (see related story on page 9).

The center of Beryl was to move away from the southern Windward Islands on Monday night and pass swiftly westward to west-northwestward during the next few days. On the forecast track, the center of Beryl was to move across the southeastern and central Caribbean Sea from Monday night through Wednesday.

LUMA releases plan to deal with natural disasters and severe weather

With Hurricane Beryl entering the eastern Caribbean on Monday as the earliest Category 4 storm on record and on a track to the south of Puerto Rico, LUMA Energy announced it submitted the fourth edition of its Emergency Response Plan (ERP) detailing its preparation for emergencies, such as hurricanes, earthquakes and severe weather.

ERP 2024 defines how LUMA, the private operator of the Puerto Rico Electric Power Authority’s (PREPA) transmission and distribution system, prepares for and responds to

emergencies following industry best practices, including the National Incident Management System established by the Federal Emergency Management Agency (FEMA).

“Emergency preparedness is a priority at LUMA,” LUMA Energy President & CEO Juan Saca said. “Emergencies can be challenging, but at LUMA we are focused on planning, preparation and response. That is our responsibility. When disaster strikes, our goal is to work closely with our local and federal partners and mobilize all of our efforts to ensure we are ready and restore service as quickly and safely as possible.”

Some measures to prepare for emergen-

cies include two emergency drills to practice the response in coordination with Puerto Rico and federal government agencies, such as the island Bureau of Emergency Management and Disaster Administration, commonly known as NMEAD, FEMA, PREPA and the Central Office for Recovery, Reconstruction and Resilience.

“While the significant steps LUMA has taken over the past three years to install stronger poles, modernize substations, clear hazardous vegetation, and deploy automation devices across the island have made the system more reliable and resilient, the power [grid] remains fragile compared to other modern systems,” the company said. “Even as we prepare to respond

to any emergency, the reality is that no utility company, no matter where it is located, can guarantee electrical service during a storm. Industry-wide, it is vitally important that our customers take action now to prepare for potential prolonged weather-related disruptions and, more importantly, to stay safe.”

To prepare its 1.5 million customers, LUMA will begin a multi-month emergency preparedness campaign to provide essential emergency tips and resources. As part of that effort, LUMA will remind customers to stay away from power lines and to report an electrical emergency that requires immediate attention by calling 1-844-888-5862 (LUMA).

Energy Bureau approves 4.7% increase in energy bill

The Puerto Rico Energy Bureau (PREB) has approved an increase in the electricity bill of 4.7% that was to be applied beginning Monday and remain in effect through Sept. 30.

The result will be a price, for an average residential customer with a consumption of 800 kilowatt-hours (kWh) per month, of 23.779 cents per kWh, not the 24.086 cents

originally requested by LUMA Energy, the private operator of the island’s electric power transmission and distribution system.

Currently the cost per kWh is 22.72 cents.

“The role of the Bureau is to make a balance in favor of the public interest. That implies ensuring that excessive expenses are not passed on to the consumer, but it also means avoiding the managerial responsibilities that led the [Puerto Rico Electric Power] Authority to bankruptcy,” PREB Chairman Edison Avilés

Deliz in a written statement. “In this reconciliation, the Bureau avoided a greater increase than necessary, but was forced to recover all the costs associated with the purchase of fuel.”

Avilés Deliz noted that LUMA Energy had requested a cost per kWh of 24.086 cents.

“As a result of certain discrepancies associated with the power purchase clause identified by the Energy Bureau during the evaluation process, a quarterly adjustment 1.3 percent below the requested one was approved,” he said.

The PREB’s resolution explains that what was invoiced by LUMA for the purchase of fuel during the previous quarter was below the real cost for a total of $56,663,337.32. That amount will be recovered on the bill during the quarter beginning Monday, July 1. Similarly, it details that LUMA overbilled $8,294,423.32 for the purchase of energy, an amount that will be credited to customers on the bill during the next quarter.

Citizens gain access to thousands of digital PR historical documents

Starting this week, the general public will have access to thousands of historical documents in the Puerto Rico General Archive from anywhere in the world.

The Institute of Puerto Rican Culture (ICP by its Spanish initials) recently presented the new “Digital Collections of the General Archive of Puerto Rico,” a project made possible by the Andrew W. Mellon Foundation.

“We are proud to officially present this important and ambitious project to digitize the General Archive of Puerto Rico [AGPR] collections. Thanks to this great effort, thousands of documents will now be accessible to people from anywhere in the world,” ICP Executive Director Carlos Ruiz said. “The most recent technology was used for this project, allowing us to adapt these collections to modern times and contribute to preserving and accessing Puerto Rico’s documentary collection.”

The project, which began in 2020, promotes preservation and seeks to ensure and facilitate access to the AGPR collections. In the first phase, more than 3,500 documents and 190,000 pages of manuscripts, newspapers, photographs, graphics, scores, and magazines from different fundamental collections kept at the AGPR are included.

Hilda T. Ayala González, the general archivist of Puerto Rico, expressed satisfaction with the result, stating that “after four years of work, we will be able to enjoy this beautiful project of preservation and access to our heritage collections.”

“It has been a massive effort, an extraordinary team effort to achieve the publication of this platform that undoubtedly begins a new era in the General Archive of Puerto Rico,” she said. “I am extremely grateful and indebted to everyone who has supported this project to see the light. I hope that you can enjoy this new experience. Still, above all that, it continues to highlight the importance of the General Archive of Puerto Rico for the country.”

The portal’s design stands out for being simple and easy to navigate. The platform will allow users to search for keywords, apply filters to reduce the number of results, and browse by collections, document type, language, date, topic, and place. The system will be

fed new content monthly. Optical character recognition (OCR) technology was used in the digitization process. OCR software allows the user to identify text in an image and conduct word searches.

Some of the collections that will be available in the first phase are: the Newspaper Library Collection, the Minutes of the Cabildo of San Juan Bautista de Puerto Rico of the San Juan Municipal Fund, and the 18-volume version published by the Municipality of San Juan; a selection from the Musical Scores Collection; and watercolors from the Agustín Stahl Collection. Also found in the initial selection are the Railways and Trams series and magazines of the Public Works Fund, the

San Juan and Puerta de Tierra barracks of the Police News Series of the Puerto Rico Police Fund, and the Publications Subseries of the Fortaleza Fund.

Among the photographic collections, a part of the Photograph Series of the Felisa Rincón de Gautier Collection is included, along with part of the Negative Series of the Institute of Puerto Rican Culture and of the Negative Subseries of the Police Intelligence Division Subfund. Additionally, audiovisual collections are included such as WKAQTV’s Telemundo newscast and audio recordings from the Police Intelligence Division Subfund. Likewise, the portal will continue to be supplied with documents that the ICP manages as part of agreements reached with different international entities such as the State Archives of Spain, the State Archives of the United States and Family Search Inc. Through a $2 million grant, the Andrew W. Mellon Foundation established the physical and digital infrastructure to create the AGPR Digital Collections platform. The foundation will also support a second phase with a new investment of $1.7 million. With that investment, in addition to digitizing heritage collections, the project seeks to expand and develop a course on digitizing cultural heritage and translating federal guides, better known as FADGI. This second phase will culminate with a congress of institutions that keep archives about Puerto Rico in order to learn about their needs and support disseminating their valuable resources.

House pays homage to departing member Ángel Bulerín Ramos

The New Progressive Party delegation in the island House of Representatives, led by its minority leader Carlos “Johnny” Méndez Núñez, highlighted the work of Rep. Ángel Bulerín Ramos on Monday before his retirement from the Legislative Assembly after 55 years of public service, including eight four-year terms as a representative and one as mayor of Río Grande.

“The history of the Legislative Assembly is marked by the legacy of many leaders. Among these must be mentioned the colleague and friend Ángel Bulerín Ramos, who has served for the past five decades in public service, always ensuring to improve the quality of life of the residents of the eastern part of the island, particularly his beloved municipality of Río Grande,

as well as Canóvanas and Loíza,” Méndez Núñez said. “Bulerín Ramos is an example of dedication, commitment and hard work. His passion for the constituents will be missed by all.”

Sunday marked the last ordinary session in which Bulerín Ramos, who is retiring at the end of the year, would participate.

“Since being sworn in as representative in 1993, Bulerín has been key in the development of the Eastern region,” the former House speaker continued. “He was one of the promoters of one of the most important road infrastructure projects in the past 50 years, the PR-66 state highway, better known as ‘Route 66.’ He also promoted the development of a breakwater for the tourism sector of Piñones, in Loíza, as well as numerous infrastructure projects in Canóvanas. Always working, that’s Bulerín.”

Supreme Court says Trump is partly shielded from prosecution

The Supreme Court ruled on Monday that former President Donald Trump is entitled to substantial immunity from prosecution, a decision that will almost surely delay the trial of the case against him on charges of plotting to subvert the 2020 election past the coming election in November.

The vote was 6-3, dividing along partisan lines.

Chief Justice John Roberts, writing for the majority, said Trump had at least presumptive immunity for his official acts. He added that the trial judge must undertake an intensive factual review to separate official and unofficial conduct and to assess whether prosecutors can overcome the presumption protecting Trump.

That will entail significant delays, and the prospects for a trial before the election seem vanishingly remote. If Trump prevails at the polls, he could order the Justice Department to drop the charges.

Broad immunity for official conduct is needed, the chief justice wrote, to protect “an energetic, independent executive.”

“The president therefore may not be prosecuted for exercising his core constitutional powers, and he is entitled, at a minimum, to a presumptive immunity from prosecution for all his official acts,” Roberts wrote. “That immunity applies equally to all occupants of the Oval Office, regardless of politics, policy or party.”

In dissent, Justice Sonia Sotomayor wrote that the decision was gravely misguided.

“Today’s decision to grant former presidents criminal immunity reshapes the institution of the presidency,” she wrote. “It makes a mockery of the principle, foundational to our Constitution and system of government, that no man is above the law.”

Roberts wrote that it was not the Supreme Court’s job to sift through the evidence and to separate protected conduct from the rest. “That analysis,” he wrote, “ultimately is best left to the lower courts to perform in the first instance.”

But he issued guideposts.

Trump, he wrote, is “absolutely immune from prosecution for the alleged conduct involving his discussions with Justice Department officials.”

The trial judge, the chief justice wrote, should determine whether prosecutors can overcome Trump’s presumed immunity for his communications with Vice President Mike Pence.

”We therefore remand to the district court to assess in the first instance, with appropriate input from the parties, whether a prosecution involving Trump’s alleged attempts to influence the vice president’s oversight of the certification proceeding in his capacity as president of the Senate would pose any dangers of intrusion on the authority and functions of the executive branch,” he wrote.

Other parts of the indictment against Trump, the chief justice said, “requires a close analysis of the indictment’s extensive and interrelated allegations.”

utive power and a detailed recipe for delay.

In dissent, Sotomayor wrote that “the long-term consequences of today’s decision are stark.”

“The court effectively creates a law-free zone around the president, upsetting the status quo that has existed since the founding,” she wrote, adding: “The president of the United States is the most powerful person in the country, and possibly the world. When he uses his official powers in any way, under the majority’s reasoning, he now will be insulated from criminal prosecution.”

She gave examples: “Orders the Navy’s SEAL Team 6 to assassinate a political rival? Immune. Organizes a military coup to hold onto power? Immune. Takes a bribe in exchange for a pardon? Immune. Immune, immune, immune.”

Trump contended that he is entitled to absolute immunity from the charges, relying on a broad understanding of the separation of powers and a 1982 Supreme Court precedent that recognized such immunity in civil cases for actions taken by presidents within the “outer perimeter” of their official responsibilities.

Lower courts rejected that claim.

“Whatever immunities a sitting president may enjoy,” Judge Tanya S. Chutkan of U.S. District Court in Washington wrote, “the United States has only one chief executive at a time, and that position does not confer a lifelong ‘get out of jail free’ pass.”

A unanimous three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit agreed. “For the purpose of this criminal case, former President Trump has become citizen Trump, with all of the defenses of any other criminal defendant,” the panel wrote in an unsigned decision. “But any executive immunity that may have protected him while he served as president no longer protects him

against this prosecution.”

In agreeing to hear the case, the Supreme Court said it would decide this question: “whether and if so to what extent does a former president enjoy presidential immunity from criminal prosecution for conduct alleged to involve official acts during his tenure in office.”

The court heard two other cases this term concerning the attack on the Capitol on Jan. 6, 2021.

In March, the court unanimously rejected an attempt to bar Trump from the ballot under Section 3 of the 14th Amendment, which makes people who engage in insurrection ineligible to hold office. The court, without discussing whether Trump was covered by the provision, ruled that states may not use it to exclude candidates for the presidency from the ballot.

On Friday, the court ruled that federal prosecutors had improperly used an obstruction law to prosecute some members of the pro-Trump mob that stormed the Capitol on Jan. 6. Two of the four charges against Trump are based on that law.

The court decided the case restoring Trump to the ballot at a brisk pace, hearing arguments a month after agreeing to and issuing its decision a month after that.

The immunity case has moved at a considerably slower pace. In December, in asking the justices to leapfrog the appeals court and hear the case immediately, Jack Smith, the special counsel overseeing the prosecution, wrote that “it is of imperative public importance that respondent’s claims of immunity be resolved by this court.” He added that “only this court can definitively resolve them.”

The justices denied Smith’s petition 11 days after he filed it, in a brief order without noted dissents.

After the appeals court ruled against Trump, he asked the Supreme Court to intervene. Sixteen days later, on Feb. 28, the court agreed to hear his appeal, scheduling arguments for almost two months later, on the last day of the term. Another two months have passed since then.

At the argument, several of the conservative justices did not seem inclined to examine the details of the charges against Trump. Instead, they said, the court should issue a ruling that applies to presidential power generally.

“We’re writing a rule for the ages,” Justice Neil Gorsuch said.

Loss of Chevron doctrine will have ‘chilling effect’ on public health, experts say

The Supreme Court decision overturning the so-called Chevron doctrine is likely to hamstring the federal government’s public health efforts and invite waves of litigation from parties opposed to regulations aimed at safeguarding Americans, scientific and legal experts said.

deadly pandemic.

“We anticipate that today’s ruling will cause significant disruption to publicly funded health insurance programs, to the stability of this country’s health care and food and drug review systems, and to the health and well-being of the patients and consumers we serve,” several of the nation’s largest health organizations, including the American Public Health Association and the American Cancer Society, said in a joint statement Friday.

Federal officials will feel a “chilling effect” that will slow regulations in areas in which they do not have explicit authority, said Dr. Reshma Ramachandran, co-director of the Yale Collaboration for Regulatory Rigor, Integrity and Transparency, an initiative that studies medical product evaluations and coverage in order to improve patient outcomes.

Instead of hiring more scientific and technological experts, federal agencies will have to arm themselves with lawyers, she predicted.

Zachary L. Baron, director of the Health Policy and the Law Initiative at the O’Neill Institute at Georgetown Law in Washington, said one result of the ruling “is likely to be an increase in litigation and an increase in uncertainty.”

“It seems like, as Justice Kagan wrote in her dissent, the court is flipping the script today, giving more authority to courts and judges and less authority to federal agencies and the expertise that they have,” Baron said.

Now that this authority has been curtailed, public health agencies simply may regulate less, a goal long sought by proponents of a smaller federal government and companies eager to pursue unfettered growth.

“If agencies know that everything they do that is not perfectly aligned with a statute will be scrutinized by the court, they will be less likely to promulgate expansive rules or swift rules,” said Selina Coleman, a health care partner at Reed Smith, a large law firm.

Other experts also predicted an explosion in litigation and uncertainty. The ruling will “signal to industry and aggressive state attorneys general to open the floodgates to more litigation to block federal regulatory efforts,” Baron said.

Moving public health decisions from federal agencies to Congress and the courts will lead to “incoherence, chaos and endless litigation,” said Paul Billings, national senior vice president of public policy at the American Lung Association.

Friday’s ruling was one in a string of court decisions in recent years in which the court has given itself “more and more power over every significant policy dispute, and closing the door on agency experts that have been working on these issues for years,” he said.

Indeed, Elena Kagan’s dissent offered an example of the type of detailed scientific question judges may now face in court: When does an alpha amino acid polymer qualify as a protein?

“I don’t know many judges who would feel confident resolving that issue,” she wrote. “(First question: What even is an alpha amino acid polymer?)”

The Food and Drug Administration, she added, has scores of experts who could “collaborate with each other on its finer points, and arrive at a sensible answer.”

The Chevron doctrine has its roots in public health: a 1984 Supreme Court case involving air pollution. At issue was the Environmental Protection Agency’s interpretation of an ambiguous provision in the Clean Air Act that affected companies subject to pollution controls.

The court determined that federal agencies should receive “deference” for reasonable interpretations of gaps or ambiguities in the statutes that Congress could not have anticipated when it crafted the laws.

The court gave federal agencies leeway because of their subject matter and scientific expertise, experience and political accountability.

The Supreme Court and lower courts have already chipped away at the authority of regulatory bodies to make public health decisions. Many such rulings were handed down during the coronavirus pandemic.

In November 2021, the Supreme Court upheld an injunction that barred the Centers for Disease Control and Prevention from enforcing a national moratorium on evictions from rental housing, despite fears that a wave of such displacements would exacerbate the spread of COVID-19.

In January 2022, the Supreme Court ruled that the Occupational Safety and Health Administration could not require large businesses to vaccinate their employees against COVID. In April 2022, a federal judge in Florida struck down a CDC mandate that required passengers to wear masks on public buses, trains and planes. Friday’s Supreme Court decision will task Congress with spelling out exactly what agencies such as the CDC can and cannot do, several observers said. “Nobody has any confidence that Congress can get its act together to do that,” said Dr. Georges C. Benjamin, executive director of the American Public Health Association.

“I think the decision as written solidifies employment for lawyers and judges, and undermines the authority of experts,” he added. Other scientists also expressed doubt that Congress or the judiciary could remain abreast of constantly evolving scientific evidence. “To keep up with that pace of change, even for a medical or scientific professional, is very challenging,” said Karen Knudsen, CEO of the American Cancer Society.

Labor Dept: Minimum wage hike goes into effect regardless of lawsuit

Labor and Human Resources Secre-

tary Gabriel Maldonado-González said Monday that until a court says otherwise, starting that same day the minimum wage was to go up to $10.50 an hour.

The labor chief’s remarks were made after six business groups filed a writ of mandamus in the Court of First Instance of San Juan last week to stop the minimum wage hike from going into effect.

“Regardless of positions to the contrary, and until a court orders otherwise, the minimum wage in Puerto Rico as of July 1, 2024 is $10.50 per hour, for all non-exempt employers and employees covered by the Fair Labor Standards Act (FLSA), except for workers in the agricultural industry and the government, [and] except public corporations operating as a private business,” Maldonado-González said.

Failure to comply with the applicable state minimum wage could be subject to claims, fines and penalties as provided by law.

Sen. Thomas Rivera Schatz also insisted that there is no reason why the increase in the minimum wage should not be allowed to go into effect. He said all economic indicators point toward a growth in the economy.

“We already sponsor the salary increase for public service; for private service, several incentives were approved with the consent of legislators from many parties,” Rivera Schatz said. “So, that is the law and you have to abide by it and I understand that there is the capacity. In fact, economic indicators show that Puerto Rico is growing economically, which has not happened in a long time.”

“In terms of employment, unemployment is at its lowest and the labor participation rate is at its highest,” the former Senate president added. “So, the

economy is showing signs of recovery and growth. Therefore, there is no reason why the increases should not be sponsored or granted.”

The Puerto Rico Chamber of Commerce, the Retail Trade Association, the Manufacturers Association, the Food Marketing, Industry and Distribution Chamber, the Restaurant Association and the Puerto Rico Hotel and Tourism Association filed the suit against the government.

As a result of Act 47 of Sept. 21, 2021, the increase to the local minimum wage, from $9.50 to $10.50 per hour, was to take effect July 1 after the Minimum Wage Evaluation Commission, the working group created as a result of the statute, approved the increase.

The business groups, however, argued that the hike is illegal because only three members voted in favor of the hike when the law says all members have to vote for it.

Chicken Soup for the Soul Entertainment files for bankruptcy

Chicken Soup for the Soul Entertainment, the parent company of the movie rental company Redbox, which is known for its distinctive red kiosks, filed for Chapter 11 bankruptcy protection on Friday.

In the filing, Chicken Soup listed debts of about $970 million, and total assets of about $414 million. It owes millions to entertainment and media companies, including Universal Studios, Sony Pictures and BBC Studios Americas, as well as some retailers, such as Walgreens and Walmart, according to court filings.

Chicken Soup for the Soul was founded in 1993 by two motivational speakers, Jack Canfield and Mark Victor Hansen. The company’s inspirational book series, with titles including “From Lemons to Lemonade” and “Angels Among Us,” contains collections of stories for specific audiences, for example new mothers or cat lovers. Its original book, published more than 30 years ago, dispensed life advice

and stories of overcoming obstacles with the hope that it would heal readers’ souls just as “chicken soup has a healing effect on the body of the ill.”

The company, which has published more than 300 titles, has sold more than 500 million copies worldwide.

Chicken Soup for the Soul Entertainment is separate from its book-publishing arm, which is unaffected by the bankruptcy filing. It was not immediately clear whether the Chapter 11 filing would affect the Redbox operation. The company declined to comment Sunday.

In 2022, Chicken Soup for the Soul Entertainment acquired Redbox, a business founded in 2002 and recognized for its bright red DVD rental kiosks outside supermarkets and pharmacies. Redbox has about 27,000 kiosks across the United States.

William Rouhana became the company’s CEO in 2008 and ran the company with his wife, Amy Newmark, publisher and editor-in-chief of the book division.

Rouhana tried to expand the com-

pany into different products, including a line of soups, which ultimately failed. He founded the entertainment division of Chicken Soup for the Soul in 2016.

The company requested relief to pay its employees, which it has been unable to do “for the two-week period ending on June 14, 2024.” Chicken Soup for the Soul Entertainment has about 1,000 full- and

part-time workers.

The company reported $636 million in net income loss in 2023, compared with $111 million in 2022, according to a filing with the U.S. Securities and Exchange Commission. At the time that Chicken Soup for the Soul acquired Redbox, the movie rental company had more than $300 million in debt.

Apple, Tesla lift stocks to higher close in light pre-holiday trading

Megacap growth stocks led by Apple and Tesla lifted the tech-heavy Nasdaq to a higher close on Monday, while the Dow and the S&P 500 also eked out slight gains in light pre-holiday trading.

Investors were waiting for U.S. labor market data due later this week for clues about the interest rate outlook.

Apple climbed 2.9%, Microsoft rose 2% and Amazon. com ended 2.2% higher, boosting the Nasdaq.

“The most important driver of earnings is GDP and the economy still looks very healthy to us,” said Ben Snider, a senior equity strategist at Goldman Sachs Research.

“We’re forecasting economic growth this year in the U.S. - over trend - above 2%, so underlying revenue growth still looks strong. On top of GDP, profit margins seem to be recovering after a pretty rough couple of years.”

A quarter of earnings on the S&P 500 index comes from the largest technology stocks, which also look strong, he said.

Shares of automaker Tesla surged 6.1% ahead of second-quarter vehicle delivery data.

Wells Fargo added Tesla stock to its third-quarter “Tactical Ideas list” yet kept its “underweight” rating and expressed concerns about slowing growth in deliveries and a risk of price cuts.

Shares of semiconductor makers Advanced Micro Devices dropped 2.8% and Arm Holdings fell 2.9%, pulling the Philadelphia SE Semiconductor index close to a oneweek low.

Real estate stocks, also seen as a bond proxy, dropped almost 1%, as U.S. Treasury yields jumped to multi-week highs. But higher yields often boost bank profits so the S&P 500 banks index jumped to its highest in more than a month.

JP Morgan Chase shares were at an all-time high after the biggest U.S. bank on Friday hiked its dividend to $1.25 a share from $1.15. Its board also authorized $30 billion in share buybacks, effective July 1.

Chewy dropped 6.7%, reversing sharp early gains, after stock influencer Keith Gill, also known as “Roaring Kitty”, disclosed a 6.6% stake in the pet products retailer.

Trading volumes were thin, with the equity market set to shut on Thursday for U.S. Independence Day. Volume on

New York Fed President John Williams noted he still believes price pressures are moderating back to the 2% target.

The Dow Jones Industrial Average rose 50.66 points, or 0.13%, to close at 39,169.52, the S&P 500 gained 14.61 points, or 0.27%, to 5,475.09 and the Nasdaq Composite gained 146.70 points, or 0.83%, to 17,879.30.

Hurricane Beryl moves into the Caribbean as a Category 4 storm

Hurricane Beryl made landfall on Carriacou Island, north of Grenada, on Monday morning as an “extremely dangerous” Category 4 hurricane and was expected to bring life-threatening winds and storm surges to islands across the Caribbean.

Here are key things to know about the storm.

— Barbados largely avoided the worst effects of Beryl, officials there said Monday morning. The storm was expected to continue across the Windward Islands before traversing the central Caribbean Sea through the middle of the week.

— The storm surge accompanying Beryl is expected to raise water levels by up to 9 feet near where it makes landfall. Flash flooding is also a concern as the storm brings 3 to 6 inches of rain.

— By the weekend, the storm could make it into the Gulf of Mexico, but it is “too soon” to discuss what happens if and when it does, forecasters said Monday morning.

When Beryl developed into a Category 4 hurricane Sunday, it was the earliest in a season that a storm had reached such strength. The earliest Category 4 hurricane on record had been Hurricane Dennis on July 8, 2005.

Beryl, the first hurricane of the 2024 season, was downgraded slightly early Monday but strengthened again to a Category 4 storm, with maximum sustained winds near 150 mph, according to the National Hurricane Center, which cited an observer. The center said in an advisory that lifethreatening winds and storm surges were expected within hours in the Windward Islands, southeast of Puerto Rico and north of Venezuela.

A hurricane warning was in effect for Barbados, St. Vincent and the Grenadines, Grenada, and the island of Tobago. Martinique, Trinidad and St. Lucia were under a tropical storm warning, while parts of Haiti and the Dominican Republic were under a tropical storm watch.

Officials in Barbados said Monday morning that the island had been spared from the worst of the hurricane, as it passed close to the southern tip of the country.

Hurricanes in the Atlantic Ocean are now twice as likely to grow from a weak storm into a major Category 3 hurricane or higher within just 24 hours, according to a study published last year.

Devastating winds from Beryl will occur where the eye wall, the area that surrounds the eye of a hurricane, scrapes across the islands. Across the higher elevations of the hills and mountains of the islands, the winds might be even stronger.

Beryl is the third-earliest major hurricane to form in the Atlantic, according to Philip Klotzbach, an expert in seasonal hurricane forecasts at Colorado State University. The

only hurricanes to have formed earlier in a calendar year were Alma on June 8, 1966, and Audrey on June 27, 1957. Both made landfall on the U.S. coastline in the Gulf of Mexico: Alma near St. Marks, Florida, and Audrey near Port Arthur, Texas.

As officials across the Caribbean braced for the storm to arrive, Barbados appeared to have avoided the worst effects of Beryl. By 5 a.m. Monday, sustained wind speeds of over 45 mph were recorded at the Grantley Adams International Airport in the southern parish of Christ Church, which has been taking the brunt of Beryl. Gusts up to 60 mph, accompanied by bouts of driving rain were reported throughout the southern half of the island.

There were no overnight reports of injuries, Wilfred Abrahams, minister of home affairs and information, said during a broadcast from the emergency operations center in a daybreak broadcast.

“We dodged a bullet,” he said. “Or we’re in the process of dodging a bullet, but there is still a lot of weather to come.”

In Grenada on Monday, Prime Minister Dickon Mitchell urged people to stay indoors.

“With God’s blessing, we hope the damage will be minimal,” he said. “It is absolutely critical that we remain indoors, that we hunker down, that we find the safest places within our homes, within the shelters, within wherever you are to try and remain safe,” he said.

Ralph Gonsalves, prime minister of St. Vincent and the Grenadines, on Sunday urged residents to take the storm seriously, saying that many buildings could lose their roofs.

In St. Lucia, Prime Minister Philip J. Pierre announced a countrywide shutdown at 8:30 p.m. Sunday, with schools and businesses remaining closed Monday.

After Beryl passes through the eastern Caribbean Islands on Monday, it is expected to continue pushing west over the Central Caribbean, skirting just south of Jamaica in the middle of the week and into the Yucatan Peninsula by the weekend. There is some indication that the hurricane may weaken over the central Caribbean.

This hurricane season is expected to be busy.

Forecasters have warned that the 2024 Atlantic hurricane season could be much more active than usual.

In late May, the National Oceanic and Atmospheric Administration predicted 17 to 25 named storms this year, an “above-normal” number and a prediction in line with more than a dozen forecasts earlier in the year from experts at universities, private companies and government agencies. Hurricane seasons produce an average of 14 named storms.

Far right’s surge in France lays bare deep divisions

For many, France felt like a very different place on Monday.

The results from the first round of legislative elections, held on Sunday, revealed a country deeply fractured, with a surging far right winning a record number of votes and the near collapse of President Emmanuel Macron’s centrist party.

“The far right at power’s door,” the cover of Le Parisien, a daily newspaper, pronounced the morning after the first half of the snap election called by Macron.

“Twelve million of our fellow citizens have voted for a far right party that is clearly racist and anti-Republican,” the left-leaning Libération newspaper declared in an editorial, referring to Marine Le Pen’s National Rally party. “The head of the state threw France under the bus, the bus continued without slowing down, and now it’s parked in front of the gates of Matignon” — the prime minister’s office.

If the National Rally takes an absolute majority in the runoff on Sunday, Macron will be forced to appoint a prime minister from its ranks, who will in turn form a Cabinet.

There was a sense of whiplash and disbelief at the political nosedive of Macron’s party, which with its allies has had the most seats, but not an absolute majority, in the National Assembly. That centrist coalition finished a distant third in the first round of the two-

round electoral race. Only two of his candidates — and not one of his ministers who were running for a seat — got enough votes to be reelected without a runoff for their positions, compared with 37 members of the far-right National Rally, and 32 of the left-wing coalition of parties called the New Popular Front, which came in second.

The results of the first round of voting do not typically provide a reliable projection of the number of parliamentary seats each party will secure. But the National Rally now

looks very likely to be the largest force in the powerful National Assembly. The question is whether it will get enough seats to command an absolute majority.

If that does not happen, the National Assembly will most likely be ungovernable, with Macron’s centrist party and its allies squeezed between the right and the left and with greatly diminished power.

“End of an era,” declared the front page of Les Echos, the main business daily.

“When historians look back on the dissolution, they will have only one word: disaster!” stated an editorial in the conservative newspaper Le Figaro.

“Emmanuel Macron had everything, or almost everything,” it continued. “He lost everything.”

On the ground, the reaction to the vote reflected the country’s divisions. In the north, considered a stronghold of the far-right National Rally, there was jubilation.

“I’m going to party all night long,” Manuel Queco, 42, a contractor, said in a local hall in the town of Hénin-Beaumont, where Le Pen was receiving one round of congratulations after another on Sunday evening, after she was elected outright in her own race. As the crowd of National Rally supporters burst into a round of the national anthem, Queco raised his glass of Champagne. “I’ve been waiting for them to win since I was 18 years old.”

In Paris, the results of the first round revea-

led an electoral map that had blocked out the National Rally almost entirely, but was divided between the New Popular Front and the president’s party. Yet, the predominant feeling in the Place de la République, where thousands of left-wing supporters gathered Sunday night, was one of sorrow and commiseration.

“I never thought I would see this in my life — the far right leading the country,” said Camille Hemard, 50, a professor of Latin, Greek and French at an advanced preparatory college. She had brought along her 16-yearold daughter to seek solace in the crowd that danced and chanted, “Everyone hates the fascists.”

She added, “I had hoped my children would not know this.”

From the radio, television sets and news websites, pollsters reminded people that not everything was decided. Only 76 of the country’s 577 legislative seats were won outright. A battle would ensue for the remaining 501 this week, until the definitive vote on Sunday. The question many were asking was how many candidates would drop out of three-way races in a strategic move to block the far right from winning.

Official results published by the Interior Ministry showed that the National Rally and its allies won about 33% of the vote. Macron’s centrist Renaissance party and its allies took about 20%, and the New Popular Front won about 28% of the vote.

Tropical Storm Chris makes landfall in eastern Mexico

Tropical Storm Chris made landfall on the eastern coast of Mexico late Sunday and weakened to a tropical depression hours later, the National Hurricane Center of the United States said.

The center of the storm made landfall in the state of Veracruz, the Hurricane Center said, just before midnight local time. Chris was the third named storm in an already active Atlantic hurricane season.

Hurricane Beryl was also moving west toward the Caribbean as a dangerous Category

4

hurricane early Monday. That prompted emergency preparations over the weekend across the Windward Islands, southeast of Puerto Rico and north of Venezuela.

Chris’s maximum sustained winds at landfall were around 40 mph, more than 30 mph below hurricane strength, according to the National Hurricane Center. A tropical storm warning was in effect on Sunday for part of Mexico’s eastern coast.

By 5 a.m. Eastern time, the storm’s winds had weakened to 35 mph, and Mexico had discontinued its tropical storm warning. But forecasters warned the storm could bring 4 to 8 inches of rain across portions of eastern Mexico through Monday morning, and more across higher terrain, bringing the threats of flooding and mudslides.

Alberto, the first named storm of the Atlantic hurricane season, made landfall in eastern Mexico on June 20. Alberto unleashed heavy rain, flooding and gusty winds. Authorities said that at least four people died in events related to that storm.

This hurricane season was expected to be busy.

The seasonal hurricane outlooks were notably aggressive because forecasters looking at the start of the season saw a combination of circumstances that didn’t exist in records dating to the mid-1800s: record warm water temperatures in the Atlantic Ocean and the potential formation of the weather pattern known as La Nina.

La Nina occurs in the Pacific because of changing ocean temperatures, and it affects weather patterns globally. When it is strong, it typically provides a calm environment in the Atlantic; this allows storms to develop more easily and to strengthen without interference from wind patterns that might otherwise keep them from organizing.

The dramatic dangers of a second Biden administration

Now that the first general-election debate of 2024 has removed any doubt about the necessity of removing President Joe Biden from the Democratic ticket, you will hear a lot of serious liberals make the case for Biden’s removal primarily as a means to defeat Donald Trump. Biden must step aside, the argument will go, because he’s going to lose the election, and only a different Democrat can save the country from Trumpian misrule.

This is a necessary argument for its intended audiences: Americans who fear Trump above all else and a Democratic Party motivated by partisan self-interest. It is emphatically the case that sticking with Biden now gives Trump his best chance at an easy victory — a better chance even than nominating Kamala Harris, who might be a terrible candidate but would still be better than her boss at this point. It is definitely true that if you believe America needs to be saved from Trumpism 2.0, continuing with Biden is a grave dereliction.

But it’s also important, especially for those of us who are not Democratic partisans, to emphasize that declining to nominate Biden is essential not just if you hope to avert a second Trump term. It’s essential if you want to protect the country from a second Biden term — from the ways that his obvious deterioration endangers the country that he nominally leads.

That is to say, if a genie or fairy godmother appeared to Barack Obama, Nancy Pelosi and Jill Biden and granted them the foreknowledge that Joe Biden would somehow eke out a victory over Trump, the prospect of Biden being

president for four more years should be enough to compel some kind of serious action now.

Here, the frequent analogy to a figure like Ruth Bader Ginsburg doesn’t go quite far enough. Ginsburg’s staying too long in office was a sin against her own liberal principles, which suffered a great setback when a Republican president appointed her replacement. But the decline of a Supreme Court justice is more manageable and less perilous, for the court and for the country, than the decline of a U.S. president.

Yes, presidential aides and Cabinet members can manage some aspects of the job for a fading chief executive. But they aren’t law clerks drafting opinions on a leisurely timeline. Their boss sits at the heart of a global network of alliances; commands the world’s most powerful military, which includes a vast nuclear deterrent; and is charged with maintaining a Pax Americana that’s currently under threat from an alliance of revisionist powers. The entire global order will be endangered if there is an empty vessel in the Oval Office, a headless superpower in a destabilizing world.

Back in the days when presidential unfitness was a bit more of a novelty, I made this argument about Trump. Before his election in 2016, I warned that our rivals would be eager to test a president with no experience or self-discipline and that “he need only be himself in order to bring an extended period of risk upon the world.” Early in his term, I worried that having “a man who has no idea what he’s doing in almost any aspect of the presidency” made a Middle Eastern conflagration much more likely.

My warnings about the peril of a presidential vacuum found some vindication when Trump flailed and foundered through the early months of the pandemic. But in geopolitics, the tests were thankfully not all that severe, and Trump groped his way to a more effective foreign policy than I

had expected. A Biden apologist today could even argue that Trump’s first term shows that the American empire can survive an unfit president ...

... except that under Biden, the severity of the geopolitical testing has increased. Many of the choices his administration has made in response have been reasonable or at least defensible, and his team has done a decent job of working around the president’s tighter limits. But for the same reason that Trump’s incapacities seemed likely to yield dangers, it seems plausible that Biden’s decline has itself encouraged our enemies and been partially responsible for the gravity of the challenges we face.

That’s basically the argument Trump made at the debate: that he was taken more seriously by our rivals, and therefore, the world was more stable on his watch. Whether or not that’s been true in the last few years, on the basis of what Biden showed the world Thursday, I think it would become true if he remained on the job through 2028. On this important metric, the capacity to lead a superpower without the 25th Amendment hanging in the background, he appeared to be not as unfit as Trump but more so.

This reality does not erase Trump’s unfitness on other counts, the stain of Jan. 6 especially. It just means that a second Biden administration would be unusually dangerous for the country in a very specific, very significant way. And replacing him with another Democratic candidate, however difficult it seems, would spare America from the significant dangers of a Biden victory, not just from the risks of his defeat.

SAN JUAN – La situación que enfrentan los adultos mayores en Puerto Rico, sobre todo con los altos costos de cuido, es un asunto de equidad que se tiene que abordar en el Congreso de Estados Unidos, dijo el lunes el director ejecutivo de la Junta de Control Fiscal (JCF), Robert Mujica.

“Este es un tema muy importante. Y el programa de Medicaid en Puerto Rico es diferente del programa de Medicaid en el resto de Estados Unidos. En el resto de Estados Unidos, el programa de Medicaid financia el cuidado de ancianos, el cuidado a largo plazo, el cuidado en el ho-

gar. Y en Puerto Rico no lo hace. Y eso es un problema de equidad que creo que necesitamos abordar porque es diferente y se convierte en un aumento muy significativo. Así que creo que no se va a resolver solo con fondos del Estado Libre Asociado. Es algo que vamos a tener que tratar a nivel federal también”, dijo Mujica en conferencia de prensa.

“Y cuando el programa de Medicaid sea reautorizado a finales de 2027, creo que eso es algo en lo que todos necesitamos centrarnos porque la demografía está cambiando, la población está envejeciendo. SAN JUAN – El secretario interino del Departamento de Hacienda, Nelson Pérez Méndez, anunció que a partir del martes 2 de julio, los ciudadanos de 65 años en adelante y los pensionados de bajos recursos podrán solicitar electrónicamente los créditos reembolsables con el uso del Formulario 481.1, disponible a través de SURI.

“Culminado el Ciclo Contributivo 2023, a partir del 2 de julio y hasta el 14 de octubre de 2024, los seniors y pensionados podrán reclamar los créditos de $400 y $300, respectivamente, a través de sus cuentas en SURI o utilizando los servicios de los Especialistas en Planillas certificados por Hacienda, disponibles en la página principal de SURI,” anunció Pérez Méndez en declaraciones escritas.

El Departamento de Hacienda ha habilitado un micrositio en su página web con toda la información necesaria sobre ambos créditos y los pasos que deben seguir los ciuda-

La facilidad y la accesibilidad a través de SURI ha logrado la agilidad del procesamiento y de los desembolsos, lo que ha contribuido a que cada año sean más las personas que logran reclamar su crédito,” añadió Pérez Méndez.

Los pensionados de bajos recursos podrán optar por el crédito de 300 dólares si son pensionados de la Administración del Sistema de Retiro de los Empleados del Gobierno y la Judicatura, del Sistema de Retiro de Maestros, de la Universidad de Puerto Rico, de la Autoridad de Energía Eléctrica y del sector privado. La pensión no debe exceder

los 4,800 dólares anuales y, en el caso de casados, cada cónyuge debe cumplir con los requisitos de forma individual. No se tomarán como agregadas las fuentes ni el total de los ingresos.

DRNA lanza campaña “Pa’l Agua Seguro” para promover la seguridad y protección marina

SAN JUAN – La secretaria del Departamento de Recursos Naturales y Ambientales (DRNA), Anaís Rodríguez Vega, anunció el lunes el lanzamiento de la campaña educativa “Pa’l Agua Seguro” de la Oficina del Comisionado de Navegación. La campaña, que comenzó el lunes y se extenderá durante todo el verano, tiene como objetivo educar sobre la seguridad en la navegación, el cumplimiento de leyes y reglamentos, y la protección de la vida marina y los hábitats costeros.

“Estamos comprometidos en garantizar la seguridad de nuestros nautas y la protección de nuestros recursos naturales. La campaña ‘Pa’l Agua Seguro’ es fundamental para

educar sobre la importancia de la navegación responsable y el cumplimiento de las normativas que protegen tanto a las personas como al medio ambiente,” sostuvo Rodríguez Vega en declaraciones escritas.

Rodríguez Vega explicó que la campaña se enfoca en educar a los nautas sobre la importancia de seguir las leyes y regulaciones de navegación, con el fin de prevenir accidentes y proteger los recursos naturales. A través de esta iniciativa, el DRNA busca reducir los incidentes en el agua, fomentar una navegación responsable y resaltar la necesidad de preservar la vida marina y los ecosistemas costeros. The world’s next big drag queen is Brazilian

Sao Paulo’s main avenue was packed in June with thousands of people draped in the yellow and green of the Brazilian flag and captivated by a commanding figure atop a tractor-trailer rigged with speakers.

From above, the scene could have maybe passed for one of the many political rallies held in the same spot by former President Jair Bolsonaro, the Brazilian far-right leader who has infamously declared that he could never love a gay son.

(Though, to be fair, the enormous rainbow flag would be a giveaway.)

It was, in fact, one of the world’s largest Pride parades, and the person atop the sound truck was Phabullo Rodrigues da Silva, 30, the gay son of a working-class single mother in Brazil’s north.

Yet everyone in the crowd knew him as Pabllo Vittar, a 6-foot, 2-inch drag queen in a glittering cutoff Brazilian soccer jersey and shredded jean shorts — one of the biggest pop stars in this nation of 203 million.

“It’s so beautiful to see you in yellow and green!” Pabllo Vittar shouted to those in the crowd, many wearing fishnet and Gstrings. She had called on the revelers to wear Brazil’s national colors to reclaim the Brazilian flag from Bolsonaro’s right-wing movement. “Let’s dance!”

RuPaul may still be the queen of queens, but the heir to the global crown has arrived.

Over the past seven years, Pabllo Vittar has become, by some measures, the world’s most successful drag queen. She has six studio albums (one gold, one platinum and two double platinum), her own fashion release with Adidas, a global ad campaign with Calvin Klein and 1.8 billion streams of her songs.

She has toured the United States and Europe; taken the stage at Lollapalooza and Coachella; performed alongside Madonna at Madonna’s biggest concert; and sang at the United Nations for Queen Elizabeth’s birthday.

Pabllo Vittar calls RuPaul, 63, the American drag queen pioneer, an inspiration, though they have never met. And RuPaul has shot down any talk of competition. “I LOVE & SUPPORT @PablloVittar,” RuPaul wrote on Twitter, the platform now known as X, in 2022. “Shame on you catty Twitter trolls trying to create a rivalry.”

By the metric of the modern internet, however, it is hard to argue with the idea that

singing on YouTube and in bars. Then, at a Halloween party at a gay club on his 18th birthday, he tried drag.

“I had never experienced such a powerful sensation of freedom — to be able to express what was going on inside my head,” he said.

At the same time, a video of him singing a Whitney Houston song was going viral. The club’s owner, Yan Hayashi, and a music producer, Rodrigo Gorky, quickly saw the potential and began managing Rodrigues da Silva as Pabllo Vittar. (The name was in homage to a drag queen Rodrigues da Silva knew earlier.)

Pabllo Vittar quickly landed a gig fronting a band on a late-night variety show. Then she began releasing music, and by 2017, she had Brazil’s No. 1 song.

Pabllo Vittar has begun to surpass her childhood idol. Across Facebook, Instagram, Twitter, TikTok and YouTube, Pabllo Vittar has a combined 36 million followers, three times that of RuPaul.

In the process, Pabllo Vittar has come to represent Brazil’s LGBTQ+ paradox.

In addition to being home to a crew of breakout drag stars, Brazil has adopted some of the world’s most expansive gay rights. Gay couples can marry and adopt children; transgender people can legally choose their gender; homophobic slurs are a crime; and so-called conversion therapy, which seeks to make gay people straight, is banned.

Yet for years Brazil has also ranked among the deadliest countries for gay and transgender people. Since 2008, more than 1,840 transgender people have been killed in Brazil, more than double the next deadliest country, Mexico, according to tracking by Transgender Europe, an advocacy group. Brazil has led the rankings every year since tracking began.

“We never know when it will be my friend, when it will be my family, when it will be me,” Pabllo Vittar said in an interview. “This is the biggest goal of my career: To make it so younger people don’t feel this fear when they go out.”

Brazil’s loudest gay voices against a right-wing movement in the country, led by conservative Christian groups, that has made a heterosexual vision of gender, sex and marriage a central part of its political strategy.

To Pabllo Vittar’s gay and transgender fans, she has been a powerful inspiration.

“She gives us such a sense of security,” said João Rabelo, 28, a publicist from the northern Brazilian city where Pabllo Vittar was born. “Today I can walk in the street with my boyfriend relaxed and not fear death.”

While the public largely sees Pabllo Vittar dressed as a woman, the star lives life as a man. Gender “is a societal construct,” Rodrigues da Silva (the star’s real name) said. “What’s most important is how we feel inside. I feel like a boy, and when Pabllo Vittar arrives, it doesn’t make me a woman.”

On pronouns, she is indifferent — when out of drag. “If I’m in drag, use the feminine, for the love of God,” she said.

Rodrigues da Silva was born in Maranhao, Brazil’s poorest state, to a single mother who worked as a nurse technician. By age 5, he was seeking the stage, starting with the choir at church. “I just wanted to sing,” he said, “and I wanted people to see me sing.”

He said he was mocked by classmates for being effeminate but his mother always supported him. By his teenage years, he was

Pabllo Vittar has since become one of Brazil’s most dependable draws, with a highpitched voice, elaborate dance routines and a high energy show. She has also gained a moderate international following, mostly among the LGBTQ+ community, but is now working on an album that mixes in English and Spanish.

After sitting for an interview as Rodrigues da Silva, she emerged as Pabllo Vittar hours later at a charity concert in her native state of Maranhao. The transformation typically takes three hours. (Like an athlete collecting free sneakers, she has amassed a collection of 200 wigs donated from a London wig maker.)

She wore a tight top that imitated the state flag, a blonde wig, white boots, a tiny skirt and a G-string. Waiting to take the stage with her cadre of male dancers in the Brazilian heat, her hair stylist used a fan to cool her butt.

“My favorite place in the world,” she said. Then she strutted onstage and the crowd erupted.

It’s Brutus, not Bruno! The etiquette of remembering your friends’ pets’ names.

Kiyomi Lowe regularly hears people mispronounce her name or sometimes forget it altogether. “I get Naomi, Kaiomi, sometimes Kimmy,” she said. It doesn’t bother her: “I’ll respond to anything.”

She is less forgiving when friends and acquaintances forget the name of her dog, a shar-pei. “I get Bruno a lot,” she said. To which she responds: “‘No, it’s Brutus!’ The dog doesn’t care. But I care for the dog.”

Lowe is a stylist at Al’s Barber Shop, a popular six-chair salon in Boulder near the campus of the University of Colorado. On a recent morning, she fell into a spirited conversation with her fellow stylists and several customers over a delicate question: Should you be responsible for remembering the name of a friend’s pet? What’s the etiquette?

“A big question,” said Jen Himes, a stylist, who conceded that she sometimes made a naming mistake, which pained her. “I’ve gotten a lot of pet names wrong. I’m, like, ‘How’s Pookie?’ And they’re, like, ‘It’s Rufus!’ or whatever.”

“Most people laugh,” she said. “But some people are, like, ‘That’s offensive.’”

When it comes down to it, she added, there is a pretty good way to determine if you are obligated to remember a pet’s name. “It depends how important the pet is to your friend,” she said.

There was general agreement with that assessment in the barbershop (which happens to be the reporter’s regular one). The conversation mostly revolved around dogs, which, several people said, are different from other pets in that they are taken on walks and get out and about, and so deserve more name recognition

than more private animal companions.

“That’s cat discrimination!” objected Himes. She laughed and suggested that she wasn’t all that worried about it. Even she doesn’t always stick to her own tuxedo cat’s name, Cosmos.

“I call her Kitty,” she said.

Al’s Barbershop is owned by Al Urbanowski, who identified another key factor in determining whether you should remember the name of a friend’s pet: how important the friend is to you. Urbanowski, 58, still remembers Whiskey, the name of his best friend’s dog when he was 9. Urbanowski now lives in a neighborhood full of dogs, he said, and his passing relationship with neighbors makes it hard to remember the names of dogs and humans alike.

Your interpersonal connections change with age, he noted, and that changes what you can and should be responsible for remembering. When he was 25, Urbanowski said, dogs joined the hikes and other social outings that he went on with friends and were a big part of those friendships.

“When I started having kids, the dog names didn’t roll off the tongue,” he said. Remembering a dog’s name “is still a priority, but it got pushed down.”

The group in the barbershop said that some responsibility did fall on the person trying to remember the friend’s pet’s name, but some responsibility might also belong to the pet-owning friend, who could pick a pet name that was easy to recall.

“The funnier the name is, the easier it is to remember,” Lowe said. “Like Derek.”

Derek is memorable? Yes, she insisted.

“Luke Skywalker,” offered Himes, recalling

one name of a client’s dog that stayed with her.

“Big Tuna,” said Madisyn Crandell, a stylist at Al’s, referring to the name of one of her mother’s two English bulldogs. (The other, Lucy, was deemed by the group to possess a less memorable name.)

“Doug,” said Jason Owens, who stood loyally nearby as his 11-year-old son, Ryder, got a haircut. Doug was the name of a friend’s Corgi. “How can I forget a name like Doug,” Owens said. But maybe he’d forget Doug if it were a person’s name, he added.

Recently, the Owens family’s Rottweiler, Derby, died. Owens said most friends didn’t remember Derby’s name, but they were good about remembering his nickname, Cheeky.

“She was the sweetest dog,” Owens said. “Dumb as rocks, but the sweetest dog.” He didn’t at all mind if his friends also called Derby dumb. “I’d be, like, ‘Yeah, you’re right: She’s dumb as rocks.’”

Others have trouble getting past a forgotten pet name. Christian Huerta, a receptionist at Al’s with a pit bull mix named Frida, had one friend who repeatedly called her dog Freya. Huerta devised a plan.

“I texted her multiple times when she was coming over, and I said, ‘Frida is excited to see you’ — like, I’d spell out Frida,” Huerta said. “And my friend was like, ‘Freya!’ And I was upset.” Huerta reflected on that. “Maybe it’s not so serious,” she said. “Maybe I’m too sensitive.” She then likened it to forgetting something else important, such as a birthday.

“I guess it bothers me because I love my dog so much,” she said.

In defense of wine

Around the globe, much of the wine world is feeling besieged and stigmatized.

Sales are down, way down for some. New studies suggest that any consumption of alcohol is unhealthful. New diseases are preying on grapevines, older maladies seem more prevalent and climate change — which has caused subtle and violent changes to weather patterns and more frequent catastrophic events like spring frost, hail, drought and fire — poses a threat to the existence of small growers and producers.

I don’t want to speculate here on the systemic reasons that wine sales are down, or question the credibility of the World Health Organization, which published the 2023 study asserting that even moderate consumption of alcohol was unhealthy. Others have tried to do that.

Instead, I want to stand up for the beauty and joy of wine, which has been embraced by humans since the dawn of civilization. Wine has played a role in religions and been a beloved element of many societies. It is often integral to people’s cultural identities. For centuries, wine was a necessity for many people, safer to drink than water.

It’s not essential to survival any longer. People in countries like France and Italy drink far less wine than they once did because it’s now a choice, not a necessity. Wine endures because of the deep and subtle pleasures it offers.

Yes, wine is an alcoholic beverage. Good wine is far more. Wine drinkers enjoy the buzz, but if that were the only element sought, wine would be no more than an intoxicant.

Sadly, many in the wine industry fear that, as marijuana has become easier and less risky to obtain, wine will lose out to legalized cannabis as people trade one high for another.

The notion of wine as solely an intoxicant is reinforced by popular culture, which so often portrays wine as self-medication, something to drink to relieve anxiety or to unwind at the end of the day.

Good wine transports as it refreshes. It’s an invitation to visit other cultures and worlds, to learn about history and geology, agriculture and environmentalism. Aged wine offers a journey through time. It can be a gateway to philosophy and to contemplation.

Though skill, vision and humility are

crucial to the creation of great wine, it is not a work of art that springs entirely from the imagination. Rather, it is a beautiful craft. It takes no special skill to appreciate or enjoy. It’s fun, and it’s delicious, and if you give a glass of good wine to a dozen different people you are liable to get a dozen distinct opinions.

I want to make clear that I have no vested interest in wine except that I love it. It has given me more pleasure over the decades than I can quantify, as I’ve shared bottles at the table with friends and family.

Wine’s gift is to enhance meals and gatherings. It brings people together, amplifies a sense of well-being and can comfort in times of sadness.

Wine can also transfix, captivate and inspire, touching people’s emotions in ways that can range from simple happiness to profound wonder. If they wish, people can discuss and debate the quality and meaning of a profound bottle with language that paradoxically struggles to articulate its mysterious appeal.

At the same time, the humble, everyday bottles are often the most important. Great wines occupy an exalted place because of the discussions they provoke and the context they provide; they will never overshadow the simpler pleasures that we enjoy most frequently with friends and loved ones, just as masterpieces in museums will never eclipse the daily joy we take in our children’s artwork on the fridge.

Yes, wine, like all alcoholic beverages, can be dangerous. Out-of-control consumption can be a menace. Societies struggle to balance the benefits and dangers of alcohol in cycles that have ranged from outright bans to overthe-top permissiveness. With the recent reports, many people are wrestling with what is right for them.

It’s too easy to lump all alcoholic beverages and their dangers together. While wine can be abused like any other, its role as an accompaniment to food and its long-term cultural importance must be considered.

In wine-producing societies, no other beverage has been as entwined with cultural rituals and reaffirming social bonds as wine. We toast to declare love, affection, trust and to reinforce our ties. We raise glasses to celebrate births and to mourn deaths. Wine makes people feel closer to one another.

How important has wine been? Grape vines were among the first crops cultivated by

humanity. Scientists have dated the earliest domesticated grapevines to roughly 11,000 years ago, which means that early humans considered grapes and wine significant enough to give up their nomadic lives and settle down in what would become communities.

Over the centuries, with a few exceptions, wine grapes were not only grown in isolation. They were often part of mixed farms that also grew grains and vegetables and raised animals, everything necessary to sustaining life. The food crops would go in the most fer-

tile terrains. The vines were often planted in places where other crops might not prosper. These vines might sometimes grow in places that were onerous and exhausting to farm. Visit the Mosel and Rhine valleys in Germany, the Northern Rhône Valley in France, the Douro in Portugal and Ribera Sacra in Spain. These are ridiculously steep, rocky places where farming was both arduous and terribly dangerous. Vineyards were created on these sites many centuries ago, which required digging out boulders and grading sites to create stone terraces — backbreaking, grueling tasks before mechanization.

Why would people subject themselves to such labors? These choices of vineyard locations may also indicate acute senses of discernment. Centuries later, these sites are recognized as among the best possible places to plant vineyards. It was not simply that wine was necessary. Those people wanted the best wine possible.

Even in more modern times, as in the 19th century, the importance of wine has inspired people to do mind-boggling things, like planting a vineyard at Monte Bello in the Santa Cruz Mountains of California. I drove up there for the first time around 20 years ago, taking a steep, winding road that scared me in both directions. How did people do that with horse and mule? And why?

Wine was that important. It served social, spiritual and aesthetic roles that other foods and beverages never did. And, if the grapes were planted in the right places and skillfully fermented into wine, it was delicious.

I’ve been writing about wine for more than 25 years. If anything, I’m more fascinated by the subject than ever, and more in awe of the people who dedicate themselves to making wines that are the best expressions of their vision and heritage, whether their bottles cost $20 or $200. These wines have enormous cultural value. They will always have an audience.

Wine producers who are in business simply to sell a product face the biggest threat. An audience that doesn’t see the value in wine — their audience — will be the most likely to go elsewhere.

I have never consumed wine because I imagined it was healthy. But I don’t fear it in moderation, just as I continue to do other things that are not without risk, like drive, fly, eat meat and train in martial arts.

Everybody ought to feel free to make their own choices about wine. In assessing the risks, please take its beauty, culture, history and joy into account as well.

La demandante, mientras estudia en Loyola University, reside en un hospedaje fuera del campus universitario. Tiene gastos de vivienda, agua, luz, servicios de internet, transportación y matricula. A pesar de que la Alba B. Cruz Cabañas ha sido la progenitora que aporta a la educación y gastos de la demandante en su mayoría de edad es parte indispensable en la presente solicitud de alimentos. Se esta solicitado que se celebre vista evidencia para ordenarle al Manuel A. Arroyo Rivera que continue con el pago de la suma de $149.50 semanales y le establezca un plan de pago para satisfacer la deuda de $25,199.61 que existe por pensiones alimentarias no pagadas a favor de la demandante. At Wimbledon, players must deal with the challenge of grass

For Debbie Jevans, a seat on Centre Court at Wimbledon requires no more than a left turn out of her office, then a right turn past the trophies honoring past champions. A few short steps farther, the same steps taken by the competitors on finals day, and Jevans finds herself on hallowed grass.

“Centre Court is such a special place,” Jevans, the first female chair of the All England Club, said recently by video call. “The court is pristine, the flowers look amazing, the overviews of St. Mary’s Church in the background. I feel an enormous sense of pride and thanks to the hundreds of people who have got us to this point.”

Seeing the elegance and lush lawns on opening day at Wimbledon is, for players and fans, like stepping back in time. One of the biggest reasons is because professional play on grass is as elusive as a Wimbledon title itself.

Iga Swiatek has played 23 WTA grass-court singles matches out of almost 400 total in her career. Swiatek, the world No. 1, has not advanced beyond the quarterfinals at Wimbledon.

Jannik Sinner, the newly named world No. 1 in men’s tennis, enters Wimbledon having played just one ATP grasscourt tournament this year — which he won over Hubert Hurkacz in Halle, Germany, on June 23 — and only nine in his career. One of those matches was a five-set Wimbledon quarterfinal loss to Novak Djokovic in 2022.

Carlos Alcaraz won 12 straight matches on grass last year, including titles at Queen’s Club and Wimbledon, but was upset in the Round of 16 at Queen’s Club about two weeks ago by Jack Draper. At Wimbledon last year, Alcaraz beat Djokovic in five sets. He also won the 2022 U.S. Open on hard courts. When he won this year’s French Open on clay he became the youngest man to win three majors on three different surfaces.

“Every time I step on a grass court, I have to learn how to move better, how to play better,” Alcaraz said after his first-round win at Queen’s Club in June. “So, I feel like I’m still learning.”

The grass-court tennis season is precariously short. This year, there are only eight ATP tournaments and seven WTA events, spread over a few weeks.

In 2025, with the dissolution of the Hall of Fame Open in Newport, Rhode Island, there will be one less ATP week on grass. Pro tennis has been played on grass at the International Tennis Hall of Fame in Newport virtually every year since the first U.S. National Lawn Tennis Championships, precursor to the U.S. Open, began there in 1881. The Hall of Fame Open is the only ATP grass-court tournament left in the United States.

By comparison, there are 40 hard-court tournaments out of 70 total on the ATP Tour this year and 22 clay-court tournaments, including the Paris Olympics. The WTA has 56 tour-level events this season, 36 of which are on hard courts and 13 on clay. The numbers are similar for 2025.

Grass is an inherently tricky surface to maintain and to master. The groundskeepers at Wimbledon spend the majority of the year cultivating and sodding the perfect blades. They even employ England-based company STRI, which was founded in 1929 to help golf’s St. Andrews in Scotland improve its greens, to make sure that the grass is as playable as it is pristine.

The upkeep of grass courts, which quickly become treacherous during frequent London rain — Frances Tiafoe, Dan Evans and defending Wimbledon women’s champion Marketa Vondrousova all took nasty falls during a tournament in June, putting their Wimbledon chances in jeopardy — is a challenge, but they also require a different skill set for the players.

When Martina Navratilova won Wimbledon nine times from 1978 to 1990 and Pete Sampras captured seven titles from 1993 to 2000, the grass was slicker, rewarding those with a potent slice backhand and the ability to serve and volley. Then, in 2001, the tennis club changed the surface from a rye mixture to all rye grass, which allows the ground underneath to remain dry and firm, making the court play a little more like a hard court. But, given that it is still a soft surface, it can be kinder on the players’ bodies than the constant pounding they take on pavement.

“It would be nice to have more tournaments on grass,” Navratilova said. “Just for the longevity of the bodies to stay on those natural surfaces more.”

Current players agree.

“There’s something pure about the grass at Wimbledon,” said Christopher Eubanks, who won his only ATP title on grass in Majorca last year and then reached the quarterfinals at Wimbledon. “Players who like to have clean ball striking, who like to have effectiveness on the serve, are rewarded on grass. If you’re into ripping the ball or like to have some variety on the slice, it takes those well, too.”

The issue for players is the constant change of surfaces throughout the year and that so few tournaments are played on grass. Two major championships — the French Open on clay and Wimbledon on grass — are also contested just three weeks apart. It’s all part of the game, Eubanks said.

“We all know when we embark on a career in pro tennis that there are seasons,” he said. “You start on the hard courts, transition to clay, then to grass and then the rest of the year is on hard courts. We understand that we’re only going to get four, maybe five weeks on the grass, so it’s important to maximize them as best we can. The varying surfaces is

one of the things that makes tennis so cool.”

This year, the tour schedule adds another wrinkle in that the Paris Olympics are being staged on red clay at Roland Garros a few weeks after Wimbledon ends. That means abandoning the sometimes-staccato movements needed on grass and readjusting to sliding on clay.

For some, the schizophrenic scheduling comes at a cost. While natural clay-courters such as Alcaraz, Swiatek and 14-time French Open champion Rafael Nadal cherish the chance to go for gold on clay, others, such as Tiafoe, Aryna Sabalenka, Ons Jabeur, Ben Shelton, Sebastian Korda, Madison Keys and Emma Raducanu, have said that the potential for injury simply isn’t worth the risk and are passing on the Olympics.

Fifty years ago, three of the four majors — the Australian Open at the Kooyong Lawn Tennis Club in Melbourne, Wimbledon and the U.S. Open at the West Side Tennis Club in the Forest Hills neighborhood of Queens, in New York City — were all played on grass. Then, in 1975, the U.S. Open shifted first to green clay and then, when the tournament moved to the USTA National Tennis Center in Flushing Meadows in 1978, to hard courts. The Australian Open transitioned to hard courts in 1988.

For many, the allure of Wimbledon is that it is still played on grass.

“No tournament makes you feel more like a champion than Wimbledon,” Navratilova said. “Most kids dream about winning that more than any other tournament. You feel the history when you walk in there. And the grass courts are part of that history.”

Asked whether Wimbledon would ever alter its surface to play on hard courts, Jevans, a former tour player who still finds time to hit on the grass courts, didn’t take a breath before responding.

“No,” she said as she gazed out the window of her office overlooking the All England Club grounds. “That’s my answer. Wimbledon is Wimbledon.”
