González Colón holds her first board of directors meeting as NPP president

New Progressive Party (NPP) President Jenniffer González Colón held her first party board meeting on Monday, at which several appointments were made.

“The mayor of Gurabo, Rosachely Rivera, was unanimously voted as interim NPP vice president for women, which will later be confirmed in the NPP General Assembly,” González Colón said at a press conference. “Likewise, the corresponding appointments were made to the platform committee, which is a board of seven people that is now directed by Verónica Ferraiuoli of the Luis A Ferré Institute, which is the body that will be preparing the New Progressive Party platform for the next election.”

At González Colón’s first meeting as party president, the 44 members present decided to leave Hiram Torres Montalvo in place as general secretary.

Raúl Márquez Hernández was also chosen as undersecretary; Ciary Pérez Peña, alternate electoral commissioner; Oriol Campos Hernández, state political director; José Gerena, mayors’ representative; Ángel Cintrón García, San Juan region director; Yashira Lebrón, Bayamón region director; Julennie Vázquez, Aguadilla region director; Jayson Martínez, Mayagüez region director; Margarita Nolasco, Guayama region director; Francisco “Paco” López, Central region director; Omar Massa, Humacao region director; William Villafañe, at-large member; José “Pichy” Torres Zamora, at-large member; Tatiana Pérez Ramírez, atlarge member; and Juan Aubin “Bin” Cruz Manzano, at-large member.

Meanwhile, it was announced that the NPP Convention will be held Sept. 13-15 at the Caribe Hilton hotel in San Juan.

The premises would be paid for by the parity of funds from the State Election Commission, she added.

And opening these doors after this primary means that people who perhaps did not vote in the last election or in recent elections, now have space in this committee, have space in this party to channel family values, causes and rights of each citizen in defense of free enterprise, work and opportunities.”

Court orders delivery of Machargo’s file to House panel

The Puerto Rico Court of Appeals has ordered the Government Ethics Office (GEO) to submit the investigative file on former Natural and Environmental Resources Department Secretary Rafael Machargo Maldonado to the House Anti-Corruption Committee for a probe, Committee Chairman Héctor Ferrer Santiago said Monday.

Previously, Superior Court Judge Alfonso Martínez Piovanetti had determined that the GEO had engaged in contempt for not delivering an investigation file to the House of Representatives and established May 10 as the last deadline before issuing an arrest warrant against the GEO executive director.

The judge had already ordered the delivery of the file on the investigation, which had been closed without a complaint being filed against Machargo. If the GEO had an objection to delivering a particular document within the file, it was supposed to detail it in a log to bring it to the attention of the judge, who had dismissed GEO arguments that the file was outside the scope of a resolution that allowed the Anti-Corruption and Public Integrity Commission to investigate agencies such as the GEO.

accountability,” Ferrer Santiago said. “The decision strengthens our commitment to integrity in public service.”

The Court of Appeals reaffirmed the position of the

House of Representatives, ruling that they have the legislative and constitutional power to access essential documents to carry out oversight functions. The court noted that, pursuant to Articles I, Sec. 2 and Art. IV, Secs. 1 and 4 of the Constitution of Puerto Rico, the Legislature has the prerogative to investigate and access the information necessary to legislate in an informed and effective manner.

Ferrer Santiago called it regrettable and paradoxical for the GEO, led by Luis Pérez, to torpedo the Legislature by refusing to deliver crucial information and going to the Court of Appeals to hide the truth. The GEO’s initial refusal and subsequent disregard for the court’s mandate underscore the importance of the resolution, which prevents any attempt to hide information and reaffirms that no one is above the law, the legislator said.

“With this decision, we will continue our work to ensure that all government entities operate under the principle of transparency and that public officials are accountable to the citizens of Puerto Rico,” Ferrer Santiago said.

Last month, the Office of the Special Independent Prosecutor opted not to investigate Machargo over a meeting with former Santa Isabel mayor Enrique Questell Alvarado, who was being investigated for certain illegal construction projects.

Treasury Dept. called on the carpet over $32 million info system

The Office of the Comptroller of Puerto Rico has issued a qualified opinion on the fiscal operations of the island Treasury Department related to computerized information systems.

A qualified opinion is issued when individual or aggregate breaches are significant, but not widespread.

The report reveals that the Treasury Department has not obtained the expected benefits after investing $32,369,127 to implement a standardized accounting system in accordance with the Fiscal Plan for Puerto Rico.

The plan, certified by the Financial Oversight and Management Board on March 13, 2017, established that the government’s financial data should be centralized in

a single account and database. To this end, the Treasury selected PeopleSoft 9.2 to reimplement Enterprise Resource Planning (ERP).

In this regard, the department formalized two contracts and amendments from July 25, 2018 effective until June 30, 2020 for $55,999,000, which was interrupted in November 2019, six weeks after completing the first phase of the reimplementation of the ERP system. Prior to the interruption of services, $32,369,127 had been disbursed to the company.

The Financial Oversight and Management Board warned on Feb. 26, 2021, about the importance of the system facilitating the preparation of the Comprehensive Annual Financial Report. It also noted that, despite the authorized funds, the project had not been completed. To this end, a Steering Committee was created in 2021 to implement a new

financial and accounting system for the island government The committee, after evaluating proposals, decided to hire the same company.

On November 2, 2022, the Treasury Department awarded a new contract to continue the project, but this time with a cloud solution that would require three years at a cost of $73,104,102. According to the work plan, the project should be completed by Dec. 31, 2024.

This situation is attributed, among other things, to the department’s failure to request all the necessary funds, which resulted in the project having to be interrupted on four occasions, and to the absence of a needs study. The difficulty of communication between consultants and Treasury Department staff due to language was also pointpointed as a cause of delays, the comptroller’s report noted..

Police arrest 167 people for drunk driving in a week

Highway Patrol Division agents attached to the Puerto Rico Police Bureau made 167 arrests in a week for driving while intoxicated.

During the week agents carried out a total of 18,532 interventions, including six for the Weapons Law, four for controlled substances, two for obstruction of justice and one for Law 54, the domestic violence

law. They also intervened with 89 unauthorized drivers.

Amid those interventions, a total of four pistols, three revolvers, and 173 units of ammunition were seized, along with five jars of marijuana, 21 bags of cocaine and eight bags of marijuana.

As part of the work plan, the officers also confiscated six vehicles and one was recovered. In total, they obtained $9,249 in cash and $9,000 in bail.

It should also be noted that during the weekend there were no fatal accidents on Puerto Rico’s roads.

The number of fatal accidents stands at 136 so far in 2024, which represents 20 fewer accidents compared to the 156 reported in 2023.

The breakdown of fatal roadway accidents for the year as of Monday was as follows: 46 drivers, 15 passengers, 29 pedestrians, 38 motorcyclists, five cyclists, and two riders and one driver on a four-track.

Legislator demands publication of June 12 power outage reports

San Juan Rep. Víctor Parés Otero has asked Puerto Rico Electric Power Authority (PREPA) Executive Director Josué Colón Ortiz on Monday to make public the reports that LUMA Energy and Genera PR had to deliver on the widespread blackout on June 12, which left more than 350,000 consumers without power for hours.

“It has been nearly a month since the significant blackout that plunged over 350,000 customers into darkness,” Parés Otero said in a recent written statement. “Yet, we are still awaiting the crucial reports on its causes and the corrective measures that LUMA and Genera are expected to implement to prevent a recurrence of the June 12 incident. The current status of these reports and any associated actions remains unknown.”

The New Progressive Party lawmaker urged Colón Ortiz to confirm whether LUMA, which is responsible for energy transmission and distribution, and Genera,

which is in charge of the power plants, have submitted comprehensive reports on the June 12 events. He further demanded that the reports be made public.

“The public has a right to know the details and the steps these two companies are taking to rectify the situation,” Parés Otero said. “This is our request to our colleague Josué Colón.”

“I don’t think preparing a report on something so important can take that long,” the legislator said. “It is as if there is no sense of urgency, of a desire to tell the people what happened and what they are doing to avoid another similar event. Well, I’m sorry, we want to see those reports now. It’s been almost a month and nothing.”

Colón Ortiz had previously noted that on June 14, he requested the information from LUMA Energy and Genera PR through the Public-Private Partnerships Authority.

“As of July 5, we have not received a response to the information request from LUMA Energy, while Genera PR responded on June 24,” the PREPA chief said. “Once we receive the response from the private operator LUMA Energy, we will be able to continue evaluating the events that occurred on June 12.”

Lawmaker makes call to recover yolas left on island shores

At-large Rep. José “Che” Pérez Cordero announced Monday that he will be contacting U.S. Customs and Border Protection and the U.S. Department of Agriculture to initiate a program to recover yolas, as well as other vessels used to transport people with undefined immigration status and then abandoned on the island’s shores, particularly in the west and northwest.

Pérez also said he will be meeting with Natural and Environmental Resources (DNER) Secretary Anaís Rodríguez Vega to evaluate possible actions to begin the collection of the vessels given the possible

environmental impact of their deterioration on the coasts.

“This is a situation that we have been monitoring very closely for some time,” the lawmaker said. “On the coasts of Puerto Rico, especially in those of the western and northwestern municipalities, this is an issue that impacts the environment, since most of these boats are boats made of fiberglass, an element that usually stays in the sea and has the potential to harm the marine ecosystem.”

There is also the danger the abandoned vessels represent for bathers, and people who practice water sports such as kayaking and surfing, among others, Pérez noted.

“Therefore, in the coming days we

will be requesting an urgent meeting with the directors of the Customs and Border Protection office to establish the parameters of a program to identify these vessels and remove them as soon as possible,” he said. “We will also summon the DNER secretary to see how she can help. The problem cannot continue. According to several reports, more than 30 yolas and/or boats are floating adrift or stranded on the coasts of the northeast region, causing a serious environmental hazard. It is not only the fiberglass, but, as environmental groups have also indicated, it is the oil and gasoline that they carry with them that represents a danger to nature. Removal must be a priority.”

Ag chief: Suiza Dairy-union conflict won’t disrupt milk supply

Agriculture Secretary Ramón González

Beiró said Monday that the agency has worked so that the situation between Suiza Dairy and General Workers Central (CGT by its initials in Spanish) does not hinder the consumption of milk or its production.

He said there have been no major losses in the industry.

“The situation is difficult for Suiza

employees and we have extended our full support to them,” González Beiró said in a written statement. “We have ensured that both consumers and farmers are not affected by the conflict. Our commitment has been firm and from day one we have taken the necessary measures to guarantee that the product reaches the tables of our families in Puerto Rico without interruptions.”

Since the beginning of the demonstration, the Agriculture secretary said, the agency

has been working with the parties involved and other production plants such as Indulac and Tres Monjitas to implement contingency plans. The plans have included the coordination of alternative carriers for distribution to businesses, efforts with Tres Monjitas to acquire additional resources for collecting milk from farms, and guaranteeing payment to dairy farmers.

“We also collaborated with the Suiza plant in Aguadilla for UHT milk,” González Beiró said.

“Between the two plants, around 4,200,000 liters are processed every 14 days and Tres Monjitas was able to process it on the same days,” he noted. “Now, we are looking for other measures to improve distribution, which has represented a challenge, but has not left the consumer without a product as essential as milk. We have managed to mitigate the risks and ensure that our supply chain remains intact despite the strike situation.”

Beryl moves away from Houston, leaving flooding, power outages in its wake

Skies began to clear, but gusts continued to blow as Tropical Storm Beryl moved north of Houston on Monday afternoon, bringing heavy rain and tornado warnings farther inland. The storm lashed the city and its suburbs with strong winds and torrential rains, flooding streets and highways and knocking out power to more than 2.7 million customers in Texas.

Officials and residents in the nation’s fourth-largest metro area began assessing the damage and recovering from the storm’s impact. The winds had been stronger than expected, officials said, leaving the roadways blocked in many places by trees and other debris.

At least two people were killed in of their homes by falling trees north of downtown Houston, officials said, including a 74-year-old woman. “We have a lot to do when we assess things in future days,” Mayor John Whitmire of Houston said at a late-morning news conference.

Here’s what to know:

— The forecast: Beryl, which made land-

fall as a Category 1 hurricane just before 4 a.m. in Matagorda, Texas, had maximum sustained

winds of 65 mph as of noon local time, according to the National Hurricane Center. Its center was about 55 miles north of Houston, and half a dozen tornado warnings were issued for parts of eastern Texas and western Louisiana.

The impact in Houston so far: Beryl’s deadly force cut down trees across the city and dumped so much rain that sections of highways were transformed into rivers. At least eight people had been rescued from high water, a top police official said.

The damage elsewhere: Beryl tore a deadly path across the Caribbean, killing at least 11 people as it flattened islands, inundated communities and became the first hurricane to reach Category 5 status this early in the season.

— Climate’s role: Researchers have found that climate change has increased the frequency of major hurricanes. It is also making hurricanes intensify faster and produce more rain with a higher storm surge. Beryl’s quick escalation to a major hurricane is a bad sign for the rest of the season.

Menéndez put ‘power up for sale,’ prosecution argues in bribery case

Sen. Bob Menendez, the New Jersey Democrat accused of selling out his public office in pursuit of lucrative bribes, “put his power up for sale,” a federal prosecutor said Monday, the first of at least two days of closing arguments in a historic corruption case against a sitting senator who faces up to 20 years in prison if convicted.

The prosecutor, Paul Monteleoni, described gold bars and “envelope after envelope” of cash seized from the home of Menendez — once the chair of the powerful Senate Foreign Relations Committee — as evidence of a “clear pattern of corruption” that involved promises of military aid to Egypt and financial gain for two New Jersey businesspeople, Fred Daibes and Wael Hana, who are on trial along with him. Menendez’s wife, Nadine, is also charged. Here’s what to know about the trial: — Trial timing: Prosecutors told the judge in the case, Sidney H. Stein, that their closing argument could take up to five hours — which would mean they would wrap up sometime Tuesday. Lawyers for the defendants would come next, with prosecutors having the chance to

offer a rebuttal before the case goes to the jury.

— The allegations: Prosecutors described for the jury a list of official actions they say Menendez traded for bribes. These include ghostwriting a letter from Egypt lobbying senators to release military aid; trying to quash criminal cases for Daibes and another businessperson, Jose Uribe; and introducing Daibes to a member of the Qatari royal family who could invest in a real estate development.

— Key testimony: Uribe, who pleaded guilty to bribing the senator and agreed to cooperate with authorities, was a key government witness. In June, minutes after taking the witness stand in Manhattan federal court, Uribe testified that he had bribed Menendez by giving Nadine, who was not yet the senator’s wife, a luxury car.

— Menendez’s defense: The senator’s lawyers rested their cast last week without calling Menendez to testify in his own defense. They have argued that the government has attempted to criminalize routine legislative activity and have sought to shift blame to his wife, saying she kept the senator “in the dark on what she was asking others to give her.” Avi Weitzman, one of Menendez’s lawyers, told the jury in his opening statement that Nadine Menendez “tried to get cash and assets any which way she could.”

She is also charged, but her trial was postponed after she was diagnosed with breast cancer.

— A historic prosecution: Menendez is the first senator ever indicted under the foreign-agent statute, and the first in the Senate’s 235-year history to be indicted twice in separate bribery cases. (His first prosecution ended in a mistrial in 2017.) Prosecutors have circled him for decades.

— Political fallout: The case has already dealt a near-lethal blow to Menendez’s four-decade political career. He did not run in the Democratic primary for his Senate seat last month. And while he has filed paperwork to run as an independent in November, polls show there is little chance he could win.

Biden’s strategy to make the race about Trump is suddenly in doubt

From the outset of President Joe Biden’s reelection campaign, the plan for winning was to make former President Donald Trump so unpalatable that voters uneasy with the incumbent would vote for him anyway.

But now Biden is stuck in a political tailspin, with an abysmal debate performance highlighting his inability to make a case against Trump and prompting a collective national hand-wringing about his ability to do his job while an increasing number of House Democrats say he should leave the race. To get voters to focus on the threats posed by a second Trump administration, Biden’s own allies say he first must escape his current doom loop and convince voters — even and especially fellow Democrats — that he is up to the job himself.

“The focus has to shift back to Trump and what rights we lose if he’s president,” said Rep. Eric Swalwell, D-Calif., who ran against Biden for the 2020 Democratic presidential nomination. “The last three elections have shown us if you’re the focus, you lose.”

Indeed, the Biden campaign has long sought to make Trump its focus.

That’s why Biden kicked off this year with a blistering speech about Trump’s attempt to overthrow the last election, why his allies spent millions to block the No Labels effort and why the president has tried to highlight the anniversaries of news regarding abortion rights.

And it is why Biden’s top aides thought it was a good idea to move the first debate

from September to June — to give voters the one-on-one look at Biden and Trump that the president’s team thought would recalibrate the race, lift Biden’s sagging poll numbers and remind voters what would change if Trump takes office again in January.

A predebate memo from Jen O’Malley Dillon, Biden’s campaign chair, mentioned Trump 18 times and Biden just five. Of Trump’s record, O’Malley Dillon wrote that the president “will hold Donald Trump accountable for all of it on the debate stage — and he’s raring to go.”

That didn’t happen.

Before it can, Biden now must first assuage doubts about himself, a task that his team waited more than a week after the debate to mount a full-throated attempt at doing. When it did, during Friday’s interview with George Stephanopoulos of ABC News, Biden drew a television audience one-sixth the size of the debate’s and spent nearly the entire 22 minutes parrying questions about his fitness for office.

“Trump is a profoundly flawed candidate,” said David Axelrod, a longtime skeptic of Biden’s ability to mount a presidential campaign at age 81. “It is going to be very difficult now for the Biden campaign to put the focus on him.”

“It is settled in people’s minds that this is not going to work for him, and I don’t see how there’s any coming back from it,” said John Kasich, the former Ohio governor who ran for the Republican presidential nomination in 2016 and crossed party lines to back Biden in 2020. “To run a campaign against Trump, people are like, ‘We’ve got to move on.’”

Democrats who braved the Sunday political talk shows faced a barrage of questions about Biden’s fitness for office.

Rep. Debbie Dingell, D-Mich., whose warning calls about Hillary Clinton’s weakness with blue-collar voters in her state went unheeded in 2016, appeared exasperated on CNN.

“We’ve got to stop talking about this,” Dingell said. “We need to get back to talking about Donald Trump.”

Sen. Chris Murphy, D-Conn., in his own CNN appearance, suggested Biden was short on time.

“They need to see more from the president,” he said. “I hope that we see that this week.”

There is some evidence that the Black voters who propelled Biden to his primary victory in 2020 have not yet abandoned him. Adrianne Shropshire, the executive director of BlackPAC, said her group’s post-debate polling found that support for Biden among Black voters who watched the debate had increased. But among Black voters who did not watch the debate and consumed coverage of it, there was a dip in support.

Biden on Sunday visited one of Philadelphia’s largest Black churches in an effort to reassure voters there that he’s up for the job.

There is no doubt in Democratic circles that Biden must make the election about Trump, as he did in 2020, when his winning coalition stretched from progressive Democrats to moderate Republicans.

Then, as Biden won support from Republicans and other voters who sought a return to normalcy in Washington, he ran as a transitional candidate. He said he saw himself “as a bridge, not as anything else” while standing beside Sens. Kamala Harris and Cory Booker, giving the distinct impression he was a vessel to help the country move on from its Trump period.

“The joy cometh in the morning,” Biden told churchgoers. “You’ve never given up. In my life, and as your president, I’ve tried to walk my faith.”

Even Biden’s most stalwart supporters say Democrats will lose the election if it remains a referendum on Biden’s ability to serve.

“My goal is to defeat Trump,” said Rep. Jasmine Crockett, D-Texas, who was one of the Biden campaign’s spin room surrogates after the debate. “Those calling for him to step down and those wanting him to stay in are on the same page about the fear of MAGA.”

HMS Global Maritime takes over ferry services from HMS Ferries

The Financial Oversight and Management Board approved with conditions an amendment to the contract between the Maritime Transport Authority (MTA) and HMS Ferries that would hike the ferry services contract costs by $56.6 million and transfer it to the operator’s parent company, HMS Global Maritime.

The operator and various of its affiliates are currently undergoing a Chapter 11 restructuring proceeding in the Southern District of Texas. According to the MTA, the proposed amendment is scheduled as an executory contract, which will be assumed and assigned to HMS Global as part of the Chapter 11 restructuring. The operator’s plan of reorganization was confirmed by the bankruptcy court on June 7, reducing its debt by $720 million.

“As such, the Proposed Amendment is conditioned upon the formal assumption and assignment becoming effective and on MTA providing the Oversight Board with the Operator’s formal notice of the effectiveness of the assumption and assignment as issued in its Chapter 11 case,” the oversight board said.

A proposed new amendment increases the maximum payable amount under the ferry service contract with HMS Ferries to $809.5 million without altering the term, and the Maritime Transport Authority consents to the assignment of the contract to HMS Global Maritime LLC, the operator’s parent company.

The initial contract approved with conditions by the oversight board on Sept. 30, 2020, stemmed from a tender issued on April 30, 2019 for the operation and maintenance of MTA’s ferry system between San Juan and Cataño, and between Ceiba and the offshore island municipalities of Vieques and Culebra. Specifically, the operator was selected pursuant to a public-private partnership organized by MTA in collaboration with the Puerto Rico Public-Private Partnerships Authority.

The contract has an estimated aggregate cost of $750.8 million and a term of 23 years, from its date of execution on Oct. 27, 2020 to Oct. 27, 2043, and is divided into two phases. Phase 1 constituted a three-year period in which MTA was to transfer the operation and management of the ferry system to the operator. Phase 2 comprises the 20-year period in which the operator is to provide all ferry services.

The contract was amended previously on Feb. 5 of this year to extend the Phase 2 commencement deadline from Jan. 25 to June 30 of this year, with the option to further extend upon mutual agreement, without altering the maximum payable amount.

In the proposed new amendment, which increases the maximum payable amount to $809.5 million without altering the term, MTA consents to the assignment of the contract to HMS Global Maritime LLC, the operator’s parent company. As such, HMS Global will have to satisfy all the operator’s obligations under the contract in the future.

The new amendment’s costs are to be covered entirely with general funds. Further, MTA must submit a budgetary reprogramming request through the Office of Management and Budget to reprogram $16.7 million of the maximum payable amount necessary to fund the proposed amendment.

Boeing agrees to plead guilty to felony in deal with Justice Department

Boeing agreed Sunday to plead guilty to a felony charge of conspiring to defraud the federal government over two fatal crashes of the 737 Max in 2018 and 2019, according to a late-night court filing.

In the deal with the department, outlined in part in the court filing, Boeing also agreed to pay a $487.2 million fine — the maximum allowed by law — and invest at least $455 million over the next three years to strengthen its compliance and safety programs.

The company will be put on probation, supervised by the U.S. District Court for the Northern District of Texas, for three years. As part of the probation, the Justice Department will appoint an independent compliance monitor who will make sure that safety measures are in place and followed, submitting annual reports to the government. The company will face additional penalties if any of the terms are violated. The company’s board of directors will also be required to meet with crash victims’ families.

The decision by Boeing to plead guilty is significant because the company has not been convicted of a federal felony in decades. In the filing, the department described the charge of conspiring to defraud the federal government as “the most serious readily provable offense.”

The deal reached Sunday stems from violations of an agreement that Boeing had reached with the Justice Department in 2021 that it would make significant safety changes after the two deadly crashes. The department, during the Biden administration, has made it a priority to ensure that companies like Boeing follow through on such agreements.

night, notifying the District Court that they had agreed in principle. In the next week or so, the formal agreement will be filed. The court will then set a hearing for the company to formally enter its guilty plea. Victims’ families will be able to speak during that hearing.

Families of the victims, who were briefed a week ago on the general outlines of the deal, had said it did not go far enough. Paul G. Cassell, a lawyer for more than a dozen of the families, said the families had sought an admission of fault in the deaths of 346 people who were killed in the crashes, which involved Boeing’s troubled 737 Max plane in Indonesia and Ethiopia in late 2018 and early 2019. The families had hoped for stiffer consequences for the company and its executives, including a trial.

The Justice Department acknowledged the families’ position in its court filing Sunday. In a separate document, the families said they will object to the deal and “intend to argue that the plea deal with Boeing unfairly makes concessions to Boeing that other criminal defendants would never receive and fails to hold Boeing accountable for the deaths of 346 persons.”

Cassell said the government’s agreement with Boeing is “clearly not in the public interest.”

“This sweetheart deal fails to recognize that because of Boeing’s conspiracy, 346 people died,” Cassell said. “Through crafty lawyering between Boeing and DOJ, the deadly consequences of Boeing’s crime are being hidden.”

Boeing’s decision to plead guilty does not provide immunity to any employees or corporate executives. And the deal does not protect it from charges that might come from other investigations, including one into a Jan. 5 episode on Alaska Airlines in which a panel blew off a Boeing 737 Max jet soon after the plane took off

from the airport serving Portland, Oregon. Though the blowout did not cause any major injuries, the incident could have been catastrophic had it happened minutes later when the plane had reached cruising altitude and flight attendants and passengers were moving around the cabin.

A Boeing spokesperson confirmed that the company reached an agreement with the Justice Department, but declined to comment further.

The deal updates a 2021 deferred prosecution agreement, reached in the last days of the Trump administration, that allowed Boeing to avoid criminal charges in the two deadly crashes. The company has already paid $500 million in restitution to the families of the victims and $243.6 million in fines.

Boeing’s 2021 settlement required that the company not engage in wrongdoing over a three-year period. In May, the Justice Department said Boeing broke the agreement because the company failed to “design, implement and enforce” an ethics and compliance program into its operation to prevent and detect violations of U.S. fraud laws.

As part of the 2021 agreement, the Justice Department said Boeing would have to pay only $243.6 million more if the company was in violation. But a judge will ultimately decide whether the 2021 payment counts toward the total fine, a Justice Department official said, speaking on the condition of anonymity to discuss the deal. The judge will also decide on how much more restitution should be paid during sentencing.

The 2021 charge focused on two Boeing employees who were accused of withholding information from the Federal Aviation Administration about changes Boeing had made to flight control software that was implicated in both crashes.

S&P 500 and Nasdaq notch record highs; chipmakers climb

The S&P 500 and Nasdaq notched record-high closes on Monday as investors awaited fresh inflation data, commentary from Federal Reserve Chair Jerome Powell and the start of quarterly earnings season.

Nvidia rose nearly 2%, Intel rallied over 6% and Advanced Micro Devices added 4%, lifting the Philadelphia semiconductor index 1.9%.

Traders will scrutinize consumer price data due on Thursday and producer price data expected on Friday to gauge the Fed’s progress in fighting inflation.

Investors worry that waiting too long to cut interest rates could damage the labor market and push the economy into a recession. They will closely monitor Powell’s semiannual testimony before U.S. Senate and House committees on Tuesday and Wednesday.

“What investors want to hear is a dovish tone and an acknowledgement that the two-sided risks are more evenly balanced today, in particular, with respect to the labor market,” said Ross Mayfield, an investment strategy analyst at Baird.

Expectations for interest rate cuts as early as September grew after Friday’s nonfarm payrolls report showed U.S. job growth slowed in June - the latest data to point to weakness in labor market conditions.

The S&P 500 index and technology-laden Nasdaq rose on Wednesday to post record high closes, as data pointing to a softening economy raised hopes the Federal Reserve could cut interest rates in September.

The Dow Jones Industrial Average closed slightly lower, pressured by selling in healthcare and consumer stocks during a shortened trading session ahead of the Fourth of July. The market will stay closed on Thursday for U.S. Independence Day, keeping trading volumes thin throughout the week.

Traders now see a greater than 75% chance of a rate cut of at least 25 basis points by September, up from last week’s 60%, according to CME’s FedWatch.

Citigroup, JPMorgan Chase and Wells Fargo are slated to kick off Wall Street’s second-quarter earnings season on Friday. Citigroup shares gained 1.1%, while Wells Fargo lost 1%.

It was the Nasdaq’s fifth straight record-high close and the S&P 500’s fourth straight.

Of the 11 S&P 500 sector indexes, six declined, led lower by communication services, down 1.01%, followed by a 0.59% loss in energy.

Paramount Global fell 5.3% after it agreed on Sunday to merge with Skydance Media, scripting a new chapter for one of Hollywood’s oldest studios.

Boeing gained 0.55% after the planemaker agreed to plead guilty to a criminal fraud conspiracy charge and pay a fine of $243.6 million to resolve a U.S. Justice Department investigation into two fatal 737 MAX crashes.

Advancing issues outnumbered falling ones within the S&P 500 by a 1.3-to-one ratio.

Russia strikes children’s hospital in deadly barrage across Ukraine

Ukraine’s largest children’s hospital was destroyed by a Russian missile Monday, shaking Kyiv, the capital, with images of bloodied and injured children, and sending hundreds racing to the scene to help clear twisted metal and smashed concrete in a desperate search for survivors.

The hospital strike was part of a barrage of bombings by Moscow across the country, including one of its deadliest assaults on Kyiv since the first months of the war. At least 38 people were killed across the country, including 27 in Kyiv. More than 100 people were injured. The Ukrainian air force said it shot down 30 out of the 38 missiles launched by Russia during the attack, which began in the midmorning.

“The attack was massive, combined with the use of aerial, ballistic and cruise missiles,” said Serhii Popko, the head of the Kyiv military administration. “The missiles flew at the capital in waves and from different directions.”

At the hospital, one doctor and another adult were killed and at least 10 more people were injured, including seven children, local officials said. At least three children were pulled from the rubble, Ukraine’s emergency services agency said.

Olha Melnyk, the mother of a child being treated in the oncology unit of the hospital — who was not there at the time — said she was in a state of shock.

“There were so many families like us, who had their own personal war with oncology already,” she said. “And you know, these children can’t go to the basement, because all the tubes and treatments. If they do this, there will be no healing at all, you can’t interrupt the healing session.”

The U.N. Security Council will hold an emergency meeting Tuesday to address the strikes. President Volodymyr Zelenskyy of Ukraine called for the meeting, saying President Vladimir Putin of Russia should be held accountable.

“To everything that they try to discuss with him about peace, Russia responds with strikes on houses and hospitals,” he said. “That is why we can only force Russia to make peace.”

showed a missile moving downward at high speed before striking the children’s hospital. Fabian Hoffman, a doctoral research fellow at the University of Oslo who specializes in missile technology, identified the weapon as a Russian Kh-101 cruise missile.

The type of the weapon and its trajectory suggested that Russia intentionally targeted the hospital, according to Hoffman. He said the trajectory of the missile “appears controlled,” and that it was likely programmed before launch.

Hoffman also noted that the missile was not struck by a Ukrainian air defense interceptor, and was “fully intact, with no visible damage to the fuselage.”

The Ukrainian Security Services recovered fragments of what it said was the missile that struck the hospital, also identifying it as a Kh-101 cruise missile.

The Ukrainian prosecutor’s office said seven of the casualties Monday were caused by missile debris that fell onto another medical facility, a women’s hospital in Kyiv.

The Ukrainian air force said Monday’s attacks were carried out in part by bombers operating from deep within Russian territory, where Ukraine is restricted from using Western weapons to strike. The strikes came a day before NATO leaders were

scheduled to meet in Washington, where they were expected to announce new efforts to bolster Ukraine’s air defenses.

Zelenskyy, who was in Warsaw on Monday to sign a new security pact with Poland, said the document “includes a provision for shooting down Russian missiles and drones in Ukraine’s airspace that are fired in the direction of Poland.” He said both sides were “committed to implementing it,” but he did not say when it would go into effect.

Russia has relentlessly bombed Ukraine in recent weeks, seeking to overwhelm its defenses with the sheer volume of attacks. While Kyiv has some of the most robust air defenses in the country — and thus has been largely protected from direct missile strikes — the city’s military administrator warned last month that Moscow has been testing new tactics to breach them.

Overall, the country’s air defenses are stretched thin, struggling to protect vital military assets, critical infrastructure and residential neighborhoods at the same time.

At the hospital, Volodymyr Zhovnir, the director, said more than 600 children were being treated there when it was hit.

Doctors and others inside the hospital shared images of bloodstained hallways, collapsed ceilings and destroyed operating

rooms.

Dr. Tymofii Dvorovyi, a surgeon, said he had managed to get his patients into the bomb shelter just before the strike. “I don’t know about other departments,” he said. “There were surgeons who were performing operations when the missile hit.”

After the explosion, he said, he saw scores of “badly injured” people staggering through the halls.

A two-story medical building next to the main hospital sustained the most extensive damage. Shortly after an explosion tore through it, a woman carrying a small child covered in dust and blood emerged near the entrance. More dazed and bloody staff, many carrying children, followed.

The explosion also blasted out the windows of the main hospital and sent shrapnel tearing into the building.

“Now, we are evacuating the patients to another hospital,” Dvorovyi said Ukrainian Health Minister Viktor Lyashko said intensive care units, operating rooms and the oncology department had all sustained damage.

“Maybe Russians knew that families like us are an easy target,” said Melnyk, the mother whose child was being treated at the hospital. “I just can’t believe it’s happening.”

Monday’s attacks began before dawn, when Russian bombers launched four X-101 cruise missiles and two Iskander-M ballistic missiles, the commander of the Ukrainian air force, Lt. Gen. Mykola Oleschuk, said in a statement. Three of the cruise missiles were shot down, he said, without offering details on those that evaded air defenses.

A few hours after that first strike, air alarms sounded across Ukraine as Russia launched the second, larger barrage, including the one that hit the hospital.

Three transformer substations were also destroyed in the barrage, according to DTEK, Ukraine’s largest private energy utility. All told, damage was reported in at least seven districts of the capital.

In an analysis provided to the Times after Monday’s attack, Janes, a British security intelligence firm, concluded: “Ukraine’s air defense network will have a harder time defending against saturation attacks until it is reinforced, or Ukraine gains the ability to consistently and accurately strike the assets Russia is using to launch these attacks.”

French election yields deadlock as left surges and far right comes up short

France faced a hung parliament and deep political uncertainty after the three main political groups of the left, center and right emerged from snap legislative elections Sunday with large shares of the vote but nothing approaching an absolute majority.

The preliminary results upended widespread predictions of a clear victory for the National Rally, Marine Le Pen’s anti-immigrant party that dominated the first round of voting a week ago. Instead, the left-wing New Popular Front won 178 seats.

The centrist coalition of President Emmanuel Macron, who cast the country into turmoil a month ago by calling the election, was in second place with 150 seats. Trailing it was the National Rally and its allies, which took 142 seats.

The results were compiled by The New York Times using data from the Interior Ministry, and they confirmed earlier projections showing that no single party or bloc would win a majority.

The details of the outcome may still shift, but it is clear that, to a remarkable degree, a scramble by centrists and the left to form a “Republican front” to confront the National Rally in the second round of voting worked. Candidates across France dropped out of three-way races and called for unity against Le Pen’s party.

“The president now has the duty to call the New Popular Front to govern,” said Jean-Luc Mélenchon, the far-left leader who is the charismatic but polarizing voice of the left-wing alliance. “We are ready.”

But France looked near ungovernable, with the Paris Olympics about to open in less than three weeks. The left surged, the National Rally added dozens of seats to its presence in the National Assembly, and

Macron’s party suffered a stinging defeat, with the 250 seats held by his party and its allies in the National Assembly cut by about a third.

The result was that in the sharply divided lower house of parliament, where most legislative power resides, no governing coalition appeared immediately conceivable, with Macron’s centrists squeezed between far-right and far-left groups that detest each other and him.

Jordan Bardella, the protege of Le Pen who led the National Rally to victory in European Parliament elections and the first round of legislative voting last month, called the deals that frustrated its push for an absolute majority “an alliance of the dishonorable” and said Macron had condemned France to “uncertainty and instability.”

Even with fewer seats than predicted, the National Rally has now assumed a place in French politics that erased a postwar political landscape built around the idea that the far right’s history of overt racism and antisemitism made it unworthy of positions of power.

Le Pen has disavowed that past. But even in its rebranded form, the party’s core message remains that immigrants dilute a glorified French national identity and that tighter borders and stricter regulations are needed to keep them out or prevent them from benefiting from the French social safety net.

elites gathered around Macron, who is term-limited and must leave office in 2027.

“France is more divided than ever,” said Alain Duhamel, a prominent political scientist and author. “We have learned it was a very bad idea for Mr. Macron to dissolve parliament and call this election.”

At a time when a faltering President Joe Biden is struggling to counter the nationalist America First message of former President Donald Trump, protracted French political limbo could add to an unstable international situation. Long close to Russia, Le Pen has tried to recast herself as a guarded supporter of Ukraine, but there is no question that Moscow will welcome the National Rally’s growing influence.

The New Popular Front campaigned on a platform that would raise France’s monthly minimum wage, lower the legal retirement age to 60 from 64, reintroduce a wealth tax and freeze the price of energy and gas. Instead of cutting immigration, as the National Rally vowed, the alliance said it would make the asylum process more generous and smooth.

The platform said the alliance was supportive of Ukraine’s fight for freedom against Russia, and called for President Vladimir Putin to “answer for his crimes before international justice.”

How exactly the alliance’s economic program would be financed at a time when France faces a ballooning budget deficit, and how a pro-immigration policy would be applied in a country where it is perhaps the most sensitive issue, was unclear.

The New Popular Front, which is sharply divided between moderate socialists and the far left, did very well among young people in the first round of voting, and in the projects heavily populated by North African immigrants around major cities, including Paris.

Still, Macron’s centrist alliance did better than expected at the last and he lived to fight another day.

Macron now appears to have two options, excluding resignation, which he has vowed he will not contemplate.

The first is to try to build a broad coalition that might stretch from the left to what remains of moderate Gaullist conservatives, some of whom broke a taboo during the campaign by aligning with the National Rally.

This possibility seems remote. Macron has made no secret of his intense dislike for Mélenchon; the feeling is reciprocated.

The second, less ambitious option would be for Macron to try to form some sort of caretaker government to handle current business.

Macron might, for example, ask former prime ministers from parties across a centrist bloc — his own, the Socialists, the center-right Republicans — to suggest a government of technocrats or prominent personalities who could deal with a restricted agenda over the next year.

Under the constitution, at least a year must elapse before the next parliamentary election.

One area where Macron may still be able to exert considerable influence, more than if he had been forced into a “cohabitation” with Bardella as prime minister, is international and military affairs, the traditional preserve of the president in the Fifth Republic.

An ardent supporter of the 27-nation European Union, which the National Rally wants to weaken, he will no doubt pursue his push for a “Europe power” with more integrated armies, defense industries and technological research, but his clout may be lessened by domestic weakness.

France rejected that vision, but voted overwhelmingly for change. It did not want more of the same. It sent a stinging message to the pro-business

The ardently pro-Palestinian stance of Mélenchon proved popular in these areas, even as it caused outrage when he appeared to cross a line into antisemitism, accusing Yaël Braun-Pivet, the Jewish president of the National Assembly, of “camping out in Tel Aviv to encourage the massacre.” He said of a large demonstration in November against antisemitism that “the friends of unconditional support of the massacre have their rendezvous.”

Nothing had obliged Macron to call the snap election, but he was ready to gamble he could still be a unifying figure against the extremes. In fact, he had lost the allure to do so over seven years in office. He declared left and right to be obsolete labels when he came to power in 2017. They no longer are.

Macron, once tempted by a rapprochement with Putin, has also become an outspoken supporter of Ukraine’s fight for its freedom. With the U.S. presidential election just four months away, doubts have grown over the willingness of the West to continue arming and funding Ukraine.

France, in short, faces great uncertainty, both internally and externally. It appears that a constitutional crisis cannot be ruled out over the coming months. Gabriel Attal, the outgoing centrist prime minister who offered his resignation Sunday, declared that “tonight no absolute majority can be controlled by the extremes thanks to our determination and values.”

He was claiming a small victory, but of course the center does not have any such majority either.

Joe Biden, in the goodest bunker ever

When I saw the Michael Shear story in The New York Times on Thursday, recounting how President Joe Biden had stumbled talking to Black radio hosts days after his debate debacle, telling one he was proud to have been “the first Black woman to serve with a Black president,” I knew it spelled trouble.

First of all, if any white man could claim to be “the first Black woman” in the Oval, it was Bill Clinton. Black fans called him “the first Black president,” and feminist fans called him “the first woman president.”

Second of all, we were entering a new post-debate examination period with Biden, where his every word would be scrutinized. He was always a fast and voluminous talker, and as he has gotten older, the words and ideas sometimes tumble out in the wrong order. Also, he’s more slurry now, so words get smushed together, and words and thoughts collide; words get dropped, caesuras skipped, and sentences sometimes trail off into the ether.

The Times’ chief White House correspondent, Peter Baker, told me he has started using translation headsets on overseas trips, even when he is 20 feet away from the president, because they offer a magnified volume when Biden starts to mumble.

The White House press corps, stung by critiques that they did not pull back the curtain enough on the president’s diminished powers, are now on the alert, ready to tear down the Pollyanna scrim erected by Biden’s family and aides.

The White House and the Biden campaign are so smotheringly protective that, as news outlets reported, Biden aides helped draft the questions that local radio hosts asked the president after his calamitous debate.

In going through Biden’s verbal mistakes in his Times story, Shear used the phrase, “He appeared to mean …”

And that is going to be a big issue moving forward. A panicky White House is going to be persnickety, acting as though journalists are unfairly picking on the president about every gaffe, berating them when they don’t properly interpret the president’s elisions and jumbles. Joe Scarborough, a supporter and confidant of the president, took to the social platform X to mock the “breathless NYT syntax blogs.”

But how the president puts words together — or doesn’t — happens to be a life and death matter. We’re now dwelling in a murky area of what the president intended to say, or what he said that was incomprehensible, and whether we should take the White House interpretation.

Journalists are going to be appropriately resistant to making corrections based on what the White House asserts Biden said, or its version of what Biden intended to say. It’s not our job to play Mad Libs with the president.

Biden’s word salad and sudden drops in volume to pianissimo are relevant for reporters to cover because they’re a microcosm of the questions at the heart of the 2024 Democratic campaign: Is the president’s mental state strong enough to beat Donald Trump and can he serve for four more years? The desperate Biden team is ready to go to war over every syllable.

In my Saturday column, I quoted Biden’s line to ABC’s George Stephanopoulos, about how he would feel if Trump were sworn in as president because he refused to step aside: “I’ll feel as long as I gave it my all and I did the goodest job as

I know I can do, that’s what this is about.”

Now, “goodest” isn’t a word. But my researcher, Andrew Trunsky, and I listened to the video, our ears up against the computer, 10 times, and that’s what it sounded like. We also checked the ABC News transcript and that’s the word they used. Times news reporters and reporters for other news outlets took their cue from the ABC transcript.

The confusion was so universal that on Axios on Saturday, there were two different versions: Mike Allen’s newsletter used “goodest” and another story used “I did as good a job as I know I can do.”

After my column posted Saturday morning, T.J. Ducklo, a Biden campaign spokesperson, emailed me to “flag” that ABC News had updated its transcript to read: “I’ll feel as long as I gave it my all and I did the good as job as I know I can do, that’s what this is about.”

Ducklo asked if I could “tweak” the column and change the word “goodest” to make my piece “consistent with the corrected transcript,” even though the revised version was also gobbledygook.

When I said we would tell our editor what he thought, Ducklo wrote back: “Yeah again, it’s not what I think. It’s what ABC News, who conducted the interview, thinks. I think it would be quite unusual if the Times asserted the president said something that the news organization who conducted the interview says he didn’t say …”

Andrew and I both emailed Ducklo, asking whether ABC had changed the transcript on its own or if the Biden team had asked them to change it.

“ABC News, like any news organization, makes their own independent editorial decisions,” Ducklo replied to us. “surely you are not suggesting otherwise.” He emailed again to add: “Had another convo on this. ABC News received the tape and confirmed the error to us. Then made the correction.”

I was more confused than ever. What tape? From whom?? Why the runaround??? Given the White House’s egregious cover-up about Biden’s sag from aging, the spokesman’s coyness seemed de trop. By Saturday night, Shear and Michael Grynbaum had a Times story clearing up things. Indeed, the White House had asked ABC News to check whether the president said “goodest” or “good as,” after White House stenographers, who had recorded the president on ABC News, noticed the discrepancy between their recording and the network’s transcript.

The Times attached notes on my column and all the news stories that had used “goodest,” explaining the befuddlement.

Whatever the president meant, his answer to that question went over like a lead balloon. No one cares if he feels good about himself in a losing cause.

It might seem like much ado about goodest. But it’s a harbinger of tense times between a White House in bunker mode and a press corps in ferret mode.

Maybe the White House should think about closed captioning.

El CoC PR 502 expresa su profunda preocupación y desaprobación ante la reciente decisión del Tribunal Supremo de Estados Unidos que permite a los municipios criminalizar el dormir en espacios públicos, tal como ocurrió en Grants Pass, Oregon. La decisión de 6 a 3 establece que las personas sin hogar no están protegidas por la Octava Enmienda, que prohíbe los castigos crueles e inusuales, estableciendo un precedente peligroso para todas las jurisdicciones en los EE.UU.

“Esta decisión del Tribunal Supremo es un golpe devastador para las personas sin hogar en todo Estados Unidos, incluyendo Puerto Rico”, declaró Belinda Hill, presidenta del CoC PR 502. “Eliminar cualquier protección para las personas vulnerables y permitir su criminalización es una medida inhumana y contraproducente.”

Por su parte, la secretaria del Departamento de la Familia, Ciení Rodríguez Troche, añadió: “El fallo del Tribunal Supremo subraya la necesidad imperante de continuar implementando políticas públicas que garanticen el acceso a viviendas seguras y asequibles. No podemos permitir que nuestra población más vulnerable sea castigada por circunstancias fuera de su control. La política pública de esta administración ha sido la de trabajar para asegurarnos que la población de personas sin hogar, que cada vez es una más diversa, pueda tener acceso a los servicios y las oportuni-

dades que necesitan para tener una vida digna, según establece nuestra Constitución”.

El CoC PR 502 hace un llamado a todas las partes interesadas a trabajar conjuntamente en la creación de soluciones sostenibles que prioricen la dignidad y los derechos humanos de las personas sin hogar. Además, el CoC PR 502 lanzó una campaña de orientación para ofrecer asistencia a las personas sin hogar o en riesgo de perderlo.

Liz Mónica Lamboy, directora ejecutiva del CoC, explicó que esta campaña, “Un hogar para todos” está diseñada para que las personas sin hogar o en riesgo de perderlo sus familiares, vecinos o amistades puedan conocer los recursos disponibles existentes para que una persona pueda ser ubicada en una vivienda digna en el menor tiempo posible.

Alec Baldwin heads to trial in ‘Rust’ movie shooting: Here’s what to know

The winding prosecution of Alec Baldwin over the fatal shooting on the “Rust” film set is set to arrive at a trial this week in New Mexico, where a jury will be asked to decide whether his role in the death of the movie’s cinematographer amounts to involuntary manslaughter.

The case revolves around the events of Oct. 21, 2021, when the gun Baldwin was rehearsing with discharged a live bullet that killed the cinematographer, Halyna Hutchins, and wounded the movie’s director. The weapon was supposed to have been loaded with inert rounds that could not fire.

The initial announcement that prosecutors were bringing a criminal case against Baldwin was met with shock from Hollywood, where many consider on-set gun safety the responsibility of a production’s weapons experts and safety coordinators, not its actors. (The movie’s armorer, Hannah Gutierrez-Reed, has already been convicted of involuntary manslaughter and sentenced to 18 months in prison.)

The case has put those Hollywood norms to the test and the conduct of Baldwin, a fixture of the television and movie industry for decades, under a microscope. The proceedings are expected to be highly contested by his lawyers, who have argued for months that the prosecution is a misguided bid to secure a high-profile conviction of a celebrity.

The trial is expected to last about two weeks at the Santa Fe County District Courthouse, where the proceedings will be livestreamed. Jury selection is scheduled to begin today.

Why do prosecutors say he’s guilty?

The special prosecutors in charge of the case, led by Kari T. Morrissey, have argued that Baldwin, 66, flouted industry rules around firearm use, citing industry guidelines that urge actors not to place their finger on the trigger of a gun before they are ready to shoot and to never point a weapon at anyone.

“These are the rules for actors handling firearms on movie sets and Mr. Baldwin managed to disregard every single one of them,” Morrissey wrote in a court filing.

Although those industry guidelines do not require that an actor independently check the gun on set, prosecutors have argued that Baldwin had a responsibility to do so under the law.

Prosecutors want the judge to allow

them to show jurors video footage that they say furthers their argument that Baldwin was careless with safety on set, including video of him using his gun “as a pointer” outside of acting sequences and firing his weapon after “cut” was called. Another video they want shown at trial shows what they describe as Baldwin rushing the armorer by urging her to reload his revolver quickly.

They are also expected to argue at trial that just before the gun discharged a live bullet, Baldwin had failed to follow instructions from the director, Joel Souza, who has said that the particular take called for the actor to slowly pull the gun from its holster, not point the gun outward.

“He ignored direction from Mr. Souza and without warning, acted on his own volition,” Morrissey wrote in court papers.

What is the defense’s argument?

Baldwin, who was both a lead actor and producer on “Rust,” has pleaded not guilty to the manslaughter charge and has long denied responsibility for Hutchins’ death. Weeks after the shooting, he said in a television interview that Hutchins had been directing him where to point the gun and that the gun had discharged suddenly, without him pulling the trigger.

Prosecutors have said forensic testing rebuts Baldwin’s account that he did not pull the trigger, but the actor’s lawyers have focused on evidence that they say indicates the gun could have been prone to malfunction, pointing to odd marks on an internal part of the revolver.

Regardless of the trigger question, the defense has argued that Baldwin cannot be found guilty because he had no reason to believe that the gun had been loaded with a live bullet. Witnesses have said the crew was told that the gun was “cold,” meaning it did not contain live ammunition; in general, live ammunition is banned from film sets.

To convict him of involuntary manslaughter, the jury must find that the actor was aware of the risk caused by his conduct and ignored it.

“Nobody believed the gun Baldwin was holding was capable of discharging anything, let alone a live bullet,” one of Baldwin’s lawyers, Luke Nikas, wrote in court papers. “It was a prop on a movie set, and the actor had been told by the responsible professionals that it held no live ammunition.”

The defense has laid blame at the feet of Gutierrez-Reed and Dave Halls, the movie’s first assistant director and safety coordinator, and has fought the prosecution of Baldwin at

every turn, calling it an “abuse of an innocent person whose rights have been trampled to the extreme.”

Why was there live ammunition on a movie set?

Since the fatal shooting, the biggest mystery has been how live ammunition ended up mixed in with dummy rounds, inert cartridges that are used to resemble real ones for the camera.

Five other live rounds were found on set after the shooting, and prosecutors in Gutierrez-Reed’s trial argued that she was the one responsible for bringing them. The armorer’s lawyers denied that she was the source of the live rounds and are appealing her conviction.

Who is expected to testify?

The witness lists for both the prosecution and the defense contain members of the “Rust” production, including Souza; Seth Kenney, the primary supplier for guns and ammunition for “Rust”; and several crew members who have sued Baldwin over the shooting. One of those crew members, Ross Addiego, took the stand in Gutierrez-Reed’s trial and said that he did not think

Baldwin had followed gun safety rules and that the production had cut corners in a way that endangered the cast and crew.

One of the defense’s assets is Halls, who took a plea deal after admitting that he failed to properly check the gun the day of the shooting. He has made some statements that are helpful to Baldwin’s case, including that Hutchins had been in communication with the actor about where to point the gun. Law enforcement officers who investigated the case and gun experts are also expected to take the stand.

Prosecutors hoped that Gutierrez-Reed’s testimony would help their case, based on her previous statements that Baldwin was inattentive during weapons training, but she declined to answer their questions in a pretrial interview in prison, indicating that she was not likely to be a cooperative witness.

It is not clear whether Baldwin will take the stand himself.

This summer in Paris: More ‘open’ signs, thanks to the Olympics

Anyone who’s visited Paris in late July and August knows the word “fermé.” It adorns the darkened windows of chic indie boutiques and cozy bistros whose owners, along with other locals, have fled the city on their annual vacations.

This summer, with Paris expected to draw nearly 15 million visitors between July 26 and Sept. 8 for the Olympic and Paralympic Games, that ritual is anything but certain. Many shopkeepers, bakers, restaurateurs and tour guides — citing patriotism as well as profit — say they’re planning to stay open.

It’s a decision that comes with unpredictability. The 2012 London Olympics have cast a long shadow in Paris. Before those Games, warnings of overcrowded roads, congested transit and security concerns emptied out much of the popular city center and the West End, causing a tourism slump in those areas. Smallbusiness owners in Paris are hoping history does not repeat itself.

The French capital is in a better position than the British capital was, insisted Pierre Rabadan, Paris’ deputy mayor for sports. Most of the events in London were held in one section of the city, he said, while in Paris, they’re taking place all over. “So when businesses have asked if they should stay open,” he explained, “we tell them we’re trying to create the conditions for this to be a real opportunity and for the city to function normally.”

With streets restricted, Metro stations closed and public transportation likely to be jammed, “normally” might be a stretch. But if you’re traveling to Paris for the Olympics or Paralympics, you will most likely find more dining and shopping options than you would otherwise see at that time of year. Here’s what to expect.

Preparations and a few disruptions

“If you want to have your ‘Emily in Paris’ trip to Paris this summer, you absolutely can,” said Olivia Grégoire, France’s minister in charge of tourism. Most popular attractions will remain open as normal, but a few closures could complicate plans.

The Place de la Concorde was set to be blocked off, even to pedestrians and cyclists, as of June 1, and three nearby Metro stations will close until Sept. 21.

day of the opening ceremony, July 26. The region’s airspace will also be closed for six hours before and during that event. And because the opening ceremony is set to take place on the Seine, river cruises, among the city’s most popular sightseeing experiences, will stop seven days before the ceremony and resume on July 27 at noon.

Owners of businesses that focus on tours and cultural experiences are banking on early-summer visitors to soften the blow that might come from a drop-off during the Games, after the Paris Tourist Office reported that participation in cultural activities was down 15% during the London Olympics.

Fat Tire Tours, a leading bike tour company, will run special Olympics-themed tours in early summer, then pivot to bike rentals during the Games to compensate for an expected drop in tour bookings.

Jane Bertch, a co-owner of La Cuisine Paris cooking school, which offers English-language classes in a location near City Hall, said she had noticed a sharp drop in bookings for late summer, but will “run as many classes as possible.”

Rising to the challenge

The Olympic crowds will bring appetites for Paris’ renow-

ned cuisine, but for months, restaurateurs worried that restrictions on motorized vehicles in security zones around the city’s 25 competition venues could curtail deliveries. City officials have calmed some of those nerves.

“We don’t want restaurants to close during this monumental event because they’re worried about deliveries,” said Grégoire Ambroselli, a co-founder of the food logistics startup Choco, during an Olympics-related conference in March.

Now, armed with more clarity on how to adapt to delivery challenges, most restaurants and bakeries report they will stay open during the Games, with one big caveat: Many plan to take a break between the closing ceremony, on Aug. 11, and the start of the Paralympics, on Aug. 28.

Maslow, a soaring, centrally located vegetarian restaurant facing the Seine, wouldn’t dream of closing, given its proximity to the Olympic action. But that decision comes with some unease. “We’re staying positive because the energy will be incredible, but we’re a bit worried about how hard it will be for our staff to get to work,” said executive chef Mehdi Favri, who is also a co-owner.

Commuting has ranked high among businesses’ concerns. However, locals have faced similar hurdles getting to work before. In 2019, trains across France and public transport in Paris were severely disrupted for nearly two months during a nationwide pension reform strike, forcing workers to walk or cycle long distances.

André Terrail, the owner of the Michelin-starred restaurant La Tour d’Argent, which overlooks the Seine, doesn’t think the Olympic commutes will be quite that complex but admits such challenges, in general, are the price of doing business in Paris. “It’s going to be complicated. We’re all going to be running around. But it’s also going to be amazing,” he said. “If other host cities have found solutions, so will we.”

Etheliya Hananova, a co-owner and sommelier at the contemporary French restaurant Comice, is perhaps the most enthusiastic about the summer ahead — enough to remain open seven days a week for three weeks through Aug. 10. “It’s one of the biggest events in the history of Paris. We’re here to be part of the welcoming committee,” she said.

Our favorite workouts of 2024, so far

The sun is out, the days are long and it feels like everyone is outside exercising. Building a fitness habit requires commitment and creativity, and summer is the perfect time to start.

Being disciplined about movement doesn’t mean you have to be a gym rat or marathon runner; part of developing a routine that sticks is finding a way to move that makes you happy.

The first step, of course, happens before you even lace up your shoes. We all have our favorite excuses for why we don’t work out enough, and some of them can be paralyzing. The way through starts with setting comfortable expectations and just creating some accountability. You might have to hack your brain now and then to get started, but the most important thing is to be persistent and forgiving of yourself when you backslide.

Here are a few of our favorite workouts so far this year — whether your goal is to bench 230 pounds, up your pickleball game or just squeeze in a high-intensity routine when you barely have time to exercise.

BUILDING STRENGTH

Power hungry

We’ve written a lot about the impor-

tance of building and maintaining strength, especially as one gets older. But you don’t just need strength, you also need power, or the ability to deploy strength quickly. Strength helps you dig a shovelful of snow, power helps you dump it. Strength lowers you into a chair, but power gets you out again.

Building power doesn’t have to be hard, but it does require concerted effort.

Break your strength rut

Even for those who strength train twice a week, every week, it’s easy to fall into a routine and plateau. And while any form of strength training is good, it’s important to know how to build on it too.

If you want to break through to the next level, the key is what experts call “progressive overload.” It’s a simple concept — just consistently increase the weight or intensity of your exercise each week — but it can be hard to actually pull off.

Exercise like an animal

Over the past decade, there has been a quiet revolution in exercise circles. Maybe your trainer suggested an exercise where you crawl around like a bear, or your favorite HIIT workout now includes a crab walk.

These animal-inspired exercises go by many names, but they can be an excellent way to build functional strength that can help you during everyday activities. They may look a little silly at first, but they gener-

ally don’t require any equipment and can be done just about anywhere.

And, as such, you can train to get better at it. Yes, increasing your cardio is important, but how strong are your pelvic floor muscles? What about your hips and core?

PR men’s basketball team is Olympics-bound after 20-year drought

Puerto Rico put the finishing touches on a dream week Sunday night with a historic 79-68 victory over Lithuania to win the 2024 FIBA Olympic Qualifying Tournament in San Juan and punch the last ticket to the 2024 Summer Olympic Games in Paris.

The backcourt duo of José Alvarado and Tremont Waters led the way in front of 2004 legends such as Carlos Arroyo and an ecstatic crowd of 13,504 at José Miguel Agrelot Coliseum in Hato Rey as Team Puerto Rico qualified for the Olympics for the first time in 20 years.

“This game was everything we worked for,” said Alvarado, who was named both player of the game and tournament MVP. “For us, for the island, we knew it was more than basketball. We knew how great we had to be to represent this island. As a kid, I wasn’t born on the island so I’m learning so much about this game and the history that came with it. I’m just so happy to be a part of it. JJ [Barea], Carlos [Arroyo] and all those greats that were here created a path for us.”

Puerto Rico’s offense came in a series of potent waves throughout the game, starting with an 11-3 first-quarter lead before Team Lithuania gathered itself and evened things up at 19 apiece at the end of the opening frame.

Led by Waters, Puerto Rico then went on an 11-0 run in the second quarter to turn a 6-point deficit into a 37-32 advantage, and a 39-35 lead at the half.

Puerto Rico extended the lead to as many as 14 points

The Azucareros of Yabucoa earned the last ticket to the Double A Superior Baseball League semifinals on Sunday by defeating the Patrulleros of San Sebastián, 9-0, at Néstor Morales Stadium in Humacao.

Along with Yabucoa, the Titanes de Florida, Toritos de Cayey and Mulos de Juncos compete in the tournament semis. The Yabucoa-San Sebastián game was completed after being suspended due to rain on June 28, with the score 8-0 in

in the third quarter and led by 12, 62-50, going into the final frame.

Lithuania hung around in the fourth quarter, cutting Puerto Rico’s lead to eight points, 76-68, on a 3-pointer by Marius Grigonis with 42 seconds left in a case of too little too late.

Alvarado, a 26-year-old from Brooklyn, set the tone for Puerto Rico throughout with suffocating defense, blinding speed and deadly accuracy from beyond the arc.

The New Orleans Pelicans guard scored 10 points in a key stretch of the third quarter when Puerto Rico took control. He finished with 23 points, 6 rebounds and 2 steals while shooting 9-for-14 from the field and 4-for-6 from outside the arc.

Waters, a standout for the Carolina Giants in the National Superior Basketball league (BSN by its initials in Spanish), scored 18 points, with 3 assists and a pair of steals. Jordan Howard (Manatí Bears of the BSN) added 12 points off the bench.

Lithuania was led by Rokas Jokubaitis (16 points and 3 assists), Domantas Sabonis (10 points, 9 rebounds and 2 blocks) and Edgaras Ulanovas (8 points, 6 rebounds, 4 assists and 5 steals).

“We let this game get away from us,” Sabonis said. “We couldn’t find ways to score on the offensive end and especially get stops when we needed to.”

Puerto Rico managed to both play fast and under control, finding better ball movement in the second half and raining down a storm of three-pointers.

Exactly 20 years after Puerto Rico shocked the world by defeating the United States in Athens, the men’s national basketball team is returning to the Olympics where they’ll share Group C with the U.S., Serbia and South Sudan in Paris.

Nelson Colón’s squad shot 12-for-25 from 3-point range, and the boricuas also held their own on defense, limiting Lithuania to just 6 three-pointers and 42% shooting from the field overall.

“My 12 players, they’re the heroes,” Colón said. “We made history tonight. We beat two of the most powerful teams in the world here on our island and in front of our people because we believed and we prepared ourselves for this moment.”

Elsewhere in the Carnival of Champions on Sunday, the Peces Voladores of Salinas finished with a 5-2 victory over Juncos. Right-hander Yadiel Rolón was the winning pitcher with five innings and Jonerick Hernández took the loss. Raúl Febus homered and Pedro Nazario scored a pair of runs for Salinas, which closed the round robin tournament at 3-3, while Juncos fell to 5-2.
