Retailers: PREPA debt plan could force up to 20% of island businesses to close

Environmental groups to challenge utility’s DAP in court on the grounds that it violates Puerto Rico’s energy public policy

While environmental groups said Monday that the Puerto Rico Electric Power Authority’s (PREPA) debt adjustment plan will hinder the transition to renewable energy sources, the United Retailers Association (CUD by its Spanish acronym) said it will also cause business closings.

CUD President Lourdes M. Aponte Rodríguez said at a news conference that the debt deal will lead to a debacle for small and medium-size businesses (SMEs) because they will not be able to afford rate hikes.

A study by Gustavo Vélez, an economist, indicates that some 20,000 to 40,000 jobs could disappear in the next two years because of the continuous increases in energy costs, which could cause the closure of 15% to 20% of businesses on the island.

of fossil fuels and because the costly “inheritance charge” or “sun tax” penalizes residential (rooftop) solar within the net metering schedule.

The entities have previously presented their arguments to the federal Title III bankruptcy court in a report produced by renewable energy systems expert Agustín Irizarry Rivera. The engineer concluded that the inheritance or legacy charge that the Financial Oversight and Management Board intends to impose through the debt deal would create an energy burden on islanders that could only be escaped by leaving Puerto Rico or by partially or totally disconnecting from the electrical grid.

The energy expert also concluded that the proposed legacy charge would penalize consumers who have embraced renewable power generation through net metering by making rooftop solar more expensive.

“We are sending Judge Laura Taylor Swain a copy of this study [Monday] …” the CUD leader said. “We cannot allow an additional increase of 28% on the electricity bill. Merchants can no longer bear the increases in operating costs and the aid to this class, which drives the economy of Puerto Rico, is scarce. Our SMEs represent 95% of the establishments on the island, and 43.6% of the jobs created in Puerto Rico.”

According to data from Vélez, micro-businesses estimate that their electricity costs would represent 13% to 17% of general expenses if electricity costs increase, while small businesses estimate that they would be 13.1% to 17.1% of their costs. Midsize companies estimate that the numbers are 15.3% to 19.9%.

Another piece of information that emerges from the study by Inteligencia Económica Inc. is that the cost-reduction measures implemented by SMEs include reducing material purchases (36.6%), reducing the workforce (37.4%), cutting operating hours (42.1%) and delaying investment plans (60.9%).

The study also confirms that supportive policies, financial incentives and accessible resources are critical to facilitating and accelerating energy adoption.

While the CUD laid out the impact of the debt plan on their sector, eight environmental and community organizations said they will also object to the PREPA debt adjustment plan (DAP) in U.S. District Court because it would hinder the transition to distributed renewable energy.

The organizations also said the debt plan violates Puerto Rico’s energy public policy because it interferes with PREPA’s obligation to end power generation through the burning

Arroyo, from Earthjustice, pointed out that “the expensive burden imposed by the Plan on the people, businesses and institutions of Puerto Rico violates the Public Energy Policy of Puerto Rico and the legislative mandates in this regard by penalizing residential solar energy and hindering the energy transition in Puerto Rico.”

“We reject the Puerto Rico Electric Power Authority debt adjustment plan presented by the Puerto Rico Fiscal Control Board (sic),” said Federico Cintrón Cintrón of El Puente de Williamsburg Inc.-Enlace Latino de Acción Climática. “The Puerto Rico Energy Public Policy Act calls for Puerto Rico to draw 40% of its generation from renewable energy sources by 2025, 60% by 2040, and 100% by 2050.”

Although it is subject to change, the PREPA DAP proposes to restructure PREPA’s debt principally through issuance of $5.68 billion of new bonds to fund partial recoveries on creditors’ claims. PREPA owns about $8.26 billion in revenue bonds, plus some $218 million in prepetition accrued interest on such bonds. The utility also owns $700 million in fuel line loans and projects roughly $246 million to $4.9 billion in general unsecured claims. It also has over $3 billion in unfunded pension liabilities.

Under the proposed plan, PREPA will pay for the new bonds over 35 years through revenues from a legacy charge to PREPA’s customers.

Lodging groups denounce shortcomings of bill to regulate short-term rentals

The presidents of the Paradores & Small Inns Association of Puerto Rico and the Bed & Breakfast Association accused lawmakers of damaging House Bill 1557 (HB 1557) to benefit short-term rentals to the detriment of hotels and hostels.

They asked lawmakers to rework HB 1557 -- which sought to register and regulate shortterm rentals, better known as “the Airbnbs” -- responsibly taking into account the use of best practices already implemented and tested in other tourist destinations.

“We believe that HB 1557, at its inception, was a step in the right direction, but it has been severely damaged, with last-minute amendments to benefit short-term rental digital platforms such as Airbnb, and is intended to put the business of hosting short-term rentals above our laws and regulations,” stressed Xavier A. Ramírez Rodríguez, president of the Paradores & Small Inns Association.

hosts of short-term rentals, does not consider the proliferation of illegal hotels located throughout Puerto Rico, and seeks to limit the intervention of municipalities and regulatory agencies on the island.

The Paradores Association, as it is widely known, said HB 1557 prevents regulatory agencies from inspecting short-term rentals but calls for the Puerto Rico Tourism Company

(PRTC) to promote them, which the group said is absurd and substantially distances itself from the mission and quality and safety protocols of the PRTC.

“Certainly, short-term rentals are important for the development and growth of tourism and facilitate the dispersion of tourism on the island; but they are a commercial activity, and must comply with all current and applicable laws, regulations and ordinances, and they must contribute equitably to maintaining the infrastructure and public services they use to operate and expand their businesses,” said Eddie Ramírez, president of the Bed & Breakfast Association.

“My family and I operate a five-room bed & breakfast in Old San Juan, and multiple permits, licenses, insurance, and operating fees are required for me, while in the city, there are dozens of buildings with multiple unregistered short-term rentals that contribute nothing and operate without consequences,” Ramírez added.

Ramírez said the mandatory registration of all short-term rentals is key to the success of the regulation. He criticized HB 1557’s focus on short-term rentals marketed by digital platforms such as Airbnb and Vrbo, ignoring the changes occurring in the short-term rental

segment. In the United States, digital platforms represent less than 40% of rentals. Still, online travel agents, such as Booking.com, account for about 28%, and the sector’s movement is toward direct reservations, which has already reached about 22% of income, making it difficult to control the payment of a room tax.

He revealed that fewer than 6,000 shortterm rentals are registered in the Tourism Company. At the same time, various reliable studies indicate that there are more than 30,000 short-term rental rooms, concentrated in cities of high tourist interest. Discover Puerto Rico reported sales of over $1.3 billion in 2021 and 2022, with an additional 14% increase expected in 2023.

“Puerto Rico needs and deserves an adequate and balanced regulation for the commercial segment of the short-term rental,” Ramírez said. “HB 1557 should be amended to close the tax evasion gates of the commercial segment of short-term rentals, which exceeds $125 million annually, including nearly $20 million in room tax. We have even recommended that our legislators use and adapt the legislation of the Virgin Islands or other North American jurisdictions, which are much more advanced and robust than what is proposed in HB 1557.”

The international airports of Aguadilla and Ponce registered increases in passenger movement of 44.6% and 63.5%, respectively, from January to April, compared to the same period of 2022, Puerto Rico Ports Authority Executive Director Joel A. Pizá Batiz said Monday.

The Ports chief said Rafael Hernández International Airport (BQN by its air code) in Aguadilla registered 280,369 passengers between January and April of this year, compared to 193,861 registered in the same period of 2022. That represents an increase of 86,508 passengers. Mercedita International Airport in Ponce (PSE) meanwhile registered 86,232 passengers compared to the 52,741 for the same comparative period, representing 33,491 additional passengers.

In the air cargo area, the BQN recorded 47,805,048 pounds versus 39,517,730 pounds in the same comparative period, which equates to an additional 8,287,318 pounds, or a 20.9% increase. For its part,

the PSE registered 5,999,210 pounds versus 3,779,554 pounds in the same comparative period, which is equivalent to an additional 2,219,656 pounds, or an increase of 58.9%.

“We are pleased with these achievements in increasing passengers and air cargo, as we have been working toward that, and to maximize the development of our facilities,” Pizá Batiz said. “These statistics reflect that we are in a consistent recovery, considering that the comparative periods include the low season for aviation in Puerto Rico, which are the months of February and March.”

Puerto Rico Tourism Company Executive Director Carlos Mercado Santiago added that “as we recently announced, the closing projections for fiscal year 2023 point to historically high figures in all lines of the tourism sector, including with regard to air access.”

Loíza Mayor Julia Nazario Fuentes, president of the Popular Democratic Party (PDP) Women’s Organization, met over the weekend with a group of party members, as well as with PDP President Jesús Manuel Ortiz González and his wife Myriam Pérez Ruiz, to initiate several processes of reorganization by districts and to approve a “Manifesto onViolence Against Women and Girls.”

“As part of the processes we are carrying out in our organization, we are taking sides on the important issues in Puerto Rican society, and violence is one of them, but particularly against women and girls,” Nazario Fuentes said.

“Violence against women and girls is a serious violation of human rights, as well as an affront to dignity …” the manifesto reads. “We welcome the United Nations (UN) definition of violence against women as ‘any act of gender-based violence that results in, or is likely to result in, physical, sexual or psychological harm to women, including threats of such acts, coercion or arbitrary deprivation of liberty, whether occurring in public or private life.’

“The voices of popular women are raised on behalf of all women who today or in the future are victims of discrimination,

physical violence, verbal violence, sexual violence, emotional violence or human trafficking.”

The manifesto in its language considers the current situation in Puerto Rico to be a crisis and calls for an environment

where respect and accountability prevail.

“We emphatically repudiate any act of violence and will be vigilant to ensure that our party’s regulations are complied with so that any elected or unelected member of our party who is formally accused of a violent act against a woman is immediately punished,” the manifesto says.

Elected officials should be removed from office and victims must receive all help to “get up and move on,” the document says.

“But we also understand that the perpetrator must receive all the necessary psychological help since otherwise, history will repeat itself again and again. Violence against women and girls is rooted in discrimination based on gender and power,” reads the manifesto. “From our perspective, there is much to do with education and families. That is why we intend to work on a scientifically based document to present it to our party and that it will eventually be presented as part of our government plan.”

PDP women from the 40 representative districts, as well as from the eight senatorial districts that make up Puerto Rico, participated in the event.

“We will continue to hold these types of events, as well as training on effective leadership and electoral issues,” Nazario Fuentes said.

PDP issues manifesto on violence against women and girls San Germán to establish ties with Seville, Spain

Guided by a commitment to tourism and economic development, San Germán Mayor Virgilio Olivera Olivera met over the weekend with the newly elected deputy mayor of the City of Seville, Spain, Minerva Salas López, with whom he spoke extensively about the creation of bonds of brotherhood “that seek to strengthen our relationship with Spain, through history, culture and gastronomy.”

The meeting occurred in Spain as part of the “Cultural and Educational Mission” between the Puerto Rico Department of State and Spain, in which Secretary of State Omar Marrero Díaz participated on behalf of Gov. Pedro

Pierluisi Urrutia, along with Assistant Secretary of State Félix Lizasuain, University of Puerto Rico (UPR) President Dr. Luis A. Ferrao, UPR-Río Piedras Campus Chancellor Dr. Angie Varela, Interamerican University of Puerto Rico (UIPR) Director of Internal Affairs Dr. Ramón Ayala, the consul general of Spain in Puerto Rico, ambassador Josep María Bosch, and various representatives of the Spanish government, among many other people.

Among the places visited by Olivera were the headquarters of the Cervantes Institute in Madrid, and the General Archive of the Indies, directed by Esther Cruces.

“This place (the General Archive of the Indies) is one of the most important in the history of humanity, so I have just left a few words on behalf of all the sangermeños,” the mayor of San Germán said in a written statement. “Here is a book of minutes that contains part of the very important history of San Germán, in fact, it speaks even of the population.”

Olivera added that “we leave our commemorative medal of the ‘450 Years of Foundation in Las Lomas de Santa Marta.’”

“The reason for our visit to Spain is the creation of alliances of brotherhood between the City of Seville and the City of San Germán, as part of our celebration of the ‘450 Years of Foundation in Las Lomas de Santa Marta,” the mayor emphasized. “What we are looking for is an exchange of opportunities, under the banner of tourism,

arts, culture, education and economic development.”

Olivera expressed great satisfaction with the meeting he had with Salas López, with whom he hopes to sign the “Brotherhood Agreement” soon.

“For us, it is very important to continue promoting the history that unites us as Puerto Ricans and Sangermeños,” he said. “It is extremely important to promote economic development through cultural tourism, religious tourism and gastronomic tourism. We (Spain and San Germán) are united by history.”

‘One of the greatest we’ve had’

The single-star flag reigned supreme across 5th Avenue at Sunday’s National Puerto Rican Day Parade

On 5th Avenue in New York City on Sunday, the 66th National Puerto Rican Day Parade took place, from 44th Street to 79th Street. Despite the air pollution caused by wildfires in Canada hundreds of miles away from The Big Apple, on the day of the parade the smoke had left the scene and attendance surpassed all expectations, with nearly 40,000 individuals participating in the parade and an estimated one million people watching from the sidelines.

The smoke produced by the wildfires had all officials and representatives of the participating organizations on edge leading up to parade day, because those conditions were the main cause of the cancellation of the reception hosted by Mayor Eric Adams at Gracie Mansion earlier in the week. Compared to the reception -- a significantly smaller activity with fewer people involved -- the parade would depend entirely on the weather conditions as it takes place completely outside. However, thanks to the good weather conditions, the annual event was celebrated with no setbacks.

“It was almost like a miracle; we were

very concerned in regards to the wildfire situation, but on the day of the parade we were extremely surprised to see not a single cloud of smoke in the sky,” parade credentials official Wilson Nazario Torres told the STAR. “On top of that, that day was my 51st anniversary as a credentials area official, so to have the parade be celebrated despite all of the adversity we were facing, was a delightful thing to see. People didn’t want to go out because of the smoke and on top of that, this is only the second parade after the pandemic started, so the odds were not in our favor. Puerto Rican Week had already been affected because of the smoke; we didn’t want the parade to be canceled. Thankfully, it was one of the greatest we’ve had in the last nine years and the attendance was much greater than it was last year.”

Nazario added that he alone certified 21 different radio station teams, including technicians and reporters, all from Puerto Rico. He also stated that one of the things that made this event so special, on top of the attendance, is the fact that Puerto Ricans are the second-largest Hispanic group in the mainland United States, and despite Mexicans having a larger population in the U.S., the National Puerto Rican Day

Parade is the largest Hispanic marching event in the nation.

“There was a larger effort this year in terms of raising the profile of the island,” Nazario said. “This was achieved by having much better coverage and sending a great number of important people from the island, including politicians, musical groups, and the radio station teams; the event was covered by many American and Puerto Rican entities as well. The parade gave a very good impression of our culture.”

Some of the Puerto Rican artists who traveled to the event included Eladio Carrión, J Wheeler and Chucho Avellanet. The parade included a range of musical genres such as salsa, reggaeton and plena. Most Puerto Rican municipalities were represented in the parade, as well.

“All of the parade carts and carnaval troupes were great, but Vieques had the most beautiful one, in my opinion,” Nazario said.

The event was Lillian Rodríguez López’s

first parade as chair of the National Puerto Rican Day Parade organization’s board of directors. She was extremely grateful for the amount of hard work that was put into this year’s event and all the activities that took place during Puerto Rican week. Her goals for next year include making sure all island municipalities are represented and gathering more funds for the scholarships provided by the organization to more than 100 university students of Puerto Rican descent thanks to the funds collected by “La Gran Gala Banquete.” This year the attendance duplicated the previous year’s, but next year Rodríguez wants to double the impact.

Notes by Trump’s own lawyer gave a road map to prosecutors

The two indictments filed so far against former President Donald Trump — one brought by the Manhattan district attorney, the other by a Justice Department special counsel — charge him with very different crimes but have something in common: Both were based, at least in part, on the words of his own lawyers.

In the 49-page federal indictment accusing him of retaining classified documents after leaving the White House and scheming to block government efforts to retrieve them, some of the most potentially damning evidence came from notes made by one of those lawyers, M. Evan Corcoran.

Corcoran’s notes, first recorded into an iPhone and then transcribed on paper, essentially gave prosecutors a road map to building their case. Trump, according to the indictment, pressured Corcoran to thwart investigators from reclaiming reams of classified material and even suggested to him that it might be better to lie to investigators and withhold the documents altogether.

Earlier this year, over Trump’s objections, the special counsel overseeing the investigation, Jack Smith, obtained the notes through an invocation of the crime-fraud exception. That exception is a provision of the law that allows prosecutors to work around the normal protections of attorney-client privilege if they have reason to believe and can demonstrate to a judge that a client used legal advice to further a crime.

The ruling agreeing to the Justice Department’s request by Judge Beryl A. Howell, then the chief judge of the U.S. District Court in Washington, was crucial to the shape and outcome of the investigation.

Trump’s legal fate could now hinge on testimony and evidence from two men he paid to defend him: Corcoran, who is still a member of his legal team, and Michael Cohen, a former lawyer for Trump who has helped prosecutors in New York with their case related to the former president’s payment of hush money to a

porn star before the 2016 election. Cohen pleaded guilty to federal charges, including one related to a campaign finance violation, in 2018. Corcoran has not been accused of any wrongdoing.

Their complicated involvement in the two cases reflects the perils of the former president’s long habit of viewing lawyers as attack dogs or even political bosses rather than as advocates bound by ethical rules.

Now in his late 70s, Trump is still searching for lawyers in the mold of the one who first mentored, protected and, in his words, “brutalized” for him: the ruthless and ultimately disbarred Roy M. Cohn.

Trump is due to appear in federal court in Miami today.

When the indictment of Trump was unsealed Friday, it became abruptly clear that the notes by Corcoran — identified as “Trump Attorney 1” — were far more extensive, and far more damaging, than previously known.

“What happens if we just don’t respond at all or don’t play ball with them?” Corcoran quotes Trump as saying at one point, referring to government officials seeking to enforce a subpoena demanding the return of the documents.

The notes referred to in the indictment underscore the extent to which the charges were built on evidence from his inner circle. Along with Corcoran’s notes, prosecutors drew upon text messages from a number of his employees and a recording made of him by an aide. Prosecutors seized phones and subpoenaed documents from a wide group of his advisers.

Trump has long complained about lawyers or other advisers taking notes in front of him. But The New York Times had reported that Corcoran’s notes were copious, dictated into the Voice Memos app on his iPhone after a meeting with Trump about the subpoena issued in May 2022 demanding the return of any classified documents he still had at Mar-a-Lago.

In her memorandum of law explaining her ruling that Corcoran needed to provide testimony in the documents investigation, Howell wrote that prosecutors had presented compelling evidence that Corcoran was misled by his client, who left the lawyer with a “blinkered” view about where remaining boxes of documents were stored.

In one of the most damning passages of the notes, Corcoran describes how

Trump made a “plucking motion” after he had placed about 40 secret documents in a folder in preparation for handing them over to federal prosecutors in compliance with a subpoena that had demanded the return of all classified documents in Trump’s possession.

In his notes, Corcoran said the gesture made him think that Trump was suggesting that he should take the folder to his “hotel room and if there’s anything really bad in there, like, you know, pluck it out.”

In another revealing exchange about what Trump hoped to communicate to his lawyer about what the former president expected from him, Trump spoke admiringly about an unidentified lawyer for Hillary Clinton, the former secretary of state. Trump claimed that the lawyer had taken responsibility for deleting emails from her private server for her, an issue that prompted an FBI investigation into her handling of government material.

“He was great, he did a great job,” Trump said, according to Corcoran’s retelling in the indictment. “He said that it — that it was him. That he was the one who deleted all of her emails, the 30,000 emails, because they basically dealt with her scheduling and her going to the gym and her having beauty appointments. And he was great. And he, so she didn’t get in any trouble because he said that he was the one who deleted them.”

Beyond serving as potential evidence for a jury, Corcoran’s notes could prove useful to prosecutors in what is sure to be a contentious pretrial period marked by motions from Trump’s lawyers to dismiss the case for various reasons.

One of those efforts to dismiss could be a so-called selective prosecution motion, arguing that Trump has been unfairly charged when a figure like Clinton, say, was also investigated for handling classified information but never faced indictment.

Corcoran’s detailed accounts of how Trump sought to avoid handing back any classified material could be powerful evidence of his obstruction of the government’s investigation and, for that reason, serve to distinguish his case from Clinton’s.ls.

The political world’s eyes will turn to the federal courthouse in Miami today when former President Donald Trump is expected to surrender for his first appearance on charges that he illegally retained national security documents after leaving office, obstructed efforts to retrieve them and made false statements.

The extraordinary event will be the former president’s second courtroom appearance as a criminal defendant, after his arraignment in April in a New York courthouse on state charges that he falsified business records in connection with a hush-money payment to a porn star just before the 2016 election.

Authorities in Miami are bracing for protests by both supporters and opponents of Trump. Some of his backers have portrayed this indictment, in an investigation led by the semi-independent special counsel Jack Smith, as an act of war and called for retribution.

During Trump’s arraignment in New York in April, however, crowds of rival protesters outside the courthouse were raucous but peaceful.

Trump has said the hearing will be at 3 p.m. His team has been discussing security arrangements and procedures for the event with authorities, and it is not yet clear how certain details will be handled.

Criminal defendants who are taken into custody before an initial court appearance are often handcuffed, fingerprinted and photographed for a mug shot. In April, however, authorities in New York only took Trump’s fingerprints and did not handcuff or photograph him.

It is also not yet clear which judge will oversee the hearing.

Trump’s case has been assigned to Judge Aileen Can-

non, who earlier handled a lawsuit he filed challenging the FBI’s court-authorized search of his Florida estate and club, Mar-a-Lago. That search came in August, after Trump had not fully cooperated with a subpoena requiring him to give back all the documents with classification markings that he still had.

Cannon was appointed by Trump days after he lost the election in November 2020. She surprised legal experts across the ideological divide last year by intervening with various rulings favorable to Trump, disrupting the documents investigation until a conservative appeals court rebuked her, saying she never had legal authority to intervene. Her assignment to the criminal case was random, the chief clerk for the Southern District of Florida has said.

Trump never appeared before Cannon during the earlier lawsuit, so if she handles today’s hearing, it would bring them face to face. But such hearings are often instead overseen by a magistrate judge. Today, that could be the magistrate who works with Cannon, Bruce Reinhart — who signed the search warrant for Mar-a-Lago — or it could be whatever magistrate judge is on duty at the Miami courthouse.

At the hearing, Trump is likely to stand quietly next to his lawyer until the judge gives him permission to speak. It is also not yet clear whether Trump will return for an

arraignment later or enter his expected plea of not guilty Tuesday to eliminate a need to come back for that step.

In the search of Mar-a-Lago, agents found 102 documents marked as classified. Smith has charged Trump with 37 counts of unauthorized retention of national security information based on 36 of those documents, along with one that agents found that had no markings and laid out certain “military contingency planning.”

The indictment also details an array of evidence in support of prosecutors’ accusations that Trump knew he still had classified documents; took steps with his co-defendant, Walt Nauta, to keep them from the government even after being subpoenaed; and caused one of his lawyers to unknowingly lie to the Justice Department about the matter.

On Fox News on Sunday, William Barr, Trump’s former attorney general who has fallen into disfavor with Trump since refusing to falsely say the 2020 election had been stolen, said that Trump was “not a victim here.” Barr added that Trump appeared to have engaged in “egregious obstruction” to hold on to highly sensitive documents he had no right to retain.

Referring to the assessment of another conservative legal commentator, Andy McCarthy, Barr also said: “If even half of it is true, he is toast. I mean, it’s a very detailed indictment, and it’s very, very damning.”

I-95 overpass collapses in Philadelphia after a tanker fire

Part of Interstate 95 in northeast Philadelphia was shut down in both directions early Sunday morning after a tanker truck believed to be carrying gasoline caught fire, causing part of the highway to collapse, officials said.

The collapse left authorities scrambling for ways to ease the commute on Monday morning as well as for weeks to come and assessing what options they had to make up for the loss of the section of busy highway, which carries about 160,000 vehicles daily.

A tanker driver was on an offramp of Route I-95 North when a crash or other incident sparked a fire below the highway lanes, which run overhead, said Brad Rudolph, a spokesperson for the Pennsylvania Department of Transportation.

“That structure quickly collapsed with the heat of the fire as big as it was,” he said. “And then the southbound structure was also shut down because it was compromised by the fire as well.”

At a news conference Sunday afternoon, Pennsylvania Gov. Josh Shapiro said that at least one vehicle remained trapped beneath the collapsed roadway and that officials were working to identify “any individual or individuals” who may have been caught in the fire and the collapse, which happened around 6:20 a.m.

He described the scene on the highway as one of “remarkable devastation,” adding, “I found myself, you know, thanking the Lord that no motorists who were on I-95 were injured or died.”

The northbound portion of I-95 had completely collapsed, and the southbound side was not structurally sound, Shapiro said, noting that it would likely take “some number of months” before the highway was repaired.

Shapiro said he would issue a disaster declaration on Monday to expedite that process, and had been assured by U.S. Transportation Secretary Pete Buttigieg that whatever resources were needed would be provided.

Rudolph said the cause of the fire was still being investigated but that nothing so far suggested it was intentional.

He said the fire was on the ramp from Route I-95 North to Cottman Avenue, which juts out and then goes underneath the highway.

“It seems like it was a vehicle accident,” Rudolph said. “That ramp can be tricky if you’re going at a high rate of speed.”

The National Transportation Safety Board said on Twitter that it was sending a team to conduct a “safety investigation” into the incident.

Dominick Mireles, the director of the Philadelphia Office of Emergency Management, said at an earlier news conference that the agency was concerned about the possible “environmental impacts” the fire and collapse could have on the Delaware River, which runs parallel to the damaged section of the highway.

The Philadelphia Water Department, which draws on the Delaware for some of its supply, said there was “no impact to water quality” on Sunday afternoon.

“Philadelphia Water Department staff are continuing to monitor the situation and working with other agencies in the emergency response,” it said.

The area where the fire occurred includes auto shops, construction companies and Four Seasons Total Landscaping, the family-operated business where Rudy Giuliani, then former President Donald Trump’s personal lawyer, held a news conference in 2020 as major news organizations began to call the election for President Joe Biden.

All lanes of Route I-95 between the Woodhaven and Aramingo exits, and some nearby streets, were closed Sunday afternoon, the city of Philadelphia said in a news release.

The city advised commuters to plan alternate routes for their weekday commutes and encouraged them to use public transportation. State and local agencies were creating detours, including on Pennsylvania Route 63, Interstate 676 and U.S. Route 1, the city said.

At the news conference Sunday afternoon, Leslie Richards, the general manager of the Southeastern Pennsylvania Transportation Authority, said that cars would be

added to scheduled trains and that free parking would be made available at three stations.

“This is an emergency that has created a tremendous challenge for our transportation network,” Richards said. “We are all going to need some extra patience in the coming days.”

The repair of similarly damaged roadways took several weeks, said Thomas Gernay, an assistant professor of engineering at Johns Hopkins University, adding that even parts of the overpass that appeared intact could be damaged.

While buildings are protected from fire using sprinkler systems and other means, outdoor highways are not, he added.

“We are in an unlucky situation where the fire occurs just underneath a structure,” he said.

In April, part of Interstate 95 in Connecticut was shut down after a fuel tanker crash on a major bridge. The explosion killed one person and sent home heating oil into the Thames River, officials said.

In 2017, a part of Interstate 85 in Atlanta collapsed because of a fire. The contractor that replaced the damaged roadway, C.W. Matthews, said it took 44 days of uninterrupted work to finish the repairs.

JPMorgan reaches settlement with Epstein’s victims

2006, the bank kept him on as a customer despite media reports detailing allegations of his sexual abuse of teenage girls and evidence that some of the cash withdrawals were for payments to dozens of young women.

JPMorgan had provided banking services for Epstein from roughly 1998 to 2013 — a period in which the federal authorities and victims have said some of the worst conduct was committed by the financier, who had palatial homes in Manhattan, Florida, the U.S. Virgin Islands, New Mexico and Paris.

The bank had said a number of times before the agreement was reached that it did not assist Epstein in committing “his heinous crimes” and “in hindsight, any association with him was a mistake.”

a dozen depositions given over the past three months, including the one from Dimon and another from Albert Bryan Jr., the governor of the Virgin Islands. The deal between JPMorgan and Epstein’s victims was hammered out as some of the plaintiffs’ lawyers were taking the deposition of James E. Staley, the former JPMorgan executive who had close ties to Epstein.

In court filings, the Virgin Islands claimed Epstein and Staley shared sexually suggestive emails about young women.

JPMorgan Chase on Monday reached a tentative settlement with sexual abuse victims of Jeffrey Epstein, the deceased financier, after weeks of embarrassing disclosures about the bank’s longstanding relationship with him, said the bank and lawyers for the victims.

The proposed deal would settle a lawsuit filed last November in Manhattan federal court by an unidentified woman on behalf of victims who were sexually abused by Epstein over a roughly 15-year period when they were teenage girls and young women, the suit said. The number of victims could potentially rise to more than 100.

In the statement, the bank and the lawyers for the victims said they had reached “an agreement in principle to settle” the lawsuit on behalf of the victims and the “settlement is in the best interests of all parties, especially the survivors who were the victims of Epstein’s terrible abuse.” The statement did not disclose a settlement amount.

The settlement agreement was reached roughly two weeks after Jamie Dimon, JPMorgan’s chief executive and one of Wall Street’s best-known bankers, sat for a daylong deposition in which he said

he had barely heard of Epstein before the financier’s July 2019 arrest on federal sex trafficking charges.

Epstein killed himself in August 2019 in a Manhattan jail cell a month after his arrest.

JPMorgan still faces a related lawsuit by the government of the U.S. Virgin Islands. That suit remains the biggest outstanding Epstein-related case after years of civil lawsuits against Epstein’s estate and Ghislaine Maxwell’s conviction in 2021 in Manhattan federal court for helping Epstein engage in sex trafficking.

The lawsuit filed by the victims charged that JPMorgan ignored repeated warnings that Epstein had been trafficking teenage girls and young women for sex, even after he registered as a sex offender and pleaded guilty in a 2008 Florida case to soliciting prostitution from a teenage girl. The complaint said the bank overlooked red flags in Epstein’s activity because it valued him as a wealthy client who had access to dozens of even wealthier people.

Court documents and deposition testimony reviewed by The New York Times revealed that bank employees had filed numerous suspicious activity reports about Epstein’s repeated large cash withdrawals. The legal documents revealed that after designating Epstein a “high risk client” in

In a separate lawsuit, the same lawyers for Epstein’s victims last month negotiated a tentative $75 million settlement with Deutsche Bank, which succeeded JPMorgan as Epstein’s primary banker. Deutsche, which ended its relationship with Epstein in late 2018, paid a $150 million fine to New York regulators in 2020 over allegations that it failed to sufficiently police its financial dealings with the disgraced financier among other compliance failures.

The settlements with both banks must be approved by Judge Jed Rakoff of U.S. District Court in Manhattan. Rakoff is also presiding over the related lawsuit by the government of the U.S. Virgin Islands.

The Virgin Islands, the U.S. territory in the Caribbean, contends that JPMorgan should pay it damages for enabling Epstein to set up a sex trafficking operation on his private island residence off St. Thomas. But JPMorgan, in court papers, has bitterly opposed the lawsuit, arguing that government officials there cozied up to Epstein for nearly two decades.

Two of Epstein’s businesses received lucrative tax breaks from the U.S. territory worth tens of millions of dollars. Shortly after JPMorgan ended its relationship with Epstein, the Virgin Islands approved a firstof-its-kind boutique banking license for Epstein.

Rakoff had put the lawsuits against JPMorgan on a fast track, with more than

Staley, better known as Jes, has in court papers repeatedly denied doing anything wrong or being aware that Epstein had sexually abused young women and teenage girls. JPMorgan then sued Staley seeking to ensure that, if it is determined that he did engage in improper activity, he can be held liable for damages the bank ends up paying.

The victims lawyers who were most involved in litigating and negotiating the proposed settlements with the two banks included David Boies, Sigrid McCawley, Brad Edwards and Brittany Henderson.

Boies said of the proposed settlement with JPMorgan, “It has taken a long time, too long, but today is a great day for Jeffrey Epstein survivors.” McCawley, who argued before Rakoff that the JPMorgan lawsuit should be treated as a class action, said the settlements signal that financial institutions have an important role to play in spotting and shutting down sex trafficking.

In court papers associated with the proposed settlement with Deutsche Bank, the victims’ lawyers said they expect to seek fees of up to 30%. The lawyers are likely to submit a similar fee request in the JPMorgan litigation. Any fee request must be approved by Rakoff.

In the Deutsche Bank settlement, the victims will each be entitled to receive anywhere from $75,000 to $5 million in restitution, according to court filings.

The settlements with the two banks will add to the total relief that the many victims of Epstein have received in recent years. Epstein’s estate has paid out about $150 million in restitution to over 125 victims — many of whom may be eligible to apply for additional compensation from the deals with Deutsche and JPMorgan.

S&P 500 and Nasdaq close at highest since April 2022

The S&P 500 jumped to its highest level in 13 months on Monday as traders hoped the Federal Reserve will skip hiking rates when the central bank decides on policy Wednesday.

The S&P 500 added 0.93% to close at 4,338.93, with gains steadily increasing throughout the trading day. The benchmark surpassed its high from last August and reached the best intraday and closing levels since late-April 2022. The Nasdaq Composite popped 1.53% to finish the day at 13,461.92, also reaching its highest levels since April 2022. The Dow Jones Industrial Average climbed 189.55 points, or 0.56%, to close at 34,066.33.

Markets have come to expect that the Fed will skip a rate increase at this week’s meeting, with traders pricing in a roughly 72% chance that there will be no hike, according to the CME Group’s FedWatch tool. The Fed has hiked 10 consecutive times since starting this latest policy-tightening cycle in March 2022.

Tuesday’s inflation data could help reinforce the case that inflation is subsiding, as economists expect the consumer price index to show inflation dropping to a 4% annual rate in May. That’s down from 4.9% in the prior month.

The central bank will ultimately decide to skip a rate hike for June, according to Certuity co-chief investment officer Dylan Kremer, but the Fed likely isn’t done raising rates overall.

“We don’t necessarily believe that there’s no more hikes in the cards, but we do think it’s a 50/50 chance of another hike happening in this cycle,” Kremer said. “All else equal, [the CPI report] could be a short-term tailwind as markets continue to grind higher.”

However, market expectations are that Fed officials will emphasize a commitment to keep inflation at bay and come back with a final rate increase at July’s meeting before going on hold for the rest of the year.

The S&P 500 last week reached a significant milestone, gaining more than 20% off its October low. The move caused many investors to signal the bear market is over. The benchmark has been on a bit of a hot streak, gaining four weeks in a row. The Nasdaq Composite has been on an even bigger tear, up 33% from its 52-week low.

The Nasdaq and technology stocks led the way on Monday again, with Amazon and Tesla each up more than 2%.

Technology stocks connected to artificial intelligence have surged this as enthusiasm for these tools gains steam. But Needham sees five specific big technology names as the biggest winners in the race.

As the top beneficiaries given their size, scope, and financial prowess, enabling them build and maintain AI models, and harness the talent.

“Also, Cloud services get much more sticky after a business builds an app on their [foundation models],” she said.

The U.S. dollar drifted from a two-month high as investors trimmed bets based on lower rate hike expectations, while the euro recovered from a two-month low after European Central Bank (ECB) President Christine Lagarde said inflation remained too high and further policy tightening was necessary.

The dollar index fell 0.586%, with the euro up 0.68% to

$1.0761.

Oil prices were buoyed by optimism from the passage of the debt ceiling bill that could underpin consumer demand despite reports that U.S. crude inventories rose by about 5.2 million barrels last week.

Brent crude futures settled up 2.3% to $74.65 a barrel, their biggest daily gains since May 17. U.S. West Texas Intermediate crude (WTI) climbed 3% to settle at $70.10 a barrel, recording its biggest daily gains since May 5.

Gold gained nearly 1% to a more than one-week peak on Thursday, as the dollar tumbled. Spot gold added 0.8% to $1,978.01 an ounce, while U.S. gold futures gained 0.73% to $1,978.30 an ounce.

How Silvio Berlusconi changed Italy, for better or worse

The death of Silvio Berlusconi on Monday brought to an end one of the longest, most consequential and colorful eras in Italian politics, with both ardent admirers and die-hard critics marking a life of outsized influence as something that split contemporary Italian history into the before and after.

From his origins as a real estate and media mogul, Berlusconi, who was 86 when he died, became the most dominant personality on the theatrical Italian landscape. He revolutionized not only Italian politics, but also its sport, daily life, image of itself and popular culture — all through his privately owned television channels — leaving an imprint, or a bruise, on almost everything he touched.

“Goodbye Silvio,” Prime Minister Giorgia Meloni said in a statement about her coalition partner, calling him “one of the most influential men in Italian history.” He will receive a state funeral in Milan’s Duomo on Wednesday.

Even in death, Berlusconi had the power to potentially destabilize the political universe and Meloni’s governing coalition, of which his party, Forza Italia, is a small but critical linchpin.

Berlusconi, who had an enormous opinion of himself, seemed to believe, along with much of Italy, that he would live in perpetuity. He recently gave his “biological age” as in his 50s, and never anointed an heir to his center-right Forza Italia party.

As a result, political analysts believe that either one of his children will step up to hold the party, and potentially the coalition, together, or it will disintegrate without him, putting Meloni’s government, at the beginning of a five-year term, in doubt.

Such an outcome would be only the last tremor Berlusconi sent through the political system. While his health and political influence diminished in recent years, everything around him could be argued to be products of his making, shaped in support of, or opposition to, the man widely known as “The Knight.”

That included the political allies who eclipsed him, like Meloni; the Machiavellian political operators who tried to co-opt him; even the anti-establishment opposition that tried — but never fully succeeded — to get rid of him.

His fans, who for years sang, “Thank Goodness There’s Silvio,” say he was a force of nature that modernized Italian politics, matured its democracy and added capitalist dynamism to a creaky economy overly reliant on government.

His detractors saw him as the very personification of the country’s political and cultural decline, a crooked businessperson who entered politics to protect his business interests, a womanizing caricature of the Italian libertine who cozied up to despicable strongmen from Moammar Gadhafi of Libya to Vladimir Putin of Russia.

He embodied multitudes of contradictory personas: The reformer who promised to liberalize the country, but then governed like a populist. The family man whose long list of young companions, especially at socalled Bunga Bunga bacchanals, both scandalized the country and endeared him to aspiring Lotharios. The committed ally and lover of America who became an apologist for Putin and his invasion of Ukraine. The candidate who, in a clear conflict of interest, used his television channels as a politi-

cal cudgel.

Whether he changed Italy for better or worse “was a very, very complicated question to answer,” said Giovanni Orsina, dean of the Luiss School of Government in Rome and the author of “Berlusconism and Italy: A Historical Interpretation.” It is likely to be debated for a period at least as long as the three decades that Berlusconi weighed on the Italian imagination. What is certain is that he changed Italy.

“The impact he had through television is much deeper than an electoral cycle,” said Christian Rocca, the editor of Linkiesta, an Italian news outlet. Rocca said Berlusconi transformed the staid Italian programming “that was in color but could have been in black and white,” bringing American sports, soap operas, movies and a new Italian style of variety show adorned with beautiful women.

That cultural shift to the spectacular and tawdry has not only remained on the airwaves, but critics have argued it has pervaded all of Italian society, transforming the way people look and the ambitions and dreams

of a generation of Italians who hungered for the wealth and confidence that Berlusconi, transactional and aspirational and gaudy, stood for.

After the fall of Communism, which had been the chief dividing line for Italian politics for a half-century, Berlusconi capitalized on the collapse of the political establishment in a bribery scandal to “enter the field” of politics, as he famously put it. In doing so, Berlusconi became Italy’s new dividing line.

“This was his great innovation,” said Rocca, “you were in favor or against, you couldn’t be indifferent.”

Berlusconi’s polarizing style not only has remained in Italy, but it has become a global trend, seen most clearly in Donald Trump in the United States, who in many ways echoes his bombast.

Berlusconi “modernized the instruments of politics, that is to say, leadership, television, communication,” Orsina said. “He changed the political language.”

And he started doing that, said Enrico Letta, the former Italian prime minister and center-left opponent of Berlusconi, by changing “the Italians’ daily life with commercial television,” giving them greater choice. In return those viewers provided Berlusconi with “a huge reserve of votes.”

He also changed the way Italian politicians sounded. He projected optimism, capitalized on over-the-top demonization by his critics and perfected victimization. He painted all his critics red as Communists, ushering in a combative campaigning style and delegitimization of institutions that would be distilled to the poisonous messages that his enemies and acolytes flooded social media with in the last decade.

Rocca said that one story about Berlusconi summed him up.

When he was starting out as a real estate tycoon in Milan, he said, Berlusconi wanted to build a suburban-like housing complex and market it as an oasis of peace and quiet.

But planes flying in and out of the nearby airport made that a hard sell. To reroute the planes, Berlusconi built a hospital, over which they could not fly, greasing more than a few palms in the process. The hospital, San Raffaele, became a center of excellence, and it was where he died on Monday morning.

“That’s Berlusconi — entrepreneur, outlaw, politician,” he said. “But somehow in the end, it was a good thing.”

Faceless, nameless and dead by the dozen in a train’s cheapest cars

They cram themselves every day by the millions onto India’s overtaxed trains, chasing a shred of economic opportunity across the vastness of the world’s most populous nation.

Tickets costing about $5 — nearly a day’s wage — are all they can afford. For that, they stand shoulder to shoulder over long stretches in the middle of so-called general category coaches, far removed from the air-conditioned cars that lie beyond the pantry where workers prepare the rice, roti and chai for the journey.

It was these packed general coaches, right behind the engine of the Coromandel Express, that became a scene of unthinkable carnage just after sunset June 2 when the train smashed into a parked freight train at 80 mph in eastern India.

Almost all of the 288 dead were in those three cars at the front of the train — a fact, confirmed by officials, that has gone almost unnoticed in India. Unlike the 1,200 people in reserved seats, those in the general coaches were officially nameless; the rail service had no record of their identities. Their names and other details emerged only when they were taken to hospitals, or when loved ones traveling hundreds of miles identified their bodies in a morgue.

In the government’s initial reports on the crash, India’s worst train disaster in decades, its passenger count included only those in reserved seats, almost as if the hundreds in the general coaches did not exist.

“They were all people like me, poor,” said Rahul Kumar, a 28-year-old carpenter who was in one of the Coromandel general coaches, traveling to the southern city of Chennai. “Daily wage workers, laborers and people who can’t afford a ticket in the next compartment.”

The railway calamity has once again highlighted how unevenly the burden of India’s inadequate infrastructure falls on the poor.

With train routes stretching about 40,000 miles, India has one of the world’s largest and oldest networks — and perhaps the most overburdened.

It is an affordable lifeline for the tens of millions of young people who must uproot themselves to scrape out a living. Of the 20 million daily passengers, six out of seven hold unreserved tickets, according to Indian Railways, particularly on suburban trains: streaming in and out of the crowded cars as the trains

make their stops in small towns and cities.

The three crushed general coaches of the Coromandel Express held about 300 people in all, according to a senior Indian official. That figure matches the cars’ official capacity; accounts from inside the train indicate that the number could be significantly higher. Railway officials have said that only two of the dead identified so far came from the reserved coaches.

While the passenger load in this country of 1.4 billion people has increased more than threefold over the past 50 years, the railway network’s capacity, in terms of mileage of track, has expanded only about 40%. The network transports about 8 billion passengers a year — roughly double what China’s network transports on a larger, and much newer, network.

The biggest impediment to improving safety and performance on the Indian network is dangerous levels of congestion, said Alok Kumar Verma, a retired chief engineer of India’s North East Frontier Railway. Indian Railways data shows that about 6,000 miles of its central and most important “trunk routes” are operating at 125% capacity, Verma said.

That puts strain not only on the tracks, but also on the staff working on those tracks, and does not allow sufficient time for maintenance.

Indian officials acknowledge that railway upgrades and expansion have long lagged behind investment in roads. But annual spend-

ing on India’s railway system, they say, has increased eightfold compared with about a decade ago. Tracks are being rebuilt and added at a much faster rate, and safety technology is being introduced.

The overall number of major rail accidents — such as collisions, derailments and fires — has fallen by about two-thirds in the past decade, and casualties from such events have dwindled to double and single digits in recent years, official data shows.

Still, there are nearly 20,000 scattered rail-related deaths each year, many from things like falling from an overcrowded car or being struck by a train.

The hundreds of people in hospitals and the bodies scattered across morgues in the days after the Coromandel crash spoke to the section of India’s population that depends on the railway.

The lucky ones who survived had to pick themselves up and carry on with their search for a living — or return home, broken. For most, it was inconceivable that a loved one could afford to travel hundreds of miles to offer help. They could count one thing in their good fortune: The cyclone-prone state of Odisha, the site of the crash, has a well-oiled disaster relief system that rushed to the rescue and saved lives.

For the unfortunate, their search for better lives ended here, in transit.

Some of the dead were identified in the days that followed — by injured friends

who left their hospital beds to search in the morgues; by relatives who traveled hundreds of miles on government-organized buses and trains to claim the deceased; or through pictures of their disfigured faces on government websites.

Others, nearly 100 in all, remain in the morgues — unidentified and unclaimed.

Kumar, the carpenter, said his family had learned he was alive only three days after the accident, because he had lost his phone. After an initial round of surgery, he returned to his village in the northern state of Bihar in an ambulance provided by a Sikh charity.

He has used the Coromandel Express frequently for the past five years, after he and his brother expanded their carpentry work to Chennai, the southern city.

Income from their furniture repair shop in Bihar was not meeting the needs of their family of eight. After Kumar’s brother Nitesh went to Chennai for work, where he could earn more, Kumar started spending time there also — for short-term gigs or to buy new tools and return to Bihar.

On June 2, Kumar reached Kolkata early in the morning on an overnight train from Bihar and waited about 10 hours in the heat until the Coromandel Express was ready to depart. The train was packed, with many passengers standing — holding their bags in one hand, clutching a cabin chain with the other for support. Some sat on the floor; the exit doors of the coach were completely blocked.

Kumar managed to get a seat by being among the first in the swarm. What saved him, he said, was a chance happening: A family of three sitting next to him asked if he would be willing to swap his seat with one being used by a female relative in the back of the car.

“When I regained consciousness, half of the compartment was hanging in the air, the other half was gone,” he said. “While crawling toward the gate, I saw a red head cover of the woman whom I had swapped the seat with. They were all lying dead.”

The daily struggles of India’s poor go largely unnoticed. For many on the Coromandel, attention fell on them only in disaster, as workers cut through the jumbled coaches to drag out the bodies, watched by cameras and crowds of onlookers.

“It doesn’t matter if we die at home or in a train accident — we are nobody,” said Madhu Sudhan Haldar, 24, one of the survivors from the general coaches, who essentially grew up on construction sites. “After a few days, everyone will forget so many people died.”

‘The state killed my brother’: Senegal in uproar after deadly protests

Atailor shot in the head. A baker killed by a bullet in the chest. A geography student planning to continue his studies in Canada felled by a deadly bullet in the back.

The West African nation of Senegal is reeling after clashes between police and supporters of a leading opposition figure early this month left at least 16 people dead. Many families have found that their loved ones had died from gunshot wounds, raising suspicions that the Senegalese police fired on demonstrators.

Senegal is often hailed as a model of stability in West Africa, but for years anger has been mounting against President Macky Sall and his government over widespread youth unemployment and perceptions of entrenched corruption. Sall has also remained vague about his intentions to run for a third term next year, which most legal experts say would violate the Senegalese Constitution.

Sall has praised the professionalism of the country’s security forces, while his interior minister, blaming a “foreign influence” for the riots, has said the death toll could have been much worse had police not shown restraint.

Yet a different picture is painted by social media footage, testimonies from relatives of victims and human rights defenders, and half a dozen death certificates obtained by The New York Times. The certificates all list the cause of death as wounds inflicted by live ammunition.

The source of the bullets is not mentioned on the death certificates. But Amnesty International, which has counted 23 fatalities, said most of the victims died from bullets fired by police or unidentified armed men operating alongside them. The Senegalese Red Cross said it had treated more than 350 people, 10% of whom were among the security forces.

“The state killed my brother,” said Issa Sarr, whose brother died June 2 after being shot in the head in Pikine, a suburb of the

capital, Dakar. His brother, Bassirou Sarr, 31, was a tailor who invested his spare time in his neighborhood, painting, planting trees and installing lighting to make the area safer, his relatives said.

The government has rejected accusations that police fired at protesters and said it had arrested 500 people, some carrying firearms. The Interior Ministry did not respond to requests for comment.

Thousands of protesters took to the streets of various Senegalese cities earlier this month after the country’s leading opposition figure, Ousmane Sonko, was sentenced to two years in prison for “corrupting youth.” He was acquitted of rape and other charges, all which he had denied.

Sonko’s supporters, and an increasing number of public intellectuals and political observers, say the case was an attempt to block him from running in next year’s presidential election.

As news of the verdict against Sonko spread, protesters set cars ablaze, threw stones at security forces and ransacked properties and businesses. Dakar’s central university, one of the best in West Africa, remains closed until further notice after rioters burned several buildings.

The Senegalese government deployed the military to respond to the protests. It also cut off access to social media for nearly a week.

Many families say that the young men they lost had not even participated in the protests. Bassirou Sarr had

been forced to close his shop because of the protests, like most businesses, and was shot as he was standing on a bridge overlooking rioters who were cornering police officers at a tollgate, his brother Issa Sarr said in an interview last week. His account could not be verified independently.

Issa Sarr spoke as he was waiting to collect his brother’s body at a morgue in Dakar. Minutes later, another family loaded the coffin of a man killed in the demonstrations on the roof of a hearse. Sarr and two of his brothers gathered around the coffin with two dozen others and prayed for the victim, Seyni Coly, a baker who died after being shot in the abdomen, according to his autopsy report.

Families of other victims shared similar stories. Elhadji Cissé, a 25-year-old geography student who was about to move to Canada this summer for his studies, was returning from a mosque, his family said, when he was shot in the back. The bullet punctured his right lung and came out of his arm, according to an autopsy report.

With three-quarters of Senegal’s population younger than 35, most of its 17 million people have known only democracy. Even as Senegal has faced sporadic episodes of political violence since it gained independence from France in 1960, it has long taken pride in its culture of free expression and the existence of multiple political parties — in a region where coups are common and aging leaders cling to power.

But that exceptionalism has come under question as the country faces its worst political crisis in decades. In recent years, demonstrations against Sall have grown more violent, political opponents have been jailed,

journalists arrested and news organizations suspended.

In 2021, Sonko’s arrest, following accusations of rape by an employee of a massage parlor, set off demonstrations and left 14 people dead over six days. But the police response was more violent this year, according to human rights organizations.

Amnesty International has called for an independent investigation.

Sonko, who was convicted on June 1, has yet to be arrested. Stranded in his house in Dakar, he has not condemned the violence, instead calling for more unrest. More than half a dozen protesters hospitalized after being wounded in the protests and interviewed by the Times last week said they would keep demonstrating against Sall’s government. (Sall was elected in 2012 after defeating an incumbent who had rankled many in Senegal by attempting to claim a third term.)

“I don’t regret anything,” said Samba, a 23-year-old demonstrator who was discharged from a hospital in Dakar this past week after being shot in the chest. He asked to be identified only by his first name for fear of government retaliation.

“Injustice in this country must stop,” he added, referring to the prosecution of Sonko.

But the strife has also alienated more moderate Senegalese who favor dialogue, observers say.

“Political parties, in power and in the opposition, are rarely insisting on the fact that violence isn’t the solution or that institutions should be respected,” said Guillaume SotoMayor, a Dakar-based researcher with the Middle East Institute. “Those same institutions, most recently the justice system, and their leaders have lost credibility.”

As hospitals discharged their wounded, families buried their loved ones in Ziguinchor, a city in southern Senegal where Sonko is the mayor, and in Dakar and its suburbs.

The body of Bassirou Sarr, the tailor, was released by authorities Thursday, six days after he died. As relatives and acquaintances lined up Friday in a narrow alley outside a mosque, the imam urged young mourners to think twice before acting.

“Your parents need you alive, not dead,” he said.

Saly Sarr, one of Bassirou Sarr’s aunts, said she had had time while waiting for his body to be released to reflect on Senegal’s future.

“What happens if our children grow up in a country where the police shoot at their own people with real bullets?” she asked earlier at the family house. “They’ll just create more insurgents.”

It’s shocking how easy it is to imagine Donald Trump campaigning for the presidency from prison. He’d have the joint wired, like the mob guys in “Goodfellas.” He’d be enjoying all kinds of privileges, DJing Elvis and Luciano Pavarotti; getting a steady flow of Viagra, cheeseburgers and conjugal visits (not from Melania). Maybe he’d even be able to smuggle in his special Tang-colored hair bleach.

It wouldn’t be the first time someone tried for the White House from the Big House. In 1920, after being imprisoned on sedition charges for excoriating the U.S.’ involvement in World War I, which he considered a capitalistic war, Eugene Debs won about 900,000 votes as the Socialist Party nominee.

“I will be a candidate at home in seclusion,” he joked when asked how he would campaign. “It will be much less tiresome, and my managers and opponents can always locate me.” He was allowed to give one bulletin a week to the United Press. With Trump, it will be Newsmax.

Trump wouldn’t be in prison for sticking by his principles, though. He’d be in prison because he has no principles. We’re watching him spiral down to his essence. At bottom, he’s a humongous, dangerous liar and a criminal. As Logan Roy would say, this is not a serious person.

at Mar-a-Lago

The dramatic unsealing of United States of America v. Donald J. Trump is a fitting switch. Until now, it has been Donald J. Trump v. United States of America. He tried to engineer a coup against the government he was running. I bet Jack Smith will be bringing those charges later.

The special counsel made it clear that this isn’t just a “boxes hoax,” as Trump called it. You can’t purloin classified documents; leave them in the gilt-and-crystal glare of the bathroom, shower, bedroom and ballroom at Mar-a-Lago; and show them off to remind people how important you are. Trump’s ego is his greatest weakness. He couldn’t resist self-aggrandizing. Hey, I got these secret documents.

The indictment — charging Trump with violating the Espionage Act and other laws — offered devastating photos of America’s secrets stacked up like something on “Hoarders,” spilling out under the dry cleaning, a guitar case and other items.

“The classified documents Trump stored in his boxes included information regarding defense and weapons capabilities of both the United States and foreign countries, United States nuclear programs, potential vulnerabilities of the United States and its allies to military attack and plans for possible retaliation in response to a foreign attack,” the indictment said. “The unauthorized disclosure of these classified documents could put at risk the national security of the United States, foreign relations, the safety of the United States military and human sources and the continued viability of sensitive intelligence collection methods.”

Well, that’s bad.

The indictment is based on information from Trump’s own lawyers, staffers, phone records and security cameras. This isn’t the work of some insider or Trump hater who’s out to get him. And it makes clear that there was a very deliberate effort by Trump to hold on to and conceal these documents that he was going to use for heaven knows what and show to God knows whom.

The former president directed his valet, Waltine Nauta (named as a co-conspirator with Trump), to move about 64 boxes from a storage room to Trump’s residence and bring about 30 boxes back to the storage room — without informing the Trump attorney who was supposed to be reviewing the material.

On top of that, the attorney said, Trump later encouraged him to go through the documents that he did review and pluck out anything really bad. Trump even made a plucking motion.

During the 2016 campaign, Trump was always boasting about his devotion to protecting classified information, to mock Hillary Rodham Clinton. The prosecutors thoughtfully included some of his old comments, like this one: “In my administration I’m going to enforce all laws concerning the protection of classified information. No one will be above the law.”

Those statements obviously carried the same weight as his 2016 comments vowing to be so busy as president that he would never play golf. What an utter phony.

The Republicans who jumped out in front of the indictment to defend Trump should be ashamed. Unfortunately, shame is long gone from the Republican Party, except for a vestigial smidge in Mitt Romney’s office.

Up until now, Trump has managed to slink away from innumerable seamy episodes, from bankruptcies to vile personal misconduct, by proclaiming himself a victim.

I was trepidatious, after watching the lame performances of James Comey and Robert Mueller. But Smith seems to be bringing an impressive skill set and temperament to his prosecution of Trump. Maybe he developed them in his years nailing war criminals at The Hague, Netherlands.

In his brief appearance at the Justice Department Friday afternoon, Smith emphasized the risks that this kind of mishandling of sensitive information poses to the people who have volunteered to protect us.

He praised the FBI, the agency that Trump and the Republicans have been trying to tear down and defund, saying the agents there work “tirelessly every day, upholding the rule of law in our country.”

Republicans used to embrace the rule of law. Now many describe the Jan. 6 rioters as martyrs and say Trump shouldn’t be prosecuted. Kevin McCarthy called the indictment “a dark day for the United States of America.”

But Smith is intent on reminding Americans that the rule of law is a fundamental tenet of our country.

SAN JUAN – El gobernador Pedro Pierluisi y el secretario del Departamento de Hacienda, Francisco Parés Alicea, anunciaron el lunes la emisión de los Estados Financieros Auditados correspondientes al año fiscal 2021.

“Según nuestro compromiso, completamos la emisión de los estados financieros del año 2021. Los esfuerzos de nuestro gobierno y la disciplina fiscal que hemos mantenido, siguen rindiendo frutos para el beneficio de la ciudadanía. Continuamos poniendo nuestras finanzas al día para definir una ruta de desarrollo sobre bases económicas confiables”, afirmó Pierluisi en declaraciones escritas.

Por su parte, Parés Alicea, también Principal Oficial Financiero del Gobierno, aseguró que continuarán actualizando la publicación de los Estados Financieros Auditados. “Hemos hecho historia y estamos comprometidos a romper nuestros propios récords. Vamos a seguir trabajando para continuar desarrollando un gobierno responsable, transparente y efectivo, para crear un mejor Puerto Rico para las futuras generaciones”, sostuvo.

Para el año 2021, los Estados Financieros del Gobierno primario reflejaron activos y diferidos totales de 41,207 millones de dólares y pasivos y diferidos totales de 100,432 millones de dólares, incluyendo la deuda pública. Parés Alicea explicó que las unidades componentes del Gobierno de

Puerto Rico reflejaron activos y diferidos totales de 39,213 millones de dólares y pasivos y diferidos totales de 54,189 millones de dólares.

El secretario también detalló que los ingresos del gobierno primario aumentaron en 9,877 millones de dólares y los gastos aumentaron en 11,595 millones de dólares en comparación al año 2020. Mientras, los gastos de las unidades componentes excedieron sus ingresos por 816 millones de dólares.

El Departamento de Hacienda continúa trabajando en coordinación con la Oficina de la Inspectora General, promoviendo el cumplimiento de las agencias con la entrega de los informes financieros relacionados con su condición y operaciones.

Parés Alicea agradeció la cooperación del personal del Departamento, en especial del Área de Finanzas Públicas, por el compromiso de encaminar las finanzas públicas y cumplir con la agenda de trabajo trazada.

Se espera que a partir del año fiscal 2023 en adelante, los Estados Financieros Auditados sean emitidos dentro de los 305 días (alrededor de 10 meses), luego del cierre del año fiscal.

Vega Baja adoptará jornada laboral de cuatro días a partir de julio

VEGA BAJA – El alcalde de Vega Baja, Marcos Cruz Molina, reveló en su mensaje de presupuesto a la Legislatura Municipal el lunes, que la municipalidad se sumará a las tendencias laborales globales implementando un plan piloto de jornada laboral de cuatro días a partir de julio.

El alcalde especificó que todas las oficinas de servicios municipales seguirán funcionando de lunes a viernes, excepto aquellas relacionadas con la seguridad, la salud y la gestión de emergencias, que mantendrán sus servicios las 24 horas del día, todos los días de la semana.

“En coordinación con los directores, de forma coordinada, equitativa, eficiente y uniforme, todos los empleados de carrera y temporales trabajarán treinta y dos horas a la semana. Además, a partir del primero de julio, los funcionarios municipales recibirán un aumento salarial, con una base de nueve dólares y cincuenta centavos la hora”, destacó Cruz Molina en comunicación escrita.

‘Kimberly Akimbo’ wins best musical Tony and ‘Leopoldstadt’ best play

“Kimberly Akimbo,” a small-scale, big-hearted show about a teenage girl coping with a life-shortening genetic condition and a comically dysfunctional family, won the coveted Tony Award for best musical Sunday night.

The award came at the close of an unusual Tony Awards ceremony that almost didn’t happen because of the ongoing screenwriters’ strike. Only an intervention by a group of playwrights who also work in film and television saved the show: they persuaded the Writers Guild of America that it would be a mistake to make the struggling theater industry collateral damage in a Hollywood-centered dispute, and in the end the telecast aired without pickets, without scripted banter and without a hitch.

“I’m live and unscripted,” the ceremony’s returning host, Ariana DeBose, said at the start of the show, after an opening number that began with her backstage, paging through a binder labeled “Script” filled with blank pages, and then dancing wordlessly through the theater and onto the stage. She then pointed out the absence of teleprompters, offered her support for the strikers’ cause, and declared, “To anyone who thought last year was a bit unhinged, to them I say, ‘Darlings, buckle up!’”

At one point, she looked at words scrawled on her forearm, and said, “I don’t know what these notes stand for, so please welcome whoever walks out onstage next.”

The basic elements of the awards show — acceptance speeches by prize winners and songs performed by the casts of Broadway musicals — remained more or less intact. But the introductions to the shows and performances were mostly sleekly shot videos, rather than descriptions by celebrities; presenters kept their comments extremely spare, which left more time for unusually well-filmed production numbers.

The ceremony featured a pair of milestone wins: J. Harrison Ghee and Alex Newell became the first out nonbinary performers to win Tony Awards in acting categories, Ghee as a musician on the lam in “Some Like It Hot,” and Newell as a whiskey distiller in the musical comedy “Shucked.”

“For every trans, nonbinary, gender nonconforming human, whoever was told you couldn’t be, you couldn’t be seen, this is for you,” said Ghee. Newell expressed a simi-

lar sentiment, saying, “Thank you for seeing me, Broadway.”

Last fall’s production of “Topdog/Underdog,” Suzan-Lori Parks’ 2001 tour de force about two Black brothers weighted down by history and circumstance, won the Tony Award for best play revival. The play had won a Pulitzer Prize in 2002 but no Tony Awards; Parks, in accepting this year’s Tony, praised actors Yahya Abdul-Mateen II and Corey Hawkins for “living large in a world that often does not want the likes of us living at all” and added, “Theater is the great cure.”

There was star power, too. Jodie Comer, best known for playing an assassin on television’s “Killing Eve,” won the best actress in a play award for her first stage role, a grueling, tour-de-force performance as a defense attorney who becomes a victim of sexual assault in “Prima Facie.” And Sean Hayes, best known for “Will and Grace,” won for playing depressive raconteur-pianist Oscar Levant in “Good Night, Oscar.”

The night served as a reminder of the growing concern about antisemitism in America and around the world, as “Leopoldstadt,” Tom Stoppard’s wrenching drama following a family of Viennese Jews through the first half of the 20th century, won the prize for best play, and a new production of “Parade,” a 1998 show based on the early 20th-century lynching of a Jewish businessman in Georgia, won the prize for best musical revival.

“Leopoldstadt,” which bested three Pulitzer-winning dramas to win the Tony, also won several other prizes Sunday night, including for its director, Patrick Marber, and for Brandon Uranowitz, who won as best featured actor in a play, and who noted the personal nature of the production for its predominantly Jewish cast in his speech, saying “my ancestors, many of whom did not make it out of Poland, also thank you.”

The win by “Parade” cemented a re-

markable rebirth for that show, which was not successful when it first opened on Broadway in 1998, but which is shaping up to be a hit this time, thanks to strong word-ofmouth and the popularity of its leading man, Ben Platt. The success of “Parade” is also a significant milestone for the musical’s composer, Jason Robert Brown, who is widely admired within the theater community but whose Broadway productions have struggled commercially. Brown wrote the music and lyrics for “Parade,” and the book is by Alfred Uhry; both won Tonys for their work on the show in 1999.

Michael Arden, who won a Tony for directing the “Parade” revival, said in his acceptance speech, “we must come together,” adding, “or else we are doomed to repeat the horrors of our history.” Arden went on to recall how he had been called a homophobic slur — “the F-word,” many times as a child, and he drew raucous cheers as he reclaimed the slur. “Keep raising your voices,” he said.

But the night belonged to “Kimberly Akimbo,” the smallest, and lowest-grossing, of the five nominees in the best musical category, but also by far the best reviewed, with virtually unanimous acclaim from critics. (Nodding to the show’s anagram-loving subplot, New York Times critic Jesse Green presciently suggested one of his own last fall: “sublime cast = best musical.”)

The show, set in 1999 in Bergen County, New Jersey, stars 63-year-old Victoria Clark as Kimberly, a 15-going-on-16-yearold girl who has a rare condition that makes her age prematurely. Kimberly’s home life is a mess — dad’s a drunk, mom’s a hypochondriac, and aunt is a gleeful grifter — and her school life is complicated by her medical condition, but she learns to find joy where she can. Clark won a Tony for her performance as Kimberly, and Bonnie Milligan won a Tony for her performance as the aunt.

“Kimberly Akimbo,” which was directed by Jessica Stone, began its life with an off-Broadway production at the nonprofit Atlantic Theater Company in the fall of 2021 and opened at the Booth Theatre in November. It was written by playwright David Lindsay-Abaire and composer Jeanine Tesori, based on a play Lindsay-Abaire had written in 2003. Lindsay-Abaire and Tesori both won Tony Awards for their work Sunday night.

The musical, with just nine characters, was capitalized for up to $7 million, according to a filing with the Securities and Exchange Commission; that’s a low budget for a musical on Broadway these days, when a growing number of shows are costing more than $20 million to stage. The lead producer is David Stone, who, as a lead producer of “Wicked,” is one of Broadway’s most successful figures; this is the first time he has won a Tony Award for best musical, and he was also the lead producer of the Tony-winning “Topdog” revival.

The award for best musical is considered the most economically beneficial Tony, generally leading to a boost in ticket sales. In

winning the prize, “Kimberly Akimbo” beat out four other nominated shows: “& Juliet,” “New York, New York,” “Shucked” and “Some Like It Hot.” None of the five nominated musicals is a runaway hit, and four, including “Kimberly Akimbo,” have been losing money most weeks.

The 2022-23 season, which ended last month, was a tough one for new musicals: Broadway audiences were still down about 17% below pre-pandemic levels, and those who did buy tickets gravitated toward established titles (like “The Phantom of the Opera,” which sold strongly in the final months of its 35-year-run) and big stars (especially Hugh Jackman in “The Music Man,” Sara Bareilles in “Into the Woods,” Lea Michele in “Funny Girl” and Josh Groban in “Sweeney Todd”). So this year’s Tonys ceremony took on even more

importance than usual, with the industry’s leaders hoping that a nationally televised spotlight on theater would boost box office sales.

The ceremony featured not only musical performances by all nine nominated new musicals and musical revivals, but also a barn-burning performance of “Don’t Rain on My Parade” by Michele, a “Sweet Caroline” singalong led by the cast of the Neil Diamond musical “A Beautiful Noise,” and, as part of the In Memoriam segment, a song from “The Phantom of the Opera” sung by Joaquina Kalukango to acknowledge the show’s closing in April.

The Tonys, presented by the Broadway League and the American Theater Wing and named for Antoinette Perry, gave lifetime achievement awards to two beloved nonagenarians: actor Joel Grey, 91, who remains best known for playing the master of ceremonies in both the Broadway and film versions of “Cabaret,” and composer John Kander, 96, who wrote music for “Cabaret” as well as “Chicago” and “New York, New York.” “I’m grateful for music,” Kander said after being introduced by Lin-Manuel Miranda as “the kindest man in show business.” Grey was introduced by his daughter, actress Jennifer Grey; he sang a few words from the opening number of “Cabaret.”

“Oh my God, I love the applause,” he said, to a round of applause.

What’s the best way to treat a workout injury: Heat or ice?

hours after an injury, scientific studies on the effectiveness of ice have been inconclusive.

Dr. Julie Han, a sports medicine physician at NYU Langone Health, said there was no right or wrong answer on whether to use heat or ice, and emphasized that neither would cure an injury.

“It’s not going to fix anything, it’s not going to impede your progress if you choose one over the other,” she said. “They’re essentially techniques that could be helpful in alleviating symptoms.”

Typically, to reduce pain caused by acute injuries, she recommended icing for the first week or two when the injury is swollen or bruised and then switch over to heat therapy to relax and warm up the muscle if there is stiffness. But there is no hard-and-fast rule, she said.

Over his nearly two decades of work in physical therapy, Kunzer said recommendations have shifted away from immobilization and toward more early movement. “You want to walk that tightrope, that fine line between getting that motion, but also still protecting it,” he said of the injured muscle.

While moving too quickly after an injury can prolong the pain, too much rest can cause stiffening and further loss of strength. He tells patients that exercise is the best medicine and uses the phrase “motion is lotion” to encourage patients to keep moving, particularly when they have conditions such as osteoarthritis.

“Be as active as you can for as long as you can, with whatever activities bring you joy,” he said.

The prevailing theory on how to treat sprains and strains, especially from exercise, has been to follow the RICE sequence — rest, ice, compression and elevation.

While the method is still widely recommended and observed, some sports medicine physicians, including the one who coined the acronym RICE, are shifting their guidance: Movement, rather than rest, can better aid recovery in some cases, and icing is not always the most effective treatment.

Dr. Gabe Mirkin, a retired sports medicine physician who in 1978 coined the term, said he no longer advises following that protocol because of evidence that, for some injuries, rest and ice delay healing, rather than aid it.

He now recommends early movement after an injury, as long as patients are not in pain, especially for overuse injuries. “The most important rule is to listen to your body because you feel pain when you’re doing something wrong,” Mirkin said. “The reason injuries are so common is that people think they can work through pain.”

Updated approaches are incorporated into the (awkwardly named) acronyms “METH” — movement, elevation, traction and heat — or “POLICE,” protection, optimal loading, ice, compression and elevation.

When should you ice, and when should you heat?

While many clinics and health care providers, including Britain’s National Health Service, recommend applying ice to the injury for 20 minutes every two to three

Corey Kunzer, a supervisor of physical therapists at the Mayo Clinic in Rochester, Minnesota, said he typically recommended ice at the onset of an injury to help with the pain, and that both ice and heat can be helpful. He tends to recommend heat in the morning, when muscles may be stiffer, and ice in the evening.

Ice is the “safest pain medicine available today,” Mirkin said. But it also reduces inflammation, which is needed for healing, he added.

Kunzer said, “You want some of that swelling and inflammation because that is what some of the healing process happens with,” he said. “At the same time, you don’t want too much because it can be painful.”

The argument in favor of movement

The best treatment approach depends on the injury.

The method of recovery that is most appropriate depends on the type of injury, its severity and its location. While many strains heal on their own within a few weeks, more severe ones may need to be immobilized in a cast or may require surgery.

The bottom line: If an injury is serious, seek recommendations from a doctor as soon as possible for advice on treatment. Understanding the cause of your pain, through a professional diagnosis, can help determine whether it is safe to keep moving or whether rest is required for healing.

Injuries occur when people add too much to their exercise regimen too quickly, so it’s important to build intensity, frequency and duration gradually. As you get older, warming up and cooling down are even more important. Eating a balanced diet and getting enough sleep are good ways to stay healthy and prevent future injuries.

This sweet-tart roasted salmon is ready in no time

It’s easy to forget that rhubarb is a vegetable. Much of the time, you’ll find it buried, like a fruit, under an avalanche of sugar baked into a pie, crumble or cake, or maybe simmered into a compote.

But rhubarb isn’t just for dessert. With a bracing acidity reminiscent of citrus or pomegranate and no pesky seeds, it lends brightness and tang to all sorts of savory dishes. It also adds body, cooking down into a thick sauce with a soft, pulpy texture much like tomato (an actual fruit), though sharper and pinker.

My favorite way to show off rhubarb’s savory side is to use it as a foil for rich ingredients like fatty meats, buttery sauces and oily fish, which the stalks’ tartness cuts like a light saber. Think vinegar, but with precision and finesse.

In this recipe, I match rosy rhubarb with even pinker salmon fillets for a simple, sunset-colored weeknight meal.

First, simmer the rhubarb until it dissolves into a sauce, spiked with piquant fresh ginger, rice vinegar and scallions. Adding just enough sugar tames the acidity, but feel free to stir in a little more if you like, as long as the sauce doesn’t slide into compote territory (in which case, save it for your

morning yogurt).

When the sauce reaches a perfect balance of tart and sweet, spoon some over the fish fillets before roasting. This allows the rhubarb filaments to singe and caramelize in the oven’s high heat. Then serve the rest of the rhubarb mix on the side for a fresher, zippier bite.

If you can find deeply red rhubarb

stalks, they’ll give you the most vivid presentation. Green stalks, though just as flavorful, cook down to a listless beige and aren’t nearly as pretty. Still, that’s nothing a flamboyant garnish of scallion greens couldn’t fix.

You can substitute other fillets for the salmon, but proceed carefully. You need a strongly flavored fish to stand up to this strident sauce. Assertive mackerel, swordfish, bluefish and tuna all stand their ground nicely. But mild fillets like cod, flounder and halibut will be quickly overwhelmed. Rhubarb is not for delicate proteins.

I love this dish on a bed of buttery rice, which absorbs the flavors of the salmon and the sauce and mellows them perfectly.

Rhubarb’s always a joyful dessert, but to really get to know it, bring it to dinner.

Rhubarb roasted salmon

In this speedy, rosy weeknight dinner, a tart ginger-rhubarb sauce lends brightness to rich, buttery roasted salmon fillets. It’s used in two ways here. First, it’s spooned over the fillets before roasting, allowing the bits of rhubarb to singe and caramelize in the

oven’s high heat. Then, more sauce is served alongside for a fresher, zippier bite. To balance the rhubarb’s astringency, a few tablespoons of sugar are stirred into the sauce, but feel free to adjust the amount to taste. It should strike a balance between tangy and sweet. For the pinkest, prettiest sauce, seek out the reddest rhubarb stalks you can find.

Yield: 4 servings

Total time: 25 minutes

Ingredients:

3 scallions, thinly sliced

2 tablespoons granulated sugar, more to taste

1 tablespoon rice vinegar, more for serving 1/2 teaspoon grated fresh ginger, more to taste

Salt

6 ounces rhubarb, trimmed and sliced 1 inch thick (1 1/3 cups)

4 (6- to 8-ounce) skin-on salmon fillets

Freshly ground black pepper

3 tablespoons unsalted butter, cubed Red-pepper flakes, for serving (optional)

Preparation:

1. Heat oven to 350 degrees. Line a rimmed baking sheet with parchment paper, if you like, for easier cleanup.

2. Set aside about 2 tablespoons of the scallion greens for serving. In a medium saucepan, combine remaining scallions, sugar, vinegar, ginger and a pinch of salt. Bring to a simmer over medium heat and simmer until the sugar has dissolved.

3. Add the rhubarb. Cover pan and cook, stirring occasionally, until the rhubarb is just tender, about 5 minutes. Remove pan from heat and, using a spoon or fork, mash the mixture until it falls apart into a chunky purée. Taste and add more sugar, vinegar, ginger and salt if needed. It should taste balanced between sweet, tangy and salty.

4. Arrange salmon skin-side-down on the prepared baking sheet. Season lightly with salt and pepper. Spread half of the rhubarb mixture on top of the fillets (save remaining rhubarb for serving). Top fillets evenly with cubed butter. Roast for 8 to 13 minutes or until the salmon is just cooked through.

5. Garnish the fillets with the reserved scallions, red-pepper flakes (if using) and, if you like, a drizzle of rice wine vinegar. Serve with the remaining rhubarb sauce.

It’s all fun and games until someone gets hurt

In the movie “Moneyball,” Peter Brand, a baseball analyst played by Jonah Hill, has a mantra for the type of player his team covets. “He gets on base,” Brand says when his boss points at him.

The movie, like the Michael Lewis book upon which it is based, is about the rise of sabermetrics in Major League Baseball. It is the story of a group of outsiders who take on the baseball establishment by following a core belief rooted in an expression you can hear at any Little League game: A walk is as good as a hit.

But what if they did not go far enough? If a walk is as good as a hit, and a hit-by-pitch is essentially a one-pitch walk — a base on ball, if you will — then it stands to reason that a hit-by-pitch is as good as a hit, with a little danger mixed in to spice things up.

The math of the strategy is easy enough to explain. But it can be hard to sell the idea to players who are risking their health — and their livelihoods — every time they stand in the way of a 96 mph fastball. Just ask Pete Alonso, the New York Mets first baseman, who is leading the majors in home runs but was placed on the injured list Friday with a bone bruise he sustained by taking a heater from Charlie Morton off his left wrist during a game last week.

It was hardly a surprise to see Alonso get hit by a pitch. He and a few other brave — some might say foolish — players are known for making little effort to get out of the way when a pitch is headed toward them. It is a strategy they have honed for years as a useful, and painful, tool in their arsenals. And it is even harder than it looks on TV.

“Go stand in there and have someone use a machine and see how you react,” said Anthony Rizzo, the New York Yankees first baseman who has been plunked 207 times in his career, tops among MLB’s active players.

The instinct, for nearly everyone, is to get out of the way. But there are some outliers who get hit far too often to explain it through bad luck. Rizzo and others say they do not go up looking to get hit — they swear — but they also admit they aren’t inclined to dive out of the way.

Consider Mark Canha. The Mets outfielder was hit an MLB-leading 55 times over the previous two seasons and has been hit 112 times over the course of his nine-year

career.

As Canha said: “Last year, I’d joke at times: ‘These hit by pitches are keeping the lights on in the Canha household. I’m making a career out of this.’ Your on-base numbers go up. That’s a weapon for you. You’re creating runs.”

As of Wednesday, Canha had been hit in 3.47% of his career plate appearances, which was more than three times the MLB average over the course of his career. If he had been hit at the league-average rate, his .348 career on-base percentage would drop to .324.

In Rizzo’s case, his career on-base percentage of .366 would drop to .345 if he had been hit at the average rate — a difference so vast that he would drop from 11th in the majors since 2011 (among players with 5,000 or more plate appearances) to a tie for 24th.

So how do they do it? For Rizzo, it begins with how he sets up at the plate.

A left-handed power hitter with a quick stroke, Rizzo feasts on pitches down and inside. Knowing he can handle any pitches thrown there, he crowds the plate to make it easier for him to reach outside pitches. But the goal is to hit the ball; a hit-by-pitch is merely an acceptable fallback position.

“If you’re ever thinking about trying to get hit by a pitch, the next thing you know, there’s going to be a fastball in the middle that you’re missing,” Rizzo said. “I think it’s just the approach and how they try to pitch me and where I stand.”

In Canha’s case, it is more about how he is pitched. Right-handed starters often attack the righty-hitting Canha with inside fastballs, a pitch he struggles with. Sometimes those pitches veer too far inside.

There is nothing particularly novel about such an approach, but players like Canha, Rizzo and Alonso set themselves apart from their peers by how they react once they realize the pitch is heading their way: They stand their ground.

“You have to overcome a mental block,” Alonso, who has been hit by 56 pitches over the past five seasons, said before last week’s plunking.

The mental block Alonso referred to, known as the startle reflex, is something he and Harrison Bader, the Yankees center fielder, have been working to overcome since they were college teammates at the University of Florida.

Once a player learns to suppress the startle reflex, the next step is to anticipate where a pitch might hit him. If he can track the ball’s trajectory, he can contort himself in a way that protects his more sensitive areas, like the wrist, thus avoiding what happened to Alonso — an accident that is expected to cost him three to four weeks.

It should be noted in all this, of course, that batters are not allowed to simply let pitches hit them. By rule, they have to try to get out of the way.

That rule, however, which dates to 1887, has been flawed from the start. Umpires have mostly punished batters for clearly leaning into pitches that otherwise would not have hit them, rather than going after players who do not attempt to move out of the way.

That was the genius behind a decision made by Martín Maldonado, the all-glove, no-bat catcher for the Houston Astros, in Game 6 of the 2022 World Series. Leading off the sixth inning with his team down by a run, Maldonado, who typically stands in the middle of the right-handed batter’s box, toed the chalk next to the plate. His sole intention was to get hit by a pitch, and that’s exactly what happened.

Facing elimination, the Philadelphia Phillies challenged the call, saying Maldonado had not made any attempt to get out of the way. But a replay review showed that Maldonado had set up so close to the plate that he hadn’t needed to move for the pitch to collide with his elbow, and the replay crew could not conclusively prove that he had not attempted to avoid the ball. Three batters later, Yordan Alvarez clobbered the three-run home run that put Houston ahead for good, clinching the Astros’ second World Series title.

While Maldonado got away with his gamesmanship, and Rizzo, Canha and Alonso have accepted getting plunked as the not entirely intended reality of their approach at the plate, Tim Locastro, an outfielder for the Mets, has surpassed them all by turning getting hit by pitches into an art form.

Despite being limited by injuries and a part-time role, Locastro has been hit 40 times in 559 career plate appearances. Among players who have been hit at least 10 times, Locastro tops everyone, as it has happened in 7.16% of his career plate appearances.

Locastro, whose biggest asset is his speed, has a solid .325 career on-base percentage that would be an unplayable .264 if he had been hit at the league average rate.

When told this, he was blunt.

“It’s a skill,” Locastro said. “There’s your answer to that question right there.”

In the words of the fictional Peter Brand: “He gets on base.”

Arcangelo’s Belmont victory makes trainer first woman to win a Triple Crown race

As the field for the 155th running of the Belmont Stakes edged into the starting gate Saturday, anyone who has been enthralled with this sport and everyone who loves thoroughbreds was hoping — no, pleading — for something good to happen.

Just a little bit. For the past five weeks, horse racing’s annual turn in the consciousness of American sports fans had hopscotched to one miserable outcome after another, prompting open debate about whether the sport should have its social license renewed.

The Belmont Stakes, by comparison, was mostly a fairy tale.

A gray named Arcangelo thundered down the stretch of the track on Long Island to make history: His trainer, Jena Antonucci, became the first female trainer to win a Triple Crown race, a series that spans more than a century.

From the clubhouse, Antonucci watched her rider, Javier Castellano, dive into the rail around the far turn and slingshot into the stretch as if Arcangelo were tethered to a magnetic electric train track. The horse held off a late run by Forte and gave Castellano his first Belmont victory in 14 tries. Castellano, a Hall of Famer, won his first Kentucky Derby five weeks ago aboard Mage on his 16th attempt.

“He wanted to run today and I had to be patient with him,” Castellano said after the race before directing the attention back to Antonucci and her team.

In the clubhouse with wet cheeks and happy feet, Antonucci jumped and exhorted her horse down the stretch. Antonucci, a Florida-born former show rider, had paid her dues in the barn of another Hall of Fame trainer, D. Wayne Lukas.

Her barn is small, with just a couple dozen horses. Her staff is mostly women, and this was her first victory in a Grade I race, the highest tier of the sport. Since 1937, 30 women had tried 47 times to win a Triple Crown race, only to come up short.

Antonucci was asked what it meant to her to crash through a glass ceiling.

“I don’t have a polished answer,” she said, her voice cracking. “They say no crying in baseball, I think’s it’s the same in horse racing.”

After a couple of deep breaths, she tried.

“Horses don’t know who you are,” she said. “To have a horse believe in you and your team like this one does, I wish more people can be like horses.”

Arcangelo is a 3-year-old ridgeling who cost owner Jon Ebbert of Blue Rose Farm a bargain basement $35,000 as a yearling. In the last couple of months, as the gray developed into a classy runner, Ebbert fielded phone calls from owners and trainers who were offering a lot more

money than the horse’s purchase price to land Arcangelo in their barns.

Arcangelo began his racing career in December as a 2-year-old and Antonucci took her time with him between races. He had only raced four times before Saturday, winning twice, most impressively last month on this racetrack.

“I have an immense amount of gratitude to Jon,” Antonucci said. “He’s a patient owner. A lot of owners could learn from his example and let a horse develop. This crazy guy gave a bunch of girls

a chance.”

The record books will say Arcangelo won the mile-and-a-half race known because of its length as the Test of the Champion in 2:29.35. He paid $17.80 for a $2 win bet and earned a $900,000 first place check for Ebbert and Blue Rose Farm.

For a moment, perhaps, a hopeful look into the future eclipsed the tragedy of a spate of dead horses and the stain of failed drug tests by two top trainers.

Twelve dead horses — two on the undercard of the Kentucky Derby — put the venerable sport under red-hot scrutiny.

Things got worse in Baltimore, where Bob Baffert, the most accomplished and controversial horse trainer in the United States, returned from a suspension straight to the spotlight with his horse National Treasure winning the Preakness Stakes.

Baffert had been banned for two years from the Triple Crown because of a failed drug test by Medina Spirit in the Derby. And in the hours before the Preakness Stakes, Havnameltdown, another colt he trained, stumbled around the far turn of Pimlico Race Course, injured a leg and had to be euthanized on the track.

Last month, second-place finisher Forte was disqualified as the winner of the Hopeful Stakes in Saratoga Springs, New York, after a prohibited substance was found in his post-race drug tests. His trainer, Todd Pletcher, another Hall of Famer, has had horses fail six drug tests in three states, The New York Times reported.

And 25 minutes after Antonucci’s victory, a horse named Excursionniste sustained a fatal injury in the last race of the day at Belmont Park. It was the third fatality at the track since the meet’s opening May 4.

Still, Antonucci’s victory was something to celebrate. The trainer was both grateful and determined. As she walked out of the paddock before the race, she had a moment to remind herself what was ahead.

“I said, ‘There is not a table made for you,’” she said. “‘You make the table. You put great people around you, you work hard. Work your tail off. It will come if you do it the right way.’”

She did. And, man, did horse racing need it.
