Judge Swain certifies constitutional challenges to PROMESA

The judge overseeing the Puerto Rico Electric Power Authority’s (PREPA) bankruptcy to restructure some $10 billion in debt certified on Wednesday challenges to the constitutionality of the Puerto Rico Oversight, Management and Economic Stability Act (PROMESA), which created a bankruptcy process for Puerto Rico and the Financial Oversight and Management Board to oversee local finances.

Monoline insurers Assured Guaranty Corp. and Assured Guaranty Municipal Corp., as reported by the STAR in a June 14 story, provided notice to the court and the attorney general of the United States of their objection to PREPA’s debt plan. They said their objection calls into question the constitutionality of PROMESA on the grounds that it violates the uniformity requirement of the U.S. Constitution’s Bankruptcy Clause.

through issuance of $5.68 billion of new bonds to fund partial recoveries on creditors’ claims. PREPA owns about $8.26 billion in revenue bonds, plus some $218 million in prepetition accrued interest on such bonds. The utility also owns $700 million in fuel line loans and projects roughly $246 million to $4.9 billion in general unsecured claims. It also has over $3 billion in unfunded pension liabilities.

Under the proposed plan, PREPA will pay for the new bonds over 35 years through revenues from a “legacy charge” to PREPA’s customers.

In her order certifying the challenges to the U.S. attorney general on Wednesday, U.S. District Judge Laura Taylor Swain said objections have also been filed by Isla del Rio Inc. and Manuel González Joy arguing that the proposed debt plan violates the Fifth Amendment to the Constitution of the United States by failing to pay just compensation for the taking of property.

They would be among several challenges to PROMESA to date, including a case involving the appointment of Financial Oversight and Management Board members, which the Supreme Court has dismissed.

The challenge by Assured stems from the fact that bankruptcy rules must be uniform for all states. Congress enacted PROMESA, a bankruptcy law that applies only to Puerto Rico.

Assured Guaranty has said its only remaining non-paying Puerto Rico exposure is PREPA. While the entity says it prefers to resolve PREPA’s debt restructuring consensually and remains open to doing so, “the PREPA bonds have robust creditor protections, and we’ll continue defending our rights in court as necessary.”

Bondholders are insisting on getting their entire $8 billion bond claims paid in full, but the oversight board wants to reduce the payout significantly.

The legacy charge for certain customers not currently benefiting from subsidized electricity rates is about $19 a month that would be added to the utility bill. The legacy charge, which will be used to pay bondholders, would exclude qualifying low-income residential customers from a connection fee and kilowatt-hour (kWh) charge for up to 500 kWh per month. For non-subsidized residential customers, the proposed PREPA legacy charge would be: a flat $13 per month connection fee; and 75 cents per kWh for up to 500 kWh per month of electricity provided by PREPA, and 3 cents per kWh for electricity above 500 kWh per month.

For commercial, industrial, and government customers, the PREPA legacy proposed charge would entail: a connection fee of between $16.25 for small business customers, $20 per month for smaller industrial companies, and $1,800 per month for large businesses proportional to their current rate.

UPR celebrates graduations at campuses across the island

The University of Puerto Rico (UPR) continues to celebrate the awarding of degrees to more than 8,000 graduates on its 11 campuses this month.

Members of the UPR Class of 2023 will receive diplomas from one of the institution’s 240 academic programs.

“The University of Puerto Rico gives the country its best professionals, its best talents,” UPR President Dr. Luis A. Ferrao Delgado said. “I hope that the education imparted, based on scientific knowledge, ethical dilemmas, critical thinking, leadership skills and a sense of humanism, will be standard wherever they go. We hope that you will stay here on our island, contributing your knowledge to our people.”

The first Class of 2023 graduation took place on June 2, when 753 Medical Sciences Campus students graduated in the health sciences.

The graduation ceremonies of the College of Agricultural Sciences and Business Administration, along with the College of Engineering, were held on June 9, and on Saturday, June 10, the graduation ceremonies of the College of

Arts and Sciences were held.

On June 9 and 10, the graduation ceremonies of the UPR Mayagüez Campus (RUM by its Spanish acronym) were held at Rafael Mangual Coliseum. There, some 1,934 students received their diplomas.

The RUM offers a total of 61 baccalaureate and 46 graduate programs, which include master’s and doctoral degrees in the areas of engineering, agriculture, arts, sciences and business administration.

new graduates, only one year and five months in age separates sisters Andrea I. Conty Rodríguez and Giuliana S. Conty Rodríguez, who fulfilled their dream of graduating together.

To add to the pride that fills them, both achieved that dream with a perfect 4.00 grade point average, becoming winners of the highest award conferred by the institution to honor that feat of academic excellence, the Luis Stefani Raffucci Award.

The sisters completed their baccalaureates in the Faculty of Arts and Sciences, so they paraded in last Saturday’s 110th RUM graduation ceremony. Andrea earned her history degree in the Department of Social Sciences, while Giuliana obtained hers from the Department of Psychology.

Likewise, Andrea was honored with the Salvador Brau Award as Best Student of the Department of Social Sciences, and Giuliana won the Hilda Bacó Pagán Award as Best Student of the Department of Psychology.

On Wednesday, the graduation ceremonies of the UPR Arecibo Campus were held at Manuel Petaca Iguina Coliseum. Some 564 students will receive academ-

ic degrees in unique programs such as: technology in chemical engineering, veterinary technology, industrial chemical processes, Ibero-American studies, information technology management and administrative processes with emphasis on virtual administrative professional and gastroenterological nursing.

Today, the UPR Humacao Campus will hold its graduation ceremonies at Marcelo Trujillo Coliseum at 4 p.m. Some 412 students will graduate from the 24 academic concentrations in the disciplines of biology, arts, social work, education, English communications, humanities, business administration, office systems, natural sciences, health allied sciences, mathematics and chemistry.

The UPR Aguadilla Campus, meanwhile, holds its graduation ceremonies on Friday at 10 a.m. at Raymond Dalmau Coliseum in Quebradillas. Some 362 students will take their degrees in the areas of business administration, natural sciences, education and physical education, office systems, technology in electronic engineering, humanities and social sciences, education in English in multimedia technology, and aeronautical and aerospace Technology.

Resident commissioner lauded for supporting seniors

The 60 Plus Association recognized Resident Commissioner Jenniffer González Colón this week for her defense of rights, benefits and resources to ensure a better quality of life for older adults both in Puerto Rico and throughout the nation.

The national organization awarded the congresswoman the “Guardian of Seniors’ Rights Award,” which, according to the organization, is given to people who “vigorously fight for and defend the rights of our senior citizens. Patriotism, love for our great country and commitment to protecting our seniors are just some of the attributes we look for in a candidate for this award.”

Since coming to Congress, González Colón has worked to ensure health coverage for over 1.5 million patients in Puerto Rico who receive Medicaid, which has the highest

percentage of seniors of any state, achieving historic allocations such as in 2017 with $295.9 million, in 2018 with $4.9 billion, in 2019 with $5.3 billion for two years, and in 2022 with $19 billion for five years. In the wake of natural disasters such as hurricanes, earthquakes and pandemics, the resident commissioner has secured over $3.1 billion in emergency disaster funding for the nutrition assistance program (PAN by its Spanish acronym).

González Colón has prioritized in her agenda the elimination of the discrimination that Puerto Rico suffers in the financing of federal programs, many of which disproportionately impact senior citizens.

Some of the measures on that front that the commissioner continues to work on in the current Congress are: House Resolution (HR) 256, to make Supplemental Security Income, or SSI, accessible to Puerto Rico; HR

254, to make TRICARE veteran and military health coverage accessible to the island; and HR 253, for Puerto Rico to receive more resources for food assistance by switching from PAN to SNAP.

The 60 Plus Association was founded in 1992 by Jim Martin, as a nonpartisan senior

advocacy group with a vision of free enterprise, less government, and less taxation toward issues important to seniors and future generations. The organization partners with other groups to reach minority communities in the United States to help seniors who need assistance with tools to function better in society.

Former first lady Luisa ‘Piti’ Gándara dies after long battle with cancer

In a statement, her family reported that Gándara Menéndez “requested that in lieu of flowers, any show of affection be made through donations to the non-profit organizations Lee Conmigo, Convento de las Siervas de María on Fortaleza Street and the American Cancer Society.

Several weeks ago, Acevedo Vilá reported that the former first lady had been hospitalized for a week because of the effects of the chemotherapy treatment as her cancer had spread.

On Tuesday, during the transmission of the “Aníbal Podcast,” the former governor said his wife’s health “has been deteriorating rapidly” and that she was in intense pain.

“Given this scenario, in conversation with her doctors and following her wishes, Gabriela, Juan Carlos and I have decided that treatment for her condition is no longer appropriate, that it is not prudent to bring her home and that all efforts be devoted in this last stage with us, to medicines and care necessary to ease her pain,” Acevedo Vilá continued on the podcast, noticeably affected.

As first lady, she promoted early childhood education, developing programs such as Lee y Sueña, aimed at promoting reading among fathers, mothers and their children, and which managed to donate 60,000 books; Rincón de la Lectura, which created 50 reading centers through throughout the island; and Aprendamos Juntos, aimed at recruiting talent from the community as volunteer tutors in public school extended-hours programs.

In March 2013, “Piti” launched her candidacy for a vacancy that arose in the House of Representatives after Jorge Colberg Toro resigned from the seat to become secretary of public affairs of La Fortaleza. The former first lady served in the Legislature until 2016.

Luisa “Piti” Gándara Menéndez, a former legislator and former first lady of Puerto Rico, passed away Wednesday after a long battle against cancer.

News of her death prompted numerous condolences.

California firm lands $57 million contract for San Juan Harbor dredging

California’s Curtin Maritime Corp. of Long Beach has won a $56.7 million U.S. Army Corps of Engineering (USACE) contract for San Juan Harbor construction and maintenance dredging, according to DredgingToday.com.

The work, according to USACE, consists of construction and maintenance dredging in designated areas of the federal navigation channel and Puerto Rico Ports Authority berthing areas. The dredging project has an estimated completion date of July 31, 2024.

The project also involves constructing 50 feet of new channel on both sides of Army Terminal Channel to increase the total channel width by 100 feet to 450 feet, DredgingToday.com said.

All dredged material will be disposed of at the San

Juan Ocean Dredge Material Disposal Site located some 2.3 nautical miles offshore, the publication said.

The $56.7 million project in San Juan Harbor consists of construction and maintenance dredging in designated areas of the federal navigation channel and Puerto Rico Ports Authority berthing areas.

Data suggests youth and child well-being is deficient due to poverty in Puerto Rico

states, the District of Columbia and the 78 municipalities in Puerto Rico.

The nonprofit Youth Development Institute (IDJ by its Spanish initials) on Wednesday presented an index developed by the organization indicating that while the cost of living continues to rise, the average income in Puerto Rico has stayed below $23,000 a year.

That harsh reality marks the 10th year in a row where the island obtained a low score on the index, the institute reported at a press conference in San Juan. In comparison to 51 other jurisdictions of the United States, Puerto Rico ranks in 31st and stands as the U.S. jurisdiction with the worst conditions in various indicators such as: child poverty, median income in families with children, families with children in which one or both parents are unemployed, and participation in the state nutrition assistance program (which in Puerto Rico is commonly known as PAN by its Spanish acronym), which is currently received by 61%. Over 55% of children on the island live in poverty, which equates to nearly 300,000 children and youth in the archipelago.

“Puerto Rico is still stuck with a ‘D’ grade in the living conditions in which its children and youth develop,” said María Enchautegui, the IDJ’s research and public policy director.

“With this rating on the Child and Youth Well-Being Index, Puerto Rico ranks 31st in comparison with the 51 U.S. jurisdictions evaluated in the Index. The economic data shows that there is a lot of work left to be done.

The only way to improve these indicators is with intentional and concerted actions. IDJ proposes and supports systemic change that generates opportunities for boys and girls that live in low-income families and that paves the way for economic mobility.”

The index used to provide the following data is a tool created and published by the IDJ for the past 10 years, in collaboration with KIDS COUNT of the Annie E. Casey Foundation. It provides a better look at the living conditions of children and youth in Puerto Rico between the ages of 0 and 17, with 27 different indicators in the areas of economy, family, education, health and safety. One of the advantages that the tool provides is that it makes it possible to compare the 50

“With this tool, we have the possibility this year in Puerto Rico to make a scale comparison between 2011 and 2021 of the tendencies and how the conditions of the children and youth in Puerto Rico [have changed],” stated IDJ Research Analyst Vallerie Blakely Vallecillo. “With this data we are making a call to action. The median income of families with children in Puerto Rico is 22,334; this represents about $36,000 less than the median income of New Mexico, which is the jurisdiction with the second-worst conditions in the United States, compared to all other jurisdictions. On a municipal level the median income of families with children is even lower, where municipalities like Naranjito have a median income of $11,396 followed by Mayagüez, where the median income is around $11,643.”

Blakely Vallecillo added that the index shows that from 2011 to 2021 the percentage of families with children where one or both parents are currently unemployed has decreased by almost 10%; however, Puerto Rico is still the less favorable jurisdiction in that category in comparison to all 50 states.

She also stated that Puerto Rico places first when it comes to families that participate in nutrition assistance programs in comparison to the other jurisdictions. The municipality with the highest number of families with children receiving nutrition assistance is Guánica, with 84% of all families receiving the benefit. Guánica also has the largest number of families with children where one or both parents are unemployed.

Thankfully the data the index provides is not all bad, as the number of mothers who

gave birth recently and don’t possess a high school diploma was reduced from 18% in 2011 to 8% in 2021. Over the past decade, Puerto Rico was able to reduce the number of teen pregnancy births, out of every 1,000 teenagers between the ages of 15 and 19. In 2011 there were 51 teen pregnancy births out of every 1,000 teens, while in 2021 there were only 13 teen pregnancies out of every 1,000 teens, which equals 1,267 births.

The index also shows that in comparison to 2011 there’s been a substantial reduction in the youth death rate, from 73 to 44, almost 30 fewer deaths for every 100,000 young people on the island.

However, the IDJ is not going to rest on the positive data the index provides. The next priority, the researchers said, will be to continue complying with Rule 84 2021, which implies reducing poverty in children and teenagers on the island. They also said at the press conference that they will soon reveal results from a survey that will show what the barriers are regarding employment that families currently face.

“There are solutions, and we have many proposals, as it is evident this problem cannot be solved with a single thing, this problem is the combination of many issues,” Enchautegi said. “However, we are hard at work with a timeline to reduce child poverty in the next 10 years which incorporates various policies, from developing skills, reducing the barriers in the workforce and the creation of jobs. Even though there are solutions, not every family has the same problem or solution -- maybe some families need daycare, maybe for others it’s lack of transportation. That is why we provide a wide variety of solutions to reduce child poverty in Puerto Rico.”

Public urged to learn the benefits of the Internet Subsidy Program

Enrique Völckers Nin, the assistant chief of staff for innovation, information, data & technology and executive director of the Broadband Program of Puerto Rico, urged citizens to determine if they qualify for the Internet Subsidy Program created by the Federal Communications Commission (FCC), which seeks to help families with the monthly payment for high-speed internet. The announcement comes after the federal government declared the week of June 14-22 as the Affordable Connectivity Program (ACP) Week of Action. During this period, the Puerto Rico Broadband program will be making various efforts to disseminate details about the program and how more families in Puerto Rico can benefit.

“This week we will conduct orientations directly in the communities with the support of community leaders, who we have trained to assist people in the application process,” Völckers Nin said. “This new initiative of the federal government allows us to disseminate details about the program on a mass scale, which has benefited thousands of families, but we know that many more, who are eligible, have not yet applied.”

The official noted that Puerto Rico is one of the jurisdictions that has assisted the most people, with some 565,000 families reached. The subsidy provides a discount of up to $30 per month on the internet service bill in eligible households and a one-time discount of up to $100 for the purchase of a computer or tablet purchased from a participating provider.

For Trump, the show and the campaign must trudge on

Former President Donald Trump went to bed Tuesday night, on the eve of his 77th birthday, as a now twice-indicted former president and current front-runner for the Republican nomination for the White House in 2024.

“Some birthday,” Trump grumbled on Tuesday as he visited Versailles, a popular Cuban coffee shop in Miami. “Some birthday.”

He had just been arraigned on federal charges. His co-defendant was working as his valet. And he didn’t eat Cuban — he had McDonald’s. On his plane headed back to New Jersey from Miami, Trump ate the fast food while holding court with advisers and finishing edits on the speech he would soon deliver and mostly adhere to.

The surreal scene that awaited him at his private club in Bedminster, New Jersey, was a blend somewhere between a summer garden wedding and a political victory party. There was an air of an almost post-arraignment celebration as women arrived in their finery: fuchsia and canary yellow dresses, embroidered Trump wares and heels. Men sported suits and red MAGA hats.

Then Trump arrived. Visibly deflated after pleading not guilty for the second time in three months, his dry and lowenergy resuscitation of his legal defense — even inflected with the usual references to Marxists, communists and fascists — pleased his advisers but drew a relatively muted response from a crowd that had minutes earlier craned their phones for a shot of his motorcade.

He had entered to the same track — “God Bless the USA” by Lee Greenwood — that he has used as an entrance theme so many times before. On Tuesday, the chorus landed differently.

“I did everything right,” Trump declared in his 30-minute speech, “and they indicted me.”

When he finished, he barely lingered to take in the applause. He gave an obligatory fist pump and mouthed thanks to the crowd. Then he turned and went inside.

All told, the day encapsulated the remarkable numbness to the extraordinary that has defined the Trump era. The former president entered federal court as a criminal defendant, and now faces hundreds of years in prison. The Republican front-runner’s early 2024 calendar now includes not only key caucuses and primaries but court dates. His rivals are at times contorting themselves while discussing his alleged crimes; one circulated a petition on Tuesday demanding they all promise to pardon him.

Trump’s appearance in a Miami courtroom was a humiliating moment for a New York businessman with a 40-year history of engaging in gamesmanship with prosecutors and regulators, viewing most every interaction as a transaction or

something he could bluster his way through. By 2017, he had the armor of the presidency protecting him when the first special counsel investigating him, Robert Mueller, began his work. And by 2021, as investigations began into his efforts to thwart the transfer of power, he had come to see another campaign as a shield against prosecutions.

But that grandeur — and legal insulation — had vanished on Tuesday. Instead, Trump’s team tried to create the sense of a man still in power. In Bedminster, he spoke with the white columns of the main house of his New Jersey golf club behind him. The indictment became another backdrop for the ongoing Trump Show.

He was comforted by a motley assortment of his most fervent supporters. They included former President Richard Nixon’s son-in-law; a former New York Police Department commissioner whom Trump pardoned in the final year of his presidency; and a former administration official whom Trump named as a representative to the National Archives.

It was the National Archives that began the winding road that ended with Trump facing charges alleging that he had defied a subpoena and kept highly classified documents. The agency, which is in charge of preserving presidential records, spent most of 2021 trying to compel Trump to return boxes of materials that he had taken with him when he left the White House. So did some of his lawyers and advisers. When he finally returned 15 boxes in January 2022, archives officials discovered nearly 200 individual classified documents, and alerted the Justice Department.

On Tuesday night in Bedminster, what amounted to a red-carpet MAGA crowd mingled to a carefree playlist of Trumpfavored throwbacks: “Macho Man” by the Village People, “Can’t

Take My Eyes Off You” by Frankie Valli, “We Will Rock You” by Queen, “Dancing Queen” by ABBA. Dozens of women wore matching red-white-and-blue outfits and chanted “We love Trump!” in unison as Trump was airborne.

The arraignment date happened to coincide with Trump’s first major fundraiser, with those who had raised at least $100,000 invited to a “candlelight dinner” after his speech. The Trump campaign will be paying Trump’s private business in donor dollars for both events, a practice he has done for years.

Robert Jeffress, an evangelical pastor in Dallas and an early supporter who said he would not “abandon” Trump, got a call from a staffer for the former president on Monday, asking him to attend. He said Trump’s supporters saw the charges as “political.”

“I think they see this as Biden’s way of getting rid of his No. 1” opponent, he said, as music blared behind him.

The gathering in Bedminster and Trump’s not-quite impromptu cafe stop in Miami were reminiscent of how he handled the gravest political threat he faced in his first 2016 campaign: the infamous “Access Hollywood” tape. Back then, he immersed himself in a crowd of his supporters outside Trump Tower. Now, he did so both at his own property and in a friendly corner of a city where he will soon face trial.

Seeking Latino support, Trump raises specter of Latin American corruption

Carinés Moncada, repeatedly concurred.

“What we’re seeing here is the type of thing, Mr. President, that sadly happens in Latin America,” Moncada said.

Trump’s comparison is, to say the least, a stretch. The former president has been accused of possessing dozens of classified documents after he left office and repeatedly obstructing the government’s attempts to retrieve them from his Mar-a-Lago home. The indictment, which relies on his own lawyer’s notes and photos and aides’ communications, has been described as serious and damning by even some Republican lawyers, including his former attorney general.

The investigation was led by a special counsel to give President Joe Biden, Trump’s former and possibly future rival for the White House, some remove from the case.

That evidence and measure of independence, however, have done little to persuade Republican voters. At least one early poll, conducted by CBS News/YouGov, suggests the vast majority of GOP voters have accepted Trump’s defense that the case amounts to political retribution.

His latest remarks go further. Trump has repeatedly alluded to Democrats as “communists,” including during a speech Tuesday night at his club in Bedminster, New Jersey.

“If the communists get away with this, it won’t stop with me,” he said. “They will not hesitate to ramp up their persecution of Christians, pro-life activists, parents attending school board meetings and even future Republican candidates, which they do.”

Eduardo A. Gamarra, a professor of politics and international relations at Florida International University who is also part of its Cuban Research Institute, said the narrative woven by Trump and his surrogates, while false, was a shrewd one.

“It’s reinforced by local media, by much of what of the Trump campaign and other Republicans are saying: that this administration, the Biden administration, is behaving like the banana republics behave, so that’s resonated very intensely here,” he said. “It’s great politics, but it’s not true.”

The day before former President Donald Trump was arraigned on federal charges, he gave an interview to Americano Media, a conservative Spanish-language broadcaster in South Florida, and described his indictment as a “regression” of democracy.

Minutes before he pleaded not guilty in a Miami courtroom on Tuesday, his spokesperson told reporters that the episode was something “you see in dictatorships like Cuba and Venezuela.”

After he left the courthouse, Trump went directly to a popular Cuban restaurant in Little Havana and prayed with supporters.

As he mounts his political defense against a 37-count indictment, Trump has repeatedly invoked corruption and dysfunction in Latin American governments, casting himself in the role of oppressed political dissident.

It’s a clear effort to try to disparage the government’s case — but also a not-so-subtle play for the sympathies of Latino voters, both in Florida and far beyond.

“They really see it better than other people do,” Trump said Monday in an interview with Americano Media. The host,

Trump has been particularly focused on persuading Latino voters on that point, a strategy that may be both political and legal. It is possible that the jury pool could be drawn from registered voters in Miami-Dade County, where nearly 70% of the population identified as Latino, according to census data.

More broadly, Trump sees his relative strength with Latino voters across the country as critical to his hopes of returning to the White House. He won about one-third of Latino voters in 2020, according to surveys of the electorate. That was up from 2016, when he received support from less than 30%.

In a May poll conducted by Quinnipiac University, Hispanic voters were about evenly split when surveyed about a rematch between Trump and Biden in 2024.

Trump has used a range of cultural and religious issues to connect with those voters, with success that ranges broadly across geography and demographics. He has also used messages aimed more specifically at voters with close ties to Cuba, Venezuela and Central America. In 2020, repeating language effectively used by Gov. Ron DeSantis of Florida, Trump repeatedly cast Biden as a “socialist,” playing on negative associations many Latin American immigrants have with the governments they fled.

Gamarra, who was born in Bolivia, said Trump’s courtship was refreshing to many groups of Latino voters because some have been overlooked by many politicians. But he said that his latching onto the premise that he was somehow a political dissident was damaging.

“I think it just sort of propagates the stereotypes about Latin America,” he said. “It’s much more complex than simply the banana republic image.”

The symbolism in Trump’s cameo at Versailles Restaurant in Little Havana was clear. A landmark for the Cuban diaspora, the restaurant is frequently visited by politicians looking for support. In 2016, the restaurant hosted Trump and Rudy Giuliani together after Trump’s first debate against Hillary Clinton.

On Tuesday, Trump soaked up support and prayers from the crowd. Paloma Marcos, a native of Nicaragua who has been a U.S. citizen for 15 years, rushed to Versailles with a Trump hat and a sign that said, “I stand with Trump.”

She said many Nicaraguans like her had an affinity for the former president, because he is against communism.

“He knows we support him. The Latino community has had an awakening,” Marcos said. “The curtain has been pulled back.”

The federal indictment of a former president is unprecedented in the United States, but many Latin American presidents have been prosecuted after leaving office.

GOP rebels are breaking the rule on rules, upending how the House works

It has long been an axiom of the House majority: Vote against a piece of legislation put forth by your party if you absolutely must, but never, ever vote against the “rule” to bring that legislation to the floor.

Until the last few weeks, that standard had held for more than two decades. But now, about a dozen rebellious House Republicans have decided to leverage their badly needed votes on the routine procedural measures to win policy concessions, breaking the long-standing code of party discipline and threatening the traditional operation of the House.

“Who cares?” asked Rep. Eli Crane, R-Ariz., one of the

members of the far-right House Freedom Caucus who broke with their party on the rule last week, resulting in a very rare defeat that ground the chamber to a halt for a week.

“I could care less, and neither could my voters,” he said about violating a House norm. “Tradition be damned; we have to change the way this town works.”

But making such changes would fundamentally alter the nature of the House. Unlike the Senate, where consensus is required to move forward on virtually anything, the House operates according to strict majority rule, making party unity critical to the smooth functioning of business.

It could also greatly complicate life for Speaker Kevin McCarthy, with potentially disastrous consequences for the

country. With a razor-thin margin of control, if all Democrats are present and voting “no,” he can afford to lose no more than four Republicans and still win approval of the rules that are required to bring most major legislation to the floor.

Should the group of Republicans continue their procedural resistance, it would sow chaos for McCarthy’s efforts to legislate, potentially upending the consideration of government spending bills needed to avert a shutdown this fall. Their new strategy gives the mutineers, who lack the votes to oust McCarthy, significant power over the speaker and his agenda.

They were outraged over McCarthy’s deal with President Joe Biden to suspend the debt limit and avert a federal default, which included spending caps far higher than what House Re-

publicans had endorsed.

McCarthy met with the rebels Monday and appeared to quell the procedural mutiny at least temporarily by offering new assurances, and the House got back to business Tuesday. But the insurgents said they had explicitly refused to promise to vote for rules in the future, and would have no problem defeating them in the weeks ahead should McCarthy fail to share power with them in the ways they demanded.

“Each day there’s another challenge,” McCarthy said. “I just wake up every day, pray for the patience of Job and find a solution. We work forward.”

While little noticed by the public, House rules are fundamental to the functioning of the chamber. They put the agenda firmly in the hands of the majority, allowing the party in power to control what legislation is considered and what changes may be proposed. Past speakers of both parties have made supporting the rules a strict test of party loyalty, and lawmakers would defect on them at risk of punishment such as losing committee posts or having their legislation bottled up.

But hard-right conservatives suspicious of McCarthy’s conservative bona fides have had the usually obscure rules process in their sights since he had to fight for his speakership in January. Among the concessions he made was an agreement to put three of the most conservative members of the House on the Rules Committee, usually an organ of the speaker.

The committee narrowly sent the debt limit legislation to the floor late last month over the objections of two Freedom Caucus members on the panel. But more than two dozen Republicans opposed the rule to allow the compromise to be considered, forcing McCarthy to rely on Democrats to cross party lines and rescue the bill. It was an extraordinary turn that underscored the speaker’s weak grip on his conference, and angered conservatives even more.

Democrats were not about to help Republicans last week when 11 far-right conservatives opposed the rule on a political messaging bill about gas appliances that had no chance of becoming law. It was the first time since 2002 that a rule had been defeated, and it stunned the House, leaving McCarthy unable to put any bills on the floor. Lacking a governing majority as the hard right refused to relent, he sent lawmakers home for the week.

In a series of meetings after the floor revolt, McCarthy and the Freedom Caucus members sought to find some accommodation, with the far-right Republicans demanding more say in determining what bills reach the floor, particularly the spending bills that are beginning to take shape.

In trying to mollify the rebelling lawmakers, Rep. Kay Granger, R-Texas, the chair of the Appropriations Committee, said Monday that the panel would keep spending bills below the amounts agreed to in the debt limit deal, a position certain to provoke a clash with Democrats.

The situation left Democrats declaring that the speaker had ceded control of the floor to what Rep. James McGovern of Massachusetts, the senior Democrat on the Rules Committee, called the right wing’s extreme right wing.

“In what world should the 11 most extreme people in the Republican Party get to dictate the entire agenda of a legislative body that represents 332 million people?” McGovern asked.

The uproar left many other House Republicans frustrated, complaining that a handful of their colleagues were turning the chamber upside-down and worried about the electoral ramifications in 2024. They called for calm and said they hoped that opposing rules did not become as routine as

supporting them once was.

“This can’t be the new normal,” said Rep. Dusty Johnson,

R-S.D. “We can’t afford to have this kind of disruption every week.”

Food prices rise even as inflation eases, straining consumers’ budgets

Hanna Hensley, 29, an assistant high school teacher in Arlington, Virginia, is glad to see some food prices come down recently, because it has helped ease her grocery bill.

When egg prices shot up to around $5 a carton a few months ago, she stopped buying them. But on Sunday, while shopping at a Giant Food store, she picked up a carton of them, along with oatmeal, tomatoes, mushrooms and sliced marble cake. A dozen eggs now cost her about $2.50, she said.

Despite some relief at the grocery store, Hensley said she was still frustrated with the high cost of food. Weekly groceries for her family, which includes her parents and sister, now total about $100, up from $70 before the pandemic.

After remaining flat for two straight months, food costs climbed 0.2% in May from the prior month, according to a Labor Department report released Tuesday. That gain defied a cooling trend in inflation: Overall prices rose 4% in the year through May, the slowest pace in more than two years.

On a monthly basis, food prices are rising at a slightly slower rate than they were earlier in the year, but costs are still much higher than they were before the pandemic. Over the last year, food prices picked up 6.7%, down from 7.7% in April.

The price increases are particularly painful for households because food is an essential part of their budgets. Lower-income households tend to be hit harder because they typically spend a greater portion of their incomes on food.

Prices for groceries rose 0.1% in May from the month before, when they declined 0.2%. Prices for food at restaurants continued to climb, rising 0.5% over the month, an increase from the 0.4% pop in April.

Fruit and vegetable prices increased 1.3% in May, following a 0.5% decrease in April. The index for meats, poultry, fish and eggs fell 1.2% in May after declining 0.3%

in April. Egg prices continued to see a steep decline, falling 13.8% last month. Egg prices had jumped a few months ago after an outbreak of bird flu and the cost of fuel, feed and packaging rose.

Fam Chock, 43, an accounting specialist at a nonprofit in Washington, said she was surprised to see the price of eggs come down recently, but she had not noticed other products become cheaper. Chock said groceries for her family now total about $1,000 a month, up from about $600 before the pandemic.

“It’s a family of four, so all of that adds up,” she said. “We’re not buying anything extravagant.”

Her family has cut back spending in various ways: They used to eat at restaurants about four times a week, but now they go out once a week, at most. She rarely buys the rib-eye steaks her husband likes, and she started growing more vegetables in her home garden, including sugar snap peas, which she said had nearly doubled in price at the grocery store since before the pandemic.

Chock was at Safeway on Monday buying strawberries, fried chicken and pickles with her co-worker Lashanor Doolittle for a staff lunch. Doolittle, 60, an administrator at the nonprofit, pointed to the two bags of chicken in their

cart, noting that they were buying them because they were on sale.

Doolittle said she had also made adjustments to deal with the high cost of food, including buying most of her groceries in bulk at Costco.

“Everything I tend to buy has become more expensive,” Doolittle said. “I’m always looking for coupons.”

Food prices began rising sharply about two years ago as the costs of labor, transportation and raw materials increased, partly because of supply chain snarls and higher fuel prices. That resulted in companies passing along some cost increases to consumers for a wide variety of products. Other factors, such as extreme droughts in the western United States, have also strained supply and pushed up food prices.

Though costs for some raw materials have recently fallen, some large corporations, such as PepsiCo, have signaled that they will continue increasing prices or keep them elevated for the foreseeable future as consumers have largely kept buying products.

Still, economists say that overall food prices could show signs of moderating as labor pressures ease and wage growth across the food industry has slowed, reducing stress for companies. Recent declines in fuel prices have also helped bring down transportation costs.

Biden administration officials have highlighted the recent slowdown in price increases for groceries, although they have said, “The job is not done yet and there is considerable uncertainty around the outlook.”

Some shoppers have taken little comfort in the recent easing of price increases.

Sofia Arias, 27, a management analyst at a federal agency, picked up bananas, bell peppers and chicken at a Whole Foods in Washington on Monday. She said that there were less expensive stores in the area, but that she tried to buy as much organic food as possible and had more room in her budget because she was single and did not have to shop for others.

She said her groceries, which usually lasted her about two weeks, would cost about $150, up from about $100 before the pandemic. Many products have grown more expensive: A container of cottage cheese that cost about $3.50 at the beginning of the pandemic now costs $5, she said.

Arias said she had cut back expenses in other ways, such as dining out less, curtailing snacks and eating at home before going out for drinks. She said she had seen egg prices fall, but she had not noticed much relief elsewhere.

“I don’t know if it’s getting better,” she said. “I just feel like the cost of living is ridiculous.”

Stocks edge higher, dollar sags after inflation data with Fed pause expected

Global shares edged higher and the dollar fell to a fourweek low on Wednesday after the latest reading of U.S. inflation cemented bets that the U.S. Federal Reserve will not hike interest rates later in the session.

U.S. producer prices fell more than expected in May and the annual increase in producer inflation was the smallest in nearly 2-1/2 years, according to Labor Department data.

This was after the consumer price index (CPI) report on Tuesday showed prices barely rose in May, with just a 0.1% increase from the prior month.

The data appeared to support traders’ views that the Fed is unlikely to hike rates later on Wednesday. They now see more than a 95% chance of the central bank staying put, according to CME Group’s FedWatch Tool.

“Following yesterday’s lower inflation data and today’s improving numbers, markets are expecting the Fed to pause its rate hikes today,” said Peter Tuz, president of Chase Investment Counsel in Charlottesville, Virginia.

On Wall Street, the Dow Jones Industrial Average fell 136.57 points, or 0.4%, to 34,075.55, the S&P 500 gained 12.64 points, or 0.29%, to 4,381.65 and the Nasdaq Composite added 54.67 points, or 0.4%, to 13,627.99.

The pan-European STOXX 600 index rose 0.40% and MSCI’s gauge of stocks across the globe gained 0.46%, hitting its highest level since April 2022.

Wednesday’s data also sent U.S. Treasury yields lower with benchmark 10-year notes down 5.5 bps to 3.784%, from 3.839% late on Tuesday. The 30-year bond was last down 4.4 bps to yield 3.8969%, from 3.941%. The 2-year note was last was down 7.4 bps to yield 4.6222%, from 4.696%.

And in currencies, the dollar index hit a four-week low and was last down 0.532%, with the euro up 0.53% to $1.0848. The yen strengthened 0.59% versus the greenback at 139.40 per dollar, while sterling was last trading at $1.2694, up 0.65%.

Oil prices rose after bullish oil demand forecasts from the International Energy Agency (IEA) and OPEC.

U.S. crude recently rose 0.42% to $69.71 per barrel and Brent was at $74.66, up 0.5% on the day.

The S&P 500 and Nasdaq rose for a fifth straight session to hit multi-month highs on Wednesday, as investors bet the Federal Reserve would skip raising interest rates later in the day, while a drop shares of insurer UnitedHealth weighed on the Dow.

A larger-than-expected drop in U.S. producer prices in May due to a decline in the costs of energy goods and food signaled that inflation was cooling, further supported by data a day earlier that showed consumer prices moderated last month.

The U.S. central bank is expected to leave interest rates steady at the 5%-5.25% range, unchanged for the first time since it kicked off a historically aggressive round of policy tightening in March 2022 aimed at curbing soaring inflation.

we don’t know yet nor does the Fed,” said Brad Bernstein, managing director at UBS Wealth Management.

“I think we’ll get what’s called a hawkish pause today, where they’ll be talking about their concerns about inflation but at the same time not raise rates.”

Traders see a 95% chance the Fed will hold rates at the current levels, but have priced in nearly 60% odds of a 25-basis-point hike in July, according to the CME Fedwatch tool.

The yield on the two-year Treasury notes, which tend to move in step with short-term rate expectations, slipped to 4.6% after the release of producer prices data. [US/]

The Fed is scheduled to issue its policy statement and deliver new quarterly economic projections at 2 p.m. EDT (1800 GMT), followed by Chair Jerome Powell’s news conference.

Weighing on the Dow, UnitedHealth Group tumbled 7.4% after the health insurer warned of a spike in medical costs in the second quarter as more older adults undergo nonurgent procedures they had delayed during the pandemic.

The S&P 500 health sector fell 0.9%, while the S&P 500 managed healthcare index hit a near 17-month low, down 7.8%.

At least 79 die as boat carrying migrants sinks near Greece

ATHENS, Greece — At least 79 people drowned in the Aegean Sea after a large boat carrying migrants sank early Wednesday, Greek authorities said, in the deadliest such episode off the country’s coast since the height of the 2015 migration crisis.

More than 100 people were rescued, but the Greek coast guard warned that the death toll would probably increase.

What happened?

The boat foundered Wednesday about 50 miles southwest of Pylos, a city in southern Greece. A day earlier, Greek officials were alerted to the boat’s unusual movements, according to a statement from the Greek coast guard, which said the boat’s crew had declined assistance offered by the authorities.

The cause of the sinking was unclear as of Wednesday afternoon. A Greek Shipping Ministry official said the boat was traveling to Italy from Tobruk, Libya.

Officers on a coast guard vessel dispatched to the area saw “a large number of migrants on the outside deck of the boat” on Tuesday night, the agency said. The boat’s crew declined aid, according to the statement.

The Greek coast guard learned about the boat’s engine failure shortly before 2 a.m., the Shipping Ministry said. Coast guard officers tried to approach the vessel after receiving a request for help, it said, then “saw the boat take a right turn, then a sharp left, and then another right so big that it caused the vessel to capsize.”

Ten to 15 minutes later, it said, the boat had sunk and many people had fallen into the sea.

After the sinking, Greek authorities said, the coast guard and military deployed a large number of vessels to reach survivors and locate the dead. Many of the migrants were believed to be from Egypt, Pakistan and Syria, according to the Shipping Ministry.

that is about 13,000 feet deep, which could put the wreck and victims beyond divers’ reach.

Greece’s caretaker prime minister, Ioannis Sarmas, declared three days of national mourning Wednesday. President Katerina Sakellaropoulou, who holds a largely ceremonial office, visited the port of Kalamata, in southwestern Greece, where some people were protesting the government’s tough stance on migration.

How deadly are these migrant routes?

The sinking was the deadliest such episode off the Greek coast since 70 people died when a boat carrying migrants sank near the island of Lesbos in October 2015, according to the International Organization for Migration.

Last year, nearly 3,800 migrants died on routes within and from the Middle East and North Africa region, according to a new annual report by the organization — the highest death toll in five years, the report said. And given the scarcity

of official data, the actual number of deaths on those routes is probably much higher, it said.

“As many as 84% of those who perished along sea routes remain unidentified, leaving desperate families in search of answers,” the report said.

Some of the worst disasters at sea took place in 2015 and 2016 as hundreds of thousands of people were trying to reach Europe. In one sinking, in April 2015, an estimated 800 people died near Libya; a year later, the United Nations said that as many as 500 died when a boat packed with migrants capsized en route to Italy.

What is Greece’s stance on migration?

Migration has been a central issue in the Greek election, and two leading politicians, the conservative Kyriakos Mitsotakis and the left-wing Alexis Tsipras, canceled speeches on Wednesday. Mitsotakis, a former prime minister, has defended his tough migration policy, arguing that a more lenient stance had caused undue pressure on Greece and a rise in deaths at sea.

While in office, Mitsotakis cracked down on migration, heightening border controls in an effort that led to a 90% drop in migrant arrivals since 2015. Rights groups accused his government of illegally pushing back migrants at sea and building camps with prisonlike conditions, and video verified by The New York Times showed the Greek coast guard in April rounding up asylum-seekers, among them children, and abandoning them on a raft at sea.

In a statement, Mitsotakis said he was “stunned” by Wednesday’s sinking, which he said underlined a need for Europe to respond to criminal smuggling networks.

“This is a time for solidarity and humanity. The priority is to save as many lives as possible,” he said. “The new incident, however, highlights in a dramatic way that the issue of migration remains a problem that demands a coherent European policy.”

Many people in Greece, particularly in border areas, have welcomed the reduced number of migrant arrivals, and Mitsotakis’ party did well in a vote in May, though it fell short of a majority to lead the government.

Wedding guests among at least 103 killed in boat accident in Nigeria

More than 100 people died, including many who were returning from a wedding ceremony, after a riverboat transporting them capsized earlier this week in Nigeria, according to residents and local police.

The boat was sailing on the Niger River in the western state of Kwara early Monday morning, according to a police spokesperson, Okasanmi Ajayi, who said that more than 100 people had been rescued and that the search was ongoing.

“The boat capsized in complete darkness, and it wasn’t until hours later that we were alerted,” Ajayi said. The death toll stood at 103 as of Tuesday evening and was likely to rise, he added.

Riverboat accidents are a recurring issue in Nigeria, a

West African nation where overloading, lax safety regulations, the absence of life jackets and poor maintenance often lead to deadly incidents. Nighttime sailing is outlawed across the country, but the ban remains poorly enforced.

Authorities had yet to determine the cause of the accident Monday, Ajayi said. Among the victims were several families, including children, according to testimonies from local residents.

Ibrahim Hassan, a resident of the village of Ebbu, where many of the wedding guests were from, said the area experienced heavy rainfall Monday. One family that Hassan knows lost seven children, with two others still missing as of Tuesday night, he said in a telephone interview.

“We lost a lot of people, including women and children,” Hassan added. “Our community will never be the same again.”

The 2,600-mile Niger is the main river in West Africa.

Allies pressure Biden to hasten NATO membership for Ukraine

President Joe Biden has taken every opportunity over the past 16 months to celebrate NATO’s unity on Ukraine. But on one key topic, Biden finds himself somewhat isolated within the alliance: when and how Ukraine would join.

Biden, who has been cautious about getting NATO into a direct fight with Russia, has sought to maintain the status quo of more than a decade: a vague promise that Ukraine, now arguably the most powerful military force in Europe, will eventually join the alliance, but with no set timetable.

Now a debate has broken out among the allies that is putting pressure on Biden to support a significantly faster and more certain path to membership for Ukraine. For Biden, all the options carry considerable risks, pitting his desire not to allow any fractures to appear in NATO against his standing instruction to his staff to “avoid World War III.”

Many of the allies, especially from countries bordering Russia, want to provide Ukraine with a strong political commitment on membership ahead of a NATO summit next month in Vilnius, Lithuania. Some want a timetable and specific goals to meet for true membership, though only after the war is no longer raging, Biden administration officials said.

Krisjanis Karins, the American-born prime minister of Latvia, argued that “the only chance for peace in Europe is when Ukraine will be in NATO.” Speaking Wednesday at a strategy conference in Riga, he said that any other outcome means inevitably “Russia will come back.”

The hope in the push is that once Ukraine is a full member of the alliance, Russia would not dare to try to topple the government in Kyiv because an attack on one NATO country is considered an attack on them all. Ukrainian membership has become a “consuming debate,” both in Europe and inside the Biden administration, according to one senior U.S. official who is deeply involved in the discussions.

Only Germany has sided fully with Biden, though some of the other 29 allies have their own quiet doubts about Ukraine’s readiness to fully join the alliance — and the risks that NATO nations could get sucked directly into a conflict with Russia in the future.

In a blur of memos and meetings, several U.S. officials, led by Secretary of State Antony Blinken, appear to have taken the position that the Biden administration will be forced to be more specific about Ukraine’s path to membership, even if no date can be agreed upon

in the middle of a war that has no clear end in sight.

Blinken’s view was reinforced during a meeting of NATO foreign ministers in Oslo, Norway, two weeks ago, when many of the allies — led by Poland and the Baltic States — insisted that Ukraine’s status had to be clarified when Biden and other world leaders meet.

While there was no consensus on how to bolster the commitment to Ukraine, it was clear that some NATO members are desperate for ways to show that 16 months of war have brought the country closer into the fold — and closer to full membership. The move would be partly intended as a message to President Vladimir Putin of Russia that he will not be able to wait for support for Ukraine to lag, and partly as a concession to President Volodymyr Zelenskyy, who has long called for Ukrainian entry into NATO.

U.S. officials say that no proposal to alter the current American position is formally circulating in the White House, though they expect that to come in the next few weeks. While the Biden White House is loath to discuss internal policy debates, in this case many details have seeped out, including the argument that Biden should get out ahead of the curve, rather than

appear to be catching up with the Europeans. Already this year, Biden has agreed to send M1 Abrams tanks and said he would allow Ukrainian pilots to be trained on American-made F16s, in significant reversals.

The issue of Ukraine’s path to membership was expected to be central in a meeting Biden held with NATO Secretary-General Jens Stoltenberg on Tuesday in the Oval Office. The alliance official made what is assumed to be his last such visit, unless a last-minute push emerges to again extend his tenure.

Stoltenberg was bringing a compromise proposal to Biden, in which NATO would agree that Ukraine, battle-tested with NATO equipment and training, would not need to go through the standard process for aspiring members before it can join, according to a senior U.S. official.

Other officials said that would raise

questions about what would replace that process, including obtaining assurances that Ukraine, which has a history of corruption and is under wartime martial law, does not turn authoritarian.

But NATO is a military alliance first and foremost, and it includes numerous countries with patchy democratic credentials, including Turkey and Hungary.

In brief remarks to reporters at the White House, Stoltenberg did not address NATO membership for Ukraine directly. He said there would be new commitments to spend more on defense at the NATO summit, and noted that new equipment and training for Ukrainian forces “is making a difference on the battlefield as we speak,’’ insisting Ukraine was making progress with its long-awaited counteroffensive.

“President Putin must not win this war because that will not only be a tragedy for Ukrainians, but it will also make the world more dangerous,” he said. “It will send a message to authoritarian leaders all over the world, also in China, that when they use military force, they get what they want.”

In Vilnius, NATO will present Zelenskyy with a set of commitments from member states to continue to supply Ukraine with weapons, ammunition and money in the medium term — not subject to the fate of the current counteroffensive or the electoral calendar.

NATO is also expected to elevate its relations with Ukraine from a NATO-Ukraine Commission, founded in 1997, to a NATOUkraine Council, a higher level of engagement and integration.

The symbolism is clear: In 2002, a dozen years after the collapse of the Soviet Union, Russia was given exactly the same treatment — complete with an office inside the NATO compound in Brussels. At the time, Russia was termed an “equal partner” with NATO members, but it all ended after Russia’s annexation of Crimea in 2014.

Now, Ukraine could be playing the role inside NATO that Russia once did.

Colombian children rescued in jungle had been fleeing for their lives

The four children who survived an almost unfathomable 40 days in the Colombian jungle after their tiny plane crashed in the Amazon rainforest had boarded the plane because they were fleeing for their lives.

Manuel Ranoque, the father of the two youngest survivors, explained in an interview that an armed group that forcibly recruited children by threatening violence had seized control of their home region in southern Colombia.

Fearing their family was next, relatives had tried to fly the children out of the territory, to a city where they could live safely.

Then the children’s escape plane crashed, killing their mother and two other adults and sending the quartet on a traumatic weekslong survival journey in the Amazon jungle. The oldest of the children, Lesly, 13, played the role of guide and mother to her siblings, helping them navigate the forest.

“I was very scared the children would be recruited,” said Ranoque, who like others spoke by phone. He added that the country’s armed groups “have no respect — they are capable of recruiting a child as young as 2.”

The rescue of the children last week has provided a rare moment of unified celebration in a deeply divided nation, with broad swaths of society, from left to right, praising the work of the search team. Gustavo Petro, the country’s leftist president, called the rescue “magical,” and Iván Duque, his conservative predecessor, called it “a miracle.”

But the story of the children — Lesly, Soleiny, 9, Tien, 5, and Cristin, 1 — all from the Huitoto Indigenous group, is also a stark reminder of the dangers faced by thousands of rural Colombian children every day.

For decades, the country has been terrorized by armed groups, including the Revolutionary Armed Forces of Colombia, or FARC. In 2016, the FARC agreed to lay down its arms. But the state never took control of many places where the rebels once flourished.

In the government’s absence, old rebels have united with new recruits, battling with criminal groups for command of rural territory, the cocaine industry and other illicit economies.

Trapped in the middle of these warring factions are Colombia’s rural civilians, and children are the youngest victims, suffering displacement, recruitment and the deaths and disappearances of family members and community leaders.

The Indigenous reserve where the children

live, next to the small town of Araracuara in the department of Amazonas, is extremely remote, according to their great-uncle, Fidencio Valencia. “There is no sewage system; there is no electricity,” he said. “There is nothing. We are abandoned, all of us, by the state.”

Residents in and around Araracuara have been the target of violence in recent months, according to Colombia’s ombudsman, which tracks human rights violations and attributes killings and child recruitment in the area to a group of FARC dissidents who call themselves the Carolina Ramírez Front.

“People live in fear and are very afraid to speak out because you have to protect your family,” said one resident of Araracuara, a Huitoto woman who asked that her name not beused, out of concern for her safety.

At least two other armed groups operate in the region, she said.

The Carolina Ramírez Front occasionally issues statements via social media but has not commented on the case.

The head of the Colombia military, Maj. Gen. Helder Giraldo, said in a meeting with reporters Tuesday that officials were aware of Ranoque’s statements about the armed group and were monitoring the situation.

In the jungle, the effort to find the children after their plane crashed, called Operation Hope by the government, was led by the Colombian military and members of the Indigenous Guard, an unarmed civilian defense force made up of tens of thousand of people from various tribes. About 300 people participated in the search, according to the military.

Lesly helped her siblings by building shelter, finding food and lifting their spirits, said Luis Acosta, the national coordinator of the Indigenous Guard, who formed part of the search team and spoke with the group that eventually found the children.

For many years, but especially the past three, conservatives have warned of the dangers of a criminal justice system that is overly reluctant to put and keep dangerous people in prison. The law is the law. Violations of it should be prosecuted. We are, and must remain, the land of equal justice, not social justice dictated by the ideological fixations of angry Americans.

These same conservatives should try being consistent when it comes to the federal indictment of Donald Trump.

It is stunning to read the grand jury’s 37-count indictment, with its depictions of a former president treating the law with the contemptuous disdain of a mafia don — but with none of a don’s concern for covering his tracks. It is even more stunning to hear what some of those in the legal community who have been defenders of Trump have to say about it.

Alan Dershowitz: “It is the kind of evidence every defense lawyer dreads and every prosecutor dreams about,” the retired Harvard law professor wrote of Trump’s recorded admission of unlawfully possessing highly classified documents.

Jonathan Turley: “Some of the evidence is coming from his former counsel, and these are very damaging statements made against him,” the Fox News legal analyst said, referring to notes made by one of Trump’s lawyers, in which the former president plots to obstruct a government subpoena. “All the government has to do is stick the landing on one count, and he could have a terminal sentence.”

Bill Barr: “It’s a very detailed indictment, and it’s very, very damning,” Trump’s former attorney general told “Fox News Sunday.” As for the suggestion that Trump is the victim of a witch hunt, Barr noted that the Justice Department had “acted in a very patient way” in trying to obtain documents from Trump, only to be met with “very egregious obstruction.”

Barr added that the manner in which Trump held on to and possibly shared vital national secrets — including, reportedly, the Pentagon’s planning documents for an attack on Iran — was done in a way that “anyone who really cares about national security, your stomach would churn at.”

None of this will sway Trump’s base, because nothing will sway them. It doesn’t matter that they were the ones most outraged in 2016 by Hillary Clinton’s alleged mishandling of classified documents. Or the most disgusted by the conclusion by the then-FBI director, James Comey, that “no reasonable prosecutor” would bring charges against her. Or the most lustily cheering “Lock her up” at that summer’s Republican convention.

But what about more mainstream conservatives who know the 2020 election wasn’t stolen, that Jan. 6 was a disgrace for the ages, that Trump is a one-time-lucky serial loser whose bottomless narcissism keeps costing Republicans winnable Senate and gubernatorial races, that his entire presidency was a drunken joy ride with a reckless driver careening around hairpin turns at high speed, that his renomination as the GOP candidate would give President Joe Biden his best shot at reelection and that another Trump presidency would be an orgy of petty political retribution and reckless policymaking that would make his first term seem, by comparison, responsible and tame?

They are, with few exceptions, supine.

Their excuses for Trump have run the gamut. There were legally inaccurate claims about the Presidential Records Act, which does not give Trump whatever time he wants to return

documents to the archivist of the United States. There was the idea that Trump held on to the documents because he was a hoarder or that he had little idea what was in them or that any secrets they contained were not serious. The counts of the indictment powerfully indicate otherwise.

There’s also the whataboutism regarding Clinton’s emails and the documents found in Biden’s offices and garage. But the people who argue that Comey’s recommendation was a travesty of justice cannot now argue that Trump should be let off on far more serious charges. As for Biden, his case has its own special counsel: Let him come to his conclusions based on the facts.

Which leaves the argument that our democracy will be gravely damaged if the administration of an incumbent president sets the precedent of criminally prosecuting a political opponent. That’s essentially what Trump threatened to do against Clinton. That’s exactly what he sought to do against Biden by trying to dig up dirt on Hunter Biden’s business dealings in Ukraine — the subject of Trump’s first impeachment. I don’t recall many conservatives taking a bold stand then against that attempt at using the formidable powers of the presidency to criminalize an opponent.

It remains true that the federal prosecution of Trump, along with his potential conviction and incarceration, will be a fateful moment in American history. Far more fateful would have been the failure to prosecute. If Trump can be above the law, in a case of this kind, then we will have lost the rule of law.

As for larger considerations of justice, of both a legal and a cosmic kind, the English language is well stocked with phrases for occasions like this.

Turnabout is fair play.

L CAPITOLIO – En vista pública de la Comisión de Desarrollo de la Región Sur Central que preside el senador Ramón Ruíz Nieves sobre la Resolución del Senado 60 para investigar las etapas que conlleva el proyecto para completar la Carretera Estatal PR-10, Marco García de la Autoridad de Carreteras y Transportación (ACT) indicó que los cuatro tramos restantes están divididos actualmente en etapas de diseño.

“La PR-10 no es un proyecto más, es uno de desarrollo económico para conectar el norte con el sur, es la única vía que une dos puertos…Esto significa también turismo para esta zona y también espacio para seguridad. Esto no es un capricho, es una necesidad de desarrollo encaminada, pero con una planificación y protección del ambiente…Esta vista es para conocer dónde estamos, qué se espera del proyecto y qué hemos hecho con la declaración ambiental. Necesitamos la PR-10”, expresó el senador Ruíz Nieves.

Por su parte, García, de la ACT, explicó que “la agencia contempla cuatro proyectos o fases de construcción: AC-100069 (100 por ciento diseñado); AC100071 (diseñado excepto puentes y muros en un 35 por ciento); AC-100055 (35 por ciento en diseño preliminar) y AC-100079 (35 por ciento en diseño preliminar), que son trabajadas bajo un mismo proyecto bajo la metodología de subasta de diseño y construc-

En cuanto al financiamiento del proyecto por los fondos de la Subvención en Bloque para el Desarrollo Comunitario de Mitigación (CDBG-MIT, por sus siglas en inglés), García detalló que el 10 de enero de 2023 la ACT y el Departamento de Vivienda de Puerto Rico otorgaron el Acuerdo de Sub-Recipiente (SRA, por sus siglas en inglés). Este establece la otorgación de fondos federales del Programa CDBG-MIT a la ACT por la cantidad total de $540,732,876.00, para llevar a cabo la construcción del Proyecto de la PR-10.

Ruíz Nieves cuestionó al deponente por qué el incremento en la totalidad del proyecto cuando en el año 2021 dijeron que costaría $260 millones y al presente dicen que son $540 millones. García res-

pondió que para el 2021 se sabía del alto riesgo de inflación que podría enfrentar el país en aquel entonces. “Hemos visto que el costo de materiales y la empleomanía ha aumentado con el tiempo. Todos los proyectos en la ACT están llegando por encima del estimado original. Este es un proyecto complejo que conlleva un total de 20 puentes a través de los cuatro tramos. Por eso el mismo ha ido evolucionando y eso ha llevado a esta alza”, manifestó García.

En su turno, la senadora del Partido Independentista Puertorrqueño, María de Lourdes Santiago, cuestionó también el aumento en el precio del proyecto, así como quién tomó la decisión. García reiteró que son estimados de la ACT basados en la experiencia que ven en el día a día con los proyectos.

How the record man Harvey Averne helped take Latin music worldwide

Harvey Averne begins most days with a bialy and whitefish salad. He watches “Morning Joe,” plays with his cat, Coco Baby, and fields calls from Latin music legends such as Joe Bataan at his eclectic but tidy Woodhaven, Queens apartment.

On a particularly humid day in midMarch, they were advising each other on prescription medication. But a peek at Averne’s foyer — which is adorned with awards, concert posters, framed newspaper clippings and photos, including a prominently displayed shot with Celia Cruz — tells a story that belies his typical 86-year-old day-to-day travails. Averne is one of the last of the Latin music giants: a Jewish kid from East New York who had a hand in the development of Latin music, from the borscht belt to boogaloo and salsa.

“I like rhythm, I like the beat,” Averne explained. “I didn’t understand a word they’re saying, but that’s OK — you don’t understand a word in the opera.”

As a producer, manager and musician, Averne has a storied history behind the scenes at some of New York’s biggest Latin music labels. He was the de facto COO of the crucial Fania Records, where he produced or supervised records by Willie Colón, Larry Harlow, Ralfi Pagan and Ray Barretto. At his own Coco Records, which released Latin jazz and salsa, Averne’s work with pianist Eddie Palmieri earned the first two Grammy Awards for Latin music.

“He was the type of guy that always had new ideas,” said Bataan, a longtime friend and Fania artist. “He’s always been a hustler; he’s always been that guy — the Phil Spector of Latin music.”

Born in 1936, the first generation child of Polish parents, Averne was a class clown and troublemaker whose teachers would send him out to Linden Boulevard to watch plants grow in lieu of disrupting class. Music was the only thing that held his attention.

Averne said he loved R&B but realized that “every hotel and every club had a Latin band.” He didn’t want to work at a factory like his father, and in music, “there were a lot of girls.”

kills hotel band when he noticed another employee strumming a guitar and singing in Spanish. He was “hypnotized,” he recalled, and asked to learn the song. Inspired, he changed the name of his Harvito Trio to Arvito and His Latin Rhythms and made the leap from Catskills stages to the Palladium, where the teen group opened for stars including Tito Puente, Machito and Tito Rodriguez.

Before he entered the record business, Averne “ran errands for the local mafia guys,” he said, worked in diaper service and family photo sales, and had his own successful home improvement business. The shrewd business sense he accumulated over the years — even as a teen bandleader — kept him on the cutting edge of the growing and ever-diversifying Latin music scene.

Averne came to Fania in 1966, when a fellow Jewish salsero, Larry Harlow, introduced him to Jerry Masucci — a lawyer who had recently founded the label — and the two hit it off instantly. Averne recalled arriving at their first meeting in his chauffeured Cadillac Seville, dressed to the nines. Masucci immediately asked Averne to run his fledgling company.

Fania’s impact on Latin music in the mid-60s was undeniable: “We blew everything up,” Averne said. The label pioneered Latin soul and boogaloo, a fusion of traditional Latin music styles with contemporary R&B and soul music. One of Averne’s favorite productions during that period was Barretto’s 1968 boogaloo LP, “Acid.”

“Ray was the one who really saw my potential,” Averne said of the percussionist. “I produced ‘Acid,’ but Ray Barretto produced Harvey Averne. He was the most prepared artist I’ve ever worked with.”

While Averne had no previous label experience, he aggressively (and successfully) marketed acts using the sales tactics he honed in his teens and 20s, broadening the appeal of Fania artists and Latin music beyond the tristate area. He was “a great spokesman for whoever he chose to work with,” said Bobby Marin, a songwriter, producer and performer who worked with Fania.

In 1972, Arverne founded Coco Records, and his first signee was Palmieri, a pioneer of Latin jazz who continues to perform globally. Their two biggest recordings — “The Sun of Latin Music”

and “Unfinished Masterpiece” — were a monumental step away from Latin dance music and further expanded what popu lar Latin music could sound like.

While their pairing was professiona lly and critically successful, the two clas hed over sound, contracts and payments, Averne said. “‘Unfinished Masterpiece’ was a war between Eddie and I,” Averne said. Palmieri, now 86, declined to com ment.

In 1976, the two parted ways, and Averne turned his focus to albums from Eydie Gormé and Machito, as well as re cords with Cortijo y Su Combo Original. By the end of the decade, though, Coco was over, done in by financial issues, Averne said.

His final foray in the record business was as a partner in the disco-focused Prism Records (a forerunner to hip-hop label Cold Chillin’ Records), during which time he met a young Madonna. (He said he still has some of her earliest demos.)

In the early ’80s, his career at labels over, Averne fell into a dark period.

“Everything crumbled,” he said. “I wasn’t even answering the phone for a couple years.”

When Carlos Vera, a DJ and boogaloo enthusiast who has worked closely with Averne in recent years, first met Averne in the 2010s, “He wasn’t taking care of himself,” he said, and the younger man traveled from his home on the Upper West Side to Averne’s apartment in Queens several days a week. He helped Averne renovate his apartment, organized his ephemera and got him online. “I pushed him to eat well and take better care of himself. It took me a long time to convince him.”

Today, Averne is in better spirits. “I’m still making money from music,” he said. “I still own my own publishing and I’ve written more than 50 songs.” Mostly, he’s retired. “I had the feeling of ‘Harvey, you did it. You proved yourself to yourself.’”

And while most of his friends are gone — including Larry Harlow in 2021 and salsa radio host Polito Vega this March — Averne said, “I’ve never been lonely. When I had a lot of people around, it wasn’t because I needed them. It’s because I wanted them.”

“I’m relaxed. I’m chilling,” he added. But “if the right musical project came along that was interesting to me, I would do it in a heartbeat.”

Miami Heat prove value of patience, even in defeat

Jimmy Butler studied a box score. Max Strus pulled on a sweatshirt from Lewis University, the Division II school in Romeoville, Illinois, that had offered him a scholarship when high-major programs passed on him. And as fireworks crackled outside, Udonis Haslem — a power forward and a staple of the Miami Heat for the past 20 seasons — reflected on the final game of his playing career.

“Proud of these guys, proud of my team,” Haslem, 43, said. “I told the guys I have no complaints, no regrets. They gave me a final season that I’ll never forget, and that’s all I can ask for.”

Inside the visiting locker room at Ball Arena in Denver on Monday night, there was sadness but also some joy. There was resignation mixed with no small amount of pride. But most of all, in the wake of the Heat’s 9489 loss to the Denver Nuggets in Game 5 of the NBA Finals, there was the sense that Miami had lost the series to a superior opponent and a worthy league champion, and sometimes it really is that simple.

“We would have liked to be able to climb the mountaintop and get that final win,” Heat coach Erik Spoelstra said. “But I think this is a team that a lot of people can relate to, if you ever felt that you were dismissed or were made to feel less than. We had a lot of people in our locker room that probably have had that, and there’s probably a lot of people out there that have felt that at some time or another.”

Some of the story lines that accompanied the Heat on their deep playoff run may be irritatingly familiar by now. How nine of the players on their roster were undrafted. How they seemed to thrive on adversity. How Spoelstra flummoxed arguably more talented opponents with his zone defense. And how Butler and Bam Adebayo, the team’s two best players, filled their more unsung teammates with self-assurance.

But there was also something novel and fun about how the Heat, as the Eastern Conference’s No. 8 seed, went about their business — pulling off upset after upset, surprise after surprise. They were just the second eighth seed to reach the NBA Finals.

“I’m just grateful,” Butler said of being around his teammates. “I learned so much. They taught me so much. I wish I could have got it done for these guys because they definitely deserve it.”

Most of all, perhaps, Miami’s playoff run was a testament to organizational stability, a

concept that sounds about as bland as boiled potatoes. But the Heat — along with the Nuggets, who have stuck with their core and their coaching staff through a smorgasbord of ups and downs — have shown that being boring and exercising patience have value, that constant change is seldom the answer.

Spoelstra, who has been with the Heat since the mid-1990s, first as a video coordinator and later as an assistant, personifies that approach. He has been the team’s coach for 15 seasons, making him the second-longesttenured coach behind San Antonio’s Gregg Popovich — no small feat when coaches in professional sports tend to be shuffled like playing cards. About one-third of NBA coaches were fired or quit in the 2022-23 season.

And in an era in which some teams stockpile draft picks and strategize about the best way to land top-shelf prospects — this is less diplomatically known as “tanking” — the Heat have continued to prioritize developing their young players while striving to be competitive, even when it is hard and often unrewarding work.

Spoelstra recalled training camp, which he described as hypercompetitive. At the time, the Heat were only a few months removed from a disappointing end to their

2021-22 season: a Game 7 loss to the Boston Celtics in the Eastern Conference finals. The memory of that game seemed to fuel them.

“We could barely get through those fullcontact practices without everybody screaming at each other, yelling at the coaches that are officiating, arguing about the scores,” Spoelstra said.

And then something odd happened: Miami spent months wrestling with mediocrity. The NBA is not an easy business. The Heat lost seven of their first 11 games. In late December, they had won only half. By April, they were bound for the play-in bracket, and with the No. 7 seed in the East on the line, they lost to the Atlanta Hawks. Needing to defeat the Chicago Bulls to secure the conference’s final playoff spot, Miami trailed by as many as 6 points in the fourth quarter — and then won by 11.

The entire process, though, proved important. Despite their struggles, the Heat ignored the lure of quick fixes. They did not flip their roster at the trade deadline. Instead, they kept at the daily grind while banking on the belief that they would find their rhythm, that they would get it right when it mattered, that they were becoming more resilient.

“Nobody let go of the rope,” Adebayo said.

If the Heat slipped into the playoffs as an afterthought, they crashed the party once they arrived. They needed just five games to eliminate the top-seeded Milwaukee Bucks in the first round (leading Giannis Antetokounmpo, the Bucks’ star forward, to offer his viral discourse on the definition of “failure”), then beat the fifth-seeded New York Knicks in six games. Miami proceeded to reach the NBA Finals by exacting a measure of revenge on the Celtics, walloping them in Game 7 of the conference finals — in Boston, no less.

As for facing a 3-1 series deficit to the Nuggets before Monday’s game, some members of the Heat expressed as much confidence as ever.

“We’ve been through so much adversity this season,” Adebayo said. “Who else would be in this situation?”

Some of it could have come off as public posturing, except that the Heat seemed truly determined to extend the series. The Nuggets went 5 of 28 from 3-point range in Game 5, an effort that was due in part to the Heat’s aggressive defense. Butler, meanwhile, emerged from hibernation to go on a lategame scoring binge, and his two free throws gave Miami an 89-88 lead with 1 minute 58 seconds remaining.

But the Heat went scoreless the rest of the way as the Nuggets seized their first championship behind Nikola Jokic, their do-everything center.

“The last three or four minutes felt like a scene out of a movie,” Spoelstra said. “Two teams in the center of the ring throwing haymaker after haymaker, and it’s not necessarily shotmaking. It’s the efforts. Guys were staggering around because both teams were playing and competing so hard.”

Afterward, Haslem said he was already thinking about next season and how the team’s returning players could build off their experience in the playoffs. He will not be among them.

Haslem, who signed with the Heat in 2003 and won three championships with the team, is retiring. And while he played sparingly in recent seasons, he wielded outsize influence in the locker room. He also operated as a connective thread for the organization, as someone who understood pressure and hard work and the way things are done in Miami, from one season to the next — a phenomenon more commonly known as Heat Culture.

Haslem pledged that he would still be around next season.

“Somewhere close by,” he said. “Somewhere close by, I can promise you that.”

Vegas Golden Knights win the Stanley Cup in just their sixth season

The Vegas Golden Knights, born out of trepidation, tragedy and ultimately triumph, won their first Stanley Cup in just their sixth season, beating the Florida Panthers, 9-3, at TMobile Arena in Las Vegas on Tuesday.

The Knights, the top seed in the Western Conference, used a high-speed, sharp-elbowed attack to overwhelm the Panthers, the eighth seed in the Eastern Conference, in five games. The Knights were making their second appearance in the finals, the same as the Panthers.

But while the Panthers came within one round of a championship for the first time since 1996, the Knights made the second-fastest trip to a Stanley Cup victory by any team in the expansion era that began in 1967, trailing only the Edmonton Oilers, who won the Cup in their fifth season in the league. (The Oilers played seven seasons in the World Hockey Association before joining the NHL.)

“We waited a lot of time for that moment to come back and we wanted to make sure we cashed in,” said Vegas winger Jonathan Marchessault, who was selected from the Panthers in the expansion draft and was one of the original “misfits” from Vegas’ inaugural season. “This team has been unbelievable since the beginning.”

After captain Mark Stone hoisted the Cup after the game, he handed it off to Reilly Smith, who is another player from the first season and also came from the Panthers. He passed it to Marchessault, who won the Conn Smythe Trophy as the playoffs MVP.

After a shaky start to Game 5, the Golden Knights opened the scoring about 12 minutes into the first period. After Vegas goalie Adin Hill stopped Florida center Aleksander Barkov, Stone scored an unassisted short-handed goal. Vegas scored again less than two minutes later.

In the second period, Vegas scored four times in less than 10 minutes, including a second goal by Stone, to build an insurmountable lead. The Panthers were playing without their leading scorer, Matthew Tkachuk, who was injured in Game 4. But Vegas was clearly the hungrier team.

in-house DJ, cheerleaders and an overthe-top light show, spent the third period preparing for a full-throated celebration that few imagined just six years ago.

The annals of the NHL are littered with failed franchises. Expansion clubs. Teams that moved to new markets. Teams that moved again. Remember the Cleveland Barons? The Kansas City Scouts? The Minnesota North Stars?

So it’s no wonder critics were skeptical when, in 2016, Commissioner Gary Bettman held a news conference at a hotel in Las Vegas to announce that the city would be home to the Golden Knights, the league’s 31st team. With the temperature outside peaking at 108 degrees, Bettman fielded questions about the viability of a professional hockey team in a desert city where many residents are retirees or work in service jobs at night.

A host of minor league hockey teams — including the Gamblers, the Outlaws, the Aces, the Thunder and the Ice Dice — have struggled in Las Vegas. The Coyotes, who relocated to Arizona from Winnipeg for the 1996-97 season, were in such bad financial shape that the NHL had to take over the team at one point. Maybe hockey wasn’t meant to be

played in the desert.

Still, Bettman pointed to the city’s growing population and its reputation for entertainment.

“We think this is a tremendously exciting opportunity not just for Las Vegas but for the league as well,” he said. There were also questions about adding a franchise in a city known for legal sports gambling, something sports leagues, the NHL included, had long shunned. Bettman said betting on hockey wasn’t as popular as it was on football, so the threat that players would throw a game was minimal.

“We don’t worry about the integrity of our game,” Bettman said.

As it turned out, Bettman should have put money down on the team before it took the ice for the first time. The Knights overcame seemingly every obstacle thrown at them in their inaugural season. They sold more than 14,000 season tickets before the team even had a name. The team moved into T-Mobile Arena, which was already open on the Strip.

But after the team’s final preseason game, a gunman in the Mandalay Bay hotel, a mile or so south of the arena,

opened fire on a concert nearby, killing 58 people and wounding hundreds of others. The team’s players, who were supposed to have appeared at a public rally the next day, became a galvanizing force in the city. They fanned out across the community, thanking police officers, giving blood and donating tens of thousands of dollars to help victims, their families and emergency medical workers.

Their response endeared them to the city’s stunned and grieving residents. And remarkably, the Knights went on an epic run. Led by three-time Stanley Cup champion Marc-Andre Fleury in goal, the team began the season as 500-to-1 long shots to win the Stanley Cup. Yet they collected 109 points and a .622 winning percentage in the regular season, both league records for a team in its first season by wide margins. They raced through the first three rounds of the playoffs, beating the Los Angeles Kings, the San Jose Sharks and the Winnipeg Jets, and won the first game of the Stanley Cup Final against the Washington Capitals. The team lost the next four games and the series, but it had made its mark like no one else.

“The team wrapped themselves around the town, and the town wrapped themselves around the team,” Brad Kreel, a longtime Las Vegas resident, told me before the team’s final game that season.

The WNBA’s Aces came from San Antonio in 2018, the Raiders arrived from Oakland, California, a couple of years later, and now the Athletics are trying to find a stadium in the city, too, validating the NHL’s hunch that the city, despite being the 40th-largest media market in the U.S., could support big-time sports teams.

The Knights, though, are now fixtures. They have made the playoffs in five of their six seasons, and despite the long odds, have showed the sports world that Las Vegas can support a pro sports team, and that team can succeed.

“It’s the best feeling in the world,” Vegas center Jack Eichel said. “It’s a really special organization and I just feel blessed to be a part of it. I started to really enjoy coming to the rink again.”

Marchessault, asked what kind of a party Las Vegas was in store for, said with a grin, “I don’t know. Probably a big one.”
