Consumer survey: Purchase of cisterns & generators on the rise

The lack of trust in water and electricity utilities in Puerto Rico has led consumers to invest in equipment that replaces that need, according to the Consumer Survey 2024 study by the Chamber of Food Marketing, Industry and Distribution (MIDA by its Spanish acronym).

“We’re talking about all the things outside of food that we have to have in order to survive or live in the situation that we’re living in,” said Richard Valdés, chairman of the Consumer Survey Committee at a press conference Tuesday. “And this is very interesting, because from last year to this year, the electrical generator [purchase rate] went up from 48 percent to 52 percent. In other words, the trend is that little by little we are using our budget to buy things beyond food and what has been our day-to-day life.”

In the study, conducted through 1,350 house-tohouse interviews, in the island’s eight census regions, it was found that 37% (up from 31% last year) purchased a cistern, 19% (up from 17% last year) bought a solar heater and 15% (up from 13%) invested in solar panels and batteries.

“We are preparing ourselves as consumers to be able to survive in a situation like the one we are experiencing in Puerto Rico,” he added.

The study reveals that 92% of respondents prepare food at home and of those, 50% do so for several days.

“Cooking at home is still cheaper [than eating out],” MIDA Vice President Manuel Reyes Alfonso said. “Not only is it cheaper, but you have more alternatives in general terms by varying what goes in the grocery basket.”

Another trend revealed by the study, especially in millennials (29%) and Generation Zers (35%), is that they replace some of their meals with a snack. It was not measured whether this has to do with a trend such as the so-called “fasting,” or as an alternative for saving money.

The study also concludes that 47% of the participants take items out of the shopping cart because “the kids don’t like them,” and 28% of the respondents said they will always do the shopping “with the kids in mind.”

Meats are the most purchased product on a regular basis (from 64 to 74%) but, in the same way, it is one of the main items that is taken out of budget, with 43% of respondents indicating as much versus 25% in 2023.

“The consumer is exhibiting patterns that perhaps were not so marked before, or we did not see them,” said Diana Rodríguez Figueroa, president of market research firm Lighthouse Strategies. “And it’s precisely what they do when they get to the end of the leash [of paying]. How is it that they organize these products on the leash, and what do they do if the money isn’t there for them?”

Priorities in food purchases are meats, rice, bread, eggs, grains, vegetables, cheese, ham, coffee and UHT milk. Chicken and fresh milk showed a 5% drop in purchases in one year.

The findings of Consumer Survey 2024 will be presented on Thursday, June 13 as part of the program of activities at the MIDA Conference & Food Show 2024 at Pedro Rosselló Convention Center in Isla Grande.

“It’s definitely an area that we all have to look at, because the percentage of people who substitute a meal for a snack is high,” Reyes Alfonso said. “We don’t know the reasons for that and we’re going to be considering it. Because you have to know if it’s due to economic factors or dieting.”

Another finding of the study is that the average monthly spending on food purchases remained similar to 2023 spending, with $452 per month on food purchases in 2024 versus $453 in the previous year.

House to summon State Elections Commission to explain chaos at primaries

House Constitutional and Electoral Affairs Committee Chairman José Varela Fernández announced Tuesday he will summon State Elections Commission (SEC) Interim Chairwoman Jessika Padilla Rivera to account for the multiple problems that arose during the primaries on Sunday.

“Both the reports from various media outlets and the information received from our sources show multiple problems with organizing the primary process and disseminating the results, which must be corrected to avoid chaos during the upcoming general elections,” Varela said. “Among others, we know that there were problems with the selection and location of voting centers,

failures with the operation of the counting machines, long lines due to the slow operation of those machines, problems with the management of the so-called ‘e-poll book,’ interruptions of the electrical energy service in the voting centers and delays with the management and disclosure of early voting, among others.”

The SEC used vote-counting machines provided by Dominion, but they sometimes malfunctioned.

“The purpose of incorporating all these new technologies was to facilitate the process of casting and counting votes, and achieve accurate results in much less time,” Varela noted. “That purpose was not fulfilled in these primaries. So far, the best that can be said is that at least the vote could

be carried out in a single day, unlike 2020.”

Around 400,000 Popular Democratic Party and New Progressive Party voters participated in this past Sunday’s primaries. Nearly 2 million voters are registered for the general elections.

“We have only five months before the next electoral event, in which much more participation is expected than there was in these primaries,” the legislator said. “Suppose the SEC does not refine the processes. In that case, we run the risk of facing another election as chaotic as that of 2020, which is not acceptable to anyone. For this reason, the SEC must prepare, not to make excuses, but to inform the people how it will guarantee that the general election process is reliable.”

Legislator calls on LUMA, Genera to explain blackouts today

Otero on Tuesday summoned the executives of Genera Puerto Rico and LUMA Energy for an urgent meeting today to address the crisis of the constant interruptions in electricity service that have been occurring since last week.

“What has been happening in Puerto Rico since last week is unacceptable,” the

lawmaker said. “Every day there are more than 50,000 subscribers without electricity service and that cannot be allowed. In view of this, I am summoning the directors of Genera and LUMA … to explain to us, in detail, what is happening and, more importantly, what actions they are taking to end this cycle of constant blackouts.”

The meeting will be at the Capitol at 11 a.m.

“At the meeting we are going to re-

quest specific data from all the generation units, the status of rehabilitation work and what remains to be completed,” Parés Otero added. “We want accurate information, because there can be no more excuses seven years after Hurricane Maria. We seek to impose a structure of compliance metrics around the generation of electricity.”

“In the case of Genera Puerto Rico, they have already confirmed their participation. We are waiting for LUMA Energy,

but we are confident that they will attend the meeting because it is very important to address this issue,” the legislator said. “There have been too many interruptions this past week. In the case of LUMA, the questions are many and the people will have concrete answers tomorrow. In the same way, they have to detail the action plan to mitigate this in the face of the Atlantic hurricane season, which will be a very active one.”

DACO: Single-use plastic ban will go into effect July 1

Consumer Affairs (DACO by its Spanish acronym) Secretary Lisoannette González Ruiz announced Tuesday that a law banning the sale and use of single-use plastics in all commercial premises will enter into force on July 1.

The head of the island’s consumer protection agency said the draft of the Joint Regulation of the Department of Consumer Affairs and the Department of Natural and Environmental Resources on the Use and Sale of Single-Use Plastics in Puerto Rico has already been worked on.

“We have been working agency-to-agency so that this process can be carried out most efficiently,” González Ruiz said. “It is the public policy of the Puerto Rico government to pay the greatest attention to the use of plastics in Puerto Rico’s jurisdiction. The purpose of the regulation is to establish the procedures for supervision and inspection of commercial establishments.”

“It is important to highlight that as of July 1, 2024 and until December 31, 2024, non-compliance with the provisions of this law and the regulations will entail a ‘Notification of Failure,’ which will constitute

a warning and guidance on the non-compliance with Law No. 51-2022 or with this regulation,” the DACO chief emphasized. González Ruiz also highlighted that “we will be very vigilant that businesses comply and abide by the mandate of the law.”

“Our Commercial Liaison and Compliance Office will remain alert and available to guide and clarify any questions that businesses may have,” she said. “At DACO, we are available to everyone to collaborate with them in the process for the benefit of all parties and, above all and most importantly, compliance with public policy.”

Self-checkout is here to stay, study shows

The self checkout system is an alternative that has come to stay among Puerto Rican consumers, according to the findings of Consumer Survey 2024, a study commissioned by the Chamber of Food Marketing, Industry and Distribution (MIDA by its Spanish acronym).

MIDA President Joeyleen Quiñones said that almost half of the island consumers surveyed said they use “self checkout” when paying for their purchases in stores. According to the research that the entity carries out every year, 48% of the consumers surveyed stated that they use the tool where the client carries out the collection and payment transaction themselves. Almost a third of those who said they use self checkout said they use it whenever the store has it available.

Consumer Survey Committee Chairman Richard Valdés noted that the integration of the technology to facilitate and speed up

the purchasing process has been key for the physical store to have maintained and recovered the consumer’s preference for instore buying, following the increase in online shopping during the COVID-19 pandemic. In this sense, the study reflects that 86% of consumers prefer physical purchases versus 14% online. For example, Valdés cited that more than half of consumers who resort to using the self checkout ATM do so for convenience, either when they are in a hurry (33%) or when there is a long line at the cash registers (30%).

“During the pandemic years, the consumer became accustomed to not standing in line due to social distancing and in those years internalized the use of technology as part of their daily purchases,” said Félix Aponte, first vice president of MIDA at the board of directors level, who will assume the presidency of the entity on June 15. “Therefore, we have to continue innovating and be attentive to that consumer’s needs, but we must also imple-

ment it with the necessary precautions to avoid its misuse. This is what happens with all technology, you have to embrace innovation with your eyes open and with due precautions.” According to another study commissioned by MIDA in December 2023, Portrait of the Food Industry, 56% of supermarket owners interviewed generally expressed an increase in theft in their stores, although not necessarily related to self checkout.

Consumer budgets under pressure

This year, average monthly spending on food purchases remained similar to 2023 spending, with $452 per month on food purchases in 2024 versus $453 in the previous year (see related story on page 2). MIDA Executive Vice President Manuel Reyes Alfonso said the stabilization of average monthly spending, despite inflationary increases, is related to various factors, but is worrying because it points to a possible reduction in the sale of units or adjustments in the combination of products that are purchased.

Forty-eight percent of the consumers surveyed stated that they use self checkout at island stores.

“Although percentage increases in prices are lower than what we saw after the pandemic, inflation is a challenge for everyone,” he said. “The problem is when we evaluate that this loss in purchasing power due to inflation is combined with the fact that consumers seem to have exhausted the excess savings they achieved during the pandemic and we see an increase in personal debt and a reduction in imports.”

More than 49,000 LUMA customers were without electrical service as of midday Tuesday

According to the latest available data on the status of energy service in Puerto Rico provided by LUMA Energy, the private operator of the island’s electricity transmission and distribution system, a total of 49,211 customers were experiencing interruptions in service as of 1:22 p.m. Tuesday.

The distribution of those outages varied in

different regions, with areas such as Caguas being the most affected, with 22,383 customers without power, followed by San Juan with 9,799 customers, Ponce with 8,618 customers, Carolina with 3,360 customers, Arecibo with 2,838 customers, Bayamón with 1,611 clients and Mayagüez with 884 clients without service. LUMA added that some interruptions, affecting only 282 clients, were related to planned improvement projects.

Senate panel visits Guánica community contending with landslides

The Senate Government Committee, chaired by Sen. Ramón “Ramoncito” Ruiz Nieves, visited the Alturas de Bélgica community earlier this week to investigate the government’s efforts to address the situation of more than 300 families threatened by landslides.

“A situation has arisen that affects more than 300 families indirectly, about 80 families [directly] and above all, something very important, the concern of the municipality of Guánica and its honorable mayor, where they have done everything humanly possible,” Ruiz Nieves said Monday. “He has approached government agencies to find out what attention is being paid to the issue of the state’s responsibility regarding what the Alturas de Bélgica community is experiencing.” Even without having a clear cause for the landslides and despite concern about the composition of the soil since 20022003, Guánica Mayor Ismael “Titi” Rodríguez Ramos noted

that reports are being made and the terrain is being evaluated to determine the cause of the problem that has gone on for 10 days and continues to worsen.

Puerto Rico Aqueduct and Sewer Authority Executive Vice President of Operations Damarys Santini stressed that they have not found evidence of any broken or open pipe under the ground. But, she said, due to situations such as earthquakes and heavy rains the stability of the terrain has been impacted since 2000.

Both the senator and the Guánica mayor emphasized that their priority is to find safe housing for the most affected families.

“My concern, currently, is the safety of these residents,” Rodríguez Ramos said. “These refugees have already been in the María Luisa McDougall school for more than a week, and I believe that short-term options should be sought, whether it is housing in a public residential [complex] or activating the Section 8 program.”

Biden issues executive order to temporarily seal the border to asylum-seekers

President Joe Biden issued an executive order Tuesday that prevents migrants from seeking asylum at the U.S.-Mexico border when crossings surge, a dramatic election-year move to ease pressure on the immigration system and address a major concern among voters.

The order is the most restrictive border policy instituted by Biden, or any other modern Democrat, and echoes an effort in 2018 by President Donald Trump to cut off migration that was blocked in federal court.

The restrictions kick in once the seven-day average for daily crossings hits 2,500. Daily totals already exceed that number, which means that Biden’s executive order could go into effect right away, allowing border officers to return migrants across the border into Mexico or to their home countries within hours or days.

The border would reopen to asylum-seekers only when the number of crossings falls significantly. The figure would have to stay below a daily average of 1,500 for seven days in a row. The border would reopen to migrants two weeks after that.

The American Civil Liberties Union said it planned to challenge the executive action in court.

“The administration has left us little choice but to sue,” said Lee Gelernt, a lawyer at the ACLU, which led the charge against the Trump administration’s attempt to block asylum in 2018 and resulted in the policy being stopped by federal courts. “It was unlawful under Trump and is no less illegal now.”

Biden’s move shows how drastically immigration politics have shifted in the United States. Polls suggest there is support in both parties for border measures once denounced by Democrats and championed by Trump as the number of people crossing into the country has reached record levels in recent years.

There would be limited exceptions, including for minors who cross the border alone, victims of human trafficking and those who use a Customs and Border Protection app to schedule an appointment with a border officer to request asylum.

But for the most part, the order suspends longtime guarantees that give anyone who steps onto U.S. soil the right to seek a safe haven. Typically, migrants claiming asylum are released into the United States to wait for court appearances, where they can plead their cases. A huge backlog means those cases can take years to come up.

The executive action mirrors a bipartisan bill that had some of the most significant border security restrictions Congress had considered in years. But Republicans thwarted the bill in February, saying it was not strong enough. Many of them, egged on by Trump, were loath to give Biden a legislative victory in an election year.

“Donald Trump begged them to vote ‘no’ because he was worried that more border enforcement would hurt him politically,” Andrew Bates, a White House spokesperson, said in a statement Tuesday. He added: “The American people want bipartisan solutions to border security — not cynical politics.” Immigration advocates and some progressive Democrats

have expressed concern that Biden was abandoning his promise to rebuild the asylum system.

“By reviving Trump’s asylum ban, President Biden has undermined American values and abandoned our nation’s obligations to provide people fleeing persecution, violence and authoritarianism with an opportunity to seek refuge in the U.S.,” said Sen. Alex Padilla, D-Calif.

Tuesday’s decision is a stark turnaround for Biden, who came into office attacking Trump for his efforts to restrict asylum. During a 2019 debate, Biden, then a candidate running against Trump for the first time, excoriated his rival’s policies.

“This is the first president in the history of the United States of America that anybody seeking asylum has to do it in another country,” Biden said at the time.

Trump tried several times to close the U.S. border to asylum-seekers, succeeding only in 2020 when he used a COVID-era emergency rule to seal the border to most migrants.

In a call with reporters, Biden administration officials bristled at the idea that the president’s executive order is comparable to Trump’s actions. They emphasized that Biden’s administration would only turn away asylum-seekers during periods of surging crossings.

Immigration has proved to be a huge political vulnerability for Biden, reaching a crisis in December, when about 10,000 people a day were making their way into the United States.

Biden administration officials, panicked over those numbers, pressed Mexico to do more to curb migration. Mexican officials have since used charter flights and buses to move migrants farther south and away from the United States.

The number of people crossing has plunged since then, though the numbers are still historically high. On Sunday, more

than 3,500 people crossed without authorization, in line with the trends of recent weeks, according to a person with knowledge of the data.

Even with the executive order in place, migrants could still apply for other protections designed for those who can prove they will be tortured in their home country. But that screening has a much higher bar than asylum and as a result, administration officials said they do not expect many migrants to be screened into the United States.

People who cross illegally and do not qualify for those other protections would be subject to a five-year ban for entering the United States.

White House officials believe the order provides Biden an opportunity to take Republicans to task for dooming the bipartisan bill. That legislation also would have provided billions to the Department of Homeland Security for more border officers and immigration judges. Biden cannot provide those resources through executive action. White House officials for weeks said they preferred legislation over presidential proclamation because it would more lasting and less exposed to a court challenge.

The order also comes with some political risks. Republicans have questioned why Biden did not take unilateral action at the border sooner. In January, he told reporters that he had “done all I can do” at the border and that he needed help from Congress.

“It’s window dressing. Everybody knows it,” House Speaker Mike Johnson, R-La., said of the president’s order at a news conference Tuesday morning. “If he was concerned about the border, he would have done this a long time ago.”

As Biden considered whether to take executive action in recent months, his administration has taken smaller steps to try to control those backlogs.

In May, the administration proposed a rule change that would allow officers to quickly identify people who are ineligible for asylum, such as those who have been convicted of serious crimes. Currently, they may be allowed to enter the country and wait months, or often years, for asylum proceedings. The proposal must go through a 30-day public comment period.

The U.S. Citizenship and Immigration Services also issued a new policy in May instructing asylum officers to consider whether applicants could find refuge in their own countries before coming to the United States.

Sen. Bob Menéndez, on trial, files to run for reelection as an independent

Sen. Bob Menendez of New Jersey, a lifelong Democrat who is in his fourth week of a federal bribery trial, filed paperwork earlier this week to run for reelection as an independent in November.

The specter of Menendez, 70, trying to mount a comeback campaign raises the possibility of a splintered Democratic vote in November’s election, creating a wider lane for the Republican nominee at a time when Democrats are struggling to retain their narrow majority in the Senate.

Menendez has been abandoned by most of the state’s leading Democrats, who quickly called on him to resign after he was indicted on corruption charges last year. He has defiantly refused to step down, but he opted not to run in Tuesday’s Democratic primary.

He never, however, shut the door to running as an independent — enabling him to continue to raise and spend campaign contributions on lawyers hired to defend him and his wife, Nadine Menendez, who is also charged in the bribery conspiracy.

His trial is likely to last for at least another month;

he has until the middle of August to withdraw from the Nov. 5 election.

The Democratic front-runner for Bob Menendez’s seat, Rep. Andy Kim, was quick to criticize the embattled senator’s entry into the race as selfish.

“Everyone knows Bob Menendez isn’t running for NJ families,” Kim wrote on social media. “He’s running for himself. People are fed up with politicians putting their own personal benefit ahead of what’s right for the country.”

Spokespeople for Senate Majority Leader Chuck Schumer, D-N.Y., and the Senate Democrats’ campaign arm in Washington both declined to comment.

The move leaves Menendez’s son, Rep. Rob Menendez, in an awkward position on the eve of his Democratic primary against Ravi Bhalla, the mayor of Hoboken, New Jersey. Rob Menendez, 38, has worked to distance himself from his father’s legal trouble and has not been accused of wrongdoing.

An aide to the congressman had no immediate comment on the senator’s plans or on how they might affect his son’s ability to win reelection to a second term in the House. But the continued public focus on the senator’s legal troubles has made his son’s reelection battle far harder.

Several men delivered the nominating petitions to the Department of State in Trenton, New Jersey, Monday afternoon on behalf of Menendez, who was in a New York courtroom all day.

The filing showed he had collected 2,465 signatures — three times the required minimum. Opponents have until June 10 to challenge their validity.

After court on Monday, Menendez confirmed that he had personally collected signatures. He also reiterated that he expected to be exonerated, and he listed several ways in which he had helped New Jerseyans in times of real need during his tenure in Congress.

He said he believed the trial was going well.

Electric cars are suddenly becoming affordable

Alex Lawrence, a dealer in Salt Lake City who specializes in used electric vehicles, has seen a change over the past year in the kinds of customers who are coming into his showroom. They used to be well-heeled professionals who could drop $70,000 on a Rivian luxury pickup truck.

Recently, Lawrence said, customers have been snapping up used Teslas for a little more than $20,000, after applying a $4,000 federal tax credit.

“We’re seeing younger people,” Lawrence said. “We are seeing more blue-collar and entry-level white-collar people. The purchase price of the car has suddenly become in reach.”

Regarded by conservative politicians and other critics as playthings of the liberal elite, EVs are fast becoming more accessible. Prices are falling because of increased competition, lower raw-material costs and more efficient manufacturing. Federal tax credits of up to $7,500 for new EVs, often augmented by thousands of dollars in state incentives, push prices even lower.

At the same time, technology is improving quickly and making EVs more practical. Cars that can travel more than 300 miles on a fully charged battery are becoming common, and charging times are dropping below 30 minutes. The number of fast chargers, which can top up a battery in less than half an hour, grew 36% from April 2023 to this past April.

Carmakers including Tesla, Ford, General Motors and Stellantis, owner of Jeep, have announced plans for EVs that would sell new for as little as $25,000.

“The EV market has hit an inflection point,” said Randy Parker, CEO of Hyundai Motor America, which will begin producing EVs at a factory in Georgia by the end of the year. “The early adopters have come. They’ve got their cars. Now you’re starting to see us transition to a mass market.”

All of this is good news for proponents of EVs and the Biden administration, which is aiming for half of new cars sold to be electric by 2030 as part of the president’s plan to combat climate change. Even if Republicans gain control of the White House and Congress and follow through on promises to dismantle EV subsidies, they may not be able to undo the market forces pushing down prices.

“There may be some hiccups in the exact pace and scale of EV sales if there are major policy changes, but I wouldn’t expect the EV market to flatline,” said Peter Slowik, who leads research on passenger cars at the International Council on Clean Transportation, a research organization. “Most automakers are committed to an all-electric future, and many are planning on a timeline that goes far beyond the next administration.”

EVs, sales of which have slowed in recent months, are still more expensive than gasoline models, costing an average of $55,252 in the United States in April, according to estimates by Kelley Blue Book. That is a decline of 9% from April 2023 but still about $6,700 more than the average for all vehicles.

But Slowik’s group estimates that cars and SUVs capable of traveling 400 miles on a full battery will cost less than cars with internal combustion engines in 2030, even before taking into account government subsidies. (Pickup trucks, which require bigger batteries, will take a little longer, not reaching parity

for 400-mile models until 2033.)

Those calculations do not take into account lower fuel and maintenance costs that strengthen the financial argument for EVs. Electricity is almost always cheaper per mile than gasoline, and battery-powered vehicles don’t need oil changes, engine air filters or spark plugs. For people who drive a lot, EVs may already be a better deal. At the same time, some automakers are offering strong discounts on EV models as an enticement for buyers.

Although prices are clearly trending downward, there are risks. China supplies more than half of the lithium-ion batteries used in cars sold in the United States, according to Interact Analysis, a research firm. Those batteries will become more expensive because the Biden administration announced in May that it would raise tariffs on them to 25% from 7.5%.

Many companies are building battery factories in the United States and Canada, but most of these won’t produce enough batteries to replace China for several years.

Raw materials are another risk. The price of lithium and other materials required for batteries has plunged in the past 12 months, making EVs cheaper. But commodity prices could soar again.

The recent slowdown in the growth of EV sales has prompted Tesla, Ford and others to delay plans to expand manufacturing. But many analysts expect sales to pick up as a glut of models pushes down prices and as the charging network grows. High prices and the fear of not being able to find a place to recharge are the two biggest reasons people hesitate to buy an EV, surveys show.

For many people, the car’s price is not the only expense to consider. People who live in apartments often depend on public charging plugs. Public charging, besides being less convenient, tends to be more costly than charging at home.

Still, the forces pushing prices down are powerful. Manufacturing costs are dropping as traditional carmakers, who were slow to sell EVs, start to apply their decades of experience with

mass production to the new technology.

Later this year, for example, General Motors will begin selling an electric version of its Chevrolet Equinox SUV that will have a range of more than 300 miles and sell for less than $30,000 after the $7,500 federal tax credit. And the company plans to sell an even cheaper car, a new Chevrolet Bolt, next year.

The Equinox and Bolt will be built on GM’s Ultium platform, a collection of components that can be used for a variety of vehicles including pickups and luxury Cadillacs. GM, which has cut costs by using the same batteries and parts for different models, has said its EVs will become profitable in the second half of this year.

EVs still cost about 10% more to manufacture than cars with internal combustion engines, said Prateek Biswas, an analyst at Wood Mackenzie, a research firm. But costs will come down as companies learn how to produce the cars more efficiently, Biswas said — for example, by eliminating rare minerals from electric motors or replacing copper wiring with aluminum.

At the same time, the cost to make a gasoline car is rising because of stricter emissions regulations. “At some point it will be easier to just move toward EVs,” Biswas said.

Competition is also intensifying. Toyota and other Japanese carmakers with a reputation for delivering reliable and affordable vehicles are belatedly offering EVs. Honda plans to begin producing them at an Ohio factory next year.

There will be more than 100 fully electric models for sale in the United States by next year, according to Cars.com, an online sales platform, double the number available last year. “We’re at the point now where anybody that wants an EV for a price point can actually get an EV,” said Rebecca Lindland, senior director of industry data at Cars Commerce, which operates Cars.com. Used-car prices are arguably more important than prices of new cars. Most people buy used cars. A vibrant used market vastly increases the number of people who can consider an EV.

Models from Tesla, Nissan or GM have been on the road for three years or more, generating inventory for dealers as the original owners buy new ones. More than half of the used EVs on the market sell for less than $30,000, according to Recurrent, a research firm that focuses on the used EV market.

Besides the lure of affordable prices, he noted, his customers like that electric vehicles are quieter than gasoline models, better for the environment and faster because an electric motor generates instant torque.

“The car is more fun than whatever they’re driving now,” Lore said.

Wall Street stocks end slightly higher as weak jobs data supports rate cut

U.S. stocks ended a shade higher on Tuesday following softer-than-expected labor market data that reaffirmed expectations of an interest rate cut by the Federal Reserve.

Data on Tuesday showed that U.S. job openings fell to their lowest level in more than three years in April, signaling an easing in labor market tightness that supported a Fed rate cut this year. The U.S. Treasury yields slipped following the report.

Wall Street’s main indexes gained ground after paring earlier loses. Equities in real estate and consumer staples sectors advanced ahead of others, while materials and energy stocks were the biggest losers.

The labor market data was the latest in a string of recent reports that pointed to cooling U.S. economic growth. Data on Monday showed that U.S. manufacturing activity had slowed for the second straight month in May.

“What we’ve seen in the data so far this week is that it’s been relatively weak, starting with manufacturing PMI and job openings today,” said James St. Aubin, chief investment officer at Sierra Mutual Funds in Santa Monica, California.

“That has had a total effect of helping the rally in the bond market; but for the stock market, it’s a double-edged sword because they’re looking for a rate cut announcement, which has a rising probability with weaker data,” St. Aubin added.

Market expectations for a September rate reduction now stand around 65%, versus below 50% last week, according to the CME’s FedWatch tool. The closely watched non-farm payrolls data for May is due on Friday.

The Dow Jones Industrial Average rose 140.26 points, or 0.36%, to 38,711.29, the S&P 500 gained

Paramount Global fell 4.4% after the media conglomerate said it was exploring strategic options or a joint venture for its Paramount+ streaming service.

Declining issues outnumbered advancers by a 1.32to-1 ratio on the NYSE. On the Nasdaq, 1,468 stocks rose and 2,762 fell as declining issues outnumbered advancers by a 1.88-to-1 ratio.

The S&P 500 posted 19 new 52-week highs and 6 new lows while the Nasdaq Composite recorded 40 new highs and 134 new lows.

Total volume of shares traded across U.S. exchanges was about 10.6 billion, compared with the 12.6 billion average over the last 20 trading days.

Needing help to stay in office, Modi no longer appears all-powerful

Suddenly, the aura of invincibility around Narendra Modi has been shattered.

In an Indian election in which his party’s slogan had promised a landslide victory and Modi even repeatedly referred to himself as sent by God, the results announced Tuesday were unexpectedly sobering.

Modi, 73, appeared to secure a third consecutive term as prime minister, a feat that only one other Indian leader has accomplished, and his Bharatiya Janata Party, or BJP, gained far more seats than any other party.

But instead of a runaway win, the BJP lost dozens of seats. It now finds itself at the mercy of coalition partners — including one politician notorious for how often he has switched sides — to stay in power, a sharp reversal a decade into Modi’s transformational tenure.

As the results came into view, the country’s stock markets plunged. Opposition parties, newly unified in what they had called an effort to save the country’s democracy, rejoiced. And India, while extending Modi’s firm hold on power, learned that there are limits to his political potency, even as he made the election, usually fought seat by

seat, squarely about himself.

Modi took a more positive view in a statement on the social platform X, declaring that his coalition had won a third term.

“This is a historical feat in India’s history,” he said.

For Modi, a generous reading of the outcome could be that only with his personal push could his party overcome its unpopularity at the local level and scrape by. Or it could be that his carefully cultivated brand has now peaked, and he can no longer outrun the anti-incumbency sentiment that eventually catches up with almost any politician.

How Modi will react is uncertain — whether he will harden his effort to turn away any challenge to his power or be chastened by the voters’ verdict and his need to work with coalition partners that do not share his Hindu-nationalist ideology.

“Modi is not known as a consensual figure. However, he is very pragmatic,” said Arati Jerath, a political analyst based in New Delhi. “He will have to moderate his hardline Hindu-nationalist approach to issues. Perhaps we can hope for more moderation from him.”

Few doubt, however, that Modi will try to deepen his already considerable imprint on the country over the next five years.

On his watch, India, the world’s most populous nation, has enjoyed newfound

prominence on the global stage, overhauled its infrastructure for the needs of its 1.4 billion people, and been imbued with a new sense of ambition as it tries to shed the legacy of its long colonial past.

At the same time, Modi has worked to turn a vastly diverse country held together by a secular democratic system into an overtly Hindu-first state, marginalizing the country’s large Muslim minority.

His increasingly authoritarian turn — with a crackdown on dissent that has created a chilling environment of self-censorship — has pushed India’s vociferous democracy closer to a one-party state, his critics say. And the country’s economic growth, while rapid, has mostly enriched those at the top.

Modi rose from a humble background as the son of a tea seller, becoming India’s most powerful and popular leader in decades by building a cult of personality, spending big on infrastructure and welfare, and tilting India’s democratic institutions in his favor.

The ultimate goal was to cement his standing as one of the most consequential prime ministers in India’s nearly 75 years as a republic and make the BJP the country’s only plausible national governing force.

But the results Tuesday pointed to a turnaround for India’s beleaguered main opposition party, the Indian National Congress, which had been seen by many as irrevocably weakened after big losses in the previous two elections.

The once-dominant Congress, long positioned at India’s political center, struggled for years to find a direction and offer an ideological alternative to the BJP. But it and its coalition partners found traction in this election by attacking Modi’s government over issues like unemployment, social justice and the prime minister’s ties to India’s billionaires.

Last year, as Rahul Gandhi, 53, the public face of the Congress party, sought to burnish his standing by leading long marches across India, the BJP ensnared him in a court case that led to his expulsion from parliament. He was later returned to his seat by India’s highest court and was set to win reelection Tuesday.

Exit polls released Saturday, after more than six weeks of voting in the world’s largest democratic exercise, indicated that Modi’s party was headed toward an easy victory. But there had been signs during the

campaign that Modi was worried about the outcome.

He crisscrossed the country for more than 200 rallies over about two months and gave dozens of interviews, hoping to use his charismatic appeal to paper over any weaknesses in his party. In speeches, he often veered from his party’s message of a rising India to counter accusations that he privileged business and caste elites. He also abandoned his once-subtle dog whistles targeting India’s 200 million Muslims, instead demonizing them directly, by name.

As things stood by nightfall, Modi would need at least 33 seats from allies to cross the 272 minimum for forming a government.

Two regional parties in particular would be kingmakers: the Telugu Desam Party, in the southern state of Andhra Pradesh, with 16 seats, and the Janata Dal (United) party in the eastern state of Bihar, with 12.

Both parties are avowedly secular, raising hopes among Modi’s opponents that their influence could slow down his race to turn India’s democracy into a Hindu-first state.

Some of Modi’s biggest losses came in India’s most populous state, Uttar Pradesh in the north, with about 240 million people. His party leads the state government and had won 62 of the state’s 80 seats in the national parliament’s lower house in the previous election, in 2019.

As counting entered its last stretch in the evening Tuesday, the BJP was leading in only 33 seats there. In his own constituency, Varanasi, Modi’s victory margin was reduced from 500,000 last time to about 150,000.

Modi broke some new ground in Kerala, a state dominated by the political left and long hostile to his ideology. But overall in the south, he struggled to improve on the 29 seats, out of 129, that his party had won in the previous election.

Perhaps the biggest disappointment for the BJP in southern India was that it once again appeared not to have won any of the 40 seats in Tamil Nadu, a state with its own strong cultural and linguistic identity.

Modi had campaigned aggressively there, even visiting one coastal town for two days of meditation as the voting neared its conclusion.

“Mr. Modi’s and the BJP’s antics cannot win my Tamil heart,” said S. Ganesan, a waiter at a hotel in Kanniyakumari, the town Modi visited.

Adding to the complexity of the problem, it is unclear in Washington exactly what an acceptable endgame might look in Ukraine or in the Gaza Strip. Officially, Ukraine still talks about total victory, pushing Russia out of every inch of territory it seized since the February 2022 invasion. Israel still speaks of the goal of the “total destruction” of Hamas, the only way to assure that it could never again mount an attack like the Oct. 7 assault that killed nearly 1,200 Israelis and sparked seven months of brutal retaliation.

But in Washington, those rallying calls sound increasingly unrealistic. Russia appears to be regaining momentum. The call for the total defeat of Hamas sounds like a rationale for perpetual war — and, in fact, Israeli officials have publicly declared the war in Gaza will likely continue to the end of the year, if not longer.

So Biden has taken to crisis management, trying to prevent the worst, even if he cannot answer the question of how, exactly, these wars end.

“Neither Ukraine nor Israel is a treaty ally,” said Aaron David Miller, a senior fellow at the Carnegie Endowment for International Peace and a longtime Mideast negotiator. He was referring to the status of the other 31 members of NATO, which are obliged to come to one another’s defense, and the formal U.S. pacts with Japan, South Korea, the Philippines and others. “And yet we are fully invested in how to get these wars to the next phase, a phase where we lessen the violence, even if we can’t articulate a realistic vision of how it stops.”

In both cases, Biden has now staked some big bets.

On Thursday, with the most minimal of public explanation, the White House revealed that Biden had carved what it termed a narrow exemption to his 27-month-long insistence that American weapons can never be shot into Russian territory. It is a rule he established at the outset of the war in Ukraine to “avoid World War III.”

It was one thing, Biden told his aides, to give the Ukrainians the weaponry they need to protect their own homeland. But letting them launch American artillery rounds and rockets and missiles over the border, where they could take the lives of not only soldiers but also civilians, and wipe out Russian infrastructure, could escalate into a direct American confrontation with a nuclear-armed adversary.

That mandate made sense when time was on Ukraine’s side, one of Biden’s top advisers said over the weekend. But now, momentum has reversed. Zelenskyy, who clashed repeatedly with Biden and his staff over their reluctance to give him long-range artillery, then tanks, then F-16s, began a public pressure campaign to get

Biden to soften his restrictions on firing American weapons across the border into Russia.

In an interview with The New York Times two weeks ago, Zelenskyy addressed Biden. “Shoot down what’s in the sky over Ukraine,” Zelenskyy said. “And give us the weapons to use against Russian forces on the borders.” He was taking public what he had been saying more insistently to visiting U.S. officials, including Secretary of State Antony Blinken, the most recent senior official to visit Kyiv.

Blinken came back convinced, and in a Friday night Oval Office meeting with Biden, he and Jake Sullivan, the national security adviser, along with Defense Secretary Lloyd Austin, convinced Biden that he needed to lift the restrictions at least in the border areas around Kharkiv, Ukraine’s second-largest city. Otherwise, they warned, Russia could well start taking back significant parts of territory that it was chased out of in the fall of 2022.

Ukraine announced on Monday that it had used Western-provided weapons to destroy an air-defense system on Russian territory, though it did not name the weapon or give details. Russia’s deputy foreign minister, Sergei Ryabkov, then issued a warning that if Western-provided weapons struck Russia, Moscow would extract “fatal consequences.”

The day after Biden allowed limited strikes on Russian territory, he made a much more public move to force the hand of Netanyahu, with whom his relationship has turned just short of poisonous. Biden gave a public speech in which he endorsed what he called an Israeli plan to win the release of hostages and end the fighting in Gaza. “It’s time for this war to end, for the day after to begin,’’ he said.

It was unusual, to say the least, for an Amer-

ican president to be spelling out the details of an Israeli plan: Diplomats are trained to avoid speaking for other countries. But in this case, that was the point. Biden spoke after months of frustration, in which Netanyahu refused to go along with American admonitions to let in more lifesaving aid, to create a plan for evacuating hundreds of thousands of Palestinian civilians from Rafah before military operations took place, and to avoid using 2,000-pound bombs that injure or kill civilians.

So the president was determined to make Netanyahu admit to ownership of a threephased peace plan, one that could stretch out for years.

In fact, the plan was approved by the war Cabinet — though not by the small right-wing parties that support Netanyahu and that he needs to keep his fragile coalition government in power. It appears those opponents of the deal never even saw the offer to Hamas.

Netanyahu did not exactly deny that he had signed off on the plan, but he did not admit it, either. “He’s dancing,’’ said Shalom Lipner, a senior fellow at the Atlantic Council who worked for seven Israeli prime ministers over 26 years, including Netanyahu. “He hasn’t disclaimed it. But he hasn’t embraced it, either.”

“Going public with this proposal — on the Sabbath, when he knew that the more right-wing religious parties might not hear it or could not respond — became a necessity because time is slipping away,’’ Lipner said.

It is slipping in particular for Biden. Six weeks ago, the president and his aides thought a prisoner swap and a cease-fire, even if temporary, was just days away. That moment came and went. Now, atop the human tragedy of the war is the political reality: Biden knows that his campaign appearances, and the Democratic convention, may well be marked by protesters from the progressive wing of his party who believe the United States should have cut off all of Israel’s offensive arms as the civilian deaths mounted.

But, as a strong supporter of Israel over the past 50 years — Biden still talks of dealing with Golda Meir at the end of her time in power as Israel’s prime minister — the president knows he cannot appear to be threatening or abandoning the current government.

So the two men have taken to public pronouncements that make clear their differences of strategy. It is hardly the kind of quiet, takea-friend-aside cajoling that Biden prides himself on, whether he is strong-arming NATO leaders to spend more on defense or persuading the Japanese to reconcile their century-old differences with South Korea. But it is what the U.S. and Israel have come to, out of distrust: Public pronouncements to corner the other.

The verdict is in on the Supreme Court

After Donald Trump was found guilty of 34 felony counts in a Manhattan court, conservatives — from Marjorie Taylor Greene to George Santos to the Heritage Foundation — began posting upside-down American flags on the social platform X in solidarity with the “political prisoner,” as Trump absurdly styles himself.

It was the same upside-down symbol that insurrectionists carried to the Capitol on Jan. 6 to proclaim that they thought the election was stolen and that was seen flying over Justice Samuel Alito’s house in suburban Virginia even as the Supreme Court was considering whether to hear a case about the 2020 presidential election.

Now that it’s being used to show support for a felonious expresident, Alito will have an even harder time trying to pretend he’s oblivious about its meaning.

I don’t need a black robe to hand down a judgment on the Supreme Court.

It’s corrupt, rotten and hurting America.

The once august court, which the public held in highest esteem, is now hopelessly corroded: It is in the hands of a cabal of religious and far-right zealots, including a couple of ethical scofflaws with MAGA wives.

Chief Justice John Roberts, who dreamed of being remembered as a great unifier of the court, is refusing to rein in Alito and Justice Clarence Thomas, who are thumbing their noses at the public and their own oaths to dispense fair and impartial justice.

When Alito pushed a willing conservative majority into yanking away women’s right to control their own bodies, he was, in essence, blaming women: You get pregnant, you’ll have to live with it.

In this latest firestorm, he blamed one woman in particular: his wife, Martha-Ann.

Somehow, in Alito’s world, women are to blame.

It was shocking when The New York Times’ Jodi Kantor reported that the upside-down flag cherished by “Stop the Steal” marchers was hanging outside Alito’s house. It was even more shocking when we learned that another flag carried by “Stop the Steal” rioters on Jan. 6, the “Appeal to Heaven” flag, was flying outside the Alitos’ vacation home in New Jersey as cases concerning the Jan. 6 assault and riot were pending at the court. This flag symbolizes support for Donald Trump and a desire to infuse the federal government with a lot more Christianity.

“In coming weeks, the justices will rule on two climactic cases involving the storming of the Capitol on Jan. 6, including whether Trump has immunity for his actions,” Kantor wrote. “Their decisions will shape how accountable he can be held for trying to overturn the last presidential election and his chances for reelection in the upcoming one.”

Alito’s conservative Christian, right-wing, deeply aggrieved views about the culture wars are reflected in his speeches, decisions and now flags that are red flags.

He is refusing to recuse himself from the two cases about the attempted coup on Jan. 6. (One concerns the question of whether Trump is immune from prosecution for his role egging on rioters; the other involves a federal obstruction law used to charge the rioters.)

When leading Democratic lawmakers demanded Alito’s recusal, he wrote back, trying to make Martha-Ann Alito the fall guy. Alito has clearly heard enough criminal appeals to know you’ve got to point the finger at somebody else when you’re guilty.

“My wife is fond of flying flags,” he wrote to the lawmakers. “I am not. She was solely responsible for having flagpoles put up at our residence and our vacation home and has flown a wide variety of flags over the years.”

“I was not even aware of the upside-down flag until it was called to my attention,” he wrote. “As soon as I saw it, I asked my wife to take it down, but for several days, she refused.” He said there was absolutely nothing he could do to get that pesky seditious flag taken down sooner.

He was oblivious about the symbolism of the “Appeal to Heaven” pine tree flag, he claimed.

Thomas is also awash in ethical snarls, some related to his wife. Ginni Thomas’ supporters also tried to defend her activism related to Jan. 6 by saying she is an independent spouse.

But it doesn’t wash. As Jane Mayer wrote in The New Yorker, Ginni Thomas is a lawyer and a prominent member of hardright groups and “has declared that America is in existential danger because of the ‘deep state’ and the ‘fascist left,’ which includes ‘transsexual fascists.’”

In a Facebook post, she linked to a news item about the Jan. 6 protest and wrote “LOVE MAGA people!!!!”

Mayer noted that it is getting harder to dismiss Ginni Thomas’ actions as harmless, given that the “Supreme Court appears likely to secure victories for her allies in a number of highly polarizing cases — on abortion, affirmative action, and gun rights.”

Sen. Richard Blumenthal asked Roberts to make Clarence Thomas recuse himself from the case on Trump and the insurrection, but Thomas refused.

The Supreme Court has two decisions on abortion cases due any day.

“The Fall of Roe,” an insightful new book by The New York Times reporters Elizabeth Dias and Lisa Lerer, laid out the events and the strategy — and the failure of the Democrats to recognize the threat — that led to the fall of Roe. There was a determined group of religious zealots with a long-term master plan to pack the court with religious zealots.

He’s happy to take away the rights of millions of American women to control their bodies, but respects the right of his wife to control their incendiary flags. While he’s on the Supreme Court, he said, MarthaAnn wields the gavel at home.

“These conservative Catholic and evangelical Christian operators believed they were fighting the biggest moral battle of the modern age, and forced America to debate on their terms,” they wrote. “But despite their public appeals, they did not convince broad swaths of Americans of the righteousness of their cause. Instead, they remained a minority, and leveraged the structures of American democracy in their favor, building a framework strong enough to withstand not only the political system but also a society moving rapidly against them. They took power to remake the nation in their image. And they were far more organized than their opponents or the public ever knew.”

Now it’s up to Democrats to turn the tables and see if they can use this issue in the November election to save the country and women’s rights.

For her third album, Angélica Garcia adds her first language: Spanish

“My blood speaks Spanish to me,” Angélica Garcia sang in “Red Moon Rising,” a track on her 2016 debut album, “Medicine for Birds.” Garcia, who was born in California, was living in Virginia; the album leaned toward indie-rock and Americana. But the lyric turned out to be prophetic. She was thinking about the legacy of her maternal grandparents, who are from Mexico and El Salvador, and the musical heritage her parents maintained. Garcia’s second album, “Cha Cha Palace,” delved further into what it meant to be a Chicana growing up bicultural in the San Gabriel Valley — a quintessentially American experience, yet a very individual one. “Been wearing my roots and flying this flag,” she sang in “Jícama,” which former President Barack Obama listed among his favorite songs of 2019.

“One day I showed my grandmother ‘Cha Cha Palace,’” Garcia, 30, said in a video interview from the kitchen of her apartment in Los Angeles. “And I realized I’d made this whole record about growing up in El Monte, and she didn’t even understand it. It just hit me that I’m missing a whole side of my culture and people because of the language I’m choosing to write in.”

Garcia’s new album, “Gemelo” (“Twin”), out Friday, expands on both her bloodlines and her ambitions, and features lyrics in Spanish. True to its title, its songs are full of dualities: angels and demons, grief and healing, dreams and realities, mirror images. The album opens with a somber chorale titled “Reflexiones” (“Reflections”), while in “Gemini,” Garcia sings, “I see double everywhere I go.”

The music is largely electronic, unleashing the directness of Garcia’s voice — sometimes ghostly and airborne, sometimes a near-scream — amid programming, loops and layering. There are moments that hint at Kate Bush, Bjork, MIA and Santigold.

Garcia grew up speaking Spanish at home with her grandparents, but said she lost it “once I got into the public school system.”

“Honestly, I think the most punk thing I ever did was write in Spanish as a Chicana,” she added. “There were all kinds of feelings from everybody. Some people were like, ‘Your Spanish is really bad, don’t do this, it’s embarrassing.’ And then you have other people like, ‘Screw Spanish, it’s the language of the colonizer,’ yada yada yada.”

But, she explained, “I just realized that this is something I want to do. With any music I make from now on, I’m going to be writing in both languages — or all three if you count Spanglish as its own language.”

For Garcia, each has its own mood and musicality. “To me, English feels like a sword fight,” she said. “It’s very cutting

and sharp and quick. Whereas Spanish feels like there’s just this poetry to it. You stroll around something to get to it. Or you’re sitting in front of a window on a rainy day writing. And then Spanglish feels like a party.”

“Cha Cha Palace” was released in 2020, and Garcia was mid-tour when the pandemic set in. “Gemelo” got its start amid pandemic isolation and introspection.

“I was putting a lot of work and intention into understanding where I came from and where my family came from,” Garcia said. “I remember keeping all these journals like a madwoman, brainstorming and putting everything on the wall and trying to connect everything. I was trying to understand what things, what qualities of theirs that I maybe carried, like nature versus nurture. What is ingrained in me? And what is all mine?”

One of the first songs she came up with was “Juanita”; it arrived, she said, like “a gift.” It’s an electronic cumbia — a bedrock Latin American rhythm — with lyrics about a mystical encounter: “You made me wake up/ Your voice the sound of stars,” Garcia sings. Only after she wrote it did she learn that one of her great-grandmothers was named Juanita.

The indie scene in Richmond, Virginia, gave Garcia the room to try different styles and experiment; she was playing in five bands at once while she was making “Cha Cha Palace.” She moved in with her grandparents when the pandemic set in, and then to Brooklyn, where she spent a year and a half before returning to Los Angeles early this year.

Garcia was already in touch with Carlos Arévalo, the guitarist for the eclectic, retro-tinged Los Angeles band Chi-

cano Batman. He had discovered her music among prospective opening acts for a 2020 tour that was canceled by COVID. In 2021, she began sending him songs in progress; he suggested ideas and possible producers. Eventually, she convinced him to produce the album himself — his first album production.

“I knew this was a pivotal record for her in her career,” Arévalo said via video interview from a Chicano Batman tour stop in Oklahoma City. “She wanted the world to really see for the first time who she was on her terms, not what the label thought she should be and not what her community thought she should be.”

“Gemelo” doesn’t aim for dance-floor simplicity; nor does it latch onto the worldconquering pop beat of reggaeton. It’s an album of introspection and catharsis, about what Garcia calls “cycles of grief.” Garcia concocts her own beats, often irregular ones, and she revels in dynamic contrasts, from quiet and dulcet to explosive.

As she was writing the songs, Garcia said, “there were things that had me in my room crying, very low points. First it’s just the grief, right? But then you get up and try to voice it and you get excited when you hear, ‘Oh, but with that bass line, it sounds really cool.’ It’s kind of the coolest superpower ever that musicians have,” she added. “We can take something that really could debilitate so many people and make it into something else — a whole other experience.”

In “Color de Dolor” (“Color of Pain”), she sings about drawing inspiration from sorrows: “Even though I will never sever the tie with my pains / I paint them full of colors,” she vows. And in “El Que” (“He That),” she confronts a figure who undermines her, who “Makes cold, robs energy, controls, bewitches,” with a crescendo building as she warns, “Don’t follow me with your shadow — I have my light!”

For Garcia, music has always been “the one place where I could say exactly what I thought,” she said. “My whole life, I’ve just tried to follow where the music was calling me.”

She smiled and pointed to her head. “It’s very loud in here.”

For more than two years, a group of health experts, economists and lawyers in the U.S. government has worked to address a growing public health crisis: people dying on the job from extreme heat.

In the coming months, this team of roughly 30 people at the Occupational Safety and Health Administration is expected to propose a new rule that would require employers to protect an estimated 50 million people exposed to high temperatures while they work. They include farm laborers and construction workers, but also people who sort packages in warehouses, clean airplane cabins and cook in commercial kitchens.

The measure would be the first major federal government regulation to protect Americans from heat on the job. And it is expected to meet stiff resistance from some business and industry groups, which oppose regulations that would, in some cases, require more breaks and access to water, shade and air-conditioning.

But even if the rule takes effect, experts say, the government’s emergency response system is poorly suited to meet the urgency of the moment.

Last year was the hottest in recorded history, and researchers are expecting another record-breaking summer, with temperatures already rising sharply across the Sun Belt. The heat index in Miami reached 112 degrees Fahrenheit last weekend, shattering daily records by 11 degrees.

‘New territory’ for Americans: Deadly heat in the workplace

secretary for climate change and health equity in the Health and Human Services Department.

“The threat to people from extreme heat is reaching a point where we have to rethink how, at all levels of government, we are preparing and putting in place a response that matches the severity of the problem,” Balbus said in an interview.

“This is new territory.”

An estimated 2,300 people in the United States died from heat-related illness in 2023, triple the annual average between 2004 and 2018. Researchers say all those figures are probably undercounts, in part because of how causes of death are reported on death certificates.

Emergency room visits for heat illness shot up around the country last summer compared with the previous five years, according to a study by the Centers for Disease Control and Prevention.

Heat kills more people each year than hurricanes, floods and tornadoes combined, according to the National Weather Service.

President Joe Biden has tried to respond to the threat, notably with a call for worker protections in 2021. His administration tapped Balbus to be the first senior official to address the health impacts of climate change.

“Even those who deny that we’re in the midst of a climate crisis can’t deny the impact that extreme heat is having on Americans,” Biden said in July, adding that “it hits our most vulnerable the hardest: seniors, people experiencing homelessness who have nowhere to turn, disadvantaged communities that are least able to recover from climate disasters.”

But Biden’s efforts to respond to the extreme heat linked to climate change will almost certainly be erased if former President Donald Trump returns to the White House, Republican strategists said in interviews. Initiatives like the Office of Climate Change and Health Equity could be wiped away. And the proposed OSHA heat rule would very likely be shelved and ignored.

“So far this rule-making seems bound up in policy concerns about climate change and structural racism,” said Jonathan Berry, who served as a senior Labor Department official under Trump. “I don’t see a second Trump administration supporting rules on those bases.”

You could ‘cook an egg’

The health effects of extreme heat can be devastating even to the healthy and the young. High temperatures can damage organs, depriving the heart and kidneys of oxygen and blood, and overwhelm the body’s ability to cool down.

and emergency medicine physician at BannerUniversity Medical Center in Phoenix, saw patients last summer with confusion, unresponsiveness and body temperatures above 105 degrees Fahrenheit. Blood tests would reveal kidney or brain damage and muscle that had broken down. People who collapsed on hot concrete or asphalt arrived with burns, he said.

Juan Villalpando, 43, a roofer in Gary, Indiana, battled 94-degree temperatures last week. “You can physically cook an egg up here,” said Villalpando, who has experienced episodes of heat illness, with fatigue, cold sweats, chills and disorientation. “When that happens to guys, they can fall off and die.” (As the heat has broken records in Indiana, Villalpando’s employer has provided more water breaks and shade.)

Telitha Solis, 57, an airplane cabin cleaner at George Bush Intercontinental Airport in Houston, recalls sweating, shaking and feeling nauseated while working without air-conditioning. “Any kind of air cooling would make a big difference,” she said.

The White House has pushed officials at the Labor Department, which oversees OSHA, to publish a draft heat rule this summer. But even if that happens, it is unlikely to be finalized this year and faces broad opposition from industry groups that say new regulations would be unreasonably complicated and expensive.

Marc Freedman, a vice president at the U.S. Chamber of Commerce, the country’s largest business lobbying group, wrote that such a rule would present huge challenges for employers and that “it is extraordinarily difficult for them to determine when heat presents a hazard because each employee experiences heat differently.” Freeman said the unpredictable nature of heat creates “a substantial barrier to efforts to determine when employees require protection.”

The rule, which would set clearer standards for employers, would most likely include two heat index thresholds, one at 80 degrees Fahrenheit and the other at 90 degrees, for worker protections in both outdoor and indoor settings, according to an outline that OSHA officials presented in late April. The heat index is a measure of how hot it really feels outside, factoring in humidity and other factors along with the temperature.

At the first, lower threshold, employers would be required to offer drinking water and break areas and to allow workers to start with lighter workloads. The higher threshold would require breaks and monitoring for signs of heat illness.

Since April 2022, OSHA, which has nearly 2,000 inspectors, has conducted about 5,000 inspections related to heat exposure. That resulted in 54 citations to employers for heat-related violations of the agency’s general duty clause, which requires companies to maintain workplaces free of hazards, said Mandy McClure, an agency spokesperson. Of those 54 citations, a dozen were issued after heat-related hospitalizations and 25 after heat-related deaths, she said.

Rep. Greg Casar, a Texas Democrat who went on a thirst strike in July to pressure OSHA to expedite the heat rule, said that “it would take OSHA nearly 150 years to inspect every workplace in the country, because they’re constantly underfunded.”

About half a dozen states have implemented their own protections for outdoor workers. But some of those protections have faced backlash from conservatives.

Gov. Ron DeSantis of Florida and Gov. Greg Abbott of Texas, both Republicans, signed legislation to prevent local governments from requiring heat protections for outdoor workers.

An invisible crisis

In October 2022, after a record-breaking, triple-digit heat dome formed over California, Gov. Gavin Newsom, a Democrat, asked the Federal Emergency Management Agency to declare a major disaster, which would have unlocked federal assistance.

The agency denied the request, responding that “precedent is to evaluate discrete events and impacts, not seasonal or general atmospheric conditions.” The 1988 Stafford Act, which authorizes the federal government to declare a disaster or emergency, does not include extreme heat in its list of 16 causes. No president has declared an emergency in response to heat.

Local officials and health providers say FEMA’s requirements for activating an emergency response typically involve things like property damage from a disaster. A heat crisis that stresses human health can be harder to measure.

A heat crisis “is not a big visual episode,” said Jane Gilbert, the chief heat officer of MiamiDade County.

The most perilous heat-related health crisis could come if heat takes down an electric grid. Extreme heat can send demand for electricity soaring, straining transmission, and can damage equipment, hobbling production. The result is a steamy community, in the dark, without airconditioning, refrigeration or relief. “That would be an overwhelming situation where I think you would probably have to see a federal response,” Balbus said.

Richard Ellis, ‘poet laureate’ of deep-sea creatures, dies at 86

Richard Ellis, a polymath of marine life whose paintings, books and museum installations — especially the life-size blue whale at the American Museum of Natural History in New York — revealed the beauty and wonders of the ocean, died May 21 in Norwood, New Jersey. He was 86.

His daughter, Elizabeth Ellis, said the cause of his death, at an assisted living facility, was cardiac arrest.

Ellis had no formal training in marine biology, conservation, painting or writing. But in fusing his artistic flair with an encyclopedic knowledge of ocean creatures, he became an invaluable, sui generis figure to conservationists, educators and those curious about sea life.

“Richard was an enthusiast, and he absolutely adored the natural world, especially the sea,” said Ellen V. Futter, the former president of the natural history museum, where Ellis was a research associate for many years. “He wanted everybody to share his appreciation and joy from the beauty of it, but also to feel the same sense of responsibility to protect it.”

Ellis spent much of his life traveling to exotic locales, where he bobbed around on boats and went diving in search of giant squid, great white sharks and other fantastical, elusive deep-sea creatures.

“If people understood the life, the importance, the habits of these creatures — whether sharks or whales or manatees — they would acquire a reverence,” Ellis told The New York Times in 2012. “I do it so people will say, ‘Wow, I didn’t know that’ or ‘Isn’t that cool! Look at what octopuses can do!’”

His photorealistic paintings of whales were sold in an art gallery and published in Audubon and National Wildlife magazines and in the Encyclopaedia Britannica. His more than a dozen books about marine life — especially his tomes on whales, sharks and tuna — made him, in the view of bestselling author Simon Winchester, the “poet laureate of the marine world.”

Throughout his life, Ellis was never far from a major body of water. Growing up on the Rockaway Peninsula in Queens, he swam nearly every day in the Atlantic Ocean, weather permitting. The blue water, and what lurked below, frequently washed up in his daydreams.

“I would be sitting in class, learning about the Revolutionary War — except I was drawing swordfish,” he told a weekly newspaper on Long Island in 2015. “I didn’t think this was going to mark the beginning of my career, but it did.”

In 1969, the American Museum of Natural History hired Ellis as an exhibition designer and assigned him to help build a life-size blue whale to hang from the ceiling in the Hall of Ocean Life.

“I thought, ‘OK, how hard can it be?’” Ellis told the Times. “There must be all kinds of pictures.”

There were not. Ellis had to rely on drawings and photos of dead animals, an experience that convinced him that the only way to accurately depict oceanic wonders was to swim among them — even if they harbored a desire to eat him.

In the 1980s, wearing scuba gear and protected by a steel cage, he was one of the first ocean explorers to swim with great white sharks. He told the Times that he recalled “breathing extraordinarily fast because I’m sure the sharks are going to break through the cage and kill me.”

After that fear subsided, Ellis became filled with wonder.

“You don’t belong here, but it does,” he said. “And then you understand how beautiful it really is, and you spend the rest of your time staring at this animal or photographing it and thinking to yourself, ‘I am very privileged to be able to see this creature in its natural habitat.’”

Richard Ellis was born April 2, 1938, in the Belle Harbor neighborhood of Queens. His father, Robert, was a lawyer and also worked at the United Transformer Corp. His mother, Sylvia (Levy) Ellis, was also a lawyer but did not practice.

He spent most of his childhood swimming in the ocean.

“I had always been fascinated by the ocean and what lived in it,” he told the Times. “But most of the time, what lived in it was me.”

After graduating from the University of Pennsylvania in 1959 with a degree in American civilization, he joined the Army. He was stationed in Honolulu and, in his off hours, surfed and swam in the Pacific Ocean.

Ellis maintained an affiliation with the American Museum of Natural History for much of his life, but he made his living painting, writing and illustrating books. His output was

prodigious.

“The Book of Whales” (1980) tells the complex history of nearly every species of whale, accompanied by his illustrations.

In “Monsters of the Sea” (1994), author and naturalist Janet Lembke wrote in a review in the Times, Ellis aimed his “insatiable curiosity” at “legend-hallowed behemoths: the leviathan, the polyp, the man-eating elasmobranch (otherwise known as the shark), all manner of sea serpents (including Nessie, the Loch Ness monster) and some great, stranded lumps of flesh called ‘blobs’ and ‘globsters’ for want of more precise names.”

“Tuna: A Love Story” (2008) tells the story of how a fish capable of swimming 55 mph became an overfished commodity.

“To biologists,” Ellis wrote, “the tuna is the epitome of hydrodynamic excellence; it is fast, powerful, streamlined, and equipped with specializations that enable it to perform its duties better than any other fish in the ocean.”

To humans, it is tuna salad and sushi.

“What I do is I paint the things I admire,” Ellis said on the NPR program “Talk of the Nation” in 2008. “Other people shoot them, some people fish for them. I paint them.”

Ellis married Anna Kneeland in 1963. They divorced in 1981.

In addition to his daughter, he is survived by Stephanie W. Guest, his companion since 1989; a son, Timo; Guest’s children, Victoria, Vanessa, Fred and Andrew Guest; six grandchildren; and his brother, David. He lived on the west side of Manhattan for many years.

Ellis appeared on the CNN program “Larry King Live” in 2001 after a shark bit an 8-year-old boy in Pensacola Beach, Florida.

“They are dangerous when hungry, right?” King asked him.

Not exactly.

“They’ve been around for roughly 300 million years,” Ellis said. “And if something moved in the water, it was edible to a shark.”

It’s not the fault of sharks that people started swimming in their water.

“If it moves in the water and you’re a shark,” Ellis said, “you can eat it.”

Por la presente se le(s) notifica que se ha radicado en la Secretaría de este Tribunal una Demanda en Cobro de Dinero y Ejecución de Hipoteca en su contra, en la cual se alega entre otras cosas que la parte demandada adeuda a la parte demandante por concepto de hipoteca la suma de $80,832.89 por concepto de principal, desde el 1ro de diciembre de 2023, más intereses al tipo pactado de 4.50% anual que continúan acumulándose hasta el pago total de la obligación. Además, la parte co-demandada Oscar Berríos Galarza adeuda a la parte demandante los cargos por demora equivalentes a 4.00% de la suma de aquellos pagos con atrasos en exceso de 15 días calendarios de la fecha de vencimiento; los créditos accesorios y adelantos hechos en virtud de la escritura de hipoteca; y las costas, gastos y honorarios de abogado equivalentes a $9,157.50. Por razón de dicho incumplimiento, y al amparo del derecho que le confiere el Pagaré, el

demandante ha declarado tales sumas vencidas, líquidas y exigibles en su totalidad y cualesquiera otros adelantos que se hagan en virtud de la escritura de hipoteca número 193, otorgada en Caguas, Puerto Rico, el día 26 de mayo de 2017, ante la notario Jesús A. The history of Black baseball players, on full display

Octavius Catto’s impact was mostly unknown here at the National Baseball Hall of Fame and Museum in Cooperstown, New York, amid the sport’s heroic feats of lore and legend, like Joe DiMaggio’s 56-game hit streak, Ted Williams’ .406 batting average and Hank Aaron’s 715th home run to break Babe Ruth’s record.

Catto, born a free Black man, turned to baseball in the shadows of the Civil War. He was a founder of Philadelphia’s all-Black Pythian Base Ball Club, which included Frederick Douglass’ son, Charles. (They lost their first game, 70-15, but improved quickly.) The Pythians applied for and were denied entry into Pennsylvania’s association of amateur baseball and the National Association of Base Ball Players.

The story of Catto, who was also a civil rights activist before his 1871 assassination, is among many that the museum is showcasing in a new exhibit, “The Souls of the Game: Voices of Black Baseball.”

“It has been documented that we’ve been playing baseball going back to the period of being enslaved,” said Bob Kendrick, president of the Negro Leagues Baseball Museum in Kansas City, Missouri, and a member of the exhibit’s advisory committee. “Baseball has always been an important part of the African American experience in this country. It’s just the fact that it wasn’t documented in the pages of American history books.”

The exhibit is opening at a time when the percentage of American-born Black players in Major League Baseball is historically low. About 40% of major league players last season were players of color, according to a report by the Institute for Diversity and Ethics in Sport, but only about 6% identified as either Black or African American, the lowest since tracking started in 1991. The 2022 World Series, between the Philadelphia Phillies and Houston Astros, featured no American-born Black players for the first time in 72 years.

“It continues the conversation, which is great,” Curtis Granderson, a three-time AllStar, said of the exhibit. “And that’s what you want to have. You want to have the conversation go from one generation to the next.”

In recent years, baseball has sought to rectify previous omissions and oversights related to its history. None is more momentous than the recent incorporation of statistics from several Negro leagues into official MLB statistics, where, for example, Josh Gibson

isn’t drawn just with that moment or another. It gets heavier and bolder and bolder and stronger with all sorts of things going on.”

The new exhibit explores Jackie Robinson’s life beyond breaking that barrier, along with other, lesser-known thresholds. One item on display is the championship ring that Aaron received at 19 when he integrated the South Atlantic League in 1953.

Robinson’s story is universally celebrated as the tale of triumph and preservation that it is. But reintegration, as Shieber likes to call it, coincided with the collapse of the Negro leagues. The exhibit does not shy away from exploring those ramifications.

“It is absolutely a bittersweet kind of story,” Kendrick, of the Negro Leagues Baseball Museum in Kansas City, said. “Those owners and the older players in the Negro leagues essentially took one for the team. It reminds us that there is always a cost for what is deemed progress. And Black economy paid a dear cost for this progress.”

After reintegration, MLB executives established an unwritten quota system limiting the number of Black players on rosters, Shieber said.

replaces Ty Cobb for highest batting average of all time. The Hall of Fame, which is not funded by Major League Baseball, also acknowledged in recent years that the legacies of enshrinees like Kenesaw Mountain Landis and Cap Anson included maintaining the color barrier that remained until 1947.

One player the Hall of Fame recruited for its recent advisory committee was Dave Stewart, a standout starting pitcher and World Series most valuable player with the Oakland A’s, who discussed the full spectrum of his experiences to help inform the exhibition. At the start of his career, he suffered isolation as the lone Black player on a team traveling by bus through tiny minor league towns. Once, he said, a racist tried to run him over in a parking lot in Mississippi. But he was eventually able to meet heroes from previous generations, like Bob Gibson, Roy Campanella and Don Newcombe, and found camaraderie.

“We talked about those experiences and what it felt like to be in that situation and how I was treated or how we were treated at that time,” Stewart said. “We talked about style of play. You look at guys like Rickey Henderson and Reggie Jackson, and the style and brand of play and what they did. Were they more acceptable or less acceptable because it was Rickey Henderson doing it versus if Cal Ripken would’ve done some -

thing like that?”

Part of the exhibit’s opening featured an exhibition game that included more than two dozen former Black big leaguers like Granderson, Matt Kemp and Prince Fielder.

“The reason I said yes was to get a chance to be with all those guys again,” said Granderson, who played in the majors from 2004 to 2019. “It’s the first time I’d be around so many Black ballplayers that I played against, played with, watched growing up.”

It was a reminder that even recently, Black representation on big-league diamonds was more common. Among the items in the new exhibit’s section on the modern era is a Tshirt worn by Mookie Betts at the 2022 AllStar game emblazoned with “We need more Black people at the stadium.”

Tom Shieber, the Hall of Fame’s senior curator, read from “De Witt’s Base-Ball Guide of 1868” during a recent tour of the exhibit. The document noted that the rejection of Catto’s team, the Pythians, from the National Association of Base Ball Players was based on the rationale that “if colored clubs were admitted, there would be, in all probability, some division of feeling, whereas by excluding them, no injury could result to anybody.”

“It’s like, ‘What?’” Shieber asked. “It’s so weird to connect the dots that way, but they did. One thing we tell here is, the color line

“This resulted in lopsided trades,” he added. “That’s not just a one-on-one trade. That’s a ‘we’ve got enough Black players trade.’”

Near the exhibit’s end, Shieber pointed out the locker once used by Willie Mays that Barry Bonds took over as a San Francisco Giants player.

One of Stewart’s cherished early memories was meeting Mays, his favorite player, as a 5-year-old. But Stewart could also look up to Gibson, Aaron, Frank Robinson and a host of other Black stars.

Today, he said, children probably emulate Betts. He struggled to name another current American-born Black star.

Under the surface, numbers are improving. The league has established several programs to encourage, identify and nurture young Black players. An increasing number of Black players have been among the top draft picks in recent years: 12 of the first 100 three years ago, 13 of the top 100 in 2022, and 10 of the top 50 in last year’s draft.

“We are going to have to be patient, though, and as a society, we aren’t very patient,” Kendrick said. “This trend didn’t happen overnight. The solution isn’t going to occur overnight either.”

Telling stories like those of Catto, from as far back as 150 years ago, will help those efforts, Kendrick believes. “It will,” he said, “be an awakening.”
