Dispute arises over testimonies of top fiscal board officials

Puerto Rico Electric Power Authority (PREPA) bondholders opposing the utility’s debt adjustment plan and the Financial Oversight and Management Board are engaged in a dispute over the admissibility of separate testimony from the oversight board’s chairman, David Skeel, and its executive director, Robert Mujica.
The dispute is one of many in hearings to determine whether PREPA’s debt deal should be confirmed. The debt deal proposes to reduce PREPA’s $9 billion bonded debt to about $2.5 billion.
The oversight offered Skeel’s testimony in favor of PREPA’s debt adjustment at confirmation hearings that began this week, but a set of bondholders argued he made remarks that he was not qualified to make.

“The length of the PREPA bondholders’ objections speaks not to an effort to harass, but to the volume of deficiencies with Mr. Skeel’s direct testimony in this hotly contested confirmation proceeding,” the objecting bondholders said. “Mr. Skeel’s over-100-page-long declaration is laden with legal argument, improper opinion testimony, factual statements for which he has no personal knowledge, and statements concerning matters that the Oversight Board has claimed are privileged (blocking any ability by objecting parties to test such assertions).”
U.S. District Judge Laura Taylor Swain’s decision on the objections could affect how further disputes over testimony in the hearing are handled. The oversight board has requested that Swain modify her procedures so that responses to objections aren’t due until before evidence closes.
“The Oversight Board now suggests that the Court modify the process it outlined at the pre-trial conference for handling objections to written direct testimony,” the bondholders said. “The fact that the Oversight Board does not want to spend time defending its voluminous and improper fact witness declarations does not warrant a wholesale abandonment of the procedures that this Court, and not the PREPA Bondholders, proposed.”
The change would allow witness testimony to continue at a more undisturbed pace, rather than potentially requiring lengthy legal argument prior to each witness’s testimony and preserve objecting parties’ ability to lodge timely objections as testimony proceeds, the oversight board argued.
Bondholders said allowing witness testimony that is improper is a problem.
“The oversight board should not be allowed to
introduce inappropriate and objectionable testimony into the record wholesale without any impediment whatsoever, subject only to a retroactive ruling on the papers,” bondholders argued. “Critically, it would be a waste of the parties’ already limited trial time to defer decision on objections to direct testimony until the close of evidence, which would require parties to conduct cross-examination on direct testimony that may ultimately be stricken entirely.”
Regarding Mujica’s testimony, opponents of the plan, including certain groups of bondholders, monoline insurers and PREPA’s bond trustee, said Mujica’s declaration was laden with improper testimony, including legal arguments, opinion testimony, and statements for which he has no personal foundation.
“As to the latter, the Oversight Board now claims that Mr. Mujica testified to the matters at issue at his deposition, but a review of the relevant transcripts will show that Mr. Mujica’s testimony does not demonstrate personal knowledge,” the bondholders said. “Just because a witness was questioned on a topic does not mean that he is competent to provide trial testimony on the matter.”
The oversight board pointed out that the objecting bondholders have been in possession of the substantive portions of Mujica’s declaration for three weeks.
“Nevertheless, the objecting bondholders once again waited until the last minute … to send the Oversight Board 44 pages of objections to the declaration of Mr. Mujica,” the board said.

Judge Joie-Lin Laó Meléndez of the San Juan Court of First Instance did not find cause for trial on Wednesday against Citizen Victory Movement Rep. Mariana Nogales Molinelli.
Nogales Molinelli faced two charges of perjury and ideological falsehood.
“After hearing the evidence, the court finds no cause on both counts,” the judge said. “I ask the Public Prosecutor’s Office if they are going to request an appeal at this time.”
“Yes, we’re going to go on appeal,” replied the special independent prosecutor, Ramón Mendoza.
The date of April 29 was set for the new Rule 6 appeal process.
“Today the political persecution to which Mariana and her family were subjected is confirmed. Despite having prevailed in court, the damage done to Mariana and her family is irreparable,” Nogales Molinelli’s defense team said in a statement. “And will those responsible for this hoax be held accountable? From unscrupulous politicians like [Sens.] Thomas Rivera [Schatz] and Gregorio Matías [Rosario], to their representatives in the Department of Justice, the FEI [special independent prosecutor] and the media themselves. Your time will also come.”

The House of Representatives did not concur earlier this week with the Senate bill approving a salary increase for judges, sending the bill to conference committee.
Senate Bill 1400 will go to a conference committee after it is approved by the House and, through a floor amendment, some of the content will be removed.
“Being consistent with our proposals, we are in the best position to evaluate this measure and seek common ground regarding its approval,” House Speaker Rafael “Tatito” Hernández Montañez said Tuesday in a written statement.
Hernández Montañez has insisted on taking up the measure after the June primaries.
Meanwhile, several measures were approved in the lower chamber’s first session after a recess declared in February.
Among the measures approved was House Bill 1957, to create the “Natalia Nicole Ayala Rivera Law,”
which received 44 votes in favor and three against during the final vote. The bill reviews the classification and conditions related to the vehicular crime of hit and run after an accident that causes serious bodily harm or death to a person.

The House also approved a 2002 bill to establish as a budget base the allocation of $500 million for the University of Puerto Rico and that the funds are to be used without restriction for the daily operation of the institution.
It also concurred with Senate amendments to House Joint Resolution 606, for the payment of the refundable incentive.
The lower chamber adjourned until next Tuesday at 1 p.m.
Auto repair shops, junkyards fined for lacking permits

Several auto repair shops and junkyards in the Viví Abajo neighborhood of Utuado, the Juan González neighborhood in the Lirios sector of Adjuntas and the Callejones neighborhood on highway PR-129 in Lares were inspected and fined this week for lacking the permits required by law.
The Stolen Vehicles Investigation Division of the Puerto Rico Police Bureau’s (PRPB) Utuado Police Region, led by Lt. Reinado Jiménez Padró, along with the Puerto Rico Planning Board, carried out the inspections on Monday and Tuesday.
According to the PRPB, eight establishments were fined, with several complaints issued such as: not having an automotive technician’s license, violations by not having the unique permit granted by the Planning Board, not having a record of entry and exit of vehicles, and lacking a registry where the required data on the applicant for each reproduction or delivery of keys of a motor vehicle appear. Fines amounted to $5,000, and an additional 33 vehicles were inspected.
The Planning Board issued cease and desist orders on the shops, as they were operating illegally. Those in charge of the shops could face other fines for carrying out work that
causes environmental problems.
The PRPB’s Stolen Vehicle Bureau will continue to conduct such inspections so that auto repair shops and scrapyards comply with all regulations as required by law.
Sgt. Christopher Atiles Cruz of the Utuado Stolen Vehicles Bureau Division was in charge of the work plan, which is focused on minimizing the problems faced by citizens who request services in the shops.

Women’s advocate, PR Coffee Roasters ally to help break gender violence cycle

In commemoration of International Working Women’s Day and with the purpose of promoting learning and growth so that women can empower themselves and get out of the cycle of gender-based violence and abuse, the Office of the Women’s Advocate (OPM by its Spanish initials) and the company Puerto Rico Coffee Roasters signed a collaborative agreement on Wednesday to jointly carry out several activities.
“I thank Puerto Rico Coffee Roasters for joining in this important public policy effort of Gov. Pierluisi, through which we promote a more just society, of respect and human dignity,” said Madeline Bermúdez Sanabria, the acting women’s advocate, in a written statement. “At the OPM we work to be an accessible and supportive resource for women and develop actions aimed at solving the problems faced by women in our society and improving their quality of life.”
During March, the OPM will hold two events entitled “Coffee to Celebrate Us,” at the Olimpo Community Center in Guayama and in San Juan, where workshops will be offered on various topics of importance to women.
At both events, Puerto Rico Coffee Roasters will be in charge of setting up a station and tastings of its Yaucono coffee brand, with a band and singer Yaire, who will also give her testimony as a survivor of gender violence.
Germán L. Negrón, general manager of Puerto Rico Coffee Roasters, said “Puerto Rico Coffee Roasters and Yaucono, the favorite brand of the Puerto Rican family, stand in solidarity with women’s fight for equality.”
“Our corporate social responsibility goes beyond coffee,” he added. “It is a duty to actively participate in these events dedicated to raising awareness and contributing to the dialogue about the importance of justice and equality for women.”
A day earlier, the OPM signed a similarly aimed collaborative agreement with the Puerto Rico Teachers Association and the island House of Representatives.
The OPM’s main purpose is to oversee the implementation of and compliance with public policy and laws for the protection of women in Puerto Rico. It has a toll-free guidance and assistance hotline, available 24 hours a day, 7 days a week at 787-722-2977.
Federal agents arrest and charge a teacher from Mayagüez with child exploitation

AMayagüez teacher was arrested by Homeland Security Investigations (HSI) agents on criminal charges related to child exploitation conduct, federal prosecutor W. Stephen Muldrow announced Wednesday.
“The accused, who was entrusted by the community to protect and teach our children, violated that sacred trust by attacking a child,” Muldrow said in a written statement. “As this case demonstrates, we will aggressively target those who prey on children.”
“The U.S. Attorney’s Office will continue to work with its law enforcement partners to aggressively investigate and prosecute individuals who exploit minors for sexual purposes,” the official said.
On Feb. 29, a federal grand jury in the District of Puerto Rico indicted Kiara Ramos Meléndez, 29, on one count of coercion and enticement of a minor and one count of receipt of child exploitation material. On Wednesday, the Puerto Rico Crimes Against Children Task Force (PRCACTF), led by the HSI, arrested Ramos Meléndez.
According to court documents, from November 2022 to October 2023, the defendant used her cell phone, as well as internet instant messaging services to persuade and seduce a minor, between 13 and 14 years old, to participate in activities sexual acts and requesting and receiving sexually explicit images of the minor. From November 2022 to April 2023, Ramos Meléndez received sexually explicit images of the minor via WhatsApp.
Rebecca González Ramos, special agent in charge of HSI San Juan, said: “People in a position of public trust have a responsibility to protect the most vulnerable. A teacher is one of the first lines of protection for our minors.”
“Predators do not have a profile, there are [predators in] all genders; it is our job to investigate them all and protect our children,” she said. “HSI is vigilant and we will not allow a single individual to tarnish the name of all the incredible teachers who have a real commitment to teaching and, most importantly, protecting their students.”
If convicted of charges of coercing and inciting a minor to engage in illicit sexual conduct, Ramos Meléndez faces a mandatory minimum prison sentence of 10 years to life, and for receipt of child pornography she faces a mandatory minimum sentence of a five-year prison sentence, up to 20 years, with all counts followed by a period of supervised release after a prison sentence of not less than five years to life in prison. A federal district court judge will determine any sentence after considering the United States Sentencing Guidelines and other legal factors.
Assistant U.S. Attorney (AUSA), Daynelle Álvarez Lora, of the Child Exploitation and Immigration Unit, is prosecuting the case. The case was brought as part of Project Safe Childhood, a national initiative to combat the epidemic of child sexual exploitation and abuse launched in May 2006 by the U.S. Department of Justice. Led by the United States Attorney’s Office and the Child Exploitation and Obscenity Section, Project Safe Childhood marshals federal, state, and local resources to better locate, apprehend, and prosecute people who exploit

COR3 submits 17 infrastructure projects for FEMA grants

The Central Office for Recovery, Reconstruction and Resiliency (COR3) has submitted 17 infrastructure projects totaling $331.8 million through the Federal Emergency Management Agency’s (FEMA) Infrastructure Development and Resilient Communities (BRIC) program.
The projects entail mitigation work in government agencies and municipalities, noted COR3 Executive Director Manuel Laboy Rivera.
“At COR3, we set the goal of submitting proposals under the BRIC program whose value would amount to $250 million, and we managed to exceed that figure despite the short time available to submit them by the February 29 deadline,” Laboy Rivera said. “In our meeting the goal, FEMA recognized the efforts of the COR3 team and the subrecipients to direct and streamline the processes that allowed Puerto Rico to participate for the first time in this federal grant that offers more resources to develop works that provide greater resilience to public infrastructure …”
The BRIC program arises from a national competition that FEMA initiated by making $701 million available to states and territories that have undergone an emergency declaration through the federal Robert T. Stafford Act.
Among the agencies and municipalities that submitted proposals are the Puerto Rico Electric Power Authority, the Department of Natural and Environmental Resources, the Public Buildings Authority (PBA), the Department of Health, the Puerto Rico National Guard, the University of Puerto Rico (UPR), and the municipalities of Aguadilla, Barceloneta, Guánica, Moca, Jayuya and Toa Baja.
For example, the PBA proposal is focused on transforming some classrooms into safe rooms. Meanwhile, other proposals are for microgrid, flood and erosion control projects.
Also under the BRIC program, Puerto Rico presented
two proposals led by UPR’s Mayagüez Campus (RUM by its Spanish acronym) and the Permit Management Office (OGPe) of the Department of Economic Development and Commerce. Both projects will have an additional allocation of total funds reaching $4 million.
Once FEMA reviews the proposals, the RUM will be tasked with establishing a project to educate communities about land stabilization in the event of a landslide. Experts on the subject will guide citizens on how to stabilize the soil through natural resources.
Meanwhile, the OGPe will develop training workshops to raise awareness of planning, land use, and construction regulations.
“We are very grateful to FEMA for their openness and collaboration,” Laboy Rivera said. “This news demonstrates their close collaboration with COR3 and our subrecipients to strengthen Puerto Rico’s infrastructure in favor of the socioeconomic development of our people.”
Once the deadline for submitting proposals has passed, officials will evaluate the projects for the selection process during the third quarter of the year.
BRIC is a federal non-disaster grant program to support states, local communities, tribes, and their nations and territories undertaking risk mitigation projects aimed at reducing the risks they face from disasters and natural hazards. The funds are intended to help state, local, tribal, and territorial governments address future risks from natural disasters, foster greater community resilience and reduce disaster damages.
Guaynabo residents demand hearings on ‘shadow tolls’

Outraged by what they described as government abuse, Guaynabo Sur residents belonging to the organization
No More Tolls in Guaynabo on Wednesday demanded public hearings to put a stop to what
they see as “shadow tolls” on the Martínez Nadal Expressway.
The group also urged Guaynabo residents to avoid paying the invisible double tolls on the expressway.
“Since last year, when we found out about this new attack on our pockets, we demanded
that the Pierluisi government hold public hearings, as mandated by law and as is our right, before implementing this double toll. Thousands of citizens wrote letters in opposition but were ignored,” said Ángel González, spokesperson for the organization. “We took our request to the Guaynabo Mayor’s Office and the Municipal Assembly, hoping they would protect us. We are still waiting for the response.”
He said Rep. Jorge “Georgie” Navarro Suárez and Sen. Nitza Morán Trinidad, and other politicians who are supposed to represent them, have done nothing either.
“They stayed silent and canceled appointments with us,” he said.
About 30,000 vehicles use the Martínez Nadal Expressway daily, generating some $5 million.
Retired engineer Efraín Irizarry noted the lack of signage on the highway.
“It is important that they mark [the area] so that drivers know which exit is before the tolls,” he said. “It is mandated by law.”
The group said the tolls are unfair taxes that affect those who have the least.
“Those who have a Mercedes pay the same as those who have a beat-up car of the kind that Pierluisi detests,” González said. “And in particular, some neighborhoods in the south of Guaynabo have a large proportion of people over 60 years of age and almost 50% in poverty levels.”
González said toll hikes will raise the prices of what Puerto Ricans consume as products are transported by trucks that must pay the tolls.
However, there is a way to avoid the tolls in both directions on the expressway, the group pointed out.
Drivers coming from the north, from San Patricio or Guaynabo in the direction of La Muda, can take the ramp before the toll toward David Urbina Avenue and take the old highway 169 toward La Muda.
Motorists coming from the south, from La Muda or highway PR-1, can take the exit toward Piedras Blancas before the toll, cross the bridge over the expressway, return to the bridge along Avenida David Urbina, and from there enter the expressway northbound.

Haley cedes Republican race to Trump, but does not endorse him

Nikki Haley, the former governor of South Carolina, ended her presidential campaign Wednesday and pointedly declined to endorse her rival, former President Donald Trump. Instead, she told supporters in Charleston, South Carolina, that the effective Republican nominee must earn the backing of her voters.
“It is now up to Donald Trump to earn the votes of those in our party who did not support him, and I hope he does,” she said in brief remarks to her campaign staff, core backers and the gathered news media. “This is now his time for choosing.”
Haley’s announcement effectively ended the Republican primary season, less than two months into it, remarkably early for a contest without an incumbent. It came after she lost 14 of the 15 primaries held on Super Tuesday, making her quest for the White House all but out of reach mathematically.
In increasingly personal terms, Haley, who was Trump’s first ambassador to the United Nations, had painted her former boss as an aging, mentally unsound agent of chaos, unable to respect veterans or service members and unwilling to be faithful to the Constitution.
Unlike virtually every other Republican candidate for president, Haley on Wednesday congratulated but did not back
Trump, despite a pledge to the Republican National Committee that she would support the eventual nominee. She ticked through stark policy differences she has with Trump, attention to the swelling federal deficit, term limits for federally elected officials and a forward-looking foreign policy that includes military aid to Ukraine.
“If we retreat further, there will be more war, not less,” she warned.
But she was most pointed in the tone she wants to see from the nation’s leadership. “We must bind together as Americans,” she said. “We must turn away from the darkness of hatred and division. I will continue to promote all those values, as is the right of every American.”
President Joe Biden, responding to Haley’s decision before Trump did, said, “Donald Trump made it clear he doesn’t want Nikki Haley’s supporters. I want to be clear: There is a place for them in my campaign.”
He added: “On the fundamental issues of preserving American democracy, on standing up for the rule of law, on treating each other with decency and dignity and respect, on preserving NATO and standing up to America’s adversaries, I hope and believe we can find common ground.”
The Republican National Committee, now in Trump’s hands, declared him the presumptive nominee.
Haley can boast of two victories in the first 25 contests of
the nomination season — Vermont and the District of Columbia — the first wins ever for a female Republican candidate for president. But that was enough to win her only 89 delegates to Trump’s 995 — with 1,215 needed to win, a threshold he is likely to reach by March 19.
Even as she amplified her attacks on the former president, she was never able to sufficiently loosen Trump’s grip on the party.
On the Democratic side, Biden swept all 15 states that held Democratic contests, as well as the Iowa caucuses. His one stumble came in American Samoa, a tiny American territory in the Pacific Ocean, where he tied a little-known businessperson, Jason Palmer, for the territory’s delegates, 3-3, according to The Associated Press.
Haley’s campaign did highlight fractures in the Republican electorate — she consistently won enough votes in enough states to raise questions about Trump’s viability in November. But her argument that only she could beat Biden was undercut by polls showing him doing so.
She faced intense pressure from Republican Party officials who feared that a post-Super Tuesday campaign would further divide the GOP and help Biden.
Speaking at his Palm Beach, Florida, home on Tuesday night — before the news that Haley would drop out — Trump did not mention her, instead calling for “unity.”
Haley, at first, was having none of it. Her campaign spokesperson, Olivia Perez-Cubas, fired off a statement saying: “Unity is not achieved by simply claiming, ‘We’re united.’ Today, in state after state, there remains a large block of Republican primary voters who are expressing deep concerns about Donald Trump.”
Behind Haley’s anti-Trump rhetoric over the past few months was a notably cautious and conventional campaign. She repeated her stump speech almost word for word and rarely took questions from voters or the news media.
Ultimately, she failed to stitch together a coalition of Republicans who liked Trump’s policies but had wearied of his baggage, were drawn to her call to return the party to fiscal responsibility and international leadership or were eager to leave the Trump era behind.

In Trump cases, Supreme Court cannot avoid politics

In major cases concerning former President Donald Trump, the Supreme Court has tried to put some distance between itself and politics. That fragile project does not seem to be succeeding.
“If the court is trying to stay out of the political fray, it is failing miserably,” said Melissa Murray, a law professor at New York University.
The case for attempted unity at the court in cases involving the former president is built on 27 data points, or nine votes each in three important rulings, all nominally unanimous. Those rulings suggest that the justices are trying to find consensus and avoid politics.
There were no dissents, for instance, in Monday’s Supreme Court decision letting Trump stay on ballots nationwide despite a constitutional provision that bars insurrectionists from holding office.
Nor were there noted dissents in December, when the court turned away a request from government prosecutors to bypass a federal appeals court and render a prompt decision on Trump’s audacious claim that he is immune from prosecution on charges of plotting to subvert the 2020 election. That could have ensured a trial well before the 2024 election.
And there were, similarly, no noted dissents last week when that case returned to the court after a unanimous three-judge panel of the appeals court soundly rejected the immunity argument. The Supreme Court, after mulling what to do for more than two weeks, decided to keep Trump’s trial on hold while it considers the case, scheduling arguments for about seven weeks later and putting the prospect of a trial verdict before the election in grave peril.
But the unity displayed in the three rulings is fraying.
On Monday, all nine justices agreed with the bottom-line conclusion that states may not bar presidential candidates from their ballots under Section 3 of the 14th Amendment, which prohibits officials who had sworn to uphold the Constitution and then engaged in insurrection

from holding office.
The court should have stopped there, said David A. Strauss, a law professor at the University of Chicago. But five justices, in an unsigned majority opinion, went on to issue a much broader ruling, saying that detailed federal legislation was required to give Section 3 teeth in any setting.
“In fairness to the court,” Strauss said, “they were in a tough spot — they understandably did not want to disqualify Trump, but all the offramps had major problems. Having said that, though, if they were inevitably going to have to write a weak and flawed opinion, maybe they could have written one that got nine votes instead of five.”
In a concurring opinion, the three liberal members of the court — Justices Sonia Sotomayor, Elena Kagan and Ketanji Brown Jackson — seemed puzzled by the majority’s rush to decide matters not before them when nine justices had already found common ground. “We cannot join an opinion that decides momentous and difficult
issues unnecessarily,” they wrote of the majority’s unsigned “per curiam” opinion, which is legal Latin for “by the court.”
J. Michael Luttig, a conservative former federal appeals court judge, called the majority’s broader ruling astonishing and reminiscent of the excesses of the famously liberal court led by Chief Justice Earl Warren from 1953 to 1969.
“The decision is a textbook example of the kind of activist judicial opinions from the Warren court era that begot the conservative legal and judicial movement in the 1980s in first place,” he said.
Pamela S. Karlan, a law professor at Stanford, said the court had done damage to itself by going further than it needed to.
“To my mind,” she said, “the court’s effort to appear apolitical was undercut by the decision of the per curiam majority to go beyond the minimalist rationale of the concurrence — that there are special considerations with respect to
the presidency that counsel against having state courts enforcing Section 3 — that could have gotten Justices Sotomayor, Kagan and Jackson to sign on. And for what?”
Murray had a theory, and it was not one that flattered the court.
“While this decision rejects state authority to invoke Section 3 in favor of Congress’ authority to do so, in the end, the real winner here is the court, which gets to decide when states’ prerogatives matter and when they do not,” she said. “And the beneficiary of the court’s arrogation of power to itself is not just the court, but also Donald Trump.”
The decision in the Colorado case, she added, at least had the virtue of speed. The court granted Trump’s petition seeking review on Jan. 5, two days after he filed it. It scheduled arguments for a month later and rendered its decision a month after that.
Disposing of a significant case bristling with novel constitutional issues in two months was exceptionally quick work by Supreme Court standards.
The immunity case is much simpler and yet is moving much slower. True, the court put it on what it said was an expedited schedule when it got around to addressing the matter 16 days after Trump asked it to put the trial on hold. But that schedule called for arguments some seven weeks after the court acted, during the week of April 22.
Murray said the contrast between the two cases was telling.
“The disqualification case was decided relatively quickly, proving that the court can act expeditiously when it wants to do so,” she said. “The immunity appeal makes clear that the court can also drag its feet when it wants to.”
The delay will matter, Murray said.
“It is very unlikely that the D.C. Jan. 6 trial will proceed — at least in its current form — to a verdict before the election begins in earnest,” she said. “This means that, in addition to giving Trump an actual victory over Colorado in the disqualification case, the court has given Trump the delay he sought — and a de facto victory on the immunity issue.”

Sen. Bob Menendez and his wife, Nadine Menendez, were charged with obstruction of justice in a new federal indictment Tuesday, adding to the wide-ranging bribery and
corruption charges they already face.
Prosecutors accused the couple of trying to cover up a bribe by making it look like a loan.
In the process, they lied to their own lawyers, who in turn inadvertently misrepresented the arrangement to federal prosecutors from the
Southern District of New York, according to the updated indictment.
The new indictment, returned by a grand jury in Manhattan, expands the charges from four to 18, and comes just two months before the Menendezes and two New Jersey business-
people are scheduled for trial.
Federal prosecutors said Tuesday in a letter to the judge, Sidney H. Stein of U.S. District Court, that the new indictment should not affect the scheduled trial date of May 6.

businesspeople — Wael Hana and Fred Daibes — all pleaded not guilty to the earlier charges and are expected to appear for an arraignment on the new counts soon.
The indictment comes just days after a fifth defendant, Jose Uribe, a former New Jersey insurance broker, pleaded guilty to trying to bribe the couple with a Mercedes-Benz and agreed to cooperate with the government’s investigation.
Some of the new charges against Bob Menendez and his wife appear related to information that was provided to the government by Uribe, who in court Friday described getting a message from Nadine Menendez after he first received a subpoena in the case.
He told Stein that they met a few hours later at a Marriott hotel, and they discussed the Mercedes that Uribe had given Nadine Menendez in exchange for the senator’s efforts to disrupt an insurance fraud investigation in New Jersey.
“She asked what was I going to say if somebody asked me about the car payments,” Uribe said in court, according to a transcript of the proceeding.
He then agreed to lie to investigators — and to his own lawyer, he told the judge.
“I knew that giving a car in return for influencing a United States senator to stop a criminal investigation was wrong,” Uribe added, “and I deeply regret my actions.”
Prosecutors said Bob Menendez and his wife hatched a plan to pay Uribe back after becoming aware that they were under investigation. They falsely referred to payments made for the Mercedes as a “loan” in conversations with their lawyers, deliberately mischaracterizing the transaction.
As a result, the indictment charges, Bob Menendez last June “caused his then counsel to make false and misleading statements to the United States attorney’s office for the Southern District of New York.” Two months later, Nadine Menendez did the same, the indictment says.
Bob Menendez, in a statement issued through his lawyers, called the new indictment “a flagrant abuse of power.”
“The government has long known that I learned of and helped repay loans — not bribes — that had been provided to my wife,” the senator said. “Not content — or capable — of meeting those facts fairly at trial, the
government has now falsely alleged a cover-up and obstruction.”
Bob Menendez said the latest charges revealed far more about the government than about him, and that prosecutors were “uncons trained by any sense of justice or fair play.” He added: “It says, once and for all, that they will stop at nothing in their zeal to get me.”
Lawrence Lustberg, a lawyer for Hana, said he was still analyzing the new indictment. “It is, however, stunning to receive such a drama tic alteration of a charging document only two months before trial following an investigation that has lasted for years,” he said.
David Schertler, a lawyer for Nadine Menendez, and César de Castro, a lawyer for Daibes, each had no comment.
Bob Menendez, 70, a New Jersey Demo crat, was charged in September with accepting bribes, including cash, gold bars and a luxury Mercedes, in exchange for lucrative political favors and what prosecutors described as efforts to derail criminal investigations.
Federal prosecutors in Manhattan have since expanded the accusations by filing revised indictments.
In October, Menendez was additionally charged with conspiring to act as an agent of Egypt while also serving as chair of the Senate Foreign Relations Committee. And in January, prosecutors said he had used his power to aid the government of Qatar, a tiny Gulf state and major natural gas exporter that hosted the World Cup in 2022.
The new indictment comes as Stein is considering defense motions to dismiss charges in the case. On Monday, he denied other motions seeking to exclude evidence that the defense argued was the product of unconstitutional searches by investigators.

Bitcoin hits record high, completing a stunning comeback

Bitcoin hit a record high of more than $69,000 on Tuesday, capping a remarkable comeback for the volatile cryptocurrency after its value plunged in 2022 amid a market meltdown.
Bitcoin’s price has risen more than 300% since November 2022, a resurgence that few predicted when the price dropped below $20,000 that year. Its previous record was just under $68,790 in November 2021, as crypto markets boomed and amateur investors poured savings into experimental digital coins.
The cryptocurrency was “pronounced dead for the 150th time,” said Cory Klippsten, CEO of Swan, a financial services firm focused on bitcoin. “And bitcoin continues to do what bitcoin does, which is win people over as they take the time to actually learn about it.”
Bitcoin’s recent surge has been driven by investor enthusiasm for a new financial product tied to the digital coin. In January, U.S. regulators authorized a group of crypto companies and traditional finance firms to offer exchange-traded funds, or ETFs, which track bitcoin’s price. The funds provide a simple way for people to invest in the crypto markets without directly owning the cryptocurrency.
As of last week, investors had poured more than $7 billion into the investment products, propelling bitcoin’s rapid rise, according to Bloomberg Intelligence.
The price of ether, the second-most-valuable digital currency after bitcoin, has also risen more than 50% this year, reaching about $3,800. Its increase has been driven partly by enthusiasm over the prospect that regulators may also approve an ETF tied to ether.
But cryptocurrencies remain volatile. Within a few minutes of hitting the record,

bitcoin’s price dropped to about $67,500.
And despite the euphoria, the crypto industry is still navigating the legal aftermath of the 2022 crash. Sam Bankman-Fried, the disgraced founder of the collapsed FTX crypto exchange, is set to be sentenced to prison at the end of March. The Securities and Exchange Commission has sued several prominent crypto firms, including the U.S. exchange Coinbase, arguing that the companies offer unregistered securities.
Courts have begun weighing in on some of those lawsuits, and the outcome could determine whether crypto companies can continue operating in the United States. Many

skeptics remain unconvinced that digital currencies offer much real-world utility.
“There’s no inherent value,” said John Reed Stark, a former SEC official and an outspoken critic of the crypto industry. “There’s no proven track record of adoption or reliance.”
Bitcoin was invented in the aftermath of the 2008 financial crisis by a mysterious developer using the pseudonym Satoshi Nakamoto. The digital coin was originally envisioned as a decentralized alternative to the traditional financial system, a way for people to exchange funds without relying on banks or other intermediaries.
But as bitcoin’s value increased, it became a vehicle for financial speculation. The currency’s price rose rapidly before falling just as quickly — minting new millionaires one day and erasing their savings the next.
In the early part of the pandemic, a surge in day trading by amateur investors helped turn cryptocurrencies into a hot commodity. The industry promoted itself in splashy magazine spreads and Super Bowl commercials, sending bitcoin’s price soaring.
Within a year, the bubble burst. A series of corporate implosions culminated in
November 2022 with the collapse of FTX. Investors lost billions of dollars as bitcoin’s price plummeted to around $16,000.
The industry’s fortunes started improving in August, when a federal appeals court paved the way for companies to offer ETFs tied to bitcoin. An ETF is essentially a basket of assets broken up into shares. Investors buy shares in the basket, rather than owning the assets directly.
In the crypto world, that means investors can gain exposure to bitcoin without mastering the technical details of a digital currency wallet or entrusting large amounts of money to fly-by-night firms with checkered legal histories. Financial giants like BlackRock and Fidelity are offering the bitcoin investment products, providing a measure of stability to a volatile industry.
For years, crypto advocates predicted that the approval of bitcoin ETFs would bring billions of dollars in new investment to the industry, though some analysts expressed skepticism about those projections.
Early data suggests the impact has been significant. Over recent months, the approval of the investment vehicles has combined with other factors to send bitcoin’s price up.
“During every period when you’re in despair, it looks like crypto and bitcoin will never come back,” said John Todaro, an analyst at Needham who tracks the crypto industry. “But we’ve seen time and time again that it continues to go forward.”
Later this year, the amount of new bitcoin that goes into circulation will decrease because of an event known as “the halving.” The event, which was programmed into bitcoin’s underlying code, will reduce by half the amount of bitcoin that people receive when they run software to validate crypto transactions (a process commonly known as “mining”).
The prospect of scarcer bitcoin supply has helped drive up its price this year, some analysts have argued. And with the halving expected to take place in the spring, bitcoin advocates are predicting that prices will continue to surge.
“This is just the beginning of this bull market,” said Nathan McCauley, CEO of crypto company Anchorage Digital, as prices were skyrocketing this month. “The best is yet to come.”

Powell tees up after megacaps scatter
Alook at the day ahead in U.S. and global markets from Mike Dolan
Wall St stocks’ worst day in almost three weeks sets the backdrop for Wednesday’s congressional testimony from Federal Reserve chair Jerome Powell, with markets starting to get antsy about everything from Trump to Taiwan.
In a packed day for major macro events - including a Bank of Canada policy decision, Britain’s annual budget, key U.S. labor market updates and Super Tuesday primary results - the main market focus was likely to be on Powell’s appearance.
In many respects, Powell and his team have interest rate markets where they want them - and should be comfortable now that the Fed’s December message on modest rate cuts later this year has been heeded at last ahead of its March 20 policymaking meeting.
Tuesday’s soft service sector survey for February did nudge up the amount of easing futures markets are pricing for 2024. But at 88 basis points they remain close to the most recent Fed projections for some 75bps of cuts this year and the first move is still not fully priced until July.
Given that, Powell may not want to rock the boat too much - although he could nod to the risks associated with a re-acceleration of the economy or even warn on recent stock market “exuberance” in the long question-and-answer session that follows his speech on Capitol Hill.
A possible rise in long run “neutral” interest rate assumptions, the pace of the Fed’s balance sheet rundown and election year policy questions may also come in the exchanges.
But, almost as if they were expecting a slap on the wrist, pricey U.S. megacap stocks tumbled on Tuesday ahead of the event - with a variety of reasons cited, from economic and political risks in China to antitrust moves in Europe and the Super Tuesday klaxon on the White House race.
Of the so-called Magnificent Seven of leading stocks, only artificial intelligence poster child Nvidia managed to gain on the day. The S&P500 lost 1% and the Nasdaq 1.7%, although futures clawed back about a third of that ahead of Wednesday’s bell.
In China and Taiwan, where the “Mag 7” revenue exposure is estimated to be close to 20%, the mood remained edgy after annual government plans were outlined by the National People’s Congress on Tuesday. The CSI300 edged lower again overnight, even though Hong Kong recovered some losses.
Strategists puzzled over how a modest 3% budget deficit target would contain enough of a fiscal boost to meet the government’s ambitious 5% economic growth target for the year.
And yet surging defence spending plans and the NPC report’s removal of language about Taiwan that included the phrase “peaceful reunification” were most jarring to those worried about worsening geopolitics.
The prospect of Donald Trump’s possible return to the White House, with promises of 60% tariffs on Chinese imports, will not have eased those concerns much as he dominated this week’s slew of Republican primaries.
On Tuesday, Trump won the Republican votes in a dozen states and brushed aside rival Nikki Haley to all but clinch his third consecutive presidential nomination even in the face of a

litany of criminal charges. Again casting Trump as a threat to American democracy, Biden took the equivalent Democratic party nods and set up what looks to be a re-run of the 2020 election race.
Elsewhere, and possibly partly related to the political uncertainties, gold and bitcoin remained well bid.
Bitcoin suffered vertigo on Tuesday after briefly hitting record highs above $69,000 and retreated sharply in a wild 14% intraday swing. But it was back higher about $66,500 on
Wednesday, even if still shy of the new peak.
Gold prices also breached December’s record peak briefly on Tuesday and held most of those gains today.
The dollar index were lower more generally.
With the Bank of Canada expected to leave its policy rate unchanged at 5% later on Wednesday, the focus will be on the accompanying statement as well as Governor Tiff Macklem’s post-decision interview to see if an all-clear on inflation is forthcoming. Canada’s dollar was steady overnight.
Britain’s pound and government bond yields pushed up ahead of finance minister Jeremy Hunt’s annual budget speech. Despite the fragile state of the public finances, Hunt is expected to offer tax cuts to voters ahead of this year’s election - including a reported 2 percentage point cut in social security contributions.

Aid group says it was turned away by Israeli military as desperation intensi fies

The Israeli military turned back a convoy trying to take 200 tons of food into the northern Gaza Strip on Tuesday, a U.N. agency said, a day after United Nations officials said children in the territory were dying of starvation.
The World Food Program was attempting its first food delivery into northern Gaza since it said Feb. 20 that it had to suspend operations in the region because of Israeli restrictions and a breakdown of civil order among hundreds of thousands of people on the brink of famine.
The convoy of 14 trucks waited for three hours at the Wadi Gaza checkpoint in central Gaza on Tuesday before the Israeli military turned it away, WFP said in a statement. It was rerouted and then was stopped by a “large crowd of desperate people who looted the food,” said the agency, which is part of the U.N.
The turning away of the convoy “was an operational decision by the forces on the ground,” Shimon Freedman, a spokesperson for COGAT, the Israeli agency responsible for coordinating aid deliveries into Gaza, said Wednesday.
The WFP’s deliveries to the north had already been largely halted for three weeks before the Feb. 20 announcement over safety concerns and what it called the absence of a functional system for coordinating with the Israeli military, which has maintained
tight control over aid to Gaza.
At least 20 people, most of them children in northern Gaza, have died in recent days from malnutrition and dehydration, the territory’s Health Ministry said Wednesday.
U.N. officials have called for the system
for delivering aid to be overhauled, after saying for weeks that Israel was continuing to impose excessive delays at checkpoints, interfering with aid missions and outright denying access to northern Gaza as the humanitarian crisis there spiraled. On Tuesday, a group of U.N.-appointed experts said Israel had been “intentionally starving the Palestinian people in Gaza” and violating its obligations under international law, as well as measures it was ordered to take by the International Court of Justice at The Hague
“We have said before: We are alarmed to see an entire civilian population suffering such unprecedented starvation so quickly and completely,” the group said.
The World Health Organization said at least 10 of the child deaths from malnutrition or dehydration happened at the Kamal Adwan Hospital, which its teams were able to visit for the first time since early October over the weekend.
At a news conference Tuesday, the leader of the WHO’s sub-office in Gaza, Dr. Ahmed Dahir, said the team saw at least two other malnourished children at Kamal Adwan and that other patients and health care workers themselves were “barely surviving on one meal a day.”
Russia strikes Odesa during visit by Zelenskyy and Greek leader

Russia launched a strike on the southern Ukrainian city of Odesa on Wednesday while President Volodymyr Zelenskyy and Prime Minister Kyriakos Mitsotakis of Greece were visiting.
Neither was hurt, and they continued their visit of the strategic port city. It is unclear whether the Russian army specifically targeted them, or how close they were to the explosion.
Mitsotakis said at a news conference in Odesa that he and Zelenskyy were visiting the city’s port at the time of the assault. “We heard the sound of sirens and explosions that were very close to us,” he said. “We didn’t have time to go to a shelter.”
Dmytro Pletenchuck, a spokesperson for the Ukrainian navy, said Russia had struck port infrastructure in the city and that five people had been killed.
“You see who we are dealing with,” Zelenskyy said. “They don’t care where they strike, whether they are military, civilians, international guests — it doesn’t
matter to these people.”
Oleksiy Goncharenko, a Ukrainian lawmaker who was in Odesa at the time of the attack, said it occurred around 10:40 a.m. “I heard explosions, I was very close to the port,” he said in a text message. “It was very loud.”
It was not immediately clear what weapons Russia used, but Ukraine’s air force reported the possible deployment of ballistic missiles. Pletenchuk said an investigation was underway.
Russia said its army had launched “a high-precision missile strike on a hangar in the industrial port area of Odesa where preparations were being made for the combat use of unmanned boats of the Ukrainian Armed Forces.”
Ukraine has frequently used sea drones to target vessels of Russia’s Black Sea Fleet. On Tuesday, it claimed to have sunk a patrol ship off the coast of Russian-occupied Crimea. “This is the third Russian Black Sea Fleet vessel sunk in the past five weeks,” Britain’s military intelligence said.
Odesa, a lifeline for the Ukrainian economy, is home to a vast port infrastructure vital to Ukraine’s Black Sea exports. Many vessels depart from the port to ship grain and other agricultural products across the Black Sea.
But for the past six months, Russia has been targeting grain silos and naval infrastructure with drones and missiles.
The attacks have also caused civilian casualties, either from direct targeting or falling debris. Last week, a drone hit a residential building, killing 12 civilians. It took rescue workers several days to pull the bodies from the rubble, including those of babies and children.
Zelenskyy and Mitsotakis on Wednesday visited the site of last week’s attack to pay tribute to the victims, laying bouquets of flowers at a makeshift memorial in front of the building. They also visited a cathedral badly damaged by a previous Russian missile strike.
The Ukrainian leader said at the news conference that Wednesday’s attack “speaks to the fact that we need to defend ourselves first and foremost.”

Too little ammunition, too many Russians: The harrowing retreat from Avdiivka

The fighting had become increasingly ferocious last month at the Zenith air-defense base a mile south of Avdiivka, where for years a company of Ukrainian soldiers had defended the southern approaches to the city.
Russian troops had moved up on their flanks and were pounding them from all sides with tank, artillery and mortar fire, smashing their defenses and wounding men.
“Every day we tried to repel enemy attacks,” said Senior Soldier Viktor Biliak, a 26-year-old with the 110th Mechanized Brigade, who had spent 620 days defending the base. “All the fortifications were being destroyed and there was no possibility to build new ones.”
Soldiers interviewed after their retreat described an uneven four-month battle under a relentless onslaught of Russian artillery and glide bombs that destroyed buildings and broke through deep concrete bunkers. As the Ukrainians took casualties, they became increasingly outnumbered by the Russians assaulting the city, who broke through at two strategic points and quickly seeded areas with fighters.
The fall of the city, when it came in midFebruary, was brutal and fast, occurring in less than a week.
For two weeks, as soldiers warned they could be overrun by Russian forces, commanders told them to keep holding their positions, a delay that cost lives, Biliak said. Some units were crumbling under Russian fire. One company pulled back to the Zenith base after losing its positions.
The final retreat was dangerous and costly, as Russian artillery fired constantly on the roads leading out of the city. Many soldiers died along the way.
The biggest losses came in the center of the city from the heavy Russian aerial bombardment, said Shaman, 36, a commander of the 25th Separate Battalion, who was monitoring his units from a command post. Some brigades lost contact with units under the bombing. A group retreated to a house and were killed when a glide bomb hit it, said Shaman, who like others interviewed identified himself by his call sign for security reasons.
The capture of Avdiivka was the Russians’ most significant gain in nine months and a blow to Ukrainian forces struggling with shortages of ammunition and men.
As they regrouped in the villages and training grounds after their retreat from Avdiivka, Ukrainian soldiers expressed no doubt why they lost the city, a holdout on the eastern
front that had been a target of Russian assaults for 10 years.
“It was the lack of ammunition,” said Shaman, whose battalion was deployed to Avdiivka in October when the Russians began a new offensive against the city. “No question.”
With sufficient artillery, Ukrainian troops could have held the city, he said, by hitting Russian supplies and logistics behind lines, and preventing reinforcements from coming in.
One soldier, Roman, 48, from the Territorial Defense Force, spent three months in Avdiivka with his unit last spring. “It was difficult,” he said. “We did not have support.” The unit was sent in February to help defend the Avdiivka Coke and Chemical Plant, which served as a headquarters for the Ukrainian military on the edge of the city.
He choked up when describing the casualties his unit had suffered in the war. “We had 20 in the unit, eight remain,” he said. Of his company of 86, only 28 were left, he added. There is no official count for Ukrainian casualties in Avdiivka, but commanders said hundreds were likely lost in the city’s fall.
Ukrainian officials say Russian casualties were far higher, as their repeated assaults were met with Ukrainian artillery fire and drone strikes, leaving fields and trenches strewn with bodies and broken armor.
But the Russian troops kept coming and succeeded in reaching the edges of the city from the north and south. By the end of January they were poised to penetrate the residential areas. They broke in at two important places, from the northeast across the railway line, and in the south by tunneling through sewers to attack Ukrainian positions from the rear.
“That was an alarm bell,” Biliak said.
Soldiers at the Zenith base began urging their commanders to request to withdraw, he
said. They were told to wait.
Inside the city Russia was hurling up to 80 to 100 glide bombs, known by the acronym KAB, every day. A single warplane would drop four half-ton bombs, which exploded in quick succession, gouging out massive craters in the earth or flattening multistory concrete buildings.
“When a KAB falls, you wonder whether the concrete will fall on you and they will not be able to dig you out,” a soldier, whose call sign is Patrick, 42, said. “We saw that happen.”
Russian drones were constantly hovering above the roads. A medic, call sign Malyi, 23, was racing out of the city with a wounded soldier one day with a Russian drone pursuing him. The drone miraculously hit the spare tire on the back of the car and bounced off. Malyi and his wounded passenger survived.
“It’s life or death out there,” he said.
By early February, Russian troops were close to encircling the city and cutting the last two roads out. On Feb. 9, Dmytro, 36, the commander of Stugna, a military intelligence unit, was ordered to Avdiivka to help push back the Russian infiltration and secure the main road into the city for the withdrawal of troops.
The unit joined the 3rd Assault Brigade which had arrived a week earlier but they found the Russian troops had spread through the neighborhood so fast that their plans were obsolete before they could use them. “The situation was changing by the hour,” Dmytro said.
Within days of Stugna’s arrival, on Feb. 13, Russian troops seized the main road into the city and began working down a tree line toward a second road to the south, which was the last route out. Already Ukrainian soldiers were driving through heavy fire to bring in
supplies and evacuate the wounded, but thousands of them would be stranded if the Russians seized control of that road.
Nearly surrounded, the men at the Zenith air base finally received orders to evacuate. A first group did not make it, hit by artillery fire. The main group set out on the night of Feb. 15, walking in small groups across the fields in the dark. Biliak led one group but he said they came under shell fire and he never saw the others again.
By dawn several dozen men regrouped by some cottages on the edge of the city. It was foggy, which meant there were no drones flying, and although they had no orders to do so, they continued falling back toward the only road out.)
The Russians made six attempts to seize control of the tree line, Dmytro said, and his units repelled them each time with artillery. But in the end the Ukrainians could not staunch the flow of Russians.
He could send four to eight men as reinforcements, but he said the Russians fielded groups of 30 people at a time. “To stop a group 30 people, you would need 50 shells,” he said. “You need five shells to correct the fire and we can only use 10 shells.”
Nevertheless, Stugna held the road at two junctions and Ukrainian troops steadily withdrew from the city, on vehicles and on foot, mostly under cover of darkness. Biliak caught a ride with other wounded in an armored vehicle in the early hours on Feb 16. The last units from Zenith came out the next day.
But they left six men behind — five wounded men and a helper — who were captured and killed by Russian troops, Ukrainian officials later said. “There were six. Our guys who remained. We should remember there were three times more lying dead and on the road,” Biliak said.
The road led through the fields and was under constant fire. “You could still dash through with vehicles, but most came out on foot,” Dmytro said.
At the chemical plant, the 25th Separate Battalion were the last leave, just before dusk on Feb. 17, heading north on foot.
“There were only 21 of us left to guard the whole plant,” said Staf, 36, a tall soldier with an ill-fitting helmet. “They were coming from three sides,” he said. “They were within firearms’ range,” another soldier said. “They were close enough to throw a grenade.”
The next day, on their seventh attempt, the Russians took the tree line and cut the lower road, Dmytro said. “A day earlier,” he said, “it would have been chaos.”

Venezuela announces election date, with opposition candidate still banned

Venezuelan officials announced earlier this week that national elections that many had hoped would forge a path toward democracy will be held July 28.
But the decision on a date comes a month after the country’s highest court barred the leading opposition candidate from the ballot, leading many to question how free and fair the summer election would be.
Still, the announcement from the government of President Nicolás Maduro is at least a partial fulfillment of a commitment to the United States to hold elections this year in exchange for a lifting of crippling economic sanctions.
In October, Maduro signed an accord with the country’s opposition and agreed to work toward a free and fair presidential vote. In the agreement, Maduro said he would hold an election before the end of this year, and the United States in turn lifted some sanctions as a sign of goodwill.
But just days later, Maduro watched as an opposition candidate, María Corina Machado,

won more than 90% of the vote in a primary election, organized by the opposition and without the involvement of the government. The decisive results emphasized her populari-
ty and raised the prospect that she could beat him in a general election.
Since then, Maduro’s government has declared Machado ineligible to run, over what it claimed were financial irregularities that occurred when she was a national legislator, and arrested several members of her campaign. Men on motorbikes have attacked supporters at her events.
The temporary easing of U.S. sanctions on the oil and gas sector is set to expire April 18, and the Biden administration could choose then to reimpose them.
Tuesday’s announcement “makes it crystal clear that Venezuela will not have free and fair elections this year” and “all but guarantees that the Biden administration will snap back sanctions,” said Geoff Ramsey, a senior fellow for Venezuela at the Atlantic Council, a research institution based in Washington.
Chavismo, the socialist-inspired movement that Maduro heads, has controlled Venezuela for 25 years. Maduro came to power in 2013 after the death of his predecessor, President Hugo Chávez, and he stayed in power
following a 2018 election whose results were widely considered fraudulent. That election was followed by a period of international isolation, in which many countries followed the lead of the United States in refusing to conduct business with Venezuela.
The date of the coming election, July 28, is Chávez’s birthday. The announcement came on the date of his death, March 5.
The choice is probably intended to leverage Chávez’s legacy to bolster the electability of Maduro, who is deeply unpopular, according to Phil Gunson, an analyst with International Crisis Group, who is based in the country’s capital, Caracas.
Opposition candidates have until March 25 to register. It is unclear if Machado’s party will try to insist on her candidacy or if it will look to unite around another candidate.
A fractured opposition will probably be a boon to Maduro’s candidacy.
“The combination of a divided opposition, heavy abstention and weak opponents gives him the best chance of winning without having to commit fraud,” Gunson said.

The new rape denialism

On Oct. 7, Hamas invaded Israel and filmed itself committing scores of human-rights atrocities.
Some of the footage was later captured by the Israeli military and screened to hundreds of journalists, including me. The “pure, predatory sadism,” as Atlantic writer Graeme Wood described it, is bottomless.
Yet Hamas denies that its men sexually assaulted Israelis, calling the charges “lies and slanders against the Palestinians and their resistance.” And Hamas’ fellow travelers and useful idiots in the West, most of them self-described progressives, parrot that denialism in the face of powerful and deeply investigated evidence of widespread rapes, documented most recently in a United Nations report released on Monday.
The interesting question is, why? Why the refusal to believe that Hamas, which butchered children in their beds, took elderly women as hostages and incinerated families in their homes, would be capable of that?
I’ll get to that in a moment, but first it’s worth looking at the forms this denialism takes. One method is to acknowledge, as one recent article put it, that “sexual assault may have occurred on Oct. 7,” but nobody has really proved that it was part of an organized pattern.

Another is to raise questions about various details in stories to suggest that if there’s even a single error, or a witness whose testimony is at all inconsistent, the entire account must also be false and dishonest. A third is to treat anything an Israeli says as inherently suspect.
And finally, there is the point that there are barely any witnesses to the assaults. Where are the women who were allegedly raped? Why aren’t they speaking out?
The answer to that final question is the grimmest: Overwhelmingly, the women who could have spoken out are dead, for the simple reason that any Israeli who got close enough to a terrorist to be raped was close enough to be murdered. As for the credibility of Israeli witnesses, who else — other than the early responders who encountered the victims at first hand — should be interviewed and quoted by anyone investigating this? In the misogynistic courtrooms of Iran, the legal testimony of a woman is worth half that of a man. In the Israel-hating corners of the left, the worth of Israeli witnesses seems to be even lower.
But it’s the first two types of denialism that are in some ways the most shocking, because they are also the most hypocritical.
Wasn’t it progressives who, during the Brett Kavanaugh saga, stressed that occasional discrepancies in the memory of traumatic events are absolutely normal? And since when have progressives insisted that the burden of proof for demonstrating a pattern of sexual assault lies with the victims, most of whose voices have, in this case, been silenced forever?
How quickly the far left pivots from “believe women” to “believe Hamas” when the identity of the victim changes. If, God forbid, a gang of Proud Boys were to descend on Los Angeles to carry out the kinds of atrocities Hamas carried out in Israeli communities, I’m pretty sure no one on the left would devote any energy trying to poke holes in who got raped, much less how or when.
It’s in this ideological climate that we get the U.N. report. In some ways it’s a landmark, if only because the U.N. is never sympathetic to the Jewish state and was
outrageously slow even to notice the early evidence of sexual assaults. For anyone who maintains a reasonably open mind but is still in doubt, the report notes, among other details, “at least two incidents of rape of corpses of women,” “bodies found naked and/or tied, and in one case gagged,” and “clear and convincing information that sexual violence, including rape, sexualized torture and cruel, inhuman and degrading treatment occurred against some women and children” during their time as hostages.
That should be more than enough. It won’t be. A large and expanding corner of the West refuses to accept that Israel’s war in the Gaza Strip is a response to evil, or that Israelis might be victims in any way. It disturbs the narrative of the war in Gaza as a case of strong against weak, the settler-colonialist Israelis against righteous and indigenous victims.
Honest critics of Israel’s policies can raise serious objections while also candidly acknowledging the horrific circumstances that set those policies in motion. What we are seeing instead are dishonest critics, dishonestly disputing those circumstances so they can take aim at the existence of Israel itself.
Serious people should know what an older version of antisemitic denialism was all about: a steady stream of factual nitpicks, logical inversions and rhetorical legerdemain meant to obfuscate and deny the greatest crime in history. They should also understand the aim: that by denying past atrocities, they paved the way for the next ones. Today’s rape deniers are no better than their forebears.

Gabriel García Márquez wanted to destroy

Toward the end of his life, when his memory was in pieces, Gabriel García Márquez struggled to finish a novel about the secret sex life of a married middleage woman. He attempted at least five versions and tinkered with the text for years, slashing sentences, scribbling in the margins, changing adjectives, dictating notes to his assistant. Eventually, he gave up, and issued a final, devastating judgment.
“He told me directly that the novel had to be destroyed,” said Gonzalo García Barcha, the author’s younger son.
When García Márquez died in 2014, multiple drafts, notes and chapter fragments of the novel were stashed away in his archives at the Harry Ransom Center at the University of Texas at Austin. The story remained there, spread over 769 pages, largely unread and forgotten — until Garcia Marquez’s sons decided to defy their father’s wishes.
Now, a decade after his death, his last novel, titled “Until August,” will be published this month, with a global release in nearly 30 countries. The narrative centers on a woman named Ana Magdalena Bach, who travels to a Caribbean island every August to visit her mother’s grave. On these somber pilgrimages, briefly liberated from her husband and family, she finds a new lover each time.
The novel adds an unexpected coda to the life and work of García Márquez, a literary giant and Nobel laureate, and will likely stir questions about how literary estates and publishers should navigate posthumous releases that contradict a writer’s directives.
Literary history is littered with examples of famous works that wouldn’t exist if executors and heirs hadn’t ignored authors’ wishes. On his deathbed, the poet Virgil asked for the manuscript of his epic poem “The Aeneid” to be destroyed, according to classical lore. When Franz Kafka was gravely ill from tuberculosis, he instructed his friend and executor, Max Brod, to burn all of his work. Brod betrayed him, delivering surrealist masterpieces like “The Trial,” “The Castle” and “Amerika.” Vladimir Nabokov directed his family to destroy his final novel, “The Original of Laura,” but more than 30 years after the author’s death, his son released the unfinished text, which Nabokov had sketched out on index cards.

writer’s intentions for the text were unclear, leading scholars and readers to wonder how complete it was, and how much latitude editors took with the manuscript. Occasionally, estates and heirs have been criticized for tarnishing an author’s legacy by releasing inferior or unfinished works in order to squeeze the last bit of intellectual property out of a literary brand name.
For García Márquez’s sons, the question of what to do with “Until August” was complicated by their father’s conflicting assessments. For a while, he worked intensely on the manuscript, and at one point sent a draft to his literary agent. It was only when he was suffering severe memory loss from dementia that he decided it wasn’t good enough.
By 2012, he could no longer recognize even close friends and family — among the few exceptions was his wife, Mercedes Barcha, his sons said. He struggled to carry on a conversation. He would occasionally pick up one of his books and read it, not recognizing the prose as his own.
He confessed to his family that he felt unmoored as an artist without his memory, which was his greatest source material. Without memory, “there’s nothing,” he told them. In that fractured state, he began to doubt the quality of his novel.
“Gabo lost the ability to judge the
book,” Rodrigo García, the eldest of his two sons, said. “He was no longer able to even follow the plot, probably.”
Reading it again years after his death, his sons felt García Márquez may have judged himself too harshly. “It was much better than we remembered,” García said.
His sons acknowledge that “Until August” doesn’t rank among García Márquez’s masterpieces, and fear that some might dismiss the publication as a cynical effort to make more money off their father’s legacy.
“We were worried of course to be seen as simply greedy,” García said.
Unlike his sprawling, lush works of magical realism — epics like “Love in the Time of Cholera” and “One Hundred Years of Solitude,” which has sold some 50 million copies — “Until August” is modest in scope. The English language edition, which comes out March 12 and was translated by Anne McLean, unfolds over just 107 pages.
The brothers argue that it’s a valuable addition to García Márquez’s body of work, in part because it reveals a new side of him. For the first time, he centered a narrative on a female protagonist, telling an intimate story about a woman in her late 40s who, after nearly 30 years of marriage, begins seeking freedom and self-fulfillment through illicit love affairs.
They also tried to change the text as little as possible, and decided not to patch
up the prose or add any phrases that didn’t come directly from García Márquez’s drafts or notes.
Still, some readers and critics may question their choice to release a work that García Márquez himself considered incomplete, potentially adding a disappointing footnote to a towering legacy.
In his native Colombia, where García Márquez’s face appears on the currency and anticipation for the book is high, many in literary circles are eager for anything new by García Márquez, however unpolished. Still, some are wary of the way the novel is being sold.
“They’re not offering it to you as a manuscript, as an unfinished work, they are offering you the last novel by García Márquez,” said Colombian writer and journalist Juan Mosquera. “I don’t believe in the grandiloquence we bestow on it. I think it is what it is — a great commercial moment for the García Márquez signature and brand.”
Colombian novelist Héctor Abad said he was skeptical about the publication at first, but changed his mind when he read an advance copy.
“I was afraid it might be an act of commercial opportunism, and no, it is quite the opposite,” Abad, who will appear at an event celebrating the novel in Barcelona, said in an email. “All the virtues that made the best

There’s no doubt that García Márquez at one point felt the novel was worth publishing. In 1999, he read passages during a public appearance with novelist José Saramago in Madrid. Excerpts from the story were later published in Spain’s leading newspaper, El País, and in The New Yorker. He set the project aside to finish his memoir and published another novel, “Memories of My Melancholy Whores,” which got mixed reviews. He began working on it intensely again in 2003, and a year later, he sent the manuscript to his agent, the late Carmen Balcells.
In the summer of 2010, Balcells called Cristóbal Pera, an editor who had worked with García Márquez on his memoir. She said that García Márquez, who was then in his 80s, was trying to finish a novel, and asked Pera to help him. García Márquez was highly guarded about his works in progress, but a few months later, he allowed Pera to read a few chapters of the novel, and seemed excited about it, Pera recalled. About a year later, his memory faltering, the author struggled to make sense of the narrative, but continued to scribble notes in the margins of the manuscript.
“It was therapeutic for him, because he was able still to do something with a pen and paper,” Pera said. “But he was not going to finish.”
When Pera gently urged García Márquez to publish the book, the author was firmly against it. “He said, at this point in my life, I don’t need to publish anything else,” Pera recalled.
After his death at age 87, various versions of “Until August” were kept at the Ransom Center archives.
Two years ago, García Márquez’s sons decided to take a fresh look at the text. The novel was messy in places, with some contradictions and repetition, they said, but it felt complete, if unpolished. It had flashes of his lyricism, like a scene where Ana, about to confess her infidelity to her mother’s grave, tightens her heart “into a fist.”
Once the brothers decided to publish the novel, they faced a puzzle. García Márquez had left at least five versions in various stages of completion. But he provided a clue about which one he preferred.
“One of the folders that he kept had a ‘Gran OK final’ on the front of it,” García Barcha said.
“That’s before he decided it was not OK at all,” his brother added.
Last year, when they asked Pera to edit the novel, he started working from the fifth
version, dated July 2004 — the one marked “Gran OK final.” He drew on other versions as well, and from a digital document that García Márquez’s assistant, Mónica Alonso, had compiled, with various notes and changes that the author had wanted to make. Often, Pera was confronted with competing versions of a sentence or phrase — one typed, one scribbled by hand in the margins.
Pera tried to correct inconsistencies and contradictions, such as the protagonist’s age — García Márquez wavered on whether she was middle-aged or closer to elderly — and the presence, or absence, of a mustache on one of her lovers.
In constructing the most coherent version they could, Pera and the brothers established a rule: They wouldn’t add a single word that wasn’t from García Márquez’s notes or different versions, they said.
As for the fate of any other unpublished works by García Márquez, his sons say it’s not an issue: There’s nothing else. Throughout his life, García Márquez routinely destroyed older versions of published books and unfinished manuscripts because he didn’t want them to be scrutinized later.
That was among the reasons they decided to publish “Until August,” they said.
“When this book is released, we’ll have all of Gabo’s work published,” García Barcha said. “There is nothing else in the drawer.”

Everyone would hide since the beast would roam around eating people and creating chaos. Until one day someone confronted Nian using red decorations and firecrackers. The next morning the villagers were surprised to discover that there was no damage done in the village. Later they learned that the monster was afraid of the color red and disliked loud noises.

The Chinese New Year, also known as the Lunar New Year or Spring Festival, is a holiday that thousands of people observe around the globe. The festival can fall anytime from Jan. 21 until Feb. 20 since it is based on the lunisolar calendar.
The Chinese New Year is welcomed with the arrival of the new moon; therefore, for 2024 it fell on Feb. 10. Starting on this auspicious day and continuing until the 24th of the month, many activities were performed to replace the bad and the old with the new and good.
Planting, praying to gods and praying to the ancestors as they are also perceived as celestial beings are some of the activities people tend to observe. The family reunions, the food and the exchange of red envelopes with “lucky” money are common practices for welcoming the new year and warmer days.
Wearing red clothing, cleaning the house, taking special baths and even staying in the house for the first five days are other unique Chinese New Year traditions performed by many people around the world. Many of these rituals are linked to folktales and people perform them to attract good luck and wealth, while others practice them to keep the bad energy away.

Compared with South American countries, not many Chinese immigrants have settled in Puerto Rico.
José Lee Borges, a historian whose father was Chinese and mother was Cuban, arrived in Puerto Rico with his family as a child.
“The number of Chinese in Puerto Rico was not a threat because of their small numbers in comparison to Peru or Cuba,” Lee said. “The Chinatowns were created as a way for them to protect themselves. This way they could watch each other’s backs;here in Puerto Rico they spread all around to open different businesses.”
Lee also noted that “we established on the island in the [19]70s.” No formal activities were held for the Chinese New Year, only small gatherings at restaurants or homes among relatives and close friends.”
One tradition he does remember is the lucky money in the red envelopes. As he points out, “it could be 5, 10 or even 20 dollars, since the Chinese are firm believers in the adage that says the more you give the more you receive.”

Can Trout reclaim his place in the sun?

Mike Trout hears the noise: that he is content to play for the Los Angeles Angels; that he does not want to win; that he will not demand a trade. It doesn’t bother him. Quite the opposite, in fact.
“It fuels me more,” Trout said in a recent interview at the Angels’ spring training facility in Tempe, Arizona. “The overall satisfaction, when we do win here, it will be greater than if I did go somewhere else.
“So when I hear, ‘Trout needs to get traded’ or ‘He’s happy to be there,’ they can say whatever they want. I’ve got one thing on my mind. That’s trying to win here.”
Scoff if you must. FanGraphs projects the Angels to finish 78-84 this season, ahead of only the pitiful Oakland Athletics in the American League West.
Trout, 32, is not ignoring the obvious as the team appears destined to miss the playoffs for the 10th straight season. That is why he continues to lobby management for free-agent additions. But he does have one other thing on his mind, something that would help boost the team’s performance.
He wants to return to most valuable player form.
Let’s not forget who Trout is. He finished first or second in the voting for the MVP award seven times in eight years from 2012 to 2019. As recently as 2022, he hit 40 homers in only 119 games. Last season, he had 18 homers before July 3, but played in only one game after that because of a left hamate fracture he suffered fouling off a pitch. He finished with an .858 on-base plus slugging percentage, a career low.
It was Trout’s third consecutive season of missing significant time. In 2021, he did not play after May 17 because of a strained right calf. In 2022, he missed more than a month because of left rib cage inflammation. The injuries, Trout said, prevented him from getting into a proper offensive rhythm, the kind only consistent at-bats provide. “I haven’t been able to get into a stretch,” he said, “where I can be me.”

Trout is not there yet. For now, he continues to take this at his pace, remaining loyal to the team that signed him to what is now the second-largest contract in baseball history, surpassed only recently by Shohei Ohtani’s, his former teammate. When Trout was growing up in Millville, New Jersey, his role model was Derek Jeter, in part because Jeter spent his entire career with the New York Yankees. That is the career path Trout wanted for himself. Still does.
Trout appears to be growing more comfortable publicly expressing his impatience with the team. He at least has admitted to voicing his opinion internally about the need for the Angels to sign free agents, not that Moreno is necessarily listening.
How much will this season affect Trout’s desire to stay?
Trout, though, does not believe he is in decline. As he first told The Orange County Register, he identified a problem in his approach that he said has hampered him for the past year and a half. He is “sliding” into his swing instead of maintaining a strong base.
The effect is evident in his numbers. Trout batted .316 on all fastballs (fourseam, two-seam and cutters) through 2021. That average fell to .285 in 2022 and .254 in 2023. His whiff percentage on fastballs the past four seasons went from 14.1% to 19.1% to 26.7% to 25.9%.
“I don’t know what’s causing it,” he said. “We’re in the cage every day working on it. It feels good in the cage. And then in the game it kind of comes back. It’s a habit I created over time. I don’t know how. I think once we calm that down and get that back right, you’ll see a big difference.”
Trout added matter-of-factly, rather than defiantly, “When I’m in my zone and I feel like I’m in that good spot hitting, I can hit anybody.” His desire to correct his mechanical flaw certainly is not in question. Ron Washington, the
Angels’ new manager and the team’s fifth in seven years, sounds almost alarmed by Trout’s intensity.
“You have to slow him down,” Washington said. “I’m not saying he’s out of control. But he’s out there every day and he’s giving everything he has, to lead as an example. And I just have been trying to tell him, you can still lead. But just slow it down. Don’t burn yourself out.”
Washington said his fear was that the other Angels would try to keep up with Trout’s pace and run out of gas. He said that he advised Trout, an 11-time All-Star, of his concerns and that Trout understood. Still, Trout is hellbent on returning to the player he once was and eliminating at least that aspect of the noise around him.
As for the rest of the noise, well, Trout has seven years and nearly $250 million remaining on his contract. For all the talk of him getting traded, he first needs to restore his value by staying healthy and producing. If that happens and team owner Arte Moreno finally decides to retool, Trout can then wield his no-trade clause and effectively choose
“I wouldn’t say. I’m not trying to predict my future,” Trout said. “I come in with the same mindset every year. I’ve got to stay on the field. I think being on the field, I can make a difference for the club. And the last few years I couldn’t do that.”
What would make him want to move on?
“We got to win,” he said. “I think that’s a big part. I want to win. I’ve said it in an interview a few weeks ago at the beginning of spring, when the trade talks come up, I could go that route. That’s obviously a decision I would have to think about. I haven’t thought about any of that yet. I think the desire to win for this team is bigger than any of that.”
Again, scoff if you must. But Trout’s notion of returning the Angels to glory, however far-fetched, drives him still. One player cannot do it alone. The Angels’ only meaningful additions have been in their bullpen. Still, Trout is healthy again after appearing in fewer than 50% of his team’s games the past three seasons. That, at least, is a start.
He does not simply dream of returning to MVP form. He is convinced it will happen.
“I’m getting chills thinking about it right now,” he said.
