







Former Guaynabo Mayor Ángel Pérez Otero, who is facing trial on federal corruption charges, is willing to plead guilty to some but not to all of the crimes he is being accused of, making it difficult to negotiate a plea bargain with federal prosecutors, his lawyer Osvaldo Carlo said Tuesday.
“He is willing to accept some charges but not all of the brunt of the charges contained in the indictment,” Carlo said in a radio interview (Radio Isla).
After making an initial offer, federal prosecutor Scott Anderson has not come up with other plea bargaining arrangements, Carlo said.
paid. The indictment alleges that Individual A regularly met in secret with Pérez Otero to pay him cash bribes and kickbacks.
While Carlo indicated that his client is open to accepting some degree of responsibility for the charges, Pérez Otero has no information to give prosecutors about other people who have committed crimes of corruption.
“In a negotiation that aspect comes up, but our client has no information. Possibly if that aspect was there, we would have already reached an agreement,” Carlo said. “But he is not and has not been a potential cooperator.”
The former Guaynabo mayor was arrested in December 2021 on charges of conspiracy, soliciting a bribe and extortion. The indictment alleges that Pérez Otero was involved in a bribery conspiracy in which, from late 2019 through May 2021, he received and ac cepted $5,000 cash payments on a regular basis from a person identified as Individual A. In exchange for these payments, the mayor allegedly agreed to obtain and re tain contracts for Company A, a construction company, and ensured that Company A’s invoices were promptly

“That confusion is felt by almost everyone,” he said. “That photo appears as an attachment to a motion filed by the federal prosecutor’s office, to request a higher bail.”
Carlo indicated that the public impact of the photo will be important in the process of selecting an objective and impartial jury, and in fact, it will be included as a question to potential jurors.

The agriculture chief made his remarks as he highlighted the recovery of the island’s farming sector.
Additionally, the DA has granted around $1.2 million in fertilizer incentives for planting and some $1 million for specialized equipment. The grants allow farmers to buy equipment for the construction of hydroponics, for pumps to recirculate water for hydroponics, construction of a sheep ranch, trimmers, warehouse construction, and for chainsaws.
“The DA is the first agency that quickly began to put the money in the hands of the farmers to recover their fields,” González Beiró said.
He emphasized that “we must restore our local pro duction, so we continue to work so farmers can receive all available state and federal aid.”
Meanwhile, the DA also delivered more than 700 box es of bees and 2,500 pounds of supplements for bees so beekeepers can increase production, since crops depend to a large extent on pollination.
The agency also delivered around 4,000 boxes of food harvested by farmers to nonprofit organizations to help the most disadvantaged populations and, in turn, help farmers sell crops that survived.
The Agricultural Insurance Corp. (CSA by its Spanish initials), meanawhile, has already paid out $5 million in claims. It will continue to provide funds until all the in sured are satisfied. In the coming weeks, the CSA projects an additional $4 million disbursement currently in the approval process.
Given the demands of citizens in Salinas this past weekend denouncing the lack of action by Mayor Karilyn Bonilla Colón to stop envi ronmental crimes in the southern coastal municipality, the New Progressive Party (NPP) minority leader in the island House of Representatives, Carlos “Johnny” Méndez Nuñez, along with the former House Speaker José Aponte Hernández, charged inaction on the part of the Legislative Assembly on Tuesday.
The NPP leaders also called for an investigation into the protesters’ allegations that they described as the illegal construction of a gun target range over the southern aquifer.
“The Legislative Assembly initiated an investigation
into illegal construction in the Las Mareas area, within the Bahía de Jobos Estuarine and Research Reserve in Salinas. Several public and on-site hearings were held in the House of Representatives in April and May, yet nothing has happened,” Méndez Nuñez said. “Meanwhile, the Senate announced a similar process and to this day there are no results there either. There is no action on this issue that is so important for the residents of that area, as well as surrounding areas.”
This past weekend a group of citizens painted the street that runs in front of City Hall in Salinas as a sign of protest against what they charged is Bonilla’s lack of action to stop ‘environmental crimes’ in the municipality, including against the southern aquifer, among other natural assets.
There are currently several inves tigative resolutions in the Legislature calling for investigations into the construction of the firing range; however, not a single public hearing has yet been held.

The southern aquifer is a network of drinking water wells that extends from the municipality of Patillas to Ponce. In the case of Salinas, its aquifer begins in the Río Grande de Patillas and culminates in the Nigua River in Salinas. The aquifer occupies a geographic area of around 62 square miles.
The demonstrators also allege that they have not had communication with the mayor, who is affiliated with the
Aponte Hernández stressed that the “legislative investigation on environmental issues is in the same place as that of Mayagüez, nowhere.”
“This is an important issue for not only Salinas, but for all of Puerto Rico,” he said. “There is official documentation that officials, including the mayor, of the Municipality of Salinas knew about these envi ronmental crimes since at least 2013, so the claim of citizens is justified, and even more so when they have no communication with the mayor.”
Three former candidates for mayor of San Juan, Manuel Natal Albelo, Rossa na López León and Adrián González Costa, denounced on Tuesday the lack of rigor with which the Department of Justice handled the referral they presented jointly related to an alleged asphalt scheme involv ing New Progressive Party (NPP) candidates in San Juan and the company JR Asphalt.
Natal Albelo, who ran for San Juan mayor under the Citizen Victory Movement banner in 2020, said in a written statement that “the admissions of Miguel Romero and the other NPP legislators are sufficient cause to appoint an Independent Special Prosecutor and continue the investigation.”
“There is no controversy about these facts: Romero and his henchmen carried out asphalting activities in San Juan communi ties in the middle of the electoral campaign,” he said. “The asphalt, personnel and ma chinery used to carry out the activities were given away by a company whose owners pleaded guilty to bribing and giving illegal commissions to other mayors in exchange for receiving government contracts. The asphalt given away by the corrupt company was not reported by Romero and his NPP henchmen to Government Ethics, the Elec toral Comptroller, or the secretariats of the legislative bodies to which they belonged. The corrupt company competed in bids before the Municipality of San Juan under the municipal administration of Romero and was awarded multiple contracts. While giving asphalt to Romero and his hench men that was supposedly a ‘leftover’ from other projects, the company kept almost $40 million in government contracts. With

Meanwhile, former senator and former Popular Democratic Party mayoral candi date Rossana López León stated that “what was determined by the Justice Department’s Division of Public Integrity and Comptrol ler’s Affairs shows that there is cause, but the officials determined that ‘it is not enough’ to believe that the defendants have engaged in criminal behavior.”
“All of Puerto Rico knows what kind of company JR Asphalt is and the serious corruption cases in which they are currently involved,” she said. “No one believes that JR Asphalt ‘gave away’ material, personnel and equipment to fill holes in San Juan in the middle of the 2020 political campaign. Justice, even in its statement, did not answer the allegations of illegal donations when
the then-senator and now mayor himself accepted it with statements in several media. What is determined by the Department of Justice adds even more to the discredit of the agency before the country.”
As confirmed by the defendants themselves, Romero Lugo, Juan Oscar Morales, Jorge Navarro and Víctor Parés, while serving as public officials and ap pearing as candidates for elective positions, received asphalt, labor and machinery as a “gift” from JR Asphalt, whose own ers pleaded guilty to several corruption crimes at the federal level. The material and services provided by the company were used in activities coordinated and promoted by the accused to pave multiple communities of San Juan during the most recent election cycle. The Department of Justice determined to recommend to the Special Independent Prosecutor Panel that it not appoint a special prosecutor
against the accused, thereby terminating its investigation.
Former San Juan municipal legislator and former Puerto Rican Independence Party mayoral candidate Adrián González Costa said “the determination of the Depart ment of Justice is a dangerous precedent.”
“According to the Secretary, because there was no proof that the asphalt was paid for with public funds and that there was no proof that the defendants had received an offer of bribes, he did not recommend the appointment of a [special independent prosecutor],” he said. “It is an admission that the asphalt was provided for free, but omitting to inquire about the origin of it, for the Secretary, if this asphalt was paid for with private funds, even if it was given to officials, it does not represent a problem. That is not acceptable because of the dan gerous message it sends to the country about tolerance for shady acts. Once again, the already battered image of the Department of Justice is damaged. Our referral was intended to be a tool for the search for the truth and the government’s decision was to hide it. Given the apparent impossibility that these proceedings will be considered before a judge of facts in a court, the People will be the best Judge.”
The former candidates for mayor of San Juan, who together obtained over 60 percent of the votes in the most recent municipal elections, made public the extensive referral they presented to the Department of Justice on May 2, along with all the documentary evidence they collected, including publi cations of the accused on social networks, government contracts, recordings in which the accused admit the facts, among other evidence that the candidates say “confirms the need to continue the investigation.”
Office of Administration and Transformation of Human Resources (OATRH by its Spanish initials) Director Zahira Maldonado Molina announced Tuesday that Gov. Pedro Pierluisi Urrutia has granted leave with vacation compensation on Friday for public employees.
In case employees have accumulated compensatory time, it may be deducted. For those employees who, due to the na ture of their functions or the services provided by the agency, are required to work during the day granted, Friday will be considered a normal day of work.
Maldonado Molina said the agencies excluded from the Human Resources Administration System established in Law
8-2017, as amended, known as the Law for the Administration and Transformation of Human Resources in the Government of Puerto Rico, will be governed in accordance with the current rule of law and/or the internal regulations of their agency.
She added that municipal governments may adopt similar provisions, through municipal ordinance, as provided in the Municipal Code of Puerto Rico, Law 107-2020, as amended.
On Friday, Saturday and Sunday, the Walk & Shop La Calle Fortaleza will take place in Old San Juan. The La Fortaleza Street event is an initiative to promote economic activity in the district along with purchases and consumption in the sections of the street that are still under construction.
The municipal administration of San Juan and Mayor Miguel Romero Lugo are promoting the initiative in conjunction
with La Isleta de San Juan Business and Cultural Development Corp. (CODEVISA by its Spanish acronym) and the Old San Juan Merchants Association (ACOVI) promote the initiative.
The initiative’s objective is to bring visibility to the shops and restaurants on the main street of Old San Juan.
“Fortaleza Street received a consider able investment to improve its conditions,” Romero Lugo said. “As a result, our admin istration has focused, among other things, on promoting various efforts to spearhead
the development of businesses located in the area of construction.”
The Walk and Shop on Calle Fortaleza will include a varied cultural offering in which children can participate in vari ous creative workshops. For example, on Friday, Saturday and Sunday there will be linoleum printing workshops where participants can ink a linoleum plate and create their own graphic print with Old San Juan motifs. From 10 am to 3 pm., there will also be a “frottage” group mural activity in which participants can create
a mural on brown paper, using chalk and cobblestone textures as the background of the mural.
The Music Walk will take place on Friday from 2 p.m. to 6 p.m. and Sunday from 2:30 p.m. to 6 p.m.
In the Plaza de Armas, on Saturday starting at 2 p.m. there will be a craft market, a talent show at 3 p.m., a friends group at 5:30 p.m., and at 7:30 p.m. A Son de Guerra will perform.
On Sunday, a folkloric troupe will perform at 2 p.m.
With Republicans on track to as sume control of the House next year, progressive groups that have been bracing for that prospect for months are rolling out a coordinated campaign to counter the new majority as soon it takes charge in January.
Under the umbrella of an initiative called Courage for America, progressive activists plan to establish a war room, begin media campaigns, hold events in targeted congressional districts and conduct other activities to emphasize what they see as the harms of Republican policies and counter the GOP’s efforts to hamstring and tarnish the Biden administration with a barrage of investigations.
“What Courage for America aims to do is really make sure the MAGA agenda doesn’t get passed without strenuous oppo sition,” said Naveed Shah, a spokesperson and senior adviser for the group, which ex pects to have a seven-figure budget funded by donors who can remain anonymous.
“A big part of this work is making sure that regular people see what is happening and don’t have the wool pulled over their eyes,” added Shah, an Army veteran who is also the political director for Common Defense, an organization of progressive veterans.
The Courage for America effort, just one of the Democratic-allied campaigns springing up after the midterm loss of the House, will focus both on Republican policies on issues including entitlements, immigration, abortion rights, the environ ment and health care and on expected investigations the groups decry as politically motivated.
A new House “accountability war room” supported by Courage for America will be independently run by Zac Petkanas, a veteran Democratic strategist who worked for Harry Reid of Nevada in the Senate and on Hillary Rodham Clinton’s presidential campaign, where he was director of rapid response.
Its new website features a prominent picture of Rep. Marjorie Taylor Greene, the right-wing firebrand from Georgia, along with Rep. Kevin McCarthy of California, the party’s nominee for speaker, and declares that the House GOP “puts power over the freedoms and well-being of American
families.”
“We are committed to holding them accountable for how they choose to wield their considerable new power,” it says.
Petkanas promised an aggressive ap proach and a sharp focus on the members of the new Republican majority, many of whom are little known outside a circle of high-profile far-right conservatives, to educate “the American people on who is acting in their name and what they are trying to do.” He said the group would also provide strategic advice and guidance on the most effective messages to push back on Republicans.
The effort comes as Republicans, who won a historically small House majority last week, toil to overcome their divisions and figure out how to govern. Democrats are primed to do as much as they can to disrupt the delicate balance that McCarthy will have to strike, should he win the speakership, to keep a handle on his fractious ranks.
The new liberal groups intend to work in cooperation with other, more established organizations that are also gearing up for showdowns with the new House majority and believe their experience in monitoring Republicans in recent years will prove an advantage. At the same time, the Biden administration and Democratic lawmakers are preparing for the onslaught, bringing on staff experts, communications specialists and lawyers versed in investigations to help with responding to the Republican efforts.
“We are more ready than I feel we have
been before,” said Lisa Gilbert, executive vice president of watchdog group Public
Citizen, part of an existing coalition called Not Above the Law, which has focused on what it sees as abuse of power by former President Donald Trump and his allies. “We know the playbook in a real way.”
McCarthy’s office did not respond to a request for comment on the emerging campaign. But Republicans are aware that well-funded groups on the left will do what they can to stir opposition to the new majority.
In an appearance Sunday on Fox News, McCarthy made it clear that he would not be deterred from leading an am bitious House majority if he can secure the votes to become speaker, a tall order given opposition to him on the far right and the party’s razor-thin vote margin. He argued that fellow House Republicans should rally around him so they could follow through with their legislative proposals and plans to shine a spotlight on the Biden adminis tration.
landing just out of reach. Fierro started to go for the rifle, he said, but then saw the gunman had a pistol as well.
“I grabbed the gun out of his hand and just started hitting him in the head, over and over,” Fierro said.
As the fight continued, he said, he yelled for other club patrons to help him. A man grabbed the rifle and moved it away to safety. A drag performer stomped on the gunman with high heels. The whole time, Fierro said, he kept pummeling the shooter’s head while the two men screamed obscenities at each other.
When police arrived a few minutes later, the gunman was no longer struggling, and Fierro said he feared that he had killed the man.
Michael J. Allen, the district attorney, said formal charges would likely be filed after the suspect, who remained hospitalized Monday, makes an initial court appearance. Additional charges are possible, Allen said. The suspect is being held without bond.
Court records showed that a public defender is represent ing the suspect. Efforts to reach that lawyer were not successful.
Families of the five fatal victims began sharing tributes to their lost loved ones.
Aston, a 28-year-old transgender man, moved to Colorado Springs two years ago and landed his first job as a bartender at Club Q. Loving, 40, visited Club Q on Saturday night during a weekend trip from Denver, a city to where she had recently moved. A friend described her as “a trans mother” — someone who taught her how to live her day-to-day life. Vance, 22, was visiting the club for the first time with his girlfriend.
Gov. Jared Polis of Colorado ordered flags on all public buildings to be lowered to half-staff beginning on Monday morn ing for five days, one for each of the people killed.

Fierro was at a table in Club Q with his wife, daughter and friends on Saturday, watching a drag show, when the sudden flash of gunfire ripped across the night club. His instincts from four combat deployments as an Army officer in Iraq and Afghanistan kicked in.
He charged through the chaos, tackled the gunman and beat him bloody with his own gun.
“I don’t know exactly what I did, I just went into combat mode,” Fierro, 45, who left the Army in 2013 as a major, said Monday at an interview in his garage, his first since the shooting on Saturday night. “I just know I have to kill this guy before he kills us.”
On Monday, the authorities said they were holding Ander son Lee Aldrich, 22, on suspicion of murder and bias-motivated
crime causing bodily injury, Colorado’s equivalent of a hate crime, for each of the five people killed in the shooting. Chief Adrian Vasquez of the Colorado Springs Police Department identified the victims as Daniel Aston, Kelly Loving, Ashley Paugh, Derrick Rump and Raymond Green Vance.
The number of wounded victims was revised downward by authorities to 18 from 25. Of those people, 17 were shot and one was injured without being shot, officials said. At least 13 injured victims remained hospitalized, spokespeople for two hospital systems said. Fierro said his wife and daughter were recovering from injuries at home. Vance was his daughter’s longtime boyfriend.
The rampage lasted only a few minutes, and the death toll could have been much higher, officials said, if patrons of the nightclub had not stopped the gunman. Vasquez identified Fierro and Thomas James as the people who knocked down the gunman.
“He saved a lot of lives,” Mayor John Suthers of Colorado Springs said of Fierro. The mayor said he had spoken to Fierro and was struck by his humility. “I have never encountered a person who engaged in such heroic actions and was so humble about it.”
When the shooting started, Fierro said he hit the floor, pulling a friend down with him. As bullets sprayed, he saw the gunman move through the bar toward a door leading to a patio where dozens of nightclub patrons had fled. Fierro said he raced across the room, grabbed the gunman by a handle on the back of his body armor, pulled him to the floor and jumped on top of him.

Officials revealed little about the suspect on Monday. He is the grandson of state Assemblyman Randy Voepel of California, according to one of Voepel’s aides, who added that Voepel, a Republican from Santee, California, in San Diego County, would not comment.
Fierro, the Army combat veteran who took down the gun man, was at Club Q with his wife, Jess; their daughter, Kassandra; Vance and family friends to watch one of Kassandra’s friends perform a drag act. It was Richard Fierro’s first time at a drag show. He said he was having fun.
“These kids want to live that way, want to have a good time, have at it,” he said in the interview Monday. “I’m happy about it because that is what I fought for, so they can do whatever the hell they want.”
The fight with the gunman left Fierro covered in blood, he said. When the police arrived, officers tackled him and put him in handcuffs. He said he was held in a police car for more than an hour and screamed and pleaded to be let go so that he could see what had happened to his family.
Fierro, who owns a local brewery, said that on combat de ployments in the Army, he had been shot at and had seen roadside bombs shred trucks in his platoon. His record shows that he was awarded the Bronze Star twice. The experiences of combat still haunt him, he said, and the psychological and physical toll of the deployments were why he left the Army.
He said he never thought he would have to deal with that kind of violence at home.
“I was done with war,” he said.
As climate change makes coastal storms more des tructive, an environmental group is trying a new approach to protecting Hawaii’s coral reefs. It could become a model for defending natural structures around the country — if it works.
The plan involves an urgent sequence of actions that, in theory, will unfold like this:
— Step 1: The Nature Conservancy, a large environ mental nonprofit, takes out an insurance policy for the reefs surrounding the islands of Oahu, Molokai, Lanai, Maui and Hawaii, despite not owning those reefs, which are on public land.
— Step 2: If Hawaii experiences a storm strong enough to damage the reefs, the Nature Conservancy will get a payout from the insurance company within about two weeks. (Compared with most insurance policies, that is the approximate equivalent of light speed.)
— Step 3: The Nature Conservancy will ask the state of Hawaii, which owns the reefs, for a permit to repair the storm damage. Although permission isn’t guaranteed, the odds seem good considering Hawaii doesn’t have the money to do the work itself.
— Step 4: If state officials say yes, the conservancy will use the insurance money to pay teams of divers to start repairing the damage. This stage most closely resembles a race: They have about six weeks, starting from the storm. After that, the broken coral dies, further shrinking Hawaii’s best protection against future storms.
On Monday, the Nature Conservancy, which is based near Washington, D.C., completed the first step and bought a $2 million insurance policy on Hawaii’s coral reefs. It is the first insurance policy in the United States for a natural structure, according to the group, following similar efforts in Latin America. The conservancy says that if the experiment is successful, it will look at expanding the model to other states and include other natural features that shield against storms, such as mangroves, wetlands and coastal dunes.
“We think we can help our Hawaii state government put this into place as a pilot project,” said Makale’a Ane, who leads community engagement and partnerships in Hawaii for the Nature Conservancy. “It’s not simple.”
As governments struggle, insurers see an opening
The Hawaii test sits at the intersection of two trends that demonstrate the difficulty of adapting to climate change. First, the effects of warming are increasingly overwhelming the ability of governments to respond, even in wealthy areas. The problem is not just money but also an inability to adjust quickly enough to overlapping and evolving threats.
Coral reefs highlight that challenge. They act much like sea walls, blunting the destructive force of waves hurtling toward the shore, protecting the people, land and structures behind them. But reef repair isn’t eligible for money from the Federal Emergency Management Agency, even though the work to repair sea walls is. And Hawaii’s Division of Aquatic Resources doesn’t have the budget to restore reefs damaged by storms.
“We cannot do everything,” said Ryan Okano, the division’s program manager for ecosystem protection.
That leads to the second trend in climate adaptation: insurance companies presenting themselves as a solution, offering a suite of products that promise payouts for all sorts of calamities.
Focusing on wind speeds
Still, it won’t be easy.
The money needs to be available quickly in order to be effective, but assessing damage to coral reefs takes time. It can take a week or more after a hurricane for waters to calm down enough for divers to even access reefs safely.
So, instead of depending on a damage assessment, the insurance policy depends on the force of the winds generated by the storm, which is measured in close to real time. Under that approach, known as parametric insurance, a storm with winds of 50 knots (57 mph) or greater leads to a payout.
Wind speeds reflect the force of a storm; the more forceful the storm is, the more likely it is that damage will be done to the reefs. At 50 knots, storm winds are strong enough to cause damage to the reefs, generating large waves that break off pieces of coral or knocking tree limbs and other debris into the water that do further damage.
One of the most recent storms to have winds reach that speed is Hurricane Douglas, which passed close to Oahu in July 2020, said Eric Roberts, senior manager for climate risk and resilience at the Nature Conservancy.
A storm with lower wind speeds could still damage the reefs. But starting insurance coverage at less than 50 knots would have increased the cost of coverage. “The policy that we selected was reasonably priced,” Ane said.
Although healthy coral reefs can usually bounce back after storms, today’s weakened reefs need intervention, said Robert Richmond, a research professor at the University of Hawaii at Manoa who was not involved with the insurance effort.
In Hawaii and around the world, coral reefs have been damaged by a cascade of chronic afflictions. Overfis hing reduces fish species needed to keep the ecosystem in balance. Sediment enters the water when people do things like clear land, smothering corals. Sewage causes destructive algae blooms. Most existentially, climate change threatens to make the oceans too warm and acidic for corals to survive.
‘I’d rather try something and fail’
The importance of coral reefs to Hawaiians cannot be overstated, said Ekolu Lindsey, co-founder of Polanui Hiu, a group that works to monitor and restore a reef off the coast of Maui called Nā Papalimu O Pi‘ilani.
“It’s really that foundation of life,” he said, noting that the coral polyp is the first form of life to emerge in the Kumulipo, a Hawaiian creation chant.
When the Nature Conservancy proposed the idea of reef insurance against high winds to Lindsey, he was intri gued but skeptical.
“I find it difficult to comprehend that the reef gets all busted up, and you’re going to send a bunch of scuba divers down there to glue everything back,” Lindsey said.
If it did work, he wondered, what about tsunamis and swells that tumble coral reefs without high winds? Still, he didn’t see a downside.
“If we need to pilot this thing in the United States,” he said, “I’d rather try something and fail at it than not try at all.”
After two years of regulatory scrutiny and heated speculation in the publis hing world, after a hard-fought court battle and hundreds of millions of dollars in expenses, Penguin Random House’s deal to buy Simon & Schuster officially collapsed ear lier this week.
The unraveling of this agreement stop ped the largest publisher in the United States from growing substantially larger. It also pau sed consolidation in an industry that has been profoundly reshaped by mergers and acquisi tions, with little regulatory intervention.
The implosion of the deal came three weeks after a federal judge ruled against Penguin Random House in an antitrust trial, blocking the sale from going forward on the grounds that the merger would be bad for competition and harmful to authors. In order to appeal the Oct. 31 ruling, Penguin Random House needed Paramount Global, Simon & Schuster’s pa rent company, to extend the purchase agreement, which ex pires Tuesday. Instead, Paramount decided to terminate the deal, leaving Penguin Random House out of legal options and obligated to pay them a termination fee of $200 million.
“Penguin Random House remains convinced that it is the best home for Simon & Schuster’s employees and authors,” Penguin Random House said in a statement. “We believe the judge’s ruling is wrong and planned to appeal the decision, confident we could make a compelling and persua sive argument to reverse the lower court ruling on appeal. However, we have to accept Paramount’s decision not to move forward.”
The outcome of the trial came as a shock to many in publishing, who have watched the number of big firms dwindle to five, even as those five — Penguin Random Hou se, HarperCollins, Macmillan, Hachette and Simon & Schus ter — got larger by buying small and midsize publishing hou ses. Many feared that the further reduction in the number of big publishing houses to four would leave authors and literary agents with fewer buyers for their books and would
make it even harder for smaller publishers to compete.
Many were especially wary of Penguin Random House — already by far the largest publisher in the United States — getting even bigger by absorbing a rival. Penguin Random House has about 100 imprints; together, they publish more than 2,000 titles a year. The merger would have given it Si mon & Schuster’s approximately 50 imprints, as well as the company’s vast and valuable backlist of older titles.
As it turned out, the Justice Department and the judge who heard the case had similar concerns and blocked the deal, an outcome that some authors and industry organiza tions celebrated as a necessary check on consolidation.
“The market is already too consolidated,” said Mary Rasenberger, CEO of The Authors Guild, an advocacy group for writers that opposed the purchase. “A healthy publishing ecosystem is one that has many publishers with different tas tes and interests and degrees of risk they’re willing to assu me.”
This extends a period of uncertainty at Simon & Schus ter, but it is one they are in a good position to navigate. The company’s recent performance has been strong, even as the results have sagged at other major publishers. Its profits for the first nine months of the year were up 29% compared to the same time last year, putting it on its way to a having a record-breaking year.
Among its successes are several novels by Colleen Hoover, who has dominated the fiction bestseller lists, and a surprise bestselling memoir, “I’m Glad My Mom Died,” by Jennette McCurdy, which has sold 1 million copies since it was published in August, the company said.
“Simon & Schuster has never been more profitable and valuable than it is today,” Jonathan Karp, CEO of Simon & Schuster, said in a letter to employees Monday. “As I have
noted before, we will be celebrating our 100th anniversary in April of 2024, regard less of who our owner is — and we will have much to celebrate.”
In a statement released Monday after noon, Paramount indicated that it views Si mon & Schuster as not a good fit for its bro ader strategy. “Simon & Schuster is a highly valuable business with a recent record of strong performance, however it is not videobased and therefore does not fit strategica lly within Paramount’s broader portfolio,” it said.
Until the agreement with Penguin Ran dom House expires Tuesday, Paramount is prohibited from discussing a sale of Simon & Schuster with other suitors. But Paramount is likely to explore a potential sale of Simon & Schuster in the new year, according to a person familiar with the matter, who said the company will hold out for a bid that reflects its improved financial performance and who was not authorized to discuss confidential matters on the record.
The list of suitors could include companies that expres sed interest in Simon & Schuster last time, including French media conglomerate Vivendi and HarperCollins owner News Corp, according to two people familiar with the mat ter who also were discussing confidential matters and spoke anonymously. Simon & Schuster is also likely to garner in terest from financial bidders, according to an executive at a private-equity firm who spoke anonymously to discuss dealmaking strategy.
It’s unclear, however, whether the headache and the legal expense of the trial could dampen the enthusiasm of other publishers. During the trial, executives for two other major publishing houses, Hachette and HarperCollins, testi fied that they would like their own companies to buy Simon & Schuster. It is also unclear how the Justice Department would view such an acquisition. Concerns about market sha re would be less pronounced — particularly for Hachette, which is significantly smaller than Penguin Random House — but the number of publishers big enough to compete on the most expensive books would still drop from five to four.
Some antitrust experts said that any deal to sell Simon & Schuster to another Big Five publisher would probably face intense scrutiny from regulators.
“If somebody else wants to put in a bid, they should put into their calculation, here’s the cost of litigating this with the government,” said Erik Gordon, a professor of business at the University of Michigan.
The end of the deal also signals a period of uncertainty for Penguin Random House. Penguin Random House revea led at trial that it has been losing market share in recent years. It had hoped that buying Simon & Schuster would make up for that slippage. Now, it will have to find another way.
Global stocks and oil prices slipped on Monday as a spike in COVID-19 cases and newly recorded deaths in China prompted authorities in the world’s secondlargest economy to reinstate lockdowns.
Beijing’s most populous district urged residents to stay at home on Monday as the city’s COVID-19 case numbers rose, while at least one district in Guangzhou was locked down for five days.
“It looked like zero COVID-19 was moving in the right direction and everyone was excited but the Chinese govern ment is taking some strong action and in the short term there’s going to be fits and starts,” said Thomas Hayes, chairman of Great Hill Capital in New York.
MSCI’s broadest index of world shares fell 0.91%, while European stocks were down 0.8%.
On Wall Street, all three major indexes were trading lower, led by a selloff in technology, energy and consumer discretionary stocks.
The Dow Jones Industrial Average fell 0.24% to 33,664.66, the S&P 500 lost 0.49% to 3,945.76 and the Nas daq Composite dropped 0.83% to 11,053.73.
Oil prices dropped to their lowest level since early Janu ary on concerns of lower Chinese fuel demand owing to the COVID-19 lockdowns as well as reports that Saudi Arabia and other OPEC members are holding talks on a potential output increase.
Europe is scrambling to wean itself off Russian supplies and build up reserves before the cold winter months, but in vestors reckon the hit to its economy will be huge.
Russia scrapped a Saturday deadline for flows down the Nord Stream pipeline to resume, citing an oil leak in a tur bine. It coincided with the Group of Seven finance ministers announcing a price cap on Russian oil.
The euro slid to $0.9876 in early European trade, the lowest level since 2002, while sterling -- with the British economy also vulnerable to rising gas prices -- dropped half a percent to a new 2-1/2 year low of $1.1444.
“Gas flows have been curtailed even more than expect ed and we have already seen evidence of demand destruc tion weighing on activity,” said Michael Cahill, a strategist at Goldman Sachs.
“We now expect the Euro to fall further below parity ($0.97) and remain around that level for the next six months,” he added.
In what is a huge week for the euro, investors are also preparing for the European Central Bank meeting on Thurs day and markets have priced a near 80% chance of a super sized 75 basis point (bp) interest rate hike.
ECB officials will be keen to see the euro, which has lost around 8% of its value in the past three months, stabilize. That will feed into the desire to try and tame inflation through tightening policy.
Other currencies that tend to perform badly when mar
ket confidence is shaken also fell on Monday. The risk-sensi tive Australian dollar slid 0.5% and was near a seven-week low at $0.6774.
The dollar’s appeal as the go-to currency this year helped it to rise even against safe-haven currencies. The Japanese yen, down at 140.35 per dollar, was under pressure near a 24-year low.
“The first order effect seems to be that the heightened geopolitical risk and consequent adverse global demand
shocks will probably be the effects dominating,” said Vishnu Varathan, head of economics and strategy at Mizuho Bank in Singapore.
“The adverse demand shocks in a very unsavory geopo litical environment are probably going to trigger, and reflect, safe demand for the US dollar ... the European currencies are perhaps going to be the worst hit and on the back foot.
The offshore yuan fell to a new two-year low, with the dollar gaining 0.4% to 6.9543 per dollar, as worries linger over COVID-19 lockdown measures in the country.
China’s southern tech hub of Shenzhen said it would adopt tiered anti-virus restriction measures beginning on Monday, while Chengdu announced an extension of lock down curbs, as the country grapples with fresh outbreaks.
Ukrainian security officers raided a centuries-old Orthodox Christian monastery complex in Kyiv on Tues day, saying they wanted to prevent its use as a center for pro-Russian, subversive activities. The agents scoured the sprawling complex aboveground looking for Russian saboteurs among the clerics and weapons amid the holy relics, even as pilgrims prayed in caves below where the monks are buried. Moscow con demned the move as an attack on the Russian Orthodox Church.
It was unclear if any arrests were made or illegal activity discovered, but the publicly an nounced search appeared designed to send a clear message: Priests who support the Krem lin’s goal of a “Russian world” that includes Ukraine will be found and perhaps punished.
The Kyiv-Pechersk Lavra, also known as the Monastery of the Caves, is a huge complex that is considered one of the holiest Christian sites for both Russians and Ukrainians. It is the headquarters of the Ukrainian Orthodox Church, which until recently had been sub ordinate to the Russian Orthodox Church in Moscow,
The search was a vivid demonstration of the depth of mistrust toward the Ukrainian Or thodox Church, which long pledged its loyalty to the Moscow Patriarch. After Russia’s inva sion in February, the Ukrainian church’s lead ership made a formal break, but government
officials have spoken openly about suspicions that some clergy members are still loyal to Moscow.
Officers of Ukraine’s state security service said in a statement that, together with the po lice and national guard, it carried out “coun terintelligence” activities in the monastery in tended to “counter the subversive activities of the Russian special services in Ukraine.”
Sprawling along the Dnieper River in cen tral Kyiv, the complex encompasses ancient churches, administrative buildings and caves where many revered monks and saints are buried. It is considered the birthplace of mo nastic life in Eastern Orthodox Christianity.
The Rev. Hieromonk Ioan, a member of
the Kyiv monastery, said that the clergy there simply wanted to pray in peace. He said that they were not loyal to the Moscow Patriarch ate but did not shy away from the monastery’s close historic ties with Russia.
“We have certain relations with Russia, and it’s painful for us what is going on now,” he said in an interview outside the monastery after the raid. “Time will show how it will be in the future.
“The most important is that the war is over. We are praying for that,” he said. “For the guilty to be punished and for us to live in peace and not to be afraid of tomorrow.”
Ukrainian security officials said in a sepa rate statement that they had also raided two
Afire swept through a two-story fac tory in central China on Monday, killing 38 people in one of the most deadly fires in the country in recent years.
According to a statement from local officials, the fire started at around 4 p.m. at Kaixinda Trading, a wholesaler that deals in a variety of goods, in Anyang, a city in Henan province known as a hightech development zone that was once an ancient Chinese capital. Teams of rescue workers extinguished the fire by around
11 p.m., state media reported.
On Tuesday, state media attributed the cause of the fire to electrical welding that violated regulations. In a statement released Monday, the Anyang police said they had “placed relevant suspects under control.”
A video shared by state media showed a bright-orange fire raging at the end of a street, as firefighters fastened a hose onto a fire truck and a column of smoke billowed. State media reported Tuesday that the fire had been fueled by the burning of “plastics, cloths, furnitures and medications, among others.”
Kaixinda Trading sells, among other
items, clothing, furniture, chemical prod ucts and industrial equipment. It was established in 2007, according to public records.
The company did not respond to re quests for comment.
In 2013, a fire in a poultry plant in Ji lin province killed 120 people and stirred public outrage over workplace safety concerns. State media outlets reported at the time that doors and windows at the factory had been locked to keep workers from leaving during work hours. Similar accusations were reported after a 1993 fire killed 81 people at a Shenzhen doll factory.
After a factory blast in Jiangsu killed 69 workers and injured hundreds more in 2014, President Xi Jinping ordered an investigation and Li Keqiang, China’s
other monasteries as well as the headquarters for a local diocese, all in western Ukraine.
The Ukrainian church has been slowly as serting itself since the country’s independence in 1991. It received formal autonomous status within the Eastern Orthodox Church in 2019. Since the war started, hundreds of churches have switched allegiance from the Moscow patriarchate to the Kyiv-based church.
Patriarch Kirill I, the leader of the Russian Orthodox Church, is a prominent supporter of President Vladimir Putin’s invasion of Ukraine and has characterized the war as a just de fense of Russian nationalism and a crusade against the spread of liberal ideologies. Pope Francis, the head of the Catholic Church, has urged Kirill not to “transform himself into Pu tin’s altar boy” and instead to work for peace.
Tuesday’s raid prompted a harsh reaction in Russia, with the Kremlin characterizing the move as further proof that Ukraine is “at war with the Russian Orthodox Church.”
“This can be regarded as another link in the chain of military actions against the Rus sian Orthodoxy,” said Dmitri Peskov, the Kremlin’s spokesperson.
Vladimir Legoyda, the spokesperson for the Russian Orthodox Church, called the raid “an act of intimidation” against the only remaining institution “where people both in Russia and Ukraine sincerely pray for peace.”
Ukrainian security services said they had already arrested more than 30 Ukrainian priests working as Russian agents over the course of the war.

In recent years, China has moved to reduce factory accidents and fire regula tions around fire management in dense areas have proliferated.
“Just because there are laws and regulations does not mean there are guar antees” of safety, said Jiang Dining, a fire safety expert and a member of the Chi nese Fire Protection Association.
Jiang called the Henan blaze a “par ticularly serious fire,” a term used in his field for fires that kill more than 30 people or cause 100 million yuan ($13 million) in damage. Monday’s fire was the first in China to claim that many lives in the past years, he said.
Schoolhouses were reduced to skeletal, warped frames, thousands of homes were uprooted from their foundations and an entire village was engulfed by a landslide in the wake of a devastating earth quake in a mountainous region of Indone sia.
The scope of the destruction and aftershocks of Monday’s earthquake that killed at least 268 complicated the ongoing rescue effort in Indonesia’s most populous province, as workers were hampered by blocked roads, power outages and stretched medical resources. Anxious family mem bers awaited news of loved ones, some of whom were trapped in villages with weak phone and internet services. Hospitals were overrun, with the injured being treated out side in makeshift tents.
After being trapped by the fallen bricks of her home, Supartika, 47, was even tually rescued by her husband and neigh bors. She was taken to the hospital hours later, around 8 p.m. Monday, because of the limited number of ambulances.
“I was shocked. It was very sudden,” said Supartika, who like many Indonesians goes by only one name. Her right hand was broken, right shoulder dislocated and leg cut by broken glass. “My house is flat to the earth.”
The full extent of the damage from Monday’s shallow, magnitude 5.6 earth quake remained unclear with more than 1,000 injured and 150 still missing. Most of the dead had been crushed in collapsed buildings. Many were women and children in homes or schools that crumbled when the earthquake struck in the afternoon, Rid wan Kamil, governor of West Java province, said at a news conference.
Supartika was cooking lunch at home when suddenly she felt the earth beneath her convulse.
Her husband had offered to cook but she had insisted on doing it herself, so he went out to scatter fertilizer on their rice fields instead. In an instant, she found her self kneeling in the darkness of her crum pled home, her arms shielding her head from the crush of a wall that had collapsed around her.
“I fainted for a while,” she said. “When I got my senses back, I found myself still un der the debris.”
Earthquakes are a daily occurrence in Indonesia, which sits on the “Ring of Fire,” an arc of volcanoes and fault lines along the Pacific Basin. The landslides that follow can be catastrophic in a country where defor estation for farmland and illegal small-scale gold mining operations have contributed to unstable soil conditions.
The sloping, hilly terrain of Cianjur Regency, an agricultural region that was the epicenter of the earthquake, made it espe cially vulnerable to landslides, said Ridwan, the governor. Damage to homes appeared worse in villages farther out of the city and deeper into the hills, where low-slung, shoddily built dwellings dot the landscape.
President Joko Widodo of Indonesia on Tuesday visited Cianjur, the city closest to the epicenter, pledging to provide aid to victims to rebuild and to improve construc tion standards.
“It’s important to have quake-proof buildings,” he said. “We’re focusing first on opening road access in landslide-affected areas. I’ve instructed that evacuation and
rescue of buried victims be prioritized.”
More than 58,000 residents were dis placed from their homes, according to offi cials. Many of the injured were being treat ed in makeshift tents outside overwhelmed hospitals in Cianjur. Some victims were be ing transferred to nearby regions because of a shortage of medical professionals, Ridwan said.
More than 22,000 homes were dam aged, at least 6,500 of them severely, of ficials said. In the Cianjur area, 13 schools and 10 office buildings were also hit, ac cording to emergency officials.
Around 2.5 million people live in Cianjur, a fertile area of waterfalls and rivers that gets three crops of rice a year compared with the standard two. The regency, cover ing an area slightly larger than Rhode Island, sees frequent flooding, volcanic eruptions and other calamities. On Tuesday, next to a road with traffic inching behind excava tors trying to reach remote affected areas, a yellow sign warned: “Be careful, prone to landslide.”
At the site of a landslide in the remote area of Cugenang, the side of a mountain looked as if it had been cleanly sliced off.
Rescue dogs were sniffing Tuesday after noon for what officials estimated could be dozens of people still buried under mounds of rust-colored soil.
Resna Darmayana, 48, a fried rice seller and a volunteer at the fire depart ment from the nearby city of Bandung, said rescue workers at the site felt at least four strong aftershocks, delaying their efforts because they were required by protocol to stop and stay away from the hills when the tremors occur. The area experienced more than 120 aftershocks since Monday.
Resna said at least a dozen businesses were buried under several meters of soil, and that it would take the rescuers days to clear the collapsed hillside. As dusk neared Tuesday, they located another body, their 13th, an adult man.
According to Indonesia’s Meteorologi cal, Climatological, and Geophysical Agen cy, Cianjur and the areas around it have a long history of destructive earthquakes stretching back more than 100 years, in cluding one in July 2000 that destroyed 1,900 homes.
More than 90% of Cugenang was de stroyed, according to the governor.
One resident, Uus, 40, had returned home on Monday to fix a leaky roof, leav ing his family to manage their roadside eatery during the lunch rush. When the earthquake struck, mud and debris from a nearby hill engulfed the restaurant and sev eral other nearby cafes.
Uus, who also goes by a single name, rushed back to try and save his family. “I screamed out for help,” he said. “I wanted to dig out, but I had no tools.”
“The landslide covered the place. I never thought that hill would collapse,” he added, wiping away tears with a brown sa rong around his neck, his feet and the hems of his trousers still muddy from the frantic aftermath of the previous day.
His wife, three children and sister were all killed.
“Oh God, oh God, all of them died, oh God!” he cried, as an official at the hos pital delivered the news of his lost family members.
“If I knew that earthquake would come, I would have taken my family home too and not left them in the restaurant. Oh God, you took them all,” Uus said.
At the World Cup in Qatar, Iran’s soccer players earlier this week declined to sing their country’s national anthem. In Tehran, two wellknown actresses were arrested over the weekend for defiantly removing their headscarves. And at least nine promi nent Iranians were summoned for ques tioning for daring to criticize authorities.
High-profile Iranians are increasin gly making public gestures of support for the protests that have gripped the country for the past two months, pos ting photos and messages critical of the government on social media or flouting the country’s strict hijab laws.
In perhaps the most dramatic dis play, televised around the world, Iran’s national soccer team stood silently as the national anthem was played befo re a game against England on Monday, while some Iran fans in the stands sang the pre-revolutionary national anthem instead.
Fans carrying pre-revolutionary flags — viewed as a symbol of protest against Iran’s theocratic government — were barred from entering the stadium in Qatar on Monday for the Iranian team’s opening match against England unless they surrendered them. At least one fan held up a “Woman! Life! Free dom!” sign during the match, and some Iranian fans could be heard chanting “without honor” — both slogans adop ted by protesters in Iran to condemn the Iranian regime and security forces.
The displays at the World Cup highlighted the extent to which many prominent Iranians, including artists, musicians and athletes, have publicly come out in support of the protest mo vement.
Anger over the country’s dress res trictions for women and their enforce ment helped fueled the protests. They were sparked by the death of Mahsa Amini, a 22-year-old Iranian Kurdish woman, in the custody of the morality police in September after she was accu sed of violating the law on headscarves. But they have morphed into broader calls to end the Islamic Republic.
Some 15,000 Iranians have been arrested and several hundred killed af ter two months of protests and a heavy
crackdown by authorities in dozens of cities across Iran, according to rights groups.
Many high-profile Iranians, among them musicians, artists and journalists, have been targeted by authorities for coming out in support of the protes ters, in what appears to be an effort to undercut the momentum of the largely leaderless movement.
Two prominent actresses, Henga meh Ghaziani and Katayoun Riahi, were arrested Sunday for removing their headscarves and participating in the protests, according to state-run news media. The actresses were char ged with “collusion with the intention of acting against the state security” and “propaganda against the state,” IRNA, Iran’s state-run news agency, said.
In a statement posted to her perso nal Instagram account Saturday, Gha ziani, 52, denounced the government for its crackdown on the young people who have joined the demonstrations.
“How many children, teenagers and young people have you killed — is it not enough with the bloodshed?” she said in her post. “I hate you, and your historical reputation.
“This may be my last post,” she added.
Ghaziani was arrested the next day, hours after uploading another video, from the streets of Tehran, in which she is seen staring defiantly into the camera
with no head covering before turning her back and tying a ponytail in her hair.
“From this moment on, whatever happens to me, know that I will be with the people of Iran until my last breath,” she wrote in the post, which garnered an outpouring of support and concern over her fate as it coursed through so cial media.
Ghaziani was taken to the prosecutor’s office hours later by se curity personnel, who said that the charges against her included “com munication with opposition and cou nterrevolutionary media,” according to IRNA.
Riahi, 60, who was also arrested Sunday, removed her hijab publicly in mid-September in an Instagram post and for an interview with TV channel Iran International, in which she said she had always opposed the law and was ready “to show the truth.”
Security forces arrested her at her villa in Qazvin, northwest of Tehran, according to the semiofficial news agency Tasmin.
A number of prominent Iranians, including “five movie personalities,” were summoned to the prosecutor’s office Saturday for publishing “unveri fied comments about the recent events, as well as the publication of provocati ve material in support of street riots,” according to the news agency Mizan,
which is owned by the Iranian judi ciary. The agency did not give a total number for those summoned but na med nine people.
One of the people summoned for questioning by authorities in Tehran over the weekend was a former defen der on Iran’s national team, Yahya Gol mohammadi.
Players on Iran’s national team and in its domestic soccer league have re cently become emboldened in sup porting the protests by not singing the country’s national anthem and by de clining to celebrate goals scored. That carried into the World Cup match aga inst England on Monday, which Iran lost, 6-2. There was no celebration by Iranian players after either of their goals.
Speaking at a news conference Sunday, Ehsan Hajsafi, the team’s cap tain, said, “We have to accept that the conditions in our country are not right and our people are not happy.”
“We are here, but it does not mean that we should not be their voice, or we must not respect them,” he added.
Carlos Queiroz, the Portuguese coach of the Iranian national team, told reporters last week that players were free to protest “as long as it con forms with the World Cup regulations and is in the spirit of the game.”
The players find themselves in a difficult position. Displays of activism carry the risk of reprisal from Iranian authorities, especially for players who must return home to play in Iran’s do mestic soccer league.
To show no solidarity with the pro tests could lead to harsh criticism from fans; many do not believe Iran should participate in this World Cup because of the unrest in the country. Some ac tivists had called for Iran to be banned from the tournament. More recently, some fans were outraged when pho tos emerged of the players in frivolous, celebratory poses as children were being killed in the protests.
“Iran is a nation of soccer fanatics, but I think decades from now what Iranians will remember most about this World Cup is not who played well but who showed heart,” said Karim Sadjadpour, an Iran expert and senior fellow at the Carnegie Endowment for International Peace, in a recent email.

There’s typically a grievance against the potatoes: the format, mashed or casserole, whether or not to marshmallow, why is there never enough. Someone has canceled at the last minute; someone nobody invited shows up anyway. At least one child refuses to sit at the kiddie table; the teenagers refuse to put their phones down at whichever table; an uncle insists on watching the football game at the table. The table itself looks nothing like tables on Instagram.
But in recent years, we’ve had particular reason to squabble over the holiday.
For four unforgiving years, from 2016 to 2020, the problem was breaking bread with your political nemeses. Advice columns bristled with agita. No sooner was Donald Trump voted out than we had a new thing — the threat of death — to antagonize the proceedings. With the government urging Americans to stay home, Thanksgiving 2020 was a potential superspreader event extraordinaire — and one reserved exclusively for family members. Were you inviting that great-aunt because you enjoyed her company or because you wanted her dead? Into 2021, the challenge persisted as the vaccinated squared off against the anti-vaxxers, with divided families worried about the full immunological spectrum of their extended entourage.
Also last year and just in time for its 400th anniversary — though one could hardly suggest the issue was new — some raised the pesky question of Thanksgiving’s celebration of genocide. This forced people intent on their pumpkin pie to confront the fact that Thanksgiving is, at root, a commemoration of conquest and subjugation. It is, after all, a day that the United American Indians of New England observe as a day of mourning. The original Native American “helpers,” the Wampanoags, have expressed regret for helping the Pilgrims out in the first place.
Or maybe it all just makes you angry and resentful! What has happened to your cherished American tradition, you wonder? Must everything be problematic?
Nearly every holiday — with the possible exception of April Fools’ Day, but just you wait — has become some kind of political football. The Republican right has been catastrophizing about an alleged war on Christmas for over a decade, though nobody has alerted the pharmacy chains whose aisles are already laden with red-andgreen candy. Meanwhile, one poorly chosen wig on Halloween, fraught with potential cultural offenses, can result in social disaster. Please, let it not be your kid who winds up the wrong kind of Disney character! Also in autumn, Diwali, a major occasion for Indians at home and abroad, has lately become a huge celebration across the United States. But who, some wonder, is allowed to put on a sari?
Ye olden holidays, they are a-changin’. For the past two years, President Joe Biden has issued a proclamation naming the second Monday in October, also known as Columbus Day, Indigenous Peoples Day in order to “celebrate indigenous history and our new beginning together, honoring Native Americans for shaping the contours of this country since time immemorial.” The obvious question there is, what took so long?
So let’s consider the nominees for this year’s chief Thanksgiving gripe: We could make a big deal out of the turkey shortage, for example. Both bird and side dishes have gotten notably more expensive, and with
an impending recession, now really isn’t the time. After a summer of exorbitant and overbooked flights that got canceled just as its passengers straggled out of security, travel this year looks to be particularly crowded and unpleasant. And there’s always contagion to fall back upon. With COVID, respiratory syncytial virus and the flu all going around, a full-fledged gathering should provide ample opportunity to spread ill health.
But would it be a problem to suggest that maybe Thanksgiving not be a problem this year?
Boiled down to its essentials, Thanksgiving is a holiday about shared gratitude. We could just think about the “thanks” in Thanksgiving for a change. That gratitude may have originally been intended toward God and those Native Americans who helped the newly arrived colonists survive — and for whom atonement may have been more appropriate. But even for us secular humanists, Thanksgiving offers a moment to appreciate whatever good this year wrought, even if by accident or chance.
I can think of a few things to feel thankful for. As vexing as this country can be, the midterms ended with a semblance of democracy still intact. The Democrats retained the Senate, striking a necessary blow against insanity. And while Sarah Huckabee Sanders was somehow considered a suitable person to run an entire state, Wes Moore, the accomplished author of five books and a promising leader, was elected to lead another. Elon Musk has sent Twitter twisting and shrieking toward the hellish oblivion where it belongs. Every year, more people seem to recognize the wisdom of spatchcocking their turkeys. And the Little Pie Co., whose sour cream apple walnut pie I’ve been worshipping since high school, now ships nationwide. If nothing else, for many Americans, it’s a fourday weekend. I’ll spend mine grateful for any leftovers.

Torres Montalvo fue multado por el Tribunal Supre mo de Puerto Rico en 2016 por cinco mil dólares al in tentar impugnar el nombramiento de Maité Oronoz Ro dríguez como jueza presidente de la Alta Curia. Torres Montalvo fue candidato a representante por el Partido Nuevo Progresista (PNP).
“La experiencia del licenciado Torres Montalvo a fa vor de los consumidores le hacen la persona idónea para ocupar el cargo de secretario del DACO. Su trayectoria de más de 10 años como abogado, así como su trabajo en la agencia como su pasado asesor legal del DACO, permite que tenga los conocimientos necesarios para

Torres Montalvo tiene un bachillerato en Adminis tración y Finanzas, una maestría en Administración de Negocios y un grado juris doctor, todos de la Universidad Interamericana de Puerto Rico. Durante su incumbencia en la división legal del DACO desde el 2011 al 2012, Torres Montalvo estuvo a cargo de estrategias legales a favor de lo ciudadanos. Desde el 2013, estableció su propio bufete representando clientes del sector público y privado. Tiene experiencia en el derecho corporativo, contributivo y civil, entre otros.
“El dinamismo, la capacidad y la experiencia del licenciado Torres Montalvo harán la diferencia en el DACO”, añadió el gobernador.
Por su parte, el recién designado señaló que “agra dezco al señor gobernador por colocar su confianza en este servidor para dirigir este importante Departamento”.

One evening in 1962, a recent college graduate fresh to New York City took the stage for an open mic night at Gerdes Folk City in Greenwich Village. Her name was Buffy Sainte-Marie.
Like most of the audiences at the folk coffeehouses, the crowd — which that night included another aspiring musi cian named Bob Dylan — was largely white; she was of Cree descent. She strummed a few plaintive chords on her guitar and, in a strong, clear voice that quivered with emotion, ad dressed her listeners in a song called “Now That the Buffalo’s Gone,” which was both a history lesson and an urgent plea for justice regarding concerns such as the recent construc tion of the Kinzua Dam, which had displaced hundreds of Seneca families in Pennsylvania and New York.
“There would be very intelligent New Yorkers sitting there hearing, for the first time, about something that was going on in upstate New York, right in their neighborhood,” Sainte-Marie said last week, on a video call from her home in Hawaii. At 81, the singer-songwriter, who is the subject of an American Masters documentary that debuted on PBS on Tuesday, is full of wit and spry energy; her fingernails were painted a vivid, peacock-feather blue. “When it came to my
songs about Indigenous issues, the smartest people in the room didn’t have a clue. They had no idea that the oldest treaty in congressional archives was being broken in their state.”
But, she added with an irrepressible glint in her eye, “I was singing about it.”
Dylan liked what he heard that night, and he told Sain te-Marie she should start playing at the storied Gaslight Cafe. Her buzzy performances there led to a deal with Vanguard Records; a year later, she released her indelible debut al bum, “It’s My Way!,” which featured “Now That the Buffalo’s Gone,” along with a few other songs that were destined to be covered by countless artists across generations: the sti rring anti-war ballad “Universal Soldier” and the harrowing “Co’dine,” an early and unfortunately still relevant tale of opiate addiction. Plenty more modern standards would fo llow later in her career, including romantic fare such as “Un til It’s Time for You to Go” (Elvis and Priscilla’s wedding song, apparently) and the ’80s pop hit “Up Where We Belong” from “An Officer and a Gentleman,” for which Sainte-Marie won an Oscar — the first ever awarded to a Native Ameri can.
Still, Sainte-Marie said, “It wasn’t about careerism at all.”
“I wanted to write songs that would last for genera tions,” she said. “I didn’t care whether I ever had a hit. I was trying to write songs that were meaningful enough to enough

In one sense, that has certainly happened. Sainte-Ma rie has become incredibly influential to artists of many diffe rent ages and genres: Joni Mitchell, Robbie Robertson, Neko Case, the Indigo Girls, Steppenwolf’s John Kay and classical musician Jeremy Dutcher are all vocal admirers. “She’s a massive bright light and a guide to so many,” Polaris Prizewinning Indigenous musician Tanya Tagaq, who collaborated with Sainte-Marie on a 2017 song, said in a phone interview. “She was that even when she was young, but now that she’s older, it’s almost like she’s laid the foundation to let us raise our voices so that we can be heard.”
But many of Sainte-Marie’s fans also believe she hasn’t quite gotten her due, especially in the United States. Emily Sailers of the Indigo Girls — whose rollicking cover of SainteMarie’s 1992 anthem “Bury My Heart at Wounded Knee” has long been a staple in their set list — said in a phone interview, “To me, she’s a household name.”
“But she didn’t get that career that Dylan or Joni or even Joan Baez and some of the other folk singers of her era did,” she added.
Director Madison Thomas’ lively new documentary “Buffy Sainte-Marie: Carry It On,” though, makes the case
for Sainte-Marie’s continued importance and offers a welco ming primer on Sainte-Marie’s life as a songwriter, performer and activist. Sailers said the timing is fortuitous for a new audience to come to Sainte-Marie’s music: “She started re cording in the ’60s, but we need her now more than ever. I think that people in this country are seeking meaning in their music in a way that they haven’t for a long time.”
Sainte-Marie was born in Saskatchewan and adopted by a white family who raised her in Massachusetts. The only other Indigenous person in town was the letter carrier. “I grew up with real self-esteem problems, real bad self-iden tity problems,” she says in the film, noting that she was also sexual abused as a child. Her mother taught her to dream of an escape. “She made it possible for me to go to college,” Sainte-Marie adds. “She always pointed to the light at the end of the tunnel.”
From the late 1960s on, Sainte-Marie was involved in activism with the American Indian Movement — an associa tion that, although she didn’t realize it at the time, was par tially responsible for her fading impact in the United States. Years later, before an American radio interview, a DJ apo logized to her for pulling her music from his programming in that era. He then showed her a letter, on White House stationery, commending him for having suppressed SainteMarie’s music. She was flabbergasted. A lawyer later helped her get access to an FBI file on her, which was longer than she ever imagined.
“I was having a heck of a time in other countries,” Sain te-Marie said, “and when I came back to the U.S. everything had kind of gone away and my records weren’t played.” It “never occurred” to her that there was a government-sup ported ban of her music. “I just thought, singers come, sin gers go.”
Despite all of the challenges of her life, Sainte-Marie’s infectiously hopeful energy and radiant smile seem imper meable to cynicism and despair. “I don’t like misery of any kind,” she said. “So, if something starts bothering me, I either put up an umbrella or I go inside. I do something about it, because I’m really uncomfortable being unhappy. I try to keep my nose on the joy trail.”

In the Cambrian Period, 500 million years ago, the armored set ruled the seas. Soft-bodied animals secreted a mineral paste that hardened into protective shells of immense strength and deco beauty, some shaped like rams’ heads or eagles’ wings, others like Champagne flutes studded with dagger-sharp spines.
But by the Devonian Period some 70 million years later, most of these brachiopods, briopods and related well-shelled mariners had gone extinct, victims of theft and their own extravagant ways.
As researchers recently proposed in the journal Trends in Ecology and Evolution, the collapse of the brachiopod empire exemplifies a struggle that has defined life from the start: the quest for phosphorus. Scientists have long known that the element phosphorus is essential on many fronts, here holding the DNA molecule together, there powering the cell’s every move. The new report emphasizes yet another way that phosphate — the biochemically useful form of phosphorus — has shaped the course of evolution as an arbiter of nature’s hard parts, its shells and teeth and bones.
“Phosphorus was stolen by the vertebrates, the bony fishes,” said Petr Kraft, a paleontologist at Charles University in the Czech Republic and an author of the new report. “And once this happened, they diversified quickly and took over.” Kraft collaborated with Michal Mergl of the University of West Bohemia.
The research is part of a renaissance of phosphate studies, an enterprise that spans disciplines and time frames. Chemists are exploring how phosphates managed to season the prebiotic broth that gave rise to life in the first place, while materials scientists are manipulating the element into startling new colors and
forms.
“If you heat phosphorus under different conditions, different temperatures, different pressures, strange things start to happen,” Andrea Sella, a professor of inorganic chemistry at University College London, said. “You get red fibrous forms, metallic black forms, purple forms.”
You can also stack up layers of phosphorus atoms and then pull them apart into ultrathin and flexible sheets called phosphorenes, all with the goal of controlling the flow of electrons and light particles on which technology depends.
“We’ve only scratched the surface of what this element can do,” Sella said.
Phosphorus was discovered in the late 17th century by Hennig Brand, an alchemist from Hamburg, Germany, who inadvertently isolated it while seeking the storied “philosophers’ stone” that would transform ordinary metals into gold. Experimenting doughtily with large quantities of the golden liquid he knew best — human urine — Brand emerged with an eerie substance that lacked any Midas touch but did glow in the dark, prompting him to christen it phosphorus, Greek for “bringer of light.”
This pure form of the element, called white phosphorus, turned out to be toxic and flammable and so has been used in warfare, to make tracer bullets, smoke screens and the Allied firebombs that destroyed Brand’s hometown during World War II.
Pure phosphorus does not exist in nature but instead is bound up with oxygen, as phosphate, and this molecular trade union, the phosphorus-oxygen bond, “is central to why biology
works,” Matthew Powner, an organic chemist at University College London, said. The body stores and burns energy by perpetually making and breaking the phosphate bonds found in the cell’s little cash machines, its adenosine triphosphate molecules, better known as ATP. The phosphate recycling operation is so relentless, Powner said, “you basically turn over your body weight in ATP every day.”
Phosphate conjoins with sugar to form the backbone of DNA, holding in meaningful order the letters of genetic information that would otherwise collapse into alphabet soup. Phosphate colludes with lipid molecules to encase every cell in an ever vigilant membrane that dictates what gets in and what must be kept out. Proteins send messages to one another by exchanging phosphate parcels.
One lingering mystery is how early life got hold of phosphate initially. Given how essential phosphate is to every aspect of biology, the primordial watery setting in which the first cells arose must have been rich in phosphate.
“Yet most natural waters on Earth today are pretty lean in terms of phosphate,” Nicholas Tosca, a geochemist at Cambridge University, said. “We had expected the same to be true of the early Earth.” Iron, he explained, was thought to sequester the phosphates away.
Tosca and his colleagues at Cambridge addressed the origin-of-life conundrum in a study published recently in Nature Communications. The researchers decided to revisit the assumption, asking: What about early on, when there was much less oxygen around? Oxygen, they knew, turns iron into a form that tenaciously hoards phosphate. What would happen if oxygen were removed from the equation?
The researchers created artificial seawater in a large oxygen-free glove box and discovered that, sure enough, under those conditions the dissolved iron left most of the phosphate alone, presumably available to any proto-cells in the neighborhood.
In the Trends in Ecology and Evolution paper, Kraft similarly proposed that the Cambrian seas were comparatively glutted with phosphates. Animals could soak up so much, in fact, that they could fashion thick and durable shells, as hard as the hardest tissue in the human body: the phosphatic enamel of our teeth.
“It’s a big advantage to have these shells,” Kraft said. By comparison, the shell of a modern mollusk, made of calcium carbonate, cracks easily beneath a beachcomber’s feet. But as the seas grew crowded and bony fishes appeared, phosphate supplies dwindled, and brachiopods could no longer freely scavenge what they needed to construct their expensive housing.
Bony fishes were judicious in their use of phosphate as a building material: their teeth, a few parts of the skeleton, and that was it. And being mobile, fish could trap whatever phosphate and other nutrients filtered down from land to sea, before they reached the lumbering hard shells below.
The vertebrates had seized control of phosphate, and nothing could stop them now.

This time was not supposed to end like all of the others, with those slumping shoulders, that distant stare, that hollow grimace. Qatar was not supposed to be as bad as Rome, let alone Rio de Janeiro. And, in a way, it wasn’t. It was worse.
Argentina arrived in Qatar with the sole ambition of ensuring that Lionel Mes si’s final World Cup would be remembered as the one which bathed his legacy in the brilliant, golden glow only this tournament can confer. Instead, it must now face the haunting possibility that it will forever be synonymous with one of its darkest humili ations, one of the greatest upsets in tourna ment history.
Losing to Saudi Arabia, 2-1, was not just a defeat; it was an embarrassment, an ignominy, a stigma scarred into Argentine skin in front of 88,000 people, streamed live on television and beamed around the world. By the end, as delirious Saudi sub stitutes swarmed onto thefield, Argentina’s players seemed visibly diminished, their faces drawn, their eyes hunted.
None more so, of course, than Messi. He has worn that look rather more than he would like in recent years; it has be come rather more familiar than might be expected for a player widely considered the greatest of all time.
The sunset of the most glittering career of all has been picked out in no small part in shadow: those traumatic defeats in his final years with Barcelona against Roma and Liverpool and Bayern Munich, the dreaded inevitability of disappointment snatched from the jaws of glory with Paris Saint-Germain against Real Madrid earlier this year.
And after each of them, that same dispirited silhouette — hands on hips, head bowed, eyes downcast as he walks slowly off the field — that he cut when the whistle blew at Lusail, the stadium that will host the final of Messi’s final World Cup next month, and Argentina’s nightmare be came flesh.
If anything, the pain of this will sting more than any of the others. Not just be cause of the opponent: an unheralded and unfancied Saudi team that had been cast
as little more than a sacrificial lamb, ad vised before the tournament to focus more on “enjoying themselves” than winning by Crown Prince Mohammed bin Salman, not a man who seems like the sort to believe that it’s really the taking part that counts.
The real difference, though, was Ar gentina itself. For the first time in years, the country had somehow concocted a national team that was not entangled in an intricate web of neuroses and complexes. Under Lionel Scaloni, the low-key coach who had initially taken the job on a tem porary basis and proved surprisingly good at it, Argentina had fostered a system de signed to provide an older Messi with the support he needed.
In the years before the tournament, it had played 35 games and not lost any. More importantly, it had ended its gener ation-long wait for an international honor, capturing its first Copa América since 1993 in the most satisfying way imagin able: beating Brazil, in Brazil. It had fol
lowed that up by dismantling the European champion, Italy, in a game marketed as the Finalissima.
Argentina had the finest player on the planet — possibly the finest of all time — in a rich vein of form, a supremely gifted supporting cast and a vast army of fans at its back, the streets of Doha thronged with albiceleste jerseys and banners and flags. All of that has been the case for at least three World Cups, of course. The differ ence, this time, was that the team looked self-confident, assured, something close to serene.
It took no more than five minutes to break all of that apart. Argentina had dominated the first half — taking the lead through a penalty won, a little fortuitously, by Leandro Paredes and converted with precious little ceremony by Messi. That was as far as its good fortune ran — a fur ther three goals were ruled out for offside, at least one of them extremely narrowly — but still, as the teams headed inside at the
break, there seemed scant cause for con cern.
Perhaps complacency explains what happened next: Argentina dozing as Saleh Alshehri clipped home an equalizer, and then watching on powerless as Salem Aldawsari danced through three challenges and curled a shot, its parabola picture-perfect, beyond the clawing grasp of Emiliano Martínez.
Saudi’s fans, bused in by the thousand from the border 90 miles away, roared; Ar gentina’s stood, shell-shocked, the ghost of defeat to Cameroon at their shoulder. The players, too, seemed unable to respond; this is not a team that in recent years has had much experience in recovering from set backs.
And so, instead of keeping a cool head, slowly turning the screw on their tiring op ponents, Argentina’s players fretted and fraz zled and chased and hurried. There is a fine line between urgent and frantic, and Messi and his teammates fell firmly on the wrong side of it.
With half an hour to create a single chance for some of the finest forwards on the planet, Argentina generated nothing. Even Messi — a being seemingly hewn from pure, uncut poise — seemed afflicted, rushing his passes, missing his beats, fading from the game as the clock ticked rather than bending it to his will. Perhaps, by now, he has suf fered these indignities enough to sense when one is coming; perhaps he is in tune with the cruelty of fate.
All is not yet lost, of course. Argentina still has two games to avert disaster. Beat Mexico and Poland in the remaining two group games and, on the surface, losing to Saudi Arabia will have done no lasting dam age. That defeat to Cameroon in 1990, after all, did not prevent Diego Maradona from leading his team all the way to the World Cup final. This is not the end of Messi’s tour nament. It may be nothing more than a false start.
In the moment, as Messi and his team mates gathered in a tight bunch in the mid dle of the field, as if huddling together for safety and for security and warmth, it did not feel like that. Instead, it seemed as if something had come undone in the white heat of Lusail’s afternoon sun. This time was supposed to be different. All of a sudden, for Messi and for Argentina, it all felt exactly the same.
Organizers of the World Cup threatened earlier this week to issue a yellow card to any player who wears a rainbow armband at the event, escalating a fight that had begun as a show of support for gay rights but has turned into a showdown between world soccer’s governing body and a handful of Euro pean nations.
Harry Kane, the captain of England’s national soccer team, was expected to be the first player to take the field in a multicolored armband emblazoned with the words “One Love” at this World Cup. Instead he appeared at England’s tournament opener against Iran on Monday wearing an armband bearing the logo of FIFA’s own “No Discrimination” campaign, which was rushed out, ap parently to spoil the “One Love” plans.
The “One Love” armbands were designed to show support for minority groups amid continuing concerns about the treatment of the LGBTQ community in Qatar, where homosexuality is a crime. A group of European soccer federations joined forces and planned to defy the strict uniform rules by FIFA, world soccer’s governing body, and wear them at the World Cup, soccer’s biggest stage.
On Monday, however, the teams said FIFA’s threats of discipline have made that impossible. Its decision to take aim at players in such a direct way at such a high-profile event had little precedent and underlined the tensions it is grappling with in Qatar. Just three days ago, FIFA in furiated a longtime business partner by announcing that beer would no longer be available within the perimeters of all eight World Cup stadiums.
The latest decision will put further scrutiny on FIFA; FIFA’s president, Gianni Infantino; and Qatar, the tourna ment’s host nation. Qatar has been increasingly strident that the event keeps with its traditions and customs. The sale of beer is strictly controlled in Qatar, a conservative Muslim emirate, and homosexuality is a criminal offense.
In discussions over the weekend, the teams had ap peared willing to accept a fine for the uniform violation. But by Monday they faced the new threat, according to a statement released by the seven European teams, includ ing England, Wales and the Netherlands, which played their tournament openers Monday. FIFA, which did not reply to letters sent by the teams in September informing it of their intentions, instead waited until hours before the first games to make its threat to issue a yellow card to players wearing the unsanctioned armband.
Starting a game on a yellow card means a player be gins play at risk of receiving a second during the match. Players can compete with one yellow, but two yellows lead to a red card — resulting in an ejection and then a suspension for the next game.
As a result, the teams said, they had little choice but to ask their players not to risk punishment.
“FIFA has been very clear that it will impose sporting sanctions if our captains wear the armbands on the field of play,” the group of seven teams said in a joint state ment. “As national federations, we can’t put our players
in a position where they could face sporting sanctions including bookings, so we have asked the captains not to attempt to wear the armbands in FIFA World Cup games.
“We were prepared to pay fines that would normal ly apply to breaches of kit regulations and had a strong commitment to wearing the armband. However, we can not put our players in the situation where they might be booked or even forced to leave the field of play.”
The statement was issued jointly by the soccer feder ations of England, Wales, Belgium, Denmark, Germany, the Netherlands and Switzerland.
“We are very frustrated by the FIFA decision, which we believe is unprecedented,” the federations said. On Sunday, FIFA’s meetings with officials from the European federations ended without a resolution and with officials from the nations concerned insisting they would press on. By Monday that resolve had apparently melted away, even though the symbol they had picked to make their point was not quite in the colors of the Pride flag. Their effort appeared to try to thread the needle of meeting the demands of activist groups at home while not infuriat ing their Qatari hosts. But in the end even that was too much.
Oliver Bierhoff, the director of Germany’s team, which opens its tournament against Japan on Wednes day, said FIFA had “escalated” the situation overnight. Germany’s captain, goalkeeper Manuel Neuer, Bierhoff
said, went to bed Sunday “believing he would be wear ing the armband.” Both Neuer and Kane, England’s cap tain, had spoken publicly about their determination to wear the armband.
But it was FIFA that had the final say, once again mak ing an eleventh-hour decision that appeared to benefit the host country, Qatar. Infantino, FIFA’s president, on Saturday rallied to the Gulf country’s defense, outlining why criticism of the country is wrong during nearly an hourlong soliloquy that lashed European countries for what he described as their “hypocrisy” and “moralizing.”
The decision may undercut efforts by FIFA to high light its own role in promoting human rights. For exam ple, before the World Cup in Russia in 2018 it worked with Human Rights Watch to issue a message in support of the rights of women in Iran to attend games in stadi ums, a long-standing ban that largely remains in place. FIFA’s position then was that human rights and women’s rights were not political.
The organization has always tried to steer teams from anything that could be perceived as a political gesture. Its rules on whether there could be on-field penalties ap pear to have been vague enough to embolden the teams to push through with making a statement.
Bernd Neuendorf, president of the German Football Association, said the outcome was “a show of force from FIFA.”
