is the largest of the island’s regional air travel facilities, with more than 1,700 employees and nearly 700,000 passengers during 2022. In addition to the Aguadilla airport’s main terminal, FEMA obligated nearly $3.3 million to repair the Air Rescue Unit and Lufthansa Technik Puerto Rico facilities. Lufthansa Technik specializes in maintenance, repair and overhaul of short and medium-range aircraft. FEMA also obligated over $1.4 million to repair damage at Yabucoa Harbor, a commercial maritime shipping facility located at Playa Guayanés that specializes in storage and distribution of fuel and petroleum derivatives, such as diesel, bunker C, jet fuel and gasoline. This obligation will allow repairs at several structures, including Pier No. 1, the West Wharf, East Wharf and the breakwater area. It provides nearly $31,600 in hazard mitigation repairs to protect against future similar damage. Manuel A. Laboy Rivera, executive director of the Central Office for Recovery, Reconstruction and Resiliency (COR3), noted that “in support of the Ports Authority, COR3 advanced $20.5 million through the Working Capital Advance pilot program for multiple reconstruction projects that will transform the ports and airports infrastructure into a modern and resilient one for the socioeconomic benefit of Puerto Rico.”

he Federal Emergency Management Agency (FEMA) has awarded $54 million to the Puerto Rico Ports Authority for repairs at regional airports and shipping docks, a press release said Tuesday. FEMA has awarded Ports nearly $174 million for permanent work projects at various air and sea transportation facilities throughout Puerto Rico, the press release noted. The obligation will allow repairs at the Puerto Nuevo Seaport, Yabucoa Harbor, Rafael Hernández International Airport in Aguadilla and José Aponte de la Torre Airport in Ceiba. Funding includes more than $4.6 million to cover hazard mitigation work at each site, adding strength and resiliency to permanent work to prevent similar damage from future events. The Puerto Nuevo Pier is one of the busiest on the island, with more than 30,000 containers or nearly 300,000 tons of merchandise imported every month by local and U.S.-based shipping companies. In the case of the Puerto Nuevo seaport, over $27.8 million will fund construction at six loading docks, the port’s main roadway, and the Trafon Building -- a twostory, corrugated metal warehouse that serves as one of the main storage facilities for perishable food items. Nearly $2.8 million is earmarked for hazard mitigation work, including strengthening metal rooftops, improving exterior metal panels, and installing anchoring systems and impact-resistant windows. Meanwhile, José Aponte de la Torre Regional Airport, located in the former Roosevelt Roads Navy base in Ceiba, was awarded nearly $16.5 million in public assistance funds to repair its main terminal, pilot school, storage facilities and hangars. This amount includes about $800,000 for hazard mitigation repairs to prevent or reduce future damages from similar events. Fiscal board welcomes new PPP that will leave bankrupt PRHTA debt free By THE STAR STAFF

T

he Financial Oversight and Management Board on Tuesday welcomed a proposed new public-private partnership with the Spanish firm Abertis Infraestructuras to operate four toll roads as it will leave the Puerto Rico Highways and Transportation Authority (PRHTA) debt free. The oversight board said it reviewed and approved the proposed concession agreement, a critical element to improve Puerto Rico’s roads by providing a clear incentive for more efficient maintenance of toll roads and significant new funding for investments in non-toll roads. PR Tollroads, a subsidiary of Abertis Infraestructuras SA, will pay the PRHTA a concession fee of about $2.85 billion, considerably more than the minimum Public-Private Partnership Authority (P3A) had required under its request for proposals (RFP) from all bidders. The concession fee will enable the PRHTA to pay off its roughly $1.6 billion outstanding debt, including a loan of approximately $360 million from the island government, under

National Guard endorses creation of strategic diesel reserve By THE STAR STAFF

he Puerto Rico National Guard (PRNG) endorsed on Tuesday the creation of a strategic diesel reserve on the island as a measure to mitigate the effects of supply chain disruptions caused by the impact of a major storm. “Yesterday the Senate received the first report of Resolution 659, which orders the Innovation, Telecommunications and Infrastructure committees and the government to investigate the feasibility of creating a strategic diesel reserve for the purpose of having sufficient supplies during an emergency,” said Sen. Keren Riquelme Cabrera, author of the bill. “In that report, the PRNG endorsed the creation of this reserve, which we believe is of great importance to our people.” The resolution also calls for the investigation of the location, capacity and construction of the reserve, along with access to federal funds, and that it be administered by the Puerto Rico Energy Bureau and the Public Safety Department, and

that its distribution be coordinated by the National Guard. “In this first report, it is highlighted that the reserve is something viable and necessary because one of the great problems that the island faces every time it is hit by an atmospheric phenomenon is the high demand for diesel, since this fuel is used by most of the emergency electrical generators in hospitals, stores and government centers, among others,” the at-large senator said. “During a regular period, this is a fuel that doesn’t have as much output, in contrast to gasoline or gas; however, in an emergency, the use of diesel increases dramatically.” Last year, Riquelme proposed the creation of a strategic diesel reserve just like those in the states of Texas and Louisiana. A network of several tanks can be underground -- depending on the final study -- where a sufficient volume of fuel can be stored to meet a high demand for a period of up to 60 days. According to data provided by fuel retailers in Puerto Rico, diesel sales in normal periods represent 20 percent of total

fuel sales, between 160,000 and 175,000 million gallons each year. This, coupled with the fact that the fleet of tanker trucks that transport the fuel to its destination is relatively small compared to the refined gasoline fleet, means that in times of crisis the real possibility of a shortage arises.

Sanabria Baerga, 47, a resident of Salinas, was driving a 2019 Ford F150 vehicle when he had a health problem, invaded the opposite lane and collided head-on with a heavy vehicle, a Kenworth Contract T-80, driven by Josean Colón,

33, of Cidra. Sanabria Baerga suffered serious injuries and, after being stabilized at the Menonita Hospital in Guayama, was transferred to the Río Piedras Medical Center, where he remains in delicate condition. Currently, the company operates and manages the PR-22 and PR-5 toll roads and the Teodoro Moscoso toll bridge. For years, the PRHTA has faced administrative, operational and fiscal challenges -- including debt, funding restrictions and shrinking budgets -- that have made it difficult to carry out effective planning for toll roads, maintain them in a state of good repair and provide a reliable road network. The situation has resulted in old and deteriorating infrastructure that is not up to par with the operational standards of the road and highway industry. While new roads, lighting and other maintenance features sound promising, the sum involved is not small, and Abertis will have to recover its investment somehow. “Half of the money will be covered by Abertis’ own capital, while the other half will be financed with the help of 11 banks which will be local financing,” Metropistas CEO Julián Fernández Rodes said. And what does that mean for drivers? The government has already formulated a fiscal plan that will inevitably continue to impact toll rates. Will the new PPP have a further effect on the already established hikes that will occur? “Toll prices will inevitably continue to rise because of inflation,” Pierluisi said. “In the past there have been raises to the toll prices, and they will happen in the future depending on the inflationary cost of living. In terms of Abertis, it’s the same thing; the income created by these tolls will be directed straight to Abertis. The government will not have any participation in that.”

Over $93 million in credit payments issued for low-income seniors, pensioners By THE STAR STAFF

ov. Pedro Pierluisi Urrutia, along with Treasury Secretary Francisco Parés Alicea, announced earlier this week the disbursement of $93 million in payments corresponding to the credit for people 65 years of age or older and for low-income pensioners. The period for requesting the credit for the 2022 tax year through the Unified Internal Revenue System ended Monday. “Just hours before the end of the period to request the senior loan, we have fulfilled our commitment to send payments in an agile and timely manner to 191,499 older adults,” the governor said in a written statement. “This represents a disbursement of $93,036,600, of which $91,416,000 corresponds to the credit for people over 65 years of age and $1,620,600 to low-income pensioners.” Parés Alicea meanwhile highlighted that as of Monday, 207,019 forms had been received since the filing period began in July.

“We have been efficient in processing applications and disbursing payments and we have already completed 92.5 percent of the total forms filed,” he said. Last year on the same date, the Treasury Department had received 202,472 applications and approved 183,652 forms for both credits, which represented disbursements of $89,999,000. People who, as of the last day of the taxable year, are 65 years old or older qualify for the senior credit provided their aggregate annual income does not exceed $15,000.The personal compensatory credit is $400, since the Treasury Department met the net income test to the General Fund, established in the Internal Revenue Code. In the case of married people, each spouse was entitled to claim the senior credit, as long as the aggregate income did not exceed $30,000. Pensioners from the Government Employees’ Retirement Systems Administration, the Teachers’ Retirement System, the University of Puerto Rico, the Puerto Rico Electric Power Authority and pensioners from the private sector were able to opt

esident Commissioner Jenniffer González Colón reported Tuesday that during the most recent quarter, from July to September, she raised more than $875,000, positioning her with more than $1 million in cash for her gubernatorial election campaign. The report filed with the Federal Election Commission (FEC) by the campaign of the New Progressive Party (NPP) vice president, and now gubernatorial candidate, clearly demonstrates that “the campaign is achieving and exceeding the established collection goals,” said Oriol Campos, treasurer of González Colón’s campaign. “In this way, we will be able to bring to the people the mes-

sage of a change of vision that Jenniffer has so that public affairs are handled with the urgency that our people demand,” he said. The sum raised in the most recent quarter was the largest raised by González Colón in a quarter for any of the political offices for which she has been a candidate in the past. The amount raised was added to what already existed in the bank account, exceeding $1 million. In compliance with federal and state rules and regulations, $750,000 was transferred from that federal account to the new gubernatorial campaign account, with additional transfers coming soon. “Jenniffer is extremely grateful for the strong support she continues to receive from the people. Jim Jordan loses first vote to become speaker By LUKE BROADWATER

R

ep. Jim Jordan, the right-wing Republican hard-liner from Ohio, lost his first bid to be elected speaker Tuesday, prolonging a two-week fight that has paralyzed the chamber and shone a spotlight on deep GOP divisions. Jordan, the combative co-founder of the ultraconservative House Freedom Caucus and a close ally of former President Donald Trump, fell 17 votes short of the majority he would have needed to prevail, despite a right-wing pressure campaign to win the support of mainstream Republicans who opposed him. The group of GOP holdouts was larger than previously known and included some powerful members of the House, including Rep. Kay Granger of Texas, the chair of the Appropriations Committee, and several Republicans from politically competitive districts won by President Joe Biden. Following the vote, Republicans immediately called a recess to allow them to regroup and chart a path forward. Before the vote, he said he was willing to force multiple rounds — “Whatever it takes to get a speaker today.” And with his opponents’ names now on the record, right-wing activists were planning to bombard them with calls. Democrats were united in voting for Rep. Hakeem Jeffries of New York, the minority leader. Rep. Pete Aguilar of California, the No. 3 Democrat, delivered a blistering speech against Jordan, accusing him of “inciting violence on this chamber,” a reference to the Jan. 6, 2021, assault on the Capitol — re-

He was once a right-wing rebel on the fringe of his party who was described as a “legislative terrorist” by a former Republican speaker. His ascent is the clearest indicator yet of how far House Republicans have moved to the right and shows the strength of Trump’s grip on the party. Rep. Elise Stefanik, R-N.Y., who formally nominated Jordan on the floor Tuesday, praised his bruising style. “Whether on the wrestling mat or committee room, Jim Jordan is strategic, scrappy, tough and principled,” she said. Jordan, 59, is a close ally of Trump, with whom he speaks frequently. He played a key role in helping the former president plan his efforts to use Congress to overturn the 2020 election on Jan. 6, 2021. Since then, he has been a leading defender of Trump on Capitol Hill, using his committee to try to intervene in the various legal cases against him. Jordan is also a co-leader of the impeachment inquiry against Biden that Republicans are pursuing in the absence of any evidence linking him to high crimes or misdemeanors.

onathan Nez, a former president of the Navajo Nation, will run as a Democrat for a congressional seat in Arizona — a bid that could make him the first Native American from the state to be elected to the House. The seat, in Arizona’s 2nd District, is now held by Eli Crane, a first-term lawmaker who was among the small group of Republicans who voted to oust House Speaker Kevin McCarthy this month. Nez announced his candidacy in a video posted Monday on X, the social media platform formerly known as Twitter. “I grew up in a rural, low-income home without electricity or running water,” Nez said in the video. “I understand the struggles that 2nd District families are facing right now, from the rising costs of food, gas and child care to increasingly devastating wildfires and health care deserts.” The sprawling district, which is larger than several states, includes 14 of the 22 federally recognized tribes in Arizona. But it leans more Republican after redistricting last year. Nez, 48, who lives in Flagstaff, Arizona, led the Navajo Nation, one of the largest federally recognized tribes

in the country, from 2019 to 2023, a period marked by an enrollment surge during the pandemic. But last fall, he lost his bid for reelection as president of the tribe, a group that tilts Democratic. Crane, 43, a former Navy SEAL and a contender on “Shark Tank,” won a crowded Republican primary last year in the district, aided by an endorsement from former President Donald Trump.

His arrival on Capitol Hill was hardly low key. At the beginning of the year, he was one of the notable holdouts among a group of right-wing Republicans who opposed McCarthy’s election as speaker, voting against him 14 times until McCarthy garnered enough votes on the 15th ballot. He voted “present” on the final ballot. That intraparty fight played out again this month, when Crane cast his vote to oust McCarthy. Families separated at border by Trump reach settlement By MIRIAM JORDAN

L

awyers representing thousands of families separated at the southern border during a Trump administration crackdown have reached a settlement with the federal government that enables the migrants to remain in the United States and apply for asylum, putting them on the path to permanent legal residency. The agreement, filed Monday in federal court in San Diego, concludes years of negotiations that were part of a class-action lawsuit to address the harm inflicted by family separations carried out in 2017 and 2018. The policy was a key component of the Trump administration’s efforts to curb unauthorized immigration. Children were systematically taken from their parents and sent to shelters and foster homes across the country, and parents were criminally charged for entering the country unlawfully. The objective was to deliver a powerful deterrent to families planning to come to the United States, even those seeking asylum. All told, several thousand foreignborn children were taken from their parents. Later, it emerged that hundreds of U.S.-born children crossing the border with migrant parents were also subjected to the policy. Wrenching images and audio of children being taken from their parents stirred outrage and criticism, and eventually prompted a wave of lawsuits — including the class-action suit, which was filed in the U.S. District Court for the Southern District of California.

If approved by the judge overseeing case, the settlement in the class action would grant the families permission to live and work legally in the United States while they await a decision on their asylum claims. Parents and children who have been separated and are already in the United States will be able to petition to bring immediate family members from

their home countries. “This agreement will facilitate the reunification of separated families and provide them with critical services to aid in their recovery,” Attorney General Merrick Garland said in a statement. Families that have previously been denied asylum will be eligible to reapply, and asylum officers will be instructed by the government to take into account the trauma caused by the forced separations. Families that prevail in their asylum cases — which typically take years to be adjudicated — will be eligible for green cards and, eventually, U.S. citizenship. “While we can never completely make these families whole again, or erase the moral stain of this abhorrent policy, we are thrilled for the families that will receive the settlement’s benefits, most of all the children who have not seen their parents in years and suffering families who will have a meaningful opportunity to remain in the U.S.,” said Lee Gelernt of the American Civil Liberties Union, the lead counsel in the class-action lawsuit. The agreement, which was negotiated by the Justice Department, now goes before Judge Dana M. Sabraw of U.S. District Court in San Diego, who has been overseeing the case. A hearing is scheduled for December. “When we brought this lawsuit, no one thought it would involve thousands

of children, take us to so many countries searching for families, or last for years,” Gelernt said. Parents were incarcerated for illegally entering the country, and their children, as young as 6 months old, were sent to shelters or foster homes. Most of the separations occurred in the spring of 2018 and lasted several weeks. But, in some cases, they extended to years because parents were deported without their children. The American Academy of Pediatrics said the initiative amounted to “sweeping cruelty.” Some young children did not recognize their parents when they were reunified by U.S. authorities, after an order issued in June 2018 by Sabraw. Other parents and children could not be found, delaying reunification, because of poor record-keeping by federal agencies. The settlement largely restricts separations in the future to cases in which a parent has been abusive or committed serious crimes, and the settlement stipulates that all separations must be documented in databases shared among federal agencies. While many of the separated families have been reunited, and many parents who were deported have returned to the United States, hundreds more families are yet to be found. Shortly after taking office, President Joe Biden established a task force to create a process for locating parents who had not been reunited with their children because they had been deported to countries such as El Salvador, Guatemala and Honduras. Lawyers for the families and the government lawyers also had been negotiating financial compensation for the harm caused by the separations. But talks stalled, and ultimately collapsed in October 2021, after a leak suggested that the Justice Department was willing to pay hundreds of thousands of dollars to each family. Following that disclosure, only the class-action negotiations proceeded, and the government task force continued to work with the ACLU and advocacy groups to reunite families. Still, some lawsuits seeking money damages are proceeding in federal courts, accusing the government of negligence, abuse and intentionally inflicting emotional distress.

The real estate tycoon whose fingerprints are on the Menéndez indictment

F

red Daibes, the New Jersey real estate tycoon at the center of an international scandal threatening the career of Sen. Bob Menendez, has found his way out of more than one tough spot over the course of his tumultuous life. He spent his first 10 years in a Palestinian refugee camp before emigrating to New Jersey, court records show. At 20, after his father died, he dropped out of college to support four younger siblings, a decision that paved the way to a wildly successful career building luxury housing in Edgewater, New Jersey. In 2013, he survived a vicious beating inside his penthouse apartment there. But in 2018, he faced a challenge that was far different. A 14-count federal indictment accusing him of scheming to defraud a bank he had founded threatened to upend his real estate empire and carried the risk of a lengthy prison term. It was then, prosecutors say, that he turned to a longtime ally for help: Menendez. What followed would form the basis for federal charges that Daibes, Menendez and his wife, Nadine, and two other business owners are now facing. All five have pleaded not guilty. Daibes, 66, was accused of giving the Menendezes bribes in exchange for the Democratic senator’s efforts to help him in the bank fraud case by installing a U.S. attorney inclined to ease up on the prosecution. Envelopes stuffed with cash bearing Daibes’ fingerprints and nine bars of gold bullion with serial numbers tracked to him were seized during a search of the Menendez home, according to federal prosecutors in Manhattan.

Still, the senator’s effort to meddle in the bank-fraud case failed, prosecutors said. “I don’t want him to be upset over it,” Daibes wrote in a text message to Nadine Menendez as his case proceeded toward trial. “This is not his fault he was amazing in all he did he’s an amazing friend and as loyal as they come.” In the end, there was no trial. Daibes pleaded guilty to a single count of making false entries in connection with a $1.8 million loan document as part of an agreement, approved by the U.S. attorney’s office in New Jersey, that required no prison time. Last week, however, a judge rejected that plea agreement, scuttling the original deal altogether and complicating an already sprawling web of allegations that poses new threats to Daibes’ real estate empire. On Friday, his lawyer in the New Jersey federal case, Lawrence Lustberg, formally withdrew Daibes’ guilty plea. Both cases — the accusations of bank fraud and bribery — have tainted Daibes’ legacy as the chief architect of Edgewater’s rebirth. Forty years ago, the borough of Edgewater was struggling. The narrow ribbon of land adjacent to the Hudson River, facing Manhattan, was once home to factories where Ford manufactured cars, Alcoa made toothpaste tubes and Quanta Resources produced roofing tar. But the companies had shut down, leaving environmental contamination in their wake. In the 1980s, Daibes, a mason’s son, hopped on a wave of postindustrial redevelopment already taking place downriver, in Hoboken and Jersey City. While taxpayers

financed much of Edgewater’s environmental cleanup, Daibes Enterprises built thousands of residential units, plus office suites, retail complexes and a golf range. Its working-class bars long gone, Edgewater’s bustling business district today includes Whole Foods and Trader Joe’s, multiple fine restaurants and a seven-story day spa with a rooftop pool. As Daibes’ high-rises went up, the population roughly tripled — to 14,600 — over three decades. Robert D’Angelo, the owner of Roberto’s II, a family-run restaurant in business since 1962 in Edgewater, said Daibes put the borough on the map yet never forgot his humble roots. After Hurricane Sandy, D’Angelo said Daibes was one of the first people to arrive at the restaurant once the roads reopened. Daibes helped him clean up and put him in touch with electricians, plumbers and carpenters. A local media fixture, Daibes was featured in a magazine spread about his classic and exotic car collection, including a red 1957 Jaguar XK140, a silver 2005 Bentley Continental GT with a turbocharged W-12 engine and a pair of Mercedes-Benz SLR McLarens. His high profile, though, came at a cost. Two days before Thanksgiving, in 2013, four people broke into his penthouse at the St. Moritz, one of his buildings, tied a bag over his head and beat him, breaking his ribs, dislocating a shoulder and bruising his face. They left with at least $2 million in cash, gold and jewelry. When they were arrested, one

turned out to be a confidant of Daibes living in the same building. The four struck plea agreements to serve 12 to 18 years in prison. Last month, prosecutors in Manhattan unsealed a 39-page indictment against Daibes, the Menendezes and the two other business owners, Wael Hana and Jose Uribe. It said that Daibes provided financial backing to Hana, an Egyptian American business owner who was later awarded a lucrative contract giving his company, IS EG Halal, the sole rights to certify that products imported to Egypt had been prepared according to Islamic law. IS EG Halal operates from a building in Edgewater owned by a company run by Daibes, who also has offices there. In turn, Bob Menendez, as chair of the Senate Foreign Relations Committee, helped direct aid and weapons to Egypt, prosecutors said. Daibes’ lawyer in the Manhattan criminal case, Tim Donohue, said his client’s financial link to Hana was limited to an “arms-length loan.” “Mr. Daibes is not an owner or investor in that business,” Donohue said about IS EG Halal. By then, Daibes was a major fundraiser for Menendez, a Democratic power broker who has represented the region since he was appointed to the Senate in 2006, prosecutors and federal election records show. Similar generosity had helped earn Daibes a role as kingmaker in Edgewater, at the expense of taxpayers, according to a recent state investigation. Daibes provided Edgewater officials free or reduced rents in apartment buildings he owned and awarded a flooring job to a council member’s company in exchange for favorable treatment in business deals, state investigators found. “Daibes’ power and influence within Edgewater were so strong he even held sway in local political decisions and other municipal concerns,” New Jersey’s Commission of Investigation found. “Municipal officers who took official actions unsupportive of the developer faced political and professional retribution,” investigators added. Daibes, through his lawyer, has rebutted the allegations and said that the rental benefits were gifts provided to longtime friends. A judge has scheduled trial on the bribery-related charges for May 2024, in a courthouse in lower Manhattan, 10 miles from Edgewater.

look at the day ahead in U.S. and global markets from Mike Dolan Another eye-catching bounceback in U.S. stocks on Monday was just about sustained overnight ahead of another slew of big bank earnings and as President Joe Biden’s planned visit to Israel tempered anxiety about a wider escalation of the Gaza war. Even with a packed diary of third-quarter earnings, economic updates and policymaker speeches ahead this week, day-to-day sentiment still appears to be dominated by the ebb and flow of concern about the tense Middle East conflict. Biden leaves later on Tuesday for a high stakes visit to Israel and Jordan and Washington said Israeli Prime Minister Benjamin Netanyahu had agreed to let humanitarian aid reach besieged Gazans. That reversed a pre-weekend ‘safety bid’ that emerged amid fears an Israeli ground invasion into Gaza could draw other regional countries and groups into the war. It appeared to put the situation on hold for a day at least. The 1%-plus rally in the S&P 500, which was the best start to the week since February, was matched by a retreat in crude oil, gold and Treasury bond prices and the dollar. Global stocks in Asia and Europe aped at least some of that bounce overnight, but Wall St futures ticked back a touch ahead of Tuesday’s opening bell. U.S. crude held steady and Treasury yields crept higher. But after impressive Q3 readouts from JPMorgan, Wells Fargo and Citigroup on Friday, markets are braced on Tuesday for updates from Bank of America, Goldman Sachs and Bank of New York Mellon. Reflecting the optimism around how banks and financials are benefitting from a higher interest rate world and rising asset management growth, Charles Schwab shares also jumped 4.7% on Monday as the brokerage posted a smallerthan-expected drop in quarterly profit. Third-quarter earnings for S&P 500 companies are estimated to have increased 2.2% year-over-year, up from an estimated increase of 1.3% a week earlier, according to LSEG data. But a welter of economic numbers will barrel into the mix today too - chief among them the September retail sales release, but also industrial output data and an October reading on U.S. housing. Canada’s latest consumer price data will be also be closely eyed. And a full schedule of Federal Reserve speakers tees up Fed boss Jerome Powell’s public appearance on Thursday. Before then, bond markets will have to negotiate tomorrow’s 20-year Treasury auction. The relatively new 20-year tenor has often proved unpopular and will be watched closely after a poor reception for the latest 30-year bond last week. But with yields back

above 5% and close to record highs of 5.25% set earlier this month, it will be an interesting test of investor appetite to grab these elevated long-term coupons. Another key moment on the radar is China’s third-quarter GDP release on Wednesday - but angst about the ongoing property sector bust there just won’t go away. Country Garden’s entire offshore debt will be deemed to be in default if China’s largest private property developer fails to make a $15 million coupon payment on Tuesday, the

end of a 30-day grace period. And non-payment of this tranche is set to trigger cross defaults in other bonds as is standard in bond contracts. To add to the complication of foreign investment in China, Russian President Vladimir Putin arrived in Beijing to meet with Chinese President Xi Jinping on a widely watched trip aimed at showcasing the trust and “no-limits” partnership between the countries even as the war in Ukraine raged on. Elsewhere, there was some relief for the Bank of England amid signs of ebbing wage growth for the first time since January. That helped drag back government gilt yields and the pound slightly lower.

Israeli airstrike hits Gaza hospital, killing 500, Palestinian Health Ministry says By HIBA YAZBEK and MATTHEW ROSENBERG

A

t least 500 people were killed by an explosion at a hospital in Gaza City on Tuesday that Palestinian authorities said was caused by an Israeli airstrike. The Palestinian Health Ministry said the number of casualties was expected to rise. Many civilians were sheltering at the Ahli Arab Hospital, better known as AlMa’amadani, before it was hit. The Israeli military said it was investigating if it was responsible for the blast. “We’re checking,” said Maj. Nir Dinar, a military spokesperson. In the past, rockets fired by Palestinian armed groups have occasionally malfunctioned and hit civilian neighborhoods. The deadly blast at the hospital came as President Joe Biden was preparing for a visit to Israel on Wednesday as conditions in besieged Gaza grew ever more desperate. What little remains of the enclave’s food, fuel and water supplies were dwindling fast Tuesday and hundreds of thousands of people were on the move, fleeing the strip’s northern half to escape a planned Israeli ground invasion. Israel has blocked basic necessities from reaching Gaza and has launched daily airstrikes in retaliation for the Oct. 7 cross-border attacks, in which 1,400 Israelis died and 200 people were taken hostage by the Hamas militants who control the enclave. By Tuesday, the consequences of the blockade and strikes were inescapable: Rescuers were struggling to free some 1,200 people trapped under rubble, fights were breaking out over loaves of bread, and hospitals were grappling with how to treat the rapidly growing number of wounded and ill as their generators ran short of fuel. Palestinian officials said at least 2,800 people have been killed and 10,000 others wounded in the Israeli strikes. With the humanitarian crisis deepening, pressure mounted to immediately provide safety and aid to Gaza’s 2 million residents. Yet U.S.-led diplomatic efforts have so far yielded few results. Days of efforts to get aid through Egypt’s border with Gaza have failed to bear fruit. Early Tuesday, the United States again expressed hope that it was close to an aid agreement and to establishing safe zones in southern Gaza, where the United Na-

tions said 600,000 Palestinians have fled after Israel warned them to leave the north. But Israeli forces have continued launching airstrikes into southern Gaza. The statement identified him as a commander in the Qassam Brigades, the group’s military wing. — Hamas released a hostage video showing Mia Schem, a 21-year-old woman who was abducted during its massacre at a music festival, one of the approximately 200 people believed to have been taken hostage by the group on Oct. 7. Tracking cellphone data by neighborhood, Israel gauges Gaza evacuation By PATRICK KINGSLEY and RONEN BERGMAN

I

n a windowless control room on an army base in southern Israel, five soldiers monitored the displacement of hundreds of thousands of Gazans on a massive computer screen. The screen showed a live map of northern Gaza, the densely populated area of roughly 1.1 million residents who were told Friday by the Israeli military to head south for their own safety. Using data harvested mainly from more than 1 million mobile phones, the map gave the soldiers a real-time assessment of how many Gazans had heeded Israel’s demand. The Israel Defense Forces have telegraphed for days that they will soon begin a ground operation in northern Gaza to oust Hamas, the armed Palestinian group that controls Gaza and orchestrated the worst terrorist attacks in Israel’s history on Oct. 7, killing more than 1,400 people and abducting at least 199 others. Israeli counterattacks have killed more than 2,800 Palestinians, according to the Gazan health authorities. The Israeli military allowed a New York Times journalist to view the data-tracking system, hoping to show that it was doing what it could to reduce harm to civilians — even as its warplanes killed hundreds more Palestinians on Monday, including in southern Gaza, where civilians had been told to take shelter. Some neighborhoods were colored white and red on the screen, suggesting that they still housed the majority of their residents. But an increasing number of areas were turning green and yellow, signaling that most of their residents had left. “It’s not a 100% perfect system — but it gives you the information you need to make a decision,” said Brig. Gen. Udi Ben Muha, who oversees the monitoring process. “The colors say what you can and can’t do.” With political leaders yet to give the final go-ahead for a ground operation, the Israeli military was locked in a holding pattern on Monday. On Monday night, its troops remained massed on the border of Gaza, yet to advance across it. The army was watching to see how many civilians had left northern Gaza. It was also giving last-minute training and equipment to the hundreds of thousands of military reservists who had been called up for the war effort. And the extra few days have given diplomats time to conduct last-minute — and, so far, unsuccessful — negotiations about opening Gaza’s border with Egypt to evacuees and aid convoys.

Israeli Prime Minister Benjamin Netanyahu has also invited President Joe Biden to visit Israel this week, and the military was unlikely to complicate his visit by starting an invasion while he was on Israeli soil, analysts said. “The ground operation is going to have lots of casualties on both sides,” said Miri Eisin, a former senior military officer and the director of the International Institute for CounterTerrorism at Reichman University in Israel. “You don’t want to do that when the U.S. president is here,” she added. In the meantime, three senior Israeli commanders said they were using every moment to prepare the reservists for ground warfare. The expected operation will be the first in nearly 15 years in which Israel will attempt to capture and hold on to land for a prolonged period. Many full-time soldiers have never conducted such an operation, let alone the 360,000 reservists called up from their day jobs since the Hamas attacks. A significant minority of infantrymen and tank units likely to be deployed in Gaza are reservists, according to three senior officers, who were not authorized to speak publicly. The Israel Defense Forces were believed to have 200,000 active-duty troops before the call-up, of whom three-fourths were conscripts, but there are no official figures. It has taken the military time to stock up on enough equipment for its army. Although Israel’s commandos all have enough protec-

tive gear, the army is still securing protective vests for some reservists, according to one senior officer. Several families have also said they privately obtained vests for sons who were called up. In the meantime, more Palestinian civilians are leaving northern Gaza, albeit to dire conditions in the south, where there is a lack of accommodation, fuel, water, medicine and food — and where Israeli strikes also continue. Many Palestinians say they fear that Israel ultimately seeks to force them into Egypt, never to return, in a mass expulsion that they compare to the Nakba, an Arabic term that refers to the flight or expulsion of 700,000 Palestinian Arabs during the wars that surrounded the creation of Israel in 1948. Israel says the call to evacuate is to prevent as many civilian casualties as possible during upcoming military operations in the north. To that end, from the military control room in southern Israel, Ben Muha was trying to encourage more Gazans to head south. Military offi-

cers called Palestinians directly, and air force planes dropped leaflets that urged Gazans to ignore Hamas’ demands for them to stay put. Spread across the general’s desk were dossiers and spreadsheets that listed the phone numbers of hundreds of Gazan community leaders, hospital directors and school administrators — all of whom could be phoned at a moment’s notice by a soldier in the control room. On a whiteboard nearby, aides had detailed the timing of the regular airdrops of leaflets across northern Gaza. On the live map in front of the general, there were fewer and fewer patches of red and white: Up to 700,000 Gazans had moved south by Monday afternoon, the data suggested, leaving about 400,000 in the north. Once a neighborhood turns green on the map, an Israeli officer operating in the area will have greater room for maneuver because of the reduced likelihood of harming civilians during the fight against Hamas, the general said. “If you are a brigade commander and you see those colors, it tells you how many civilians are in the area, and you know if you can or can’t use your tank, your infantry,” he said. Palestinians say such measures mean little amid the steep loss of life and hardship caused by the bombings and the displacement. Civilians and aid workers say that many people lack transportation to move southward or are too infirm to make the trip.

A severe drought pushes an imperiled Amazon to the brink By ANA IONOVA and MANUELA ANDREONI

T

he planet’s biggest freshwater tank is in trouble. The Amazon rainforest, where one-fifth of the world’s freshwater flows, is reeling from a powerful drought that shows no sign of abating. Likely made worse by global warming and deforestation, the drought has fueled large wildfires that have made the air hazardous for millions of people, including Indigenous communities, while also drying out major rivers at a record pace. One major river reached its lowest level ever documented on Monday, and others are nearing records, suffocating endangered pink dolphins, shutting down a major hydropower plant and isolating tens of thousands living in remote communities who can only travel by boat. “There’s just dirt now where the river used to be,” said Ruth Martins, 50, a leader of Boca do Mamirauá, a tiny riverside community in the Amazon. “We’ve never lived through a drought like this.” The drier conditions are accelerating the destruction of the world’s largest and most biodiverse rainforest where parts have started to transform from humid ecosystems that store huge amounts of heat-trapping gases into drier ones that are releasing the gases into the atmosphere. The result is a double blow to the global struggle to fight climate change and biodiversity loss. “This is a catastrophe of lasting consequences,” said Luciana Vanni Gatti, a scientist at Brazil’s National Institute of Space Research who has been documenting changes in the Amazon. “The more forest loss we have, the less resilience it has.” Recent studies have shown that climate change, deforestation and fires have made it harder for the Amazon to recover from severe droughts. And, Gatti warned, the worst may be yet to come. The rainy season is expected to start in the next weeks and if the drought, which

In Tefé, a rural municipality in the northwestern Amazon, residents are crossing muddy stretches of lake bed on motorcycles and paddling canoes down narrow streams that were once rivers. Some 158 riverside villages in the same region have been left stranded as waterways linking them to bigger towns have dried up, said Edivilson Braga, coordinator of the local civil defense service. “They’re completely cut off,” he said, adding that so far authorities have delivered thousands of basic food baskets, many by helicopter, to about 3,500 families. The Amazon has experienced droughts in the past, but it’s now facing “simultaneous disasters,” said Ayan Santos Fleischmann, a hydrologist at the Mamirauá Institute, a research organization based in Tefé. Scarce rainfall, scorching heat and scalding water temperatures are battering the region all at once. “This is a crisis — a humanitarian, envi-

ronmental and health crisis,” said Fleischmann. “And what scares us most is what lies ahead.” In Boca do Mamirauá, about two hours by speedboat from Tefé, drying waterways have caused stocks of basic food items and medications to dwindle and prevented children from making the river journey to school since Sept. 20, Martins said. Across the Amazon, wells and streams have dried up, leaving communities without clean drinking water. “The water turned to mud here,” said Tuniel Gomes Figueiredo, who lives in Murutinga, an Indigenous village of about 3,000 people. With no alternative, some residents are drinking, cooking and bathing with contaminated water. “This water is making children sick, it’s making elderly people sick,” Braga said. Health authorities also worry that stagnant pools of overheated water could breed mosquitoes carrying malaria and dengue. The drought has stressed countless animal species in a region known for abundant wildlife. In Lake Tefé, water temperatures remain high and the carcasses of more pink river dolphins have surfaced over the last week, bringing the death toll to 153 since the first carcasses were recovered on Sept. 23, Fleischmann said. A toxic algae bloom, likely linked to the drought and extreme heat, has also proliferated in the lake, creating a red stain in the water, although scientists are unsure if it could harm

humans or animals. “We’re using nets to try to steer the dolphins out of this area,” Fleischmann said. While low humidity and high heat alone can kill some plants and animals, much of the destruction is caused by the drier forest’s increased vulnerability to fires typically started by farmers and others who clear the land. Wildfires have consumed more than 18,000 square miles of the Amazon since the start of the year, an area twice the size of Vermont. Smoke from wildfires turned the air so hazardous in Manaus, a city of 2 million in the heart of the Amazon, that it recently became one of the most polluted cities on the planet, according to the World Air Quality Index project. Checking air quality data each morning has become an anxious habit in the city, as children and older people have ended up in hospitals struggling to breathe, according to doctors in Manaus. Camila Justa, a veterinarian in Manaus, said she has never seen such heavy smoke blanket the sky and suffered an asthma attack for the first time in 20 years, while her 4-year-old son has had pneumonia twice since September. “It’s really hard to fill your lungs with air,” she said. “And, when you do, it burns.” The drought has parched countries across the Amazon region. In Bolivia, dozens of municipalities have dwindling water supplies, crops have shriveled and lagoons have dried up, “with great consequences to biodiversity,” said Marlene Quintanilla, a research director at the Friends of Nature Foundation, a nonprofit group. The lack of rain in the Amazon is largely the result of two climate patterns, experts said. From the west, El Niño, which warms waters in the Pacific near the equator, is gaining strength. From the southwest, high temperatures in North Atlantic waters have accelerated the air flow toward the Amazon, preventing rain clouds from forming above the forest. While the link between human-caused global warming and the drought is unclear, climate models suggest that “over the next decades, with the increase in temperatures caused by climate change, these events will become more frequent,” said Gilvan Sampaio, a scientist monitoring climate patterns at Brazil’s National Institute of Space Research. The effects of a changing climate are intensified by high deforestation levels in the Amazon, as farmers clear land for soy and cattle farms whose products are exported to countries around the world. Cutting down trees, like global warming, makes rain scarcer and temperatures higher because the Amazon’s trees release moisture, cooling temperatures and forming rain clouds.

W

atching from afar as people race toward an abyss, I find it hard to know what to write except “no,” over and over. In the face of massacres that for Jews around the world brought back memories of genocide, the language of some Israeli leaders has, in turn, become murderous. On the cusp of a likely ground invasion of Gaza, many people I’ve spoken to, Jewish and Palestinian alike, are terrified that this rhetoric will become reality. Isaac Herzog, Israel’s president, said that the “entire nation” of Gaza was “responsible” for the attacks at a news conference on Friday, telling reporters, “It is not true, this rhetoric about civilians not being aware, not involved.” Herzog later clarified that civilians are not legitimate targets, but his words, coming from a member of Israel’s center-left Labor Party, were still chilling, suggesting a broad political consensus that Gazans are collectively to blame for the horror that befell Israel. “All gloves are off,” Ron Prosor, a distinguished Israeli diplomat, told Politico. In such an environment, the ruling Israeli right, some of whose members spoke of forcing Palestinians out of Israel even before Hamas’ latest rampage, has little to restrain it. Another member of Likud called for a second nakba, the Arabic word referring to the mass expulsion of Palestinians at Israel’s creation in 1948. I can empathize with liberal Jews both in Israel and throughout the diaspora who feel too overwhelmed, at this moment of great fear and vulnerability, to protest the escalating suffering inflicted on Palestinians. It is not fair that events are moving too quickly to give people time to grieve the victimization of their own community before being asked to try to prevent the victimization of others. Nevertheless, as atrocities are piled on atrocities, I hope Jews will attend to what is being threatened in our name. And all Americans should pay attention, given how much our country underwrites Israel’s military. In Gaza, mass death has already begun. Last week Defense Minister Yoav Gallant announced that Israel was cutting off Gaza’s water, electricity, food and fuel. There was hopeful reporting over the weekend that at the urging of President Joe Biden’s administration, water to a town in Gaza’s south had been turned back on, but for many, drinking water is still unavailable. The Associated Press reported Sunday that clean water has run out in U.N. shelters across Gaza. On Saturday, UNICEF reported that, according to local sources, more than 700 children in Gaza had been killed. The number by now is surely higher. Some readers, I suspect, will respond that while this is all terrible, it is also all Hamas’ fault. In many ways, I agree. Hamas’ terror is clearly the immediate cause of the hell raining down on Gaza; most countries attacked as Israel was attacked would respond with war. That does not, however, license Israeli indifference, or worse, to the lives of civilians. Israelis have a right to their rage; I imagine that if I were Israeli, I would share it. But incitement against Palestinians, the overwhelming majority of whom have nothing to do with Hamas terrorism, is leading us toward somewhere even darker than where we are right now. Influential voices in America are intensifying the bloodthirsty atmosphere. Appearing on “Fox News Sunday,” Sen. Tom Cotton, R-Ark., dismissed worries that mass civilian casualties in Gaza will work to Hamas’ advantage on the world stage. “As far as I’m concerned, Israel can bounce the rubble in Gaza,” he said. That phrase, “bounce the rubble,” is a reference to a Winston Churchill quote about apocalyptic military overkill. To Cotton’s right, the language is even more incendiary. “If it comes down to ethnic cleansing — you want to cleanse my people, I’ll cleanse yours first,” said Joel Pollak, a senior editor at large at Breitbart News, on the webcast of the leading young conservative Charlie Kirk.

According to the local sheriff’s office, the victims were targeted “due to them being Muslim and the ongoing Middle Eastern conflict involving Hamas and the Israelis.” If this is the atmosphere in parts of the United States, it is exponentially more fevered in Israel. On Monday morning I spoke to Diana Buttu, a Canadian Palestinian lawyer in Haifa who once served as a legal adviser for the Palestine Liberation Organization. “I can understand what my grandmother felt in 1948 when she fled” from a town near Nazareth, Buttu said. “Because it’s a climate of total fear that you’re next. And this isn’t just in the Gaza Strip; it’s also spread to the West Bank.” According to Al Jazeera, at least 55 Palestinians in the West Bank have been killed, some by soldiers and others by settlers. Haaretz reported that five Palestinians were shot dead by settlers in the village of Qusra. A message to the village on WhatsApp said, “We have no red lines. We’ll punish you in order to make an example out of you.” Buttu sent me a link to a mostly Hebrew-language Telegram group with over 82,000 subscribers in which people had posted celebratory photographs of dead and injured Palestinians. “The people of Gaza are not innocent!” said an introductory message for English speakers. If and when those who believe this act on it, we can’t pretend we weren’t warned.

The Mediterranean diet may also benefit those with psoriasis, a condition that causes thick, dry and itchy patches of skin, Ploch added. In general, though, evidence that dietary changes can treat skin conditions is limited, said Dr. Aaron Drucker, a dermatologist and an associate professor of medicine at the University of Toronto. And even if dietary changes help, he added, you may still need medications. Dietary advice for healthy skin Unless you’ve been diagnosed with a specific deficiency, it’s best to get your nutrients from food rather than from supplements, which aren’t well-regulated and can sometimes cause more harm than good, Ploch said. In one large clinical trial conducted in France, for instance, adult women who took a daily antioxidant supplement containing vitamins C and E, beta-carotene, selenium and zinc for 7.5 years had a 68% greater chance of developing skin cancer than those who did not take the supplement. And biotin supplements, which claim to support hair, skin and nails, can contain up to 650 times the recommended dose, which may lead to incorrect lab test results. Ploch’s go-to recommendation for healthy skin is the Mediterranean diet, which provides beneficial nutrients like antioxidants and protective plant-based compounds, she said. Chang also often suggests that her acne-prone patients try cutting back on dairy products and foods high in sugar and refined carbohydrates for at least four to six weeks. This won’t help everyone, she said, but some notice significant improvements. Eczema and other skin conditions naturally “wax and wane,” so it may not always be obvious if a dietary change is helping or hurting, Drucker said. But if you notice that a certain food consistently worsens your symptoms, it makes sense to avoid it, he said. In general, though, be aware that eliminating too many foods or food groups can have unintended consequences, Drucker said. If you cut out dairy, for example, you might lose out on calcium and vitamin D, so make sure that your diet is balanced with a variety of foods to meet your nutrient needs.

What are the must-have amenities for today’s pampered pet? By TIM MCKEOUGH

W

hen you’re designing or decorating a home, you have to consider the needs of the occupants — and that means not just people but any resident animals. “Our clients are very serious about their animals,” said Jimmy Crisp, the principal of Crisp Architects in Millbrook, New York. At Crisp’s home, in nearby Poughquag, New York, there are multiple dogs in residence, along with a cat. So it’s not surprising that many of the homes he designs have built-in amenities for pets. Amy Storm, the principal of interior design firm Amy Storm & Co., in Glen Ellyn, Illinois, thinks along the same lines. “Most of our clients do have pets and certainly want to pamper them and create special places for them,” she said. “It would actually be unusual that we wouldn’t be working on some sort of location for the pets to eat and bathe.” What are the must-have amenities for today’s pampered pet? Read on. The dog shower One of the most popular features is a dog shower. Usually placed in a mudroom or laundry room with direct outdoor access,

it offers a convenient way to rinse muddy paws and fur. Kate Marker, an interior designer in Barrington, Illinois, added a shower for her two dogs to the lower-level mudroom of her own home. “We made the dog shower opening fairly large and implemented a hand-shower component for easy washing,” Marker said. There is no shower curtain or glass door to get in the way, which makes it easier to reach in and scrub the dog. For larger dogs, a shower with an opening at the floor makes the most sense, Storm said. But for smaller dogs, it’s often better to raise the shower, so that it resembles an oversized sink, she said — that way, you don’t have to hunch over. And don’t forget: Dog showers can be multifunctional. A raised shower for small dogs “could double as a mudroom sink,” Storm said, while those that extend to the floor offer a great place to dry laundry if you add a hanging rod. Built-in bowls Food and water bowls can look like an afterthought if separate dishes are simply placed on a waterproof mat. A better alternative is a built-in pet food station. Shelby Van Daley, a founder of interior design firm Daley Home, included an open cabinet with built-in dog bowls when she was designing a kitchenette for a family room in Austin, Texas. The pet dining space is lined in quartz countertop material and has cutouts to hold removable stainless-steel bowls. There’s also a pot filler, to make it easy to add water. “A lot of our clients look for things they can add to their home to make it easier having pets,” Van Daley said. If you don’t want to see bowls sitting out all day long, there’s another option: Install a low drawer in a bank of cabinetry, with cutouts for bowls, so you can slide it closed when it’s not in use. “It’s a hidden dog bowl,” said Crisp, who once built a bowl drawer into the base of a mudroom bench seat. A custom crate Crate training your dog shouldn’t mean putting up with an ugly wire structure in the middle of your living space. Many designers are creating upscale custom crates that are built into homes.

Kate Marker, an interior designer in Illinois, added a dog shower to her mudroom, “with a hand-shower component for easy washing.” Van Daley designed a pair of crates with brass-mesh doors and enough space inside for dog beds as part of storage cabinets in the primary bedroom of one project. And Crisp designed a custom crate to fill the unused space under a staircase. If you don’t need a crate but want a place to hold wet dogs in the mudroom, there are other options. For one client, Storm designed a mudroom with a half-height screened pocket door that pulls out of the wall like a baby gate. Compared with a solid door, “you still have good light and good air, and everyone can still see each other,” she said, “even though the dogs are secured.” An architectural playground While dogs can usually get outside to play, indoor cats don’t have that opportunity. To compensate, some cat owners design their interiors to double as feline playgrounds. Alexandra Barker, the founder of New York-based architecture firm BAAO, prioritized cat-friendly features while renovating a Brooklyn row house for a couple of cat lovers. “They came to me with a request to design a house for them and their two cats,” Barker said. “Right from the get-go, the cats were on an equivalent plane.” The home’s defining feature is a builtin bookcase that runs along one wall of the living room. Some of the shelves project out into the room to serve as cat steps, and the top of the structure angles up and down to

serve as a cat run. At one end, the run reaches a ceiling hatch that opens to the primary bedroom above; at the other, a hatch opens to an art studio. A concealed cat bathroom For another client in Brooklyn, Barker is designing a cat bathroom that conceals the litter box. “It’s a door into a closet with a portal in it,” she said, so the cats can come and go as they please and no one has to look at the litter box. “Then you can open the door to take the litter box out.” The same thing can be achieved with cabinetry, by adding a cat door that opens to a concealed litter box in a base cabinet. That way, Barker said, “the litter box isn’t this object always parked in your way.” Playful products If you want to create an indoor feline playground but aren’t ready to renovate, there are products that can be installed on an existing wall. Mike Wilson co-founded Catastrophic Creations, a manufacturer of cat-play equipment in Grand Rapids, Michigan, after devising a wall-mounted rope bridge for his own cat in 2013. “We had a small apartment and were looking for ways that we could expand the place for him without taking up floor space,” Wilson said. “I wanted it to look good. We just weren’t interested in regular cat trees.” On Etsy, the bridge was a hit, and the company soon developed a range of wallmounted cat runways, steps, scratch posts and hammocks. Jackson Cunningham started Tuft & Paw in Vancouver, British Columbia, for similar reasons. “The idea came from our own experience of living in a smaller space in the city and caring about the stuff we put in that space,” Cunningham said. “When it came to pet furniture, you had to settle for one of these tacky, fuzzy cat trees.” Tuft & Paw now makes cat hammocks, perches, beds and litter boxes that are as considered as any piece of designer furniture. After all, creating a home that takes into consideration the needs of animals shouldn’t mean compromising on design. “People love their pets,” Barker said. “The idea is to integrate their pets’ needs into the design of their spaces.”

Mary Lou Retton crowdfunded her medical debt, like many thousands of others By SARAH KLIFF

W

hen Mary Lou Retton, the decorated Olympic gymnast, accrued medical debt from a lengthy hospital stay, her family did what countless Americans have done before them: turned to crowdfunding to cover the bills. On Tuesday, Retton’s daughter started a fundraising campaign on social media for her mother, who she said was hospitalized with a rare pneumonia. “We ask that if you could help in any way, that 1) you PRAY! and 2) if you could help us with finances for the hospital bill,” McKenna Kelley, Retton’s daughter, wrote in a post on Spotfund, a crowdfunding platform similar to GoFundMe. The public swiftly responded, with thousands donating $350,000 in less than two days, shattering the goal of $50,000. The United States has the highest health care prices in the world. Each year, 250,000 Americans start crowdfunding campaigns to pay medical bills. The Spotfund post for Retton, 55, did not share many details about her costs but noted that she did not have health insurance. (When another one of Retton’s daughters, Shayla Kelley Schrepfer, was reached by text, she did not respond to a question about why her mother was uninsured.) Unlike Retton, most patients do not meet their fundraising goals. About 16% of the time, studies have found, crowdfunding campaigns generate no donations at all. About half of Americans report difficulty paying their medical bills, according to a 2022 Kaiser Family Foundation survey. The problem tends to be particularly acute among the 27.5 million Americans who do not have health insurance. Most uninsured Americans have low incomes and about

two-thirds say they cannot afford to buy coverage. Some earn slightly too much for Obamacare’s subsidies or say that, even with the financial assistance, the premiums are still too expensive. Last year, Nora Kenworthy, an associate professor at the University of Washington Bothell, published the largest study to date of medical crowdfunding, which analyzed nearly a half-million GoFundMe campaigns. Her work showed that the typical fundraiser generates about $1,970, falling far short of the $5,000 to $10,000 patients are typically seeking. The most successful campaign in her data set raised $2.4 million, but such high numbers were rare. Fewer than 12% of campaigns met their goals. “What is concealed in viral campaigns like this one is that the vast majority of crowdfunding efforts earn much smaller amounts of money,” Kenworthy said. “As competition in this marketplace expands, the rates of success are being driven lower.” GoFundMe offers tips on how to make campaigns successful, suggesting that campaigns include “high-quality images” of the person in need and that they share “the financial, physical and emotional troubles” that patients are experiencing. A growing body of research, however, suggests that much of a crowdfunding campaign’s success boils down to factors outside a patient’s control, including race and income, and that crowdfunding often directs resources to those who need them the least. A 2022 study of cancer patients’ fundraisers found that those run by patients in poor neighborhoods tended to raise the least money, leading the authors to conclude that “online crowdfunding may exacerbate socioeconomic disparities in

cancer care.” Poorer patients may struggle to generate donations because of bias against them as lazy or undeserving of help, said Jeremy Snyder, a professor of health sciences at Simon Fraser University in Canada and the author of a book on the ethics of crowdfunding. And richer patients are often boosted by their social networks. “If you have a lot of wealthy friends, or live in a wealthy community, those are a lot more people who can potentially donate,” Snyder said. Racial and gender disparities also exist in crowdfunding. Kenworthy and her colleagues analyzed what makes a GoFundMe successful by looking at the 827 highest performing campaigns. She found that young white men coping with unexpected medical crises tend to attract the most support, while Black women were underrepresented among successful campaigns.

Margot Polivy, champion of women in college sports, dies at 85 By SAM ROBERTS

M

argot Polivy, a high school physical education teacher turned lawyer who tirelessly lobbied the federal government to legally guarantee that college athletic departments offer women equal opportunities to participate in sports, died on Oct. 7 at her home in Washington. She was 85. Her death was confirmed by her sister, Gail Polivy, who said the cause had not yet been determined. In the 1970s, representing women’s groups on campuses and on Capitol Hill, Margot Polivy (pronounced PAHL-a-vee) fought the male-dominated National Collegiate Athletic Association and helped transform the ambiguous wording of congressional anti-discrimination mandates, which had made no specific mention of sports, into a Hail Mary pass that profoundly expanded the resources available to female athletes in high school and college. Title IX of the Education Amendments of 1972 stated only, “No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.” But once athletes staked a claim to those benefits, with Title IX interpreted to include nondiscrimination in sports, Polivy, a lawyer for the Association for Intercollegiate Athletics for Women, partnered with the National Coalition for Women and Girls in Education to insist that the regulations being drafted to implement the legislation fulfill the expec-

Margaret Dunkle, whose 1974 analysis documenting discrimination against female college athletes provided the blueprint for the regulations, said of Polivy in an email, “She was a key player in shaping Title IX’s sports regulations, which opened athletic scholarships for women and set standards to ensure that female teams got the funding and resources needed to excel.” The women’s groups Polivy represented prioritized amateur student athletics as a form of physical education. That view stood in contrast to the predominant male model of student sports, which prioritized recruiting, scholarships and winning to generate financial contributions from alumni — and, critics said,

encouraged academic laxity. Instead of drafting a bill that would have appeased athletic directors by exempting revenue-generating sports like football from the regulations, Polivy, roaming the Capitol deskless, sketched out an alternative — which she wrote on a sheet of paper that rested on the back of Rep. Shirley Chisholm, D-N.Y. The resulting bill was introduced by Sen. Jacob K. Javits, R-N.Y. Her alternative gave Title IX proponents what they wanted all along, Michael MacCambridge wrote in “The Big Time: How the 1970s Transformed Sports in America” (2023): “that athletic departments would offer a rough equality of opportunity and reasonably similar resources, especially in scholarships.” The bill, he said, “in essence reassured colleges that they wouldn’t have to spend as much on gymnastic equipment as they did on football paraphernalia.” The women’s rights groups had by then grudgingly accepted some of the economic realities behind collegiate athletic programs. Polivy accomplished what she did, MacCambridge wrote, by injecting the Association for Intercollegiate Athletics for Women’s “wide-eyed idealism with a tough-love dose of the realities of the bruising world of politics and the law.” Margot Polivy was born on April 25, 1938, in New York City. Her father, Charles, sold paint and wallpaper. Her mother, Ruth (Klein) Polivy, was a homemaker. After graduating from Evander Childs High School in the Bronx, Polivy earned a bachelor’s degree in education from Hunter College in Manhattan. She then

taught physical education at Hunter College High School and received a law degree from New York University School of Law in 1964. She was then hired as an associate counsel by the Federal Communications Commission, where she oversaw the fairness doctrine, which required equal broadcast time for political candidates. She worked for Rep. Bella Abzug of New York in Washington from 1971 to 1972 and then started a law firm, which became known as Renouf & Polivy. It was from there that she was recruited by the Association for Intercollegiate Athletics for Women. Polivy’s sister is her only immediate survivor. Her life partner, Katrina Renouf, died in 2009. Polivy “was a tough negotiator and tenacious advocate,” Dunkle said. “At the same time, her New York elbows were tempered by an irreverent and engaging sense of humor that lightened the mood and made getting to yes more likely.” The Association for Intercollegiate Athletics for Women was ultimately subsumed by the NCAA, which took control of women’s sports, and ceased operation in 1982. By the early 1980s, courts were curbing the reach of Title IX. “But if the passage of time did not produce compliance, it did serve at least some constructive purposes,” Polivy wrote in a New York Times opinion essay in 1978. “It allowed an emotional adjustment period, during which all the old arguments about the preference of ‘normal’ girls for passive pursuits have come to be universally recognized for the foolishness they are.”
