Most of the Arecibo fatal overdose victims had fentanyl in bloodstream
By THE STAR STAFF
The Institute of Forensic Sciences (ICF by its initials in Spanish), the island’s medical examiner’s office, revealed Thursday that toxicology tests have shown that most of the recent overdose victims in Arecibo had fentanyl in their bloodstream.
ICF Executive Director María Conte Miller said most of the 10 overdose deaths reported in recent days in Arecibo tested positive for fentanyl in combination with other drugs.
“A special work plan was carried out between Monday and Tuesday to attend to these cases and confirm the preliminary tests carried out in the autopsy room, as it was a multiple incidents of overdose deaths in a single municipality or region,” Conte Miller said in a written statement.
The island’s top forensics official said six of the victims tested positive for fentanyl mixed with cocaine; two tested positive for fentanyl mixed with xylazine; one tested positive for fentanyl, cocaine and xylazine; and only one tested positive for cocaine.
The deaths revealed the widespread adulteration of cocaine with fentanyl and fentanyl-related substances. Fentanyl, a Schedule II opioid analgesic, is approximately 50 times more potent than heroin and 100 times more potent than morphine. For that reason, it carries a high risk of overdose and can be lethal at the 2-milligram range.
The deaths are also being investigated by federal officials.

Police arrested former lawmaker Severo Colberg Toro on Wednesday afternoon in Mayagüez for drug possession.
According to the police report, Colberg Toro, 71, a resident of Mayagüez, was found with cocaine and $21 in cash in the Roosevelt residential area of the Dulces Labios neighborhood.
He was brought before Judge Luis Padilla Galiano who determined cause for arrest and imposed a bail of $4,000, which Colberg Toro posted.
The preliminary hearing was scheduled for Oct. 30, 2024.
Colberg Toro, a native of Cabo Rojo, served as a member of the Puerto Rico House of Representatives from 1993 to 2004 with the Popular Democratic Party.
Study: People love to dine out more than ever in Puerto Rico
By THE STAR STAFF
Consumers in Puerto Rico show a high level of loyalty to restaurants, including increasing levels of use and average spending, maintaining the historical results observed in 2023, a study shows.
On Thursday, the Puerto Rico Restaurant Association (ASORE by its acronym in Spanish) presented the results of the ASORE Trends Study (EAT) 2024, conducted by The Research Office.
“This ASORE study confirms again, even more forcefully than the previous ones, that consumers love and need restaurants in their lifestyles,” said José Alfonso of The Research Office. “One of the most impressive data is that 88% of all users agree that going out to a restaurant with their family or friends gives them an unparalleled opportunity to socialize and represents the best use of their free time.”
ASORE President Carlos Budet highlighted that “the results of the EAT 2024 study reaffirm that consumers in Puerto Rico are not only loyal to restaurants by choice but because they have become an essential part of their daily lives.”
“The reality of the country has transformed visiting restaurants into a necessity that offers convenience, security, and the possibility of enjoying experiences in an environment suitable for socializing and disconnecting from daily challenges,” Budet added.
The study reaffirms that consumers value the experience of going to restaurants as a space to share with family and friends and as a means to relax and forget about daily worries. In fact, 80% of those surveyed indicated that they prefer to
invest in restaurant experiences rather than cooking at home, thus reinforcing the importance of the industry in the social life of Puerto Rico residents.
Other key findings from the EAT 2024 study include:
1. Quick-service restaurants (QSR): Leading in usage with 90% of consumers visiting them, up 4 percentage points from 2023. On average, consumers visit such restaurants 7.4 times per month and spend $24 per occasion.
2. Casual restaurants: They are the second most frequented type of restaurant, with nearly 50% of consumers using them. The average number of visits has increased from 2.8 times per month in 2023 to 3.7 in 2024, with average spending of $52 per visit.
3. Family restaurants: Used by 33% of consumers, with an average spend of $56 per occasion.
4. Pizzerias: 27% of consumers visit pizzerias regularly.
5. Fine dining restaurants: These restaurants have seen an increase in usage, with an average frequency of 4.5 times per month, and an average spend per visit of $102.
6. Overall satisfaction: Nine out of 10 consumers are satisfied with multiple aspects of the industry, such as delivery time, service quality, restaurant cleanliness, and staff courtesy.
7. Increase in total spending: Average monthly restaurant spending has increased to $622 in 2024, representing an increase of $27 compared to the previous year, driven primarily by increased visits to certain restaurants.
8. Industry competition: Consumers have shown themselves to be careful with their spending, but they benefit from competition in the industry, which offers them better options in terms of value for their money.

The EAT study reaffirms that consumers in Puerto Rico value the experience of going to restaurants as a space to share with family and friends, and as a means to relax and forget about daily worries.
The EAT 2024 study was conducted through 1,000 in-person interviews throughout Puerto Rico, targeting users who have frequented limited-service restaurants (such as quick-service restaurants) in the past three months, or full-service restaurants in the past six months. Fieldwork was conducted between Aug. 31 and Sept. 22, 2024. The estimated margin of error for the total sample of 1,000 participants is plus or minus 3%.
Governor supports decriminalizing drugs but rejects legalization
By THE STAR STAFF
Gov. Pedro Pierluisi Urrutia said Thursday that he favors decriminalizing the use of controlled substances, but not legalizing them, following the increase in fentanyl-related deaths.
“This legalization thing is not for me,” Pierluisi said in response to questions from the press. “Decriminalization could be done to a certain extent, but with great care and controls, because we do not want to encourage drug use in Puerto Rico; if anything, we want to discourage it.”
“I have always said that drug users, addicts, should not
be imprisoned, except when it is a repeat offense and they are committing a series of crimes that do not provide alternatives,” the governor added.
The head of the Mental Health and Anti-Addiction Services Administration (ASSMCA), Carmen Bonet, stressed that the agency has been working on the fentanyl issue for years.
“Since 2017, ASSMCA has made more aggressive campaigns to close off [the availability of] illicit fentanyl, because we must mention that fentanyl in therapeutic use is a controlled drug due to its potency,” Bonet said.
“It is a fentanyl created in clandestine laboratories without any type of quality control, and it can be lethal,” she said.
“ASSMCA has distributed more than 100,000 naloxone kits in recent years and has trained more than 26,000 people, including professionals and community leaders.”
Bonet called on “anyone who buys any substance illegally to be aware of the risk that it may contain fentanyl.” She added that rapid fentanyl tests are being distributed for those with substance use disorders and that the ASSMCA will continue its efforts throughout Puerto Rico.
Earlier on Thursday, the Institute of Forensic Sciences confirmed that a spate of deaths reported in Arecibo were caused by overdoses of fentanyl in combination with other drugs, such as cocaine and xylazine (see related story on page 2).
Judicial branch expands mental health courts system
By THE STAR STAFF
The judicial branch of the island government announced on Thursday the expansion of the Specialized Mental Health Courts to the judicial regions of Arecibo, Bayamón and Caguas, Supreme Court Chief Justice Maite Oronoz Rodríguez stressed that the expansion will benefit residents of 26 municipalities, promoting the recovery and rehabilitation of people with mental health
disorders through a therapeutic justice approach.
“Cases under the Mental Health Act require a different approach, where treatment and rehabilitation are the central axis, because it is not about punishment, but rather about providing support, care and healing,” Oronoz Rodríguez said in a written statement.
The specialized chambers offer remedies such as involuntary commitment orders and compulsory treatment under the Mental Health Act. Each chamber is staffed
with coordinators who serve as a liaison between the court, mental health service providers and the families of participants.
The project is supported by agencies such as the Mental Health and Anti-Addiction Services Administration, the Department of Health, and the Legal Aid Society, among others. The specialized courts are part of the judicial branch’s Access to Justice Program for People with Mental Health Conditions.
Project underway to provide computers & digital know-how to seniors

By THE STAR STAFF
The island Family Department, through the Families and Children Administration (ADFAN by its acronym in Spanish), on Thursday began the delivery of 300 computers to elderly adults who completed a training program in the management of technology and prevention of fraud and exploitation.
The initiative seeks to close the digital gap in the senior population and offers tools for interacting in a secure manner with the digital environment.
“Technology is not only a tool, it is a bridge of opportunities and protects those who are vulnerable,” Family Secretary Ciení Rodríguez Troche said in a written statement during the first delivery, held at Luis Muñoz Marín Park in San Juan. The totality of the
San Juan to hold latest electronics recycling event
By THE STAR STAFF
To celebrate the International Day for the Protection of Nature, the Municipality of San Juan will hold the 2nd edition of its Electronics Recycling event on Friday (Oct. 18) in drive-thru mode and free of charge.
Some examples of devices that can be recycled are computers (laptops and desktops), mice, UPS batteries, cables, keyboards, cell phones, tablets, headphones, televisions, monitors, video game consoles, cable TV boxes, internet modems, home printers, security cameras and digital cameras.
During the event, which will be held from 8 a.m. to 4 p.m., citizens of San Juan will be able to go to the community collection center at Coliseíto Pedrín Zorrilla using the entrance on Domenech Avenue to leave their electronics with personnel from the Office of Environmental Compliance and Planning.
“Our goal is to promote a safe and environmentally
sustainable management system for electronic equipment and components in order to minimize their environmental impact,” San Juan Mayor Miguel Romero Lugo said. “We also seek to promote the reuse, recycling, recovery, and development of appropriate systems for collecting and processing this equipment. Our first event, held on November 15, 2023, was a resounding success, with the participation of 710 citizens. Forty-three thousand, one hundred twenty-six pounds of electronic waste were diverted.”
Citizens with questions about the items to be recycled can take their material to the event, where specialized personnel will be available to classify it and manage its distribution to the corresponding recycling companies on the island. In addition, the Municipality of San Juan will not charge citizens who participate in the service since private companies charge by weight or item for the recycling of electronic devices.
The event is to be held in compliance with Act 18 of 2012,
computers will be delivered in a week.
The workshops held in the ADFAN’s Multipurpose Centers for People of Advanced Age (CAMPEA) focused on training the participants to navigate digital platforms in a safe and secure manner and preventing online fraud.
ADFAN Administrator Nicole Báez Ortiz stressed that digital education is key so that older adults can protect themselves from economic exploitation.
In addition, the Family Department has established new cybercafés throughout the island so that all CAMPEA participants have access to technological equipment.
“This project is only the beginning,” Rodríguez Troche said. “We aspire for all older adults in Puerto Rico to have the necessary tools to access the digital world in a safe and confident manner.”

Some examples of devices that can be recycled are computers (laptop and desktop), UPS batteries, cables, keyboards, cell phones, tablets, televisions, monitors and video game consoles.

DACO seeks data from 4 companies in cases of possible discrimination against PR consumers
By THE STAR STAFF
The Department of Consumer Affairs (DACO by its acronym in Spanish) has requested information from four companies allegedly engaging in commercial discrimination practices against consumers in Puerto Rico, Interim DACO Secretary Francisco González de la Matta announced Thursday.
The entities from which information has been requested are Dyson, Paypal, JBL and Mastercard. The new series of requests is added to previous efforts by DACO with other multinationals to ensure that consumers on the island receive fair and equitable treatment in the market.
“These requests for information are a key tool within our strategy to combat commercial discrimination,” González de
la Matta said. “Through these requests, we seek to ensure that multinational companies comply with regulations that guarantee fair treatment for Puerto Rican consumers. It is unacceptable that there are geographic limitations that deny Puerto Ricans access to products or services that should be available without restrictions.”
In the first two rounds of information requests, DACO has already requested data from eight companies, including Apple, Yeti, Microsoft, TikTok, Samsung, Sony, H&M and Nike. So far, all companies have responded, although Yeti, Nike and Sony did so late, for which they will be fined between $10,000 and $30,000. Additionally, Apple, Tik Tok, Samsung and Nike have been granted additional time to provide the necessary information.
“The objective of these requests is clear: to ensure that consumers in Puerto Rico do not suffer discrimination in access to goods and services,” added González de la Matta, who is an attorney. “Not only do we demand compliance, but we are also receiving proactive approaches from companies seeking to collaborate and discuss solutions, so I am sure that this exercise will have results that will benefit consumers on the island.”
The four companies from which data was most recently requested have 10 days to respond. Failure to comply could lead to sanctions of $10,000 per day. The Office of Commercial Anti-Discrimination was reactivated by González de la Matta in September and, so far, 12 companies have been required to provide data for commercial discrimination practices against consumers on the island.

Supreme Court allows EPA to limit power plant emissions
By ABBIE VANSICKLE
The Supreme Court earlier this week allowed the Environmental Protection Agency to move ahead it with its plans to limit carbon emissions by power plants, handing a victory to the Biden administration.
The decision, which was temporary, centered on a major regulation the administration enacted in April that seeks to eliminate pollution from coal, which emits more carbon dioxide than any other fossil fuel.
The move was part of the Biden administration’s promise to curb pollution from such emissions by 2050.
More than two dozen states challenged the regulation, arguing that the federal government had failed to prove that the techniques used to control emissions would curtail them to the degree the government is seeking.
The ruling, which was provisional, was in response to an emergency application as a challenge moves through the lower courts.

The EPA has been repeatedly stymied in the courts during the Biden administration over its efforts to protect the environment. In June, the Supreme Court temporarily paused an EPA plan to curb air pollution that drifts across state lines. It has also constrained the agency’s ability to limit water pollution and factors that lead to climate change.
Under the rule, coal- and gas-fired power plants slated to operate long-term would have to capture up to 90% of their emissions by 2032. The requirements are less strict for power plants scheduled to close in the coming years.
The court’s brief order Wednesday did not include its reasoning, which is typical in emergency applications. Justice Clarence Thomas noted that he would have blocked the emissions rule. The court’s order also indicated that Justice Samuel Alito did not participate in the deliberations, although no reason was given.
In a brief statement, Justice Brett Kavanaugh, joined by Justice Neil Gorsuch, said that while he agreed with the court’s decision to allow the emissions rule to go into effect, he believed that some of the Republican-led challenges “have shown a strong likelihood of success on the merits.”
Still, Kavanaugh said that a lower court would have sufficient time to review the case given that the power plants would not have to start work to comply with the rule until June 2025.
Environmental groups, as well as the EPA, lauded the decision.
“People across America are suffering through intensifying storms and other disasters because of climate change,” the general counsel of Environmental Defense Fund, Vickie Patton, said in a statement. “EPA — as specifically required by Congress — set reasonable and achievable standards
to reduce the pollution that causes climate change from one of its largest sources, fossil fuel-burning power plants.”
One of the states that mounted the challenge, West Virginia, said it would continue to contest the rule.
“We will continue to fight through the merits phase and prove this rule strips the states of important discretion while forcing plants to use technologies that don’t work in the real world,” the state’s attorney general, Patrick Morrisey, said in a statement. “Here, the EPA again is trying to transform the nation’s entire grid, forcing power plants to shutter.”
The challenge is currently pending in the U.S. Court of Appeals for the District of Columbia Circuit. In July, a three-judge panel refused a request by the conservative-led states to stop the EPA rule from going into effect while the court case continued, prompting the states and other groups to ask the Supreme Court to step in.
In its decision, the appeals court panel wrote that there was no need to pause the EPA rule from going into effect while litigation continued because the case would proceed quickly and the federal government’s compliance deadlines were years from now, in 2030 or 2032.
The Biden administration announced the rule in April as part of a broader effort at limiting pollution from power plants. Several Republican-led states, including Indiana, Alabama and Alaska in addition to West Virginia, challenged the regulation the same day.
In their emergency application, the states accused the agency of being “driven by a distaste for fossil-fuel fired facilities,” and seeking to “force coal-fired plants to close and shift over to EPA’s preferred methods of power generation.”
The states argued that the EPA had exceeded its au-
thority by creating the rule without specific congressional approval, and called the rule “an unlawful and ill-advised attempt to restructure the entire power industry.” They said the agency’s rules set “impossible-to-meet standards for regulated facilities, stripping away the states’ discretion to patch up the damage and ultimately pushing regulated sources into early retirements.”
In its brief, the Biden administration argued that the EPA had acted within its authority in setting emission limits and that it had determined that the best approach was 90% carbon capture. The technology uses chemical solvents to remove carbon dioxide from the exhaust stream of a power plant, permanently storing it underground.
The Biden administration contended that the challengers did not take issue with how the EPA had interpreted the Clean Air Act, but objected to the agency’s “technical and scientific judgments regarding the dependability, feasibility and cost of carbon capture.”
Those critics, Solicitor General Elizabeth B. Prelogar wrote, “largely ignore the hundreds of pages of analysis” by the EPA.
Although the challengers portrayed carbon capture as “an untested, futuristic technology,” Prelogar added, the agency found that its benefits had been “adequately demonstrated.”

takeaways from Harris’ contentious interview on Fox News
By NICHOLAS NEHAMAS and KATIE ROGERS
Vice President Kamala Harris sat for the most adversarial interview of her campaign earlier this week, sparring with Fox News anchor Bret Baier over the U.S. border, President Joe Biden’s mental fitness and whether former President Donald Trump is a threat to American democracy.
For a Democratic presidential candidate, appearing on Fox News is about as close as going into the lion’s den as it gets. On Wednesday, the lion was Baier, who repeatedly interrupted the vice president and tried to talk over her.
But Harris — giving her first interview on Fox News in an attempt to reach millions of voters, especially conservative-leaning women, who have probably not heard much of her message — largely steered the conversation in her preferred direction.
Here are five takeaways from the interview.
She broke with Biden (a little).
Harris made her clearest effort to separate herself from Biden after she was asked how her administration would be different.
“My presidency will not be a continuation of Joe Biden’s presidency,” she replied, adding that she represented a different generation of leadership and would address issues such as housing and small businesses in different ways.
Republicans have seen Harris’ unwillingness to articulate differences from the unpopular president as a political gift. In an interview on ABC’s “The View” last week, she said there was “not a thing that comes to mind” when asked what she would have done differently from Biden.
Harris has engaged in an awkward dance with her boss, walking a line between being deferential to their administration’s accomplishments while trying to assert her own authority. Her answer Wednesday was more rhetorical than substantive, but Biden may have given her the green light to be more aggressive going forward.
“Every president has to cut their own path. That’s what I did,” he said in a speech Tuesday. “I was loyal to Barack Obama, but I cut my own path as president. That’s what Kamala’s going to do. She’s been loyal so far, but she’ll cut her own path.”
And when Baier slyly asked her when she had first noticed that “President Biden’s mental faculties appeared diminished,” she
gave little ground, saying Biden was more than capable of leading the nation — unlike Trump, whom she called “unfit,” “unstable” and “dangerous.”
An aggressive Bret Baier pushed right-wing arguments.
From the outset, Baier seemed determined to knock Harris off her talking points — often by echoing those of Trump.
It took him less than 20 seconds to interrupt her for the first time. Harris, who is known as an effective practitioner of the filibuster, had hardly even begun to answer his opening question. That pattern continued for much of the interview.
Many of Baier’s questions seemed drawn from Trump’s own arguments. The Fox News anchor invoked the names of young women whom Trump frequently points to at his rallies as victims of immigrants in the U.S. illegally and who are often cited on Fox programming. In fact, nearly half of the 26-minute interview was devoted to immigration and border security, issues seen as among Harris’ biggest weaknesses with undecided voters. Baier also suggested she was soft on Iran.
For Harris, the interview was largely meant to appeal to women ...
The interview with Baier gave Harris access to a large audience of Republican women whom her campaign is trying to win over. Her advisers believe there is a sliver of conservative women who might be receptive to the character contrast she is trying to draw with Trump — or who are at least willing to hear her out.
Harris campaign officials believe that talking about the current landscape of abortion restrictions in the United States is a winning strategy with female voters, particularly liberal and liberal-leaning ones. But Baier did not bring up the issue, and the vice president did not guide him there.
Instead, both of them stayed focused on immigration and border security — a topic that, according to recent polls, is near the top of the list of concerns among female voters.
... and those women saw the vice president being interrupted repeatedly.
During this portion and others, the viewers Harris and her campaign are trying to appeal to also saw
Baier repeatedly interrupt her as she tried to answer his questions.
“We’re talking over each other,” he said shortly before it ended, though he had been doing so himself throughout their encounter. “I apologize.”
The interview showed the limits of Harris’ outreach to Republicans.
Harris frequently made points that Fox News viewers don’t often hear in their normal programming, saying that Trump was unfit to serve and pointing out the number of former officials in his administration who support her candidacy.
But the interview was a reminder that even as she talks in speeches about establishing a cross-party dialogue — and campaigns with Republicans like former Reps. Liz Cheney and Adam Kinzinger — the vast majority of the Republican Party and its media ecosystem view her with skepticism bordering on contempt and stand firmly behind their chosen candidate.

President Kamala Harris, the Democratic presidential nominee, speaks during a campaign rally in Washington Crossing, Pa., on Wednesday, Oct. 16, 2024. Vice President Harris sat for the most adversarial interview of her campaign on Wednesday, sparring with the Fox News anchor Bret Baier over the border, President Biden’s mental fitness and whether former President Donald Trump is a threat to American democracy. PR Workforce Training Program adds 1,165 skilled workers for reconstruction
By THE STAR STAFF
The Institute for Building Technology and Safety (IBTS) recently unveiled the findings of a comprehensive economic study that underscores the significant impact of its Workforce Training Program (WFT) in Puerto Rico.
Conducted in partnership with Huertas College and analyzed by Advantage Business Consulting, the study whose results were released Oct. 10 reveals that the WFT program is not only addressing critical labor shortages but also driving substantial economic benefits for the region.
In the wake of Hurricane Maria, Puerto Rico faced unprecedented challenges, including a severe shortage of skilled construction workers essential for the island’s recovery and reconstruction. To tackle that issue, the Puerto Rico Department of Housing (PRDOH) developed the WFT program using Community Development Block Grant Disaster Recovery (CDBGDR) funds provided by the U.S. Department of Housing and Urban Development. As an awardee of the program, IBTS -- a national nonprofit organization and trusted adviser and partner to local, state and federal governments -- partnered with Huertas College to develop eight courses in
construction aimed at equipping residents with the skills necessary to fill those crucial roles. Courses included key trades such as drywall, carpentry, cabinet making, and masonry; project management and supervision; and solar photovoltaic installation. All courses focused on meeting or exceeding current building codes.
The study highlights the success of the initiative, with 1,165 participants graduating as of June of this year as newly skilled workers poised to meet the growing demand in Puerto Rico’s construction industry.
“We first and foremost see the impact of the program on the individual participants, who are now beginning rewarding careers in the construction industry,” said IBTS Program Manager Judelly Hernández, who oversaw the WFT program. “However, the economic impact of this program extends far beyond these individuals. The new jobs created through this initiative are stimulating the local economy, generating additional employment in related sectors.”
“With the focus on current building codes, the professionals trained through this program will not only contribute to helping Puerto Rico rebuild, but also ensure that new structures are resilient to

Judelly Hernández, program manager at the Institute for Building Technology and Safety
future storms,” she added. “And those trained in renewable energy installations will also contribute to meeting Puerto Rico’s goal of 100% renewable energy by 2050.”
Key findings from the economic study note that IBTS’ WFT program efforts:
• Included the creation of 1,165 direct jobs as well as 261 indirect and 348 induced jobs supporting businesses.
• Injected over $55 million into the local economy through wages.
• Will generate an estimated tax revenue of $5 million annually.
The PRDOH structured the WFT program to benefit low- and moderateincome (LMI) residents, with a national objective that 51% of participants qualify as LMI. Among participants in IBTS’ program, 66% were from low- to moderateincome households, surpassing the required threshold by 15 percentage points.
The program’s success is largely attributed to the partnership with Huertas College, which provides a curriculum certified by the National Center for Construction Education and Research, ensuring that graduates are well-prepared to meet the industry’s needs.
As Puerto Rico continues its recovery efforts, the need for a skilled workforce remains critical. Although the IBTS WFT program has made significant strides in addressing this demand, new solutions will need to address the remaining jobs needed for reconstruction efforts. IBTS remains committed to continuing to provide solutions for sustained economic growth and resilience in Puerto Rico.

Dow ends at another record high as chip stocks, retail data support
The Dow Jones Industrial Average ended higher on Thursday, its fourth record close in the last five sessions, as stronger-than-expected monthly retail sales indicated a robust U.S. consumer and chips stocks were buoyed by TSMC’s upbeat forecast.
The other main Wall Street benchmarks, the S&P 500 and the Nasdaq Composite, finished largely unchanged.
Taiwan Semiconductor Manufacturing Co, the world’s largest contract chipmaker, beat market estimates for profit and forecast a jump in fourth-quarter revenue, driven by demand for artificial intelligence chips.
The chipmaker’s U.S.-listed shares soared, while AI-trade favorite and TSMC customer Nvidia gained.
The optimism spread to other chip stocks, sending the broader Philadelphia SE Semiconductor index higher.
Fresh U.S. data confirmed healthy growth in the world’s largest economy, while keeping bets on a 25-basis-point rate cut at the Federal Reserve’s next meeting largely intact at 89.4%, according to CME’s FedWatch.
U.S. retail sales increased 0.4% in September, slightly more than expected, while weekly jobless claims fell unexpectedly.
A broadly upbeat start to the third-quarter earnings season, strong economic data and the Fed kicking off its policyeasing cycle have pushed the Dow and the S&P 500 to record highs in recent sessions, with the latter close to the psychologically important 6,000 mark.
According to preliminary data, the S&P 500 lost 0.99 points, or 0.02%, to end at 5,841.48 points, while the Nasdaq Composite gained 6.46 points, or 0.04%, to 18,373.54. The Dow Jones Industrial Average rose 164.01 points, or 0.38%, to 43,241.71.
Josh Jamner, investment strategy analyst at ClearBridge Investments, said investors have been revising economic and earnings growth expectations as robust data eased worries about a recession.
However, there was still a question of leadership in markets, and as investors wrestled with this, and the level of rotation happening, this has left the market slowly grinding higher.
“Overall, it’s allowing the market to advance, but maybe in a somewhat more restrained fashion than what otherwise might be expected,” Jamner said.
Highlighting this was the fact the Dow advanced for the second straight day, but small cap indexes fell. The Russell 2000 and the S&P Small Cap 600 were down, having both

MOST ASSERTIVE STOCKS

closed at their highest in nearly three years on Wednesday. A majority of S&P 500 sectors were also in negative territory, including rate-sensitive indexes such as utilities and real estate.
One other quirk is that U.S. equity benchmarks have advanced in recent days even as U.S. Treasury yields have crept up. On Thursday, the yield on the benchmark 10-

year note rose 7.5 basis points to 4.091%.
In earnings-related moves, Travelers Companies and Blackstone Group advanced after both the insurer and the money manager posted third-quarter profit which beat market expectations.
The S&P Banks index rose for the fifth straight session as a slew of larger regional banks posted third-quarter numbers. M&T Bank and Synovus Financial rose, but Truist Financial dropped.
Outside financials, health insurer Elevance Health plummeted after slashing its full-year profit forecast.
Sinwar’s death could unlock stalled Gaza truce talks, but barriers remain
By PATRICK KINGSLEY
For more than a year, the fate of Hamas leader Yahya Sinwar seemed entwined with the fate of the war in the Gaza Strip.
Sinwar orchestrated the Hamas assault on Israel last October that killed up to 1,200 people, captured some 250 hostages and prompted a devastating Israeli retaliation that has killed tens of thousands of Palestinians and laid waste to much of the Gaza Strip.
He was considered the driving force behind Hamas’ refusal to surrender, even as Israel’s airstrikes and ground invasion devastated the territory and displaced most of its population. And his survival made it impossible for Israel to declare victory — living proof that Hamas, though decimated, remained undefeated.
Now, after Sinwar was killed, a route toward a truce in Gaza seems slightly more navigable, according to Israeli and Palestinian analysts, even if major obstacles remain on both sides and a resolution to the broader conflict between Israel and Hamas’ regional allies remains out of reach.
Negotiations for a cease-fire and a hostage release deal had stalled partly because Sinwar had held out for a permanent deal that would allow Hamas to retain power in a postwar Gaza. His maximalist stance was incompatible with that of Benjamin Netanyahu, the Israeli prime minister, who sought only a temporary truce that would allow Israel to return to battle within weeks to prevent Hamas’ long-term survival.
With Sinwar dead, Netanyahu could have a stronger argument to persuade his hard-line allies that Hamas has been defeated without the need for further war, analysts said.
“If Netanyahu has a victory picture under his belt, he can be a bit more forthcoming because he is in a much more prestigious position,” said Itamar Rabinovich, a former Israeli

Yahya Sinwar, viewed as the architect of the brutal Oct. 7 attack on Israel that set off the 13-month war that has plunged the Gaza Strip into a humanitarian crisis and began a wider conflict that now includes the fighting in Lebanon, is dead, according to the Israeli military who confirmed his death on Thursday, Oct. 17, 2024. ambassador to Washington.
Meanwhile, Hamas’ remaining leadership, demoralized and afraid, might agree to cede some power to other Palestinian factions to ensure the movement can survive at least in some form in Gaza. The group could also agree to exchange more hostages for fewer Palestinian prisoners held in Israeli jails — another stumbling block to a truce.
“You could find a weakened, more pragmatic leadership in Hamas that would make some tactical compromises, though not on the strategic issues,” said Ibrahim Dalalsha, director of the Horizon Center, a political research group in Ramallah, West Bank.
Still, plenty of obstacles remain.
Hamas is a highly disciplined organization that has sur-
vived the killings of several previous leaders. Sinwar’s hardline brother, Muhammad, is believed to still be alive and to retain significant influence.
And even without either Sinwar, Hamas’ new leadership would be unlikely to withdraw its demand for a permanent truce, or to accept continued Israeli occupation of parts of Gaza, Dalalsha said.
But a new leadership might be more willing than Sinwar to hand over power to a technocratic Palestinian government, or to agree to a temporary Israeli presence in Gaza as long as Israel nominally promised to withdraw permanently in the future, Dalalsha said.
“For the sake of their own physical survival, they may make more compromises than the man who initiated the whole war,” Dalalsha said. But, he added, “They won’t say: ‘Yes, we’ll do whatever you want, Mr. Netanyahu.’”
For Netanyahu, too, Sinwar’s death may not be enough.
The relatives of hostages still held in Gaza pressed Netanyahu on Thursday to use Sinwar’s death as the political cover he needs to agree to a truce that would free the remaining roughly 100 captives.
But the prime minister still has a complicated political calculation. He has promised his supporters that he will dismantle Hamas and remove it from power, and key members of his coalition have threatened to collapse his government if the war ends without Hamas’ total defeat.
Even with Sinwar dead, Hamas retains some administrative and military capacities, displaying a resilience that could prompt Netanyahu to continue the war to ensure his political own survival.
“The question is,” said Rabinovich, “Does Netanyahu rise to the occasion, or does he not?” And regardless of Netanyahu’s answer, ending the war in Gaza would not immediately resolve Israel’s war with Hezbollah in Lebanon, where an Israeli ground invasion is ongoing, or its conflict with Iran.
Zelenskyy tries to sell his ‘victory plan’ to European leaders
By JENNY GROSS and CONSTANT MÉHEUT
President Volodymyr Zelenskyy of Ukraine told leaders of the European Union’s 27 member states in Brussels on Thursday that his country desperately needed their support for his “victory plan,” which he maintains could end the war no later than next year, but which it is unclear how much Ukraine’s allies will embrace.
Zelenskyy made the impassioned plea on his latest trip abroad as he tries to attract sustained international support for Ukraine, 2 1/2 years into the war, and as Ukrainian forces are steadily losing ground to Russian troops. He had hoped to present the plan to European leaders in Germany earlier in the month, but that gathering was postponed when President Joe Biden canceled his participation to deal with the effects of Hurricane Milton.
“You all know Russia’s psychology,” Zelenskyy told EU leaders Thursday. “Russia will resort to diplomacy only when it sees that it cannot achieve anything by force.”
Zelenskyy is scheduled to speak at a news conference with Mark Rutte, the head of NATO, later Thursday and will make the case for Ukraine’s accession into the military alliance — a key point in his proposals.
The “victory plan” also calls for the West to lift restrictions on Ukraine’s use of Western-delivered missiles to strike ammunition depots and other military facilities inside Russia, and to share more satellite data that Ukraine can use to identify and strike Russian targets.
The Ukrainian leader laid out the plan for the first time in public Wednesday in a speech to his country’s parliament, an attempt to rally support at home around the idea that Ukraine can turn the tide on the battlefield. Ukraine is heading into what looks to be another difficult winter, with Russia stepping up its attacks on energy infrastructure.
In the past few months, Ukraine has also lost a series of cities, towns and villages in its eastern Donetsk region, currently the war’s main theater. Its forces are often overwhelmed on the battlefield by Russia’s superior numbers of troops and ammunition.

What’s so funny about a dictator? Venezuela’s comedians-in-exile have ideas
By JULIE TURKEWITZ
Estefanía León, a young Venezuelan comedian, once wondered how she could keep making jokes amid so much tragedy.
It was 2017, and she was living in Caracas, Venezuela’s capital, at the worst point in her country’s economic crisis. Protests convulsed the nation, while food shortages left millions hungry, and hyperinflation erased savings overnight.
Her father, at the time very ill, would rise at 3 in the morning to line up to buy food before supplies ran out. Léon was working seven days a week but could not afford his medication.
Her job as a writer at El Chigüire Bipolar, a wildly popular website for political satire, required her to churn out jokes on a daily basis. But she was dodging tear gas on the way to the office.
Then the government, controlled by an increasingly authoritarian President Nicolás Maduro, passed legislation outlawing many kinds of speech. She wondered if her jokes would land her in prison.
Comedy, she said, had been her trench, the place from which she lobbed political and social critique. “Now, there was nothing to laugh at,” she said. “There’s no food, there’s no money, there’s a dictatorship, and I’m scared.”
She fled to Mexico City in 2018. At first she focused on surviving. But eventually, she returned to humor.
And today León plays a principal role in a larger Venezuelan comedy boom, whose protagonists work and live mostly outside their country, now free, for the most part, to say what they want.
Some nations elevate their novelists or poets to positions of cultural eminence; Venezuela has long viewed its comedians as among its most important societal expositors.
Now, with nearly 8 million Venezuelans having fled their homes since 2015, that talent is moving abroad.
These comedians include George Harris in the United States, José Rafael Guzmán in Mexico and Víctor Medina in Argentina. Medina, known by his childhood nickname Nanutria, performed last year with others at Luna Park, a stadium in Buenos Aires that normally hosts Argentine rock gods like Charly Garcia and international superstars like Shakira.
León, 33, is one of three producers of El Cuartico, a weekly video sketch and podcast project streaming across social media and audio platforms. On TikTok they have more than 600,000 followers, representing just a slice of their fan

base.
When El Cuartico began in 2020, the group started by addressing universal topics — “The Secrets of OnlyFans,” and “Contraceptives for Men, please!” were the titles of two early podcasts — attempting to attract a diverse, Spanish-speaking audience.
But they found themselves drawn to themes closer to the Venezuelan experience, like migration and authoritarianism, that they thought few Spanish-language humorists were touching in a sophisticated way.
Soon, their voices and videos were reaching hundreds of thousands of people in their search for a Venezuelan identity abroad. Today, all three members of El Cuartico make a living from comedy.
Recent video sketches feature León in a fictional U.S. migration line, trying to charm a border agent named Larry into believing that she’s just coming for a short visit.
He eyes her belongings, which include four suitcases, an air fryer and an arepa griddle called a budare, which she hugs to her chest like a life preserver.
Finally, under Agent Larry’s imposing glare — experienced by pretty much every Venezuelan who has crossed a border in the past 10 years — she explodes.
“Yes! I’m here to stay!” she admits. “I want you to know it and for everyone to know it, the whole world!”
Chucho Roldán, 36, León’s colleague at El Cuartico, attributed their popularity to the collapse of the Venezuelan entertainment industry amid the political crisis and a near absence of Venezuelan characters in mainstream international entertainment.
“There is nothing for us,” said Roldán, “and we want to see ourselves.”
Leonardo Martínez, 38, who left Venezuela for Puerto Rico in 2014, said that the group had helped him reconnect with his Venezuelan identity, which had been “tucked away amid all the anger, frustration and national heartbreak.”
“I barely see Venezuelans here,” he said of his new home, “so things like El Cuartico, you cling to them.”
Just before a recent crackdown on dissidents in the country — roughly 2,000 people have been detained since a disputed election in late July — the trio embarked on a risky five-city tour inside Venezuela. There, the three were received like celebrities and filled theaters, including an iconic amphitheater in the capital of Caracas.
Outside their country, the three continue using a distinctly Venezuelan cadence (very fast) and vocabulary (a girl is not a “chica” but a “chama”; a friend is not an “amigo” but a “pana”) and have kept Venezuelan references. (In the migration sketch, León attempts to bring her air fryer to the United States so she can make tequeños, beloved cheese sticks whose consumption is practically a patriotic duty.)
Yet an important slice of their audience hails from outside their home country.
“A sketch about corruption works in all of Latin America,” said Daniel Enrique Pérez, 34, the third member of El Cuartico. “A sketch about dictatorship works in all of Latin America.”
A number of Venezuelan comedians began their careers in Venezuela and then built new ones abroad.
But Angelo Colina, 30, from the city of Maracaibo, began his stand-up career only after moving to the United States, landing in Salt Lake City in 2018.
Now based in New York, since January he has performed in 31 states and Puerto Rico, often at sold out shows, including one at New York City’s Gramercy Theater.
Unlike the trio from El Cuartico, much of his comedy focuses on the Latino experience in the United States, not on the country he came from.
“Obviously I miss my country, my people, my family, a lot. But at the same time, the most beautiful moments I have had as an adult and in my career have been outside” of Venezuela, he said. “I don’t know if I would be doing comedy, much less at this level, if I had stayed.”
In recent months the political situation in Venezuela has gone from difficult to dire. Following the July election that Maduro is widely viewed to have stolen, his security forces have detained hundreds of people, many of them everyday citizens.
Despite a crackdown, a small comedy world still exists inside Venezuela, largely centered around a Caracas comedy club called Pizpa.
Alejandra Otero, 41, is a frequent performer at Pizpa who has remained in the country. While most of her humor is not political, she has spent years honing an impression of Maria Corina Machado, the conservative opposition leader who has emerged as a foil to Maduro’s leftist government.
Otero has long had to be careful about what she says and does, and even more so in the post-electoral environment. In preparation for a recent show at Pizpa, Otero cut several political references, she said.
Every passing day, she added, there is less space for comedy in Venezuela.
“Humor is obviously something that makes the regime uncomfortable,” she said, “because humor was born for that, to make people uncomfortable and to criticize.”
Yet she has no plans to stop performing or to flee. Because now more than ever, she said, “we need to laugh.”
Harris needs a closing argument. Here’s one.
By BRET STEPHENS
It’s time for Kamala Harris to deliver her closing argument for why she deserves to be the next president. Here’s what I think she should say.
My fellow citizens,
When the tumultuous history of this year’s presidential election is written, future generations will note that the choice boiled down to this: the certainty of division versus the possibility of unity.
Whether you love Donald Trump or loathe him, prefer his policies or mine, you can be sure of one thing: If he wins next month, we will be a bitterly, vocally, emotionally, exhaustingly divided country. You know this because whatever you thought of his first term, you remember how that division became a part of your daily life. Thanksgiving dinners you stopped going to — because of Trump. Friends and neighbors you stopped speaking to — because of Trump. Topics you wouldn’t broach — because of Trump. There was no getting away from it. Trump is a human jackhammer pounding outside your window at 6:30 a.m. The noise is incessant. It’s in the ad hominem tweets, the nasty nicknames, the disparagement of anyone who disagrees with him as an idiot, a weakling, an enemy of the people. And let’s be honest: The noise also came from the enraged reaction that Trump provoked, whether on cable

TV or the streets of many of our cities.
Trump brought out the worst in everyone, not just his most ardent fans but also — yes — his most acerbic critics. In the four years of his presidency, he turned us into a nation of haters. He’ll do it again if you elect him next month.
In a democracy, a certain amount of division is natural. Like the opposition of wind and sail, it’s the productive tension that drives a nation forward while allowing it to find its balance.
I’m a proud Democrat. I’ll fight hard for the policies in which I believe: a woman’s right to her reproductive choices, a child’s right to quality public education, a worker’s right to collective bargaining, a citizen’s right to safe streets. Above all, I’ll fight for what we cherish most: the American dream, which for so many of us starts when we sign the purchase agreement for an affordable first home.
But in a healthy democracy, division must ultimately be framed by unity. Democrats, Republicans and independents must be able to recognize one another as fellow patriots. The party in power should not abuse its temporary majority to change the rules of the game — something both parties have been guilty of. When consensus reached through compromise is possible, we should prefer it to divisive, and reversible, partisan victories. That’s how progress isn’t just achieved but also secured.
I’ve been a partisan in my past — sometimes in ways that perspective has caused me to regret. But I’m not ashamed that some of my opinions have changed; it is what thoughtful people do in the face of new information. Better that than being stuck, like my opponent, with the worldview he seems to have adopted when he was 6.
What I’ve mostly learned in my nearly four years as vice president is that the national interest demands greater unity — never more so than right now. Can we be disunited against the challenge of a brazenly aggressive China and its new best friends in Moscow and Tehran? Can we be disunited when it comes to strengthening our national infrastructure in the face of devastating storms and climate change? Can we be disunited over stopping the billionplus doses of fentanyl that crossed our border last year? And — seriously — can we continue to be disunited about gaining effective control over our borders while remaining a welcoming destination to legal immigrants from around the world?
Disunity leads to paralysis, and that’s where this country has been stuck for too long. We’re like a Corvette in which the driver and the passenger keep fighting for control of the stick, stalling and ruining the gears. We can do better, go faster and — why not? — put some joy in the ride.
I’ve said that I intend to name a Republican to my Cabinet. In fact, it will be more than just one,

and not just to secondary positions. Donald Trump wants to politicize the entire civil service and turn it into an arm of MAGA-nation. I, on the other hand, intend to depoliticize the Cabinet so that the men and women in charge of our defense, diplomacy, Justice Department and economic system will have broad bipartisan respect, whatever party they affiliate with.
We can’t lose hope that this kind of leadership is within our grasp. We see it every day in the work of so many Americans: destroyer captains in the Navy fighting Houthi pirates, biotech entrepreneurs charting the next wave of lifesaving innovation, pastors and social workers providing hope — and food and shelter — for the neediest.
The talent, the passion, the optimism, the capacity, the sense of a shared and greater purpose that united our states and must continue to unite our nation — it’s still there, all around us. With your help, let me bring it to the White House.

Liam Payne, 31, former One Direction singer, dies in fall in Argentina
By HANK SANDERS
Liam Payne, who rose to fame as a singer and songwriter for British group
One Direction, one of the bestselling boy bands of all time, died after falling from the third floor of a hotel in Buenos Aires, Argentina, on Wednesday. He was 31.
His death was confirmed by Alberto Crescenti, director of emergency services in Buenos Aires. The circumstances of the fall were unclear.
One Direction burst onto the scene in 2011 when the group’s debut single, “What Makes You Beautiful,” hit No. 4 on Billboard’s Hot 100. Five of its other songs reached the chart’s Top 10, including “Story of My Life,” “Drag Me Down” and “Live While We’re Young.”
The group, which had 29 total hits on Billboard’s Hot 100, would go on to release five albums and become one of the definitive boy bands of the 2010s, largely by eschewing the sleek precision and polish of an earlier generation of pop vocal groups.
One Direction announced in 2015 that it was taking a break from performing as an ensemble, and each of the artists has since invested most of their time in their solo careers.
“It’s just a break :) we’re not going anywhere !!,” Louis Tomlinson, one of the band’s members, posted on Twitter at the time.
But in January 2016, the band split, Us Weekly reported.
Payne released a single called “Teardrops” under his name earlier this year.
Payne auditioned as a solo artist on the television show “The X Factor” in 2008. But he found even further success in 2010 after trying out again with a jazzy rendition of Ella Fitzgerald’s “Cry Me a River.” He was put together with four other contestants — Niall Horan, Zayn Malik, Harry Styles and Tomlinson — for another round of auditions as a group, which eventually turned into One Direction.
Clarín, a news outlet based in Buenos Aires, reported that Payne had recently attended a concert by Horan, who was touring Latin America.
The band was brought together by Simon Cowell, the sharp-tongued English television personality and music executive — best known to American audiences from his time on “American Idol” — who tailored

more. His single with Quavo, the bouncy and flirty “Strip That Down,” reached No. 10 on the Billboard Hot 100. But in time, Styles would eclipse all other former One Direction members as a chart-topping pop star. In 2020, Payne teamed up with Swedish producer Alesso for an EP.
The temptations that came with fame took a toll on his mental health, which he described in a 2023 video posted to his YouTube account about his decision to stop drinking. “I kind of became somebody who I didn’t really recognize anymore. And I’m sure you guys didn’t either,” he said. He explained that he had spent 100 days in a rehab facility in Louisiana. “It’s good to be in this position,” he said. “I definitely don’t need those things anymore. The party’s over.”
“It feels to me like when we were in the band the best way to secure us, because of how big it got, was just lock us in our rooms,” Payne said on the “Diary of a CEO” podcast in June 2021. “Of course, what’s in the room? Mini bar. So at a certain point I thought well I’m going to have a party for one.”
the group’s sound and songs to appeal to teenage girls.
Although the boy-band formula was nothing new in 2011, the appeal of One Direction’s members led to frenzied crowds outside pop-up concerts and movie deals.
When the group arrived in America in 2012 after the release of its debut album, “Up All Night,” “there was nothing security could do about the screaming,” Jon Caramanica wrote of a New York concert in The New York Times.
Liam James Payne was born Aug. 29, 1993, in Wolverhampton, England, just outside of Birmingham.
Payne’s survivors include a 7-year-old son, Bear Grey Payne, his parents, Geoff and Karen Payne, and his two older sisters, Ruth and Nicola, The Associated Press reported.
Payne was one of the group’s standout singers, though One Direction as a whole underscored affability and casualness. He had several songwriting credits across the group’s releases.
Payne told Entertainment Weekly in 2015 that out of all of the songs he penned for One Direction, he was most proud of his
contribution to the song “What a Feeling,” a Fleetwood Mac-inspired groove that he said he hoped people would play on long, serene drives down a coastal road.
Payne put out a solo album called “LP1” on Capitol Records in 2019, which was full of collaborations across the musical spectrum: Latin music star J Balvin, rapper Quavo, electronic producer Zedd and
In a May 2023 interview with iFL TV, he said he was working on a follow-up album to “LP1.”
“I’ve been making an album for a change, which is quite fun,” he told iFL. “It’s been good, I’m excited to bring it out, and I definitely want to tour this time, which is unusual. Because I wasn’t sure I was going to tour for a long time. I was kind of over it a little bit, but I’m really excited to get back out on the road and go and see all the fans.”

Yankees need Judge to keep slugging
By BRENDAN KUTY / THE ATHLETIC
During the celebration, Gleyber Torres, the New York Yankees’ second baseman, was catching hell. Aaron Judge had finally hit his first home run of this postseason, a towering blast that cleared the wall in center field. But as the ball sliced through the night, Torres, leading off first base, did something peculiar. He tagged up.
When the ball finally went out, Yankee Stadium erupted. It gave the Yankees a four-run lead in what became a 6-3 win against the Cleveland Guardians in Game 2 of the best-of-seven American League Championship Series on Tuesday. Heading into Thursday night’s Game 3 in Cleveland, the Yankees were two wins away from reaching their first World Series since 2009.
But Judge was still surprised, even hours later. He had nearly passed Torres while rounding first base after the seventh-inning, two-run shot. Did Torres really doubt that Judge — masher of an MLB-best 58 home runs in the regular season — had put enough of his 6-foot-7, 282-pound frame into his swing for the ball to leave the yard?
Torres had tagged up on a Judge home run earlier in the season, too. Judge was playfully miffed about it then, he said, and he was miffed about it now. In the dugout, Torres’ teammates piled on.
“I’m a little disappointed in Gleyber for not knowing Judge’s pop there,” first baseman Anthony Rizzo said. “We were ribbing him a lot about that.”
“I feel a little bit embarrassed,” Torres admitted.
The MLB playoffs rarely allow time for laughs, with each pitch mattering more than the next. Judge’s home run let the Yankees exhale for many reasons, but especially because it showed Judge just how important it is for him to be the team’s driving force.
“Always a matter of time with Aaron,” manager Aaron Boone said about Judge hitting his next home run.
The prevailing thought has been that if the Yankees are going to play deep into October, they will need Judge to continue the production that made him the front-runner this year to win the AL MVP Award, which would be his second.
Until Tuesday, that was not happening. Offensively, he had struggled, hitting .133 (2 for 15) through the first five playoff games, though he did draw six walks. It continued a pattern of not rising to the occasion in the postseason, which has stained his otherwise illustrious career.
But Judge may be changing that.
In his first at-bat, he lifted a pop-up at 103.3 mph that

seemed to scream back to earth even faster. Cleveland shortstop Brayan Rocchio dropped it, allowing Torres to score from third base to give the Yankees a 1-0 lead. Then, in a surprise move in the second inning, the Guardians walked Juan Soto intentionally to load the bases for Judge. Facing pitcher Tanner Bibee, Judge lifted a sacrifice fly to center field to bring home Rizzo to make it 3-0.
After flying out in the fifth, Judge bashed his first homer of the playoffs. It took some of the weight off the Yankees’ shoulders and allowed the bullpen to work with a sizable lead. And it lifted the Yankees, who were desperate for their captain to join the party.
“It’s so easy to root for him,” Rizzo said. “In these games, it really doesn’t matter who it is, how excited we are for everyone. But when Aaron does stuff, it’s extra special just because he’s such a special human being.”
Judge said the expectations on him were not weighing him down.
“Just don’t make any moment too big, man,” he said. “It’s still the same game we play and we’ve been playing our whole life. So that’s how I try to treat it.”
Except now it is different. Judge has been to the ALCS three times before: in 2017, 2019 and 2022. The Yankees lost in all three. He knows the stakes are higher than ever. This is the first time his team has been ahead, two games to none, in a championship series after coming into it as the top seed.
Judge has put himself in the pantheon of the most talented and productive Yankees in history. He was the league’s MVP in 2022, when he set the AL single-season record for home runs with 62. He is the team’s 16th official captain and a six-time All-Star, and he was a rookie of the year in 2017.
But he is not a World Series champion. That matters.
“It doesn’t matter what you do during a 162-game schedule,” Derek Jeter said at the Yankees’ Old-Timers’ Day in August. “It all boils down to the World Series. Win a championship, or it’s a failure.”
The series had a day off Wednesday. The Yankees used the day for a light workout before flying to Cleveland for Game 3 on Thursday. Progressive Field has not been kind to Judge in his career. In 20 games there, he has hit .214 (15 for 70) with two home runs.
A silver lining? The Guardians were expected to start lefthander Matthew Boyd, and in 11 career plate appearances against him, Judge had two hits, including a home run, and five walks. The Yankees were to counter with right-hander Clarke Schmidt, who was to be making his second start of the postsea-

New York Yankees outfielder Aaron Judge, in Toronto for a game against the Blue Jays, on Sept. 27, 2022. Until Tuesday’s 6-3 win over the Cleveland Guardians in Game 2 of the ALCS, in which he drove in three runs with a 2-run home run and a sacrifice fly, Judge had struggled offensively in the postseason, hitting .133 (2 for 15) through the first five playoff games, though he did draw six walks. (Chris Donovan/The New York Times)
son. In Game 3 of the division series at Kansas City, he allowed two runs in 4 2/3 innings in a 3-2 Yankees victory but did not get a decision.
“I’ve been on the losing side of a lot of postseason games, and those are tough,” Judge said after Tuesday’s game. “I’ve been on the other side of some good wins. All that matters is we went out there and took care of business, and we’ve got to move on to the next one.”
