he Senate Health Committee, chaired by Rubén Soto Rivera, held a public hearing Tuesday to address the debts owed by insurers to hospitals in Puerto Rico. “Every day I become more convinced that it is urgent to reform the payment system for health institutions and providers to improve these services in Puerto Rico and do justice to the professionals in this field,” the senator said. Insurance Commissioner Alexander AdamsVega said his office is actively conducting an audit to investigate outstanding claims for payments to health care providers. “During the first phase, which includes six insurers and health services organizations, it turned out that the total claims pending payments, as of July 31, 2022, were $226,368,828,” the commissioner said. “Of this amount, $101,961,593 were claims pending payments to hospitals that represented some 206,956 claims for services provided.” Currently, the Insurance Commissioner’s office’s investigation is in Phase 2, in which they are auditing seven insurers with outstanding payments as of Dec. 31, 2022 totaling $16,302,747. Of this amount, $5,489,324 represents claims pending payment to hospitals. On the one hand, regarding complaints from hospitals for non-compliance with the Timely Payment Law, which regulates the claims and payment process between insurers and health organizations, they discovered that Triple-S Salud Inc. maintained internal appeal processes to address disputes over payment of claims not contemplated by law.

The insurance commissioner told a Senate panel that his office’s audit of seven insurers has found that outstanding payments include $5,489,324 in claims pending payment to hospitals. “As a result of our investigation, an administrative order was issued to the insurer in which it was fined and ordered to desist from internal appeal procedures contrary to the Prompt Payment Law requiring it to temper its dispute processes in the law,” Adams Vega said. Triple-S senior vice president of technology and plan management, Carmen González, noted that she pays all of her contracted suppliers in Puerto Rico around $182 million per month. She added that some 30 percent of the payments issued by Triple-S are made to hospitals. González said 9.5 out of every 10 claims received are processed automatically in less than 30 days, through computerized systems that have been configured to comply with contracts. In addition, six percent of the institutional claims received are pending evaluation of the required documentation, and once received, it takes 10 days to issue payment.

lthough Hurricane Tammy is far from Puerto Rico, its residual moisture is affecting the local climate, the National Weather Service reported Tuesday. The moisture is expected to favor convective rain development, mainly in eastern areas and local offshore islands, driven by westerly winds. Toward the weekend, an increased chance of showers and storms exists, thus increasing the risk of flooding. Despite the distances, Tammy’s remnants will gen-

erate northerly swells that will affect the local Atlantic waters and Caribbean passages. Boaters and beachgoers should exercise caution. Today through Thursday, northerly winds will bring temporary showers, especially north of Puerto Rico and the U.S. Virgin Islands. St. Thomas has been one of the hardest hit areas. Despite the interaction between a drier, cooler air mass and Tammy’s moisture, consistent, if light, rain is forecast with possible afternoon thunderstorms in southern Puerto Rico.

Governor: Proposed tax relief would outweigh any benefit from Crudita II repeal By THE STAR STAFF

ov. Pedro Pierluisi Urrutia insisted on Tuesday that he does not oppose legislation that would eliminate the tax on petroleum derivatives, known as La Crudita II. However, he said there is no certainty that the repeal would positively impact the economy. The governor said it remains to be seen whether businesses will lower the prices of products if the tax is repealed. However, he said, the tax reform bill he sent to the Legislature recently would benefit workers and companies. He said that under his reform proposal, people would see their checks increase. much less in taxes. “Corporations in Puerto Rico pay more than all corporations in the United States and much of the world,” Pierluisi noted. “What I say, looking at the numbers, is that the impact on the economy is greater, the positive impact on the economy and for the benefit of all the people of Puerto Rico is greater with the tax relief bill that I sent and that is now in the Legislature.” “Now it’s not that I’m ever going to reject a tax relief bill,” the governor added. “I’m just going to ask for advice. I recognize that if La Crudita is eliminated, it would be, well, eliminating that excise tax. It

remains to be seen how it benefits the people in general.” Pierluisi said that if both bills reach La Fortaleza, he will evaluate them with the advice of his agency heads. “At that time, if they come to my office I will make a clear decision …” he said. “I repeat that the positive impact of the tax reform is greater than the impact of eliminating La Crudita could have. I am simply saying that the fiscal impact of the tax relief is aimed primarily at the working middle class, and non-exempt people and corporations, and that is the bulk of that relief. I have said that it is more positive when you look at it, from the point of view of the impact on the economy, than eliminating La Crudita II. But I recognize that the relief of La Crudita II would also be positive.”

ike so much “legislative nonsense that penalizes the people” is is how the New Progressive Party (NPP) minority leader in the island House of Representatives, Carlos “Johnny” Méndez Nuñez, described the Popular Democratic Party’s (PDP) replacement for House Bill 1839, the so-called tax reform, on Tuesday. “It is painful to know that the Popular Party in its effort not to lower people’s taxes, has created legislative nonsense that is not viable at all and that, moreover, is designed to penalize the people,” Méndez Nuñez said. “The NPP delegation in the House rejects the

changes introduced by that group to House Bill 1839 and we reiterate that the PDP is the biggest obstacle that the people and our small and midsize businesses have to receiving a reduction in taxes.” “The PDP removed the language eliminating the sales and use tax [IVU by its Spanish acronym] at the docks, thus refusing to lower the tax burden on individuals,” the former House speaker pointed out. “Meanwhile, they don’t want to do anything to mitigate the inflation-driven increase in the cost of living. On the contrary, the amendments they introduced make it virtually impossible to lower taxes to match cost-of-living hikes. First of all, they force the Treasury Department to go to the

Legislature every year to ask for ‘permission’ to match benefits with increases in the cost of living, something highly bureaucratic and unrealistic.” Méndez Nuñez said that among other amendments that do not have the endorsement of the NPP are the elimination of the option for bona fide farmers to take advantage of a tax decree. The replacement bill also empowers lawyers to certify Alternate Basic Contribution expenses, without requiring them to have academic preparation in accounting. Another highly questionable aspect of the bill, Méndez Nuñez said, is the creation of a “distinction” in the tax paid for cocktails made with rum in relation to drinks made with other

types of alcohol. The bill also amends the language for beneficiaries of passive income exemptions to impose a fixed period of residence of 15 years before enjoying those benefits. That prevents Puerto Ricans who move back to the island from enjoying the benefits, Méndez Nuñez said. “Another example of the PDP’s tax punishment of people,” he said. “If a Puerto Rican, for example, who moved to Florida due to Hurricane Maria, decides to return to his homeland, he will not be able to take advantage of the tax benefits of the passive income exemptions before he lives here for 15 more years. That kills the concept of ‘We are all Law 22,’ because it penalizes our people again.”

ustice Secretary Domingo Emanuelli Hernández announced late Monday that Judge Héctor López determined cause for trial against Alexis Alicea Torres of Lajas, accused of sexually abusing and impregnating his daughter. “This case has shocked the people because of the abhorrent acts committed against a minor precisely by those who had a duty to care for her, guide her and protect her,” Emanuelli Hernández said in a written statement. “The process is being

carried out focused on the victim and her recovery, with the highest degree of empathy and a high sense of justice.” The accused, who was arrested on Aug. 14, will face trial on charges of incest, sexual assault, child abuse and threatening witnesses. The judge also found cause for trial against Liz Rodríguez González, the teenager’s stepmother, for three counts of child abuse under Article 59 of Law 246-2011. The arraignment will be held on Nov. 6, with the trial scheduled to begin on Dec. 4.

Mental illness treatment receives a long-awaited boost Governor inaugurates ASSMCA Mental Health Center in Bayamón, announces construction of psychiatric hospital with $87 million investment By THE STAR STAFF

W

hile mental health might not have been at the center of attention in years past in many places, Puerto Rico included, a number of governments, especially since the COVID-19 pandemic, have taken it into consideration and placed it higher on the list of public policy priorities. Puerto Rico is currently also taking mental health more seriously, as earlier this month the Capitol changed the colors it displays at night to green in honor of Mental Health Awareness Month. And on Tuesday, Gov. Pedro Pierluisi Urrutia, alongside the director of the Mental Health and Anti-Addiction Services inaugurated (ASSMCA by its Spanish initials), Dr. Carlos Rodríguez Mateo, and Health Secretary Carlos Mellado López, inaugurated the new Puerto Rico Mental Health Center (PRMHC) at Dr. Ramón Ruiz Arnau University Hospital in Bayamón. The center will provide outpatient, residential and community services to children, youth and their families as part of the public policy established to address and prevent severe emotional disorders, risky behaviors, controlled substance use, adjustment problems, and adaptation issues at home, school and in the community. With an investment of $1.3 million, sourced from state and federal funds, the PRMHC is affiliated with the ASSMCA and features five new programs to address and treat mental health, substance use, and abuse. The programs cater to the outpatient, intensive outpatient, and residential care levels for the age group of 0 to 20 years, as established under Puerto Rico’s Mental Health Law 408-2000. The new services will employ 120 specialized professionals. “My administration and I are firmly committed to providing a dignified quality of life for our people, and we are taking cutting-edge steps every day to strengthen and expand access to quality mental health services,” Pierluisi said. “Specifically, through the services and programs we are inaugurating today, we seek to ensure that our children and young people, as well as their families, receive the necessary early intervention to address diagnoses and substance dependence, allowing them to achieve their full development and overall well-being, and contribute to the society we all aspire to.” Rodríguez Mateo, the ASSMCA administrator, stated that after the closure in 2020 of the ASSMCA Mental Health Center in Bayamón due to the pandemic, on Tuesday a specialized public mental health center was inaugurated to provide psychiatric services for trauma, crisis events, and globally competitive addiction treatment. In addition to creating jobs for the medical profession, it integrates families and communities into the treatment. “Mental health is everything, as without it, there is no physical well-being,” Rodríguez Mateo said. “After traumatic and shocking events such as hurricanes, earthquakes, and a pandemic, our children and young people need specialized help more than ever. Through the renovated facilities of the Puerto Rico Mental Health Center by ASSMCA in Bayamón, we have launched first-rate programs for this population, with a public health approach that includes families and communities as support networks. We are proud to inaugurate a project that

facilitators, educational therapists, recreational therapists, occupational therapists and a substance abuse counselor. Meanwhile, the Intensive Outpatient Treatment Services program focuses on providing clinical services in the community to strengthen and maximize clinical services for children and youth, aimed at enhancing the provision of clinical services. Henríquez files gubernatorial candidacy under Dignity Project By THE STAR STAFF

da Norah Henríquez, who ran for resident commissioner under the Dignity Project emblem in the most recent election, filed her candidacy for governor Tuesday at the State Elections Commission. San Sebastián Mayor Javier Jiménez Pérez also announced his intention to run for governor, so he and Henríquez will face each other in primaries next February. Among her priorities, Henríquez said, is strengthening the public education system. “There are many people who have their children in the public education stream, which right now does not meet their needs and they cannot have economic mobility,” she said. Henríquez stated that she also would prioritize public safety, and the energy crisis and power outages plaguing the island. “Puerto Rico is without security and we need to restore that,” she said. “We have the electricity problem; not only is this a problem that affects families in Puerto Rico, but also small and midsize businesses.” In the 2020 elections, as the Dignity

Project candidate for resident commissioner, Henríquez obtained 95,873 votes – the most for any of that party’s candidates. Henríquez said she spoke with Jiménez and “we agreed that the primaries, far from weakening the party, were going to strengthen it, and that we were going to do another type of promotion to give the people a better option.” Dignity Project President César Vázquez, who supports Jiménez’s candidacy, said a primary would harm the party. Henríquez said Vázquez has not spoken with her. Henríquez left the Dignity Project governing council in 2021 due to differences with the leadership. She said Joseph Ortiz will be her campaign director. “He is a serious, committed man, with an extensive and impeccable career, and who shares my vision of Puerto Rico,” the gubernatorial candidate said in a written statement. Henríquez has a Juris Doctor from the Faculty of Law of the University of Puerto Rico and a bachelor’s degree in psychology with a dual major in sociology. In addition, she has worked as a family therapist and was certified as a conflict mediator.

Supermarket chain to release study focused on energy costs in food sector By THE STAR STAFF

he supermarket chain Selectos will release on Friday a study commissioned by economist José Caraballo Cueto, which measured the impact of current and future energy costs on food and the commercial sector in Puerto Rico, Selectos Executive Director Mayreg Rodríguez said Tuesday. The findings of the study “Impact of Energy Costs on Puerto Rico’s Trade” will also be analyzed by a panel of experts on energy and food security issues during the company’s 30th annual convention. “In our interest to contribute to improving food security in Puerto Rico, we wanted to commission a study that would measure what we perceive in our stores about the high impact of the cost of energy on the food sector to contribute to the country’s discussion and the search for solutions,” Rodríguez said. Rodríguez noted that Caraballo Cueto in his research made the correlation between Puerto Rico’s

energy cost and retail sales, the price of refrigerated products and that of meat and seafood in general. Caraballo Cueto, a professor at the University of Puerto Rico (UPR) Río Piedras Campus, contemplated not only the current scenario of energy costs in commerce and food, but also the future tax increases that are projected in the debt adjustment plan of the Puerto Rico Electric Power Authority (PREPA), which is in federal bankruptcy court for consideration. A forum to discuss the results of the study will be composed of Caraballo Cueto; Dr. David Sotomayor, a soil science professor at the UPR the Mayagüez Campus; engineer Johann Gathmann, a representative of the Green Building Council; and Ariel Torres, chairman of the Supermercados Selectos board of directors. “The findings we will present are really impactful for our sector and food security,” Rodríguez said. Caraballo Cueto added: “We can already say that the results show that the energy cost for the com-

mercial sector of Puerto Rico is the second highest when compared to the commercial cost in the states.”

Emmer drops speaker bid after right-wing backlash By LUKE BROADWATER

R

ep. Tom Emmer of Minnesota, the No. 3 House Republican, dropped his bid for speaker Tuesday hours after securing his divided party’s nomination, after a swift backlash from the right, including former President Donald Trump, left his candidacy in shambles. Emmer’s abrupt exit signaled that Republicans were as far as ever from breaking a deadlock that has left Congress leaderless and paralyzed for three weeks. It made Emmer the third Republican this month to be chosen to lead the party, only to have his bid collapse in a seemingly endless cycle of GOP grievances, personality conflicts and ideological rifts. Republicans have now succeeded in repudiating all three of their top leaders over the past few weeks. The chamber has been frozen for the better part of a month as Republicans feud over who should be in charge, even as wars rage overseas and a government shutdown approaches. Emmer began Tuesday with a scant victory, winning an internal party nominating contest by a vote of 117-97 over a right-wing rival, Rep. Mike Johnson of Louisiana. The margin reflected that House Republicans were still deeply at odds. Then immediately after Emmer’s nomination, about two dozen right-wing Republicans indicated that they would not vote for him on the floor, denying him the majority he would need to succeed in a vote of the full House. And as he met with holdouts to try to win them over, the former president issued a scathing statement on social media expressing vehement opposition to Emmer, calling him a “Globalist RINO” — short for “Republican in name only” — whose elevation would be a “tragic mistake.” “I have many wonderful friends wanting to be Speaker of the House, and some are truly great Warriors,” Trump wrote on Truth Social. “RINO Tom Emmer, who I do not know well,

is not one of them. He never respected the Power of a Trump Endorsement, or the breadth and scope of MAGA—MAKE AMERICA GREAT AGAIN!” A majority of those opposed to Emmer were members of the ultraconservative House Freedom Caucus and loyal to Trump. Any candidate for speaker can lose only a handful of votes and still win the speakership because Republicans hold such a small majority in the House. Only hours later, Emmer decided to drop his bid, according to a person familiar with his thinking who divulged it on the condition of anonymity before it was officially announced. The Republican disarray underscored a new ethos that has gripped the House GOP: Dozens of members have abandoned the old norms of respecting the winner of the party’s internal elections, and instead are acting according to their individual preferences, ideologies and allegiances. Some hard-right Republicans consider themselves a distinct political party from their more mainstream, businessminded colleagues, whom they accuse of being in a “uniparty” with Democrats. The House has been in a state of uncertainty and chaos since Oct. 3, when rebels forced a vote to oust Kevin McCarthy as speaker. Eight Republicans backed that move along with Democrats, who remained united behind their own leader, Rep. Hakeem Jeffries of New York. Republicans have cast aside two previous winners of their closed-door nominating process — Reps. Steve Scalise of Louisiana and Jim Jordan of Ohio — before settling on Emmer. Emmer began Tuesday by besting six other candidates vying for the job during a series of closed-door votes. Johnson, a conservative lawyer who is a favorite of the party’s right wing, endorsed Emmer after his loss, and said he was trying to persuade his colleagues to unite around him. But old rivalries helped to tank Emmer’s speakership bid. Feelings remained raw from a contentious race for

Jim Banks of Indiana. “I can’t go along with putting one of the most moderate members of the entire Republican conference in the speaker’s chair,” Banks said. “That betrays the conservative values that I came here to fight for.” Some on the right opposed to Emmer were citing his vote in favor of codifying federal protections for same-sex couples. Others railed against Emmer’s vote in favor of a stopgap spending bill put forward by McCarthy, the speaker at the time, to avert a government shutdown. Still others said he was insufficiently loyal to Trump, because he voted to certify the results of the 2020 election won by President Joe Biden. Emmer had attempted to mollify Trump by calling him over the weekend and praising him, according to the former president. But Trump made clear he had not been won over. “I believe he has now learned his lesson, because he is saying that he is Pro-Trump all the way, but who can ever be sure?” Trump wrote. “Has he only changed because that’s what it takes to win? The Republican Party cannot take

that chance, because that’s not where the America First Voters are. Voting for a Globalist RINO like Tom Emmer would be a tragic mistake!” The current free-for-all left more mainstream members of the party fuming. “Our conference has been essentially at war with itself,” said Rep. Brandon Williams of New York, who represents a district won by Biden. He called the situation “disheartening” and reminiscent of the movie “Groundhog Day.” “Most of the country’s concerned about inflation, what they’re experiencing at the grocery store, and they would like to see Congress stand up and act like adults,” Williams said. A former college ice hockey player and coach, Emmer, 62, currently holds the job of “whip,” the chief vote counter for the party. He has allies among both the conservative and the establishment wings of the party. He served two terms as the chair of the National Republican Congressional Committee, helping Republican candidates around the country win elections and making inroads across the conference in the process.

Menéndez pleads not guilty to plotting to be an agent of Egypt By TRACEY TULLY

S

en. Bob Menendez, D-N.J., pleaded not guilty earlier this week to a new federal charge that accused him of illegally plotting to be an agent of Egypt while serving as chair of the Senate Foreign Relations Committee. It was Menendez’s second not-guilty plea in a month after he and his wife, Nadine Menendez, were accused of being at the center of a broad web of political corruption. The couple has been charged with accepting bribes in exchange for the senator’s efforts to increase aid and weapons sales to Egypt while also working to quash criminal investigations for associates in New Jersey. The bribery-related charges were first announced last month by federal prosecutors in Manhattan; a revised indictment, made public on Oct. 12, included the new charge of conspiring to act as an agent of a foreign government. On Monday, a coalition of 25 organizations, including Citizens for Responsibility and Ethics in Washington, Center for American Progress, Project on Government Oversight, and Public Citizen, sent a letter to Menendez requesting that he resign. “These allegations paint a damning picture of a senator who seemingly repeatedly placed his own personal interests above the United States’ national security and democratic process,” the letter stated. But the senator, who had been planning to run for reelection to a fourth full term next year, has given no indication that he intends to step down. A fundraiser he held last weekend at an exclusive beachfront resort in Puerto Rico drew few donors, but he has roughly $8.6 million in campaign cash, which could be used to pay legal costs. A separate defense fund he set up over the summer has raised $275,000 from about 30 individuals and organizations, Senate records show. The fund returned a $5,000 donation last month from a New Jersey law firm run by Donald Scarinci, a longtime friend of Menendez’s. Scarinci said he was unsure why the donation was rejected, but indicated that it might have been because it came from his company, not his private bank account. “Bob has been my personal friend for a lifetime,” Scarinci said in an email. “As his friend, I am there for him in his time of need. dense “super fog” hovered over New Orleans on Monday, shrouding the area in an impenetrable mist that led to traffic pileups involving dozens of vehicles and leaving at least seven people dead, authorities said. At least 158 vehicles were involved in a series of crashes,

which began just before 9 a.m. on Interstate 55 northwest of New Orleans, the Louisiana State Police said, noting that fog had been a “contributing factor.” An additional 25 people were injured, some of them critically, police said. After the accidents, which involved vehicles in both northbound and southbound lanes, some vehicles caught fire, according to police. A tanker truck carrying “hazardous

liquid” was being removed, police said, adding that it was possible that “additional fatalities could be located.” The State Police urged anyone with a missing family member to contact the agency. Aerial images posted to the State Police’s Facebook page show several pileups on Interstate 55, including some cars and trucks that appeared to be charred. The thick fog came from a combination of moisture in the air and smoke from sporadic marsh fires across the Mississippi River Valley toward Baton Rouge, Louisiana, said Tyler Stanfield, a meteorologist for the National Weather Service in New Orleans. “It was the perfect storm,” Stanfield said. While super fog is uncommon, it’s not an unheard-of phenomenon. New Orleans typically experiences super fog twice a year. It is usually fueled by marsh fires, which have become more frequent in the area this year because of drier conditions, Stanfield said. The fog began to set in around 3 a.m. Monday and became dense around sunrise, he said. Visibility for drivers was down to as low as one-eighth of a mile. The State Police closed parts of Interstates 10, 55 and 310 on Monday morning and warned that, because of the heavy fog, “drivers should avoid the area if possible and use alternate routes.” Interstates 10 and 310 South later reopened, but portions of Interstate 55 remained closed Monday evening. UAW expands strike to a Ram plant in Michigan By NEAL E. BOUDETTE

I

n a major escalation of its six-week strike at the three large U.S. automakers, the United Auto Workers union earlier this week told 6,800 workers at a large Ram pickup truck plant in Michigan to walk off the job. Union workers at the Sterling Heights plant, which is owned by Stellantis, the parent of Ram, Chrysler and Jeep, joined the strike Monday morning. Shutting down production at the plant, the largest Stellantis factory in the United States, suggests there are still big gaps in contract negotiations between the automakers and the UAW, which is seeking raises of 40% over four years, better retirement benefits and other changes. The union’s strategy in this strike is a departure from its past practice of striking all locations of one automaker before beginning negotiations with the next automaker. This time, the union started with a strike at one plant at each of the three carmakers — Ford Motor Co., General Motors and Stellantis — and has expanded them to other factories and warehouses to increase the pressure on companies that it said were not doing enough to improve their offers. The new approach has kept the automakers off balance because they don’t know when or where the union will walk out next. It is also a way for the union to play the companies off one another. to full-time, cost-of-living adjustments, and more,” the UAW said in a statement Monday. In its offer, GM proposed raising workers’ wages 23% over four years. That would lift the wage for all full-time workers from $32 an hour to more than $40, giving them a base pay of about $84,000 a year, not including overtime or profit-sharing bonuses. The walkout at the Ram plant is the first escalation in the strike since the UAW called 8,700 workers to leave their jobs at Ford’s largest plant, in Louisville, Kentucky, on Oct. 11. That plant produces the Super Duty version of the popular F-150 pickup truck and the Ford Expedition, a full-size SUV. In a statement, Stellantis said the company was “outraged” by the expansion of the strike, noting that it made a comprehensive new proposal to the union Thursday morning and was waiting for a counterproposal from the UAW. “Our very strong offer would address member demands and provide immediate financial gains for our employees,” the company said. “Instead, the UAW has decided to cause further

harm to the entire automotive industry as well as our local, state and national economies.” UAW members were already on strike at one other Stellantis plant, a factory in Toledo, Ohio, that makes the Jeep Wrangler and the Jeep Gladiator. The union has also struck 20 Stellantis spareparts distribution warehouses around the country. Ram is one of the most important of Stellantis’ many auto brands, because of the popularity and higher prices that pickup trucks command in the United States. The plant, about a 25-mile drive north of downtown Detroit, makes Ram 1500 pickup trucks, the brand’s top-selling vehicle. In the first six months of this year, Stellantis reported about $12 billion in profit, more than GM and Ford combined. Wes Lutz, the owner of Extreme Dodge, a car dealership in Jackson, Michigan, said he had been watching the inventory on his lot dry up over the past six weeks and had struggled to replace parts on his customers’ vehicles. The Ram 1500 is the bestselling model at his dealership. Jeep models, some of which were targeted in the initial walkout, are also popular. Lutz said he was selling everything he had while getting a “slow drip” of new inventory. “I think it’s getting to a crucial time now,” Lutz said. “Another month and the faucet is going to be completely turned off.” Stellantis is a relatively new company, formed by the merger of Fiat Chrysler and Peugeot, the French automaker, in January 2021. The combined company is based in Amsterdam and has its U.S. headquarters in Auburn Hills, Michigan, near Detroit. Altogether, about 40,000 workers at Ford, GM and Stellantis are on strike across the country. In addition to the Stellantis locations, the union is on strike at Ford plants in Michigan, Kentucky and Chicago, and two plants in Michigan and Missouri and 18 warehouses owned by GM. The three automakers combined employ about 150,000 UAW members.

Wall Street Surges to Close Higher, Powered by Upbeat Earnings, Guidance W all Street ended higher on Tuesday as a spate of solid corporate earnings and upbeat forecasts stoked investor risk appetite and sparked a broad

All three major U.S. stock indexes advanced, with interest rate sensitive megacaps providing much of the upside lift as benchmark Treasury yields held steady, comfortably below their recent spike to 5%. Third quarter earnings season has shifted into high gear, and this week nearly a third of the companies in the S&P 500 are expected to post results. “The earnings season is only now just getting into full swing with a third of the companies reporting this week,” said Thomas Martin, senior portfolio manager at GLOBALT in Atlanta. “Prior to yesterday and today, the earnings reports were a bit on the disappointing side, and so this was the first couple of days we’ve had some more upbeat and better earnings.” Indeed, of the 118 S&P 500 companies that have reported so far, 81% have beaten analysts’ expectations, according to LSEG. The Dow Jones Industrial Average rose 204.97 points, or 0.62%, to 33,141.38, the S&P 500 gained 30.64 points, or 0.73%, to 4,247.68 and the Nasdaq Composite added 121.55 points, or 0.93%, to 13,139.88. Of the 11 major sectors in the S&P 500, utilities enjoyed the largest gain, while energy was the sole loser, weighed down by softening crude prices. Verizon surged 9.3% after raising its annual free cash flow forecast, while General Electric rose 6.5% after the conglomerate lifted its full-year profit forecast. Coca-Cola hiked its annual sales outlook, sending its stock up 2.9%, while 3M rose 5.3% on the heels of its upbeat quarterly report. The dollar retained its bid as a result and continued to probe the 150 yen level many suspect the Bank of Japan will be keen to protect against with open-market yen buying. But the buck did slip back on the euro as the European Central Bank meets this week to assess its 10 interest rate hikes over 15 months. The ongoing anxiety in the bond markets, however, prevented a return to risk assets more broadly and stocks continued to fall around the world first thing on Monday, with China’s blue-chip CSI300 index dropping to its lowest in 4-1/2 years as the property bust there continues to smolder. Geopolitical angst is never far from the surface in China. Shares of Foxconn Industrial Internet slumped 10% on reports its parent Foxconn, the Taiwan-based firm which is a major supplier of Apple’s iPhones, was the subject of tax audits and land use probes in China. Aerospace firm RTX jumped 7.2% after its results topped expectations.

On the economics front, business activity in the U.S. has ticked higher this month, according to S&P Global’s advance “flash” purchasing managers’ indexes (PMI). Calling the PMI a “goldilocks” report, Martin said it was “generally a good report” with prices moderating and “okay” employment. On Thursday, the Commerce Department is due to release its first take on third quarter GDP, which is seen showing a robust acceleration to 4.3% from 2.1% in the second

quarter. Death toll climbs in Gaza as Israel intensifies airstrikes By NADAV GAVRIELOV

he Israeli military said Tuesday that it had stepped up its bombardment of the Gaza Strip, where Palestinian officials said that hundreds of people had been killed, adding to the devastating toll as Israel faces pressure to delay a ground invasion in response to the Oct. 7 assault by Hamas. Israel said it had struck more than 400 targets in the past 24 hours — on top of more than 320 a day earlier — in some of the most intense aerial attacks on Gaza in recent days. The Gaza Health Ministry, which is controlled by Hamas, said that it had recorded the highest single-day death toll of the war: at least 704 people killed in dozens of strikes on homes, a refugee camp and other places. It was not possible to independently verify the toll. The intense strikes came as U.N. Secretary-General António Guterres said at a meeting of the Security Council that the Oct. 7 attacks by Hamas — which he described as “appalling” — cannot justify “the collective punishment of the Palestinian people.” The attacks by Hamas, which Israeli officials said killed more than 1,400 people and led to the abduction of more than 200 others, “did not happen in a vacuum,” Guterres said, adding that Palestinians had been subjected to 56 years of “suffocating occupation.” His comments prompted fierce backlash from Israel’s ambassador to the U.N., Gilad

Erdan, who called on Guterres to resign in a post on social media. Israeli military officials say they are well prepared for a ground assault in Gaza, but it remains unclear when and if such an invasion will occur. During the delays, Israel has intensified its bombardment from the air. Israel says it will destroy Hamas. But who will govern Gaza? By STEVEN ERLANGER

A

s Israeli soldiers have massed to enter the Gaza Strip in force, the defense minister has promised them, “You see Gaza now from a distance; you will soon see it from inside.” Yet despite this vow from the minister, Yoav Gallant, it is not clear when Israel will mount a ground invasion. And if the government appears hesitant to enter Gaza — more than two weeks since the Hamas attack that killed more than 1,400 Israelis — there are good reasons to be. What lies ahead is a kind of sustained urban warfare that the country’s military forces have not encountered for nearly a decade, and in pursuit of a political end that remains unclear aside from vanquishing Hamas, which controls Gaza, so that it can never again threaten Israeli citizens. By itself, that is a tall order that will require the Israelis to establish control over Gaza for themselves, and one which will cost significant amounts of blood, treasure and international outrage over civilian deaths. And hovering over everything is the political conundrum of what happens to Gaza after the war ends. Once in, how does Israel get out? Once it has dismantled Hamas, if it can, to whom will it hand the keys? If Hamas no longer governs Gaza, who will? For the moment, Israeli officials say, those questions are not their immediate concern. But they will be unavoidable, even if Gaza becomes the responsibility of a new Israeli government. “In truth, there are no good options for an Israeli ground offensive in Gaza,” Tom Beckett, a retired lieutenant general of the British army and executive director of the Middle East for the International Institute for Strategic Studies, wrote in a brief analysis. “No matter how successful the operation proves in defeating Hamas as a military organization, Hamas’ political imperative and the population’s support for the resistance will continue,” he wrote. “Israel either reoccupies Gaza to control it or, by withdrawing after an offensive, cedes ground to people for whom the resistance is existence.” Rear Adm. Daniel Hagari, the Israeli army spokesperson, has said that the military “is focused on the objectives of the war as defined by the political echelon: the rout of Hamas and the elimination of its leaders after the slaughter they perpetrated on Shabbat. “This organization will not rule Gaza military and politically.” But somebody must. That is one weakness of the Israeli strategy, because Hamas represents a political and religious idea that cannot be dismantled, and it is an organization that has thrived on its reputation among Palestinians for embracing armed struggle and “martyrdom” against Israel. “Even if militarily defeated, Hamas cannot be neutralized,” said Lina Khatib, director of the Middle East Institute at SOAS University of London. “That the existence or legitimacy of Hamas is linked to its military success is false. It can be militarily defeated and remain politically relevant,” she said. “It can present any defense as heroic martyrdom for the sake of the liberation of the Palestinian people.” For Lawrence Freedman, emeritus professor of war

Examples abound, including U.S. military victories in Iraq and Afghanistan in the name of broad and ambitious political goals, like democratization and gender equality, that have resulted in failure. Easy conquests ended in long, vicious counterinsurgency campaigns against local militias and radical Islamist fighters who knew the territory, who lived among the population and who did not obey the Geneva Conventions or the rules of war. And the governments established by the Americans required huge and continued amounts of Western cash and military support to survive. Freedman wrote about some of his concerns in The Financial Times. The Israelis, he said in a subsequent interview, risk a similar fate. “They have set themselves an ambition that is extremely hard to meet, because even if they deliver Hamas a heavy blow, they can’t stop its regeneration,” he said. Israel cannot occupy Gaza indefinitely and doesn’t want to, he said, adding, “And it can’t push the population into Egypt, which wants nothing to do with Gaza either.” So without a clear political strategy, Freedman said, “it’s hard to see if this goes anywhere.” In August 2014, after a serious Israeli-Hamas conflict, ideas were floated about what to do with Gaza, in a confidential options paper provided to the Times. It stated, presciently, that “a return to the status quo ante will produce a new war” and that the Palestinian Authority is “too weak and divided to govern.” The best solution, the paper suggested, was authorizing United Nations forces to control Gaza’s borders while Palestinian militias are disbanded and disarmed and the Israeli

and Egyptian blockade of Gaza is gradually lifted. In 2014, the paper presumed that Hamas would still control Gaza but might agree to moderate its behavior in return. The paper also pointed out that the existing U.N. Truce Supervision Organization, founded in 1948, retains a legal mandate to patrol Gaza, even though it left in 1996 after the Oslo Accords. Under a reconfigured mandate, UNTSO could both patrol Gaza’s borders and help disarm militias, while another existing international committee would coordinate donor aid. Nine years later, the paper may serve as a starting point. If Hamas and similar groups are destroyed in Gaza, as Israel vows, perhaps UNTSO could help keep the peace inside Gaza, too, as a kind of supplementary police force while the status and credibility of the Palestinian Authority are somehow resurrected there. The 2014 discussion was real, said Robert Serry, a Dutch diplomat who served as the U.N. Special Coordinator for the Middle East Peace Process. “We had hoped that the Palestinian Authority could be brought back,” he said. While that may be as unrealistic now as then, each time “we allowed the situation to go back to the status quo,” with a fragile cease-fire and “minimum arrangements to keep Gaza afloat,” Serry said. Now, he said: “I hope Israel learns a lesson. If they keep ignoring the Palestinian question, it will from time to time explode, it’s just a question of when.” In the current conflict, Israel will need to control what’s left of Gaza and garrison Israeli forces there until a political solution of some kind allows them to leave, which will stretch the army, especially if Hezbollah opens a second front from southern Lebanon or if there is a surge of violence in the occupied West Bank between Israeli settlers and Palestinians. Of course, if Gaza’s urban centers are smashed and the ground operations lead to the displacement of large parts of the population, it will be easier for the Israeli military to control Gaza without fully occupying it, said Khatib of SOAS. “It’s a tactic of war used by other regimes in the Mideast,” she said, citing President Bashar Assad of Syria and his scorched-earth tactics against his opponents there. Beckett agreed. “Brutality can reduce the numbers required for a counterinsurgency,” he wrote, citing the crushing of resistance in 1982 at Hama by the former Syrian president, Hafez Assad. His son, “Bashar Assad, supported by Russia, has applied indiscriminate brutality throughout the Syrian civil war,” he added. While the world is appalled by the Hamas killings and will likely give Israel more time than in the past to defeat Hamas, there are already calls for Israel to obey the Geneva Conventions and the rules of war, including from President Joe Biden and Secretary of State Antony Blinken. The inevitable deaths and wounding of civilians will, as it has always done, eventually bring significant pressure on Israel to negotiate a cease-fire, pressure, especially from Washington, that could become too much to bear before Israel has accomplished its stated military goal. Israel is already trying to prepare its supporters around the world, and especially in the United States, to resist that kind of pressure to stop its operation before Hamas is dismantled.

Jamaica fears brain drain as teachers leave for US schools By SIMON ROMERO

keef Saunders loves his job teaching history to high school students in Jamaica’s capital. But he is getting ready to leave for the United States, where a teaching job with a much bigger paycheck in North Carolina awaits him. “I have four kids to support, a mortgage, bills for food, water, electricity,” said Saunders, 49, who teaches at a Kingston high school. He said he plans to start out earning about $50,000 a year in United States, doubling his current salary after working as a teacher in Jamaica for the last 28 years. “When an opportunity like this comes up, you go for it,” he said. Saunders is joining an exodus of thousands of teachers from Jamaica in the last two years, primarily for jobs in the United States, Canada and Britain, as schools in those countries step up recruiting of foreign educators to address increasingly severe staff shortages. In the United States alone, nearly half of all public schools have been operating without a full teaching staff, according to the U.S. Department of Education, as enrollment in teacher preparation programs plunges. But the race to fill vacant teaching positions is creating havoc in the education system of Jamaica, the largest English-speaking country in the Caribbean, reflecting how school staffing challenges in rich countries are spawning a brain drain in parts of the developing world. than 1,500 Jamaicans left their jobs in the first nine months of that year. The crisis seemed to wane somewhat this year when only 427 teachers had announced plans to resign from the start of the year through mid-August. But just before classes were to begin in September, an additional 400 teachers submitted their resignations in less than two weeks, stunning education officials and school administrators. Overall, the sudden rush for the exits meant that Jamaica has lost about 10% of its teachers in just the last two years. “You can imagine what anxiety that created in the system,” said Fayval Williams, Jamaica’s education minister. “School boards have to be scrambling.” Adding to the stress on teachers who remain in Jamaica, administrators in parts of the country had to place even more students into already overcrowded classrooms. ribbean, such as Turks and Caicos and the Cayman Islands. “They’re going wherever the U.S. dollar is being paid,” said Baston, who has worked in education for 40 years. “It’s not like ‘I got my papers, yay, I’m off to North Carolina.’ Very often the teacher is weeping when they say they are migrating.” In the United States, foreign teachers get J-1 visas, which allow them to work temporarily in the United States, like au pairs or camp counselors. Nearly 5,800 teachers obtained such visas last year, up from about 2,800 in 2017, according to the State Department. States in the Southeast, including North Carolina, Georgia and Florida, are among the top destinations. Guilford County Schools, North Carolina’s third-largest school district, hired 42 international teachers this year, the largest such group in the district’s history. Thirtytwo are from Jamaica. Jamaica is especially coveted for such recruiting, which is often carried out by U.S. companies that specialize in locating and hiring foreign teachers. Jamaica has a large pool of skilled Englishspeaking teachers, making them well-suited for working in other English-speaking countries or in places like the United Arab Emirates or Japan, where English proficiency is prized. The Caribbean country also boasts an array of respected teaching training institutions. Tuan D. Nguyen, an associate professor at Kansas State University and an expert on educator shortages, said the influx of teachers from abroad is one key way to address teacher vacancies in the United States, which have increased sharply since the onset of the COVID-19 pandemic. Vacancies shot up to 55,000 positions this year compared with about 36,000 last year, Nguyen and other scholars determined, finding

that more teachers in the United States are leaving the profession than ever before. The reasons include stagnating or declining salaries in much of the country, a surge in job-related stress during the pandemic and laws in many states that make teachers unsure of what they can say in classrooms because of new legal limits on conversations about racism and other contentious topics. Nguyen said the rush to hire foreign teachers was without precedent during recent times. “There’s the moral and ethical issue of what this means,” he said. “If we’re taking teachers from these other countries what happens to students in those countries? They also need teachers. We need to consider the net effect.” Devon Thompson, 28, a Spanish teacher who in 2021 took a job in Macon, Georgia, said he was motivated not only by low pay but by the dysfunction he saw around him in Jamaica: overcrowded classrooms without airconditioning and teachers who were being “thrown under the bus by administrators.” But Macon, where he estimates that about 40 other Jamaican teachers have also recently found jobs, came with its own challenges, like bad behavior and students ill-prepared to advance to higher grades. “The level of disgust that we have in how education is created in our country — it’s the same way American teachers feel about their own system,” Thompson said, citing the low morale he’s seen among teachers in both countries. Still, he said he felt Jamaica could do more to retain teachers, starting with raising pay, an issue that the main teachers union has consistently been agitating for. “I get that we’re not a first-world country so we can’t get certain things,” he said. “But it’s not that we don’t have the money. We’re just not using it wisely.” Others disagree, noting that Jamaica already spends more than 5% of its gross domestic product on public education, which is relatively high compared with regional peers, according to the World Bank. For Jamaican teachers who are undecided about leaving their country for work, the issue often boils down to money. Donovan Edwards, 47, a high school science teacher from St. Catherine, near Kingston, said he needs to make improvements to his home and pay for his daughter’s university studies. He is planning on moving to Britain. “I’ve seen a lot of teachers who are retired and they are in poverty,” Edwards said, explaining that after 22 years of teaching he was still earning less than $24,000 a year. “I reached my breaking point.”

athan Thrall’s searing new book, “A Day in the Life of Abed Salama,” struck me as important even before the obscene massacres and mass kidnappings committed by Hamas this month lit the Middle East on fire. Today, with people still struggling to understand the contours of this deeply complicated conflict, the book seems essential. An expanded version of Thrall’s widely praised 2021 New York Review of Books article of the same name, the book follows a Palestinian man named Abed Salama as he searches for his 5-year-old son after a deadly school bus crash in the West Bank, a search hindered by Israel’s restrictions on Palestinian movement. Thrall, the former director of the Arab-Israeli project at the International Crisis Group, uses his reported account of the Salama family’s tragedy to offer a panoramic look at life under Israel’s occupation. He is deeply concerned with Palestinian grief, but he also writes rich portraits of Israelis, including Beber Vanunu, founder of a settlement in the West Bank, and Dany Tirza, architect of the separation wall that cuts through the territory. In it, Thrall was asked about his depictions of Israelis, and whether he had qualms about “humanizing the occupation.” “I was very glad to be asked that question,” Thrall told me. “Because that was absolutely the ambition of the book, to depict real people” rather than villains and saints. Because I admire “A Day in the Life of Abed Salama” so much, I agreed to moderate a talk with Thrall this Thursday in Brooklyn. But I’ve been shocked to learn that several of his other events, both in the United States and in Britain, have been canceled, either because of security fears or because it’s considered insensitive, right after the killings and abductions in Israel, to dwell on the plight of Palestinians. “How does one promote a program on this subject to a largely Jewish audience when people on all sides are being bombed, killed and buried?” Andrea Grossman, whose Los Angeles nonprofit called off an event with Thrall, said in The Guardian. American Public Media, which distributes content for public radio stations nationwide, even pulled ads for the book. “We aim to avoid any perception of endorsing a specific perspective,” an APM spokesperson said in an email, insisting that airing sponsorship spots for Thrall’s book would be “insensitive in light of the human tragedies unfolding.” Thrall is not alone; in recent weeks several literary and cultural events by pro-Palestinian speakers or groups have been either scrapped or relocated. On Friday, Pulitzer Prize-winning novelist Viet Thanh Nguyen was supposed to speak at 92NY, a major literary venue in Manhattan formerly known as the 92nd Street Y. That afternoon, however, the talk was abruptly called off, apparently because of an open letter Nguyen had signed about the “violence and destruction in Palestine,” as well as because of his past support for the boycott, divestment and sanctions movement against Israel. (The talk ended up happening instead at a downtown bookstore.) The Boston Palestine Film Festival moved online, nixing its live screenings. A Hilton hotel in Houston canceled a conference of the U.S. Campaign for Palestinian Rights, citing “security concerns.” Part of me shudders to view the unfolding catastrophe in Israel and Gaza through the provincial lens of America’s cancel culture debate. In some ways, that debate has now come full circle, because proPalestinian voices were being censored long before the phrase “cancel culture” existed, one reason the left was unwise in recent years to prevaricate about the value of free speech. But if someone as evenhanded as Thrall

now finds his talks being dropped, we’re in an especially repressive period. And in a time of war, particularly a war shrouded in fiercely competing narratives, free speech is more important than ever. I don’t like the fact that the statement Nguyen signed gestured only vaguely at Hamas’ slaughter of Israeli civilians. In calling off his Friday evening appearance, 92NY, a Jewish organization, was playing by rules much of the left established, privileging sensitivity to traumatized communities ahead of the robust exchange of ideas. And supporters of Israel are hardly alone in creating a censorious atmosphere; particularly on college campuses, it is Zionists who feel silenced and intimidated. A professor at the University of California, Davis, is facing investigation by the university for a social media post calling for the targeting of “Zionist journalists,” which said, “They have houses with addresses, kids in school,” and included emoji of a knife, an ax and three drops of blood. Nevertheless, a commitment to free speech, like a commitment to human rights, shouldn’t depend on others reciprocating; such commitments are worth trying to maintain even in the face of unfairness. “Art is one of the things that can keep our minds and hearts open, that can help us see beyond the hatred of war, that can make us understand that we cannot be divided into the human versus the inhuman because we are, all of us, human and inhuman at the same time,” Nguyen wrote on Instagram. If the statement he signed didn’t live up to his own words’ generous spirit, 92NY would have been a good place to ask him why. The moments when dialogue is most fraught and bitter is when leaders most need to model it.

ilegal de identidad, posesión y traspaso de documentos falsificados y violación a la Ley de Sustancias Controladas. El caso se originó a raíz de un referido del Departamento de Salud como parte de una alianza investigativa entre esa agencia y el Departamento de Justicia. La imputada entregó a la farmacia las recetas falsas que alegadamente

From ‘Goodfellas’ to ‘Killers of the Flower Moon’: How Scorsese has rethought violence

O

f all the haunting images and disturbing sounds that permeate Martin Scorsese’s “Killers of the Flower Moon,” none is more upsetting than the guttural cry from Mollie Burkhart (Lily Gladstone), a tortured wail of rage and grief that escapes her reserved visage when tragedy strikes. And it often does: “Killers of the Flower Moon” tells the true story, adapted from the book by David Grann, of how Mollie’s Osage community was decimated by murderous white men, who killed dozens of her tribe members for rights to their oil-rich land. Mollie’s howl of pain is not quite like any sound heard before in a Scorsese film. But in many ways, Scorsese is emulating her jarring cry in the ominous aesthetics of “Killers of the Flower Moon” and of his 2019 feature, “The Irishman.” The movies have much in common: their creative teams, expansive running times, period settings, narrative density and epic scope. But what most keenly sets them apart from the rest of Scorsese’s work is the element by which the filmmaker is arguably most easily identified: their violence. In these films, the deaths, which are frequent, are hard and fast and

blunt, a marked departure from the intricately stylized and ornately edited set pieces of his earlier work. “The violence is different now, in these later movies,” Thelma Schoonmaker, his editor since 1980, noted recently. “And often it’s in a wide shot. It’s hardly ever a tight shot, which is very different from his earlier movies, right?” It certainly is. Wide shots, for those unfamiliar with the lingo of cinematography, are spacious, open compositions, often full-body views of characters and their surroundings (frequently used for broad-scale action or establishing shots). Medium-wides are slightly closer, but they still allow us to observe multiple characters and their surroundings. The “tight shots” that Schoonmaker references as more typical of Scorsese’s earlier work are the medium shots, close-ups and extreme close-ups that place the camera (and thus the viewer) right in the middle of the melee. Take, as an example, one of Scorsese’s most effective sequences, the murder of Billy Batts (Frank Vincent) in his 1990 crime drama, “Goodfellas.” When Tommy DeVito (Joe Pesci) and Jimmy Conway (Robert De Niro) kill Batts, it’s dramatized in a flurry of setups and rapid-

fire edits: from a three-shot of Tommy’s initial punch, to an overhead shot of Batts hitting the floor, a low-angle composition (from Batts’ point of view) of Tommy pummeling him with his fists, then an alreadydollying camera that tracks Henry (Ray Liotta) as he goes to lock the bar’s front door. Scorsese cuts back to Tommy landing more punches, then cuts to Jimmy contributing a series of kicks, with a quick insert of a particularly nasty one landing on Batts’ brutalized face. We then see, briefly, Tommy holding a gun, Henry reacting to all of this in shock, more kicks from Jimmy and more punches from Tommy, as blood spurts from Batts’ face. It’s a signature Scorsese scene, combining unflinching brutality, dark humor and incongruent music (the jukebox is blasting Donovan’s midtempo ballad “Atlantis”). It’s a tough, ugly bit of business — and it’s also pleasurable. There is, in this sequence and much of Scorsese’s crime filmography, a thrill to his staging and cutting that is often infectious. He’s such an electrifying filmmaker that even when dramatizing upsetting and difficult events, we find ourselves swept into the visceral virtuosity of his mise-enscene. It’s this duality, the discomfort of enjoying the actions of criminals or killers

or vigilantes, that makes his pictures so potent: Jake LaMotta’s beatings in “Raging Bull,” the high-speed execution of Johnny Boy in “Mean Streets” and particularly the gun-toting rampage of Travis Bickle at the end of “Taxi Driver” are all the more disturbing because of the spell Scorsese casts. That’s not how the violence works in “The Irishman” and “Killers of the Flower Moon.” When people die in these films, it’s grim, nasty, divergent in every way from the dirty kicks of “Goodfellas” or “Casino” (1995). In “The Irishman,” Sally Bugs (Louis Cancelmi) is dispatched in two setups, one wide and one medium, bang bang bang; the deaths of Whispers DiTullio (Paul Herman) and Crazy Joe Gallo (Sebastian Maniscalco) are likewise framed wide, hard and fast — simple, bloody, done. One of the film’s most upsetting scenes, when Frank (De Niro) drags his young daughter to the corner grocery store so she can watch him beat up a shopkeeper, is staged with similar simplicity: Scorsese keeps the scene to a single wide shot as Frank goes in, drags the man over his counter, smashes him through the door, kicks him, beats him and stomps on his hand. Scorsese cuts away only once — to the little girl’s horrified reaction. Scorsese carries this sparseness into “Killers of the Flower Moon.” An early montage of Osage people on their deathbeds concludes with the murder of Charlie Whitehorn (Anthony J. Harvey), who is killed in two cold, complementary medium-wides. Another character is hooded on the street, dragged into an alley and stabbed to death, with all of the action in two wide shots; a third is knocked down in one wide shot, then thrashed to death in a low-angle medium. The mayhem is over before it even starts. Perhaps Scorsese was ready to dramatize violence as he remembered it, rather than how he had seen it in the movies. Or perhaps, at age 80, he is acutely aware of his own mortality, and that awareness is affecting how he sees and presents death in his own work. Scorsese ends “The Irishman” with Frank literally picking out his own coffin and crypt; side characters are all introduced with onscreen text detailing their eventual deaths (“Frank Sindone — shot three times in an alley, 1980”). It’s coming for everyone, Scorsese seems to insist, not in a razzledazzle set piece, but in a sudden moment of brutality, shrouded in a cold, endless silence.

Many of his flourishes are familiar (although rendered with great visual originality), like the puzzle-solving detectives prowling an industrial urban landscape depicted in stark chiaroscuro. The mystery at the heart of the film, however, burns unquenchably: It illuminates no answers or evidence, but only a people’s blazing desire for self-determination. (Rent it on Amazon.) ‘The Foolish Bird’ If you saw and liked the film “Stonewalling,” by directors Huang Ji and Ryuji Otsuka, which was released in theaters earlier this year, their 2017 movie “The Foolish Bird” — newly streaming on the Criterion Channel — is a must-see. Like its successor, “The Foolish Bird” is a somber, delicately crafted drama about the nexus of ruthless capitalism and patriarchal violence that ensnares young women in China. Here, a shy and bullied high schooler, Lynn (Yao Honggui), charts a difficult coming-of-age in the shadow of sexual violence in a small Hunanese city. The recent rape and murder of a girl has shaken the town, but it doesn’t dampen the yearning of Lynn and her friend May to break free of their restrictive, impoverished home lives. They start selling stolen phones to make some extra cash but find themselves repeatedly — and in some instances, brutally — fenced in by a world where it seems like masculinity, rather than money, is the real currency. ‘Back Home’ In this gentle French drama, a man, Thomas (Niels Schneider), returns to his hometown after 12 years away and confronts a family in disarray. His mother is on her deathbed; his father still has not forgiven him for leaving; and his sisterin-law, Mona (Adèle Exarchopoulos), whose husband died under mysterious circumstances, struggles to raise her 6-year-old son. Grief hangs over the house and the adjoining farm, which debt has chipped away over the years. Thomas feels his way through this emotional fog, finding his way back into the family through his young nephew, Alex (Roman Coustère Hachez). Jessica Palud’s film is remarkably simple yet dense with feeling, thanks to an ensemble of sensitive performances. Exarchopoulos exudes both sensuality and suffering, and Schneider simmers with love and hurt, but Coustère Hachez is the standout: His precociousness and mischief perfectly embody the ways in which children can usher in the future when adults are too mired in the woes of the past. ‘Aachar & Co.’ Boxy vintage cars, creaky dial-up phones and women traded off in marriage like cattle: Set in the 1960s and ’70s in the South Indian city of Bangalore (now Bengaluru), this period drama by Sindhu Sreenivasa Murthy (she also stars) combines nostalgic charm with a whip-smart satire of fusty old patriarchal traditions. When the film opens in 1960, the fearsome Madhusudhan Aachar (Ashok), an engineer with a temper, is the envy of his neighbors with his government job, big house and 10 children. Three are boys who he hopes (or rather, demands) become engineers like him, and seven are girls he hopes to match with successful husbands. As the film zips through the next two decades, a multitude of weddings, unexpected deaths and births shift the family’s fortunes, as do changing attitudes about marriage and women’s social roles. Narrated with great wit and charming irony and brimming with gags (three neighborhood gossips, nicknamed BBC for their initials, appear every now and then like a Greek chorus), “Aachar & Co.” is a clever, Austenian take on the great Indian wedding melodrama. This store-bought spice blend makes everything taste better By ERIC KIM

of just-fried chicken karaage, or to gently awaken it in a warm pool of olive oil before tossing with noodles. Whether you keep that red-capped bottle next to your salt and pepper shakers is up to you, but your world will certainly be better for it.

A

t Sushi Yoko in Norcross, Georgia, as at Japanese restaurants across the world, each booth has a red-capped bottle of shichimi togarashi, the seven-spice blend that makes food taste spicy, savory, nutty and electric all at once. This combination delivers an exciting interplay of dried red chile, orange peel, sesame seeds (both black and white), sansho peppercorns, seaweed and often ginger. It enhances food without overpowering it, which is why everyone should keep a bottle in the pantry. “Shichi” means seven, and “togarashi” refers to the Japanese red chile that grounds the mix. The six other ingredients depend on the brand and, when made at home, on the cook. Some variations might include poppy seeds, hemp seeds and yuzu peel. A successful shichimi togarashi (sometimes called nanami togarashi) offers a kaleidoscope of tastes, each turn of the tongue showing off a new combination. Sushi Yoko’s chef, Tomonori Nakamura, likes to dust it over yakitori but wants his customers to use it on whatever they like. A bowl of his tempura udon wouldn’t be complete without a sprinkle of shichimi, which, at his diner-like restaurant, you can find next to the salt and pepper shakers and soy sauce decanter. Rie McClenny, whose debut cookbook “Make It Japanese” (written with Sanaë Lemoine) comes out this month, uses it as a finishing spice for soba, deviled eggs and tonjiru, a pork and vegetable soup flavored with miso. It lends a layered spiciness, she said, with pops of mildness from sesame and citrus, and soothing warmth from sansho pepper. McClenny first saw an application of shichimi togarashi in a non-Japanese setting as an intern at a restaurant in the Manhattan neighborhood of NoLIta. The spice blend was added to melted butter, which then coated fried chicken wings to astounding results. “It opened my eyes,” she said. Though shichimi togarashi is classically used in Japanese cuisine as a finishing spice, there are many ways to extend its multidimensional flavors beyond a lastminute sprinkle. Maple-soy pork chops with shichimi togarashi Shichimi togarashi is a citrusy, savory Japanese seven-spice blend featuring ground red chiles, roasted orange peel, black and white sesame seeds, sansho pepper, seaweed and often ginger. You can extend those sharp, multilayered flavors with lime juice, maple syrup and a touch of soy reduced to a sticky pan sauce that slicks quick-cooking pork chops in this easy recipe. Try to find bone-in loin chops with nice fat caps around the curved outer edges for richness and succulence. Serve with white rice and green beans, or alongside a big crunchy salad. Yield: 2 to 4 servings Total time: 25 minutes

Ingredients: 4 bone-in (1/2-inch-thick) pork chops Kosher salt and freshly ground black pepper Zest and juice of 1 lime 2 tablespoons maple syrup 2 teaspoons soy sauce 1 teaspoon shichimi togarashi (see Tip), plus more for serving Neutral oil, such as canola or grapeseed 2 tablespoons cold unsalted butter 1. Cut two shallow slits into the fat cap of each pork chop to help the chops stay flat as they cook. Season the chops with salt and pepper. (If you have time and want to ensure juicy meat, refrigerate to dry-brine for at least 30 minutes or up to 24 hours.) 2. In a bowl, stir the lime juice, maple syrup, soy sauce, shichimi togarashi, 1/2 teaspoon salt and 3 grinds of pepper to combine. 3. Heat a large skillet over mediumhigh. Add enough oil to lightly coat the bottom. Working in batches as needed, add the chops and cook until browned and crusty, about 2 minutes per side. Transfer to a plate to rest. 4. Add the lime juice mixture to the pan, still over medium-high, and let it bubble up and cook, stirring constantly, until syrupy, 30 seconds to 1 minute. Off the heat, add the butter and stir until combined. Add the chops back to the pan and turn to coat in the sauce. Transfer to plates, pouring any leftover sauce over the meat. Sprinkle with the lime zest and additional shichimi togarashi, if you’d like. Tip: You can find a bottle of shichimi (sometimes labeled nanami) togarashi at a Japanese or Asian grocery store; it’s easy to buy online, as well. But to make your own with other pantry ingredients, stir together 1/2 teaspoon ground cayenne,1/4 teaspoon ground ginger and 1/4 teaspoon sesame seeds (black or white, or both), plus a couple grinds of black pepper. For fullspectrum flavor, you could also include a pinch of sumac for sourness, a fleck of crushed dried seaweed for savoriness and a dash of poppy seeds for sweet nuttiness. These aren’t traditional ingredients by any means, but they get you close when you’re in a pinch.

Orders for other details like logos and crests were expedited at other facilities, sometimes leapfrogging the production of apparel for other Adidas teams. To cut down on shipping times, the first batches of the Messi jerseys were sent out in small shipments, almost as soon as they came off the production line. The frantic production effort worked. Initially, Adidas had told its retailers to begin selling jerseys with a promise of delivery by Oct. 15. But the first editions arrived in the United States by July 18. They were sent straight to Miami, where demand was highest. They sold out almost instantly.

A

ll of a sudden, after a single summer, the pink jersey is everywhere. It has become almost impossible to acquire, yet there it is, paradoxically, on the backs of thousands of fans thronging American stadiums, hanging from market stalls in Bangkok and Buenos Aires, Argentina, a vivid flash on almost every field where children gather to play soccer in England. That the jersey has become, apparently overnight, the hottest piece of sports merchandise on the planet is a simple, capitalist equation: the result of an irresistible combination of one of the most recognizable and beloved athletes of his generation; a distinctive, exotic color; and the ruthless efficiency of textile factories in Southeast Asia. Somehow, though, few people saw it coming. Tor Southard was better placed than most, but even he was caught unaware. As Adidas’ senior director for soccer in North America, he had been receiving emails from colleagues for nearly a year asking if the company’s biggest star, Lionel Messi, would be joining Inter Miami, also a client of Adidas. As far as he knew, it was just a rumor. Like the rest of the planet, Southard learned it was true only on June 7, the day Messi announced his intentions in a rare interview with two Spanish news outlets. For many, the immediate question was the soccer one. Six months after winning the World Cup with Argentina, why was Messi, the finest player of his generation and arguably the best of all time, leaving the elite clubs and competitions of Europe to join a team that ranked among the worst in the comparative backwater of America’s top league, Major League Soccer? For Southard, and for Adidas, there was a rather more pressing matter. Within a couple of days of Messi’s announcement, the company had received almost 500,000 requests from stores and suppliers for jerseys in Miami’s soft, electric pink. It is a specific fabric and a specific shade: Pantone 1895C. “It’s not like it

Even if they could not foresee quite what a phenomenon the jersey would become, and quite how many people would clamor to get their hands on one, Southard and his colleagues had some sense of what was about to happen. Adidas was going to need more of that fabric. A lot more. ‘No. 1 priority’ On the day Messi announced he would sign for Inter Miami, Adidas had a stock of Inter Miami jerseys in stores and storage facilities around the United States. It did not last. The shirts sold out so quickly that Southard said it seemed the inventory simply “evaporated.” Getting the fabric to make more — and fast — was just the first step. Although Adidas would not start selling official Messi jerseys until his contract was formally signed on July 15, it placed orders for vast rolls of the pink fabric needed to make them within 24 hours of his interview on Spanish television in the first week of June. The risk, of course, was that the deal

could still collapse. “It’s a trade-off you make for speed,” Southard said. In ordinary circumstances, retailers order jerseys as many as nine months in advance. Major sportswear brands, like Adidas and Nike, generally prefer to produce large batches of team gear, rather than manufacturing to meet demand, as fast fashion chains tend to do. Given the number of what the industry terms “chase buys” — a sudden influx of orders in unanticipated volumes — for Messi’s Inter Miami jersey, Adidas knew its usual playbook would not work. It had learned that from experience. In 2021, when Cristiano Ronaldo returned to Manchester United, one of the handful of retailers Adidas works with, Fanatics, asked for 1 million more jerseys. A year later, after Messi helped Argentina win the World Cup, Adidas had to produce and ship an extra 400,000 Argentine national team shirts in the span of three months. Getting pink jerseys bearing Messi’s name and No. 10 into the market, Southard said, immediately became Adidas’ “No. 1 priority, globally.”

‘Everyone has a hookup’ On a street corner in Miami’s wealthy Brickell neighborhood one evening last month, two young men had set up a pop-up Messi store, their racks groaning with Inter Miami jerseys in pink and an alternate version — black with pink trim — that the team wears on the road. This was the work of the imaginatively titled Messi Miami Shop. The name sounds official. The online store looks it, too. It sells two versions of the Messi jersey, as most sportswear manufacturers now do: a “player version” made with high-quality material and an athletic cut, and a “replica” designed for fans whose bodies might not have the precise dimensions of an elite athlete. The Messi Miami Shop is not, though, affiliated in any way with Messi, Inter Miami or Adidas. (It is, though, a shop.) Its jerseys had come, instead, from a contact in Thailand, purchased for $10 apiece. “This is Miami,” one of the sellers said. “Everyone has a hookup.” And a markup: The stall was selling the jerseys at $25 for a children’s edition and as much as $65 for an “authentic” inauthentic adult version of the team’s black jersey.

A few nights earlier, outside Exploria Stadium in Orlando, Florida, a different group of hawkers were doing their own brisk business in Messi jerseys. Messi was not playing that night — he missed several weeks of the season because of an injury — but Inter Miami was in town, and plenty of fans were prepared to pay $40 for a pink jersey bearing his name, even if it had shoddy stitching and was plucked from a backpack. Despite all of Adidas’ attempts to get its official Messi jerseys into stores as quickly as possible, the clamor for them — any version of them — has proved so great that counterfeits have flooded the global market to meet the shortfall. Although the company says it has now largely caught up with the backlog of orders, it has found that it is still selling jerseys far faster than it can produce them, and not just in the United States. In Buenos Aires, where Messi’s status as a national treasure was sealed by victory in the World Cup, there are

pink jerseys for sale in store after store and kiosk after kiosk along Calle Florida, one of the Argentine capital’s teeming shopping streets, and in the stalls of the bustling San Telmo Market. At some vendors, the fakes go for about $50. In Europe, where tribal affiliations to local clubs run deep, Miami jerseys are suddenly commonplace. At a training session for elementary school children last month in Manchester, England, the usual concentration of Manchester United, Manchester City and Liverpool gear was flecked with a half dozen pink Inter Miami jerseys, each bearing Messi’s name. It is difficult to overstate the scale of demand. Official sales have surpassed every benchmark Adidas could have imagined, Southard said: more than the frenzy that accompanied David Beckham’s move to the Los Angeles Galaxy in 2007; beyond the rush prompted by Ronaldo’s return to Manchester United in 2021; beyond the clamor for Messi’s Argentina shirt in the aftermath of Qatar 2022. Inter Miami is now the bestselling Adidas soccer jersey in North America, ahead of all five of the storied European clubs that the brand traditionally regards as the crown jewels of its portfolio: Manchester United, Real Madrid, Juventus, Bayern Munich and Arsenal. Since July, Fanatics, which dominates sports apparel

in the United States, has sold more Messi jerseys than for any other soccer player, and any athlete at all except Philadelphia Eagles quarterback Jalen Hurts. No player, in any sport, has ever sold more jerseys on the site in the first 24 hours after switching teams than Messi did in July. His cinematic arrival in MLS — with a late game-winning goal in his debut on July 22 — came too late to salvage Inter Miami’s season. The club will miss the playoffs, which start today. Messi will not play in pink again until next year. But that has done little to quell his impact. Inter Miami’s games drew record crowds from the moment he arrived. The team’s ticket prices for next season have soared. Adidas is confident that it has enough of the next edition of Messi’s jersey — due out in February — in production to meet demand. For many fans and retailers, it cannot come a moment too soon. The jersey has become so coveted, so scarce, that even Beckham himself — one of the most famous soccer players of his generation, a worldwide celebrity and, as part-owner of Inter Miami, Messi’s boss — has found it hard to get hold of one. More than once, he has wanted to send a pink Messi jersey to a friend or an associate as a gift, only to be told that he will have to wait, just like everyone else.

ary Lou Retton, a decorated Olympic gymnast, has been released from a hospital, one of her daughters said Monday, about two weeks after her family reported that the gold medalist had a rare form of pneumonia and was in an intensive care unit “fighting for her life.” “We still have a long road of recovery ahead of us, but baby steps,” McKenna Lane Kelley, Retton’s daughter, said on Instagram, noting that her mother was at home. “We are overwhelmed with the love and support from everyone.
