PIP, MVC won’t appeal ruling banning political coalitions to top court By THE STAR STAFF
T
he Puerto Rican Independence Party (PIP) and the Citizen Victory Movement (MVC by its Spanish initials) announced Monday they will not appeal to the commonwealth Supreme Court a ruling making it illegal for different political parties to form coalitions. The PIP and MVC are interested in reaching agreements on candidacies that have the support of both communities. To those ends, they legislatively and judicially challenged provisions of the Electoral Code approved before the 2020 election that prohibit coalitions of common candidates. “Efforts to get the Legislative Assembly to repeal the ban on common candidates were unsuccessful,” the political parties said. “Neither the NPP legislative minority, originally responsible for the ban, nor the current PDP legislative majority in the House and Senate, which had promised to repeal the 2020 code, gave way to the proposal to repeal the ban.” The two parties then jointly appealed to the judiciary so that, in exercising its responsibility as guardian of the Constitution, it would invalidate the ban as contrary to the fundamental constitutional rights of the two
parties and their candidates, their members, and the general electorate. “These are fundamental rights such as freedom of political association, the constitutional rights of all political parties, the right to vote, freedom of expression, and the prohibition of political discrimination that violates equal protection under the law,” they said. The Court of First Instance and the Court of Appeals both refused to invalidate the ban on a coalition of candidates. “The latter accepted our arguments regarding the justiciability of the lawsuit and recognized that both the plaintiff parties and the candidates Juan Dalmau and Manuel Natal pursue legitimate and valid objectives,” the parties said. “But since, in an uncertain future, other people could have illicit purposes, the Court of Appeals validated the prohibition imposed by the two political parties that have taken turns in the exercise of government power for decades, to the detriment of the rights claimed by the parties that threaten their control of legislation, the government and the electoral apparatus.” The lawyers who represented the PIP are Carlos Iván Gorrín Peralta, Arturo Hernández González and Juan Mercado Nieves. PIP and the MVC, there would be no time left to make it a reality. The electoral calendar has already begun to run. All political parties and their members have begun internal processes so that in less than two months the candidacies for all positions that will be subject to election next year will be formalized.” The PIP and MVC will now have to concentrate their efforts on the identification of candidates, on agreements on those candidacies that will have the support of both communities within the rigid demands imposed by current legislation, and on the political strategies so that the electorate can realize what the three branches of the government of Puerto Rico have refused to make viable, the parties said. “Neither the ruling of the Court of Appeals nor the prohibition of allied candidates will prevent the progress of the talks to forge an alliance that offers the country an electoral option to transcend the NPP-PDP rotation,” they said. Attorneys Juan Dalmau Ramírez and Manuel Natal Albelo will soon make an announcement on the results of the efforts to provide the electorate with viable options that change the island’s current course, the parties added.

he latest public service office in Puerto Rico to adopt an online approach to make things easier for citizens, the State
Elections Commission (SEC), unveiled at a press conference on Monday its new technological system, the ElectronicVoter Registry (eVR), with which the voter will be able -- from anywhere and in real time -- to carry out their electoral transactions electronically.
“Times move forward and push us to modernize and streamline electoral processes,” said Jessika Padilla Rivera, the SEC interim chairwoman. “With the help of technology, we intend to provide voters with direct access that allows them to have an easy, safe and direct way to carry out electoral procedures without the need to visit a board of permanent registration.” Now, from any electronic device, voters will be able to register and update their electoral records. Registering in the new eVR system is very easy, Padilla Rivera was quick to point out. She said voters will only need to have an email address, and complete and provide the information and required documents. The voter will receive a response once their request has been processed and approved. “With the eVR we give absolute power to the voter, converting their electoral registration into their property,” Padilla Rivera said. “We urge you to keep an eye on the SEC social networks and the portal cyber www.ceepur. org, where we will be providing information on how to use this new technological system.”
The official stressed that the new system is not a replacement in terms of the current system and how it works, but rather an additional tool to add to the SEC’s arsenal. “This doesn’t mean that individuals won’t be able to transfer and change data on their electoral cards the traditional way, it’s just an extra tool,” she said. Aníbal Sanbrana, deputy director of the Office of Information Systems and Electronic Processes (OISEP) added: “We have taken all of the precautions to make sure that all data is well protected, all of the servers are well protected. We are confident that voters’ data will not be breached.” In other words, voters should not be worried about cyberattacks, and the officials insisted on the system’s reliability. “Our systems … will have the capacity to withstand the volume of people who are going to use it,” OISEP Director Eduardo Nieves said. “While right now we don’t expect a high demand, our systems are prepared for when demand does come.”

Additionally, the expansion of the Toa Vaca Treatment Plant or the construction of a new water treatment plant in that area, as well as new pipelines for the areas currently served by groundwater wells, are under study.” Island Housing Secretary William Rodríguez Rodríguez noted that “these two important agreements with PRASA and PREPA address two instances of utmost importance for a large sector of our citizens.” “The mitigation funds that are being allocated for these projects, specifically, come to address situations that may occur in the future and thus mitigate damage,” he said. “At the same time, we are turning our island into a more resilient one. APPU wins union vote to represent UPR faculty By THE STAR STAFF

he Puerto Rican Association of University Professors (APPU by its Spanish initials) took 97 percent of the vote in an election held last week to become the union representing faculty at the University of Puerto Rico (UPR). “After 63 years of fighting for the recognition of our right to organize collectively, today the UPR teachers’ union is born,” said APPU President María del Mar Rosa Rodríguez, a professor at the UPR Cayey Campus, in a written statement. Rosa Rodríguez emphasized the importance of the milestone and thanked the professors for exercising their right to vote and supporting the APPU. “It is thanks to all that committed faculty that today we
can organize collectively and work for the university toward a future that we deserve, that students deserve and that the country deserves,” she said. Rosa Rodríguez stressed that the election marks only the beginning of the relationship between the newly formed union and the UPR. “Now we will begin to work on the draft of that first UPR teachers’ collective [bargaining] agreement and then sit down to negotiate,” she said. “We will do it in a participatory and inclusive way and we have all the know-how for the development of the agreement.” A celebration of the union victory has been scheduled for Friday, Dec. 8, with additional details to be made available on the APPU website.
The vote marks the beginning of the relationship between the newly formed faculty union and the University of Puerto Rico.
Senate votes to include Vieques in environmental preservation fund By THE STAR STAFF

arolina District Sen. Marissa “Marissita” Jiménez Santoni announced on Monday the approval of Senate Bill 571, which includes the offshore island municipality of Vieques as a participant in the Permanent Fund for the Environmental Preservation of Culebra. “I thank my fellow senators for endorsing this initiative that brings justice to the residents of the island municipality of Vieques,” said Jiménez Santoni, who authored the bill. “When the Fund was created, it was done under the premise that Culebra is
unique, butVieques also has its unique tourist charms. It is time for both island municipalities to benefit from the scope of this law.” Law 293-2004, better known as the “Permanent Fund for the Environmental Preservation of Culebra Law,” established a permanent fund to finance environmental preservation and maintenance work in Culebra, thus making possible a permanent alternative to allow, among other things, a payment source for the disposal of solid waste generated by the thousands of visitors to the small island municipality. The bill to include Vieques in the fund passed unanimously (22 votes in favor and none against) in session last Thursday.
In the evaluation of the measure, Vieques Mayor José Corcino Acevedo said “indisputably, our island of Vieques has ample reasons for its ecological integrity to be conserved and protected, just as the legal framework through Law 293-2004, supra, already protects the island of Culebra.” “Therefore, Vieques and Culebra, including their keys and surrounding waters, require a recurring source of economic resources that is destined to annually pay for all the studies, work, expert personnel and expertise necessary to achieve the aforementioned ecological conservation of our natural resources,” the mayor said.

T
he super PAC supporting Donald Trump will begin airing an attack against Florida Gov. Ron DeSantis in Iowa, a shift in strategy after months of focusing its messaging on its likely general election opponent. It will enter the rotation as part of an ad buy totaling hundreds of thousands of dollars by the group Make America Great Again, which supports Trump. It aims to paint DeSantis, with less than three months before the state’s first-in-the-nation caucuses, as insufficiently conservative, by accusing him of supporting statehood for Puerto Rico. It marks a change in approach by the super political action committee, which abandoned negative ads about DeSantis at the start of this past summer. The group shifted to focusing on the likely general election opponent, and attacking President Joe Biden, beginning in August, a move that might appeal to some primary voters but that also sent the message that Team Trump saw DeSantis as a fading threat. DeSantis’ team took something of a victory lap over the existence of the ad, with Andrew Romeo, a spokesperson, saying it showed that “after months of pounding their chest that they already had the race won, Team Trump is now being forced to publicly admit that Ron DeSantis is climbing in Iowa, and is a dire threat to their chances of securing the nomination.” Romeo described a litany of problems such as the southern border crisis and the war in the Middle East and said that amid all of it, “Team Trump inexplicably has decided to level false and hypocritical attacks on Ron DeSantis … about Puerto Rico.” An official with the super PAC declined to comment on the ad. Trump’s team appears to be trying to crush DeSantis

And the fresh attacks are coming as he tries to stave off Haley, pushing him into a two-front political battle with reduced resources. “Liberals have a plan to make Puerto Rico a state, adding two Democrats to the Senate, and Ron DeSantis sided with the liberals’ power play,” the ad says. “Ron DeSantis sponsored the bill to make Puerto Rico a state.” It ends by saying, “DeSantis sided with the liberals and sold out Iowa conservatives. Ron DeSantis is just plain wrong.” The topic of statehood for Puerto Rico, a U.S. territory since 1898, has been politically charged for years,
with many Republicans opposing it, suggesting it would help Democrats electorally. As a congressman, DeSantis, along with several other members, co-sponsored a bill that did not openly call for statehood for Puerto Rico, but laid out a path by which it could be accomplished. DeSantis’ state has a number of Puerto Rican constituents, and his support for an effort to explore a pathway to statehood was politically resonant in Florida. The ad comes as DeSantis is fending off the threat of movement in the state by Nikki Haley, the former governor of South Carolina, after DeSantis had held steady in second place for months, though well behind Trump. DeSantis’ team pointed to a statement Trump gave in early 2016, as a first-time candidate, in which he also supported a process for Puerto Rican statehood. But since then, and during his presidency, Trump was adamantly opposed to statehood, primarily after officials in Puerto Rico criticized his performance in response to Hurricane Maria. DeSantis has also been critical of Puerto Rican statehood more recently, and in starkly political terms. In a recent virtual event with voters in the Virgin Islands, which is holding its primary in February, DeSantis was asked about whether he would support territories gaining a voice in the Electoral College. “Well, how would the Virgin Islands vote for president — would they be red or blue?” he said to laughs, according to a recording of his remarks. “I don’t want to pony up three electoral votes for the other team.” He later added: “People are Americans and they should be treated as equal citizens. How that works with the Electoral College, you know, I’m not sure that there’s going to be necessarily a movement on that front.”

Biden to issue first regulations on artificial intelligence systems By DAVID E. SANGER and CECILIA KANG
P
resident Joe Biden was to issue an executive order Monday outlining the federal government’s first regulations on artificial intelligence systems. They include requirements that the most advanced AI products be tested to assure they cannot be used to produce biological or nuclear weapons, with the findings from those tests reported to the federal government. The testing requirements are a small but central part of what Biden, in a speech scheduled for Monday afternoon, is expected to describe as the most sweeping government action to protect Americans from the potential risks brought by the huge leaps in AI over the past several years. The regulations will include recommendations, but not requirements, that photos, videos and audio developed by such systems be watermarked to make clear that they were created by AI. That reflects a rising fear that AI will make it far easier to create “deepfakes” and convincing disinformation, especially as the 2024 presidential campaign accelerates. The United States recently restricted the export of high-performing chips to China to slow its ability to produce so-called large language models, the massing of data that has made programs like ChatGPT so effective at answering questions and speeding tasks. Similarly, the new regulations will require companies that run cloud services to tell the government about their foreign customers. Biden’s order will be issued days before a gathering of world leaders on AI safety organized by Britain’s prime minister, Rishi Sunak. On the issue of AI regulation, the United States has trailed the European Union, which has been drafting new laws, and other nations, like China and Israel, that have issued proposals for regulations. Ever since ChatGPT, the AIpowered chatbot, exploded in popularity last year, lawmakers and global regulators have grappled with how AI might alter jobs, spread disinformation and potentially develop its own kind of intelligence. “President Biden is rolling out the strongest set of actions any government in the world has ever taken on AI safety, security and trust,” said Bruce Reed, the White House deputy chief of staff. “It’s the next step in an aggressive strategy to do everything on all fronts to harness the benefits of AI and mitigate the risks.” The new U.S. rules, some of which are

But the order is aimed at the most advanced future systems, and it largely does not address the immediate threats of existing chatbots that could be used to spread disinformation related to Ukraine, the Gaza Strip or the presidential campaign. The administration did not release the language of the executive order Sunday, but officials said some of the steps in the order would require approval by independent agencies, such as the Federal Trade Commission. The order affects only American companies, but because software development happens around the world, the United States will face diplomatic challenges enforcing the regulations, which is why the administration is attempting to encourage allies and adversaries alike to develop similar rules. Vice President Kamala Harris is representing the United States at the conference in London on the topic this week. The regulations are also intended to influence the technology sector by setting first-time standards for safety, security and consumer protections. By using the power of its purse strings, the White House’s directives to federal agencies aim to force companies to comply with standards set by their government customers. “This is an important first step and,
importantly, executive orders set norms,” said Lauren Kahn, a senior research analyst at the Center for Security and Emerging Technology at Georgetown University. The order instructs the Department of Health and Human Services and other agencies to create clear safety standards for the use of AI and to streamline systems to make it easier to purchase AI tools. It orders the Department of Labor and the National Economic Council to study AI’s effect on the labor market and to come up with potential regulations. And it calls for agencies to provide clear guidance to landlords, government contractors and federal benefits programs to prevent discrimination from algorithms used in AI tools. But the White House is limited in its authority, and some of the directives are not enforceable. For instance, the order calls for agencies to strengthen internal guidelines to protect personal consumer data, but the White House also acknowledged the need for privacy legislation to fully ensure data protection. To encourage innovation and bolster competition, the White House will request that the FTC step up its role as the watchdog on consumer protection and antitrust violations. But the White House does not have authority to direct the FTC, an independent agency, to create regulations. Lina Khan, chair of the FTC, has already signaled her intent to act more aggressively as
an AI watchdog. In July, the commission opened an investigation into OpenAI, the maker of ChatGPT, over possible consumer privacy violations and accusations of spreading false information about individuals. “Although these tools are novel, they are not exempt from existing rules, and the FTC will vigorously enforce the laws we are charged with administering, even in this new market,” Khan wrote in a guest essay in The New York Times in May. The tech industry has said it supports regulations, though the companies disagree on the level of government oversight. Microsoft, OpenAI, Google and Meta are among 15 companies that have agreed to voluntary safety and security commitments, including having third parties stress-test their systems for vulnerabilities. Biden has called for regulations that support the opportunities of AI to help in medical and climate research, while also creating guardrails to protect against abuses. He has stressed the need to balance regulations with support for U.S. companies in a global race for AI leadership. And toward that end, the order directs agencies to streamline the visa process for highly skilled immigrants and nonimmigrants with expertise in AI to study and work in the United States. The central regulations to protect national security will be outlined in a separate document, called the National Security Memorandum, to be produced by next summer. Some of those regulations will be public, but many are expected to remain classified — particularly those concerning steps to prevent foreign nations, or nonstate actors, from exploiting AI systems. Halloween headaches in Salem, Massachusetts: Traffic. Crowds. Tiny liquor bottles? T he list of public nuisances in Salem, Massachusetts, in high Halloween season is long and weird: Rowdy crowds imperiling 17th-century gravestones. Unlicensed fortune tellers. Skirmishes over parking spaces at Gallows Hill or the Museum of Torture. This October, though, some city leaders and long-suffering residents have risen up against another scourge in Salem — the diminutive bottles of alcohol informally known as “nips.” Innocent as they may appear, with their pocket-size proportions and frequently fruity flavors, the single-serving, 50-milliliter bottles have been pilloried and placed on trial in Massachusetts in recent years as they have piled up, drained and discarded, in gardens, parks and playgrounds. Weary of the crunchy plastic carpet underfoot — and wary of their appeal to teens and closet drinkers — a growing roster of cities and towns is moving to ban nips altogether. For most, including Salem, reducing litter is the main objective. But the campaigns cannot help but carry a whiff of the region’s Puritanical origins. Some Salem residents said banning nips seems extreme, almost like a throwback to the intolerant era that spawned the city’s most shameful history. Residents acknowledged that litter is a problem, especially in October, when nearly 1 million Halloween celebrants visit the city — many of them dressed in pointed hats and spider web leggings — for the 40-year-old “Haunted Happenings” festival.
The monthlong event, featuring twilight ghost tours, haunted pub crawls and witch trial reenactments, triggers traffic gridlock so fearsome that residents of neighboring towns steer clear of Salem as early as mid-September. In this chaotic context, some locals said, a ban on nips seems like a drop in the bucket. “The problem is, people are just going to buy a bigger bottle,” said Brian Carter, a 30-year resident of Salem who paused his evening walk to watch a couple engineer a 12-foot skeleton into place outside a house on Derby Street. But the most popular cost about $1, including the ubiquitous, cinnamon-flavored Fireball (“tastes like heaven, burns like hell,” according to its slogan). At the Bunghole, a closet-size liquor store on Salem’s Derby Street, seasonal stock includes an “adult trick or treat” bag of 15 Fireball nips. Since Chelsea, a small city north of Boston, became the first place in Massachusetts to ban the sale of nips in 2018 — a step the city said reduced alcohol-related hospital admissions — the movement has spread. A ban in New Bedford, the one-time whaling port, set to take effect Nov. 1, was postponed last week under pressure from owners of the city’s liquor stores, who said they stand to lose hundreds of thousands of dollars in annual sales. Town meeting voters in Wellfleet, on Cape Cod, rejected a ban last month after heated debate, but victorious liquor store owners extended an olive branch, offering to add a 5-cent deposit to every nip sale and donate the funds to the town to help with recycling. Robert Mellion, president of the Massachusetts Package Stores Association, thinks a 5-cent deposit on nips statewide would be a better way to address the litter problem and has lobbied legislators for the change repeatedly without success, he said. Even when empties are returned, however, disposing of nips is complicated: The bottles are too small to be effectively recycled, according to the state, which recommends throwing them away instead. Attempts to pass statewide bans on nips in Maine and Rhode Island failed in recent years. Elsewhere in the country, Utah and New Mexico have enacted bans on most nip sales, as Chicago did 20 years ago. In Salem, some residents imagine eco-friendly substitutes for the wee plastic containers. A Reddit user jokingly proposed “a refillable flask program” in the Witch City, with “booze on tap in liquor stores.” William Legault, a former city councilor who tends bar at the Columbus Society Lounge, sees bigger problems. “If you want to do something about litter in Salem, ban cigarettes,” he said. “See how well that goes over.” Carter had another suggestion, one that some Salemites dream of every fall. “How about ban the Haunted Happenings,” he said, “and don’t bring all the people here?”

UAW says it aims to organize nonunion auto plants By NEAL E. BOUDETTE
A
fter winning major gains in wages and benefits from two of the three Detroit automakers, the United Auto Workers union is looking beyond the Motor City to car companies operating nonunion factories across the South. In a speech to union members livestreamed Sunday night on Facebook, the UAW president, Shawn Fain, said the union planned a push to organize plants at some of the nonunion automakers, such as Toyota, Honda and Tesla. “One of our biggest goals coming out of this historic contract victory is to organize like we’ve never organized before,” Fain said. “When we return to the bargaining table in 2028, it won’t just be with the Big Three. It will be the Big Five or Big Six.” The statement was one of Fain’s clearest to date that the UAW intended to renew efforts to unionize the plants of foreign-owned automakers and Tesla, which operates nonunion vehicle plants in California and Texas. The UAW has previously tried to unionize Southern auto plants — where workers typically make significantly less than the top UAW wage — with little success. While it has unionized some small component plants in the South, and represents workers employed by heavy truck manufacturers such as Mack and Freightliner, it has not been able to organize plants owned by any major automaker there. Volkswagen workers in Chattanooga, Tennessee, voted against UAW representation in 2014. Workers at a Nissan plant in Canton, Mississippi, did the same in 2017. UAW organizers have also tried to win support at a Mercedes-Benz plant in Alabama. Fain said the increased wages and benefits in a tentative contract agreement with Ford Motor Co. would help the UAW and other unions win gains for working-class people. Harley Shaiken, a professor emeritus at the University of California, Berkeley, who has followed the UAW for more than three decades, said the tentative agreements with Ford and Stellantis should improve the UAW’s image and lift its

On Sunday, a UAW council that oversees negotiations with Ford approved the tentative agreement hammered out with Ford on Wednesday. In a statement, Ford said it would give an assessment of how the contract affects its business after ratification. On Saturday, the union announced it had a tentative contract agreement with Stellantis, the maker of Chrysler, Jeep and Ram vehicles. The agreement closely follows the terms reached with Ford, a method known as pattern bargaining. Stellantis also agreed to reopen a plant in Belvidere, Illinois, that had been idled this year, and to keep an engine plant in Michigan and a machining factory in Ohio that the company had considered closing. Union workers have begun returning to work at the
three Ford plants that were affected by the union’s growing wave of strikes. Stellantis workers are expected to begin returning to work in the next day or so. The UAW began its strikes Sept. 15 and eventually expanded the action to include about 18,000 workers at three Ford vehicle plants and more than 14,000 workers at two Stellantis plants that make pickup trucks and Jeeps along with 20 Stellantis parts distribution warehouses. The union is continuing to negotiate with General Motors, and on Saturday expanded its strike against the automaker, telling workers to walk out at a factory in Spring Hill, Tennessee. All told, about 14,000 UAW workers are on strike at GM. The other affected locations include plants in Missouri, Michigan and Texas and 18 parts warehouses. In a statement, GM said it was “disappointed” by the expansion of the strike, adding, “We have continued to bargain in good faith with the UAW, and our goal remains to reach an agreement as quickly as possible.” Fain used most of his address to outline the details of the union’s tentative agreement with Ford. It calls for significant wage increases for many of the company’s 57,000 UAW workers. By the end of the agreement’s 4 1/2-year term, most workers will earn $40.82 an hour. That gives workers now earning the top wage of $32 an hour increases of 25%; for some workers lower on the wage scale, wages will more than double. At the new top wage, employees working 40 hours a week will earn about $84,000 a year. Profit-sharing bonuses and overtime work will enable many UAW members to make more than $100,000 a year. The tentative deal also gives workers additional paid time off, including two weeks of paid family leave and paid leave for jury duty. It also allows temporary employees, who currently earn $16.67 an hour, to gain permanent status after 90 days, and to rise to the top wage in three years. If the agreement is ratified by a majority of Ford’s UAW workforce, most workers will get an immediate 11% wage increase and will be given bonuses of $5,000 each.

Frazzled US stock investors eye frothy Treasury market as Fed looms
F
inancial markets are bracing for what could be a momentous week, with a Federal Reserve meeting, U.S. employment data and earnings from technology heavyweight Apple Inc (AAPL.O) possibly setting the course for stocks and bonds the rest of the year. October has lived up to its reputation for volatility, as a surge in Treasury yields and geopolitical uncertainty pressured stocks. The S&P 500 index (.SPX) is down 3.5% for the month, adding to losses that have left it over 10% off its late-July high. Whether the ride remains rough for the rest of 2023 may depend in large part on the bond market. The Fed’s ‘higher for longer’ stance on interest rates and rising U.S. fiscal worries pushed the benchmark 10-year Treasury yield - which moves inversely to prices - to 5% earlier this month, the highest since 2007. Higher Treasury yields are seen as a headwind to stocks, in part because they compete with equities for buyers. Investors worry that yields could rise further if the Fed reinforces its hawkish message at the central bank’s Nov. 1 monetary policy meeting. Strong U.S. employment data next Friday could also be a catalyst for yields to rise if it bolsters the case for keeping rates elevated to cool the economy and prevent inflation from rebounding. “Stocks will start to recover when the market believes that bond yields have peaked,” said Sam Stovall, chief investment strategist at CFRA Research. Overall, futures markets are pricing in a near-certainty that the Fed does not raise rates in November, and a nearly 80% chance that the central bank holds rates steady in December, according to CME’s FedWatch Tool. Still, policymakers have projected they will keep the key policy rate at current levels through most of 2024, longer than markets had previously anticipated. Investors are playing a “waiting game of how much does each economic data point need to increase to put another rate hike back on the table,” said Alex McGrath, chief investment officer for NorthEnd Private Wealth. With U.S. Gross Domestic Product growth at a sizzling 4.9% in the third quarter, signs that the labor market remains too hot, or the Fed sees the need for further tightening to control inflation, could fuel further volatility. “It feels like we are at a crossroads whether or not the strong growth we’ve seen over the summer months will continue over the fourth quarter,” and keep worries over inflation and restrictive monetary policy bubbling, said Charlie Ripley, senior investment strategist for Allianz Investment Management. Adding to the bond market’s concerns, the Treasury is expected to announce its upcoming auction sizes later this week. Worries about a growing federal deficit and increased supply have helped push yields higher. Investors are also awaiting Apple’s results on Thursday, during an earnings season with disappointments from some growth and technology giants, including Tesla and

Google. The tech-heavy Nasdaq 100 index is down 11% from its high, though still up nearly 30% on the year. Some investors believe the worst of the selling may be over. A stock market rebound would follow seasonal trends, said Stovall, of CFRA Research. Since 1945, the S&P 500 has advanced by an average of 1.5% in November, making it the year’s third-best performing month, he said.
More broadly, some believe the stock market’s trading patterns this year point to a rebound in the fourth quarter. In the 14 instances when the S&P 500 has gained at least 10% through July and then declined in August, as it did this year, the index has increased every time over the last four months of the year, according to Ned Davis Research. The average gain in those instances has been 10%. Stocks appear “oversold” according to technical indicators and could rally if economic data comes in as expected, said Randy Frederick, managing director of trading and derivatives for the Schwab Center for Financial Research. “The stock market is poised for a late Q4 rally.”

‘A very slow game’: Why the pace of Israel’s ground operation counts

n the 23 harrowing days since Hamas attacked Israeli civilians and soldiers, Israel’s Western allies have had to perform a delicate balancing act: expressing steadfast support for the country during its darkest hours, while navigating the growing public anger on their streets over the intensifying bombardment of the Gaza Strip. Israel’s neighbors in the Middle East have walked a different tightrope: managing outraged populations and, in some cases, proxy militant groups, which threaten to drag them into a broader war with Israel that they may not seek. For both, Israel’s unfolding ground invasion of the densely populated Gaza Strip has complicated their calculations. The phased nature of the operation has lacked the thunderous impact of an all-out infantry and tank assault, something Israel’s rivals had warned against, given the likelihood that it would cause untold civilian casualties. And yet the growing Palestinian death toll — more than 8,000, according to the Hamas-run Gaza Health Ministry — and the prospect that the fighting might go on for months, has drawn thousands of
protesters into the streets from London to Istanbul, demanding a cease-fire. Israeli officials said their planning was being driven by military, not diplomatic, imperatives: the need to prepare troops for a prolonged campaign; a desire to avoid harming the more than 200 people held by Hamas as hostages; and tactical concerns, such as searching for mines and other defenses laid by the militants. Yet the deliberate pace of the operation may nonetheless affect the response of allies and enemies, from the United States, which has offered Israel public support as well as private pleas for restraint, to Hezbollah, the Iran-backed militant group, which has peppered it with rockets from Lebanon but threatened to inflict more damage. On Sunday, President Joe Biden reaffirmed his support for Israel in a call with Prime Minister Benjamin Netanyahu. But he urged Netanyahu to “immediately and significantly increase the flow of humanitarian assistance to meet the needs of civilians in Gaza,” according to a White House readout of the conversation. While military considerations are driving Israel, “in the front of the minds of the planners was also the question, ‘Can so-

Hezbollah fired almost 20 rockets into Israel on Sunday, setting a house ablaze in Kiryat Shmona, near the Lebanese border, and prompting an Israeli response. But the attacks, an Israeli official said, were within a predictable range and did not suggest that Hezbollah was on the verge of joining the war. Iranian Foreign Minister Hossein Amirabdollahian said Sunday that his government does not want the war to “spread out.” Two weeks ago, he had declared that Israel would face a war on “multiple fronts,” waged by a network of militias across the region, if Israeli forces did not stop killing civilians in Gaza. “Israel hasn’t made the decision that it wants to test its foes,” said Daniel Levy, a former Israeli peace negotiator who now runs the U.S./Middle East Project, a think tank based in London and New York. “Both sides have that in their calculations. There’s a very slow game of chess that could quickly pick up pace.” Israel’s methodical approach has not prevented some Muslim leaders from hardening their rhetoric. Turkish President Recep Tayyip Erdogan told a vast pro-Palestinian rally in Istanbul on Saturday that Israel was “behaving like a war criminal.” Israel responded by pulling its diplomats out of the country. There are other signs of mounting international pressure. On Friday, the United Nations General Assembly passed a nonbinding resolution calling for a humanitarian truce in Gaza. The vote, which passed 120-14 with 45 abstentions, was supported by eight European Union countries, including France, which had previously expressed strong support for Israel’s right to defend itself. The fact that France voted in favor of the resolution is “problematic” for Israel, said Emmanuel Navon, executive director of ELNET Israel, a nonprofit group that seeks to strengthen ties between Israel and Europe. In the Security Council, Navon said, “Israel does not want to only rely on the U.S. veto.”
The Security Council has failed to pass any resolution on Gaza, neither condemning the Hamas attack on Israel nor calling for a cease-fire. Four attempts to do so have failed because of vetoes of proand anti-Israel resolutions by the council’s permanent members, including the United States, Russia and China. While Europe’s leaders continue to express public support for Israel, they are facing growing demands for a cease-fire in their own countries. Tens of thousands of pro-Palestinian demonstrators marched through London on Sunday, many expressing outrage that Britain has so far refused to back a truce. For the leader of Britain’s opposition Labour Party, Keir Starmer, the war has triggered a political mutiny. More than a dozen members of his leadership team in Parliament have broken with the party to call for a cease-fire, fracturing Labour’s show of solidarity with Israel in the days after the Hamas attack. uthorities in Colombia have mobilized the national police and the military to look for the father of soccer star Luis Díaz, a Colombian standout for the English club Liverpool whose parents were kidnapped in his hometown Saturday. Given soccer’s popularity here, the incident captured the South American country’s attention, but it also stoked fears of increasing insecurity in a nation where such kidnappings were becoming less common until a surge in recent years. Díaz’s mother, Cilenis Marulanda, was rescued hours after she was abducted, President Gustavo Petro of Colombia said Saturday night. Colombian national police, the military and a unit that specializes in kidnapping dispatched officers, soldiers, cars and aircraft to find his father, Luis Manuel Díaz. The parents of Díaz, who is known as Lucho, had been in a car at a gas station in Barrancas — a town in La Guajira, a region of northern Colombia along the Caribbean Sea and bordering Venezuela — when they were kidnapped by armed men Saturday afternoon, according to local reports and authorities. Salamanca told Díaz, 26, that Colombian authorities were sparing no effort in trying to find his father and that the situation had moved the country. He also told Díaz that he was in La Guajira and was headed to his hometown soon to help lead the operation.
Díaz is reportedly earning more than $3 million a year, and thus may have been a target for extortion, said Sergio Guzmán, director of Colombia Risk Analysis, a political risk consultancy, based in the Colombian capital, Bogotá. “I’m presuming it’s an extortion kidnapping, which wouldn’t necessarily be out of the norm, because Luis Díaz is not politically connected or an important player politically, and neither are his parents,” Guzmán said. “But his notoriety, his rise to fame and perceived wealth could be more for that kind of hostage taking.” Although kidnappings have dropped dramatically since Colombia’s peace treaty with rebels in 2016, Guzmán said the practice had surged over the past two years. The Revolutionary Armed Forces of Colombia, or FARC, used extortion kidnapping to fund their operations. But in recent years, Guzmán said, other criminal groups have been battling for territory previously held by the demobilized FARC, and thus more extortions, kidnappings and ransoms have been happening. “I think it feeds into the existing pessimism about the country’s security situation,” Guzmán said of the kidnapping of Díaz’s parents. He also noted that Colombians were voting Sunday in regional elections. “If you look at the latest polls, the majority of Colombians feel dissatisfied with the overall direction of the country, but also citizens feel less safe than they have previously,” he said. Soccer is the most popular sport in the country of nearly 52 million, and Díaz has shined for his country’s national team, winning the Golden Boot award, alongside Argentine superstar Lionel Messi, for being the top scorer during the 2021 Copa América tournament. Díaz’s father was a gifted amateur player in Barrancas and trained his son. The younger Díaz, who is of Wayúu descent and comes from an area often overlooked for soccer talent, rose from playing for his local Indigenous team to larger clubs in Colombia before eventually landing in Europe and then last year at Liverpool, one of the biggest clubs in the world, in the Premier League in England. Díaz, who has scored twice in nine appearances for Liverpool this season, was not in the lineup Sunday against Nottingham Forest after a last-minute change by Liverpool’s manager, Jürgen Klopp. He told reporters Sunday that what was happening to Díaz and his family was “a worrying situation for all of us and it was a pretty tough night.” After Liverpool player Diogo Jota scored during Sunday’s 3-0 win, he ran to the sideline and held up Díaz’s jersey. “It is our fervent hope that the matter is resolved safely and at the earliest possible opportunity,” Liverpool said in a statement Sunday morning. “In the meantime, the player’s welfare will continue to be our immediate priority.”

Searching for humanity in the Middle East By DAVID BROOKS

e’re living through an era of collapsing paradigms. The conceptual frames that many people use to organize their understanding of the world are crashing and burning upon contact with Middle Eastern reality. The first paradigm that failed this month was critical race theory or woke-ism. Yascha Mounk has a good history of this body of thought in his outstanding book “The Identity Trap.” But as it applies to the Middle East, the relevant ideas in this paradigm are these: International conflicts can be seen through a prism of American identity categories like race. In any situation, there are evil people who are colonizer/oppressors and good people who are colonized/oppressed. It’s not necessary to know about the particular facts about any global conflict, because of intersectionality: All struggles are part of the same struggle between the oppressors and the oppressed. This paradigm shapes how many on the campus left saw the Hamas terror attacks and were thus pushed into a series of ridiculous postures. A group of highly educated American progressives cheered on Hamas as anti-colonialist freedom fighters, even though Hamas is a theocratic, genocidal terrorist force that oppresses

These campus activists showed little compassion for Israeli men and women who were murdered at a music festival because they were perceived as “settlers” and hence worthy of extermination. Many progressives called for an immediate cease-fire, denying Israel the right to defend itself, which is enshrined in international law — as if Nigeria should have declared a cease-fire the day after Boko Haram kidnapped 276 girls in 2014. American universities exist to give students the conceptual tools to understand the world. It appears that at many universities, students are instead being fed simplistic ideological categories that blind them to reality. The second paradigm that fell apart this month was what you might call “pogromism.” This is the belief, common in Jewish communities around the world, that you can draw a straight line from the many antisemitic massacres in ancient history, through the pogroms of the 19th century, through the Holocaust and up to the Hamas massacres of today. In this paradigm, antisemitism is the key factor at work, and Jews are the innocent victims of perennial group hate. The paradigm has some truth to it but is simplistic. In fact, Israel is a regional superpower, not a marginalized victim group. Israeli indifference to conditions in the territories has contributed to today’s horrible reality. The Middle East conflict is best seen as a struggle between two peoples who have to live together, not as a blackand-white conflict between victims and Nazis. The third conceptual paradigm under threat is the
one I have generally used to organize how I see the Middle East conflict: the two-state paradigm. This paradigm is based on the notion that this conflict will end when there are two states with two peoples living side by side. People like me see events in the Middle East as tactical moves each side is taking to secure the best eventual outcome for themselves. After this month’s events, several assumptions underlying this worldview seem shaky: that most people on each side will eventually come to accept the legitimacy of the other’s existence, that Palestinian leaders would rather devote their budgets to economic development than perpetual genocidal holy war, that the cause of peace is advanced when Israel withdraws from Palestinian territories, that Hamas can be contained until a negotiated settlement is achieved, and that extremists on both sides will eventually be marginalized so that peacemakers can do their work. Those of us who see the conflict through this twostate framing may be relying on lenses that distort our vision, so we see the sort of Middle East that existed two decades ago, not the one that exists today. The worldview that has been buttressed by this month’s events is unfortunately the one I find loathsome. You can call it authoritarian nihilism, which binds Donald Trump, Vladimir Putin and other strongmen: that we live in a dog-eat-dog world; life is a competition to grab what you can; power is what matters; morality, decency, gentleness, and international norms are luxuries we cannot afford because our enemies are out to destroy us; and we need to be led by ruthless amoralists to take on the ruthless amoralists who seek to take us down. I don’t want to live amid that barbarism, so I’m hoping the Biden administration will do two things that will keep the faint hopes of peace and basic decency alive. The first is to help Israel reestablish deterrence. In the Middle East, peace happens when Israel is perceived as strong and permanent and the United States has its back. Second, I’m hoping the U.S. encourages Arab nations to work with the Palestinians to build a government that can rule the Gaza Strip after Hamas is dismantled. (Robert Satloff, Dennis Ross and David Makovsky of the Washington Institute for Near East Policy have sketched out how this would work.) Some events alter the models we use to perceive reality, and the events of Oct. 7 fit that category. It feels as if we’re teetering between universalist worldviews that recognize our common humanity and tribal worldviews in which others are just animals to be annihilated. What Israel does next will influence what worldview prevails in the 21st century.

El viernes, el juez Martínez Piovanetti sostuvo que la presidenta interina de la CEE, Jessika Padilla Rivera puede permanecer en el cargo hasta el día que culmina la Sesión Ordinaria el 14 de noviembre. Pierluisi Urrutia insistió que está disponible para reunirse con los presidentes de la Cámara de Representantes y el Senado para presentar a una persona que pueda ocupar la posición, luego de la renuncia de Francisco Rosado Colomer. “Y como yo he dicho anteriormente, yo siempre estoy disponible para dialogar, por ejemplo, con el presidente del Senado, el presidente de la Cámara, si quieren dialogar sobre nombramientos pendientes en la Comisión Estatal de Elecciones, o sea, no descarto que hacer algún nombramiento a futuro. Los árboles sembrados incluyen una variedad de especies autóctonas tales como el mangle botón, palmas de yarey, uva playera y árbol de María. “Esta es una iniciativa municipal que ha sido posible gracias a nuestra Oficina de Turismo, la Oficina para Manejo de Emergencias, y otras entidades dedicadas a la protección de nuestros recursos como el Departamento de Recursos Naturales y Ambientales, Para la Naturaleza, Campamento Carey, Ciudadanos Aguadeños Pro Conservación del Medio Ambiente y Surfrider Puerto Rico de Isabela”, señaló el Alcalde. Back in October 1993, “Nightmare” was released not as a Disney title but under the studio’s more adult-oriented label Touchstone Pictures. “They were afraid it might hurt their brand,” director Henry Selick said in a video call from his home in Los Angeles. “If they had put the Disney name on it right then, it would’ve been much more successful, but I understand it just didn’t feel anything like their other animated films.” Based on Burton’s original story and characters, the unusual picture was directed by Selick, by then a seasoned stop-motion artist with spots for MTV and a variety of commercials to his name. Burton’s frequent collaborators Michael McDowell and Caroline Thompson wrote the screenplay. Over the course of its original run, “Nightmare” grossed $50 million at the domestic box office. And while that number is by no means dismal, it’s a far cry from Disney animated hits like “Aladdin,” which just a year earlier brought in $217 million from U.S. screens alone. At the time, Disney couldn’t figure out how to market the operatic saga of Jack, a
lanky, sharply dressed skeleton, infatuated with bringing the wonder of Christmas to his monstrous friends in uncanny Halloween Town. Selick initially worried that the number of songs Danny Elfman had composed for the movie, a total of 10 tracks for the brisk 76-minute run time, would alienate viewers. In retrospect, he said, the memorable tunes were crucial to the film’s eventual success, once audiences connected with its unconventional rules of storytelling and design. These days Selick can’t go a week without running into a fan wearing a sweater, hat or other apparel emblazoned with “Nightmare” imagery. “This year there’s a 13-foot-tall Jack Skellington you can buy at Home Depot, and people have them on their lawns,” Selick said. “I like that because it’s pretty bizarre and extreme. That’s not just a T-shirt, that’s a real commitment.” For Burton, the character of Jack Skellington embodies a preoccupation common in his work over the years: the terrifying notion of being misunderstood. “The conception of it was based on those feelings growing up of people perceiving you as something dark or weird when actually you’re not,” he recalled. Selick compared the skeletal antihero’s amusingly manic behavior to Mr. Toad from the animated classic “The Wind in the Willows,” one of his favorite Disney protagonists. “I’ve always been drawn to characters like Jack Skellington,” Selick said. “He gets carried away with something new and goes way overboard with his enthusiasm.” For stop motion as a technique, “Nightmare” represented a watershed right before the advent of computer-generated animation. Selick credited the director of photography, Pete Kozachik, for introducing the tools that set the production apart, namely designing and building the rigs that allowed the heavy Mitchell film cameras to move a frame at a time. “That made the film so cinematic,” Selick said. “All the stop motion before had been done in lock shots or really simple little pans,” the mostly static visual language that limited other stories told in the same medium. But, Selick continued, “what Pete brought was this freedom of camera movement, which really turned it into a bigger movie.”

While there was talk of turning his concept for “Nightmare” into a TV special or realizing it in hand-drawn animation, Burton — who as a child adored Ray Harryhausen’s creations and Rankin/Bass tales like “Rudolph the Red-Nosed Reindeer” — held out until there was a team to do it in stop motion. “If you’ve ever been on a stop motion set and you see its tactile beauty, it is like going back to the beginning of making movies in the sense that it’s all about artists making puppets, sets, there’s a feeling that’s unlike any kind of thing,” Burton said. For Selick, one of the indicators that the movie had become a classic came a few years after the lukewarm reception to the theatrical release, but before Disney had fully embraced it. The director recalls children coming to his house trick-or-treating on Halloween night in homemade costumes of “Nightmare” characters before officially licensed versions existed. “I’d sometimes bring them in with their parents and show them the original figure of Jack as Santa in his sled with the reindeer that I kept, and they would just scream with joy,” Selick recalled while pointing his camera to the fragile figure in a glass display case. “It’s not really mine or Tim’s or Danny’s anymore,” Selick said. “It’s the world’s movie, and I kind of like that.” Since 2001, the Haunted Mansion ride at Disneyland has been transformed every fall
into a “Nightmare”-inspired attraction known as Haunted Mansion Holiday. And each year, from early September through October, Disneyland hosts the Oogie Boogie Bash, a Halloween party three nights a week featuring and named after the movie’s rambunctious villain. Burton believes these displays epitomize the film’s evolution from unclassifiable oddity to a uniquely beloved property. “When I see that, I go back to the early days when the film was first being done, and thinking of the journey that it’s taken, this symbolizes it in a very strange way,” said Burton. Selick added that he was invited the first year of the Haunted Mansion Holiday. “They didn’t try to turn it into one of their other characters,” he said. “They really got the aesthetic of the designs just right.” A sequel novel, “Long Live the Pumpkin Queen,” focused on Jack’s romantic partner, Sally, and a prequel comic, “The Battle for Pumpkin King,” were published in the last year. Yet three decades on, Burton maintained that the original animated film was a one-ofa-kind feat. “In a certain way that’s the beautiful thing about it as it is. It’s one movie. It’s stop motion and it tells its story. And that helps make it special for me,” Burton explained. “It’s its own thing, there aren’t five sequels and there’s not a live-action reboot.”

A professional pumpkin carver spills his guts By CALLIE HOLTERMANN
A
group of children watched as Adam Bierton made his first few slashes into the meat of a pumpkin at the New York Botanical Garden earlier this month. Using a tool that resembled a carrot peeler, Bierton scored a horizontal eyebrow ridge and the grooves of a frown. Over the course of three hours, a steady crowd of about 20 people looked on as heaps of orange pulp formed at his feet. Every so often he spritzed the pumpkin’s facade with a bottle of lemon juice to keep its flesh dewy. “It looks like Javier Bardem,” Jasmine Taby, a 24-year-old college student in the Bronx, said as she watched the face being carved. Bierton, 40, is a pumpkin carver who expects to carve more than 100 pumpkins this fall. His pumpkins appear to be snarling or wailing, and often have bulging eyeballs that he scoops from russet potatoes using a melon baller. Unlike hollowed-out jack-o’-lanterns, most of his carvings have their guts intact and are not lit from within. His interest started in childhood, partly from watching his father carve. “My household was very creative because my mother was a hairdresser, and my dad was a photographer,” he said. “My dad was always doing really outlandish jack-o’-lanterns, like, turning them upside down. He would always grab the deformed pumpkin.” Later, as a student at the School of the Arts in Rochester, New York, he began sculpting with clay, plaster and metal. He brought tools for making ceramics home from school so he could use them on pumpkins. After honing his technique under the tutelage of other carvers, he was part of a team that won a season of “Halloween Wars,” a pumpkin-carving competition show on Food Network, in 2015. Now Bierton, who still lives in Rochester, is one of a handful of artists who carve professionally throughout a frenzied season that begins in September and ends Nov. 1. He has been doing weekend demonstrations each fall since 2018 at the botanical garden in the Bronx, where the edited interview that follows took place. Time pressure, he said, is far from his only challenge. “I’m actually mildly allergic to pumpkin,” he said. “It’s like, I love something, and it fights me. Maybe that’s why I’m so attracted to it.” Q: How did you go from an amateur to a professional pumpkin carver?
A: I had a tradition where every single year I would do an eight-hour carving. The first one I did was Beetlejuice; that was probably in 2000. I did it primarily with a paring knife and an X-Acto blade. In 2012, my mom sent me a story about the Maniac Pumpkin Carvers, a pumpkin-carving team, and I reached out. Q: Wait, what’s a pumpkin-carving team? A: Well, there are very few of them. Maniac Pumpkin Carvers are two guys, Marc Evan and Chris Soria, who bring in artists during the season. They primarily do etching work, which is a style of carving where you’re peeling the skin and illuminating the pumpkins from the inside. I worked for them for a couple of years. Q: How many top-tier carvers are there in the United States? A: I think there are fewer than 20 of us that are on the same level. And then there are another 20 that are up-and-coming. Q: Walk me through your carving process. A: I bathe all my pumpkins and store them with a fan blowing on them so bugs don’t get in there. Then the first step is to peel the pumpkin. You remove the hard orange skin, which allows access to that beautiful flesh that’s underneath, which is great for sculpting. Next I’ll block in the face with a ribbon tool. I’m kind of playing with perspective and drawing with shadow: the deeper the cut, the

pumpkins and time-lapse stuff. I’m working with Starbucks and the BBC this year. Q: How much do corporate clients usually pay for pumpkins? A: A pumpkin can range anywhere between $400 and $5,000. I have a dream to replace my entire year’s salary with the pumpkin season. I’m not quite there yet. Q: What do you like about pumpkins as a medium? A: Every single pumpkin is unique, and the material changes. It’s not a consistent medium like wood or clay. I don’t usually have a design before I have a pumpkin — the size and shape leads into the design. I also love the ephemeral part. I have to create something that I can’t keep. Q: What do most people do wrong when carving? A: The biggest mistake is cutting a hole in the top of the pumpkin. Q: Say more! A: Something I learned is to go in through the back, by cutting a big square or an octagon. Cutting a hole in the top of the pumpkin takes away from the character of a long, ornate stem. People cut the bottom too. That’s no good, because the juice ends up everywhere. Q: How do you decorate your own house for Halloween? A: It’s all pumpkins. I don’t get in with the tacky stuff. There’s no blown-up spiders, even though my wife tries to bring that stuff home. Q: Do friends ask you to carve pumpkins for them? A: All the time. I don’t have time for that! I don’t think people understand that I spend six hours on a single carving. Q: How long will the pumpkin you carved today at the botanical garden last? A: Because I haven’t opened up the cavity of the pumpkin, it has a good chance of lasting up to two weeks. It depends on the freshness of the pumpkin and the elements it’s in. If it’s in the beating sun and there’s bugs and squirrels? See you later. Q: How do you manage the time pressure that comes with the job? A: I don’t sleep in October. I’m doing two or three pumpkins every single day. It’s exhausting, but there’s just no other way because it’s a time-sensitive medium. I try to tell all my corporate clients, like, let’s shoot in November, and we can use it for 2024. They’re like, “Nobody’s thinking about next Halloween.” Q: What do you do the rest of the year? A: I own a fried-chicken restaurant in Rochester.

Eyedrops from major brands may cause infection, FDA says By REBECCA CARBALLO
F
ederal health officials are advising consumers to stop using more than two dozen over-thecounter eyedrops products because of a potential risk of eye infection that may lead to partial vision loss or blindness. The Food and Drug Administration issued an alert last Friday flagging 26 eye care products including eyedrops and gels from CVS Health, Leader (Cardinal Health), Rugby (Cardinal Health), Rite Aid, Target up&up and Velocity Pharma. The federal agency recommended Wednesday that the manufacturer recall all lots of those products after agency investigators found unsanitary conditions in a manufacturing plant, according to the news release from the FDA. Bacterial tests came back positive from critical drug production areas in the plant, which the agency did not immediately identify. The FDA said it had not received any reports of
infection associated with these products, but it was encouraging health care professionals and patients to report any cases to the agency. It’s imperative that these products are sterile, regulators said, because drugs applied to the eyes bypass some of the body’s natural defenses. The FDA said consumers should properly discard these products by taking them to a drug takeback site or by checking whether a product was included on the FDA’s “flush list” of drugs that can be safely discarded at home. CVS, Rite Aid and Target are removing the products from their stores and websites, the agency said. Products branded as Leader, Rugby and Velocity may still be available in stores and online and should not be purchased, federal regulators said. Rite Aid confirmed through a spokesperson that it was removing “applicable Rite Aid branded products” from store shelves. A CVS spokesperson said the retail chain “immediately stopped the sale instore and online of all products supplied by Velocity
Pharma within the CVS Health Brand Eye Products portfolio,” and that customers could return those products for a full refund. The other retailers did not immediately respond to requests for comment. There have been other recent reports of problems with eye products. In January, the Centers for Disease Control and Prevention and the FDA warned consumers to stop using EzriCare Artificial Tears and Delsam Pharma’s Artificial Tears. The eyedrops were linked to a drugresistant strain of the bacterium Pseudomonas aeruginosa, which was linked to at least four deaths and vision loss in 14 patients. Apotex, a Canadian Pharmaceutical company, recalled prescription eyedrops in March after some bottle caps developed cracks, which could compromise the product’s sterility. Experts say eyedrops are generally safe to use. By 2024, 123 million Americans are projected to use eyedrops, according to Statista, a market research firm.

Sarah Massameno was born in London, England on August 17, 1935 and passed away at Shalom Park in Denver, Colorado on October 4, 2023, at 88. Her father Izek Doktorczyk was Polish and her mother Esther de Miranda was English. They changed the family name to Wolf at Ellis Island because the Polish name was too difficult for most Americans to pronounce and spell. When World War II broke out in 1939, her parents were in the United States with her sister Ruth and the task of caring for Sarah and her brother Maurice fell to their beloved grandmother Rachel Miranda in Antwerp, Belgium. Grandmother Rachel was stoutly English and had had the foresight to ask that Esther give birth to her children in England, making them British subjects. In a story that has become legend in the Wolf Family, they escaped the Nazi invasion by taking one of the last trains out of Antwerp and were able to board an English military ship because of their nationality, and so their lives were saved. The family made it to Rayners Lane in North London to join their Aunt and their brother Samuel, where they in the formative years of their childhood endured the Battle of Britain, rationing, and wartime schooling. In 1947, they finally were able to reunite with their parents and sister in Manhattan, where they lived in midtown on the East Side, close to Wolf’s United Nations Gift Shop. In the nineteen sixties, Sarah returned to London, where she worked at Eastern Airlines while moonlighting as an antique vendor at the fabled Portobello Road Market. She married David Massameno, and when he passed away, she remai-
ned Sarah Massameno and never remarried. Sarah raised and loved cats all of her life and had a special place in her heart for Darling, the cat she brought with her from London to San Juan Puerto Rico, where she lived close to her parents and furthered her self-taught intellectual breadth working at the Casa del Libro, Old San Juan’s renowned rare book museum. Sarah eventually settled in Boulder, Colorado to be near her nephew Govinda and niece Mariah. She came to know and love Mariah’s daughter Quinn. Those people who were lucky to be her friends will always remember her forthrightness, wisdom, and empathy. Never has a less biased person walked this earth and if you were her friend, you shared some of these rare qualities. She did not suffer fools gladly. She was cherished for her British wit and the countless stories she told about her adventurous life, relying on an almost superhuman memory for detail. She even proved on many occasions that she possessed the rare gift of Extra Sensory Perception When anyone asked her, “Sarah, how are you?” she would invariably answer “Content and grateful!” Her family and friends are content and grateful, and always will be, that Sarah was part of their lives. She is survived by her sister-in-law Yolanda Wolf, niece Monica Turenne and husband Marc, niece Mariah Quish, nephews Govinda Quish, Michael Wolf Segal, Simon Wolf, and David Wolf and wife Ana Maria Otero Otero, and her great-nieces and nephews, Mattea Turenne, Nicholas Wolf Turenne and Quinn Theodora Quish.

Rapid Antarctic melting looks certain, even if emissions goals are met

A
t the bottom of the world, the floating edges of one of the enormous ice sheets covering Antarctica are facing an invisible threat, one that could add to rising sea levels around the globe. They are melting from below. As the planet warms, larger volumes of warm water are bathing the undersides of West Antarctica’s ice shelves, the giant tongues of ice at the ends of glaciers. The sheer mass of these shelves stops the ice on land from flowing more quickly into the open sea. So as the shelves melt and thin, more of the land ice moves toward the ocean, eventually contributing to sea level rise. Curbing fossil fuel emissions might help slow this melting, but scientists haven’t been sure by how much. Now, researchers in Britain have run
the numbers and come to a sobering conclusion: A certain amount of accelerated melting is essentially locked in. Even if nations limited global warming to 1.5 degrees Celsius, or 2.7 Fahrenheit, it wouldn’t do much to halt the thinning. Staying below 1.5 Celsius is the most ambitious aim of the Paris Agreement, and at the moment, it is unlikely to be achieved. “It appears that we may have lost control of the West Antarctic ice-shelf melting over the 21st century,” one of the researchers, Kaitlin A. Naughten, an ocean scientist with the British Antarctic Survey, said at a news briefing. “That very likely means some amount of sea level rise that we cannot avoid.” The findings by Naughten and her colleagues, which were published Monday in the journal Nature Climate Change, add to a litany of gloomy prognostications for the ice
on the western side of the frozen continent. Two of the region’s fastest-moving glaciers, Thwaites and Pine Island, have been losing vast amounts of ice to the ocean for decades. Scientists are trying to determine when greenhouse-gas emissions might push the West Antarctic ice sheet past a “tipping point” beyond which its collapse becomes rapid and hard to reverse, imperiling coastlines worldwide in the coming centuries. Even so, cutting emissions of heattrapping gases could still stop even greater amounts of Antarctic ice from being shed into the seas. The East Antarctic ice sheet contains about 10 times as much ice as the West Antarctic one, and past studies suggest that it is less vulnerable to global warming, even if some recent research has challenged that view. “We can still save the rest of the Antarctic ice sheet,” said Alberto Naveira Garabato, an oceanographer at the University of Southampton who wasn’t involved in the new research, “if we learn from our past inaction and start reducing greenhouse gas emissions now.” Naughten and her colleagues focused on the interplay between the ice shelves and the water in the Amundsen Sea, which is the part of the Southern Ocean that washes up against Thwaites and Pine Island glaciers. The researchers first used computer simulations to estimate changes in ocean temperature and the resulting ice-shelf melting that took place there in the 20th century. They then compared this with potential changes under several pathways for global warming in the 21st century, from highly optimistic to unrealistically pessimistic. They found that the water at 200 to 700 meters, or 650 to 2,300 feet, beneath the surface of the Amundsen Sea could warm
at more than three times the rate in the coming decades compared with the last century, pretty much regardless of what happens with emissions. If global warming were limited to 1.5 degrees Celsius compared with preindustrial conditions, temperatures in the Amundsen would flatten out somewhat after about 2060. In the most calamitous emissions trajectory, by contrast, ocean warming would accelerate even more after 2045. The reason the differences aren’t bigger is that water temperatures in this part of the Southern Ocean are influenced not just by human-driven warming of the atmosphere, but also by natural climate cycles such as El Nino, Naughten said. The differences under the various emissions trajectories, she said, are small by comparison. The study is unlikely to be the last word on the future of the West Antarctic ice shelves. Scientists began collecting data on melting there only in 1994, and, because of the difficulty of taking measurements in such extreme conditions, the data is still sparse. “We are relying almost entirely on models here,” Naughten said. When mathematical representations of reality are the best option available, scientists prefer to test their hypotheses using multiple ones to make sure their findings aren’t the product of a given model’s quirks. Naughten and her colleagues used only a single model of the interactions between ice and ocean. Still, their study’s methods are broadly in line with past findings, said Tiago Segabinazzi Dotto, a scientist with the National Oceanography Centre in Britain who wasn’t involved in the new research. This gives coastal societies reason to take the study’s predictions seriously and to plan for even higher sea levels, he said.

As for Amazon, it is seen as highly unlikely that the NBA — a league proud of being forward-thinking regarding technology — would sign a new rights agreement with only traditional media companies, according to some of the people familiar with the negotiations. Amazon has long been interested in broadcasting the NBA, according to a person familiar with the league’s negotiation history, and it has won plaudits for how it has handled Thursday night NFL games. The media and technology companies declined to comment for this article. CNBC, Bloomberg and The Wall Street Journal have all previously reported on parts of the NBA’s media-rights negotiations.

he NBA’s season tipped off last Tuesday with stars including LeBron James and Nikola Jokic beginning the long quest for a title. But the action that will have longer-term ramifications for the league, and the media and entertainment landscape, is happening off the court. The companies holding the rights to show NBA games — The Walt Disney Co., which owns ESPN and ABC, and Warner Bros. Discovery, parent company of TNT — are collectively paying the league $24 billion over nine years for that privilege. But their contracts expire after next season, and the NBA hopes to more than double the money it receives for rights in the next deal, according to several people familiar with the league’s expectations who spoke on the condition of anonymity to discuss ongoing negotiations. It won’t get that without a fight. After decades in which sports leagues garnered ever-bigger piles of money for the rights to show their games, there are signs that media and technology companies are under increasing pressure to justify the exorbitant amounts they spend on broadcast rights. Interest rates are high, Wall Street is demanding profitability over growth, and streaming has reconfigured the entertainment industry. The result of the NBA’s negotiations will say a lot about the future of broadcast networks, the cable bundle, streaming services and the sports media ambitions of technology companies. “I think in this era that we’re coming out of, this is the last of the big deals,” said John Kosner, who advises sports media and tech startups after a two-decade career as an executive at ESPN. The NFL, the most valuable sports league in the world, did not quite double its rights fees when it signed new agreements in 2021. And that was before the stock market declined, interest rates rose and wars began in Europe and the Middle East. Disney and Warner Bros. Discovery, which have televised N.B.A games for more than two decades, aren’t necessarily in positions to shell out lots of cash, either. Disney has carried out extreme costcutting and layoffs this year, and CEO Robert Iger has said the company is considering “strategic options” to sell equity in ESPN.
The N.B.A. season began last week with a face-off between the Denver Nuggets, with Nikola Jokic, center, and the Los Angeles Lakers, with LeBron James, right. Warner Bros. Discovery has also cut costs and said in August that it had a debt load of nearly $50 billion following the merger of the two companies last year. The most likely scenario, according to the people familiar with the negotiations, is that Disney and Warner Bros. Discovery will sign new agreements with the NBA to televise fewer games. The NBA declined to comment for this article. The two companies together show about 160 regular-season games each year, as well as the playoffs and NBA Finals. Most games are shown on cable (ESPN and TNT), with a handful on ABC. For both companies, NBA broadcast rights still represent a valuable bargaining chip in negotiations with their biggest customers: cable and satellite companies. Those distributors pay billions of dollars to Disney and Warner Bros. Discovery for the rights to show their cable channels, including TNT and ESPN, based in part on the expectation that those channels will air sports including NBA games. An NBA package would also help both companies shift to a streaming future. Warner Bros. Discovery recently added a live sports package to its streaming service, Max, while ESPN has been vocal about having a stand-alone streaming offering for its flagship channel in the near future. Disney and Warner Bros. Discovery
are not likely to be the only companies showing NBA games, though. If those companies end up showing fewer games in the new deal, the league may create a third rights package, perhaps even a fourth, of the games no longer included in the first two packages, as well as the league’s new inseason tournament. The most likely buyers for those packages of games are Amazon and NBC, according to the people familiar with the negotiations. Top executives at Fox, CBS and Google-owned YouTube have said that they are unlikely to put in serious bids for broadcasting rights. The intentions of Netflix and Apple are less clear, but Netflix has long said it is uninterested in paying the kind of prices the NBA is looking for. Apple has largely committed itself to a sports strategy of buying up all of a league’s domestic and international rights, as in its recent deal with Major League Soccer. That isn’t possible with the NBA. Amazon and NBC are attractive partners to the NBA for different reasons. For a generation, most NBA games have been watchable only with a cable package. But the collapse of the cable bundle — from around 100 million households with a cable package a decade ago to around 70 million today — has made oldschool broadcast networks, the most widely distributed television channels, more attrac-
