FOMB orders Treasury to stop granting incentives for certain distilled spirits

The Financial Oversight and Management Board has ordered Treasury Interim Secretary Nelson Pérez Méndez to stop enforcing Regulation 9309, which provides preferential tax treatment to certain distilled spirits.

FOMB Chairman Robert Mujica said that although the FOMB told Treasury in 2021 that the regulation violated the fiscal plan, it learned recently that the agency has been granting the tax incentives in violation of the order.

Regulation 9309 provides a preferential tax treatment to “all distilled spirits that are obtained through the fermentation, distillation and/or rectification of sources or substrate of fermentable sugars such as grains, fruits, citrus or plants.”

The resolution includes the manufacturer’s total production, distiller or rectifier, outside and inside Puerto Rico for the previous calendar year that is less than 300,000 gallons, according to an October 28 letter.

Regulation 9309 was submitted to the Oversight Board for review and approval on February 4, 2021. After a review, the Board on August 5, 2021, deemed it inconsistent with the Fiscal Plan for Puerto Rico.

In November 2021, the Oversight Board informed the Treasury that Regulation 9309 is not effective and may not be implemented, enforced, or applied. “However, the Oversight Board has recently been made aware that the Treasury is, in fact, implementing and enforcing Regulation 9309,” the letter notes.

The provisions of Regulation 9309 are not contemplated under the Puerto Rico Internal Revenue Code. Based on the Internal Revenue Code’s definition, the only distilled spirits that can be considered “artisanal distilled spirits” are products derived from sugarcane with a

production that does not exceed 300,000 gallons. “However, Regulation 9309 provides a preferential tax treatment to all distilled spirits that are obtained through the fermentation, distillation and/or rectification of sources or substrate of fermentable sugars such as grains, fruits, citrus or plants;” which is contrary to the statutory provision of the Internal Revenue Code,” the Board said.

That is, the Internal Revenue Code clearly provides that the only artisanal distilled spirits entitled to the preferential tax treatment therein are those “obtained through the fermentation and distillation of any product derived from sugarcane.

“If the Treasury wishes to incorporate an expanded definition of “artisanal distilled spirits” subject to the preferential tax treatment, such as the definition included in Regulation 9309, it must do so through legislation amending the Internal Revenue Code,” the letter notes.

Fraud complaint received

olice received a complaint for alleged fraud in early voting, on Tuesday afternoon, in the Experimental urbanization, in Rio Piedras.

According to the 59-year-old plaintiff, about a week ago she received an email in her personal account notifying her that she had requested an early vote, a request that she denies. According to the victim, days later, she was informed that her advance vote had been rejected by the State Election

Commission and that she could not vote in the municipality of San Juan.

Later, on Sunday, October 27, before noon, three representatives of the New Progressive Party, Popular Democratic Party and Citizen Victory Movement arrived at his residence so that he could cast his vote and they would be in charge of delivering it.

Officer Estrella Reyes, assigned to the Río Piedras Precinct, investigated and referred the case to the Criminal Investigation Corps (CIC) personnel of San Juan.

Women’s Ombudsman begins investigation and refers case of alleged sexual violence at the MVC

The interim Advocate for Women, Madeline Bermúdez, reported on Wednesday that, after learning through the media of a serious complaint of conduct constituting sexual violence among members of the Movimiento Victoria Ciudadana (MVC), she has sent a referral to the Secretary of Justice, Domingo Emanuelli, and to the Commissioner of the Puerto Rico Police, Antonio López.

“As the Women’s Advocate h, I condemn this and any act that harms the honor, dignity and sexual integrity of women in Puerto Rico. I strongly condemn any act of sexual aggression and reaffirm my commitment to defending the human rights of women in Puerto Rico,” Bermúdez said in a written statement, who also reported that her office has launched an investigation into the case.

Bermudez added that, due to the seriousness of the allegations, she asked the Department of Justice and the Puerto Rico Police to take note of the complaint and act according to their ministerial duty.

Bermúdez stressed the importance of inter-institutional collaboration to address the challenges faced by women on the island.

“From the Office of the Women’s Advocate, we reiterate our commitment to defending women’s rights and promoting a safe and fair environment for all. We firmly believe that cooperation with the Department of Justice and the Puerto Rico Police is crucial to achieving these goals and ensuring that women’s voices are heard and addressed,” concluded the interim attorney general.

For her part, the general coordinator of the Citizen Victory Movement, Ana Irma Rivera Lassén, spoke about the situation. “A letter dated October 24 has been circulated, signed by a member of the Citizen Victory Movement, in which she describes an incident described as gender violence by a colleague from the MVC towards another colleague also from the MVC. We are not mentioning their names because we are not authorized to do so and because the investigation procedures of our protocols for these cases have been initiated. Once the letter was received, it was forwarded as is the process for the corresponding investigation,” Rivera Lassén indicated in a written statement.

“Regardless of the handling of the letter circulated today to the media, it is our responsibility to follow the processes and seek consent from the people mentioned. In the Citizen Victory Movement we value the protection of spaces free of gender violence and that is why once we received the letter, as has been said, we began the regulatory process immediately. Any comment distorting the attention given to this situation is untrue. Even mixing up a previous situation that was also addressed immediately upon learning of it, in relation to the MVC, is also

manipulating the truth for partisan political purposes,” he added.

Rivera Lassén also responded to criticism from the Popular Democratic Party (PPD) candidates. “If the Popular Democratic Party candidates want to announce their candidacies in an attempt to attack us, they are attacking the wrong party. I wish them luck in their aspirations and I hope they are known for their proposals for the country and their commitment to the truth. That is not what they are demonstrating,” she said.

The MVC candidate for the Senate, Rosa Seguí, also reacted to the allegations. “No one should be surprised by the most recent expression of the discredit and decadence admitted by the leadership of the Popular Democratic Party itself. Today a group of women from that party called a press conference to irresponsibly disclose information about which they have no direct knowledge. By doing so, they not only violate the privacy of a person who they claim suffered gender violence, but they re-victimize her,” Seguí said in a written statement.

“Distorting facts in their eagerness to gain some relevance in the electoral contest in San Juan, without caring about or having the consent of the person, is as serious as what they claim. This unpleasant expression reveals the lowest and meanest political opportunism. This action by the PPD candidates shows that they care more about political opportunism than safeguarding the privacy and respecting the autonomy of women,” she added.

Seguí stressed that the MVC has specific protocols to deal with these cases. “The Movimiento Victoria Ciudadana has a firm commitment to the eradication of gender violence in all its forms, and contrary to what they claimed today, it has specific protocols to deal with these cases. This protocol requires that the complainant has direct knowledge of the facts. The will of the survivors and victims must be respected. Support them in their decisions and respect their agency. This is what I did,” she said.

“For my part, I reiterate to all people that I carefully watch over and offer a safe space to those who approach me with any complaint or accusation, always validating what they tell me and respecting their wishes for intimacy, privacy and confidentiality.

Governor announces strategies to strengthen the tourism industry

Governor Pedro Rafael Pierluisi Urrutia, along with the executive director of the Puerto Rico Tourism Company, Carlos Mercado, announced new strategies on Wednesday to boost the growth of the tourism sector on the Island, during the Tourism Innovation Summit at the Coca-Cola Music Hall, which brought together leaders of tourism, hos-

pitality and government agencies.

“Tourism in Puerto Rico has reached unprecedented levels, and my administration continues to work to consolidate the Island as a globally competitive destination, while preserving our natural beauty and cultural heritage,” Pierluisi Urrutia said in a written statement.

The statements by the attorney general and the reactions of the MVC come after several candidates and volunteers of the Popular Democratic Party denounced on Tuesday what they described as inaction on the part of the Citizen Victory Movement in the face of an alleged case of sexual harassment in the party.

According to a letter written by Karen De León, electoral coordinator of the MVC, which was sent to the candidate for resident commissioner, Ana Irma Rivera Lassén, an official of the campaign of the candidate for the Senate, Rosa Seguí, accused a fellow official of said party of sexual assault.

The names of those involved are omitted from the copy of the letter provided by the PPD. The PPD candidates referred to what they consider to be “inaction” by the MVC in past incidents, including a case in which two employees of the Puerto Rican Workers Union and MVC officials filed a complaint against municipal legislator Joel Vázquez Rosario for workplace harassment.

The PPD emphasized the events that supposedly occurred during a trip by several MVC officials to take a course in political communication and participate in other related events. The PPD maintained that, after the alleged events, the victim reported what happened to Seguí, who, according to them, limited himself to calling the alleged aggressor and coordinating a conversation so that he could apologize.

Ivonne Lozada, a Popular Party candidate for the Senate, specifically criticized Seguí and Rivera Lassén, stating that they have “chosen to ignore the situation.” “It is useless to have the best platform to promote the rights of women in the country if they cannot even guarantee the rights, dignity and security of women in their own party,” Lozada said.

When Lozada was asked about the time elapsed since the alleged incidents, he initially replied that they had occurred as recently as a few weeks ago, but later adjusted his answer to “a few months ago.”

Also present at the press conference were Raquel Gauthier, candidate for the Senate for District 2 of Bayamón; Swanny Enit Vargas Laureano, candidate for the House by At-Large; and Belmarie Ortiz González, candidate for municipal legislator for San Juan.

In response to possible speculation that this complaint could be used to benefit the PPD just days before the elections, Lozada said: “Many will label our complaint as a political act. I condemn violence against women in political spaces that limits their capacity for effective participation. I defend this space not only in my party, but in all political spaces,” said the Senate candidate.

Economists give C on average to economic proposals of candidates

The Puerto Rico Economists Association analyzed the economic proposals of the four political candidates, giving them on average, a satisfactory grade of C.

“Most of the proposals lack details on obtaining resources to execute the strategies outlined in their respective proposals, aspects that are not favorable for determining their viability and transparency. The evaluation highlighted the need for political parties to develop stronger accountability mechanisms,” the Association said on Wednesday.

Although some parties, such as the Puerto Rican Independence Party (PIP), showed progress in monitoring their proposals, there is still a general need to strengthen monitoring plans and outcome evaluation metrics.

The lack of transparency and clarity in measuring socioeconomic impact

continues to be a common weakness in all the platforms evaluated, limiting the ability of citizens to monitor the fulfillment of campaign promises effectively, the group said.

According to the findings, the best ratings were obtained by the candidate of the Alliance between the PIP and the Citizen Victory Movement (MVC), headed by Juan Dalmau, followed by the candidate for the Popular Democratic Party (PPD), Jesús Manuel Ortiz.

“The PIP and PPD proposals are possibly the most specific and complete economic proposals, focused on sustainable development, debt, and support for the local economy and emerging sectors. A focus on the solidarity economy and cooperativism is observed,” the organization said.

The evaluation consisted of three criteria: focus and transparency, structure and viability, and accountability. Each criterion was evaluated in three questions on a point scale from 1.0 to 5.0, with five being the highest score and

one being the lowest.

The analysis focused on the ideas’ clarity and not on their impact on the island’s economic activity.

In the first criterion of “focus and transparency,” Dalmau’s economic proposals achieved the highest rating of the evaluations with a “B,” equivalent to an average score of 4.0.

The first criterion evaluated whether the economic goals are clear and long-term, with well-defined objectives and strategies.

Meanwhile, the lowest rating in the focus and criteria criterion was obtained by the candidate for governor of Proyecto Dignidad (PD), Javier Jiménez, also with a grade of D with 1.5 points.

The group found that the proposals of the NPP and PD lack a clear focus, based on reconstruction projects and attracting foreign investment, but without specifying how the results will be measured.

In the second criterion of structure and viability, the economic proposals of the PIP and PPD candidates achieved a grade of B being, again, the highest average scores with 3.4 and 2.9, respectively.

Meanwhile, the PNP and PD also achieved a satisfactory rating with a score of 2.8 each.

The second criterion evaluated the scope of the economic proposals, their viability, and compatibility with the financial and fiscal situation of Puerto Rico, and whether they present a defined and realistic plan. The candidates did poorly.

For the third criterion of accountability, the committee evaluated whether the economic objectives are presented together with a follow-up and monitoring plan; if they are qualitatively and quantitatively measurable, and if they consider their socioeconomic impact in a defined period.

“Most proposals, by failing to set clear and specific goals, lack ways to measure the performance of economic proposals,”” the committee said.

Dalmau earned the highest grade for accountability with a grade of C or 2.8 points, followed by Ortiz with n a grade of D or (1.8 points) and, in turn, González with 1.7 points, also poor.

For his part, Jiménez received the lowest score, of 1.0, which is an F for offering less clarity.

SESA files friend of the court brief in FOMB’s suit to stop net metering

The Puerto Rico Solar and Storage Association (SESA) filed a friend of the court brief in U.S. District Court Wednesday in the case the Financial Oversight and Management Board filed against the government to annul Act 10-2024 that extends net metering until 2030.

The FOMB filed a suit earlier this year seeking to invalidate Act 10-2-24 (Act 10), a law designed to promote net metering. Act 10 would stop the Puerto Rico Energy Bureau (PREB) from changing the current net metering and energy distribution policy until at least 2031.

The net metering law compensates solar-equipped households for their contributions to the grid.

The friend of the court brief supports the Government of Puerto Rico and the Senate in opposing the FOMB’s

motion for summary judgment that seeks to annul the law.

Javier Rúa Jovet, director of Public Policy at SESA, indicated that this appeal presents to Judge Laura Taylor Swain “data on the importance of net metering for energy resilience, especially for low- and moderate-income populations, and for the sustainable economic development of Puerto Rico.”

“The FOMB’s lawsuit is an arbitrary attack on net metering and lacks legitimate reasons. This policy allows affordable access to solar energy, benefiting Puerto Ricans and promoting the Island’s energy stability,” said Rúa Jovet in a written statement.

Entities that signed the appeal include the Solar Energy Industries Association (SEIA), GRID Alternatives, Power Solar, SolarEdge and SMA, among other organizations and companies in the sector.

In closing, Harris casts herself as the unifier and Trump as a ‘petty tyrant’

Vice President Kamala Harris used the last major speech of her campaign to unleash a fiery broadside against former President Donald Trump, calling her rival “consumed with grievance and out for unchecked power” and presenting herself as a fighter who would usher in a new generation of leadership.

In a speech in front of what her campaign said was around 75,000 people assembled at the Ellipse, a park just south of the White House in Washington, Harris sharpened her case, gesturing to the nation’s seat of power and bringing up the specter of a riot that had unfolded less than 2 miles to the east.

Even as she made a case for herself, her warnings about Trump remained the spine of her argument. She repeatedly tried to tie his behavior and his increasingly threatening language to the forces that animated the 2021 riot at the Capitol, arguing that a second Trump term would pose a dire threat to American civic life.

But her speech had to bear more weight than just another attack on Trump. So on the 101st day of her improbable presidential campaign, Harris presented herself as a former prosecutor who had long worked for the public good — pausing to remind her audience that she had spent most of her career outside Washington and assuring her listeners that “not all good ideas come from here.”

Relaying her case in a way that was plain-spoken but forceful, Harris told the crowd that she would not be a perfect president but that she would govern with unity in mind, based on what she said was a “lifelong instinct to protect” people who had been abused or victimized.

But she also used the arc of history to make her case, saying that the country was born “when we wrested freedom from a petty tyrant” and that, over centuries, Americans had fought threats both foreign and domestic to preserve the promise of democracy.

“They did not struggle, sacrifice and lay down their lives, only to see us cede our fundamental freedoms, only to see us submit to the will of another petty tyrant,” Harris said. “The United States of America is not a vessel for

Throughout her speech, Harris instead tried to keep the focus trained on the comparison between herself and Trump. As she ticked through her policy plans, she warned that his proposals would continue to harm Americans.

She said that he would again aim to repeal the Affordable Care Act, legislation that is now popular among a majority of Americans but whose provisions Speaker Mike Johnson, a Republican, suggested Tuesday he would seek to overhaul.

Harris said Trump would again enact tax cuts for the country’s highest earners. And she reiterated that her administration would crack down on corporate price gouging and help lower costs for Americans through tax credits for homebuyers, parents and caregivers.

“There’s something about people being treated unfairly or overlooked that, frankly, just gets to me — I don’t like it,” Harris said, adding, “If you give me the chance to fight on your behalf, there is nothing in the world that will stand in my way.”

She said a Harris administration would be a bulwark against a raft of abortion restrictions and highlighted the possibility of a broader rollback of reproductive rights. She pointed to other plans laid out by Project 2025, the

Her speech was delivered days after speakers at Trump’s rally at Madison Square Garden targeted Black people, Puerto Ricans, Palestinians, Jews, Harris and other Democrats. Trump has not distanced himself from those comments, though his campaign has tried.

Hoping to draw a starker contrast with Trump, Harris spent much of the day Thursday at a historic building in Washington, rehearsing the speech and delivering last-minute revisions as advisers looked on. The goal was to hone the best argument to win over people who might be distrustful of both Harris and Trump but might be unable or unwilling to stomach another Trump term.

Before she ended her remarks and turned her sights back to the campaign trail, she put herself, and an audience that spread across the Ellipse and, farther in the distance, onto the grounds of the Washington Monument, squarely in the scope of American history.

“That’s why I’m in this race,” she said. “To fight for the people, just like I always have.”

Trump and his allies link Biden’s ‘garbage’ comment to 2016 ‘deplorables’ remark

Donald Trump and his allies are trying to recreate a moment that resonated deeply with his supporters in the 2016 campaign: when Hillary Clinton referred to Trump supporters as a “basket of deplorables.”

On Tuesday, it was President Joe Biden who provided the ammunition, appearing to call Trump supporters “garbage” while talking to Latino allies by video.

“Just the other day, a speaker at his rally called Puerto Rico a ‘floating island of garbage,’” Biden said, adding what sounded like, “The only garbage I see floating out there is his supporters — his, his demonization of Latinos is unconscionable, and it’s un-American.” The White House insisted that what Biden had said was “his supporter’s demonization,” referring only to the comic who initially insulted Puerto Ricans with an offensive joke at Trump’s New York rally Sunday.

Trump’s allies insisted the meaning was clear.

Within minutes of the clip of Biden’s remarks going viral on social media Tuesday night, Sen. Marco Rubio of Florida addressed Trump’s rally in Allentown, Pennsylvania, and informed the crowd of Biden’s statement.

“I have breaking news for you, Mr. President — you may not have heard this,” Rubio told the audience after Mr. Trump had called him up to the stage and stood next to him. “Just moments ago, Joe Biden stated that our supporters are garbage — are garbage.”

Rubio added, as the crowd booed and Trump shook his head: “He’s talking about the Border Patrol. He’s talking about nurses. He’s talking about teachers. He’s talking about everyday Americans who love their country and want to dream big again and support you, Mr. President.”

Trump’s team saw the moment from Biden as similar to the occasion when Clinton, speaking at a fundraiser in late summer during the 2016 campaign, condemned half of Trump’s supporters as belonging in “what I call the basket of deplorables.” She had added, “The racist, sexist, homophobic, xenophobic, Islamophobic — you name it. And unfortunately there are people like that. And he has lifted them up.”

Clinton went on to say the other half of his supporters felt let down and ignored by the government, but the damage had been done. Trump’s supporters proudly called themselves “deplorables,” owning the label, as the Trump campaign said it proved how little Clinton thought of a significant chunk of the country.

The Trump campaign of 2024 immediately sought to highlight Biden’s comment, which was made far later in the race than Clinton’s remark. Biden’s comment did not just give fodder to Trump to portray Biden as uninterested in those he represents; it gave the Trump campaign yet another opportunity to tightly tie Harris to the unpopular sitting president.

“That’s terrible,” Trump said from the stage at his rally. “So you have — remember Hillary, she said ‘Deplorable.’” He added of Biden, “I’m convinced that he likes me more than he likes Kamala.”

Trump has repeatedly demonized Democrats, using terms that have included “the enemy within,” “communists,” “Marxists” and “vermin.” He has attacked his critics and threatened some with prosecution if he becomes president again.

The insult of Puerto Rico at the rally Sunday by comic Tony Hinchcliffe set off backlash within the Puerto Rican community, denunciations from Republican lawmakers and now two days of negative news cycles for Trump.

Even the Trump campaign issued an uncharacteristically defensive statement distancing Trump from Hinchcliffe’s joke. And both of Trump’s events in Pennsylvania on Tuesday featured Puerto Rican women who praised Trump and portrayed him as an ally of Puerto Rico.

By Tuesday night, the Trump campaign was using the Biden comments to appeal to his supporters. Trump sent a fundraising email with the subject line: “You are not garbage! I love you! You are the best our nation has to offer.”

Trump’s running mate, Sen. JD Vance of Ohio, who has been the former president’s most aggressive defender, posted on the social platform X about the remark, writing: “This is disgusting. Kamala Harris and her boss Joe Biden are attacking half of the country. There’s no excuse for this. I hope Americans reject it.”

Inside The Washington Post’s decision to stop presidential endorsements

Atropical storm was heading toward Florida’s Gulf Coast in late September when senior news and opinion leaders of The Washington Post flew into Miami for a periodic meeting with Jeff Bezos, the newspaper’s billionaire owner.

During their visit — which included a working lunch at Bezos’ sprawling home on an exclusive island in Biscayne Bay and dinner at a nearby restaurant — David Shipley, the Post’s opinion editor, and Will Lewis, the Post’s CEO and publisher, discussed plans for the future of the newspaper’s opinion section. The election, less than 45 days away, loomed large.

By the end of the meeting, according to four people familiar with it who spoke on condition of anonymity to relay private conversations, it appeared to Shipley and Lewis that Bezos had reservations about the Post endorsing either candidate in the presidential race. But they also thought he was open to persuasion.

Bezos’ ultimate decision, to end the Post’s decades-long practice of endorsing presidential candidates, exploded into public view Friday, drawing criticism from reporters, editors and readers, along with an unusual rebuke from legendary Post journalists Bob Woodward and Carl Bernstein.

It came after additional discussion between Bezos and the two Post leaders, Shipley and Lewis, who privately made a case not to abandon the tradition so close to an election. The editorial board had already drafted an endorsement of Vice President Kamala Harris, though Bezos did not read it before his decision, Lewis said in a statement Saturday.

The decision by Bezos had been in the making for weeks. It is not clear what motivated his final determination or its timing.

Bezos has clashed repeatedly with Harris’ electoral opponent, former President Donald Trump, who for years has been openly hostile to him on social media. In 2019, Amazon sued the Trump administration, blaming Trump’s animosity toward Bezos for its loss of a $10 billion cloud computing contract.

The businesses Bezos founded, including Amazon and Blue Origin, his aerospace company, still compete regularly for lucrative government contracts. Blue Origin executives met with Trump on Friday, and the company has a $3.4 billion contract with the National Aeronautics and Space Administration to

By 1 p.m., top Post editors were fielding questions from their colleagues about the decision. Matt Murray, the Post’s executive editor, was asked in a meeting about election coverage why the newspaper was ending its endorsements for president but continuing to recommend candidates in other elections, according to a person familiar with the matter. So far this year, the Post has endorsed candidates in House and Senate races in Virginia and Maryland.

A spokesperson for the Post said Friday that ending presidential endorsements was a “Washington Post decision.” In his statement Saturday, Lewis added that, as publisher, he does not believe in endorsements.

The decision to abandon presidential endorsements at the Post followed news that the owner of The Los Angeles Times, Patrick Soon-Shiong, had quashed presidential endorsements.

In the weeks after Bezos met with Shipley and Lewis, members of the Washington Post’s editorial board, who write editorials for the newspaper, including endorsements, assumed that the Post would be giving their stamp of approval to Harris. Two of them had drafted the endorsement, which was awaiting a final sign-off.

It never came.

Instead, on Friday, Shipley joined the editorial board via video for a regular meeting at 11 a.m. in an eighth-floor conference room at the Post’s headquarters, according to two people who attended. He announced the new endorsement policy without much enthusiasm, one said.

The board members were aghast. They grilled him — why wouldn’t the paper endorse? There was little support for the idea among the editorial board, which had not been consulted on the decision, one of the people said.

Shipley tried to explain: He said the Post was no longer going to tell people how to vote, a posture that would reflect the paper’s independent bona fides, the two people said. Several of the board members asked for space to write dissenting statements signed under their own names, together or separately. The meeting ended without a resolution on how they should convey their disagreement.

The announcement was sent to the entire newsroom around noon. Lewis said in the memo that the Post was returning to a prior policy of not making endorsements, trusting readers to “make up their own minds.” The Post has issued endorsements in every presidential election since 1976, when it gave its stamp of approval to Jimmy Carter, though it abstained in 1988. It endorsed President Joe Biden in the last cycle.

The decision, which was reported by NPR before Lewis sent his email, generated near-instantaneous blowback. Within minutes, Martin Baron, the former Post editor featured in the movie “Spotlight,” posted on the social platform X that it amounted to “cowardice, with democracy as its casualty.” Robert Kagan, an editor at large who has written for the Post for more than two decades, dashed off a quick resignation email to Shipley at 12:56 p.m.

Vineet Khosla, the Post’s chief technology officer, instructed Post employees to prevent the Post’s experimental artificial intelligence tool from responding to reader questions about the decision, according to screenshots obtained by The New York Times.

“Let’s block it,” Khosla wrote, essentially calling a halt to AI responses on the topic. A spokesperson for the Post said in a statement that it would have been “irresponsible to serve our audience with an AI-generated response summary based off of one article” about the decision not to endorse.

In a 4 p.m. news meeting, Murray fielded more questions — before a larger audience than usual, he noted, according to a recording of the meeting obtained by the Times.

He said that he hadn’t been involved in the decision because the newsroom was independent of the Opinion department. He added that he had only found out Thursday night. But, seeking to reassure newsroom employees, he said, “What this newsroom does is supported up to the very top of this company.”

Later in the evening, Woodward and Bernstein weighed in. In a statement, they said that — although they respected the independence of the Post’s editorial board — the decision “ignores the Washington Post’s own overwhelming reportorial evidence on the threat Donald Trump poses to democracy.”

By the end of the day, the Post’s opinions department had made its voice heard. In a dissenting editorial, 18 Post opinion columnists signed their names to a column calling the decision not to endorse a “terrible mistake.”

Nasdaq, S&P end lower ahead of Megacap earnings

The Nasdaq and S&P 500 closed lower on Wednesday as chip stocks tumbled and investors await a host of corporate earnings.

Shares of Alphabet, the first of the five “Magnificent Seven” megacap stocks that report results this week, rose after the company beat expectations for third-quarter revenue and profit on strength in its cloud business and YouTube ad sales.

Microsoft and Meta Platforms are set to report results after the bell, which are expected to provide insight into whether heavy AI investment is translating into better company performances.

Alphabet helped to offset falling chip stocks, weighed by dour forecasts from Advanced Micro Devices and Qorvo.

Meanwhile, shares of Super Micro Computer plunged after Ernst & Young resigned as the company’s accountant. Nvidia was also down.

The Information Technology sector was the biggest sectoral decliner, while Alphabet’s gains lifted the Communication Services sector.

“Qorvo, Advanced Micro and Super Micro - those are three pretty big moves that are causing a little bit of angst and taking some of the bloom off the rose from the stellar print from Google last night,” said Michael James, managing director of equity trading at Wedbush Securities.

“The clear laser focus is going to be on the stock specific reports and guides,” James said.

According to preliminary data, the S&P 500 lost 16.01 points, or 0.27%, to end at 5,816.91 points, while the Nasdaq Composite lost 96.37 points, or 0.52%, to 18,616.38. The Dow Jones Industrial Average fell 65.14 points, or 0.15%, to 42,167.91.

In economic data, the U.S. gross domestic product increased at a 2.8% annualized rate, according to the Commerce Department’s advance estimate of third-quarter GDP, slightly below economists’ forecast of 3.0% growth.

A separate report showed U.S. private payrolls growth surged by a higher-than-expected 233,000 jobs in October.

The neck-and-neck race between U.S. presidential candidates Kamala Harris and Donald Trump was also at the top of investors’ minds ahead of the Nov. 5 election.

Starbucks is also set to report earnings after the close.

UK markets were spared painful blows from the new Labour government’s first budget on Wednesday, which announced 40 billion pounds of tax hikes to plug shortfalls but soothed jitters about public spending blowouts and debt market disorder.

Israel orders residents of city in eastern Lebanon to evacuate

Israel’s military warned residents of the city of Baalbek in eastern Lebanon to evacuate Wednesday, as it appeared to deepen its campaign against Hezbollah strongholds beyond the country’s south.

Baalbek, which had a population of roughly 80,000 people before Israel stepped up its attacks on the Lebanese militant group Hezbollah this month, is an important urban center in the Bekaa Valley and is famed for its towering Roman ruins. It is also well known as a city where Hezbollah holds sway.

But unlike other places where the group enjoys support, the city of Baalbek has largely been spared Israeli bombardment. In a signal that Israel’s campaign against Hezbollah may be widening, Baalbek was one of two urban areas to be targeted by Israel in recent days after largely escaping the brunt of the war.

The warnings came amid renewed diplomatic efforts to reach a truce, according to three officials briefed on the negotiations who spoke on the condition of anonymity to discuss sensitive diplomacy.

No agreement has been reached, but Israel is pushing for an arrangement in which Hezbollah would be given several weeks to withdraw its forces from the Israel-Lebanon border, allowing Lebanon’s official army — which had been sidelined by Hezbollah in southern Lebanon over the past two decades — to fill the void, according to two of the officials.

Israel also wants to be guaranteed the right to invade Lebanon if Hezbollah does not withdraw fast enough, the two officials said.

“The IDF will act forcefully against Hezbollah interests within your city and villages and does not intend to harm you,” Adraee said, referring to the Israel Defense Forces. “For your safety, you must evacuate your homes immediately and move outside the city and villages.”

The evacuation warning comes two days after Israeli airstrikes killed at least 60 people in the Bekaa district, which includes the city and its rural hinterland, Lebanese officials said. Lebanon’s Health Ministry said at least 58 others were injured in the attacks.

The farmland and villages around the city of Baalbek have been hit by airstrikes numerous times in recent weeks, leaving many of the small towns largely deserted. Ibrahim Bayan, a deputy to the mayor in Baalbek, said earlier this month that about two-thirds of the residents in the city had left their homes out of fear.

As people in Baalbek received the evacuation warnings by text message late Wednes-

day morning, a sense of alarm seized the streets of the city, Bayan said.

“People are panicking,” Bayan said. “They are running around and bumping into each other, like chickens with their heads cut off. They have no idea what to do, where to go.”

Within minutes, the roads filled with residents who threw their valuables into plastic bags, locked their houses and pulled metal grates over their shop doors, he said. As people crammed into cars, they shouted to each other to determine the safest way to leave the city.

Others opted to remain in the city, unsure where they would go or how they would get there.

Baalbek is in one of Lebanon’s most underdeveloped regions and many residents do not have the means to flee, some said.

“Gas stations are closed, but even if they were open, people don’t have money to fill up their cars’ tanks,” said Mahmoud Zikra, a resident of Baalbek who remained in his home. “There are no vans or taxis — even if they were available no one can afford to hire them.”

The warning from Israel’s military included a village in Baalbek’s southern suburbs that connects the city to the region’s main highway, cutting off a standard route for residents trying to leave the valley.

Hezbollah’s new leader, Naim Qassem, gave his first televised speech Wednesday afternoon, a day after he was named to the position. He replaced Hassan Nasrallah, the group’s longtime leader, whom Israel assassinated last month.

In the speech, which was delivered as the group fired a barrage of rockets into northern Israel, Qassem effusively praised his predecessor, and said Hezbollah “will continue to implement the war strategy he developed.”

Fighting between Israeli forces and Hezbollah continued elsewhere in Lebanon. On

Wednesday, the Israeli military said it had struck more than 100 sites across the country in the previous 24 hours, including a rocket launch site used in a deadly strike on the Israeli town of Ma’alot-Tarshiha on Tuesday. It also said it had killed a large number of Hezbollah fighters in what it called “limited, localized, targeted raids.”

Adraee said one of the fighters killed by Israeli forces was Mustafa Ahmed Shehadi, whom he called a prominent commander in the group’s elite Radwan Force. Hezbollah did not comment on the claim.

Shehadi was killed in a strike on Nabatieh, a large southern town, Adraee said. On Wednesday, the military also issued evacuation warnings for eight small towns in the district surrounding Nabatieh, urging their residents to move north of the Awali River.

On Tuesday night, an Israeli airstrike killed at least 10 people in the coastal city of Sidon in southern Lebanon, according to a report by the country’s national news agency. It said the strike injured at least 36 others. Until recently, attacks on Sidon, one of Lebanon’s largest cities, and the areas around it, had been rare.

Hezbollah said its forces had battled Israeli troops in recent days near the border town of Kfar Kila and the mountain town of Khiam, which is well known in Lebanon as the former site of a prison camp run by allies of Israel during its two-decade occupation of southern Lebanon.

The camp was turned into a museum by the Lebanese government after Israel withdrew in 2000, although it was later destroyed by an Israeli airstrike during the 2006 war in Lebanon.

Hezbollah’s claims could not be independently verified. The national news agency reported that Israeli soldiers near Khiam were “attempting to infiltrate the town under heavy fire” on Wednesday and that Israel’s air force had conducted multiple raids on the area.

Big fire breaks out at nuclear submarine plant in Britain

Alarge fire broke out at a nuclear submarine plant in northwestern England early Wednesday. Two people were taken to the hospital for smoke inhalation, according to a spokesperson for BAE Systems, the company that owns the plant, but police said that there was no nuclear risk.

The fire started after midnight l at the plant, in Barrow-in-Furness, England, which produces vessels for the Royal Navy. As of

7:30 a.m., emergency workers were still at the site, police said, and firefighters were likely to be working for much of the rest of the day.

Police advised residents in the area to keep the windows and doors in their homes shut. They also recommended that people driving in the area close their “windows, air vents and sunroof, and turn off fans. Turn off fans and air conditioning if you have them.”

Neither BAE Systems nor local authorities provided a cause for

the blaze. The company said that it was working with emergency services at the site and that all its workers had been accounted for. The two employees taken to the hospital had been released by 9 a.m. local time, according to a BAE Systems spokesperson.

BAE Systems employs about 100,000 people across 40 countries and works with many other nations, including the United States. In December, the Biden administration awarded the company a federal grant from a program aimed at shoring up U.S. manufacturing of semiconductors.

Flash floods in Spain leave more than 95 dead

Aleast 95 people have died and others were missing after devastating flash floods hit eastern Spain, according to local authorities, in one of the worst natural disasters to hit the country in recent years.

The catastrophic floods, fueled by an unrelenting deluge that began Monday, washed away cars, inundated homes and knocked out power across eastern Spain. Rescuers waded through neck-high waters to reach some residents.

In the town of Chiva in the eastern Valencia region, practically a year’s worth of rain fell over eight hours, Spain’s meteorological agency said Wednesday, illustrating the ferocity of the storm. Other areas across the south and east saw more than a month’s worth of rain in less than 24 hours.

The severity of the disaster became more apparent Wednesday as regional authorities confirmed that 95 people had died in the Valencia region, where the storm battered cities, villages and towns along the mountainous coastline.

Two other people died in the neighboring province of Cas-

tile-La Mancha, where at least five other people were missing in the municipality of Albacete, local officials said.

More remain missing, but authorities in Valencia said they could not give an exact figure. A phone line was set up to report missing people, they added, and residents were urged not to travel in the area. The death toll, officials said, was expected to rise.

More than 1,000 soldiers from an emergency response team were sent to respond to the disaster, officials said, sharing videos of some people being airlifted from flooded areas into helicopters or waiting on rooftops.

Widespread areas appeared almost entirely submerged, and dozens of cars piled up in the flooding’s aftermath, according to footage released by the Civil Guard. Some buildings were reduced to sodden rubble.

The damage to roads and bridges left rescuers struggling to reach some areas, officials said Wednesday. The overflowing ravines and strong winds also damaged infrastructure supplying telecommunications and power in the region. About 155,000 customers were left without power, according to Iberdrola, an

energy provider in Valencia, adding that workers were encountering difficulties in restoring service.

Highways leading to the region’s capital, also named Valencia, were littered with debris and covered with mud, according to footage from local media, and the subway was flooded. Regional trains on Wednesday were halted, and schools were closed in several places.

The Spanish parliament on Wednesday held a minute of silence to mourn the victims. Prime Minister Pedro Sánchez vowed in an address to help the flood-struck regions recover. “Together we are going to rebuild your streets, your squares, your bridges,” he said from Madrid. “All Spain cries with you,” he added.

The deluge is not yet over: More rain was expected Wednesday, with Spain’s meteorological agency raising an emergency alert for the Valencia region to the highest level. A popular tourist destination, Valencia is also known for its bustling agricultural industry, which grows citrus and other fruits and vegetables.

Though storms are typical during the fall in Spain, local residents were shocked at the sheer amount of rain: more than 70 gallons per square yard in some villages. In the village of Chiva, more than 100 gallons per square yard of rain fell in eight hours, practically a year’s worth, Spain’s meteorological agency said.

With limited options, Zelenskyy seeks a path forward for Ukraine

For weeks, President Volodymyr Zelenskyy of Ukraine has pushed Western leaders to support his so-called victory plan, which he claims will end the country’s war with Russia next year. But Zelenskyy has received only lukewarm rhetorical support.

No country has agreed to allow Ukraine to fire Western long-range missiles at military targets deep inside Russia. Nor has any major power publicly endorsed inviting Ukraine into NATO while the war is raging.

By those measures, Zelenskyy’s lobbying tour of the United States and Europe over the past six weeks could be seen as a failure.

But the real audience for the plan might be at home, some military analysts and diplomats say. Zelenskyy can use his hard sell — including a recent address to Parliament — to show Ukrainians that he has done all he can, prepare them for the possibility that Ukraine might have to make a deal and give Ukrainians a convenient scapegoat: the West.

With waning Western support, losses along the eastern front and in the Kursk region of Russia, and a looming U.S. election that could mean a drastically different policy toward Ukraine, Zelenskyy might have few other options.

“He has to go cap in hand to push the plan, sort of carve out a position and then say at home, having asked, that this is now what we have to do,” said Michael John Williams, a professor of international relations at Syracuse

University and a former adviser to the North Atlantic Treaty Organization. He added: “At least he can say he’s tried. He’s exhausted the possibilities.”

Zelenskyy is doing whatever possible to get the United States and other allies to commit to what Ukraine believes it needs, so he can negotiate from a position of strength. The Ukrainian president is using the arrival of North Korean troops to fight alongside the Russians in Kursk — confirmed by the head of NATO on Monday — to try to build some momentum for his plan.

In an interview session with reporters last week, Zelenskyy said that there was no evident Plan B if the West didn’t support his plan.

“I’m not insisting that they do it exactly this way,” Zelenskyy said. “I said it will work. If you

have an alternative, then please, go ahead.”

He reiterated that he was still against ceding territory. But he also talked about diplomatic steps to resolve issues like protecting energy infrastructure and establishing a safe shipping corridor out of Ukraine on the Black Sea.

And he hinted at one approach that might allow Ukraine to save face if it does not reclaim all the land Russia has captured. “No one will legally recognize the occupied territories as belonging to other states,” he said.

U.S. officials have privately expressed some exasperation with Zelenskyy’s victory plan, calling it unrealistic and dependent almost entirely on Western aid. They spoke on condition of anonymity to discuss sensitive military information.

Case in point: In one part not made public, Zelenskyy proposed a “non-nuclear deterrence package” in which Ukraine would get Tomahawk missiles, a totally unfeasible request, a senior U.S. official said. A Tomahawk has a range of 1,500 miles, more than seven times the range of the long-range missile systems called ATACMS that Ukraine got this year. And the United States sent only a limited number of those, senior U.S. officials said. Ukraine also hadn’t made a convincing case to Washington on how it would use the long-range weapons, the U.S. officials said. The target list inside Russia far exceeded the number of missiles that the United States or any other ally could supply without jeopardizing missiles earmarked for potential problems in the Middle East and Asia, they added.

Four U.S. officials told The New York Times recently that Zelenskyy was stunned that President Joe Biden didn’t grant him permission to use U.S. long-range missiles to strike deep inside Russia when they met in Washington in September. In the past, Biden had usually relented after initially refusing Ukraine’s requests for weapons like Abrams tanks, F-16 fighter jets and ATACMS.

There is widespread agreement that neither side is ready for formal negotiations. Russian President Vladimir Putin has claimed repeatedly that he’s ready for talks, including last week, when he said, “the ball is in their court,” referring to Ukraine. But two former Russian officials who remain close to the Kremlin said they didn’t believe Putin would in fact negotiate so long as Ukrainian forces are in Kursk. The threat of a widespread conflict in the Middle East has shifted attention from Ukraine. Western fatigue with the war in Ukraine is real, “and increasingly so,” the foreign minister of Finland told the Financial Times recently.

The president of the Czech Republic said last month that Ukraine needed to face the reality that it will have to temporarily cede territory to Russia. Many diplomats and analysts say the most likely outcome in the near future for the war is a deal that would temporarily freeze the two sides along a yet-to-be-determined line. But Putin would have to be convinced that he could gain no more territory if any cease-fire is going to last.

The U.S. election, just days away, will go a long way toward determining the war’s future, analysts say.

Trump’s biggest con: Pretending to support American workers

Donald Trump has always been a con man. As an entrepreneur, he left behind a trail of investors who lost money in failed ventures even as he profited, students who paid thousands for worthless courses, unpaid contractors and more. Even amid his current presidential campaign, he has been hawking overpriced gold sneakers and Trump Bibles printed in China.

But Trump’s biggest, potentially most consequential con has been political: portraying himself as a different kind of Republican, an ally of working Americans. This self-portrait has been successful so far, notably in gaining Trump significant support among working-class people of color — although the carnival of racism at his Sunday rally at Madison Square Garden in New York, in which a comedian opened the event by describing Puerto Rico as an “island of garbage” and made a watermelon joke in reference to a Black man, may dent that support in the campaign’s closing days.

The truth is that to the extent that Trump’s policy plans — or, in some cases, concepts of plans — differ from GOP orthodoxy, it’s because they are even more antilabor and proplutocrat than his party’s previous norm.

Background: Since the 1970s, our two main political parties have diverged sharply on economic ideology. In general, Democrats favor higher taxes on the rich and a stronger social safety net; Republicans favor lower taxes on corporations and the wealthy paid for in part by cutting social programs.

Kamala Harris is, in this sense, a normal Democrat, calling for tax hikes that would primarily affect high-income Americans while expanding tax credits for families with children; she has also proposed expanding Medicare to cover home health care for seniors, which would be a big deal for millions of families.

An aside: I really don’t understand people who claim that Harris hasn’t supplied enough policy detail. All I can think is that they’re looking for something to complain about so they can sound evenhanded.

Has Trump deviated from Republican norms? While he was president, not really. His 2017 tax cut strongly favored high-income Americans. Now he wants to make that tax cut, many of whose provisions will expire in 2025, permanent. He

has also floated the idea of a further large cut in corporate taxes (much of which could, by the way, ultimately benefit foreign investors).

As president, Trump tried to push through deep cuts in Medicaid, although he didn’t succeed. And while he says that he won’t cut Social Security and Medicare, his policy proposals would undermine these programs’ financial foundations.

Trump has also made some tax proposals that may sound pro-worker but aren’t, such as ending taxes on tips; many tipped workers don’t make enough to pay income taxes, and those who do are mostly in a low tax bracket.

If Trump has broken with standard GOP economic policy, he has done so by intensifying efforts to redistribute income upward. For he is proposing higher taxes on the working class in the form of a large national sales tax — which is essentially what his tariffs would be. And this tax would be highly regressive — a large burden on middle- and lower-income families, a trivial hit to the 1%.

If you put reasonable estimates of the effects of the Harris and Trump tax plans on the same chart, they’re more or less mirror images. Trump would raise taxes on most Americans, with only the top few percent coming out ahead; Harris would do the reverse.

So, no, Trump isn’t a friend to working-class Americans; quite the opposite. Why, then, do millions of people believe otherwise?

Some of it probably reflects racial tension: White men without college degrees have lost ground relative to other groups since 1980, and some of them, alas, surely feel an affinity for the racism and misogyny we saw at Madison Square Garden. But as I said, some Latino and Black Americans also appear to have bought into Trump’s spiel. Why?

Well, Americans correctly remember Trump’s prepandemic economy as an era of strong job growth and rising wages — largely, I’d argue, because Republicans in Congress opened the fiscal spigots after austerity during the Obama years slowed recovery from the 2008 financial crisis. Many also implicitly discount or memory-hole the high unemployment of Trump’s final year in office. And they’re still frustrated about higher prices, the consequence of the inflation surge of 2021-22 — even though this surge was a global pandemic phenomenon, and wages adjusted for inflation are now higher than they were right before the COVID-19 pandemic.

What relatively few people realize, I believe, is that if he wins next week, Trump’s antiworker agenda will be much broader than anything he managed to do in 2017-21. Back then, he raised average tariffs on Chinese goods by about 20 percentage points, but China accounts for only about 15% of U.S. imports; now he’s talking about imposing similar tariffs across the board, and 60% on imports from China. Overall, we’re talking about a sales tax roughly 10 times as large as his last venture.

Trump, then, is anything but pro-working-class Americans. If many believe otherwise, well, they aren’t the first victims of his lifelong career as a con man.

Anuncian nuevo ciclo de conferencias para cuidadores

Un nuevo ciclo de charlas educativas del proyecto “Una Mano al Cuidador”; organizado por la Universidad Central del Caribe (UCC) dará inicio este próximo mes de noviembre, para capacitar a personas que tienen la responsabilidad de atender a un familiar adulto mayor, brindándoles herramientas y conocimientos esenciales para mejorar su labor. La próxima charla de este nuevo ciclo se llevará a cabo el próximo 9 de noviembre en EDP University de Humacao, localizado en la calle Antonio López #4.

“Esta jornada de ‘Una Mano al Cuidador’ regresa después de la acogida recibida en junio, lo cual evidencia la gran necesidad de apoyo que tienen los cuidadores en Puerto Rico. En la iniciativa, desarrollada por la gerontóloga Mildred Rivera Marrero, participa un equipo multidisciplinario que ofrece un espacio de aprendizaje y acompañamiento”, destacó la presidenta de la UCC, Dra. Waleska Crespo Rivera.

Centro Médico camina para crear conciencia sobre la prevención de un ACV

Alrededor de 200 personas celebraron ayer el Día Mundial de Prevención del Accidente Cerebrovascular en una caminata organizada por la Administración de Servicios Médicos (ASEM) para crear conciencia sobre los ataques o derrames cerebrales.

El entusiasmo y energía contagiaron a los participantes que respondieron al llamado del equipo de trabajo del programa de Neuro Endovascular y la ASEM para participar de esta iniciativa denominada “Puerto Rico sin ACV: marcha por tu cerebro”, que tuvo como ruta una vuelta al Paseo José Celso Barbosa que rodea la ciudad médica.

A la caminata, que estuvo liderada por el director ejecutivo de ASEM, Jorge Matta González y el Doctor Rafael Rodríguez Mercado, director del Centro de Cirugía Neuroendovascular, se unieron galenos, estudiantes de medicina, pacientes, familiares y empleados de Centro Médico.

The October ritual of watching horror movies in the lead-up to Halloween can be exhilarating. Unless, of course, you can’t quite stomach the gory and gruesome, or even the spooky and spine-tingling.

This used to be me, until I made a concerted effort to push past my qualms. It took a while, but now I consider myself something of a horror enthusiast, relishing the thrill, tension and challenges of a genre that can playfully toy with dark themes, like “Shaun of the Dead,” or pull no punches, like “Hereditary.”

If you’re someone who wants to indulge in the season but dreads jump scares and buckets of blood, here are five tips that could help even the biggest scaredy cats among us start to open up to the world of horror.

Embrace the spoiler

The first and best line of defense is to read the plot in advance. If you’re feeling brave, go for just a synopsis, but there’s no reason to be a hero. I sometimes read an entire plot in great detail before watching, especially with films I know will tap into my weak spot: movies about demonic possession. Unlike with other genres, knowing what will happen in horror doesn’t necessarily detract from the experience of watching. Your heart will most likely still pound. You will probably still jump. And the visuals and sounds will probably still shock. Knowing what comes next may simply help keep the anxiety and uncertainty in check.

Even after 15 years, my midnight bathroom runs are often still plagued by mental flashes from “Paranormal Activity.” Otherwise I have largely been able to avoid this side effect by allowing myself even 10 minutes for a post-viewing journal entry in my phone’s Notes app or a scrawl on the nearest scrap of paper. Quickly writing down what scared you the most, and how those moments made you feel, can help demystify the worst of it and set your future mind free.

Por la presente se le(s) notifica que se ha radicado en la Secretaría de este Tribunal una Demanda en Cobro de Dinero y Ejecución de Hipoteca por la vía ordinaria en contra de Elba Lydia Lascot Rosario por sí y como miembro de La Sucesión De Luis Adrián Villafañe Mejías (Deudora Hipotecaria) y La Sucesión de Luis Adrián Villafañe Mejías, en la cual se alega que adeuda a la parte demandante por concepto de hipoteca la suma de $36,277.21 por concepto de principal, desde el 1ro de agosto de 2022, más intereses al tipo pactado de 6.50% anual que continúan acumulándose hasta el pago total de la obligación. Además Elba Lydia Lascot Rosario y La Sucesión de Luis Adrián Villafañe Mejías adeuda a la parte demandante los cargos por demora equivalentes a 5.00% de la suma de aquellos pagos con atrasos en exceso de 15 días calendarios de la fecha de vencimiento; los créditos accesorios y adelantos hechos en virtud de la escritura de hipoteca; y las costas, gastos y honorarios de abogado equivalentes a $3,600.00 para cubrir intereses en adición a los garantizados por ley y cualquiera otros adelantos que se hagan en virtud de la escritura de hipoteca número 245, otorgada en Arecibo, Puerto Rico, el día 28 de noviembre 2007, ante el notario Ramón H. Banuchi, de la finca número 11,443, inscrita al Folio 185 del Tomo 247 de Arecibo, Registro de la Propiedad de Arecibo, Sección Primera. Por razón de dicho incumplimiento, y al amparo del derecho que le confiere el Pagaré, el demandante ha declarado tales sumas vencidas, líquidas y exigibles en su totalidad. Este Tribunal ha ordenado que se le(s) cite a usted(es) por edicto que se publicará una sola vez en un periódico de circulación general. Quedan emplazados y notificados de que en este Tribunal se ha radicado una demanda enmendada en su contra. A modest monument to the Dodgers’ days in Brooklyn

NEW YORK — Every now and then, someone will wander into the parking lot of the sprawling apartment complex in Brooklyn where Ezra Askotzky works and start staring inquisitively at the ground.

By now, Askotzky knows what they are looking for: a small plaque that marks

the location of home plate at Ebbets Field, the long-ago-dismantled home of the Brooklyn Dodgers.

Askotzky, 28, the maintenance manager for the Ebbets Field Apartments, or one of his staff members, will emerge — often wielding one of the wooden bats they keep in their office as props for pictures — and momentarily assume the role of tour guide.

“At this location on April 15, 1947, Jack Roosevelt Robinson Integrated Major League Baseball,” the plaque reads.

“People come all the way out here just to see something that means so much to them,” said Askotzky, who started working at the Crown Heights complex in 2021 after moving from Milwaukee. “It’s not a big deal for us just to go out there and give someone a bat and offer to take their picture. You see the smile, and that makes it worth it.”

The Dodgers moved to Los Angeles before the 1958 season, and two years later Ebbets Field was razed. In 1962, the Ebbets Field Apartments rose up in its place.

Now, with the New York Yankees and the Los Angeles Dodgers competing in the World Series, the plaque that gets a small handful of visitors most days is now seeing a few groups almost every hour.

And Askotzky and his staff of 40 or so maintenance workers and porters have become unwitting, and generally ungrudging, caretakers of this almosthidden vestige of the franchise’s lore.

On Monday, hours before Game 3 of the World Series in the Bronx, Phillip Duke, a maintenance staffer who has

worked at the complex for more than 20 years, was crouched on the sidewalk, using a cordless drill with a brush bit to burnish the plaque.

At one point, Adam Aguilar and Osvaldo Heredia, two friends visiting the city from San Bernardino, California, wandered hesitantly into the parking lot.

“We’re looking for the home plate marker,” Heredia said.

“Oh, we sold it this morning,” one of the porters said, with a straight face. “For $1.5 million. It’s gone.”

The friends looked at each other, surprised and dejected. A second later, the workers burst out laughing.

“No,” the porter said. “You’re standing on it.”

Indeed, one of the memorial’s defining features is its inconspicuousness. You wouldn’t see it if you weren’t looking. And even if you were, you might struggle to find it.

something of a dying breed: a native New Yorker who roots for the team.

Dagliolo, 37, of Astoria, bent over to touch the plate — “trying to get the old Brooklyn ghosts going” — and left shortly after, feeling at once impressed and a tad underwhelmed.

“There should be more of a shrine to it,” he said. “It’s part of the fabric of Brooklyn. If I had to give feedback, I would say they could do a little more with it.”

But the memorial, of course, is not sequestered inside a museum. It sits on the well-trodden pavement of a sprawling, 1,318-unit apartment complex.

As on any New York City sidewalk, most of the residents on Monday wove wordlessly around the loitering tourists and visitors, hardly breaking stride.

One resident, Alexia Scott, 39, who grew up in the houses and recently moved back, took the time to shepherd over a couple of confused out-of-towners she had encountered down the street.

Scott said she was proud of the building’s past — its associations with Jackie Robinson and Black history — but not-

ed that gentrification and changing immigration patterns in the neighborhood meant that fewer people seemed to revel in its aura.

“New people don’t always understand the gravity of the fact that we’re walking where legends walked,” Scott said. “This is a landmark, and we really need to preserve this space.” She paused, saying she had gotten chills. “It’s a big deal. But it looks like this.”

Askotzky said he often met people who had attended Brooklyn Dodgers games as children. He said he had found the wooden bats in a vacant apartment one day and brought them downstairs, thinking they might be of use.

“Some people really crouch down into a stance,” Askotzky said. (He prefers basketball and football to baseball: “The games are too long. It’s too slow.”)

As the day went on, more visitors arrived, sparking more banter with the staff — about whether the Yankee Stadium crowd could buoy the home team that night, whether certain star players were healthy or not, and who ultimately would take the trophy.

Not all tennis balls are the same

Yellow felt and a rubber core. A tennis ball seems so simple. But reality is more complicated, at least on the pro tours where manufacturers can make balls that fit into a range of specifications. And in recent years, with players forced to adjust to different balls at so many tournaments, they have begun complaining about the consistency and the quality of the balls as never before.

Novak Djokovic spoke out. So did Rafael Nadal. And Taylor Fritz, Daniil Medvedev, Stan Wawrinka and Andrey Rublev. The varying balls not only harmed the quality of play, according to players and coaches, but the athletes blamed them for the increase in shoulder, elbow and, especially, wrist injuries.

“The quality of even the best balls has come down in the last few years,” said Craig Boynton, who coached Hubert Hurkacz. “They should not just be picking the ball that will pay the most money to be associated with a tournament, but what is the actual best ball.”

Lower-quality balls can feel like rocks early in a game then “get fluffed-up like little kittens” after a few games, Boynton said.

When that happens, “players trying to muscle the ball more” by swinging with more force to make up for what the ball is lacking can get injured.

But that’s only half the story, Boynton said. Wayne Ferreira, Frances Tiafoe’s former coach, said that even when the balls were high quality, there were too many different ones in play. Players often saw different brands each week.

“Some are heavier and some are lighter, and making that adjustment all the time is difficult,” he said.

The list of unhappy players grew so long and the criticisms so loud that the ATP and WTA felt compelled to respond. Earlier this year, they promised a comprehensive review of the issue.

“It’s natural for the players to be sensitive to the changes because they now have so much feel on their rackets,” said Ross Hutchins, chief sporting officer for the ATP. “This has been a challenge for decades to be honest, but we realized we could do better.”

He said they had made enormous progress. The ATP looked into manufacturing balls itself but instead decided the best solution was to centralize the ball-purchasing process that

They considered having one manufacturer for the entire season, but they instead set a goal of only having one ball — whether Wilson, Penn, Babolat, Dunlop or another — in use for each swing, Hutchins said. He added that a swing could range from a handful of tournaments to as many as 10 in a given region and on a specific surface.

So the year begins with a swing through Australia and New Zealand, followed by ones through the Middle East and North America. All of those tournaments are played outdoors on hard courts, but it is possible that each grouping will use a different ball.

Later in the year there will be one ball for the European clay-court swing, the grasscourt swing and so on. The ATP is coordinating with the WTA to use the same balls as much as possible, especially where the men and women are playing in the same location.

“The ATP will do the negotiations and oversee the development of the ball with the manufacturers to get the best balls for each swing,” Hutchins said.

The process began this year, and he said that as each deal ended between individual tournaments and manufacturers, the ATP would fold those tournaments into its centralized process. Five more will be added next year, and by 2026 they will control more

than 75% of the tournaments, with 2029 as the target date for “full alignment where we control everything,” he added.

The exception is the Grand Slams, which operate independently of the ATP and WTA and have their own deals with ball manufacturers. “The Slams are a major cog in the wheel of tennis, but we have tons of tournaments around them and can control what we can control,” Hutchins said.

He said the Australian and U.S. Opens and Wimbledon have been good collaborators, so the balls used in the Slams will match those used in the tournaments leading up to them, with only the French Open as a holdout — the ATP is using a Dunlop ball for claycourt season, but the French Open has a deal with Wilson.

“We hit thousands of balls per day, which puts stress on your tendons and muscles, so this change would produce a more consistently high level of play and a better product for the sport and our fans,” said Matthew Ebden, president of the ATP’s player advisory council. (Ebden was ranked No. 1 in doubles this year.)

Ferreira said it would be impossible to account for every variable, including players with differing styles (big server versus an agile defender, say) who want different things from each ball.
