José Enrique “Quiquito” Meléndez Ortiz announced on Tuesday the filing of a resolution in the island House of Representatives to investigate the feasibility of conducting an electrical load study for each of the 856 schools in the island public education system to support the installation of air conditioning systems in each of the system’s 33,000 classrooms. The measure also aims to study the possibility of expanding the capacity of the electrical substations that serve the island’s public schools. “There is a reality and that is that most of the 856 public schools in Puerto Rico were built before the 1980s; none have more than 40 years of construction,” the New Progressive Party (NPP) lawmaker said. “This, together with the development of new housing and business complexes on the periphery of these schools, has undermined the distribution capacity of the substations. That is why we want to make a detailed study of the energy needs of each school, including the capacity of the substations.” Meléndez’s comments came the day after the House Education Committee, chaired by Rep. Deborah Soto Arroyo, announced that they will try to override the governor’s veto of House Bill 1040 on the installation of air conditioners in public schools. “The governor vetoed the bill that both the House and Senate approved in May 2022, a vital project given the high levels of heat I have observed in my visits to schools at the beginning of classes,” Soto Arroyo said in a written statement. In addition, she urged the New Progressive Party (NPP) delegation to join forces to overcome the governor’s veto, requiring a total of 34 votes. “I know firsthand the difficulties students face with these heat levels,” the District 10 lawmaker said. “I invite the governor and the secretary of education to experience these conditions for themselves.” Meléndez said the intention to install air conditioners in every public school classroom is laudable. However, he added, it is not feasible to do so without a certified load study that includes the substations. With his resolution, he seeks to know the real energy status of each campus and substation in order

to outline a program that allows the installation of the units without stressing the electrical network. “We cannot install without checking and rehabilitating the electrical structure in schools,” Meléndez said, “or without knowing the capacity of the substations. Doing so would be irresponsible and would endanger students. We believe that the Education Committee in the House of Representatives has the power to initiate this investigation, which should include, in addition to the Department of Education, LUMA Energy, the Electric Power Authority, Genera Puerto Rico and the Public Buildings Authority and the Society of Master Electricians, among others.” Meléndez said the resolution will be filed this week and hopes that the Lower House will provide “the urgency it deserves by approving it as soon as possible.” Later on Tuesday, designated Education Secretary Yanira Raices Vega met with other public school officials at the agency’s Hato Rey offices. The meeting was still in progress at press time. Meanwhile, the National Weather Service announced Monday that a temperature record was set for Sept. 1 in San Juan at 95 degrees Fahrenheit.

García Padilla brands the House speaker ‘a poor devil’ By THE STAR STAFF

he internal disputes of the Popular Democratic Party (PDP) reached new heights Tuesday after former Gov. Alejandro García Padilla branded Speaker of the House of Representatives Rafael “Tatito” Hernández Montanez “a poor devil” and suggested he would ask PDP supporters in Dorado to vote against him in future primaries against current mayor Carlos López Rivera. “Poor devil” (pobre diablo) is a term that means a mediocre, unfortunate person. García Padilla’s remarks to a radio station came after Hernández Montañez told another media outlet that the former governor was mediocre and immature and that he had endangered the self-governing powers of the commonwealth during his four-year gubernatorial term. When asked if he felt hurt by Hernández Montañez’s remarks, García Padilla said “those who can hurt me can, but these are remarks of a poor devil.”

Senator proposes cut to salary withholdings By THE STAR STAFF

T

o ensure that salaried taxpayers and the self-employed can have immediate economic relief from the effects of inflation, Popular Democratic Party Sen. Javier Aponte Dalmau introduced a measure Tuesday to allow a reduction in salary withholdings to temporarily put more money in Puerto Rico residents’ pockets. “After unsuccessfully trying to address somehow the inflation that has been affecting us in recent years, we realized that at the domestic level we had to identify an alternative that does not touch the Sales and Use Tax (IVU) and that the Financial Oversight and Management Board will not allow us to play with,” Aponte Dalmau said in a written statement. “That is why we are proposing a temporary solution that, at least, would put more money in the pockets of our taxpayers, and that would represent relief from the difficult situation we are experiencing due to the rise in the cost of living.”

Senate Bill 1304, introduced by Aponte Dalmau, proposes an immediate and temporary reduction in the withholding tax while the inflationary situation lasts and/ or the inflationary consumption indicator is at 2% in the market. The imposition of the measure will be of similar application in the short term as the instruments used by the Federal Reserve (Fed Funds) with the same purpose of reducing inflation, he said. The senator added that “the government itself has repeatedly indicated that it is experiencing stability in collections and we believe this means that we should discuss alternatives like this one that I am presenting to help our salaried and self-employed taxpayers without having to breach the outlined Fiscal Plan by the [oversight board].” “We find it unacceptable that the government continues to unjustifiably accumulate the positive income that we have obtained while our citizens continue to suffer economic limitations due to the increase in the cost of products and services, seeing their quality of life and growth possibilities

adversely affected,” Aponte Dalmau said. “I am confident that we can make way for a discussion of this measure and approve it for the benefit of our workers.” According to a Fiscal Agency and Financial Advisory Authority report, Puerto Rico’s net general fund revenues in July were nearly

Governor signs order to establish a violence prevention plan By THE STAR STAFF

ov. Pedro Pierluisi Urrutia announced onTuesday the signing of Executive Order 2023-023 for the creation of a Comprehensive Plan for Social Reconstruction and Violence Prevention. “The government is making many efforts to establish a public policy that seeks to address the roots of crime and violence,” Pierluisi said at a press conference. The plan will convene diverse sectors of society, led by an advisory committee, in a Multisectoral Congress on Social Reconstruction and Violence Prevention. María del Carmen Muñoz will be responsible for the administrative aspects and implementation of the plan, which seeks to address the root problems of violence in society. The congress will seek to promote dialogue and consensus to identify resources, establish short- and long-term

strategies, and foster social welfare programs. The effort aligns with the administration’s current strategies to combat violence on all fronts, the governor said. “The goal is to promote a broad and comprehensive discussion so that we can all be part of the strategies in favor of a society of respect,” the governor said regarding the plan, which was designed in collaboration with designated Family Secretary Ciení Rodríguez Troche. In line with the new initiative, the administration has implemented various strategies, including allocating increased funding for mental health and rehabilitation programs in correctional institutions. Pierluisi also highlighted that ongoing initiatives against gender-based violence are influencing government policies at the national level. “Violence does not discriminate, it hurts families and communities, leaving permanent scars on citizens,” the governor said, stressing the need for coordinated action to

he National Hurricane Center (NHC) in Miami announced on Tuesday the formation of Tropical Storm Lee, whose center should pass some 350 miles north of Puerto Rico as a hurricane later this week. According to the NHC, Tropical Storm Lee was located some 1,500 miles east of the Lesser Antilles, moving west-northwest at 15 miles per hour (mph), with sustained winds of up to 40 mph. The storm was maintaining a minimum central pressure of 12 millibars. The system poses a potential threat to the Leeward Islands and those interested in that area are advised to monitor the progress of the depression. It could reach major hurricane status within days, implying more intense winds and dangerous conditions.

ore than a dozen merchants on Calle Manuel Camuñas in the Hato Rey sector of San Juan raised their voices in protest on Tuesday at the absence of maintenance of the streets that provide access to a dozen important businesses in the area. A package of photographs sent to the local news media shows that the merchants have had to buy loose asphalt fill, or “tierra mogolla,” for the numerous large potholes that have formed in the asphalt that has been in use for more than 30 years without receiving maintenance. “We know that the Municipality of San Juan has a program in place to pave streets in the Capital; we call on Mayor Miguel Romero to include the short Manuel Camuñas Street, which runs parallel to the south of the busy Carlos Chardón Avenue,” said Andrés Medina Gutiérrez, an engineer with a business on Manuel Camuñas Street. “We merchants and businessmen have done our bit by making repairs and sometimes buying tons of asphalt to patch up the street. However,

it no longer supports this type of arrangement; it is necessary to repave so that customers can access our businesses and

companies, where we have more than 400 employees who depend on us.”

Ceramics for a cause Artisans collective sells works to support Down syndrome nonprofit By RICHARD GUTIÉRREZ richardsanjuanstar@gmail.com

I

n the course of reporting on artisans that come from various parts of the island, the STAR has learned with time that being an artisan in Puerto Rico can be a lot of hard work with very little pay. Sometimes island artisans must spend more money than they make in order to make it through the month and get into the right events. While gathering the right promotions is also hard work in itself, large corporations can sell many things they make for a cheaper price, which sometimes can be a very big stepping stone for artisans. Some of these big companies, such as Walmart or Sam’s Club, tend to make charity donations, sometimes ranging in the thousands or millions of dollars. Of course, companies that make a lot of money can spend a lot of money. Even though artisans have a difficult time making ends meet every month, there is a group of artisans from Puerto Rico and the mainland United States who are currently working hard toward donating to a cause themselves. “We are a collective of ‘keremicós’ -- we are 19 ceramic artists who share their experiences together,” Rosa Serrano, the collective’s director, told the STAR. The collective came together “through simply us getting together and talking about ceramics and what we like about it and what we project upon it with our work,” Serrano said. “Thanks to this group we’ve created, we’ve been able to unite people who have a lot of experience in ceramics, not just from people who are on the island, but those who are not in Puerto Rico. We’ve been doing this for about three years in a row. … We have around seven artists who are in the United States and are participating in this exhibition as well. Our goal is to continue supporting the ceramic tradition in Puerto Rico and encourage more people to get into it.” Over the past three years the collective has supported different causes, with this year’s cause having to do with Down syndrome. “The first year we supported the CAP Foundation for children with cancer; we donated about 20% of our sales toward that cause,” Serrano noted. “The year after that we supported the Gogo Foundation, which is also a nonprofit for children with cancer, while this year we have the Down Syndrome Foundation. On Thursday we were able to spend time with the children in the foundation; we gave them some ceramics classes.” “Today we were supposed to have them here again to take more classes and be inspired by our work,” the artisan said, “but due to certain circumstances it was canceled. However, on Thursday we had a delightful

time with all of those children. The director of the foundation came here yesterday and was able to explain the organization’s functions to the artists.” Even though it was rather unfortunate that the children were not able to visit the artists again, the cause still stands. In fact, Serrano said, their purpose is to continue bringing in young and able artists who want to join their group and continue the ceramics legacy. “We want to encourage young people to join our group and continue the ceramics tradition in Puerto Rico and support the causes we support every year,” Serrano said. “The first year we started this expo we had about 52 participants; this year we already have 97 participants. We are very happy about it.” The event was also dedicated to Cristina Córdova, a Puerto Rican ceramics artist who has made an immense contribution to ceramics art, and is very well known internationally. “We will at least connect with her through Zoom because she is not currently in Puerto Rico, but she is most certainly someone worth dedicating this event

to,” Serrano said. The cause that the artisans are supporting this year, the Puerto Rican Down Syndrome Foundation (FPSD by its Spanish initials), is a nonprofit organization that was incorporated by the island State Department in 1989. However, the society had been formed in 1986 by parents of children with the condition, specifically because they found an absence of services for this population and dedicated themselves to guiding other parents in the same situation. Since then the FPSD has offered numerous services. According to the foundation’s official statement: “With the seriousness and commitment that characterizes us, we have served more than 6,000 children, youth, and adults. This is currently the only organization that serves the population with Down syndrome with a comprehensive approach to services. This year we celebrate 33 years of continuous services. We are also pleased that other children and youth, who do not have Down syndrome, benefit from the nonprofit’s programs.”

First lady tests positive for COVID, but president does not By MICHAEL D. SHEAR

J

ill Biden, the first lady, tested positive for COVID-19, the White House announced late Monday night, but she is experiencing only mild symptoms and will remain at the family home in Rehoboth Beach, Delaware, where she and President Joe Biden spent part of the weekend. Biden tested negative for the virus after the first lady’s diagnosis, a spokesperson said. The president returned to the White House on Monday evening. Officials said the president would continue to test on “a regular cadence” throughout the week and would monitor for possible signs of infection. The first lady’s diagnosis is a reminder that COVID-19 remains a potent virus in the country. In recent weeks, public health authorities have noted an increase in the number of COVID infections around the country, though the total number remains low and experts do not believe the United States will experience a dangerous

wave of illness like those during the height of the pandemic in 2020 and 2021. Still, scientists have identified new variants of concern, called EG.5 and BA.2.86. EG.5 has become the dominant variant of COVID in the United States and BA.2.86 — while responsible for fewer infections — shows more than the usual amount of mutations from the original coronavirus, a fact that concerns scientists because it could mean it is better at evading vaccines. The effects of COVID-19 on daily life in America have largely receded, though it remains a danger for the elderly and people with compromised immune systems. The number of deaths from the virus is the lowest since the pandemic began, and roughly one-tenth of the levels seen in January of this year. Few people wear masks when they are in public and businesses no longer close for fear of the virus spreading. But doctors are still urging people to make sure they get vaccinated. An updated vaccine expected this fall is designed

to better protect against some of the newer variants. For Joe Biden, his wife’s illness is a throwback to the beginning of his administration, when the virus was raging and the economy was reeling from closures. Those days are largely in the past. Biden rarely mentions COVID or the pandemic in speeches anymore. In Labor Day remarks in Pennsylvania on Monday morning, Biden only made a glancing reference to the economic effects of the virus. “We’ve recovered all the jobs lost during the pandemic,” he said. “We’ve added millions more.” Biden spent Saturday with his wife as the couple traveled to Florida to tour damage from Hurricane Idalia. They spent Sunday at their home in Rehoboth Beach. If Biden does test positive in the next several days, it could jeopardize his plans to travel abroad later in the week. He is scheduled to leave Thursday for a three-day trip to India, where he is supposed to attend a meeting of the Group of 20 leaders from around the world. He is then scheduled to travel to Vietnam for a day before returning to the United States.

housands of people who had spent days stranded at the Burning Man festival in a rain-gorged stew of mud and slop began to pack up their camps Monday and stream away from the sprawling site in remote northwest Nevada. “Exodus operations have officially begun,” organizers wrote in a post on social media. But it was a mucky, uncertain trek. The ancient lake bed where the annual festival is held was beginning to dry and harden on Monday after days of torrential rain, but drivers said they were still encountering foot-deep puddles and stretches of muddy bog along the 5-mile route from the camp to a paved road. “You had to haul,” said Kristine Rae, 50, a physical therapist from Idaho who made it out in her truck. On her way, she saw marooned vehicles that weren’t so lucky. “There were cars stuck halfway up their wheels.” On Monday night, the festival’s climax, postponed twice because of the weather, finally took place: the burning of a towering wooden effigy shaped like a man. Even in normal years, leaving Burning Man can take up to 12 hours as thousands of cars and trailers creep off the desert playa and onto a jammed two-lane road. This year, organizers urged the roughly 72,000 attendees to consider postponing their departure until Tuesday to avoid creating an epic traffic jam. On Monday, Black Rock City — the name of the site on federal lands where the annual celebration of arts and music takes place — was a hive of activity as people packed sleeping bags, stoves and muddy tents into their trunks before heading out. Some left excess water, food and camping essentials for festivalgoers — known as burners — who were staying.

Roughly a third of the campers had packed up and moved out, and others were collecting mud-caked flotsam left behind in the rutted ground. There were abandoned bikes, mud-smothered tents and the steel skeleton of a 15-foot shade structure. At camps, people raked the ground to search for any items that had become mixed into the hardening batter of dirt and rain. With better weather forecast for Monday night, some people had decided to stay in hopes of witnessing the burn, as the torching of the wooden effigy is known. “Of course I’m staying,” said Olivia Steele, 38, an artist whose trailer had become home to a half-dozen other campers fleeing their leaking tents. “We come here every year to get schooled. This time we got a great education.” Muddy conditions and the inability to move heavy fire safety equipment to the burning site were to blame for the two postponements of the burn, officials had said on a social media account linked to the festival. Conditions across the area were drier and warmer on Monday, and the weather was expected to stay that way the rest of the week, with only a slight chance of sprinkles overnight into Tuesday morning, said Mark Deutschendorf, a meteorologist at the National Weather Service in Reno. It was a welcome change from the downpours that began Friday and forced the festival to urge attendees to shelter in place and conserve food and water. Bike wheels became clogged with mud, and people had to navigate the normally powdery desert with plastic bags over their shoes to protect them from the oatmeal-thick mud. Some decided to bail, trudging through miles of mud to reach the road and hitchhike. A widely shared video showed music producer Diplo and comedian Chris Rock sandwiched in the back of a pickup truck after being picked up by fans. The makeshift town of Black Rock City hosts more than

70,000 people every year and is a three-hour drive from the nearest airport, which is more than 100 miles away in Reno. This year’s festival began on Aug. 27. The authorities were also investigating the death of one participant, though they said it did not appear to be weatherrelated. In normal years, people at the festival have to contend with sweltering temperatures and dust storms, so this time, many tried to embrace the mud. Donovan McGrath, a 47-year-old yoga instructor from Los Angeles, said that many at the camp threw parties inside recreational vehicles, played games and got to know the people they were stuck indoors with. “The rain provided an amazing opportunity to walk, to move more slowly, to connect with people who you may not have,” he said. “There were many silver linings.” On Sunday afternoon, a White House official said President Joe Biden had been briefed on the situation and that administration officials had been in touch with state and local officials. On the playa, people laughed about the fact that the president had been briefed about Burning Man, McGrath said. Mayor Hillary Schieve of Reno said Sunday on social media that the city was working with regional partners to prepare for a mass exodus of Burning Man attendees. Certain parking lots of the local convention center were available for use, she said. Many said the unexpected rain had brought out the gritty, self-reliant roots of a festival that has sometimes been criticized for gentrifying into a destination party for tech moguls and social-media influencers. On Monday afternoon, tents were coming down and a bus was expected to arrive at the 100-person Mystopia camp where Hayden Welda had stayed during the festival. He and his crew were already talking about their return. “We’ll be back next year,” he said, “and hoping it doesn’t rain.”

Maui evacuation alert shows limits of a warning system dependent on cellphones By MIKE BAKER, SERGIO OLMOS and EILEEN SULLIVAN

A

s fire was billowing through residential neighborhoods in the Hawaii town of Lahaina last month, emergency managers for Maui County sent out an evacuation alert that would blare on the cellphones of anyone near the blaze. “Evacuate your family and pets now, do not delay,” the warning said. But many people most in need of the alert said the message never reached their phones, leaving them scrambling for safety as the fire began roaring toward their homes. More than 100 people died in the inferno, and some survivors wondered why they had not been notified earlier that the situation was out of control. “I probably could have saved my animals,” Barrie Matthews, 70, said as she tearfully recalled her family’s desperate effort to escape. “We just had to go. We had to leave five of my cats. I can barely live with myself.” As more households disconnect landline telephones and fewer families have access to broadcast television and radio, emergency managers have increasingly focused on wireless emergency notifications to instantly reach large numbers of people. But that modern system has its own limitations, relying on the resilience of cell networks and the proficiency of emergency crews across a patchwork of local agencies. Two weeks after the Aug. 8 Lahaina fire, as Hurricane Hilary was threatening California, the San Bernardino County Sheriff’s Department found that it could not send a wireless evacuation alert to the community of Seven Oaks, where several people were ultimately left stranded and one remains missing. The county cited a breakdown in its connection to the wireless alert system, which is managed by the federal government. Jim Keeney, who lives in Seven Oaks and is one of the six people who opted to stay behind, said the missing woman, Christie Rockwood, would have “absolutely” evacuated if there had been an order from the sheriff. “Somebody dropped the ball,” Keeney said. “We would have left.” The patchwork nature of the system was made evident again last week, as Hurricane Idalia was barreling toward the Florida coast. As 30 counties announced various evacuation orders, some local agencies pushed them out via wireless alerts on the federal network, but many did not.

Launched in 2012, the Wireless Emergency Alerts system was designed to allow federal, state and local authorities to send messages about severe weather, unfolding disasters and abducted children on a single, uniform system. It has been used tens of thousands of times and will be part of a nationwide test of emergency warning systems set to take place on Oct. 4. Unlike television, radio, road signs or social media, emergency managers can use wireless alerts to target specific neighborhoods with an alarm that can wake someone from sleep or jar them to attention. Jeannette Sutton, a professor at the University of Albany who specializes in disaster warning alerts, said the system can be messy. There is little guidance for agencies on how to formulate the alerts, so they can sometimes go out with missing information or confusing instructions. They are often left to be sent by emergency personnel who are busy trying to fight fires or control floods. When the system is operated correctly, Sutton said, it acts like a siren in thousands of pockets, giving the authorities the ability to warn the right people at the right time. An upgrade several years ago expanded how much text can be included in each alert, allowing for more detailed guidance on how people can keep themselves safe. “It is vital,” she said. “It is absolutely necessary. It does save lives.” On Maui, the first signs of the afternoon fire came around 3 p.m., when video showed smoke blowing down a hillside. As the blaze began moving into the neighborhood below, some residents began evacuating on their own. Others said they struggled to see what was happening or where to go, with some saying they assumed the smoke in the distance was a fire that would soon be under control. Soon, however, the fire gained momentum and was igniting houses in its path. Records show that it was only at 4:16 p.m., after the fire had begun moving through town, that the county sent an emergency cellphone alert. It was sent to a portion of the town’s residential area east of the commercial district. But it did not cover the Front Street area along the waterfront, nor the other neighborhoods to the north and south, that were soon overrun with fire. Matthews said that, at her home on the south side of town, she saw the smoke to the north of her and began checking media sources for updates. She got in her car and

She went back in the house and flipped through television stations but saw no sign of trouble. No alerts popped up on her cellphone. The county has said it did not activate its audible warning sirens, fearing that people would think a tsunami was coming. “I thought somebody would let us know what was going on,” Matthews said. “There was nothing.” Suddenly, she said, the fire was just a couple of blocks away. She said she and her husband scrambled to collect their many animals and her ailing father. But they did not have time to gather all of their cats. Many residents said they never got an alert. Others said they did. Emergency management officials in Hawaii did not respond to requests for comment about how the Maui wireless alerts were handled. A range of technological factors can determine whether an alert gets through, including whether a cellphone is in the zone targeted, whether it was turned on, and whether it had cell coverage. The age of a phone can also influence how it receives an alert, as newer devices are calibrated to receive alerts targeted to more specific

geographic areas. Some who received the alert said it may have saved their lives. Breanna and Glenn Gill were taking a nap at the Lahaina Shores Beach Resort when the emergency alert came at 4:17 p.m., blaring on their phones, waking them up. Glenn Gill opened the shade of their hotel room and saw the hillside ablaze above them. They were able to evacuate. Residents reported that cellphone coverage was spotty that day, as the town dealt with power outages and high winds. Cellphone service in the area of Maui where the fire occurred is largely dependent on overhead fiber lines, and as the fire spread, those lines were damaged. An AT&T spokesperson, Jim Greer, said the fiber infrastructure that serves all wireless carriers in the area was burned. While lines are buried in many parts of the country, Greer said that the volcanic rock on Maui makes that a challenge. Sutton said it was important to build more redundancies into the emergency alert system, look at burying cables to make it more resilient and remember that the wireless system cannot be relied on alone to warn people that danger is imminent. “It’s one layer in the many potential strategies,” she said.

A $700 million bonanza for the winners of crypto’s collapse: Lawyers By DAVID YAFFE-BELLANY and YIWENN LU

T

he collapse in cryptocurrency prices last year forced a procession of major firms into bankruptcy, trigging a government crackdown and erasing the savings of millions of inexperienced investors. But for a small group of corporate turnaround specialists, crypto’s implosion has become a financial bonanza. Lawyers, accountants, consultants, cryptocurrency analysts and other professionals have racked up more than $700 million in fees since last year from the bankruptcies of five major crypto firms, including the digital currency exchange FTX, according to a New York Times analysis of court records. That sum is likely to grow significantly as the cases unfold over the coming months. Large fees are common in corporate bankruptcies, which require complex and time-intensive legal work to untangle. But in the crypto world, the mounting fees have sparked widespread outrage because many of the people owed money are amateur traders who lost their personal savings, rather than corporations with the ability to weather a financial crisis. Every dollar in fees is deducted from the pool of funds that will be returned to creditors at the end of the bankruptcies. The fees are “exorbitant and ridiculous,” said Daniel Frishberg, a 19-year-old investor who lost about $3,000 when the crypto company Celsius Network filed for bankruptcy last year. “At every hearing, they have an army of people there, and most of them don’t need to be there. You don’t need 20 people taking notes.” To tally the overall fees, the Times analyzed more than 5,000 pages of billing statements and other court documents from the bankruptcies of the crypto firms FTX, Celsius Network, Voyager Digital, BlockFi and Genesis Global. The totals include fees that a bankruptcy judge has formally approved as well as some that are awaiting approval and could be reduced. Among the biggest winners from the five cases are two major law firms. Sullivan & Cromwell, which is managing FTX’s bankruptcy, has charged more than $110 million in legal fees and recorded more than $500,000 in expenses. Kirkland & Ellis has billed $101 million for its work on three of the crypto bankruptcies, with $2.5 million in expenses, according to the Times’ analysis. More than 50 other professionals have also profited, including specialized startups

The ballooning costs reflect the broken promises of crypto, a renegade industry that was pitched to amateur traders as a force for equality in the ultra-stratified world of high finance. After months of rising prices and social media hype, the crypto market last year spiraled into a crisis that cost investors billions in savings and allowed lawyers, bankers and other traditional power brokers to reap immense profits. As the industry has struggled to rebound, the bankruptcy fees have come under intense scrutiny from the hyper-online community of crypto obsessives, who have spent hundreds of hours analyzing billing statements that the companies are required to file publicly in court. In FTX’s bankruptcy, creditors have raised concerns about the hourly rates charged by Sullivan & Cromwell, which reach as high as $595 for paralegals and $2,165 for partners. Last fall, creditors of Voyager filed a motion complaining that lawyers overseeing the bankruptcy were expensing thousands of

dollars per person for hotel stays and billing $10,000 a month for catering. Lawyers and other bankruptcy professionals argue that they are charging market rates for difficult work that will ultimately help recover the money that crypto investors lost. In the FTX case, Sullivan & Cromwell has said it has scraped together more than $7 billion in assets, though it’s unclear how much of that total will go back to creditors. A Kirkland & Ellis spokesperson declined to comment. Over the past few decades, corporate bankruptcy has become a big business. John J. Ray III, the executive whom Sullivan & Cromwell tapped to run FTX after its collapse, has made a career of managing distressed companies like Enron and Fruit of the Loom. He has billed $2.8 million for his work on the FTX bankruptcy, court records show. Bankruptcy cases were not always so expensive. The average hourly rate for bankruptcy lawyers at Sullivan & Cromwell rose to $2,000 this year from $1,300 in 2018, according to Reorg, a credit and bankruptcy data provider. And research by the legal experts Lynn LoPucki and Joseph Doherty shows that

professional fees in bankruptcies grew about 10% a year between 1998 and 2007. When the crypto market tumbled last year, Celsius and Voyager, which had styled themselves as experimental crypto banks, were the first to go under, costing investors more than $6 billion. FTX failed in November, erasing as much as $9 billion in user funds. That was followed by the demise of BlockFi and Genesis, which had also overseen billions of dollars. Lawyers, accountants and consultants sprang into action. Kirkland & Ellis is managing the Celsius, Genesis and Voyager bankruptcies, while Alvarez & Marsal, a turnaround management firm, has charged more than $125 million for its work on FTX, Celsius and Genesis. Alvarez & Marsal didn’t respond to requests for comment. The fees drawing the most scrutiny have come in the bankruptcy of FTX, the largest and highest-profile of the crypto firms that failed. FTX’s case has cost more than $325 million, in the most expensive of the five bankruptcies, ahead of the roughly $200 million in fees that Celsius has generated. In several of the cases, bankruptcy judges have appointed fee examiners — outside lawyers who monitor costs and work with the firms to eliminate unnecessary spending. In June, Katherine Stadler, the FTX fee examiner, wrote that the bankruptcy was “on track to be very expensive by any measure.” She noted that the spending up to that point amounted to 10% of FTX’s remaining cash. Ultimately, Stadler called for only modest reductions in spending. Fee examiners in the Celsius and Voyager cases have made similar recommendations. Creditors have called for more aggressive cuts. In January, a group of Voyager customers filed a motion complaining about the tens of thousands of dollars in meal and hotel expenses filed by lawyers at Kirkland & Ellis. They argued that the lawyers were also duplicating one another’s efforts, repeatedly charging for the same work. In response, Kirkland & Ellis agreed to cap nightly hotel expenses at $550 and limit catering costs to $20 per person. In the Celsius bankruptcy, Frishberg has filed a series of motions contesting various issues, including fees. By Frishberg’s own calculations, Kirkland & Ellis billed nearly $50,000 responding to his filings in September and October — about 16 times the amount that he lost in the first place.

Analysis-US Healthcare Stocks Roiled by Investor Tug of War Over Economy U .S. stock fund flows into and out of the healthcare sector have swung wildly from week to week lately, as investors have adjusted their bets over how long the economy will stay strong. Many view healthcare as a defensive sector because it has constant demand and is somewhat insulated from the economy. Down nearly 2% for the year to date, healthcare has badly lagged the gain of over 17% in the S&P 500 index as U.S. economic growth has heated up to what the Atlanta Federal Reserve estimates is a booming 5.9% expansion in the third quarter. In the latest week, investors pulled a net $1.4 billion from the sector, the biggest weekly outflow since May 2022. That was only a little more than the net inflow of $1.3 billion to healthcare stocks in the week of Aug. 14, the second-largest weekly gain since 2008, according to BofA Global Research. Overall, the healthcare sector - which ranges from health insurers like UnitedHealth to pharmaceutical companies like Pfizer to small biotechs - has received the third largest inflows of any sector year to date, BofA’s data showed. Still, the sector [.SPXHC] is down around 2% year-to-date, one of few areas that have not joined the broad market rally, adding to its appeal among bargain hunters. “If you continue to see money flowing into healthcare then investors are using their feet to march to a more conservative posture given the uncertain outlook for where the economy goes from here,” said Bob Kalman, senior portfolio manager at Miramar Capital. While U.S. growth has largely been robust this year, some investors who are bullish healthcare stocks believe that the Federal Reserve’s interest rate hikes will eventually start to weigh on the economy. Healthcare “offers some defense in a period where the lagged impact of Fed tightening is likely to cause economic growth to contract,” said Emily Roland, co-chief investment strategist at John Hancock Investment Management, who is bullish on the sector. One potential sign of economic weakness came last Tuesday, when U.S. data showed job openings dropped to the lowest level in nearly 2-1/2 years in July as the labor market gradually slowed. Less pessimistic investors noted that the economy has been resilient thus far and shows few signs of cracking. This would weaken the case for loading up on healthcare stocks. The Atlanta Federal Reserve’s GDPNow forecast model showed the economy was likely growing at a 5.6% annualized rate in the third quarter, though analysts said they expect the estimate to drop as more data comes in. Dan Lyons, a portfolio manager at Janus Henderson Investors, said the Fed’s rate increases will begin to weigh on the economy this fall, making earnings growth estimates for the broad market appear too rosy. He has been buying biotech stocks, expecting them to hold up while

other areas of the market wobble. “The sector is set up to do well in any environment but when you’ve got slowing growth investors tend to look for companies that can provide innovation,” said Lyons. Others have been more hesitant, even if they already hold some healthcare names in their portfolios. Kalman, at Miramar Capital, believes it is early to add to his healthcare allocation, citing possible political and regulatory risks for the sector.

Last week, President Joe Biden’s administration released its list of 10 prescription medicines subject to the first-ever price negotiations by the U.S. Medicare health program as part of the Infastructure Reduction Act. Big-selling blood thinner Eliquis from Bristol Myers Squibb and Pfizer are among them, but analysts said factors such as upcoming patent expiration may dull the impact to earnings. Overall, healthcare sector earnings are expected to lag this year as COVID-related revenues decline 13% versus a 1.8% rise for the overall S&P 500. For 2024, earnings in the sector are expected to rise 12.8%, slightly better than the 11.8% increase seen for the S&P 500, thanks in part to increased demand for products such as obesity drugs, according to LSEG data.

E

very day, Vélina Élysée Charlier drives past barricaded neighborhoods and frequently sees dead bodies lying on the street, she said, a result of score-settling between gangs and vigilantes in Haiti’s capital. After dusk, she never leaves home for fear of being killed or kidnapped. When her 8-year-old daughter got appendicitis one evening, Ms. Charlier said, the family waited until morning to get her medical care since driving to a hospital was out of the question. “Port-au-Prince looks like something out of hell these days,” said Ms. Charlier, 42, a prominent anticorruption activist in the city and mother of four who lives in a hillside area of the capital. As gangs were seizing control of one part of Haiti’s capital after another, the country’s fragile government issued a plea nearly 12 months ago for foreign troops to step in and assert order in the crisis-racked Caribbean nation. After that desperate appeal, a force led by Kenya finally seems close to materializing in what would be the first time an African country leads such a mission in one of the Americas’ most unstable places. But as Haiti’s security conditions spiral further out of control, manifested by a rise in killings around Port-au-Prince as heavily armed gangs try to quell a citizen-led vigilante movement, many in the country disparage the plan as too meager and too late. The criticism underscores deep-seated anxieties in Haiti over foreign interventions, as well as mistrust of Kenyan security forces over their record of human rights abuses and graft. Ms. Charlier voiced doubt that the Kenyan-led force would be large enough to make headway against the gangs, which are thought to control roughly 80 percent of the capital. The plan calls for the deployment of 1,000 Kenyan police officers and several hundred officers or soldiers from Caribbean countries. “Fighting the gangs will require going into shantytowns, hillsides, terrain that you need to know very well,” said Ms. Charlier. She said that money going to an outside force would be better spent on strengthening Haiti’s own depleted police forces. Before the Kenyan force even secures the approval it needs from the United Nations Security Council for the mission, the scale of Haiti’s crisis is raising doubts about what the Kenyans can accomplish. The plan for a force of fewer than 1,500 compares to a 1994 intervention force led

So far, the United States and Brazil, the two largest countries in the Americas, are reluctant to intervene with their own forces. That wariness reflects doubts over large deployments two years after the U.S. withdrawal from Afghanistan and the fatigue that many governments in the hemisphere have about the nearly perpetual crises in Haiti, especially after the assassination of President Jovenel Moïse in 2021 created a power vacuum in the already volatile nation. Scenes of anarchic violence have many in Port-au-Prince on tenterhooks. In late August, gang members opened fire on protesters organized by an evangelical church leader, killing at least seven; earlier in the month, gang members burned alive seven people from the same family, apparently in retaliation for a relative’s support of a citizens selfdefense movement. Amid the latest outbursts of gang violence, the United States repeatedly urged its citizens over the summer to leave Haiti as soon as possible. From April to June, at least 238 suspected gang members, including some seized from police custody, were killed in lynchings, according to the United Nations. Some were stoned, mutilated or burned alive. The vigilante movement, largely comprising ordinary Haitians in Port-au-Prince, coalesced earlier this year. Its members often carry machetes instead of guns, and are known for brutally meting out retribution on the streets. While the outbreak of mob justice caused abductions and killings by the gangs

to decline temporarily, the resurgence in recent weeks has led to a new phase of unrest. Nearly 200,000 people are displaced across the country, according to the International Organization for Migration; the highest concentration of these internal refugees is in Port-au-Prince, where thousands are languishing in shelters. Esther Pierre, 33, was selling food on the streets of her neighborhood, Savane Pistache, before she fled her home in mid-August. Since then, she and her two children have been living in a camp for displaced people in a Port-au-Prince gymnasium. Ms. Pierre said her family left with the clothes on its back. The Biden administration supports the Kenyan plan. Discussions about Kenya’s offer to deploy a multinational police force in Haiti began about two years ago but began solidifying only this year, Kenya’s foreign minister, Alfred N. Mutua, said. Both the United States and the Bahamas asked the East African nation this year if it would consider leading a force to help restore order. Haiti’s prime minister, Ariel Henry, also reiterated a similar request to Kenya’s president when the two met on the sidelines of the climate finance summit in Paris in June. Kenya was also motivated to step in order to inspire Pan-African unity and show solidarity with the people of Haiti, where enslaved people ousted the French in a revolution, said Mr. Mutua. While specific operational details were yet to be finalized, he said he expected the Kenyan police to train their Haitian counterparts, patrol with them and protect “key installations.” He said he hoped the Kenyan officers would deploy to Haiti by the end of

the year. Kenya’s security forces have long participated in troop deployments abroad, serving in countries like Lebanon, Sierra Leone and South Sudan. Kenya has 445 personnel currently serving with United Nations peacekeeping missions, according to U.N. data. Kenyan troops also serve as part of the African Union peacekeeping mission in Somalia and under a new regional force deployed in the volatile eastern region of the Democratic Republic of Congo. But domestically and internationally, Kenyan security forces have come under scrutiny for their actions. In Somalia, the Kenyan military, a key ally of the United States in the fight against Islamist extremism, has been accused of facilitating and profiting from illicit exports of charcoal and sugar. Kenyan law enforcement officers have also been condemned by rights groups, which have accused them of excessive force, carrying out extrajudicial killings and conducting arbitrary arrests. This was in stark display during the pandemic, when their police were accused of killing dozens of people while enforcing lockdowns. The Kenyan police also killed at least 30 people during antigovernment protests this year, according to Amnesty International. Given that record, activists and human rights groups in Kenya and beyond have criticized the decision to deploy the Kenyan police to Haiti. Many have voiced their concerns to the U.N. Security Council and the U.S. and other governments, and have urged them to drop their support for the deployment. Mr. Mutua, Kenya’s foreign minister, dismissed those concerns as “hot air” and said he was confident that the Kenyan force would help bring stability to Haiti. U.S. officials say they are focused on not repeating mistakes made in previous stabilization missions in Haiti. The Biden administration does not want the multinational force to engage in constant firefights with gangs but rather to ensure humanitarian aid can safely be sent to the nation, said two U.S. officials who were familiar with the matter but were not authorized to speak publicly. Still, many Haitians echo the concerns of Kenyan rights groups, highlighting recent interventions as evidence of how they harm the country. Trust in the United Nations plummeted in Haiti after investigations showed that poor sanitation by U.N. peacekeepers after Haiti’s 2010 earthquake had caused one of the deadliest cholera outbreaks of modern times, killing at least 10,000 people.

Erdogan had a warm meeting with President Joe Biden. Turkey allowed a group of celebrated Ukrainian commanders, being held in the country as part of a prisoner exchange deal, to return to the battlefield, angering Russia. And Erdogan dropped his resistance to allowing Sweden to join NATO, strengthening the military alliance’s efforts to isolate Russia. But there was no signal of a major change in Erdogan’s balancing act between Russia and the West earlier this week, when he and Putin stood side by side in the Russian resort city of Sochi and spoke of further expanding their countries’ partnership. They would increase trade and work together on energy issues, they said, despite efforts by Erdogan’s NATO allies to cripple Russia’s economy and limit its access to global energy markets. They also discussed a more pressing geopolitical topic — the resumption of an agreement to allow the export of Ukrainian grain through the Black Sea — although they announced no concrete progress. The leaders’ joint appearance made clear that their relationship endures and will likely continue to develop, largely because both sides have more to gain from the partnership than they stand to lose, analysts said. As Russia finds itself ostracized from the West, Turkey has served as a vital channel, declining to join Western sanctions and continuing to ship much needed goods to Russia. For Turkey, struggling with an economic crisis, Russia has proved a fertile market for Turkish exports and has bolstered the Turkish government’s finances with delayed gas payments and deposits in Turkey’s central bank. “As far as Erdogan is concerned, he is, in my opinion, living in the best of both worlds,” said Ahmet Kasim Han, a professor of international relations at Beykoz University in Istanbul.

Can shrinking be good for Japan? A Marxist bestseller makes the case. By BEN DOOLEY and HISAKO UENO

W

hen Kohei Saito decided to write about “degrowth communism,” his editor was understandably skeptical. Communism is unpopular in Japan. Economic growth is gospel. So a book arguing that Japan should view its current condition of population decline and economic stagnation not as a crisis but as an opportunity for Marxist reinvention, sounded like a tough sell. But sell it has. Since its release in 2020, Saito’s book “Capital in the Anthropocene” has sold more than 500,000 copies, exceeding his wildest imaginings. Saito, a philosophy professor at the University of Tokyo, appears regularly in Japanese media to discuss his ideas. His book has been translated into several languages, with an English edition to be issued early next year. Saito has tapped into what he describes as a growing disillusionment in Japan with capitalism’s ability to solve the problems people see around them, whether caring for the country’s growing older population, stemming rising inequality or mitigating climate change. Japan, the world’s third-largest economy, has worked for years to promote economic growth in the shadow of an aging, shrinking population, with a monetary and fiscal policy that is among the most aggressive of any nation. But there are strong indications that the country’s growth-oriented policies of ultracheap money and big government spending are reaching their limits. The interventions have done little to stimulate growth in Japan’s economy. And as government efforts to lift the birthrate also falter, with fewer people doing less work, “the room for growth is running out,” Saito, 36, said during a recent interview at his Tokyo home. That’s seemingly true even when Japan’s economy expands. When the country reported growth of 6% in the second quarter of this year, it was driven almost entirely by external factors: exports and inbound tourism. Domestic consumption, on the other hand, shrank. The focus on growth was important when Japan was developing. But now that the country is wealthy, Saito said, the insistence on an endlessly expanding eco-

Some areas of the economy, such as health care, will need to continue growing, but “there are too many cars, too many skyscrapers, too many convenience stores, too much fast fashion,” he said. The focus on consumption, he argues, has had devastating consequences for the environment, driven widening inequality and wasted limited resources that could be put to better use. Reorienting Japan toward goals that more effectively reflect the country’s current needs, he says, would mean using metrics other than GDP to gauge the country’s economic well-being. The focus would shift from quantity to quality, on measures like health, education and standard of living. Saito first encountered Marx in 2005, when he was an undergraduate at the University of Tokyo. In high school, Saito was “more right wing,” he said, convinced that individual failings were the root cause of Japan’s problems. When he encountered the German philosopher’s arguments that structural causes led to inequality and war, it was “shocking,” he said. “After the economic crisis of 2008, there was a Marx renaissance in Japan, and

I was convinced of the importance of his theory,” Saito said. He has spent the years since studying Marx’s twilight years, when, Saito argues, the philosopher realized that capitalism, with its insatiable demand for growth, would inevitably lead to environmental disaster. Saito conceived “Capital in the Anthropocene” — a reference to an era in which human activity has a profound impact on the Earth’s environment — early in the COVID pandemic. Socialism was a hot topic in Europe and the United States, where politicians like Sen. Bernie Sanders, I-Vt., urged Americans to grapple with the drawbacks of U.S.-style capitalism. The aftermath of the 2008 financial crisis, rising inequality and the unavoidable realities of climate change were driving many young people to question the sustainability and fairness of existing economic systems. People in Japan, too, felt dissatisfied with the status quo, Saito said. But unlike people in other parts of the world, “they aren’t thinking, ‘Capitalism is bad,’ they’re thinking, ‘I’m bad.’ They aren’t thinking that capitalism needs to change, they’re thinking, ‘I need to change.’ ” He recognized the thinking as similar to his own in high school, when he believed that people merely needed to work harder

or be more productive. Saito’s critics have called him out for castigating the capitalist system he has benefited from while providing little more than unworkable idealism and failed ideology as an alternative. His book has ignited a publishing boomlet on Marxism in Japan, with some works attacking his ideas and others supporting them. The renewed discussion hasn’t done much to revive the prospects of Japan’s Communist Party, however. Saito is not a fan of the group, which he sees as wellmeaning but stale. He also does not have much patience for other more familiar strains of communism, such as that practiced by the Soviet Union and the Chinese Communist Party, with their emphasis on state power over industry and centralized planning. He recognizes that growth remains crucial for improving quality of life in less developed countries. And even in rich nations, he does not call for people to give up their creature comforts. He recently moved into a three-story home in an upscale neighborhood on the outskirts of Tokyo and drives a compact Toyota. One of the few things he has given up, he said, is fast food. Achieving degrowth communism, he believes, is less about personal choices and more about changing overarching political and economic structures. Marxism, he argues, offers a viable model for reorienting society around the maximization of public goods as opposed to the endless pursuit and concentration of wealth. That would require, among other things, moving away from GDP as the key measure of a country’s health. As an alternative, he suggests the “human development index,” an idea proposed by Pakistani economist Mahbub ul Haq, which the United Nations has used as an alternative indicator of a country’s progress. The index — which measures life expectancy, education and quality of life — gives a more comprehensive view of how the economy affects people’s lives than GDP. Saito is not clear exactly what shape a world under degrowth communism would take, but he insists that it would be democratic and focused on expanding communal resources, reducing the wealth gap and removing incentives for excess consumption.

Kia and Hyundai helped enable a crime wave. They should pay for it. By FARHAD MANJOO

I

n a recent analysis of data from 37 American cities, the Council on Criminal Justice, a nonpartisan think tank, suggested a hopeful trend — the pandemic-era spike in crime may have peaked. The homicide rate has dropped significantly over the last year, based on data from 30 American cities. In many places, just about all types of violent crimes are down, in some areas substantially — in Atlanta, for instance, there have been 21% fewer aggravated assaults, 28% fewer homicides and 56% fewer rapes than at this point in 2022, according to police department data. But there’s a glaring exception: auto thefts. According to the Council on Criminal Justice, “The number of vehicle thefts during the first half of 2023 was 33.5% higher, on average, than during the same period in 2022 — representing 23,974 more vehicle thefts in the cities that reported data.” In Philadelphia; Washington, D.C.; Chicago; New Orleans; Buffalo, New York; and Durham, North Carolina, motor vehicle thefts this year have more than doubled relative to last year, according to stats collected by Jeff Asher, a crime data analyst. This week, The Baltimore Sun reported that “auto thefts are on pace to more than double the total from last year, as reports through the first eight months of 2023 are already up 88% compared to all of 2022.” Why are so many cars getting stolen? Police departments and city officials point to this: Millions of Kias and Hyundais are ridiculously easy to steal.

For years now, most automakers have equipped most of the cars they sell in the United States with electronic immobilizers, devices that prevent cars from starting unless they detect a radio ID code associated with the car’s rightful key. But Hyundai and Kia, which come under the same South Korean conglomerate, did not install this basic device in somewhere around 9 million cars sold between 2011 and 2022. A couple of years ago, videos showing how to hotwire the vulnerable cars began to pop up online. I won’t go into details but I will say that it doesn’t require much more than a USB plug. The resulting crime wave has clobbered American cities. “We’re hitting close to 6,000 cars that have been stolen this year alone,” Adrian Diaz, Seattle’s police chief, told me. More than a third of the cars stolen in Seattle in August were Hyundais and Kias, he said. “That’s a massive cost, not only for the victim of having a vehicle stolen,” but also in resources involved in “trying to investigate these crimes,” Diaz said. And then there are the follow-on incidents. Stolen Kias and Hyundais have been involved in numerous deadly crashes, armed robbery sprees and other crimes around the country. “We’re recovering guns out of a lot of Kias that are stolen,” Diaz said. Seattle is one of several cities that are suing Kia and Hyundai, and they make a compelling case. The carmakers should have known they were creating unsafe products. The costs of their decision have had far-reaching effects on public safety and city resources, and there’s no telling when the thefts might abate. Kia and Hyundai, not the public, should bear the cost of their irresponsible decision to sell cars without immobilizers. The carmakers say they’re doing all they can to stem the thefts. They’ve created a software update that they say fixes the issue; it requires a visit to a dealer and takes up to 45 minutes to install. They’ve also given police departments antitheft steering wheel locks to hand out to affected owners, they say. So far, about 21% of affected cars — about 660,000 Kias and 811,000 Hyundais — have had the software upgrade installed, the carmakers said. (After you get the upgrade, the carmakers will give you a window sticker to alert thieves that they’re wasting their time with your ride — a good idea, I guess, though it does place a lot of faith in the integrity of would-be criminals.) The companies have also settled a $200 million lawsuit with owners of the vulnerable cars (though a federal judge recently rejected the settlement, ruling that it may not offer enough compensation for some drivers). A Kia spokesperson told me that the cities’ lawsuits are “without merit,” arguing that federal auto safety regulators do not require automakers to install immobilizers in their vehicles. (A lawsuit filed by several insurance companies disputes this point.) It may also be difficult for cities to prove that the rise in thefts is primarily Kia and Hyundai’s fault. Richard Rosenfeld, a criminologist who is one of the authors of the Council on Criminal Justice’s analysis, told me that motor vehicle theft is an under-researched phenomenon. Many police departments

do not “code” the make and model of stolen cars, so it’s difficult to make long-term comparisons. “I cannot tell you what fraction of all motor vehicles that are stolen are Kias and Hyundais,” he said. But stats released by some of the worst affected cities strongly suggest that thefts of Kias and Hyundais are a major part of the recent spike. In the first half of 2022, according to the Chicago mayor’s office, there were about 500 stolen Kias and Hyundais in Chicago. In the second half of 2022, the number of stolen Kias and Hyundais shot up to 8,350; this year, more than half of the cars stolen in Chicago were from these two brands. In August, Cleveland.com reported that Kias and Hyundais made up 57% of cars stolen this year, compared with 11% during the same period last year. In May, the Baltimore mayor’s office announced the city’s suit against the carmakers, reporting that Kias and Hyundais accounted for 41% of the cars stolen up to that point this year. (Hyundai and Kia accounted for just over 10% of the cars sold in America in the first quarter of this year, according to the research firm Cox Automotive.) There’s a chance that Kia and Hyundai will escape some of the blame for these thefts because there’s a juicier target for politicians to go after: social media platforms, where the howto videos have circulated. Media accounts of the thefts often highlight TikTok’s role; one Insider story was headlined “Grand Theft TikTok.” In March, Eric Adams, the mayor of New York, held a news conference to discuss the city’s response to the rise in stolen cars. After pointing out the steps Hyundai and Kia have taken to prevent the thefts, he went after tech companies. “We don’t need social media to contribute to social disorder,” he said. The same month, Rep. Joe Morelle, D-N.Y., told reporters, “We don’t need companies like TikTok playing an active role in facilitating these crimes and putting information on how-to videos for people who would misuse them.” This strikes me as bizarre blame shifting. It’s Kia and Hyundai, not TikTok, that sold theft-prone cars. I’m not against tech companies moderating their platforms to curb the spread of potentially dangerous information. But you know what would be better? Making cars that can’t be stolen with a USB cable.

El director de Rumbayé, Freddy Benítez, indicó que la gira se iniciará el viernes 3 de noviembre en San Germán y terminará el 28 de noviembre en Caguas. “Celebremos la Puertorriqueñidad” se presentará en cinco funciones escolares que tienen el endoso del DE. El espectáculo, compuesto por más de 20 músicos, bailarines, actrices y actores profesionales; es un homenaje a la cultura puertorriqueña a través del baile y la música autóctona. “Ver Rumbayé es traer el salón de clases al teatro, los estudiantes de cualquier nivel pueden aprender de nuestra cultura a través del baile y la música. Por esta razón, el DE, endosó esta presentación, para reforzar las materias de Español, Estudios Sociales y Bellas Artes. ou may not think there’s a need for two big Elvis Presley movies in back-to-back years, but it’s hard to imagine a pair of filmmakers with sensibilities as different as Baz Luhrmann, who directed “Elvis” (2022), and Sofia Coppola, who came to the Venice Film Festival on Monday to debut “Priscilla,” about the rocky marriage between Priscilla Presley and her famous beau. Luhrmann is a maximalist, a master of shock-and-awe spectacle in which every new frame is a confetti-crammed party. Coppola is more interested in the intimate: Her settings may be as luxurious as Luhrmann’s, but the young women she finds living in these gilded cages are a party of one, desperate for real connection. That’s a feeling Coppola has explored in movies such as “Lost in Translation” (2003) and “Marie Antoinette” (2006), and “Priscilla” finds the filmmaker at the peak of her preoccupations. “I don’t know why I keep coming back to it,” Coppola joked at a news conference Monday after she was asked about her frequent depictions of girlhood. “Hopefully, I’ll grow up soon.” Adapted from the memoir “Elvis and Me,” Coppola’s film gets underway when Elvis, sent to Germany during his military service, meets Priscilla, the daughter of a military officer newly stationed there. She’s isolated and homesick, yearning for the life she left behind in the United States. Despite being a superstar, a besotted Elvis finds he can relate. Priscilla is also 14, a fact the film doesn’t shy away from. “Ninth grade? You’re just a baby,” the 24-year-old Elvis murmurs when they meet at a party, though that age difference hardly slows his pursuit: At times, he even seems to regard Priscilla’s virginity as her primary trait. “Promise me you’ll stay the way you are,” he says as he proceeds to turn the poor girl’s life upside down, eventually whisking her from Germany to Graceland, plying her with uppers and sleeping pills, and insisting that she keep their yearslong relationship secret even as he’s publicly photographed in romantic clinches with the likes of Nancy Sinatra and Ann-Margret. As in “Marie Antoinette,” when our young protagonist is dropped in the lap of luxury and finds it awfully lonely, Priscilla

The star she found so alluring is often cruel and manipulative, telling her what to wear and how to act, and reminding her every time she balks that millions of women would eagerly take her place. To assert herself, Priscilla has to get creative: Since Elvis wants her to dress only in solid colors, every time he does something upsetting, she retaliates by wearing a vivid print. Priscilla is sensitively played in the film by Cailee Spaeny, an up-and-coming actress, while “Euphoria” star Jacob Elordi has the even trickier task of playing Elvis a year after Austin Butler’s uncanny re-creation made him an A-lister. Elordi acquits himself just fine, and it helps that Coppola isn’t interested in staging splashy musical numbers: During the few glimpses we do get of Elordi’s Elvis midsong, he’s always filmed from the back. That aesthetic choice smartly steers “Priscilla” away from Luhrmann’s movie (which was much more interested in Elvis the performer) and further grounds the film in Priscilla’s perspective. If he’s heading onstage, all it really means is that he’s leaving her behind. Luhrmann’s hagiography was estate-approved and portrayed the singer as the innocent pawn of his craven manager, Col. Tom Parker. “Priscilla” shows how manipulative Elvis himself could be. This is no puff piece: It’s a warts-and-all portrayal of a charismatic man who pulled a young girl into his orbit and then wouldn’t let her out.

Although Presley attended the Venice news conference in support of the film, she didn’t sit on the dais with Coppola and her cast, instead watching from the front row of the audience. But when a journalist asked what moved her most about “Priscilla,” Presley herself took the mic. “It’s very difficult to sit and watch a film about you and about your life and about your love,” she said. “Sofia did an amazing job. She did her homework.” The moment that moved her most was the ending, Presley said. It’s the moment just after their marriage crumbles, when Priscilla finally summons the strength to stand on her own two feet. “Yes, I left, and it wasn’t because I didn’t love him,” Presley said. “He was the love of my life. It was the lifestyle that was so difficult for me, and I think any woman can relate to that.”

Patou’s Spring Summer 2024 Collection. And how could they not? This is a courageous brand that has been delivering fashion for over a century, through thick and thin, through war and peace. A label that has been helmed by fashion institutions the likes of Karl Lagerfeld, Jean Paul Gaultier and Christian Lacroix doesn’t shy away from a little commotion. After all, is this not what fashion is all about? To keep people up when things are down? Didn’t we all appreciate the efforts some designers went through to keep us smiling through the pandemic? There. Since 2018 Patou has been in the hands of creative director Guillaume Henry. He has maintained the elegant and chic style of Jean Patou, who founded the label in 1914. Patou was known as “the most elegant man in Europe.” His philosophy was “Elegance, beauty, fine arts and fantasy, in these four words you’ll find my collections.” On Sunday we saw the pioneer’s philosophy, in fast forward. Modern. Festive. We saw Henry’s take on fantasy and beauty, “the extraordinary in the ordinary.” “Dancing Diaries,” the collection, is a nod to the 1920s, but also to party girls everywhere. The 1980s? Perhaps. He designed playful mini dresses in pink, orange, black, turquoise and seafoam. Very short, very tight and very feminine. We loved his bralettes and tailored slacks, short skirts and blowsy crop tops. Also winning? Big breezy cotton blouses with butterfly sleeves. Orange mini jackets and boleros, turquoise body-hugging dresses, and baby doll dresses in shimmering white. Attention to details: sparkle everywhere. In straps, borders and hems, everything is trimmed with recycled crystals. “Dancing Diaries” was staged at Salle Wagram, a historic auditorium 200 yards down the hill from the emblematic Champs-Élysées.

How I turned my errands into exercise By ANDREW LEONARD

I

was physically destroyed the first time I rode my bike home from Costco lugging a trailer full of groceries. The 11-mile round trip left me with dead legs, a sore back and the sneaking suspicion I had made a mistake. A month earlier, my 23-year-old minivan broke down for the last time. Rather than replace it, I decided a new “car-free” reality would encourage a healthier lifestyle. My aching muscles questioned the viability of this plan. Three years later, I now know that giving up my car was the first step toward solving a lifelong struggle: maintaining consistent physical activity. What started as a necessity — I had no car, so I must bike — became a strategy: Errands are an opportunity for exercise. This reframing turned out to be a motivational bonanza. I began seeking out new errands just for the exercise they would provide. A need for new socks became an opportunity to walk to Target. Running low on Sichuan peppercorns spurred me to cycle the 9-mile round trip to the Chinese supermarket. This year, I learned that the public library stocked a book about an ancient tomb I was researching, and my first thought was: Excellent, that’s a 4,000-step round trip! Rain or shine, I became an errand-running machine. My mood improved, my grocery runs got easier, and I had to buy a new belt for my shrinking waistline. For most of my adult life, I’d been trying, and failing, to consistently exercise. Only now, as I hit my 60th birthday, did I feel I’d cracked the code. Experts who study exercise psychology say it was no accident my new errands-based regimen had lasting results. Better yet, what worked for me can work for others. Find the right motivation. I am no stranger to motivational gimmicks. After my marriage broke up in the early 2000s, I told myself losing weight would make me more attractive. Mindful of my doctor’s advice about cholesterol, I told myself I was only allowed French fries with dinner if I biked over the nearest hill. But nothing stuck. Michelle Fortier, a physical activity psychologist at the University of Ottawa in Ontario, said that outside motivations, like doctors’ warnings and weight insecurities, do not result in lasting behavior change. “That can get people started,” Fortier said, “but it will

It doesn’t lead to positive consequences or positive emotions.” Intrinsically generated motivation, which is driven by a sense of accomplishment or satisfaction, is much more powerful, she said. “You do it because it’s enjoyable,” she said, “And the research shows that type of motivation is good” for exercise maintenance. My own behavior change, Fortier said, was probably the result of combining two intrinsically generated motivations that had nothing to do with body-image fears or outside pressures: I love to ride my bike, and I love the satisfaction of getting things done. Make a mental shift. But that doesn’t mean my carless strategy will work for everyone. People bike more in cities with biking infrastructure and walk more in walkable communities. I’m lucky: I live in the San Francisco Bay Area, which has an extensive network of bike paths, including a gorgeous trail that curves along the water that I take to get groceries. But what happens if you live in a rural community 30 miles from the nearest shopping center? Or if your office no longer allows you to work from home, where you can slip out midday for a walk? The trick can be as simple as just changing how we think about the act of exercise, said Benjamin Gardner, a researcher in the psychology of habitual behavior at the University of Surrey, in Britain.

Too much focus on the word “exercise,” Gardner said, “brings to mind going to the gym, lifting weights, running on treadmills and so on.” Recognizing that day-to-day tasks often involve movement is an opportunity to “build physical activity habits into our everyday lives,” he added. You could decide to walk a mile to get a sandwich for lunch instead of grabbing one from the deli around the corner. If you live in a rural area and can’t bike to get groceries, try spending 20 minutes a day weeding or reorganizing the garage. Anything you’ve been putting off, like digging up an old stump or hauling yard waste, becomes a more inviting prospect when you think of it as a workout. But maybe don’t start with Costco. “The most important thing,” Fortier said, “is that people find ways to make their bout of exercise — be it walking the dog or biking to Costco — the most enjoyable possible.” In her work with clinically depressed women who are inactive, Fortier tells her patients to start out by picking a nice day to go for a walk, and then setting a timer for 10 minutes. If they’re feeling good when the timer goes off, maybe walk a little more. If not, call it a day. Listening to Fortier, I realized that by beginning my new exercise regimen with a grueling grocery run, I ran the risk of squelching my enthusiasm before I’d barely started. Best to pay attention to the pleasure principle, begin with easier challenges and work oneself into shape. So run your first exercise errand on a sunny afternoon: Take a stroll to the nearest post office to mail a package. Ramp up for a few months, and your to-do list will start to fill up with more strenuous tasks. You may even find yourself buying a used bike trailer on Craigslist and scoffing at an incoming rain squall, and loving every minute of it.

A young player’s future looks bright until he runs into Carlos Alcaraz By MATTHEW FUTTERMAN

M

atteo Arnaldi, an unheralded Italian player, was having a lovely time in New York, knocking off one opponent after another on his way to the fourth round at the U.S. Open. One, Arthur Fils of France, is expected to become one of the top players of the next decade. Another, Cameron Norrie, the 16th seed, has been among the better players of the past two years. Those wins earned him a date Monday with Carlos Alcaraz, the defending champion and world No. 1, in Arthur Ashe Stadium. “A good challenge,” Arnaldi, 22, who grew up in the shadow of other Italians his age, such as Jannik Sinner and Lorenzo Musetti, said before the match. His coach, Alessandro Petrone, thought so, too. “I think tomorrow will be not so easy,” Petrone said Sunday afternoon as he tried to come up with a game plan for taking on Alcaraz. Both were right. It took Alcaraz 1 hour, 57 minutes to take apart Arnaldi 6-3, 6-3, 6-4. He has dropped just one set in four matches. None of this is particularly surprising. Alcaraz has won two of the past four Grand Slam events and has played in only three of them, having missed the Australian Open with a pulled hamstring.

But this is the first time he has had to defend one of the biggest titles in the sport, a challenge that some top players can struggle with. Iga Swiatek, the women’s defending champion, lost Sunday night, a defeat that will cost her the No. 1 ranking when the new rankings are released next week. Alcaraz said Monday that he had tried to put thoughts of defending a title out of his head.

“All the pressure that people put on you, on the defending champions, I just delete it and focus on my own game,” Alcaraz said. So far, so good. Alcaraz’s match Saturday against Dan Evans of Britain, long a favorite of tennis sophisticates because his style is smooth and varied, was a shotmaker’s delight. The two players put on a show, impressing themselves and others with long rallies, filled with touch

and power. There were plenty of big winners hit from behind the baseline and drop shots feathered to within inches of the net. This is the way Alcaraz likes it best. Massive video boards loom high above Arthur Ashe Stadium. Alcaraz loves to watch matches on television when he isn’t on the court, though he also likes watching when he is on the court as well. If he has played a particularly exceptional shot, one that elicits a loud and lusty roar from the crowd — and this happens a lot — as soon as the point is over, his eyes gaze skyward. “I love to see it again,” he said Monday through that broad smile. The stakes rise each day, but so far one of the secrets of Alcaraz’s success is that tennis has remained something of a hoot. His workday over by early evening, he had the luxury of watching the match that would determine his quarterfinal opponent today. Alexander Zverev of Germany ended up outlasting Sinner in five sets, 6-4, 3-6, 6-2, 4-6, 6-3. At the U.S. Open last year, Alcaraz’s fiveset quarterfinal match against Sinner ended at nearly 3 a.m. He saw no reason to think things would be any easier this year against either Sinner or Zverev. “Going to be a really tough quarterfinal,” Alcaraz said. Dodgers’ Julio Urias arrested on domestic violence felony By LIVIA ALBECK-RIPKA

L

os Angeles Dodgers pitcher Julio Urias was arrested late Sunday night and charged with a domestic violence felony after a physical altercation with his wife at a stadium in South Los Angeles, authorities said Monday. The altercation took place following a Major League Soccer match at the BMO Stadium, according to Assistant Chief Chris Carr of the Exposition Park Department of Public Safety, which manages the stadium and surrounding area. Urias, 27, was arrested just after 11 p.m. and released on $50,000 bail just before 5 a.m. Monday, according to a booking document from the Los Angeles County Sheriff’s Department. He is scheduled to appear in court Sep. 27.

Further information regarding the details of the arrest were not immediately available. On Monday, the Dodgers said they were “aware of an incident” involving the player. “While we attempt to learn all the facts, he will not be traveling with the team,” the team said in a statement provided by Jon Weisman, a spokesperson for the Dodgers. “The organization has no further comment at this time.” Neither MLB nor Urias’ agent immediately responded to requests for comment Monday afternoon. The arrest comes four years after Urias, a star Dodgers player who earns more than $14 million a year, was placed on administrative leave following a similar incident in which he was arrested by the Los Angeles Police Department on suspicion of “intimate partner battery.” Urias, then 22, was involved in an alterca-

tion with a woman in a shopping center parking lot, according to a 2019 article in The Los Angeles Times. The city prosecutor agreed not to file misdemeanor charges so long as Urias was not arrested again for violent criminal behavior that year, the newspaper reported. MLB’s domestic violence and sexual abuse policy, implemented in 2016, provides for the possibility of discipline, including suspensions, even if the legal process is not completed. The policy states that players may be placed on paid administrative leave for up to seven days while the commissioner’s office investigates accusations against them, but the leave has been extended in past cases. Urias was suspended for 20 games, or around three weeks, following the 2019 incident, Weisman said by email. He did not comment on whether Urias would be suspended as a result of Sunday’s arrest.

Coach of Spain’s women’s soccer team is fired By RACHEL CHAUNDLER

T

he coach of the Spanish national soccer team that won the Women’s World Cup trophy last month was ousted Tuesday by the country’s soccer federation, after months of complaints from players who accused him of outdated methods and controlling behavior. The firing of the coach, Jorge Vilda, comes as the fate of one of his most ardent supporters, Spain’s soccer federation chief, Luis Rubiales, hangs in the balance. Rubiales forcibly kissed a member of the national team at a medals ceremony in Australia, setting off a national controversy in Spain and highlighting sexism in the sport. The federation said in a statement that as one of the “first measures of renewal” announced by the interim president, Pedro Rocha, it had decided “to do without the services” of Vilda as sporting director and national women’s coach, a role which he accepted in 2015. The federation also thanked Vilda for his work with the national team and the success during his tenure, crowned by the World Cup victory. It said it was highlighting “his impeccable personal and sporting behavior,” which “was a key piece in the notable growth of Spanish women’s football.” The federation has called on Rubiales to resign, and Spanish prosecutors have opened an investigation into whether he could be charged with committing an act of sexual aggression. Players have said they would not take the field for the national team unless changes were made on a managerial level. And FIFA, soccer’s governing body, has suspended him for 90 days. Vilda, who was hired in 2015 after one of his predecessors was ousted amid accusations of sexism, had long been the subject of complaints from players regarding unequal pay and what they called his controlling behavior, as well as a general culture of sexism. Last year, 15 star Spanish players staged a protest, refusing to play on the national team unless Vilda was fired.

In an interview with the Spanish newspaper El País in October 2022, Rubiales connected the success of the women’s team to Vilda’s coaching skills and dismissed the accusations of ill treatment.

His mother went on a three-day hunger strike in a church in his hometown, Motril, in southern Spain, demanding that Hermoso “tell the truth.” Hermoso, for her part, has said that “at no time did I consent to the kiss that he gave me.” As the scandal mushroomed, the federation, known as the Royal Spanish Football Federation, called an emergency meeting. Vilda was one of the many men in the room who gave Rubiales a standing ovation. Later, however, Vilda tried to distance himself from Rubiales, saying that he regretted his boss’s “inappropriate conduct.” The Spanish men’s coach, Luis de la Fuente, also apologized for applauding. But the damage was done. The firing of Vilda comes on the same day as the Spanish government published the awarding of a Gold Medal for Sporting Merit of the Royal Order to the entire women’s team, including Vilda. But with a match against Sweden set for Sept. 22, and with none of Spain’s star players apparently willing to compete, the soccer federation cut Vilda loose.
