Nicholas deemed a ‘high or a very high risk to reoffend’ to his head, hand, back and torso. Nicholas was charged with assault causing bodily harm as a result of the incident, according to the parole board. He has not been convicted of that charge. Nicholas was arrested and charged in 1999 following break-ins at three homes where people were confronted and in two cases older women were sexually assaulted. Police had been investigating the Scarborough bedroom rapist break-ins, and after tips from the public, Nicholas’ DNA was collected and found to be a match to evidence found at the crime scenes. In one incident, a 75year-old woman awoke in the night to find Nicholas on top of her. The senior initially thought it was her husband who had health issues but quickly realized that it was a stranger. In another incident, a 68-year-old woman awoke to find Nicholas holding a pillow over her face. In the third incident, a 54-year-old woman awoke to find a man standing by her bed. Nicholas hit her

"The stark horror of awaking to find a stranger in one’s bedroom in the middle of the night can only be imagined. Many of your victims were traumatized and the victim that you struck on the head and sexually assaulted while holding a pillow over her face reportedly suffers from posttraumatic stress disorder." The 2014 parole board report also highlights "problematic" behaviour behind bars. The report alleged Nicholas had a "hockey stick swinging fight" with an offender in 2001 and

was involved in two fights with other inmates in 2003. In 2004, Nicholas was reportedly "threatening and muscling other offenders, fought with another offender on two occasions and grabbed and scratched the neck of a correctional officer." In 2005, Nicholas and another offender allegedly assaulted an inmate. Nicholas allegedly assaulted another offender in 2006. The report also said Nicholas’ "criminal history reflects a traumatic and unstable childhood" that appears to have seriously affected him. He also developed substance abuse issues, the report stated. According to the 2014 parole board report, a psychiatric assessment completed in 2009 reported "diagnoses of ADD with hyperactivity (possibly secondary to fetal alcohol syndrome), Paraphilia NOS, alcohol and sub-

stance abuse (in remission), anti-social personality disorder and learning disorder versus mental retardation." The 2016 parole board review said that Nicholas, who has a long criminal record, is at a "high or a very high risk to reoffend sexually or violently." His latest psychological assessment was completed in April 2016, according to the report. The psychologist, according to the parole board, concluded that Nicholas was an "untreated, high-risk offender" and that if he were to leave the correctional system without the "necessary recommended programming" he would present a significant risk to the community. The parole board noted Nicholas declined an offer to transfer to another maximum-security prison in May 2016 to take part in high-intensity sex offender programming. "At this time, none of your risk factors have been addressed. ... Your reintegration potential remains assessed as low," the parole board wrote in Octo-

ber 2016. "You remain assessed as a maximumsecurity inmate and even within that highly structured environment you continue to demonstrate violent behaviour." Nicholas had waived his right to a parole hearing, meaning he chose not to participate in the October 2016 decision. "By law, we still have to review his case, so that occurred in his absence," a parole board communications officer said in a phone interview. "With a dangerous offender, it’s an indeterminate sentence, which means it has no end date. We’re legally required to see them every two or five years." Nicholas’ next parole review is expected to take place October 2018. Neither the parole board nor Correctional Service Canada would disclose which institution Nicholas is at, though it’s believed to be in Alberta. The so-called Scarborough Bedroom Rapist remains behind bars and was charged last year in an alleged attack on another offender, Parole Board of Canada documents reveal. Eli Nicholas, now 38, was denied both day and full parole in the parole board’s latest decision, rendered on Oct. 24 2016. Nicholas was designated a dangerous offender in 2010 and is serving an indeterminate sentence for convictions of sexual assault and breaking and entering. The parole board’s 2016 review described Nicholas’ "institutional behavior" as disruptive, noting that on March 16, 2016 he allegedly attacked another offender from behind and began beating him. "Other offenders intervened and attempted to stop the assault prior to the correctional officers intervening," the parole board wrote. The victim was allegedly punched and kicked and required medical treatment. Several sutures were used to treat injuries

MIKE ADLER madler@insidetoronto.com The Toronto Pan Am Sports Centre opens at 5 a.m., and every day, as soon as it does, people slip into the training pool. A small but dedicated group comes to TPASC to swim lanes in the early morning. Its members dislike crowds, and aren’t happy TPASC management recently gave some of their early morning hours to swim clubs. Mike Howes, a Scarborough resident who says he swims at least six days a week, argues managers of the Morningside Avenue building "reneged on their mandate" by cutting earlymorning public lane times, and are treating lane swimmers as second class. There are reasons lane swimmers turn up so early. Five months ago, Lisa Gosden was told arthritis in her knees would require surgery, but after several

months building her endurance in the pool, she could swim for 1.5 hours, head home and get to work by 9 a.m. "It was a beautiful thing. I have lost weight, my blood pressure has dropped and I feel good about what I am doing." In October, though, Gosden was told her two hours of daily swim time at 5 a.m. was down to an hour on Monday, and was gone on Tuesdays and Wednesdays. Yes, there’s still lane swimming every day except Saturday from 7 to 9 a.m., and public swimming at other times. But Gosden said many who came at 5 a.m. can’t fit those times to their schedules. "I have noticed a severe drop off of the regular attendees," she wrote last week. "It appears that the pool use is being repurposed for private swim teams and coaching," said Glenn Ikeda, a recreational iron man

"We try to keep everybody happy," he added. "We need to let the Penny Oleksiaks of the world train here." Lane swimming changes were made two months ago but announced last year, said Singleton, maintaining, despite Howes’ and others’ suspicions, no other lane swimming changes are coming in 2018. A TPASC community advisory group meets bimonthly, and lane swimmers are invited to join, Singleton said.

Term limits are a temptation best avoided Sometimes it seems that nobody overstays their welcome so well and easily as does a long-serving city councillor. With inertia on their side in the form of long-held incumbency, they have an easy time of it come re-election time, or at least some of them do. Voters in some parts of the city don’t seem to know when to get rid of a bad, or even just mediocre councillor. Last month, Beaches-East York Coun. Mary-Margaret McMahon made it clear she’s not going to be one of those councillors. She was first elected in 2010, and in 2017, she confirmed she will follow through on what she promised then: she would serve two terms and then step aside. City politicians, she said, should not stick around more than two terms. As refreshing as it is to see a politician follow through on her promises and stick to her principles, it is hard to follow McMahon’s reasoning too far - particularly to the point that she has continually advocated: term limits for city politicians. McMahon has twice put forward motions asking council to set a two-term limit. Doing so, she argues, might promote a more diverse and representative council, and would certainly clear out the old and allow the new to gain a foothold. If that were all we cared about in a city council, then term limits would make a lot of sense. But in the context of governing a city the size and complexity of Toronto’s, there is more to consider. Which is to say that experience and deep institutional knowledge and understanding is crucial - as is a professional understanding of public service. That sort of depth can be gained after just a few years in office, perhaps. But it is squandered, if developed in a politician whose political lifespan wouldn’t even run to the end of an elementary school education. More commonly, city councillors only find their feet after their rookie term in office, and hit their stride in the third and fourth term. Why squander that? There is the matter of accountability. A two-term councillor is really only accountable to the electorate in the second election, after that rookie term. Disappointed voters in the second term have no recourse but to wait it out. And that leads us to a final point to consider. Incumbency may offer an advantage, but only insofar as voters are apathetic. If a city councillor has overstayed his or her welcome, it is up to their disappointed constituents to do something about it. Term limits do nothing but let lazy voters off the hook.

Basing car insurance on postal codes isn’t fair The Kanetix.ca map showing car insurance rates by neighbourhood is something every Torontonian should see. It looks strikingly like maps showing Toronto’s highest concentrations of poverty. Angry red the company uses to show highest rates covers North Etobicoke, the Jane Street corridor in North York, the former City of York, Scarborough along Eglinton Avenue and north of Hwy. 401. It’s white, signifying lowest rates, in places like Rosedale, Lawrence Park, and Bloor West Village. As my colleague Justin Skinner reported recently, drivers in North Scarborough pay $2,300 on average $950 more than people in the wealthy core.

The Financial Services Commission of Ontario is supposed to make sure the rates are "just and reasonable." They’re based on the vehicles, where drivers live, driving experience, and their accident and conviction history. But postal codes - just the first half of postal codes carry enormous weight, which is unfair. I benefited a while, while I lived in downtown North York. Then I moved not far very west, into a postal code for Downsview. My rate took a huge jump. Yes, there’s a plaza at Bathurst and Sheppard where you can watch people maneuver around the park-

ing lot like they were steering shopping carts at Costco. But are they so much worse than drivers south of the 401, a short walk from where I live, where rates are much lower? I had a Civic, Canada’s most popular car, so insurance companies punished me for that. They taught me buying a larger, more expensive, car will pay off if you keep it long enough. Kathleen Wynne’s Liberal government pledged years ago to cut rates by 15 per cent, and hasn’t. They’re supposedly dedicated to reducing income equality. The map tells a different story. Transit will bring jobs: Tory MIKE ADLER madler@insidetoronto.com Economic development gets people out of poverty, and economic development will come to Scarborough when Toronto builds more rapid transit there. That won’t be on any exam, but it’s what Mayor John Tory told dozens of students from University of Toronto Scarborough (UTSC) and Centennial College. At a spot called the Meeting Place at UTSC - a rapidly-growing campus of 12,000 students with a pronounced lack of student residences and, for the first time this fall, a food bank operating twice a week - Tory took questions. Several times, his answers returned to his revised transit plan for Scarborough, all "real and happening," which includes new local GO Rail stations for SmartTrack, the BloorDanforth subway extension to Scarborough Town Centre, and the Eglinton East light-rail-transit line which, though unfunded, is proposed between Kennedy Station and the UTSC campus "at least in its first phase," the mayor said. When a student suggested the LRT line, a continua-

tion of the Crosstown, might get built during the 2030s, Tory shook his head. "Much sooner," he said, promising the first public consultations on the project will start in November and maintaining, if funded, the line could be running along with the single-stop subway extension by around 2023 or 2024. "Everywhere you have built transit, development and investment have followed," said Tory, arguing his plan will remove a major reason why more employers haven’t moved to Scarborough. The mayor hinted, as he has for years, that he might move municipal workers to the area. "Why do all the jobs for the city government have to be downtown? No reason at all," he said. When a student asked when the TTC would add the suicide barriers he’s seen on subways in Seoul, South Korea and Singapore, Tory said that could cost up to $1 billion. "We’re not in position to do that." Later, Raymond Dang, the Scarborough Campus Students’ Union’s (SCSU) director of political science, said the mayor answered questions "very broadly." "It was a little bit gray,"

said Dang, but noted people who came to the Oct. 25 forum are engaged citizens. "People will take notice of local issues. We will vote on them." Kate Ippolito asked Tory about the city’s lack of affordable housing for people around her age. Even earning $15 an hour, she said, they still can’t afford a onebedroom apartment and other necessities. Tory said the city didn’t meet its target for new affordable housing until this year, but "I intend to exceed it in every year going forward," with new mixed-income neighbourhoods. The mayor gave her good information, but could have said more specific to youth, said Ippolito, who later accepted a card from Tory and stood with him for a selfie. "This did help his standing in my book," she said. Along with the SCSU, the forum was organized by the Scarborough Community Renewal Organization, whose executive director, Jennifer McKelvie, said the group needs Millennials’ ideas and their energy. Students from Centennial College, whose Morningside Campus is nearby, were also invited.

Arnold Chan’s widow wants to run for his seat MIKE ADLER madler@insidetoronto.com Not long before he died, Arnold Chan was speaking with his wife, Jean Yip, about the future. Yip said she suddenly asked Chan if she should try to run for his seat, and the Scarborough-Agincourt MP, then terminally ill with a rare cancer, agreed. "I don’t think he was surprised," said Yip, who had attended many events with her husband in the riding during his three years in office and, as Chan’s health worsened, found herself representing him more and more. The couple didn’t have time to discuss Yip’s idea further, she said, before Chan passed away on Sept. 14, but on Oct. 28, Yip announced she will seek the Liberal nomination for a coming Scarborough-Agincourt byelection. In an interview, Yip, who grew up in Agincourt, said she understands the community, and wants to continue Chan’s work, including his efforts to secure federal financial support for the Bridletowne Community Hub. She said she felt the support of the community after Chan’s death, "and I want to

Chan won a 2014 byelection for the Liberals after Jim Karygiannis, the riding’s longtime Liberal MP, resigned to run as a city councillor. Months later, he was diagnosed with nasopharyngeal carcinoma. After treatment, Chan’s health improved, and he was re-elected in 2015, but by March 2016 the cancer had resurfaced. Parliamentary rules say a byelection date to fill the seat must be announced before March 18. Yip said she would work to bolster local seniors’ ser-

vices - the riding has a large proportion of seniors - and mental health supports as well as a digital learning environment in Canada’s schools. She has already drawn endorsements from Scarborough-Agincourt MPP Soo Wong and her predecessor, Gerry Phillips. In a release, Michael Chan, Liberal MPP for Markham-Unionville, said he admires "Yip’s exceptional courage to embrace the total confidence Arnold had in her as she works to advance his remarkable legacy." The riding’s federal Liberal association said a nomination date hasn’t been announced yet.

Chin Lee to run for Liberals against Raymond Cho MIKE ADLER madler@insidetoronto.com Scarborough Councillor Chin Lee will run for Ontario’s Liberals in the new provincial riding of Scarborough North, setting up a battle between him and a former colleague, Raymond Cho. Cho, after spending a quarter-century as city councillor in northeastern Scarborough, won a byelection last year as a Progressive Conservative to become MPP for ScarboroughRouge River. But Scarborough-Rouge River will disappear in the 2018 Ontario general election, and by February the PC party declared Cho would run in Scarborough North. On Friday, Oct. 27, the Liberals announced Lee will be their Scarborough North candidate. "The Ontario Liberal government has been and will continue to be a fantastic partner for Scarborough, on files as varied as transit, healthcare, post-secondary education, families and most recently the creation of the Rouge Park," he said through a press release. Lee, whose status as nominee will be confirmed by the Liberal riding association on Nov. 6, was first elected in 2006 in Toronto’s Ward 41 (Scarborough-

Scarborough North, formed from portions of the ridings of ScarboroughAgincourt and Scarborough-Rouge River, covers the area from Midland Avenue to Nielson Road between Highway 401 and Steeles Avenue. It contains some territory where both men had constituents as councillors. Ontario’s New Democrats have not yet chosen a candidate for the riding.

Lee’s term as a councillor ends with the municipal election on Oct. 22, but the provincial election date is June 7. Other changes on the provincial level are in store for Scarborough, where Liberals held all six local seats in the 2014 election. Scarborough Centre MPP Brad Duguid, a longtime Liberal member of Cabinet, said in September he won’t run in 2018. Parthi Kandavel, Toronto District School Board trustee for Scarborough Southwest (Ward 18), has said he’ll seek nomination in Scarborough Centre for the Liberals. Duguid has endorsed the candidacies of both Kandavel and Lee.

Centennial College students are increasingly worried as the faculty strike on Ontario campuses continues, the college’s student president said a day before a planned rally at Queen’s Park. "They’re just feeling helpless because they don’t know if their semester will be lost or not," Ravneet Kaur, of the Centennial College Student Association Inc. (CCSAI), said Tuesday. A 2006 faculty strike at Ontario colleges lasted

three and a half weeks. Kaur said students could start losing their semesters if the current one goes beyond four. International students worry about their visas and fees, but all students are affected, some saying they don’t have strong financial resources and "would just be done" with college if they had to repeat a year, Kaur said. CCSAI stays neutral on the strike, she said, but the association wants "student voices heard," and for both

sides to return to bargaining. Along with other student governments in Toronto, CCSAI planned to bus students to a rally, scheduled yesterday (Wednesday) in front of the Ontario Legislature. The College Student Alliance, organizing the event, hasn’t chosen sides in the dispute, but on its Facebook page says, "a unified voice showing our strength will pressure both sides to make a deal immediately."

Staff and students at Wexford Collegiate School for the Arts had to endure the deaths of three of their own in the span of a month. This triple-tragedy has brought a sombre and numb feeling to the building said Wexford’s principal, Tom Lazarou. While principals and teachers aren’t specifically trained to help students process grief, Lazarou said, they can do their part by listening. Wexford’s first loss was Susan Longuet, a guidance counsellor for 11 years, who died of cancer on Sept. 16. "She did things for students away from Wexford and we had no idea. It’s a huge loss," said Lazarou, adding that she would help students from home, supporting them with their plans for the future. Two weeks later, Nicole Sutton, a French teacher who had been at Wexford for 16 years, died of a brain aneurysm. "It shocked us a great deal because she was very young and it’s tragic; she worked Friday and she passed away Saturday," he said. The biggest shock for students was 15-year-old

Isaiah Witt who died after being stabbed in East York on Oct. 7. Mohamad Ayoub, 15, couldn’t sleep the night he found out his friend died. "I didn’t believe it," Ayoub said. "If he’d see someone lonely he’d go up and ask to be friends. He was just so nice." After hearing about Witt’s death, students at Wexford began to wonder who would be next. "I was telling my parents, ’if anyone else dies I’m leaving the school’," Ayoub said. But Lazarou assures the community that students are safest in school with their peers and teachers. Wexford turned to the Toronto District School Board (TDSB) for assistance to help students deal with the three losses. According to TDSB spokesperson Ryan Bird, the board has 115 social workers who can aid staff and students. "Some issues may only require one counsellor, while issues affecting a large number of students may require multiple counsellors," Bird said. A team of four grief counsellors was brought to Wexford for two days. "The biggest part of a loss is to go through the process and deal with it

Bernard said her group’s next goal, a big one, is to launch a retirement home specializing in the ethnocultural needs of Greater Toronto’s black community, as the Yee Hong Centre for Geriatric Care does for Chinese residents.

Crystal Bins is “top shelf” A top craft brewery recommends the local bin business Great Lakes Brewery has been a leader in the craft beer business for 30 years and president Peter Bulut likes to work with local businesses. hat Toronto’s bike culture is changing and growing rapidly is made apparent by increased numbers of bike commuters and leisure/ sport riders on the city’s roads and paths, and the financial resources devoted to them. But two less well-known cycling disciplines, street riding and cyclocross, are gaining a foothold among Toronto’s twowheeled enthusiasts. Street riders go freestyle and use ramps, man-made and natural obstacles, as well as their own bikes to perform stunts

and jumps of outrageous athleticism. Cyclocross riders follow a set cross-country course over rolling terrain and varied surfaces, at some points even hoisting their bikes up and running with them. These two off-the-main-road sports recently found outlets in the city. Montreal-based The Rise Bikes brought its Party Master Tour to Toronto cyclists in partnership with Dufferin Street bike shop ZM Cycle & Fitness. The boutique frame manufacturing company’s pro

demonstration team took to area venues with local fans and riders to test their skills. The Midweek Cycling Club, in cooperation with Bateman’s Bike Company, holds weekly cyclocross clinics and races at Etobicoke’s Centennial Park in the late summer and fall. Riders of all ages and experience ride high and low perfecting their off-road abilities, with a competitive edge. Toronto’s cyclists have served themselves well by embracing these two specialty rides.

New Agincourt Mall plans unveiled Agincourt Mall has been around since 1966, but may be ready for a huge makeover. Its redevelopment potential at Sheppard Avenue and Kennedy Road has been considered for decades, says Scarborough-Agincourt Coun. Norm Kelly. It didn’t surprise Kelly when a developer approached Scarborough councillors with plans for 5,000 residential units, retail stores, offices, and public streets around a park arranged rather like Shops

on Don Mills in North York. Because it’s so big, a "planning framework" for the mall property must be approved before city officials deal with the redevelopment itself. People can start looking at the framework on Monday, Nov. 6 during an open house at the mall from 4 to 8 p.m., with presentations at 5 and 7 p.m. Kelly said he hopes for a quality redevelopment complementing neighbourhoods around it. "We’re going to have to look at traffic

very carefully, because people still drive cars," he said. Other plans for mixeduse mall redevelopment in Scarborough have stalled Bridlewood and Parkway malls are examples - but Kelly believes the Agincourt property sits on a great location near Highway 401 and a GO Transit station. Kelly supports a Sheppard Subway extension, but said redevelopment would plan both for that or a future light-rail line along Sheppard.

Trustee ward boundary meeting Monday Toronto City Council’s plan to reshape itself means Toronto District School Board must do the same. There are currently five TDSB wards in Scarborough to 10 city council seats, but council is moving from a 44 to a 47-ward system, starting in 2018.

While regulations don’t allow TDSB to add more wards, it must still align its wards with the city’s. A Trustee Ward Boundary Review is underway, and residents can review and comment on different options for the TDSB wards during a public meeting at Scarborough Civic Centre
