Completing renovations there by the end of 2013 or perhaps next March will fulfill a long-sought goal for Tropicana, whose focus remains Scarborough’s black and Caribbean populations but is open to all, Shelton said. It was 2005 “when we really started the push” for a building which could house “an aspect of every one of our programs,” she said.

Tropicana Community Services started in 1980 with a $500 grant, money its founders hoped would help Caribbean-Canadian youth around Birchmount and Finch avenues. Decades later, the United Waybacked agency is a $10-million operation covering all of Scarborough with around 80 staff and 200 volunteers. This week, Tropicana announced it has been given federal funds to finish a new headquarters where it can represent its 30 programs under one roof.

Federal fund The $613,000 announced this week from the federal Community Infrastructure Improvement Fund follows a $2-million provincial grant, including $1.36 million for the property’s purchase. Grouped along a “main street” the Huntingwood headquarters will contain a gymnasium, computer labs, teaching kitchen, program rooms, offices and eventually one of Tropicana’s childcare centres. “It will be very much a home, a community home where you can sit and chat,” said Shelton. Sherman said members of his group are hearing “all kinds of rumours” from hospital employees suggesting, despite administration assurances, “certain critical services are being moved from the Birchmount campus” so that its 24-hour Emergency Room “could end up fading away.” Sherman admitted group members - who say they realize the hospital is in a difficult position - hadn’t heard officially any consolidations had been approved. “Neither have we,” responded

Michael Mueller, a former board chairperson, who maintained nothing has been decided yet. Mueller said board members will be at a retreat next Tuesday, Jan. 15, to see for the first time what internal management teams and the Hay Group, consultants for the strategic plan exercise, have to say. The administration will go to the community soon after with potential recommendations, and say, “Help us make the best decision,” Mueller said, but insisted the Birchmount’s 24-hour ER “has been a must-have at the hospital” and putting it at risk has never been discussed.

“We’re not hiding anything,” he added later, saying the recommendations will present savings that add up to more than the hospital’s projected 2013 budget shortfall of $17 million, so the community can choose. “If the community says, ‘save this, cut this,’ we have to listen to it.” Administrators were hoping to have the recommendations in hand last month, but officials say the timetable proved too ambitious. “The good news is the consultant said, ‘You’re not wasting any money,’” Mueller said. “The bad news is there’s no low-

hanging fruit.” The final set of evening meetings presenting the hospital’s message but no specifics on the choices it may face are scheduled for tonight at the Malvern Community Centre and next Monday at the Cedarbrook Community Centre. Board members this week said the hospital has tried to involve the community as early in the process as it could. “We are on the same page,” said Vu Tran, a family physician at his first meeting as a member who wondered why things had turned so antagonistic. “Why are we fighting over rumours?” he asked.

Artwork on front page appreciated To the editor: I would like to thank you for the beautiful front pages on The Mirror during Christmas week. I was visiting my daughter in Scarborough and commented to her on the beautiful cover of The Scarborough Mirror. Then, I got home to East York to another beautiful cover, done by a local artist. It’s a great idea, and so nice to share with the readers. It also gives exposure to the artists, as there is some great talent out there, that many aren’t aware of. I’d love to see this regularly.

Gardiner deserves long-term plan

oronto council must understand the future of the Gardiner Expressway is a significant consideration. The Gardiner’s place in Toronto’s transportation infrastructure is an issue that needs to go beyond next week’s budget deliberations. It can’t just habitually resurface when a piece of concrete falls from it. Council needs to identify a comprehensive plan. Council must move forward with the Environmental Assessment (EA) process that began under the previous administration exploring tearing down the Gardiner east of Jarvis Street. That EA was shelved, however, after the 2010 municipal election – despite no council order to do so. That the budget committee voted Tuesday to resume the EA, originally authorized in July 2008 at a cost of $7.69 million, is reason for optimism. our view Council must have the best information available. The EA Gather info will present those options. to make best The Gardiner is well-used. It is busy. And it is aging. Currently decision about $500 million is proposed for the roadway over the next 10 years. Engineers have raised significant concerns that the eastern portion’s safety will be compromised by the end of the decade should those repairs not be made. Those dollars are significant. Most recently, Toronto’s budget committee asked for a report on the pros and cons of selling or leasing the Gardiner. That, too, is an impactful proposal. There are important questions for council to consider. How should we expect our major roadways to operate? How do any of the proposals for the Gardiner fit in with other planned transportation improvements, such as light rail? What kinds of impacts can our communities expect? The Gardiner is a large piece of Toronto’s existing transportation infrastructure. According to Waterfront Toronto figures from 2008, some 200,000 drivers use it daily west of the core. That number is 120,000 east of Jarvis. It’s a significant east-west corridor, serving not only residents of the city, but the Greater Toronto Area. But in many respects this is the ultimate neighbourhood issue – one that has an impact beyond even the 14 Toronto neighbourhoods the roadway actually touches. The pressures of gridlock, only expected to intensify, have far-reaching impacts – into all of our neighbourhoods. Council must gather the best information to confront that reality. newsroom

‘Lazy’ media reports portray unfair image of Scarborough To the editor: Re: ‘Make 2013 Year of the Scarborough Community,’ Editorial, Dec. 27. The biggest improvement that anyone could make for the Scarborough community can only be done by you and your colleagues in the Toronto media including the press, radio and television. I object most strongly to the use of phrases including, but not limited to, “a Scarborough man,” “a Scarborough house,” and “in Scarborough” when it doesn’t add important information to a story. I, along with the rest of the country, regularly read, hear, and see references to these meaningless phrases reporting something negative. I’ve done my part by writing to all three groups of opinion makers regarding their

liberal use of “Scarborough” when reporting negative news events. The problem is that when reporters report location, either force of habit or laziness prevails. They won’t report the intersection of Surrey and Tedford because nobody knows where it is and they would have to explain it to their boss. But report it as Scarborough, and everybody including the boss knows, meaning the job is done. We rarely come across similar references to the other former cities: “a York man”, “an East York man,” and we can’t even comprehend what might be meant if a story refers simply to “a Toronto man.” Is it the former city or the amalgamated city?

T h e m o s t e g re g i o u s example I have witnessed is: “A Scarborough man was arrested at Yonge and Dundas.” which tells the consumer absolutely nothing except that Scarborough must be a nasty place. Those of us who live in Scarborough know it as a caring, friendly, vibrant place to live and work but non-residents, who only get the media reports, are left with a totally erroneous and negative impression. Please do your part to correct this and correct everyone else who is guilty of this crime against the Scarborough community. That would be a happy new year for all Scarborough residents. No purpose for unions To the editor: Re: ‘‘Good old days’ were not so good,’ Letters, Dec. 20 I must disagree with Joy Taylor’s letter in support of unions. And before anyone wonders, yes, I spent several years in a union-based job. Whilst it is true that in the beginning, unions served the just and noble cause of protecting workers’ rights, this purpose has long since degenerated and been replaced by a bunch of greedy, inflexible, living-inthe-past union leaders, who are clinging to antiquated systems no longer viable in current economic realities. We hear countless stories in the media of actual union members who are do not wish to strike and are quite happy, in most cases, with the more than fair salaries and benefits that they receive. The system is long since broken. Constant strikes disrupt our city and cost millions of dollars in taxpayers money. It’s time to try something new, such as using an independent arbitrator to settle negotiation stalemates. Let’s move into the 21st century and find a better way. Neil Folkard

De Baeremaeker seeks appeal of city’s shark fin ban ruling Toronto’s city solicitor has filed a notice of intent to appeal a court decision last month ruling the city’s ban on shark fins illegal. Toronto Council must still approve an appeal, but Scarborough Centre Councillor Glenn De Baeremaeker said he thought support among councillors for banning the fins remains strong. Ontario Superior Court Justice James Spence said the fin bylaw, challenged before it could go into effect last Sept. 1, “lacks a proper municipal purpose” and added no “identifiable benefit” to the city’s “environmental well-being.” However, De Baeremaeker maintained Canadian cities have a discretionary power to pass bylaws “in the public interest” of their citizens, which includes banning fins. Spence wasn’t persuaded by the city’s arguments the fins, served in banquet halls and restaurants, are obtained by a practice called finning

which is threatening shark species with extinction, or that the fins are unhealthy for human consumption because sharks accumulate mercury from prey. “We as a city may not have done our homework properly,” De Baeremaeker said, but added the city did not present experts or all available evidence supporting its claims, and could during an appeal. Spence also said the bylaw called for “highly intrusive” enforcement, because it banned possession of shark fins anywhere in Toronto. De Baeremaeker said the bylaw is only meant to stop the sale of fins at restaurants and banquet halls, and would not give “shark fin police” the power to enter homes.Depending on a ruling by the city clerk, the councillor said, approval of an appeal could be introduced at a council meeting beginning Jan. 15 on the city’s 2013 capital and operating budgets. – Mike Adler

Soil from auto recyler in Rouge will not have to be removed MIKE ADLER madler@insidetoronto.com An automobile recycler in Rouge Park won’t have to remove soil from its property from which fuel was discovered leaking into the adjacent Rouge River creek in November of 2010. Ontario’s environment ministry chose to leave the soil in place “since the materials will biodegrade over time” and because the recycler, Standard Auto Wreckers, is now required to contain and remove stormwater from the Scarborough property and to stop runoff to the creek, said Kate Jordan, a ministry spokesperson. It was also thought removing the soil would damage the creek and its floodplain, Jordan added.

The province’s Environmental Review Tribunal last June found “motor vehicle fluids” seeping into the creek, a tributary of the Little Rouge River, appeared to come from a structure in which Standard Auto removed parts from vehicles. The ministry agreed to change a clean-up order issued after the spill so “the question whether there has been a breach (of the law) would not arise.” Parent company Goldy Metals agreed to remove the structure as well as to “risk management measures” to prevent another accident and “delineation and remediation of the petroleum spill” on and off the property. Jordan said an ecological risk assessment found hydrocarbons in a small area near the creek. The ministry finished reviewing

the assessment late last year and sent its conclusions to the Toronto and Region Conservation Authority, interim manager of the park, which supports them, she said. The ministry will continue to monitor Standard Auto’s operations and will meet company executives in the coming weeks to discuss next steps, Jordan said. “Our priority is that the company’s operations do not impact the environment and any potential impacts are addressed and studied.” Before it was disbanded last year, the Rouge Alliance, a co-operative of agencies and governments which ran the park, had called on the province to talk to Standard Auto about purchasing the property south of Steeles Avenue at Sewells Road and relocating the business.

Ford’s image survives court time

ayor Rob Ford was back in court this past Monday — this time sitting quietly in an Osgoode Hall courtroom as his lawyer, Alan Lenczner, made a final pitch for his job. Newspaper deadlines being what they are — by the time you read this, it is entirely possible that the three judge Divisional Court panel will have decided on Ford’s appeal of the conviction by Justice Charles Hackland. Monday was not so much about the future — but what has gone before. Being an appeal, there was no new evidence, no testimony, and a surfeit of arcane legal arguments, which was as it should be: Ford’s lawyer’s job was to dig into Hackland’s decision to convict Ford under the Municipal Conflict of Interest Act, and demonstrate whatever errors he might find. Lenczner took on another task, though: to present and recast the nar-

rative of the mayor’s career on council in the kindest light possible. So when Ford spoke and voted on his own behalf over a recommendation to compel him to repay $3,150 in charitable donations to lobbyists, he did so, according to Lenczner, as “an honest man.” There was no subterfuge, nothing hidden. He simply had a flawed understanding of the way the Municipal Conflict of Interest Act applied to matters of personal accountability on council. It’s a narrative that seems to be an easy sell for a large number of Torontonians. Ford continues to poll well in spite of a great deal of evidence that suggests he shouldn’t.

None of this came up at the appeals court, of course, because none of this was before the court. So Lenczner could present an image of a mayor dedicated to openness and honesty, whose simple desire to help young people only occasionally affected his judgment. There was some indication that the narrative found some currency with the judges. Senior Justice Edward Then wondered aloud whether Ford might not have simply made an honest mistake. So in that sense, whatever the future holds for him, Ford can take comfort in the fact that the narrative he and his supporters crafted — of the stolid everyman, the only honest one at city hall — has at least survived the ordeal of his mayoralty. n David Nickle is Toronto Community News’ city hall columnist. Man faces charges after two police officers injured A man is facing nine charges after two police officers were allegedly assaulted on Monday. Police said two officers were called to the Scarborough Golf Club and Ellesmere Road area for an investigation when a man fled the scene on foot. Police alleged a man charged at one of the officers, knocking him to the ground causing the officer to break a leg.

Sharks take gold and silver medals at Ice Trials tourney The Scarborough Sharks Girls Hockey Association managed to keep some of the hardware for themselves from their huge 29th annual Ice Trials hockey tournament last weekend. The filled-to-capacity tournament, with well more than 100 teams and 1,800 players, was split into six age divisions (atom, peewee, bantam, midget, intermediate and senior) at the four top skill levels (AA, A, BB, B). That translated into 17 championship games on Sunday with the host Scarborough Sharks organization winning two of them and settling for silver in three other games. Sharks winners are: B A N TA M B B : t h e Scarborough Sharks bantam BB team won the gold medal game 3-0 over Woolwich Wild, avenging an earlier preliminary round 1-0 defeat. It was the only multi-goal winning margin for the Sharks in the ultra-competitive division. The Sharks won their semifinal 1-0 over Durham West Lightning after posting a pre-

liminary round record of one win, one tie and two losses (2-2 with North Bay, 2-1 over West Huron and two 1-0 losses to Woolwich Wild and Russell Coyotes). SENIOR A: the Scarborough Sharks senior A team won the gold medal game 1-0 over previously undefeated Durham West Lightning in a shootout. The two had finished onetwo atop their five-team division, and Scarborough’s only loss in the preliminary round was to Durham West 4-3. Scarborough earned second place (and a berth in the championship game) with two preliminary round 4-0 wins over Timmins and Niagara and a 0-0 tie with Ottawa. The finalists: PEEWEE B: the Scarborough Sharks lost the peewee B championship game 3-0 to Sudbury. Scarborough won its semifinal 2-1 over Peterborough. Lawyers for and against Mayor Rob Ford faced off Monday for the final appeal that will ultimately decide whether Ford will continue as mayor of Toronto or be tossed out of office for violating Ontario’s Municipal Conflict of Interest Act. The hearing at Osgoode Hall lasted a day, with Ford’s lawyer Alan Lenczner laying out his four-pronged argument as to why Ontario Superior Court Justice Charles Hackland’s conviction of Ford ought to be struck down. Justice Hackland found this fall that Ford was guilty of violating the Municipal Conflict of Interest Act in February 2012, when he spoke and voted on recommendations from Toronto’s Integrity Commissioner that Ford be made to repay $3,150 in donations by lobbyists to a football charity he operated. Ford had maintained the lobbyists didn’t want their money back, and said he would have to pay the money himself. Under the Municipal Conflict

of Interest Act, elected officials are prohibited from voting or speaking on matters in which they have a pecuniary interest. Lenczner presented four arguments in favour of his client. He maintained that council had no power to extract the money from Ford because the City of Toronto Act didn’t list that among possible punishments. honest mistake He also argued that Ford had made an honest mistake, and that the amount of money in question was insignificant. And he said the Municipal Conflict of Interest Act did not govern councillors’ code of conduct. Clayton Ruby, representing Toronto resident Paul Magder in the complaint against Ford, spent the afternoon arguing none of those arguments held water. He maintained that Ford was wilfully ignorant of the conflict of interest rules – and that Ford’s explanation that he relied on the city solicitor for

advice on the act did nothing to mitigate that. “If I rely on advice from the city solicitor – number one, I know the City Solicitor doesn’t work for me, she works for the city,” said Ruby. “If there’s a conflict it’s between the city and me. How can I reasonably expect that I think I can get advice on conflicts of interest from the other side? And there’s no way on earth that the city solicitor can know the financial affairs of all 44 councillors?” Ruby was subject to thorough questioning from the chief Divisional Court Justice on the three-judge panel, Justice Edward Then, who wondered if Hackland’s judgement on Ford had been too narrow. ‘good faith’ “When you’re looking at good faith, isn’t it important to balance that outlook and balance the factors rather than looking at those things that weren’t done?” said Then. “Isn’t it important to look at the things that were done?” Then said Ford had been

generally cooperative with the city’s integrity commissioner – save and except his refusal to pay the money back. “I’m not sure Mr. Ford, short of insisting on the point that he not reimburse, didn’t cooperate quite fully with the integrity commissioner,” said Then. “He met with her several times, sent out letters asking whether he could return the money. The one thing he didn’t do was yield on the point of reimbursement.” And he said that one of the times Ford was warned about his conflict on the matter might have been politically poisoned, because it came when Sandra Bussin was speaker. Ruby countered: “That may make sense by itself but if the speaker of the city council draws this very issue to your attention and you ignore it and vote on it because you don’t trust her – is it then reasonable to take no steps to seek legal advice from anyone. You can’t call that good faith. It’s not good faith.” The judicial panel is expected to provide a ruling within weeks.

Toronto’s budget chief Mike Del Grande moved a motion to resume the Environmental Assessment (EA) on the possible tear-down of the Gardiner Expressway. But that’s not to say that Del Grande, a longtime opponent of plans to tear down the Gardiner, has changed his tune. Del Grande said the EA, which was halted early in Mayor Rob Ford’s term, should be completed as a way to take some of the partisan bite out of the debate on the future of the elevated highway. “I’m all for a fair and reasonable review and an environmental assessment — I am,” said Del Grande at Tuesday’s, budget committee meeting to finish off the city’s 2013 budget before sending it to executive committee. “There’s this notion that in order to have
