Ford Fest has broken out of Etobicoke. The barbecue thrown by Mayor Rob Ford and members of his family – up until now an annual late-summer event for supporters and friends at the mayor’s mother’s home in Etobicoke – is coming to Scarborough’s Thomson Park this Friday night. It will include the usual hamburgers, drinks, dancing and live music, but also halal food according to a notice which said everything would be free. Mayor Rob Ford has asked the city manager for a report on replacing the Scarborough RT with a subway.
“The councillor who originally supported the LRT saw an opportunity — they listened to the taxpayers, they realized instead of building transit they could be building subway tunnels that can be used for the next 10 years. We want subways.” Council voted to ask for the subways during a long debate over what revenue tools the city would prefer to fund transit expansion through the provincially-appointed transit agency Metrolinx. In the end, council rejected nearly all of the possible revenue tools, and voted to
ask for more transit from the provincial government: the subway extension of the Bloor-Danforth line from Kennedy Road to Sheppard Avenue and the closure of the loop between Sheppard Station and Downsview Station. Man, 19, charged in Canada Day shooting A man has been charged in connection with a Canada Day shooting that seriously injured a 34-year-old man. Police allege the victim was walking through a pathway near Wishford Drive, near Morningside Avenue, when a man armed with a sawedoff shotgun approached him and demanded the victim’s backpack around 3:20 p.m. The victim refused and tried to disarm the gunman. The victim, shot in the upper right shoulder, was taken to a trauma centre with serious but non-life-threatening injuries.

Members of the family of a woman who died after being struck by a TTC bus in January announced yesterday that they have filed a $3.2 million lawsuit against a TTC bus driver and the Toronto Transit Commission. The lawsuit, which was filed in Ontario Superior Court on behalf of the family of Wendy Martella, accuses TTC driver Magdalene Angelidis, 39, of allegedly failing to follow TTC safety protocol, resulting in her striking and seriously injuring Martella, 47, who was crossing the road at the intersection of Eglinton Avenue East and Sinnott Road in Scarborough on Jan. 23, of this year. Martella was transported to Sunnybrook Health Sciences Centre where she died from her injuries a day later. “The lawsuit we’re filing today is to attempt to hold the defendant Magdalene Angelidis and the T TC accountable for the tragic consequence of their failure to follow safety procedures that were put in place,” said attorney Dale Orlando of McLeish Orlando, flanked by members of the Martella family during a press conference at the law firm’s downtown office. The lawsuit alleges Angelidis, who was driving the TTC bus eastbound on Eglinton around 4 p.m., decided to stop for a passenger outside of the normal bus waiting area and while already in the middle of the intersection at Sinnott. intersection following the unscheduled stop, the lawsuit alleges Angelidis missed the traffic light, which had by then turned red, and continued on – unaware that Martella, who had already begun to cross, was in front of her bus. None of these allegations have been proven in court. “No one is suggesting for a moment the defendant intended these horrible consequences, but this is what happens when people ignore the procedures in place,” said Orlando. Martella’s husband, Paul, said the lawsuit was not intended as a way to profit from his wife’s death, but to ensure no one will have to go through what he and his family have endured. Angelidis has been charged with careless driving and failing to stop at a red light. She is scheduled to make a second court appearance at Old City Hall today. The TTC did not respond to requests for comment on the lawsuit.

Subways in Scarborough will be back on the floor of council on July 16. Mayor Rob Ford said he’s asked city manager Joe Pennachetti to write a report, detailing what it would take to build a subway along the route of the soon-to-bedefunct Scarborough RT line rather than light rail. And while the report request is ostensibly in response to a letter received last week from Metrolinx CEO Bruce McCuaig, demanding that the city re-affirm its support for light rail along the line to keep the work on the $1.8 billion line going, Ford made it clear he’s got other ideas. Ford said he believes the May vote of council, asking that Metrolinx consider building a subway along the route for $500 million more, was decisive. “Just two months ago council voted against the LRT in support of subways,” said Ford yesterday afternoon.

Ford would not speculate on what financing mechanisms might be recommended this time.

It’s your vote – make them earn it

yelections are a chance for people to become engaged in community building – and hold vote-seeking candidates to account on issues of importance. And with five provincial byelections upcoming, it’s a chance for the voter to show their support (or not) for the government of the provincial Liberals. In Toronto, where two of the votes are being held, all but five of Toronto’s 23 seats (counting PickeringScarborough East) are in the hands of the governing Liberals. The others are NDP. None are held by the Progressive Conservatives. The results could be interpreted as more than a mere microcosm of how voters feel the minority Liberal government is performing. That’s because the relationship between our city and the province is rocky these days. Then there’s the matter of competing visions over what to do with the Scarborough RT line – and transit funding in general. The CEO of provincial transit agency Metrolinx has raised the possibility of stopping work on the new light rail replacement of the RT – in light of a recent Toronto council resolution asking for a subway instead. The light rail line, per an agreement between the city and the province, is being funded by the province. A subway line is not. In Scarborough-Guildwood and EtobicokeLakeshore, byelections are being scheduled to replace departing Liberals Margarett Best and Laurel Broten, respectively. Voters must look beyond traditional voting support and ask for policy positions on the real issues that affect the people of Toronto. Toronto remains the economic driver for this province and country. Success of Toronto is significant in every corner of this province. Voters deserve a clear message from candidates on whether their political parties believe it – and what that means for a provincial commitment on transit funding. The candidates are seeking your vote. Make them earn it.

With binding arbitration, costs go in one direction
D
o you ever wonder why the public usually pays above market rates for almost every decision that goes to arbitration? Just recently, an arbitrator awarded firefighters a 14.26 per cent raise over five years, far in excess of the 6.5 per cent given to Toronto’s inside and outside workers, well above the rate of inflation, and higher than settlements in the private sector. Our firefighters are not alone in achieving lucrative awards. Joining the ranks of very well paid municipal workers are our police and paramedics, whose remuneration increased by almost six per cent annually despite a flat economy, according to the Association of Municipalities of Ontario. How do they do it? It begins by having their service declared essential. On paper it looks like a fair deal. The two sides agree not to have a strike or lockout, but instead take their differences to binding
david soknacki beyond the headlines arbitration. Practically, competition among municipalities, the rigid nature of arbitration, and provincial governments unwilling to take on powerful unions all conspire to preserve a system that pushes up costs. Part of the problem is because municipalities compete for experienced workers, trained at other jurisdictions’ expense. Add to the mix the number of firefighters who live well outside of the city, thanks in part to Toronto’s adoption of the 24-hour shift, and it is easy to see why surrounding municipalities find it tempting to poach Toronto’s firefighters. Part of the problem is an inability to limit arbitration. Despite the province’s best intentions, arbitrators are not known to lower awards based on financial distress.
Toronto’s woes were rejected by the arbitrator when he pointed to our surpluses. In jurisdictions as challenged as Windsor and Scugog, large awards were given with little consideration to difficulties in those local economies. And part of the problem is that arbitrators will not open up contracts to find savings, such as changing work practices. Usually arbitrators deal solely with outstanding issues, meaning remuneration and other benefits. That means the only major question open for arbitration is how high to raise pay. Since firefighting standards are the same throughout the province, municipalities compete for trained workers, and the current arbitration system is so skewed in favour of one of the parties, using provincial powers makes sense. Perhaps the simplest way is to limit the rate of
increase province-wide. This is the approach recently attempted in New York state. Even though the costs of arbitrated contracts would continue to be paid by the municipalities, the provincial government will avoid involvement probably because it wants no part of confronting some of the strongest and savviest unions around. As well, the current provincial Liberal government requires the support of the NDP. As a result, the public’s problem of paying more than necessary for arbitrated services will remain. The too-expensive costs of these settlements remain part of the tangled mess of our intergovernmental relations, a downloaded problem, every bit as significant as public housing, transit and social services. Firefighters awarded pay hike by arbitrator

Municipality’s ability to pay should be factored in, city manager says DAVID NICKLE dnickle@insidetoronto.com Toronto firefighters have been awarded a five-year contract that will see their wages rise by more than double the rate of unionized city workers, but commensurate with police wages. The settlement was awarded by arbitration — the means by which firefighters, police and TTC workers settle their contracts, because legislation prevents them from striking. The firefighter contract is retroactive to 2010 and will see wages rise by a total of 14.26 per cent over the five year term. City workers will see their wages rise by 6.25 per cent over the same period.

$45.7 million cost The pay hike will cost a total of $45.7 million over the course of the contract, but the retroactive portion has been budgeted for said city manager Joe Pennachetti. And the city will be saving $11 million as a result of changes to the benefit packages. One thing the provincial arbitrator didn’t do was accept the city’s argument that any settlement ought to be based on the municipality’s ability to pay. “We believe strongly that should be taken into consideration,” said Pennachetti. “They said that because we were running budget surpluses, they don’t believe we have a difficulty paying the increases.” The Toronto Professional Firefighters Association pointed out in a news release that the wage

DAVID NICKLE dnickle@insidetoronto.com Toronto’s Board of Health will be weighing the pros and cons of setting up a safe injection site similar to the Vancouver model, and possibly asking the provincial government to fund a pilot site in Toronto. That is the recommendation from a long-awaited report by the Toronto Medical Officer of Health, supporting the implementation of so-called supervised injection facilities in Toronto. The report is a response to Toronto’s eight-year-old drug strategy, which recommended looking into the viability of safe injection sites for heroine. Following the completion last year of a joint study by the University of Toronto and St. Michael’s Hospital, indicating Toronto should have at least three such sites, Medical Officer of Health Dr. David McKeown is recommending pushing forward. Parkdale-High Park Councillor Gord Perks has sat on the working group looking at ways to implement such a site. At this point, there are no recommendations as to a location for any site. “The issue for next week is not what location,” he said of the July 8 meeting of the Board of Health. “The issue is, based on the evidence, the health evidence about the community impact and the evidence about wise use of health dollars, is that now is the time to take the next step and produce a pilot site, and the provincial government should be funding it.” The report highlights the need for a safe injection site, pointing out that addicts using dirty needles and other unsafe forms of injection are more prone to pass on the HIV virus and Hepatitis C antibody. Research found one in five people injecting drugs have used needles previously used by someone else.

ob Ford isn’t the only one thinking about the next municipal election in 2014. Radio host John Tory’s thinking about it, word is that TTC Chair Karen Stintz is building a team and New Democrat MPP and former councillor Olivia Chow is aimed that way too. It’s all an invitation to start up a game of fantasy politics post-haste, scour the polls and start picking winners and losers. That’s all good fun. But it puts aside a more vital question: just exactly what the next Mayor of Toronto will be left to work with, once the ballots are cast and the winner’s chosen, and what that individual will be able to do with it? Mayor Rob Ford has repeatedly maintained it’s been his job to reduce the size and cost of government. He claims that he has so far saved taxpayers a billion dollars. The claim’s not entirely accurate – he’s included both the removal
david nickle the city of the vehicle registration tax and the increase of user fees – but it is wrong to say the mayor hasn’t done taxpayers a good turn, contracting out garbage collection and taming unions and cutting councillors’ budgets. If he’s not re-elected for all that, however, he will also have done his successor a good turn. For two years running now, the Ford administration has operated under a strict policy of sliding three-quarters of prior year surpluses into the city’s capital budget and holding back the rest for unanticipated liabilities. This year, that surplus amounts in total to $248 million. So $186 million will be going to pay cash for the sorts of projects that in the past the city has funded through debt. Last year, the
surplus was higher: $292.7 million. This 75-25 policy is a child of the Ford administration but happily midwived by the city’s finance staff. Keeping debt levels low makes for far more manageable books and more predictable revenue streams. It also limits city council’s ability to make in-year operating changes, and allows Ford to continue the business of shrinking government in terms of the services it provides. By sending surpluses to reduce debt, what the Ford administration has done is create borrowing room for an ambitious mayor to embark on an ambitious capital program. Many things become possible, for a city-building mayor riding in on the heels of a mayor whose major ambition was to put a hold on ambitious projects.

Meleni David, a newcomer success story Lawyer, mother, and entrepreneur extraordinaire, Meleni David is an astonishing woman. Coming to Canada from Sri Lanka in 1995, Meleni overcame a set of challenges as a mature student at Osgoode Hall Law School, simultaneously managing the family duties and law school. Meleni is a recipient of the Top 25 Canadian Immigrants of 2012 Award. Recently she received The National Ethnic Press and Media Council of Canada Award from the Lieutenant Governor. Even during such a busy time, Meleni found the time to speak about her life as a newcomer, a businesswoman, and a mother. Here are some of her impressions. On interest in law? I had a passionate interest in law from a very young age: My aunt and uncle, who were both very successful lawyers and were respected by the community very much. I grew up admiring them.
Challenges faced? I was very motivated towards producing social change. From the beginning, I felt many wrong things were happening in the world, and I really wanted to get involved to change things. But then, I had to stop and think about my personality: when I do something, I put my everything into it, all my time. I can’t commit a little bit, or spread things around. So I thought: I can enact social change, but it will be at the expense of serving my community in the largest scale; So I accepted that I can’t help with everything out there. I will do what I can and my first priority would be my community. Studying at Osgoode Hall I went into Osgoode not expecting a lot: I aimed to finish what I set out to do and get out, but it actually turned out to be an extremely pleasant experience. I made very good friends, and some ended up working with me – one for seven years! I never felt excluded or treated different as a mature student; I was one of them. I think these days, most law
schools have more women than men. So I did not feel the pinch as a woman…I didn’t feel any discrimination as an immigrant, either; because of my friends, and within months I became one of them. On starting her Law Firm It felt like everything just fell into place! When I came out [of law school,] I doubted I would even get an articling job, but immediately after graduating I got one though some students wait for years for an articling position. I did set up my practice prior to being called to the Ontario Bar. On the day I was called to the bar, I walked into the office to start practicing. I felt a sense of accomplishment, as I always wanted to have my own practice, just like my aunt and uncle. I also wanted my own practise because of my children: when you have your own practice, you are able to keep your own hours – so this flexibility was good for caring for them. Also with God’s blessings I inherited little over 100 files from a paralegal firm right before I started my practice, so I had clients right from my first day.

NHL’s Simmonds hosts charity ball hockey event NORM NELSON nnelson@insidetoronto.com You can be sure a contingent of Scarborough National Hockey League veterans will be very much on the ball for a charity tournament back in their hometown on Saturday, July 13 at Scarborough Gardens Arena. Wayne Simmonds of the Philadelphia Flyers, born and raised in Scarborough, will be hosting his second annual ball hockey tournament which serves two purposes: one short term, the other long term. The short term purpose is to create a memorable day of ball hockey for 64 local pre-teens (ages eight to 12) who have been chosen from local schools and from the Scarborough East Boys and Girls Club. They’ll suit up for eight
different teams for a fourgame round robin, followed by playoffs. While doing so, they’ll get to hang out with the NHL stars, most of whom grew up in Scarborough. The long-term purpose is to provide funds for underprivileged youth who can’t afford to participate in community sports programs. For this, the charity works with the Canadian Tire Jumpstart program for which it hopes to hand over $10,000. “Hockey is an expensive sport and all kids should have the opportunity to play,” said Simmonds in a press release. “This tournament is going to bring the community together and provide kids with an experience that will change their lives. I am excited to be a part of this tournament and give other kids the chance that I was given.”

Beach volleyballers win gold medals Two Scarborough girls youth beach volleyball teams won gold medals in the recent Ontario Volleyball Association tournament in Cobourg. The Under-12 team of Nicole Croft and Vivian Zanutel and the under-13 team of Samantha Cyrille and Lauren Wong won the championship in division one of their age groups. All four are from
Scarborough and were members of the Scarborough Titans Tektonics volleyball team this past indoor season. Both teams went undefeated in pool play as well as the playoffs: n In U-12, Nicole and Vivian won their semifinal match 16-14, 15-4 and the championship match 15-12, 15-4. That makes it two gold medals and one silver medal in three
U-12 tournaments so far. n And in U-13, Samantha and Lauren won their semifinal match 10-15, 15-10, 15-10 and the championship match 15-9, 15-11. That makes it two gold medals in two U-13 tournaments and one silver medal in a U-14 tournament. Lauren also won a gold medal with her Tektonics teammate Kha Vi An Tran in an earlier U-14 tournament.

Kirupa, Hunter to run in upcoming byelection >>>from page 1 and other regional issues. “I have dedicated my entire working life to unlocking the potential of our people and our community,” Hunter said in a Liberal Party release issued after she was nominated Tuesday at the East Scarborough Boys and Girls Club. “I want to help create fair access to community housing and public transit, as well as good jobs and new opportunities for our youth and families right here in Scarborough.” The release called Hunter a Scarborough native “happy to be back home” but did not say whether she had lived in the riding. She could not be reached for comment. On Tuesday, Lawrence Dawkins, president of the Scarborough-Guildwood provincial Liberal association, said he was excited to have Hunter as a candidate. “I’m elated we’ve got a person of her calibre,” he said. “That’s showing we can attract talented people to this riding and to our party.” Kirupa, a real estate agent, banker and past president of the Canadian Tamils’ Chamber of Commerce, said he was confident of his chances in a riding that has been Liberal provincially since Best first won the seat in 2007. He did, however, criticize Premier Kathleen Wynne’s decision to call a byelection for the riding, along with four others, during the summer. “This is part of the trick

they play always,” said Kirupa, adding he hoped local voters “will be here to vote for me and take this government back and vote for accountability at Queen’s Park.” Kirupa, nominated last December, said he has been visiting homes in the riding for three months, and “every door I knock on people want change.” Like Hunter, he is running for office for the first time. Other candidates can join the race before the nomination period closes on July 18. A New Democratic candidate will be chosen soon, Viresh Raghubeer, a member of the riding executive, said Tuesday. Becky Smit, a spokesperson, said a Green Party candidate will be announced for the riding “in the next few
days.” Wynne acted quickly to call the byelections after the resignation last Friday of Margarett Best, who had served in the Liberal cabinet and in 2011 became the first black woman to be reelected as an MPP in Ontario. She had been on a medical leave from her duties since February. Hunter was previously CAO of Toronto Community Housing Corporation and a vice president of Goodwill Industries of Toronto. She also served on the boards of TVOntario and United Way of Greater Toronto. “Her obvious passion for this region and its people shines through in everything she does,” CivicAction’s chairperson John Tory, who happens to be the former leader of the PC party, said in a statement Tuesday. “I’ve known Mitzie for a decade, and while I led a different political party I can say she is just the kind of person we need offering herself for election.” The riding stretches from Lake Ontario to Hwy. 401, and from Bellamy Road in the west to Highland Creek in the east. Advance polls will be open between July 20 and July 26, and voters can also cast ballots by using assistive voting technology between July 21 and July 31 at the local returning office at Unit B1, 1200 Markham Rd.

The Taste of Lawrence opens tomorrow night. The Scarborough street festival is celebrating its 10th anniversary. The street festival runs from 6 to 11 p.m. tomorrow; 11 a.m. to 11 p.m. Saturday; and 11 a.m. to 6 p.m. Sunday. Admission is free to the event, which takes place along Lawrence Avenue, between Warden Avenue and Birchmount Road. The

Fengjin Wu came home Friday night and told her husband that she had been struck by a car. Then she died. Where and when the accident happened is a mystery that police hope the public can help them unravel. Police said Wu, 46, left her home near Finch Avenue and Leslie Street to go shopping at about 2 p.m. “We believe that she took public transit,” said Det. Sgt. Jim Gotell of 33 Division. “She liked to go to the Scarborough Town Centre and to the Pacific Mall so those are two of the places she could’ve gone, but she could’ve gone anywhere in the city.” When Wu returned home at about 9 p.m., she told her husband that she had been hit by a car. “She has some injuries to her hands and elbows, and he asks her if she wants to go to the hospital and she says no,”

Gotell said. “She’s just going to go upstairs and get cleaned up in the bathroom.” Wu’s husband later found her without vital signs in the bathroom. Paramedics pronounced her dead at the home. As part of the investigation, police are attempting to retrace Wu’s final steps through cellphone, bank and credit card records. Police are also appealing for the public’s help. “If anybody in the community saw her on Friday, please let us know,” Gotell said. “Anybody who saw a woman being struck by a car, please let us know or if a driver is out
there who was involved in an accident with a Chinese lady, please call us.” Police don’t know if the accident was a hit and run. “The driver might have even stopped and spoken to this lady,” Gotell said. “She did have relatively minor injuries, and they could’ve decided that everything is OK...We need to determine what happened to her on Friday, the total sequence of events, so we need to speak to the driver to find out what happened.” Wu had collar-length straight dark brown hair and brown eyes. She wore a long brown coat and blue jeans. An autopsy failed to determine the cause of death. “We’re waiting for additional autopsy results like toxicology,” said Gotell. “It may very well be that the accident had nothing to do with the eventual cause of death.” Anyone with information is asked to call 33 Division at 416-808-3300 or Crime Stoppers at 416-222-8477.
