He received his Doctors of Dental Medicine (DMD) from University of Illinois at Chicago. Dr. Ebad is currently a member of the American Dental Association, The Academy of General Dentistry, and the Chicago Dental Society. He is committed to provide the best possible comprehensive care for his patients which suits their needs. He is also a firm believer in building a long-lasting relationship with his patients while providing state of the art care in all aspects of dentistry. HAMILTON MILL COMMUNITY ASSOCIATION BOARD ELECTION Request for Applicants for Nomination to Run for the HMCA Board of Directors All Applications must be received no later than 5:00 p.m. on November 30, 2017 As a homeowner in the Hamilton Mill Community Association, you have an opportunity to provide leadership and advance the best interests of the community by running for a position on the Board of Directors. Serving on the Board will allow you to have direct involvement in “directing” the business of the Association and adopting policies that reflect the benefits and services provided to our neighborhood. Please consider the following reasons why you should be nominated to serve as a Board Member: • Opportunity to make decisions on issues that have an impact on the quality of life for all residents of Hamilton Mill • Governance – policy making, oversight, and strategic planning • Opportunity to address issues and concerns of neighbors Serving on your Homeowner’s Association Board of Directors can be exciting and rewarding. NOMINATIONS FOR BOARD OF DIRECTORS BOARD MEMBER DUTIES, RESPONSIBILITIES & OBLIGATIONS To All Hamilton Mill Owners: In accordance with the By Laws for Hamilton Mill Community Association, Inc., four positions of the current board are up for re-election. The Nominations Committee is currently accepting applications for nomination and the Closing Date for nominees for the Board is November 30, 2017. The duties and responsibilities of a board member include governance, decision making, and oversight and requires a great deal of time, dedication, and knowledge on the workings of the community. In addition, a clear understanding of the association’s covenants, restrictions, bylaws, and a working knowledge of the association’s finances, insurance requirements, and contract obligations for the vendors that work for the association will be required. The affairs of the Association are governed by the Board of Directors, elected by its members. GA Code requires a director to discharge his or her duties in a manner the director believes in good faith to be in the best interest of the Association, and with the care an ordinary person in a like position would exercise under similar circumstances. The legal duties of a Director are: • Duty of Care – must exercise good judgment; includes an obligation to make informed decisions; ignorance is no defense • Duty of Obedience – must comply with the Association’s governing documents and act consistent with goals • Fiduciary Duty – must be loyal to the Association and never use position for personal gain or illegal acts; loyalty includes confidentiality Below is an overview of the role of officers of the Association which are appointed by and consist of elected Board members. Please read the information below carefully and take all the information into consideration before considering a position on the Board of Directors.

OFFICERS OF THE ASSOCIATION: PRESIDENT The president of an association is vested with all the powers generally given to the chief executive officer of a corporation. While specific by-law provisions may vary the president’s duties, it is generally presumed that he or she will preside at all meetings of the board and the membership. The president will execute contracts, orders and other documents in the name of the association as its agent. When signing documents, the president should indicate the capacity in which he or she is signing in order to avoid any personal liability since the president’s signature, under most circumstances, will bind the association under a doctrine of inherent powers. The president also assumes general charge of the day-to-day administration of the association and has the authority to order specific actions in furtherance of the board’s policies. The president serves as spokesman for the board of directors in most matters relating to general association business. Like all officers of the association, the president has an affirmative duty to carry out the responsibilities of the office in the best interests of the

association. Unless otherwise specified in governing documents, the president serves at the will of the board of directors and can be removed with or without cause at any time by a majority of the full board. VICE PRESIDENT The vice-president is vested with all the powers which are required to perform the duties of the association president in the absence of the president. The vice president does not automatically possess inherent powers to act in the capacity of the chief executive officer, and may act for the president only when the president is actually absent or otherwise unable to act. The vicepresident may assume such additional duties as are defined by the board of directors. Often, the vice-president will chair one or more substantive committees like that of architectural review. SECRETARY The secretary of the association is responsible for keeping and maintaining a record of all meetings of the board and the membership and is the custodian for most of the official records of the association. The position of secretary is not simply a clerical position. As the custodian for the minutes and other official records of the association, the secretary is responsible for insuring access to those records by the members of the association and their authorized representatives. TREASURER The treasurer is the custodian of the funds, securities and financial records of the association. When the association has a manager or Management Company that actually handles the funds on a daily basis, the treasurer’s duties will include overseeing the appropriate people to ensure that the financial records and reports are properly kept and maintained. Unless the by-laws otherwise specify, the treasurer is responsible for coordinating the development of the proposed annual budget and for preparing and giving the annual financial report on the financial status of the association. The treasurer does not have the authority to bind the association or the board of directors in dealings with third parties unless the board has provided express authority for the treasurer to do so. As with the association’s secretary, the treasurer does not have to perform the day-to-day record keeping functions of the association when this responsibility is transferred to a management company, but the treasurer will ultimately be responsible for insuring that the financial records of the association have been maintained properly in accordance with sound accounting practices. FIDUCIARY RELATIONSHIP AND RESPONSIBILITY The members of the board of directors and each officer of the association have a fiduciary relationship with the members of the association. This fiduciary relationship imposes obligations of trust and confidence in favor of the corporation and its members. It requires the members of the board to act in good faith and in the best interests of the members of the association. It means that board members must exercise due care and diligence when acting for the community, and it requires them to act within the scope of their authority. The fact that the association is a not-for-profit corporation, or that the members of the board are volunteers and unpaid, does not relieve them from the high standards of trust and responsibility


COMMUNITY NEWS that the fiduciary relationship requires. When a member accepts a position on the board of directors, he or she is presumed to have knowledge of the duties and responsibilities of a board member. Board members cannot be excused from improper action on the grounds of ignorance or inexperience and liability of board members for negligence and mismanagement exists in favor of the association and the property owners.

• Determine the scope of services and monitor

Each board member must recognize the fiduciary relationship and the responsibilities that the board has to the association and each of its members. The board’s duties must be performed with the care and responsibility that an ordinary prudent person would exercise under similar circumstances, and the ultimate responsibilities of these unique positions cannot be delegated to a manager, a management company or other third party.

Operating a homeowner association carries with it many of the very same duties and responsibilities as overseeing any other business. Serving as a board member is a valuable and rewarding experience that should be undertaken by those who see it as an opportunity to serve their fellow neighbors while protecting and enhancing the assets of the community. It is serious business, but also a task worth doing well in order to safeguard the investments of all.

CHASTAIN NIGHT 2017 Hamilton Mill’s annual Chastain Night was on Saturday, September 30 on the soccer field. The weather was perfect, the bands were amazing, the crowd was a riot… what a gorgeous and fun night we had! The “doors” opened at 6:30 pm as Hamilton Mill-iens and guests arrived with food, coolers, and ready to have fun! Some even dressed the part with awesome 80’s and 90’s outfits and accessories. We had a HUGE stage with professional lights and sound provided by Red Rocket Entertainment. Opening for us was a local band from Atlanta called The Haraway Brothers–and they set the mood for the night with original songs from their album “Wish You Love and Luck in the World”. You can find out when they play next and have another listen to their smooth acoustic and steel guitar sounds at harawaybrothers.com. The headliner was Saved by the Band–a party band from Atlanta, with the best set list of music from the 80’s and 90’s! The lead singer, Chris Arrington, was a “dee-lite”-ful entertainer, getting the crowd involved and everyone dancing. With Wes on bass, Matt on guitar, and Jason on drums, Saved by the Band, which was back by popular demand, put on a stellar show with 2 sets of songs we all know and love. The night wrapped up with everyone’s favorite song to sing along too “Don’t Stop Believing!” Follow them on FaceBook to check out upcoming shows or book them for your party or event at pleaserock.com. Angel Tree!

For the past several years we have been lucky enough to help the Gwinnett Department of Family and Children Services, and this year we have 15 foster children who are counting on us to make their Christmas dreams come true. We plan to kick off the Angel Tree season Friday, November 10-Friday, November 17 – just in time for Christmas shopping season! Plan to come by the clubhouse that week to pick your Angel from the tree. All gifts will be due by Monday, December 4. from Jeff Dudacek, Director of Tennis November is here and we are kicking off the winter tennis season. USTA league is first, which is the combination of 2 singles lines and 3 doubles lines. What is interesting about USTA is it involves singles. Even though the flex singles leagues have help, most of Atlanta still play doubles. The strokes are the same in singles but the strategy can be a little different. Since we do play plenty of doubles, a singles match strategy sometimes looks like a doubles match but with only two people. Singles is all you and no one else–there is partner to blame! When you do succeed it is the best feeling. If you are called to play singles this season, check out the tennis tip–it can only help. Having the pro instruct you in the right movements during the doubles play is golden. Once you understand the strokes in tennis, the next step is to improve your position on the court. A better positon on the court improves your strokes. If you have a group or you need to find a group, call the shop or email me and let’s get started on making you a better player. PRO-SHOP NEWS Is your racket more than 5 years old? Do you know what your racket looks like? Has it been over a year since you strung your racket? Is your game or matches the same all the time? It might be your racket. Our games change with the condition of our racket. That is why restringing is important. After numerous play the racket eventually becomes dead. Hamilton Mill pro-shop carries the latest in Head, Wilson and Babolat rackets and strings. Racket demos are free for 3 days for residents. Come down and let us fit you a racket that is right for you, not just the one on sale. Our prices are the same and sometimes better than the big box store and the internet. BALL MACHINE With the crazy weather during the winter or sometimes due to your schedule, you might have one day or afternoon to get on the court before your match. Try the ball machine. It is great work out and you will feel better about your match. It comes with the ball mower to pick up all 200 balls in 5 minutes. The cost $15.00 for the hour and we also have unlimited monthly and yearly rates. Call or email the pro-shop to reserve your time. It cannot be reserved on the court scheduler.

TENNIS TIPS Singles Yes, tennis is not just doubles. Alta even tried a singles league many moons ago but they didn’t have the interest. With the help of the flex leagues, singles is growing. Singles is like the monster in the closet and your singles opponent is in the closet. It can scare you only if you open the closet. If you are sure about your singles strategy then the closet door never opens. Here are few thoughts to keep the door closed.

TIP #6 When in trouble lob the ball. You have to recover to the middle of the court.

TIP #1 Go for high net clearance. This will ensure good depth, which is key in singles.

Playing the percentages also involves taking into account your strengths and weaknesses, your opponent’s strengths and weaknesses, the court surface, and playing conditions. You should stay with a winning strategy and change a losing one! Exploit your opponent’s weaknesses and have fun doing it. Winning a singles match is all you and that is the greatest!

TIP #2 Singles is all about hitting cross court. This should ensure crossing the net at its lowest point and less chance of over-hitting. It also makes it difficult for your opponent to angle a ball away from you.

TIP #7 When called to play singles be positive and except the challenge.

TIP #3 If your opponent doesn’t have a week stroke, aim your approach shot straight ahead. This will ensure minimal opportunities to use angles on the pass. TIP #4 Just like in doubles, plan to hit two volleys to win the point. TIP #5 Get your first serve in, aiming for placement rather than power. This will save you energy and the threat of the opponent moving in on second serves.

David Aldrich and Jimmy Mongilo opened the Trackside Tavern in the summer of 1982. Eddie Owen started working there part-time in 1983 and worked at Trackside Tavern until he opened Eddie’s Attic in 1992. During his time there, the owners allowed him to book songwriter’s rounds and shows, during the weekdays, starting in the mid-1980s. Trackside Tavern became a “hang” for local songwriters and musicians, and a “close knit community” was birthed! There were no cover charges. The writers and players were paid with a sandwich and beer and some of the tips from the tip jar. Some of these folks play in very large rooms and spaces these days. Some have ceased playing shows all together! On November 11, there’s gonna be a “reunion” for some of them at the Red Clay. As the confirmed list grows, we’ll share that with yall.
