Supreme Court ruling brings mixed response BY JOHN GOLDEN jgolden@westfairinc.com

T

he U.S. Supreme Court’s 5-4 ruling that upheld the Affordable Care Act’s mandate on individual insurance coverage by 2014 was received in Westchester and beyond with praise mixed with sharp criticism, business-as-usual shrugs and warnings of reform work yet to be done. With the landmark ruling behind, many in the health care and insurance industries said they are focused on the details of the state health insurance exchange taking shape this year. In the wake of the long-awaited ruling, “I think it’s sort of business as usual,” said St. John’s Riverside Hospital spokeswoman Denise Mananas in Yonkers. “We were working toward (implementing) the law as though it was going to be upheld.” “Since Thursday (when the Supreme Court ruled),” said Supreme Court, page 6

“I

t’s a little tough,” said Steven K. Oto, nodding at the stacked cartons and rising display cases of comic books, action figures and Pokemon cards at his Alternate Realities shop in a Central Avenue strip mall on the edge of Scarsdale. “Too much merchandise and not enough customers.” It’s a complaint common to small business owners in recent years. At Alternate Realities, a 20-year-survivor in a shrinking retail market threatened by the dark forces of monolithic bookstore chains, declining readership and digital comics on iPads, it’s that kind of comment from the owner that has shop regulars regularly asking: Will he renew the lease? “Every five years, it’s the same question,” said Anthony Desiato, a recent Pace Law School graduate enjoying a few hours of truancy from his daily cramming for the state bar exam this month. A 25-year-old Hartsdale resident, Desiato got hooked on comics at 5 on a trip to the Galleria in White Plains – a miniature “Death of Superman” action figure, complete with coffin, ignited the collector’s passion – and in high school started part-time work in the narrow-aisled, 1,500-square-foot (by the landlord’s measure; by the tenant’s, more like 1,400-plus) comics and cards store in Acropolis Plaza in the town of Greenburgh. “One day I was shopping here” – Desiato mainly collects graphic novels – “and Steve asked, ‘How’s your alphabet?’” “I don’t actively go out and hire,” said Oto, whose best hanging-out customers – and brightest, to judge from the master’s degrees and PhDs among them – have become one- or two-day paid employees. A youth with alphabetizing skills – an essential task in a well-organized comic-book shop – is not easily found, according to Oto. So Desiato was recruited. “It’s really been the first and only job I’ve had,” said Desiato, who mined Alternate Realties and its presiding dispenser of “Otoisms” for highly graded stories

as an undergraduate journalism major at Fordham. “In addition to being my place of employment, this has been an endless source of inspiration for me.” Two summers ago, Desiato was inspired to duck the corporate internship expected of a law student and seek “a creative outlet” in filmmaking on familiar ground. At his own expense and with no prior training, he would make a documentary of his local employer and comic shop, shattering stereotypes of comic-shop habitués and making its shop subculture accessible to a non-comics-reading, movie-ticket-buying public. Desiato bought a Canon camera and light and sound equipment and produced 45 hours of film. “It was definitely trial by fire,” he said. “It was an incredibly intense summer, but very rewarding.” The edited 80-minute result, “My Comic Shop DocumentARy,” will be shown at 7:30 p.m. July 16 at Jacob Burns Film Center’s Media Arts Lab in Pleasantville. A questionand-answer session with the bar-cramming documentarian will follow. “It’s very much a story of this store,” said Desiato, who still is trying to find a theatrical distributor after screenings at five film festivals. “It’s about Steve and his unlikely journey and about the very colorful community and cast of characters that have assembled here over the years.” Some of those characters Desiato tracked home to the man-caves where their collections hold dominion. “It’s pretty intense,” he said. “Even more challenging” than making the film “has been getting the film out there” into distribution. “It’s extremely competitive. It’s a lot of waiting for a response. It definitely tests your patience.” Though his documentary has been shown at festivals from New York City to San Diego and from Buffalo to Phoenix, “Unless it’s like Sundance or Tribeca, one of the really big festivals, distributors aren’t there to pick up movies,” he said. Desiato is not willing to give away his product on YouTube or other free, popular websites. “If I self-distribute, I could still monetize it. Just putting it out there for free

would not be my top choice.” The 56-year-old Oto’s journey to the shop on Central Avenue took him from a bilingual Japanese-American home in White Plains to political science studies at Yale University – where a 25-cent comic-book purchase had him “hooked again” after years of collecting abstinence – and to law school in Albany. “I hated law school,” he said behind the shop counter. “I hated all three years, and I tried to discourage him” – with a nod to Desiato – “from doing it.” Oto for several years was a real estate attorney at a Manhattan firm, often representing Japanese corporations in residential purchases. “I always had a dream of opening a comic book store.” His opportunity came in 1992, when he teamed with friends in the comic collectors’ world to start Alternate Realities. Oto was the venture‘s moneyman, investing about $30,000. “It would cost about $100,000 to start it now,” he said. “Back in the early ‘90s, the market was booming. Like me, everyone who was a comics collector thought, wouldn’t it be cool to open a store.” Many who did open stores lacked business acumen to match their collecting passion and adjust to economic cycles. “Westchester had about two dozen baseball card-slash-comic book stores in the early ’90s,” Oto said. “Today, I’d say there are about half a dozen. Back in the ’90s, every little town in Westchester had something.” “There used to be 5,000 stores in the country. Today there are maybe 3,000.” Of the survivors, Alternate Realities has ranked 105th nationally in volume of product ordered from the industry’s chief wholesale supplier, Diamond Comic Distributors Inc., putting the Scarsdale shop, as Oto noted, in the top 5 percent of independent retailers. “There are very few young people reading,” said Oto, whose typical customer is “an adult male from 20 to 60.” “Comic book sales have dropped significantly …Nowadays a press run of over 100,000 is cause for celebration.” In May, only the top three of Diamond’s 100 top-selling comics had more than

100,000 copies sold. The industry’s largest publishers, Marvel Comics and DC Comics, continue to dominate sales. Oto sees a near and deadly threat to retail businesses like his in a move of readers to digital comics. “I think iPad is going to affect us detrimentally,” he said. Comic book stores could go the way of record stores. “Maybe in five to 10 years, there will be a big change in the industry – sort of like CDs are no longer around,” he predicted. Comic publishers already offer the digital option to readers, while assuring independent retailers of their close, continuing partnership, said Oto, speaking of an industry conference he attended. “They’re getting ready to cut us at the knees and we’re like lambs going to slaughter.” “One thing you can’t get online is the sense of camaraderie you get here,” Desiato said. “This is almost like a family hangout,” Oto said. “You get to know them so well. You go out to dinner with them” – on Saturdays, at Mickey Spillane’s – “you go to their weddings.” About 10 years ago, Oto hedged on his alternative career and returned to law practice doing insurance litigation on Wall Street. He worked at the comics shop on weekends. “I was involved with a woman who said I didn’t make enough here for us to have a future.” So the owner took a better-paying job with a law firm. “But she dumped me a week before I started with the firm,” said Oto. He practiced insurance law for a year before returning to Alternate Realities. So, despite the gloomy business prognosis, will he renew his lease at Acropolis Plaza? That’s the open question with which “My Comic Shop DocumentARy” ends. His five-year deal expired June 30, but the tenant apparently worries more than his landlord about not having a current lease. “He said, ‘You can stay here the rest of your life,’” Oto said. Oto in the interim paid his rent for July. After 20 years, he did not sound eager to sign over his business to a new owner. “I’m afraid someone else would run it into the ground in a year,” he said.

John, Re your recent story on Wilson Kimball, be advised that the Inspector General (IG) report did not result in my early retirement. I retired from the Battery Park City Authority in October of 2010, having attained 30 years of service in the state retirement system and having announced my intention several months earlier, as covered by the lower Manhattan press. Most people retire once they reach 30 years, because you stop accruing full benefits going forward. Also, be advised that Wilson Kimball was never docked five days’ pay or in fact penalized at all, as a result of the IG report. It would be nice to get a correction on these two items. A little context about the report itself: In releasing his report only after my retirement, the IG attempted to make it look like it was the reason for my leaving. Indeed, his press release is artfully worded to imply that sentiment. But it does not actually say it, because it cannot. The report also states that there were allegations of fraud and corruption etc., which you repeated. But in a footnote to the report the IG acknowledges there was no evidence of any of that. By stating that “no criminal charges were brought,” you are being accurate, but also conveying an impression that there were indications of wrongdoing somewhat short of that. In fact, by the IG’s own admission, those allegations of fraud and corruption were completely unsubstantiated. Admittedly, you have to look at the fine print to see that, which is among the many reasons the report is so dishonest. The report is an unfortunate one, in that it was the result of three years’ work and nearly $1 million in expenditures by an Inspector General who was convinced laws were being broken when they were not. Despite his efforts to justify the expense, the report finally cited not a single violation of law, procedure or policy. Tellingly, it did not include an acknowledgement of the extensive rebuttal submitted by the persons subjected to the investigation.

Westcon Group acquires Afina for $62.5M BY PATRICK GALLAGHER pgallagher@westfairinc.com

arrytown-based communications services, data security and data center provider Westcon Group acquired the Afina Group as part of a July 2 deal valued up to 50 million euros, or about $62.5 million. Afina, which is based in Madrid and has its U.S. headquarters in Miami, is a distributor of data security software in addition to providing data center services, and has strong roots in Latin America, the Caribbean and parts of Europe and North Africa. With 400 employees based in 12 countries, Afina expects revenue for its current fiscal year to approach $300 million. Westcon spokesman Craig Librett called the deal “a very big win for us,” saying it allows the company to extend its reach into new markets and to form stronger relationships with the various software vendors it partners with.

Librett said Westcon specializes in giving software developers access to markets in which they were previously unable to secure a foothold.

Afina was acquired through a deal that involved Westcon parent company Datatec Ltd., based in South Africa, buying GLS Software S.A. from Araguaya S.A. Westcon is a private holding of Datatec, while Afina was a holding of GLS Software. Datatec will pay Araguaya 30 million euros in cash, 10 million euros in Datatec stock, which is traded on the London Stock Exchange and the Johannesburg Stock Exchange, and another 10 million euros in cash contingent on Afina meeting certain performance goals.

Reader’s Digest pares down

The Reader’s Digest Association Inc.(RDA), formerly based in Chappaqua, has sold most of its Lifestyle and Entertainment Direct business to Mosaic Media Investment Partners L.L.C. RDA officials said the deal allows the company to focus on its strategy of simplifying the organization’s structure to drive greater profitability and growth in its two core media and direct marketing businesses. The sale includes Direct Holdings Americas, Saguaro Road Records and many of the assets of Direct Entertainment Media Group. Terms of the sale were not disclosed. Based in Chappaqua since 1939, Reader’s Digest in late 2009 announced plans to leave its landmark office campus with about 650 employees and move its corporate headquarters to midtown Manhattan as part of a bankruptcy restructuring. More than 500 employees were relocated in 2010 to RDA’s new Westchester County office at 44 S. Broadway in downtown White Plains.

Transportation bill approval could help TZ funding BY PATRICK GALLAGHER pgallagher@westfairinc.com

B

usiness advocates and elected officials said a bipartisan, $127 billion transportation bill passed by Congress June 29 is a step in the right direction, but still puts off the question of how federal transportation programs will be funded in the coming years. New York state officials and members of Westchester’s congressional delegation applauded the measure, which they say preserves tens of thousands of construction jobs statewide while slightly increasing the state’s share of federal highway and transit dollars and boosting chances of securing Transportation Infrastructure Finance and Innovation Act (TIFIA) financing for a new Tappan Zee Bridge. After months of deadlock between Senate Democrats and House Republicans, a conference committee reached an agreement that extends federal highway and transit funding through October 2014 and that prevents student loan interest rates from doubling for at least another year. Also included is a provision that significantly increases funding for the federal TIFIA loan program, from $122 million to $750 million in the 2013 fiscal year and $1 billion in the 2014 fiscal year. The federal fiscal calendar runs from Oct. 1 through Sept. 30. Had an agreement not been reached, federal highway and transit aid programs and the federal government’s authority to levy fuel taxes would have expired June 30, and student loan interest rates would have increased from 3.4 percent to 6.8 percent on July 1. New York State Department of Transportation Commissioner Joan McDonald said in an email that the bill “will bring stability to New York and states across the country by enabling long-term transportation planning.” The bill provides New York with $3.3 billion a year in highway, bridge and transit funding from October 2012 through September 2014, McDonald said. While the state’s share of federal highway funds, currently $1.625 billion a year, will not significantly increase, transit funds will increase from $1.23 billion a year to $1.43 billion starting this October and to $1.45 billion in October 2013. Reps. Nita Lowey, a Harrison Democrat, and Nan Hayworth, a Mount Kisco Republican, voted in favor of the measure, which passed the House 373-52 and the Senate 74-19. Both said that it will help

to boost jobs in the region’s construction industry. Hayworth said that while she was pleased with the bill as a whole, she had hoped to include a provision to allow construction on the proposed Keystone XL pipeline. House Republicans ultimately conceded on that issue as the deadline for extending transportation funding approached, but Hayworth said it would have provided much-needed revenue. About two-thirds of the bill will be paid for by the 18.4 cent-a-gallon federal gasoline tax and the 24.4 cent-a-gallon diesel tax, with an estimated $19 billion coming from the national general treasury. Critics contend that the fuel tax is no longer an acceptable means of funding federal transportation initiatives. The fuel taxes are not indexed for inflation and haven’t been increased since 1993, causing revenue to fall significantly. Since 2008, Congress has drawn on treasury funds on three occasions to keep transportation programs running, borrowing a total of $34.5 billion, according to The Associated Press. “We had hoped in the House ... to bring the Keystone pipeline online, anticipating that that would provide substantial revenues,” Hayworth said. “I thought that was a great solution, but we could not get the president’s cooperation on that plan and that does reduce our opportunities for the longer term, trying to be fiscally responsible.” Ross J. Pepe, president of the Construction Industry Council of Westchester and Hudson Valley Inc., said area contractors and laborers had hoped for something longer than a 27-month extension of the federal transportation funding programs, but added the measure should kick-start the industry and spur job creation. “(The bill) restores some confidence in the public with respect to federal government investments in infrastructure. And now it’s time for them to move onto a longer-term measure in a bipartisan way that can create new funding revenues in a transportation program that has needed innovation,” Pepe said. Marsha Gordon, president and CEO of The Business Council of Westchester and president of BuildTheBridgeNowNY.org, a coalition representing more than 300,000 employees and more than 15,000 employers, said the bill “is a huge boost” for the Tappan Zee Bridge project. “This enhances the Tappan Zee’s chances of being competitive for greater amounts of funding,” she said.

You’ve written your business plan and completed your marketing plan. You’ve memorized your elevator pitch and registered your business under the appropriate business structure. Your product or service has been perfected and is ready for the market. Have you forgotten anything? Oh, that’s right: Money, Moolah, Scratch. Whatever you call it, your business needs capital! Financing is one of the most important aspects of your business. The ability to raise adequate capital may determine the fate of your business. According to the U.S. Small Business Administration, while poor management is cited most frequently as the reason businesses fail, inadequate financing is a close second. Many times it comes down to cash flow – companies have closed their doors because they couldn’t continue operations for another few months until the money came in. Before you start, you must take a careful look at the type and amount of capital you need. Then, you must decide how you are going to finance the capital needs of the business. Last, but not least, you have to determine a source for the capital at an affordable cost. There are five questions you should ask to determine how much capital is needed: • How much do I need to start the business? • Do I have personal funds/assets to finance the start-up phase? • Do I have family or friends who are willing to invest in the business? • Do I have personal credit that will allow me to obtain lines of credit? • Do I have relationships with any financial institutions? There are two types of capital: START-UP: money needed to initially get the business on its feet – this might include capital for acquiring/leasing real estate equipment or for inventory. WORKING CAPITAL: money needed for the day-to-day operation of your business. How much working capital you need depends on the type of business you have. Fundamentally, there are two types of business financing: DEBT FINANCING – borrow the money and agree to pay it back at a stated interest rate. Many businesses

are funded with debt financing. If you pass the requirements of the lender, you may be able to obtain a termloan or line of credit. Factoring can also be a debt financing solution. Factoring is typically the most expensive option but depending on your situation (new business, seasonal sales) it may be the best or only choice. • The benefits/detriments – you don’t have to give up ownership and it is available to companies that can’t get equity financing. However, you must pay interest, and the lender will likely require personal guarantees. EQUITY FINANCING – sell partial ownership of your company. While debt financing is most common, there are thousands of companies financed each year by private or “institutional” investors in exchange for an equity ownership stake. They range from ‘friends-and-family’ to angel investors and venture capitalists. • The benefits/detriments – friends and family: convenient, no-nonsense and available quickly. An investment group led by the Satows, Nutrition 21 Acquisition Holding L.L.C., closed on the $7.5 million purchase Nov. 22, 2011, acquiring all of the company’s assets, including more than 70 patented nutritional supplement ingredients. Nutrition 21, which had been publicly traded on the Nasdaq stock exchange, declared Chapter 11 bankruptcy in White Plains last August, listing $122.8 million in liabilities and fewer than $7.2 million in assets. up their insurance exchanges. At The Business Council of New York State in Albany, President and CEO Heather Briccetti dismissed the Supreme Court decision as having “little immediate impact on the health insurance issues affecting New York state employers.” Nothing in the ruling “helps ‘bend the cost curve’ or addresses the issues driving health care costs and utilization in New York state, which make the state one of the most expensive health insurance markets in the nation and a tremendous burden on large and small employers,” she said. Briccetti and others commenting on the court ruling noted that New York already has adopted a number of mandated reforms and expanded Medicaid coverage that are part of the Affordable Care Act. “Unlike many of our sister states, we have already seen how dozens of mandates have dramatically driven up costs and limited choice in the marketplace in our state,” Briccetti said. The Business Council will work to ensure that New York’s health exchange is developed with input from insurers, agents, brokers, chambers of commerce and employers, she said. At the New York Health Plan Association in Albany, which represents managed health care plan insurers, President and CEO Paul F. Nothing to date has really addressed the affordability issues.” In the wake of the Supreme Court ruling, the Westchester County Medical Society issued some of the most forceful criticism of the law

that justices by a narrow margin upheld. In an editorial letter, Dr. Thomas T. Lee, president of the county society, said the methodology used under the law to achieve the laudable goal of universal coverage is “unrealistic and unsustainable.” Fully implementing the Affordable Care Act “will harm access to patient care,” he said. In a webcast hosted by the Westchester County Association, Keith Safian, president and CEO of Phelps Memorial Hospital Center in Sleepy Hollow, said while the court ruling “at least gave us some clarity about going forward,” the insurance mandate does not apply to the illegal immigrants that make up a sizable part of the county’s labor force and are regularly treated at Westchester hospitals. While losing money treating uninsured patients, hospitals also are inadequately reimbursed by the government for Medicare and Medicaid patients, Safian said. And health care providers face an additional $150 billion in Medicaid cuts as part of the Affordable Care Act, he said. Schutzer said insurance brokers at firms like his question whether their services will be needed by individuals and small businesses shopping in the state health exchange. “Now more than ever, our clients need us,” he said. “There are so many regulations coming through in the next 18 months, our role has changed. It has changed forever. I like a new role.” “It’s full steam ahead,” Schutzer said.

The real potential, though, is in the drug development business, Satow said. “Given our pharmaceutical background, some of the patents and compounds that the company owns, we feel, are suitable as drug candidates,” he said. Satow said JDS Therapeutics L.L.C., which is owned by the Satows and is the parent company of Nutrition 21 L.L.C., is proceeding with two projects with the intention of developing them into drugs. “I believe it’s something new,” Satow said, adding that to his knowledge,

Nutrition 21 did not seek to enter into the drug development business. “I don’t believe they had done it before, but they certainly laid a good groundwork for some of these assets as potential drugs. Based on that work we’re going to move them hopefully forward from where they are.” While Nutrition 21 does not own manufacturing facilities or research laboratories, it develops all of its products in-house, Satow said. “The conceptualization of the product, the initial testing, those kinds of things are done by us,” he said. Satow said manufacturing is contracted to outside sources, but it all takes place in the U.S. He also said more than 75 clinical studies have been performed on Nutrition 21 products by universities and research institutes. Nutrition 21 has added several employees since the initial acquisition, bringing the total staff to 16, Satow said. “And we’ll be adding additional employees next year,” he said, and upgrading its office space at The Centre at Purchase to accommodate a larger staff. The company is located at 4 Manhattanville Road and plans to move to 3 Manhattanville Road in August.

Frito-Lay reaches high, low on snack shelves

F

or more than 50 years, Frito-Lay in Purchase has ruled the business of snack foods by making the potato chips, pretzels, corn chips, tortilla chips and cheese-flavored snacks that appealed to just about everyone. But times change and tastes change and those middle-market snack foods are being abandoned in favor of fancier, if not healthier, snacks at the premium end of the market. The $22 billion salty snacks market is losing sales, according to Goldman Sachs, but the $2 billion premium end has averaged about 7 percent annual growth over the last two years. At the lower-priced end of the market, Goldman Sachs has forecast 4 percent yearly growth for the next few years. In the middle market, only 2 percent annual growth is expected. Frito-Lay’s response to these projections? Not surprisingly, to focus on the top and bot-

tom of the market. “They’ve been moving that way anyway,” said Caroline Levy, analyst at Calyon Securities in New York City. “The Sabra joint venture, they’ve had that a long time, they’ve built a plant on the East Coast,” in Virginia in 2010. Sabra Dipping Co., the kosher and vegetarian hummus maker, in 2008 was acquired in a joint venture by the Frito-Lay division

of PepsiCo and the Strauss Group, the second largest food and beverage company in Israel. Started in Queens, Sabra, the world’s largest manufacturer of hummus, relocated its headquarters to White Plains to be closer to its parent PepsiCo in Purchase. The Sabra business was expanded from North America to markets around the world in 2011. In another move beyond the salty-snacks

market, PepsiCo formed a global nutrition group in October 2010 to develop more products made with fruits, vegetables and whole grains. Levy said growth in snack foods is going to have to come from sources other than the traditional ones such as volume. “Volume is going to be less of a growth driver than in the past because the government is trying to crack down on big portion sizes. So it makes complete sense to premiumize their portfolio,” she said. “Higher price per ounce is going to be the theme in the food and beverage industry in the U.S.” Levy said she thinks PepsiCo will try to make more acquisitions like Stacy’s Pita Chips, which it bought in 2006. Ali Dibadj, analyst at Sanford C. Bernstein & Co. in New York City, agreed that “premiumizing” is a good idea. “The struggle that Frito-Lay has is that its products are stuck in the middle, they don’t have appeal at the low end or the high end of the market, and at the high end a lot has to do with healthier, organic, natural snacks,” he said. “They’ve gotten into it a little with Stacy’s Pita Chips. And these are typically higher margin products.” Dibadj added that it’s not just making the products, but how they are marketed that will determine if PepsiCo is successful with this strategy. “They can do it. It will take some learning, though. It’s marketing in a different way. It’s not ‘big bang, taste this thing,’ it’s more health conscious, marketing to the premium consumer. People’s tastes are changing.” Or are they? Harry Balzer is chief food industry analyst at the research firm NPD Group in Port Washington. “There is a desire, whether it’s 1900 or 2000, to try new flavors, that’s the spice of life,” he said. “People will try something because it’s a novelty, but if novelty is the only thing it offers it won’t be around long term. If it’s a time savee or a money saver, it’ll be around for a while.” Balzer said the real change is that snack foods are more and more being eaten at the main meal. “Fifty percent of snacks are being consumed as part of a main meal,” he said. “Think of the chips you get with a Subway sandwich.” Balzer, though, noted It is difficult to get growth in the food business. To get growth you have to take market share from somebody and Frito-Lay, they have the power of distribution, advertising power, money and other resources.” Levy said Frito-Lay might find competition at the low end of the market from grocers’ private-label brands. “Supermarkets are starting to make their own brands of chips. Kroger has done very well with their privatelabel potato chips. They’re trying to move toward where the consumer is.”


Insurance premiums to grow in 2012, says Swiss Re BY JANICE KIRKEL jkirkel@westfairinc.com

T

he insurance industry can look forward to moderate premium growth in 2012, with emerging markets showing strong growth in non-life premiums and a recovery in life insurance premiums. Developed countries should show moderate expansion in non-life premiums. But record low interest rates will remain a challenge for the entire industry. Those are the findings of the latest study by the Swiss Re Group, the Swiss-based wholesale provider of insurance and reinsurance with U.S. headquarters in Armonk. The study also looked back at how insurance markets worldwide performed in 2011. Non-life premiums rose 1.9 percent last year because of stronger economies in emerging markets and rate hikes in certain developed countries. Life insurance premiums, meanwhile, fell 2.7 percent, with the sharpest declines in Western Europe, China and India. Growth resumed in the U.S. The worldwide drop in life insurance premiums was mainly caused by a few large markets where premiums tumbled. “In non-life, we had some growth, strength in the emerging markets, and some small turnaround in pricing in the motor business (car insurance) in Europe,” said Kurt Karl, Swiss Re’s chief economist. “But we had a decline on the life side because of two big emerging markets, China and India, where there were regulatory changes.” Those changes, said Karl, meant that banks were more restricted in how they could sell life insurance. “That meant that sales fell pretty dramatically. China is quite large in terms of life insurance premiums in the global economy.” Those regulations led to an overall decline in emerging market life premiums of 5.1 percent. But other emerging regions such as Latin America and the Middle East showed continued growth, even though very little life insurance is sold in the Middle East compared with other emerging markets. In the U.S., premiums from new life insurance business recovered, mainly because of strong demand for variable annuities with guarantees. Meanwhile, in Western Europe, life insurance premiums fell sharply. Those premiums are driven by macroeconomic factors, and Europe’s economies in general are more macro-driven, said Ming Zhu, analyst at Canaccord Genuity in London. “As an example,” she said, “in Italy, life was down 20 percent, non-life was down 2 percent, because life is driven by what’s going on (the economic problems) in Italy. The bank bailouts affect it. In the U.S., though, life has gone up about 3 percent. That’s because the impact from macroeconomic factors is

smaller in the U.S. than in Western Europe.” Life premiums were down 7 percent last year in Germany but only 3 percent in Great Britain “because they’re not in the euro zone, there is not the same currency risk,” said Zhu. Growth in non-life premiums was concentrated in the emerging markets at 8.6 percent, driven by strong economic expansion. But the recession in Europe and the still weak economy in the U.S. cut into demand for insurance there. “There is uncertainty about the economic outlook,” said Karl. “Savings products have been quite soft in Western Europe and the U.S. Countries like China and India watch develop-

ments in the global economy, they saw stress in savings products, and decided the prudent course was to tighten up regulatory requirements,” he said, explaining how conditions in developed markets affect emerging markets. Growth in non-life premiums also was driven by natural disasters, said Karl. “Last year was quite a heavy catastrophic event year. In Asia we had a turnaround in pricing because of tornadoes, and the earthquake in Japan. The floods in Thailand were important for business continuity insurance, to insure businesses against interruption.” Karl said that because of the Thai floods,

many suppliers to large corporations had their operations washed out and could not deliver key parts to North America and other parts of Asia.”That’s how tight inventories are these days,” he said. “That’s especially true in the auto parts industry, which is big in Thailand.” The Swiss Re study noted that the insurance industry will have to contend with record low interest rates again in 2012. “That’s a challenge for the industry because part of its profit is from investment income,” said Karl. “Premiums come in, there may be a catastrophe later, but in between you hope to get some investment yield.”

Integrate lead generation with sales When we’re recruiting for sales, I find that people get scared off when we tell them they have to generate their own leads. I have only two or three people on the sales force who make enough calls per day. The rest slack off and wait for me to give them leads to follow up or live in hope they’ll pick up something through networking. What should I do?

Thoughts of the day: There’s no school out there to teach people sales like there is for engineering or nursing or general business or any other professional discipline. Finding good salespeople – at any level from entry to experienced – is a process of looking for a needle in a haystack. Building a leadgeneration program to supplement what salespeople can come up with on their own is smart business. Ultimately, you want people who are motivated, smart and willing to show initiative to master the job they signed up for. Sometimes, people are just not made for this job. But don’t write them off because they don’t have much sales experience. Develop a training program within your company. Just like in school, create a syllabus for the program that outlines what you will cover and what your salespeople can expect at each session. Ask your senior sales managers to work together to create this program. Every manager or executive has a story about a prime sales candidate, after investing money and time on training, this person turns out to over-promise and under-deliver. Often, we spend too much time focused on the “potential” that someone has, rather than accepting the reality. Sales is hard, but you hired these people to do exactly that, sell. Don’t be blindsided by a fancy résumé. Hire your salespeople on a probationary level, set a date for performance review and at that time if they’re not performing, it’s time to cut them loose. There are people out there who would kill for the job, so be tenacious. Building a lead-generation program to supplement what salespeople can come up with on their own is smart business. Come up with measurable qualities that your customers need to have in order to be considered

viable prospects. Whatever your parameters may be, if your lead-generation program is working correctly, these prospective clients will qualify themselves. You will be able to funnel a large amount of prospects and turn them into a list of qualified sales leads. This ensures that you always have quality prospects and have a big enough pool to choose great customers rather than mediocre ones. If you want to take your company to the next level, choosing your customers has to be a number one priority. In the beginning it

was about quantity, but now, your sales team has to know that quality customers are more important. With a great lead-generation program in place, it will be easier to develop a large, quality driven, customer base. Ultimately you want people who are motivated, smart and willing to show initiative to master the job they signed up for. But know when to cut them loose. Salespeople need to have drive, but this is not something that you can teach. If you interview someone who has all the qualities of a great sales person, drive, enthusiasm, ability to sell ice to an Eskimo, etc., but they’re lacking in the experience department, give them a chance. harmaceutical giant GlaxoSmithKline plc agreed to a $3 billion settlement with the federal government, 43 states and the District of Columbia on July 2, in what officials called the largest health care fraud settlement in U.S. history. As part of the settlement, New York state’s Medicaid program will receive $146 million and Connecticut will receive $11.1 million. The settlement resolves charges that GSK

violated U.S. law in the marketing and pricing of drugs it manufactures, including antidepressants Paxil and Wellbutrin and the diabetes drug Avandia. New York State Attorney General Eric Schneiderman called GSK’s misconduct “breathtaking in its scale and scope.” He applauded the settlement, saying that GSK “will now be held accountable for putting corporate profits ahead of the safety of the public.” GSK, which is based in London and has U.S. corporate offices in Philadelphia and

NYPA approves $30M grant program The New York Power Authority July 2 approved a $30 million fund to advance development and the commercialization of new energy efficient technologies, Gov. Andrew Cuomo announced. The grants will be disbursed over a five-year period under NYPA’s new Energy Efficiency Market Acceleration Program. The program will focus specifically on the development of commercial energy efficiency products. NYPA President and CEO Gil C. Quiniones said in a statement that the pro-

gram will “advance New York’s technology leadership in this important industry and create clean energy jobs throughout the state.” Based in White Plains, NYPA is a public benefit corporation and is among the largest public power providers in the U.S. Under Cuomo’s Power NY agenda, NYPA will also finance $450 million in cost-effective, energy efficiency projects over the next four years.

North Carolina’s Research Triangle, agreed to pay a total of $2 billion in damages and civil penalties and $1 billion in criminal fines and to plead guilty to federal criminal charges for misconduct related to drug labeling and U.S. Food and Drug Administration reporting. The U.S. Justice Department and state attorneys general charged that GSK unlawfully marketed several of its drugs for uses not approved by the FDA, made false representations regarding the safety and efficacy of certain drugs, offered kickbacks to medical professionals and underpaid rebates owed to government programs for various drugs paid

for by Medicaid and other federally-funded health care programs. The final settlement was reached in principle last November, GSK said in a statement. The investigation was initiated in 2004 by the U.S. Attorney’s Office in Colorado. “Today brings to resolution difficult, long-standing matters for GSK,” GSK CEO Sir Andrew Witty said in a statement. “Whilst these originate in a different era for the company, they cannot and will not be ignored. On behalf of GSK, I want to express our regret and reiterate that we have learnt from the mistakes that were made.”

O

n the eve of the Fourth of July holiday, White Plains architect Norman DiChiara had a long, busy workday ahead. It began with an early morning appointment in Bronxville with a client in the restaurant industry with whom the architect is in negotiations on a project. At Norman DiChiara Architects P.C., the full schedule of client meetings and projects is not unusual, despite the major blow dealt architectural firms in the recession and the continued stagnant commercial real estate market in Westchester County and the region. DiChiara’s business volume, though, seems more exceptional than a sign of a widespread rebound in the large and highly competitive community of architects in the county. “It’s spotty,” he said of the available commercial work here for architects four years after the recession. “I still think that the industry as a whole, based on my conversations with colleagues, is still not as healthy as me.” Nationally, the U.S. Bureau of Labor Statistics has forecast a 24 percent increase in employment for architects in the decade from 2010 to 2020, when 141,600 architects are expected to be employed. But that increase is based on employment levels in 2010, when the labor statistics bureau found

113,700 architects at work. Two years earlier, more than twice that number, 230,000 architects, were employed in the months prior to the recession, according to federal statistics. Since 2008, the architectural industry has declined by 40 percent, said DiChiara, who was a principal at an interior design firm in Manhattan before starting his company in his native Westchester in 1991. Westchester County, with 810 statelicensed architects at the start of this year, trails only Manhattan and Brooklyn in numbers in the profession in the state. “There are a lot of very good architects in Westchester County and clients have a lot of choices,” DiChiara said. And architects have fewer projects and often reduced fees in a commercial office market with declining rents and tighter landlord budgets. “It didn’t get that way for me (a 40 percent loss), but when things went south in 2008, everyone pulled back, myself included,” DiChiara said. “It took about a year for some of my steady clients to get a little more confident and continue on their efforts” with building projects. As construction and commercial leasing came to a virtual standstill, a health care client, Lenox Hill Hospital in New York City, “was my lifeline, so to speak.” Building projects at the hospital, where DiChiara’s is one of two architectural firms under contract, sustained his business for about two years.

turned to DiChiara. Those connections have brought him work at three or four Saks Off 5th stores from Chicago to Woodbury Common Premium Outlets in Central Valley. Big-box doors that have closed to customers and contractors like DiChiara are reopening under new owners. Michael’s Arts and Crafts, a company expanding into former Linens ’n Things locations, repeatedly seeks DiChiara’s assistance when building out retail space with which he is familiar. “That’s worked out extremely well for us,” he said. DiChiara has a growing list of restaurant clients, including the Brazen Fox and Ron Blacks in downtown White Plains and Hudson Grille locations in White Plains and Stamford, Conn. Two new restaurants and bars opening in White Plains, Butterfield 8 and Lola’s, also are his clients. Architects once could rely on Westchester’s robust corporate office market for work. Since 2008, “It’s a lot more difficult on every plateau,” said DiChiara, “from the owner’s perspective, from the broker’s perspective.” With rental rates declining and more vacant space, money available for tenant fit-outs from building owners “is at a point I’ve never seen in all the years I’ve been doing this.” The architect’s fixed fees of 10 years ago no longer hold. With landlords’ revenue down, “They take it from every avenue that they can,” he said.

Development of both inpatient and outpatient medical centers – DiChiara has designed both – is expected to help drive the revival and reuse of commercial office properties in Westchester. “The medical has been on the radar for 30 years,” he said. “Right now, it’s getting close to its peak.” DiChiara in his 11-employee business moves regularly between market niches, from hospitals to restaurants to retail stores to corporate office interiors. “That’s the key to our success, that we are extremely diversified,” he said. “That’s intentional. We’re in a couple good market niches. When one declines, the other seems to get more active.” In the recession, “My retail stopped.” But the architect has since worked on retail projects for Urstadt Biddle Properties Inc., the Greenwich, Conn. developer, as the company has bought a string of shopping centers in Westchester and the region at reduced distressed-property prices and refurbished them. Before the recession, DiChiara had eight to 10 accounts with national retailers that included Foot Locker, Linens ’n Things and Kay-Bee Toys. The architect did about 300 rollouts at Linens ’n Things stores. “That has died,” he said. “Most of those national retailers are no longer in business.” But project staff from those companies moved on to other retailers, where they again

Weather, economy have chilling effect on HVAC firms BY PATRICK GALLAGHER pgallagher@westfairinc.com

ud Hammer, president and owner of Atlantic Westchester Inc., thrives on extremes – extreme temperatures, that is. “Being an air conditioning and heating service company, we always look forward to extreme weather conditions because it means we get busy,” Hammer said. This year, however, the mild winter and spring have combined with lingering economic conditions and a high vacancy rate to hurt commercial heating, ventilation and air conditioning (HVAC) firms like Atlantic Westchester. Based in Bedford Hills, Atlantic Westchester’s offerings include HVAC system design and installation, maintenance, upgrades and repairs, and energy audits that can show property owners how they can improve their system’s efficiency. Founded more than 50 years ago, the company exclusively services commercial properties and institutional properties, such as schools or municipal properties, working primarily in Westchester and Putnam counties, Fairfield County, Conn., and parts of New York City. Hammer said his company is aggressively

marketing its energy benchmarking service, which can help to show property owners available upgrades and improvements and what the return on investment would be. Private property owners, he said, are largely not biting. “Energy is not as painful a subject right now because there has not been a lot of consumption,” he said, the result of the unseasonably mild weather. “It’s been a hard sell.” The high vacancy rate, Hammer said, seems to be weighing heavily on property owners’ decisions over whether to install more costly systems with an eye to long-term savings or whether to favor short-term fixes. “There seems to be a tremendous fear in the future in making a major investment in a property without a guarantee of that property being occupied, so vacancy is a huge problem right now,” he said. Normandy Real Estate Partners in the past 18 months opted for full-scale upgrades at all of its Westchester properties in an effort to make the buildings more attractive for current and potential tenants, said Christopher Masotto, general manager of Normandy’s Westchester portfolio. “We really don’t want to do a short term

fix if the next year you’re going to be doing a replacement,” Masotto said. He declined to elaborate on the cost savings, but said, “the impact is tremendous and it’s immediate.” Normandy owns and manages The Exchange, a collection of 14 buildings totaling 1.5 million square feet along the Interstate 287 corridor. Upgrades at the developer’s Westchester properties have included more efficient chillers, building management systems, better insulation and new roofs that better reflect sunlight. While acknowledging the high vacancy

rate across the county, Masotto said having energy-efficient systems that can reduce costs can be a significant draw for future tenants. “That’s what the business is. You want to have a great tenant roster and be 100 percent full and to do what you need to excel in every aspect of the business,” he said. Public entities and small businesses have been quicker to embrace energy upgrades and audits, Hammer said. Notably, small businesses and nonprofits with an average electric demand of 100 kilowatts or less are eligible for a free system assessment under the New York State Energy Research and Development Authority’s energy audit program.

Beef O’Brady’s, the Florida-based chain of family-style sports-themed restaurants that has a college bowl game named after it, has decided to take on its toughest opponent yet – the New York market – and the line of scrimmage will be in White Plains. “At this point in history it makes sense,” said James Walker, the restaurant’s chief development officer. “People are value conscious, yet they demand quality. We’re sports oriented and family oriented. It sounds like something that should go into White Plains to me.” Beef O’Brady’s has been around for 27 years, and is in 22 states, with the greatest concentration of restaurants in the Southeast – Florida, Arkansas, Kentucky and Texas. The northernmost location is in Brewer, Maine (near Bangor, population 9,500) and it’s opening in Saudi Arabia later this year. Why? “They love sports, and American brands, and they have a very strong economy,” Walker said. But getting back to White Plains, Walker said it seems like a good fit for several reasons. “They have the kind of real estate we usually go into, strip malls, but we also look at freestanding locations. He said the rents and the demographics are appealing, as are the sports fans. The Florida-New York vacation connection was also a contributing factor, Walker said. “One of the other things that’s great about White Plains is people go to Florida on vacation. So there’ll be good brand awareness. People will go to Florida, then come home to go to the restaurant.” There is no shortage of restaurants of any type in the New York area, though, so what about the competition? “We have a unique position because of our high quality food and value,” Walker said. He cited Chili’s and Applebee’s as the main competitors. “But we

think we’re more value oriented and quality oriented.” He said price ranges vary because they are determined by the individual franchisees, but an Angus burger starts at $7.99 and that’s with fries. “And there’s the sports aspect that Applebee’s doesn’t have.” He said before making the decision to come to White Plains, many markets were scouted. And he said he was aware that New Yorkers have more than their share of individually owned restaurants and are not limited to choosing among national chains. “While we are known as a national chain with over 200 locations, we’re also a very integral part of local communities,” Walker said. “We won’t come in as a faceless national chain, but through a franchisee who would have local ties.” Finding the franchisee, he said, will actually be the first order of business. “We did a show in New York, we also advertised, and used our website – beefobradysfranchise.com – as we started aggressively looking for a franchisee about a month and half ago. By the end of the year we hope to find the right person and open in the first or second quarter of next year.” Walker said he has talked to brokers, but that it is premature to talk about possible locations. The franchise fee is $35,000 due to the company, and then there are the construction costs, which of course vary by market and individual site. Walker also said that as is the case with most businesses these days, finding financing is challenging. “Banks are generally more cautious about who they lend to. We don’t offer financing to franchisees, but we do have third party lender we work with,” he said. “It’s important that folks looking to get into the business have a sound business plan. It’s important that they’re in a position where they’re not looking to finance the entire project through debt. That will make them more attractive to banks.”


White Plains eyes new mix on Platinum Mile

hite Plains officials are moving closer to adopting zoning changes that would allow retail and residential development along the city’s Platinum Mile office-park corridor, with a vote on the measure expected as soon as August 6. While office vacancies are rampant across Westchester, nowhere is the issue more prevalent than in central Westchester along the Interstate-287 corridor, business advocacy groups and elected officials have said repeatedly. City of White Plains Mayor Thomas Roach said allowing for more flexible uses in the city’s campus-office zoning district is “essential” to increasing occupancy rates. “This is an issue for the entire county and really the region, because these types of office parks have a high vacancy rate right now and the likelihood in this environment of singletenant occupancies riding in to save the day is slim,” Roach said. For months, White Plains planning officials have been crafting amendments to the city’s comprehensive plan that would allow office parks to be classified as “planned office development” districts and that would expand the various uses permitted in the campus-office district. Under the 1997 comprehensive plan, which was last updated in 2006, uses in the campus-office district that lines I-287 are limited to traditional offices and officerelated uses. The amendments, if approved by the White Plains Common Council, would allow multi-family dwellings, commercial indoor recreation facilities, theaters, swimming pools, churches, public, private and nursery schools, scientific research facilities, retail locations and cafes, among other developments. As proposed, property owners seeking to incorporate any of those elements would first be required to apply for status as a planned office development district. If approved, owners could then submit applications for specific projects. The Common Council rescheduled a public hearing on the zoning proposal for its Aug. 6 meeting. Karen M. Pasquale, senior advisor to the White Plains mayor, said a council vote on the amendments could follow the public hearing that night. The scheduled hearing comes as the town and village of Harrison are also discussing comprehensive plan changes to allow mixeduse developments on the Harrison stretch of the Platinum Mile corridor. Roach said he believes there is strong

support for the changes, particularly with the trend in Westchester favoring smaller occupants rather than major tenants like Nine West and its former Platinum Mile neighbor, Starwood Hotels and Resorts Worldwide Inc., which relocated this year to Stamford, Conn. “Years ago it was determined that this would be a place to have large corporations with hundreds or thousands of employees coming and going every day,” Roach said. “I

think we’re in a different place now in terms of technology and the way business is done...I don’t think you’re going to see a return to the same level of demand” for office space. The city’s campus-office district includes more than 2.8 million square feet of commercial office space. Roach added that most of the proposed uses likely will not adversely affect businesses and residents around the office-park district. “This is not a forest that’s being converted

into a development project – these are developed, large-scale office parks,” he said, noting that they already see significant vehicle traffic. In order to preserve the city’s open space and environmental character, any office parks approved as planned office development districts will be required to include outdoor recreational aspects such as bike paths and walking paths, said city Planning Commissioner Susan Habel.

A

fter almost 30 years at Western Beef, a low-cost supermarket chain located primarily in the New York metropolitan area, Richard Fraschilla, the company’s chief operating officer for the past 12 years, was ready to go out on his own. The Fleetwood neighborhood where his new supermarket Metrofresh is, had been without a market since March 2011, when a Key Food at that location closed just eight months after opening. The lack of a supermarket nearby was a hardship for the area’s many elderly residents. “I wanted to bring value to the neighborhood,” said Fraschilla, “with fresh produce, meat, a deli and support the community. We’re catering to the neighborhood with a

Hoping for a Metrofresh start lot of prepared foods like veal marsala, penne ala vodka, a lot of Italian items, but we’re not just focusing on that.” Fraschilla and his wife, Bea, opened the store June 20. “It’s been going well,” she said. “We seem to have gotten a good response, but we still haven’t reached all the customers as far as them knowing we’re here. We’re trying to do more advertising and get the website up. Right now that’s our biggest challenge.” She said business has been somewhat less than they might have expected in the first two weeks because of the heat wave and also because of the timing of the opening, between Father’s Day and the Fourth of July. “But we have got our beer license and we’re getting the lottery in,” she said. The owner of the Key Food store, Salvatore Gizzo, who was invited in 2009

by then-Mayor Clinton Young to open a supermarket, claimed he was forced to close because of the city’s failure to follow up on and complete improvements in parking, lighting and landscaping around the store. The Fraschillas, though, have had a very different experience with current Mayor Ernest Davis. “The city has worked very well with us,” Richard Fraschilla said. “They leased us some spaces on the ground floor of the parking garage. That had been metered parking, so now it’s free for people going to the store.” He admitted it’s hard to monitor the parking to make sure it’s only being used by Metrofresh patrons. “They’ve been very business friendly. The building department, usually that involves a lot of red tape, but there’s been none here. You fill out the right paperwork

and it gets done. The mayor, to me, has an open door policy. He’s interested in seeing business grow and serving the community.” Fraschilla said improvements in lighting and parking had been made before they got there, but said the lighting could still use some work. “But we’ll be able to tell more about that in the winter. We’ll see where the spots are where it’s not adequate. It’s light in the summer so it’s hard to tell.” Work is still being done on the garage and the elevators have been revamped. He was given permission to post signs letting people know that Metrofresh has free parking on the ground floor of the garage. As for financing this project, Rich said it was hard to get financing. It took a “couple of million dollars to open up, about 50 percent was borrowed. It was a lot of money.”

Children’s Village The Children’s Village (CV) was founded in 1851 in Manhattan in response to a growing orphan crisis following an explosion in immigration. Since then the agency has continued to care for New York’s most vulnerable children and families. Headquartered in Westchester County since the turn of the century, the agency now serves more than 10,000 children and families in the metropolitan area. CV is known for providing effective interventions that keep families intact and provide a large cost-savings to the public. CV’s mission is to work in partnership with families to help society’s most vulnerable children so that they become educationally proficient, economically productive and socially responsible members of their communities. “One of our core beliefs is that children do their best when they are connected to a family,” said Paul Jenkel, chairman of the board of trustees. “Our staff works tirelessly to keep kids safe while helping struggling families heal.” CV’s programs are part of a continuum of innovative, evidenced-based services that are at the forefront of transforming the juvenile justice and foster care systems in New York state. Much of its work provides preventive services that intervene to support families and reduce the need for out-of-home care. CV’s services address diverse needs such as behavioral problems, mental illness, homelessness, education, domestic violence, substance abuse, life-skills training, housing and employment. Making sure we meet their expectations while volunteering and provide support for their efforts may be critical to prevent burn out. First, find out why your volunteers have joined your organization. Is it because they want to directly make a difference, be a part of a fun atmosphere or have an opportunity to socialize with others? The answers will help you determine what your expectations should be of your volunteer, how to keep him or her interested and perhaps most importantly, how to hold onto your volunteer. If making a difference is the most important motivation of a volunteer, then be sure to directly link the connection between the work that your volunteer is providing and the overall mission of your organization. If they understand that the mailing they are helping with will bring in a needed dollar amount and reach a specific goal, then they are more likely to stay energized and continue with the task. If being a part of a fun or socially engaging atmosphere is why they volunteer, then make sure that the tasks that you assign provide that outlet. With a little extra attention and alignment of your volunteers’ interests, your organization can hold on to its most precious resource for years to come.

The board also presented a plaque to Hudson Valley Hospital President John C. Federspiel. Sound Shore Medical Center (SSMC) in Rochelle has announced its main laboratory received confirmation of its ongoing accreditation by the Commission on Laboratory Accreditation of the College of American Pathologists (CAP). This achievement marks the 47th year of continuous accreditation for SSMC. Maria Colucci, a financial advisor with Merrill Lynch, was recognized on the “America’s Top 100 Women Advisors” list, which published in the June 4 edition of Barron’s magazine.
