In a city short on revenue and long in waiting for an economic renaissance driven by downtown redevelopment, Yonkers Mayor Mike Spano in his first year in office has turned to the state as a key funding source for private developers. Spano recently announced that Empire State Development Corp., the state’s chief economic development arm, has commit-

ted $8 million to fund the uncovering of the Saw Mill River at the site of River Park Center, the mixed-use development near Getty Square on which the city’s master developer, Struever Fidelco Cappelli L.L.C. (SFC), has been unable to break ground in the prolonged economic downturn. Spano in a press release said the grant will be used to acquire parcels needed for the Saw Mill daylighting and riverwalk project. His predecessor in the mayor’s chair,

Philip Amicone, in 2009 formed the New Main Street Development Corp. (NMSDC) to administer the riverwalk project and property purchases for the city. The city and SFC have identified 13 private properties needed for the project. The Yonkers Industrial Development Agency three years ago agreed to use eminent domain to take properties whose owners reject the city’s purchase offers. Before the recession,

hen Southwest Airlines announced in February that AirTran, which it bought last year, would stop flying out of Westchester County Airport in August, it blamed high fuel prices and the weak economy. AirTran will stop flying into and out of Westchester County Airport in less than a month and so far no airlines have said they will take over those flight routes to Florida and Atlanta. AirTran has five direct flights to and from the county airport daily – three to Atlanta, one to Orlando and one to West Palm Beach. It served 300,000 of the almost 2 million passengers who used the airport in 2011. On Oct, 2, the airport will hold its next quarterly lottery – one was held July 10 – for airlines to bid on the remaining passenger allocation in any half-hour time period. “No more than 240 passengers per half- hour can be leaving or flying in to the airport,” said Patricia Chemka, deputy commissioner of the county’s department of public works and transportation. “So, for instance, there may be a time when Delta is bringing in 120 passengers and no one else is operating. During a lottery someone else could elect to take the remaining allocation (of passengers) from 11 to 11:30 a.m. And airlines can make

A Harlem battle lost, developer looks to build in Yonkers

t is not only the city’s oppressive heat and humidity that have made a hellish summer for Nick Sprayregen and the family-owned business he heads in Manhattan. At Tuck-It-Away Self-Storage, a 30-year history in the Manhattanville neighborhood on the west side of Harlem is coming to an end that will reduce the company’s presence there to rubble. TuckIt-Away is the last business standing on a massive demolition site of several acres between Broadway and the Hudson River, where Columbia University has begun an approximately $6.3 billion campus expansion. Sprayregen, a major landlord in downtown Yonkers and managing member of Rising Development-Yonkers L.L.C., led the West Harlem opposition to the Columbia project in a David-vs.-Goliath battle that pitted local businesses and residents against their university neighbor – the city’s seventh largest employer – and the state’s Empire State Development Corp. By 2008, as other property owners accepted Columbia’s purchase offers, Sprayregen alone was waging “a crusade” in state courts to prevent the state from condemning four Tuck-It-Away buildings – about 350,000 square feet of commercial space – and forcing the company’s relocation. In 2010, the New York Court of Appeals reversed a lower court’s ruling and allowed the state to use eminent domain for the private redevelopment project. Columbia’s victory was sealed when the U.S. Supreme Court later that year refused to hear an appeal brought by Sprayregen’s attorney. Sprayregen said his legal expenses in the six-year-long fight amounted to $1.5 million. Another court battle looms, as Tuck-ItAway’s owners will seek a higher compen-

sation price for their condemned properties than the fair-market value appraised and paid out by the state. Sprayregen said that legal wrangling could take another three to five years. Earlier this month, the storage company vacated the first of its four buildings that will be taken by the state. The company’s headquarters at 3261 Broadway must be vacated by mid-October. Sprayregen said the company in the last six months bought two buildings in the Bronx where it will transfer the storage of its 1,600 tenants in West Harlem. About 60 percent of those tenants have been retained in the relocation, he said.

has spent about $30 million to acquire numerous commercial and residential properties that cover more than three acres in the heart of the city’s targeted redevelopment area. At City Hall, Sprayregen’s serial acquisitions in the Larkin Plaza area at times gave rise to concerns in the mayor’s office that he was land-banking parcels for future sale and would not actively develop them. Sprayregen has consistently assured Yonkers officials and the public that Rising Development is there for the long term and planned to redevelop its main assemblage on Larkin Plaza once the city completed its Saw Mill River daylighting project. The new Larkin park beside the newly uncovered Saw Mill “will be the catalyst for more and more going on” in development, he said. With that project completed this summer, Sprayregen has stepped from the sidelines with plans for two projects, the first of which could begin in 2013. But public grant money will be needed to make it financially viable, he said. On Mill Street, a narrow one-block cul-de-sac behind Main Street and Warburton Avenue that city officials want to redevelop as a public courtyard beside what would be the next uncovered section of the Saw Mill River, Sprayregen plans a $22 million rehabilitation of five properties. The centerpiece is 2 Mill St., a former warehouse that the developer plans to convert to 40 work-live lofts for artists and entrepreneurs and 20,000 square feet of retail space. “I would love to create on Mill Street a destination place that would contain music and other arts,” he said. “It’s very exciting, but on the other hand, the reality is just like any proposed economic development today, you have to make the project work from a financial perspective.” With construction costs in

Yonkers matching New York City’s, but rents that are significantly lower, the Mill Street project “is economically not feasible” without a government grant, he said. Rising Development recently applied for a $4 million state grant for the project. “If we get that grant, we are committed to moving full steam ahead,” he said. Sprayregen also recently appeared before the Yonkers Planning Board with plans for an approximately $150 million mixed-use project overlooking Larkin Plaza and designed by Perkins Eastman, the renowned New York City architectural firm. The project would include a 250-foot-high, 22-story tower with luxury apartments, 80,000 square feet of office space and 40,000 square feet of retail and restaurant space. The developer said medical-type uses are planned for the low-rise office space. He also wants to create a restaurant row across from Larkin Plaza. “We’re optimistic and desirous to move forward with this. In the end, even with approval (from the city), the economics have to make sense,” he said. Sprayregen said he has had “only positive interaction” with the city Planning Department and the office of first-year Mayor Mike Spano. He said he also has good relations with Scenic Hudson and other environmental groups that strongly supported the Saw Mill River project. With the public-private partnership forged in Yonkers, “This is a situation that’s rarely achieved in the realm of public policy and private development, where everything is aligned to make this a success,” Sprayregen said. With the city’s daylighting project completed, he and other private developers “need to do our part now to make the transformation complete. We’re moving into a very important period of time when we’re trying to continue this transformation rather than have it stop with the uncovering of the Saw Mill River.”

F

airway Market, the iconic New York City grocer that opened its first Westchester County store two years ago, is close to signing a lease in the town of Greenburgh for its second Westchester supermarket, according to sources. Fairway is expected to lease the former A&P store at Crossroads Shopping Center on Route 119. The 70,000-square-foot space has been vacant since April 2011. The shopping center’s owner, Heyman Properties in Westport, Conn., did not respond to requests for comment on the reported pending lease deal. A spokesman for Fairway Group Holdings Corp. said, “Fairway does not comment until deals are signed.” Greenburgh Town Supervisor Paul Feiner said he heard “rumors” but had received no official notice of the Fairway deal from the Crossroads landlord. “The community desperately needs a supermarket at this location,” Feiner said in an email. “Fairway would be a spectacular addition. Having Fairway at this location would help revitalize the Crossroads Shopping Center, which has experienced vacancies in recent months. We could turn Crossroads into another Midway Shopping Center – a shopping center that is now one of the most successful in Greenburgh, thanks to ShopRite.” ShopRite opened as that Central Avenue shopping center’s anchor supermarket in early 2011. The former A&P store is not the only conspicuous vacancy in the 310,000-squarefoot Crossroads complex. In May, Barnes & Noble closed its bookstore there. Fairway Market in April 2010 opened a $10 million, 75,000-square-foot supermarket at Post Road Plaza Shopping Center in Pelham Manor. Later that year, it opened its first Connecticut store in a 70,000-squarefoot space at Harbor Point in Stamford. The company’s expansion from Manhattan into the tristate suburban market and New York City boroughs in recent years has been spurred by Sterling Investment Partners, a private equity firm in Westport. Sterling in 2008 reportedly paid about $150 million to acquire shares in the business formerly held by two of Fairway’s founding partners. Fairway CEO Howard Glickberg and his son Daniel, executive vice president, represent the third and fourth generations in their nearly 80-year-old family business.

New owners for Rye office building

A

n underoccupied class-A office building in Rye that sold for $22.6 million about seven years ago has been acquired for $10.8 million by a joint-venture partnership that includes a principal in the former ownership. Baywater Properties, of Darien, Conn., and WillKen Investments announced their joint venture with a $536 million real estate investment fund

managed by True North Management Group in White Plains to acquire 411 Theodore Fremd Ave., a three-story, 112,000-square-foot office building. WillKen Investments is an affiliate of Willett Companies L.L.C., headed by Frank Kenny and headquartered in the sold building in Rye. R. David Genovese, co-founder of 11-year-old Baywater Properties, said the office building is 60 percent occupied.

The partners in a press release said they plan to invest “significant sums” in renovations to building lobbies, common areas and amenities. Yonkers IDA backs factory, hotel projects Rite-Aid unveils

T

he Yonkers Industrial Development Agency at its July meeting authorized financial incentives to developers of a shopping-center hotel and a furniture plant in the city. The agency will provide Instock Cabinets Inc. a sales tax exemption of approximately $84,000 on purchased materials used in the

company’s conversion of the former Stewart EFI plant at 630 Central Park Ave. IDA officials also will negotiate a property tax abatement with the new owner. The former metal stamping plant was closed in 2008, idling 145 employees as Stewart EFI shifted manufacturing operations to the company’s newly expanded plant in El Paso, Texas. An affiliate of Instock Cabinets last year paid $7.6 million for the

201,000-square-foot Yonkers property. The vacant factory will be converted into a showroom and assembly plant for cabinets at an estimated cost of $2 million. The business will bring 40 permanent jobs to the city. Instock Cabinets currently is located in the Bronx. “Manufacturing is becoming an endangered species in New York state, but we are showing it can work in Yonkers,” said Mayor Mike Spano, who chairs the IDA board. “These are important skilled jobs to have in our community.” The Yonkers IDA also approved nearly $1 million in sales and mortgage tax exemptions for a New York City developer’s $26.2 million conversion of an office tower and former hospital at the Cross County Shopping Center into a 155-room, 72,000-square-foot hotel. Friend Development Group L.L.C. is seeking a national hotel brand for the site. Construction could begin in the fourth quarter of this year and the hotel is expected to open in summer of 2014. The IDA board authorized approximately $702,000 in sales tax exemptions for the construction phase, an approximate $277,000 mortgage tax exemption and a still undetermined property tax abatement The hotel project will create up to 100 construction jobs and 28 permanent jobs, according to the developer.

Wellness Stores

Rite-Aid Corp., the nation’s third-largest drugstore chain by number of stores, has brought its new “wellness” concept to Westchester County. The store at 50 N. Greeley Ave. in Chappaqua has been remodeled, along with seven others in the metro area, into a Wellness Store. That means it will offer advanced clinical services, including a private pharmacist consultation room. It will also have more staff for customer service and a bigger selection of wellness products. Grand opening events were held July 14, when nurses and pharmacists were on hand to provide free services such as cholesterol testing, blood sugar testing, blood pressure readings and diabetes risk assessments, as well as assessments of chronic obstructive pulmonary disease and memory impairment. But those services will not be available on a regular basis. – Janice Kirkel

service adjustments between lotteries, if they think there’s enough demand to start a new flight.” In addition to AirTran, whose flights make up 10 percent of the total at the airport, the other passenger airlines at Westchester are Delta Air Lines, JetBlue Airways, Cape Air, United Airlines, American Airlines and US Airways. Do any plan to bid for AirTran’s routes? Matt Miller, a spokesman for CLIENTS 1 22:10 9/17/02 American Airlines and American Eagle, said the airline will maintain its service in Westchester and is not planning any changes. Its current service consists of flights to and from Chicago – five daily Monday through Friday, two on Saturday and four on Sunday. Jet Blue spokeswoman Allison Steinberg said in an email that the airline participated in the July lottery “and continues to seek opportunities to add capacity and keep fares low. …We are committed to growing our service out of Westchester, but don’t have specific information that we’re able to share at this time.” She did say that Jet Blue has turned to a larger aircraft, the Airbus A320, to handle

the increase in daily traffic to Florida that will come as a result of AirTran’s departure. Trish Lorino, spokeswoman for Cape Air, said the airline flies only nine-passenger Cessna planes to Provincetown, Martha’s Vineyard and Nantucket and has no plans to take over any other routes. It also flies within the Caribbean and within Florida, among other routes. Calls to120 Delta, United and US Air were WV DOLEV not answered as of press time. Regardless of whether or when the slots are taken over, there will be a gap in service from Aug. 12 until the October lottery. Chemka said that there is no deadline by which an airline must make known its intent to take part in a lottery. “Sometimes they show up to see what everybody else is doing. JetBlue might not want to make any changes but they want to see what Delta is doing.” Chemka said that if an airline that does not currently fly at Westchester wanted to participate in the lottery, she would likely know about it in advance. “Most of the time we would know if we get a brand new airline, they will want to

know a lot about the airport, how much it costs to fly out of here, they’d want to talk to the airport manager about doing busi-

Spano’s office and ESDC officials did not respond to questions as to which state program would fund the $8 million grant and when the city expects to receive it. The mayor’s office said the ESDC board is expected to officially approve the grant Aug. 16. An ESDC spokesman said the Yonkers grant is pending board approval and a public hearing. Both the Amicone and Spano administrations have waited for another state agency, the Dormitory Authority of the State of New York (DASNY), to release a $24 million grant authorized five years ago for the Saw Mill daylighting project. NMSDC proposed to use those funds to acquire 11 properties for the River Park Center segment. Members of the Yonkers City Council at the time said they opposed using the state grant to acquire

the airport will lose $1.7 million in operating revenue from August to December. That revenue comes from a per-head passenger fee that the airlines pay the county, as well as fuel sales. But a report from the state Transportation Department issued last year showed that the airport had earnings in 2009, during the depths of the recession, of $334 million and provided more than 6,300 jobs. It was not among the airports that were hit harder by the recession than the national averages. It was one of only three airports in the state that gained enplanements, passengers flying in and out of the airport, along with Elmira/Corning Regional and Ithaca TompkinsRegional. Stewart International, along with Long Island’s MacArthur Airport and LaGuardia were hit harder than the national average, with an average drop of almost 13 percent in passengers from 2007-2009. “If nobody wants the routes then there will be fewer choices for passengers,” said Chemka. But she said she does not expect that to happen “because those flights have been full.” private properties taken by eminent domain to benefit a private developer, SFC. The mayor designated the River Park Center project as one of three priority economic development projects for the city, calling it “a transformative environmental, commercial and retail project that will highlight Yonkers’ natural beauty, employ residents and attract visitors for years to come.” Spano also seeks state funds for a $22 million private project planned by Rising Development-Yonkers L.L.C. to rehabilitate five properties on downtown Mill Street for conversion to live-work lofts and retail and restaurant space. (See related story on page 2.) Nick Sprayregen, managing member of Rising Development, said the company has applied for a $4 million state grant that it needs to make the project financially viable. The mayor said he is also pursuing state grant money for the proposed redevelopment of the Glenwood Power Plant on the Yonkers waterfront. Ron Shemesh, owner and CEO of Excelsior Packaging Group on the downtown Yonkers waterfront, and investment partners are acquiring the industrial property, vacant for more than 40 years, for mixed-use redevelopment. The private developers in late June submitted Spano’s letters of support with their grant proposals to the Mid-Hudson council.

asterCard employees bought themselves some casual Fridays, some seats from the old Yankee Stadium and helped send students to college. The MasterCard Manhattanville College Scholarship was established in December 2011. It has received the first installment for the scholarship fund, $20,000. MasterCard employees donated through two fundraisers. In the Purchase headquarters, employees were able to wear jeans every Friday during the summer when they donated a minimum of $5 a week. They were able to prepay the donation at a discounted rate. Every donation of $25 or more was eligible for a dollar–for–dollar match with the Matching Gifts program. There was also a yearend event where employees made donations and bid on auction items including Yankee Stadium seats from the old stadium, MasterCard gift cards and Priceless Experiences at Jazz at Lincoln Center and the NY Botanical Gardens. Priceless experiences entitle the donors to various benefits at the events they attend.

IBM earnings rise IBM reported second quarter earnings of $3.34 per share, up from $3 per share in the second quarter of 2011, an increase of 11 percent. Second-quarter net income was $3.9 billion, up from $3.7 billion in the second quarter of 2011, an increase of 6 percent. Revenues for the quarter of $25.8 billion were down 3 percent from the second quarter of 2011. Currency factors hurt revenue growth by approximately $1 billion. “In the second quarter, we delivered strong profit, earnings per share and free cash flow growth. This performance reflects

State snags top job-training award State officials are urging businesses in New York to apply for federally funded training grants for dislocated workers that are hired for full-time jobs. Gov. Andrew M. Cuomo recently announced that the state has received a $6.4 million grant from the U.S. Department of Labor, the largest award in the nation, to implement job-training programs. This year’s award follows a $3.4 million federal training grant that has helped 308 businesses hire 543 workers since 2011, according to state officials. That grant provided businesses an average wage reimbursement of more than $5,500 per worker. For private employers to qualify for the grants, the job training must be at a business location in New York state. The job the employee trains for must be a full-time job of 30 hours or more weekly. Persons hired under the program must be dislocated workers and unlikely to return to their prior occupations. For more information about training grants, send an email to StateOJT@labor. ny.gov. Wanted in Yonkers: your online vote Officials at Yonkers Partners in Education (YPIE) are waging a get-online-and-vote campaign in Westchester County’s business community to help the 5-year-old nonprofit win a prestigious award as the top educational nonprofit in the eastern U.S. A public education fund that works to raise the graduation rate in Yonkers city high schools and help graduates complete post-secondary programs, YPIE has been nominated for a Classy Award – the so-called Oscar for charities, nonprofits and philanthropic organizations. YPIE emerged as one of five nominees in its award category, educational advancement, from a field of more than 2,500 applicants. To win, the organization must generate the greatest number of online votes and be selected by a panel of nonprofit professionals. Voting ends July 26 and can be done via Facebook. “We are running against huge, much better known national charities and need every vote we can muster,” Marie Rama, a YPIE board member, wrote in an email. “Winning this award would bring national recognition to YPIE and hopefully draw the attention of donors and supporters around the country who can help us continue to improve the educational lives of our 27,000 deserving and

underserved Yonkers schoolchildren.” YPIE Executive Director Wendy Nadel in a press release said the nominee has challenged all social media marketing companies in Westchester and companies and groups with large online followings to rally potential voters. The voting link has also been shared with county legislators, business groups, retailers and other companies active on Facebook. Nadel said the marketing firm that comes up with the best viral marketing concept will be awarded a ticket to YPIE’s fall gala at the Cross County Shopping Center in Yonkers. “We need to raise awareness of our mission throughout Westchester and across the country, as other cities start to look to our work as a model,” Nadel said. Bank adds wealth management practice Provident Bank announced it has launched a new wealth management services practice to expand its offerings to what Rodney Whitwell, the Montebello-based bank’s chief operating officer and executive vice president, called “a growing and sophisticated client base.” Whitwell and David S. Bagatelle, executive vice president and New York City metro market president of the Provident New York Bancorp subsidiary, will co-lead the new practice. Whitwell said the bank also would continue to provide clients with wealth management products and services through third party and affiliate providers. With the launch of its wealth management services, Provident Bank also announced it has reached an agreement in principle with LPL Financial to provide wealth management services to support the bank’s financial and wealth advisers. JPMorgan Chase JPMorgan Chase earned $5 billion in the second quarter, or $1.21 a share, on the strength of its mortgage lending. The quarter included the bank’s disclosure of a trading loss May 10. In releasing the earnings, the bank said a trading blunder had cost it $4.4 billion since the beginning of April, more than double its original estimate. Some reports put the size of the loss at $5.8 billion. The bank said all managers in the London office responsible for the trade had been dismissed without severance pay and that it planned to revoke two years’ pay from each of those executives. The bank said it was reducing its net income for the first quarter by $459 million because it discovered information that “raises questions about the integrity” of values placed on certain trades. CEO Jamie Dimon said the bank had closed the division responsible for the bad trades, which have been moved to the company’s investment bank. JPMorgan was one of the inventors of credit derivatives and its investment bank is one of the biggest traders of the product on Wall Street. Just a few months ago, JPMorgan was viewed as the top American bank under the reliable guidance of Dimon. But since the disclosure of the trading loss his reputation

has suffered. He originally belittled concerns about the bank’s trading, but now has gone before Congress twice to apologize and explain himself. Several government agencies are investigating the matter.

Bank of America Bank of America returned to profitability in the second quarter, earning $2.5 billion, or 19 cents a share, compared with a loss of $8.8 billion, or 90 cents a share, a year ago. The 2011 quarter included $18 billion in pretax charges for certain mortgage-related items. Mortgage banking income rose, driven by improved credit quality across most major portfolios. In addition, there were solid contributions from the wealth management and corporate and commercial banking businesses. This was partly offset by lower net interest income from the continued low interest rate environment and lower loan levels.

Wells Fargo Wells Fargo said a rise in lending sent its net income up 18 percent in the quarter. The bank has managed to avoid a lot of the problems that have beset other big banks and is now the country’s largest mortgage lender. The San Francisco bank also announced a $175 million fair lending settlement with the Justice Department. The settlement stems from claims

that some Wells Fargo mortgages may have adversely affected some African-American and Hispanic borrowers. The claims primarily relate to mortgages priced and sold to consumers by independent mortgage brokers. Wells denies the claims but has agreed to pay $125 million to borrowers that the Justice Department believes were adversely affected by the loans. It will also pay $50 million to support a housing recovery in Baltimore.

Citigroup Citigroup beat analysts’ estimates for second quarter earnings, with profit boosted from revenue for advising on mergers and underwriting stocks and bonds. Still, net income was down 12 percent from the second quarter of 2011 to $2.9 billion. Excluding accounting adjustments and the loss from the sale of a stake in a Turkish bank, earnings were $1 per share, above estimates. Investment banking revenue was down 21 percent. Citigroup said it will probably not need “massive” headcount reductions to respond to market challenges. Revenue from trading stocks and bonds was down 9 percent, fixed-income trading was down 4 percent and equity trading revenue was down almost 30 percent. Losses at Citi Holdings, the unit created by CEO Vikram Pandit to house unwanted assets, were up 40 percent.

Capital One Earnings at Capital One tumbled in the second quarter to $92 million, or 16 cents a share, from $911 million, or $1.97 a share, a year earlier because of the effects of accounting for acquisitions. Separately, the Consumer Financial Protection Bureau announced an enforcement action against Capital One, its first public enforcement case. The bureau will make Capital One pay up to $210 million to settle charges of deceptive credit card marketing practices from some of the company’s third-party vendors. Capital One will pay between $140 million and $150 million to 2 million consumers as a result of the bank’s telemarketers deceptively pushing such products as credit monitoring and payment protection. In addition, Capital One will have to pay fines of $25 million to the CFPB and $35 million to the Offices of the Comptroller of the Currency.

Focus on what your operations needs are now My operations manager has proposed that we work on stuff we need two years from now. What we need to focus on in the next six months is much more hands on. I’m worried that I might have the wrong person for the job. How do I get her to tune into our immediate priorities? Thoughts of the day: Make sure there’s an overall game plan. Define all the priorities together and then identify immediate needs. Work out a budget and payoff. Consider it an advantage that you have someone who can look at the big picture; now develop her skills at tackling the short-term issues that can interrupt long-term progress. Bring everyone together by writing an overall set of goals. Make sure there’s a point on the horizon toward which everyone is headed. Go through an annual review of the long-term goals to be sure they are still on point for the company and relevant to where the marketplace is going. Ask your head of operations to lay out the short- and long-term priorities. Be sure to measure customer satisfaction, innovation, quality of assembly and delivery standards. Ask her to rate how your company is doing with the same performance measures right now and how she’d like the company to be doing two years from now. Discuss the immediate gaps between performance goals and actual. What are the issues that are cropping up now and getting in the way of meeting current standards? Why are they happening? What can be done immediately in order to improve performance? Identify actions and priorities as short term or long term based upon their immediate vs. long-term impact to performance measures. Solicit input to the short- and longterm goals and plans by asking for feedback from the bottom up. Start with the shop floor. Ask them what they think

needs to be fixed. Ask them to distinguish between nice to have and need to have. Figure out the cost/value of fixing immediate problems. What will be the cost savings? What expenses need to be incurred in order to implement immediate fixes? Which short-term fixes will be of no value once it’s time to implement long-term solutions? What’s the cost of long-term changes? How long until that budget is available? Work with your manager to determine the difference in profitability with short-term fixes vs. long-term solutions. Make sure that you’re not being penny wise and pound foolish by focusing on short-term issues and holding off on longer term solutions. Value the contribution your manager can make to help you think big picture. It’s common to get caught focusing on what’s immediate and overlooking the long term. If this manager can help you see the longer term, use her insight to plan, debate and compare options. At the same time, in the discussion of key measures – immediate gaps in performance and cost/payoff ratios related to implementing change – help her learn about the challenges of running a fiscally sound business. Fix the problems and improve profits short term, in order to fund longer term changes. Keep a list of short- and long-term changes in front of both of you at all times. Agree on what has to be fixed short term and what can wait. Define the long-term timetable. Figure out how long the short-term solutions have to work before you can afford to implement the master change plan. Looking for a good book? mployers across New York state will see the first decrease in four years in their workers’ compensation insurance premiums after Gov. Andrew Cuomo’s administration deemed a proposed rate increase unnecessary. Workers’ compensation costs, though, still challenge the ability of New York businesses to compete, according to the head of a leading state business group. Rates for workers’ compensation policyholders will decrease 1.2 percent, the first reduction since 2008, Cuomo announced. The governor also said the 2007 Workers’ Compensation Reform Law, which secured benefit increases for injured workers and cost reductions for businesses, has now been fully implemented by the state. “To create jobs and get our state’s economy back on track it is essential that New York’s businesses remain in a competitive position to succeed in the global marketplace,” he said. “For years, the workers’ compensation system has been too costly for businesses and ineffective for injured workers.” The New York Compensation Insurance Rating Board, a nongovernmental rate service organization, this year recommended a cost increase in their annual loss cost filing. According to the Business Council of New York State, the overall increase averaged 11.5 percent. After reviewing all filings and written submissions, state officials concluded the rate increase was not necessary. The decision to reduce the rate was made by the state Department of Financial Services, according to the governor’s office. State Superintendent of Financial Services Benjamin M. Lawsky called it “the right decision on rates at the right time.” Mario Cilento, president of the state AFL-CIO, said the labor movement’s priority in the 5-year-old reform bill “was to ensure that workers who suffer injury or illness while at work receive the timely treatment they need and adequate benefit levels to support themselves. The reform led to the indexation of the benefit at two-thirds of the state’s average weekly wage so that never again would injured workers suffer an erosion of their benefits through inflation.” Heather Briccetti, president and CEO of the Business Council of New York State, said the reform legislation was a good-faith effort to balance benefit increases, reduced employer cost, and improved claims administration.” Now the law’s actual impact on both benefits and costs needs to be evaluated, she said. “The cost of workers’ compensation coverage remains a significant competitiveness issue for New York state business,” said Briccetti, “and we look forward to working with the administration and other stakeholders on next steps in improving the system.”

Housing boomers

y 2030, the number of Americans over 65 years old is projected to double to 70 million people, according to the U.S. Department of Health and Human Services. With the elderly population growing at a rapid rate and living longer, an increasing number of seniors are in need of care at home. Some are able to bring services into their own houses, while others are moving to senior living complexes or in with their children. Watching the aging trend, businesses are taking note. The Engel Burman Group has developed eight luxury assisted-living rental communities surrounding New York City and recently has started moving north into Westchester County, building in Armonk and White Plains. Jan Burman, president of The Engel Burman Group, said the developments have been received well by the community. Burman has seen a high demand for units and each building has nearly 100 percent occupancy. The Bristal in White Plains will include 116 assisted living suites and 32 suites for residents with Alzheimer’s disease. The community will open in October and prices begin at $4,600 a month. In the next two years, Burman said it’s likely the group will start expanding into Fairfield County. But while senior housing has performed strongly for a real estate market through the recession, growth has slowed nationwide, especially in comparison with how fast the boomer generation is getting older. In the late 1990s, roughly 55,000 new developments were opening every year, while fewer than 14,000 opened in 2010, according to data from the American Seniors Housing Association. “It is performing reasonably well,” said David S. Schless, president of the American Seniors Housing Association (ASHA). “But what you actually see is very little new construction.” Still, senior housing occupancy rates continue a “modest” improvement in the words of the National Investment Center for the Seniors Housing & Care Industry, with NIC reporting an estimated 88.4 percent rate in the

first quarter, up 0.8 percent from a year earlier. The national occupancy rate reached its nadir in the first quarter of 2010, at 87.1 percent. Annual rent growth for senior housing was 1.2 percent in the first quarter, unchanged from a year earlier but off from the 1.6 percent year-over-year growth recorded in the fourth quarter of 2011. “The slowdown in the pace of annual rent growth speaks to the challenges that a number

of operators have been experiencing in achieving rental rate increases,” Chuck Harry, director of research and analysis for Annapolis, Md.-based NIC, said in a statement. With a sluggish economy, ASHA’s Schless said developers can’t find the capital to build and many families haven’t been able to afford the housing either. As a result, more families have delayed the move or have chosen to have the parents live with their children.

For this group, Meriden, Conn.-based Practical Assisted Living Solutions (PALS) has entered the marketplace. Selling firstfloor home modules to add to caregivers’ houses, the units make room for parents moving in. Each unit comes with handicap accessible furnishings and acts like a home remodeling or addition. “With medical advancements, people are getting older,” said Alison Rhodes-Jacobson, PALS CEO. “But they’re outliving their money.” Rhodes-Jacobson said senior living can cost $7,000 a month in the area, which is too much for the average person to afford. The PALS addition, which Rhodes-Jacobson said adds value to a home, costs roughly $85,000 to install over roughly eight weeks. Plus customers can sell back the unit for roughly 50 percent of the cost after they no longer need it. “This is just a tsunami,” she said. “It’s going to affect all of us.” – Alexander Soule contributed to this report. mature adults, spoke about “Caring for the Caregiver” during a July 11 presentation at The Kensington, an enhanced assisted living residence on Maple Avenue. When Abramson, now 45, was in her 20s, she was the primary caregiver for her grandmother, Mimi Rose. It was a period of great challenges. “Whenever you’re a paid caregiver or an unpaid caregiver you have some very tough moments,” she said. But, Abramson added, it was a time of even greater rewards, a period that had an enduring impact on her life and solidified her commitment to her chosen field. “It was the most incredible time in my life,” Abramson said. “I was so honored.” Having learned so much both in academic settings – she has a doctorate in gerontology from the University of Southern California’s Davis School of Gerontology – and firsthand, Abramson is dedicated to helping others on their own “caregiving journey.” And reflective of Abramson’s personality and approach, the presentation combined straightforward advice with a hefty dose of humor. There were not only facts, figures and practical suggestions, but also plenty of funny anecdotes, cartoons, short videos and even a bit of song. It’s a way to face a most serious problem, Abramson said in a chat before the formal program began. “I feel very strongly that mature adults have been put out to pasture,” she said. The Emmy Award-winning journalist, who appeared frequently as an on-air expert gerontologist for NBC’s “Today Show” and “Weekend Today” and has also appeared on CNN, CBS and MSNBC, was quick to reel off facts and figures that show just how important the field of eldercare is. She says that there are currently more than 65 million caregivers (defined as those who care for an aging loved one) in the United States. Nearly one in four households is involved in caring for a relative or friend who is aged 50 or older. Caregivers, she says, are primarily female (72 percent), mostly wives and adult daughters. The average age of a caregiver is 47. More than one in three, though, are mature adults (65 or older) themselves. Caregiving can last from less than a year to decades, with 80 percent of caregivers providing at least some type of unpaid assistance seven days a week. And the need for caregivers, Abramson added, is growing. It’s also estimated that more than 80 million people in this country


will have more than two chronic conditions by the year 2020. There are already growing problems that will impact the number of caregivers who will be available in coming years. A rise in rates of divorce and remarriage, increasing geographic mobility, smaller family sizes, a delay in childbearing and an increase in women in the workplace all contribute to less available help for the aging population, she said. And it is time, Abramson said, to address the situation: “Otherwise, it’s going to be a catastrophe, an epidemic.” Abramson, who is based in Manhattan and Atlanta, is involved in most every aspect of eldercare. Just a glimpse of her partial client list shows the breadth of her work, as she has provided services for businesses, events and organizations such as AARP, the Alzheimer’s Association, General Foods, Century 21 Real Estate Corp., the National Association of Television Executives, Senior Olympics and the White House Conference on Aging. All of her background and training help her make a thoughtful connection with those she addresses at her many speaking engagements. “I’m here to throw you a lifeline and show you there are some tools,” she said to the audience, as she launched into a presentation that touched on everything from juggling multiple tasks to managing feelings, from how to garner family support to how to communicate effectively with your loved one. Much of the talk reflected the topics covered in Abramson’s book, “The Caregiver’s Survival Handbook,” written with Mary Anne Dunkin. As Abramson is often tapped as keynote speaker at industry conferences and helps bring awareness of baby boomer and mature adult issues to corporations, consumers, government agencies and nonprofit groups, she is also sometimes asked to address some very practical needs, from personal-care products to ways to adapt a home. “I think products need to be taken to another level,” she said. “Manufacturers need to be challenged.” For many, the topic of aging and eldercare is mired in financial concerns, as well. “People are making some pretty critical decisions now, whether they’re going to pay for their children’s educations or their parents’ health care,” Abramson says. “Our fountain of youth is finances.” In the end, she said one of the biggest issues in facing this growing challenge is learning how to deal with the feelings that caregiv-

ing prompts, including stress and guilt. “As caregivers, we can’t turn our feelings on and off,” she said. “There are so many issues and challenges that guilt has become a major problem.” She hopes that people can learn to provide caregiving in an environment that serves both the needs of the loved one – and the caregiver. After all, she said, remembering her time with her maternal grandmother, the caregiving experience was one that has been a major part of her life a positive experience, that cannot be replaced. She got to spend quality time and form a bond that she has helped turn into a legacy“I know the stories and I’m going to pass them on.”

Boomers will spur change to eldercare By Bernard A. Krooks

A

s 78 million baby boomers approach retirement, they will redefine what it means to be a “senior.” They’ll live and work longer, with healthier lifestyles than previous generations, requiring cultural changes in senior services. “It should be seen as a time for personal growth,” says Burton Greenberg founder of the Caregiver Insights Foundation. “This is your time.” He envisions local governments consolidating daily activities on an online calendar. “Think how wonderful it would be to be able to go to one place to learn about an exercise class at the Y or a computer workshop at the library. They should make it easy for people to stay active.” Helene Bergman, founder and director of Elder Care Alternatives, believes that assisted living professionals will need to rethink their structure, especially as related to leisure activities. “Given more active lifestyles, people won’t settle for bingo and movie night. The emphasis needs to move beyond socialization to stimulation.”

but that needs to change if hospitalization is to be avoided,” Bergman says. Adult children have traditionally acted as unpaid caregivers for their aging parents and, if they’re also holding down a day job the pressure can be intense. It’s been estimated that U.S. companies lose more than $17 billion annually due to absenteeism and decreased productivity related to eldercare. These numbers will only increase unless the business community responds with flexible work hours, hotlines and other caregiver benefits.

Creative solutions On the other hand, boomers have divorced more frequently than previous generations, borne fewer children and scattered geographically. How will they manage if there are no family members nearby? “In urban areas, I’m familiar with informal support systems that have been established within apartment buildings to help out with food shop-

ping, trips to the Post Office and other errands,” says Bergman. “More extensive ‘volunteer ecosystems,’ coordinated and funded by local nonprofits, may become important in the future.” Another option is to pay for professional in-home services. “Strong emotional ties can develop between paid caregivers and those they serve,” notes Burton. “Look for someone who’s both certified in the latest home care techniques and whose personality is compatible with your own.” In my elder law practice, I’m beginning to see other creative solutions, such as seniors moving in together to pool resources and care for one another. But while good friends can become a new form of extended family, it’s wise to think through the details ahead of time. Working with an attorney to draft a simple cohabitation agreement that outlines financial responsibilities and other commitments can avoid problems. A similar document may be appropriate even when a family member is providing the

care. If someone has moved or altered career plans in order to help out, you may wish to remunerate them for services you would otherwise need to pay someone else to perform. The coming wave of seniors will inevitably bring change as support systems morph to meet new needs. Early planning will be key to shaping the life you want. Bernard A. Personal responsibility “Seniors should take charge of their own health and they need to put their legal house in order,” counsels Burton. “If they learn how the body works, they may be able to identify early symptoms and head off problems. They should take notes when they visit the doctor and ask lots of questions.” Putting in place several standard legal documents can ensure that health care wishes will be respected if someone becomes too ill to make decisions. A living will outlines instructions regarding such life-sustaining treatments as dialysis and tube feeding. Naming a health care proxy empowers another to make medical choices on your behalf, while a power of attorney enables them to handle financial matters. Estate planning, including consideration of long-term care insurance and Medicaid planning, can mean the difference between a comfortable retirement and years of financial stress. Given the cost of long-term care, failure to plan can result in the loss of a lifetime’s earnings in a couple of years.

Helping hands Given longer life spans, it’s likely that more seniors will reach a point where they require help with meal preparation, medication and other daily tasks. As personal mobility becomes an issue, demand will increase for in-home visits by doctors, nurses and other therapeutic professionals. fter a long career on Wall Street, Joseph Heinlein decided last year it was time for a change. He felt “empty” in his job. He wanted to help people. “I did a lot of research, a lot of digging. for an office north of New York City. So he started looking at the demographics of Westchester and met the person who runs Synergy’s Manhattan office. “He said there was a huge demand in Westchester for these services.” Heinlein said Synergy fit the bill for him because it provides nonmedical home care – companionship, personal care and homemaking help. “I didn’t want to get into too many different types of services. I don’t have a background in skilled nursing and the learning curve would have been too long.” The office opened July 9 in Hastings with about 20 or 30 clients who signed up through the Manhattan office. Synergy serves clients of all ages, but Heinlein said most are elderly. Right now, he is working on the first item on his to-do list – hiring caregivers. He has 15, but wants to expand to 50. “My employees are all W-4 employees, not independent contractors. So clients don’t need to worry about unemployment or workers’ comp. He said the hiring process is pretty rigorous. “They all have to be CPR and firstaid certified and have a current TB (tuberculosis) skin test. We go through their previous employment, their references and do a national background check. Everyone takes three-plus hours of pre-orientation training and has to pass exams. They have to learn infection control and safety issues.” To match the client with the appropriate caregiver, Heinlein visits clients at home to get a feel for what their needs are. He says a lot of the people who do this kind of work tend to be health care providers coming in, either home health aides, certified nursing assistants, or personal care assistants. They don’t necessarily do their work at someone’s home. “We will also go into a rehab center if a client is there after surgery, for example, if the family can’t get there as often as they’d like but they want someone the person feels comfortable with, we can go in. We can spend a few hours a day (three is the minimum) just keeping someone company. We could also be in an independent living or assisted living facility. For people with Alzheimer’s or other forms of dementia, memory care is available. “These are people who have typically worked in a nursing home or an assisted living facility where there is an Alzheimer’s or dementia section,” said Heinlein. It doesn’t end there. “We can also call to check on someone if the family wants,” he said. And caregivers who are not Synergy employees can also take advantage of its services. “We do continuing education for caregivers. A family caregiver can get online training, at no charge, just by contacting Synergy,” he said. It’s online information on caregiving topics that is available to anyone. Heinlein has put out the call for help. “We need to fill shifts around the clock. We’re taking applications and conducting interviews.”

W

hile quite controversial, an emerging body of literature now seems to support moderate wine consumption for individuals with many forms of arthritis and the possibly therapeutic role of wine for patients with certain types of the ailment. Arthritis is a group of more than 100 conditions that attack one or more of the body’s joints, causing pain and often swelling of the affected area. Three of the most common types are osteoarthritis, gout and rheumatoid arthritis. Osteoarthritis is a disease affecting the weight-bearing joints of the body – spine and pelvis – and is found primarily in older persons. Gout is a disorder in which uric acid crystals are deposited into joints, particularly in the toes. Rheumatoid arthritis is one of a number of forms of autoimmune disorder, in which the body fights its own cells with resultant inflammation.

What’s the evidence of benefits from alcohol? Four major, large-scale studies in humans conducted during the past decade show a benefit from alcohol for those suffering from a number of types of arthritis. In one study of more than 2,500 Scandinavian patients, reported in the medical journal Annals of the Rheumatic Diseases, alcohol consumption was found to be associated with a significantly lower risk of developing rheumatoid arthritis, with a similar effect for men and women. In fact, individuals who had the highest average consumption of alcohol had the greatest reduction in risk, 50 percent, of developing rheumatoid arthritis. While the researchers offer no concrete reason for this result, they suggest that it may be because of alcohol’s ability to dampen the immune system with regard to arthritis. In another study related to rheumatoid arthritis, reported in the prestigious medical journal Rheumatology, it was found that people who drank alcohol 10 or more days the preceding month were less likely to have arthritis than those who abstained from alcohol. Moreover, as compared with teetotalers or infrequent drinkers, frequent alcohol drinkers often had less joint pain, swelling and disability, as well as lower levels of inflammation markers and less damage to joints. The study’s findings were the same for women and men. As in the Scandinavian study, researchers suggest that the reason for the effect on arthritis might be alcohol’s ability to favorably modify the immune system. A

limitation of the study was that the type of alcohol consumed by respondents was not specified. Researchers noted that different types of alcoholic beverages might have varying effects. A third recent study, reported at the annual meeting of the European League Against Rheumatism, surveyed about 1,000 patients with arthritis and about 7,000 healthy subjects in the Netherlands. It found that people who consumed alcohol were more than 70 percent less likely to develop rheumatoid arthritis and more than 60 per cent less likely to develop certain other types of arthritis than abstainers from alcohol. A seven-year study of more than 34,000 Swedish women found that women who moderately drank alcohol were 50 percent less likely than nondrinkers to develop rheumatoid arthritis. Importantly, this risk reduction was independent of other dietary factors, smoking history and physical activity. The study’s findings were published online this month in the British Medical Journal.

Researchers at Goteborg University in Sweden found that in mice injected with a compound that induces arthritis, an alcohol solution similar to that of wine was significantly superior to water alone in reducing arthritic symptoms. Moreover, the mice fed the diluted alcohol solution had greater bone mass and fewer inflammatory proteins in their blood. The investigators conclude that while more research is needed, perhaps in humans a glass or two of wine daily is beneficial for arthritis. Adding to the evidence of the use-

he Wartburg Adult Care Community in Mount Vernon has been honored as an eldercare innovator for its Council for Creative Aging program. LeadingAge New York, a nonprofit association of eldercare providers that advocates in Albany for aging and continuing care services, in June awarded its 2012 Innovation of the Year Award to Wartburg officials. Accepting the award, Wartburg President and CEO David Gentner called the Council for Creative Aging “an example of a new and innovative program that sparks the creativity in the elderly and ignites a fire within them that makes them feel vibrant and alive.” The Wartburg program was started in 2010 in partnership with the National

Center for Creative Aging in Washington, D.C., an organization founded in 2001 to foster an understanding of the vital relationship between creative expression and healthy aging and to develop programs that build on that. The Mount Vernon council hosts a variety of art groups that meet at least weekly in eight-week sessions. It serves about 450 senior citizens annually, according to the Wartburg website. When designing the program, Wartburg officials followed suggestions from staff at Lifetime Arts Inc., a nonprofit in New Rochelle that promotes the inclusion of professional arts programs in organizations serving older adults. “Creativity actually grows with age,” said Ann Frey, director of volunteers at Wartburg, who spearheaded the pri-

vate nursing home’s partnership with the National Center for Creative Aging. “Our program provides opportunities to draw and sing and write … things that our residents never quite had enough time for when they were younger.” Gentner said he hoped that “other organizations and facilities around the state and the country will use our program as a model and institute this same structure and spirit into their everyday lives.” The Wartburg Adult Care Community is a nonprofit Lutheran ministry that provides a range of residential options and health-related services for older adults and their families in the area. Importantly, the researchers in all the studies caution about individuals consuming alcohol without first discussing it with their physician because of possible contraindications, such as liver problems and unfavorable reactions with some arthritis medications. Also, people with gout should consume very little alcohol because of its known negative effect on that medical condition. In spite of all the favorable research, detractors, many of whom are opposed to the use of alcohol at all, feel that alcohol and arthritis are “a bad mix.” Their reasons range from alcohol causing weight gain to alcohol causing strokes to alcohol causing bone loss – all of which appear to be incorrect with respect to moderate wine consumption. So, after a discussion with their physician, it would not seem unreasonable for someone with arthritis to enjoy a glass or two of red wine daily - and if it helps alleviate some symptoms, so be it. As for the use of wine to prevent arthritis, it would seem prudent to wait until the results of more definitive, prospective, double-blind, placebo-controlled research are reported. Balancing work and caregiving BY MARY K. SPENGLER

M

any of today’s busy business owners, executives, managers and workers feel that they can juggle their work and home responsibilities with ease. Yet the challenges of caring for an aging or ailing loved one can impinge on the ability to get work done at the office. A combination of strategies, resources and support can help caregivers continue to focus on their office work while balancing the myriad duties of caring for a loved one. It can be beneficial to begin incorporating your caregiving tasks into your daily routine. To map out a feasible daily or weekly schedule, the first step is to add these duties to other professional duties, such as meetings and events. This will enable you to view all tasks at hand. Select times for caregiving tasks that are least disruptive to your work schedule. For example: early morning for processing paperwork and midday for communicating by phone and email with a loved one’s care team. Try to contact doctors in the early morning to give them time to get back to you during the day. Whenever possible, avoid scheduling work-related meetings at times designated for caregiving duties. You may want to designate certain hours when you are unable to communicate except in the case of emergency. Make sure that your support staff is aware of your availability for caregiver-related calls. Prepare yourself and your staff and coworkers with a backup plan for work coverage. Developing emergency procedures as well as keeping an organized summary of client and project status will allow staff to keep the office running in your absence. Brief colleagues so they can fill in if an emergency pulls you away from the office unexpectedly. Store important files on a laptop or portable storage device that you can use while away from the office. Consider delegating appropriate tasks to colleagues to give yourself additional time to dedicate to more productive tasks. Also consider delegating home-related tasks to family members or close friends. Communication with your boss, coworkers and employees is an important element of balancing work and caregiving, especially since you may seem preoccupied or even arrive to the office late periodically. Explain the situation to them and even clients, where appropriate. Ask your boss for input and guidance on how best to handle work issues in the event of a caregiving emergency. Offer to work late on days when you are able to, since you might have to accompany your loved one on doctor visits or other appointments during

regular working hours. Talk with co-workers who have gone through similar situations. They can often provide input and advice by relating their own experiences. It is important for caregivers to know they and their loved ones have rights. The Equal Employment Opportunity Commission’s (www.eeoc.gov) report, “Enforcement Guidance: Unlawful Disparate Treatment of Workers with Caregiving Responsibilities,” outlines employment rights that are protected under the federal Equal Employment Opportunity laws. An older adult may be entitled to programs, services and benefits that relieve some of the cost and burden of care at home. The National Council on Aging Benefits CheckUp (www.benefitscheckup.org) offers valuable information on such resources.

The Family and Medical Leave Act (FMLA) entitles eligible workers who meet certain criteria to unpaid leave – without the risk of losing a job or health benefits – for the purpose of family caregiving. Reach out to family members, friends, community groups and organizations. They may be available to provide muchneeded, support, allowing you to have time for yourself. Social workers, geriatric care experts and contacts at the hospital and other healthcare facilities should be identified. Also explore options for in-home care such as hospice care, palliative care and nursing care. Some services may be more affordable and more comprehensive than unpaid leave from work. Counseling services, legal and eldercare resources can be invaluable in facilitating your caregiving decisions. It may

be beneficial to discuss your caregiving responsibilities and the impact they may have on your job, with these individuals. And remember, despite your best intentions, you may not be able to make a commitment to full-time, long-term caregiving without additional help. Being honest with yourself allows you to recognize when caregiving is adversely affecting your work. Take a step back to determine the best balance between work and caregiving, and seek out the support you need to protect your own mental and physical well-being. Mary K. White Plains Hospital scores at golf outing More than 300 people recently attended festivities surrounding the third annual Ahmad Rashad Golf Outing to benefit White Plains Hospital. The event kicked off with a reception at Restaurant 42 in the Ritz Carlton, Westchester and was followed by golf the next day at Quaker Ridge in Rye.
