ith less than 100 days till Election Day, fundraising for the local U.S. House races gathered momentum in June as political action committees nearly doubled their contributions. Six candidates vying for seats in the House in the three districts that include parts of Westchester combined to raise $894,852 between June 7 and June 30, after combining for $732,634 between April 1 and June 6. Those fundraising totals include contributions from political party committees and political action committees affiliated with neither party. ncertainty over how the new Tappan Zee Bridge will be financed prompted one of the four teams selected by the state to bid on the project to scrap its proposal at the 11th hour. Hudson River Bridge Constructors, led by principal contractors Dragados USA Inc., Flatiron Constructors Inc., Samsung C&T Americas Inc. and Yonkers Contracting Co. Inc., was not among the three consortiums of developers who submitted bids by the July 27 deadline. The group was unable to submit a proposal when Flatiron Constructors backed out due to financial considerations, a spokesman said. “We were pleased to be a part of Governor Cuomo’s efforts to rebuild a new Tappan Zee Bridge,” said the spokesman, who asked not to be identified by name. “Unfortunately, one of our partners, Flatiron, was unable to submit its financial qualifications. Therefore, a bid was not submitted.” Without Flatiron’s participation, any bid submitted by Hudson River Bridge Constructors would not have been in compliance with state regulations due to Flatiron’s inclusion in the team’s initial statement of qualifications, which was submitted to state and federal transportation officials as part of the bidding process in January. Flatiron Constructors is a subsidiary of Flatiron Construction Corp., based in the Denver area, and recently completed construction on the Lake Champlain Bridge. Calls to Flatiron for comment were not returned. The Hudson River Bridge Constructors proposal had been printed and was about to be sent to the New York State Department of Transportation on the day of the deadline when Flatiron gave word that it could not proceed and the proposal was scrapped, multiple sources said. The state received more than 750,000 pages of documents from the remaining three teams. Proposals were submitted by Kiewit-

Separately, the state released its final environmental impact statement Aug. 1, detailing a number of stringent requirements that the winning contractor must adhere to in order to limit the impact of construction on the river itself and the surrounding communities. A source with knowledge of the Hudson River Bridge Constructors proposal said Flatiron was “spooked” by the sheer size of the project and uncertainty on the part of state officials over how the project would be financed. While state officials have said they will resubmit for a loan under the federal Transportation Infrastructure Finance and Innovation Act (TIFIA) program when the next round of funding is made available, the amount of funding, if any, awarded to the Tappan Zee Bridge project won’t be known until well after a contracting team is selected. Without TIFIA funding available at the start of the project, “the upfront mobilization cost of building this bridge is gigantic,” the source said. The state has also failed to elaborate on how the remainder of the project would be financed, the source said. The source noted that all of the principal contractors that make up the Hudson River Bridge Constructors team, with the exception of Flatiron, were prepared to move forward regardless. Additionally, the source cast doubt on the state’s estimate for the total cost of the bridge, saying that “it’s going to be a real struggle to get it down to $5 billion” for the teams that submitted bids. Tappan Zee bidder exits as partner drops out
State mulls commercial vehicle toll hike The New York State Thruway Authority is considering a proposal that would raise tolls 45 percent on nearly all commercial vehicle classes. The proposal, which is based on a report conducted by Jacobs Civil Consultants Inc. this past spring, is aimed at shoring up capital for regular operations as well as for major projects. Public hearings on the proposal will be held in Buffalo Aug. 16, East Syracuse Aug. 17 and Newburgh Aug. 18. The proposal, if adopted, will take effect in October. The public comment period runs through Aug. 24. State business advocates have rallied against the planned increase. Michael P. Durant, director of the New York State division of the National Federation of Independent Business, called the proposal “priority number one right now.” “I’m vehemently opposed to it. I think it’ll have a tremendous adverse impact on businesses large and small,” Durant said. magine you could go anywhere on a direct flight from the Westchester County Airport. Imagine if it took 30 minutes to get to Manhattan from Bridgeport, Conn. Commercial real estate brokers from Westchester and Fairfield counties gathered July 24 to discuss ideas and ways to attract growth in a sluggish market and stagnant area. The 2012 mid-year reports for Westchester County show a relatively flat market and a nearly 3 percent increase in vacancies from last year. Hosted by real estate event company Bisnow L.L.C., panelists said the future of the counties’ growth depended not only on businesses moving to the region, but attracting the younger generation. The New York City exodus to the northern suburbs was spurred by high taxes, crime and dirtiness. But since it has cleaned up its act, people no longer want to leave the city and area youth want to move there. Roughly 60 percent of buildings in the counties were built between 1973 and 1988 and many are in need of a redesign, said William Cuddy, CBRE Inc. executive vice president. “Inventory requires constant reinvestment,” Cuddy said. “(It) can’t sit for years for a redesign. It needs to happen faster.” Additionally, the area could use a lesson in “being cool,” said Kurt Wittek, Black Rock Realty CEO. Wittek is behind the Fairfield Metro Center project that will develop the area surrounding the new Fairfield Metro Station. A hotel and residential apartments
will be set along an 11-acre waterfront park and office and retail spaces will be built connecting to the train station. Young adults want entertainment options after work, as well as being able to walk to retail stores and be close to trains into Manhattan, Wittek said. When they work, they want well-designed spaces with natural light and fresh air, which typically are not found in a building that’s 30 years old. By offering the best in convenience, such as access to Zipcars, day care centers, good food and cheap rent, the area could differentiate itself as well, said Jeffrey Newman, executive vice president of Malkin Properties. There are 14 colleges and 30,000 students in the area, which opens up a lot of opportunities, Cuddy said. If there was more integration between the colleges and the workforce, the area could better retain the youth that already live and grew up in the region. Funding and guiding entrepreneurs in and out of college would do just that, said Justin Krebs, principal at Normandy Real Estate Partners. Silicon Valley is a suburb of San Francisco near Stanford University, said Julia Klein, a Stamford real estate attorney who attended the event. What’s stopping Fairfield and Westchester counties? They are suburbs of New York City near Yale University, Columbia University and New York University. Krebs said business incubators drive growth, leading to more companies coming here to find talent. “Early stage funding is what is going to start companies,” Krebs said. “I’m optimistic, even though we have some challenges ahead of us.”
BY WILLIAM A. BRENNER, CPA CITRIN COOPERMAN Over the years I have seen many clients misclassify employees as independent contractors. In almost every case, the misclassification was due to a simple lack of knowledge and understanding of the differences between employees and independent contractors, as seen through the eyes of the IRS. On the surface it may not seem like a big deal, however, this is currently a hot topic with the IRS. Think about it from their perspective for a moment. You don’t withhold and remit income, Social Security, and Medicare taxes on payments made to independent contractors, thereby shifting the tax burden to the individual workers. This is certainly not a problem provided the individuals are truly independent contractors, but if the IRS determines that they are in fact employees, you, personally, could be on the hook for a substantial tax assessment. Many clients have said to me “I’ve been doing it this way for years and have never been questioned. Why change now?” Interesting point, but when you terminate a person who wanted to be, or whom you classified as, an “independent contractor,” what is the first thing he or she will do? They will run to the nearest unemployment office and file a claim. When the NYS Department of Labor notices that you haven’t included the individual on any of your payroll filings (and they will), hang on tight because the ride you are on will probably get a little bumpy. These cases tend to mushroom quickly, with the State asking questions about others that work in your company, and just so you know, the State typically sides with employees. It’s not just a matter of some payroll taxes. If these workers are determined to in fact be employees of the company or firm, they may be entitled to other employee benefits (health insurance, vacation, etc.), overtime pay, or even participation in the company pension plan.
My advice is to obtain an understanding of the factors that the IRS considers when making employee / independent contractor determinations, and then seriously consider the proper classification of your current independent contractors. Here are some of the key factors to be considered when making an employee / independent contractor determination: 1. The degree of control you have over the worker and the work being performed? The key factor is having the right of control, whether or not you exercise that right. 2. To what degree do you control the financial aspects of the relationship? In other words, who is in control of the finances of the worker? 3. Do you have a contract with the worker that defines the relationship as that of an independent contractor? While this is certainly a factor to be considered, the IRS will look to other factors that demonstrate the independent contractor relationship. 4. Do you provide tools, training, or employee benefits? 5. Is the working relationship expected to continue indefinitely? The good news is that it’s not too late to make changes and get a fresh start. The IRS currently has a Voluntary Worker Classification Settlement Program in place that provides taxpayers with the opportunity to come clean and begin treating independent contractors as employees. beginning April 1 to the period beginning June 7, jumping from $178,442 to $334,040. Incumbents Eliot Engel, a Bronx Democrat, Nita Lowey, a Harrison Democrat, and Nan Hayworth, a Mount Kisco Republican, all led their opponents in available campaign funds through June 30, and each led his or her opponent in total funds raised during the first half of 2012. All three will be running in reconfigured districts based on 2010 census data. Most of the funds raised by local candidates over the first half of the year came in the form of direct contributions from individuals or businesses. However, with the help of political action committees, small and mid-sized businesses have taken on a more prominent role, said New York City political consultant Hank Sheinkopf. “What’s happened now in the age of super PACs and coordinated campaigns is that even small businesses are joining together in collectives that contribute money to PACs that can impact races,” said Sheinkopf, principal of consulting and communications firm Sheinkopf Ltd. The most involved businesses continue to come from the financial services, insurance and real estate industries, Sheinkopf said. But, he added, “Size no longer matters. Only the ability to write a check does.”

posal to redevelop the former Akzo Nobel Chemicals Inc. campus for luxury apartments, retail shops and restaurants, a gourmet grocery store, a cinema complex and a hotel. The approximately 17-acre site adjoins Chauncey Square Shopping Center near the intersection of Saw Mill River Parkway and Lawrence Street. The project had sparked opposition and concerns about traffic congestion and safety and other issues among residents, led by members of the Rivertowns Preservation Civic Association. On July 26, Dobbs Ferry Mayor Hartley Connett in a brief public notice announced the suspension of the state environmental quality review process for the project. Village trustees for several weeks have been reviewing a draft environmental impact statement from the developer before issuing their findings on the project’s impact and scheduling public hearings. Connett said the suspension was requested by the developer. He indicated village offi-

Sheinkopf said businesses are generally very careful in determining which campaigns they will contribute to, but noted that New York City and the lower Hudson Valley are most popular with candidates seeking to bolster their war chests. “The New York region is the ATM of American politics,” he said, adding that Westchester and southern Connecticut are home to some of the country’s wealthiest citizens.
Seeking election in the new 16th District, which includes parts of the Bronx and southern Westchester, Engel raised $303,693 in the first half of the year. Republican challenger Joseph McLaughlin, who previously was a candidate for the New York State Assembly, raised no money and has no campaign funds through June 30, according to Federal Election Commission filings. In the 17th District, which includes Rockland County and parts of Westchester, Lowey raised $835,471 in the first half of 2012 compared to challenger and former Rye Supervisor Joe Carvin’s $138,646. Hayworth and Democrat Sean Patrick Maloney, a former staffer under President Bill Clinton and advisor to Governors David
Paterson and Eliot Spitzer, are locked in a tight race in the 18th District, which includes Orange and Putnam counties and parts of Westchester and Dutchess. Through the first six months of the year, Hayworth had raised $750,535 to Maloney’s $645,643 in a race seen as critical to both parties. In the Senate race, Democratic Sen. Kirsten Gillibrand – who in 2010 won a special election to succeed current Secretary of State Hillary Clinton – has a commanding fundraising edge over Republican nominee Wendy Long, a New York City lawyer. Gillibrand raised $3.5 million over the first six months of 2012 compared to $319,978 for Long, and has more than $10.5 million in available campaign funds.

Berger, managing principal of Saber Real Estate Advisors, on July 30 told the Business Journal he could not comment on the suspension “at this time, but hope to be able to soon.” In late June, Berger indicated the $150 million project was on track in a presentation at the Hudson Gateway Association of Realtors office in White Plains. “We’re about two and a half million (dollars) into it,” he told an audience at a meeting of the Realtors’ commercial investment division. “That means we’re at the beginning.” Berger said the developer hoped to complete a final environmental impact statement this month and begin demolition of buildings on the former chemical manufacturing site by the end of this year. He said he hoped to have tenants occupying spaces by early 2014. Berger said the commercial complex would include approximately 130,000 square feet of retail and entertainment space. In response to local concerns about traffic flow, he said, plans for a grocery store on the site were scaled back from a 55,000-square-foot
to 75,000-square-foot anchor supermarket to an 18,000-square-foot gourmet market. Retail shops would be sized at about 3,000 square feet and restaurants at about 6,600 square feet, he said.

Berger and his partner in Armonk, Matthew Klinger, manage Saber Real Estate Capital Partners I L.P., a private equity fund that targets distressed and undervalued commercial properties for investment. A panel of experts on fitness and nutrition gathered at the Bruce Museum in Greenwich July 26 to discuss tips on how to stay in shape, in the face of rising health care costs and rates of obesity and heart disease. Speaking on the subject of eating, chef Elyce Jacobson, co-owner of Skinny Buddha in Mount Kisco, said it’s important to listen to the messages your body sends you. “Your body pulls you in different directions,” Jacobson said, when you’re not getting enough nourishment. If you’re on a diet and you’re having cravings – like a chocolaty, delicious candy bar – it’s because you’re not getting enough of a certain food group and reaching a balanced diet. “No one food group should be eliminated,” Jacobson said. That includes fats. When you’re eating right, you won’t have cravings, she said. But it’s important to steer clear of processed foods and go back to the basics for what your body needs: fruits, vegetables and grains. When it comes to exercising, Equinox trainer Caitlin Vassello echoed a similar message. Just as you need a well-balanced meal, you need a well-balanced workout. Don’t isolate areas to focus on; you need a full body workout, Vassello said. Then, when designing your workouts, it’s important to take things slowly and – again – listen to your body, said Tim Greene, an orthopedic surgeon in Greenwich. “Your body is a marvelous machine that deals with stress,” Greene said. If you work too hard, you won’t continue to work out regularly. Your body will be too tired. When doing yoga, for instance, you should be listening to your body’s limits, stretching only in your comfort ranges. Not all of us will be Olympic athletes, but do what you can, said Dany Berghoff, vice president of 21 Sports and Entertainment Group Inc. Don’t use the golf cart, walk; don’t use the subway, walk the extra mile instead. Finally, the most important thing to remember is “be kind to yourself,” said Erika Schwartz, a medical doctor and wellness and prevention expert. “Don’t feel deprived. Develop self-awareness, know what’s good for you and remember: Everything you eat and put in your body is like a medication; it affects you.” She spoke passionately about connecting the body, mind and soul to stay healthy. most of all, she concentrated on her magnum opus, her work with bioidentical hormones. Moderator Elizabeth Bracken-Thompson introduced Schwartz as “a walking billboard for staying young forever.” At 63, Schwartz says she uses bioidentical hormones to keep her looking healthy. Bioidentical hormones, unlike synthetic
hormones, are identical to the molecular structures that make up the natural hormones our bodies produce. Proponents include Suzanne Somers and Oprah Winfrey. “In your 20s and 30s, you look and feel great because your body is creating high levels of estrogen, progesterone and testosterone,” Schwartz said. “As you get older into
your 40s and 50s, you don’t feel so great anymore because your body is not making these hormones as much.” You can take these bioidentical hormones to help you feel good again, to prevent disease and alleviate painful symptoms of menopause, including hot flashes and night sweats, she said.

We’ve picked up a number of new clients and we’re running into coordination problems. Most of our staff is technical. We used to assign one person to each client, but now we’re seeing the need to have our people support more than one client and work on specific activities that they’re best at, etc. How do you suggest we organize ourselves for the next round of growth?

municate about priorities, budgets and timelines. Account manager positions may be less technically oriented than project manager jobs, with greater emphasis on communication and sales-related skills. Often account managers have quotas for expanding an existing book of business. They meet the quota by identifying new contacts and opportunities within existing accounts that they have been assigned to manage. In order to grow the base of business, the account manager has to be able to “ask for the order” and negotiate terms with the client. Some companies can afford both positions – project manager and account manager. In that case, the two people should work closely together to figure out how to meet client demands, organize workflow priorities, plan upcoming assignments and communicate with staff and clients about job status. When the company can only afford one position, it’s important to decide where to put the emphasis – internal coordination or client expansion. If the company has an active flow of requests from clients, it may be more important to focus on project management. If more sales from existing clients are needed to meet the company’s overall sales quota, it may be better to hire an account manager and assign sales goals. Job skills for both positions include ability to communicate internally and externally, in writing as well as verbally. This person has to be sure that people internally understand what they are being asked to do and where they are expected to show up if they are being rotated from one client site to another. They also have to match individuals’ technical skills to the projects being assigned. Externally, they need to let clients know who, what and when – who will be doing the work, what work will be done and when to expect that work to be carried out. Make it easier to plan work by defining

Thoughts of the day: Figure out the roles of project and account management. Keeping work on track is a critical skill and requires both technical knowledge and the ability to communicate. Set up measures that help you
insure work is done on time and according to standard. Consider the following two ways to tackle keeping the workload on track. One is managing the projects from start to finish. The other is working with clients to identify and plan needs. Managing projects beginning to end is about thinking internally. Keeping track of the workload, knowing what skills are needed and who is available are all pieces of the puzzle. It’s essential that anyone assigned to manage projects is able to use a calendar and keep track of multiple projects, personnel assignments and priorities. The project manager has to plan and check off completion of assignments day to day, week to week and month to month. Account management is the external piece of the picture. The account manager must be able to look at clients’ current and long-term needs. It’s essential that the person holding this job is able to effectively com-

A 2-year-old specialty apparel company started in its majority owner’s Ossining home will open its headquarters and a small retail business in downtown Mount Kisco. Tommie Copper Inc., a marketer and manufacturer of copper-infused compression apparel for people with arthritis and other joint pain, is leasing a 5,000-squarefoot space at 74 Moger Ave. Founder Thomas Kallish said he expects to invest $425,000 in renovations to the Mount Kisco building. The company expects

If you can’t afford both a project manager and an account manager, pair up a project manager with someone on the sales force. Ask the sales person to provide support-building proposals, negotiating with clients and “asking for the order.” Put the project manager in charge of managing the workload. Consider giving the project manager a bonus for meeting or exceeding quota for work successfully completed, in order to keep everyone’s eye on the important goal of profitable growth. Though the Westchester County housing market showed modest improvement this spring from 2011, property deed transfers in the first half of 2012 trailed the slow pace of recovery over the past two years. Westchester County Clerk Timothy C. Idoni said 5,389 deed transfers were recorded in his office through June, a 10 percent decline from the first half of 2011. The decline was due to a slow first quarter, when deed transfers were down 20 percent from the first quarter of 2011. Transfers have risen monthly this year from 784 in January to 1,052 in June. Property transfers through June were down 6 percent from the first half of 2010, when the county housing market began to climb from its nadir in 2009. Deed transfers this year were down 43 percent from the first half of 2007, when 9,529 properties were deeded to new owners in a peaking market. – John Golden

The Westchester County Local Development Corp. has approved a total of $44 million in tax-exempt financing for two hospital and school construction projects in the county. The expansion and improvement projects at Northern Westchester Hospital and the Rippowam Cisqua School are the first to be approved for funding since the LDC was formed in January to issue tax-free bonds that were formerly available to nonprofits from the Westchester County Industrial Development Agency. IDAs in the state lost their bonding power at the start of 2008, when legislation authorizing them to finance civic or nonprofit projects expired. County Executive Robert P. Astorino, who established the LDC, said the financing “comes at no risk to the county or to taxpayers.” The LDC board at its July 26 meeting agreed to issue $36 million in tax-free bonds for an estimated $42 million expansion of the surgical suite at Northern Westchester Hospital in Mount Kisco. The hospital plans to add six operating rooms and 13 beds for its preand post-anesthesia care unit. The project is expected to create approximately 29 construction jobs and numerous patient care positions. The Rippowam Cisqua school district, with facilities in Mount Kisco and Bedford, stands to receive $8 million in tax-free bonds for a project that includes renovations to its athletic fields. The funds also would cover the school’s refinancing of an existing IDA bond and existing bank loans, resulting in $80,000 to $100,000 annually in savings for the district, according to school officials. The LDC financing must be approved by the county Board of Legislators.

Digital education facility opens in White Plains

ith cutting-edge technology upgrades unveiled on what seems like a daily basis, the ambitious business owner can run a company with no more than a laptop and a smartphone, says Rob Kissner. His mission is to show them how. And then some. The Digital Arts Experience Inc., founded by Kissner, opened July 11 in White Plains and began offering a wide range of courses July 16. The company’s goal is simple: to help businesses and individuals unlock the full potential of the devices they use on a daily basis, while also providing instruction in audio and video production, graphic design, animation, photography and web design. Kissner, who previously managed a recording studio in addition to working for Apple Inc. as a computer trainer, said he and his father initially conceived of The Digital Arts Experience as a venue to provide students with hands-on training in the digital media production field. However, Kissner said, they expanded the scope of their initial plan to include courses and training programs for adults and

businesses after observing a major void in services aimed at businesses that wanted to implement their own marketing initiatives but lacked the technological know-how. “What we’re trying to do is take the things a small business would normally rely on a third-party company to do, and give them the tools to do that in-house,” Kissner said. “There’s really no place to go that will cater to these specific businesses, so that’s what we’re aiming to do.” Among the course offerings for businesses are programs focusing on social media, e-commerce, branding and marketing, blogging and web design, and cybersecurity. Digital Arts, which employs about 15 people in different technology fields, also offers courses in various software products, including Microsoft Office, Quicken, Evernote and Dropbox. Courses aimed at adults run the gamut from those that teach the basics of smartphones and laptops to those who delve into multimedia production. The bulk of the company’s efforts since opening have been directed toward marketing. “That’s really what it’s been, 100 percent,” Kissner said. He said the company has already reached out to various business organizations, includ-

ing The Business Council of Westchester and the Westchester County Association, in addition to the county Department of Tourism. After getting courses up and running, Kissner said the ultimate goal is to create a business model that can be duplicated at other locations. “Really what the long-term goal is, is to take this idea, work out the kinks and transplant it in other communities,” he said. Kissner said the company looked at several possibilities before selecting White
Plains, which he called “a no-brainer” due to its central location. Digital Arts is located at 170 Hamilton Ave., which is owned and managed by GHP Office Realty, also based in White Plains. The 8,000-square-foot facility includes a recording studio, classroom spaces and a number of computer rooms for small group or individual training. Digital Arts signed a seven-year lease for the property, and was represented by Bruce Wenig of Rakow Commercial Realty Group Inc.
Kayak Software relocating to Stamford

eading into its initial public offering of stock, Kayak Software Corp. quietly secured a lease at a small building in Stamford’s Harbor Point development as a new headquarters. Kayak, long based in Norwalk, Conn., raised $91 million in its July 25 IPO, with shares of the travel website company immediately rising from a sale price of $26 to above $33. Kayak had delayed its IPO after Facebook Inc. shares dropped in value following its own May debut as a public company. Kayak secured a lease for offices at 7 Market St. in Stamford, with the building totaling 18,000 square feet of space on two floors and a mezzanine level. Kayak executed the lease with an affiliate of Building and Land Technology, the lead developer for Stamford’s Harbor Point district and the former Yale & Towne factory properties that include the building at 7 Market St. It is only the latest coup for Building and Land Technology, with Harbor Point drawing the headquarters offices for Starwood Hotels and Resorts Worldwide Inc., upscale furniture purveyor Design Within Reach and Louis Dreyfus Highbridge Energy. Kayak’s initial lease is for 12 years with rents steadily escalating from $63,000 a month to just over $74,000 in the final year of the deal. Kayak holds two options for five-year extensions. As part of the deal, Building and Land Technology is planning nearly $1 million in renovations. At its current 55 North Water St. headquarters in Norwalk, Kayak to date has required just a third of the space its new quarters offers. CEO Steve Hafner runs the company from Connecticut, while CTO Paul English manages Kayak’s larger technology operations center in Concord, Mass. With IPO proceeds totaling more than $86 million after payments to investment banks and other expenses, Kayak has a fresh cache of cash upon which to draw – with apparent implications for its local presence given its new, expanded quarters in Stamford. At press deadline, Kayak had yet to release its second-quarter results. In the first quarter, the company earned $4.1 million as sales increased 39 percent to $73 million. Kayak has 162 employees, according to Hoover’s. In its public filings and some other venues, Kayak, Hafner and English have warned of the potential ramifications of Google Inc.’s 2011 acquisition of ITA Software Inc., a Cambridge, Mass., company whose software handles back-end bookings for airlines. Microsoft Corp. has
also made aggressive moves into the online travel sector. “The online travel category is the biggest category by far – equal in size to almost every other e-commerce category combined,” Hafner told Bloomberg Television last month. “We actually have a partnership with Google and a partnership with Microsoft, so overall we feel very confident in our prospects … I think we’ll do just fine.” With $86 million in its pocket, Kayak is now navigating its own options for expansion, including international opportunities.
In May, the company opened an office in Zurich, Switzerland. “I think one of the things people are excited (about) Kayak as a company is the scalability,” English said. “If you look at the revenue-per-employee, our productivity against not only online travel sites, but even general search engines, we rank pretty high. We’re continuing to scale users and revenue, and we don’t think we actually need to expend a lot more money in running the company. Right now we’re just taking profits coming in and putting that into more and more marketing.”

VC dollars up for New York metro area But down 15 percent compared with last year

espite an overall increase in venture capital spending compared with the previous quarter, the irregular VC trends continued in the second quarter of 2012, both nationally and in the New York metro area, according to a MoneyTree report based on Thomson Reuters data. The total amount of money invested nationally increased 17 percent compared with the first quarter, with $7 billion invested in 898 deals. But with relatively low funding levels in the first quarter, the year’s totals are still projected to fall short of the $30 billion invested in 2011, yet exceed the $23 billion invested in 2010, Tracy Lefteroff, a PwC global managing partner, said in a press release. PwC and the National Venture Capital Association assembled the report. The New York metro area saw VC dollars increase 52 percent this quarter – with $567 million invested in 100 companies – but compared with this time last year, spending is still down percent. Software and information technology companies received the most capital, while
companies in the life sciences and clean technology sectors saw continued decreases. At the national level, VC dollars to the software industry increased 38 percent from last quarter to $2.3 billion, which is the highest quarterly total since 2001. VC investment in the life sciences, which includes biotechnology and medical device companies, decreased for the second consecutive quarter, falling 9 percent to $1.4 billion. Quarterly funding to biotechnology firms was at its lowest level since 2003. “I think it’s more of a reflection that the Internet is a very hot area right now,” said David Silverman, a PwC partner. “It’s always been an area of investment since the mid ’90s.” But with the success of social media and evolving e-commerce models, such as daily deal websites and better online catalogues, there has been an uptick in interest. Plus, with relatively efficient models and low operating costs, Internet companies can be an attractive investment compared to a costly life sciences project. In the New York metro area, 47 percent of VC funding went to software and IT services companies, totaling $264.2 million invested in 44 companies.
While the New York metro’s funding and industry mix mirrored national trends this quarter, it differed in what stage of development companies receiving funds were classified.
Funding for companies in the latter two stages increased in dollars and the number of deals this quarter, accounting for 53 percent of the total deal volume. Only 26 percent of deals were in the expansion stage. “New York continues to demonstrate a very healthy mix of stage of investment funding,” Silverman stated. “With a significant portion of deals and dollars focused on the early stage, (we’re) providing ample opportunity to and for young startups, followed by strong funding in the expansion stage to enable the continued growth of these companies.” Connecticut companies garnered just $13 million in funding across eight deals. All but one of the eight were included in the New York metro data. In Norwalk, an expanding software company received $2.4 million and in Stamford a startup medical device company received $1 million. “Venture capital continues to be invested in Connecticut biotech, medical device, IT and software companies,” said Owen Davis, a PwC partner in Stamford. “However, the number of deals in Connecticut this quarter is disappointing. In addition, the dollars invested are not keeping pace with national venture capital investment levels.”

ohn McEnroe’s philosophy for training future tennis champions isn’t what you might think. Kids don’t have to leave their homes and families and move into an academy where they’ll do nothing but play tennis. They should have outside interests and even be involved in other sports. “The big thing with John is at every other academy you have to come down to Florida, leave your family, play tennis six hours a day, get rid of every other interest in life and hope you’ll be the one-in-a-billion player who ends up ranked high on the pro tour,” said Lawrence Kleger, who will be the John McEnroe Tennis Academy’s new director of tennis. “He wants kids to have other interests, he thinks that makes them well-rounded – better people, better citizens. He even encourages kids under age 10 to be involved in other sports even if tennis is their major sport.” McEnroe started his tennis academy in 2010 at Sportime on Randalls Island. Its aim is to train top junior players for pro careers. There is also a facility in Bethpage on Long Island, and in September the academy will expand to Westchester, at the Lake Isle Country Club in Eastchester. Kleger, a veteran coach of junior players, has been the executive director of tennis at Sportime Clubs since 1998, and an assistant academy director for McEnroe’s school since September 2011. Sportime Lake Isle will have an eightcourt facility with synthetic clay indoor courts covered by three bubbles. There will also be a 5,000-square-foot clubhouse. Kleger
said McEnroe’s academy will use four of the eight courts. “The sessions will run for the indoor season, from September through the end of May or early June. There will probably be about 100 students, ages 10 to 18,” Kleger said. The 32-week program costs $4,200. Private lessons are also available. Kleger said McEnroe will spend most of his time at Randalls Island, but be a “significant presence” at the other locations. “He also personally interviews every staff member and gives his okay to every hire.” Randalls Island has the largest facility with 34 teachers. Eastchester will have seven to 10. The coaches are from all over the world. They were players who had been ranked in the top 35 at one point. The Eastchester facility, which will cost $6 million to build, was started in January and is set to be finished by September. “We select students based on their ability, coachability, attitude and effort,” Kleger said. Some have already achieved success. “One player on Randalls is 16. He’s from Long Island; Noah Rubin. He’s been ranked as high as 14th among people 18 and under. He made the quarters of the French Open juniors.” Kleger has coached Rubin since age 7. Another, he said, is from Westchester, 17-year old Jamie Loeb of Ossining, who also trains on Randalls Island. “She just won a Futures tournament in Buffalo and cracked the top 1,000 in her WTA ranking.” Futures tournaments give players a chance to improve their rankings. When asked what McEnroe is like as a teacher of young players, Kleger said, “You’d be surprised to see how patient he is, he knows just what to say and how to say it to kids. He’s very inspiring.”

Finding a cloud for your small business
loud technologies continue to rapidly evolve. Up until recently, businesses could choose from public and private cloud solutions where companies can store all of their documents on a remote server accessed through an Internet connection. However, small businesses now have access to cloud-based applications, which allow them to license software that is hosted on the vendor’s cloud. As opposed to purchasing one software license for each employee and installing the license on their computer, business leaders can now purchase licenses, often referred to as “seats,” to the cloud-based version of the software. Often these solutions are more affordable, offer flexible use plans and are easier to upgrade because the vendor handles upgrades for the client. While these cloud-based applications may be attractive to small businesses, the importance of researching one’s options and asking the right questions cannot be overstated. When considering a cloud-based application, such as Adobe Creative Cloud, Microsoft Office 365 and Apple iCloud, evaluate the solution’s offerings in these four key areas: security, support, data transfer and terms of service. Safety first - Is my data secure? When housing your data on a cloud owned by another company, having trust in the vendor is essential. Security policies and procedures should be explicitly outlined in the contract or terms of service posted on the vendor’s website and users should feel confident that their documents are protected. For example, an accounting firm that uses a cloud-based program for tracking clients’ financial records needs to understand how the vendor protects data on their
cloud against online security threats, such as hackers and viruses. Having this sensitive information exposed could lead to lost business and negatively impact a company’s reputation. Small businesses subject to specific security and privacy compliance regulations, such as those storing personal health data (subject to HIPAA) or credit card data (subject to PCI), must also be sure that the security policies and procedures comply with industry rules and regulations. A la carte or all-inclusive? Across cloud-based applications, there is no common definition of what is included. The tools and features available vary widely, which can lead to confusion. Before contracting for a cloud-based application, read and make sure that you fully understand what is and is not included – from functionality to upgrades. To illustrate this challenge, let’s take a look at Microsoft Office 365. For only $8 per user per month, small businesses can purchase a Microsoft Office 365 E1 plan. For $20 per user per month, small businesses can purchase a Microsoft Office E3 plan. While the E1 plan is more affordable, it only allows users to view documents, whereas the E3 plan allows users to both view and edit documents. This flexibility may be attractive to businesses that require different functionality for different employees. However, it also requires a bit of homework to understand what you are sacrificing by purchasing the least expensive plan. In addition to varying widely by vendor, these solutions are different from those purchased from a managed IT services provider and installed on a company’s cloud-hosted server. QuickBooks is an example of such a program where fewer features and functions are available in the cloud-based application. This is not necessarily a bad thing – you just need to know what you are getting and what you might be giving up. Help! What are the tech support offerings? When technology fails, small businesses need support. Be sure to research each ven-

dor’s tech support offerings before you buy. Is there a call center that provides real-time support from a representative? Is all custom-

er service provided through email exchange? Does the company offer online chat support in real time? Vendors often are able to reduce the cost of their services by only offering email support. This can be challenging for companies whose day-to-day business operations are interrupted by technological failure and frus-
trating for individuals who are less technologically savvy and unable to perform basic troubleshooting measures themselves. Moving on – How do I transfer my data? While it may seem premature to evaluate how to leave a vendor’s cloud before you have even signed on, “How do I get my data back if I decide to change vendors?” is a must-ask question. The terms and conditions should outline who owns the data that your company is storing on the vendor’s cloud and how to get it back. Unfortunately, the transition is not always an easy one. Take Gmail, for example. Small businesses are often attracted to its large storage capacity and ease of access. However, transitioning from Gmail to another email solution is far from simple. Despite the ability to export your historical emails, if you have a large volume of email the transition is extremely laborious, time-consuming and error-prone. Taking these precautions will help your small business to choose a cloud-based application that is both cost-effective and adequate for your business needs. The parent trap – balancing the cost of aging parents BY MARGARET PRESTON

aby boomer parents in We s tch e s ter County are feeling the pressure – sandwiched between the increasing costs of education for their children and some of the highest costs in the nation for elder care services for aging parents and relatives. Decisions about elder care need to be addressed sooner rather than later. Adding to this pressure is Americans’ increased life span. According to the U.S. Census Bureau, the number of people who 211215A01 live to be 100 rose from 2,300 in 1950 to nearly 80,000 in 2010, proving the so-called nest egg needs to last much longer than it used to. Aging brings about many different concerns and fears. A recent survey titled “U.S. Trust’s 2012 Insights on Wealth and Worth”
highlighted the top priorities of high networth households should long-term health care be needed. The survey was conducted online by the independent research firm Phoenix Marketing International in March. More than 640 people with assets of $3 million or more, not including their primary residence, responded. Top priorities included being financially independent, not being a burden on children and receiving the best medical care. Furthermore, more than half of the respondents cited as very important being able to stay in their own home and maintaining the lifestyle to which they are accustomed. Despite these many concerns, the same survey found that only 20 percent of baby boomers have a plan in place for meeting the financial needs of aging parents or relatives, while 30 percent said they are already personally financing their cost of care. Decisions about whether to put an older family member into a retirement or nursing home can be both emotionally and financially stressful without a plan in place. This lack of planning needs to be rem-
edied so that boomers are prepared for the financial burden of caring for aging relatives and can try to meet their needs as well for their own retirement. Working with a financial adviser to help balance these costs within your existing financial strategy can be crucial to success. One big step you can take now is to keep it personal – organize financial, legal and health information so that you and your family members can answer vital, unforeseen questions should you or a loved one become incapacitated. Another is to be prepared. Each family has their own unique concerns and priorities when it comes to health and the type of care they require. Develop a network of advisers, including external health care providers and professionals to help assess your specific needs. Taking these two simple steps now can help answer many of the unknowns and make unexpected decisions much less stressful to resolve. Working with a trusted adviser and network of health specialists will help you address your elderly loved ones’ needs as well
as prepare you for your golden years so they can be enjoyed without the feeling of being a burden that so many people experience.

Acorda Therapeutics, which makes drugs to treat a variety of neurological conditions, returned to profitability in the second quarter, with earnings boosted by sales of Ampyra, used to treat multiple sclerosis. The Ardsley-based company earned $4.5 million, or 12 cents a share, compared with a loss of $285,000, or one cent a share, a year earlier. Sales rose from $65 million to $75 million. Sales of Ampyra were up 28 percent from the second quarter of last year. The company said it is exploring the use of Ampyra to treat stroke patients and those with cerebral palsy. However, sales of Zanaflex, used to treat spasticity, tumbled to $2.5 million from $11 million in the second quarter of last year. A generic version was launched during the first quarter of 2012. Last year Acorda lost a patent lawsuit involving Zanaflex as it tried to block the generic from coming to market. Separately, in May, Acorda said it received a warning letter from the FDA regarding the timeliness of its adverse-event reporting and recordkeeping procedures. The company said it has taken steps to ensure compliance with regulations.

Hudson Valley earnings down
Hudson Valley Bank reported a drop in second quarter earnings, which fell to $5 million, or 25 cents a share, from $7.4 million, or 38 cents a share, a year earlier. Non-performing assets – bad loans – fell to $40 million from $64.5 million in the year-ago quarter, but were up from $29 million at the end of the first quarter. The Yonkers-based bank cited one $13 million loan in particular as not being repaid, but said a repayment plan had been worked out and that it had received $6.5 million in early July. The bank said the decrease in earnings was primarily due to a $4 million drop in net interest income, a higher provision for loan losses and lower fee income. The bank said asset quality continued to be hurt by the state of the economy and the real estate market. Its net interest margin declined, it said, because interest rates remain at historic lows. Expenses rose because the bank set aside $1.3 million related to the previously announced investigations and settlement discussions with the Securities and Exchange Commission and the Department of Labor relating to the brokerage practices and policies of the company’s investment advisory subsidiary, A.R. ax oversight and aggressive marketing of private student loans in the mid-2000s have contributed to cumulative defaults in excess of $8 billion, according to a new report from the Consumer Financial Protection Bureau and U.S. Department of Education. In a report released July 20, the CFPB and Education Department outlined several recommendations aimed at shoring up the private student loan market, including one in which schools certify all private student loans. The joint report was submitted to Congress as mandated by the Dodd-Frank Wall Street Reform and Consumer Protection Act. Consumers currently owe more than $150 billion in outstanding private student loan debt, in addition to an estimated $900 billion in government loan debt. Between 2005 and 2007, the percentage of loans to undergraduates made without school involvement or certification grew from 40 percent to 70 percent, as lenders increasingly marketed their loan products directly to students, the report states. Similarly, the market for private student loans supplied by financial institutions grew to more than $20 billion in 2008 from less than $5 billion in 2001, before dropping to less than $6 billion in 2011. Consumer debt attorney Leslie Tayne said the biggest problem is that students are not equipped to understand the long-term implications of taking out more than they need in private loans. “When you’re 17, 18, 19 years old, it’s really easy to take student loans – you just sign on the bottom line and you don’t really pay attention,” Tayne, whose firm, Law Offices of Leslie H. Tayne P.C., has locations in White Plains, Mount Kisco, New York City and Long Island. While outstanding government student loans far exceed private student loans, Tayne said the latter “tend to be more difficult in terms of options available to you.” Government lending programs often have multiple repayment programs that allow students to pay back loans in smaller increments over a longer period of time. Tayne said that with private loans, there is sometimes the option for the consumer to negotiate a settlement with their lender. Absent that, however, it can be all too easy to fall into delinquency and default, she said. “I find that the student loan is the last debt to be paid, partly because of the problems in repaying them and partly because people ignore them early on,” Tayne said. “People pay their credit card bills because they need to buy gas tomorrow,”
whereas they don’t automatically see the need to keep up with student loan payments, she said. Tayne recommended that those who are overburdened with loan payments talk to their lender before they are in default. “We have lots of people who come to us when they’ve received notices on levied bank accounts and garnished wages,” she said. “At that point, you really have gotten to a point where it’s now a very desperate situation and your options become much more limited.” The CFPB report notes that lenders have significantly reformed their student lending practices since the 2008 recession, with more loans requiring co-signers and a college’s certification, but in many instances, the damage was already done. According to the report, 10 percent of recent graduates of four-year colleges have monthly payments for all education loans that exceed 25 percent of their income. More than 850,000 private student loans are currently in default,
totaling $8 billion. During the mid-2000s, due to the lack of oversight and certification of private loans by colleges, increasing amounts of student borrowers did not exhaust their federal Stafford loan limits before seeking private loans, the report states. In the time since the recession, financial institution practices have become more stringent. The number of student loans with a co-signer increased from 67 percent in 2008 to more than 85 percent in 2009 and more than 90 percent in 2011. In 2011, 90 percent of private student loans to undergraduates required the school to certify the student’s need for additional financial assistance. In addition to a recommendation for requiring school certification of all private student loans, the CFPB report recommends that Congress look into whether changes are needed in the way private student loans are treated in bankruptcy proceedings, whether the definition of a private student loan could be clarified and whether more mechanisms could be provided that would offer borrowers a better understanding of their student loan options.

mar Gupta, a visiting scientist at the Massachusetts Institute of Technology and a management and technology professor at the University of Arizona whose focus is on linking technology and entrepreneurship, will be the dean of Pace University’s Seidenberg School of Computer Science and Information Systems effective Aug. 15. Gupta has also served as an adviser to the United Nations and World Bank. Gupta said the locations of Pace, in Westchester and Manhattan, make it uniquely suited to his work. “There’s a proximity to a number of good companies, like IBM, and the chance to develop closer relationships with businesses to find out their needs and train students to meet those needs, to produce the skills and talent that will help them,” said Gupta. “I want to see more joint efforts involving business, government agencies and universities.” Gupta said dual-degree programs are more important than ever today. “In the old days there were clear demarcations between

people in health care, law and information systems,” he said. “But as an example, in the case of law, today there are issues related to law from information technology and information technology plays a growing role in how legal processes are conducted today.” Health care is one area Gupta pointed to, knowledge of which, along with expertise in computer science, could enable students to be “the change agents of tomorrow.” At the University of Arizona, he developed what has come to be known in academic circles
as the 24-Hour Knowledge Factory, a system of working whereby teams in different time zones work on a project during their work day. “When you come back to your project, you feel as if a magic fairy has done work for you while you were asleep,” said Gupta. “It’s like a relay race.” He talked about how this might be applied to health care. “If an accident takes place at night in the U.S., X-rays can be taken somewhere nearby but read by someone working daytime hours in another country. Or in Australia, in a similar situation, it comes to us for a doctor here to see,” he said. Technology makes this possible, he said, and eliminates the need for shift work, which has been linked to health problems. This system of working can be applied to many different types of situations, he said, and “allows a project to be completed more quickly. Also, there is an international feel to what is developed and, depending on what the project is, it will be of greater interest to potential buyers around the world.” Gupta also developed technology, on which he holds a patent, to allow for precise readings of handwritten information on bank checks. He said it was only wide-
ly accepted after 9-11 when planes were grounded and checks could not be processed the way they had been for many years. Then there is his advisory work. For the World Health Organization, he helped set U.S. guidelines on health infomatics –– information relating to health care and the computerization of it. In the 1980s he worked with the World Bank, in one instance helping develop a financial infrastructure for a Caribbean country that had experienced a lot of bank failures. His work with major corporations in the early days of personal computers produced some interesting reactions. He recalled that when meeting with executives at IBM and encouraging them to develop their own PC after Apple had come out with its computer, one half-joking response was, “ ‘We’re not in the toy computer business.’ But very soon after that, they came out with their own PC,” said Gupta. Just as Apple and other PCs brought computerization to the average person, Gupta wants to bring education in computer science to everyone on campus. “My goal is for every student at Pace to take at least one course in computer science.”
College of New Rochelle gets $250K to open door to higher learning BY JANICE KIRKEL jkirkel@westfairinc.com
The College of New Rochelle has been awarded a College Access Challenge Grant of $250,000 from the New York State Higher Education Services Corp. to help people who do not have a high school diploma or the equivalent continue their education. This comes at a time when the federal government has tightened the eligibility requirements for Pell grants, so people who do not have a high school diploma or equivalency certificate do not qualify. Here’s how it works: Any student 21 or older who wants to continue school but doesn’t have a high school diploma or GED can sign up for an 18-week workshop beginning Aug. 27. The workshop, which is free, meets two days a week at the college’s South Bronx campus. There students’ abilities in some of the fundamental areas of education are assessed – reading comprehension, sentence skills and mathematic computation. The goal is for students to be able to pass what is known as the Ability to Benefit test, also called the Accuplacer Test, administered by the College Board. If they pass, they can be admitted to The College of New Rochelle

at the South Bronx campus for the spring semester starting in January 2013, to complete the required 24 credits to get a GED. At that point they become eligible for Pell funding. The $250,000 is designed to provide
aid for 40 students. If more students enter the program, the college makes up the difference. The program requires that institutions contribute no less than 33 percent of the grant amount.
The program has been around since 2008. This is the first time The College of New Rochelle has received a grant. “It’s a hallmark of who we are,” said Darryl Jones, dean of the college’s School of New Resources, of which the program is part. “Forty years ago this October we began providing people from historically disadvantaged backgrounds with the means to get higher education.” Jones mentioned a recent study from the Community Service Society detailing the costs to New York City of people without high school diplomas. It showed that each individual, in one way or another, through cash benefits or institutional costs, costs the city $134,000. Those who have completed high school yield a benefit to the city of $192,000. Jones said 80 percent of those in the workshop pass the test. So far 100 have signed up for the August workshop, all from the South Bronx. Hans Van Dyk, the college’s director of corporate and foundation relations, noted that “the program has been renewed every year since 2008, but every year is a new budgetary cycle so of course we don’t know if it will be refunded for 2013. We certainly hope so.”
