irst of all, Merry Christmas! We recognize that this is a time when many people, events and things are demanding your time, and you chose to open this issue in the midst of it all. We want you to know we appreciate that. Not just today, because it’s the holidays, but every day. With just 5 weeks or so left of 2020, we’re quickly rounding the corner to 2021. What are your wishes for 2021? I wish for more peace, harmony and compassion for everyone. Our world needs kindness and respect for all beings, no matter what our differences may be. I wish people were more respectful and considerate of what other people are going through. I wish that I would be a light to others. I wish for people to be grateful for their families, friends, relationships, challenges and victories and celebrate those for others. I wish that we can understand each other’s point of view and perspective without the divisiveness we have been experiencing this year in particular. I wish for more love and understanding, more acceptance and kindness in the world. Christmas is one of my favorite holidays. It’s not just about the presents or the cookies and desserts—although they are delicious and I love the once-a-year time to pig out on chess squares. For me, it’s about the time I get to spend with family, and I love encountering the holiday cheer of those who don’t have the bah-humbug state of mind. Oh, and I have to mention how much I absolutely love watching Christmas movies and seeing Christmas lights. I could watch “Christmas with the Kranks”, “The Santa Clause”, “Bad Santa”, and “Four Christmases” over and over the month of December. Luckily for me, several channels play Christmas movies all month long and we have Netflix, so I’m all set. As Christmas is the season of giving, take the opportunity to give to those around you. Step out of your comfort zone and do something for someone who could use a hand. Help a coworker with something that isn’t your responsibility; offer help to someone struggling with an oversized package; pay someone’s bill at a restaurant; speak kindly to someone who’s being abrasive, etc. Merry Christmas and thank you for supporting us and our wonderful advertisers that also support us. CHIHULY AT CHEEKWOOD D ale Chihuly is an American artist known for his colorful and often massive, hand blown glass sculptures. His art is displayed worldwide with retail stores in the Bellagio and MGM Grand casinos in Las Vegas, and is even seen in a ceiling at the Makers Mark Distillery. For the first time since 2010, you can see his exhibit at Nashville’s Cheekwood through January 10th. Ironically, Chihuly gained his fame in giant sculptures, literally by accident. He was in an auto accident which left him blind in his left eye and then a body surfing accident dislocated his shoulder. He was no longer able to hold the heavy glass blowing pipe and had to rely on others to create his designs. Today he has a large staff and directs their work, enabling massive structures which he would never be able to accomplish on his own. Cheekwood Estate and Gardens, next to Percy Warner Park in Nashville was the 30,000 sq. ft. home of Leslie and Mable Cheek. Leslie and his father, C.T., bought stock in the Cheek-Neal Coffee Company, creator and brewer of Maxwell House Coffee and Tea. He made his fortune in 1928 when the company sold to Postum, later renamed General Foods for $45 Million. In 1929, construction began on the mansion and gardens. In 1957 his daughter Huldah and her husband, Walter Sharp offered the estate and 55 acres as a public garden and arts center. After a massive fundraising effort in 1960, the new organization opened to the public. For the Chihuly exhibition there are 17 exhibits throughout the gardens and mansion. If you go, buy your tickets online at cheekwood. org for the desired arrival time, and be sure to include the mansion tour. Masks are required indoors. I also advise comfortable shoes and a small flashlight as the tour map is in fine print and the gardens are very dimly lit. If you feel froggy, Chihuly works are on sale in the gift shop (least expensive when we were there was $5,500). With Covid limiting what we can do and see, this is a mostly outdoor event that families can enjoy. Holiday Lights at Cheekwood also started on November 20th. Ride Safe and Have Fun!! Cooper

Bullet Points PRINCIPLES OF A SELF-DEFENSE CLAIM – REASONABLENESS

H

appy December bikers! I hope you had an awesome Thanksgiving. As I write this in mid-November, I am getting ready for my last ride to the mountains of 2020. I hope you have had some opportunities to get some riding in this fall. This month’s Bullet Points column is the last in the five-part series, Principles of a Self-Defense Claim and deals with Reasonableness. In review, the five critical components to a successful self-defense claim are: 1. Innocence 2. Imminence 3. Proportionality 4. Avoidance 5. Reasonableness If you find yourself in the unfortunate position where you have to defend yourself with lethal force, your continued freedom will depend on if the police and courts believe all five of these components were properly met. If there is any doubt in their minds that each one was met, your legal team will have to convince a jury that you did in fact meet them. Reasonableness of your actions is judged both objectively and subjectively. In the event that the police turn your case over to the prosecuting attorney, objective reasonableness will primarily be determined by interviews with witnesses, physical evidence – and if the case goes to court – testimony by expert witnesses. Subjective reasonableness is primarily going to be determined by your actions and any statements you make (Hint: a subject of an upcoming article). Let’s examine both of these. Objective Objective reasonableness is an imaginary litmus test. Essentially, it implores someone to consider if a reasonable person would make the same decisions and take the same actions you did if in exactly the same situation. This imaginary person is a law-abiding citizen, goes to the intersection to cross the street, does not have anger issues, does not do drugs and never drinks to excess. He/she would be cautious by nature. Average in every way, he/she would not have above average intelligence or super human strength. When considering objective reasonableness, the police and district attorney may well transfer your physical characteristics to the imaginary person. If you are old, frail, small or handicapped you would likely fear for your life more quickly than a healthy man in his mid-20s. As such, a lower threshold would have to be exceeded before you began to become fearful and the fight-orflight instinct kicked in – when you believed the threat was imminent. In a self-defense case, the court may also allow Mr. Reasonable to have specialized knowledge which you have. A good example would be if you knew the person was extremely violent, unstable and had a reputation as a vicious fighter. If you were to find yourself in a position where he was coming quickly at you with

clenched fists and in an obvious rage, you may believe the threat to be imminent more quickly than if you did not have this specialized knowledge. Having this knowledge transferred to Mr. Reasonable is only fair because a reasonable person with such knowledge would be more likely to react quickly. Other specialized knowledge, such as your previous understanding of the Tueller Drill (for more information see the Bullet Points article on Imminence) can be passed to Mr. Reasonable – and he, like you – will know that a knife wielding man is an imminent threat at 21 feet, which may not seem reasonable to everyone. But if you were to find yourself in court, you will most likely need to prove that you knew this before you used the force. Owning a book which cites the Tueller Drill, with a receipt, would be proof. Attending a self-defense class prior to the incident which provided information on the Tueller Drill may well suffice as proof. If Mr. Reasonable would have taken the same actions you did, you have passed the litmus test for objective reasonableness. But that does not mean you are out of the “proverbial woods” yet. Subjective Reasonableness Subjective reasonableness takes into consideration all of the things you did and said. Just because Mr. Reasonable would have acted like you did, if you truly did not believe you were innocent, there was not an imminent threat or your actions were not proportional, you are at risk of not passing the subjective reasonableness test. You may be wondering, “How would the police or prosecutor know I did not believe this if I did not tell them?” This is where your statement to the police can come in. If you were to say, “I was not afraid for my life,” or “I could have taken him with my fists,” you are in jeopardy of losing your self-defense case because there was not imminence and your actions were not proportional. Other things which can cause police and prosecutors to fail your self-defense claim due to subjective reasonableness would be running from the scene, hiding from police or tampering with evidence. These actions will immediately cause them to believe you were not the innocent party. In closing, remember that you must be able to prove the following to claim self-defense: you are INNOCENT, you believed there was an IMMINENT threat of death or serious injury, your use of force was PROPORTIONAL, there was no reasonable avenue of AVOIDANCE and a REASONABLE person would have taken the same actions. “THE OVERCOMER” Rev.2:7 “He that has an ear, let him hear what the Spirit saith unto the churches; to him that overcomes will I give to eat of the tree of life, which is in the mist of the paradise of God.” There are ten verses in the book of Revelations that speak The Blessing (empowered to prosper) over “The Overcomers.” 1. “Let him hear” this is a calling, a duty, an order from the Holy Spirit 2. “To him that overcomes” implying some in heaven are not Overcomers. 1 Cor.3:15 “…but he himself shall be saved; yet so as by fire” 3. “Will I give” Jesus makes the presentation Himself 4. “The tree of life” This is the same tree that God forbid Adam & Eve to eat from 5. “In the Paradise of God” This is in heaven as a special reward to Overcomers. The pandemic, the economy crises, and the street violence, many believers have stopped assembling their selves together at Church, stopped tithing, offerings, praying, and reading their bibles. John 16:1 “These things have I spoken unto you, that ye should not be offended.” Jesus had warned the disciples fourteen times that He would be going away. God has always warned his people of impending disasters in order to prepare His people for it. For many years now we have had Pastors, Teachers, and Prophets warning us that this season we are now in was coming and for us to prepare for it, some listened and some did not. 2 Thess.2:2 “That ye be not soon shaken in mind, or be troubled neither by spirit, nor by word, nor by letter as from us.” Vs. 3 “Let no man deceive you by any means… there shall come a falling away first.” Many believers have been “offended-shaken in mindtroubled in spirit (human spirit) and have Fallen away.” Vs. 10 “And with all deceivableness of unrighteousness in them that perish; because they received not the love of the truth, that they might be saved.” The truth 8

is Jesus, and Jesus is the Word (Jo.1:1 & 14). With all that is going on in these last days, we must be in love with the Word of God! It’s still the same battle between Religion & Relationship. If we don’t have the love and the passion for “The Word of God,” we could find ourselves susceptible to being “deceived.” If we are closer to unrighteousness than we are the truth, we could very well be part of that “falling away group.” But with the “love for the truth,” we will be Overcomers. Rev.12:11 “And they overcame him by the blood of the lamb, and the word of their testimony and they loved not their lives unto the death.” It’s easy to love God when everything is going our way, but when something doesn’t go our way, we turn from God, we get “offended, troubled, and soon shaken.” In these last days. by Bob “Bulldog” Ousley Dear Fellow Veterans and Patriots: As I write this article it’s shortly after the national election. Many game changing reports of election fraud and corruption are being reported. Law suits are being filed, the news media is suppressing reports of fraud and declaring Joe Biden the next President of the United States. It won’t be surprising if the election is still undecided when this edition of our magazine is distributed and you read it. My sincere hope is that all of the fraud and illegal activity will be discovered and those responsible will be indicted, tried and confined. It is hard for me to understand how President Trump could have massive election rallies before the election, the Republicans could pick up seats in the house and, as of today, do so well in the Senate and President Trump could lose the election. I don’t believe there has ever been an election when the president’s party does so well and the president doesn’t win. Where is our justice department?? I’ve been predicting what will happen if the Marxist Democrat Party wins and as of today they are openly talking about tribunals and retribution against those who supported President Trump. The news media, including FOX, is openly censoring those who attempt to inform the public about election fraud in any way. The number of media outlets that are being open and honest are dwindling. I’m sure when I have talked about re-education camps, imprisonment and executions of the opposition many thought I’m from an alternate universe but all of this is becoming more possible by the day. Several weeks ago, someone put a Black Lives Matter sign on the door of the football coach for Illinois State University. He took the sign down and put one up that said “All Lives Matter to Christ.” The school fired the football coach for that. That’s political oppression of religious freedom and freedom of speech. The social media outlets have taken over compiling information on you from the NSA. The NSA is still doing it but social media is now the primary source for the Marxists. Over the coming years anyone who has been vocal in supporting the constitution as written, is for the first and second amendment, supports our system of government as founded or is vocal in opposing Marxist domination of our country will suffer in some way. Major corporations will deny jobs, promotions and opportunity to patriotic Americans. Many good Americans will be fired and restricted from various stores, services and programs. Mortgage loans, health care, child care and insurance will be manipulated to punish those who don’t go along with

permanent Marxist domination. Speech will be restricted to what is allowed by the government. Your neighbors will be rewarded for spying on you, schools will be rewarded for spying on you through your children. The government will convince your children to spy on you. America will likely become the nightmare that the people of China, the Soviet Union, Cambodia, Laos, Venezuela, the Middle East and many African countries have lived through or are living with after Marxist and dictator coups. The only answer to this outcome is resistance, self-reliance and truth. If the government comes after you in contradiction to the constitution you must fight it. If you have children is school you need to consider home schooling to stop them from being brain washed by teacher’s union Marxists. If you don’t have a garden or some way of making your own food you may want to start one. Marxists will ensure food goes to Marxists and not to patriots. Decide if you are willing to go to jail for supporting the constitution of the United States. As the Marxists suppress religions and churches you should consider holding services for your family at home and keep religion alive. Not sure what to tell you about money because the Marxists will do away with hard currency and convert to controllable electronic means of transferring funds and purchases. That gives them the power to turn off your money and bring you to your knees. The black market and barter will naturally become more important but will carry harsh penalties. Make no mistake, this Marxist movement is getting massive support from China and we may well become a substate of the Chinese government. The light of the world may well be extinguished beginning in January of 2021 if the Marxists win the presidency. I am not advocating armed rebellion against what is coming but our founding fathers knew this day would come and gave us the first and second amendments to the constitution. These two amendments stand against the oppression of a free people but they are just words on paper if not supported and exercised. Every American must choose – Domination or Freedom!!! What will your legacy be to America and your descendants? Will you give them over to enslavement and oppression?? Keep the faith. Thank a vet for the freedoms we still enjoy and support politicians who will bring back the ones we’ve lost. Fly the flag of the people and be proud you’re an American. Hug the families of those still missing because their quest for closure has not ended. Live the good life and ride for those who can’t. Xtreme Hooligan Races – Shelbyville TN On Saturday, October 17, Patrick Bedford and Celebration of Speed produced the Xtreme Hooligan races, including the Tennessee Hooligan Final State Championship at the Celebration Arena in Shelbyville. Classes included all racers from Youth and Beginners to Mad Dog Pro, Open Expert and Xtreme Hooligan. As usual, there was lots of good racing, crashes and lots of fun for racers and spectators alike. Rich Heaverly took home the title and prizes as the Hooligan State Champion. The flat gravel track is normally used for Tennessee Walking Horse Shows and can prove to be a challenge for motorcycle racing. The following is a list of all of the day’s winners: 50cc Beginner

NCOM BIKER NEWSBYTES Compiled & Edited by Bill Bish, National Coalition of Motorcyclists (NCOM) DESPITE PANDEMIC, MOTORCYCLISTS MEASURE SUCCESSES

“Even in the middle of a global pandemic, we’ve succeeded in getting pro-motorcycle legislation passed and advanced our political agenda,” said National Coalition of Motorcyclists’ Legislative Task Force Chairman Frank Ernst to open the LTF Meeting during the recent NCOM Convention in Indianapolis, Oct. 16-18, 2020. In reviewing a legion of legislative victories over the past year, Ernst highlighted the fact that determined and resourceful bikers successfully lobbied to repeal a mandatory helmet law in Missouri and passed anti-profiling in Idaho, all the while dealing with the worldwide spread of Coronavirus and subsequent lockdowns, social distancing, travel restrictions, and related complications. On March 18, Idaho became the fourth state since 2011, behind Washington, Maryland and Louisiana, to pass a law (S.B. 1292) restricting law enforcement from discriminatorily profiling bikers for traffic stops and investigative measures. A few months later, on July 14, the “Show-Me” state showed the biker world how persistence and perseverance pays off by passing H.B. 1963 to repeal their helmet requirement for most adult riders 26 and older, on their fifth attempt since 1999. Additionally, the biker lobby worked with Congress to include several motorcycle-friendly provisions in the massive $1.5 trillion infrastructure bill, H.R.2 “Moving Forward Act,” including further prohibitions against motorcycle-only checkpoints, expanding profiling restrictions based on mode of transportation or style of dress, and furthering riders’ future advisory role with Congress. While this legislation will need a reboot with the new Congressional Session, bikers also succeeded in getting many key legislators re-elected to make the mission easier to accomplish with the new Senate and House. Riders’ rights activists from across the country went on to present the gathering with their own examples of legal and legislative accomplishments despite the odds and obstacles. “If we can rise above a deadly plague to effectively promote our issues, imagine what we can accomplish when life gets back to normal,” summed up Ernst to conclude the productive Convention forum. MOTORCYCLE SALES CONTINUE TO ROLL

The good times keep rolling, as the Motorcycle Industry Council (MIC) reports a new-model sales increase for the third quarter this year. Yearto-date sales of new motorcycles and scooters through September increased 10.2% compared to the same period last year. Erik Pritchard, MIC President and CEO, directed a message specifically to the thousands of people who work in powersports across the nation: "Many of us have faced tremendous challenges and genuine hardship," he said. "Think back on all the ways you've adapted your business to meet this crisis and get through the pandemic. Think back to how quickly you adapted to online commerce. Think back on your first home delivery. Recall all of your hard work. Recall the relief when the MIC's government relations team persuaded the federal government to declare dealership employees essential. Our industry is enjoying the results of those efforts and you should enjoy the moment." RIDER FATALITIES CONTINUE DECLINE

Preliminary estimates of 2019 highway crash data released by the National Highway Traffic Safety Administration (NHTSA) in October indicate that motorcyclist deaths continue to decline even as vehicle miles traveled or VMT increases. Motorcyclist fatalities fell 0.5% to 5,014 last year, a third consecutive year of declines in rider road deaths, amid an overall 2% decline in vehicle fatalities in 2019 (from 36,835 in 2018 to 36,096 in 2019). So far for 2020, data indicates a 3.3% decrease in motor vehicle fatalities through the second quarter, though notably total traffic volume decreased by more than 16% in the first half of the year during the Coronavirus pandemic. RIDING OFF-ROAD BIKES ON ROAD

While some jurisdictions across the U.S. are developing new laws to allow the use of off-road vehicles on city streets, police in New Haven, Connecticut have launched a new task force specifically to identify people illegally riding dirt bikes, ATVs, or other “motorized recreational vehicles” on any public property within city limits. That includes streets, sidewalks, parks, and playgrounds. The new ordinance increases fines for illegal riding to $1,000 for a first offense, $1,500 for a second violation, and $2,000 for a third conviction. In addition, the new law includes a $100 fine for service stations that sell fuel to anyone who arrives riding an off-road vehicle.

e’re always on the lookout for new and unusual places to grab a meal. So when I saw there was a new restaurant in the area called Southern Comfort, I just had to give it a try. I was not disappointed. Being there early, my wife and I ordered off the breakfast menu. So many choices, it was hard to choose. We both chose the Two Egg Platter with two eggs any style with your choice of country sausage, turkey sausage, Applewood smoked bacon or Benton’s country ham and served with your choice of toast or a freshly baked biscuit. Southern specialties breakfasts are served with country cinnamon apples and your choice of southern grits or home fries. There are also omelets, pancakes and French toast. On my next breakfast visit I will try a Breakfast Cocktail. The one that caught my eye was Southern Sunrise; Tequila, orange juice and grenadine and for breakfast, Savannah Praline Pancakes. They also have a great dinner menu. Of course being in the south, they have barbeque. The Smokehouse Platter comes with pulled pork, ribs and Andouille sausage. Barbeque orders come with a signature order of their sweet potato fritters and a side of your choice. For starters you might try the fried okra followed by Creole Jambalaya or Carolina Shrimp and Grits, or maybe the Texas Chicken Fried Steak with your choice of red-

eyed or southern pepper cream gravy. Whichever you choose for your entree’, rest assured you’re in for a true taste of Southern Comfort food. Top it off with a peach cobbler with house-made vanilla icecream, pecan pie, banana cream pudding, Southern Comfort Beignets with house-made vanilla ice-cream. Wash it all down with a selection of their huge drink menu. After eating breakfast there and having a chance to look over their dinner menu, I know I’ll be going back. ‘Knuckle’, an avid Harley man, finally proposed to his long-time girlfriend, even though she wasn’t so much into bikes. One evening after their honeymoon, he was working on his bike when his bride walked into his bike garage, stood there watching Knuckle as he worked in his happy place. His bride said, “Sweetie, I was thinking now that we’re married you could sell your bike and we could open up some small business together.” Knuckle almost fell over his bike. His wife said, “Oh honey, what’s wrong? Are you alright?” Knuckle said, “Wow, for a split second there you sounded just like my ex-wife!” She replied, “What?
