Get the porch ready for warmer weather The kitchen may be the heart of the home, but the front porch is like a handshake, welcoming visitors, serving as a connection point with the neighborhood and roleplaying as the first impression for passers-by and neighbors. “The porch is the calling card of your home,” says Susanna Salk, a design expert and author of “Weekend Retreats” (Rizzoli, 2009). “Don’t neglect it or, worse, use the space as storage. It’s an extension of the soul of the house.” Creating front-porch style is a simple weekend project. First, Salk says, head outside and look at your porch. How is it used? “Some porches are little portals into the house that you don’t notice much, and others are big spaces with a view.” Salk believes a small porch that functions as a transitional space into the house itself should echo the overall style of your home. “You should never shortchange this space, but it’s too small to create a completely new look,” she says. “If the porch leads into a traditional living room, don’t decorate it with tropical accents.” Alison Gelb Pincus, cofounder of One Kings Lane, a home-decor and accessories website, advises going vertical on a small porch. Her top three improvements include: • Paint the front door with a new high-gloss coat of paint, preferably in a color that pops. • Change out your hardware. • Hang a canvas or print specifically formulated for the outdoors from snow to sunlight. – HGTV

NAR Economist Lawrence Yun says there is a growing trend for empty nesters to downsize and use extra proceeds from the sale to buy homes to rent to their children at 5 to 6 percent interest return, versus 1 percent in the bank. He also says that the number of all-cash buyers has risen to a record high 35 percent of all sales and that the home buying affordability index shows to be the highest since 1971 for new buyers. As rents are going up, he notes that presently 40 percent of all renters could qualify to buy a home. Divide perennials with a shovel think about your garden. Cool temperatures help the transplants form roots in their new locations before the arrival of warm weather stimulates vigorous new growth. Abundant spring rain is also key to successful transplanting, helping reduce transplant shock and quickly settling soil in and around freshly dug roots, removing unwanted air pockets. Early spring is not only the best time to relocate plants, in the case of perennials; it is also the best time to divide them. If you are wondering weather your perennials need dividing, a close inspection of the crown will help you decide. Plants that have grown into clumps with multiple crowns are candidates for dividing. Recently a friend asked me what my favorite garden tool is. After thinking about the various tools that help make my gardening tasks easier, I decided that the simple pointed shovel was the one tool I depend on most – at least at this time of year. Early spring is when I start my annual plant relocation process, and my trusty shovel is frequently pressed into service. Inevitably, there are small trees, shrubs or perennials that have either outgrown their allocated space, crowding their neighbors, or that would look better somewhere else in the garden. Relocating plants in your garden is a relatively simple task and, after your first success, will change the way you

clumps, but the majority will benefit from dividing every three or four years. The best tool for dividing perennials is a sharp, pointed shovel. Start by digging the plant out of the ground, taking care to remove an adequate amount of roots with the clump. To ensure an adequate amount of roots, position the shovel point at the soil surface several inches away from the outer growing edge of the clump. In one quick motion, drive the shovel blade into the soil at
about a 45-degree angle. Continue the process around the plant until you end up where you started. Once the plant is removed from the ground, position the shovel point between two distinct growing points on the crown. Again in one swift motion, drive the shovel blade between the growing points, taking care to end up with roots attached to each separate piece. You now have two new perennials. Continued from 3

Loan modifications are hard to get Q: I am a Realtor and my husband was recently laid off. Our lender, which is one of the big box lenders, put us on a forbearance plan until July 2011. I’m not sure why they did not give us a trial plan or a permanent loan modification. We need a permanent loan modification, as we have had a drastic reduction in income. We are scared of the forbearance as this means the lender can foreclose on us at the end of the six-month period. We have friends and they got a loan modification while they were on unemployment and don’t understand why we can’t get one. Please help. A: While you may want a loan modification, it seems that most lenders have been rather reluctant to grant permanent loan modifications to their borrowers. In fact, only a very small percentage of borrowers have been helped by the federally sponsored loan modification programs. Given that lenders aren’t agreeing to many permanent loan modifications, your big box lender has given you a different short-term option. The forbearance allows you to pay less than you ordinarily would have owed and then add what you did not pay to the loan balance in the future. If you received documentation from your lender, that document would spell out your current payments, when you must resume making payments of a higher Ilyce Glink amount and the consequences if you fail to Tribune Media Services make those payments. It seems that banks will try to do whatever they can to avoid modifying loans for their borrowers. In your case, you probably have made all of your payments on your loan and are making whatever payments you are required to make to the lender now. If that’s the case, the lender appears to have minimized any damage it would sustain from your financial problems. And that’s the whole point of the program – to minimize any financial damage to the lender, not the borrower. If the bank gives you a loan modification, it potentially could get less income throughout the life of the loan. However, if it gives you some temporary relief, and you keep your loan, it minimizes its losses. Given your financial situation, you might want to revisit the loan modification possibility with the lender. If the lender won’t agree, it may force you to make a decision you were avoiding to make: to default on your mortgage and let the home go into foreclosure or sell your home. If you sell your home and the sales price exceeds the mortgage, the lender is made whole, but if your home is sold and the proceeds do not end up paying off the lender in full – a short sale – the lender will be worse off. Unfortunately, sometimes the short-term benefit to the bank seems to outweigh the long-term benefits. In your case, if you were to obtain a loan modification and make all your payments for the balance of the life of the loan, the lender would suffer a loss of income compared to what it would get from your current loan. If you default or go into a short sale, that loss may exist and be larger than the loss from the modified loan, but I’ve given up trying to figure why lenders would rather see loans go into foreclosure or short sale rather than help borrowers out. When buying a home, mean what you say and say what you mean when filling out the contract. That’s the advice of lawyer Jeff Marks, a partner with Ryan and Marks Attorneys LLP in Jacksonville, Fla. A real estate dispute in the Sunshine State illustrates his point. Christine and Nigel Gibney contracted to buy a house from Helen and Randy Pillifant for $620,000. The purchase contract provided that the sale was “contingent upon this property appraising for no less than $620,000,â€? according to court documents. Two appraisals were done. One arranged by the Gibneys (the buyers) came in at $560,000. The Pillifants secured an appraisal that valued their house at $635,000. The buyers refused to close and terminated the contract. The sellers sued for breach of contract, arguing that any appraisal of $620,000 or more obligated the Gibneys to buy the house. The Gibneys argued that any appraisal for less than $620,000 allowed them to terminate the contract. Who’s right? Florida’s Second District Court of Appeal favored the would-be buyers, ruling in April 2010: “In our view, ’appraising for no less than $620,000’ means that no appraisal may be less than $620,000,â€? the court ruled. “The appraisal contingency allowed the Gibneys to terminate the contract if any appraisal valued the property at less than $620,000.â€? Too often, homebuyers and sellers think a contract allows for one thing, when the language says something else. “Contingencies should be written in full sentences,â€? Marks says. “In this case, it should have read, ‘This agreement is contingent, at buyers’ option, on the property appraising for at least $620,000 as determined by the appraiser for the buyers’ lender,’â€? he says. “There’s no confusion in that language.â€? Here are four ways to avoid making common contract mistakes. • Give yourself time to get a loan. Many contracts are contingent upon the buyer getting financing by a certain date. In today’s tough lending climate, buyers are wise to allow themselves plenty of time to get mortgage approval for a loan. If the date passes and no financing has been secured, the sellers may terminate the contract and keep the earnest money deposit. • Be specific about which items stay with the house. You’ve heard the story of the buyer who walked into a new home only to discover that the refrigerator and chandeliers were missing. Check the contract. As a seller, be sure you specifically state on the contract what will stay with the home. As a buyer, pay attention. Don’t assume that the sub-zero refrigerator is yours once you close. • Know the effective date. The contract doesn’t always go into effect on the day you sign it. In every contract, certain things “must be done within X number of days from the effective date: inspections, loan applications and approval, title searches,â€? Marks says. “If you don’t know the date that the contract went into effect, you may not have a valid contract.â€? • Get everyone to sign. “Sometimes the home is owned by both spouses, other owners or an entity such as corporation,â€? Marks says. “Make sure all of the parties sign the contract. If a party to the transaction fails to sign, they’re not bound to perform the contract.â€? You’ve heard it before: Buying a house is one of the biggest financial decisions you’re going to make. Says Lawton: “Make sure everything that’s important to you is in writing.â€?
