If you can’t get that title insurance coverage for one reason or another, you’ll have to investigate who performed work on the property and start asking those contractors questions about whether they got paid or not. If you get enough information, you might decide that the risk of liens is relatively small and proceed with the purchase. If not, you’ll have to factor into the price you pay the amount you may have to shell out to contractors to remove any future liens that pop up. Lastly, if liens have already been placed on the property, you can usually get copies of those liens by going to the office in the county or municipality in which the property is located and ask for copies of those documents. You can also get copies of these documents from the title insurance company or closing attorney. And if the liens are out there already, you can condition the contract on the seller removing or paying off those parties prior to closing. Q: I am in the process of buying a new home. It’s a foreclosure. The lender foreclosed on the developer. In doing my due diligence on the purchase, I noticed some contractors were not paid. Will these contractors be able to put liens on the house after I close on it? A: The short answer is yes. Most contractors can put a lien on a home when they have been hired to perform work on a home and they are not paid. In some states, contractors have a certain amount of time to put a lien on a home. Some states even require contractors to give the owner notice of the lien before the lien can be effective. Each state has its own contractor’s liens statutes and they can be quite complex. Now that you know that contractors can lien your property, you also need to know a bit more about liens and the lien holder’s rights. A lender’s mortgage lien is of the highest importance and can trump all other liens. For example, if the builder took out a loan to put up the home and the lender recorded that mortgage against that property, that lender’s lien may have priority over all other liens. If the lender forecloses on the home, the lender may have the ability to wipe out all other subordinate liens, including contractor liens. There are some peculiar circumstances that can crop up and make life difficult for you, so buying an owner’s title insurance policy and hiring a good settlement company are important. If you suspect there could be liens against the property, you need to make sure that the title insurance company and settlement attorney or closing agent issue you a title insurance policy at closing that would protect you against any and all possible contractor and materialmen liens that could pop up. If you have obtained that coverage on your title insurance policy and liens do pop up, you would need to file a claim

What colors are they predicting we’ll fall in love with? Let’s see what the Color Marketing Group tells us. First, let me tell you that the CMG is the leading international nonprofit association of color-design professionals, and has been accurately predicting color trends for more than 45 years. The predictions seem worth looking at. Purple is a hot fashion color this year and has been in the limelight since last fall. Grayedout violets are in and they work well as an accent or as a neutral. Some redder, plummier purples are making an appearance. Green was the big deal in the past with all the green-living push we’ve had, but now it’s blue. And the blues that are popular include watery blues and sky blues mostly, but just about any blue you might choose will
fit into the color trend for this year and a few more years to come. Grayed-out browns and plain old grays are the new sophistication in color. The reason given for the craving for these hues is the economy. An economically challenged economy begs for complex grays. These grays also bridge the area between black and brown where black is too harsh yet brown is not strong enough. Yellow is popular again. After all, yellow against gray is eyepopping. Here again, the droopy economy begs for vivid and energetic colors to lift us up. Remember back in the ’80s when gray and yellow were very much “in“? It wasn’t so much a result of the economy then, though. The new business color is white. Even corporate boardrooms are showing white in their decor. Technology has given us practical finishes, allowing us to use white in just about any
setting. We are seeing matt instead of gloss. We see textured whites instead of smooth whites. And all the finishes are washable and cleanable. The psychological reason given for our new craving for white, particularly in business atmospheres, is that white represents purity of thought, motive and result. Mauve is back. Say it ain’t so! The CMG tells us this old color looks new again in dusty violet shades. It works as an accent, but also serves as a neutral. One of the most difficult tasks a designer has is making an old decor look new again, particularly if the owners love the old and want only to upgrade some things. Finding the perfect match in fabrics and accessories is sometimes impossible when a color fades from fashion. Now with these old colors coming back into view, perhaps this is the perfect time to upgrade without having to redo the entire decor.
