Happy New Year I would like to take this opportunity to give my New Year’s message to all the members of the HOA of Centurion Residential Estate and Country Club. Firstly, I would like to thank the Board of Directors for their efforts and commitments that made 2013 such a success. A lot was achieved during the year and the one aspect we are very proud of is our security record. There was also a significant improvement on aesthetic standards across the Estate. Secondly, I would like to thank all the home owners for their assistance in making the tasks of the Home Owners Association easier as well as the contribution that
each home owner made towards making our Estate what it is today. We are looking forward to a challenging 2014. Our Estate is an address of aspiration and inspiration and with the plans in the pipe line for 2014, both inspiration and aspiration will only increase. I would like to invite all home owners to contribute towards the elevation of the Estate to even higher levels. I wish all home owners and their families a very happy and prosperous 2014, and let us build on the successes of 2013 to make 2014 a year to remember! Sias de Klerk
Festive wishes After a year of many accomplishments, challenges and half a new Board of Directors the time is now drawing near when the year will end, and hearts and thoughts turn towards home. Like the shepherds of old who journeyed to the manger marked by the star, many of you will travel to a destination to spend some quality time with loved ones. For many, Christmas is also a time for coming together. But for others, daily tasks will come first. And those who have lost loved ones may find this day especially full of memories. That's why it's important at this time of year to reach out beyond our familiar relationships to think of those who are on their own. At Christmas I am always struck by how the spirit of togetherness lies also at the heart of the Christmas story. A young mother and a dutiful father with their baby were joined by poor shepherds and visitors from afar. They came with their gifts to worship the Christ child. From that day on he has inspired people to commit themselves to the best interests of others. I wish all our residents a blessed and joyful festive period with their loved ones, travel safe and be responsible. May 2014 be a year of highlights, smiles, neighbourliness and prosperity. I do hope that Father Christmas will be bringing a little something for our guards as well... Many of our residents ask why I am appealing for a donation for our guards. I strongly believe that a small token of our appreciation towards the guards will go a long way towards strengthening our relationship with them and the lack of crime on our Estate is a testament to the dedication of our security company. GOLF BALLS STRAYING INTO YOUR PROPERTY Being a resident on a golf estate has a certain allure. That is why you have elected this particular lifestyle. And as the Centurion Residential and Golf Estate has that additional enchantment, you purchased a property in the Estate. Lining on the edge of the golf course has its own interesting and unique problems. As not all golf players are Tiger Woods in disguise, you will inevitably have golf balls ending up against your house or in your garden with the pursuing golfer shortly thereafter. This will not only cause inconvenience to you but may also cause damage to your property and worse, injury to you, a family member or a visitor. As the golf course is your neighbour, the neighbourly relationship can quickly turn sour. The Judgement by Justice Dlodlo in the matter of Tiffin v Woods NO and Others [2007] 3 ALL SA 454 (C) noted that a dispute between neighbours invariably involves the question of whether there was an abuse of a right. The facts of each matter individually should therefore be examined to determine if the neighbour whose conduct is being complained of, exceeded his powers of ownership. This issue must be answered with reference to considerations of reasonableness and fairness. The powers of ownership extend only as far as there is a duty on a neighbour to endure the exercise of those powers. If a neighbour exceeds those powers, he infringes on the right of his neighbour. Interference will become unreasonable when it ceases to be “expected in the circumstances” or when it becomes such that a neighbour need not tolerate it under the principal of “give and take” or “let and let live”. This would constitute wrongful conduct tested against a reasonableness test. What is reasonable must be assessed objectively and with regard to the circumstances of each particular case. Broadly, it may be said that a useful test is perhaps what is reasonable according to the ordinary usages of mankind to living in a society, or more correctly, a particular society. In an unreported case of Campbelltown Golf Club Ltd v Winston and another, case number NSWCA CA no. 40056/1996, the foreign court dealt with the question dealing with a golf course and balls
that landed on the neighbouring properties. The court stated that what was required was that the golf course should so adjust its activities as not to interfere unreasonably with the peaceful enjoyment by residents of their land. At the same time, the residents, bordering as they did a golf course, had to accept the fact that the game of golf was going to be played on land adjoining their properties and that it could be expected that from time to time some golf balls might come on their land. Clearly, the odd golf ball every now and then should be tolerated by you, as the owner of the adjoining land, in good neighbourliness. But how much tolerance should you have for the neighbour golf course? Justice Griessel handed a more recent judgment down in the Western Cape in the matter of Steenkamp and Steenkamp v Knysna Local Municipality and Another under case number A20/2011. He considered the question of nuisance and quoted Appeal Justice Harms with approval. The determination of when an interference so exceeds the limits of expected toleration is achieved by invoking the test of what, in the given circumstances, is reasonable. The criterion involves an objective evaluation of the circumstances and milieu in which the alleged nuisance has occurred. This evaluation is to decide whether it is fair or appropriate to require the complainant to tolerate the interference or whether the perpetrator ought to be compelled to terminate the activities giving rise to the harm. In essence, this is achieved by comparing the gravity of the harm caused with the utility of the conduct which has caused harm. The court further elaborated on the question of reasonable measures to be put in place to prevent or attenuate the disturbance. The above comments were made with the appeal court ruling in the matter of Allaclas Investments (Pty) Limited v Milnerton Golf Club 2008(3) SA 134 (SCA) in mind. Allaclas Investments had built a residential property in early 2001 next to the Milnerton Golf Club, at which the game of golf was played since 1925. Notwithstanding the fact that Allaclas has erected netting of 4,7metres high, a very large

proportion of badly aimed golf balls found their way over the netting. Over a 28 month period, 875 balls were found within the area, despite the netting constructed by the owner of the property at both the southern and western sides of the property. The Supreme Court of Appeal found that the number of golf balls was excessive and unreasonable, as it could have caused damage to property or injury to person, despite the preventative measures in place. The court therefore ordered the golf course to halt play on the sixth hole until the golf course has introduced effective measures to avoid or reduce the number of badly aimed golf balls striking the property of Allaclas. It should be noted that a large number of factors was considered by the court including the wind, the design of the hole, the design of the house, the preventative measures taken and even the advancement in technology causing golfers to consistently hit the balls higher and further than previous years. In short the neighbours, both the golf course and the owner of the adjacent property should consider each other. Although the owner has elected to purchase a property adjacent to a golf course and accepted the additional nuisance of the game of golf being played, the golf club should also consider its neighbour in the design of the course. These include the positioning of the tee, the width of the tee shot and the par of the hole. Simultaneously the owner will have to accept the risk of the game of golf being played on his doorstep and actively manage the risk of damage to property and injury to a person. Consideration of positioning of entertainment areas, large glassed areas and preventative measures like netting, must be taken. Each case will be considered individually, especially by the courts. Therefore, the odd golf ball landing in your garden with no risk of damage to the property or injury of a person will be deemed as normal and acceptable. Confirm with your insurance that the property is correctly insured for accidental damage by the straying golf ball. And enjoy the privilege of residing on a golf estate, with the luxury of space and a view.
Birdrunner: Fun in the holiday sun
It gives me pleasure to divert from my ‘Five steps to birding’ in this issue to share with you a few fun ideas for the holiday season. Some of us will be away on holiday, whilst others will be spending the long, lazy summer days at home here in the Estate. (O.K., I agree that “lazy” will not be applicable to those of us that will be working over the Festive Season, but let’s all try and make it an enjoyable time of year, no matter where we spend it.) Count the k’s Forget about the kilograms (many lifestyle magazines may make you feel guilty about all the Christmas foods) and start counting the kilometres! If possible, do not wait to make it a New Year’s resolution to walk/run more: then it easily becomes a task instead of a pleasure. • I f you have a GPS sports watch or a pedometer, keep track of the number of kilometres you walk and/or run over the holiday period. Set yourself a target and see how you progress towards achieving it. There are many ways in which you can log the kilometres, for example by using the Kilometre Meter: a log sheet designed by the Birdrunner which you can put against the fridge door.
Take a sheet of paper and divide it into a number of blocks. Number the blocks and use two different colours of self-adhesive labels to indicate the kilometres for alternate weeks. For example, if you run eight kilometres in week 1 and walk seven in week two, your Kilometre Meter could appear as follows (start week 3 with the same colour used in week 1).
The Garmin Forerunner 110 is a great Christmas gift to give or ask for. A few of the many things you can do with this GPS watch are:
o Store information about past activities. o Upload your activities onto the Garmin website to keep track of distances, routes, time splits for different laps (eg. kilometres); to compare different runs; to show graphs of your speed and the estimated elevation; etc. You can find the watch at stores like Sportsmans Warehouse or shop for it online. Other makes and models also exist and you can do some research and make some enquiries as to which watch will suit your needs the best. The Birdrunner has found the Sweat Shop at Southdowns to be a useful and friendly source of information about almost anything to do with running.
A cheaper option would be to buy a pedometer for less than R100 at Game. This gadget counts your steps and calculates the equivalent distance covered. Though it may be less accurate than a GPS, it is still a very useful tool and it can be very motivating to try and improve on your previous record of most steps in a single day. • T ake part in the road/off-road races in Gauteng or around your holiday destination. Don’t be put off by the word “race”: many of the road races around Gauteng attract more than a thousand participants and don’t be mistaken: not all of these participants run or walk fast! Although there are usually cut-off times involved, most of these cut-off times are lenient and will allow slower runners or walkers to also finish and get rewarded with a medal. You can start with entering a five kilometre fun run at one of these races and see if you enjoy the atmosphere as much as the Birdrunner does. And enjoy coffee and a pancake afterwards on behalf of the Birdrunner! The Cape Robin is a mainly resident breeder and is found in southern and eastern Africa from Kenya through to South Africa. It is a common species at forest edges and in other dense vegetation, foraging at and close to ground level. They are territorial and, once they have moved into a garden, they become quite confiding around the birdfeeder or birdbath, and they do love to take a bath.
This well known bird is commonly called the Cape Robin and is probably our best loved garden bird as it is entirely an insect eater.
These birds are early risers and their song can already be heard before sunrise. Their call has given rise to the Afrikaans name “Jan Frederik”. The Cape Robins are insectivores, as their diet consists of a variety of insects they mainly find on the ground. They easily get used to being fed in gardens and if their regular treat is not forthcoming, they might come calling at your door! Both sexes look alike. It is about 16-17cm long. The adult’s upper-parts are pale grey with a orange breast. The chin, throat, under-tail coverts and outer tail feathers are also orange, and the central tail feathers are brownish-grey. The bird has a short and strait black bill, pinkish grey legs and feet and brown eyes. The juvenile bird is dark brown and buff below, heavily marked with buff on the upper parts and grey-brown on the breast. The Cape-Robin mostly nests from August to January. They build a cup shaped nest of coarse vegetation, and line it with fine material-like animal hair. One of the pair will dowse his/her under feathers and use the moisture to soften and shape the material for the nest. The nests are usually concealed low down in a bush, dense creepers or old tree stumps.

CAPTAIN’s report This weekend saw the conclusion of the South African Open, which was won by the Danish player, Morten Madsen. This is only the 11th time that the trophy has been won by a foreign player. Runners up were JB Kruger (his caddie is our very own Jason Reynolds) and Hennie Otto. Charl Schwartzel was well in contention until the 6th hole and fell out of the bus with a triple bogey. The comeback of the week for me was Darren Fichardt who posted a 5 over for the 1st round and followed it up with an amazing 7 under on round 2 to make the cut! Well Done Darren!

Sunday, 27 October saw the car park littered with cars and an Idols Bus standing in the middle of the driveway. Visitors to our course were confused as to the nature of the bus and some even enquired as to what was going on. Well, it was the annual Captains Invitational where we whisk you off to an unknown destination for the day. 47 Golfers (1 overslept) were greeted with Champagne and Orange Juice as a morning welcome drink and were loaded on the bus to… The Wanderers Golf Club. While some thought we were playing here, this was only a smoke screen. We were all treated to coffee and muffins, followed by a buffet breakfast after which everyone was loaded on the bus again to be taken to The Eye of Africa in the south of Johannesburg.
- We are finally playing the 7th again after what seemed like an eternity and we are now playing the par 3’s off a flat surface again. I must, once again, thank all our members for their patience during these times.

As the year winds down, I am sure that everyone is reflective of what has been a hectic year. As far as the golf course is concerned, these are my reflections:
- We have initiated the monthly Toits Captains Challenge which continues to be well received by all concerned. We are blessed to not only have Toits Butchery as our main sponsor, but also Jannes’ supplies who sponsor the closest to the Pins. - Our league teams failed to reach the heights of previous years but I am sure we will once again raise our levels in the New Year. - We were runners up in the annual “River Runs through It” competition.

- We flooded early in the rainy season following the work done on the 7th, but the course was playable the next day – touch wood, but it seems as if the investment has paid off. Please keep your eye on the notice board for the league teams for next year, as we are certain to start late in January or early February, and we don’t want you to miss out on the chance of representing your club. The year is really ending on a high... last weekend we had the Festival of Golf played here at the club, starting with the ‘Green Keepers Revenge’ on Friday afternoon, Sikkels Golf Day on Saturday, night golf Saturday night then finishing off with the Mixed Open on Sunday morning. Wow! What a weekend it was... Jannes, Hans and Juan in the Pro Shop, you guys did an awesome job in making sure all four competitions ran smoothly, thanks guys your efforts are very much appreciated by us all. Thanks to Amarille and her staff for the great lunch that you laid on for us on the Sunday at the Open Mixed, you did Centurion CC proud. The winners of the Open Mixed were Joey and Louis du Toit partnered by Nico and Florence Vermulen on a score of 93 points. Second place went to Wim and Anna Skinner and their partners Rosa and Pierre Lombard on 90 points. Third place was won by Pat and Bev Mulligan and their partners from Kyalami CC Fuzzy and V da Silva with 88 points. Today (26 November) the Early Birds had our year-end function. We went on an away trip to Ebotse Links. What a great day we all had. The day started with a round of golf followed by some most welcomed drinks then a very nice lunch. The staff at Ebotse Links really out did themselves making us very welcome at their beautiful course. We played four ball alliance and the day was won by Koko Mashigo/Piret Vilborn/Shadi Mohuba and Johanna Rathete on a great score of 88 points. It's a day that Elize Visser will remember for a very long time as she got a hole in one on the 15th hole. Congrats to Elize. I felt like I got a hole in one as I got a birdie from 147m out, that's about as close as I am going to get to a hole in one for a while I am sure.

FESTIVAL OF GOLF Getting into the spirit of things, we kicked off our Festival of golfing weekend with the fun Green Keeper’s Revenge which took place on Friday, 22 November. The chaps from Servest got their own back by setting up a challenging golf course with different shots at different holes. Fun was had by all and the event concluded with prize giving and snacks on Friday evening after the round of golf. Early Saturday morning, 23 November was the start of the 7th Annual Sikkel’s Golf day with a full morning and afternoon field concluding with dinner and prize giving afterwards, and then Night Golf for the very brave determined golfer. Jannes and his crew got to bed after 1am in the morning but everyone agreed unanimously that it was a fun ‘night-out’! Our annual Mixed Open concluded a full golfing weekend on Sunday, 24 November with a lovely prize giving lunch that Amarille and her staff prepared. SUPER 8’S vs SUPER STUDS REVIVAL GAME For those who do not know, many years ago, a group of not so young players, jokingly named the Super 8’s by Kevin Stone when called to the tees, became well known in the Centurion Country Club golfing fraternity. Like all good western movies, it was not long before the old guns were challenged by the young ‘uns. This group of young, bold and aggressive golfers, the Super Studs, led by main man, Victor Markram, took on the older, wiser Super 8’s in an inaugural Ryder Cup style game way back in 2005/6, which the Super 8’s won. The next two games were won by the Super Studs with rather big margins and the reason given by the last team captain, Pat Mulligan, was that the Super 8’s were not really selected for their golfing prowess, but rather for their team spirit, socialising, etc. From the very first game, a great spirit and camaraderie developed between these two teams. Unfortunately, due to most of the Super Studs relocating, these great golf and social meetings seemed, as they say in the classics, to be done and dusted. But, like all good things, after a time warp of about six years, all changed back to the way it was. Under the renewed leadership of Victor Markram, and his old and new band of merriment, a revival game between the two old teams was played on 2 November 2013.

The format was the usual Ryder Cup style draw, this time with 12 single matches, drawn randomly. From that it is clear that the Super 8’s and Super Studs had by now grown to an enjoyable complement of 12 members each. The results of this great return game between these two old rivals could not have turned out better, as the game was drawn with 6 pts each, with the last match being the deciding factor. Great moments were relived and new tales regaled with snacks and the usual drinks afterwards, and apparently, according to witnesses, the total encounter was actually won by the Super 8’s, with the last team to leave the battlefield being the strongmen, Tony Postma and Colin King. It is envisaged that that these two teams will meet at least twice annually, playing for a rather unique trophy conjured up by Colin King and Toby Adelaar… a small log of the tree blown over near the HOA on the 10th fairway and smartened up by Tienie de Villiers. It can safely be said that almost every golfer on this Estate has on some occasion had some encounter with this thorn tree, usually followed by some rather spicy language. Well done to Jannes and the organising gentlemen for this great, renewed golfing experience.
