Cancellation of a gymnasium contract We all have had New Year’s Resolutions. This year we will start exercising, eating healthy and spend less time at the office and more with the family. And in keeping with your resolution, you joined the local gymnasium as soon as you returned from your December holiday. It did not bother you that the agreement was for two, three or four years. The longer the better, you thought on signing. This year you are going to keep that resolution. And being fit will greatly improve your Saturday afternoon golf. Suddenly you realise Easter Weekend has passed and you spend more time at the office and at the fireplace and are less frequenting the gymnasium. Soon you recognise the debit order of the gymnasium on your bank statement, knowing that you have not been there for at least two months. The Consumer Protection Act (“the act”) has limited the effect of fixed-term agreements with automatic renewal clauses for a further fixed term. As the legislator has given a wide definition to the words “goods” and “services”, most fixedterm agreements will fall under the auspices of

the act. Section 16 of the act provides that any consumer may cancel a long term agreement on twenty business days’ notice, which notice must be in writing, unless both parties to the agreement are juristic persons. The act provides that the supplier may be entitled to a “reasonable cancellation penalty”, payable by the consumer for cancelling the fixed-term agreement. Depending on the type of contract, the interpretation of this term will be different. Lester Timothy of Denys Reitz Attorneys uses the fine example of a mobile contract, an analogy most of us will understand. A consumer enters into a two year contract with a mobile service provider and purchases simultaneously a handset to be paid off in monthly instalments over the course of the two year contract. The mobile service provider will thus have incurred expense regarding the handset. Subsequently, it will be acceptable for the mobile service provider to charge the outstanding balance of the handset to the consumer to recover the incurred cost in the event of the consumer cancelling the contract. cost as a result of the consumer’s cancellation, the supplier will have more difficulty to establish the reasonableness of any cancellation penalty if no discount was given. You are therefore entitled to approach the gymnasium and notify them in writing of the intention to cancel the agreement with twenty business days’ notice. Depending on the remaining period of your contract and the wording of the agreement, you will have to pay a reasonable cancellation penalty. However, if the gymnasium did not incur significant additional cost as a result of your cancellation, which is in most instances, you will be entitled to a discount on the remaining balance of the agreement. Negotiate the cancellation penalty fee with the gymnasium. You may be surprised what the offer of an immediate payment as cancellation penalty can do. And next year, rather buy running shoes, even expensive ones. The shoes will wait patiently till the following New Year’s resolution…


Birdrunner: Experiencing Oceans In this edition, I would like to share my experience of the Old Mutual Two Oceans Marathon with you. For those readers who do not know, the Old Mutual Two Oceans is a popular running event held on an annual basis in the Western Cape over Easter weekend. If you are considering going away next Easter, the Old Mutual Two Oceans might provide some exciting options for you. This year’s event again had activities for the whole family:

• The Expo From the Wednesday just before Easter up to Good Friday, the Expo takes place at the CTICC (Cape Town International Convention Centre). At this Expo, you have to collect your race entry pack (for the 56 km this contained a nice goodie bag, our race numbers, some guidelines regarding the day and a beautiful Adidas running shirt. Here you can find almost anything that you can think of that is related to sport: exciting sports gear, gadgets, nutritional products, health checks, entries for other races, competitions and many more. And, of course, food and drink for shoppers running on empty.

• Church service Another one of the Easter weekend events is the interdenominational church service. This year it was held in the registration foyer of the CTICC at 15h30 on Good Friday.

• Trail running Both a short (10 km) and a long (22 km) trail run take place on the morning of Good Friday. These are run in the forests in the vicinity of the University of Cape Town (UCT). I would like to know how many people are brave enough to run one of the trail runs and the ultra marathon the next day…

Even if you do not have a previous time, you can still run, but you will have to stand in the seeding pen furthest from the starting point. Finally we get to the 56 km ultra marathon in which my husband and I took part – he for the first time and I for the second time. The 2014 race was the 45th consecutive Old Mutual Two Oceans Marathon and started at 06h30 on the Saturday morning. For this race, one has to be at least 20 years old on race day (now I am giving away my age ☺ ) and has to qualify beforehand by running a qualifying race within a prescribed time (for example, an ASA standard marathon in under 5 hours). You can find more information on qualifying and seeding on the Two Oceans Marathon web page: http://www. twooceansmarathon.org.za. The race, often called “The world’s most beautiful marathon”, starts in Main Road in Newlands, passes Muizenberg, Fish Hoek, Noordhoek, Hout Bay and other beautiful places, and ends on the sports fields at UCT. You can ask anyone who did it before about the two notorious hills of a few kilometres each that await participants: Chapman’s Peak and Constantia Nek. There are different prizes and different medals for different places and/or finishing times. Although an additional R1 million of prize money was offered for winning the race AND breaking the record in 2014, no-one was able to better the 3 hours, 3 minutes and 44 seconds for men that was set by Thompson Magawana in 1988 or the 3 hours, 30 minutes and 36 seconds for women that was set by Frith van der Merwe in 1989. How can I summarise my 5 hours and 37 minutes in only one word? Lovely…

• Road races A series of twelve fun runs is held in the months preceding the Easter weekend and aims to involve local communities.

My ten tips

There is also a variety of fun runs held on Good Friday. Some of these runs are specifically for kids, like the 56 m Nappy Dash (for kiddies under 4 years) and the 300 m Toddlers’ Trot (for kiddies 4 to 6 years of age), whereas others are for the whole family (and cover distances of 2,1 km, 5,6 km or 8 km).

If you buy something at the Expo (shoes, nutritional products, etc.), rather use it only when you are back home (unless your baggage got lost…).

Stephanie Gobe, a colleague of mine, ran the 5,6 km and boasts a beautiful medal. A fun run is a good option for family members of half marathon and ultra marathon runners, as it enables them to also experience some of the action first-hand. But don’t be surprized if you, like Stephanie, are inspired to run at least the half marathon the next year… The 5 km International Friendship Run on Good Friday morning provides international participants and their families and friends with the opportunity to fly their countries’ flags in the City of Cape Town. Friends of mine from Lichtenburg ran the 21,1 km together as husband and wife and indicated that they thoroughly enjoyed it. This event starts at 06h00 on the Saturday and was held for the 17th consecutive time this year. Participants are seeded (ranked into

abcdefghijkm influence on your race, so be prepared that you might have to adjust your pace. Tip # 5: Fuel up I know this is a contentious issue. For me, carboloading seems to work. But I consume almost only complex carbohydrates, which sustains energy for longer. Don’t eat too much the night before. Make sure you take enough food or your preferred source of energy on the day of the race – find out what works for you on a long run long enough before race day. I try to go as natural as possible, but we all have our own preferences. I mainly use bananas, Race Food (obtainable from the Rockets Sports Store at Dooringkloof Mall) and Rehydrat Sport.

Tip # 6: Listen to your body Don’t run if you are ill.

Tip # 7: Walk before it is too late This may not work for everyone, but I have run PBs over many distances when I incorporated some strategic short distances of walking. Find out what works for you.

Tip # 8: Carry a R50 note with you I wish I had some money on me for after the race. We were waiting for some of our team members to finish and it would have been nice to be able to buy a coffee, more water and something to eat just after finishing.

Tip # 9: Take a (clean) garbage bag with you The morning of the race can be quite cold. A large plastic bag offers some protection against chilly weather or rain. Please make sure that you throw it into a dustbin or as close as possible to a rubbish collection point when you get rid of it (and not in the middle of the road!) – many bags and other items dropped by runners obstruct the road for those of us running at the back of the field and one can easily fall over a bag in the dark. Tip # 10: Enter on time To avoid disappointment, make sure that you visit the website soon to read about the closing dates and requirements for entering for next year’s races.

Tip #2:Get enough rest

Try to sleep enough and well two nights before the race. It is quite difficult to sleep well the night before the race, but don’t let this bother you. Don’t walk too much the day before the race.

Although I was too tired to make use of the many birding opportunities the area has to offer, I would like to mention a few of the possibilities:

It is far to walk to the start if you park at the finish, but afterwards you might be glad if you parked there – just build in enough time to get a good position in your seeding pen.

CAPTAIN’s report The first and second Hokaai Captains Challenge events have now come and gone. I had the pleasure of doing the prize giving on 26 April. I have attended a few ‘Meat Comps’ in my time and I have to admit that the prizes handed out were truly awesome! I can only see this competition going from strength-to-strength.

Centurion Country Club hosted the first ‘Big Easy’ tournament a few days ago and congratulations to Kevin Stone who finished 3rd. I am not sure if you are all aware of what our Local Government plans for our river? They are in the planning stages but let’s hope that they are realised and completed. This plan is on the notice board at the post boxes if you would like to have a look at what is envisaged.

Obviously this could not be possible without the wonderful sponsorship offered to us by Pieter Roodt from Hokaai Vleis Mark! Once again, thanks a million!

By the time you read this article my term as Lady Captain will sadly have come to an end. I have served on the ladies committee for the last 4 years... 2 years as a committee member and the last 2 years as the Lady Captain.

It has been a most fulfilling 2 years and I have to thank Nicola, Errol and the guys in the Pro Shop Jannes, Hans and Jean for always being close on hand to assist me in my tasks. I would also like to say a huge thank you to Amarille and her team for always coming to the party and providing a superb meal at all the functions that I have hosted. To all the members of Centurion Country Club thank you for all the support I received over the last 4 years... it made it all so worthwhile. Last Wednesday, 16 April I held a ladies competition as my "Farewell" and it was very well supported with 50 ladies taking part. There were ladies from many other clubs taking part as well and it was very special to see the support I got on the day. The prizes were sponsored by Whitehouse, Sue Smith, Debra Arroyo and myself. 5th Avenue Jewellery sponsored a lucky draw prize. BLESHOENDER WEEKEND IN PARYS The Bleshoenders started to go on annual weekend tours in 2001. The first seven tours were all to Swaziland but as the Blessies aged over the years, shorter travelling distances became more important and the previous three tours were all to Parys where we stayed in the Le Grand Chateau Hotel. This year’s weekend tour was the fourteenth and took place on the weekend of 11 to 13 April. The hotel is relatively small and all the weekend guests were Blessies. The main tour organizer was Jan Schutte with Toby Adelaar and Willie van der Lingen as his two main aide-de-camps. On Friday we played golf at Vaal de Grace and on Saturday at Parys Country Club. Congratulations to Barry Robinson who won and Myra Roberts who came second. This year we also had a bridge tournament on the side and congratulations to Helene Renwick who was the winner. On Saturday the non-golfing ladies enjoyed a lovely lunch at Style and shopped till they dropped. Each tour member had his/her daily duty to see to (photography, controlling, pins, fines, etc). Toby Adelaar as the Judge with Pat Mulligan, Jannes Sik and Giel Smit as the fine masters had us in stitches on Saturday evening while they were actually emptying our purses. Myra Roberts and Frik Venter were responsible for identifying the ‘Big Stirrer’ of the weekend. Myra, with a tradition of very subtle stirring, was this year not subtle enough and was eventually unmasked as the Big Stirrer herself! All of us had lots of fun and thanks again to all the organisers for a most enjoyable weekend filled with laughter and camaraderie.

El-Shalem Haven The Bleshoenders together with the continued support of Gerhard Coetzer's Lyttleton Superspar sponsored a much needed computer and monitor to El-Shalem Haven through their annual fundraising efforts on 1 May 2014. Gustav and Roedolf from the Spar together with Hennie le Roux and Jan Schutte from the Centurion Country Club's Bleshoenders delivered the new computer to the haven on Wednesday, 23 April 2014. El-Shalem Haven is a non-racial private learning establishment for children and young people with severe disabilities and/or special learning requirements. A need was identified in the greater Centurion area due to a shortage of such facilities for these children and young people who are delicately different. They opened their doors on 7 January 2013. The haven is located in Centurion and offers a safe nurturing environment that addresses the spiritual, social, cognitive and physical requirements of children at their own pace.
