Well-intentioned suggestions made by those who view Turkey from the outside always converge on the same point: conciliation.

EU Enlargement Commissioner Olli Rehn and German constitutional law expert Professor Andrew Arato, too, tell us to seek conciliation as the shortest path to solving our problems. Here, however, is a problem: In the new parliamentary term, every attempt for reform should rely on conciliation, but between what sides? To attain the widest possible conciliation in doing something is definitely the best way to do it. It would be an ideal situation if all political powers in the country could align their policies in certain issues. However, in today's Turkey, this is very hard or even impossible to attain.

With the conclusion of the closure case against the ruling Justice and Development Party (AK Party) last month, which had led to months-long political and economic uncertainty in the country, Parliament is expected to handle Turkey's real agenda items when it returns from summer recess on Oct. 1. Recent political developments in Turkey -- such as the Constitutional Court's annulment of a reform package that received the support of 411 deputies which would have lifted a ban on Muslim headscarves at universities -have shown that there is an urgent need to make constitutional amendments to balance the powers and responsibilities of the state's legislative, executive and judicial branches so as to prevent each branch from interfering in each other's domain of authority.

According to Sabah's Erdal Þafak, political actors will face a very challenging agenda when they go back to work in October. He describes Parliament's first and most important duty as redefining the relations of the state's legislative, executive and judicial branches, establishing a balance among them, strengthening Parliament's position as the only address of the nation's will and reinforcing its dignity and transparency. "In other words, [Parliament] is to develop a democratic braking mechanism against the arbitrariness of the executive branch. It is to strengthen the supremacy and independence of law on the one side and end the authority confusion, which urges the supreme judiciary to interfere in the business of the political domain on the other side," explains Þafak. He suggests that Parliament should work on a new Constitution or make extensive constitutional amendments in order to reinforce the democratic legitimacy of the legislative, executive and judicial branches.

In addition to these, he says Parliament should prepare a new Law on Political Parties and Elections Law. "In taking these steps, the biggest responsibility falls on the shoulders of the AK Party because it is the governing party and therefore has a part in the political crises, and this heavy responsibility obligates it to reach a consensus with the main opposition Republican People's Party [CHP]," comments Þafak.

Zaman daily's Mustafa Ünal, referring to an action plan that was announced by Nationalist Movement Party (MHP) leader Devlet Bahçeli on Tuesday for the new period, says Bahçeli's action plan includes proposals that will contribute to the normalization of politics in the new period. He agrees with Bahçeli that constitutional amendments should be made that will prevent party closures unless they resort to violence or engage in or support terror activities. Ünal says perhaps the AK Party, which initiated headscarf amendments with the encouragement of the MHP but later suffered from having taken these steps, may act hesitantly in regards to the MHP's action plan; however, he notes that there is no other way for the AK Party to reconcile with the opposition parties in order to realize constitutional changes.

Milliyet's Hasan Cemal also agrees that Parliament should in the new period realize a set of reforms in the Constitution, in the judiciary, in the Law on Political Parties and in the fight against corruption.

"An advanced democracy can be reached this way. This means contemporary civilization. The way to the EU passes through such reforms. And I am appealing to Prime Minister Recep Tayyip Erdoðan and AK Party officials: If you do not want to be forgotten on the dusty shelves of Turkish politics, never neglect issues such as democracy, supremacy of law, human rights and liberties," says Cemal.

straightforward answer. On one side are acute diseases; on the other side are chronic arsenic effects. This is Ýzmir's position. Things shouldn't have been allowed to get to this stage. If Çamlý dam could be completed, Ýzmir would not have such a big water problem," he said.

Professor Ayfer Haydaroðlu, the manager of Ege University's Anti-Cancer Research and Practice Center, explained that boiling water would not remove arsenic from the water.

Rather, she explained, this will make arsenic levels increase further as the water evaporates.

"Carbon filters and water softeners are not effective [for removing arsenic]," she added.

Haydaroðlu indicated that while there are distillation devices to remove arsenic, using these devices for arsenic removal is a costly method. "If you are very picky, you can use distillation devices at home. But because of high energy consumption, this method may prove costly," she said.

Haydaroðlu further stressed that the argument that milk and yogurt consumption will remove heavy metals from the body is an unproved, outdated assumption. "We must drink milk in large volumes, but we should not think that in doing so we can get rid of arsenic's harmful effects. There are measures that we should take. Currently, the tap water in Ýzmir is not healthy to drink. Thus we should use this

Extended consumption of arsenic has many negative effects including cancer, noted Professor Ali Osman Karababa of Ege University. Pointing out that risk rises with increasing consumption, Karababa nevertheless stressed that the potential health problems that could arise from arsenic in the water over a period of four months -- the time it will take to establish water treatment facilities -- were being "exaggerated."

"Of course, to provide a city with drinking water with high levels of arsenic is not a desirable thing. But Ýzmir has limited water sources. The water source that supplies 38 percent of the city cannot currently be used due to drought. Supplying water that has high levels of arsenic instead of providing nothing is a move to decrease the cases of contagious disease. On the other hand, there are risks posed by arsenic consumption. Çýnar participated in a talent competition organized by the Kayseri Municipality yesterday along with more than

50 drummers in a bid to be granted the title of Ramadan drummer once more by the municipality. Çýnar said he has been waking fasters in his neighborhood for suhoor for the last 30 years, and intends to do so this Ramadan as well. "I am 91 years old.

I've been waking people for suhoor with my drum for the last 30 years. I plan to continue doing so this Ramadan, too, if I am given the task," he said. Çýnar said that he used to walk through the streets drumming to wake people for suhoor, but in the last few years has opted to wend his way on a motorcycle. "I drum while on my motorcycle. In this way, I fulfill my task without getting tired," he said.

Kocasinan Mayor Bekir Yýldýz said his municipality offers training courses for drummers in the city ahead of Ramadan. "We teach drummers how to drum better.

Turkey to have air ambulance system

by September September will see the beginnings of what is to become a full-fledged air ambulance system for Turkey, Health Minister Recep Akdað has announced.

"Two ambulance helicopters will begin to serve in Ankara and Ýstanbul beginning in September," he said in comments to the Anatolia news agency.

The Health Ministry has signed a contract for 17 ambulance helicopters to establish Turkey's air ambulance system, Akdað said, adding that the ambulances were purchased through the service procurement method. He noted that the first two ambulance helicopters would operate in Ankara and Ýstanbul. "We will increase the number of these helicopters to 17 by the end of this year," he stated. Three ambulance airplanes will also be purchased by the ministry as part of the air ambulance system.

According to Akdað, the project foresees the installation of helipads atop hospitals in Ýstanbul, Ankara Ýzmir, Antalya, Bursa, Çanakkale, Afyonkarahisar, Konya, Adana, Kayseri, Samsun, Trabzon, Erzurum, Van and Diyarbakýr. The air ambulance program envisions nationwide coverage, so the ambulances will serve neighboring cities and districts located up to 200 kilometers from their base provinces.

Turkey’s Caucasus community cherishes Russia’s move

Obama's VP pick may not be disaster after all

But South Ossetia's declaration of independence is clearly a political game," said Ali Rýza Altýner, chairman of the Association for Friendship with Georgia. "We think Russia wants revenge for the West's move to recognize Kosovo. If Russia is that careful about freedom, she should have accepted Chechnya's independence.

People have been struggling there for years. We think Russia is shooting itself in the foot because this will not end with the independence of Abkhazia and South Ossetia. US Democratic presidential candidate Barack Obama's decision to pick Senator Joe Biden as his running mate is likely to increase the chances of a US policy shift on Armenian claims of genocide at the hands of the late Ottoman Empire, but does not necessarily mean trouble for TurkeyUS relations as a whole, analysts have said.

Obama's selection of Biden as a running mate alarmed Turkish newspapers. Many dailies recalled an unpleasant meeting between Biden and late Turkish Prime Minister Bülent Ecevit in 1999, in which Biden told Ecevit, in what some saw as a rather impolite manner, that he would work to block US aid to Turkey if Ecevit's government did not compromise on its Cyprus policy. The 65-yearold senator is also known to be close to Greek and Armenian lobbies and to support Armenian claims that 1.5 million Armenians were subjected to genocide in eastern Anatolia during the World War I era.

But much depends on who will be the new foreign minister in the event that Obama is elected as president, said Bülent Alirýza, director of Turkey studies at the Washington-based Center for Strategic and International Studies (CSIS). Whether Biden will be a powerful vice president like incumbent Dick Cheney also depends on whether Obama would like to see a strong man as his vice president or not, as Biden's powers in foreign policy will be limited to how much power Obama would like him to have, said Alirýza. Obama will probably not let Biden become a "new Cheney," said Þanlý Bahadýr Koç, an expert on US ties at the Ankara-based Center for Eurasian Strategic Studies (ASAM). "Biden may be an important part of the decision-making mechanism in foreign policy, but it may not be wise to expect Biden to control the entire foreign policy-making process."

In comments reported by the Anatolia news agency, Alirýza also played down concerns on the Armenian issue, saying Biden did support Armenian efforts when they came up, but that he has had no leadership role in bids to win recognition from the US Congress or the administration to the Armenian claims of genocide. What may bother Turkey more, he said, is Biden's pro-Greek and pro-Greek Cypriot stance on Cyprus and his earlier calls for division of Iraq into Kurdish, Shiite and Sunni regions to defuse tensions in the war-torn country. The disintegration of Iraq is an anathema for Turkey, which fears such a division could trigger tension and conflicts across the entire Middle East.

Other analysts are even more optimistic that some of Biden's views on Turkey could change in time, something that happens quite often in the world of politics. "We tend to analyze what could happen in the future on the basis of past policies of the US and Turkey. But both the United States and Turkey are changing, and so will Biden," said Mensur Akgün of Ýstanbul's Kültür University.

Turkey's Abkhaz and Ossetian communities have cheered Russia's decision to recognize Georgia's breakaway regions of Abkhazia and South Ossetia as independent nations, saying their rule by Georgia was an unwilling unity forced on them by former Soviet ruler Joseph Stalin.

"Abkhazia declared independence 15 years ago. So, Abkhazia was independent already, not 'separatist' as people say," Mücella Genç, chairperson of the Caucasus Abkhazian Culture Association, told Today's Zaman. "Stalin attached Abkhazia to Georgia, but we don't accept that.

Abkhazia was already a de facto independent state.

But we are glad that Russia has now recognized it."

Turkey is home to a large community of peo-

ple with roots in the Caucasus, comprising Georgians, Ossetians and Abkhazians. The Ossetian and Abkhaz community has sided with Russia since the outbreak of a brief war between Russia and Georgia following a Georgian military offensive in South Ossetia in early August.

Remzi Yýldýrým, chairman of the Association of South Ossetia, said that Ossetians are very happy. "Eighty to 85 years of unwilling unity has ended. Stalin is the cause of this unity. Ossetians faced three genocide campaigns throughout this century that Westerners do not know about. At least from now on no more people will die," he said. He was also optimistic about the future despite a tsunami of protests from the West.

"All Georgians, Abkhazians, and Ossetians will live peacefully there. But as Georgia, Abkhazia and South Ossetia," Yýldýrým said. "We are happy now and will take it to the end. Georgia should look back to its own history. Ossetians and Abkhazians were attached to it awkwardly. The Caucasus are not made up of Georgians alone. Many ethnic groups live there."

He added that the Turkish government should be more fairly to Ossetians and Abkhazians and pursue more balanced policies. Ankara says it supports the territorial integrity of its regional ally Georgia, but is also reluctant to antagonize Russia.

When another correspondent asked why Russia refused to recognize the wills of the people of Kosovo and the KKTC, Ivanovskiy said two fundamental principles of international law had been protected in Europe for six decades: the right of nations to self-determination and national sovereignty. However, he said, the principle of national sovereignty was violated in the Kosovo case. "Unfortunately, our warnings concerning Kosovo's independence were ignored and an international case law has emerged," he said, adding that he didn't expect many countries' to recognize the independence of South Ossetia and Abkhazia.

However, South Ossetia and Abkhazia will continue living with their current statuses, he said. Although he had previously said that Kosovo was a special case and that it should not be compared with the situation in South Ossetia and Abkhazia, Russian President Dmitry Medvedev also cited the Kosovo case as a justification for his country's latest move.

Moscow had long and insistently warned the international community over the probable consequences of recognizing Kosovo's February declaration of independence, Russia's top diplomat in Ankara said yesterday, suggesting that the Kosovo case has set "international case law" for similar cases, including South Ossetia and Abkhazia.

Russian Ambassador to Turkey Vladimir Ivanovskiy held a press conference yesterday, one day after Moscow announced its decision to recognize the Georgian breakaway regions of South Ossetia and Abkhazia as independent states, thus increasing existing tensions in the Caucasus. The move, called an "annexation" of Georgian territory by Moscow, has been sharply condemned by the West.

Kosovo's declaration of independence was backed by the US and much of Europe, but it was firmly opposed by Russia as an illegal affront to Serbia, its ally. In strongly-worded remarks, Ivanovskiy blamed Georgian leadership for the recent developments in the Caucasus, where a regional crisis erupted following a Georgian military offensive in South Ossetia on Aug. 7.

"Russia has recognized the independence of South Ossetia and Abkhazia, mindful of its responsibility for ensuring the survival of their fraternal peoples in the face of an aggressive, chauvinistic policy pursued by Tbilisi," Ivanovskiy told reporters, quoting an earlier statement released by the Russian Foreign Ministry. When invited to comment on Ankara's policy on this issue, Ivanovskiy referred reporters to a written statement released by the Turkish Foreign Ministry on Tuesday evening.

"Turkey attaches importance to the independence, sovereignty and territorial integrity of Georgia and is highly concerned about the recent developments. Ankara cold to Russian ambassador's BSEC idea Russia's ambassador to Turkey, Vladimir Ivanovskiy, said yesterday that the Black Sea Economic Cooperation (BSEC) might offer an opportunity to bring together the five countries that Turkey has invited to establish a Caucasian Stability and Cooperation Platform.

Russian Foreign Minister Sergey Lavrov will arrive in Ýstanbul on Monday evening and have talks with his Turkish counterpart, Ali Babacan, on Tuesday; the two ministers will discuss details of the proposed cooperation platform, which aspires to bring Armenia, Azerbaijan, Georgia, Russia and Turkey to the same table. Reminded of the current conflict between Moscow and Tbilisi, Ivanovskiy, speaking to reporters at a press conference, said these issues could not be resolved "overnight."

"This is not an easy task at all. However, I know where this meeting can take place, and …

it can be held during the regular annual meeting of the BSEC in October," Ivanovskiy said. Yet Turkish diplomatic sources, speaking with Today's Zaman, approached Ivanovskiy's idea cautiously, as Ankara doesn't want to demote the proposed platform via attaching it to the BSEC. Additionally, not all of the member countries of the BSEC are planned participants of the Caucasian Stability and Cooperation Platform, said the same sources, who spoke on condition of anonymity.

Azerbaijan, Albania, Armenia, Bulgaria, Greece, Georgia, Moldova, Russia, Romania, Ukraine, Serbia and Turkey are members of the BSEC permanent secretariat, which is based in Ýstanbul. Talat voices respect for will of peoples of S. Ossetia and Abkhazia While expressing respect for the will of the peoples of South Ossetia and Abkhazia, Turkish Cypriot leader Mehmet Ali Talat spoke cautiously yesterday in regards to the possible impacts on the Cyprus issue of Moscow's Tuesday decision to recognize South Ossetia and Abkhazia, two breakaway Georgian regions, as independent states.

Talat's remarks came in response to reporters' questions after he delivered a speech at the Ýstanbul Chamber of Commerce (ÝTO). The president of the Turkish Republic of Northern Cyprus (KKTC) was invited to comment on Moscow's decision and was asked what kinds of changes he expected in the region following this decision.

"This is our view on this issue: First of all, no people can be forced to live under another country's oppression. Hence, we are respectful of the will of the peoples of South Ossetia and Abkhazia," Talat stated.

"We, as the Turkish Cypriots, have lived

through similar incidents. Turkey was the one that extended its hand of help and who recognized [us]. The Turkish Cypriots have displayed many times their determination not to live under the oppression of the Greek Cypriots who attacked them. Consequently, we understand the peoples of South Ossetia and Abkhazia very well and respect [them]," Talat added.

The Turkish Cypriot leader said predicting the impacts of the South Ossetian and Abkhazian declarations of independence would be difficult at this stage. "We have been in a resolution process.

Our target with the resolution process is to constitute a federal structure based on two zones, political equality and two constituent states.

Accordingly, our target via resolution is to create a federal and united Cyprus that integrates with the world. This is our current policy," Talat said.

Talat is scheduled to meet with Greek Cypriot leader Dimitris Christofias on Sept. 3 in the first direct talks on the reunification of the

divided island of Cyprus since the UN-brokered process collapsed in 2004.

In Lefkoþa, a spokesperson for Talat yesterday called on the Russian capital to review their policies regarding Cyprus following its decision to recognize South Ossetia and Abkhazia, while urging Greek Cypriots to take lessons from recent developments. "We understand the desires of South Ossetia and Abkhazia to live under the roof of their own independent state, and we respect their decisions," Hasan Erçakýca, spokesperson for the KKTC Presidential Office, told reporters at a weekly press briefing held in Lefkoþa.

First in Kosovo and now with developments in the Caucasus, the principle of inviolability of the territorial integrity of states, which is under protection of the UN Security Council, has been violated, Erçakýca said, adding that there are lessons to be taken by the Greek Cypriot administration from all of these developments.

Turkey-bound plane evacuated in Rotterdam A plane due to leave Rotterdam for Bodrum in Turkey was evacuated late on Tuesday after emergency services received a telephone threat saying it would be hijacked, Dutch authorities said.

Passengers on the plane, operated by Dutch budget airline Transavia, were kept on board for about five hours before the evacuation began.

"The plane is now empty and all passengers left in a calm manner," a Dutch police spokesman said.

A spokeswoman for the Dutch public prosecutor said two men and a woman who had been aboard the aircraft were being questioned.

"The telephoned threat was in the nature of a hijack or a hostage-taking," she said. Police were still searching the plane, she added.

Bürge said the goal of this project was to create synergy among similar cultures, adding: “We would like to introduce our country and show that Turkey has not forgotten our fellows in the Balkans. Our iftar proj-

ect has strengthened our ties of brotherhood with the Balkans.” Bürge said the convoy will visit Balkan countries such as Bosnia and Herzegovina, Serbia, Kosovo, Macedonia, Albania, Greece, Bulgaria and Romania.

There are four trucks, two buses and four minibuses in the Bayrampaþa Municipality’s convoy. A total of 150 volunteers will cook iftar meals of Turkish cuisine in the places they visit. After the iftar programs there

will be concerts with the participation of local singers and talks with the participation of local journalists and intellectuals. The convoy will return back to Ýstanbul on Sept. 29. Speaking to Today’s Zaman, Bozdað said he had assessed Bahçeli’s proposals and found Bahçeli’s declaration of support to constitutional amendments to be a positive development.

However, he indicated that the package of proposals voiced by Bahçeli contained only one new item -- the ombudsman bill. He brought up that the MHP had always been opposed to this bill and had prevented the passage of this bill during the past coalition government of the MHP, the Democratic Left Party (DSP) and the Motherland Party (ANAVATAN).

“In the Third National Program announced on Aug. 18, our government pledged to make 131 amendments. It follows that the new legislative term will be considerably busy with respect to the EU process. Mr. Bahçeli created a package, picking several proposals that we had made in the past. It is a good development that he came to this point after a certain time,” he said.

However, Bozdað asserted that Bahçeli’s proposal for banning individual politicians from politics instead of closing down a political party is not realistic. “The MHP suggests that the Constitutional Court should punish individuals. What is the difference between that and closure?” he asked.

Bozdað further indicated that Bahçeli was trying to lead the constitutional amendment to a dead end. “On the one hand, the MHP says that this government is not legitimate. On the other hand, they say that they will lend support to the constitutional amendments this government will make. Can an illegitimate government make a constitutional amendment? This approach intends to block the amendments. At least the Republican People’s Party [CHP] says this openly. The MHP is trying to make the AK Party’s position disputable and give the impression that

Koþaner says amendments hinder fight against terror Newly appointed Land Forces Commander Gen. Iþýk Koþaner, who handed his former post of gendarmerie commander over to Gen. Avni Atilla in a ceremony in Ankara on Tuesday, has lamented that certain Turkish laws are being amended so as to harmonize with the EU in a way that denies Turkey’s terrorism problem and hinders its fight against terrorist organizations.

Koþaner, speaking at the handover ceremony, stressed that the amendment of Turkish laws in disregard to Turkey’s terrorism threat is a great obstacle to the country’s fight against terror. “It is a fact that laws that are amended in a way as if there is no terrorism threat against our country prevents security forces from fighting terrorism in a rapid and effective manner,” he said.

The ceremony was attended by President Abdullah Gül, Prime Minister Recep Tayyip Erdoðan and Chief of General Staff Gen. Yaþar Büyükanýt. He noted that several acts that were previously defined as crimes and were within the scope of intervention by gendarmerie forces had been decriminalized as part of efforts to harmonize Turkey’s legislation with EU laws.

“These efforts have had positive outcomes in terms of extending the scope of human rights and freedoms. But they have introduced new arrangements for security forces and considerably restricted their scope of authority in taking the necessary precautions to prevent crimes. Encouraged by the amendments to laws, terrorist organizations and illegal formations have increased their acts and gained ease of movement to abuse the freedom granted to them,” remarked Koþaner.

He said security forces need to feel that laws support them in their fight against illegal formations.

“We are aware that it is a necessity to ensure safety in the country without taking away human rights. But if terrorist groups threaten human rights, then we believe it is necessary to revise the balance between rights and freedoms and measures to be taken. Evaluating the amendments to our laws in light of this necessity will contribute largely to our fight against terrorism,” Koþaner stated.

In the meantime, Koþaner took over the post of new land forces commander yesterday from newly appointed Chief of General Staff Gen. Ýlker Baþbuð in a ceremony held at the Gendermerie General Command. Baþbuð, who delivered a speech at the ceremony, said Turkey was very close to eradicating the outlawed Kurdistan Workers’ Party (PKK). “The terrorist organization is rapidly approaching a breaking point. We need to conduct our fight against the terrorist group in full coordination in such areas as security, economy, social-cultural, education and health. It is rumored that Ferda Paksüt was called to testify due to her phone conversations with Turhan Çömez, a former Justice and Development Party (AK Party) deputy currently sought after on suspicion of links to Ergenekon. An indictment prepared by prosecutors into the Ergenekon investigation includes Ferda Paksüt's phone conversations with Çömez about a closure case against the AK Party.

According to the indictment, the two discussed on the phone the impacts of the AK Party closure case on the party. Ferda Paksüt said the closure case had resulted in fractures within the party. Çömez agreed, saying it would be very difficult for the AK Party administration to prevent the emergence of such schisms.

In the meantime, Ferda Paksüt told Today's Zaman yesterday that the objective of Ergenekon case prosecutor Zekeriya Öz was to force her husband, Osman Paksüt, to resign from his post.

Osman Paksüt is known for his criticism and tough stance against the AK Party government. "I don't even know what this Ergenekon gang is. The real reason behind calling me to testify as part of the Ergenekon operation is to force my husband to leave his post. The prosecutor didn't provide me with clear information as to what it is I will testify about. It will be the first time I will give a deposition. I am obliged to defend myself, though there is no reason to do so," she said. She also stressed that she had no ties with the Ergenekon gang. "I've never been a gang member or visited the house of any gang member. I've known [Turhan] Çömez for long years. My phone conversations with him took place before a search warrant was issued for Çömez. I've not been in contact with him since then," she said.

Gül’s fýrst year as presýdent: openýng the palace to the people

During his first year as president, Abdullah Gül has addressed some of Turkey’s most important problems, showing that his doors are open to all.

Gül, who was elected president by Parliament on Aug. 28 of last year, described the fundamental tenets of his presidency in his speech after taking oath. “I will embrace all citizens without discrimination during my time in office. I will preserve my impartiality and do my best to ensure that state institutions work in harmony.”

Gül has made the palace an important foreign policy actor. He has recommenced highlevel relations with Central Asian and Caucasian countries, opened Turkey’s doors to its neighbors and underlined that Turkey’s EU membership is the most important goal of his presidency.

His name was included in the list of defendants in the indictment filed with the Constitutional Court asking for the closure of the Justice and Development (AK Party). In his initial assessment of the case, he said, “What the request in regards to the ruling party … will make Turkey gain or lose should be considered carefully.” In the following days, he made attempts to ensure that the tension and discussions between the government and the opposition, and the government and the judiciary, did not harm internal peace and harmony. He met with the political parties represented in Parliament.

He made calls for democracy and stability.

Gül hosted the party leaders at a luncheon on April 23, National Sovereignty and Children’s Day, though Republican People’s Party leader Deniz Baykal did not attend. However, the opposition party leader did meet with the president two times -- after the Daðlýca attack and on the occasion of Dick Cheney’s visit to Ankara.

Gül has made critical appointments in his first year. He picked Professor Yusuf Ziya Özcan from Middle East Technical University (METU) as the new chairman of the Higher Education Board (YÖK). His appointments of 22 university rectors in July to replace those whose terms had expired were the most controversial. President Gül vetoed two of 78 bills referred to the presidency for ratification. The bill that lifted the headscarf ban in universities but was later annulled by the Constitutional Court was the most striking one among those which he endorsed. Gül returned the bill on electronic communication and another bill on freelance accountants to Parliament for reconsideration. He used his authority vested by the Constitution to grant amnesty twice, including his pardon of former Prime Minister Necmettin Erbakan.

Received by US President George W. Bush at the White House in January of this year, President Gül has also represented Turkey at NATO and Organization of the Islamic Conference (OIC) summits. He has taken effective steps to improve relations with Central Asian countries, hosting Iraqi President Jalal Talabani and Iranian President Mahmoud Ahmadinejad, who had previously not been invited during the presidency of Ahmet Necdet Sezer.

Since his first day as president, Gül proved that the palace would be influential in foreign policy making. The foreign policy approach of

the presidency rests on four pillars: relations with big powers, revival of relations with Turkic republics, cooperation with neighboring countries and sustaining Turkey’s policy of peace.

In a sign of the importance attached to relations with major powers, Gül headed to the US shortly after Prime Minister Recep Tayyip Erdoðan’s visit to Washington. His visits to Russia and China are set to take place in 2009. The palace seeks to maintain “balanced and close relations” with big powers.

Improving relations with Caucasia and Central Asia is another priority for the president. To revive

President Gül pays great attention and attributes much importance to Turkey’s EU bid. The president has asked for commitment to the reforms needed to achieve the goal to integrate with the EU. In his visit to the General Secretariat of the Council of the EU, Gül said on this matter: “This project includes a greater vision that will positively affect welfare, stability and peace of a broad geography beyond Europe and Turkey. Commitment to the reforms means Turkey’s real modernization.”

For his first trip as president, Gül visited Van, Hakkari, Þýrnak, Siirt and Diyarbakýr. The four-day visit, which began with demonstrations of joy at his visit, was important because it showed the importance the president has attached to the resolution of problems in the region and to combating terror. Gül has visited 14 cities in Turkey as president. Unlike his predecessor Sezer, he attended the Þeb-i Arus ceremonies held in Konya on Dec. 17, which commemorated Sufi philosopher Mevlana Jelaluddin Rumi. He also delivered a message of unification at Hacýbektaþ, where primarily Alevi citizens gather every year to commemorate Sufi philosopher Hacý Bektaþ-ý Veli.

Palace dinners In his palace dinners, President Abdullah Gül has received some of Turkey’s most renowned artists, historians, novelists and intellectuals. His first guests were historian Halil Ýnalcýk and Professor Talat Sait Hamlan.

Since then he has hosted Elif Þafak, Selim Ýleri, Ýlber Ortaylý, Adalet Aðaoðlu, Rasim Özdenören, Hilmi Yavuz, Doðan Hýzlan, Orhan Gencebay, Neþet Ertaþ, Zara, Ahmet Özhan, Mazhar Alanson, Rengim Gökmen, Yýlmaz Öztuna, Faruk Loðoðlu, Ýbrahim Kalýn and Güven Sak. At one such dinner, legendary folk singer Neþet Ertaþ performed, singing the famous folk song “Divane Gönlüm.”

Gül says being in conflict with gov’t not an accomplishment President Abdullah Gül has said he does not view it as an accomplishment to be in conflict with the government and to unjustly criticize its right actions as being wrong.

Gül’s remarks came yesterday during an interview with the private NTV news station on the occasion of the first anniversary of his election to the presidency.

“If the government does something wrong, I will openly mention it and ask them to correct it; this is what I have been doing,” said Gül.

When asked about a news article appearing in Turkish media on Wednesday saying the presidency had lost prestige and ranked forth among the institutions which the public trust most, he replied: “I do not know anything about a study bearing this result. Many things are written in Turkey intentionally and with prejudice. So, I have no idea about such a study,” he said. On another question over

relations, Gül paid visits to Azerbaijan, Georgia, Turkmenistan and Kazakhstan. Baku was the second capital that Gül visited as president after Nicosia. Kazakh leader Nursultan Nazarbayev was the first to congratulate him on his new presidential post, and Turkmen President Gurbanguly Berdimuhammedov has also been warmly received in Turkey. Gül has improved relations with Azerbaijan and Georgia so as to create “an economic zone” that could be part of a potential Caucasus alliance, which Turkey has recently proposed.

Relations with neighboring countries make up another chapter in foreign policy during Gül’s presidency. Israeli President Shimon Peres and Palestinian leader Mahmoud Abbas were hosted in Ankara at the same time. Syrian President Bashar al-Assad was also among many foreign guests at the palace last year. Iraq’s Kurdish president, Jalal Talabani, was also received in Ankara, demonstrating the change in Turkey’s foreign policy since Gül became president. Gül also met with Iranian President Ahmadinejad on Aug. 14 in Ýstanbul, where he warned his guest that there was little time left for a diplomatic solution for the Tehran administration’s troubled relations with the West.

Countering criticism about his choice of rectors, whom he recently appointed for 28 universities, Gül said: “The sensitivity I showed in rector appointments is obvious. I appointed 28 rectors and 22 of them were at the top of the list [sent by the Higher Education Board (YÖK) to the president]. One should put aside prejudices when criticizing someone. It is true that one of

the rectors I appointed was a parliamentary candidate from the ruling Justice and Development Party [AK Party]. There are also other rectors who occupied important positions in opposition parties. Why do those critics talk about this? I appointed rectors whom I thought were the best for the position.” Gül also countered criticisms about the number of his vetoes since he became president last August. Some circles directed criticism at Gül for cooperating with the government and approving of all of its actions.

“I do not find debating over vetoes right.

One should look at how many times former presidents used their right to veto. My predecessor had only two vetoes in his first year. I cannot boast that I have used my right to veto for this many or that many times. Bulgaria says EU must do more to back Nabucco The European Union-backed Nabucco gas pipeline project is under threat unless the bloc moves at a high political level to secure supplies from the Caspian region, Bulgaria said on Wednesday. The EU has made the 7.9 billion euro pipeline a cornerstone of its policy to ease its dependence on Russian gas but Bulgaria's Economy and Energy Minister Petar Dimitrov said that was not enough and strong political lobbying was needed. "Finding enough supplies is the big problem and it cannot be solved just by the efforts of the compa-

Abdi Ýbrahim among top world’s 100 drug firms A domestic Turkish generic drug manufacturer has for the first time placed among the world's top 100 pharmaceutical companies in terms of annual turnover, a recent report has shown.

Abdi Ýbrahim, Turkey's leading medicine producer, was ranked 96th in a worldwide listing of 2007's largest drug companies. The Turkish company released a written statement yesterday to share its success with the public in which it said Abdi Ýbrahim had left many strong global brands behind in annual sales volume, according to the latest findings of the Intercontinental Medical Statistics (IMS), a global sector-specific assessment institution.

The statement included remarks from Abdi Ýbrahim Chairman Nezih Barut, who said, "This success is a very valuable reflection of the company's efforts and commitment in the business."

Private sector calls on government to help lower production costs Ekren said the Turkish economy is passing through a process of serious change and transformation that is leading the way to "the building of a healthy future." The minister also noted that these meetings help the government become aware of the problems private sectors are facing during this process.

Hisarcýklýoðlu also gave a speech at the opening session of the meeting, saying the state has to remove all impediments hindering the private sector and empower businesses with more room for free movement. He said the country is in need of a new economic program to keep from falling behind in the global competition. He noted that the Middle-Term Economic Program set-out by the government was a big step taken in the right direction, but added that it still needs improvement.

"For us, the new program has to include elements to provide short-term relief to the economy together with longer-term measures against the problems facing growth," he said. He asked the government not to curtail public investments, which are necessary to support growth and competitiveness in the private sector, instead requesting that it pay special attention to education at all levels.

To prepare the report, representatives from all involved sectors got together to discuss common and specific problems every sector was, as well as possible solutions for these problems. Some of the problems mentioned in the report are listed below:

Representatives of major sectors of the Turkish economy, including textiles, contracting, iron, cement and banking, have submitted a report to the government about rising production costs and asked for immediate solutions to a number of problems that are keeping them from working at full efficiency.

They also asked for the central bank to revise its monetary policies, which they believe are loading international sales with extra burdens and obstacles. The report was presented to the government yesterday during the Fourth Sector-Specific Economy Consultation Meeting, organized by the Turkish Union of Chambers and Commodity Exchanges (TOBB). The meeting, held in the headquarters of the Turkish Statistics Institute (TurkStat) in Ankara, was presided over by Minister of State for the Coordination of the Economy and Deputy Prime Minister Nazým Ekren. The attendants also discussed a report recommending the establishment of a high-level regulatory and supervisory institution for organized industrial zones and a report

by TOBB's Women Entrepreneurs' Board.

Other Cabinet members at the well-attended meeting were Economy Minister Mehmet Þimþek, Foreign Trade Minister Kürþad Tüzmen, Minister of Energy and Natural Resources Hilmi Güler and Minister of Industry and Commerce Zafer Çaðlayan. TOBB Chairman Rifat Hisarcýklýoðlu and the other TOBB board members were all there together with presidents and vice presidents of the TOBB sector representatives.

A governmental decree on the payment of price adjustments for materials costs to contractors that do business with the public sector must be released as soon as possible. Turkish banks need to be encouraged to hand out letters of guarantee. For this, some urgent steps are needed to promote Turkish banks in the international financial markets so that the letters of guarantee extended by these banks will be more easily accepted globally. The government should provide risk insurance support to contracting companies in their projects abroad.

The two notebook and two desktop PCs are the first Dell models designed especially for emerging markets, said Steve Felice, the US computer maker's president for the Asia-Pacific. They are meant for small business users and are to be sold in 20 countries across Asia, Africa and Latin America.

Strong sales in Asia helped Dell turn in betterthan-expected results in the first quarter despite a slowing US economy. "Our success is going to be largely dependent on our ability to expand globally," Felice said in an interview. Royal Bank of Scotland has appointed three new directors in a long-awaited board shake-up that it hopes will go some way to ease shareholder concerns over its corporate governance after a turbulent year. Lebanon indicts Gaddafi over missing imam Lebanon has indicted Libyan leader Muammar Gaddafi and is seeking his arrest for an alleged role in the disappearance of a prominent Lebanese Shiite Muslim leader 30 years ago, according to judicial documents. Lebanese Shiites say Libya kidnapped Imam Musa al-Sadr and two of his aides during a visit to the North African country in 1978. Libya says Sadr left the country safely. He is widely believed to have been killed shortly after he was seized.

"We decided ... to accuse Muammar Gaddafi... of inciting the kidnapping and withholding the freedom of... Imam Musa al-Sadr," said the court documents, approved by Investigative Judge Samih al-Haj late on Tuesday. The charges, brought under Lebanon's terrorism law, carry the death penalty. An initial case against Libya was closed in 1986 for lack of evidence. But Lebanon's public prosecutor said in August 2004 he would reopen the investigation after considering new evidence. Sadr was the founder of the Shiite Amal Movement, from which the powerful Lebanese guerrilla movement Hezbullah later emerged. He originally took up the plight of Lebanon's impoverished Shiite community before the 1975-90 Lebanese civil war. While Lebanon was dissolving into chaos, Sadr preached religious tolerance as he sought to organize the Shiites. Beirut Reuters

Up to 20 die in China chemical plant blasts The death toll from explosions that ripped through a chemical plant in southwest China rose to 20 on Wednesday, state media said. The victims were employees of the plant in Yizhou city in Guangxi province, the official Xinhua News Agency said. Another 60 people were injured in the blasts that started at about 6 a.m. Tuesday and continued until 1 p.m., the report said. The blaze started in a workshop and spread through the plant as containers with flammable chemicals including formaldehyde and acetylene caught fire, Xinhua said. Fire spread over a nearly 108,000-squarefoot (10,000-square-meter) area, Xinhua said, citing an unidentified firefighter in the rescue operation. The government evacuated 11,500 residents in case of further blasts and chemical leaks. Poisonous gases, mainly sulfurated hydrogen and carbon monoxide, were still coming from the site, Xinhua quoted Ge Xianmin, Guangxi's toxic substances emergency center director, as saying. Thai PM orders police to clear protesters Thai Prime Minister Samak Sundaravej has ordered thousands of riot police to move an anti-government crowd occupying his office compound by Wednesday, his spokesman said. "The prime minister said it has to end today," Samak's chief spokesman Wichianchot Sukchotrat told reporters. "Thousands of police will be deployed to move the protesters out of the Government House." Wichianchot said police would try to pursuade the thousands of demonstrators to leave the lawn of Government House, normally the nerve center of the Thai administration, but if violence flared it would be met with decisive actions . Earlier on Wednesday, Interior Minister Kowit Wattana, a former national police chief, suggested the authorities would continue to exercise restraint in the wake of the demonstrators' siege and their occupation on Tuesday of several ministries and a state television station. "I am begging to my fellow citizens to leave the Government House and hold a rally somewhere else where police will have no objection to it," he told a news conference. Gustav kills 11 in Haiti, heads toward Cuba Hurricane Gustav triggered flooding and landslides that killed at least 11 people before weakening to a tropical storm, but forecasters said on Wednesday it's still a major threat to the Caribbean and the Gulf of Mexico. Forecasts suggested it could head toward the US Gulf Coast as a dangerous Category 3 hurricane next week. The tentative forecast track pointed toward Louisiana, but forecasters said it might hit anywhere from south Texas to the Florida panhandle if it continues to develop. That could mean higher gasoline prices for drivers in many countries.

Global oil prices rose by $1.40 early Wednesday to above $117 a barrel on concerns the storm could disrupt output in the Gulf of Mexico, home to a quarter of US crude production. Royal Dutch Shell PLC said it could begin evacuating workers as soon as Wednesday. Gustav's maximum sustained winds were near 60 mph (95 kph) on Wednesday morning, with higher gusts. The storm was centered about 90 miles (150 kilometers) west of Port-auPrince and was moving toward the northwest at 5 mph (7 kph). It was expected to continue moving toward the west-northwest. Armed men were no threat to Obama, US attorney says Authorities are investigating whether three men arrested in Colorado with guns and drugs planned to kill Democratic presidential candidate Barack Obama, but said they posed no real threat. "We're absolutely confident there is no credible threat to the candidate, the Democratic National Convention (in Denver), or the people of Colorado," US Attorney Troy Eid said in a statement on Tuesday.

ABC News quoted federal law enforcement officials saying the men, one of whom is alleged to have strong ties to a white supremacist gang, had admitted to a "crude" plan to use a rifle to kill Obama. Local media had reported the incident on Monday.

ABC News said the men had spoken of finding a high vantage point overlooking the football stadium, Invesco Field, in Denver where Obama is due to speak to the Democratic convention on Thursday night, and opening fire with scope-equipped rifles.

Obama, who would be the first US black president, is scheduled to accept the Democratic nomination for the November 4 election on Thursday at the open-air stadium.

The suspects are Tharin Gartrell, 28, Nathan Johnson, 32, and Shawn Adolf, 33, the reports said.

Hýllary Clýnton backs Barack Obama to the hýlt Hillary Rodham Clinton made an emphatic plea for Democrats to unite behind the presidential candidacy of Barack Obama, exhorting her supporters to back her one-time rival because victory over Republican John McCain "is a fight for the future and a fight we must win together."

The former first lady skewered McCain and drew thunderous applause Tuesday night as she coined what could become the most powerful political slogan of the fall campaign. "No way, no how, no McCain."

Clinton's speech probably will be the most closely scrutinized of the Democratic National Convention, a gathering that opened with great drama -- full of speculation about how full-throated her support for Obama would be and whether the party could heal the divisions from the hardfought primary campaign. On Wednesday evening, the spotlight turned to her husband, as former US President Bill Clinton took to the convention stage. D e l a w a r e Sen. Joe Biden, Obama's vice presidential pick, got prime-time exposure as well.

In the end, Hillary Clinton held back nothing in an inspired address that also served to launch whatever lies ahead in her political career. "We don't have a moment to lose or a vote to spare," said the New York senator, writing the final chapter in a quest for the White House every bit as pioneering as Obama's own.

She urged her loyal supporters to remember who was most important in this campaign. "I want you to ask yourselves: Were you in this campaign just for me?" she said. She urged them instead to remember US Marines who have served their country, single mothers, families barely getting by on minimum wage and other struggling Americans. "You haven't worked so hard over the last 18 months, or endured the last eight years, to suffer through more failed leadership," Clinton told the delegates.

The packed convention floor became a sea of white "Hillary" signs as the New York senator -- Obama's fiercest rival across 56 primaries and caucuses -- strode to the podium for her prime-time speech after being introduced by her daughter, Chelsea. The signs were soon replaced by others that read simply, "Unity."

Calling McCain, a four-term Arizona senator, "my colleague and my friend," Clinton proceeded to tear into him as a voice of the past and little more than a clone of the deeply

unpopular President George W. Bush.

"We don't need four more years of the last eight years, more economic stagnation .... more war and less diplomacy," said the New York senator, dressed out in a trademark pumpkin-colored pantsuit. Two hijackers of Darfur plane surrender Two hijackers who commandeered a jetliner from Sudan's Darfur region and diverted it to a remote desert airstrip in southern Libya surrendered on Wednesday after a 22-hour standoff, an airline official said. Sun Air Executive Director Murtada Hassan said officials on the ground at the airport in Kufra, Libya, informed him of the surrender. He said there were only two hijackers but that others may have slipped out with the 87 passengers who were released earlier. Throughout the incident the number of hijackers and their identities has been unclear. Officials at the airport in Libya had said they were Darfur rebels, but Hassan said their motives were personal and that they had no connection with any political or rebel groups. Due to security reasons, he said he could

not reveal what the personal matters were.

Hijackers commandeered the Boeing 737 jetliner, which was carrying 95 passengers and crew, soon after it took off Tuesday from the southern Darfur town of Nyala, not far from a refugee camp that the Sudanese military attacked on Monday.

Rebels took up arms in 2003 against the Khartoum's government, which has been accused of unleashing militia fighters in response. The plane, which had been en route to the Sudanese capital of Khartoum, was diverted to a World War II-era airstrip in Libya's Sahara desert oasis of Kufra. Some 500 security personnel and police descended on the plane as negotiators worked to free the passengers, said Sudan's consul in Kufra, Mohammed al-Bila Othman. Tripoli AP

Violence hits as Pakistani politicians wrangle Government forces killed about 40 militants in clashes in northwest Pakistan on Wednesday as increasing violence, and political uncertainty deepened by a split in the government drove stocks lower. Hopes for political stability in nuclear-armed Pakistan after Pervez Musharraf resigned as president last week were dashed when the ruling coalition, led by the party of slain former prime minister Benazir Bhutto, fell apart over a judicial dispute and replacing Musharraf. Military officials said on Wednesday that 41 militants were killed in two clashes near the Afghan border. Later, 30 militants including some foreigners died in fighting in the northwestern region of Bajaur, also on the Afghan border, a military official said. YARSAV: organization with military contacts While the bylaws refer to "judicial independence," the truth is different. YARSAV is nothing but an organization which had close contact with a group of military bureaucrats eager to plot coups. It briefed them and was briefed by them during the Feb. 28 process, which corresponds to today's attempt by the Ergenekon terrorist organization to make the idea of a coup widespread in the society through the agency of nongovernmental organizations.

A lawsuit has been brought against YARSAV by the Justice Ministry, but I do not hold much hope that the association will be closed because the judge who will hear the case will most probably be a member of YARSAV. Moreover, there are rumors that the Supreme Court's chief prosecutors force and even threaten judges and prosecutors to be YARSAV members. This in turn leads to the society and even the very judiciary to be gripped by a lack of trust in the judiciary. Under EU legislation, prosecutors can organize themselves under several associations while judges can only become members of an organization designed solely to express themselves.

YARSAV claims that it has been establish for this purpose; however, in its current form, this association is either an abuse of this provision or this is recklessness. No doubt political power is today one of most unlikable concepts. As it is associated with the individual's being imprisoned by a web of certain relations, it is hotly debated in modern times. Of course, it is perfectly natural to assume that the judiciary is involved in this debate in some way or another, but the judiciary has the capability of counteracting political power by relying on the principle of the absolute independence of the judiciary.

In this context, YARSAV's advertised goal of eliminating the influence of the political power is a lofty intention that would stir excitement in everyone, but this is the very essence of YARSAV's business. Indeed, it appears that YARSAV is not

One of the most important parameters of judicial independence is the judiciary's independence from itself.

Yet, in the understanding of our judges, independence means being independent of the "nation" in whose name they make their decisions. For them, independence from the government means independence from a certain government. If this is not the case, then what does the existence of an organization that cannot tolerate other organizations -- organizations that do not follow its ideology -- and that is presided over by a person who is rumored to acquire false medical reports showing his unfitness for military service -- which he sees as a nuisance -imply? The Judges and Prosecutors Association (YARSAV) wants to intervene in the judiciary -- i.e., in all kinds of lawsuits -- although it is not a victim of any crime. It wants to intervene -- all the while upholding a political position -- despite the law's absolute impartiality. It was established for this purpose and it has been launching and meddling in lawsuits with this goal in mind. Just as you as an ordinary citizen are in no way entitled to bring an action for the divorce of Ali and Ayþe, YARSAV, too, has no right or authority to bring an action concerning any issue and intervene in court decisions. But this has not been the case.

Perhaps because of a concern over how such an organization can be lawful, the first 12 principles listed in the preface of YARSAV's bylaws try to substantiate that such an organization complies with EU laws and other universal laws on organizations. Actually, the majority of the members of this organization are neonationalist Kemalists and are against the country's membership in the EU -- although, unlike their president, they may not have a problem with the military.

Nevertheless, the first 12 articles in question consist mainly of references to the above-mentioned areas. Their main purpose is written in Article 13, which states that the association was established "to ensure judicial independence and impartiality and the security of judges, to eliminate political pressures and influences on the judiciary and to monitor compliance with professional ethics." Indeed, as one reads further into the bylaws, one can get a clear picture of the fact that although it is an association or a professional organization, it aims to be an organ deeply integrated with the judiciary.

YARSAV Chairman Ömer Faruk Eminaðaoðlu (above) has brought the organization he heads under the spotlight with claims that he obtained a false medical report showing his unfitness for military service in order to evade compulsory military service. against "political power" but "a certain political power."

When we examine in detail the actions of YARSAV members and the association itself, we come to the conclusion that what they imply by referring to autonomy or influence of the political power on the judiciary has nothing to do with alienation from political power but excluding "a certain political power."

It is for this reason that we witness speeches delivered by members of the judiciary at the opening of the judicial term every year in which members of the judiciary, wearing black gowns, frown on government officials attending the ceremony as they say in a determined and loud voice that they do not want to act under the influence of political power. We do not know whether this nervous and premonitory style, obviously chosen intentionally, has ever been used in the face of real unlawfulness, but all governments set up by parties other than the Republican People's Party (CHP) have had their share of these admonitions. YARSAV's president was, likewise, nervous while responding to accusations that targeted him.

What makes them nervous? Is it because this government is not a political power that relies on the "center" with which they take sides?

Those members of the judiciary who oppose the political power of the ruling party did not protest when another party openly acknowledged that they had appointed people with certain ideologies to judicial positions.

It is obvious that the judiciary -- and YARSAV in particular -- is not against political power. On the contrary, it is political power that is their sole concrete and legitimate raison d'être.

They cannot continue to exist in any other form. The emphasis on alienation from the political power that peaked during the term of the ruling Justice and Development Party (AK Party) is certainly not an attempt to consolidate their independence from political power. Perhaps because they saw that judicial reforms to be implemented during the term of the current government may prevent them from establishing legitimate/illegitimate relations with political power, they are much more noisy. The possibility that this new form of political power might strip

YARSAV of its "power" worries them.

Currently, whether YARSAV's president had obtained a false medical report certifying his unfitness for military service is not known but it is a well-established truth that since its establishment YARSAV has been in the spotlight of debates for its acts and those of its members. If a lawsuit brought by YARSAV is heard by a judge who is a member of the association, how can this be reconciled with judicial independence?

How can YARSAV expect us to be convinced that it acts impartially in lawsuits launched and heard by its members, including those concerning the release of a person who was elected a deputy -- as in the case of Sebahat Tuncel, who was released from prison where she has being held on charges of being a member of an illegal organization -- and exams concerning the selection of judges and prosecutors.

Aren't you worried about the existence of YARSAV members within the judiciary who think they are entitled to file lawsuits against wage increases decided on by the government and then go on to accept these very cases?

If a lawsuit is launched against the head of YARSAV in connection with the medical report, allegedly fabricated, and if the judges and prosecutors who deal with this lawsuit are YARSAV members, who can claim that this lawsuit will be heard with impartiality?

If the judiciary is a three-tiered system, why then are lawyers, the third tier, not included in this association? Are they outside the legal system? Isn't law a whole?

In short, we now see what dirty work the association has been up to: YARSAV is here not to ensure judicial independence and impartiality but to legalize the political power of a certain group and to maintain the power of certain ideologies that have penetrated into the judiciary. Whether or not the organization's president obtained a false medical report to evade military service is something that can be accounted for through that person's conscience and identity as a man of the law. *Professor Mazhar Baðlý is an instructor at Dicle University.

Gen. Pervez Musharraf's resignation on Aug. 18 brings to an end an era of unprecedented Pakistani cooperation with US foreign policy and security needs. It also marks the beginning of a new negotiation between Pakistan and the US, as the US seeks fresh reassurances of Pakistan's cooperation in its war on terror and Pakistan seeks a new relationship under different terms and circumstances with the US. At present both Pakistan and US-Pakistan relations are in flux, and the two are mutually related. This is a critical year for US-Pakistan relations. Gen. Musharraf's resignation and President Bush's soon departure from power will mean that both countries will be reformulating their policies and priorities. By summer of 2009 we will have witnessed a new geopolitical paradigm in place that will dictate how the US, Pakistan and Afghanistan relate to each other.

The war on terror first brought prominence and popularity for Gen. Musharraf, and then it brought defeat and disgrace.

Gen. Musharraf's decision to abandon the Taliban, an ally and an asset to Pakistan, to join the US made him an instant hit both in the West and among a majority of Pakistanis.

From 1999-2001, he had been seen as a dictator who had subverted Pakistan's democracy and thumbed his nose at the West, and was thus shunned by the US and its allies. But overnight he became America's staunchest ally against terrorism and was welcomed as a friend in London and Washington.

A broad segment of Pakistanis applauded his decision to ignore Islamic sentimentality and praised his realism. His decision to abandon the Taliban was seen as the right thing to do because it was in Pakistan's national interest.

Since 2007, Gen. Musharraf has become a serial failure. The Taliban and al-Qaeda continued to consolidate, and both the US and Afghanistan started blaming him for all the failures of the Western alliance in the region. For Pakistanis it became obvious that Pakistan had now become a partially failed state heading towards disaster and that the government was still more concerned about Washington's needs than its own national interest.

This perception that Gen. Musharraf had become a tool of Washington united the extremists and the moderates, the secularists and the Islamists. The key virtue that had made Gen. Musharraf popular was his insistence that his policies were in Pakistan's national interest, and when this claim lost its credibility in the eyes of the Pakistani people, he quickly became a US agent.

When one talks to Pakistanis, their anger and frustration with the US and with the political realities of their own nation is palpable. "Yes," they say, "3,000 innocent Americans died on Sept. 11, 2001, but hundreds of thousands of Muslims have died in the aftermath." Pakistanis have started to react, and kicking Musharraf out is the first step. The end of Musharraf, I suspect, is just the beginning of a dangerous turn that Pakistan has now taken.

Now with Musharraf gone, the US is without an ally and without a policy -- for its policy in the region had been Musharraf.

The Pakistani leadership is now in fundamental disagreement with the US's methods. They feel that Pakistan's extremism problem cannot be done away with by use of force. They also feel that the US is part of the problem. US policies in the region fuel extremism and the heavy handed use of force further alienates those who are not radicalized. The solution, they feel, will come slowly through peaceful means and through compromise. Basically, they are pursuing accommodation with the Taliban, while the US seeks elimination.

Unless the US agrees to play ball on Pakistani terms, it will have to pursue its goals without any active help from Islamabad and perhaps even in the face of covert, active opposition from Pakistani intelligence and military.

From the outset the US's policy of reliance on Musharraf and force was an unwise strategy. It has failed completely. Bin Laden is still free and al-Qaeda is strong and active. The Taliban is still there and much stronger now, chipping away at NATO's resolve. Pakistan, a nuclear state and a longtime US ally, is destabilized, no longer friendly and heavily radicalized.

Unless Washington acknowledges its errors and adopts a new policy -- one made in consultation with Islamabad and with sensible voices in America -- then NATO, the US, Pakistan and Afghanistan are all in for really tough times ahead.

US-Pakistan relations are now at a critical juncture. It is imperative that both sides handle the crisis with respect for each others' interests and with recognition of the fact that they both need each other.

Hollywood thrýller ‘Cellular’ gets expensýve Chýnese remake AP

Hollywood has been mining Asian movies for ideas for years, but now an American studio is remaking one of its home productions as a Chinese-language movie with local partners.

Warner China Film HG -- a joint venture between Warner Bros. and China's state-run China Film Group and Hengdian Group -- is releasing "Connected" on Sept. 25, remaking the 2004 New Line Cinema thriller "Cellular," starring Kim Basinger.

New Line Cinema was an independent studio that is now part of Warner Bros. Entertainment.

"Cellular" is about a kidnapped woman who makes a random mobile phone call for help.

"Connected" changes the setting to Hong Kong and switches the cast to Chinese-speaking actors -- Hong Kong's Louis Koo, China's Liu Ye and Taiwan's Barbie Hsu. While Hollywood has remade Asian movies for years -- Martin Scorsese's "The Departed," the horror films "The Ring" and "The Grudge" are based on Asian movies -- "Connected" is billed as the first Chinese remake of a Hollywood movie.

Hong Kong director Benny Chan, who directed "New Police Story" and "Rob-B-Hood," says "Connected" improves on "Cellular" by injecting Hong Kong-style action sequences.

"In my movie, I added many elements that Hong Kong action movies do best -- human combat, action, flying cars," Chan told The Associated Press in an interview Tuesday.

The director said he doesn't mind making a remake.

Eagles continue from where they left off two weeks ago

The Beþiktaþ Black Eagles host Bosnian side NK Siroki Brijeg in their UEFA Cup second qualifying round, second-leg match at Ýstanbul's Ýnonü Stadium this evening.

Beþiktaþ won 2-1 in the first leg in Bosnia two weeks ago and therefore carries a huge advantage into today's deciding game. The obscure Bosnians may be down, but they are not out -- yet. The reason being that there is neither victor nor vanquished before any soccer match is played and so Siroki still has a chance, albeit a slim one. This the Black Eagles must keep in mind when they step foot onto Ýnönü because there is no room for complacency in the "beautiful game."

Beþiktaþ warmed up for today's encounter with a thriller 3-2 away victory over Antalyaspor in their Turkcell Super League opener on Sunday night. That the Eagles came from two goals down in the first half on Sunday to win showed there were many flaws in the team's game plan in the first half. The most outstanding was the lack of coordination between the defenders, midfielders and the forward and that was the simple reason Antalyaspor could score two cheap goals in this half.

But when young coach Ertuðrul Saðlam righted the wrongs after the break, the Eagles turned their disadvantages in advantages. Hopefully Sunday's mistakes won't be repeated today, because conceding early goals and then fighting back to equalize and eventually win defies logical reasoning.

All said, the Black Eagles still look too strong and too good for tiny Siroki -- especially upfront.

Captain-playmaker Matias Delgado, who scored the team's first goal on Sunday, appears to be in perfect form.

His millimetric passes, effective dribbling runs and powerful shots make him a big threat to opposing defenders.

Brazilian forward Bobo, who scored the equalizer and match winner against Antalya, is picking up form quickly as well as his co-striker Filip Holosko.

Though not on the scoresheet for Sunday, Holosko produced several assists and goal passes. Leftie Rodrigo Tello is also a good scorer though he is naturally a midfielder. Striker Mert Nobre, who injured his right foot on Sunday, will be missing today but that will not stop the Eagles from going for the kill right from the starting whistle.

In short, Beþiktaþ' strength lies at the foot of its strikers. The defense can be whimsical and enigmatic at times as it happened on Sunday. If Saðlam can fix those defensive leaks, then the fans at Ýnönü can expect fireworks this evening.

And Saðlam this week issued a strong warning to his players when he said, "This match is very important for us, we take it seriously and we also take our opponents seriously."

The 20-year-old son of Grammy award-winning rapper and producer Dr. Dre was found dead over the weekend at his home in Woodland Hills, California, the Los Angeles County coroner's office said on Tuesday. Andre Young Jr. was out with friends Friday night and his mother later found him "unresponsive in bed" when she tried to wake him early Saturday morning, coroner's spokesman Ed Winter told Reuters.

She immediately called paramedics, who later pronounced Young dead at the scene.

"Dr. Dre is mourning the loss of his son Andre Young Jr. Please respect his family's grief and privacy at this time," said a statement released by his spokeswoman.

An autopsy was conducted and the cause of death is still pending toxicology and other tests, which may take six weeks or more, Winter said. Dr. Dre, whose real name is Andre

Young, rose to stardom in the 1980's with rap group N.W.A's controversial gangster rap album "Straight Outta Compton." No buyers for man's million-mile Chevy -- yet A 1991 Chevrolet Silverado that has traveled more than 1 million miles is still on the market, its owner says, though it failed to fetch the premium price that he had hoped for. Frank Oresnik said he failed to sell the 1991 truck during a 10-day auction on eBay that ended on Sunday. He had placed a minimum bid of $30,000, and said all he got was a couple of feelers. But he's not giving up. The 58-yearold Oresnik said he is going to put the truck back on eBay later this week with no minimum bid. Oresnik bought the truck 12 years ago when it had 41,000 miles. He used the vehicle to deliver seafood in three states, putting on about 85,000 miles a year. When the odometer hit a million miles earlier this year, on a road near Fond du Lac, the feat brought him national attention. Over the years, the truck has had four radiators, three gas tanks and six water pumps, but the engine is still original. Feisty puppy scares off 3 bears in NJ back yard If only Goldilocks had a cockapoo. A 15-pound cocker spaniel-poodle mix named Pawlee scared off a mother bear and her two cubs on Sunday morning after they strayed into his owners' back yard. Whether his bark was worse than his bite, Pawlee's tactic worked just fine.

These three bears got the hint and took off. "We had just let him out for the morning and he ran into the yard and started barking his head off," owner Fran Osiason said.

Osiason said her 9-year-old son, Jacob, went outside to see what the commotion was about and came running back in to report there were bears in the yard. She was worried that the mother would come after Pawlee to protect her cubs, but the pugnacious pup, just 8 months old, had other plans. His barking drove the two cubs up a tree, and they eventually climbed down and hopped over a fence with their mother and retreated into the woods.

Osiason said she, her son, husband Andrew and daughter Eden, 6, have had Pawlee since he was about 8 weeks old. She marveled at his fearlessness. "He's a little fur ball," she said. Northern New Jersey seems to breed feisty pets: In 2006, a tabby cat named Jack chased a bear up a tree in his West Milford yard. Bears are not uncommon in Wyckoff, but Osiason said her family has lived there for about 10 years and had not seen any until Sunday. With Pawlee on guard, they might not see another one anytime soon. Cat survives being walled in under bath for 7 weeks A four-year-old cat in Germany called Bonny has survived after being walled in beneath a bathtub for seven weeks, its owner said. "It's a miracle," said Monika Hoppert, a 60-year-old widow from the western town of Stadthagen. "I'm a strong believer, I think she must have had a guardian angel. I'm so happy." Bonny disappeared on June 19 while workmen were replacing pipes in the block of flats where Hoppert lives. The black cat was last seen in a neighboring apartment, where the cladding around a bathtub had been removed. "Just before tub was sealed up again, Bonny had probably crept underneath," Hoppert said. Jane Balogh had been charged with making a false statement but entered into a plea agreement last year. A King County judge dismissed the charge Monday after Balogh showed that she had paid $240 in court costs and completed community service. Balogh says she registered her dog Duncan to protest a loophole in the law that she says makes voter registration so easy a nonexistent person could be added to the voter rolls.
