The following setbacks apply… - - -
Buildings must be setback 5’ from property line on both the principle and secondary front (In our case this pertains only to NW South River Drive) (Diagram A) Side setbacks are to equal 25% of the average width of the lot i.e. 25’ (Diagram A) Waterfront setback is determined by calculating the 25% width line at 40 intervals over the length of the site (Diagram A)
The following setback exceptions apply… - At the first layer, cantilevered Awnings and canopies may encroach 100% of the setback - At the first layer, canitleved balconies, bay windows, and roofs may encroach up to 3 feet of the setback - At the second layer, Façade components promoting energy efficiency such as shading and screening devices that are non-accessible may encroach a maximum of 3 feet. - Galleries and Arcades must be a minimum of 15 feet deep and are permitted to cover 100% of the setback
Building placement on site must be in accordance to the following… - - -
Allow for at least 5% open (green) space Cover no more than 90% of the lot Max height of 8 stories (Diagram B)
The following “eye sore” elements of the site must be located on the second or third layer and concealed from view of NW South River Drive and neighboring sites by street screens and opaque gates… - Storage - Utility and infrastructure elements - Service areas - Loading space - Transformers - Telephone boxes
- Garbage cans - Dumpsters - Condensers - Meters - Backflow preventers - Siamese connections
Other regulations that apply are... - Street screens must be between 3.5 and 8 feet, and have openings no larger than necessary for automobile and pedestrian access. They may be substituted by a hedge or opaque fence. - Roofs should be light-colored, high Albedo, or a planted surface. - The first layer should be planted and paved to match the surrounding frontage. - Allowable width of pavement must be provided for bicycles on waterfront walk - Waterfront walkways shall apply to A.D.A. requirements, and connect to abutting public walkways, neighboring walkways, and Open Space at a consistent A.D.A. compliant width and grade to allow clear pedestrian circulation along the water’s edge. - Average lighting at the building frontage shall not exceed 1 footcandle. - Lighting of the building shall be compatible with street lighting of abutting public spaces.
