Minimising the cost of Separation

The cost, both emotional and financial of separation cannot be understated for those involved.

Financially, those separating find themselves with the capital and income which once supported one household being divided over two, before adding into that mix legal fees.

Emotionally, separation and divorce are some of the most stressful things we can go through. Research suggests it is second only to the death of a partner in terms of stress.

One of the most common questions we are asked is how to minimise the emotional and financial costs. In both aspects the answer is most often good clear advice, as early as possible, and communication. Dealing with Family Law issues does not automatically entail courtroom battles with lawyers at loggerheads and skyrocketing legal bills.

In Scotland our legislative framework sets out how financial matters arising out of a separation or how matters regarding children of a separating couple should be approached. Getting expert initial advice and understanding the correct legal position and how it applies to you will ensure any direct negotiation takes the right course and can mean that you are able to agree far more.

We strongly encourage clients to have an early advice session which can empower them to undertake discussions with their spouse or partner. In circumstances where parties are able to reach an agreement on terms themselves, we then turn their agreement into a legally binding document called a Minute of Agreement or Separation Agreement. This results in a lower cost in

terms of both legal fees and emotional toll. Where direct discussion isn’t possible, or where you can only reach agreement on some things, alternative dispute resolution models such as Collaboration or Mediation can help you get there whilst minimising the emotional impact.

In all cases early, quality advise is the key. Understanding and knowledge can give you the power to have effective discussions which will often lower levels of conflict and cost. September and October often bring out the best in the city and shire. If we’re lucky, September features some warm hazy days and lots to keep us busy before it’s full on prep for the festive season. Can we mention the C-word yet? Our to-do lists seem to get longer every year and it takes about a week to get all the presents wrapped. At least we have our annual gift guide in the next issue and our Christmas Fayre at the Marcliffe on 3rd November to help with finding the perfect gift for everyone on your list.

We still have the October holidays to get through first so let’s just focus on making the most of autumn. Get out and about, go somewhere new and take the time to relax and take care of yourself. You’ll find some great ideas in this issue. Have a go at a golf driving range, curl up with a good book by a roaring fire or get a little peace by registering the kids in for a sports camp. Treat yourself to a new look for autumn with our guide to the most stylish buys from our local boutiques or indulge in a weekend trip to Dublin. After all, it’ll be winter before we know it!

Over the years, the team has won a string of awards and now we’re moving on to our next chapter as part of Apex Hotels. I feel lucky to head up the drive and onto the estate every day for work but also, and more importantly, the staff throughout the hotel and estate are brilliant. We have fantastic suppliers who we visit on our ‘chef trips’. We attend site visits as a team to get a deeper understanding of the produce we prepare each day and that’s always fun.

‘I didn’t set out to be a chef. I wanted to join the Army, but my asthma meant that wasn’t possible, so I enrolled in college with friends doing a one year hospitality course. Over fifteen years later and I wouldn’t change a thing! I’ve been head chef in some of Aberdeenshire’s best regarded hotel kitchens and honed my craft working as a Sous Chef for the renowned Shirley Spear at the Three Chimneys on Skye. In a few weeks, my younger brother will be following in my footsteps and joining us here at Meldrum House, so cooking seems to be a family skill.

‘I live with my partner Hannah and our two pups, Chase and Nala. I love going for long walks with Hannah, my two children Finley and Taylor and the dogs. As Hannah

will confirm, I’m not in charge of cooking at home. Hannah’s the boss there.

‘At Meldrum House, our menu is traditional Scottish dishes with French flair. Our seafood is so fresh, it’s landed and delivered straight from Peterhead. My favourite dish on the menu is my Senior Sous Chef’s starter of sea trout cured in red cabbage, served with a cucumber tea. It’s very refreshing and is definitely a winner on our à la carte menu.

‘Working at Meldrum House is amazing and always very exciting. We’ve had Tony Singh, the incredible celebrity chef, join us for the last three years. The team love working with him and learning new dishes. The team manages everything from the Cave Bar, luxury dining domes, Pineapple Grill & Seafood Restaurant, private events and weddings. We want guests to feel their expectations have been exceeded and to be looked after as if they are the only ones dining with us.

‘At this time of year, we’re putting a lot of thought into creating really special festive menus. We have the traditional take on the menus but also add in dishes that are innovative and we think our guests will enjoy at that time of year. Christmas is such a special time at Meldrum and so it’s the perfect place to bring family, friends or colleagues, dine in a great setting and have some fun.’

'Does "common law marriage" exist in Scotland?'

“Common law marriage” is a term that has been used colloquially for centuries in circumstances where couples have lived together like husband and wife but have never formalised their relationship by getting married. There is often misunderstanding about whether “common law marriage” exists in Scotland and as family lawyers, we frequently hear from clients who assume that they will be regarded as “common law wife” or “common law husband”. Somewhat contrary to popular belief, “common law marriage” is not a status or concept recognised by Scots Law.

Much of the confusion surrounding “common law marriage” has arisen because it used to be possible for couples to form a "marriage by cohabitation with habit and repute". This ‘irregular’ type of marriage could be established through an application to a court where the relationship met certain conditions, but the law enabling this was almost completely abolished in 2006.

What rights do cohabitants have in Scotland?

Cohabiting couples do not currently have any automatic rights in the event of separation or death of a partner, but they can apply to the Court for:

• Financial provision in the event of separation - cohabitants can apply to the court for payment of a capital sum where they can prove they have suffered economic disadvantage in the interests of the other cohabitant or a child of the cohabitants and/or an amount of money in respect of the economic burden of caring, after the end of cohabitation, for a child of the relationship. Crucially, any such application to the court must be

made within one year from the date of separation.

• Transfer of property or payment of capital in the event of death – if a cohabitant dies without having made a Will, the survivor will not automatically share in the deceased’s estate but can make an application to the court within six months from the date of death for a payment from the deceased’s estate and/ or transfer of property.

• Occupancy Rights – unlike married couples, cohabitants do not have an automatic entitlement to continue living in a property which is leased or owned by their partner, but ‘non- entitled’ cohabitants can apply to the court for the right to occupy the property for a prescribed period in certain circumstances.

What can cohabitants do to protect themselves?

• Enter into a Cohabitation Agreement regulating the financial aspects of cohabitation, including provision to protect any deposit used in the purchase of a heritable property;

• Carefully manage finances during the relationship so that savings are kept separate and contributions towards living costs are equal;

• Review Wills and Powers of Attorney; and

• Ensure nominations for Pension Death in Service Benefits reflect wishes.

The law on cohabitation in Scotland has been criticised as being out of date, unclear and overly complicated. A review has been carried out by the Scottish Law Commission and changes to the law are anticipated. Given the complexities involved in this area of law, it would be advisable to take legal advice prior to the commencement of cohabitation.

At this time of the year, there’s nothing quite like curling up in front of a warm fire, ideally with a mug of hot chocolate, a dog or cat at your feet, an engrossing novel or some trashy TV and a glow of contentment.

Log burners are increasingly popular, but talk to one of the expert local firms first as you need to check what fuels can be burnt in your neighbourhood and whether you have a suitable flue. There’s something to suit every style of décor and type of home, from grand Victorian and art deco open fireplaces to ultra-modern minimalist gas flame fires that don’t even need a chimney. Keep in mind that there’s a lot more effort and cleaning required with a real fire, rather than central heating.

Carry on camping: kids’ sports camps

Almost recovered from the wallet-draining chaos of the school summer break? Then the October holidays must be creeping up on us. One of the best ways to keep your little angels occupied is to book them in for a day or week-long sports camp. It’ll teach them new skills, leave them exhausted, and with any luck, you even might get some quiet evenings as a result. Book quickly because places fill up in no time…

Sport Aberdeen should be your first port of call, simply because it offers a wide variety of activities across the city run by experienced coaches at great facilities, all whilst being

excellent value for money. There are intensive swimming lessons delivered at Dyce Swimming Pool, Tullos Swimming Pool and Get active @ Cults. The classes are structed by ability, so all children in each group will be around the same level – whether just starting out or mastering the butterfly stroke.

For those looking to take to the slopes, Sport Aberdeen also runs snowsports camps at its Adventure Aberdeen Snowsports Centre

Adventure Aberdeen offer October sports camps for those aged 6-12 at the ski slope in Garthdee. A typical day can involve skiing in the morning with small group activities, followed

by tubing and multi-sports sessions in the afternoon. Participants can also try snowboarding and there’s a trip to Burn O’ Vat to round off the week with some wet and muddy fun, building dens in the woods and exploring the cave behind the waterfall.

If your child prefers activities with a little less mud involved, then perhaps a tennis camp at Aberdeen Tennis Centre is the one to keep their whites clean. There are day or week-long camps for kids aged 5-8 and 9-12, teaching the rudiments of tennis and helping to build their skills. The camps run from 8.30am to 4.30pm, which is perfect if you’re working over the holidays. Tennis camps cost £47.50 for a day or £190 for five days, with

discounts available for those registered on the Get Active for Less.

Sport Aberdeen also offers adventurous activities for children in the holidays, including coasteering, rock climbing, abseiling, mountain biking, canoeing and forest days.

If your child prefers a variety of sports, then Sport Aberdeen also offers multisport camps . These offer a wonderful mix of activities and taster sessions, so your child could discover something that really appeals to them and becomes a life-long passion. They are run at Get Active @ Cults and include athletics, basketball,

netball, football, rugby, dodgeball, tennis, volleyball for starters, with fun competitions on the Friday. There are two age groups, one for 4-8 year olds who are at primary school and the other for kids aged 9-12. With single day spaces available and week-long spaces for only £150, it offers excellent value for money.

Autumn tidy up

It is always sad to see summer disappear, but there is something incredibly satisfying about putting the garden to bed in the knowledge you are preparing it for next spring! Garden designer Kirsty McLean shares her tips for tackling the autumn tidy up…

Feed your lawn. Feeding now will provide benefits until spring when you can add a spring feed, followed by a summer feed.

Remove Dead Plants. Clear out any dead or diseased plants to prevent pests and diseases from overwintering.

Cut back perennials and remove dead . Cut back perennials to promote healthy growth next spring. Leave some foliage for winter interest and wildlife shelter if you can. Lift and divide overgrown perennials, the new divisions can provide you with several new plants for another area in the garden.

Collect autumn leaves. You can compost these to be used later as a mulch. Leave the odd pile of leaves at the back of a border or under a hedge as these provide great shelters for insects and small mammals. Do leave your wildlife leaf piles over the crowns of herbaceous perennials or on damp grass as it can promote plant rot and bare patches on the lawn. .

Weed the garden. Pull out weeds to reduce

competition for nutrients next season and give yourself a head start next spring.

Prepare the soil. Add compost or mulch to enrich the soil in your borders and beds.

Prune trees and shrubs. Prune back any overgrown trees and shrubs to maintain their shape and health. However, don’t prune plants that produce their blooms on old wood, such

as Rhododendron, Malus/Crab Apple, Azalea, Lilac or Forsythia. You can plant bare-rooted trees or hedging form November till March, but it’s worth protecting exposed evergreens

for their first couple of years. Snow is less of a problem than continuously low ground temperatures or water-logged soil.

Protect Plants. Mulch around sensitive plants for winter protection. Consider covering very tender plants with horticultural fleece or move these into a glass house/shelter. Dig up annual bulbs for reuse, dry for a few days, then store in labelled paper bags or nets and keep in a dry, cool place.

Clean your garden tools. Wipe clean and disinfect your tools to prevent the spread of diseases. Sharpen your tools and lawnmower blades, drain hoses and water features and

store your garden furniture and clean out and organise sheds and greenhouses, so you’re ready for spring.

Plan for next year. Put your feet up, get a pile of plant catalogues and plan changes to your garden and organise projects for next year.

DAWGS: Lending a paw to man’s best friend

DAWGS is a small local charity dedicated to finding new homes for dogs whose owners, for whatever reason can no longer care for them. The rehoming staff, trustees and volunteers carefully screen new homes to ensure the best match. DAWGS doesn’t have its own kennels, so the dogs awaiting rehoming are looked after by their owners in their own homes or in some circumstances, in foster homes with volunteers until a suitable new home can be found.

The charity has just marked its 30 th anniversary and has found forever homes for over 4000 dogs in that time. Unlike some other rescue and rehoming organisations, DAWGS place no limit on the age or breed of the dogs they help to find new homes. They rehome mainly in the city and shire, but will sometimes find a dog’s perfect match further

afield. If necessary, the charity can also help with ongoing veterinary costs and assistance with behavioural issues.

‘In the last couple of months we’ve seen many more dogs than usual in need of new homes from puppies to seniors and from Chihuahuas to Huskies and German Shepherds and mixed breeds,’ explained Sarah Jane, Administrator/ Assistant Rehoming Officer, ‘As well as rehoming enquiries, we’d welcome more volunteers whether that’s lending a hand with fostering, home checking, fundraising or helping out in our charity shop and pet food bank in Alford.

‘There are lots of ways you can help us, from a one-off donation on our Just Giving page www.justgiving.com/dawgs/donate to undertaking a fundraising challenge,

becoming a Best Friend through our monthly donations, sponsorships and leaving a legacy. Dogs really are our best friends, so it’s important that we are there for them when they need us.’

Just the place for a craicing weekend Dublin

Headacross the Irish Sea for a weekend break that’s packed with history, music, interesting shops, delicious food and just a little too much to drink…

Like any capital city, Dublin has so much to offer that you can tailor-make a weekend that comes pretty close to your prefect city break whether you want an action-packed time, to hit the shops, stuff yourself with gourmet specialities, go pub-crawling or simply to relax. The only thing you can’t choose in advance is the weather.

You can fly from Aberdeen and there’s a wealth of hotel choices available, from giant modern chains to the upscale Grafton, the charming Aberdeen Lodge and historic buildings like Clonarf Castle

Hotel. If you’re self-catering, the city abounds in farmers markets and food halls. Fallon and Byrne on Exchequer Street specialises in artisan treats, fine wines and there’s even a restaurant. Staying in the centre, Morton’s has a superb selection of deli products, fruit, veg and cheese. If you want to venture further afield, try the fishing town of Howth, which has a weekend lifestyle market, or book a beekeeping workshop at Olly’s farm where you could come home with a new hobby and a couple of jars of honey.

There’s a restaurant to suit every taste and pocket. Michelin rates Chapter One and the Art Deco Glovers Alley, which offers a great deal at lunchtimes if you fancy Michelin starred meals without the hefty

price tag. Wilde and Bloom Brasserie both give a nod to the city’s literary heritage, but offer menus which are easier to digest than the works of James Joyce. You’ll find everything from Taiwanese street food and to Persian banquets.

When it comes to shopping, there’s a choice of shopping centres or you could try Brown Thomas if you’re feeling nostalgic for department stores. Seek out some of Dublin’s more interesting independent stores like Avoca for womenswear, Chatham Street’s Costelloe and Costelloe which offers a rainbow of accessories and globally sourced gifts, Courtville Antique and Vintage Jewellers and the Antique Quarter on Francis Street which offers a joyful afternoon’s treasure seeking in

antique shops, galleries and restaurants. If you like your shops with a more macho appeal, try James Fox’ Cigar and Whisky Store, or Murphy’s Harley-Davidson.

You can’t go to Dublin without a visit to Jameson’s Distillery, the Guinness Storehouse or a few pubs. It may be part of the passport control procedures. Mulligan’s, The Temple Bar, The Cobblestone, The Long Hall and the Brazen Head are amongst the most popular for a night of music, atmosphere and a few laughs.

If you’d prefer a more relaxing cultural break, grab a picnic rug and head to St. Stephen’s Green where you can languish amongst the trees or at the lakeside

with a copy of Yeats’ poetry or pop into to drool over the Old Library at Trinity College and the beautifully illuminated 9th century Book of Kells. You can also take a surprisingly entertaining tour of Glasnevin, Ireland’s National Cemetery which houses the remains of half of Ireland’s historical figures from 1800 onwards. You’ll find more history and some grim tales at Kilmainham Gaol Museum, EPIC, the museum of Irish Emigration or a more cheerful approach during the 29 minute tour at the Little Museum of Dublin. If you dig archaeology, The National Museum of Ireland should also be on your schedule, don’t miss the displays of Celtic gold, Viking artefacts and the amazingly preserved, if somewhat macabre, bodies retrieved from Irish bogs.

MEET SPORTS ENTHUSIAST KEITH HESLOP, CEO OF SPORT ABERDEEN

‘‘First and foremost, I’m an Aberdonian. I was born here and went to Cornhill Primary where my love of sports was first kindled. I can’t remember a time when I wasn’t playing golf, football or tennis in the summer and I still have friends from primary that I see regularly. I wanted to be a professional golfer and would play 54 holes a day at King’s Links. It’s a wonder my parents ever saw me.

‘My teenage years were in the 1980’s – a great time for the city with Sir Alex Ferguson, the European Cup Winners’ trophy and all the amazing music and clubs.

‘I studied Business Studies at RGU, whilst working part-time running an ice-cream business in Bridge of Don and Seaton. After qualifying as

an Accountant, - I worked all over the world –Equatorial Guinea, Cote d’Ivoire, South Africa, Gabon, even Port Stanley in the Falklands for a couple of years. I moved from finance into more commercial and contracts based roles as my career progressed.

‘I have three kids, though two can’t be called kids any more. Abbie is building her career in Taiwan and Cameron's just graduated and commenced his first accountancy role. Corey is seven and has just started in Primary Three. He gives me the perfect excuse to try out some of Sport Aberdeen’s facilities. ‘Sport Aberdeen is a charity which manages over thirty indoor and outdoor sports facilities across the city, and even has an outdoor centre in the Highlands. It’s a massive undertaking, but I’m incredibly fortunate in having amazing people around me at all levels of the organisation. We have so many caring and supportive people all giving that bit extra to help other achieve their goals.

‘Sport Aberdeen really is for everyone across the city – from every neighbourhood, every age and ability. Sport and exercise brings us together as a community in a unique fashion. Inclusivity matters, so there are programmes for children, older people and communities which are often disadvantaged or from cultural backgrounds where participating in sports is less common. We try to keep prices low as well.

‘It costs about £15 million a year to offer all our programmes and to keep the facilities running. Aberdeen City Council gives us a grant of £4.5 million, so the rest we fund through memberships, external funding and sponsorships. For example, the sponsorship we receive from Ram Tubulars means that primary school kids around Garthdee can learn to ski at Snowsports Aberdeen, which they might not be able to do otherwise. Business can make a big difference to the health and wellbeing of the people who live here. Any surplus we make gets ploughed back in to our facilities and programmes, so it’s a constant cycle of improvement.

Cala Homes puts community at the heart of Burnland Meadows development
