Thanks for the Memories

The end of another fiscal year is soon approaching, and hopefully the end to the “virtual year”. We begin the task of transitioning to a new Executive Committee, welcoming new Board members, creating a new budget, and membership renewal. For me, it is time to say goodbye. August 31 will be my last day as your President. Thank you to all who have supported me in my efforts this year. It has been an honor and a privilege to serve you. We all worked very hard this year to make sure our members stayed connected and informed. We focused on updating the Bar Center, rolling out a new website and creating services that our members need to continue in their daily business life and their well-being. I am excited to welcome in next year’s President, Kara Vincent. She has great plans for the TCBA, and I'm certain that she will do a marvelous job. I have often heard that a leader is only as good as their team. Well, that is very true. I want to say thank you to the Executive Committee: Kara Vincent, Philip Hixon, Natalie Sears, Mike Esmond, Lesa Creveling and Past President, Jim Milton. I also want to thank the Board of Directors for their faithful service to the TCBA. Thank you to the TCBA staff, Tami Williams and our new Membership Director, Julie Rivers. I also want to thank, Milly Dunlap. Thank you for your patience. Those Tulsa Lawyer article deadlines just sneak up on you. When I began this journey well over 12 years ago, I had no idea the impact the TCBA would have on my life. The TCBA has given me opportunities I may not have had otherwise. I have encountered growth and education. I have met other attorneys I probably would not have ever encountered, and I have made everlasting friendships. events, new meeting spaces at the Bar center, leadership opportunities, community service and health and wellness. I urge each and every one of you to renew your TCBA membership. Reach out to your fellow attorneys who are not members, and let them know how meaningful and valuable membership can be for them. The best part is it only gets better each and every year! On August 19, we will host the TCBA/TCBF Annual Meeting at the Tulsa Club in downtown Tulsa. I, for one, am excited to get to see all of you in person again. Also, I am excited because we have an impressive speaker lined up, Denver Morrissey Nicks, an awardwinning journalist and producer. A former staff writer for TIME, he is a contributor to National Geographic Travel, Rolling Stone, Uproxx, and other publications. He's the author of the books Hot Sauce Nation: America's Burning Obsession and PRIVATE: Bradley Manning, WikiLeaks, and the Biggest Exposure of Official Secrets in American History, and CONVICTION: The Murder Trial That Powered Thurgood Marshall’s Fight for Civil Rights. Currently, he is a law student at Tulane University. Denver will be speaking on his book, Conviction, which he co-authored with his father, local attorney, John Nicks. What a Year! What a year! We have reached the final month of the Association’s fiscal year and (collective sigh of relief) my final VP’s Corner article. A year begun in masks and lockdowns—like a poorly written dystopian novel— has returned to some level of normalcy—and not the mostly dreadful “new” kind. In preparing this final installment, I reviewed my prior work product and identified some recurring themes. In my first outing and in several thereafter, I highlighted upcoming Association events such as the Holiday Challenge, Law Day, and the First Responder Will Clinic. Throughout the year, I quoted several notable personalities: Geoffrey Chaucer, Alice Cooper, Bill Cosby, Salvador Dali, T.S. Eliot, Nelson Mandela, Babe Ruth, and Yoda, among others. Many of my articles included, or were solely devoted to, personal reflections, including a tribute to Sandra Cousins, an overly descriptive inventory of my home-office, recollection of my refusal to employ the ostensible vigilante sanction powers of Association officers, and too many others to fully describe in this limited space. The COVID-19 pandemic was also a reliable theme (and more ubiquitous than my typographical errors).

Don't Have Time? It's worth thinking again.

The Oklahoma Access to Justice Commission and Access to Justice Foundation are cosponsoring the first annual Summer Pro Bono Challenge this year. We hope it will inspire lawyers in firms of all sizes to examine and expand their pro bono commitment. Often, we hear that lawyers worry that they don’t have time to do pro bono (after all, time is money). But it’s important to remember that a robust pro bono program is a critical recruitment and retention tool. All three Oklahoma law schools have a “pro bono pledge” where students are encouraged to provide at least 50 hours of pro bono and community service during their time in law school and celebrated for meeting those goals. They expect law firms to carry a similar commitment to the ethical obligation of pro bono service. Additionally, pro bono can be a valuable training and business development tool. Many young attorneys may not have opportunities early in their career for significant trial and client experience but can build those skills through pro bono volunteering. Volunteer programs can also bring attorneys in contact with others in the field in a wide variety of practice areas and settings, including corporate and in-house counsel. Many companies now look for a law firm that “walks the walk” when it comes to community engagement and volunteerism when retaining outside counsel.


To share his story on why he does pro bono, we talked with Mac Finlayson, Senior Counsel at Eller & Detrich, and chair of TCBA’s Pro Bono Committee. The Pro Bono Committee operates the Court Assistance Project, providing pro bono representation to tenants facing eviction in Tulsa County.

Volunteering at this level is also an excellent opportunity for young lawyers who may otherwise be stuck in the library to get into a courtroom and develop trial and public speaking skills to yield more effective presentations. It may take some a while to learn to talk on their feet. This is an excellent training opportunity.

When did you first start doing pro bono?

What is a piece of advice you'd give to someone looking to increase their pro bono commitment?

I believe I started volunteering as a pro bono lawyer about three and a half to four years ago. I have chaired the TCBA Pro Bono Committee for two years. What is something that has surprised you from your pro bono experience? What surprised me the most about volunteering was the level of gratitude from our tenant-clients. Often, they simply needed someone they trust to explain their options under the law and to know we were there for them. For many, the fact someone cared enough to appear to represent them on a pro bono basis was uplifting and often emotional. Tenants in this demographic often have become used to being beat up and giving up. Our appearance gives them some measure of hope, where there was none before. Of course, most were frightened and believed a courtroom experience would not work to their benefit. That the system was rigged against them. But, when we got some order into the process, got them somewhat relaxed, and negotiated an orderly transition for them, they were very grateful.

Stop thinking or talking about it and just volunteer. Lack of experience in residential landlord-tenant law should not discourage you. We will teach you! I knew little about it when I began. We have a 1-hour video presentation of landlord-tenant law (Oklahoma Residential Landlord-Tenant Act) and an ORLTA Handbook with citations of law to both statutes and decisions, with appendixes that include those statutory provisions and the actual decisions. Frankly, if I can do it, you can, too. I take that handbook to court with me each time I appear. Having the law at your fingertips (when the opposition typically does not) yields a more positive result. The video presentation will also allow you to earn 1 hour of free CLE from the OBA, and because it is recorded, scheduling is convenient. The materials are yours to keep.

I would also encourage you to join the TCBA Pro Bono Committee (we meet the first Monday of each month – the next meeting is August 2). Oftentimes, it is easy to decide how your property will be distributed after you are gone – but what about your sentient property!? Pets are living, feeling “property”, yet many people do not have a plan in place to be sure that their pets are cared for when something happens to their “master.” As an estate planning attorney, I always ask my clients during the first interview if they have pets and if they have a person that will step up immediately if something happens to them to assure that their pets have a safe home. You would be surprised how many of these clients either say “no” or are at least very hesitant to say that they are certain. Many say their children and other relatives would not be willing to take in their animals once they die.

Pet “Retirement” Home

Yes, Oklahoma allows you to establish a Trust now or in your estate planning documents to support and care for your animals. This is a good option when there is larger number of pets (but this certainly can be done for only one animal) or where there is a sufficient amount of money. If this is one of your primary desires – the future care of your animals – you should investigate the Pet Trust. Now you cannot name the animal(s) as the direct named beneficiaries of the Trust – this causes the trust to be void. But just like you were establishing a trust for minor children, you can set up the trust with a caretaker/guardian/trustee and instruct the trustee how and when to distribute the funds for the care of your pets.

For certain people and certain pets, a viable alternative is a pet retirement home. If you have sufficient funds and you want to be certain that there will be someone there to help with your animals (or your animals have special needs), this alternative can give you great peace of mind. This option requires advanced planning and a reservation fee is usually required while you are still alive to assure that they will accept your pet when you are deceased. OSU offers such a program and it is called the Cohn Pet Care Facility. It was built as a permanent home for animals whose owners planned in advance to ensure their beloved pets would be cared for in the owner’s absence. Faith’s Legacy Lives On with the Animal Law Committee Faith Orlowski is a legend in the animal law community. She started the TCBA Animal Law Committee years ago, served on the board of the Tulsa SPCA for too many years to count, helped establish other nonprofit animal welfare organizations, and provided advice and counsel to numerous animal organizations and animal lovers. She was the TCBA’s go-to person for any question that related in any way to animals and the law. How can I provide for my pet after my death? Who gets a pet in a divorce? What do I do if my dog bites another dog but that other dog growled first? If someone’s dog keeps coming to my house asking for treats, can I keep it? Will you sue my neighbor because her cat keeps defecating on my front porch? (No.) Faith helped plenty of people and organizations with their legal questions, large and small, and she also took in many pitiful, Charlie Brown Christmas tree looking dogs and cats, some of whom only a pet parent could love.

Faith Orlowski Animal Law Award to be presented to a law student member of the TCBA who is committed to advancing the welfare of animals. The award will be presented at the Annual Meeting. Lawyers Against Pawverty to benefit Tulsa SPCA Each year the Animal Law Committee supports efforts by local non-profits to positively impact the lives of animals and people through Lawyers Against Pawverty. This year the committee has chosen the Tulsa Society for the Prevention of Cruelty to Animals as the beneficiary of Lawyers Against Pawverty in honor of Faith Orlowski.

Faith was a longtime Tulsa SPCA board member, avid supporter, and extraordinary resource. She was dedicated to the Tulsa SPCA, a nonprofit that was formed in 1913 with a mission to improve the lives of dogs and cats, and their human companions in the Faith Orlowski Animal Law Award Tulsa area. In addition to its shelter and pet adoptions, In honor of Faith’s commitment to animals and those the Tulsa SPCA has a cruelty investigator, a program who love them, and her willingness to volunteer her for volunteers to take pets to visit nursing homes, and a time and talent to advance their welfare, the Animal Law clinic that provides low-cost vaccinations, preventative Committee is celebrating her legacy by establishing the care, microchipping, and spay/neuter services. As a way to honor Faith and her legacy, the Tulsa SPCA is building a permanent memorial in her honor. It will be a beautiful place for people and their newly adopted pets to take their “going home” photos. The funds raised by Lawyers Against Pawverty will be used to help build this permanent memorial. Lawyers Against Pawverty has grown and can’t all be packed into one month anymore. We have a variety of entertaining activities planned this year. In June, the Animal Law Committee sponsored Tulsa SPCA Paws & Pictures Movie Night at the Admiral Twin. ASK-A-LAWYER 2021 The Way We Were - The Way We Will Be

The OBA has decided to bring back the live version of ASK-A-LAWYER on September 30th, 2021 at the Tulsa OETA studio downtown (where it has been held for the last 6 years). THE WAY WE WERE…… In past years/decades, we did not pay much attention to the number of phones used, their distance from each other or the condition of the handsets being used over and over by different Attorneys without sanitizing. THE WAY WE WILL BE…… Hopefully, all or most of us will have been vaccinated by that time. (I certainly have been already) Notwithstanding this, we will be implementing some continuing safety precautions to encourage participation. For our Tulsa Attorney volunteers, here is the basic setup as I have envisioned it:

Tulsa Lawyers for Children, Inc. (TLC) is actively recruiting attorneys interested in improving the lives of maltreated children in Tulsa County. As an attorney, you already have the basic skills you need, but TLC provides you with the specific training and mentorship you need to make a real difference for our children in state custody In 2000, TLC was incorporated with the assistance of the Tulsa County Bar Association to provide legal services for Tulsa County’s abused and neglected children. Children in state custody are presumed by law to be indigent and are entitled to a court-appointed attorney. In Tulsa County, this role is traditionally filled by the Office of the Public Defender. However, conflicts can arise when there are pending criminal matters against the parents (represented by a Public Defender) or when siblings disagree and desire different legal outcomes in their case. TLC fills this gap in legal representation. The children referred to TLC by the Tulsa County Family Center for Juvenile Justice have all suffered abuse and neglect. Whether sexual abuse, domestic violence, or physical abuse, these children have been maltreated and deserve to have their voices heard in and out of court proceedings. While the total number of children served by TLC fluctuates from year to year, there is a significant concern that abuse and neglect went unnoticed and unreported over the past year, which will be identified and reported as schools return to normal, in-person attendance. Kathy S. Fry 1955 - 2021

Kathy Sue Fry was born on September 18, 1955 in Tulsa, Oklahoma to Joseph Limuel Bowers and Frances Anneda (Ward) Bowers. She passed peacefully from this life on Sunday, June 20, 2021 in Tulsa, Oklahoma at the age of 65 years. Kathy was raised in Owasso, Oklahoma and attended Owasso High School. During high school, she was very active and was a member of the cheerleading squad, French Club, and National Honor Society. She also attended Votech and earned a dental assistant license. Kathy graduated from high school in 1973 and spent the next 18 years as a homemaker, dedicating her time to raising her three children. Kathy returned to school once her children were older and attended Tulsa Community College. She earned two associate degrees at TCC before transferring to the University of Tulsa where she earned her Bachelor of Science in Business Administration. After graduating, Kathy was quickly hired by the Williams Company as a computer programmer. However, she only worked as a programmer briefly because she was then accepted to the University of Tulsa College of Law. She earned her Juris Doctor degree and then in 1997 opened her own law practice, “Kathy S. Fry Attorney at Law”. Kathy specialized in both family and criminal law, but criminal law was her passion. She spent the next two decades defending clients against injustice and did plenty of pro bono work to help people who were unjustly accused but could not afford to pay for a lawyer. In her free time, Kathy loved nothing more than to spend her days with friends and family outside and in her pool. She was the family entertainer and acted as hostess for countless holiday parties. When she was not in the pool or hosting a party, Kathy loved to read, especially crime novels and nonfiction works. Her greatest joy was being with her children and grandchildren. Those she leaves behind hold many cherished memories of her and loved her dearly. She leaves behind her sons Travis Fry and wife Kari, Zach Fry and wife Raquel; Daughter Courtney Davis; 5 Grandchildren Caden, Tyler, Kyle, Nash, and Xavier; 2 Sisters Debbie Gipson 30 Tulsa Lawyer

Visitation was held June 28, 2021 at Mowery Funeral Service in Owasso. Funeral service was Tuesday, June 29, 2021 amd a reception followed at Owasso First Assembly of God Church in Owasso, OK.

Heba Irvin Aston 1939-2021 Heba Irvin Aston, III (H.I.) passed in peace at the age of 81 on Saturday, June 19, 2021. He was preceded in death by his wife of 53 years, Elaine. He is survived by his children, Michael Irvin Aston, Kenneth Wayne Aston, and Dayna Aston Cruz; proud grandfather to Elizabeth Aston, Steven Aston, Aidan Aston; and stepgrandfather to Christina Cruz, Ryan Cruz, Maxwell Yell and Julian Yell. Born in 1939 to Heba Irvin Aston II and Myra Clotilde Irwin Aston in McAlester, Oklahoma, he moved to Tulsa in high school and attended Will Rogers. He was awarded the first tennis scholarship to the University of Tulsa. After graduation, he continued with his alma mater, receiving his law degree in 1965 and following in the footsteps of his grandfather who practiced law in McAlester, Oklahoma for more than 40 years. In August 2015, Mr. Aston was honored for 50 years of service in Tulsa’s legal community. During his almost 55 years of practice, he argued thousands of cases before the courts of Oklahoma and assisted hundreds of clients with their estate planning needs. H.I. will be fondly remembered by family and friends as a loving husband, father and grandfather, an avid tennis player, an enthusiastic University of Tulsa sports fan, an attorney and a follower of Christ. His humor and storytelling were larger than life and brought a smile to those around him. Family and friends attended a celebration of Life on Friday, July 16, 2021 at the Christ United Methodist Church at 3515 South Harvard Avenue in Tulsa.
