2018 Off to a Promising Start March is here, which means spring is in the air. It also means we are closer to the new construction season being in full swing. As you know, one of UCANE’s core missions is to advocate for water infrastructure funding and to maximize the number of projects that are put out to bid. We will get a full briefing on the work coming out in 2018 from MassDEP Commissioner Martin Suuberg, MWRA Executive Director Fred Laskey, and Boston Water & Sewer Commission Chief Engineer John Sullivan at our Forecast Dinner and 7th Annual Trade Show and on March 27, but early indications are very positive for our industry.

I

recently had the opportunity to attend the official announcement of the 2018 Clean Water and Drinking Water Intended Use Plans (IUP) in Billerica. At that event it was great to hear Lt. Governor Karyn Polito, Massachusetts State Treasurer Deb Goldberg, and MassDEP Commissioner Martin Suuberg acknowledge UCANE and the work our members perform.

It was extremely promising to hear that over 60 new construction projects have been approved. It was also encouraging that Governor Baker’s recent budget recommendation for the Clean Water Trust would allow them the flexibility to provide municipalities and agencies with incentives such as zero percent financing and principal forgiveness, which can lead to more work on the street.

A growing number of cities and towns are now doing a better job of long term capital planning; an approach that UCANE has long promoted, which is one reason for the increase in the number of potential projects. All the towns on the Cape are developing and implementing MARCH, 2018

long term plans to deal with their water pollution issues, and that is why we are seeing progress there after years of inaction. (This year’s list of clean water and drinking water projects can be found starting on page 17 in this magazine).

However, there is a lot more planning that needs to be done if we are ever going to cut into the state’s $18-$21 billion water infrastructure funding gap. More cities and town need to be proactive in addressing their needs. Kansas City, Missouri provides a great example for others to follow. They are using GIS data to identify their most at-risk water mains and then prioritizing them for replacement. Their program replaces 28 miles of pipe every year. The utility oversees about 2,800 miles of water main, and 600 of that is over 100 years old.

In 2012, before this plan was implemented, the city utility had 1,844 breaks. In 2017, that number was reduced to 745. Closer to home, the Boston Water & Sewer Commission has a similar program, making sure they replace several miles of pipe every year. Having the foresight to continued on page 5

President’s Message continued from page 3 take this approach instead of a patchwork “fix it as needed” mentality ultimately leads to more steady work and a smaller long-term price tag for taxpayers.

So, while the news about our industry is encouraging, there is still a long way to go. UCANE will continue to lead the way with our advocacy for increases in water infrastructure funding so that we can provide safe and clean water to all our citizens.

I am overwhelmed by all the congratulatory ads and well wishes placed in this months magazine by our members and friends. I know that these words are meant for all of our Officers and Board Members and I want you to know I am deeply moved by the expression of support. Joint Rule 10 Day: UCANE Priorities Advance, But Work Remains

he month of February saw the Massachusetts legislature reach its first mandatory deadline for reporting on legislation before it: Joint Rule 10 Day. Under the Joint Rules adopted by the House and Senate, all joint committees of first referral for legislation must take action on legislation before them by February 7. The rule, which was moved forward from its historical day in March at the start of the 2017-2018 legislative session, significantly whittles down the number of legislative initiatives the body can consider before the end of formal sessions on July 31. For non-controversial matters, the deadline for passing legislative matters is January 2, 2019.

A number of matters which UCANE supports were advanced at the legislative deadline. An Act Relative to the Timely and Consistent Payment of Law Enforcement Personnel (HB2657/SB1477) received a favorable report from both the Joint Committee on State Administration and the Joint Committee on Public Service. Meanwhile, An Act Relative to Improving Public Safety in Excavation (HB3388) received a favorable report from the Joint Committee on Telecommunications, Utilities and Energy. Finally, the Joint Committee on State Administration issued a favorable report to SB1708, An Act Relative to Timely Decisions by Awarding Authorities.

While UCANE was pleased that certain legislation was able to move favorably from Committee, the Association remains vigilant about other important legislation that could impact the construction industry. The Joint Committee on Labor and Workforce Development continues to hold wage theft and family medical leave legislation under extension orders with the expectation that amended legislation will be released shortly. Both of these bills will have significant impacts on the employers throughout the Commonwealth. Additionally, legislation relative to providing

primacy to the Massachusetts Department of Environmental Protection for drinking water and wastewater enforcement was held in an extension order by the Joint Committee on the Environment.

Baker-Polito Administration Awards Grants for Water Management and Conservation Projects

A

t the beginning of February, the Baker-Polito Administration awarded seven grants totaling $632,917 to help 13 communities and water suppliers with water conservation, source and demand management, and other water withdrawal planning and mitigation projects across the Commonwealth. The funding will be utilized in the communities of Amherst, Auburn, Bourne, Danvers, Dedham, Groton, Holden, Kingston, Lincoln, Littleton, Wareham, Westford, and Westwood.

The grants are part of the Water Management Act (WMA) Grant Program, an effort by the Executive Office of Energy and Environmental Affairs and the MassDEP to maintain healthy rivers and streams and improve degraded water resources over time. The WMA Grant Program helps water suppliers by providing grants for watershed planning projects, demand management, minimization, and mitigation activities for water withdrawal impacts.

The following grants were awarded: •

Town of Amherst: Adams Brook Watershed – $66,816.

•

Auburn Water District: Permanent Interconnection with Worcester/Design and Permitting – $105,900.

•

Town of Danvers: Data Collection and Planning in the Ipswich Watershed – $160,790.

•

Dedham/Westwood Water District: Dropcounter Public Portal Expansion – $30,350.

•

Town of Groton (in conjunction with the Holden Water Department, Kingston Water Department, Lincoln Water Department, and the North Sagamore Water District in Bourne): Water Rate Studies – $108,650.

•

Wareham Fire District: Billing Changes and Automatic Meter Reading – $58,800.

•

Towns of Westford and Littleton: Stony Brook Flow Restoration Project – $101,611.

The WMA Grant Program is funded through the Massachusetts Five-Year Capital Plan. The grant program requires a 20 percent match from the communities involved, so that the grants will leverage an additional $204,000 in project work, bringing the total expenditure for the seven projects to more than $837,000.

Legislation to Mandate Lead Removal in Schools Proposes a Commission to Make Recommendations

A

s previously reported in Construction Outlook magazine, there have been a number of programs created to focus on identifying and eradicating lead in school drinking water infrastructure. Representative Lori A. Ehrlich (D-Marblehead) and Senator Joan B. Lovely (D-Salem) recently announced the favorable release of their bill to study the prevalence of lead in school drinking water (HB 2915/SB 456) from the Joint Committee on the Environment, Natural Resources, and Agriculture. The bill would mandate the creation of a commission tasked with solving the emerging public health crisis of children exposed to lead in their schools.

According to the Centers for Disease Control and the MassDEP, there is no safe level of lead exposure.

In Massachusetts, nearly half of the school water tests conducted (49.7%) found some level of lead in the water. Lead in pipes, plumbing, water fountains and more have been found to leach lead into school water. In addition, many schools’ water service lines are still made of lead. While lead removal in paint and gasoline has been successful, lead in our water supply still remains a burgeoning threat to public health.

The proposed Commission, if passed, will be comprised of the commissioners of the Massachusetts

Departments of Public Health, and Elementary and Secondary Education, who will serve as co-chairs of the commission. The commission will be rounded out by legislative designees and representatives from the Massachusetts Water Resources Authority, the Massachusetts Clean Water Trust, the Mass. Municipal Association, the Massachusetts Association of School Superintendents, the Massachusetts Parent Teacher Association, the Massachusetts Association of School Committees, the Massachusetts Teachers Association, and the Massachusetts Chapter of the American Academy of Pediatrics, the Toxics Action Center, MassPIRG, Clean Water Action, and a representative of a relevant plumbing trade union.

The Commission will be tasked with filing a report to the legislature on evidence-based methods for testing for and remediating the harmful effects of lead in school drinking water, the cost of implementing those solutions, and the feasibility of each solution.

Tighe & Bond Publishes Annual Water and Sewer Rate Survey

T

ighe & Bond has published its annual Massachusetts Water and Sewer Rate Survey.

Since 1997, Tighe & Bond has gathered and published Massachusetts water and sewer user rates data that municipal government and private water suppliers can use as a benchmarking tool for comparing their rates against other suppliers in the state.

The survey, conducted across the state during 2017, includes typical annual homeowner water and sewer costs for most systems throughout Massachusetts. According to a press release issued by the firm, Tighe & Bond is now teaming with the Environmental Finance Center at the University of North Carolina School of Government to present the results of the firm’s rate study using a free, online rates dashboard developed, hosted, and maintained by the Center. By doing so, users will have more flexibility in examining the survey data. Users can adjust the assumed annual usage

that the comparison is based on, review conservation and affordability metrics, as well as compare annual bills. They can also compare rates by utility size, river basin, geographic area, and median household income.

In terms of the actual results, the 2017 water survey indicates that annual water costs in Massachusetts range from a low of $123 to a high of $2,025.

The 2017 average is $595, and the median is $568.

Sixty-five percent of survey respondents have increased their rates since our 2014 survey. The 2017 sewer survey indicates that annual sewer costs in Massachusetts range from a low of $229 to a high of $2,316. The 2017 average is $862, and the median is $838. Three-quarters of survey respondents have increased their rates since our 2014 survey.

• New MassDEP Chief of Staff. The Massachusetts Department of Environmental Protection recently announced that Brian Ferrarese has been appointed Chief of Staff at the agency. According to a press release issued by the office, Mr. Ferrarese comes to the agency after serving as Chief of Staff in the office of State Senator Anne M. Gobi, Senate Chair of the Joint Committee on Environment, Natural Resources and Agriculture. Prior to that position, Ferrarese served as an Administrative Aide and Staff Director in the office of then State Representative Gobi when she served in the House of Representatives.

• Goldberg Picks up Challenger. Representative Keiko Orrall, a Lakeville Republican, launched a campaign for Treasurer of the Commonwealth promising to bring a "fiscally conservative" approach to an office that oversees the Lottery, the school building assistance fund, and the Clean Water Trust. Orrall, a public school teacher in Lakeville before her election that flipped a Democratic seat to a Republican seat, is a Committeewoman to the national Republican Party.

Current Treasurer Deb Goldberg, a fierce campaigner in her own right, has stated that she welcomes the opportunity to demonstrate her three years of accomplishments during the campaign season.

• Representative Peter Kocot Passes Away. In news

that shocked Beacon Hill Democrats, Republicans, Senators, Representatives, and staff alike, Representative Peter Kocot, House Chairman of the Joint Committee on Health Care Financing, died after a brief illness. A former legislative aide to former Majority Leader Bill Nagle, Chairman Kocot, aged 61, was the House Chairman of the Joint Committee on State Administration, when UCANE was able to pass its price adjustment legislation into law. Chairman Kocot, a graduate of Brown University, faithfully served the residents of Northamption as their Representative since 2001.

• Collins Has Clear Path to Senate. With the sudden retirement of former Senator Linda Dorcena Forry, there was the potential for an extremely contentious special election to roil the local Boston political scene. Representative Nick Collins (S. Boston) and Representative Evandro Carvalho (Dorchester) were slated to battle for the long-storied Senate seat. With the sudden announcement that District Attorney Dan Conley would forego re-election as Suffolk County District Attorney however, Representative Carvalho recently announced that he would seek the District Attorney position instead. Accordingly, Representative Collins, who has been active in passing legislation addressing fire safety and substance abuse, will likely now become the next Senator representing South Boston and Dorchester. n

To All Interested Parties: The Massachusetts Department of Environmental Protection (MassDEP) is pleased to present the Final 2016 Intended Use Plan (IUP), which details the projects, borrowers and amounts that will be financed through the Clean Water State Revolving Fund (CWSRF) loan program. The CWSRF is a joint federal-state financing loan program that provides subsidized interest rate loans to improve or protect water quality in the Commonwealth.

As noted in Table 1, Massachusetts is offering approximately $414 million to finance clean water projects across the Commonwealth. Approximately $380 million will fund 35 new construction projects and an additional $15 million will be allocated towards funding 9 previously approved multi-year projects. $2 million has been allocated to the emergency set-aside account, and $3 million will be directed to the Community Septic Management Program to remediate failed septic systems in participating communities. An additional $13.8 million will fund 15 planning projects.

SRF financing is administered by the Massachusetts Clean Water Trust (MCWT) and funds projects implemented by cities and towns, regional water supply and wastewater treatment districts and the Massachusetts Water Resources Authority (MWRA). The projects include 58 clean water initiatives (see page 23) totaling more than $483.8 million and 28 drinking water projects (see page 31) totaling more than $126.4 million. Communities offered SRF funding in this round must decide to move forward with the project by June 30, 2018 and secure local funding authority.

“Through the State Revolving Fund loan program, the Commonwealth partners with communities and water utilities across Massachusetts to protect water quality, while investing in energy efficiency and renewable energy to make delivery of these essential local services sustainable and more affordable,” said Energy and Environmental Affairs Secretary Matthew Beaton.

Fifteen of the projects receiving funding are for renewable energy, energy efficiency or green infrastructure initiatives. These projects involve energy efficiency upgrades to treatment plants and the on-site installation of renewable energy technologies, such as solar cells and wind turbines. Energy use at wastewater and drinking water treatment facilities is a major contributor to overall energy consumption for many cities and towns, with communities statewide spending approximately $150 million per year on electricity to treat 662 billion gallons of wastewater and drinking water. About 30 percent of municipal energy use derives from water treatment.

This year, 45 of the new projects are eligible to receive principal forgiveness. Principal forgiveness is awarded to renewable energy projects and for projects in communities that meet the affordability criteria established by the MCWT. The affordability criteria factors in per capita income, unemployment rate and population trends.

The SRF is composed of two programs that have provided more than $7 billion to Massachusetts projects: the Clean Water Fund, first capitalized in 1989; and the Drinking Water Fund, which began operation in 1999.

This year, the Clean Water SRF provides more than $484 million in financing for clean water projects across the Commonwealth. Approximately $442 million will fund 39 new construction projects, $21 million will be allocated towards funding five previously approved multi-year projects, $3 million has been allocated to the emergency set-aside account, $5 million will be directed to the Community Septic Management Program to remediate failed septic systems in participating communities, and $12 million will fund 13 proposed planning projects.

The Drinking Water SRF provides more than $126.4 million in financing for drinking water projects across the Commonwealth. Approximately $93 million will fund 22 new construction projects, $29.9 million will be allocated towards funding five previously approved multi-year projects, $3 million will fund an emergency set-aside account, and $250,000 is allocated for a single planning project.

Massachusetts awards infrastructure financing under the SRF, which is administered by the MCWT – a joint effort of MassDEP, the Executive Office of Administration and Finance and the State Treasurer’s Office.

To be eligible for Clean Water or Drinking Water SRF loans, municipalities, wastewater districts and water suppliers filed applications with MassDEP last year demonstrating that proposed projects offer significant public health or water quality benefit, have local funding authorization and that there is a commitment on the borrower’s part to file a timely loan application. The projects on the 2018 SRF list must now file loan applications and receive MassDEP approval to obtain funding. continued on page 23

with UCANE’s Officers and Board Members How did you get started in the underground construction industry?

I started working in construction with Lawrence (Vinnie) Mawn, owner of the L. V. Mawn Corporation when I was in high school. Vinnie taught me everything I needed to know about utility construction. I later began working for him as a laborer and was quickly fascinated with underground piping systems and the way they worked. It was hard work, but I liked it; and I credit Vinnie for the strong work ethic I have today. After work I would swing by the office to learn how to read plans and I would ask a million questions about the business.

I soon wanted to learn how to run the equipment and Vinnie offered me the opportunity to practice after work in the company yard. In time, he was impressed with my skills enough to put me on a machine and later to become a foreman.

I was very fortunate to have Vinnie Mawn as my mentor and to have worked at L. V. Mawn alongside so many other talented and successful “Mawn graduates” like the Feeney brothers, Pat Walsh of Walsh Corp., and Colm O’Shea of JRF Corp.

When did you first decide to start up your own business?

In 2003 I decided to try my hand at this business. Aqua Line Utility, Inc. was incorporated in 2004. I had a couple of businessmen who believed in me and helped me MARCH, 2018

make this big decision and to whom I will always be grateful. They helped me build the business brick by brick in the early years. How and why did you decide to join UCANE? My Bonding Company was the first one to suggest that I check out UCANE. I met with Anne Klayman about 12 years ago and I was truly impressed with both her and the foundation that the Association was built on – a belief in allowing both continued on page 39

Anne told me how UCANE began from humble beginnings and, with lots of hard work by a few contractors, the Association gradually grew into its current respected role in the industry. I admired the UCANE history and felt it was a story somewhat like my own, because growing up on the city streets I felt as if the odds were against me, but with lots of hard work we both succeeded.

Having an Association like UCANE to stand up for me and for our industry in tough situations is a comforting feeling. Joining UCANE was the right decision for my company and I have never looked back.

What made you want to become a Board Member?

After I joined UCANE I started going to dinner meetings. Getting to meet some of my peers and competitors in a different setting was great. I gradually got

to see all the issues that the Association was involved in for the members and I was very impressed. Anne Klayman was true to her word and she and her staff have always responded to any concerns I had, no matter how big or small.

I know that any association depends on active participation by its members and I wanted to contribute. I am very honored that my fellow contractors elected me to the Board of Directors this year and I’m looking forward to working for them, and with them, to do my share to keep UCANE moving forward as the premier association in the underground construction industry.

What is the nature of the industry as you currently see it?

Just in the last five years alone, the business has changed so much for all of us. Regulations are getting tougher, fines are getting increasingly stiffer for contractors, and project specifications are getting trickier for us to comply with as low bidder. Unreasonable completion times are showing up more often raising bid prices and making schedules difficult for small and mid-sized contractors.

The work we perform is often high risk and definitely requires experienced crews and should be priced accordingly. I know my fellow contractors agree that only by working together as allies, with a unified voice, will we ever be able to address some of these industry issues that are eroding our already thin margins. n

Booker, Capito Introduce Bipartisan Infrastructure Bill to Boost Utility Sector Workforce Over the next decade roughly 1 out of every 3 water and wastewater utility workers will retire, far above national average U.S. Senators Cory Booker (D-NJ) and Shelley Moore Capito (R-WV), both members of the Environment and Public Works Committee, recently introduced a bipartisan infrastructure bill to boost the utility sector workforce. The Innovative Water Workforce Development Act would establish a competitive grant program to help develop the next generation of water utility workers.

Over the next decade approximately 37 percent of water utility workers and 31 percent of wastewater utility workers will retire, figures that far exceed the 23 percent nationwide replacement need of the total workforce.

“The water utility sector is facing unprecedented workforce replacement needs, with one out of every three workers set to retire over the next decade,” Senator Booker said. “We need to build a pipeline of workers that will be ready to take over when the current generation retires. Jobs in the water and wastewater sector can pay more than three times the minimum wage – our bill will make sure they’re available to more people.”

“Today, skilled workers in the water utility management field are retiring at a higher rate than they’re being hired. This is particularly true in rural communities like those in West Virginia,” Senator Capito said. “I was proud to join Senator Booker in introducing this bill, which will help provide essen-

tial job training that will build the next generation of water utility employees. With a skilled water management workforce, we can improve and maintain healthy communities—particularly in former coal camps with intractable water systems—across West Virginia.”

Specifically, the Innovative Water Workforce Development Act would do the following: •

Authorize the EPA and the United States Army Corps to establish a competitive water utility workforce development grant program.

•

Support public water and wastewater utilities that are facing challenges such as a high retiring workforce rate or are located in areas with high unemployment.

Provide support for targeted internship, apprenticeship, pre-apprenticeship, and postsecondary bridge programs.

Encourage grant recipients to collaborate with labor organizations, community colleges, and other training and education institutions to provide on-the-job training and other skill development to ensure post-secondary success.

A Perfect Storm for State's Water Infrastructure

e hardy New Englanders know how to handle a snowstorm, but the headlines of recent weeks tell a different story about our infrastructure’s ability to do the same. The extreme weather and rising water levels wreaked havoc on our vulnerable water, sewer and stormwater systems – not just along our densely populated coast, but all across the commonwealth.

Water infrastructure is essential for our health, our economy, and our quality of life. Unfortunately, it’s also largely invisible and mostly taken for granted.

In the fierce competition for public investment, it often loses out to education, public safety, transportation, and other urgent priorities. But when storms hit and temperatures plunge, the value and vulnerability of our water systems come into shockingly clear focus – and we confront the painful reality that much of our water infrastructure is old, crumbling and inadequate.

Climate scientists tell us that the kind of extreme weather we just experienced is becoming more frequent. In the year that has passed since my office first released its report on water-related fiscal challenges faced by local governments, Massachusetts has experienced record-setting tides, cold spells of unprecedented severity and duration, historic amounts of drought, and severe stormwater flooding. (Yes, that’s right: drought and flood in the same year.)

The Big Chill of 2018 arrived as yet another reminder that Massachusetts needs to focus attention – and investment – on its vital water infrastructure.

Federal spending on improved water infrastructure has been declining for decades – and now threatens to vanish entirely. Most of that infrastructure is owned by cities and towns, where state aid provides a shrinking percentage of annual budgets. Municipalities know they must put money into upgrading their water systems, but the simple truth is that they can’t do it on their own. And when it comes to incorporating climate change resiliency into their capital spending, local governments are still playing catch-up: we conducted a survey in 2016 that revealed only 6 percent of responding communities indicated that they developed any formal climate change plans or policies that affect water infrastructure systems.

The state needs to step up. The Baker Administration has offered some support in the form of small grants to develop municipal climate change vulner-

Bump ability assessments, and has handed out modest awards to communities and organizations taking on the challenges of stormwater and coastal flooding, but this is not a problem that can be addressed with a few hundred thousand – or even a few million – dollars worth of assistance sprinkled across the state.

Our 2017 study called for a significant increase in the level of state-grant funding for local water infrastructure. To encourage municipalities to put up more of their own money, the commonwealth must be willing to help underwrite these essential investments.

Fortunately, key state legislators are taking action; however, this is a problem that will not be solved with state dollars alone. To truly make the critical infrastructure investments in our communities, we also need our leaders in the federal government to carry some of the load. We were promised a federal infrastructure bill by the Trump administration that would have addressed some of the needs but the gridlock in Washington has made that unlikely. I have had promising conversations with our federal legislative delegation about the importance of this issue in Massachusetts, but to successfully address this challenge, we need action from our federal leaders that promotes a holistic approach to municipal water infrastructure needs.

The timetable and the amount of money may sound aggressive, but Massachusetts just received a preview of what lies ahead if we continue to ignore our water infrastructure crisis.

2018 Scholarship Applications Now Available UCANE to Award Twelve $2,000 Scholarships WHO MAY APPLY? Any high school student who is the son or daughter of a UCANE member or an employee of a member who will be enrolling full time in an accredited four year academic institution for the year beginning in September 2018.

IMPORTANT: In the event the applicant receives a full first year scholarship from the college of his/her choice, or from any organization, civic group, etc., the UCANE scholarship will be awarded to another applicant.

HOW WILL THE APPLICATION BE JUDGED? Selections for the awards will be based upon: 1. scholastic achievement 2. interest and effort in preparing for your vocation 3. extra-curricular activities at and away from school, including community service 4. personal recommendations 5. thoroughness of the completed application, particularly the essay 6. financial need

HOW WILL THE CONFIDENTIALITY OF THE APPLICATION BE PROTECTED? Each applicant is assigned a number. When completed, page 1 of the application with the name of the applicant must be detached and sealed in the accompanying envelope. The applicant’s name must not appear on pages 2-4 of the application or attached transcripts and recommendations. After the winning applications have been selected, the envelopes with corresponding numbers will be opened to identify the award recipient.

WHAT MUST ACCOMPANY THE APPLICATION? 1. A transcript of high school grades through the latest period prior to April 15 must accompany application.

2. A letter of recommendation from the principal or faculty advisor. The letter should include the number of students in the class and the standing of the applicant or equivalent must accompany application.

Changing How We Deal with Change Change is hard. We, as people, are all creatures of habit to one extent or another. There seems to be dichotomy in each of us that looks forward to bigger and better things, yet at the same time, dreads the changes required. A simple example of this is our use of cell phones. We can get excited about upgrading to the newest version available, but get frustrated when it isn’t exactly like our old phone and we are forced to learn a new way of using it. As the saying goes, “the only thing constant in life is change.”

​As

a key decision maker in business, this love/ hate relationship with change can be ever present. The struggle between the status quo and growth is real, and can be paralyzing at times.

But growth, by its very definition, implies change.

Learning to do things differently requires both brain power and the willingness to take a chance. Luckily, this risk can often be mitigated with small course corrections as needed, allowing the overall goal to remain while learning from the process. ​If you stop and think about what life was like, even just a few years ago, it is amazing how much change we have witnessed. A personal book shelf no longer has encyclopedias on it; you now have substantially more information available on the cell phone in your pocket than the encyclopedias ever contained. Or, try to remember the last time you stopped by the nearest gas station to ask for directions from the local attendant. But more importantly, could you imagine never having contact with any of your technicians or crew members once you send them on their way for the day? Technology has changed the way we conduct our lives and our businesses. ​So how do we look forward to change instead of fearing it? Here are 10 suggestions.

1. FOCUS ON THE POSITIVES. It is always easier to complain than to focus on the good. For example, Microsoft introduced massive changes to Windows when it went from version 7 to 8. Windows 7 had a “tried and true” feel, while Windows 8 left you staring at a computer screen wondering how to use it. But Windows 8 brought exciting new technology like touch screen support. This was later enhanced to become Windows 10. Those that use touch screen tablets and notebooks know how difficult it would be to lose that functionality. Taking time to think about the advantages can change our perspectives.

2. DON’T QUIT. Just as the Windows example demonstrated, if Microsoft had given up or reverted back to Windows 7, we would be the real losers. Luckily, they persevered and kept imagining and improving.

We must do the same. Sometimes change feels like 3 steps forward, 1 step back. But don’t let the 1 step back discourage you. Regroup, refocus and keep going.

3. HAVE CLEARLY DEFINED GOALS. It is difficult to measure success if we don’t have a vision of what it looks like. From Alice in Wonderland, we read, “Would you tell me, please, which way I ought to go from here?”

Change continued from page 49 “Then it doesn’t matter which way you go,” said the Cat. Nothing worthwhile comes easy, and business success is no different. Keeping a clear eye on the goals helps you make small course corrections before they become major problems.

4. DON’T BE INSANE. I’m sure we have all heard the saying, “The definition of insanity is doing the same thing over and over again and expecting different results” (author unknown). As a business changes and grows, it is common to want to manage that business the same old way we always have. After all, it is comfortable and has worked in the past. But a changing business requires changing procedures and processes. It requires new (and sometimes temporarily uncomfortable) ways of tackling tasks. For example, if a business started with 2 concrete cutters, keeping track of their schedule could be done in your head or on the back of a napkin. But as the business grows to 5, 10, 20 or 40 technicians, new ways must be incorporated to manage and track every technician’s time and schedule.

5. PUT YOUR CUSTOMERS FIRST. As the world changes, we must change with it. It wasn’t too long ago that fax machines would spit out paper with

work requests from customers. Nowadays, customers have taken to texting the dispatcher. If we don’t find ways to keep up with our customers, they will find someone who will. (And remember that faxing was once a new technology at one point, too.) Being able to meet your customers’ needs will require you to keep adjusting and keep changing. Remember, if you don’t keep your customers happy, someone else will.

6. TAKE THE TIME TO LEARN. Whether it is a new phone, a computer system, or a new saw, a sure way of being frustrated is to never take the time to learn how to properly use it. Assuming the new always works like the old is a scary assumption. Even in today’s fast and furious world, taking the time to think through new things, to learn how they really work and how they can best be implemented into your specific organization will pay large dividends in the long run.

We no longer have the luxury of proclaiming: “I don’t want to learn anything new.” Our technologically ever-changing world dictates that we must or we will be left behind. (For a good illustration of this, read Who Moved My Cheese? By Spencer Johnson.)

7. HAVE PATIEN CE. Businesses do not always get it right. Making the correct decision 100% of the time is simply unrealistic. That applies to every business, regardless of size. No one is immune. Referring continued on page 51

Town Looks Ahead to Long-Term Capital Projects Sandwich —Roadway and infrastructure upgrades and starting something tangible on the wastewater treatment top the town’s list of long-range capital improvement projects.

T

he list includes 13 objectives. Right behind roadway and wastewater work is ongoing consideration of what might be done with the closed Henry T. Wing School on Water Street.

Not to be outdistanced is the project to secure federal agreement and state permits for renourishing the eroding Town Neck dune system and beach strip, which is continually hit by northeast storms arriving on high tides.

Selectmen scrutinized those areas February 8, along with associated costs, possible financing options, and arguments in support of the renourishment work.

The review and explanations of each topic on the list were exhaustive. And it was difficult to both explain and encourage the various proposals without making them seem like competing interests across 57 pages of information.

In that respect, Town Manager Bud Dunham played ramrod with gentle and supportive touches where needed. He added that there will be enduring consequences for Sandwich if action on key projects is not taken soon.

“As you drive around town, it becomes eminently clear we have to make an investment in the very near future,” Dunham said about road work needs. “We need a bigger (financial) shot in the arm to move forward.”

An overall estimated cost shaped by the Public Works Department totals $48 million over 15 years.

But voters at a recent Town Meeting notoriously supported financing for roadway projects one year and nixed it the next year. A pattern of support vs. nonsupport may have been established, but Dunham said financing options must still be reviewed.

“This is our absolute top short-term priority,” Selectmen Chairman Susan James said.

Next comes wastewater treatment, progress on which Dunham said is “inevitable” if only to sidestep a federal order to build a plant and sewer pipe system that would be more costly than a Sandwich solution.

“We’re going to have to be nimble and move quickly,” Dunham said, noting that a waste system near Jan Sebastian Drive would help with hookups to schools and commercial tracts that could attract new business.

Firms likely would help pay for a facility, he added.

A long-range option, Dunham said, would be to work out an arrangement in which the four Upper Cape towns would take over treatment plant operations at Joint Base Cape Cod, which could easily service Sandwich homes along Route 130 at Forestdale.

Dunham said the county dredge could be scheduled and that would save the town some money. But he accented the point about securing permits. This will be difficult, he said, because a final decision to work in the wetlands comes from offices and employees whose very careers are built on efforts to protect natural resources and wildlife habitats.

Dunham said financing issues have to be worked out on the list of long-range projects, some of which have languished for years. Others are fairly new but will not be addressed next year. He acknowledges the point that the bigger projects are decidedly expensive.

“Fifteen years of not funding debt is beginning to bite us,” he said. “We have to start addressing our infrastructure because it’s old. That’s the bottom line.”

Selectmen also discussed the Wing School as a third capital priority, with a price range for options ranging from $5 million to knock the building down to $75 million to recondition it.

Dunham said he has been legally advised that selectmen could go to Town Meeting in May with a “sketch plan” with various Wing restrictions attached. That may be a viable approach to assure continued discussion about Wing on Town Meeting floor.

Interest Rate Risk Rising interest rates generally push down bond prices, even without significant credit risk. That’s because higher interest rates mean that lower-yielding bonds are less attractive. Prices will drop to bring yields in line.

Example: Mark Tucker invests $10,000 in bonds issued by ABC Corp., which is in excellent financial condition. The bonds yield 3%, so Mark will collect $300 (3% of $10,000) in interest each year until the bond pays back his $10,000 at maturity.

What if interest rates rise to 4%? Investors can then receive $400 a year on a similar $10,000 investment. In this scenario, no one will pay Mark $10,000 for bonds yielding $300 a year. If he wants to sell his bonds, he might have to drop the price to $7,500.

A buyer acquiring bonds yielding $300 a year for $7,500 would be getting a 4% return, the going rate in this example. As you can see, a 33.3% increase in interest rates (3% to 4%) leads to a 25% drop ($10,000 to $7,500) in bond values. This is a simplified illustration, but it demonstrates the concept that rising yields will devalue existing bonds.

The aforementioned risks can be mitigated by an adept selection of bond funds. To reduce credit risk, look for funds holding bonds from creditworthy issuers.

For instance, bonds issued by the U.S. Treasury have scant risk of default. Corporate bonds are rated by private agencies and those from financially sound companies are considered “investment grade.” Standard & Poor’s, one such agency, gives AAA, AA, A, or BBB ratings to companies considered to have low credit risk.

Bonds with lower ratings or no ratings at all are judged to have more credit risk. The term “junk bonds” may be applied to such issues, although they also may be known as “high yield” bonds because they must offer relatively robust payouts to attract investors. Online, you can see the ratings of the bonds held by various funds. A fund with average credit quality of AA, for example, would generally have little credit risk.

As for interest rate risk, that’s largely determined by whether the bonds in the fund are long- or shortterm. In the previous example, suppose Mark buys bonds that mature in one year. An interest rate rise continued on page 63

Conversely, suppose Mark’s bonds won’t mature for 20 years. A buyer would receive his or her $300 annual payout for decades, locking in that scant return. That prospect could reduce the bonds’ market value a great deal. For risk reduction, Mark should look for funds with relatively short maturity bonds.

Revealing Rates The bottom line is that high-quality short maturity bonds typically have less risk than lower quality long-term bonds. Bond funds holding lower quality or longer-term bonds will have higher yields. Thus, looking at a bond fund’s yield is a key indicator of the risks involved.

As of this writing, U.S. Treasury bonds maturing in the two- to five-year range yield around 2%. Therefore, any bond fund with yields significantly higher than 2% might be taking on meaningful credit risk, interest rate risk, or both. Lower-yielding funds may be relatively safe from share price deterioration.

Two Five-Year Tests for Roth IRAs

he pros and cons of Roth IRAs, which were introduced 20 years ago, are well understood. All money flowing into Roth IRAs is after-tax, so there is no upfront tax benefit.

As a tradeoff, all qualified Roth IRA distributions can be tax-free, including the parts of the distributions that are payouts of investment earnings.

To be a qualified distribution, the distribution must meet two basic requirements. First, the distribution must be made on or after the date the account owner reaches age 591⁄2, be made because the account owner is disabled, be made to a beneficiary or to the account owner’s estate after his or her death, or be used to buy or rebuild a first home.

Second, the distribution must be made after the five-year period beginning with the first tax year for which a contribution was made to a Roth IRA set up for the owner’s benefit.

Note that the calculation of a Roth IRA’s five-year period is very generous. It always begins on January 1 of the calendar year.

Example 1: Heidi Walker, age 58, opens her first Roth IRA and makes a contribution to it on March 29,

2018. Heidi designates this as a contribution for 2017, which can be made until April 17, 2018.

Under the five-year rule, Heidi’s five-year period starts on January 1, 2017. As of January 1, 2022, Heidi’s Roth IRA distributions are tax-free, qualified distributions because they will have been made after she turned 591⁄2 and after the five-year period has ended. The five-year period is determined based on the first contribution to the Roth IRA; the starting date of the five-year period is not reset for the subsequent contributions.

Note that if Heidi opens her first Roth IRA late in 2018, even in December, the first contribution will be a 2018 Roth IRA contribution and Heidi will reach the five-year mark on January 1, 2023.

Conversion Factors

Other than making regular contributions, Roth IRAs may be funded by converting a traditional IRA to a Roth IRA and paying tax on any pre-tax dollars moved to the Roth side. For such conversions, a separate five-year rule applies. There generally is a fiveyear waiting period before a Roth IRA owner who is under age 591⁄2 can withdraw the dollars contributed to the Roth IRA in the conversion that were includible in income in the conversion, without owing a 10% early withdrawal penalty.

Similar to the five-year rule for qualified distributions, the fiveyear period for conversions begins on the first day of the year of the conversion. However, if Jim withdraws that $20,000 in 2019, he also will owe the 10% penalty because he does not meet the five-year rule for conversions; the rationale is that the IRS doesn’t want people to avoid the early withdrawal penalty on traditional IRA distributions by making a Roth conversion.

The good news is that, in this example, Jim will have started the five-year clock with his 2019 Roth IRA conversion. Therefore, he can avoid the 10% early withdrawal penalty on the conversion contribution after January 1, 2024, even though he will only be age 47 then. Jim will owe income tax on any withdrawn earnings, though, until he reaches age 591⁄2 or he meets one of the other qualified distribution criteria.

Note that various exceptions may allow Jim to avoid the 10% penalty before the end of the five-year period. Altogether, the taxation of any Roth IRA distributions made before five years have passed and before age 591⁄2 can be complex. If you have a Roth IRA, your accountant can explain the likely tax consequences of any distribution you are considering.

Generally, it is better to wait until the age 591⁄2 and five-year tests are passed before making Roth IRA withdrawals, to avoid taxes. continued on page 67

The legalities and public perceptions can be complex. One way to start facing potential perils from sexual harassment is to get in touch with an attorney who is knowledgeable about local law in your state and perhaps your city.

It’s likely that such an attorney will advise you to create and disseminate a formal policy, expressing your company’s abhorrence of sexual harassment. The policy can spell out what actions will not be tolerated by employees at any level of the firm. Make it clear that any problems can be brought to you or to someone in a senior position without fear of retaliation. At the same time, the policy should assert that anyone accused of stepping out of line won’t be prejudged until all the facts are revealed.

Get Ready to Follow Through Accept the fact that some harassment claims will arise at some point. Therefore, you should have a plan in place to investigate the dispute, perhaps a

procedure suggested by your attorney.

You’ll probably begin by hearing both sides. This might be done separately, so the parties won’t fear intimidation. Get statements from third parties if they have witnessed the activities in question.

Keep records that thoroughly document what has been said and what has been done about it. The complaint might be dismissed, the person accused might be told to undergo counseling, or the guilty party could be fired. Again, it’s a good idea to touch base with your lawyer before announcing any resolution of the complaint.

Set an Example Perhaps the best way to indicate that sexual harassment won’t be condoned at your company is to walk the walk as well as talk the talk. Refrain from saying or doing anything that might be misconstrued, no matter how innocent it might seem to you. If you’re married, and if you have children, think about how any questionable actions might be perceived by your spouse or your kids.

Demonstrate to all your employees that your place of business is somewhere that they can do their jobs without feeling uncomfortable.

ich Pacella, Jr. is President and General Manager of Construction Activities at R. M. Pacella, Inc., Plainville, MA and is a third generation civil-utility contractor. The company was founded in 1977 by his father Richard Pacella, Sr., who is semi-retired, and his family have been UCANE members since its inception.

Rich served four years on UCANE’s Board of Directors and has now ascended to the office of President. He is also a member of our Budget, Executive, Membership, and Government Relations Committees. He recently provided testimony before the Massachusetts Joint Committee on Public Service on behalf of UCANE regarding the payment of Police Details.

Rich graduated from Wentworth Institute of Technology with a degree in Construction Management, and he currently serves as Water and Sewer Commissioner in the Town of Foxborough, MA and is also Mansfield-Foxborough-Norton Regional Wastewater District Commissioner.

Like so many other UCANE members before him, Rich intends to carry on his family’s tradition of involvement and support of our Association. He has earned the respect and admiration of his co-workers and peers within the utility construction industry, and his ongoing commitment to UCANE is evident through his hard work in effectively communicating the issues of vital importance to our industry.

Some of Rich’s goals for the coming year include, securing increased state funding for the SRF Program to assure that the maximum number of projects are put out to bid; assisting the MassDEP and other state agencies whenever possible to help cities and towns fund needed underground infrastructure projects; and promoting UCANE’s in-house safety programs while advocating for employee safety on the jobsite.

Rich is also committed to strengthening our Association in the coming year by increasing membership. His goal is to enlist 25 new members and has requested our member’s support to help him achieve his goal. He believes strongly in UCANE and its goals and future, and has committed to continue the work of those who served before him who have strived to make Massachusetts’ clean water and drinking water infrastructure a model for the entire country.

yan is the fifth generation President of McCourt Construction Company, South Boston, MA. Since 1893 McCourt has been building the infrastructure of Massachusetts. Today with his brothers, Matthew and Trevor, McCourt Construction is tackling some of the largest and most complex construction projects in New England.

Ryan attended Boston College where he graduated with a Bachelors of Science degree in Finance. Soon after receiving his degree he joined McCourt Construction.

Ryan realizes the importance of industry organizations in ensuring that the infrastructure of the Commonwealth gets the attention it so desperately needs, and he knows that UCANE is the most effective organization in getting attention for the drinking water and wastewater industry. With this in mind, he previously served from 2012-2013 on the UCANE Board of Directors, following in his father Richard’s footsteps. As UCANE Treasurer, he looks forward to working with our elected officials to improve clean water and drinking water systems, which will positively impact our citizens and the environment.

rian is Vice President and Project Manager of C. C. Construction Inc., South Dennis, MA. His father, Christopher Cooney founded the company in 1983.

This year marks their 35th year in business and they have been UCANE members since 2009. C. C. Construction performs site work and utility work on the entire South Shore, including Cape Cod and the Islands.

Brian graduated from Northeastern University in 2009, with a bachelor’s degree in Finance and Entrepreneurship. In addition, he took construction management classes at Wentworth Institute of Technology at night. Soon after graduation he joined C. C. Construction, Inc. Brian looks forward to facing the challenges our industry has with project funding and permitting in an effort to get more projects out to bid and on the street.
