UCANE Going Strong at 65 As you can tell from the cover of this month’s magazine, 2019 marks UCANE’s 65 Anniversary. My family has been a part of UCANE since its inception in 1954, and I am extremely proud to carry on the tradition of serving our industry. From its modest beginnings, UCANE has grown to over 250 members (and counting). th

ur Association was formed by like-minded business owners who, although they were competitors, saw the need to join together to speak with one unified voice in order to represent the interest of all utility contractors. So as we celebrate our 65th Anniversary, I thought this was an appropriate time to list some of the by-laws that have helped guide us through the years. Many of you are familiar with UCANE and are kept up to date by this magazine, attending dinner meetings, seminars, our golf tournaments, and our Annual Banquets. These and all of our activities are designed to help UCANE accomplish its mission, which is: • To define, establish, and preserve the identity and the common interests of the utility contracting industry; • To promote better relations between utility contractors and government agencies, general contractors, labor, professional engineers, and the public at large; • To foster, encourage, and maintain safety standards in the conduct of work;

To coordinate and provide information relative to the business in which utility contractors are engaged;
•
To represent the common interests of utility contractors at hearings, meetings, and conferences held by legislative and other public administrative bodies on national, state, and local levels;
•
To initiate or support legal actions to the extent and in the manner deemed appropriate in each case, which affects the over-all interests of utility contractors;
•
To promote and foster ethical practices among utility contractors, with government agencies and their representatives and with the general public;
•
To engage in research to aid the utility contracting industry;
•
To exchange data and information with trade associations, chambers of commerce, board of trade, and other organizations engaged in similar activities.
The utility construction industry looks a lot different now than it did in 1954. However, the goals over the years have remained constant, and the need for UCANE is just as strong now as it was when it was incorporated. But our Association has grown and prospered over these past 65 years for one simple reason: the hard work and dedication of our membership. The support and investment UCANE members have made is why we are such a respected voice for our industry, and why UCANE has made a difference. So I would like to sincerely thank all of our members for what they have done to help make UCANE stronger and more effective as we enter our 65th year, and I look forward to working together with you in the years to come! House and Senate Announce Committee Assignments for 2019-2020 Legislative Session
E
very two years, at the start of the legislative session, the Speaker of the House and Senate President not only establish their respective priorities, they install leadership teams to manage the over 6,000 filed matters introduced into the legislature. The leadership and committee assignments, while sometimes involving little change, can provide a glimpse into the political machinations that often occur out of sight. With the 2019-2020 legislative session, there was guaranteed to be great interest in the committee and leadership assignments as both Ways and Means Committee Chairs were to be newly appointed. To that end, Senator Mike Rodrigues has been appointed Chair of the Senate Committee on Ways and Means. On the House side, Representative Aaron Michlewicz is the new Chair of the House Committee on Ways and Means. On the Senate side, Senator Cynthia Creem of Newton will remain on as Majority Leader, while Senate President Karen Spilka appointed Senator William Brownsberger to the third ranking position as Senate President Pro Tempore. Senator Joan Lovely was elevated to assistant majority leader and chair of the Rules Committee. On the House side, Representative Ron Mariano and Representative Pat Haddad remain as Majority Leader and Speaker Pro Tempore, respectively. Representative Joe Wagner has been elevated to the position of Assistant Majority Leader.

Consent Order for City of Holyoke to Address Combined Sewer Overflows
A
ccording to a press release from the United States Attorney’s Office, District of Massachusetts, the City of Holyoke agreed to enter into a proposed consent decree with federal and state enforcement authorities to prevent future sewage discharges into the Connecticut River from the City’s sewer collection system. The consent decree is the result of an enforcement action brought by the United States Department of Justice, on behalf of the U.S. Environmental Protection Agency (EPA), and the Massachusetts Attorney General’s Office, on behalf of the Massachusetts Department of Environmental Protection (MassDEP). According to complaints filed with the consent decree, the City of Holyoke allegedly discharged pollutants into the Connecticut River in violation of its wastewater permits intended to limit combined sewer overflow (CSO) discharges into the Connecticut River from the City’s collection system and failed to properly operate and maintain
its sewer system. In addition to a wastewater treatment facility, Holyoke owns and operates a sewer collection system that services approximately 70 percent of the City, two-thirds of which carries both sewage and stormwater. Most of the time, the combined systems transport all wastewater to the facility for treatment. However, during periods of heavy rain the wastewater volume can exceed the capacity of the sewer system or the treatment facility and the excess wastewater will discharge into the Connecticut River without treatment. CSO discharges contain raw sewage and are a major water pollution concern. Many communities struggle with these same problems the City of Holyoke has been trying to address. The complaints alleged that from at least 2012, Holyoke discharged untreated pollutants from its sewer system in violation of its permits and both continued on page 13

Legislative Update continued from page 11 the federal Clean Water Act and the state Clean Water Act. In 2015, for example, the City reported discharging 133 million gallons of untreated effluent during wet weather, and during a 2012 inspection, EPA identified 40 potential overflows in dry weather. The complaints also alleged that the City periodically discharges sewage and other pollutants into the Connecticut River outside its sewer system, such as through manholes that flow to storm drains. The proposed consent decree requires Holyoke to develop an enforceable, long-term plan to control discharges from the City’s sewer system by December 31, 2019. Holyoke has already begun work on developing this plan and has submitted a scope of work, which the EPA and MassDEP have approved. While the City had taken steps over the years to address sewer discharges pursuant to a number of EPA-issued administrative orders, it remained in noncompliance with its permits and both the federal Clean Water Act and the state Clean Water Act. Once the City submits the plan, the consent decree calls for the parties to negotiate what further steps the City must take
regarding the discharges. The consent decree does not assess a civil penalty against the City for its violations at this time. Holyoke, however, is subject to vigorous reporting requirements to ensure compliance with the terms of the consent decree. If the City fails to comply, it may be subject to penalties as high as $2,500 per each day of violation. This settlement is part of EPA’s National Compliance Initiative to keep raw sewage and contaminated stormwater out of natural water resources. As reported by the United States Attorney’s Office, raw sewage overflows and inadequately controlled stormwater discharges from municipal sewer systems introduce a variety of harmful pollutants, including disease causing organisms, metals and nutrients that threaten our communities’ water quality and can contribute to disease outbreaks, beach and shellfish bed closings, flooding, stream scouring, fishing advisories, and basement backups of sewage. Personnel Changes in Baker-Polito Administration as Second Term Begins
er the normal course of second term machinations, the Baker-Polito Administration recently announced a variety of its personnel changes. With the transition from the first four-year term to a second four-year term, there are often personnel changes within any administration. To that end, Governor Charlie Baker and Lt. Governor Karyn Polito recently announced the following changes: • Governor’s Legal Counsel. The Baker-Polito Administration announced that Lon Povich will be stepping down as Chief Legal Counsel for the Office of the Governor. His replacement will be Bob Ross, current General Counsel at the Executive Office for Administration and Finance. According to a press release from the Governor’s Office, Mr. Povich managed attorneys across the executive branch as Chief Legal Counsel and played key roles in crafting significant pieces of legislation such as last year’s criminal justice reform bill and the MBTA reform measures passed in 2015. For his part, Bob Ross has helped craft the Baker-Polito Administration’s five state bud-
get proposals and worked with legislative leaders and administration officials on several major initiatives, including a review of all Executive Branch agency regulations, while serving as General Counsel for the Executive Office of Administration and Finance. Formerly, he was the Bureau Chief for the Business and Labor Bureau in the Office of Attorney General Martha Coakley. He came to the Attorney General’s Office from the Office of the Senate President, where he worked for more than a decade in various roles in that Office and the Senate Committee on Ways and Means, including six and one half years as Chief Policy Advisor for Senate President Therese Murray. UCANE members may remember him for his work on Chapter 259 of the Acts of 2014, the most significant water infrastructure legislation passed in the past 15 years. Mr. Ross is a graduate of the College of William and Mary and Northwestern School of Law. • Executive Office of Housing and Economic Development. Legislative Update continued from page 15 Executive Office of Housing and Economic Development, Secretary Mike Kennealy announced Timothy J. McGourthy as incoming Deputy Secretary, effective March 4. McGourthy will assume the role vacated by former Deputy Secretary Carolyn Kirk, who was named Executive Director of Massachusetts Technology Collaborative earlier this month. McGourthy has been engaged on policy development for local, state, and federal initiatives over his 25-year career. In the last 20 years, McGourthy held public sector and nonprofit executive roles focused on the economic growth of Boston and Worcester, most recently serving as the executive director of the Worcester Regional Research Bureau, a position he has held since February 2014. McGourthy holds a bachelor’s degree in history from The College of William and Mary, a master’s degree in government from Johns Hopkins University, and a master’s degree in public policy and urban planning from Harvard University’s John F. Kennedy School of Government. • Comptroller. Governor Baker recently announced the appointment of Andrew W. Maylor as the Comptroller of the Commonwealth. Comptroller Maylor brings more than 25 years of local government executive leadership and senior financial experience to the Commonwealth and is the 19th Comptroller to serve
since the creation of the office in 1922. Most recently as the North Andover Town Manager, Mr. Maylor’s financial policies led to the town's first AAA Bond Rating; and he was nationally recognized for his leadership during the 2018 Merrimack Valley Gas Disaster, one of the largest natural gas pipeline catastrophes in the nation's history. Previously as the Chief Financial Officer and Deputy City Manager of the City of Chelsea, Mr. Maylor was a key contributor in the financial resurgence of the only Commonwealth municipality placed under receivership. Comptroller Maylor was awarded the Certificate of Excellence in Financial Reporting from the Government Finance Officers Association of United States and Canada in 1998-2001 and 2012-2016, and the Distinguished Budget Award in 1998-2002 and 2006-2016. Mr. Maylor is a member of the adjunct faculty in Merrimack College’s Master of Public Affairs Program and has served in a similar role at several other colleges during the past 20 years. Comptroller Maylor earned his Bachelors Degree in Management Science from Bridgewater State College and his MBA from Suffolk University. He received his MPA from Villanova University. A
Baker Refiles Priority Legislation to Address Housing
ccording to a press release and media event to announce the same, Governor Baker filed legislation to further the Administration’s Housing Choice Initiative, a plan to support the production of 135,000 new housing units by 2025. This bill builds on efforts undertaken last legislative session to deliver necessary, targeted zoning reform to benefit communities pursuing new housing production. As outlined, the Baker-Polito Administration developed the Housing Choice Initiative to offer a combination of incentives, technical assistance and new capital grant funding to facilitate community-led housing production across the Commonwealth. This diverse set of tools for communities is intended to create the conditions for sustainable housing development that meets the needs of current and future residents. When the Baker-Polito Administration first unveiled the Housing Choice Initiative in 2017, in addition to the changes proposed through legislation, the initiative also created a new system of incentives and rewards for municipalities to deliver sustainable housing growth by designating communities that are producing new housing units and have adopted best practices with a new “Housing Choice Communities.” It also created a new technical assistance toolbox empowering cities and towns to plan for new housing production. The bill filed by the Governor mirrors the legislation filed by the Governor in the last legislative session. This proposal will enable cities and towns to adopt certain zoning best practices related to housing development by a simple majority vote, rather than the current two-thirds supermajority. This legislation will not mandate cities and towns to make any of these zoning changes; but will allow municipalities that want to rezone for denser, transit, or downtown oriented, and new housing development to do so more easily. Zoning changes that promote best practices for housing growth that would qualify for the simple majority threshold include: • Building mixed-use, multi-family, and starter homes, and adopting 40R “Smart Growth” zoning in town centers and near transit. • Allowing the development of accessory dwelling units, or “in-law” apartments. • Approving Smart Growth or Starter Homes districts that put housing near existing activity centers. • Granting increased density through a special permit process. • Allowing for the transfer of development rights and enacting natural resource protection zoning. • Reducing parking requirements and dimensional requirements, such as minimum lot sizes. This legislation also includes a provision, added by the Joint Committee on Housing last session, that would reduce the voting threshold for a special permit issued by a local permit granting authority to a simple majority vote, for certain multi-family or mixed-use projects with at least 10 percent affordable units in locations near transit or, in centers of commercial activity within a municipality. Massachusetts is currently one of only a few states to require a supermajority to change local zoning. While a broad coalition of organizations are supporting this initiative, it was not voted on in the House or Senate last session. Groups supporting the measure feel confident the measure will be taken up this session.

New Round of Grants Under MassDOT’s Complete Streets Program Announced
he MassDOT’s Highway Administrator Jonathan Gulliver announced awards totaling nearly $3 million to 11 communities through the Complete Streets Funding Program at the end of February. These awards will be used to fund local, multimodal infrastructure projects that improve accessibility for bicyclists, pedestrians, public transit users, and people using other forms of transportation. According to MassDOT, a “Complete Street” is one that provides safe and accessible options for all travel modes and for all people, taking into account the ages and abilities of individuals. The Baker-Polito Administration has now awarded a total of approximately $33 million in construction funding since creating a funding program for Complete Streets in February 2016. The Complete Streets Funding Program was launched by the Baker-Polito Administration on February 1, 2016. To date, 187 municipalities have approved policies and 136 have approved Prioritization Plans. Examples of projects that can be addressed through the program include filling bicycle and pedestrian network gaps, improving transit access, installing street lighting, improving safety of crosswalks and intersections, and building new shared use paths. The Baker-Polito Administration is continuing to invest in transportation infrastructure throughout the Commonwealth. Over the 5-year period, which began July 1, 2018,
MassDOT expects to spend over $7.6 billion on roadway and bridge construction projects. This includes support for the Municipal Small Bridge and Complete Streets Funding Programs, two local funding programs created by the Baker-Polito Administration. Among the grant awards included under this round of Complete Streets program: • Brookline will receive $234,968 for town-wide multimodal safety improvements, including the installation of pedestrian signals, new ADA compliant curb ramps, accessible pedestrian signals, high visibility crosswalks, bicycle lanes, and bicycle boxes at the intersections of Babcock Street and Harvard Street and Beacon Street at Harvard Street. • Carlisle will receive $250,000 for pedestrian improvements at multiple locations, including the installation of Rectangular Rapid Flashing Beacons and crosswalks at 142 Bedford Road and the driveway for the public athletic fields at the Banta-Davis land. • Great Barrington will receive $222,077 for a sidewalk extension on Housatonic Main Street. • Williamsburg will receive $275,000 for pedestrian network improvements, including the construction of a sidewalk along the east side of South Street from the current sidewalk terminus at #5 South Street to Eastern Avenue. n

Recreational Marijuana and Massachusetts Employers In 2016, Massachusetts voters approved a ballot initiative legalizing the limited sale, use and possession of recreational marijuana. (Marijuana remains unlawful under federal law and in many states.) The sale of recreational marijuana to the general public began in December, 2018. Until further notice, as a matter of law, this new reality, “recreational marijuana”, should have no impact on an employer’s ability to enforce its anti-marijuana rules and drug testing policies. Because Massachusetts, unlike many other states, does not have a general law prohibiting an employer from regulating an employees’ conduct outside the workplace, absent new legislation or judicial opinions, an employer should be able to regulate recreational marijuana inside and outside the workplace to the same extent it did prior to the passage of the recreational marijuana law.
T
he recreational marijuana law, also known as “The Regulation and Taxation Marijuana Act”, provides “[t]his chapter shall not require an employer to permit or accommodate conduct otherwise allowed by this chapter in the workplace and shall not effect the authority of employers to enact and enforce workplace policies restricting the consumption of marijuana by employees.” On its face, the law does not restrict an employer’s right to regulate marijuana usage by its employees, nor does the law require employers to permit or accommodate the use of recreational marijuana inside or outside the workplace. In sum: • Massachusetts employers can continue to drug test new hires for marijuana to the same extent they did prior to the passage of the new law; • Subject to anti-discrimination laws, Massachusetts employers can continue to have zero tolerance marijuana policies; • To minimize misunderstandings and legal challenges, an employer should place its employees on notice that it intends to continue to enforce

its drug policies to the same extent it did prior to the passage of the recreational marijuana law. Employees should be warned that if they fail a drug screen due to recreational marijuana usage outside the workplace, that will not excuse their failure and may subject them to disciplinary action up to and including discharge; Under pre-existing Massachusetts law, an employer may be required to accommodate an employee who uses marijuana for medical purposcontinued on page 32

Do not assume, one size policy fits all; An employer has no obligation to “accommodate” a recreational marijuana user; Because other employers may permit marijuana usage, marijuana drug test screening may limit the employer’s applicant pool.

with UCANE’s Officers and Board Members How did you get started in the underground construction industry and what was your first job? I got my start in construction working summers and weekends as a general laborer throughout my high school and college years. After college I worked for a few years as an engineer for a small consulting firm, which specialized in water infrastructure for Cities and Towns. This led to my introduction to J. D’Amico, Inc., that led to me jumping the fence to the construction side and I have never looked back. My first four projects with J. D’Amico, as a young project engineer, were all in the Town of Westborough, MA and encompassed a wide variety of utility work, including, daily blasting of ledge, wetland and river crossings, installation of water mains, deep sewer mains, a water pump station, and a sewer pump station.
How long have you been with J. D’Amico and what is your role there? I am currently the Vice President General Manager of the company. I’ve been with J. D’Amico for 19 years now. My career with D’Amico started in the field. Over time, and after gaining more experience I took on more of a role in the office. For the first 14 years I had the privilege of working with Mike Lenihan who mentored me in this business, until his retirement.
How long have you been involved with UCANE and why did you decide to get actively involved? MARCH, 2019

My peers elected me onto the UCANE Board in 2014, but I started participating early on in my career by attending many meetings, and I was always impressed how everyone came together for a common goal.
What is the nature of the industry as you currently see it? I hope that our Federal Government can come together this year on an infrastructure bill. A crew removing snow at the bottom of the Fore River Bridge saved a man who jumped 60 feet from the bridge in an apparent suicide attempt.

UINCY, MA — A man was rescued by a snow removal crew after he jumped off the Fore River Bridge in an apparent suicide attempt, fire officials said. The man was rescued by a crew from J.F. White Contracting Company that was on a construction boat removing snow from the bridge on Thursday morning. Around 8:30 a.m., Tony Arauso and two other workers from J.F. White saw a man get out of his car and jump 60 feet from the bridge into the 35-degree water, fire officials said. The workers called 911, and worked quickly to pull the man out of the water. When emergency personnel arrived, the man was walking and alert and had suffered what ap-
peared to be minor injuries to his face, Quincy Deputy Fire Chief Tim Burchill said. Burchill said luck was certainly a factor with the man's rescue. "It was a great effort and a great rescue by the guys at J.F. White Company," Burchill said. "If it wasn't for the company's swift work, the guy would have succeeded. If the snow hadn't come, he would have succeeded." The man was also a foot or two away from landing on cement or the boat the workers were in, Burchill said. Construction Safety & Compliance: An Interview with Kevin O’Brien Trench Shoring Representative United Rentals Trench Safety
UCANE’s Construction Outlook editors recently caught up with Kevin O’Brien at a busy construction site in Shrewsbury, MA. Kevin is the Trench Shoring Representative with UCANE member firm United Rentals Trench Safety. We were able to get a few minutes of Kevin’s time to discuss the importance of Safety in today’s heavy construction industry. What is your background in Construction Safety? I graduated from Worcester State University with a BS in Criminal Justice and after being in public safety for a few years I decided to do something different. I started at United Rentals Trench Safety in the fall of 2013, working in our Shrewsbury office. By enrolling in a vast array of safety training classes offered by our company I achieved certifications in CPT, CSE, and OSHA 10. More importantly, I became familiar with the OSHA regulations that apply to underground work and what equipment and training a contractor should have in order to remain in compliance. I took my knowledge to an outside role in 2016, and have been able to work closely with scores of heavy contractors and assist them in planning and implementing safe trenching work on projects across New England. United Rentals Trench Safety provides a broad range of Safety professionals and resources to support both my customers and myself throughout a project’s duration.

Tell us about the culture of safety that exists at United Rentals Trench Safety.
What are some of the biggest challenges you face as a shoring representative?
In two words it’s “Safety First.” At United Rentals we have daily safety talks, monthly safety meetings, as well as daily reminders such as Hazard 360 (always looking around your surroundings, especially before driving away from a spot.) The company wants to make sure that our outside guys know how to act safely and be observant whether it’s on a construction site or in a contractor’s garage. The corporate phi-
My biggest challenge is getting my contractor clients to view United Rentals Trench Safety as not just a supply house, but as a resource for them during the planning phase of their project. within our organization, we can work as partners to come up with trench safety methods and equipment that will maximize both production and safety. Providing solutions is more valuable than having the lowest price. Site and office visits cost nothing and may even help your company save money in realizing that you can utilize your own equipment. What advice do you have for new safety directors, specifically pertaining to the current construction climate/current jobsite risks? Speaking to contractor superintendents and safety directors I would advise them that it is important to plan out your work and your various trench protection methods early. If you need to rent equipment, make sure you get your dealer lined up and tap into their expertise. Involve your workers in planning for an excavation, get their input and make sure they can implement your plan and understand what their responsibilities are. It’s never a good thing to have said after the fact “wished we had gotten that trench box.” It’s important to not take short cuts and to take safety seriously. Being in charge of a trenching project is a serious responsibility. OSHA citations can do much more than create a bad day, they can put a company out of business. There is a reason why companies are
How do you think Contractors, as well as, their workers can benefit from organized and OSHA endorsed events like Safety Week and the National Safety Stand-Downs? It’s beneficial for all contractors to take part in these events. I would encourage company-wide stand-downs a few times a year because they could save a life. Once the construction season gears up it’s easy to get complacent or sometimes rush through tasks. Having stand down events allows workers to stop, think, refocus, and hopefully get information or put themselves in the right mindset to work safely. n

SHA has informed UCANE that in 2019 they will be focusing enforcement efforts on trenching and excavation work. That is why a full crowd once again attended our Competent Person/Confined Space Entry seminar, conducted by veteran safety trainer John Barrasso, at The Lantana in Randolph, MA. John’s specialty is excavation safety, confined space entry, and training employees to become Competent Persons as defined by OSHA. He only does this training for UCANE and has been for over 30 years. John’s knowledge of the OSHA standards is matched only by his experience with real on-site construction challenges faced by utility contractors. His 20 years as a construction superintendent/manager for one of New England’s largest heavy civil and pipe contractors allows John to communicate with his UCANE audience on a special level. The comprehensive full-day seminar covered all current OSHA Standards and best practices for CFR 1926 Excavation, SubPart P. How to test for and identify soil types, selection of shoring equipment, recordkeeping, and the responsibilities that come with being a “Competent Person” were reviewed through discussion

and video presentations. The latest OSHA regulations regarding constant monitoring of confined spaces and changes to rescue team requirements were discussed along with the multitude of existing OSHA rules that govern employees working in a confined space. John’s presentation also highlighted OSHA’s jobsite silica standards. It is anticipated that OSHA will more strictly implement these standards in 2019, so there is a need for job-specific “Dust Control Plans” and the role of the Competent Person in monitoring compliance. Our “8-Hour OSHA Class II Asbestos Training: Asbestos-Cement Pipe (ACP) Worker Safety,” seminar was held at The Irish Cultural Centre in Canton, MA. This class was presented by Tom Dion of ATC Group Services and covered important topics such as the identification and recognition of asbestos related materials, the potential devastating health affects related to asbestos exposure, federal and state regulations, safe work practices, respiratory protection, and waste handling procedures. The course is certified by MassDEP and is a “must attend” for any employee who may come in contact with asbestos continued on page 47

hat is your opinion on the age-old statement, ‘One bad apple can spoil the bunch?’ Do you feel this applies to safety and how workers operate within your company? Interestingly enough, I feel it does apply in all companies as I have witnessed it first hand on how bad behavior can ‘spillover’ into the minds of other employees through peer influence. If companies neglect to realize and underappreciate the consequences of these spill-overs, a few bad apple employees can infect and change the entire safety culture of your company. Every organization seems to have those one or two employees who are hardworking, ready to take on any task thrown at them, relentless on finishing the job, and possess the trade skills to back it all up. However, when it comes to adhering to safety standards, corners seem to continuously get cut. Or perhaps they have been a good performer through the years, but cannot seem to break old habits on how “they used to do it.” Co-workers assigned to a particular task or job site could begin to behave similarly based on peer influence, in which workers learn behaviors from each other. Among co-workers, it appears far easier to learn bad behavior than it does good behavior. The contagiousness of bad behavior somehow corrupts even your safety minded employees, especially when the misconduct is performed by either a veteran worker or worst yet, a managing (Foreman) employee. It is extremely important for managers (Foremen/

Addressing the issue isn’t easy, but attention must be paid to understand the costs associated with unsafe behaviors by an employee, and the potential financial effects reaching far beyond the particular job site they are working on. But there are additional factors that need to be understood and have the potential to possess an even greater financial impact than that of the original citation. Those factors can include: the legal costs to appeal and abate the citation; the potential for a repeat violation in the future; and the impact a poor safety rating/score has on your company during the prequalification process while bidding on future work. Removing these bad apples would be a lot easier if all problem employees were lazy, insubordinate, nasty workers affecting workplace morale. But the truth is, often times the described “bad apple” is a well-liked, genuinely good person, who may have been with the company for quite some time. Regardless, even though a particular employee may possess the skills needed to impress, at what point does he or she represent a serious threat to your business? Coming up with reasons to keep a veteran employee is not hard–avoiding confrontation, emotional attachment to the person, optimism about their ability to change, and the list goes on. Your company has devoted time and energy to this indi-
vidual, and it is only natural that you wish to protect your investment. In the end, we are all human, and it is in our nature to give employees the benefit of the doubt and offer that second (third, fourth, or fifth) chance. Employees will inevitably repeat behaviors for which they are rewarded. For example, if an employee is praised and rewarded for their productivity, it is only natural that their primary focus will be on production behaviors, rather than safe behaviors. So when do you say, “enough is enough” and come to realize that perhaps all of your efforts to change this employee may not be enough. After all, it’s hard enough to change ourselves even when we are motivated.
All of this leaves me wondering, do you think it’s possible to teach an ‘old dog a new trick’ and get those stubborn employees to work safer today than they did yesterday? Or should we look towards the future and make the best decision for the company and the brand you and the other employees have worked so hard to build? n

Bourne Receives Federal Funds for Wastewater Treatment BOURNE –The federal Economic Development Administration has awarded the Town of Bourne a grant that will go toward the construction of a new wastewater treatment plant.

inth District Congressman Bill Keating said the project will create 30 jobs, save over 180 jobs and provide $18.3 million in economic development. “This grant shows how Economic Development Grant funding can unlock the potential of our communities to expand their business base, providing jobs and opportunities for our residents while simultaneously laying the groundwork for future growth. The $2.3 million provided by the EDA represents significant federal investment in my hometown,” said Keating. “Bourne’s successful application for these funds will yield more than $18 million in private investment, in addition to saving and creating more than 200 jobs. Finding new, advanced ways to invest in wastewater infrastructure will prove critical to our region’s future. Bourne has done a great job in pursuing this federal EDA funding.” Town Manager Thomas Guerino said, “This is great news from the EDA. Brewster, Chatham, Harwich, and Orleans Have First-of-Its-Kind State Watershed Permit for Bay
The four Cape Cod communities in the Pleasant Bay watershed – Brewster, Chatham, Harwich, and Orleans – created an intermunicipal agreement that led to approval of a first-of-its-kind state watershed permit from the Department of Environmental Protection.
T
he permit will allow the towns to use nontraditional technologies to remove nitrogen from water and receive nitrogen removal credits from MassDEP, while working collaboratively to address each municipality’s contribution to nitrogen levels in the bay. Since The Beacon first reported on the effort and the final application documents were filed with MassDEP last summer, the Pleasant Bay Alliance – created by the four towns in 1998 – received a $250,000 award from the Southeast New England Estuaries Project Watersheds Program to fund implementation activities, according to the alliance’s coordinator and project leader, Carol Ridley. “These are activities taking place in each of the four towns and are intended to not only assist the towns in their efforts, but to act as models for other communities to learn from,” Ridley said. Each town and the alliance also received a 2018 Environmental Merit Award from the U.S. Environmental Protection Agency’s New England Regional office for their work on obtaining the permit. Each town had already worked on individual plans to address its share of nitrogen pollution entering the bay. The Pleasant Bay Alliance took those four plans, identified gaps and overlaps, and created a coordinated, cost-effective and faster way to reach collective goals based on the intermunicipal watershed permit.

A study completed by the Massachusetts Estuaries Project, in coordination with Pleasant Bay Alliance, concluded that approximately 40,000 pounds of nitrogen enters the bay each day, and that it must be cut by 36 percent to meet regulatory thresholds set by the MassDEP. Chatham is implementing a 30-year wastewater management plan, completed in 2009, which calls for sewering almost the entire community. Brewster adopted “fertigation” for its two 18-hole municipal golf courses, capturing nitrogen-rich irrigation water in deep wells and reusing it for irrigation, allowing the town to reduce the amount of fertilizer used on the courses. Lawn and golf course fertilization accounts for 16 percent of the nitrogen flowing into the bay, according to the Estuaries Project analysis. Orleans plans to continue expanding its shellfish aquaculture pilot project, which won an MMA Innovation Award in 2018. Entering its third year in Lonnie’s Pond, which feeds into the bay, the project uses 100 floating bags that hold an average of 5,000 oysters and hard-shelled clams that consume nitrogen. Harwich entered into an intermunicipal agreement with Chatham to use its wastewater treatment facility, widened the Muddy Creek inlet to increase nitrogen flushing, and plans to institute a fertilizer control program. (This discussion concerns investments in taxable accounts because tax-exempt municipals and muni funds typically don’t belong in a tax-favored retirement account.)
Taxable bonds generally offer higher yields than tax-exempt bonds. On the other hand, the after-tax return from munis may be higher after investors pay tax on taxable bond interest. Thus, the appeal of municipal bonds increases as investors’ tax rates move up. Lower rates, tougher calls The Tax Cuts and Jobs Act of 2017 (TCJA) reduced tax rates for many taxpayers, which could make municipal bonds less attractive. Example 1: Assume, hypothetically, that a taxable bond fund yields 4%, and a muni fund with similar characteristics (default risk, interest rate risk) yields 3%. Al Brown, in a top 37% tax bracket, would net 2.52%, after paying 1.48% (37% of 4%) in tax. Carl Davis, in a 12% bracket, would net 3.52%, after paying 0.48% (12% of 4%) in tax. Therefore, high-bracket taxpayers could get a substantial increase in after-tax yield from a muni fund, whereas those in lower brackets might profit by MARCH, 2019
choosing taxable issues. Those in between, perhaps in the 22% or 24% bracket, might find scant difference in after-tax yield between taxable and tax-exempt bonds.
State of the Art The numbers provided previously use federal income tax rates to find the after-tax yield. Many investors, though, would also pay state and even local income tax on interest from taxable bonds. That leads to a further calculation. Example 2: Suppose Al Brown from example 1 has $100,000 invested in a taxable bond fund yielding 4%. Therefore, he collects $4,000 a year in taxable interest income. As mentioned, Al is in the 37% tax bracket, so his federal income tax on that interest income would be $1,480. Assume Al also owes 8% in state income tax, or $320 on his $4,000 of interest income, for a total tax bill of $1,800, which would leave him with $2,200 of net interest income after state and local income tax. In prior years, Al might have been able to deduct the state income tax paid on his bond interest income. Multiplying the $320 of state income tax by the 37% saved by a federal income tax gives him a tax savings around $118, raising his net payout from his taxable bond fund to $2,318. However, Al may not be able to deduct that $320 of state income tax paid under the TCJA. That could be the case if he takes the standard deduction, rather than itemize deductions such as taxes paid. Even if Al itemizes deductions, the $10,000 cap on state and local tax deductions may keep him from getting any tax benefit from the tax paid on his bond interest, continued on page 59

Realistic Expectations Using QCDs may not be a straightforward exercise. IRA custodians differ in the way they handle the procedure. Taxpayers may have to call their IRA custodian and speak to a designated person who is familiar with QCDs. Charitable recipients can be named, along with their mailing addresses. Securities might have to be sold, if the QCD is to be made in cash, and a form might have to be signed by the IRA owner for each charity, permitting the QCD. Other financial firms might send out a distribution booklet to be returned, along with a signature guarantee for each QCD. Yet another possible method is to handle the QCD transaction online. The process can be timeconsuming and possibly confusing, so it’s best not to wait until the waning days of December to get started. Keep in mind that a distribution will only be a QCD if the entire distribution meets the requirements for a charitable contribution deduction, such as a charity’s eligibility under Section 501(c)(3) of the tax code and substantiation requirements. Deducting Qualified Business Income
T
he TCJA created a new deduction for small business owners who operate pass-through entities. That includes domestic companies operated as sole proprietorships or through S corporations, partnerships, certain LLCs, trusts, and estates. Income from such entities may allow business owners to deduct 20% of their qualified business income (QBI). On the surface, the deduction may seem straightforward.
Example 1: Laurie Wilson runs her website design company as a sole proprietorship. In 2019, her net income from this business is $100,000. Laurie can take a $20,000 (20% of $100,000) QBI deduction on her 2019 tax return. However, some business owners may find taking the QBI deduction more challenging.
Learning the Limits The QBI deduction may be subject to limitation if the taxpayer’s QBI is from a trade or business that pays W-2 wages to employees or has certain qualified property. In addition, the deduction may be limited if the trade or business is one of certain specified service trades or businesses. Both limitations apply only to taxpayers with taxable income over certain thresholds, which are adjusted annually for inflation. For 2019, the taxable income thresholds are $321,400 for married couples filing joint returns, $160,725 for married individuals filing separately, and $160,700 for single taxpayers as well as heads of household. Taxpayers who have taxable income above those thresholds may find their QBI deduction reduced or eliminated altogether. In those situations, it may pay to contribute to retirement plans, bringing taxable income below the relevant threshold. Example 2: Jerry Nolan is the 100% owner of continued on page 65

If either or both spouses can contribute a total of $30,000 to a pretax retirement plan, that will bring their taxable income below the $321,400 threshold, helping them to get a full QBI deduction. Business owners who already have a defined contribution plan in place, for instance, could explore setting up a defined benefit plan, as well. Your accountant can help you weigh the advantages and disadvantages of this strategy.
From More to Lesser Even for business owners under the taxable income thresholds, a 20% QBI deduction might not be available. That’s because the QBI deduction is the lesser of 20% of QBI or 20% of taxable income less net capital gain. Example 3: Steve Thomas has $200,000 of QBI from his consulting firm, which he operates as a sole proprietorship. After taking various deductions (selfemployment tax, retirement plan contributions, itemized deductions), Steve winds up with $140,000 of taxable income this year. He has no capital gains for the year. In this situation, Steve’s taxable income ($140,000) is less than his QBI ($200,000), so Steve’s QBI deduction would be only $28,000: 20% of $140,000. If Steve can raise his taxable income over $200,000, he could claim a $40,000 QBI deduction. Assume that a $60,000 Roth IRA conversion would
add $60,000 to Steve’s taxable income, to just over $200,000. Then Steve’s $200,000 QBI would be the lesser number, and he could take a full $40,000 QBI deduction: 20% of $200,000. It’s true that a Roth IRA conversion would add to Steve’s tax bill for the year, but the added QBI deduction would be an offset. Once all the numbers are crunched, this could be a relatively low-tax way to move money into a Roth IRA, from which all distributions can be untaxed, after five years and age 59½.
Earnings Don’t Count Business owners should be aware that QBI is meant to be net business income, after all claimed business deductions have been taken. Thus, the QBI rules exclude salaries to S corporation shareholders and guaranteed payments to LLC members. Those amounts are not QBI, so they don’t merit a 20% deduction. Some S corporation owners may be tempted to lowball salaries and, thus, increase QBI. However, the tax code requires reasonable compensation for owner-employees. A business owner’s efforts to take a reduced salary in order to increase QBI may lead to an IRS audit, recasting net business income as earnings, and perhaps generating steep penalties. The company was founded in 1977 by his father Richard Pacella, Sr., who is semi-retired, and his family has been UCANE members since its inception. Rich served four years on UCANE’s Board of Directors and is now in his second year as President. He is also a member of our Budget, Executive, Membership, and Government Relations Committees. He will be travelling to Washington D.C., again in April, to participate in Water Week, as part of the Clean Water Construction Coalition (CWCC). Rich graduated from Wentworth Institute of Technology with a degree in Construction Management, and he currently serves as Water and Sewer Commissioner for the Town of Foxborough, MA and also for the Mansfield-Foxborough-Norton Regional Wastewater District. Like so many other UCANE members before him, Rich intends to carry on his family’s tradition of involvement and support of our Association. He has earned the respect and admiration of his co-workers and peers within the utility construction industry, and his ongoing commitment to UCANE is evident through his hard work in effectively communicating the issues of vital importance to our industry. He has also been called upon to provide testimony before the Massachusetts Joint Committee on Public Service, on behalf of UCANE, regarding payment of Police Details. Some of Rich’s goals for the coming year include, securing increased state funding for the SRF Program to assure that the maximum number of projects are put out to bid; assisting the MassDEP and other state agencies whenever possible to help cities and towns fund needed underground infrastructure projects; and promoting UCANE’s in-house safety programs while advocating for employee safety on the jobsite. Rich is also committed to strengthening our Association in the coming year by increasing membership. His goal is to enlist 25 new members and he has requested our member’s support to help him achieve his goal. He believes strongly in UCANE and its goals and future, and has committed to continue the work of those who served before him who have strived to make Massachusetts’ clean water and drinking water infrastructure a model for the entire country.
