Failing Water Infrastructure a National Problem

As Construction Outlook magazine readers know, UCANE rightfully focuses on local water, sewer, and underground utility infrastructure issues. There are no shortages of water and sewer main breaks that highlight what happens when we neglect our aging pipes. In addition, if you look at the national news, you will find similar examples that demonstrate the dire need for additional investment in our underground infrastructure.

n Fort Lauderdale, FL, between December 10 and February 8, the city’s sewer pipes failed an incredible 11 times and spilled 211.6 million gallons of sewage into waterways and streets. That is a state record that cost the city a $1.8 million fine on top of the repair costs. The chain reaction of breaks serves as a cautionary tale of what can happen when you delay action in replacing old pipes. Comments from local officials show that they are aware of the problem and that these breaks will most certainly continue until the issue is addressed. “I can’t predict the frequency but, until we replace the aging infrastructure, we will have more breaks,” Commissioner Heather Moraitis said. The Mayor of Fort Lauderdale, Dean Trantalis said, “The break today could have been prevented if we had replaced the pipe instead of just patching it.” A local retired utilities director, Mel Entus summed up the problem by saying, “It’s happening because they have not maintained the system over the years. You have to maintain the pipes and Fort Lauderdale has not done that. If the pipes were new and you did a bypass, it wouldn’t break. But as pipes get older, they become more fragile. Pipes disintegrate from the inside, and if you do a bypass on an old pipe, of course you are going to increase the odds of that pipe breaking.” Houston, TX also recently dealt with a water main break that caused major disruption to the area. All lanes of an interstate highway were flooded, a boil water order was put in place, and several schools and businesses were forced to close. Harris County operated at a Level 3 emergency level, which is similar MARCH, 2020

to how they would prepare for a hurricane or disease outbreak. When Houston Mayor Sylvester Turner was asked about the problem, he gave a familiar answer. “This is an example of the need for infrastructure improvements, not just in this city but cities across the board. When you’re dealing with an aging infrastructure, you’re going to have these main-line breaks. And in some cases, they are major arteries and can cause major disruptions,” he said. While it is encouraging that there is a unanimous acknowledgment of the problem, there is little that will change unless the needed funding is dedicated to fixing it. The same holds true at home, where wastewater treatment plants along the Merrimack River continue to discharge millions of gallons of untreated sewage into the river during major rainfalls. Everyone is aware of the problem, and the short term solution is to notify residents after a discharge that the water quality in the river is unsafe. While notification is important, these treatment plants need the money to do the necessary upgrades so that these discharges no longer happen. The numbers are staggering. The funding gap in Massachusetts alone continues to be $18–$21 billion over the next 20 years, while that number is at about $700 billion nationally. Neither of these figures take into account stormwater and climate resiliency. The funding solution is not an easy one, and the burden needs to be shared at the local, state, and federal levels. But the longer we wait, the more the price tag will increase, and stories like those in Fort Lauderdale, Houston, and along the Merrimack River will become more common. n

Massachusetts House of Representatives Releases Transportation Finance Plan

he Massachusetts House of Representatives unveiled its plan for funding the Commonwealth’s transportation financing needs for roads, bridges, rail, transit and other modes of traversing the state. While the House had spoken about its interest in potentially looking at a large fuel tax increase, the plan released by the House was generally regarded as a balanced measure that pulled from a variety of sources. In particular, the funding plan will increase gasoline taxes from 26.54 cents a gallon to 31.54 cents a gallon. The state tax on diesel fuel will increase from 26.54 cents a gallon to 35.54 cents a gallon. The gasoline and diesel fuel hikes are estimated to bring in an additional $150 million to $175 million (gas) and $32 million (diesel). In addition, the legislation creates a new, 9-tiered system for the corporate minimum tax. According to House leaders, an estimated 60% to 70% of corporations in the state pay the minimum corporate tax rate of $456 dollars a year, a rate that has not been raised since 1989. Under the proposal, small businesses in Massachusetts with less than $1 million in sales would continue to pay the minimum. The corporate tax would be capped at $150,000 for companies with annual Massachusetts sales of $1 billion or more. As drafted, the House proposal would hike fees on most transportation network companies (TNC) such as Uber and Lyft. Fees on shared rides would stay at the current 20 cents per ride. The fee on non-shared rides would go up $1, to $1.20 a ride. And the fee on non-shared luxury rides would go up $1 in addition to the previous increase. Interestingly, the legislation states that certain of those fees cannot be directly charged to users of the TNC service. The proposed plan will also remove the exemption rental car companies currently have on sales taxes for their fleet. Currently, the companies do not have to pay sales tax on a vehicle purchased and registered in Massachusetts. If passed, those vehicles purchased in Massachusetts would be subject to the state’s 6.25% sales tax. With respect to the interaction between the Governor’s proposed commitment to the Transportation and Climate Initiative (TCI), which will increase the cost of fuel, and the House proposed increase to the fuel tax, the House’s proposed plan would require the Massachusetts Department of Revenue to change its calculations on the gasoline tax to reflect the increased price caused by the TCI. While the pro-

vision would not apply to diesel fuel, the inclusion of the language reflected House leaders’ concern for lower-to-middle wage workers who must commute to work by motor vehicle. The Massachusetts House of Representatives will likely pass their transportation finance plan within the first week of March. The Massachusetts Senate, which has been studying a myriad of transportation funding and policy measures for their own plan, will likely unveil the same in the weeks following the House’s passage of its proposal. Given the Governor’s statements in opposition to increased taxes, both branches, House and Senate, will be focused on crafting veto-proof majorities. A

Governor Files Legislation to Support Minority and Women-Owned Businesses

ccording to a press release issued by their offices at the end of February, the Baker-Polito Administration filed legislation, House Bill 4511, An Act to Expand Opportunities for Minority and Women Business Enterprises in Public Construction Projects, and announced a series of administrative changes to promote greater participation of minorityand women-owned businesses in public construction, including small businesses. According to the Administration, these changes will help optimize and improve the Affirmative Marketing Program (AMP), which sets goals for participation by minority-owned businesses (MBEs) and women-owned businesses (WBEs) in design and construction for the state and municipalities with vertical construction. The goal of the newly filed legislation is to afford new opportunities to MBEs and WBEs in two ways. First, the legislation proposes an increase in the dollar thresholds over which public entities are required to subcontract and bid out specific components of a project. Currently, bids for most subcontracted work over $25,000 are subject to a filed sub-bid requirement, a process that requires interested subcontractors to comply with certification, bonding, and other requirements, and to submit bids to the awarding authority. This proposal would increase the thresholds governing when filed sub-bids would be required, to instead only require them when the subcontracted work costs more than $50,000 and the overall project cost exceeds $1 million. The second way in which the legislation proposes to expand opportunities for MBEs and WBEs on Massachusetts Division of Capital Asset Management and Maintenance (DCAMM) and other public projects is to change certain sub-bid requirements. As reported by the Administration, over 50 percent of public building work is subcontracted out by means of filed sub-bids. As noted by the Administration, subbids are not subject to MBE and WBE participation goals. The legislation will allow DCAMM to set MBE and WBE participation goals for this subcontracted work on projects over $5 million. The administrative changes involve DCAMM splitting the AMP goals for the percentage of spending distributed to MBEs and WBEs so that there are distinct participation requirements for both groups and ensures participation by both MBE and WBE firms. Additionally, the combined annual participation MARCH, 2020

goals will be increased from 10.4 percent to 13 percent in the construction phase, and from 17.9 percent to 21.6 percent in the design phase. These changes will also allow for the establishment of project-specific AMP goals. This enables participation goals for an individual project to be specifically tailored to it prior to procurement, and ensures that goals accurately reflect the availability of contractors and other factors. UCANE, which has advocated for reasonable MBE and WBE programs supported by the development of an eligible workforce, recently submitted written testimony relative to the creation of a MBE/ WBE commission to better address this key workforce area. In its support for House Bill 2678, An Act Creating a Special Commission to Study the Participation of Minority Business Enterprises and Women Business Enterprises in Public Construction, UCANE wrote: At present rates, the Commonwealth’s vocational schools are projected to meet only about 23% of the expected demand in construction. The projected workforce shortage is an excellent impetus for forming the special commission proposed in HB2678. It is also important to recognize that in creating hiring goals and objectives for the employment of minorities and women, we must look at the available marketplace for employees. If we do not reasonably understand the potential for our future workforce composition or the tools necessary to foster a vibrant workforce, any goals or objectives we set will be arbitrary and, unfortunately, unlikely to be met. To address this concern, HB2678 would establish a special commission to investigate, study, and make legislative recommendations on the adequacy and efficiency of laws regarding the participation of minority business enterprises and women business enterprises in public construction projects. This is a key first step to better understand the industry’s challenges in diversifying the workforce. The Baker-Polito legislation has been referred to the Joint Committee on State Administration. Baker-Polito Administration Awards Grants to Help Local Watershed Groups Monitor Water Quality

A

s reported by the Baker-Polito Administration, the Massachusetts Department of Environmental Protection (MassDEP) awarded $154,145 in funding to 14 watershed monitoring groups across the Commonwealth to help them test rivers, lakes and ponds, and coastal resources for bacteria. The Water Quality Monitoring Grant Program is being offered by the MassDEP for a second year to support watershed groups with baseline monitoring program activities and to help those groups build sampling capabilities. This grant program is part of a $450,000 increase in state funding that will be dedicated to increasing capacity in water quality monitoring and assessment. Each grant will fund up to $15,000 in monitoring project support, and the resulting enhanced water quality data will help MassDEP implement program requirements for the Federal Clean Water Act. This funding will help eligible nonprofits organizations, including watershed groups, academic institutions, and others with surface water quality monitoring capacity. A sampling of the grant recipients and awards includes: Berkshire Environmental Action Team (BEAT) ($10,503). BEAT will use the grant to develop a volunteer-based water quality monitoring program in Berkshire County. Funds will be used to purchase bacteria sampling and analysis supplies to conduct biweekly monitoring at 22 sites in the Housatonic and Hoosic watersheds. Blackstone River Coalition (BRC) ($15,000). BRC will use the grant to update and integrate historic data into a water quality database and to purchase bacteria sampling and analysis supplies to conduct biweekly monitoring at 10 sites in the Blackstone River watershed. Center for Coastal Studies (CCS) ($14,788). CCS will use the grant to purchase bacteria sampling and analysis supplies and equipment to conduct biweekly bacteria monitoring at eight sites in the Cape Cod watershed. Cohasset Center for Student Coastal Research (CCSCR) ($14,983). CCSCR will use this grant to purchase bacteria sampling and analysis supplies and equipment to expand the Center’s capacity to conduct weekly monitoring at 35 sites in the Boston Harbor and South Coastal watersheds. Connecticut River Conservancy (CRC) ($15,000). CRC will use this grant to purchase bacteria sampling and analysis supplies and equipment to support the work of Deerfield River Watershed Association, Chicopee4Rivers Watershed Council, and the Fort River Watershed Association in conducting weekly and biweekly monitoring at 49 sites in the Chicopee, Connecticut, and Deerfield watersheds. Mystic River Watershed Association (MyRWA) ($9,203). MyRWA will use this grant to support an established bacteria monitoring program that includes monthly monitoring at 15 sites in the Mystic River watershed. According to the MassDEP release on this mat-

ter, watersheds across the Commonwealth must be assessed every two years. However, many water bodies are not assessed for one or more uses – such as primary or secondary recreation or aquatic life – in any given assessment cycle, and many small or unnamed streams and ponds have never been monitored or assessed. Also, many water bodies that have been assessed in the past need updated information to determine their current condition. It is anticipated that this grant program will increase the availability of bacteria data that is used to determine the condition of surface waters within the state. Supplemental Budget Includes More Funding for Testing; Legislators Write to Attorney General Healey Seeking Action Against Manufacturers

T

he Massachusetts Legislature recently passed another supplemental budget that contained additional funding of $4.2 million for the testing of water supplies for per- and polyfluoroalkyl substances (PFAS) at the end of February. The additional funding, which fulfills the Governor’s initial funding request for $8.4 million for testing resources, comes on the heels of a heightened awareness about the presence of PFAS. Efforts continue towards identifying the scope and extent of PFAS in the Commonwealth’s water supplies. It is anticipated that municipal and regional water systems will need significant financial assistance from the state to address this issue. To that end, Senator Jo Comerford and Senator Mike Moore recently sent a letter to Attorney General Maura Healey asking her to use her office to hold manufacturers who use PFAS responsible for its leaching into water supplies. In a press release issued from Senator’s Moore’s office, it was noted that “[m]any companies have been known to use PFAS chemicals, however the three most widely known to use them in their manufacturing are 3M, DuPont, and Chemour. According to

the Environmental Working Group, these companies were aware of the serious health risks associated with exposure to PFAS. Because of the widespread use of PFAS across an abundance of industries, many people have been exposed and unknowingly consumed these chemicals.” Senators Comerford and Moore also requested that the Attorney General take action because “the cost of addressing this issue will increase, putting an unnecessary financial burden on the Commonwealth and its municipalities … [i]t is therefore more prudent to have the companies who profited off this contamination pay for the damages that they have created.” The MassDEP and Massachusetts Clean Water Trust, which have passed more stringent regulations and expanded the SRF loan program, respectively, have been very active on this issue. Baker-Polito Administration Awards Grants to Help Municipalities Meet Stormwater Permitting Requirements

T

he Baker-Polito Administration recently announced that it has awarded $300,000 in grants to five stormwater coalitions across the Commonwealth to help local cities and towns meet existing and upcoming stormwater management requirements. The grants, funded by the MassDEP, were awarded to the Statewide Stormwater Coalition, Central Massachusetts Regional Stormwater Coalition, Southeast Regional Stormwater Coalition, the Massachusetts Maritime Academy for Buzzards Bay Stormwater Collaborative, and the Northern Middlesex Stormwater Collaborative. The funding will enable groups of Massachusetts municipalities to expand their efforts to meet requirements under the Municipal Separate Storm Sewer System (MS4) permit, issued jointly by the United States Environmental Protection Agency (EPA) and MassDEP, and reduce stormwater pollution through coordinated partnerships that emphasize resource sharing. More than 240 Massachusetts municipalities are subject to the 2016 MS4 permit, which took effect on July 1, 2018. Permit requirements that the municipalities subject to the MS4 permit must meet include, the development and implementation of a Public Education program, adopting more stringent local development rules, and locating and removing pollutants that are illegally entering municipal stormwater systems. The groups receiving awards are: Statewide Stormwater Coalition ($107,795). This project will further expand the “Think Blue Massachusetts” statewide stormwater public awareness and education campaign that helps each MS4 community meet MS4 education and

outreach requirements. The proposed project includes expanded advertising to build awareness and brand recognition, new messaging for certain impaired waters, an interactive social media contest, planning for a Think Blue Massachusetts symposium, and training. Central Massachusetts Regional Stormwater Coalition (CMRSWC)($28,000). This project offers workshops to meet the Illicit Discharge Detection and Elimination training requirement for CMRSWC members and additional MS4 communities. Southeast Regional Stormwater Coalition (SRWC) ($55,000). This project will offer workshops to up to 20 towns in which both SRSC communities and others would develop their required Operation and Maintenance Plans for Parks and Open Space, Buildings and Facilities, Vehicles and Equipment, and Stormwater Pollution Prevention Plans. Northern Middlesex Stormwater Collaborative ($62,504). This project will develop a bylaw/ordinance and regulations and permit-tracking materials to address construction site runoff control and post construction stormwater management at development and redevelopment sites, as required by the 2016 MS4 Permit by June 30, 2020. $162 Million Offered for Drinking Water SRF in 2020

he Massachusetts Department of Environmental Protection (MassDEP) is pleased to present the draft Calendar Year 2020 Intended Use Plan (IUP), which lists the proposed projects, borrowers and amounts that will be financed through the Drinking Water State Revolving Fund (DWSRF) loan program. The DWSRF is a joint federal-state financing program that provides subsidized loans to protect public health by improving water supply infrastructure systems and protect drinking water in the Commonwealth.

Massachusetts proposes to offer $162 million to finance drinking water projects across the Commonwealth. As noted in Table 1, approximately $135 million will fund 18 new construction projects, an additional $23 million will be allocated towards funding four previously approved multi-year projects, and $1.7 million is allocated towards the five Planning Projects submitted. An additional $3 million will fund an emergency set-aside account.

Representative Joan Meschino (D-Hull)

Representative Joan Meschino represents Massachusetts’ Third Plymouth District, which includes the communities of Cohasset, Hingham, Hull, and North Scituate. She is currently serving her second term and is a member of the Joint Committee on Telecommunications, Utilities & Energy; the Joint Committee for Veteran’s and Federal Affairs; the House Committee on Post Audit & Oversight; and the House Committee on Technology and Intergovernmental Affairs. She was also appointed as a House member of the Metropolitan Beaches Commission and the Ocean Advisory Commission. Representative Meschino is an experienced, qualified leader with a proven record of accomplishment that ranges from her leadership on the South Shore to advocacy for progressive causes across Massachusetts. Many residents know her from her years of public service across the South Shore. She was elected to two terms as a Selectman in Hull and served on numerous town boards and committees, as well as regional boards and statewide commissions. Most recently, she served on the Hull Capital Outlay Committee. She also served as Hull’s representative to the Metropolitan Beaches Commission for 10 years, as Hull’s representative to the Metropolitan Area Planning Council, and was elected by her peers to its Executive Committee for 10 years. Representative Meschino is a seasoned nonprofit executive and social justice advocate. Most recently, she served as Executive Director of the Massachusetts Appleseed Center for Law and Justice, Inc., a public interest law center that promotes equal rights and opportunities for Massachusetts residents. Under her leadership and management, Massachusetts Appleseed's influence and impact in access to justice policy increased dramatically. She began her legal career in criminal defense and civil rights law. The majority of her time in private practice was spent as a transactional attorney in health care settings, until she transitioned to nonprofit leadership and public service. A lifelong resident of the district, Representative Meschino and her husband live in Hull. She is a graduate of Harvard University with a B.A. in English, and earned her J.D. from the University of New Hampshire Franklin Pierce School of Law.

Q:

As you are aware, access to clean drinking water and proper management of wastewater is critical. Please give us your thoughts relative to the importance of maintaining our water and wastewater infrastructure.

A:

We all know that a well-maintained, reliable, and affordable water infrastructure system is vital to public health, public safety, economic vitality, and environmental resource management. Among the many services which cities and towns provide for their citizens, delivering safe and clean water and managing wastewater treatment are some of the most basic to our quality of life. As climate change continues to intensify, the threat to our water and wastewater systems will grow. Our communities must act MARCH, 2020

now to mitigate future impacts from coastal inundation, deluge stormwater runoff, sewage spills, and extreme temperatures. Communities must identify vulnerable infrastructure and plan for resiliency, and many will need significant state help to do so. I hope our Commonwealth will continue to confront these threats together, and help the most vulnerable among us to face the future with confidence. Proactive rehabilitation and replacement programs are the keys to effective management of our water and wastewater systems. They minimize service disruptions and expensive emergency repairs, and maximize water system quality and watershed stewardship. The costs are ultimately borne by the ratepayers, but regular scheduled infrastructure investments will protect the ratepayer continued on page 33

Of particular interest in my district is the Town of Hingham’s plan to acquire its privately-owned water distribution and water treatment system. This process has received approval from Hingham’s Town Meeting and is on the path to completion. I remain alert for opportunities at the state level to help with the transition in any way I can.

Q: A:

What are the greatest challenges to your district and region with regard to continued economic growth?

Traffic and transportation are among the greatest challenges to economic growth facing the South Shore region. The communities in my district are at the end of the public transit system, and are overly reliant on cars. Public transit is almost exclusively used to commute into Boston. The modes of public transit available to the South Shore are expensive and constrained by system limits. The recent dialogues and initiatives at the state level around transportation and public transit infrastructure investments are exciting. As the Commonwealth begins to tackle some of the thorny transportation system needs, it will unlock the economic potential for the South Shore.

Q:

As costs continue to rise, please give us your thoughts on how the state will continue to support local aid to cities and towns to help support basic municipal services, specifically water infrastructure.

A:

The Commonwealth must continue to be a good partner in the maintenance of our water infrastructure systems and responsible watershed management. After all, neither water nor wastewater issues observe town boundaries. Ongoing support for programs like The Clean Water Trust and other state and federal infrastructure grant funding will be critical to support investments in local and regional water systems infrastructure. Additionally, programs like the Municipal Vulnerability Program will assist cities and towns to begin to identify vulnerabilities and plan for resilience, which will make them eligible for future grant funding. The Legislature has met its commitment over the past two sessions to consistently fund its local aid obligations, and I hope that will continue. Municipalities face a tremendous number of competing demands. Through consistent local aid, the Commonwealth can create stability and ease financial uncertainty for local governments. need to meet other obligations, such as water infrastructure systems. A recent example during this session is The Student Opportunity Act, which makes a transformational financial investment in equitable education funding. Additionally the Department of Environmental Protection (MassDEP), Department of Public Health (DPH) and Department of Conservation and Recreation (DCR) all have critical roles in regulating clean drinking water, wastewater, and stormwater systems, as well as conservation of natural resources and protecting the state’s watersheds. The Legislature supports the critical functions of these departments through increased operational funding for state environmental agencies, also known as the “green budget.” But as always, there is more to do.

Q: A:

What are some of your other priorities for the balance of the upcoming session?

One of my top priorities this session is to strengthen the Commonwealth’s commitment to a clean energy future and to cut carbon pollution to net zero by 2050. I filed legislation known as The 2050 Roadmap (H.3983) that provides critical updates to the state’s landmark Global Warming Solutions Act of 2008 (GWSA). The 2050 Roadmap resets the Commonwealth’s carbon emission reduction goal to net zero by 2050; calls for a comprehensive people-centered plan to reach that goal; and creates new accountability for the implementation of fair and effective carbon emission reduction measures.

Now it is time to take the next steps. By aligning with current science, using comprehensive analysis, and supporting our communities in these efforts, Massachusetts can thrive as we transform our energy economy to mitigate the worst impacts of climate change. Massachusetts has been on the forefront of climate and clean energy for over a decade, yet it is urgent that we continue to make progress. U.S. DOL Implements New Overtime Salary Exemption Rule On January 1, 2020, the United States Department of Labor (“USDOL”) raised the weekly earnings threshold for employees it defines as “executive, administrative, and professional” to qualify as overtime exempt, (“White Collar Exemption”). This is the first threshold increase in 15 years. This rule is a downward revision from the proposed 2016 Obama era salary test, which had been subjected to a nation-wide injunction before its effective date. Under the new Trump rule, the USDOL: 1. Raises the salary threshold from $455 per week to $684 per week or $35,668 annually for a fulltime worker (not the $913 per week or $47,746 proposed by the Obama administration); 2. Increases the total annual compensation for a so-called “highly compensated” employee from $100,000 per year to $107,432 per year; and 3. Permits employers to use non-discretionary bonuses and incentive payments, including commissions, paid at least annually, to satisfy up to 10% of the standard salary level. Unless otherwise exempt, under both federal law (Fair Labor Standards Act or “FLSA”) and Massachusetts law, an employer must pay a non-exempt employee one and one-half times his/her regular rate of pay for all hours worked in excess of 40 hours per workweek (“overtime”). Under neither federal nor Massachusetts law is an employer required to pay overtime for hours worked in excess of eight hours in a day. Collective bargaining agreements may have stricter rules. There are numerous state and federal overtime exemptions and industry exceptions. One exemption applies to persons who meet the salary test and one of the White Collar job duties test(s). Simply because an employee receives a salary does not mean s/he is

overtime exempt. S/he must meet both the salary test and a definition test. In Massachusetts, the intent of the employer in misclassifying an employee may be irrelevant. Under Massachusetts’ law, a wage violation is a strict liability offense subjecting an employer to treble damages, attorney’s fees, and interest; even if the case is brought in federal court. To qualify as an exempt executive, in addition to the new salary requirement, all of the following job duties tests must be met: • The employee’s primary duty must be managing the enterprise, or managing a customarily recognized department or subdivision of the enterprise; continued on page 39

If s/he is not exempt, s/he must be paid overtime for hours worked in excess of 40-hours-per-week. 2020 Scholarship Applications Now Available UCANE to Award Twelve $2,000 Scholarships WHO IS ELIGIBLE TO APPLY? •

Any child or grandchild of a UCANE member OR an employee of a member in good standing.

The applicant should be a high school senior who will be enrolling full time in an accredited two- or four-year academic institution for the year beginning in September 2020 OR a current full-time college student who has not previously received a UCANE scholarship.

HOW WILL THE APPLICATION BE JUDGED? Twelve $2,000 scholarships will be awarded. Two of the 12 scholarships will be awarded to applicants pursuing a construction related degree. There will be a question on the application to indicate if you believe you are eligible for these scholarships. The other 10 scholarships are open to all other courses of study. Applications are judged and winners are selected by independent outside educators. Selection will be based on the overall worthiness of the applicant by considering: 1. Scholastic achievement; 2. Interest and effort in preparing for your vocation; 3. Extra-curricular activities at and away from school, including community and religious service; 4. Difficulty of course curriculum and career objectives; 5. Personal recommendations; 6. Thoroughness of the completed application, particularly the essay

Jobsite Planning and Employee Behavior

ollowing any jobsite incident, whether it involves an employee injury or property damage, my primary focus is always on task specific planning and employee behavior as the two main components of any incident. I understand the struggle and balance between safety and the need for production, but with proper planning and safe behavior, companies can achieve high levels of production along with safety conscious employee behavior. Safety and production should not be opposing goals that need to be balanced, rather, they both must function concurrently as operational and organizational behaviors. In nearly every company, there is a struggle to balance these seemingly opposing priorities, and often the focus is on work day production with a lesser regard given to the employees’ behavior in order to get the job done. Doing things the right way, each and every time, shouldn’t be that difficult. However, when working on complex jobsites, in varying work environments, it is difficult at times to adhere to prescribed work procedures to complete each assigned task. Understandably, it is nearly impossible to anticipate every situation workers will be faced with and to account for all of the variables that may impact the work they perform. Therefore, instead of trying to develop a prescribed list of standard operating procedures (SOPs), I prefer to employ safety guidelines or principles in which employees approach each task with better planning and behavior no matter the situations they may encounter. With the ever-present production schedule and excessive paperwork complaints of Foremen and Supervisors, I felt it would be best to “keep it simMARCH, 2020

ple, stupid.” Even when an employee has time to sit and listen or read a Job Hazard Analysis (JHA), his or her mind can accept only so much information in one steady flow. How long do you think an employee stands there and pays attention to what someone is saying without letting their mind wander off to other things in their life? This is why, before our employees engage in a work task, we ask them to take “60 Seconds of Safety” to think about what it is that they are assigned to do, and ask themselves the following questions: • What job am I performing? • What hazards exist? • What tool am I using to perform the work? • How do I protect myself and others? Stopping to take just “60 Seconds of Safety” to ask themselves these four simple questions may just be the difference between an accident occurring or performing the work safely. n

Yarmouth Seeks to Kick-Start Regional Sewer Effort YARMOUTH — With annual town meeting fast approaching, Yarmouth selectmen are looking at ways to pay for the $127 million first phase of a regional wastewater treatment plan without raising taxes.

A

ssistant Town Administrator Rich Bienvenue, along with the town’s Water Resource Advisory Committee, presented the Board with a plan to do that by tapping the town’s ongoing revenue sources along with user-generated amounts. Residents at town meeting will be asked to weigh in on a half-dozen articles related to wastewater treatment plans this spring. Yarmouth will save significantly by developing a regionalized system with Dennis and Harwich, Bienvenue told selectmen. Positives are a reduction in the amount of effluent Yarmouth will have to manage, the retention of a property on Buck Island Road that would be needed for leaching with a town-run system, a single wastewater treatment plant in Dennis for the three towns to staff and maintain and the renovation of the Bass River Golf Course when one of the regional leaching fields is installed there. A regional solution will also put the tri-town alliance in a strong position to qualify for no-interest loans on the project. Selection for the 0% interest rate under the state’s revolving loan program is very competitive, but applicants with regionalized systems will have an edge, Bienvenue said. Paying no interest would save the town $20 million versus a 1% interest rate over the first 15 years of the loan and $40 million versus a 2% rate. Yarmouth, Dennis and Harwich voters will all be asked to approve a three-town agreement for the re-

gionalized treatment plan at their spring town meetings. The so-called DHY Clean Waters Community Partnership will be managed by a seven-member commission that will include three representatives from Yarmouth, two from Dennis and two from Harwich. The three participating towns will cover the cost of laying and maintaining their individual sewer lines, but will share the cost of the single treatment plant to be built in Dennis and other shared components. Work on the treatment system and sewer lines will be going on simultaneously. Under its plan, Yarmouth expects to install sewer lines in 50% to 60% of the town over the next 40 years. Jobsites’ Most Universal Hazard: Personal Cell Phones

The use of mobile phones for wireless streaming of music, podcasts or other entertainment is everywhere. Walk down any street in the country and you’ll often see more people wearing headphones than those that aren’t. Some of these listening devices even come equipped with sound-canceling features that completely block out noises from the outside world.

T

he growing use of headphones, especially among young Americans, has left some construction companies scrambling to formulate policies for their use on the jobsite. At orientations and safety meetings on Miller & Long Concrete Construction jobsites in the Washington, D.C. area, managers let employees know that earpods and headphones are not acceptable, said Frank Trujillo, vice president of the Bethesda, Maryland-based contracting company. It's a never-ending battle, he said, because the use of listening devices is so prevalent that sometimes workers don’t even realize they have them in their ears when they enter the site. “People are just used to it, so that headphones and earpods are like a part of their body, so it's nothing for someone to come in off the Metro or from the parking area wearing them and walk onto the job, clock in, put on their protective gear and continue on to work with them in their ears."

A Manager's Discretion While there is no specific federal regulation that prohibits the use of headphones on a construction site, OSHA issued a letter of interpretation in September providing clarification on the matter. It said that

headphone entertainment on a construction site is permissible at managerial discretion “unless such use creates or augments other hazards apart from noise." These hazards occur when the music masks environmental sounds that need to be heard, "especially on active construction sites where attention to moving equipment, heavy machinery, vehicle traffic, and safety warning signals may be compromised,” the agency said. Despite the lack of formal OSHA regulation, no ​ cell phone use of any kind should be allowed on active construction sites, Associated Builders and Contractors Vice President of Workforce Development Safety Health and Environmental Greg Sizemore told Construction Dive. Listening to music via personal headphones puts the employee and other workers in danger. “That employee over there jamming to Mötley Crüe​can’t hear his coworker shouting to him for help,” Sizemore said. “It’s just not wise to allow something like this into an environment where it can create the condition for you or someone else to be injured.” He urges his members to train their employees on the appropriate use of technology in and around the jobsite. Workers might argue that they use music to help drown out extra loud construction noises, but an OSHA spokesperson said that is a bad idea. The continued on page 63

Additionally, the agency noted, some manufacturers may claim that their products are “OSHA approved” or “100% OSHA compliant.” OSHA does not register, certify, approve, or otherwise endorse commercial or private sector entities, products, or services. Therefore, any such claims by a manufacturer are misleading, the spokesperson said.​

He often has situations where employees tell him they are waiting for a call from a sick relative or daycare provider and “there’s an expectation that you should be able to address those concerns in real-time,” he said. the event they recognize something unsafe,” he said. For this reason, Miller & Long managers preface any talk about video recording on the jobsite with information about the company’s reporting system. Miller & Long safety leaders are still developing a formal policy but for now, managers tell employees that if they absolutely need to check their phones or take a call they must exit the jobsite, clock out and "come back when they're ready to work," Trujillo said. “If you’re in construction you need to pay attention to what you’re doing," he said. arcella is President of Albanese Brothers, Inc. of Dracut, MA. Her father Marco, and his brother Giovanni founded the company in 1978. Currently, Marcella and her siblings, Maria and Oto, represent the second generation of Albanese Contractors who are highly regarded for their ability to take on difficult projects. Like so many UCANE members before her, since her father retired in 2010, Marcella and her siblings have continued to grow the family business, working on projects throughout New England. Albanese Brothers, Inc. is WBE/DBE accredited. Marcella has been involved in UCANE since she began working at Albanese Brothers many years ago. She has since served two terms on our Board of Directors, and throughout the years has taken on additional responsibilities, having served as UCANE Secretary, Treasurer, and President Elect for two years, and she is now serving as the first woman President of our Association. Marcella was voted UCANE President because she has earned the respect and confidence of her peers, and has been a tireless advocate for UCANE and our industry for many years. Her rise to prominence in our industry, and in UCANE, is nothing short of inspirational for any woman who wants to be in construction, or who is in a business that supports the construction industry. She has so many qualities that give her the credentials to work in an industry that is male dominated. She is intelligent and knows the construction industry from both the administrative side, to working in the field as a Project Engineer. She is confident and strong willed, and when she believes she is right, she will defend her position. Recognizing her contributions to our industry, in 2015 our members presented her with our Association’s most prestigious award, that of UCANE Contractor Member of the Year. Marcella is committed to strengthening our Association in the coming year by increasing membership. Her goal is to enlist 25 new members and she has requested our member’s support to help her achieve her goal. She believes strongly in UCANE and its goals and future, and has committed to continue the work of those who served before her who have strived to make Massachusetts’ clean water and drinking water infrastructure a model for the entire country.

Ryan McCourt - McCourt Construction Company

R

yan is the fifth generation President of McCourt Construction Company of South Boston, MA. He attended Boston College where he graduated with a Bachelor of Science Degree in Finance. Soon after graduating, he joined his family’s business. McCourt Construction has been a leader in the construction industry since 1893. Ryan, along with his brothers Matthew and Trevor continue to tackle some of the largest and most complex construction projects in New England. Ryan is following in his father Richard’s footsteps at UCANE, and moving up the ranks as an officer. He previously served on UCANE’s Board of Directors from 20122013, later taking on the offices of Secretary, Treasurer, and currently as President Elect. Ryan understands the importance of industry organizations in ensuring that the infrastructure of the Commonwealth gets the attention it so desperately needs, and he knows that UCANE is the most effective organization in getting attention for the drinking water and wastewater industry. Ryan looks forward to working with our elected officials to improve clean water and drinking water systems which will positively impact our citizens and the environment.

B

rian is Vice President and Project Manager of C. C. Construction, Inc. of South Dennis, MA. His father, Christopher Cooney founded the company in 1983 and they have been UCANE members since 2009. C. C. Construction performs site work and utility work on the entire South Shore, including Cape Cod and the Islands. Brian graduated from Northeastern University in 2009, with a Bachelor’s Degree in Finance and Entrepreneurship. He also took construction management classes at Wentworth Institute of Technology at night. Soon after receiving his degree, Brian joined his family’s business. Brian previously served as UCANE Secretary for two years, and currently serves as Treasurer. He will face the challenges our industry has with project funding and permitting head on, in an effort to get more projects out to bid and on the street.

Chris Valenti - GVC Construction, Inc.

C

hris is Vice President of GVC Construction, Inc. of Leominster, MA where he works with his wife Geselle who is President of the company. His brother Michael Valenti, Jr. is also a Vice President of the company and works side by side with Chris and Geselle. GVC was founded by Geselle and Chris in March of 2000, and along with Mike they perform utility and heavy civil construction projects in Massachusetts, Southern New Hampshire, and Southern Maine. Chris studied Construction Management at Wentworth Institute of Technology and the company is now SDO Certified M/WBE/ DBE and SBA Certified EDWOSB. Chris joined UCANE in 2004, and throughout the years has been an active member, having served on many of our Committees. He has earned the respect and admiration of his peers within the utility construction industry, and his ongoing commitment to UCANE is evident by his efforts in effectively communicating the issues of vital importance to our industry.
